An amparo action (recurso de amparo) filed by MARÍA FRANCISCA GÓMEZ CALVO, identification card No. 0401051076, against the MINISTERIO DE SALUD and the MUNICIPALIDAD DE SAN JOSÉ.

**Whereas:** 1.- Through a document received at the Secretariat of the Constitutional Chamber on December 6 of the current year, the petitioner files an amparo action and states that she resides in Hatillo. She indicates that since 2015 she has requested that the problem she faces with a neighbor, Jorge Fallas Vargas, be resolved. He lives adjacent to her house in deplorable conditions, as he has no water or electricity services; additionally, he cooks with firewood in the early mornings on a wooden second floor. She explains that her dwelling fills with smoke and the heat that passes through the walls suffocates her and causes her fear that a disaster may occur. She points out that her neighbor also has his dwelling saturated with old clothes, bags full of garbage, and lives with cats. She maintains that, due to all the foregoing, the danger of fire is imminent, with the aggravating factor that a fire would be catastrophic for the entire alameda. In addition to this, the foul odors in the mornings are unbearable, and rats, flies, mosquitoes, and cockroaches have proliferated. She argues that the respondent authorities, as of the date she files this amparo, have not done what is necessary to eradicate the danger this represents to the health and life of people. She adds that the Jorge Debravo Educational Center is located approximately 5 meters away, so this situation could imply a danger to the health of the students and people who attend that educational center. She estimates that the described facts violate her fundamental rights.

2.- Johnny Araya Monge, in his capacity as Mayor of the Municipalidad de San José, reports under oath that the municipality has not received any complaint or report regarding the case indicated by the petitioner. However, upon learning of the case, it is being handled by the Department of Environmental Services. And regarding waste on public roadways, it was cleaned up yesterday. It is not possible for them to clean what is on private property. He requests that the action be dismissed.

3.- Eduardo Arguedas Barquero, in his capacity as Medical Director of the Área Rectora de Salud of Hatillo, reports under oath that in his archives and database, the petitioner does not appear as a complainant in this case. However, this Área Rectora de Salud is aware of a complaint regarding a hoarder (acumulador) located in Hatillo 8, in this case filed by another person. On November 30, 2018, Mr. Diego Salazar Gómez, with identification card 1-1179-0273, telephone 8327-2542, and email [email protected], filed complaint 2150-18 with the Área Rectora de Salud Hatillo of the Ministerio de Salud against DOES NOT INDICATE (since he states he does not know the name of the respondent) located in the province of San José, Cantón Central, District Hatillo, Hatillo 8, sidewalk 5, house #10, through Form D-1 "Filing of Sanitary Complaint" MS.NI.S1A.07.P.06. The type of activity checked is: Residential (dwellings, condominiums, residential developments, and others), while the type of complaint notes foul odors, smoke and gases, dust or particles, uninhabitability, vectors (flies and others), rodents, use of toxic substances, security, storage of fuel or gas, spoiled or contaminated food. He states that, in response to the processing of the indicated complaint, an inspector visit was scheduled for: WEEK 4 (January 21 TO 25, 2019, FROM 8 AM TO 4 PM). On February 7, 2019, through Inspection Report No. CS-ARS-H-MSA-013-19 at 9:30 a.m., the official of that Ministerio de Salud, Environmental Manager Marylin Sánchez Alpízar, indicates: "I appeared at the site of the problem and the accumulation of garbage on said property is indeed evident; a visit will be organized to issue the corresponding administrative acts. A neighbor signs as a witness to the ocular inspection." Subsequently, Sanitary Order No. ARS-H-(M)-001-2019 was issued in order to notify Jorge Fallas Vargas, who is the one inhabiting the reported dwelling. He adds that they have appeared to carry out notification of Sanitary Order No. ARS-H-(M)-001-2019 to the respondent: Jorge Fallas Vargas; the house of residence was called repeatedly, and he did not answer them. By virtue of this, on March 21, 2019, a request for support was sent through official letter No. CSARS-H-MS-016-2019 to the Policía Municipal de San José to conduct a joint visit for the purpose of notifying the Sanitary Order and filing the corresponding acts for March 28, 2019, at 9:30 a.m. On April 4, 2019, a report on the complaint filed with the Área Rectora de Salud of Hatillo regarding a hoarder located in Hatillo #8 was sent to Dr. Guillermo Flores Galindo, Regional Director of Rectoría de la Salud Región Central Sur, through official letter No. CS-DARS-H-MS-021-19. On April 5, 2019, a confidential report on the complaint filed with the Área Rectora de Salud of Hatillo against a hoarder located in Hatillo #8 was sent to Ms. Paula Vargas Ramírez, Vice Mayor of San José, Municipalidad de San José, through official letter No. CSDARS-H-MS-022-2019. On April 24, 2019, through Inspection Report No. CS-ARS-H-MSA-062-19 at 9:00 a.m., the official of that Ministerio de Salud, Environmental Manager Marylin Sánchez Alpízar, and the official belonging to the Policía Municipal de San José, Lic. Manuel Reid Villalobos, record the following: "A meeting is held with the Policia Municipal to notify Mr. Jorge Fallas Vargas, address: Hatillo #8, Avenida Nosara, behind the Escuela Jorge de Bravo. The intention is to notify Sanitary Order No. ARS-H-(M)-001-2019; the house of residence is called repeatedly, and he does not answer." On May 28, 2019, through Inspection Report No. CS-ARS-H-MSA-072-19 at 9:00 a.m., the official of that Ministerio de Salud, Environmental Manager Marylin Sánchez Alpízar, and the Medical Director Eduardo Arguedas Barquero, found the following: "When attending the case regarding a hoarder located in Hatillo #8, I appeared together with the Director of the Area, Dr. Eduardo Arguedas Barquero, in order to inspect and notify the Sanitary Order to Mr. Jorge Fallas Vargas; once again, he did not come out of the house of residence when called repeatedly." The opinion of a lawyer will be considered to request that the case be brought before a Judge. Based on conversations held with the lawyers of the Región Central Sur, their opinion is requested to proceed via legal channels; however, they recommend that in the first instance, before reaching this extreme, there be intervention from the clinic and a medical assessment since he is an older adult (adulto mayor). Consequently, a request will be made to the Clínica Dr. Solón Núñez Frutos. On June 20, 2019, a request for support to conduct a joint visit to the house of residence of Mr. Jorge Fallas Vargas was sent to Dr. Milena Quijano Barrantes, Medical Director of the Clínica Dr. Solón Núñez Frutos, through official letter No. CS-DARS-H-MS-034-2019. On June 24, 2019, a transfer of official letter CS-DARS-H-MS-034-19 was received via email from Dr. Mylena Quijano Barrantes, Medical Director, Clínica Dr. Solón Núñez Frutos, to the head of External Consultation of the Área de Salud Hatillo, Dr. Andrea Marín Madrigal. On June 26, 2019, the intervention of Dr. Wright from the Ebais of Hatillo 8 was received via email to the user account of the official of that Ministerio de Salud, Marylin Sánchez Alpízar, in order to coordinate the day, date, and time of the visit to the complainant's house of residence. On June 28, 2019, a search was conducted through the platform of the Registro Nacional, free queries, for the property's farm number (número de finca), and it is in the name of Jorge Fallas Vargas's mother, María Vargas Arroyo, who is deceased, information reiterated through the platform of the Tribunal Supremo de Elecciones, Consultas Civiles. On July 1, 2019, the official of that Ministerio de Salud, Environmental Manager Marylin Sánchez Alpízar, responded via email to Dr. Marcela Wright, agreeing on the day and time of the inspection visit, set for July 5, 2019, and they found the following points transcribed: "In accordance with the request for support made to the Clínica Dr. Solón Núñez Frutos for accompaniment and assessment regarding the situation of Jorge Fallas, hoarder of Hatillo #8, and his condition, we appeared at the place of residence, Dr. Wendy Wright Barboza from the Ebais of Hatillo #8, MSc. Flor Villalobos Mora, Dr. Eduardo Arguedas Barquero, and myself; upon conducting the visit, he did not answer." On July 26, 2019, through official letter No. MS-DARS-H-221-2019 "Response to request for copy of the file," the complainant, Mr. Diego Salazar Gómez, receives documentation indicating that he can appear at their facilities whenever he wishes to photocopy the file, as his query regarding possessing this information had been made to the Área Rectora de Salud and was approved. On August 21, 2019, official letter No. 10460-2019-DHR issued by the Defensoría de los Habitantes is received, since Mrs. María Francisca Gómez Calvo, bearer of identification card number 4-1051-076, filed a complaint before this instance, for which we are requested to provide notification and a report on the case. On August 26, 2016, a confidential report on the complaint filed with the área rectora de salud of Hatillo against a hoarder located in Hatillo #8 was sent through official letter No. CS-DARS-H-344-19 to the officials: MSc. Hazel Díaz Meléndez, Director, Control de Gestión Administrativa, Defensoría de los Habitantes, and to Licda. Roxana Quirós Cavallini, Defensoría de los Habitantes. On November 11, 2019, through a request sent by email and with instructions from Ms. Paula Vargas Ramírez, Vice Mayor of San José, they requested an update and follow-up on the case of Mr. Jorge Fallas Vargas. He points out that a telephone consultation was also made to the Prosecutor's Office of Hatillo #2 (fiscalía de Hatillo #2) to request the requirements to file a Search Warrant Order (Orden de Allanamiento), since it has not been possible to notify the respondent and the situation worsens, to which the response given is that since no crime exists, they have no basis in Law to carry out such an act. On November 21, 2019, based on the telephone conversation previously held with the Fiscalía de Hatillo #2 and on their recommendations, official letter No. MS-ORRSCS-OARsH-605-19 was issued to CONAPAM, to the Department of Social Work, in order to request accompaniment to the respondent's house, verify the state, and attempt through this means to notify Mr. Fallas, since being 69 years old, this entity can intervene. Currently, they are awaiting a response to the official letter sent to CONAPAM, as it is impossible to obtain a response by making telephone calls. Given the complexity of the case, this health authority will be taking the necessary actions, with the corresponding instances, so that the competent authority opens a probate proceeding (proceso sucesorio) to appoint an executor (albacea) and be able to notify the sanitary order, since according to information from the Registro Nacional de la Propiedad, said dwelling is in the name of Mrs. Lita María Vargas Arroyo, Farm number 533527-000, given the health conditions of Mr. Jorge Fallas Vargas, an older adult of 69 years, which is why it has been difficult for them to provide an immediate solution to the case, respecting the rights that the respondent possesses as a human being and an older adult. He considers that from the body of evidence contained in the case file, the actions taken by the Sanitary Authorities of the Área Rectora de Salud of Hatillo are in compliance with the legal framework that governs public acts.

