CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty a.m. on veintiuno de febrero de dos mil veinte.

Amparo proceeding (recurso de amparo) filed by JOSÉ MIGUEL CORDERO MATA, identity card 0302040944, against LA MUNICIPALIDAD DE CARTAGO, EL MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES (M.O.P.T.), EL CONSEJO NACIONAL DE VIALIDAD (CONAVI), and LA COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS (C.N.E.).

BACKGROUND:

  1. 1In a written submission received by the Chamber on 13 de enero de 2020, the petitioner filed an amparo proceeding and stated that when Tropical Storm Nate passed through in 2017, the levee (dique) located in Santa Cecilia de Guadalupe de Cartago sustained severe structural damage that caused landslides and weakened the foundations of the Santa Marta bridge along a stretch approximately 150 metros long. He adds that concrete pipes are installed at the foundations of that bridge to discharge stormwater and wastewater, and that they were also damaged by the force of the water, to the point that most of that structure is currently in the channel of the Río Reventado. He further states that, in his capacity as president of the Comité de Santa Cecilia, he made representations to the Municipalidad de Cartago, the Ministerio de Obras Públicas y Transportes, and the Comisión Nacional de Emergencias Investigación y Análisis de Riesgo, but the problem has still not been resolved.He comments that Mario Redondo Poveda, through official letter No. DMRP-220-17, informed the mayor of the respondent municipality of the problems faced by residents living near the Santa Cecilia levee and requested a detailed report on the procedures followed during the site cleanup work; however, no response was ever received. He alleges that, because the aforementioned damage has not been repaired, the residents whose properties border the levee are at risk. He states that, according to technical report No. IAR-INF-0645-2018 of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, erosion at the site has increased as a result of the cleanup work performed. That commission also recommended carrying out protection work and stabilizing the slope (talud) on the left bank, beneath the Santa Cecilia bridge, to reduce the impact of lateral river erosion. He complains that the mayor of the respondent municipality has not performed the work necessary to safeguard the lives of those who reside near the levee.In view of the foregoing, he considers that fundamental rights have been violated. He requests that the petition be granted and that those responsible be ordered to perform the necessary repair work on the aforementioned levee in the Santa Cecilia sector of the district of Guadalupe de Cartago.
  2. 2By order issued at 10:53 hrs. on 14 de enero de 2020, the proceeding was admitted and reports were requested from the respondent authorities.
  3. 3In a brief submitted to the Chamber on 17 de enero de 2020, Gerardo Alexis González Castro, in his capacity as Acting Head of the Departamento de Previsión Vial del Ministerio de Obras Públicas y Transportes, filed a report. He states that the department’s duties include issuing building setback lines (alineamientos de construcción) in relation to the levee pursuant to Decreto No. 22834-MOPT-MVAH. The building permit falls within municipal jurisdiction, and the setback line is merely one input needed to obtain that permit. He explains that another function of the department is to approve applications for stormwater or sanitary discharge in the levee area, subject to the prior approval of the Comisión Nacional de Emergencias. He states that, after reviewing the department’s records, it was determined that expediente No. 18-0183 concerns the matter at issue, in which the Municipalidad de Cartago reported the aforementioned situation through official letter No. AS-INSP-050-2018.He mentions that the department acted diligently by forwarding that expediente to the Comisión Nacional de Emergencias for assessment through official letter No. DVOP-DI- DV-PV-2018-2413, which was served by email on 14 de noviembre de 2018. He adds that, on 11 de febrero de 2019, Mr. Collado Ugalde of the Municipalidad de Cartago was served with official letter No. DVOP-DI-DV-PV-2018- 2412, requesting that a series of requirements be submitted. He states that, following those notices, the department received no further responses regarding the matter. He asserts that the department does not manage or maintain the levee and has no involvement in contracts related to it. Its only duties are to approve discharges with the authorization of the Comisión Nacional de Emergencias and to issue building setback lines for properties bordering the levee. He states that any other type of repair, maintenance, or similar work falls outside the scope of its jurisdiction.
  4. 4In a written submission filed with the Chamber on 17 de enero de 2020, Rodolfo Méndez Mata, in his capacity as Ministro de Obras Públicas y Transportes, filed a report. He states that the alleged facts relate to work on a bridge forming part of the national road network. He notes that responsibility for that road is vested by law in the Consejo Nacional de Vialidad, not in the Ministerio de Obras Públicas y Transportes.
  5. 5In a brief submitted to the Chamber on 21 de enero de 2020, Rolando Rodríguez Brenes, in his capacity as Alcalde de Cartago, filed a report. He states that, pursuant to Decreto No. 22834- MOPT-MVAH, titled Reglamento para el Uso Suelo y la Construcción en la Cuenca Río Reventado, the respondent municipal corporation is not responsible for maintaining the protective levees along that river. He notes that, pursuant to section 4° of those regulations, levee-maintenance work must be carried out by the Ministerio de Obras Públicas y Transportes. Consequently, he asserts that any levee-cleaning or repair work is the responsibility of that ministry. He adds that the bridge known as Santa Marta forms part of the road infrastructure belonging to national through-route No. 30107. Therefore, in strict accordance with sections 1° and 2° of the Ley General de Caminos, responsibility for work on that road and its infrastructure lies with the Ministerio de Obras Públicas y Transportes.He states that the claims regarding structural damage that caused landslides and weakened the bridge foundations are subjective and unsupported by any technical study. He states that, on the date the report was filed, the bridge known as Santa Marta was operational and the municipality had received no warning or notice concerning its use from the respondent ministry. He notes that, according to the Oficina de Gestión de Riesgo de la Municipalidad de Cartago, “(...) there are no situation reports or initial impact reports on record, nor was the site identified by the petitioner included in the damage assessment report associated with Tropical Storm Nate; it further states that section VI, subsection a, of technical report CNE-UIAR-INF-0188-2019 of 6 de junio de 2019, prepared by the Unidad de Investigación y Análisis de Riesgo de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, titled ‘Risk assessment in the Santa Cecilia sector due to damage to the Río Reventado levee,’ which was requested by the petitioner, states that ‘(...) The visual assessment conducted on the date of the visit revealed no structural damage to the levee (...)’.”
  6. 6In a written submission filed with the Chamber on 21 de enero de 2020, Eduardo Mora Castro, in his capacity as Head of the Unidad de Asesoría Legal de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, filed a report. He mentions that the commission exercises a governing role in risk prevention and a coordinating role in emergency response. He argues that it is the duty of the municipal government, through planning and the exercise of its police power (potestad de policía), to ensure that urban development complies with safety, public-health, and environmental-sustainability criteria. He states that, notwithstanding the petitioner’s assertions, the impacts caused by Tropical Storm Nate did not include damage to the levee in question. He clarifies that work on the levee is not included in any investment plan submitted by an implementing unit and that the commission therefore has not verified the existence of a causal link between the declared emergency and the damage to public infrastructure.He states that, consequently, the commission currently has no pending duties in this case. He mentions that the Unidad de Investigación y Análisis de Riesgo de la Comisión prepared technical report No. CNE-UIAR-INF-0188-2019 of 6 de junio de 2019, which stated as follows: “(...) VI. Conclusions. A. The visual assessment conducted on the date of the visit revealed no structural damage to the levee. B. It is likely that the flooding is (sic) caused by deficiencies in the systems that drain stormwater and wastewater from homes in the Santa Cecilia Sector into the Río Reventado. VII. Recommendations. A. The matter must be reported to the (sic) Municipalidad de Cartago and MOPT (...) so that they may act (sic) within the scope of their respective authority and assess the structure and the need to carry out work to improve the levee’s drainage systems. B. Any action taken or repair work performed on the levee must be supported by the necessary studies and conducted under the supervision of a responsible professional.VIII. Scope of the report. A. This report is not a substitute for the necessary technical studies and is valid only when bearing this department’s original seal. It entails no cost of any kind for the interested parties, who shall be responsible for submitting it to the appropriate authorities. B. In accordance with the decisions issued by the Constitutional Chamber concerning technical opinions provided by specialized officials of CNE and the Comités Asesores Técnicos, it is clarified that the recommendations in this (sic) report are binding upon the institutions to which they are addressed (...)”. He adds that, with respect to the petitioner’s allegations, the Consejo Nacional de Vialidad must respond pursuant to section 4° of Ley No. 7798, as must the Municipalidad de Cartago, in accordance with point 3, “Powers and Responsibilities of Local Governments in Risk Prevention Through Land-Use Planning (Ordenamiento Territorial).”
  7. 7By order issued at 15:02 hrs. on 22 de enero de 2020, the Reporting Justice ordered that the Executive Director of the Consejo Nacional de Vialidad be given an opportunity to respond (audiencia) regarding the alleged facts. Additionally, that order expressly states the following: “(…) In preparing the aforementioned report, the respondent authority must take into account that both the Alcalde de Cartago and the Head of the Legal Advisory Unit of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias informed this Chamber that CONAVI is responsible for intervening and addressing the situation complained of by the petitioner (recurrente). Additionally, the respondent director must clearly and precisely report the following:1) whether the petitioner, another resident of the aforementioned area, or any public official has submitted a request to CONAVI seeking its intervention to address the reported matter and, if so, since when;2) whether the institution he represents has been aware of the provisions of technical reports No. IAR-INF-0645-2018 of julio de 2018 and No. CNE- UIARINF- 0188-2019 of junio de 2019, prepared by the Risk Research and Analysis Unit of the Comisión de Prevención de Riesgos y Atención de Emergencias and, if so, since when; and3) whether (if aware of the aforementioned situation) any action has been taken to address the reported matter (and, if so, explain what actions were taken). (...)”.
  8. 8By order issued at 15:04 hrs. on 22 de enero de 2020, the Reporting Justice requested evidence to facilitate adjudication (prueba para mejor resolver), in the following terms: “(...) Having reviewed the record, and as evidence to facilitate adjudication, EDUARDO MORA CASTRO, IN HIS CAPACITY AS HEAD OF THE LEGAL ADVISORY UNIT OF THE COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS, or whoever holds that position in his stead, is requested to address the sworn report submitted by Gerardo Alexis González Castro, in his capacity as Acting Head of the Roadway Planning Department of the Ministerio de Obras Públicas y Transportes, stating that, since 14 de noviembre de 2018, through official letter No. DVOP-DI-DV-PV-2018-2413, he forwarded by email to the Head of the Risk Research and Analysis Unit of the Comisión de Prevención de Riesgos y Atención de Emergencias official letter No. AS-INSP-050-2018 issued by the Construction and Public Works Improvement Department of the Municipalidad de Cartago (requesting authorization to replace a stormwater discharge pipe running through the Río Reventado dike), and that no response has been received to date.In this regard, the aforementioned authority must indicate whether it responded to that official letter and, if so, on what date. Likewise, ROLANDO RODRIGUEZ BRENES, IN HIS CAPACITY AS ALCALDE DE CARTAGO, or whoever holds that position in his stead, is requested to inform this Chamber whether the municipal corporation he represents has been aware of the provisions of technical reports No. IAR-INF-0645-2018 of julio de 2018 and No. CNE-UIAR-INF-0188-2019 of junio de 2019, prepared by the Risk Research and Analysis Unit of the Comisión de Prevención de Riesgos y Atención de Emergencias and, if so, since when (...)”.
  9. 9By submission filed with the Chamber on 31 de enero de 2020, Eduardo Mora Castro, in his capacity as Head of the Legal Advisory Unit of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, responded to the opportunity to respond granted by the order of 22 de enero de 2020. He states that, as shown by the attached documents, at 10:05 hrs. on 12 de junio de 2019, Mr. Ignacio Chaves Salas, a geologist with the Risk Research and Analysis Unit, emailed report No. CNE-UIAR-INF-0188-2019 of 6 de junio de 2019, which referred to official letter No. DV0P-DI-DV-PV-2018-2413, to the recipients [email protected] (José Miguel Cordero Mata), Paula Sanabria Mena, [email protected], and ana.sancho@,mopt.go.cr, the latter being officials of the Roadway Review Department of the Ministerio de Obras Públicas y Transportes. He adds that the Risk Research and Analysis Unit communicates its reports to each municipality on a quarterly basis.
  10. 10By submission filed with the Chamber on 3 de febrero de 2020, Rolando Rodríguez Brenes, in his capacity as Alcalde de Cartago, responded to the opportunity to respond granted by the order of 22 de enero de 2020, in accordance with the statements made in turn by the Officer in Charge of the Risk Management Office and the Acting Coordinator of the Construction and Public Works Improvement Department. He states that the respondent municipality became aware of technical report No. IAR-INF-0645-2018 issued by the Risk Research and Analysis Unit. That report was analyzed for purposes of issuing an opinion through official letter No. 0GR-0F-075-2018/CM0-0F-117-2018 of 18 de octubre de 2018. He indicates that it likewise became aware of technical report No. CNE- UIAR-INF-0188-2019 issued by the aforementioned unit. He notes that the recommendations in the latter report stated that both MOPT and the municipality should act within their respective jurisdictions and that the structure and the need to undertake works to improve the dike’s drainage systems should be assessed.

He asserts that this requirement remains subject to MOPT’s determination, as the entity directly responsible for administering dike maintenance works.

