Amparo proceeding (recurso de amparo) processed under expediente N° 19-022206-0007-CO, filed by [Nombre 001], identity card [Valor 001], on behalf of [Nombre 002], identity card [Valor 002], against MUNICIPALIDAD DE ALAJUELA.
Background:
Justice Araya García writes the opinion; and,
Considerations:
The petitioner asserts that the community in which the protected party lives has serious environmental problems because the storm drains are in poor condition, causing stormwater to flow freely, and intervention was therefore requested from the Municipalidad de Alajuela. Nevertheless, as of the date this amparo proceeding was filed, that entity had not performed the corresponding works to correct the cited problem.
The following relevant facts are deemed duly established and material to the resolution of this proceeding:
The protected party is a resident of Cebadilla de Turrúcares de Alajuela, specifically near Salón Los Almendros, where she also has premises in which she conducts her business activity (undisputed fact).
The cited locality experiences stormwater flooding as a result of the poor condition of the sewer system and the lack of infrastructure to allow the water to flow properly and be collected by drainage devices. Consequently, the protected party, without specifying the exact date, filed a complaint with the Municipalidad de Alajuela, which is being processed under N° 24954-2018 (see the reports submitted by the respondents).
On 16 de enero de 2019, the municipal authorities conducted an on-site inspection, which resulted in the Stormwater Drainage Coordinator issuing official letter N° MA-AAP-0053-2019, stating: “(…) a) The petitioner’s property is located at a point where water from two different sources converges. The first source, which has the greater flow, comes from Ruta Nacional N° 721, which is administered by El Estado (sic). The second comes from the railroad right-of-way, which is administered by INCOFER. This water (that originating from the National Route and the railroad right-of-way) reaches the cantonal road and is channeled through the area’s stormwater drainage systems. It is important to note that the Cantonal Road begins in front of the property of Ms. [Nombre 002]; therefore, the stormwater causing the problems does not originate on municipally administered roads. b) The land where the business is located lies below the level of the road (and even below the stormwater drainage system); therefore, because of the topography and the effect of gravity, any overflow or significant increase in flow causes the water to run to the lowest point, which coincides with the property of Ms. [Nombre 002]. c) There are no nearby natural watercourses or collection systems that would allow us to install new piping in the short term (…)” (see the reports submitted by the respondent authorities, as well as the evidence entered in the record).
By official letter N° MA-AAP-0002-2020, the Sewerage Coordinator of the Municipalidad de Alajuela identified the following options for addressing the problem reported by the protected party “(…) i) Construction of a stormwater system (sistema pluvial) in front of the property of Ms. [Nombre 002], so that the water does not enter her property. This would have implications for the property owner, since she would subsequently have to adapt access to her property, because it is not feasible to adjust the street levels in relation to the private property, as the latter is at a lower elevation than the street. This is because stormwater systems operate by gravity, and therefore the minimum elevation is determined by the final point where the water is discharged. ii) Carry out a water ‘cutoff’ at a higher point on the roadway in order to reduce the flow reaching the property where the problem occurs.
In this case, CONAVI and INCOFER must be asked to collaborate so that these institutions may identify the aforementioned drainage channels, since the roads converging at the site are Ruta Nacional N° 712 and the railroad right-of-way (Derecho de Vía del Ferrocarril). If this option proceeds, the Municipality undertakes to carry out the proper coordination and will collaborate (sic) to the extent permitted by law. iii) Construct a stormwater system using the railroad right-of-way, for which coordination will be undertaken with INCOFER to obtain permits to use this space. iv) Construct a stormwater system along the Ruta Cantonal that will allow us to discharge the flows generated from Ruta Nacional N° 712 and the railroad right-of-way. v) Construct a stormwater system that discharges into a secondary stormwater collector (colector pluvial secundario), provided that the latter has the capacity to receive the newly generated flows (…)” (see reports submitted by the respondents).
