Document Review *190203860007CO* Case: 19-020386-0007-CO Decision No. 2019023112 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at eight fifty in the morning on November twenty-second, two thousand nineteen.

Amparo appeal (recurso de amparo) processed under case number 19-020386-0007-CO, filed by Xiomara Rodríguez Hernández, identity card number 3 0388 072, Deputy of the Republic, on her own behalf, against the Procuraduría General de la República.

Findings:

  1. 1In a written submission added to this case file on 29 de octubre de 2019, the appellant alleged, in summary, the following: she states that, in her capacity as a Deputy of the Republic, on 28 de enero de 2019, she sent the respondent authority an inquiry set forth in official letter PRNDXRH-019-19, in which she requested the following: “[...] Through this letter, I wish to make an inquiry regarding the following situation. It is my understanding that some municipalities in the country use funds from Ley 8114 to pay their payroll expenses; therefore, I respectfully request that you inform me whether payments made by municipalities using funds originating from that law are lawful and, if they are not, what would happen to the positions existing in the municipalities that have been funded for years under Ley 8114 […]”. She states that the official letter was duly received at the central document-receiving office of the Procuraduría General de la República on 29 de enero de 2019. She states that, as of the date this appeal was filed, they had received no response to her request, an omission that she believes violates her fundamental rights. She requests that the responsible officials be ordered to provide the requested information immediately.
  2. 2By a decision issued at 7:10 on 4 de noviembre de 2019, the proceeding was admitted.
  3. 3On 5 de noviembre de 2019, notice of this amparo appeal was served on the Procuraduría General de la República.
  4. 4In a written submission added to the case file on 8 de noviembre de 2019, Julio Alberto Jurado Fernández, Procurador General de la República, submitted his report. He stated as follows:

“I. REPORT FIRST: Partially admitted. The existence of official letter No. PRN-DXRH-019-19, dated 28 de enero de 2019, signed by the appellant in her capacity as a deputy, is true and is admitted.

As inaccurate, we deny that the petitioner’s matter constitutes a straightforward request (petición pura y simple) for information held by the Procuraduría, as she seeks to suggest.

As this Chamber may verify from the copy of the aforementioned official letter that she herself submitted to the record, the appellant, in her capacity as a deputy, made an inquiry and therefore requested the technical legal opinion of the Procuraduría General de la República regarding the following issue: “whether payments made by municipalities using funds originating from that law are lawful and, if they are not, what would happen to the positions existing in the municipalities that have been funded for years under Ley 8114.” Accordingly, we deny at this time—and without prejudice to the more detailed explanation I will provide in the following section of this submission—that the petitioner’s request may fall within the provisions of Articles 27 and 30 of the Constitution, in relation to Article 32 of the Ley de la Jurisdicción Constitucional, which she cites among her legal grounds, because, I repeat, this is not a straightforward request for information, but rather an inquiry concerning a matter whose breadth and complexity require adequate time for its review and response.

I also wish to point out to this high Court that, because this is an inquiry, our opinion is not subject to review in light of the aforementioned fundamental rights of petition and access to information, nor the right to a prompt decision and administrative justice under Article 41 of the Constitution, because our advisory and consultative authority is established by a legal provision, specifically Articles 1, 2, 3(b), and 4 of our Ley Orgánica (No. 681S of 27 de setiembre de 1982); that law establishes no formal obligation whatsoever to address inquiries submitted to the Procuraduría General de la República by deputies acting in that capacity, but only those submitted by the Public Administration. As we have informed the Asamblea Legislativa on many occasions, we do so in an effort to assist with the highly important duties entrusted to its members, provided that doing so does not hinder the performance of our ordinary duties established by law.

Accordingly, we deny that the appellant’s fundamental rights were violated in any way as a result of her having submitted a request for a legal opinion in her capacity as a legislator.

SECOND: Admitted.

THIRD: Admitted on the following terms. Although it is true that, as of the date the amparo appeal was filed, no response had been provided to the inquiry submitted through the aforementioned official letter No. PRN-DXRH-019-19, the fact is that it has now been answered through legal opinion OJ-128-2019, dated 5 de noviembre of the current year, which was served on the appellant’s office in the Asamblea Legislativa the following day, as this honorable Chamber may verify from the attached certified copies.