  1. 11By submission filed with the Chamber on 7 de febrero de 2020, Mario Rodríguez Vargas, in his capacity as Executive Director of the Consejo Nacional de Vialidad, submitted his report. He states that the protected party (tutelado) has no technical reports supporting his assertions. He refers to the powers assigned to CONAVI by law. He mentions the statements contained in technical report No. IAR-INF-0645-2018. He notes that, from that time onward, C.N.E. detected serious violations of the regulations governing construction that may be carried out near riverbanks. He expressly states that: “(…) when flooding occurs, those violations cause damage to structures built in contravention of the regulations. This is clearly a situation falling outside the jurisdiction of this Council. Accordingly, it is clear that the Municipality seriously failed to comply with the regulations governing verification of the documentation that must accompany an application for a building permit, because it must consider not only the requirements imposed in the Canton for granting building permits, but also the rules concerning the State’s duty to ensure the conservation, protection, and administration of natural resources.In this regard, pursuant to section 33 of the Ley Forestal, the following are designated as protected areas (áreas de protección): “(...) b) A strip fifteen meters wide in rural areas and ten meters wide in urban areas, measured horizontally on both sides along the banks of rivers, gullies, or streams, if the land is flat, and fifty meters horizontally if the land is steep (...)”. He notes that buildings were found along the riverbanks that do not comply with the setback distances (metros de retiro) established by the regulations. He asserts that violations occurred not only on the part of the municipality when granting building permits, but also on the part of the area’s residents themselves. He argues that the respondent municipality omitted from its response any discussion of C.N.E.’s statements regarding wastewater management (manejo de las aguas servidas). In technical report No. DVP-36-20- 0034 of 6 de febrero de 2020, CONAVI’s Contracting Management Office referred to the work performed in the area in the following terms: “(...) During 2018, Conavi, through the Road and Bridge Maintenance Management Office, contracted the designs and constructed the works to protect against erosion (sic) the abutments of the aforementioned bridge (through route No. 30107 over the Río Reventado), as shown in Figure No. 1.This was done in accordance with the general recommendations issued by MOPT’s Bridge Directorate through official letter No. DVOP-DP-2017-638 (11328) dated 10 de noviembre de 2017. The recommendations in report No. DG-18-51, “Soil Study, Slope Stability, and Hydrological and Hydraulic Studies for the Construction of Retaining and/or Stabilization Works to Protect the Abutments of the Bridge over the Río Reventado,” dated junio 2018 and prepared by the company D'GEO, were likewise implemented. Topographic surveys conducted in marzo and mayo de 2018 were also used. In addition, through report Geointer Cot-18-096 dated 28 de junio de 2018, the company Geointer submitted to the Administration its technical and financial proposal for those works, based on the aforementioned documents. (...)”. Likewise, in official letter No. GCSV-78-2020-0545 of 6 de febrero de 2020, the Maintenance Management Office stated the following: “(...) Point 1: This Council, through (sic) the Road and Bridge Maintenance Management Office, has addressed, within the scope of its authority established by law, the situation affecting the protection of the bridge slopes (taludes).In general, the areas of the bridge most affected was (sic) the protection along the riverbanks, which was addressed (sic) by following the recommendations stated in official letter DVOP-DP-2017-638(11328) of MOPT’s Bridge Directorate (attached). As shown in photographs 1, 2, 3 and 4, that intervention (sic) consisted of protecting the abutments of both piers by constructing riprap (escollera) and an anchored structure in order to prevent erosion thereof. The aforementioned works included passive anchors, geodrains, concrete elements, among others, in order to protect the structure in the area of the aforementioned bridge and its foundations, for which an investment of €69.466.292,75 (sixty-nine million, four hundred sixty-six thousand, two hundred ninety-two colones and 75/100) was made. The aforementioned culvert works installed by the Municipalidad de Cartago do not fall within the scope of this (sic) Council and are the exclusive responsibility of the local Municipality (...)”.He asserts that the respondent council, through the Road and Bridge Maintenance Management Office, has addressed, within the scope established by law, the situation affecting the protection of the bridge slopes. The riverbanks were protected in accordance with the recommendations stated in official letter No. DVOP- DP-2017-638 (11328) of the Bridge Directorate of M.O.P.T. He asserts that work was performed to protect the abutments of both piers by constructing riprap and an anchored structure to prevent erosion thereof. He maintains that the culvert works are the exclusive responsibility of the municipality. He argues that CONAVI does not have jurisdiction to perform work along riverbanks. The Council’s functions focus on maintaining the national road network, which includes bridges. He expressly adds that “(…) In this case, the bridge structure was compromised by Tropical Storm Nate, and for that reason the corresponding intervention on the bridge was performed, its abutments were stabilized, and all work related to protecting the abutments of the bridge over the river was undertaken

Reventado. It must be understood that the works carried out were completed by my client in a timely and proper manner, with the aim of faithfully fulfilling the duties entrusted to us by law (...) my client fully completed the work on the bridge known as Santa Marta, located over the Río Reventado, since the stabilization work on the abutments was performed in a timely and proper manner (...)”. It maintains that the bridge is currently operational. Traffic along that route has not been interrupted. It alleges that the respondent municipality made no reference to the wastewater (aguas residuales) problem in the area. Nor did it mention the work that it will carry out with respect to the buildings that fail to comply with Article 33, subsection b), of the Ley Forestal. It notes that “(...) as can be seen from the content of our response, the work to stabilize the bridge abutments was carried out, and traffic through the area has not been interrupted, a situation confirmed by the Municipalidad de Cartago when it states that said structure is operational (...)”.

WHEREAS:

I. SUBJECT MATTER OF THE PETITION

The petitioner alleges that the respondent authorities have not carried out the works required to properly channel the water flowing through the levee located in Santa Cecilia de Guadalupe de Cartago, thereby placing residents of that area at risk.

II. PROVEN FACTS

The following facts relevant to the resolution of this amparo petition (recurso de amparo) are deemed established:

  • 1)On September 6, 2017, then-Deputy Mario Redondo Poveda sent the Mayor of Cartago official letter No. DMRP-220-17, in which he stated the following: “(…) we have received several complaints from residents of the community of Santa Cecilia de Guadalupe concerning the levee located 25 meters from the Santa Marta bridge in Guadalupe de Cartago. The problem reported by the residents of this community is that, where the sewage (aguas servidas) and stormwater (aguas pluviales) discharge, the pressure and volume of the water have caused the pipe to burst, resulting in soil being washed away, creating serious problems and a major hazard; furthermore, the gabions supporting the bridge are already giving way and are in the river channel (cauce). In addition, to reach the bridge, pedestrians must cross land that has already been washed away, leaving only a very small strip on which to walk, thereby placing all residents at risk, particularly students who must travel to educational institutions, older adults, and people who must travel to their workplaces. Additionally, residents state that approximately two or three months ago, the municipal government (sic) of Cartago sent dump trucks carrying soil and refuse, which were used to cover the exposed pipe; however, this fill was washed away again and the pipe continues to deteriorate (...).” (see evidence).
  • 2)During 2018, CONAVI, through the Road and Bridge Maintenance Division, contracted for the designs and carried out the works to protect the abutments of the bridge known as Santa Marta, located in the area identified by the petitioner, from erosion. Specifically, riprap (escollera) and an anchored structure were constructed, using geodrains (geodrenes), concrete components, and other materials for that purpose. The work cost C69.466.292,75 colones (see report and evidence).
  • 3)In May 2018, the protected party (tutelado), in his capacity as President of the Comité de Obras Comunales de Santa Cecilia de Guadalupe de Cartago, sent a note to an official of the Departamento de Obras y Alcantarillado Sanitario de la Municipalidad de Cartago, in which he expressly stated the following: “(…) I request (...) that an on-site inspection be conducted in the Santa Cecilia sector, 125 meters south and 125 meters west of Capilla Santa Cecilia, because we have been experiencing serious stormwater problems, since during the rainy season the water overflows toward the homes located in this sector, as the current system has collapsed due to the increase in housing construction. We further inform you that the residents would be willing to provide the labor required to install larger-diameter gutters (cunetas) (...)”. (see evidence).
  • 4)By official letter No. AS-INSP-17-2018 of June 4, 2018, the aforementioned official of the Departamento de Obras y Alcantarillado Sanitario de la Municipalidad de Cartago responded to the request submitted by the petitioner in May 2018 in the following terms: “(...) I hereby (...) address expediente N. 7138, submitted by you regarding stormwater problems in the Santa Cecilia sector (...) On the 02nd day of the current month and year, at 7:30 a.m., an inspection was conducted at the site, and the need to improve the stormwater system was assessed. The Municipality is willing to provide the materials, with the residents providing the labor to carry out the corresponding work (...)”. (see evidence).
  • 5)At the petitioner’s request, the Unidad de Investigación y Análisis de Riesgo de la Comisión de Prevención de Riesgos y Atención de Emergencias issued technical report No. IAR-INF-0645-2018 of July 31, 2018, entitled “Risk Assessment in a Sector of Barrio Santa Cecilia due to Erosion by the Río Reventado,” which stated the following: “(...) V. Conclusions. A. Near the Santa Cecilia de Guadalupe bridge, parallel to the left bank of the Río Reventado, there is a series of cracks extending 150 m along the channel, the direction of which coincides with the sector where lateral erosion of the slope (talud) has been recorded since the (sic) year 2013. B. The community adjoining the southeastern side of the bridge over the Río Reventado is located on a 5 m-high slope that is undergoing progressive and constant fluvial erosion. If this situation persists and worsens over time, a large portion of that sector would be removed by the action of the river flow; the risk of erosion in that sector is very high.

C. The study area is situated on a considerable thickness of alluvial deposits and mudflows originating from eruptions of the Irazú volcano. The constant stabilization work in the vicinity of the nearby bridge attests to the difficulty of achieving a balance between the integrity of the works and maintenance of the river’s longitudinal profile in this type of soft material. VI. Recommendations. A. It is recommended that the necessary works be carried out to protect and stabilize the slope on the left bank downstream from the Santa Cecilia bridge, in order to reduce the impact that lateral fluvial erosion is having on the existing homes and their access routes. It is noted that all works to be performed in publicly owned waterways (cauces de dominio público) must have permits from both the municipal authorities and the Dirección de Agua del MINAE. B. The Municipalidad de Cartago is reminded that construction permits must be prohibited within the protection zones (zonas de protección) of bodies of water, whether intermittent or permanent; moreover, the boundaries of those zones should be determined by the appropriate professional using hydrological and geomorphological criteria.

C. Any work carried out must be supervised by a qualified professional. D. Any irregularity arising from failure to follow the recommendations described herein SHALL REMAIN THE SOLE RESPONSIBILITY of those responsible for carrying out the works and of the respective Municipality if it fails to request the corresponding reports, inspections, and corrective measures (...)”. (see evidence).

  • 6)In October 2018, by official letter No. AS-INSP-050-2018, authorities of the Departamento de Construcción y Mejora de Obras de la Municipalidad de Cartago submitted to the Departamento de Previsión Vial del Ministerio de Obras Públicas y Transportes a request for authorization to install a pipe in the levee area to discharge stormwater into the Río Reventado, specifically in the Santa Cecilia de Guadalupe de Cartago sector. That official letter expressly stated the following: “(...) pursuant to express instructions from the Dirección de Operaciones de esta Municipalidad de Cartago, following a request from residents of the Santa Marta levee sector for work on the collapsed stormwater pipe that serves as the discharge outlet for water from Barrio Santa Cecilia (...) and crosses the Río Reventado levee, a prior assessment is requested from the competent MOPT departments responsible for managing the levee, so that they may issue the corresponding opinion and/or specify the requirements for obtaining the relevant administrative and legal authorization enabling this Municipality to replace the pipe as requested by the residents (...)”. (see report and evidence).
  • 7)By official letter No. OGR-OF-075-2018/CMO-OF-117-2018 dated 18 de octubre de 2018, authorities of the Municipalidad de Cartago learned of the provisions of technical report No. IAR-INF-0645-2018. That official letter, addressed to the Alcalde de Cartago, expressly stated the following: “(...) In response to the Official Letter from your office (...) dated 04 de octubre del presente año, whereby you refer to us an agreement of the Concejo Municipal (...) concerning a motion requesting that the administration proceed to conduct the appropriate studies of the Santa Cecilia Levee (Dique Santa Cecilia) in the Distrito de Guadalupe due to the erosion occurring at that location, which motion was unanimously approved, we hereby inform you of the following: (...) 3. As cited in the agreement of the Concejo Municipal at its ordinary session of 25 de setiembre del 2018 (Acta NO.187-2018-ArtículoN0 XXXIV) (sic), Technical Report IAR-INF-0645-2018, issued by Geologist Ana Enid Vargas Carranza of the Unidad de Investigación y Análisis del Riesgo CNE (...), already contains the results of the assessment conducted on 11 de junio del presente año at the request of Mr.

José Miguel Cordero Mata, who submitted the request (...) 4. In section ‘VII. Scope’ of report IAR-INF-0645-2018, the authors clearly state that the technical opinions issued by the specialized officials of the CNE and the Comités Asesores Técnicos are binding upon the institutions to which they are addressed (...) 5. Considering the preceding point, and also that item B of section ‘VI. Recommendations’ of Report IAR-INF-0645-2018 is addressed to the Municipalidad de Cartago, the professional opinion expressed in that report must be regarded as current and final, leaving no opportunity for the Municipalidad de Cartago to issue an opinion that contradicts, expands, modifies, or nullifies it, or even one that confirms it; still less so, as already stated, if the Municipalidad de Cartago does not have a professional in the field of geology who can provide a technical opinion regarding the analysis already conducted. 6.

The technical studies referred to in item A of section ‘VI. Recommendations’ of Report IAR-INF-0645-2018 do not refer to other risk assessments (valoraciones de riesgo), but to technical studies required for the proposal and implementation of infrastructure projects—protective works and slope stabilization (estabilización de taludes)—which in this case depend on the legal, budgetary, and operational feasibility of those projects. Otherwise, the investment required to conduct those studies could prove fruitless. 7. Por tanto, with respect to legal feasibility, points 1 and 2 of the Whereas section (Considerando) of Decreto NO. 22834 MIVAH-MOPT (25 de enero de 1994), currently in force, explain that the lands within a zone 1 km wide on each bank of Río Reventado, from its source to the bridge connecting Tejar and Tobosi, are subject to Ley NO. 34596 (26 de noviembre de 1964), which declares them a national reserve.

In point 3, the agreement of the Concejo Municipal, Artículo NO. XXXIV-Acta NO. 187-2018 (25 de setiembre del 2018), refers to Report IAR-INFO-0645-2018 as indicating that the Dique Santa Cecilia lies within the hazard map (mapa de amenazas) where alluvial deposits and mudflows from the eruptions of Volcán Irazú during the 1960s were deposited. That event is precisely the justification for Decreto NO. 22834 MIVAH-MOPT to define the essential purpose of the ‘Diques de Cartago’ as safeguarding the lives, health, and property of persons. The decree does not state that the purpose of the levees even contemplated the possibility of housing construction or the protection of an unlawful human settlement (asentamiento humano ilegítimo), precisely because those defensive works never eliminated the risk condition; they were intended only to mitigate it by reducing vulnerability. Points 4 through 9 of the Whereas section of the decree demonstrate that the risk condition that the Honorable Concejo Municipal seeks to assess existed before the decree was approved in 1994 and that the Comisión Nacional de Emergencias merely confirmed it 24 years later, in section ‘IV General analysis of the hazard and vulnerability’ of its report IAR-INF-0645-2018, describing the progression of its deterioration due, according to the decree, to the encroachment upon the properties declared a national reserve, which are owned by the State, thereby placing the lives of the persons who have unlawfully settled there in grave danger (...) 11 (...) As stated in point 2 of the agreement of the Concejo Municipal, Artículo NO. XXXIV-Acta NO. 187-2018, local residents report that some years ago there was a distance of approximately 10 meters between their houses and the channel, whereas there are currently sectors where the distance from the eroded slope is approximately 3 meters, preventing residents from accessing their homes by vehicle.

