Amparo proceeding (recurso de amparo) processed under case number 20-000388-0007-CO, filed by RONALD JIMÉNEZ BOLAÑOS, identity card 0603350891, against the MUNICIPALIDAD DE PARRITA and the MINISTERIO DE SALUD.
Findings:

Considering:
Before analyzing the merits of the matter, it must be clarified that, beginning with Judgment N° 2008-2545 issued at 8:55 on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those matters in which it is disputed whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to conclude through a final administrative act an administrative proceeding initiated ex officio or at a party’s request, or to hear the applicable administrative appeals (recursos administrativos). Specifically, the sub lite presents an exceptional circumstance because it concerns a possible failure to decide a complaint involving an environmental matter. Having clarified the foregoing, the merits of the present amparo proceeding will be considered.
The petitioner filed an amparo proceeding and stated that the bus stop located in front of the Mercado municipal de Parrita was contaminated with the droppings of birds that roost there. He stated that, by means of a letter received on 25 de marzo de 2019, he reported that situation to the Municipalidad de Parrita. By official letter No. DAM-GHM-057-2019 of 10 de abril de 2019, he was informed that mesh would be installed. He added that the Área Rectora de Salud de Parrita inspected the site and, by official letter No. MS-DRRRSPC-DARSPA-0122-2019 of 6 de mayo de 2019, informed him that the respondent Municipality would install netting to serve as a protective barrier. Nevertheless, he alleged that, despite the time elapsed, no concrete action had yet been taken.
The following facts are deemed duly established and relevant to the resolution of this matter, either because they have been proven or because the respondent authority failed to address them as directed in the initial order:
Related to the Municipalidad de Parrita:
The petitioner has not filed any written submission with the Municipalidad de Parrita (see the report submitted by the respondent authority).
On 08 de abril de 2019, the Office of the Municipal Mayor forwarded correspondence from Mr. Carlos Jiménez Sandi concerning the problem of droppings from the birds inhabiting the Mercado municipal (see the report submitted by the respondent authority).
By official letter DAM-GHM-057-2019 of 10 de abril de 2019, the Municipal Mayor’s Office was informed that a meeting had been coordinated with entities of the Ministerio de Salud and SENASA, at which it was agreed that, as a preventive measure, the Municipality would install shade cloth and that the matter had to be addressed immediately to prevent the birds from remaining within the bus-stop structure. The foregoing was duly communicated to Mr. Carlos Sandí Jiménez on 10 de abril de 2019 (see the report submitted by the respondent authority).
The Municipalidad de Parrita undertook to make the necessary improvements no later than 31 de marzo del 2020 (see the report submitted by the respondent authority).
Related to the Área de Salud de Parrita:
The petitioner has not filed any written submission with the Área de Salud de Parrita (see the report submitted by the respondent authority).
On 25 de marzo del 2019, the Área Rectora de Salud de Parrita received a note dated 22 de marzo de 2019, submitted to Customer Service under document-receipt form N° PC-ARS-PA-EAC 208-2019 by Mr. Carlos Jiménez Cerdas, in which he made an inquiry concerning the market bus stop with a view to remedying the presence of birds that contaminated the site with droppings (see the report submitted by the respondent authority).
On 10 April 2019, the complaint filed by Mr. Carlos Jiménez Cerdas was referred to the Health Regulation Process (Proceso de Regulación de la Salud) for handling; consequently, on that same day, Licenciado José Luis Vindas Campos, Environmental Manager of the Parrita Governing Health Area (Área Rectora de Salud de Parrita), went to the site to conduct an inspection and reported observing excrement from birds inhabiting the site, where foul odors were detected and some individuals expressed discomfort regarding the matter, as recorded in visual inspection report N° 34 at 8.50 am. As a result of the site inspection, official letter N° MS-PC-ARS-PA-RS-015-2019 dated 02 May 2019 was issued, signed by Lic. José Luis Vindas Campos in his capacity as Environmental Manager of the Health Regulation Process of the Parrita Governing Health Area, stating that the matter had been verified and had also been addressed at a meeting of the Municipal Emergency Committee (Comisión Municipal de Emergencia) held that same day (see the report submitted by the respondent authority).