4.- By a resolution issued at eleven hours and six minutes on January twenty-first, two thousand twenty, the respondent parties were expanded in the report and the Chief of the Delegación Policial de Hatillo was granted a hearing.

5.- Ronny Sánchez Villegas, in his capacity as Deputy Chief of the Delegación Policial de Hatillo, reports under oath that indeed their records show that collaboration was requested from them to accompany officials of the Ministerio de Salud, but for reasons of order, the formal request document could not be located. However, the manager was contacted and stated that the activity had already been carried out and no further process was required.

6.- The legal prescriptions have been observed in the proceedings followed.

Drafted by Justice Monge Pizarro; and, **Considering:** I.- Purpose of the action.- The petitioner indicates that for several years, she has requested that the problem she faces with a neighbor, Jorge Fallas Vargas, be resolved. He lives adjacent to her house in deplorable conditions, as he has no water or electricity services; additionally, he cooks with firewood in the early mornings on a wooden second floor. She explains that her dwelling fills with smoke and the heat that passes through the walls suffocates her and causes her fear that a disaster may occur. She points out that her neighbor also has his dwelling saturated with old clothes, bags full of garbage, and lives with cats. She maintains that, due to all the foregoing, the danger of fire is imminent, with the aggravating factor that a fire would be catastrophic for the entire alameda. In addition to this, the foul odors in the mornings are unbearable, and rats, flies, mosquitoes, and cockroaches have proliferated. She argues that the respondent authorities, as of the date she files this amparo, have not done what is necessary to eradicate the danger this represents to the health and life of people.