It is therefore concluded that the residents of Dique Santa Cecilia who state that they are in this situation were not even (sic), some years ago, in compliance with the setback requirements (retiros) established for the left bank in Sector 2-Zone 2. 12. It should be noted here that no public street has ever existed in this sector; rather, the occupants of the levee once again unlawfully used the levee crest (corona del dique) for vehicular traffic, thereby encouraging the circulation of all types of vehicles, including heavy-load vehicles, and thus accelerating the erosion and deterioration of the matrix of fine sands and coarse rough stone that forms the piles of fluvial materials known as levees, which, it bears stating, serve solely as natural protective barriers. When the decree mentions the right-of-way (derecho de vía), it does not refer to the levee crest, but rather to the area beginning at the outer toe (...)”. (see evidence).

  • 8)On 14 de noviembre de 2018, Engineer González Castro of the Departamento de Previsión Vial of the Ministerio de Obras Públicas y Transportes forwarded official letter No. DVOP-DI- DV-PV-2018-2413 to the Head of the Unidad de Investigación y Análisis del Riesgo of the Comisión de Prevención de Riesgos y Atención de Emergencias, expressly stating the following: “(...) Because this matter falls within your authority as the entity responsible for preventing risk situations and responding to emergencies, official letter AS-INSP-050- 2018, issued by the Departamento de Construcción y Mejora de Obras of the Municipalidad de Cartago, is hereby forwarded. That letter requests authorization to replace a stormwater discharge pipe that crosses the levee of Río Reventado with one of a larger diameter (...)”. (see report and evidence).
  • 9)On 11 de febrero de 2019, the authorities of the Departamento de Previsión Vial of the Ministerio de Obras Públicas y Transporte forwarded official letter No. DVOP-DI-DV-PV-2018-2412 to an official of the Departamento de Obras y Alcantarillado Sanitario of the Municipalidad de Cartago. That letter addressed the request made in official letter No. AS-INSP-050-2018 and stated the following: “(...) In this regard, please be advised that officials of this department reviewed the documents submitted and determined the following: —Any intervention on the aforementioned levee requires the corresponding authorization from the Comisión Nacional de Emergencias; this Department will therefore consult that institution and will send you a copy of the consultation. Furthermore, proper assessment of the works to be performed requires construction drawings signed by the responsible professional, including (...) and all other details needed to clearly identify the works to be performed (...)”. (see report and evidence).
  • 10)The authorities of the Municipalidad de Cartago did not comply with the provisions issued by the Departamento de Previsión Vial of the Ministerio de Obras Públicas y Transporte in official letter No. DVOP-DI-DV-PV-2018-2412 (see report).
  • 11)At the appellant’s request and pursuant to official letter No. DVOP-DI-DV-PV-2018-2413 issued by the Ministerio de Obras Públicas y Transportes, the Unidad de Investigación y Análisis de Riesgo of the Comisión de Prevención de Riesgos y Atención de Emergencias issued technical report No. CNE-UIAR- INF-0188-2019 dated 6 de junio de 2019, entitled “Risk assessment in the Santa Cecilia sector due to damage to the levee of Río Reventado,” which stated the following: “(...) VI. Conclusions. A. The visual assessment conducted on the date of the visit revealed no structural damage to the levee. B. The flooding is likely caused (sic) by deficiencies in the systems for draining stormwater and wastewater from the homes in the Santa Cecilia Sector into Río Reventado. VII. Recommendations. A. The Municipalidad de Cartago and MOPT must be notified (sic) (...) so that they may act within the scope of their authority and assess the structure and the need to carry out works to improve the levee’s drainage systems.

B. Any action or repair work performed on the levee must be supported by the necessary studies and conducted under the supervision of a responsible professional. VIII. Scope of the report. A. This report does not replace the necessary technical studies and is valid only if it bears this department’s original seal. It entails no cost of any kind for the interested parties, who shall be responsible for processing it before the corresponding authorities. B. Pursuant to the decisions issued by the Sala Constitucional concerning technical opinions issued by specialized officials of the CNE and the Comités Asesores Técnicos, it is clarified that the recommendations in this (sic) report are binding upon the institutions to which they are addressed (...)”. (see evidence).

  • 12)On an unspecified date, the respondent municipal authorities became aware of the provisions of technical report No. CNE-UIAR-INF-0188-2019 (see report).
  • 13)On 12 de junio de 2019, Ignacio Chaves Salas, a geologist with the Unidad de Investigación y Análisis de Riesgo of the Comisión de Prevención de Riesgos y Atención de Emergencias, emailed report No. CNE-UIAR-INF-0188-2019 dated 6 de junio de 2019, which referred to official letter No. DVOP-DI-DV-PV-2018-2413, to officials of the Departamento de Previsión Vial of the Ministerio de Obras Públicas y Transportes (see report).
  • 14)On 13 de enero de 2020, the appellant filed this amparo proceeding (amparo) (see initiating petition).
  • 15)The residents of the Santa Cecilia de Guadalupe de Cartago area are currently in danger because no works have been undertaken to mitigate the problems they experience from the irregular flow of the waters (undisputed fact).

III. REGARDING THE STATE’S OBJECTIVE OBLIGATION TO PROTECT HUMAN LIFE

With respect to this issue, this Sala stated the following in Judgment No. 2003-011519, issued at 10:30 hrs. on 10 de octubre de 2003:

“(…) It has been customary for the right to life, frequently analyzed together with the right to physical integrity, to be understood as a right having negative content; that is, its object was limited to the claim against the State that it (sic) refrain from taking actions intended to end the physical existence of persons, such as torture or the death penalty, or that it punish public and private persons who infringed upon the life and integrity of others through the criminal justice system. However, the current trend is to impose various affirmative duties on the State, in the sense that (sic), beyond the fact that (sic) it must not disturb the physical existence of persons, it must act to safeguard their protection against the many dangers that threaten them, whether those dangers arise from actions by the State itself, by other persons, or even by nature itself. Hence, for example, environmental matters have become, at least in our country, matters of a constitutional nature, since the right to a healthy and ecologically balanced environment was elevated to the status of a fundamental right.

It must now be clarified that the objective existence of an obligation of the State concerning protection of the right to life does not necessarily entail a subjective right of persons to demand, through judicial bodies, that a specific measure be taken, but it does entail the right to have appropriate measures taken to safeguard that right in the face of manifestly negligent conduct by public authorities. Thus, the State assumes the obligation to regulate those areas of social life from which dangers to the physical existence of the inhabitants of its territory may arise, whether through legislation, regulations, agreements, or other measures related to administrative organization and procedures, and persons have the subjective right to have such action taken diligently. Consequently, the possibility of judicially demanding, through an amparo proceeding (recurso de amparo), a specific type of affirmative action by the State in fulfillment of its duty to protect the life and physical integrity of its inhabitants is limited to cases where an imminent danger to those rights is clearly established.

Thus, if, for example, a particular community considered it necessary to have a hospital to serve its residents—or any other public work—that demand should not be pursued through an amparo proceeding, but rather through the mechanisms previously established and before the competent bodies and entities, which must consider the request and determine its technical feasibility, without this necessarily entailing a favorable response. It follows that intervention by the constitutional jurisdiction is warranted only where the State, acting through its competent bodies, has demonstrably failed to address the demands made by the country’s inhabitants in the exercise of their rights (...)”.

IV. SPECIFIC CASE

Having reviewed the sworn reports submitted by the respondent authorities, as well as the evidence entered into the record, this Constitutional Court observes that, as the protected party alleges, a serious problem currently exists in Santa Cecilia de Guadalupe de Cartago, insofar as water flows irregularly through that area because of the collapse of the pipeline crossing the levee, which has caused overflows, cracks, and fluvial erosion and, consequently, has endangered the persons residing there.

The foregoing is abundantly clear from the technical reports prepared by the Risk Research and Analysis Unit of the Comisión de Prevención de Riesgos y Atención de Emergencias following inspections conducted in the aforementioned area. In this regard, in report No. IAR-INF-0645-2018 of 31 de julio de 2018, entitled “Risk Assessment in an Area of Barrio Santa Cecilia Due to Erosion by the Río Reventado,” the aforementioned unit stated as follows:

“(…) V. Conclusions. A. At the Santa Cecilia de Guadalupe bridge, running parallel to the left bank of the Río Reventado, there is a series of cracks extending 150 m along the channel, whose direction coincides with the area where lateral erosion of the slope (talud) has been recorded since (sic) 2013. B. The community bordering the bridge over the Río Reventado to the southeast is situated on a 5 m-high slope that is undergoing progressive and constant fluvial erosion. If this situation persists or worsens over time, a large portion of that area would be washed away by the flow; the risk of erosion in that area is very high. C. The study area is situated upon a considerable thickness of alluvial deposits and mudflows from eruptions of the volcán Irazú. The ongoing stabilization work near the adjacent bridge demonstrates how difficult it is to achieve a balance between the structural integrity of the works and maintenance of the river’s longitudinal profile in this type of soft material.

VI. Recommendations. A. It is recommended that the necessary works be undertaken to protect and stabilize the slope on the left bank downstream from the Santa Cecilia bridge, in order to reduce the impact that lateral fluvial erosion is having on the existing homes and access to them. It should be recalled that all works to be carried out in publicly owned channels (cauces de dominio público) must have permits from both the municipality and the Dirección de Agua del MINAE. B. The Municipalidad de Cartago is reminded that construction permits must be prohibited within the protection zones (zonas de protección) of bodies of water, whether intermittent or permanent; moreover, a hydrological-geomorphological criterion applied by the appropriate professional should govern the delineation of such zones. C. Any work undertaken must be supervised by a qualified professional. D. Any irregularity resulting from failure to follow the recommendations described herein SHALL BE THE SOLE RESPONSIBILITY of those responsible for carrying out the works and of the respective Municipality if it fails to request the corresponding reports, inspections, and corrective measures (...)” (Emphasis not in the original).

Similarly, and more recently, in technical report No. CNE-UIAR- INF-0188-2019 of 6 de junio de 2019, entitled “Risk Assessment in the Santa Cecilia Area Due to Damage to the Río Reventado Levee,” the aforementioned unit expressly stated as follows:

“(…) VI. Conclusions. A. The visual assessment conducted on the date of the visit revealed no structural damage to the levee. B. The flooding is likely caused (sic) by deficiencies in the systems used to drain stormwater and wastewater from homes in the Sector de Santa Cecilia into the Río Reventado. VII. Recommendations. A. Notice must be given to (sic) the Municipalidad de Cartago and MOPT (...) so that they may act within their respective jurisdictions and assess the structure and the need to undertake works to improve the levee’s drainage systems. B. Any action or repair work performed on the levee must be supported by the necessary studies and conducted under the supervision of a responsible professional. VIII. Scope of the Report. A. This report does not replace the necessary technical studies and is valid only when bearing the original seal of this department. It does not entail any cost for the interested parties; they shall be responsible for submitting it to the appropriate authorities. B. Pursuant to the decisions issued by the Sala Constitucional regarding the technical criteria provided by specialized officials of the CNE and the Comités Asesores Técnicos, it is clarified that the recommendations contained in this (sic) report are binding on the institutions to which they are directed (...)”. (Emphasis not in the original).

It is also important to emphasize that the situation described above has likewise been acknowledged by the Municipalidad de Cartago. Thus, in official letter No. AS- INSP-17-2018 of 4 de junio de 2018, an official of the Departamento de Obras y Alcantarillado Sanitario de la Municipalidad de Cartago—in response to a request submitted by the petitioner seeking attention to the issue of water overflowing due to the collapse of the water collection system—acknowledged the need to intervene in the stormwater system and replace the pipeline after conducting an inspection of the area. For its part, in official letter No. 0GR-0F-075-2018/CM0-0F-117-2018 of 18 de octubre de 2018, the aforementioned municipality, in addressing the findings of the previously cited technical report No. IAR-INF-0645-2018, referred to the continuing risk conditions in the area in question and the danger faced by its residents.

Likewise, based on the analysis conducted, this Chamber has deemed it established that, as of this date, not all the works necessary to address the situation described have been carried out. This undoubtedly violates the fundamental rights of the residents of the aforementioned area of the province of Cartago.

In view of these circumstances, this constitutional jurisdiction must specifically determine whether the respondent authorities—Municipalidad de Cartago, M.O.P.T., CONAVI, and C.N.E.—which are fully aware of the situation described, have taken the appropriate measures within the scope of their authority to address it adequately and whether, accordingly, the amparo petition should be granted against them. This analysis shall be conducted in the following order:

A. Municipalidad de Cartago. With respect to this corporation, this Chamber finds that the amparo petition should be granted for the reasons explained below.

It should be noted that, as may be inferred from the established facts, the issue under review was brought before the aforementioned municipality by then-Deputy Mario Redondo Poveda on 6 de septiembre de 2017, as well as by the petitioner, in his capacity as President of the Comité de Obras Comunales de Santa Cecilia de Guadalupe de Cartago, in mayo de 2018. It has also been established that the aforementioned municipal authorities were fully aware of the findings made by the Risk Research and Analysis Unit of the Comisión de Prevención de Riesgos y Atención de Emergencias in the above-cited technical official letters No. IAR-INF-0645-2018 of 31 de julio de 2018 and No. CNE-UIAR-INF- 2019 of 6 de junio de 2019. Indeed, in official letter No. OGR-OF-075- 2018/CMO-OF-117-2018 of 18 de octubre de 2018, the municipality referred to the first of those technical reports and stated that the professional opinion set forth therein had to be accepted by that corporation as current and final and, consequently, could not be contradicted, expanded, modified, or annulled in any manner. Likewise, on that occasion, reference was made—as stated above—to the risk and danger faced by persons living near Dique Santa Cecilia.