With respect to the claims brought by the appellant, it should first be noted that, in its case law, this Court has recognized the obligation of Municipalities to take effective and prompt action in response to the needs of the territorial jurisdiction assigned to each municipal corporation, which is closely linked to the population component. These obligations derive from Articles 169 and 170 of the Political Constitution and encompass a broad range of activities. Thus, in judgments N° 2011-12886 of 12:44 hours on 23 de setiembre de 2011 and N° 2015010541 of 09:20 hours on 17 de julio de 2015, among others, this Chamber stated:
“(…) as established by Article 169 of the Political Constitution and the Municipal Code (Código Municipal), municipalities are responsible for administering local services and interests in order to promote the comprehensive development of the cantons in harmony with national development. Consequently, the Municipality must establish a comprehensive urban-planning policy (política integral de planeamiento urbano), in accordance with the relevant law, aimed at the efficient and harmonious development of urban centers and guaranteeing—at a minimum—efficient electricity and communications services; sound drinking-water supply and wastewater-disposal systems; adequate aqueduct and sewerage systems; city lighting and beautification systems; street and other public-road construction, repair, and cleaning services; and, in general, concrete and practical plans to make life comfortable and safe for the population.” Furthermore, regarding the provision of services, this Chamber has held—for example, in judgment N° 2016-000427 of 09:30 hours on 15 de enero de 2016—that their proper functioning constitutes a fundamental right.
This follows from the content of Articles 139, 140, and 191 of the Political Constitution. It entails an obligation on the various Public Administrations to provide services continuously, regularly, promptly, effectively, and efficiently. Likewise, the organizational provisions of the Fundamental Charter (Carta Fundamental) establish a series of principles governing the organization and functioning of the Administration, which have been developed through subconstitutional rules, such as the General Law of Public Administration (Ley General de la Administración Pública), which, in Articles 4, 225, paragraph 1, and 269, paragraph 1, imposes upon State bodies the duty to guide and support administrative organization and functions. Thus, the principle of effectiveness (principio de eficacia) presupposes that the administrative organization is designed to achieve the objectives and purposes assigned by the legal system itself, which requires planning and accountability.
The principle of efficiency (eficiencia), for its part, entails achieving the best results through the rational use of the resources available to the various agencies. The Administration is also subject to the principle of simplicity (principio de simplicidad), which must be understood as the obligation to ensure that administrative structures and their powers are easy to understand, without complex procedures that delay the fulfillment of public interests. The principle of promptness (principio de celeridad) requires Public Administrations to fulfill their objectives and purposes in the most expeditious, rapid, and appropriate manner possible, thereby avoiding undue and unjustified delays. These principles therefore impose a series of ongoing requirements, responsibilities, and duties on all public entities.
Article 50 of the Constitution establishes the pursuit of “the greatest well-being of all the country’s inhabitants” as a fundamental purpose and essential value of the Costa Rican State. Accordingly, a “healthy and ecologically balanced environment” forms part of the greatest well-being of all inhabitants and constitutes a cause, purpose, condition, and limit on the exercise of public powers and authority, not only by the State but also by the Municipalities. As with the right to property, the subject matter of the right to the environment is external to the integrity of the human person (unlike, for example, the right to life); however, unlike the subject matter of the right to property, the person forms part of and is integrated into the environment. Its protection therefore entails preserving the context essential to human life. Conduct that adversely affects it poses a threat to human existence itself and reduces or deprives everyone of the “greatest well-being.” Life depends on the environment; therefore, care must be taken to ensure that the conditions guaranteeing life are maintained over time. In judgment number 601-2009, this Chamber ruled as follows:
“The origins of environmental problems are complex and arise from an interaction between natural and social processes within the framework of the socioeconomic development model adopted by the country. For example, environmental problems arise when methods of exploiting natural resources cause ecosystem degradation exceeding the ecosystems’ capacity for regeneration, thereby harming broad sectors of the population and generating high environmental and social costs that result in a deterioration of quality of life; indeed, the primary objective of using and protecting the environment is to attain development and progress favorable to human beings (...) It is important to understand that, although human beings have the right to use the environment for their own development, they also have a duty to protect and preserve it for present and future generations. This is not especially novel, because it is simply the application in this field of the principle of ‘injury’ (principio de la ‘lesión’), already firmly established in the general law, under which the legitimate exercise of a right has two essential limits: on the one hand, the equal rights of others and, on the other, the rational exercise and beneficial enjoyment of the right itself.” Accordingly, public entities, including Municipalities, are responsible for ensuring respect for a healthy and ecologically balanced environment within their respective territorial jurisdictions, as well as the well-being of all inhabitants of their respective cantons.