By official letter N° MS-DRRSPC-DARSPA-0122-2019, dated 06 May 2019 and signed by Dr. José Luis Miranda Cajina, Director of the Parrita Governing Health Area, a response was provided to Mr. Carlos Jiménez Cerdas, informing him about the inquiry he had submitted to that Governing Health Area concerning the birds remaining in the bus terminal at the municipal market (see the report submitted by the respondent authority).
Pursuant to Articles 21, 50, and 89 of the Political Constitution (Constitución Política), this Constitutional Court has broadly recognized the State’s duty to protect the right to enjoy a healthy and ecologically balanced environment. Those provisions, together with environmental legislation below the constitutional level (normativa infraconstitucional ambiental), give rise to the State’s responsibility to exercise protective and governing authority in this area. In this regard, this Chamber stated the following in judgment No. 4830-2002 at 16:00 hrs. on 21 May 2002:
“(…) In Article 50, our Political Constitution expressly recognizes the right of all present and future inhabitants of this country to enjoy a healthy and perfectly balanced environment. Fulfillment of this requirement is a fundamental safeguard for the protection of public life and health, not only for Costa Ricans but also for all members of the global community. Violation of these fundamental principles may harm or endanger short-, medium-, and long-term interests. Environmental pollution is one of the means by which the integrity of the environment may be disrupted, with consequences that are most often permanent and cumulative. The Costa Rican State is required to act preventively, avoiding—through oversight and direct intervention—the commission of acts that harm the environment, and is subject to the corresponding and equally unavoidable prohibition against promoting its degradation (…)”.
Likewise, in judgment No. 17552-2007 at 12:22 hrs. on 30 November 2007, this Court held as follows:
“(…) The aforementioned Article 50 also defines the Social State under the Rule of Law (Estado Social de Derecho); we may therefore conclude that the Political Constitution emphasizes that environmental protection is an appropriate mechanism for safeguarding and improving everyone’s quality of life, making intervention by the Public Authorities necessary with respect to factors that may disturb its balance and prevent individuals from developing and conducting their lives in a healthy environment. The significance of the right to a healthy and ecologically balanced environment within State activity rests, first, on the fact that, by definition, rights are not confined to the private sphere of individuals but also have implications for the very structure of the State in its role as their guarantor, and, second, on the fact that State activity is directed toward satisfying the interests of the community.
In constitutional case law, the concept of the ‘environment’ has not been limited to the primary elements of nature—that is, soil, air, water, marine and coastal resources, minerals, forests, the biological diversity of flora and fauna, and the landscape—which constitute the environmental framework without which basic needs such as food, energy, housing, sanitation, and recreation could not be met. It is important to emphasize that this term has been understood more comprehensively, establishing a ‘macro-environmental’ concept that also encompasses matters relating to the economy, the generation of foreign currency through tourism, agricultural production, and others: ‘Accordingly, Environmental Law (Derecho Ambiental) should not be associated solely with nature, because nature is only one part of the environment. Nature-protection policy also extends to other matters, such as the protection of hunting, forests, natural parks, and natural resources. It is therefore a macro-environmental concept, intended to ensure that important concepts are not excluded and thereby to unify the body of law we call Environmental Law (…)’”.
Finally, it should be noted that this Chamber, as guarantor of fundamental rights, acts as an overseer of compliance with the obligations arising from Articles 21 and 50 of the Constitution, which require the State not only to recognize the aforementioned rights but also to use the material and legally legitimate means necessary to guarantee them (see judgment N° 2014-11376 at 10:05 hrs. on 11 July 2014).
After analyzing the evidence submitted, this Court finds that the fundamental rights of the protected party (parte amparada) were violated. The report submitted by the representative of the respondent authority—which is deemed to have been given under oath, with the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for resolution of the matter duly establish that, although the petitioner (recurrente) did not file any written submission with the Municipalidad de Parrita, a complaint filed by Mr. Carlos Jiménez Sandi on 25 March 2019 concerning the problem of excrement from birds inhabiting the Mercado municipal is on record. It is also established that, on 08 April 2019, the Office of the Municipal Mayor forwarded correspondence so that the complaint could be addressed. By official letter DAM-GHM-057-2019, dated 10 April 2019, the Office of the Municipal Mayor was informed that a meeting had been coordinated with officials from the Ministerio de Salud and SENASA, at which it was agreed that, as a preventive measure, the Municipality would install shade cloth and that the matter had to be addressed immediately to prevent the birds from remaining inside the bus-stop structure.