Despite the foregoing state of affairs, this Constitutional Court finds it proven that the respondent municipal corporation limited itself to taking only two actions: 1) responding to the request submitted by the appellant in May 2018, informing him, through official letter No. AS-INSP-17-2018 of 4 de junio de 2018, that, by virtue of an inspection conducted in the Santa Cecilia sector, the need to improve the stormwater drainage system had indeed been established; and 2) requesting authorization from the Departamento de Previsión Vial del Ministerio de Obras Públicas y Transportes, in October 2018, to install a pipe in the levee area to discharge stormwater into the Río Reventado. Those works, however, as was also established, were not even commenced by the aforementioned municipality, since it failed to comply with the formal request (prevención) issued in that regard by MOPT in February 2019 through official letter DVOP-DI- DV-PV-2018-2412 (requiring the submission of construction plans signed by a responsible professional).

Thus, it is clear that, although the authorities of that municipality have been fully aware of the alleged situation for several years, they have not taken the necessary steps to resolve it conclusively.

Such neglect and omission cannot now be justified—as the respondent mayor seeks to do—by assigning all responsibility and jurisdiction to the authorities of the Ministerio de Obras Públicas y Transportes, when it is clear that a problem involving the irregular flow of water and the manner in which some residents have settled at the site under review (which, apparently, has been unlawful) is also a matter that must be addressed by this country’s municipalities, as expressly stated in the technical reports prepared by the Unidad de Investigación y Análisis de Riesgo de la Comisión de Prevención de Riesgos y Atención de Emergencias. Indeed, it should be noted that, precisely because of that assigned jurisdiction, the Municipalidad de Cartago sought in 2018 to undertake works to install pipes in the levee area in order to provide adequate stormwater discharge. Those works, however, as was likewise stated, have been neglected for many months, thereby leaving the residents of the aforementioned area of Santa Cecilia de Guadalupe de Cartago exposed to an ongoing state of danger.

Accordingly, this constitutional body finds that the authorities of the Municipalidad de Cartago have violated the fundamental rights of the residents of the aforementioned sector of the province of Cartago.

B. Ministerio de Obras Públicas y Transportes (Departamento de Previsión Vial). With respect specifically to this Department, this Court does not find grounds to grant the appeal for constitutional relief (amparo). It should be noted that, according to the report submitted under oath, subject to the consequences, including criminal consequences, provided for in Article 44 of the Law governing this jurisdiction, that department’s sole responsibilities concerning the situation under review are to establish construction setback lines (alineamientos de construcción) with respect to the levee and to approve applications for stormwater or sanitary discharge in that area. Accordingly, it was established that, in response to the authorization requested by the Municipalidad de Cartago in October 2018 to install a pipe in the levee area to discharge stormwater into the Río Reventado, specifically in the Santa Cecilia de Guadalupe de Cartago sector, those authorities took several steps within the scope of their jurisdiction.

In that regard, the record shows that in November 2018 they requested authorization from the Comisión de Prevención de Riesgos y Atención de Emergencias to carry out the aforementioned works (which, as explained below, was in fact addressed), and, in February 2019, they formally required the municipal authorities to submit—as a prerequisite for ruling on the aforementioned application—construction plans signed by a responsible professional. It is likewise deemed proven, however, that this latter request has not, to date, been addressed by the authorities of the respondent municipality, making it impossible for the Departamento de Previsión Vial of the respondent ministry to continue processing and deciding the application originally submitted.

Under these circumstances, this jurisdiction does not find that the authorities of the aforementioned department failed to fulfill the obligations incumbent upon them with respect to the alleged situation. On the contrary, as was demonstrated, they have taken the appropriate steps to carry out the work required to install a pipe in the levee area and thereby provide adequate stormwater discharge. If that work has not yet been performed, this cannot be attributed to the aforementioned authorities of the Ministerio de Obras Públicas y Transportes, but rather, as explained above, to the respondent municipal authorities.

C. Consejo Nacional de Vialidad. Upon review of the record, this jurisdiction does not find that the CONAVI authorities failed to fulfill their duties in this particular case. This is because it was deemed proven that, since 2018—many months before this appeal was filed—the aforementioned authorities, acting within the scope of the powers assigned to them concerning the maintenance of this country’s national roads (which includes bridges), undertook a series of actions to address the fluvial erosion (erosión fluvial) found in the area identified by the appellant and also referenced in technical report No. IAR-INF-0645-2018 of July 2018, prepared by the Unidad de Investigación y Análisis del Riesgo de la Comisión de Prevención de Riesgos y Atención de Emergencias.

In that regard, it should be noted that, according to the report submitted under oath, CONAVI, through the Gerencia de Conservación de Vías y Puentes, commissioned the designs and carried out a series of works to protect the abutments (bastiones) of the bridge located in the sector under review from erosion. Specifically, a riprap structure (escollera) and an anchored structure (estructura anclada) were constructed using geodrains (geodrenes), concrete elements, and other materials, and an amount of C69.466.292,75 colones was invested.

Accordingly, this appeal must be dismissed insofar as this authority is concerned.

D. Comisión de Prevención de Riesgos y Atención de Emergencias. With respect to this last institution, this Chamber likewise finds that the appeal must be dismissed. This is because the record shows that the authorities of the aforementioned commission have taken several actions, whenever requested to do so, regarding the problems experienced by the residents of the Santa Cecilia de Guadalupe de Cartago sector.

In particular, the record shows that they addressed the two requests submitted by the protected party (tutelado), through which they were asked to conduct inspections at the aforementioned site and issue a technical opinion concerning the situation that had occurred. As was clearly established, those actions did in fact result in the issuance of technical reports No. IAR-INF-0645-2018 and No. CNE-UIAR- INF-0188-2019, extensively referenced in these proceedings, which in turn have served as essential input for describing the problems currently faced by the residents of the aforementioned locality.

It is also important to consider that it is deemed proven—according to the report submitted under oath—that the aforementioned authorities of the Comisión de Prevención de Riesgos y Atención de Emergencias, since June 2019, addressed the request submitted by the Departamento de Previsión Vial del Ministerio de Obras Públicas y Transportes and, in that regard, issued their opinion concerning the replacement of the pipe crossing the levee located on the Río Reventado.

Accordingly, this constitutional body does not find that the aforementioned authorities committed any act that infringed the fundamental rights of the appellant or those of the other residents of Santa Cecilia de Guadalupe de Cartago.

V. NOTE TO THE AUTHORITIES OF CONAVI, MOPT, AND CNE

Despite what was stated regarding those authorities in the preceding recital (considerando), it is necessary to remind them of their duty to continue carrying out all actions that may be necessary, when appropriate, and that fall within the scope of their jurisdiction, in order to safeguard and protect the fundamental rights of the appellant and the residents of the area under review.

VI. CONCLUSION

In view of the foregoing, the appeal must be granted in part, with the consequences to be set forth in the operative portion (parte dispositiva) of this judgment.

VII. NOTE BY JUSTICE SALAZAR ALVARADO

In environmental matters, it is the undersigned’s view that, if the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the contentious-administrative jurisdiction (jurisdicción contenciosa administrativa). Nevertheless, I do address the merits of the matter when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy environment free of pollution (Article 50 of the Constitución Política), as occurs in this case, in which it is alleged that the respondent authority has not carried out the works required to properly channel the water flowing through the levee located in Santa Cecilia de Guadalupe de Cartago, thereby endangering the health of the appellant and his family and threatening the right to enjoy a healthy and ecologically balanced environment and a dignified quality of life.

VIII. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device or produced using new technologies, such items must be collected from the court office within a maximum period of 30 business days from service of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session number 27-11 of 22 de agosto de 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero de 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session number 43-12 held on 3 de mayo de 2012, Article LXXXI.

POR TANTO:

The appeal is partially granted, solely against the Municipalidad de Cartago. Accordingly, Rolando Rodríguez Brenes, or whoever holds the office of Alcalde de Cartago in his stead, is hereby ordered to issue the pertinent directives and coordinate all necessary actions with the competent public institutions so that, within a maximum period of FOUR MONTHS from notification of this judgment, all improvement works are carried out on the drainage systems of the dike located in Santa Cecilia de Guadalupe de Cartago, so that the waters flowing through them do not endanger residents of the area. The foregoing is ordered with the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order from this Chamber that the person is required to comply with or enforce, and who fails to do so, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty fine-days (días multa), provided that the offense is not subject to a more severe penalty.

The Municipalidad de Cartago is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed in enforcement-of-judgment proceedings (ejecución de sentencia) before the administrative courts. This ruling shall be served personally on Rolando Rodríguez Brenes, or whoever holds the office of Alcalde de Cartago in his stead. Justice Salazar Alvarado files a separate note. The respondent authorities of CONAVI, M.O.P.T., and C.N.E. shall take note of the matters stated in recital V (considerando V) of this judgment.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del veintiuno de febrero de dos mil veinte.

Recurso de amparo interpuesto por JOSÉ MIGUEL CORDERO MATA, cédula de identidad 0302040944, contra LA MUNICIPALIDAD DE CARTAGO, EL MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES (M.O.P.T.), EL CONSEJO NACIONAL DE VIALIDAD (CONAVI) y LA COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS (C.N.E.).

RESULTANDO:

  1. 1Por escrito recibido en la Sala el 13 de enero de 2020, el recurrente interpone recurso de amparo y manifiesta que con el paso de la Tormenta Nate en 2017, el dique ubicado en Santa Cecilia de Guadalupe de Cartago sufrió fuertes daños estructurales que provocaron deslizamientos y debilitamiento de las bases del puente de Santa Marta, en una longitud de aproximadamente 150 metros. Agrega que en las bases de ese puente se encuentran colocados unos tubos de concreto que desfogan las aguas pluviales y servidas, las cuales también fueron dañadas por la fuerza del agua, hasta el punto que en la actualidad la mayoría de esa estructura se encuentra en el cauce del Río Reventado. Añade que en su condición de presidente del Comité de Santa Cecilia, efectuó gestiones ante la Municipalidad de Cartago, el Ministerio de Obras Públicas y Transportes y la Comisión Nacional de Emergencias Investigación y Análisis de Riesgo, pero aún no se ha solucionado la problemática.Comenta que Mario Redondo Poveda, mediante oficio No. DMRP-220-17, le informó al alcalde de la municipalidad recurrida los problemas que presentan los vecinos que habitan en las cercanías del dique de Santa Cecilia y le solicitó un informe detallado sobre los procedimientos que se siguieron en los trabajos de limpieza del sitio; sin embargo, nunca se obtuvo respuesta. Alega que por la falta de reparación de los daños mencionados, los vecinos que colindan con el dique corren peligro. Refiere que según el informe técnico No. IAR-INF-0645-2018 de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, la erosión del sitio ha aumentado debido a los trabajos de limpieza realizados. Asimismo, dicha comisión recomendó efectuar obras de protección y estabilización del talud del margen izquierdo de las aguas, debajo del puente de Santa Cecilia, para reducir el impacto de la erosión lateral fluvial.Reclama que el alcalde de la municipalidad recurrida no ha realizado los trabajos necesarios para salvaguardar la vida de las personas que habitan en las cercanías del dique. Por lo expuesto, estima vulnerados los derechos fundamentales. Solicita que se declare con lugar el recurso y se le ordene a los responsables realizar las obras de reparación que sean necesarias en el referido dique del sector de Santa Cecilia del distrito de Guadalupe de Cartago.
  2. 2Por resolución de las 10:53 hrs. de 14 de enero de 2020, se le da curso al proceso y se requieren los informes a las autoridades recurridas.
  3. 3Mediante memorial aportado a la Sala el 17 de enero de 2020, Gerardo Alexis González Castro, en su condición de Jefe a.i. del Departamento de Previsión Vial del Ministerio de Obras Públicas y Transportes, rinde informe. Indica que dentro de las funciones de ese departamento se encuentra dar alineamientos de construcción respecto al dique según el Decreto No. 22834-MOPT-MVAH. El permiso de construcción es competencia municipal y el alineamiento es solamente un insumo para lograr el permiso de construcción. Explica que otra función del departamento es aprobar solicitudes de desfogue pluvial o sanitario en el área del dique, previo visto bueno de la Comisión Nacional de Emergencias. Señala que luego de revisar los registros del departamento, se determinó que el expediente No. 18-0183 corresponde al tema en cuestión, donde la Municipalidad de Cartago, por oficio No. AS-INSP-050-2018, comunicó la referida situación.Menciona que dicho departamento, de forma diligente, remitió el citado expediente a la Comisión Nacional de Emergencias para su valoración mediante el oficio No. DVOP-DI- DV-PV-2018-2413, el cual fue notificado el 14 de noviembre de 2018 por correo electrónico. Agrega que el 11 de febrero de 2019 se notificó al señor Collado Ugalde de la Municipalidad de Cartago el oficio No. DVOP-DI-DV-PV-2018- 2412, donde se solicitan una serie de requisitos que se debían presentar. Afirma que luego de tales notificaciones, el departamento no recibió más respuestas al respecto. Asevera que dicho departamento no gestiona, no da mantenimiento ni tiene injerencia en contrataciones relacionadas con el dique. Sus únicas funciones consisten en aprobar desfogues con visto bueno de la Comisión Nacional de Emergencias y dar alineamientos de construcción a propiedades colindantes con el dique. Afirma que cualquier otro tipo de obra de reparación, mantenimiento o similares, se escapa del ámbito de su competencia.
  4. 4Por escrito aportado a la Sala el 17 de enero de 2020, Rodolfo Méndez Mata, en su condición de Ministro de Obras Públicas y Transportes, rinde informe. Indica que los hechos expuestos guardan relación con la intervención de un puente sobre la red vial nacional. Refiere que la atención de esa vía le corresponde por ley al Consejo Nacional de Vialidad y no al Ministerio de Obras Públicas y Transportes.
  5. 5Mediante memorial aportado a la Sala el 21 de enero de 2020, Rolando Rodríguez Brenes, en su condición de Alcalde de Cartago, rinde informe. Afirma que la corporación recurrida, conforme lo dispuesto en el Decreto No. 22834- MOPT-MVAH denominado Reglamento para el Uso Suelo y la Construcción en la Cuenca Río Reventado, no tiene responsabilidad en el mantenimiento de los diques de protección a dicho río. Refiere que conforme el ordinal 4° de dicho reglamento, las obras de mantenimiento de los diques deben ser ejecutadas por el Ministerio de Obras Públicas y Transportes. Por ende, asevera que cualquier trabajo de limpieza o de reparación de los diques recae en dicho ministerio. Agrega que el puente conocido como Santa Marta, es parte de la infraestructura vial perteneciente a la ruta nacional de travesía No. 30107. Por ende, en estricto apego a lo dispuesto en los ordinales 1° y 2° de la Ley General de Caminos, la intervención de esa vía y su infraestructura corresponde al Ministerio de Obras Públicas y Transportes.Indica que las aseveraciones realizadas sobre los daños estructurales que provocaron deslizamientos y el debilitamiento de las bases del puente son subjetivas y no están respaldadas en ningún estudio técnico. Afirma que el día de rendido el informe el puente conocido como Santa Marta se encontraba en funcionamiento y la municipalidad no había recibido ninguna advertencia o notificación sobre su uso por parte del ministerio recurrido. Refiere que según la Oficina de Gestión de Riesgo de la Municipalidad de Cartago “(…) no constan ni informes de situación ni informes de primer impacto, ni se incluyó en el informe de evaluación de daños asociados a la Tormenta Nate, el sitio señalado por el recurrente, agrega que en la sección VI, inciso a, del informe técnico CNE-UIAR-INF-0188-2019 de 6 de junio de 2019 elaborado por la Unidad de Investigación y Análisis de Riesgo de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias denominado “Valoración de riesgo en el sector de Santa Cecilia por daños en el dique del río Reventado” y que fue solicitado por el recurrente, se indica que “(...) En la valoración visual el día de la visita no se evidenciaron daños estructurales al dique (...)”.
  6. 6Por escrito aportado a la Sala el 21 de enero de 2020, Eduardo Mora Castro, en su condición de Jefe de la Unidad de Asesoría Legal de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, rinde informe. Menciona que dicha comisión cumple una función rectora en prevención de riesgos y una función coordinadora en la atención de emergencias. Argumenta que es deber del gobierno municipal garantizar, mediante el planeamiento y el ejercicio de la potestad de policía, que el desarrollo urbanístico atienda a criterios de seguridad, salubridad y sostenibilidad ambiental. Indica que pese a lo dicho por el tutelado, dentro de las afectaciones causadas por la tormenta Nate no se encuentra la del dique señalado. Aclara que la intervención del dique no se encuentra dentro de algún plan de inversión presentado por alguna unidad ejecutora, por lo que no ha sido verificada por la comisión la existencia de un nexo de causalidad entre la emergencia declarada y la afectación a la infraestructura pública.Afirma que, por consiguiente, la comisión no tiene en este momento ninguna labor pendiente en este caso. Menciona que la Unidad de Investigación y Análisis de Riesgo de la Comisión elaboró el informe técnico No. CNE-UIAR-INF-0188-2019 de 6 de junio de 2019, donde se indicó lo siguiente: “(…) VI. Conclusiones. A. En la valoración visual el día de la visita no se evidenciaron daños estructurales en el dique. B. Es probable que los anegamientos de (sic) den por deficiencias en los sistemas de drenaje hacia el río Reventado de las aguas pluviales y servidas de las viviendas del Sector de Santa Cecilia. VII. Recomendaciones. A. Se debe dar parte la (sic) Municipalidad de Cartago y al MOPT (...) para que actué (sic) según su competencia y valoren la estructura y la necesidad de realizar obras de mejora de los drenajes del dique. B. Cualquier acción u obra de reparación al dique que se realice debe de contar con los estudios necesarios y bajo la supervisión de un profesional responsable.VIII. Alcances del informe. A. Este informe no sustituye los estudios técnicos necesarios y es válido únicamente con sello original de este departamento. No devenga ningún tipo de costo para los interesados serán ellos los responsables de dar trámite al mismo ante las instancias correspondientes. B. De conformidad a las resoluciones emitidas por la Sala Constitucional, con respecto a los criterios técnicos dados por funcionarios especializados de la CNE y de los Comités Asesores Técnicos, se aclara que las recomendaciones de éste (sic) informe son de carácter vinculante para las instituciones a quienes se dirigen (…)”. Agrega que con respecto a lo alegado por el recurrente, debe manifestarse el Consejo Nacional de Vialidad, conforme lo dispuesto en el ordinal 4° de la Ley No. 7798 y la Municipalidad de Cartago, según lo expuesto en el punto 3 “Potestades y Responsabilidades de los Gobiernos Locales en la Prevención de Riesgos Mediante el Ordenamiento Territorial”.
  7. 7Mediante resolución de las 15:02 hrs. de 22 de enero de 2020, el Magistrado Instructor dispone otorgar audiencia, sobre los hechos alegados, al Director Ejecutivo del Consejo Nacional de Vialidad. Adicionalmente, en tal resolución se señala expresamente lo siguiente: “(…) Para rendir el citado informe, deberá tomar en cuenta la autoridad recurrida que, tanto el Alcalde de Cartago como el Jefe de la Unidad de Asesoría Legal de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, informaron a esta Sala que al CONAVI le corresponde intervenir y atender la situación reclamada por el recurrente. Adicionalmente, deberá informar el director recurrido, de manera clara y precisa, lo siguiente:1) si el recurrente, otra persona vecina de la referida zona o bien, algún funcionario público, ha presentado ante el CONAVI una solicitud requiriendo su intervención para atender lo denunciado y, si es así, desde cuándo;2) si la institución que representa ha tenido conocimiento de lo dispuesto en los informes técnicos No. IAR-INF-0645-2018 de julio de 2018 y No. CNE- UIARINF- 0188-2019 de junio de 2019, elaborados por la Unidad de Investigación y Análisis de Riesgo de la Comisión de Prevención de Riesgos y Atención de Emergencias y, si es así, desde cuándo y3) si (en caso de tener conocimiento de la referida situación) se ha realizado alguna gestión para atender lo denunciado (explicar cuáles en caso de haberlas llevado a cabo). (...)”.
  8. 8Por resolución de las 15:04 hrs. de 22 de enero de 2020, el Magistrado Instructor solicita prueba para mejor resolver, conforme los siguientes términos: “(...) Revisados los autos y, como prueba para mejor resolver, se le solicita a EDUARDO MORA CASTRO, EN SU CONDICIÓN DE JEFE DE LA UNIDAD DE ASESORÍA LEGAL DE LA COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS, o a quien en su lugar ocupe dicho cargo, referirse a lo informado bajo juramento por Gerardo Alexis González Castro, en su condición de Jefe a.i. del Departamento de Previsión Vial del Ministerio de Obras Públicas y Transportes, en el sentido que, desde el 14 de noviembre de 2018, por oficio No. DVOP-DI-DV-PV-2018-2413, remitió al Jefe de la Unidad de Investigación y Análisis del Riesgo de la Comisión de Prevención de Riesgos y Atención de Emergencias (a través de correo electrónico) el oficio No. AS-INSP-050-2018 emitido por parte del Departamento de Construcción y Mejora de Obras de la Municipalidad de Cartago (donde se solicita autorización para sustituir una tubería de desfogue de aguas pluviales que atraviesa el dique del Río Reventado) y que, a la fecha, no se ha obtenido respuesta alguna.En ese particular, deberá indicar la referida autoridad si contestó dicho oficio y si es así, en qué fecha lo hizo. Asimismo, se le solicita a ROLANDO RODRIGUEZ BRENES, EN SU CONDICIÓN DE ALCALDE DE CARTAGO, o a quien en su lugar ocupe dicho cargo, informar a esta Sala si la corporación municipal que representa ha tenido conocimiento de lo dispuesto en los informes técnicos No. IAR-INF-0645-2018 de julio de 2018 y No. CNE-UIAR-INF-0188-2019 de junio de 2019, elaborados por la Unidad de Investigación y Análisis de Riesgo de la Comisión de Prevención de Riesgos y Atención de Emergencias y, si es así, desde cuándo (...)”.
  9. 9Mediante memorial aportado a la Sala el 31 de enero de 2020, Eduardo Mora Castro, en su condición de Jefe de la Unidad de Asesoría Legal de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, contesta la audiencia conferida por resolución de 22 de enero de 2020. Indica que tal y como consta en los documentos que se adjuntan, el señor Ignacio Chaves Salas, geólogo de la Unidad de Investigación y Análisis de Riesgo, a las 10:05 hrs., de 12 de junio de 2019, comunicó mediante correo electrónico a los destinatarios [email protected] (José Miguel Cordero Mata), Paula Sanabria Mena, [email protected], y a ana.sancho@,mopt.go.cr estos últimos funcionarios del departamento de revisión Vial del Ministerio de Obras Públicas y Transportes, el informe No. CNE-UIAR-INF-0188-2019 de 6 de junio de 2019, en el cual se hizo referencia al oficio No. DV0P-DI-DV-PV-2018-2413. Agrega que trimestralmente la Unidad de Investigación y Análisis del Riesgo comunica sus informes a cada una de las municipalidades.
  10. 10Por escrito aportado a la Sala el 3 de febrero de 2020, Rolando Rodríguez Brenes, en su condición de Alcalde de Cartago, contesta la audiencia conferida por resolución de 22 de enero de 2020 conforme lo señalado, a su vez, por la Encargada de la Oficina de Gestión del Riesgo y el Coordinador a.i. del Departamento de Construcción y Mejora de Obras. Señala que el municipio recurrido conoció el informe técnico No. IAR-INF-0645-2018 emitido por la Unidad de Investigación y Análisis del Riesgo. Dicho informe se analizó para emitir criterio mediante oficio No. 0GR-0F-075-2018/CM0-0F-117-2018 de 18 de octubre de 2018. Indica que igualmente conoció el informe técnico No. CNE- UIAR-INF-0188-2019 emitido por la citada unidad. Refiere que en las recomendaciones de este último informe se indicó la pertinencia de que tanto el MOPT como la municipalidad actuaran conforme sus competencias y se valorara la estructura y la necesidad de elaborar obras para mejorar los drenajes del dique.

Afirma que tal requerimiento continúa sujeto al criterio del MOPT, como entidad directamente responsable de la administración de las obras de mantenimiento de los diques.

  1. 11Por escrito aportado a la Sala el 7 de febrero de 2020, Mario Rodríguez Vargas, en su condición de Director Ejecutivo del Consejo Nacional de Vialidad, rinde informe. Señala que el tutelado no cuenta con informes técnicos que den soporte a sus afirmaciones. Refiere a las competencias asignadas por ley al CONAVI. Menciona lo señalado en el informe técnico No. IAR-INF-0645-2018. Apunta que desde ese momento la C.N.E. detectó incumplimientos serios respecto a la normativa atinente a la construcción que se puede llevar a cabo cerca de los márgenes de los ríos. Indica expresamente que: “(…) dichos incumplimientos a la hora en que se producen inundaciones provocan daños en las estructuras que han sido edificadas al margen de lo que establece la normativa. Lo cual a todas luces es una situación que se sale del ámbito de competencias de este Consejo. En ese orden queda claro que existió por parte de la Municipalidad un serio incumplimiento a la normativa respecto de la verificación de la documentación que debe de aportarse junto con una solicitud de permiso de construcción, ya que no sólo debe de tomar en consideración los requisitos que para estos efectos se soliciten en el Cantón para el otorgamiento de permisos de Construcción si no las normas atinentes al deber del Estado, de velar por la conservación, protección y administración de los recursos naturales.En este sentido de conformidad con el numeral 33 de la Ley Forestal, establece Áreas de protección Se declaran áreas de protección las siguientes: “(...) b) Una franja de quince metros en zona rural y de diez metros en zona urbana, medidas horizontalmente a ambos lados, en las riberas de los ríos, quebradas o arroyos, si el terreno es plano, y de cincuenta metros horizontales, si el terreno es quebrado (...)”. Apunta que se detectó que en los márgenes del río se encuentran edificaciones que no cumplen con la cantidad de metros de retiro que la normativa establece. Afirma que no solo existen incumplimientos de parte de la municipalidad a la hora de otorgar permisos constructivos, sino de los mismos pobladores de la zona. Aduce que la municipalidad recurrida omitió referirse en su respuesta a lo dicho por la C.N.E. respecto al manejo de las aguas servidas. En el informe técnico No. DVP-36-20- 0034 de 6 de febrero de 2020, la Gerencia de Contratación del CONAVI hizo referencia a los trabajos realizados en la zona, conforme los siguientes términos: “(...) Durante el año 2018, el Conavi, a través de la Gerencia de Conservación de Vías y Puentes, contrató los diseños y construyó las obras para proteger contra erosión (sic) los bastiones del puente citado (ruta de travesía No. 30107 sobre el río Reventado), según se muestra en la Figura No. 1.Esto atendiendo las recomendaciones generales emitidas por la Dirección de Puentes del MOPT, mediante su oficio No. DVOP-DP-2017-638 (11328) de fecha 10 de noviembre de 2017. De igual manera se atendió lo recomendado en el informe No. DG-18-51, “Estudio de Suelos, estabilidad de taludes, estudios hidrológicos e hidráulicos para la construcción de obras de retención y/o estabilización para la protección de los bastiones del puente sobre el río Reventado”, de fecha junio 2018 y elaborado por la empresa D'GEO. También se utilizaron levantamientos topográficos realizados en marzo y mayo de 2018. Además, mediante el informe Geointer Cot-18-096 de fecha 28 de junio de 2018, la empresa Geointer presentó a la Administración la oferta técnica-económica para tales obras, basada en los documentos citados. (...)”. Asimismo, en el oficio No. GCSV-78-2020-0545 de 6 de febrero de 2020, la Gerencia de Conservación estableció lo siguiente: “(...) Punto 1: Se informa que este Consejo atreves (sic) de la Gerencia de Conservación de Vías y Puentes, ha atendido dentro de sus alcances establecidos por ley, la situación de la afectación a la protección de los taludes del puente.En general las zonas del puente con mayor incidencia fue (sic) las protecciones de los márgenes del río, misma que se atiendo (sic), siguiendo las recomendaciones indicadas en el oficio DVOP-DP-2017-638(11328) de la Dirección de Puentes del MOPT (se adjunta). Tal como se muestra en las fotografías 1, 2, 3 y 4 dicha inervación consistió en la protección de los bastiones de ambas pilas mediante la elaboración de una escollera y la construcción de una estructura anclada, a fin de evitar la erosión del mismo. Las obras citadas comprendieron anclajes pasivos, geodrenes, elementos de concreto, entre otros; con el fin de proteger la estructura en el sector del puente citado y sus bases, para lo cual se realizó una inversión de €69.466.292,75 (sesenta y nueve millones, cuatrocientos sesenta y seis mil, doscientos noventa y dos colones con 75/100). Las obras de alcantarillas citadas instaladas por la Municipalidad de Cartago, no forman parte de los alcances de esta (sic) Consejo, siendo resorte exclusivo de la Municipalidad local (...)”.Afirma que el consejo recurrido, a través de la Gerencia de Conservación de Vías y Puentes, ha atendido, dentro de los alcances establecidos en la ley, la situación de la afectación de la protección de los taludes del puente. Se protegieron las márgenes del río, siguiendo las recomendaciones indicadas en el oficio No. DVOP- DP-2017-638 (11328), de la Dirección de Puentes del M.O.P.T.. Afirma que se realizaron obras de protección de los bastiones de ambas pilas mediante la elaboración de una escollera y la construcción de una estructura anclada a fin de evitar la erosión del mismo. Asevera que las obras de alcantarillas son de resorte exclusivo del municipio. Aduce que no es competencia del CONAVI realizar obras en los márgenes de los ríos. Las funciones del consejo se centran en dar mantenimiento a la red vial nacional, lo que incluye los puentes. Agrega expresamente que “(…) En este caso, la estructura del puente se vio comprometida por la tormenta Nate, y en razón de esto se realizó la correspondiente intervención del puente, y se procedió a llevar a cabo la estabilización de los bastiones de este y todas aquellas labores atinentes a proteger de los bastiones del puente sobre el río