II.- Proven facts.- Of importance for the decision of this matter, the following facts are deemed duly proven: a) the respondent Área Rectora de Salud is aware of a complaint regarding a hoarder (acumulador) located in Hatillo 8, but filed by another person on November 30, 2018, Mr. Diego Salazar Gómez against DOES NOT INDICATE (since he states he does not know the name of the respondent) (report rendered under oath); b) in the description field of the complaint, it states "dwelling in a state of abandonment, with accumulation of garbage and debris of all types, electrical appliances, cardboard, plastic, clothing, wood, and others, which cause the proliferation of pests of cockroaches, flies, mosquitoes, mice, and rats; the respondent handles flammable and hazardous materials that he burns in open-air bonfires; the house is located in Hatillo 8, sidewalk 5, house #11" (report rendered under oath); c) in response to the processing carried out, it is communicated that the inspector's visit has been scheduled for: WEEK 4 (from January 21 to 25, 2019, from 8 am to 4 pm) (report rendered under oath); d) on February 7, 2019, through Inspection Report No. CS-ARS-H-MSA-013-19 at 9:30 a.m., an official of that Ministerio de Salud, Environmental Manager, found the following transcribed points: "I appeared at the site of the problem and the accumulation of garbage on said property is indeed evident; a visit will be organized to issue the corresponding administrative acts. A neighbor signs as a witness to the ocular inspection." (report rendered under oath); e) subsequently, Sanitary Order No. ARS-H-(M)-001-2019 is issued to notify Jorge Fallas Vargas, who is the one inhabiting the reported dwelling, since "it is possible to evidence the situation and problem of residue accumulation on said property," therefore he is ordered to: "eliminate all types of accumulated residues inside and outside his house of residence, thereby eliminating the existing pests in said place," and he is given a period of 25 business days (report rendered under oath); f) the Health authorities appeared to carry out notification of Sanitary Order No. ARS-H-(M)-001-2019 to the respondent: Jorge Fallas Vargas, but the house of residence was called repeatedly and he did not answer (report rendered under oath); g) subsequently, coordination was made with the Policía de Hatillo for support and backing, and they did not respond to said request, informing that the official letter delivered had been misplaced (report rendered under oath); h) on March 21, 2019, a request for support was sent through official letter No. CSARS-H-MS-016-2019 to the Policía Municipal de San José to conduct a joint visit for the purpose of notifying the Sanitary Order and filing the corresponding acts for March 28, 2019, at 9:30 a.m. (report rendered under oath); i) on April 4, 2019, a report on the complaint filed with the Area Rectora de Salud of Hatillo regarding a hoarder located in Hatillo #8 was sent to Dr. Guillermo Flores Galindo, Regional Director of Rectoría de la Salud Región Central Sur, through official letter No. CS-DARS-H-MS-021-19 (report rendered under oath); j) on April 5, 2019, a confidential report on the complaint filed with the área Rectora de Salud of Hatillo against a hoarder located in Hatillo #8 was sent to Ms. Paula Vargas Ramírez, Vice Mayor of San José, Municipalidad de San José, through official letter No. CSDARS-H-MS-022-2019 (report rendered under oath); k) on April 24, 2019, through Inspection Report No. CS-ARS-H-MSA-062-19 at 9:00 a.m., the official of that Ministerio de Salud, Environmental Manager Marylin Sánchez Alpízar, and the official belonging to the Policía Municipal de San José, Lic. Manuel Reid Villalobos, indicate: "A meeting is held with the Policía Municipal to notify Mr. Jorge Fallas Vargas, address: Hatillo #8, Avenida Nosara, behind the Escuela Jorge de Bravo. The intention is to notify Sanitary Order No. ARS-H-(M)-001-2019; the house of residence is called repeatedly, and he does not answer"; l) on May 28, 2019, through Inspection Report No. CS-ARS-H-MSA-072-19 at 9:00 a.m., the official of that Ministerio de Salud, Environmental Manager Marylin Sánchez Alpízar, and the Medical Director Eduardo Arguedas Barquero, indicate: "When attending the case regarding a hoarder located in Hatillo #8, I appeared together with the Director of the Area, Dr. Eduardo Arguedas Barquero, in order to inspect and notify the Sanitary Order to Mr. Jorge Fallas Vargas; once again, he did not come out of the house of residence when called repeatedly" (report rendered under oath); m) given the indicated conditions, the lawyers of the Región Central Sur were consulted and their opinion was requested to proceed via legal channels; however, they recommend that in the first instance, before reaching this extreme, there be intervention from the clinic and a medical assessment since he is an older adult (adulto mayor). Consequently, a request will be made to the Clínica Dr. Solón Núñez Frutos (report rendered under oath); n) on June 20, 2019, a request for support to conduct a joint visit to the house of residence of Mr. Jorge Fallas Vargas was sent to the Medical Director of the Clínica Dr. Solón Núñez Frutos, through official letter No. CS-DARS-H-MS-034-2019, on June 27, 2019, to assess his situation (report rendered under oath); ñ) on June 24, 2019, a transfer of official letter CS-DARS-H-MS-034-19 was received via email from Dr. Mylena Quijano Barrantes, Medical Director, Clínica Dr. Solón Núñez Frutos, to the head of External Consultation of the Área de Salud Hatillo, Dr. Andrea Marín Madrigal, and on June 26, 2019, the intervention of Dr. Wright from the Ebais of Hatillo 8 was received via email to the user account of the official of this Ministerio de Salud, Marylin Sánchez Alpízar, in order to coordinate the day, date, and time of the visit to the complainant's house of residence (report rendered under oath); o) on June 28, 2019, a search was conducted through the platform of the Registro Nacional, free queries, for the property's farm number (número de finca), and it is in the name of Jorge Fallas Vargas's mother, Uta María Vargas Arroyo, who is deceased, information reiterated through the platform of the Tribunal Supremo de Elecciones, Consultas Civiles (report rendered under oath); p) on July 1, 2019, the official of that Ministerio de Salud, Environmental Manager Marylin Sánchez Alpízar, responded via email to Dr. Marcela Wright, agreeing on the day and time of the inspection visit, set for July 5, 2019, and they found the following transcribed points: "In accordance with the request for support made to the Clínica Dr. Solón Núñez Frutos for accompaniment and assessment regarding the situation of Jorge Fallas, hoarder of Hatillo #8, and his condition, we appeared at the place of residence, Dr. Wendy Wright Barboza from the Ebais of Hatillo #8, MSc. Flor Villalobos Mora, Dr. Eduardo Arguedas Barquero, and myself; upon conducting the visit, he did not answer" (report rendered under oath); q) on July 10, 2019, through Official Letter No. CS-ARS-H-002-2019 addressed to the Unidad de Rectoría de la Región Central Sur, Ministerio de Salud, a Request for Professional Support was sent to request a review of the will in the national archive or any probate proceeding (proceso sucesorio) given the doubt about the owner of the dwelling inhabited by Jorge Fallas Vargas, since in the registo nacional it is in the name of his mother, who is deceased (report rendered under oath); r) on July 12, 2019, through official letter No. MS-DRRSCS-1848-2019 issued by the Regional Director, Dr. Guillermo Flores Galindo, of the Dirección Regional de Rectoría de la Salud Central Sur, the previously made request for support No. CS-ARS-H-002-2019 was returned, given that Asuntos Jurídicos indicates that it is a process that the áreas can carry out (report rendered under oath); s) on August 21, 2019, official letter No. 10460-2019-DHR issued by the Defensoría de los Habitantes is received, since Mrs. María Francisca Gómez Calvo filed a complaint before that instance, for which we are requested to provide notification and a report on the case (report rendered under oath); t) on August 26, 2016, a confidential report on the complaint filed with the área rectora de salud of hatillo against a hoarder located in Hatillo #8 was sent through official letter No. CS-DARS-H-344-19 to the officials: MSc. Hazel Díaz Meléndez, Director, Control de Gestión Administrativa, Defensoría de los Habitantes, and to Licda. Roxana Quirós Cavallini, Defensoría de los Habitantes (report rendered under oath); u) on November 11, 2019, through a request sent by email and with instructions from Ms. Paula Vargas Ramírez, Vice Mayor of San José, they requested an update and follow-up on the case of Mr. Jorge Fallas Vargas (report rendered under oath); v) on November 20, 2019, a confidential report on the complaint filed with the Área Rectora de Salud of Hatillo against a hoarder located in Hatillo #8, addressed to Lic. Paula Vargas Ramírez, Vice Mayor of San José, was sent through official letter No. MS-DRRSCSDARSH-602-19 and by email (report rendered under oath); w) a telephone consultation was made to the fiscalía de Hatillo #2 to request the requirements to file a Search Warrant Order (Orden de Allanamiento), since it has not been possible to notify the respondent and the situation worsens, to which the response given is that since no crime exists, they have no basis in Law to carry out such an act (report rendered under oath); y) on November 21, 2019, based on the telephone conversation previously held with the Fiscalía de Hatillo #2 and on their recommendations, official letter No. MS-ORRSCS-OARsH-605-19 was issued to CONAPAM, to the Department of Social Work, in order to request accompaniment to the respondent's house, verify the state, and attempt through this means to notify Mr. Fallas, since being 69 years old, this entity can intervene (report rendered under oath); z) currently, they are awaiting a response to the official letter sent to CONAPAM, as it is impossible to obtain a response by making telephone calls (report rendered under oath).