The foregoing was duly communicated to Mr. Carlos Sandí Jiménez on 10 April 2019. The representative of the respondent local government stated that it had not been possible to secure resources for the specified project; however, he undertook to complete the necessary improvements no later than 31 March 2020. The factual circumstances described above demonstrate that, although the respondent Municipality has taken action to address the complaint filed, no definitive solution has yet been provided. The respondent municipality must be reminded of Article 84 of the Municipal Code (Código Municipal):
“ARTICLE 84.- In accordance with the Municipal Regulatory Plan (Plan Regulador Municipal), natural or legal persons who own or possess real property under any title shall comply with the following obligations:
When a lot contains an uninhabitable building that endangers the life, property, or physical integrity of third parties, or whose state of abandonment facilitates the commission of criminal acts, the municipality may file the corresponding complaint with the health authorities and cooperate with them in enforcing the General Health Law (Ley General de Salud).
Except as provided in the General Health Law, when municipal residents fail to comply with the foregoing obligations, or when the absence or poor condition of a sidewalk endangers safety or physical integrity or restricts pedestrian accessibility, the municipality is authorized to remedy the failure to perform those duties by carrying out the work directly or providing the corresponding services. For the work performed, the municipality shall charge the owner or possessor of the property the actual cost of the service or work. The municipal resident shall reimburse the actual cost within a maximum period of eight business days; otherwise, the resident shall pay a fine equal to fifty percent (50%) of the value of the work or service, without prejudice to the collection of default interest.” As the cited article correctly states, the respondent Municipality is required to take the actions necessary to protect public health.
According to the established factual basis, the respondent Municipality has failed to comply with the aforementioned legislation, thereby demonstrating its failure to fulfill its obligations. In this regard, as this Court has stated, if a group of municipal residents within its territorial jurisdiction faces risks to their lives and potentially serious harm to their property, psychological well-being, quality of life, and general welfare, this falls within the concept of “local interests and services” in Article 169 of the Constitution; the causes of such problems must be precisely identified and, more importantly, so must the solutions, in order to implement them as promptly as possible. Consequently, this proceeding for the protection of rights (proceso de tutela) must be granted in accordance with the operative portion of this decision insofar as this issue is concerned, because the actions taken by the respondent municipality have been insufficient and untimely.
After analyzing the evidence submitted, this Court finds that the fundamental rights of the protected party have been violated. The report submitted by the representative of the respondent authority—which is deemed to have been given under oath, with the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for the resolution of the matter have duly established that the petitioner did not file any written request with the Parrita Health Area; however, on 25 de marzo del 2019, the respondent Health Area received a note dated 22 de marzo de 2019, submitted by Mr. Carlos Jiménez Cerdas, in which he made an inquiry regarding the market bus stop, seeking corrective action concerning the presence of birds that contaminate the site with excrement. On 10 de abril del 2019, the complaint filed by Mr. Carlos Jiménez Cerdas was forwarded to the Health Regulation Process for attention; accordingly, that same day, Licenciado José Luis Vindas Campos, Environmental Manager of the Parrita Governing Health Area, went to the site to conduct an inspection and reported that excrement from birds inhabiting the site was observed, that foul odors were detected, and that some persons expressed annoyance regarding the matter, as recorded in visual inspection report N° 34 at 8.50 am.
As a result of the site inspection, official letter N° MS-PC-ARS-PA-RS-015-2019, dated 02 de mayo de 2019, was issued and signed by Lic. José Luis Vindas Campos, in his capacity as Environmental Manager of the Health Regulation Process of the Parrita Governing Health Area, stating that the matter had been verified and, in turn, at a meeting of the Municipal Emergency Commission held that same day. Finally, through official letter N° MS-DRRSPC-DARSPA-0122-2019, dated 06 de mayo de 2019, signed by Dr. José Luis Miranda Cajina, Director of the Parrita Governing Health Area, a response was provided to Mr. Carlos Jiménez Cerdas informing him about the inquiry he had submitted to that Governing Health Area concerning the presence of birds at the municipal market bus terminal. In this regard, it must be noted that the role of the constitutional judge cannot extend to reviewing the technical criteria issued by administrative authorities in environmental matters, but must be limited to determining whether the competent government agencies have fulfilled the obligation imposed upon them by Article 50 of the Political Constitution.