Within the framework of their constitutional and statutory powers, they must act to ensure respect for this right for all municipal residents and—again within the framework of their powers—act to mitigate or remedy actions that tend to violate it.
In the case before us, it is deemed established that the protected party is a resident of Cebadilla de Turrúcares de Alajuela, specifically near Salón Los Almendros, where she also has premises in which she conducts her business activity. That community experiences stormwater flooding problems as a consequence of the poor condition of the sewer system and the lack of infrastructure allowing the water to flow properly and be collected by suitable drainage devices. For these reasons, since 2018, the petitioner has requested the intervention of the authorities of the Municipalidad de Alajuela. Thus, on an unspecified date in 2018, the protected party filed a complaint with that institution, which was assigned case number 24954-2018. As a result of that filing, on 16 de enero de 2019, the municipal authorities conducted an inspection at the site, which resulted in official letter N° MA-AAP-0053-2019, in which the Coordinador de Alcantarillado de la Municipalidad de Alajuela stated:
“(…) a) The petitioner’s property is located at a site where water from two different points converges. The first, which carries the greater flow, comes from Ruta Nacional N° 721, which is administered by El Estado (sic). The second comes from the right-of-way (derecho de vía) of the railway line, which is administered by INCOFER. This water (that originating from the Ruta Nacional and the railway right-of-way) reaches the cantonal road and is channeled through the stormwater systems in the area. It is important to note that the Ruta Cantonal begins in front of the property of Ms. [Nombre 002], and therefore the stormwater causing the problems does not originate on roads under municipal administration. b) The land on which the business is located lies below the level of the road (including the stormwater system), and therefore, due to the topography and the effect of gravity, any overflow or significant increase in flow causes the water to run to the lowest point, which coincides with the property of Ms. [Nombre 002]. c) There are no nearby natural watercourses or collection systems that would allow us to install new piping in the short term (…)”.
Nevertheless, as of the dates on which the respondents submitted their responses, the corresponding works intended to resolve the problem reported by the protected party and described above had neither been arranged nor, consequently, carried out. This is so despite the existence of an assessment clearly indicating the need to carry out the corresponding works promptly, given the risk to the health and physical integrity of the petitioner, as well as that of the other people who live in and travel through the community of Cebadilla de Turrúcares de Alajuela, as a consequence of the stormwater flowing freely, which has also damaged the roadway. Likewise, official letter MA-AAP-0002-2020 set forth several options for addressing the aforementioned problem, without even one of them having been implemented. They are as follows:
“(...) i) Construction of a stormwater system in front of the property of Ms. [Nombre 002], so that the water does not enter her property. This would have consequences for the property owner, since she would subsequently have to adapt access to her parcel, because it is not feasible to adjust the street elevations to the private property, as the latter is at a lower elevation than the street. This is because stormwater systems operate by gravity, and therefore the minimum elevation is determined by the final point at which the water is discharged. ii) Diverting the water at a higher point along the road in order to reduce the flow reaching the property where the problem occurs. In this case, CONAVI and INCOFER must be asked to collaborate by identifying the aforementioned causes, because the routes that converge at the site are Ruta Nacional N° 712 and the Derecho de Vía del Ferrocarril. Should this option proceed, the Municipalidad undertakes to carry out the appropriate coordination and will collaborate (sic) to the extent permitted by law. iii) Constructing a stormwater system using the Derecho de Vía de Ferrocarril, for which coordination will be undertaken with INCOFER to obtain permits to use that space. iv) Constructing a stormwater system along the Ruta Cantonal that will allow us to drain the flows generated from Ruta Nacional N° 712 and the Derecho de Vía del Ferrocarril. v) Constructing a stormwater system that drains into a secondary stormwater collector, provided that the latter has the capacity to receive the new flows generated (…)”.