III.- On the merits.- The petitioner alleges that for several years she has requested that the problem she faces with a neighbor, Jorge Fallas Vargas, be resolved. He lives adjacent to her house in deplorable conditions, as he has no water or electricity services; additionally, he cooks with firewood in the early mornings on a wooden second floor. She explains that her dwelling fills with smoke and the heat that passes through the walls suffocates her and causes her fear that a disaster may occur. She points out that her neighbor also has his dwelling saturated with old clothes, bags full of garbage, and lives with cats. In this regard, the respondent authority of the Ministerio de Salud indicates that from the study of the case file, it is clear that this Área Rectora is aware of a complaint regarding a hoarder located in Hatillo 8, but that the complaint was not filed by the petitioner, but by another person. Furthermore, it is stated under oath that they have conducted several visits to the respondent dwelling and that, in response to said complaint, they have undertaken many efforts to notify Mr. Jorge Fallas Vargas, but it has not been possible. From the evidence provided, it is clear that the Health authorities have contacted the authorities of the Fuerza Pública, Policía Municipal, the Clínica Dr. Solón Núñez Frutos, Ebais of Hatillo #8, CONAPAM, among others. However, despite all these actions, they have still not managed to notify the respondent of the issued sanitary order. Nevertheless, in the opinion of this Court, the failure to notify cannot be attributed to negligence on the part of the health authorities, but rather to the complexity of the case, which has made it difficult to provide an immediate solution to the case. Thus, this Court does not find sufficient elements to uphold the petitioner's claim, and therefore, the appropriate course of action is to dismiss the action. However, a call for attention is made to the health authorities to continue with the efforts they have been undertaking with the corresponding instances and with the help of the authorities they deem necessary, so that they may open a probate proceeding (proceso sucesorio) to appoint an executor (albacea) and be able to notify the sanitary order, as indicated in the report rendered under oath.

IV.- Documentation provided to the case file. The petitioner is hereby warned that if any paper documents, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic device or one produced by new technologies, were provided, these must be withdrawn from the office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, any material not withdrawn within this period will be destroyed, as provided in the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in session No. 27-11 of August 22, 2011, article XXVI and published in the Boletín Judicial number 19 of January 26, 2012, as well as in the agreement approved by the Consejo Superior del Poder Judicial, in session No. 43-12 held on May 3, 2012, article LXXXI.

**Therefore:** The action is declared without merit.

Sala Constitucional Analizado por: SALA CONSTITUCIONAL *190232640007CO* Res. Nº 2020002398 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del siete de febrero de dos mil veinte .

Recurso de amparo interpuesto por MARÍA FRANCISCA GÓMEZ CALVO, cédula de identidad No. 0401051076, contra el MINISTERIO DE SALUD y la MUNICIPALIDAD DE SAN JOSÉ.

Resultando:

1.- Por escrito recibido en la Secretaría de la Sala Constitucional el 6 de diciembre del año en curso, el recurrente presenta recurso de amparo y manifiesta que habita en Hatillo. Indica que desde el 2015 ha solicitado que se resuelva el problema que enfrenta con un vecino, Jorge Fallas Vargas, quien vive contiguo a su casa en una condición deplorable, pues no cuenta con los servicios de agua ni electricidad; además, cocina con leña en las madrugadas en un segundo piso de madera. Explica que su vivienda se llena de humo y el calor que atraviesa a través de las paredes la sofoca y le causa temor a que se produzca un desastre. Señala que su vecino, también tiene saturada la vivienda con ropa vieja, bolsas llenas de basura y convive con gatos. Sostiene que, debido a todo lo anterior, el peligro de incendio es inminente, con el agravante que un incendio sería catastrófico para toda la alameda. Aunado a ello, los malos olores en las mañanas son insoportables y han proliferado las ratas, moscas, zancudos y cucarachas. Aduce que las autoridades recurridas, a la fecha en la que acude en amparo, no han realizado lo necesario para erradicar el peligro que esto representa para la salud y la vida de las personas. Agrega que aproximadamente a 5 metros de distancia se ubica el Centro Educativo Jorge Debravo, por lo que esta situación podría implicar un peligro para la salud de los alumnos y personas que acuden a ese centro educativo. Estima que los hechos descritos lesionan sus derechos fundamentales.

2.- Informa bajo juramento Johnny Araya Monge en su calidad de Alcalde de la Municipalidad de San José, que la municipalidad no ha recibido queja o denuncia alguna sobre el caso que señala la recurrente. No obstante, al conocer del caso se atiende por medio del Departamento de Servicio Ambientales. Y en cuanto a residuos de la vía pública se procedió el día de ayer a limpiarlos. No le es posible limpiar lo que se encuentre en propiedad privada. Solicita se desestime el recurso.