FOURTH: Denied. First, the reference to the Ministerio de Relaciones Exteriores y Culto is denied as irrelevant, because the Procuraduría General de la República has no organizational connection whatsoever with that ministry. The appellant overlooks the fact that the Procuraduría is a body of the Ministerio de Justicia vested with administrative independence, pursuant to Article 6(a) of the Ley Orgánica of that ministry (No. 6739 of 28 de abril de 1982). Second, we deny that the appellant was left defenseless or suffered any other type of violation of her fundamental rights because opinion OJ-128-2019 was not served until 6 de noviembre, given the absence of any constitutional or legal mandate requiring the Procuraduría to provide legal advice through its opinions to any subject or person other than the Public Administration itself, as will be further explained below.

II.CONCERNING THE ABSENCE OF A MANDATE ARISING FROM THE EXERCISE OF A FUNDAMENTAL RIGHT OR ESTABLISHED BY LAW REQUIRING THE PROCURADURÍA GENERAL DE LA REPÚBLICA TO PROVIDE ITS ADVISORY SERVICES TO LEGISLATORS, TAKING INTO ACCOUNT THE LEGAL NATURE OF THE REQUEST SUBMITTED

As stated in the section concerning the facts, the request submitted to this Procuraduría by Deputy and appellant Xiomara Priscilla Rodríguez Hernández seeks the issuance of an opinion in the exercise of our advisory function (función consultiva), which, as provided by the legislature itself in our Ley Orgánica (No. 6815), is to be exercised solely in relation to the State and its institutions as part of their administrative activities—that is, with respect to the Public Administration, both centralized and decentralized—in accordance with Article 1 thereof:

“ARTICLE 1. LEGAL NATURE: The Procuraduría General de la República is the highest technical-legal advisory body of the Public Administration and the legal representative of the State in matters within its jurisdiction.

It enjoys functional independence and independence of judgment in the performance of its duties.” (Emphasis not in the original) Consequently, the Procuraduría has no legal obligation to advise or address legal inquiries submitted by private individuals, including the Deputies of the Asamblea Legislativa, even when they act in the exercise of that high office, because it is clear that, in that capacity, they are not part of the Public Administration and are not performing an administrative function.

The appellant’s request submitted through the aforementioned official letter No. PRN-DXRH-019-19 falls squarely—as we specified in our response to the allegations in the appeal—within the category of a request for a legal opinion.

However, as our administrative case law (jurisprudencia administrativa) has repeatedly advised the deputies themselves whenever they consult the Procuraduría, their concerns are processed as an exception to the ordinary powers entrusted to this body by law, solely in an effort to assist them in the exercise of their constitutionally assigned legislative and political oversight functions, in view of the important duties entrusted to members of the Asamblea, but with the understanding that there is no legal obligation to address inquiries submitted by the Asamblea Legislativa or by its deputies individually.

This is why opinions addressed to deputies are issued as legal opinions, which, unlike our formal opinions (dictámenes), are not binding, also as an exception to the provisions of Article 2 of our Ley Orgánica, with the sole commitment that they will be addressed with the same legal rigor and objectivity and within the shortest possible time, taking into account the high volume of inquiries submitted by the Public Administration, which we are legally obligated to answer through binding formal opinions and in the order in which each is received.

Accordingly, as deputies are routinely advised on the repeated occasions when they request the technical legal opinion of this advisory body, even though they are not administrative heads and do not exercise administrative functions, the Procuraduría answers the inquiries they submit as a courtesy in recognition of the highly important office they hold, in order to facilitate the exercise of the high functions assigned to them by the Constitution. This applies to nonbinding opinions rendered in relation to a particular bill or to matters that may be considered within the scope of the political oversight function and that may reasonably be deemed to be of general interest.

It is therefore clear that this form of cooperation, which is not provided for by law, is intended, we reiterate, to assist in the performance of parliamentary functions by providing advice of a strictly legal nature. Such advice cannot distort the Procuraduría’s advisory function and, in particular, cannot constrain that function to the point of preventing it from providing advice to those entitled to request it—namely, the Public Administration. Thus, advice provided to deputies is limited by the proper scope of the advisory function, its efficient exercise with respect to the Public Administration, and the reasonableness and moderation of the inquiry submitted.

In any event, when requests from legislators are addressed, the legal analysis performed has the same depth and rigor as in cases in which we issue a formal opinion, as governed by Articles 2 and 3(b) of our Ley Orgánica, although, we repeat, they are not issued as such, but rather as Legal Opinions. This means that the same procedure followed for requests submitted by the rest of the Public Administration is applied when assigning and reviewing the requested matter.