For their part, the respondents state that INCOFER and CONAVI could bear responsibility, since water comes from ruta nacional N°721 and from a railway line owned by INCOFER; however, the authorities of the respondent Municipalidad have not taken any steps to coordinate an action plan with the authorities of the aforementioned institutions in order to remedy the problem. They also attempt to justify their failure to address the situation of the community of Cebadilla adequately by arguing that resources are lacking. Those arguments, however, cannot be accepted, because the fundamental right to the proper functioning of public services and the right to a healthy environment, together with the principles identified in the third recital of this judgment, require Public Administrations to possess the capacity for foresight and adaptation so that they may address the difficulties that may arise in the course of their administration, satisfy the interests of those subject to their authority, and protect their legally protected interests (bienes jurídicos). The fact remains that no clear and defined intervention plan exists, leaving uncertainty regarding the time and allocation of resources needed to provide the community of Cebadilla de Turrúcares de Alajuela with a permanent solution to its stormwater and storm-sewer deterioration problem.
Under these circumstances, this amparo proceeding (proceso de amparo) must be granted, as is hereby ordered and under the terms set forth in the operative portion of this judgment.
In environmental matters, it is the undersigned Justice’s view that, if the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the contentious-administrative jurisdiction (jurisdicción contenciosa administrativa). Nevertheless, I do address the merits when other rights of the persons affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (artículo 50, de la Constitución Política), as in this case, in which allegations are made concerning pollution problems affecting the residents of the Sector de Cebadilla de Turrúcares, near Salón Los Almendros, due to stormwater originating from a public roadway. This affects the physical integrity and health of local residents, in violation of the right to enjoy a healthy and ecologically balanced environment and a dignified standard of quality of life.
The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, all material not collected within that period shall be destroyed pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, artículo XXVI, and published in Boletín Judicial número 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, artículo LXXXI.
Por tanto:
The appeal is granted. Laura María Chaves Quirós and Lawrence Chacón Soto, respectively Alcaldesa and Coordinador de Alcantarillado Pluvial, both of the Municipalidad de Alajuela, or whoever may hold those offices, are ordered to take the corresponding measures within the scope of their authority so that, within EIGHTEEN MONTHS from notification of this judgment, they intervene and provide a permanent solution to the sewer and stormwater problem affecting the community of Cebadilla de Turrúcares de Alajuela. The respondents are warned that, pursuant to artículo 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo appeal (recurso de amparo) that the person must comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipalidad de Alajuela is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction. Justice Salazar Alvarado appends a note. This judgment shall be served personally upon the respondents.

Recurso de amparo que se tramita en expediente N° 19-022206-0007-CO, interpuesto por [Nombre 001] , cédula de identidad [Valor 001] , a favor de [Nombre 002], cédula de identidad [Valor 002], contra MUNICIPALIDAD DE ALAJUELA.
Resultando:
Redacta el Magistrado Araya García; y,
Considerando:
El recurrente asegura que la comunidad en la que vive la amparada presenta serios problemas ambientales debido a que las alcantarillas se encuentran en mal estado, provocando que las aguas pluviales discurran libremente, por lo que se solicitó la intervención de la Municipalidad de Alajuela. No obstante, a la fecha de interposición de este recurso de amparo, dicha entidad no ha realizado las obras correspondientes para corregir el problema de cita.
De importancia para la resolución del presente recurso, se estiman como debidamente demostrados los siguientes hechos de relevancia:
La amparada es vecina de Cebadilla de Turrúcares de Alajuela, concretamente, cerca del Salón Los Almendros, donde, además, cuenta con un recinto donde realiza su actividad económica (hecho no controvertido) La localidad de cita presenta problemas de inundaciones con aguas pluviales, como consecuencia del mal estado del alcantarillado y de falta infraestructura para que las aguas discurran adecuadamente y sean recolectadas en los dispositivos de evacuación, por lo que la ampara, sin precisar fecha exacta, interpuso una denuncia ante la Municipalidad de Alajuela, la cual se tramita bajo N° 24954-2018 (ver informes rendidos por los recurridos).