3.- Informa bajo juramento Eduardo Arguedas Barquero, en su condición de Médico Director del Área Rectora de Salud de Hatillo, que en sus archivos y base de datos, la recurrente no figura como denunciante ante este caso. Sin embargo, esa Área Rectora de Salud tiene conocimiento ante denuncia sobre acumulador ubicado en Hatillo 8 en este caso interpuesta por otra persona. El 30 de noviembre de 2018, el Sr. Diego Salazar Gómez con cédula de identidad 1-1179-0273, teléfono 8327-2542 y correo electrónico [email protected], interpone denuncia en el Área Rectora de Salud Hatillo del Ministerio de Salud la denuncia 2150-18 contra NO INDICA (ya que él indica no conocer el nombre del denunciado) ubicado en la provincia San José, Cantón Central, Distrito Hatillo, Hatillo 8, acera 5, casa #10, mediante el Formulario D-1 "Presentación Denuncia Sanitaria" MS.NI.S1A.07.P.06 en tipo de actividad marca: Habitacionales (viviendas, condominios, urbanizaciones y otros), en tanto que en tipo de denuncia señala por malos olores, humos y gases, polvo o partículas, inhabitabilidad, vectores(mosca y otros), roedores, uso de sustancias tóxicas, seguridad, almacenamiento de combustible o gas, alimentos en mal estado o contaminados. Señala que en atención al trámite de la denuncia indicada se programa visita del inspector para el día: SEMANA 4 (DEL 21 AL 25 DE ENERO 2019 DE 8AM A 4PM). El 07 de febrero de 2019 mediante Acta de Inspección N' CS-ARS-H-MSA-013-19 a las 09:30 horas la funcionaria de ese Ministerio de Salud Gestora Ambiental Marylin Sánchez Alpízar, indica: "Me apersoné al sitio del problema y sí se evidencia la acumulación de basura en dicha propiedad, se organizará visita para girar los actos administrativos correspondientes. Firma vecina, como testigo de inspección ocular." Luego, se procede a realizar Orden Sanitaria N' ARS-H-(M)-001-2019 con el fin de notificar ante Jorge Fallas Vargas quien es el que habita la vivienda denunciada. Agrega que se han apersonado a realizar notificación de Orden Sanitaria N' ARS-H-(M)-001-2019 al denunciado: Jorge Fallas Vargas, se llamó repetidas veces a la casa de habitación y el mismo no los atendió. En virtud de ello, el 21 de marzo de 2019 se remitió solicitud de apoyo mediante oficio N' CSARS-H-MS-016-2019 a la Policía Municipal de San José para realizar visita en conjunto con motivo de notificar Orden Sanitaria e interponer los actos que correspondan para el día 28 de marzo del 2019 con horario de 09: 30 horas. El día 04 de abril de 2019, se remite al Señor Dr. Guillermo Flores Galindo Director Regional de Rectoría de la Salud Región Central Sur mediante oficio N° CS-DARS-H-MS-021-19 informe sobre denuncia interpuesta en el área Rectora de Salud de Hatillo por acumulador ubicado en Hatillo #8. El día 5 de abril de 2019, se remite a la Sra. Paula Vargas Ramírez Vicealcaldesa de San José, Municipalidad de San José mediante oficio N° CSDARS-H-MS-022-2019 informe sobre denuncia interpuesta en el área Rectora de Salud de Hatillo de manera confidencial en contra de acumulador ubicado en Hatillo #8. El 24 de abril de 2019, mediante Acta de Inspección N' CS-ARS-H-MSA-062-19 a las 09:00 horas la funcionaria de ese Ministerio de Salud Gestora Ambiental Marylin Sánchez Alpízar y el funcionario perteneciente a la Policía Municipal de San José Lic. Manuel Reid Villalobos, apuntan lo siguiente: "Se realiza reunión con Policia Municipal, para realizar notificación al Señor Jorge Fallas Vargas, dirección: Hatillo #8, Avenida Nosara, detrás de la Escuela Jorge de Bravo. La intención es notificar Orden Sanitaria N' ARS-H-(M)-001-2019, se llama repetidas veces a la casa de habitación y el mismo no responde". El 28 de mayo de 2019, mediante Acta de Inspección N° CS-ARS-H-MSA-072-19 a las 09:00 horas la funcionaria de ese Ministerio de Salud Gestora Ambiental Marylin Sánchez Alpízar y el Médico Director Eduardo Arguedas Barquero, encontraron lo siguiente: "Al atender caso referente a acumulador ubicado en Hatillo #8, me apersoné en conjunto con el Director del Área Dr. Eduardo Arguedas Barquero con el fin de inspeccionar y notificar Orden Sanitaria al Señor Jorge Fallas Vargas, nuevamente el mismo no salió de la casa de habitación al llamarlo repetidas veces.” Se considerará la opinión de un abogado para solicitar que el caso se lleve a través de un Juez. En base a conversaciones sostenidas con los abogados de la Región Central Sur se solicita la opinión por parte de estos para proceder vía legal, sin embargo, recomiendan que en primera instancia antes de llegar a este extremo, exista intervención de la clínica y valoración médica ya que es un adulto mayor, por ende, se procederá a realizar solicitud a la Clínica Dr. Solón Núñez Frutos. El día 20 de junio de 2019, se remite a la Sra. Dra. Milena Quijano Barrantes, Directora Médica de la Clínica Dr. Solón Núñez Frutos mediante oficio N° CS-DARS-H-MS-034-2019 solicitud de apoyo para realizar visita en conjunto a casa de habitación del Señor Jorge Fallas Vargas. El día 24 de junio de 2019, se recibe por medio de correo electrónico traslado de oficio CS-DARS-H-MS-034-19 por parte de la Dra. Mylena Quijano Barrantes, Directora Médica, Clínica Dr. Solón Núñez Frutos hacia la jefatura de Consulta Externa del Área de Salud Hatillo Dra. Andrea Marín Madrigal. El día 26 de junio de 2019, se recibe mediante correo electrónico al usuario de la funcionaria de ese Ministerio de Salud Marylin Sánchez Alpízar intervención de la Dra. Wright del Ebais de Hatillo 8, con el fin de coordinar, día, fecha y hora de visita a casa de habitación del denunciante. El día 28 de junio de 2019 se hace búsqueda por medio de la plataforma del Registro Nacional, consultas gratuitas, el número de finca de la propiedad y se encuentra a nombre de la madre de Jorge Fallas Vargas, María Vargas Arroyo, quien se encuentra fallecida, información reiterada por medio de la plataforma del Tribunal Supremo de Elecciones, Consultas Civiles. El día 01 de julio de 2019 la funcionaria de ese Ministerio de Salud Gestora Ambiental Marylin Sánchez Alpízar, vía correo electrónico responde a la Dra. Marcela Wright, día y hora de visita de inspección a convenir. El 05 de julio de 2019, mediante Acta de Inspección N° CS-ARS-H-MSA-0100-19 a las 09:30 horas la funcionaria de ese Ministerio de Salud Gestora Ambiental Marylin Sánchez Alpízar y la funcionaria perteneciente al Ebais de Hatillo #8 la Dra. Wendy Wright Barboza, indican: "De acuerdo con la solicitud de apoyo realizada a la Clínica Dr. Solón Núñez Frutos para acompañamiento y valoración ante situación de Jorge Fallas acumulador de Hatillo #8 y su situación, nos apersonamos al lugar de habitación, la Dra. Wendy Wright Barboza del Ebais de Hatillo #8, la MSc. Flor Villalobos Mora y el Dr. Eduardo Arguedas Barquero y mi persona, al realizar visita, el mismo no atendió". El día 26 de julio de 2019, mediante oficio N° MS-DARS-H-221-2019 "Respuesta ante solicitud de copia de expediente" el Señor Diego Salazar Gómez, denunciante, recibe documentación el cual se le atribuye que se puede presentar en sus instalaciones cuando guste para fotocopiar el expediente, ya que se había realizado su consulta de poseer esta información al Área Redora de Salud, siendo esta aprobada. El día 21 de agosto de 2019 se recibe oficio N° 10460-2019-DHR emitido por la Defensoría de los Habitantes ya que la Señora María Francisca Gómez Calvo, portador de la cédula de identidad número 4-1051-076 realizó denuncia ante esta instancia, por la que se nos solicita notificación y solicitud de informe del caso. El día 26 de agosto de 2016 se remite mediante oficio N° CS-DARS-H-344-19 a las funcionarias: MSc. Hazel Díaz Meléndez, Directora, Control de Gestión Administrativa, Defensoría de los Habitantes y a la Licda. Roxana Quirós Cavallini, Defensoría de los Habitantes, informe sobre denuncia interpuesta en el área rectora de salud de hatillo de manera confidencial en contra de acumulador ubicado en Hatillo #8. El día 11 de noviembre de 2019 mediante solicitud emitida por correo electrónico y con instrucciones de la Sra. Paula Vargas Ramírez, Vicealcaldesa e San José, solicitan un avance y seguimiento del caso del Señor Jorge Fallas Vargas. Señala que también, se realizó consulta vía teléfono a la fiscalía de Hatillo #2 con el fin de solicitar los requerimientos para interponer una Orden de Allanamiento ya que no se ha logrado notificar al denunciado y la situación empeora, a lo cual se da respuesta que dado a que no existe delito alguno, no tienen por Ley en que basarse para realizar dicho acto. El día 21 de noviembre de 2019 en base a conversación telefónica anteriormente realizada a la Fiscalía de Hatillo #2 y por sus recomendaciones, se procedió a realizar oficio N' MS-ORRSCS-OARsH-605-19 ante CONAPAM, al Departamento de Trabajo Social con el fin de solicitar acompañamiento a casa del denunciado, verificar estado e intentar por este medio notificar al Señor Fallas, ya que al ser su edad 69 años esa entidad puede intervenir. Actualmente se está a la espera de la respuesta ante oficio dirigido a CONAPAM, ya que al realizar llamadas telefónicas es imposible obtener respuesta. Dada la complejidad del caso, esta autoridad de salud, estará realizando las acciones necesarias, en las instancias correspondientes, para que la autoridad competente, realice la apertura de un proceso sucesorio, para que se nombre un albacea y poder notificar la orden sanitaria, toda vez que de acuerdo a la información del Registro nacional de la Propiedad, dicha vivienda se encuentra a nombre de la Señora Lita María Vargas Arroyo, Finca número 533527-000, dadas las condiciones de salud del Señor Jorge Fallas Vargas, adulto mayor de 69 años, por lo que se les ha dificultado darle solución inmediata al caso, respetando los derechos que posee el denunciado como ser humano y adulto mayor. Considera que del acervo probatorio que consta en autos, las actuaciones realizadas por parte de las Autoridades Sanitarias del Área Rectora de Salud de Hatillo se encuentran apegadas al bloque de legalidad que rige los actos públicos.

