SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine fifteen on dieciocho de mayo de dos mil dieciocho.

Amparo proceeding (recurso de amparo) processed under expediente número 17-020269-0007- CO, filed by ALEXIS VINDAS UREÑA, identity card 103740078; ALEXANDER VINDAS VARGAS, identity card 900920103; EDGAR VINDAS MONGE, identity card 105760773; and ARNOLDO VINDAS MONGE, identity card 106830457, against the MUNICIPALIDAD DE ACOSTA and the MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES.

Whereas:

  1. 1In a written submission received by the Office of the Clerk of this Chamber at 16:52 hours on 21 de diciembre de 2017, the petitioners state that they respectively manage the properties registered in San José under real-property folio Nos. 1-106148-000, 1-606744-000 and 1-50788-000, due to their father’s advanced age and state of health. They indicate that all these properties are located in San Ignacio de Acosta. They state that, in addition to the property classification recorded in the registry, property No. 1-106148-000 consists of land with a dwelling, garage, garden, yard, and ornamental plants, citrus trees, and coffee crops; property No. 1-606744-000 has a dwelling, garage, garden, yard, and ornamental plants; and property No. 1-50788­

0 consists of land planted with coffee and citrus trees, which provides most of the income needed for the subsistence of their father, Arnoldo del Carmen Vindas Monge. They recount that the main entrance to these properties is located along national route 301, which runs from downtown Acosta to Parrita. They add that both the respondent Municipality and the other defendants are responsible, as applicable to local roads or the national highway, for managing stormwater (aguas pluviales) in the San Luis area. They indicate that, because their properties are lower-lying estates (fundos) in relation to certain other estates, particularly those along national highway 301, they are required to receive any stormwater that, by default or naturally, must flow through them, all in accordance with Article 94 of the Ley de Aguas. They state that they are fully aware of this situation and entirely willing to cooperate in this regard; however, they also know that this obligation does not justify the violation of their fundamental rights.

They recount that in the upper part of San Luis de Acosta, specifically from the intersection leading from San Luis to the community’s Cementerio, a local road extends westward for approximately 600 meters, along which the Municipality is responsible for managing rainwater and wastewater (aguas llovidas y servidas), which it does through the existing gutter and sewer system (sistema de caños y alcantarillado). Nevertheless, they state that it does not do so properly or in accordance with, or while safeguarding or complying with, the constitutional and statutory rules governing the matter, because along that 800-linear-meter stretch of road there are several areas that should be used as stormwater outlets (desfogues pluviales), pursuant to the same Article 94 of the Ley de Aguas, naturally taking into account the conditions of the land itself and of the properties adjoining that public road, which also directly benefit from that gutter and sewer system.

However, those owners, by mutual agreement with the respondents, refuse to accept what they are legally required to accept—in this case, receiving the water that, because of the natural characteristics and conditions of the land, must be discharged onto their properties. Instead, the Municipality chose to construct an entire system along those 800 meters of roadway, including gutters, sewer pipes, and several crossings beneath the roadway itself, in order to channel that water to the national highway 301. They add that the normal course followed by the waters for years, in accordance with the topography of the land, was even altered. To accomplish this, the municipality closed several water outlets or drainage points (desfogues) located on several properties and other roads that were also municipal, directing all the water collected in the cemetery and upper San Luis sector toward their properties.

This entailed rerouting the water (encausamiento de agua) for approximately 1600 linear meters, considering that the street has a dual drainage-channel system (sistema de caño), one on each side. They allege that, despite having taken the aforementioned action, the municipality was not satisfied with diverting the water and closing all drainage points in the San Luis cemetery sector, land where, by its nature and as demonstrated by evidence No. 2 and 4, the water should flow naturally and drain onto all the properties bordering the public road. They state that this was done at at least 3 points or drainage outlets that previously existed and are now closed as a result of municipal action, contrary to Article 94 of the Ley de Aguas, which is intended to prevent the accumulation of a large quantity of water from being directed into a single sector, as the municipality has done by closing those water outlets and carrying out the works and actions necessary to channel all that water to the roadside ditch (cuneta) along national highway 301, all without any technical study, much less an assessment of the impact of that action.

They state that, without regard for the damage and harmful consequences to the parcels (fundos) that must receive all that water, and certainly for the harm caused to them as property owners and local residents, their homes are situated on those properties at an approximate distance of between fifty centimeters and ten meters from the point where that volume of water passes through the middle of their properties. They recount that, without any technical study or impact assessment of its actions and of the channeling of the water to the existing ditch along national highway number 301, in violation of their rights and, of course, of the legal provisions cited above, and in clear breach of the principle of legality (principio de legalidad), the municipality also decided to close a drainage outlet, this time on national route 301, at the entrance to Calle Los Ureña. They add that this was done with a backhoe because excavation was required in the existing ditch so that the water could follow a new course, in this case through the ditch leading toward their properties, since the differences in ground elevation did not permit that new course.

This allowed all the water collected not only throughout the San Luis cemetery sector, but also all the water collected along national route 301—over an approximate stretch of 200 meters of roadway and 400 meters of ditches running along both sides of that route—when added to the water coming from the cemetery sector, to pass through a total of 2000 linear meters of drainage infrastructure and empty onto their properties. Because of the large quantity of water collected along that entire stretch and the slope down which it must flow, what enters their properties is effectively a river, given the volume and force of the water, which carries away everything in its path, whether rocks, soil, branches, weeds, or all types of refuse. This is compounded by the municipality’s failure to provide road-cleaning services in the sector, further aggravating the situation, because their properties, homes, and families receive all that contamination and the resulting health problems.

Moreover, this system collects not only stormwater (aguas pluviales), but also wastewater (aguas servidas) from the settlements near the cemetery and from the homes located along national route 301, from the intersection in San Luis to their properties. They state that the municipality has no technical study determining the feasibility and impact of channeling all that water to a single location—in this case, their properties—after unilaterally and without justification closing the drainage outlets that previously existed in the San Luis cemetery sector, at the intersection leading from San Luis to the cemetery and to Resbalón. They state that they are under no obligation to receive all that water to the detriment of their rights, since, as demonstrated, the water is undermining their properties, not only affecting their value but also placing them at risk of landslides and soil erosion.

In some areas, the gullies created by the water already exceed 3 meters in depth; furthermore, the water passes through the gardens and yards of their homes, placing them at risk of flooding and, of course, adversely affecting their health and their very lives, because, as already stated, the water carries refuse and wastewater from properties at higher elevations. They add that this is aggravated by the force of such a large volume of water, which has already undermined a dwelling, as demonstrated by photograph submitted as evidence No. 7, showing the large quantity of water and the force with which it passes through the area. They allege that this damage and the channeling of all that water onto the properties are due to the municipality’s actions and failure to act, specifically its closure of the drainage outlets that existed in higher parts of the area, as demonstrated by the evidence cited, and its channeling of the water onto their properties, all without any technical or impact study whatsoever, much less their approval or authorization; the municipality did not even provide them with notice in this regard.