En fecha 16 de enero de 2019, las autoridades de la Municipalidad realizaron una inspección en el lugar, a partir de la cual se generó el oficio N° MA-AAP-0053-2019, por parte del Coordinador de Alcantarillado, indicando: “(…) a) La propiedad de la recurrente se ubica en un sitio donde convergen aguas de dos puntos distintos. El primero, con el mayor caudal proviene de la Ruta Nacional N° 721 la cual es de administración de El Estado (sic). El segundo, proviene desde el derecho de vía de la línea férrea, la cual es de administración del INCOFER. Estas aguas (las provenientes de Ruta Nacional y derecho de vía del ferrocarril), llegan hasta la ruta cantonal y se encauzan mediante los sistemas pluviales del sector. Es importante anotar que al Ruta Cantonal inicia frente a la propiedad de la señora [Nombre 002] , por lo que las aguas pluviales que generan problemas no son producidas en rutas de administración municipal. b) El terreno donde se ubica el comercio se encuentra por debajo del nivel de la carretera (inclusive del sistema pluvial), por lo que cualquier desbordamiento o aumento significativo que se presente en el caudal, por topografía y debido al efecto de gravedad las aguas discurren hasta el punto más bajo, el cual coincide con la propiedad de la señora [Nombre 002] . c) No existen causes naturales o sistemas colectores cercanos que nos permitan realizar un entubado nuevo a corto plazo (…)” (ver informes rendidos por las autoridades recurridas, así como la prueba aportada a los autos).
Mediante oficio N° MA-AAP-0002-2020, el Coordinador de Alcantarillado de la Municipalidad de Alajuela indicó las siguientes opciones para tratar el problema denunciado por la tutelada “(…) i) Construcción de un sistema pluvial frente a la propiedad de la señora [Nombre 002], de manera que las aguas no ingresen a su inmueble. Esto tendría implicación al propietario ya que deberá posteriormente adecuar el acceso a su finca, debido a que no es factible ajustas los niveles de la calle con respecto a la propiedad privada por encontrarse está a un nivel inferior a la calle, esto por cuanto los sistemas pluviales funcionan por gravedad, por lo cual el nivel mínimo queda determinado por el punto final donde se depositan las aguas. ii) Realizar un “corte” de aguas en un nivel superior de la vía, esto para disminuir el caudal que llega a la propiedad donde se presenta el problema. Para este caso se deberá solicitar al CONAVI y al INCOFER la colaboración para que sean estas instituciones las que nos indiquen los dicho causales, esto por cuanto las vías que convergen en el sitio corresponden a la Ruta Nacional N° 712 y el Derecho de Vía del Ferrocarril.
De proceder con este caso, la Municipalidad se comprometerá a realizar la debida coordinación y colaborara (sic) dentro de las posibilidades que la ley nos permita. iii) Construir un Sistema Pluvial utilizando el Derecho de Vía de Ferrocarril, para lo cual se coordinará con el INCOFER para la obtención de los permisos de uso de este espacio. iv) Construir un Sistema Pluvial sobre la Ruta Cantonal que nos permita evacuar los caudales generados desde la Ruta Nacional N° 712 y el Derecho de Vía del Ferrocarril. v) Construir un Sistema Pluvial que desagüe un colector pluvial secundario, siempre que este último tenga la capacidad de recibir los nuevos caudales generados (…)” (ver informes rendidos por los recurridos).
Respecto a los reclamos incoados por el recurrente, en primer término, corresponde indicar que este Tribunal, en su jurisprudencia, ha reconocido la obligación de las Municipalidades de ejecutar acciones eficaces y céleres en función de las necesidades de la circunscripción territorial asignada a cada corporación municipal, y que se encuentra íntimamente ligado al elemento de población. Tales obligaciones, derivan de lo contemplado en los artículos 169 y 170, de la Constitución Política, siendo que abarca un amplio número de actividades. Así, en sentencias N° 2011-12886 de las 12:44 horas de 23 de setiembre de 2011 y N° 2015010541 de las 09:20 horas de 17 de julio de 2015, entre otras, esta Sala indicó:
“(…) conforme lo establece el artículo 169 de la Constitución Política y el Código Municipal, corresponde a las municipalidades la administración de los servicios e intereses locales, con el fin de promover el desarrollo integral de los cantones en armonía con el desarrollo nacional. En consecuencia, la Municipalidad debe establecer una política integral de planeamiento urbano de acuerdo con la ley respectiva, que persiga el desarrollo eficiente y armónico de los centros urbanos y que garantice -al menos- eficientes servicios de electrificación y de comunicación; buenos sistemas de provisión de agua potable y evacuación de aguas servidas, adecuados sistemas de acueductos y alcantarillado, sistemas de iluminación y ornato de las ciudades; servicios de construcción, reparación y limpieza de calles y otras vías públicas; en general planes concretos y prácticos para hacer confortable y segura la vida de la población”.
