Amparo action (recurso de amparo) processed under case number 20-000640-0007-CO, filed by WÁLTER BRENES SOTO, identity card 0206450800, against the MINISTERIO DE SALUD.
Background:
Justice Rueda Leal drafts the decision; and,
Whereas:
I.Subject matter of the action. The petitioner considers that his fundamental rights have been violated because, he alleges, he has filed several complaints regarding sewage contamination and they have not been addressed.
II.Proven facts. The following facts are deemed duly established and relevant to the resolution of this matter, either because they have been proven or because the respondent failed to address them as required by the initial order:
III.Merits. The evidence submitted in the record establishes that on 21 de enero de 2019, the petitioner sent a complaint to the email address [email protected] regarding sewage contamination in the stream located between Hotel Don Jon and Café Swart in the locality of Santa Teresa; however, it was not received because the official email address currently in use is [email protected]. Accordingly, the respondents cannot be held responsible for failing to address this particular submission. It was not until 2 de diciembre de 2019 that the petitioner reiterated the complaint filed in enero de 2019, sending it to the correct email address, [email protected]. Nevertheless, he sought amparo relief from this Court on 14 de enero de 2020, and therefore, as of that date, it was premature to require the respondent administration to address that complaint because an unreasonable period had not elapsed. For this reason, the amparo action must be dismissed insofar as that complaint is concerned.
IV.According to the evidence in the record, on 1° de octubre de 2019, the petitioner also filed a public-health complaint (denuncia sanitaria) concerning the presence of wastewater (aguas residuales) in Quebrada Danta in Santa Teresa de Cóbano, with the Área Rectora de Salud de Garabito. That same day, the Director of the Área de Salud de Garabito forwarded the protected party’s complaint to the Área Rectora de Salud Peninsular; however, the latter did not process it, claiming that the complainant had not identified the accused party in his complaint. In this Court’s view, however, that argument is inadmissible. The submission sent by the petitioner stated the following: “Investigate Quebrada la Danta, Santa Teresa de Cóbano, because it has a terrible odor; it smells like a septic tank, and the odor reaches the main beach of Santa Teresa; it is unbearable. The Comisión de Emergencias is requested to assess Quebrada la Danta.
A CD containing videos is attached.” The protected party also provided his personal information and his address: “Hermosa Palms casa 6ª, Playa Hermosa Taco.” Although the protected party did not identify the accused party, it must be noted that private citizens are not responsible for investigating who is liable for every reported instance of environmental pollution, since this is not readily ascertainable in every case; moreover, the administration is obligated to investigate the reported public-health and environmental problem and address it if verified. In the case under review (sub examine), what mattered was that the location of the events had been properly identified, as it was in this case. Even if the respondent authorities did not have sufficient information, they should have directed the complainant to provide it, rather than disregarding the complaint because of a mere formality, since the location covered by the complaint was clearly identified and potential harm to health and the environment could not be left unaddressed.
In light of the foregoing, and given the respondent ministry’s failure to fulfill its duties, thereby violating Articles 41, 21, and 50 of the Constitución Política, the constitutional injunction petition (recurso de amparo) must be granted with respect to this issue, and the respondent must be ordered to promptly address the reported matter.
The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device or produced using new technologies, these must be collected from the court office within a maximum period of 30 business days from the date notice of this judgment is served. Otherwise, any material not collected within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.

The petition is partially granted. Juan Gabriel Ledezma Acevedo and José Alberto Morales Ortega, respectively Director of the Área Rectora de Salud Peninsular and Director of the Área Rectora de Salud de Garabito, or whoever holds those positions, are ordered to undertake the necessary coordination, issue the appropriate orders, and carry out all actions within the scope of their authority so that, within 1 month from the date notice of this judgment is served, the complaint filed by the petitioner on 1 de octubre de 2019 is addressed and the protected party is notified of its outcome. The respondent authority is warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in constitutional injunction proceedings that must be complied with or enforced and fails to comply with or enforce it shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The State is ordered to pay the legal costs and the damages caused by the events underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative litigation court (contencioso administrativo). In all other respects, the petition is denied. This decision shall be personally served on Juan Gabriel Ledezma Acevedo and José Alberto Morales Ortega, respectively Director of the Área Rectora de Salud Peninsular and Director of the Área Rectora de Salud de Garabito, or whoever holds those positions.