This violates Articles 94, 97, and 104 of the Ley de Aguas, as well as the fundamental rights (derechos fundamentales) they assert. They note that, when the municipality carried out those actions, their properties already contained crops, gardens, yards, and the homes now affected by that wholly unlawful and unjustified conduct. This constituted an entirely defective and void administrative act (acto administrativo) affecting their fundamental rights to property, health, life, a healthy and ecologically balanced environment—because of the contamination carried by the water—and equality. They state that they performed work on the properties (fincas) solely to mitigate the effects of the passage of all that water; however, it has proved insufficient in view of the large quantity of water flowing through the area. Material damage and contamination already exist, and with each passing day their fear of further and more extensive damage increases, especially regarding the effects already being caused to their homes and health, which will become more serious in the future, considering that a greater number of climatic events producing major rainfall depressions are expected each year.

All this is occurring while the respondent authorities (recurridos) have shown no interest in providing a solution, or even in conducting a study to determine the existing harm and their violation of the claimants’ fundamental rights, much less in providing an appropriate solution consistent with the nature of the local terrain. In view of the nature and geographical conditions of each parcel, the reasonable and appropriate approach is for each parcel, to the extent possible, to receive the drainage naturally and geographically corresponding to it, instead of the municipality intervening to channel nearly 2 linear kilometers of drainage channels, storm sewers (alcantarillado), and roadside ditches onto their properties, in violation of all their rights. They state that on 6 de setiembre, because of their concern over the situation and following a request by the Engineer from the Municipal Technical Unit, a site visit was conducted to inspect the area and seek solutions; however, no opinion of any kind was issued.

It was not until late setiembre that Engineer Paula Reyes of the Consejo Nacional de Vialidad also visited and clearly stated that this was a municipal matter and that the extensive channeling of water toward their property had to be curtailed because of the harmfulness of the situation. Notwithstanding the foregoing, municipal official Nelson Castro Meza stated that they could not do so because there were culverts (alcantarillas) in poor condition that could not receive that water in the other sector (Calle Los Ureña), which had previously been closed as a drainage outlet, and that the closure had occurred precisely because those culverts were damaged. This makes clear that the municipality fails to perform its duties and, instead of replacing or repairing the damaged culvert systems, simply changes the course of the water and directs it elsewhere without any criteria or study, much less any consideration of the adverse impact caused to them.

They recount that, following those two visits, to date there has been no response or opinion whatsoever regarding the inspections, much less any solution to their problem. The recent Nate storm was disastrous, severely undermining and eroding the land and flooding their yards and gardens, with the resulting contamination, in an area inhabited by several families with children and older adults and the consequent risks to health and life, since older adults and children require greater care. The situation is worsening because natural phenomena are expected to produce larger quantities of water in the coming years, which would ultimately devastate their properties and homes.

  1. 2By an order issued at 9:03 on 27 de diciembre de 2017, reports were requested from the Head of the Road Engineering Management Unit (Unidad de Gestión Técnica Vial) of the Municipalidad de Acosta, the Alcalde de Acosta, the Ministro de Obras Públicas y Transportes, and the Director del Consejo Nacional de Vialidad.
  2. 3CARLOS EDUARDO SOLÍS MURILLO, in his capacity as Executive Director of the Consejo Nacional de Vialidad, reported under oath that the petitioners merely mention a violation of the right of petition and prompt response (derecho de petición y pronta respuesta); however, they do not demonstrate what omission or administrative action by that Council infringed such right, since the filing instituting the proceeding (escrito de interposición) contains no petition submitted to the institution he represents. Likewise, regarding the fundamental right to equality before the law (derecho fundamental a la igualdad ante la ley), he argues that they merely quote a constitutional article verbatim without providing any evidence. He further argues that it has not been shown that the entity he represents violated the petitioners’ fundamental right to health. Similarly, he considers that they have failed to prove that it infringed the right to property.He states that there is no record before that Executive Directorate, nor has it been established in the judicial case file (expediente judicial), that the petitioners are the current parties subject to the Administration (administrados) because of their father’s advanced age, nor is there any record that the registered owner (propietario registral), Vindas Ureña, has a serious health condition. He states that the petitioners categorically assert that the alleged causes damaging their properties arise from the channeling of water (encausamiento de aguas) carried out by the Municipalidad de Acosta, which is entirely consistent with the technical report issued by the Council’s engineers. He indicates that there is a contradiction in the petitioners’ allegations, insofar as they state that national route 301 is located in front of their properties; however, they subsequently state that “there is an approximately 600-meter extension of local road for which the Municipalidad is responsible for providing the appropriate treatment of rainwater and wastewater (aguas llovidas y servidas), which it in fact does through the system of gutters and sewers currently in place.” Moreover, if the respondent Municipalidad performed construction work in front of the petitioners’ property, it is because the property is in fact located on a cantonal road (vía cantonal).Finally, he indicates that the petitioners’ claim concerning the properties damaged by the channeling of water is at all times attributed to the respondent municipality, and therefore requests that the petition be denied.
  3. 4GERMAN VALVERDE GONZÁLEZ, in his capacity as Ministro de Obras Públicas y Transportes, reported under oath that, insofar as that Ministerio is concerned, it has not engaged in any active or negligent conduct that in any way violated the petitioners’ fundamental rights; based on the petitioners’ allegations, it follows that the problem arose from the effects produced by work performed by the Municipalidad de Acosta within a road belonging to the cantonal road network (red vial cantonal). In light of the foregoing, he requests that this amparo petition (recurso de amparo) be denied.
  4. 5NORMAN EDUARDO HIDALGO GAMBOA, in his capacity as Alcalde Municipal de Acosta, reported under oath that, at the request of some residents of the community of San Luis, a culvert crossing (paso de alcantarilla) on cantonal route C-1-12-024 was rehabilitated using municipal machinery, directing the waters, according to the topography, toward national route 301, where they flow into an existing stormwater outlet (desfogue pluvial) previously constructed by the Consejo Nacional de Vialidad on that national route. He indicates that this decision was made because, when alternatives for channeling the waters through other areas were explored, it was determined that the residential conditions in the area made it impossible to divert the waters elsewhere. He states that on 6 de setiembre, Engineer Carlos Pérez visited the site and, after evaluating its conditions, explained the limitations affecting water drainage (evacuación de las aguas) in the area because of the topography and residential conditions.Likewise, Engineer Paula Reyes of that Council stated that, given the quantity of water coming from the cantonal route and the fact that it is located on a national route, it is reasonable for the waters to reach the lowest point and discharge into the existing drainage system; and that, according to a prior technical opinion (criterio técnico) from the engineers of the Consejo Nacional de Vialidad, the water outflow enters the petitioners’ properties. He states that, regarding the public-health issue raised by the petitioners as a result of the “contamination” caused by wastewater from the settlements located along national route 301, the Ministerio de Salud, as the Governing Authority (Ente Rector), is responsible for overseeing and following up on violations by users, since each property owner is responsible for disposing of rainwater and wastewater properly and hygienically. In light of the foregoing, he requests that the petition be denied.
  5. 7By memorandum (memorial) dated 13 de febrero de 2018, the petitioners replied to the reports and stated that, as regards the respondent Council, its contention that the photographs could have been taken anywhere is unacceptable, as it calls their honesty into question and, above all, places their rights at risk, because they would not bring this proceeding without being certain that their rights had been violated, nor would they do so capriciously, much less manipulate evidence, given the consequences that such conduct would entail. It is clear that the engineer from the Consejo Nacional de Vialidad herself visited the area because of their complaints and stated that the outlets that had been closed along that same national route 301 had to be reopened. This establishes the Council’s responsibility for allowing the Municipalidad de Acosta to interfere with and perform work on that national route, which falls within the sole and exclusive jurisdiction of the Consejo Nacional de Vialidad, as they themselves acknowledge.The Municipalidad thus encroached upon the Council’s functions, and that agency failed and omitted to act, all of which has harmed them, as stated in the petition. Regarding the allegation that the evidence submitted may be false, it is important to mention and consider that, for certain purposes—and, as they themselves state in their response, when it benefits them—they treat that evidence as valid and genuine. They make this point merely as an observation in view of the Council’s allegation that the evidence is uncertain; yet, as already stated, the Council relies on that same evidence when doing so benefits it.