It follows from the 10 stated that we are not dealing with the exercise of the rights enshrined in Articles 27 and 30 of the Constitución Política and Article 32 of the Ley de la Jurisdicción Constitucional, because what the appellant seeks is not access to public information held by the Institution I represent. An analysis of the request submitted makes it clear that we are being asked to provide a legal analysis and that it does not constitute a straightforward request for information, which is the type of request subject to the referenced 10-day period.

The right to petition and receive a prompt response (derecho de petición y pronta respuesta) has been defined by that Sala Constitucional as the obligation to address submissions made by members of the public so that the Administration provides them with information or rules on some matter or claim affecting their interests. This right is considered to encompass two distinct types of submission: one known as a simple petition (simple petición), intended to satisfy a member of the public’s need for access to information held in public offices; and another relating to submissions seeking a ruling by the Administration on a specific matter affecting that person, made through a claim (reclamo), appeal (recurso), or request for relief (pretensión). ...

[In this regard, decision number 753-98 of this Sala Constitucional is cited] It follows from the foregoing that the advisory function (función consultiva) of the Procuraduría is not included among the circumstances that this Sala has recognized as forming part of the essential content of the fundamental rights alleged.

This is essentially because, by express mandate of the legislature, the advisory function of the Procuraduría is reserved for the bodies of the active Administration (Administración activa), and specifically for the heads of the institution (artículo 4 of our Ley Orgánica, n.°6815 del 27 de setiembre de 1982). In other words, in performing that function, it is authorized to interact solely with the bodies and entities of the Public Administration (Administración Pública), not with private individuals or members of the Legislative Assembly. Consequently, the latter have no fundamental right to require the highest advisory body to answer the legal inquiries they submit.

In this regard, we echo the words of the President of the Sala Constitucional, Justice Castillo Víquez, in his separate opinion (nota separada) in judgment n.°2012-2828 de las 14:30 horas del 29 febrero del 2012, processed under amparo proceeding (expediente de amparo) n.°12-002233-0007-C0, which dismissed the amparo appeal (recurso de amparo) filed at that time by two members of the Legislative Assembly against the Procuraduría, alleging infringement of the same rights invoked by the appellant here:

[The separate opinion of Justice Castillo Víquez in judgment number 2012-2828 is cited here] In accordance with the foregoing, given the legal nature of the submission and because the appellant is not seeking access to public information falling within the purview of the institution I represent, there has been—as she alleges—no failure whatsoever on my part, or on the part of the institution I represent, to fulfill any duty to provide “complete information... within the statutory period.” Accordingly, the amparo appeal is deemed inadmissible and the submission filed should be dismissed.

III. APPLICATION OF THE CRITERIA OF REASONABLENESS AND PROPORTIONALITY IN THIS SPECIFIC CASE

Without prejudice to the statements made in the preceding section, and although the appellant’s inquiry has already been answered, we must emphasize that the advisory function of the Procuraduría is not subject to specific statutory deadlines. Accordingly, the criteria of reasonableness and proportionality must be applied, taking into consideration the institution’s heavy caseload.

Like adjudicative work (labor jurisdiccional), the advisory function requires a detailed examination of the relevant legal rules. Regarding the advisory function itself, this body has stated:

“The advisory function is a declaration of judgment, not of intent, designed to advise or clarify for the administrative authority the scope of its jurisdiction and the principles, extent, and methods for exercising that jurisdiction in accordance with the legal system.” (C-329-2002 de 4 de diciembre de 2002 and OJ-135-2003 de 7 de agosto de 2003).

We must also point out that the institution must prioritize the allocation of its limited human resources, bearing in mind that proceedings in which the Procuraduría appears in defense of the State are subject to deadlines requiring immediate attention, unlike advisory work, for which, as stated, there are no expressly prescribed deadlines. This is particularly relevant given that most Procuradores are assigned not only inquiries and legal opinions—such as the one at issue here—but also adjudicative proceedings.

For informational purposes, in 2018, the Procuraduría handled 55.934 judicial case files that remained active and that specifically concerned contentious proceedings involving the State. In addition, it handled 18.793 case files that concluded during that year, for an overall total of 74.727 proceedings.

There are also judicial case files relating to other proceedings in which the State is not a litigant, such as possessory title proceedings (informaciones posesorias).

These are a type of proceeding that demands a great deal of time from the Procuradores handling them, and the volume of incoming matters is also very high. Specifically, during 2018, a total of 19.397 notices relating to this type of case file were processed.

Likewise, with respect to the advisory function, in 2018, 341 binding opinions (dictámenes), 133 advisory legal opinions (opiniones jurídicas), and 2 legal opinions (opiniones legales) were issued, for a total advisory output of 476 opinions.