Reventado. Debe entenderse que las obras efectuadas se realizaron en tiempo y forma por parte de mi representada, lo anterior con el objetivo de dar fiel cumplimiento a las funciones que por ley nos han sido encomendadas (...) mi representada cumplió a cabalidad con la intervención del puente conocido como Santa Marta que se encuentra ubicado sobre el Río Reventado, ya que las labores de estabilización de los bastiones se realizaron en tiempo y forma (...)”. Sostiene que el puente actualmente se encuentra en funcionamiento. El tránsito por dicha ruta no se encuentra interrumpida. Alega que el municipio recurrido no hizo referencia al problema de aguas residuales que existe en la zona. Tampoco aludió a los trabajos que realizará respecto a las edificaciones que incumplen lo dispuesto en el artículo 33, inciso b), de la Ley Forestal. Apunta que “(...) la labor de estabilización de los bastiones del puente como se aprecia del contenido de nuestra respuesta fue llevada a cabo y la transitabilidad de la zona no se ha visto interrumpida, situación que confirma la Municipalidad de Cartago, al decir que dicha estructura se encuentra en funcionamiento (...)”.

  1. 12En la substanciación del proceso se han observado las prescripciones de ley.

Redacta el Magistrado Araya García; y,

CONSIDERANDO:

I. OBJETO DEL RECURSO

El recurrente acusa que las autoridades recurridas no han realizado las obras que se requieren para encauzar correctamente las aguas que discurren por el dique que se ubica en Santa Cecilia de Guadalupe de Cartago, lo cual coloca en riesgo a los vecinos de dicha zona.

II. HECHOS PROBADOS

De relevancia para dirimir el presente recurso de amparo, se tienen por acreditados los siguientes:

  • 1)El 6 de septiembre de 2017, el entonces Diputado Mario Redondo Poveda le remitió al Alcalde de Cartago el oficio No. DMRP-220-17, en el cual señaló lo siguiente: “(…) hemos recibido varias quejas de vecinos y vecinas de la comunidad de Santa Cecilia de Guadalupe, con respecto a El Dique que se encuentra a 25 metros del puente de Santa Marta, en Guadalupe de Cartago. El problema que aquejan los vecinos de esta comunidad es que, en donde desembocan las aguas servidas y pluviales, por la presión y la cantidad de las mismas, han reventado la tubería, por lo cual se está lavando la tierra, generando graves problemas y un gran peligro, y, los gaviones que sostienen el puente, ya están cediendo y están en el cauce del río. Además, los peatones, para llegar al puente, tienen que pasar por un terreno que ya está lavado, quedando apenas un pedazo muy pequeño para transitar, lo cual pone en riesgo a todos los vecinos, en especial a los estudiantes que tienen que trasladarse hasta los centros educativos, a los adultos mayores y a las personas que tienen que trasladarse hasta sus trabajos. Adicionalmente, los vecinos indican que hace como dos o tres mees la municipalidad (sic) de Cartago envió unas vagonetas con tierra y basura, con lo cual rellenaron la tubería que está al descubierto; pero este relleno se volvió a lavar y sigue destruyendo la tubería (...).” (ver prueba).
  • 2)Durante el año 2018, el CONAVI, a través de la Gerencia de Conservación de Vías y Puentes, contrató los diseños y ejecutó las obras para proteger de la erosión los bastiones del puente denominado Santa Marta ubicado en la zona alegada por el recurrente. Específicamente se elaboró una escollera y una estructura anclada y, para tal efecto, se utilizaron geodrenes, elementos de concreto, entre otros. Dicha obra tuvo un costo de C69.466.292,75 colones (ver informe y prueba).
  • 3)En mayo de 2018, el tutelado, en su condición de Presidente del Comité de Obras Comunales de Santa Cecilia de Guadalupe de Cartago, le remitió una nota a un funcionario del Departamento de Obras y Alcantarillado Sanitario de la Municipalidad de Cartago en la que señaló expresamente lo siguiente: “(…) solicito (...) se realice una inspección de campo, en el sector de Santa Cecilia, 125 metros sur y 125 metros oeste, de Capilla Santa Cecilia, esto por cuanto hemos estado con problemas serios con las aguas pluviales, ya que en épocas de invierno se desbordan hacia las viviendas ubicadas en este sector, debido a que el sistema actual está colapsado, por el aumento de construcción de viviendas. Así mismo hacemos de su conocimiento que los vecinos estaríamos dispuestos a contribuir con la mano de obra para la colocación de cunetas de mayor diámetro (...)”. (ver prueba).
  • 4)Por oficio No. AS-INSP-17-2018 de 4 de junio de 2018, el citado funcionario del Departamento de Obras y Alcantarillado Sanitario de la Municipalidad de Cartago atendió la gestión planteada por el recurrente en mayo de 2018 conforme los siguientes términos: “(...) Me permito (...) referirme a expediente N. 7138 presentado por su persona sobre problemas con las aguas pluviales en el sector de Santa Cecilia (...) El día 02 del mes y año en curso a las 7:30 a.m. se realizó inspección en el lugar y se valoró la necesidad de mejorar el sistema pluvial. La Municipalidad está anuente a colaborar con los materiales y que los vecinos aporten la mano de obra para realizar los trabajos correspondientes (...)”. (ver prueba).
  • 5)La Unidad de Investigación y Análisis de Riesgo de la Comisión de Prevención de Riesgos y Atención de Emergencias, a solicitud del recurrente, emitió el informe técnico No. IAR-INF-0645-2018 de 31 de julio de 2018 denominado “Valoración de riesgo en un sector del Barrio Santa Cecilia por erosión del Río Reventado”, en el cual se señaló lo siguiente: “(...) V. Conclusiones. A. A la altura del puente de Santa Cecilia de Guadalupe, de forma paralela a la margen izquierda del río Reventado, se ubican una serie de grietas, que se extienden por 150 m a lo largo del cauce, cuya dirección coincide con el sector en donde se ha registrado erosión lateral del talud desde al (sic) año 2013. B. La comunidad que colinda al sur este del puente sobre el río Reventado se ubica sobre un talud de 5 m de altura, el cual está siendo sometido a erosión fluvial de manera progresiva y constante. De sostenerse y agravarse esa situación en el tiempo gran parte de dicho sector sería removido por acción del caudal, el riesgo de erosión es muy alto en dicho sector.

C. El área de estudio se ubica sobre espesor considerable de depósitos aluviales y de flujos de lodo provenientes de las erupciones del volcán Irazú. Los constantes trabajos de estabilización en las inmediaciones del puente cercano, dan fe de lo complicado que es alcanzar un equilibrio entre la integridad de las obras y el mantenimiento del perfil longitudinal del río en este tipo de materiales blandos. VI. Recomendaciones. A. Se recomienda llevar a cabo obras necesarias de protección y estabilización del talud de la margen izquierda aguas abajo del puente de Santa Cecilia, con el fin de reducir el impacto que la erosión lateral fluvial está generando sobre las viviendas existentes y sobre el acceso a las mismas. Se recuerda que todas las obras que vayan a realizarse en cauces de dominio público deben contar con los permisos tanto municipales como de la Dirección de Agua del MINAE. B. Se le recuerda a la Municipalidad de Cartago que los permisos de construcción deben prohibirse en las zonas de protección de los cuerpos de agua, sean estos intermitentes o permanentes; además que en la delimitación de dichas zonas debería imperar un criterio hidrológico-geomorfológico por parte del profesional correspondiente.

C. Cualquier obra que se realice debe ser supervisada por un profesional capacitado. D. Cualquier anomalía en cuanto a la omisión a las recomendaciones aquí descritas, QUEDA BAJO TOTAL RESPONSABILIDAD de los encargados de realizar las obras y de la Municipalidad respectiva de no solicitar los informes, inspecciones y correcciones correspondientes (...)”. (ver prueba).

  • 6)En octubre de 2018, por oficio No. AS-INSP-050-2018, autoridades del Departamento de Construcción y Mejora de Obras de la Municipalidad de Cartago presentaron ante el Departamento de Previsión Vial del Ministerio de Obras Públicas y Transportes autorización para colocar una tubería en el área del dique para desfogar aguas pluviales hacia el Río Reventado, específicamente en el sector de Santa Cecilia de Guadalupe de Cartago. En dicho oficio se indicó expresamente lo siguiente: “(...) siguiendo instrucciones expresas de la Dirección de Operaciones de esta Municipalidad de Cartago en virtud de solicitud de los vecinos del sector el dique Santa Marta para intervención en tubería pluvial colapsada que sirve al desfogue de aguas Barrio Santa Cecilia (...) y que atraviesa el dique del Río Reventado, se solicita la valoración previa de las Dependencias competentes de la Administración del Dique por parte del MOPTpara la emisión del respectivo criterio y/o los requisitos para la obtención de la autorización administrativa y legal correspondiente para que esta Municipalidad pueda ejecutar la sustitución de tubería que se nos solicita por parte de los vecinos (...)”. (ver informe y prueba).
  • 7)Mediante oficio No. OGR-OF-075-2018/CMO-OF-117-2018 de 18 de octubre de 2018, autoridades de la Municipalidad de Cartago conocieron lo dispuesto en el informe técnico No. IAR-INF-0645-2018. En tal oficio, dirigido al Alcalde de Cartago, se indicó, expresamente lo siguiente: “(...) En atención del Oficio de su despacho (...) de 04 de octubre del presente año, mediante el cual nos refiere acuerdo del Concejo Municipal (...) referente a moción para que se le solicite a la administración proceda a realizar los estudios que corresponden al Dique Santa Cecilia del Distrito de Guadalupe por la erosión que se presenta en el lugar, misma que fue aprobada por unanimidad; nos permitimos indicarle lo siguiente: (...) 3. Tal y como se cita en el acuerdo del Concejo Municipal en sesión ordinaria del 25 de setiembre del 2018 (Acta NO.187-2018-ArtículoN0 XXXIV) (sic), el Informe Técnico IAR-INF-0645-2018 emitido por la Geóloga Ana Enid Vargas Carranza de la Unidad de Investigación y Análisis del Riesgo CNE (...) ya contiene los resultados de la valoración realizada el 11 de junio del presente año, por solicitud del Sr. José Miguel Cordero Mata; quien hizo la solicitud (...) 4.

En el apartado “VII. Alcances” del informe IAR-INF-0645-2018, los autores señalan claramente que los criterios técnicos dados por los funcionarios especializados de la CNE y de los Comités Asesores Técnicos son de carácter vinculante para las instituciones a quienes se dirigen (...) 5. Considerando el punto anterior y además que el punto B. del apartado “VI. Recomendaciones” del Informe IAR- INF-0645-2018 está dirigido a la Municipalidad de Cartago, se debe asumir el criterio profesional expresado en dicho informe como vigente y definitivo, no dando oportunidad a la Municipalidad de Cartago de emitir un criterio que lo contradiga, lo amplíe, lo modifique o lo anule, ni siquiera que lo confirme; menos aún como ya se dijo, si la Municipalidad de Cartago no cuenta con un profesional en el área de geología que pueda referirse técnicamente al análisis ya realizado. 6. Los estudios técnicos a los que se refiere el punto A. del apartado “VI.

Recomendaciones” del Informe IAR-INF-0645-2018, no se refieren a otras valoraciones de riesgo, sino a estudios técnicos requeridos para la propuesta y ejecución de proyectos de infraestructura (obras de protección y estabilización de taludes), que en este caso dependen de la viabilidad legal, presupuestaria y operativa de dichos proyectos. De lo contrario; la inversión que implique la realización de dichos estudios podría ser infructuosa. 7. Por tanto y en lo que hace a la viabilidad legal, los puntos 1 y 2 del Considerando del Decreto NO. 22834 MIVAH-MOPT (25 de enero de 1994) vigente a la fecha, explica que los terrenos dentro de una zona de 1 km de ancho a cada margen del Río Reventado desde su nacimiento hasta el puente que comunica Tejar con Tobosi, están afectados por la Ley NO. 34596 (26 de noviembre de 1964), que los declara reserva nacional. El acuerdo del Concejo Municipal Artículo NO. XXXIV-Acta NO. 187-2018 (25 de setiembre del 2018), en su punto 3 hace referencia a que el Informe IAR-INFO-0645- 2018 indica que el Dique Santa Cecilia se encuentra dentro del mapa de amenazas donde se depositaron aluviales y flujos de lodos provenientes de las erupciones del Volcán Irazú de la década de 1960, evento que precisamente constituye la justificación para que el Decreto NO. 22834 MIVAH-MOPT defina como propósito esencial de los “Diques de Cartago” la salvaguarda de la vida, la salud y la hacienda de personas.