Revisión del Documento *200006400007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del catorce de febrero de dos mil veinte .
Recurso de amparo que se tramita en expediente número 20-000640-0007-CO, interpuesto por WÁLTER BRENES SOTO, cédula de identidad 0206450800, contra el MINISTERIO DE SALUD.
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
I.Objeto del recurso. El recurrente estima lesionados sus derechos fundamentales, por cuanto acusa que ha planteado varias denuncias por contaminación de aguas negras y estas no han sido atendidas.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
III.Sobre el fondo. De la prueba aportada a los autos se tiene que el 21 de enero de 2019, el recurrente remitió al correo electrónico [email protected] una denuncia por contaminación con aguas negras de la quebrada ubicada entre el Hotel Don Jon y el Café Swart en la localidad de Santa Teresa; sin embargo, esta no fue recibida, por cuanto el correo oficial y en uso es [email protected]. En tal sentido, no puede imputársele a los recurridos la falta de atención de esta gestión en particular. No fue sino el 2 de diciembre de 2019, que el recurrente reiteró la denuncia realizada en enero de 2019, remitiéndola al correo electrónico correcto [email protected]. Empero, acudió a este Tribunal en amparo el 14 de enero de 2020, de modo que para esa fecha resultaba prematuro exigir a la administración recurrida la atención de esa denuncia, pues no había transcurrido un plazo irrazonable. Por tal motivo el amparo debe ser desestimado en cuanto a esa denuncia se refiere.
IV.Según se acreditó en autos, el 1° de octubre de 2019, el recurrente también interpuso una denuncia sanitaria por la existencia de aguas residuales en la Quebrada Danta en Santa Teresa de Cóbano, ante el Área Rectora de Salud de Garabito. Ese mismo día, el Director del Área de Salud de Garabito remitió la denuncia del amparado al Área Rectora de Salud Peninsular; sin embargo, esta última no la tramitó, pues aduce que el gestionante en su denuncia no identificó al denunciado. No obstante, en criterio de este Tribunal tal argumento resulta inadmisible. En la gestión remitida por el recurrente se indicó lo siguiente: “Investigar Quebrada la Danta Santa Teresa de Cóbano, ya que tiene un pésimo olor, huele a tanque séptico, el olor cae a la playa principal Santa Teresa, es un olor insoportable. Se solicita a la Comisión de Emergencias que valore a la Quebrada la Danta. Se adjunta CD con videos.” Igualmente, el amparado indicó sus datos personales y su dirección “Hermosa Palms casa 6ª, Playa Hermosa Taco”.
Ahora, si bien el tutelado no indicó quién era el denunciado, debe advertirse que no corresponde al administrado investigar quién es el responsable de todas las contaminaciones ambientales que se denuncian, toda vez que ello no es fácilmente identificable en todos los casos y, además, es una obligación de la administración verificar el problema de salud y ambiental denunciado, y atenderlo, en caso de comprobarlo. En el sub examine, lo importante es que estuviera identificado adecuadamente el lugar de los hechos, tal como en el caso de marras. Incluso, de no contar los recurridos con los datos suficientes, debió prevenir al denunciante, pero no ignorar la denuncia por una simple formalidad, pues en este caso estaba claramente señalado el lugar objeto de la denuncia, y un eventual daño a la salud y al ambiente no podía quedar sin ser atendido. En razón de lo expuesto y ante la omisión del ministerio recurrido en atender sus deberes y con ello lesionar los ordinales 41, 21 y 50 de la Constitución Política, procede estimar el recurso en cuanto a este extremo, y ordenar al recurrido la pronta atención de lo denunciado.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso. Se ordena a Juan Gabriel Ledezma Acevedo y José Alberto Morales Ortega, por su orden Director del Área Rectora de Salud Peninsular y Director del Área Rectora de Salud de Garabito, o a quienes ocupen esos cargos, que coordinen lo necesario, giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que, dentro del plazo de 1 mes contado a partir de la notificación de esta sentencia, sea atendida la denuncia interpuesta por el recurrente el 1 de octubre de 2019, y se le notifique al amparado el resultado de la misma. Se advierte a la autoridad recurrida que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. Notifíquese esta resolución a Juan Gabriel Ledezma Acevedo y José Alberto Morales Ortega, por su orden Director del Área Rectora de Salud Peninsular y Director del Área Rectora de Salud de Garabito, o a quienes ocupen esos cargos, de manera personal.