Likewise, this jurisdiction has held that the admissibility of a constitutional protection action (recurso de amparo) is contingent not only upon proof of interference—or a threat of interference—with one or more of the rights or guarantees set forth in the Political Constitution or in the international human rights instruments signed by the country, but also upon the existence of a direct and manifest threat or violation whose urgent nature makes it impossible to await the effect of ordinary judicial remedies. This latter circumstance underscores the inherently summary nature of constitutional protection proceedings (proceso de amparo), whose procedure is not well suited to the taking of slow and complex evidence or to the need first to examine—in declaratory proceedings—whether rights below the constitutional level cited by the parties as part of the factual allegations in the constitutional protection action or the statutory report (informe de ley), as applicable, actually exist.
It is evident that, in the present case, although the respondent Health Area addressed the complaint filed by Mr. Carlos Jiménez Cerdas, it is also true that it did not follow up on that complaint, as it failed to verify that the municipality had addressed the problem caused by pigeons at the bus terminal. Accordingly, the present constitutional protection proceedings must be granted, pursuant to the provisions set forth in the operative portion of this decision.
The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, such items must be retrieved from the court within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Full Court at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 de enero del 2012, as well as pursuant to the resolution approved by the Superior Council of the Judiciary at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.
POR TANTO:
The action is GRANTED. Consequently, FREDDY GARRO ARIAS, in his capacity as Mayor of the Municipalidad de Parrita, or whoever holds that office, is ordered to arrange and coordinate whatever is necessary so that, within TWO MONTHS from notification of this decision, the necessary work is performed at the bus stop located across from the municipal market of Parrita in order to control the contamination caused by the birds. Likewise, JOSÉ LUIS MIRANDA CAJINA, in his capacity as Director of the Parrita Governing Health Area, or whoever holds that office, is ordered, within the scope of his powers and duties and within the period specified in this judgment, to verify and ensure compliance by the respondent local government so that the necessary improvements are carried out to control the contamination problem caused by the birds at the bus stop located across from the municipal market of Parrita.
The respondents are warned that, pursuant to Article 71 of the Law governing this jurisdiction, anyone who receives an order issued in a constitutional protection action that he or she is required to comply with or enforce, and fails to comply with or enforce it, shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. In all other respects, the action is denied. The State and the Municipalidad de Grecia are ordered to pay the legal costs and the damages and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction. This decision shall be personally served upon FREDDY GARRO ARIAS, in his capacity as Mayor of the Municipalidad de Parrita, and JOSÉ LUIS MIRANDA CAJINA, in his capacity as Director of the Parrita Governing Health Area, or whoever holds those offices.

Revisión del Documento *200003880007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del siete de febrero de dos mil veinte .
Recurso de amparo que se tramita en expediente número 20-000388-0007-CO, interpuesto por RONALD JIMÉNEZ BOLAÑOS, cédula de identidad 0603350891, contra la MUNICIPALIDAD DE PARRITA y el MINISTERIO DE SALUD.
Resultando:
Redacta la Magistrada Picado Brenes; y,
Considerando:
Antes de analizar el fondo del asunto, debe aclararse, que a partir de la Sentencia N° 2008-2545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones- aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues se está ante la posible falta de resolución de una denuncia en materia ambiental. Aclarado lo anterior, se conoce por el fondo sobre el presente proceso de amparo.
La parte recurrente presenta recurso de amparo y expone que la parada de buses que se ubica frente al mercado municipal de Parrita se encuentra contaminada con el excremento de las aves que llegan a dormir al lugar. Refiere que mediante oficio con fecha de recibido 25 de marzo de 2019, denunció dicha situación ante la Municipalidad de Parrita. Por oficio No. DAM-GHM-057-2019 de 10 de abril de 2019, se le indicó que colocarían una malla. Añade que el Área Rectora de Salud de Parrita realizó la inspección del lugar y mediante oficio No. MS-DRRRSPC-DARSPA-0122-2019 de 6 de mayo de 2019, le informó que la Municipalidad recurrida colocaría una red que sirviera de barrera protectora. No obstante, alega que pese al tiempo transcurrido, aún no se ha efectuado acción alguna en concreto.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:
Relacionados con la Municipalidad de Parrita:
El recurrente no ha presentado ningún escrito ante la Municipalidad de Parrita (ver informe rendido por parte de la autoridad accionada).