Regarding the response by the Alcalde Municipal: It is clear and evident that he seeks to justify his mistaken and harmful conduct toward them, even alleging that certain water outlets were closed and the water was channeled toward national route 301 because of the harm occurring elsewhere. However, they did not consider that, by doing so, they would harm the petitioners’ properties and rights. There was not even a technical study (estudio técnico) on the matter; instead, to accommodate and favor other residents of the canton, and without providing an adequate and comprehensive solution, they simply and capriciously and arbitrarily decided to close all the aforementioned outlets and channel the waters toward national route 301 without considering the impact. Worse still, they even closed an existing outlet in the upper portion of that route and now claim that it cannot be reopened because a structure was built after the closure and would be affected due to its proximity to the outlet’s flow.

However, that is their sole and exclusive responsibility, since a municipal permit under those conditions should never have been approved; and if the dwelling lacks the required permits, they should take the appropriate action, accept responsibility for their conduct or omission, and assume the consequences, including, if applicable, compensating for that dwelling, because construction was not permitted there. This should be reflected in the applicable setback (retiro) for drainage ditches (acequias). That contention is therefore unacceptable and demonstrates once again the municipality’s ineffectiveness and its view that the harm caused to the petitioners is irrelevant when seeking to safeguard the rights of other citizens. This is inconsistent with the application of the principle of equality (principio de igualdad), considering that those closures occurred after the construction of the petitioners’ homes on their properties, which are now being affected.

They agree to tolerate what the law provides regarding water disposal; however, that applies to all citizens. It is neither possible nor tolerable for their health and lives to be endangered because other residents complained that the waters were damaging their properties and the municipality considered that unacceptable, while deeming it reasonable to damage the petitioners’ properties and homes and endanger their lives and health in order to safeguard the equal or lesser rights of other residents, without providing a genuine and comprehensive solution, much less relying on technical criteria and studies concerning the impact and feasibility of its actions.

  2. 9Maricruz Chavarría Castrillo, in her capacity as Environmental Manager of the Área Rectora de Salud de Acosta, reported under oath that at 11:30 am on 22 de febrero del 2018, accompanied by official Dayanna Chinchilla Arias, she appeared in San Luis de Acosta, specifically at the locations identified in the amparo petition (upper San Luis, western sector, from the intersection to the cemetery and along Ruta 301), to investigate the allegations made in this document concerning the disposal of wastewater (aguas residuales). The following was observed during the visit: The inspection began at the complainant’s property and continued to the San Luis cemetery. Along the route, approximately 10 houses were observed bordering the stormwater pipeline (cañería pluvial) on ruta 301 and in upper San Luis, at the entrance to the intersection leading from San Luis toward the cemetery. During the inspection, sewage (aguas servidas) and even food scraps were observed in the storm sewer system (alcantarillado pluvial) originating from the aforementioned homes; due to gravity and the course of the sewer system, these discharge onto the complainant’s property.The homes were then inspected, but no one was present at most of the properties. The home of Rosmery Calderón Alfaro was successfully inspected. A sodium fluorescein test was performed in the utility sinks and washbasins of the home, and the results were negative for the stormwater pipeline in question. At the home where Andrea Rojas Arias resides, a sodium fluorescein test was performed in the utility sinks, and the result was positive for discharge onto exposed ground, waters that will eventually reach the stormwater pipeline in question through runoff (escorrentía). In view of this finding, Health Order (Orden Sanitaria) CS-ARSAC- 0S-036-2018 was issued to the tenant of the home, who stated that the property owner resides 500 metros south of the Escuela de San Luis, in a yellow house; the owner will therefore also be notified in the coming days. The presence of dry leaves and other ordinary waste in the stormwater pipeline was observed.This falls within municipal jurisdiction pursuant to artículo 8 inciso e), of the Ley para la Gestión Integral de Residuos Sólidos No 8839, which states that the Municipality must: “Provide services for cleaning gutters, ditches, culverts, roads, public spaces, rivers, and beaches, as applicable, as well as for the sanitary disposal of animals found dead on public roads.” With respect to the extent of the storm sewer system, it was observed that, from the cemetery onward, it is arranged so that the waters discharge into the culvert adjacent to the complainants’ properties; however, she is unaware of the applicable design criteria, and it will be incumbent upon the Municipalidad de Acosta and the Consejo Nacional de Vialidad to issue an opinion regarding the channeling of this stormwater. Therefore, because the improper disposal of sewage from some of the homes located in this area was observed, the investigation of the remaining homes must continue to ensure that all comply with artículos 285, 287 y 292 of capítulo III, “De las obligaciones y restricciones para la evacuación sanitaria de excretas y aguas servidas y negras,” of the Ley General de Salud, No. 5395 published in la Gaceta No. 222 of 24 de noviembre de 1973. The foregoing is recorded in inspection report M-018-02-2018.

Justice Hernández Gutierrez drafted the opinion; and,

CONSIDERING:

I. SUBJECT MATTER OF THE PETITION

The petitioners sought protection of their right to a healthy and ecologically balanced environment because, they claim, the Municipalidad de Acosta closed several water outlets or discharge points located on various properties in the area and on other municipally administered roads, directing all the water collected in the cemetery and upper San Luis sector toward their properties.

II. PROVEN FACTS

The following facts are deemed duly proven and relevant to the resolution of this matter: 1) On an unspecified date, upon closing the discharge points located on the local roads in the upper parts of San Luis, the Municipalidad de Acosta channeled the stormwater into a ditch along national route 301 that discharges onto the properties of the protected parties (reports). 2) The respondent Municipality does not provide road-cleaning services in the San Luis sector (report). 3) On 22 de febrero del 2018, the Área Rectora de Salud de Acosta conducted an inspection in the upper part of that community, in the western sector, from the intersection to the cemetery and along Ruta 301, which revealed that the waters discharging onto those properties contained sewage and food scraps originating from neighboring homes, as well as a large amount of garbage collected along the route (report). 4) On an unspecified date, the petitioners performed work on those properties solely to mitigate the effects of the passage of all that water; however, the work proved insufficient (undisputed fact). 5) The petitioners’ properties are at risk of landslides and erosion (case record).

III. UNPROVEN FACTS

The following relevant fact is deemed unproven: Sole fact.- That the Consejo Nacional de Vialidad or the Ministerio de Obras Públicas y Transportes performed the works at issue (case record).