Además, en materia de prestación de servicios, esta Sala ha señalado –v. gr. sentencia N° 2016-000427 de las 09:30 horas de 15 de enero de 2016- que el buen funcionamiento de estos corresponde a un derecho fundamental. Esto, a partir del contenido de los artículos 139, 140 y 191 de la Constitución Política. Esto se traduce en la obligación de las distintas Administraciones Públicas de prestar servicios de forma continua, regular, célere, eficaz y eficiente. Asimismo, de la parte orgánica de la Carta Fundamental, se erigen una serie de principios de la organización y función de la Administración, los cuales han sido desarrollados por normas infra constitucionales, tales como la Ley General de la Administración Pública, que en sus artículos 4, 225, párrafo 1 y 269, párrafo 1, impone el deber de los órganos del Estado, de orientar y nutrir la organización y la función administrativa. Así, el principio de eficacia supone que la organización administrativa está diseñada para la obtención de objetivos y fines asignados por el propio ordenamiento jurídico, lo que obliga la existencia de planificación y rendición de cuentas.
Por su parte, la eficiencia implica la obtención de los mejores resultados con el uso racional de los recursos con los que cuentan las diferentes dependencias. Asimismo, se impone a la Administración el principio de simplicidad, el cual se debe entender como la obligación de que las estructuras administrativas y sus competencias sean de fácil comprensión, sin procedimientos complejos que retarden la satisfacción de los intereses públicos. El principio de celeridad, impone la obligación a las Administraciones Públicas a cumplir con sus objetivos y fines, de la forma más expedita, rápida y acertada posible, para evitar retardos indebidos e injustificados. Así, estos principios imponen una serie de exigencias, responsabilidades y deberes permanentes a todos los entes públicos.
El artículo 50, constitucional, establece como fin fundamental y valor esencial del Estado costarricense procurar "el mayor bienestar a todos los habitantes del país". De tal manera que, el "ambiente sano y ecológicamente equilibrado" forma parte del contenido del mayor bienestar de todos los habitantes, causa, fin y también condición y límite del ejercicio de las potestades y competencias públicas, no solo del Estado, sino también de las Municipalidades. Al igual que el derecho de propiedad, el objeto sobre el que recae el derecho al ambiente es externo a la integridad de la persona humana (a diferencia por ejemplo del derecho a la vida), pero también a diferencia con el objeto del derecho de propiedad, la persona forma parte del ambiente, lo integra, de allí que su protección, supone la conservación del contexto esencial para la vida humana, una conducta con efectos negativos sobre él, supone un peligro para la propia existencia humana y una reducción o pérdida del "mayor bienestar" de todos. La vida depende del ambiente, por tanto, debe velar para que esas condiciones que garantizan la vida se mantengan en el tiempo. En sentencia número 601-2009 esta Sala dispuso lo siguiente:
"Los orígenes de los problemas ambientales son complejos y corresponden a una articulación de procesos naturales y sociales en el marco del estilo de desarrollo socioeconómico que adopte el país. Por ejemplo, se producen problemas ambientales cuando las modalidades de explotación de los recursos naturales dan lugar a una degradación de los ecosistemas superior a su capacidad de regeneración, lo que conduce a que amplios sectores de la población resulten perjudicados y se genere un alto costo ambiental y social que redunda en un deterioro de la calidad de vida; pues precisamente el objetivo primordial del uso y protección del ambiente es obtener un desarrollo y evolución favorable al ser humano (...) importante que ello es entender que si bien el hombre tiene el derecho de hacer uso del ambiente para su propio desarrollo, también tiene el deber de protegerlo y preservarlo para el uso de las generaciones presentes y futuras, lo cual no es tan novedoso, porque no es más que la traducción a esta materia, del principio de la "lesión", ya consolidado en el derecho común, en virtud del cual el legítimo ejercicio de un derecho tiene dos límites esenciales: Por un lado, los iguales derechos de los demás y, por el otro, el ejercicio racional y el disfrute útil del derecho mismo." Así las cosas, corresponde a los entes públicos, entre ellos a las Municipalidades, velar por el respeto a un ambiente sano y ecológicamente equilibrado en su respectiva circunscripción territorial, así como por el bienestar de todos los habitantes de su respectivo cantón, y dentro del marco de las competencias constitucionales y legales actuar a favor de asegurar el respeto de este derecho a todos los munícipes, y actuar -nuevamente dentro del marco de sus competencias- para mitigar o corregir las actuaciones que tienden a su violación.