El 08 de abril de 2019, el Despacho del Alcalde Municipal, traslada correspondencia sobre la problemática del excremento de las aves que habitan en el Mercado municipal por parte del señor Carlos Jiménez Sandi (ver informe rendido por parte de la autoridad accionada).
Mediante oficio DAM-GHM-057-2019, del 10 de abril de 2019, se le indicó a la Alcaldía Municipal, que se coordinó una reunión con las entidades del Ministerio de Salud, SENASA, acordándose que como medida preventiva la Municipalidad colocaría un sarán y que deberá de atenderse de forma inmediata para evitar que las aves permanezcan dentro de la estructura de la parada de buses. Lo anterior fue debidamente comunicada al señor Carlos Sandí Jiménez, en el 10 de abril de 2019 (ver informe rendido por parte de la autoridad accionada).
La Municipalidad de Parrita, se comprometió a realizar las mejoras necesarias a más tardar el 31 de marzo del 2020 (ver informe rendido por parte de la autoridad accionada).
Relacionados con el Área de Salud de Parrita:
El recurrente no ha presentado ningún escrito ante el Área de Salud de Parrita (ver informe rendido por parte de la autoridad accionada).
El 25 de marzo del 2019, se recibe en el Área Rectora de Salud de Parrita nota de fecha 22 de marzo de 2019, recibida en Atención al Cliente mediante boleta de recepción de documentos N° PC-ARS-PA-EAC 208-2019, presentada por el señor Carlos Jiménez Cerdas, en la cual realiza consulta sobre la parada del mercado a fin de corregir la permanencia de aves que contaminan el lugar con excremento (ver informe rendido por parte de la autoridad accionada).
El 10 de abril del 2019, se hace el traslado, de la denuncia presentada por el señor Carlos Jiménez Cerdas, al Proceso de Regulación de la Salud para su atención, por lo que ese mismo día el Licenciado José Luis Vindas Campos, Gestor Ambiental del Área Rectora de Salud de Parrita se desplazó al lugar a realizar una inspección, e indica que se observa excremento de aves que habitan en el lugar, en el cual se detecta malos olores y algunas personas indicaron molestia por el asunto, según consta en el acta de inspección ocular N° 34 al ser las 8.50 am. Motivo de la inspección al lugar se genera el oficio N° MS-PC-ARS-PA-RS-015-2019 de fecha 02 de mayo de 2019 suscrito por el Lic. José Luis Vindas Campos, en calidad de Gestor Ambiental del Proceso de Regulación de la Salud del Área Rectora de Salud de Parrita, en el cual indica que el asunto fue verificado y que a su vez en reunión de la Comisión Municipal de Emergencia efectuada ese mismo día (ver informe rendido por parte de la autoridad accionada).
Mediante oficio N° MS-DRRSPC-DARSPA-0122-2019, de 06 de mayo de 2019, suscrito por el Dr. José Luis Miranda Cajina, director del Área Rectora de Salud de Parrita, se dio respuesta al señor Carlos Jiménez Cerdas, en el cual se le informa sobre la consulta que había realizado ante esta Área Rectora de Salud, referente a la permanencia de aves en la terminal de buses del mercado municipal (ver informe rendido por parte de la autoridad accionada).