IV. THE RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT

This Court has repeatedly held, insofar as relevant, as follows:

“(...) The right to life recognized in numeral 21 of the Constitution is the cornerstone upon which the other fundamental rights of the Republic’s inhabitants rest. Likewise, that provision of the Constitution provides the basis for the right to health, since life is inconceivable unless human beings are guaranteed the minimum conditions necessary for an appropriate and harmonious psychological, physical, and environmental balance. Public health and the right to a healthy and ecologically balanced environment are constitutionally recognized in artículos 21, 50, 73 y 89 of the Constitución Política. Specifically, artículo 50 of the Constitution expressly recognizes the right of all the country’s inhabitants to enjoy a healthy and perfectly balanced environment. That right is a fundamental guarantee for the protection of life and public health. In support of the foregoing, this Court has employed the concept of ‘environmental quality’ (calidad ambiental) precisely as a measure of people’s quality of life, in conjunction with other elements such as health, food, work, and housing, recognizing that every person has the right to use the environment for their own development, but not without limitation, because there is also a duty to protect and preserve the environment for present and future generations—the sustainable development principle (principio de desarrollo sostenible).”

Likewise, artículo 50 of the Constitución Política establishes the State’s obligation to protect the environment. That provision states:

“The State shall seek the greatest welfare for all the country’s inhabitants by organizing and promoting production and the most appropriate distribution of wealth. Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that infringe that right and to seek compensation for the harm caused. The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding liabilities and penalties.” This confirms that the various public authorities have an unavoidable duty to preserve, defend, and guarantee every person’s fundamental right to health and to a healthy and ecologically balanced environment” (judgment No. 2006-005928 at 15:00 on 2 de mayo del 2006).

V. SPECIFIC CASE

The Alcalde Municipal de Acosta acknowledged that, as one of the alternatives for channeling the waters in other sectors of San Luis, a culvert crossing on cantonal route C-1-12-024 was reopened using municipal machinery, directing the waters according to the topography onto national route 301 toward a stormwater outlet that had previously been constructed by the Consejo Nacional de Vialidad on national route 301, whose outlet empties onto the petitioners’ properties (report). According to the Área Rectora de Salud de Acosta on 22 de febrero del 2018, those waters contain sewage and food scraps originating from neighboring homes, as well as garbage collected along much of their course, because road-cleaning services are not provided in the sector (report). Notwithstanding the respondent Alcaldía Municipal’s justification that the challenged decision was based on the impossibility of diverting the waters to a point other than the protected parties’ properties, the Chamber finds that, in the case at hand, the manner in which the respondent local authority arranged the discharge of the stormwater at issue is inappropriate because it endangers the integrity of the property where the petitioners and their families live, as well as their physical integrity and lives. On this basis, the Chamber finds that the alleged violation occurred.

VI.Furthermore, with respect to the Ministerio de Obras Públicas y Transportes and the Consejo Nacional de Vialidad, the Chamber finds no act or omission that threatens or infringes the fundamental rights of the protected parties. In this regard, the record does not adequately and reliably establish that the Consejo Nacional de Vialidad or the Ministerio de Obras Públicas y Transportes performed the works at issue (case record).

VII. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that if they submitted any paper document, or any objects or evidence contained on an additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the court office within a maximum period of 30 business days from notice of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, artículo XXVI, and published in Boletín Judicial número 19 of 26 de enero del 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, artículo LXXXI.

Por tanto:

The application for amparo (recurso de amparo) is granted solely with respect to the respondent local government entity. Accordingly, Norman Eduardo Hidalgo Gamboa, in his capacity as Mayor of the Municipality of Acosta, or whoever holds that office, is ordered to undertake all actions within the scope of his powers and duties so that, within six months following notice of this decision, the stormwater discharge affecting the properties of the protected parties is corrected and street-cleaning services are provided in San Luis. Maricruz Chavarría Castrillo, in her capacity as Environmental Manager of the Acosta Health Governing Area, is likewise ordered to issue the necessary health orders for that purpose and verify compliance with the measures ordered in that regard. The respondent authority and the latter official are hereby advised that, pursuant to Article 71 of the Law on Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional), any person who receives an order issued in an application for amparo that the person must comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not punishable by a more severe penalty.

As concerns the Ministry of Public Works and Transportation and the National Road Council, the application is denied. The Municipality of Acosta is ordered to pay the legal costs, damages, and losses caused by the facts giving rise to this ruling, which shall be assessed in proceedings to enforce the judgment in the contentious-administrative jurisdiction Fernando Cruz C.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del dieciocho de mayo de dos mil dieciocho.

Recurso de amparo que se tramita en expediente número 17-020269-0007- CO, interpuesto por ALEXIS VINDAS UREÑA cédula de identidad 103740078, ALEXANDER VINDAS VARGAS, cédula de identidad 900920103, EDGAR VINDAS MONGE, cédula de identidad 105760773 y ARNOLDO VINDAS MONGE, cédula de identidad 106830457, contra la MUNICIPALIDAD DE ACOSTA y el MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES.

Resultando:

  1. 1Por escrito recibido en la Secretaría de esta Sala a las 16:52 horas de 21 de diciembre de 2017, los recurrentes manifiestan que, administran, respectivamente, las fincas inscritas en San José, folios reales Nos. 1-106148-000, 1-606744-000 y 1-50788-000, debido a la avanzada edad y estado de salud de su padre. Indican que todas esas propiedades se ubican en San Ignacio de Acosta. Manifiestan que además de la naturaleza indicada en el registro, la propiedad No. 1-106148-000 es terreno con una casa de habitación, cochera, jardín, patio y cultivos ornamentales, cítricos y café; la finca No. 1-606744-000, tiene una casa de habitación, cochera, jardín, patio y cultivos ornamentales y la finca No. 1-50788­

0, es terreno cultivado de café y cítricos, del cual se obtiene, en su mayoría, los ingresos para la supervivencia de su progenitor, Arnoldo del Carmen Vindas Monge. Narran que la entrada principal a estas propiedades es por la ruta nacional 301, que va del centro de Acosta a Parrita. Agrega que tanto la Municipalidad recurrida, como las demás demandadas, son las encargadas de disponer las aguas pluviales del sector de San Luis, según corresponda entre carreteras vecinales o carretera nacional. Indica que sus propiedades, por ser fundos de bajo nivel en relación con algunos otros fundos, especialmente, con los que van por la carretera nacional 301, están obligados a recibir las aguas pluviales que, por defecto o, naturalmente, deban correr por ahí, todo conforme a lo establecido en el artículo 94 de la Ley de Aguas. Manifiestan que de su parte existe plena conciencia de esta situación y la mayor disposición de colaborar al respecto; sin embargo, también son conocedores que esa obligación no da pie a la violación de sus derechos fundamentales.

Narran que en la parte alta de San Luis de Acosta, propiamente, del cruce que va de San Luis al Cementerio de esa comunidad, existe una extensión de camino vecinal al oeste por unos 600 metros de longitud, los cuales corresponde a la Municipalidad dar tratamiento a las aguas llovidas y servidas, lo que, en efecto, hace por medio del sistema de caños y alcantarillado que existe. No obstante, dicen que no lo hacen de la mejor manera ni en respeto, resguardo ni cumplimiento de las normas de orden constitucional y legal que rigen la materia, pues, en ese trayecto de 800 metros lineales de carretera, existen varias zonas que deberían ser utilizadas como desfogues pluviales, en aplicación del mismo artículo 94 de la Ley de Aguas, por supuesto atendiendo a las condiciones mismas del terreno y de las propiedades colindantes con dicha calle pública, que además resultan directamente beneficiadas con ese sistema de caño y alcantarillado, pero que, sin embargo; esos propietarios de común acuerdo con los recurridos no aceptan lo que por imperativo legal les corresponde, en este caso recibir las aguas que por naturaleza y condiciones mismas de los terrenos les corresponda desfogar en sus propiedades, sino que la municipalidad prefirió hacer todo un sistema a lo largo de esos 800 metros de carretera, incluyendo caños, alcantarillado, y varios pasos por debajo de la misma carretera, con el fin de encausar dichas aguas hasta la carretera nacional 301.