En el caso que nos ocupa, se tiene por acreditado que la amparada es vecina de Cebadilla de Turrúcares de Alajuela, concretamente, cerca del Salón Los Almendros, donde, además, cuenta con un recinto donde realiza su actividad económica. Dicha comunidad cuenta con problemas de inundaciones con aguas pluviales, como consecuencia del mal estado del alcantarillado y de falta infraestructura para que las aguas discurran adecuadamente y sean recolectadas por dispositivos de evacuación convenientes, razones por las cuales, desde el año 2018, la accionante ha solicitado la intervención de las autoridades de la Municipalidad de Alajuela. Así, sin precisar fecha exacta, en el año 2018, la amparada interpuso una denuncia ante dicha institución, a la que se le asignó número de caso 24954-2018. Como consecuencia de dicha gestión, en fecha 16 de enero de 2019, las autoridades de la municipalidad realizaron una inspección en el lugar, a partir de la cual se generó el oficio N° MA-AAP-0053-2019, en el que el Coordinador de Alcantarillado de la Municipalidad de Alajuela indicó: “(…) a) La propiedad de la recurrente se ubica en un sitio donde convergen aguas de dos puntos distintos.
El primero, con el mayor caudal proviene de la Ruta Nacional N° 721 la cual es de administración de El Estado (sic). El segundo, proviene desde el derecho de vía de la línea férrea, la cual es de administración del INCOFER. Estas aguas (las provenientes de Ruta Nacional y derecho de vía del ferrocarril), llegan hasta la ruta cantonal y se encauzan mediante los sistemas pluviales del sector. Es importante anotar que al Ruta Cantonal inicia frente a la propiedad de la señora [Nombre 002] , por lo que las aguas pluviales que generan problemas no son producidas en rutas de administración municipal. b) El terreno donde se ubica el comercio se encuentra por debajo del nivel de la carretera (inclusive del sistema pluvial), por lo que cualquier desbordamiento o aumento significativo que se presente en el caudal, por topografía y debido al efecto de gravedad las aguas discurren hasta el punto más bajo, el cual coincide con la propiedad de la señora [Nombre 002] . c) No existen causes naturales o sistemas colectores cercanos que nos permitan realizar un entubado nuevo a corto plazo (…)” .
No obstante, a las fechas en que los recurridos presentaron sus escritos de respuesta, no se han dispuesto y, por consiguiente, no se han ejecutado las obras correspondientes con el fin de resolver el problema denunciado por la tutelada y que se mencionó anteriormente. Esto a pesar que se cuenta con un diagnóstico que indica, con claridad, la necesidad de ejecutar con prontitud las obras correspondientes, ante el riesgo para la salud y la integridad de la recurrente, así como del resto de personas que viven y transitan por la comunidad de Cebadilla de Turrúcares de Alajuela, como consecuencia de las aguas pluviales que discurren libremente, mismas que, además, han dañado la calzada. Asimismo, mediante oficio MA-AAP-0002-2020, se establecieron varias opciones con el fin de abordar el problema de cita, sin que, al menos, haya ejecutado una de ellas. Estas son las siguientes: "(...) i) Construcción de un sistema pluvial frente a la propiedad de la señora [Nombre 002] , de manera que las aguas no ingresen a su inmueble.