A partir de lo dispuesto en los artículos 21, 50 y 89 de la Constitución Política, este Tribunal Constitucional ha reconocido, ampliamente, el deber del Estado de proteger el derecho a disfrutar de un ambiente sano y ecológicamente equilibrado. Es a tenor de dichos numerales, así como de la normativa infraconstitucional ambiental, que nace la responsabilidad del Estado de ejercer una función tutelar y rectora en esta materia. En este sentido, esta Sala, en la sentencia No. 4830-2002 de las 16:00 hrs. de 21 de mayo de 2002, señaló lo siguiente:
"(…) Nuestra Constitución Política, en su artículo 50, reconoce expresamente el derecho de todos los habitantes presentes y futuros de este país, de disfrutar de un medio ambiente saludable y en perfecto equilibrio. El cumplimiento de este requisito es fundamental garantía para la protección de la vida y la salud públicas, no sólo de los costarricenses, sino además de todos los miembros de la comunidad mundial. La violación a estos fundamentales preceptos conlleva la posibilidad de lesión o puesta en peligro de intereses a corto, mediano y largo plazo. La contaminación del medio es una de las formas a través de las cuales puede ser rota la integridad del ambiente, con resultados la mayoría de las veces imperecederos y acumulativos. El Estado costarricense se encuentra en la obligación de actuar preventivamente evitando -a través de la fiscalización y la intervención directa- la realización de actos que lesionen el medio ambiente, y en la correlativa e igualmente ineludible prohibición de fomentar su degradación (…)”.
Asimismo, este Tribunal, en la sentencia No. 17552-2007 de las 12:22 hrs. del 30 de noviembre de 2007, dispuso lo siguiente:
“(…) El artículo 50 citado, también perfila el Estado Social de Derecho, por lo que podemos concluir que la Constitución Política enfatiza que la protección del ambiente es un mecanismo adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los Poderes Públicos sobre los factores que pueden alterar su equilibrio y obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano. La incidencia que tiene el derecho a un ambiente sano y ecológicamente equilibrado dentro de la actividad del Estado, encuentra su primera razón de ser, en que por definición, los derechos no se limitan a la esfera privada de los individuos, sino que tienen asimismo trascendencia en la propia estructura del Estado, en su papel de garante de los mismos y, en segundo término, porque la actividad del Estado se dirige hacia la satisfacción de los intereses de la colectividad.
En la jurisprudencia constitucional el concepto de ‘ambiente’, no ha sido limitado a los elementos primarios de la naturaleza, sea el suelo, el aire, el agua, los recursos marinos y costeros, los minerales, los bosques, la diversidad biológica en la flora y fauna, y el paisaje; a partir de los cuales se conforma el marco ambiental sin el cual las demandas básicas -como la alimentación, energía, vivienda, sanidad y recreación- serían imposibles. Es importante resaltar que este término se ha entendido de una manera más integral, estableciéndose un concepto ‘macro-ambiental’, al comprender también aspectos referentes a la economía, a la generación de divisas a través del turismo, la explotación agrícola y otros: ‘Por lo anterior, el Derecho Ambiental no debe asociarse sólo con la naturaleza, pues ésta es únicamente parte del ambiente. La política de protección a la naturaleza se vierte también sobre otros aspectos como la protección de la caza, de los bosques, de los parques naturales y de los recursos naturales. Se trata, entonces, de un concepto macro-ambiental, para no dejar conceptos importantes por fuera y así lograr unificar el conjunto jurídico que denominamos Derecho Ambiental (…)”.
Finalmente, cabe señalar que esta Sala, como garante de los derechos fundamentales, se erige como un contralor del cumplimiento de las obligaciones que derivan de lo dispuesto en los artículos 21 y 50 constitucionales, los cuales, constriñen al Estado no sólo a reconocer los derechos señalados, sino, además, a utilizar los medios materiales y, jurídicamente, legítimos para garantizarlos (véase sentencia N° 2014-11376 de las 10:05 hrs. del 11 de julio de 2014).
Después de analizar los elementos probatorios aportados, este Tribunal verifica la lesión a los derechos fundamentales de la parte amparada. Del informe rendido por la representante de la autoridad recurrida -que se tiene dado bajo juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto ha sido debidamente acreditado que, si bien el recurrente no ha presentado ningún escrito ante la Municipalidad de Parrita, consta denuncia interpuesta por parte del señor Carlos Jiménez Sandi del 25 de marzo de 2019, sobre la problemática del excremento de las aves que habitan en el Mercado municipal. Asimismo, consta que, el 08 de abril de 2019, el Despacho del Alcalde Municipal, traslada correspondencia para atender la denuncia indicada. Mediante oficio DAM-GHM-057-2019, del 10 de abril de 2019, se le indicó a la Alcaldía Municipal, que se coordinó una reunión con las entidades del Ministerio de Salud, SENASA, acordándose que como medida preventiva la Municipalidad colocaría un sarán y que deberá de atenderse de forma inmediata para evitar que las aves permanezcan dentro de la estructura de la parada de buses.