The responsibilities of the Procuraduría also include serving as an impartial adviser to the Sala Constitucional. In this regard, during 2018, it participated in preparing 80 reports for the Sala.

Finally, with respect to notarial acts (actos notariales), a total of 14 notarial certifications and 345 deeds were executed during 2018.

The total number of Procuradores is 102, including senior management, which entails a heavy workload for each one.

The foregoing clearly establishes that, given the breadth of the powers conferred on the Procuraduría General de la República and the volume of work it handles, the time taken to address the appellant’s inquiry was neither unreasonable nor disproportionate (in this regard, see also the recently cited judgment n.°2012-2828).

Ultimately, it is important for that Sala Constitucional to understand clearly that the appellant did not submit any request for information to the Procuraduría General de la República; therefore, there is no constitutional duty to respond to her within the period established by artículo 32 of the statute governing this Jurisdiction. This Procuraduría received a request to issue an advisory opinion that, by its nature and content, does not constitute a simple petition; on the contrary, as demonstrated by the response issued by this Institution, it is a request for relief that required an in-depth legal analysis of the relevant administrative case law and legislation. The time elapsed was therefore neither unreasonable nor disproportionate. Rather, the institution I represent fully discharged its advisory function, thereby precluding any constitutional violation such as that alleged by the appellant.” Based on the foregoing, the Procurador General requested the following:

“Based on the rules governing this matter and constitutional case law, we respectfully request that the Honorable Justices of the Sala Constitucional dismiss this appeal in all respects and absolve the State and the officials of this Procuraduría General of all liability.”

  1. 5The statutory requirements have been observed in the conduct of the proceedings.

Opinion drafted by Justice Delgado Faith; and,

Whereas:

I.Subject matter. The appellant alleged that, in enero de 2019, she submitted a filing to the Procuraduría General de la República and has not yet received a response.

II.Proven facts. The following facts relevant to the resolution of this matter are deemed duly established: 1) El 29 de enero de 2019, the appellant submitted to the respondent authority a filing, official letter PRNDXRH-019-19, in which she stated the following: “(...) I hereby wish to make an inquiry regarding the following situation. It has come to my attention that some municipalities in the country use funds from Ley 8114 to pay their payroll expenses. I therefore respectfully request that you inform me whether payments made by municipalities with funds originating from that law are lawful and, if not, what would happen to the positions existing within the municipalities that have for years been funded under Ley 8114” (report submitted and copy of the filing). 2) El 6 de noviembre de 2019, the Procuraduría General de la República communicated advisory legal opinion OJ-128-2019 to the appellant, responding to the filing submitted (report submitted and copy of the advisory legal opinion).

III.Merits. The appellant alleged that the Procuraduría General de la República had not responded to a filing she submitted, which, in her view, violates artículos 27 y 30 of the Constitución Política and artículo 32 of the Ley de la Jurisdicción Constitucional. It was established that the appellant did, in fact, submit the filing described. However, the text itself shows that it was not a straightforward request for information. Rather, the appellant submitted an inquiry, specifically one of a legal nature. In ruling generally on inquiries seeking a legal opinion, this Sala held as follows in judgment número 2014017155 de las 9:05 horas del 17 de octubre de 2014:

“Upon analyzing the statements made by the protected party in the filing initiating this appeal, as well as the evidence submitted in the case file, it may be inferred that he seeks to have the respondent Minister resolve certain questions regarding payment for private professional practice on public holidays and the collection of overtime pay, which he states are of interest to him. In that regard, because the appellant is requesting advice concerning a particular hypothetical situation, the respondent party’s failure to reply in this respect does not violate the rights protected by artículos 27 y 41 of the Constitución Política. This is so because the petitioner’s request cannot be classified as either a straightforward request for information—artículo 27—or a communication requiring the Administration to resolve any type of claim or complaint, or even compelling it to determine whether or not to grant his request—artículo 41.” Specifically, regarding inquiries submitted to the Procuraduría General de la República, this Sala provided the following clarifications in judgment número 2016014230 de las 9:05 horas del 30 de septiembre de 2016:

“The right to petition, established in Article 27 of the Political Constitution, empowers citizens subject to the administration (administrados) to submit petitions to public authorities on matters of general or individual interest, provided that the subject matter of the petition is legally permissible. Nevertheless, it is necessary to distinguish simple petitions (peticiones puras y simples) from other requests [...]; as regards requests for advisory opinions (consultas), the intent is for the Administration being consulted to issue a technical-legal opinion on a matter of interest to the applicant; this necessarily means that the official or entity consulted must study, analyze, and determine whether the matter raised falls within one or another category. Clearly, a proceeding of this nature cannot be equated with a simple petition and therefore does not fall within the scope of Article 27 of the Constitution. Nor could it be regarded as a request for information protected under Article 30 of the Constitution, since the appellants do not seek to obtain documentation of a public nature […] but rather a legal opinion [...]”.