Agregan que, incluso, variando el curso normal de las aguas, las que, por años, habían seguido, conforme a las topografías de los terrenos, para lo cual, la municipalidad realizó el cierre de varias salidas de aguas o desfogues que existían en varias de las propiedades y otros caminos también de orden municipal, enfocando toda la cantidad de agua recolectada en ese sector del cementerio y San Luis arriba, hacia sus propiedades. Esto que implica un nuevo encausamiento de agua por un aproximado de 1600 metros lineales, considerando que esa calle trae doble sistema de caño, en cada uno de sus laterales. Alegan que la municipalidad, a pesar de haber realizado lo indicado, no les bastó haber desviado y cerrar todos los desfogues de agua en el sector del cementerio de San Luis, terreno que por su naturaleza y conforme se demuestra en prueba No. 2 y 4, las aguas deberían correr de forma natural y desfogar hacia todos los terrenos que lindan con la calle pública.

Indican que esto se hizo en por lo menos 3 puntos o desfogues que antes existían y que ahora se encuentran cerrados por acción municipal, conforme lo dispuesto en el artículo 94 de la Ley de Aguas, y así no permitir ni encausar la acumulación de gran cantidad de agua en un solo sector, como lo hace el municipio al cerrar esas salidas de agua y realizando las obras y acciones necesarias para encausar todas esas aguas hasta la cuneta de carretera nacional 301, todo sin existir un estudio técnico y mucho menos de impacto de esa acción. Manifiestan que, sin importarles los daños y las consecuencias lesivas para los fundos que deben recibir todas esas aguas y por supuesto el perjuicio que les ha acarreado como propietarios y vecinos del lugar, recordando que sus viviendas se ubican en esas propiedades a una distancia aproximada de entre cincuenta centímetros y diez metros de donde pasa esa cantidad de agua por el medio de sus propiedades.

Narran que sin la existencia de estudio técnico ni valoración de impacto de sus actos y el encausamiento de las aguas a la cuneta existente en carretera nacional número 301, todo en violación de sus derechos y por supuesto de las normas legales también indicadas y en claro incumplimiento del principio de legalidad, la municipalidad decidió, también, cerrar un desfogue, ahora, sobre la ruta nacional 301, en la entrada a Calle Los Ureña. Agregan que, esto lo hicieron con un retroexcavador, pues, tuvieron que excavar sobre la misma cuneta existente para que pudiera tomar un nuevo curso, en este caso, sobre la cuneta que va para sus propiedades, pues, los desniveles de terreno no permitían ese nuevo curso del agua, permitiendo así que, toda esa agua que se recolecta, ya no solo en todo el sector del cementerio de San Luis, sino que, además, toda el agua que se recolecta en la ruta nacional 301, por un trayecto aproximado de 200 metros de carretera y 400 metros de cuneta a doble lateral de esa ruta, sumado al agua que viene del sector del cementerio, implica una extensión de 2000 metros lineales de acueducto, que desfoga en sus propiedades, lo que, debido a la gran cantidad de agua que se recolecta en todo ese trayecto y la pendiente de que debe recorrer el líquido, da como resultado que ingrese un verdadero río, por la gran cantidad de agua y la fuerza que trae, arrastrando a su paso con todo lo que se interponga, sea piedras, tierra, ramas, maleza y todo tipo de basura, habida cuenta que en el sector no se presta el servicio de limpieza de vías por parte del municipio, agravando aún más la situación, pues, son sus propiedades, viviendas y familias las que están recibiendo toda esa contaminación con la problemática en salud que todo esto conlleva, recordando que además este sistema recoge no solo aguas pluviales, sino que aguas servidas de los caseríos existentes por el cementerio y de las viviendas que existen sobre la ruta nacional 301, desde el cruce en San Luis hasta sus propiedades.

Indica que, de parte de la municipalidad no existe un estudio técnico que determinara la factibilidad y el impacto de encausar todas esas aguas hacia un solo lugar, en este caso hasta sus propiedades, cerrando de forma unilateral e infundada los desfogues que existían anteriormente en el sector del cementerio de San Luis, en el cruce que va de San Luis al cementerio y a Resbalón. Manifiestan que no están en la obligación de recibir todas esas aguas en afectación de sus derechos, siendo que, conforme se demuestra esas aguas se encuentran socavando sus propiedades, afectado no solo su valor, sino que las ponen en peligro de deslizamiento y erosión de los terrenos, siendo que, en algunas partes las zanjas que va creando esa agua ya sobrepasa los 3 metros de profundidad, además que pasa por los jardines y patios de sus viviendas, poniéndolas en peligro de inundaciones y por supuesto con las afectaciones a la salud y a la vida misma; por cuanto, como ya se dijo, esas aguas traen consigo basuras y aguas servidas de terrenos superiores.

Agrega que, esto se agrava por la fuerza de tanta agua que ya ha socavado una vivienda conforme se demuestra mediante fotografía de prueba No. 7, evidenciando la gran cantidad de agua y con la fuerza que pasa por el lugar. Alega que estos daños y el encausamiento de todas esas aguas a las propiedades se debe a la actividad e inoperancia municipal, esto al cerrar los desfogues que existían en partes altas del lugar, todo conforme se demuestra en las pruebas mencionadas, y encausarlo a sus fincas, todo sin la existencia de estudio técnico ni de impacto alguno, y mucho menos sin contar con su aprobación ni autorización, ni siquiera de su parte se dio un comunicado a ellos al respecto, en violación de los artículos 94, 97 y 104 de la Ley de Aguas, así como de sus derechos fundamentales reclamados, recordando que para el momento en que la municipalidad realiza esos actos, ya en sus propiedades existían cultivos, jardines, patios y las viviendas que hoy se ven afectadas por ese actuar completamente ilegal e infundado, siendo un acto administrativo completamente viciado y nulo que afecta sus derechos fundamentales a la propiedad, la salud, la vida, a un ambiente sano y ecológicamente equilibrado, debido a la contaminación que esas aguas acarrea, así como el derecho a la igualdad.

Indican que realizaron trabajos en las fincas con el único fin de mitigar los efectos del paso de toda esa agua; sin embargo, resulta insuficiente considerando la gran cantidad de agua que por ahí corre, siendo que el daño material y la contaminación ya existen y cada día que pasa el temor es mayor ante nuevos y más grandes daños, pero, sobre todo, ante la afectación a las viviendas y la salud que desde ya se están generando y que en un futuro resultarán mayores, considerando que para cada año se esperan mayor cantidad de fenómenos climáticos que provocan grandes depresiones de lluvias, y todo esto se da mientras que de parte de los recurridos no existe interés alguno por dar solución, ni siquiera por realizar un estudio con el fin de determinar la afectación que ya se da y la violación de nuestros derechos fundamentales de su parte, y mucho menos con el fin de dar una solución adecuada y acorde a la naturaleza de los terrenos del lugar, donde lo considerable y adecuado es que por la naturaleza y condiciones geográficas de cada terreno en la medida de sus posibilidades asuma el desfogue que por naturaleza y geografía le corresponde, pero no como lo hace el municipio mediante su intervención encausando casi 2 kilómetros líneas de caños, alcantarillado y cunetas hasta sus propiedades, en violación de todos sus derechos.