Lo anterior fue debidamente comunicada al señor Carlos Sandí Jiménez, en el 10 de abril de 2019. El representante del gobierno local accionado indicó que no se ha logrado la gestión de los recursos para el proyecto indicado, sin embargo, se comprometió a realizar las mejoras necesarias a más tardar el 31 de marzo del 2020. Del cuadro fáctico expuesto se evidencia que, si bien es cierto la Municipalidad recurrida ha realizado acciones para atender la denuncia interpuesta, aun no se ha dado una solución definitiva. Se debe recordar al municipio accionado lo dispuesto en el artículo 84 del Código Municipal:
"ARTÍCULO 84.- De conformidad con el Plan Regulador Municipal, las personas físicas o jurídicas, propietarias o poseedoras, por cualquier título, de bienes inmuebles, deberán cumplir las siguientes obligaciones:
Cuando en un lote exista una edificación inhabitable que arriesgue la vida, el patrimonio o la integridad física de terceros, o cuyo estado de abandono favorezca la comisión de actos delictivos, la municipalidad podrá formular la denuncia correspondiente ante las autoridades de salud y colaborar con ellas en el cumplimiento de la Ley General de Salud.
Salvo lo ordenado en la Ley General de Salud, cuando los munícipes incumplan las obligaciones anteriores o cuando la inexistencia o mal estado de la acera ponga en peligro la seguridad e integridad o se limite la accesibilidad de los peatones, la municipalidad está facultada para suplir la omisión de esos deberes, realizando de forma directa las obras o prestando los servicios correspondientes. Por los trabajos ejecutados, la municipalidad cobrará al propietario o poseedor del inmueble el costo efectivo del servicio o la obra. El munícipe deberá reembolsar el costo efectivo en el plazo máximo de ocho días hábiles; de lo contrario deberá cancelar por concepto de multa un cincuenta por ciento (50%) del valor de la obra o el servicio, sin perjuicio del cobro de los intereses moratorios.".
Como bien lo indica el citado artículo, la Municipalidad recurrida está en la obligación de ejecutar las acciones necesarias en beneficio de la salud pública. Según la base fáctica acreditada la Municipalidad accionada ha incumplido con la normativa supra citada, evidenciando así la falta de sus obligaciones. Al efecto, tal como se ha indicado por parte de este Tribunal, si un grupo de munícipes, en su circunscripción territorial, sufre de riesgo para sus vidas y posibles graves daños patrimoniales, psicológicos, calidad de vida y bienestar general, esto se enmarca dentro del concepto de "intereses y servicios locales" del numeral 169 constitucional, problemas cuyas causas tienen que ser identificadas con precisión y, más aún, las soluciones, a fin de implementarlas a la mayor brevedad posible. Consecuentemente, debe estimarse el presente proceso de tutela de conformidad con lo indicado en la parte dispositiva de esta resolución, en cuanto a este extremo se refiere, al advertirse que las acciones realizadas por el municipio accionado han sido insuficientes y tardías.
Después de analizar los elementos probatorios aportados, este Tribunal verifica la lesión a los derechos fundamentales de la parte amparada. Del informe rendido por la representante de la autoridad recurrida -que se tiene dado bajo juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto ha sido debidamente acreditado que, el recurrente no ha presentado ningún escrito ante el Área de Salud de Parrita, sin embargo, el 25 de marzo del 2019, se recibe en el Área recurrida una nota de fecha 22 de marzo de 2019, presentada por el señor Carlos Jiménez Cerdas, en la cual realiza consulta sobre la parada del mercado a fin de corregir la permanencia de aves que contaminan el lugar con excremento. El 10 de abril del 2019, se hace el traslado, de la denuncia presentada por el señor Carlos Jiménez Cerdas, al Proceso de Regulación de la Salud para su atención, por lo que ese mismo día el Licenciado José Luis Vindas Campos, Gestor Ambiental del Área Rectora de Salud de Parrita se desplazó al lugar a realizar una inspección, e indica que se observa excremento de aves que habitan en el lugar, en el cual se detecta malos olores y algunas personas indicaron molestia por el asunto, según consta en el acta de inspección ocular N° 34 al ser las 8.50 am.