4.- Mediante resolución de las a las once horas y seis minutos de veintiuno de enero de dos mil veinte, se ampliaron las partes recurridas en el informe y se dio audiencia al Jefe de la Delegación Policial de Hatillo.

5.- Informa bajo juramento Ronny Sánchez Villegas, en su condición de Sub Jefe de la Delegación Policial de Hatillo, que efectivamente en su registros consta que les fue solicitada la colaboración para acompañar a funcionarios del Ministerio de Salud, pero por cuestiones de orden, no se logró ubicar el documento de solicitud formal. Sin embargo, se contactó a la gestionante y manifestó que ya se había realizado la actividad y no se requería otro trámite.

6.- En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Monge Pizarro; y,

Considerando:

I.- Objeto del recurso.- La recurrente indica desde hace varios años, ha solicitado que se resuelva el problema que enfrenta con un vecino, Jorge Fallas Vargas, quien vive contiguo a su casa en una condición deplorable, pues no cuenta con los servicios de agua, ni electricidad; además, cocina con leña en las madrugadas en un segundo piso de madera. Explica que su vivienda se llena de humo y el calor que atraviesa a través de las paredes la sofoca y le causa temor a que se produzca un desastre. Señala que su vecino, también tiene saturada la vivienda con ropa vieja, bolsas llenas de basura y convive con gatos. Sostiene que, debido a todo lo anterior, el peligro de incendio es inminente, con el agravante que un incendio sería catastrófico para toda la alameda. Aunado a ello, los malos olores en las mañanas son insoportables y han proliferado las ratas, moscas, zancudos y cucarachas. Aduce que las autoridades recurridas, a la fecha en la que acude en amparo, no han realizado lo necesario para erradicar el peligro que esto representa para la salud y la vida de las personas.