Manifiestan que el 6 de setiembre, ante su preocupación por la problemática dada y previa solicitud por parte del Ingeniero de la Unidad Técnica Municipal, se realizó visita al lugar con el fin de inspeccionar y buscar soluciones; sin embargo, no se dio ningún tipo de criterio y no fue sino a finales de setiembre que se da la visita, también, por parte de la Ingeniera Paula Reyes del Consejo Nacional de Vialidad, quien de forma clara manifestó que eso era problema municipal y que se debía cortar tanto encausamiento de agua hacia nuestra propiedad por lo perjudicial de la situación. No obstante lo anterior, el funcionario municipal Nelson Castro Meza, manifestó que no lo podían hacer, porque existían alcantarillas en mal estado que no podrían recibir esas aguas en el otro sector (Calle Los Ureña) que había sido cerrado con anterioridad como desfogue, y que precisamente ese cierre se dio por el daño en esas alcantarillas, quedando de manifiesto que la municipalidad no cumple sus funciones y en lugar de cambiar o reparar los sistemas de alcantarillas dañados, simplemente, cambian el curso de las aguas y las enrumban sin criterio, estudio y mucho menos, considerando el impacto negativo que provocan en su contra.

Narran que finalizadas esas dos visitas, a la fecha no existe respuesta ni criterio alguno sobre las inspecciones y mucho menos se ha dado solución a su problema. La pasada tormenta Nate resultó desastrosa, socavando y erosionando mucho los terrenos e inundando sus patios y jardines, con la contaminación que implica, en un lugar donde viven varias familias con niños y personas adultas mayores, con los problemas de salud y a la vida que ello implica, pues los adultos mayores y niños requieren de más cuidados. La situación se agrava pues se espera que, en los próximos años, los fenómenos naturales produzcan mayores cantidades de agua que terminarían devastando sus propiedades y viviendas.

  1. 2Por resolución de las 9:03 horas del 27 de diciembre de 2017, se le solicitó informe al Jefe de la Unidad de Gestión Técnica Vial de la Municipalidad de Acosta, Alcalde de Acosta, Ministro de Obras Públicas y Transportes y Director del Consejo Nacional de Vialidad.
  2. 3informó, bajo juramento, CARLOS EDUARDO SOLÍS MURILLO, en su condición de Director Ejecutivo del Consejo Nacional de Vialidad que, los recurrentes se limitan a hacer mención de una violación al derecho de petición y pronta respuesta; sin embargo, no demuestran cual fue la omisión o la actuación administrativa de ese Consejo que lesiono tal derecho; pues, no consta en el escrito de interposición, alguna petición hecha a la institución que representa. Asimismo, en lo relacionado con el derecho fundamental a la igualdad ante la ley, alega que se limitan a transcribir literalmente un artículo constitucional, sin aportar ningún medio probatorio. Conjuntamente, alega que no se demuestra que su representado vulnerara el derecho fundamental a la salud de los recurrentes. De igual forma, considera que no logra acreditar que violentara el derecho a la propiedad. Plantea que ante esa dirección no consta, ni se encuentra acreditado en el expediente judicial que los recurrentes son actuales administrados debido a la avanzada edad de su padre, ni consta que el propietario registral, Vindas Ureña, tenga complejo estado de salud.Manifiesta que los recurrentes son contundentes en afirmar que las supuestas causas que están dañando sus propiedades, se debe a un encausamiento de aguas realizada por la Municipalidad de Acosta, lo que concuerda en un todo con el informe técnico rendido por ingenieros del Consejo. Indica que existe una contradicción en lo alegado por los recurrentes; por cuanto señalan que la ruta nacional 301 se encuentra frente a sus propiedades; sin embargo, posteriormente señalan que “existe una extensión de camino vecinal por aproximadamente 600 metros los cuales corresponde a la Municipalidad dar el tratamiento correspondiente de aguas llovidas y servidas, lo cual en efecto hace por medio del sistema de caños y alcantarillados que existe a la fecha”, aunado a lo anterior, si la Municipalidad recurrida realizó trabajos de construcción frente a la propiedad de los recurrentes, es porque verdaderamente se encuentra en una vía cantonal.Finalmente, indica que lo reclamado por los recurrentes en relación con las propiedades que sufrieron daños por el encausamiento de aguas, es achacado en todo momento al municipio recurrido, por lo que solicita se declare sin lugar el recurso.
  3. 4Informó, bajo juramento, GERMAN VALVERDE GONZÁLEZ, en su condición de Ministro de Obras Públicas y Transportes que, en lo que concierne a ese Ministerio, no se ha incurrido en conducta alguna, activa u indolente que haya vulnerado en forma alguna los derechos fundamentales de los recurrentes; pues a partir de lo alegado por los recurrentes, se desprende que el problema se debe a los efectos producidos por la ejecución de obras de la Municipalidad de Acosta, se dieron dentro de una vía integrante de la red vial cantonal. Expuesto lo anterior, solicita la declaratoria sin lugar del presente amparo.
  4. 5informó, bajo juramento, NORMAN EDUARDO HIDALGO GAMBOA, en su condición de Alcalde Municipal de Acosta que a solicitud de algunos vecinos de la comunidad de San Luis, se procedió a rehabilitar un paso de alcantarilla en la ruta cantonal C-1-12-024 con maquinaria municipal, disponiéndolas por topografía sobre la ruta nacional 301, mismas que son dirigidas hacia un desfogue pluvial existente y construido en su momento por el Consejo Nacional de Vialidad en dicha ruta nacional. Indica que dicha decisión se originó ya que al buscar alternativas de encausar las aguas en otros sectores, se determinó que bajo la realidad habitacional de la zona no fue posible desviar las aguas hacia otro punto. Señala que el 6 de setiembre, se presentó al sitio el Ingeniero Carlos Pérez, quien después de evaluar las condiciones del sitio, explicó las limitaciones que presenta la evacuación de las aguas en el sector, debido a las condiciones topográficas y la realidad habitacional del sector.Asimismo, la Ingeniera Paula Reyes de ese Consejo, manifestó que la cantidad de agua que viene de la ruta cantonal; siendo que se encuentra sobre una ruta nacional, es razonable que las aguas lleguen al punto más bajo, depositándose sobre el sistema de drenaje existente; y que previamente a un criterio técnico de los ingenieros del Consejo Nacional de Vialidad, la salida de agua ingresa a las propiedades de los recurrentes Señala que en relación a la problemática de salubridad reclamada por los recurrentes, en razón de la contaminación” originada por las aguas servidas por los caseríos existentes sobre la ruta nacional 301, es el Ministerio de Salud, como Ente Rector, al cual le corresponde la fiscalización seguimiento de las infracciones por parte de los usuarios, puesto que es responsabilidad de cada propietario eliminar adecuada y sanitariamente las aguas pluviales y servidas. Expuesto lo anterior, solicita se declare sin lugar el recurso.
  5. 7Mediante memorial de 13 de febrero de 2018, los recurrentes replicaron los informes e indicaron que en lo que atañe al Consejo recurrido no es de recibo que se alegue que las fotos pudieron ser tomadas de cualquier otro lugar, poniendo en duda su honestidad y sobre todo en juego sus derechos, pues no van a accionar esta vía sin tener clara la violación a los mismos ni por ser antojadiza, ni mucho menos van a manipular prueba con las consecuencias que ello conlleva. Está claro que la misma ingeniera del Consejo Nacional de Vialidad visitó la zona debido a sus quejas y ella misma manifestó que la se debía reabrir los desfogues que fueron cerrados en esa misma ruta nacional 301, determinándose la responsabilidad de ese Consejo al permitir que la Municipalidad de Acosta manipulara e interfiriera realizando obras sobre esa ruta nacional, que es competencia única y exclusiva del Consejo Nacional de Vialidad, como ellos mismos lo aceptan, existiendo así una intromisión de funciones por parte de la Municipalidad y por supuesto una falta y omisión a sus actuaciones por parte de esa dependencia, todo lo que ha conllevado a su perjuicio, conforme a lo apuntado en el recurso.Respecto, a su alegato de posible falsedad de las pruebas aportadas, es importante mencionar y considerar que para ciertas cosas y como ellos mismos mencionan en su contestación y en lo que les favorece, si toman dichas pruebas como válidas y reales, esto lo indicamos como simple observación debido a lo alegado por los mismos en cuanto a que no existe certeza de las mismas, pero como ya se dijo, para lo que les favorece hacen uso de esas mismas pruebas.