No menciona el decreto que dentro del propósito de los diques se consideró siquiera la posibilidad de la construcción de viviendas, ni la protección del asentamiento humano ilegítimo, precisamente porque tales obras de defensa nunca eliminaron la condición de riesgo, sólo pretendieron mitigarla con una moderación de la vulnerabilidad. Desde el punto 4 hasta el 9 del Considerando del decreto demuestran que la condición de riesgo que el Honorable Concejo Municipal requiere valorar, existe desde antes de la aprobación del decreto en 1994 y que la Comisión Nacional de Emergencias sólo vino a ratificar 24 años después, mediante el apartado “IV Análisis general de la amenaza y vulnerabilidad” de su informe IAR-INF-0645-2018, describiendo la evolución de su deterioro, debido, según el decreto, a la invasión de los predios declarados reserva nacional, que son propiedad del Estado, poniendo en grave peligro la vida de las personas que se han asentado ahí de modo ilegítimo (...) 11 (...) según expresa el acuerdo del Concejo Municipal Artículo NO. XXXIV-Acta NO. 187-2018 en su punto 2, los vecinos del lugar manifiestan que hace algunos años existía alrededor de 10 metros de distancia desde sus casas al cauce y que actualmente haya sectores donde la distancia ronda los 3 metros del talud erosionado, ocasionando que los vecinos ya no puedan ingresar en vehículo a sus viviendas, se concluye que los vecinos del Dique Santa Cecilia que manifiestan encontrarse en esa situación, si siquiera (sic) hace algunos años se encontraban a derecho respecto a los retiros establecidos para la margen izquierda en el Sector 2-Zona 2. 12.

Cabe señalar aquí, en que el sector nunca ha existido ninguna calle pública, sino que los ocupantes del dique utilizaron, una vez más ilegítimamente, la corona del dique para el tránsito vehicular, promoviendo con ello la circulación de todo tipo de vehículos y aún de carga pesada, acelerando con ello la erosión y deterioro de la matriz de finos arenas y de gruesos de piedra bruta que constituyen los apilamientos de materiales fluviales denominados como diques, los cuales ergo decirlo son solo con fines de barreas naturales de protección. Cuando el decreto menciona el derecho de vía no se refiere sobre la corona del dique, sino a partir del pie externo (...)”. (ver prueba).

  • 8)El 14 de noviembre de 2018, el ingeniero González Castro del Departamento de Previsión Vial del Ministerio de Obras Públicas y Transportes le remitió al Jefe de la Unidad de Investigación y Análisis del Riesgo de la Comisión de Prevención de Riesgos y Atención de Emergencias, el oficio No. DVOP-DI- DV-PV-2018-2413, donde se le indicó expresamente lo siguiente: “(...) Por ser de su competencia como ente encargado de las labores preventivas de situaciones de riesgo y atención de emergencia, se remite oficio AS-INSP-050- 2018 emitido por parte del Departamento de Construcción y Mejora de Obras, de la Municipalidad de Cartago, donde se solicita autorización para sustituir una tubería de desfogue de aguas pluviales que atraviesa el dique del Río Reventado por una de diámetro mayor (...)”. (ver informe y prueba).
  • 9)El 11 de febrero de 2019, las autoridades del Departamento de Previsión Vial del Ministerio de Obras Públicas y Transporte le remitieron al funcionario del Departamento de Obras y Alcantarillado Sanitario de la Municipalidad de Cartago el oficio No. DVOP-DI-DV-PV-2018-2412, mediante el cual se atendió lo requerido por oficio No. AS-INSP-050-2018 y se indicó lo siguiente: “(...) Al respecto se informa que funcionarios de este departamento realizaron estudios a los documentos presentados y se determinó: -Para la intervención del dique mencionado, se deberá solicitar la autorización respectiva ante la Comisión Nacional de Emergencias, por lo cual el presente Departamento, procederá a realizar la consulta respectiva a dicha institución de la cual se les estará enviando copia. Por otra parte, para la valoración adecuada de las obras a realizar, se requieren planos constructivos firmados por un profesional responsable, donde se incluya (...) y todos los demás detalles para tener con claridad las obras a realizar (...)”. (ver informe y prueba).
  • 10)Las autoridades de la Municipalidad de Cartago no atendieron lo dispuesto por el Departamento de Previsión Vial del Ministerio de Obras Públicas y Transporte en el oficio No. DVOP-DI-DV-PV-2018-2412 (ver informe).
  • 11)La Unidad de Investigación y Análisis de Riesgo de la Comisión de Prevención de Riesgos y Atención de Emergencias -a solicitud del recurrente y, en virtud de lo dispuesto en el oficio No. DVOP-DI-DV-PV-2018-2413 por el Ministerio de Obras Públicas y Transportes-, emitió el informe técnico No. CNE-UIAR- INF-0188-2019 de 6 de junio de 2019 denominado “Valoración de riesgo en sector de Santa Cecilia por daños en el dique del río Reventado”, donde se indicó lo siguiente: “(...) VI. Conclusiones. A. En la valoración visual el día de la visita no se evidenciaron daños estructurales en el dique. B. Es probable que los anegamientos de (sic) den por deficiencias en los sistemas de drenaje hacia el río Reventado de las aguas pluviales y servidas de las viviendas del Sector de Santa Cecilia. VII. Recomendaciones. A. Se debe dar parte la (sic) Municipalidad de Cartago y al MOPT (...) para que actué (sic) según su competencia y valoren la estructura y la necesidad de realizar obras de mejora de los drenajes del dique.

B. Cualquier acción u obra de reparación al dique que se realice debe de contar los estudios necesarios y bajo la supervisión de un profesional responsable. VIII. Alcances del informe. A. Este informe no sustituye los estudios técnicos necesarios y es válido únicamente con sello original de este departamento. No devenga ningún tipo de costo para los interesados serán ellos los responsables de dar trámite al mismo ante las instancias correspondientes. B. De conformidad a las resoluciones emitidas por la Sala Constitucional, con respecto a los criterios técnicos dados por funcionarios especializados de la CNE y de los Comités Asesores Técnicos, se aclara que las recomendaciones de éste (sic) informe son de carácter vinculante para las instituciones a quienes se dirigen (...)”. (ver prueba).

  • 12)En fecha no precisa, las autoridades municipales recurridas tuvieron conocimiento de lo dispuesto en el informe técnico No. CNE-UIAR-INF-0188-2019 (ver informe).
  • 13)El 12 de junio de 2019, Ignacio Chaves Salas, geólogo de la Unidad de Investigación y Análisis de Riesgo de la Comisión de Prevención de Riesgos y Atención de Emergencias, remitió, vía correo electrónico, a funcionarios del Departamento de Previsión Vial del Ministerio de Obras Públicas y Transportes, el informe No. CNE-UIAR-INF-0188-2019 de 6 de junio de 2019, en el cual se hizo referencia al oficio No. DVOP-DI-DV-PV-2018-2413 (ver informe).
  • 14)El 13 de enero de 2020, el recurrente interpuso el presente amparo (ver escrito de interposición).
  • 15)Los vecinos de la zona de Santa Cecilia de Guadalupe de Cartago corren actualmente peligro, ante la ausencia de obras para mitigar los problemas que sufren con el discurrir irregular de las aguas (hecho incontrovertido).

III. SOBRE LA OBLIGACIÓN OBJETIVA DEL ESTADO DE TUTELAR LA VIDA HUMANA

En cuanto a este extremo, esta Sala, en la Sentencia No. 2003-011519 de las 10:30 hrs. del 10 de octubre de 2003, indicó lo siguiente:

“(…) Ha sido usual que el derecho a la vida, frecuentemente analizado conjuntamente con el derecho a la integridad física, haya sido entendido como un derecho de contenido negativo, es decir, su objeto se limitaba a la pretensión contra el Estado de que (sic) se abstuviera de realizar acciones dirigidas a eliminar la existencia física de las personas, por ejemplo la tortura o la pena de muerte, o bien que castigara a las personas, públicas y privadas, que atentaran contra la vida e integridad de los otros, a través del sistema penal; sin embargo, la tendencia actual es imponer al Estado diversas conductas positivas, en el sentido de que (sic) más allá de que (sic) no debe perturbar la existencia física de las personas debe actuar en tutela de su protección, ante los múltiples peligros que la acechan, bien sea que ellos provengan de acciones del Estado mismo o de otras personas, e inclusive, de la misma naturaleza.

De ahí que, por ejemplo, los temas ambientales han pasado a ser, al menos en nuestro país, un asunto de índole constitucional, puesto que el derecho a un ambiente sano y ecológicamente equilibrado fue elevado a rango de derecho fundamental. Ahora bien, es menester aclarar que la existencia objetiva de una obligación del Estado en lo referente a la protección del derecho a la vida no apareja, ineludiblemente, un derecho subjetivo de las personas a exigir, a través de los organismos judiciales, que se tome una medida determinada, pero sí a que se tomen las medidas idóneas en tutela de ese derecho, ante actitudes abiertamente negligentes de las autoridades públicas. Se trata así de que (sic) el Estado adquiere la obligación de regular las áreas de la vida social de las cuales puedan surgir peligros para la existencia física de los habitantes de su territorio, ya sea través de la ley, de reglamentos, de acuerdos o de otras medidas relacionadas con la organización y los procedimientos administrativos, y del derecho subjetivo de las personas a que así se proceda, en forma diligente.

En consecuencia, la posibilidad de exigir judicialmente, a través del recurso de amparo, un tipo específico de actividad prestacional por parte del Estado en cumplimiento de su deber de protección a la vida e integridad física de sus habitantes, es restringida a la clara verificación de un peligro inminente contra esos derechos de las personas, de forma tal que si por ejemplo, una determinada comunidad estimara necesario contar con un hospital para la atención de sus pobladores (o de cualquier otra obra pública), no es por la vía del amparo que se debe exigir sino a través de los mecanismos previamente establecidos y ante los órganos y entes competentes, quienes deberán atender la petición y resolver su procedencia técnica, que no implica necesariamente una respuesta positiva. De lo que se desprende que la injerencia de la jurisdicción constitucional solamente es viable ante la inercia comprobada del Estado, a través de sus órganos competentes, en atender las demandas que en ejercicio de sus derechos realicen los habitantes del país (...)”.

IV. CASO CONCRETO

Revisado lo informado bajo juramento por las autoridades recurridas, así como las pruebas aportadas a los autos, este Tribunal Constitucional observa que ciertamente, tal y como lo alega el tutelado, existe actualmente un grave problema en Santa Cecilia de Guadalupe de Cartago, en el tanto las aguas discurren en dicha zona de manera irregular (por el colapso de la tubería que atraviesa el dique), lo que ha generado desbordamientos, grietas, y erosión de tipo fluvial y, por ende, ha colocado en peligro a las personas que ahí habitan.

Lo anterior se desprende, con meridiana claridad, a partir de los informes técnicos elaborados por la Unidad de Investigación y Análisis del Riesgo de la Comisión de Prevención de Riesgos y Atención de Emergencias, luego de haberse efectuado inspecciones en el mencionado sector. En ese particular, en el informe No. IAR-INF-0645-2018 de 31 de julio de 2018 denominado “ Valoración de riesgo en un sector del Barrio Santa Cecilia por erosión del Río Reventado”, la citada unidad señaló lo siguiente:

“(…) V. Conclusiones. A. A la altura del puente de Santa Cecilia de Guadalupe, de forma paralela a la margen izquierda del río Reventado, se ubican una serie de grietas, que se extienden por 150 m a lo largo del cauce, cuya dirección coincide con el sector en donde se ha registrado erosión lateral del talud desde al (sic) año 2013. B. La comunidad que colinda al sur este del puente sobre el río Reventado se ubica sobre un talud de 5 m de altura, el cual está siendo sometido a erosión fluvial de manera progresiva y constante. De sostenerse u agravarse esa situación en el tiempo gran parte de dicho sector sería removido por acción del caudal, el riesgo de erosión es muy alto en dicho sector. C. El área de estudio se ubica sobre espesor considerable de depósitos aluviales y de flujos de lodo provenientes de las erupciones del volcán Irazú. Los constantes trabajos de estabilización en las inmediaciones del puente cercano, dan fe de lo complicado que es alcanzar un equilibrio entre la integridad de las obras y el mantenimiento del perfil longitudinal del río en este tipo de materiales blandos.

VI. Recomendaciones. A. Se recomienda llevar a cabo obras necesarias de protección y estabilización del talud de la margen izquierda aguas abajo del puente de Santa Cecilia, con el fin de reducir el impacto que la erosión lateral fluvial está generando sobre las viviendas existentes y sobre el acceso a las mismas. Se recuerda que todas las obras que vayan a realizarse en cauces de dominio público deben contar con los permisos tanto municipales como de la Dirección de Agua del MINAE. B. Se le recuerda a la Municipalidad de Cartago que los permisos de construcción deben prohibirse en las zonas de protección de los cuerpos de agua, sean estos intermitentes o permanentes; además que en la delimitación de dichas zonas debería imperar un criterio hidrológico- geomorfológico por parte del profesional correspondiente. C. Cualquier obra que se realice debe ser supervisada por un profesional capacitado.

D. Cualquier anomalía en cuanto a la omisión a las recomendaciones aquí descritas, QUEDA BAJO TOTAL RESPONSABILIDAD de los encargados de realizar las obras y de la Municipalidad respectiva de no solicitar los informes, inspecciones y correcciones correspondientes (...)” (El destacado no forma parte del original).