II.- Hechos probados.- De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos: a) el Área Rectora de Salud recurrida, tiene conocimiento de denuncia sobre acumulador ubicado en Hatillo 8, pero interpuesta por otra persona el 30 de noviembre de 2018, el Sr. Diego Salazar Gómez contra NO INDICA (ya que él indica no conocer el nombre del denunciado) (informe rendido bajo juramento); b) en el espacio de descripción de la denuncia señala "vivienda en estado de abandono, con acumulación de basura y escombros de todo tipo, artefactos eléctricos, cartón, plástico, ropa, madera y otros, que provocan proliferación de plagas de cucarachas, moscas, mosquitos, ratones y ratas, el denunciado manipula materiales inflamables y peligrosos que quema en fogatas al aire libre, la casa se ubica en Hatillo 8, acera 5, casa #11 (informe rendido bajo juramento); c) en atención al trámite realizado, se le comunica que se ha programado la visita del inspector para el día: SEMANA 4 (del 21 al 25 de enero 2019 de 8am a 4pm) (informe rendido bajo juramento); d) el 07 de febrero de 2019 mediante Acta de Inspección N' CS-ARS-H-MSA-013-19 a las 09:30 horas una funcionaria de ese Ministerio de Salud Gestora Ambiental, encontraron los siguientes puntos transcritos: "Me apersoné al sitio del problema y sí se evidencia la acumulación de basura en dicha propiedad, se organizará visita para girar los actos administrativos correspondientes. Firma vecina, como testigo de inspección ocular." (informe rendido bajo juramento); e) luego se procede a realizar Orden Sanitaria N' ARS-H-(M)-001-2019 con el fin de notificar ante Jorge Fallas Vargas quien es el que habita la vivienda denunciada, ya que "se logra evidenciar la situación y problemática de acumulación de residuos en dicha propiedad", por ello se le ordena: “ eliminar todo tipo de residuo acumulado dentro y fuera de su casa de habitación, así por ende eliminar las plagas existentes en dicho lugar", y se le da un plazo de 25 días hábiles de plazo (informe rendido bajo juramento); f) las autoridades de Salud, se apersonaron a realizar notificación de Orden Sanitaria N' ARS-H-(M)-001-2019 al denunciado: Jorge Fallas Vargas, pero se llamó repetidas veces a la casa de habitación y el mismo no atendió (informe rendido bajo juramento); g) posteriormente, se coordinó con la Policía de Hatillo para apoyo y soporte y los mismos no atendieron dicha solicitud, informando que el oficio entregado se había extraviado (informe rendido bajo juramento); h) el 21 de marzo de 2019 se remitió solicitud de apoyo mediante oficio N' CSARS-H-MS-016-2019 a la Policía Municipal de San José para realizar visita en conjunto con motivo de notificar Orden Sanitaria e interponer los actos que correspondan para el día 28 de marzo del 2019 con horario de 09: 30 horas (informe rendido bajo juramento); i) el día 04 de abril de 2019, se remite al Señor Dr. Guillermo Flores Galindo Director Regional de Rectoría de la Salud Región Central Sur mediante oficio N° CS-DARS-H-MS-021-19 informe sobre denuncia interpuesta en el Area Rectora de Salud de Hatillo por acumulador ubicado en Hatillo #8 (informe rendido bajo juramento); j) el día 5 de abril de 2019, se remite a la Sra. Paula Vargas Ramírez Vicealcaldesa de San José, Municipalidad de San José mediante oficio N° CSDARS-H-MS-022-2019 informe sobre denuncia interpuesta en el área Rectora de Salud de Hatillo de manera confidencial en contra de acumulador ubicado en Hatillo #8 (informe rendido bajo juramento); k) el 24 de abril de 2019, mediante Acta de Inspección N' CS-ARS-H-MSA-062-19 a las 09:00 horas la funcionaria de ese Ministerio de Salud Gestora Ambiental Marylin Sánchez Alpízar y el funcionario perteneciente a la Policía Municipal de San José Lic. Manuel Reid Villalobos, indican: "Se realiza reunión con Policía Municipal, para realizar notificación al Señor Jorge Fallas Vargas, dirección: Hatillo #8, Avenida Nosara, detrás de la Escuela Jorge de Bravo. La intención es notificar Orden Sanitaria N' ARS-H-(M)-001-2019, se llama repetidas veces a la casa de habitación y el mismo no responde"; l) el 28 de mayo de 2019, mediante Acta de Inspección N° CS-ARS-H-MSA-072-19 a las 09:00 horas la funcionaria de ese Ministerio de Salud Gestora Ambiental Marylin Sánchez Alpízar y el Médico Director Eduardo Arguedas Barquero, indican: "AI atender caso referente a acumulador ubicado en Hatillo #8, me apersoné en conjunto con el Director del Área Dr. Eduardo Arguedas Barquero con el fin de inspeccionar y notificar Orden Sanitaria al Señor Jorge Fallas Vargas, nuevamente el mismo no salió de la casa de habitación al llamarlo repetidas veces” (informe rendido bajo juramento); m) dada las condiciones señaladas, se consulta a los abogados de la Región Central Sur y se les solicita la opinión por parte de estos para proceder vía legal, sin embargo, recomiendan que en primera instancia antes de llegar a este extremo, exista intervención de la clínica y valoración médica ya que es un adulto mayor, por ende, se procederá a realizar solicitud a la Clínica Dr. Solón Núñez Frutos (informe rendido bajo juramento); n) el día 20 de junio de 2019, se remite a la Directora Médica de la Clínica Dr. Solón Núñez Frutos, mediante oficio N° CS-DARS-H-MS-034-2019 solicitud de apoyo para realizar visita en conjunto a casa de habitación del Señor Jorge Fallas Vargas, el día 27 de junio de 2019 con el fin de valorar la situación de este (informe rendido bajo juramento); ñ) el día 24 de junio de 2019, se recibe por medio de correo electrónico traslado de oficio CS-DARS-H-MS-034-19 por parte de la Dra. Mylena Quijano Barrantes, Directora Médica, Clínica Dr. Solón Núñez Frutos hacia la jefatura de Consulta Externa del Área de Salud Hatillo Dra. Andrea Marín Madrigal y el día 26 de junio de 2019, se recibe mediante correo electrónico al usuario de la funcionaria de este Ministerio de Salud Marylin Sánchez Alpízar intervención de la Dra. Wright del Ebais de Hatillo 8, con el fin de coordinar, día, fecha y hora de visita a casa de habitación del denunciante (informe rendido bajo juramento); o) el día 28 de junio de 2019 se hace búsqueda por medio de la plataforma del Registro Nacional, consultas gratuitas, el número de finca de la propiedad y la misma se encuentra a nombre de la madre de Jorge Fallas Vargas, Uta María Vargas Arroyo, quien se encuentra fallecida, información reiterada por medio de la plataforma del Tribunal Supremo de Elecciones, Consultas Civiles (informe rendido bajo juramento); p) el día 01 de julio de 2019 la funcionaria de ese Ministerio de Salud Gestora Ambiental Marylin Sánchez Alpízar, vía correo electrónico responde a la Dra. Marcela Wright, día y hora de visita de inspección a convenir, y se establece el 05 de julio de 2019, y encontraron los siguientes puntos transcritos: "De acuerdo con la solicitud de apoyo realizada a la Clínica Dr. Solón Núñez Frutos para acompañamiento y valoración ante situación de Jorge Fallas acumulador de Hatillo #8 y su situación, nos apersonamos al lugar de habitación, la Dra. Wendy Wright Barboza del Ebais de Hatillo #8, la MSc. Flor Villalobos Mora y el Dr. Eduardo Arguedas Barquero y mi persona, al realizar visita, el mismo no atendió" (informe rendido bajo juramento); q) el 10 de julio de 2019, mediante Oficio N' CS-ARS-H-002-2019 dirigido a la Unidad de Rectoría de la Región Central Sur, Ministerio de Salud se remite Solicitud de Apoyo Profesional con el fin de solicitar revisión de testamento en el archivo nacional o algún proceso sucesorio ante duda de propietario (a) de la vivienda en la que habita Jorge Fallas Vargas, ya que en el registro nacional se encuentra a nombre de su madre, quién se halla fallecida (informe rendido bajo juramento); r) el día 12 de julio de 2019 mediante oficio N° MS-DRRSCS-1848-2019 emitido por el Director Regional, Dr. Guillermo Flores Galindo de la Dirección Regional de Rectoría de la Salud Central Sur se hace devolución de la solicitud de apoyo realizada anteriormente N° CS-ARS-H-002-2019 dado a que Asuntos Jurídicos indica que es un trámite que las áreas pueden realizar (informe rendido bajo juramento); s) el día 21 de agosto de 2019 se recibe oficio N° 10460-2019-DHR emitido por la Defensoría de los Habitantes ya que la Señora María Francisca Gómez Calvo, realizó denuncia ante esa instancia, por la que se nos solicita notificación y solicitud de informe del caso (informe rendido bajo juramento); t) el día 26 de agosto de 2016 se remite mediante oficio N° CS-DARS-H-344-19 a las funcionarias: MSc. Hazel Díaz Meléndez, Directora, Control de Gestión Administrativa, Defensoría de los Habitantes y a la Licda. Roxana Quirós Cavallini, Defensoría de los Habitantes, informe sobre denuncia interpuesta en el área rectora de salud de hatillo de manera confidencial en contra de acumulador ubicado en Hatillo #8 (informe rendido bajo juramento); u) el día 11 de noviembre de 2019 mediante solicitud emitida por correo electrónico y con instrucciones de la Sra. Paula Vargas Ramírez, Vicealcaldesa e San José, solicitan un avance y seguimiento del caso del Señor Jorge Fallas Vargas (informe rendido bajo juramento); v) el día 20 de noviembre de 2019 se remite mediante oficio N' MS-DRRSCSDARSH- 602-19 y enviado por correo electrónico, informe sobre denuncia interpuesta en el Área Redora de Salud de Hatillo de manera confidencial en contra de acumulador ubicado en Hatillo #8 dirigido hacia la Lic. Paula Vargas Ramírez, Vicealcaldesa de San José (informe rendido bajo juramento); w) se realizó consulta vía teléfono a la fiscalía de Hatillo #2 con el fin de solicitar los requerimientos para interponer una Orden de Allanamiento ya que no se ha logrado notificar al denunciado y la situación empeora, a lo cual se da respuesta que dado a que no existe delito alguno, no tienen por Ley en que basarse para realizar dicho acto (informe rendido bajo juramento); y) el día 21 de noviembre de 2019 con base a conversación telefónica anteriormente realizada a la Fiscalía de Hatillo #2 y por sus recomendaciones, se procedió a realizar oficio N° MS-ORRSCS-OARsH-605-19 ante CONAPAM, al Departamento de Trabajo Social con el fin de solicitar acompañamiento a casa del denunciado, verificar estado e intentar por este medio notificar al señor Fallas, ya que al ser su edad 69 años esta entidad puede intervenir (informe rendido bajo juramento); z) actualmente se está a la espera de la respuesta ante oficio dirigido a CONAPAM, ya que al realizar llamadas telefónicas es imposible obtener respuesta (informe rendido bajo juramento).