Respecto a la contestación por parte del Alcalde Municipal: Es claro y evidente que trata de justificar su actuar equivoco y perjudicial en su contra, donde incluso alega que se cerraron ciertos desfogues de agua y encausaron la misma a la ruta nacional 301, debido a la afectación que se estaba dando en otros lugares; sin embargo, no tomaron en consideración que con ello lo que harían afectarían sus propiedades y derechos, pues ni siquiera existió estudio técnico al respecto, sino que por complacer y favorecer a otros vecinos del cantón y sin dar una solución adecuada e integral, simplemente y de forma antojadiza y arbitraria deciden cerrar todos los desfogues mencionados y encausarlos a la ruta nacional 301, sin considerar su impacto, y siendo peor que incluso cierran un desfogue existente en la parte superior de dicha ruta y hoy alegan que no lo pueden reabrir debido a que existe una construcción realizada con posterioridad a ese cierre, la cual se vería afectada por encontrarse cerca del caudal del mismo; sin embargo eso es responsabilidad única y exclusiva de los mismos, pues ese permiso municipal bajo esas condiciones nunca debió haberse aprobado y si la vivienda no cuenta con los permisos, entonces deberían aplicar lo correspondiente y ser responsables con su actuar o omisión y asumir sus consecuencias, si fuera del caso con el resarcimiento de esa vivienda, porque ahí no se podía construir, y así debe constar en el respectivo retiro cuando se trata de acequias, por lo que no es recibo ese alegato, y demuestra una vez más la inoperancia municipal y su consideración que para ellos no es relevante el perjuicio con el fin de salvaguardar los derechos de otros ciudadanos, cuando no es así en aplicación del principio de igualdad, considerando que esos cierres se dan con posterioridad a la construcción de nuestras viviendas en nuestras propiedades y que hoy se ven afectadas.

Están de acuerdo en tolerar lo dispuesto en la ley, respecto a la disposición de aguas; sin embargo eso es de aplicación para todos los ciudadanos, no es posible y mucho menos tolerable que pongan en peligro su salud y vida, porque otros vecinos se quejaron que en sus propiedades las aguas hacían daño, y la municipalidad consideró que eso no estaba bien; sin embargo si consideran razonable dañar sus propiedades y viviendas y poner en peligro su vida y salud en función de salvaguardar esos derechos iguales o menores de otros vecinos, sin dar una solución real, integral y mucho menos con criterios y estudios técnicos sobre el impacto y factibilidad de sus acciones.

  1. 8Por resolución de las 9:34 hrs. de 16 de febrero de 2018, se tuvo por ampliado el recurso de amparo contra el Área Rectora de Salud de Acosta.
  2. 9Informó, bajo juramento, Maricruz Chavarría Castrillo, en su condición de Gestora Ambiental del Área Rectora de Salud de Acosta e indicó que al ser las 11:30 am de 22 de febrero del 2018, se apersonó en compañía de la funcionaría Dayanna Chinchilla Arias, a San Luis de Acosta, específicamente en los lugares indicados en el recurso de amparo (Parte alta de San Luis, sector oeste, del cruce hasta el cementerio y trayecto Ruta 301), con el fin de revisar a lo que en este documento se denuncia respecto a la disposición de las aguas residuales. En el momento de la visita se evidencia lo siguiente: Se inició la inspección desde la propiedad del denunciante hasta el cementerio de San Luis, durante el trayecto se visualizaron aproximadamente 10 casas que se encuentran colindantes a la cañería (sic) pluvial sobre la ruta 301 y en la parte alta de San Luis en la entrada del cruce de San Luis hacia el cementerio.Durante el recorrido fue posible visualizar presencia de aguas servidas e incluso restos de comidas en el alcantarillado pluvial proveniente de las viviendas mencionadas anteriormente, que por gravedad y por el curso que posee el sistema de alcantarillado llegan a desfogar a la propiedad del denunciante. Se procede en el momento, a hacer revisión de las viviendas, pero en la mayoría de los inmuebles no se encontraba nadie. Se logró realizar la revisión de la vivienda de Rosmery Calderón Alfaro. Se procedió a hacer prueba de fluoresceína sódica en pilas y lavamanos de la vivienda y dan negativas a la cañería pluvial en cuestión. En la vivienda donde reside Andrea Rojas Arias se realizó prueba de fluoresceína sódica en pilas de la vivienda y la misma da positiva al suelo a cielo abierto, aguas que en algún momento por escorrentía legarán a la cañería (sic) pluvial en cuestión. Ante tal hallazgo se procede a emitir la Orden Sanitaria CS-ARSAC- 0S-036-2018 a la inquilina de la vivienda, quien refirió que el propietario del inmueble reside 500 metros hacia al sur de la Escuela de San Luis, casa color amarilla, por lo que en los próximos días el propietario será notificado también.Se evidenció la presencia de horas secas y otros residuos ordinarios en la cañería pluvial. Lo cual es competencia Municipal, según lo indicado en el articulo 8 inciso e), de la Ley para la Gestión Integral de Residuos Sólidos No 8839, el cual indica que la Municipalidad debe: "Proveer de los servicios de limpieza de caños, acequias, alcantarillas, vías, espacios públicos, ríos y playas cuando corresponda, así como del manejo sanitario de animales muertos en la vía pública." Con respecto a las distancias del alcantarillado pluvial, se evidenció que desde el cementerio se encuentra acomodada de forma tal que van a desfogar a la alcantarilla contigua a las propiedades de los denunciantes; sin embargo, desconoce los criterios de diseño de los mismos, corresponderá a la Municipalidad de Acosta y al Consejo Nacional de Vialidad emitir criterio sobre la canalización de estas aguas pluviales. Por tanto, si se evidencia la inadecuada disposición de aguas servidas de algunas de las viviendas ubicadas en esta área, será menester continuar la investigación de las demás viviendas, con el fin de que todas se encuentren en cumplimiento de lo que indican los artículos 285, 287 y 292 pertenecientes al capítulo III “De las obligaciones y restricciones para la evacuación sanitaria de excretas y aguas servidas y negras”, de la Ley General de Salud, No. 5395 publicada en la Gaceta No. 222 de 24 de noviembre de 1973. Lo anterior consta en acta de inspección M-018-02-2018.
  3. 10En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Hernández Gutierrez; y,