Motivo de la inspección al lugar se genera el oficio N° MS-PC-ARS-PA-RS-015-2019 de fecha 02 de mayo de 2019 suscrito por el Lic. José Luis Vindas Campos, en calidad de Gestor Ambiental del Proceso de Regulación de la Salud del Área Rectora de Salud de Parrita, en el cual indica que el asunto fue verificado y que a su vez en reunión de la Comisión Municipal de Emergencia efectuada ese mismo día. Finalmente, mediante oficio N° MS-DRRSPC-DARSPA-0122-2019, de 06 de mayo de 2019, suscrito por el Dr. José Luis Miranda Cajina, director del Área Rectora de Salud de Parrita, se dio respuesta al señor Carlos Jiménez Cerdas, en el cual se le informa sobre la consulta que había realizado ante esta Área Rectora de Salud, referente a la permanencia de aves en la terminal de buses del mercado municipal. Al efecto, debe indicarse que el papel del juez constitucional no puede extenderse al de verificador de los criterios técnicos dados por las autoridades administrativas en materia ambiental, sino que deberá limitarse a constatar si las dependencias estatales competentes han cumplido la obligación que les impone el artículo 50 de la Constitución Política.
Asimismo, esta jurisdicción ha sostenido que la procedencia del recurso de amparo está condicionada, no sólo a que se acredite la existencia de una turbación -o amenaza de turbación- a uno o más de los derechos o garantías contemplados en la Carta Política o en los instrumentos internacionales de derechos humanos suscritos por el país; sino además, a que se trate de una amenaza o quebranto directo y grosero, que por su carácter apremiante no permita esperar a que surtan efecto los remedios jurisdiccionales ordinarios. Esta última circunstancia pone de relieve el carácter eminentemente sumario del proceso de amparo, cuya tramitación no se ajusta bien con la práctica de diligencias probatorias lentas y complejas, o con la necesidad de entrar previamente a examinar -con carácter declarativo- si existen en realidad o no derechos de rango infra constitucional que las partes citen como parte del elenco fáctico del recurso de amparo o del informe de ley, según sea el caso.
Es evidente que, en el presente caso, si bien el Área de Salud accionada atendió la denuncia planteada por el señor Carlos Jiménez Cerdas, también es cierto que no dio seguimiento de dicha denuncia, al no constatar que el municipio atendiera el problema ocasionado por las palomas en la terminal de buses. En ese sentido, el presente proceso de amparo debe ser estimado, lo anterior de conformidad con lo indicado en la parte dispositiva de la presente resolución.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara CON LUGAR el recurso. Consecuentemente, se ordena a FREDDY GARRO ARIAS, en su condición de Alcalde de la Municipalidad de Parrita o, a quien ocupe ese cargo que, disponga y coordine lo necesario para que en el plazo de DOS MESES, contado a partir de la notificación de la presente resolución, se realicen los trabajos necesarios en la parada de buses que se ubica frente al mercado municipal de Parrita, a efectos de controlar la contaminación producida por las aves. Asimismo, se ordena a JOSÉ LUIS MIRANDA CAJINA, en su condición de Director del Área Rectora de Salud de Parrita o, a quien ocupe ese cargo que, dentro del marco de sus competencias y atribuciones, y dentro del plazo indicado en esta sentencia, verifique y haga cumplir al gobierno local accionado para que se ejecuten las mejoras necesarias a efectos de controlar el problema de contaminación ocasionado por las aves en la parada de buses que se ubica frente al mercado municipal de Parrita.
Se advierte a los recurridos que, de conformidad con el artículo 71 de la Ley de esta jurisdicción, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. En lo demás se declara sin lugar el recurso. Se condena al Estado y a la Municipalidad de Grecia al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese la presente resolución a FREDDY GARRO ARIAS, en su condición de Alcalde de la Municipalidad de Parrita y, a JOSÉ LUIS MIRANDA CAJINA, en su condición de Director del Área Rectora de Salud de Parrita o, a quienes ocupen esos cargos, en forma personal.