III.- Sobre el fondo.- La recurrente acusa que desde hace varios años ha solicitado que se resuelva el problema que enfrenta con un vecino, Jorge Fallas Vargas, quien vive contiguo a su casa en una condición deplorable, pues no cuenta con los servicios de agua ni electricidad; además, cocina con leña en las madrugadas en un segundo piso de madera. Explica que su vivienda se llena de humo y el calor que atraviesa a través de las paredes la sofoca y le causa temor a que se produzca un desastre. Señala que su vecino, también tiene saturada la vivienda con ropa vieja, bolsas llenas de basura y convive con gatos. Al respecto la autoridad recurrida del Ministerio de Salud indican que del estudio de los autos se extrae que esa Área Rectora, tiene conocimiento de denuncia sobre acumulador ubicado en Hatillo 8, pero que la denuncia no ha sido interpuesta por la recurrente, sino por otra persona. Además, bajo juramento se indica que han realizado varios visitas a la vivienda recurrida y que además en atención a dicha denuncia, han realizando muchas gestiones para lograr notificar al señor Jorge Fallas Vargas, pero no ha sido posible. De la prueba aportada se extrae que las autoridades de Salud han contactado a las autoridades de la Fuerza Pública, Policía Municipal, del Clínica Dr. Solón Núñez Frutos, Ebais de Hatillo #8, de CONAPAM, entre otros. No obstante y pese a todas esas acciones aún no han logrado notificar al denunciado la orden sanitaria emitida. Sin embargo, en criterio de este Tribunal no podría atribuírsele la falta de notificación a una negligencia de las autoridades de salud, sino a la complejidad del caso, que ha dificultado darle solución inmediata al caso. Así las cosas, este Tribunal no encuentra elementos suficientes para acoger el reclamo de la recurrente y por ello, lo procedente es desestimar el recurso. No obstante, se hace un llamado de atención a las autoridades de salud, para que continúen con las gestiones que vienen realizando en las instancias correspondientes y con la ayuda de las autoridades que consideren necesarias, para que realicen la apertura de un proceso sucesorio, a fin de que se nombre un albacea y poder notificar la orden sanitaria, tal y como lo indican en el informe rendido bajo juramento.

IV.- Documentación aportada al expediente. Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara sin lugar el recurso.