CONSIDERANDO:

I. OBJETO DEL RECURSO

Los recurrentes demandaron la tutela de su derecho a un ambiente sano y ecológicamente equilibrado, pues, según afirman, la Municipalidad de Acosta, realizó el cierre de varias salidas de aguas o desfogues que existían en varias de las propiedades del lugar y otros caminos también de orden municipal, enfocando toda la cantidad de agua recolectada en ese sector del cementerio y San Luis arriba, hacia sus propiedades.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos: 1) En fecha indeterminada y al clausurar los desfogues que existían en las vías locales que existen en las partes altas de San Luis, la Municipalidad de Acosta encausó las aguas pluviales a una cuneta de la ruta nacional 301, que desfoga en los inmuebles de los amparados (informes). 2) La Municipalidad recurrida no brinda el servicio de limpieza de vías en el sector de San Luis (informe). 3) El 22 de febrero del 2018, el Área Rectora de Salud de Acosta realizó una inspección en la parte alta de esa comunidad, sector oeste, del cruce hasta el cementerio y trayecto Ruta 301, que evidenció que las aguas que desfogan en esos inmuebles contienen aguas servidas y restos de comidas que provenían de las viviendas colindantes así como gran cantidad de basura recolectada en el trayecto (informe). 4) En fecha indeterminada, los recurrentes realizaron trabajos en esas fincas con el único fin de mitigar los efectos del paso de toda esa agua; sin embargo, resultaron insuficientes (hecho no controvertido). 5) Los inmuebles de los recurrentes sufren riesgo de deslizamiento y erosión (los autos).

III. HECHOS NO PROBADOS

Se estima no demostrado, el siguiente de relevancia: Único.- Que el Consejo Nacional de Vialidad o el Ministerio de Obras Públicas y Transportes hayan realizado las obras que se reclaman (los autos).

IV. SOBRE EL DERECHO A UN AMBIENTE SANO Y ECOLÓGOCAMENTE EQUILIBRADO

Reiteradamente este Tribunal ha sostenido, en lo que interesa, lo siguiente:

“(...) El derecho a la vida reconocido en el numeral 21 de la Constitución es la piedra angular sobre la cual descansan el resto de los derechos fundamentales de los habitantes de la república. De igual forma, en ese ordinal de la carta política encuentra asidero el derecho a la salud, puesto que, la vida resulta inconcebible si no se le garantizan a la persona humana condiciones mínimas para un adecuado y armónico equilibrio psíquico, físico y ambiental. Ahora bien, la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente en los artículos 21, 50, 73 y 89 de la Constitución Política. Específicamente, el artículo 50 constitucional reconoce de forma expresa el derecho de todos los habitantes del país a disfrutar de un medio ambiente saludable y en perfecto equilibrio. Ese derecho es garantía fundamental para la protección de la vida y la salud pública. En apoyo de lo anterior este Tribunal ha recurrido a la utilización de la noción de "calidad ambiental" como un parámetro, precisamente, de la calidad de vida de las personas, que se conjuga con otros elementos tales como la salud, la alimentación, el trabajo y la vivienda, haciendo referencia a que toda persona tiene derecho a hacer uso del ambiente para su propio desarrollo pero no de manera ilimitada, ya que, también, existe un deber de protección y preservación del medio ambiente para las generaciones presentes y futuras -principio de desarrollo sostenible-”.

Asimismo, del artículo 50, de la Constitución Política, se deriva la obligación del Estado de proteger el ambiente. Norma que establece al efecto:

“El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza. Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado. El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes”.

Con lo que se corrobora que las distintas autoridades públicas tienen el deber ineludible de preservar, defender y garantizar el derecho fundamental de toda persona a la salud y a un ambiente sano y ecológicamente equilibrado” (sentencia No. 2006-005928 de las 15:00 horas del 2 de mayo del 2006).

V. CASO CONCRETO

El Alcalde Municipal de Acosta aceptó que como parte de las alternativas de encausar las aguas en otros sectores de San Luis, se procedió a rehabilitar un paso de alcantarilla en la ruta cantonal C-1-12-024 con maquinaria municipal, disponiéndolas por topografía sobre la ruta nacional 301, hacia un desfogue pluvial que construyó en su momento por el Consejo Nacional de Vialidad en dicha ruta nacional 301, cuya salida de agua ingresa a las propiedades de los recurrentes (informe). Esas aguas, según el Área Rectora de Salud de Acosta el 22 de febrero del 2018, contienen aguas servidas, restos de comidas que provienen de las viviendas colindantes así como cantidad de basura recolectada en su gran trayecto, en vista que en el sector no se presta el servicio de limpieza de vías (informe). Pese a la justificación que brinda la Alcaldía Municipal recurrido en el sentido que la decisión reclamada se sustenta en la imposibilidad de desviar las aguas hacia otro punto distinto a los inmuebles de los amparados, estima la Sala que en el caso que nos ocupa, la forma en que dispuso el ente local recurrido el desfogue de las aguas pluviales reclamadas es inapropiada, pues, pone en peligro la integridad del inmueble donde habitan los recurrentes y sus familias, y su integridad y vida. Bajo esta inteligencia, estima la Sala que se produjo la infracción reclamada.

VI.De otra parte, en lo que atañe al Ministerio de Obras Públicas y Transportes y el Consejo Nacional de Vialidad, no aprecia la Sala actuación u omisión alguna que amenace o lesione los derechos fundamentales de los amparados. En este particular, no consta idónea y fehacientemente que el Consejo Nacional de Vialidad o el Ministerio de Obras Públicas y Transportes hayan realizado las obras que se reclaman (los autos).

VII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI

Por tanto:

Se declara con lugar el recurso, únicamente, en lo que respecta al ente local recurrido. En consecuencia, se ordena a Norman Eduardo Hidalgo Gamboa, en su condición de Alcalde Municipal de Acosta, o a quien ejerza ese cargo, que lleve a cabo todas las actuaciones que se encuentren dentro del ámbito de sus competencias y atribuciones a efectos de que, dentro de los seis meses siguientes a la notificación de esta resolución, se corrija el desfogue de aguas pluviales que afectan los inmuebles de los amparados, y se brinde el servicio de limpieza de vías en San Luis. Asimismo, se le ordena a Maricruz Chavarría Castrillo, en su condición de Gestora Ambiental del Área Rectora de Salud de Acosta, que gire las órdenes sanitarias necesarias a ese efecto y verifique el cumplimiento de lo dispuesto en ese sentido. Se advierte a la autoridad recurrida y a esa última funcionaria, que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

En lo que atañe al Ministerio de Obras Públicas y Transportes y el Consejo Nacional de Vialidad, se declara sin lugar el recurso. Se condena a la Municipalidad de Acosta al pago de las costas, daños y perjuicios ocasionados por los hechos que han dado lugar a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso Fernando Cruz C.
