An amparo action (recurso de amparo), processed under case file number 18-016797-0007-CO, filed by CRISTIAN FRANCISCO DELGADO SALAS, identity card number 0401640108, against THE TRIBUNAL AMBIENTAL ADMINISTRATIVO.
Resultando:

Considerando:
2018020831, AT 09:20 A.M. ON DECEMBER 14, 2018, AND THE ACCUSATION OF DISOBEDIENCE FILED BY THE PETITIONING PARTY.- The petitioner appears before this Constitutional Court, alleging disobedience to what was ordered in ruling (voto) No. 2018020831 at 9:20 a.m. on December 14, 2018, by the respondent authority. In this regard, Maricé Navarro Montoya, President of the Tribunal Ambiental Administrativo, argues that "…Currently, in the present process, through Resolution N°251-20-TAA at one forty in the afternoon on the twentieth of January, two thousand twenty, the oral and public hearing is scheduled, which will be held at 1:30 p.m. on the first day of April, 2020, at the headquarters of the Tribunal Ambiental Administrativo, which is attached…".
In this regard, this Chamber is not unaware that the Tribunal Ambiental Administrativo has indeed taken actions to conclude the investigation of the facts reported by the petitioner. However, as can be verified from the report submitted by the respondent authority itself, the process has not yet been finalized, the foregoing despite the fact that the extensively referenced ruling of this Tribunal indicated "…to take the necessary measures so that, within a period of 6 months from the notification of this judgment, the investigation being conducted based on the petitioner's complaint is concluded, the measures that are appropriate based on what is verified are adopted, and everything resolved is notified to the petitioner…". An order that, as stated, has evidently not been complied with, and it is precisely for this reason that the petitioner alleges disobedience.
Thus, the non-compliance by the respondent authority with the order issued by this Tribunal is established.
POR TANTO:
Maricé Navarro Montoya, President of the Tribunal Ambiental Administrativo, or whoever holds that office in her stead, is hereby reminded to proceed with compliance with what was ordered by this Chamber in resolution No. 2018020831 at 9:20 a.m. on December 14, 2018: "…The action is declared with merit. Ana Lorena Polanco Morales, in her capacity as Acting President of the Tribunal Ambiental Administrativo, or whoever holds that office in her stead, is ordered to take the necessary measures so that, within a period of 6 months from the notification of this judgment, the investigation being conducted based on the petitioner's complaint is concluded, the measures that are appropriate based on what is verified are adopted, and everything resolved is notified to the petitioner..."; under the warning that a certified copy of the relevant documents (testimonio de piezas) will be ordered to be sent to the Ministerio Público if this is not done. Recurso de amparo que se tramita en expediente número 18-016797-0007-CO, interpuesto por CRISTIAN FRANCISCO DELGADO SALAS, cédula de identidad 0401640108, contra EL TRIBUNAL AMBIENTAL ADMINISTRATIVO.
Resultando:
Redacta la Magistrada Hernández López; y,
Considerando:
2018020831, DE LAS 09:20 HORAS DEL 14 DE DICIEMBRE DE 2018 Y LA ACUSACIÓN DE DESOBEDIENCIA INTERPUESTA POR LA PARTE RECURRENTE.- El recurrente acude ante este Tribunal Constitucional, aduciendo la desobediencia a lo dispuesto en el voto No. 2018020831 de las 9:20 horas del 14 de diciembre de 2018, por parte de la autoridad recurrida. Al respecto, Maricé Navarro Montoya, Presidenta del Tribunal Ambiental Administrativo, argumenta que "…Actualmente, el presente proceso mediante Resolución N°251-20-TAA de las trece horas cuarenta minutos del día veinte de enero de dos mil veinte se cita a la audiencia oral y pública la cual se llevará a cabo a las 13:30 de día 01 del mes de abril del 2020 en la sede del Tribunal Ambiental Administrativo, la cual se adjunta…".
Al respecto, no desconoce esta Sala, que en efecto el Tribunal Ambiental Administrativo, ha realizado acciones para culminar la investigación de los hechos denunciados por el recurrente. Ahora bien, según se logra constatar del propio informe rendido por parte de la autoridad recurrida, aún no se finalizado el proceso, lo anterior, a pesar que el voto de este Tribunal ampliamente referido indicaba "…que adopte las medidas que sean necesarias para que, dentro del plazo de plazo de 6 meses contado a partir de la notificación de esta sentencia, se culmine la investigación que se está realizando a partir de la denuncia del recurrente, se adopten las medidas que sean procedentes en atención a lo que se logre comprobar, y se notifique todo lo resuelto al recurrente…". Orden que según se dijo, evidentemente no ha sido cumplida y por tal motivo precisamente acusa desobediencia el recurrente.
Así las cosas, se logra acreditar el incumplimiento de la autoridad recurrida, de la orden emanada por este Tribunal.
POR TANTO:
Se le reitera a Maricé Navarro Montoya, Presidenta del Tribunal Ambiental Administrativo, o a quien en su lugar ejerza ese cargo, que proceda al cumplimiento de lo dispuesto por esta Sala en la resolución No. 2018020831 de las 9:20 horas del 14 de diciembre de 2018 "…Se declara con lugar el recurso.