Igualmente, de manera más reciente, en el informe técnico No. CNE-UIAR- INF-0188-2019 de 6 de junio de 2019 denominado “ Valoración de riesgo en sector de Santa Cecilia por daños en el dique del río Reventado”, la referida unidad señaló expresamente lo siguiente:

“(…) VI. Conclusiones. A. En la valoración visual el día de la visita no se evidenciaron daños estructurales en el dique. B. Es probable que los anegamientos de (sic) den por deficiencias en los sistemas de drenaje hacia el río Reventado de las aguas pluviales y servidas de las viviendas del Sector de Santa Cecilia. VII. Recomendaciones. A. Se debe dar parte la (sic) Municipalidad de Cartago y al MOPT (...) para que actué (sic) según su competencia y valoren la estructura y la necesidad de realizar obras de mejora de los drenajes del dique. B. Cualquier acción u obra de reparación al dique que se realice debe de contar los estudios necesarios y bajo la supervisión de un profesional responsable. VIII. Alcances del informe. A. Este informe no sustituye los estudios técnicos necesarios y es válido únicamente con sello original de este departamento. No devenga ningún tipo de costo para los interesados serán ellos los responsables de dar trámite al mismo ante las instancias correspondientes. B. De conformidad a las resoluciones emitidas por la Sala Constitucional, con respecto a los criterios técnicos dados por funcionarios especializados de la CNE y de los Comités Asesores Técnicos, se aclara que las recomendaciones de éste (sic) informe son de carácter vinculante para las instituciones a quienes se dirigen (...)”. (El destacado no forma parte del original).

Asimismo, es importante destacar que la situación supra descrita ha sido reconocida igualmente por la Municipalidad de Cartago. Así, en el oficio No. AS- INSP-17-2018 de 4 de junio de 2018, un funcionario del Departamento de Obras y Alcantarillado Sanitario de la Municipalidad de Cartago -en virtud de una solicitud planteada por el recurrente para que se atendiera el tema del desbordamiento de aguas ante el colapso sufrido en el sistema de recolección de estas-, reconoció la necesidad de intervenir el sistema pluvial y proceder con la sustitución de la tubería, luego de haber llevado a cabo una inspección en la zona. Por su parte, en el oficio No. 0GR-0F-075-2018/CM0-0F-117-2018 de 18 de octubre de 2018, el referido municipio, al pronunciarse sobre lo señalado en el ya citado informe técnico No. IAR-INF-0645-2018, hizo alusión a la condición de riesgo que persiste en el sector aludido y al peligro que corren los pobladores de este último.

Igualmente, esta Sala ha tenido por demostrado, a partir del análisis efectuado, que, a la fecha, no se han realizado todas las obras que son necesarias para hacer frente a la situación expuesta, lo cual, sin duda alguna, hace que se violenten los derechos fundamentales de los vecinos de la referida zona de la provincia de Cartago.

Ahora bien, frente a tal estado de cosas, a esta jurisdicción constitucional le corresponde valorar particularmente si las autoridades recurridas (Municipalidad de Cartago, M.O.P.T., CONAVI y C.N.E.), las que conocen plenamente la situación expuesta, han realizado las gestiones pertinentes, dentro del ámbito de sus competencias, para afrontarla adecuadamente y si, en virtud de esto, el amparo merece ser acogido o no en su contra. Dicho análisis, se procede a realizar bajo el siguiente orden de consideraciones:

A. Municipalidad de Cartago. Con respecto a esta corporación, esta Sala estima que el amparo merece ser acogido por lo que se explicará a continuación.

Nótese que, según se logra colegir del elenco de hechos probados, la problemática bajo estudio fue expuesta por el entonces Diputado Mario Redondo Poveda ante el referido municipio el 6 de septiembre de 2017, así como por el recurrente, en su condición de Presidente del Comité de Obras Comunales de Santa Cecilia de Guadalupe de Cartago, en el mes de mayo de 2018. Asimismo, se tiene por demostrado que las referidas autoridades municipales conocían plenamente lo señalado por la Unidad de Investigación y Análisis del Riesgo de la Comisión de Prevención de Riesgos y Atención de Emergencias en los supra citados oficios técnicos No. IAR-INF-0645-2018 de 31 de julio de 2018 y No. CNE-UIAR-INF- 2019 de 6 de junio de 2019. Tan es así que en el oficio No. OGR-OF-075- 2018/CMO-OF-117-2018 de 18 de octubre de 2018, el municipio hizo referencia al primero de tales informes técnicos y afirmó que el criterio profesional expuesto en este debía ser asumido por dicha corporación como vigente y definitivo y, por consiguiente, no podía ser contradicho, ampliado, modificado o anulado de ninguna manera. Asimismo, en tal ocasión, se hizo referencia -tal y como se dijo arriba- a la situación de riesgo y peligro que corren las personas que habitan cerca del Dique Santa Cecilia.

Pese al estado de cosas anterior, este Tribunal Constitucional tiene por demostrado que la corporación municipal recurrida se limitó a realizar únicamente dos actuaciones: 1) a contestar la gestión planteada por el recurrente en mayo de 2018 indicándole, por oficio No. AS-INSP-17-2018 de 4 de junio de 2018, que, en virtud de una inspección realizada en el sector de Santa Cecilia, efectivamente se había determinado la necesidad de mejorar el sistema pluvial y 2) a solicitar ante el Departamento de Previsión Vial del Ministerio de Obras Públicas y Transportes, en el mes de octubre de 2018, una autorización para colocar una tubería en el área del dique para desfogar aguas pluviales hacia el Río Reventado. Obras anteriores que, sin embargo, según igualmente se logró acreditar, no fueron ni siquiera iniciadas por el citado municipio, habida cuenta que se omitió cumplir la prevención realizada al respecto en febrero de 2019 por el MOPT mediante oficio DVOP-DI- DV-PV-2018-2412 (a efecto que se aportaran unos planos constructivos firmados por un profesional responsable).

De este modo, resulta claro que, pese a que las autoridades de tal municipio tienen pleno conocimiento, desde hace varios años, de la situación alegada, no han realizado las gestiones necesarias para solventarla de manera contundente.

Dicha desidia y omisión no puede ser justificada ahora -tal y como pretende el alcalde recurrido-, atribuyéndole toda la responsabilidad y competencia a las autoridades del Ministerio de Obras Públicas y Transportes, cuando es claro que un problema por el discurrir irregular de las aguas y la forma en que se han asentado algunos pobladores en el sitio bajo estudio (que, al parecer, ha sido irregular), es también un asunto que debe ser atendido por los municipios de este país, tal y como se señaló expresamente en los informes técnicos elaborados por la Unidad de Investigación y Análisis de Riesgo de la Comisión de Prevención de Riesgos y Atención de Emergencias. Incluso, nótese que curiosamente y, en virtud precisamente de esa competencia asignada, es que la Municipalidad de Cartago, en el año 2018, pretendió ejecutar unas obras para colocar tuberías en el área del dique con el fin, a su vez, de llevar a cabo un adecuado desfogue de las aguas pluviales. Obras que sin embargo, según igualmente se dijo, quedaron en el olvido desde hace muchos meses, dejando con esto en estado latente de peligro a los habitantes de la referida zona de Santa Cecilia de Guadalupe de Cartago.

Así las cosas, este órgano constitucional estima que las autoridades de la Municipalidad de Cartago han vulnerado los derechos fundamentales de los vecinos del mencionado sector de la provincia de Cartago.

B. Ministerio de Obras Públicas y Transportes (Departamento de Previsión Vial). Con respecto a este Departamento en específico, este Tribunal no considera que exista mérito para acoger el amparo. Nótese que, según se informó bajo la solemnidad del juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta jurisdicción, a dicho departamento únicamente le corresponde, en lo que tocante a la situación bajo estudio, dar alineamientos de construcción respecto al dique y aprobar las solicitudes de desfogue pluvial o sanitario en dicha área. En virtud de esto, se acreditó que tales autoridades, ante la autorización requerida por la Municipalidad de Cartago en octubre de 2018 para colocar una tubería en el área del dique para desfogar aguas pluviales hacia el Río Reventado, específicamente en el sector de Santa Cecilia de Guadalupe de Cartago, realizaron varias gestiones según el ámbito de sus competencias.

En ese particular, consta que procedieron a solicitar en noviembre de 2018 autorización a la Comisión de Prevención de Riesgos y Atención de Emergencias para ejecutar las citadas obras (la cual, según se explicará infra, fue efectivamente atendida) y, a su vez, en febrero de 2019, previnieron a las autoridades municipales a efecto que aportaran -como requisito previo para resolver la mencionada solicitud-, planos constructivos firmados por un profesional responsable. Se tiene igualmente por demostrado que esta última gestión, sin embargo, no ha sido, a la fecha, atendida por las autoridades de la municipalidad recurrida, con lo cual le ha sido imposible al Departamento de Previsión Vial del ministerio recurrido continuar con la tramitación y resolución de la solicitud originalmente planteada.

Bajo tal estado de cosas, esta jurisdicción no observa que las autoridades del citado departamento hayan sido omisas en cumplir las obligaciones que, con respecto a la situación alegada, le corresponden. Por el contrario, según se pudo demostrar, estas han realizado las gestiones pertinentes para llevar a cabo las obras que se requieren para la colocación de una tubería en el área del dique y así proceder con el desfogue adecuado de las aguas pluviales. Si a la fecha tales trabajos no se han ejecutado, esto no puede serle imputable a las mencionadas autoridades del Ministerio de Obras Públicas y Transportes, sino, tal y como se explicó líneas arriba, a las autoridades municipales recurridas.

C. Consejo Nacional de Vialidad. Revisados los autos, esta jurisdicción no estima que las autoridades del CONAVI hayan sido omisas en cumplir sus deberes con respecto a este caso en concreto. Lo anterior por cuanto se tuvo por demostrado que, desde el año 2018 -muchos meses previos a la formulación de este amparo-, las referidas autoridades, en atención al ámbito de las competencias que le fueron asignadas en lo que respecta a la atención de las vías nacionales de este país (lo cual incluye a los puentes), procedieron a realizar una serie de actuaciones para hacer frente a la erosión fluvial que se halló en la zona reclamada por el recurrente y, sobre la cual, a su vez, se hace referencia en el informe técnico No. IAR-INF-0645-2018 de julio de 2018 elaborado por la Unidad de Investigación y Análisis del Riesgo de la Comisión de Prevención de Riesgos y Atención de Emergencias.

En ese particular, nótese que, según se informó bajo juramento, el CONAVI, a través de la Gerencia de Conservación de Vías y Puentes, contrató los diseños y ejecutó una serie de obras para proteger de la erosión los bastiones del puente ubicado en el sector bajo estudio. Consta específicamente que se elaboró una escollera y una estructura anclada, para lo cual se utilizaron geodrenes, elementos de concreto, entre otros y se invirtió un monto de C69.466.292,75 colones.

Así las cosas, el presente amparo merece ser desestimado en lo que a esta autoridad se refiere.

D. Comisión de Prevención de Riesgos y Atención de Emergencias. Con respecto a esta última institución esta Sala estima que el amparo merece ser igualmente desestimado. Lo anterior, toda vez que consta en autos que las autoridades de la citada comisión han realizado varias actuaciones, cuando así se les ha requerido, con respecto a la problemática sufrida por los vecinos del sector de Santa Cecilia de Guadalupe de Cartago.

De modo particular, consta que han atendido las dos solicitudes formuladas por el tutelado, a través de las cuales se les requirió llevar a cabo inspecciones en el mencionado sitio y emitir un criterio técnico sobre la situación acaecida. Según se logró colegir con claridad, estas últimas actuaciones se tradujeron efectivamente en la emisión de los informes técnicos No. IAR-INF-0645-2018 y No. CNE-UIAR- INF-0188-2019 ampliamente referidos en este proceso, los que, a su vez, han servido de esencial insumo para exponer los problemas que actualmente afrontan los vecinos de la mencionada localidad.

Asimismo, es importante tomar en cuenta que se tiene por demostrado -según lo informado bajo juramento-, que las referidas autoridades de la Comisión de Prevención de Riesgos y Atención de Emergencias, desde el mes de junio de 2019, atendieron la gestión planteada por el Departamento de Previsión Vial del Ministerio de Obras Públicas y Transportes y, en ese particular, emitieron su criterio con respecto a la sustitución de la tubería que atraviesa el dique ubicado en el Río Reventado.

Así las cosas, no observa este órgano constitucional que las referidas autoridades hayan cometido alguna actuación que atentara contra los derechos fundamentales del recurrente y del resto de vecinos de la localidad de Santa Cecilia de Guadalupe de Cartago.

V.NOTA PARA LAS AUTORIDADES DEL CONAVI, DEL M.O.P.T. Y DE LA C.N.E. Pese a lo señalado en el considerando anterior con respecto a dichas autoridades, resulta menester recordarles a estas su deber de continuar llevando a cabo todas aquellas actuaciones que sean necesarias (cuando así sea pertinente) y que se encuentren dentro del ámbito de sus competencias, a efecto de garantizar y proteger los derechos fundamentales del recurrente y de los vecinos de la zona bajo estudio.

VI. COROLARIO

En mérito de lo expuesto, se impone acoger parcialmente el recurso planteado, con las consecuencias que se detallarán en la parte dispositiva de la presente sentencia.

VII. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusa que la autoridad recurrida no ha realizado las obras que se requieren para encauzar correctamente las aguas que discurren por el dique que se ubica en Santa Cecilia de Guadalupe de Cartago, lo que provoca un peligro para la salud del recurrente y su familias, una amenaza al derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.

VIII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.

POR TANTO:

Se declara parcialmente con lugar el recurso, únicamente, contra la Municipalidad de Cartago. En consecuencia, se le ordena a Rolando Rodríguez Brenes, o a quien en su lugar ocupe el cargo de Alcalde de Cartago, girar las órdenes pertinentes y coordinar todo lo que sea necesario con las instituciones públicas que sean competentes para que, dentro del plazo máximo de CUATRO MESES, contado a partir de la notificación de esta sentencia, se lleven a cabo todas aquellas obras de mejora en los drenajes del dique ubicado en Santa Cecilia de Guadalupe de Cartago, de manera tal que las aguas que por ahí discurren no pongan en peligro a los vecinos de la zona. Lo anterior se dicta con la advertencia que, de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá pena de prisión de tres meses a dos años o de veinte a sesenta día multa a quien reciba una orden de esta Sala que deba cumplir o hacer cumplir y la inobserve, siempre que el delito no esté más gravemente penado.

Se condena a la Municipalidad de Cartago al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese este pronunciamiento a Rolando Rodríguez Brenes, o a quien en su lugar ocupe el cargo de Alcalde de Cartago, en forma personal. El Magistrado Salazar Alvarado pone nota. Tomen nota las autoridades recurridas del CONAVI, del M.O.P.T. y de la C.N.E. de lo señalado en el considerando V de la presente sentencia.