Esto tendría implicación al propietario ya que deberá posteriormente adecuar el acceso a su finca, debido a que no es factible ajustas los niveles de la calle con respecto a la propiedad privada por encontrarse está a un nivel inferior a la calle, esto por cuanto los sistemas pluviales funcionan por gravedad, por lo cual el nivel mínimo queda determinado por el punto final donde se depositan las aguas. ii) Realizar un “corte” de aguas en un nivel superior de la vía, esto para disminuir el caudal que llega a la propiedad donde se presenta el problema. Para este caso se deberá solicitar al CONAVI y al INCOFER la colaboración para que sean estas instituciones las que nos indiquen los dicho causales, esto por cuanto las vías que convergen en el sitio corresponden a la Ruta Nacional N° 712 y el Derecho de Vía del Ferrocarril. De proceder con este caso, la Municipalidad se comprometerá a realizar la debida coordinación y colaborara (sic) dentro de las posibilidades que la ley nos permita. iii) Construir un Sistema Pluvial utilizando el Derecho de Vía de Ferrocarril, para lo cual se coordinará con el INCOFER para la obtención de los permisos de uso de este espacio. iv) Construir un Sistema Pluvial sobre la Ruta Cantonal que nos permita evacuar los caudales generados desde la Ruta Nacional N° 712 y el Derecho de Vía del Ferrocarril. v) Construir un Sistema Pluvial que desagüe un colector pluvial secundario, siempre que este último tenga la capacidad de recibir los nuevos caudales generados (…)”.
De otra parte, los recurridos señalan que podría existir responsabilidad por parte del INCOFER y del CONAVI, pues hay aguas provenientes de la ruta nacional N°721 y desde una línea férrea propiedad del INCOFER; empero, las autoridades de la municipalidad accionada tampoco han ejecutado actos con el fin de coordinar, con las autoridades de las instituciones supra citadas, un plan de acción con el fin de revertir el problema. Asimismo, intentan justificar la omisión de atender adecuadamente el caso de la comunidad de Cebadilla, argumentado la falta de recursos, pero, tales alegatos no son de recibo, pues el derecho fundamental del buen funcionamiento de los servicios públicos y el derecho a un ambiente sano, además de los principios señalados en el considerando tercero de esta sentencia, conllevan que las Administraciones Públicas tengan la capacidad de previsión y de adaptación, con el fin que puedan afrontar las vicisitudes que se por las que puedan atravesar en su gestión, con el fin de satisfacer los intereses y proteger los bienes jurídicos de los administrados.
Lo cierto es que no existe un plan de intervención claro y definido, manteniendo incerteza sobre el tiempo y la disposición de recursos para brindar a la comunidad de Cebadilla de Turrúcares de Alajuela una solución definitiva al problema de aguas pluviales y mal estado del alcantarillado pluvial.
Bajo tal estado de las cosas, se impone estimar este proceso de amparo, como en efecto se dispone y en los términos indicados en la parte dispositiva de esta sentencia.
En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusan problemas de contaminación que afecta los vecinos del Sector de Cebadilla de Turrúcares, cerca del Salón Los Almendros, por las aguas pluviales, provenientes de vía pública, lo que afecta la integridad y salud de los vecinos del lugar, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a Laura María Chaves Quirós y Lawrence Chacón Soto, por su orden, Alcaldesa y Coordinador de Alcantarillado Pluvial, ambo de la Municipalidad de Alajuela, o a quienes ejerzan tales cargos, tomar las medidas correspondientes y en el ámbito de sus competencias para que, en el plazo de DIECIOCHO MESES, contado a partir de la notificación de esta sentencia, intervengan y brinden una solución definitiva al problema de alcantarillado y aguas pluviales que adolece la comunidad de Cebadilla de Turrúcares de Alajuela. Se advierte a los recurridos que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere, o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Alajuela al pago de costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El Magistrado Salazar Alvarado pone nota. Notifíquese esta sentencia a los recurridos en forma personal.