Later, after examining the particular circumstances of the case at hand, it added the following:

“This unquestionably means that the Procuraduría General de la República must issue a technical-legal determination in order to resolve the question raised by the Ministerio de Obras Públicas y Transportes. As stated in the preceding recital (considerando), a request seeking a response to a technical-legal consultation is not a matter that may be heard in these proceedings, since it does not fall within any of the circumstances contemplated by the constitutional provisions governing submissions made by private parties for consideration by the Public Administration in the broad sense (lato sensu)”.

More specifically, when hearing an amparo proceeding (recurso de amparo) filed on similar grounds by several Deputies of the Republic, this Chamber had already ruled in judgment number 2012002828 at 14:30 hours on February 29, 2012, as follows:

“In the present case, the submission filed by the appellants did not constitute a simple petition, since the Procuraduría General de la República was required to conduct a complex legal analysis involving systematic, exhaustive, and meticulous legal research [...]”.

In this new amparo proceeding, it is clear that the appellant seeks the issuance of a legal opinion by the Procuraduría General de la República. For the reasons repeatedly stated by this Court, a consultation framed in this manner does not constitute an exercise of the rights enshrined in Articles 27 and 30 of the Political Constitution. Accordingly, there is no basis for granting the appeal.

IV.Documentation submitted to the case file (expediente). The appellant is hereby advised that, if she submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, she must retrieve them from the Court Clerk’s Office within no more than 30 business days from service of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the «Regulations Governing Electronic Case Files before the Judiciary» (Reglamento sobre Expediente Electrónico ante el Poder Judicial), approved by the Corte Plena at session number 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial number 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session number 43-12 held on May 3, 2012, Article LXXXI.

Therefore (Por tanto):

The appeal is denied.

Revisión del Documento *190203860007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las ocho horas cincuenta minutos del veintidos de noviembre de dos mil diecinueve .

Recurso de amparo que se tramita en expediente número 19-020386-0007-CO interpuesto por Xiomara Rodríguez Hernández, cédula de identidad número 3 0388 072, Diputada de la República, a favor de ella misma, contra la Procuraduría General de la República.

Resultando:

  1. 1Por escrito agregado a este expediente el 29 de octubre de 2019, la recurrente alegó, en resumen, lo siguiente: manifiesta que, en su condición de Diputada de República, el 28 de enero de 2019, envió a la autoridad recurrida una consulta planteada en el oficio PRNDXRH-019-19 en que solicitó lo siguiente: “[...] Por medio de la presente deseo realizar un consulta sobre la siguiente situación, es de mi conocimientos que algunas municipalidades del país utilizan recursos de la Ley 8114 para pagos de sus planillas, por lo que le solicito respetuosamente indicarme si el pago realizado por las municipalidades con recursos provenientes de dicha ley es legal y de no serlo, qué sucedería con las plazas que existen en las municipalidades y que durante años han sido cubiertas por la Ley 8114 […]”. Señala que dicho oficio fue debidamente recibido en la ventanilla única de recepción de documentos de la Procuraduría General de la República el día 29 de enero de 2019. Manifiesta que a la fecha de interposición del presente recurso, no han recibido respuesta a su gestión, omisión que estima lesiona sus derechos fundamentales. Solicita que se ordene a los funcionarios responsables procedan a brindar de manera inmediata la información solicitada.
  2. 2Por resolución de las 7:10 horas del 4 de noviembre de 2019 se le dio curso al proceso.
  3. 3El 5 de noviembre de 2019, se notificó este amparo a la Procuraduría General de la República.
  4. 4Por escrito agregado al expediente el 8 de noviembre de 2019, Julio Alberto Jurado Fernández, Procurador General de la República rindió el informe. Indicó lo siguiente:

“I. INFORME PRIMERO: Se acepta parcialmente. Es cierto y se acepta la existencia del oficio n.° PRN-DXRH-019-19, del 28 de enero de 2019, suscrito por la recurrente en su condición de diputada.

Por inexacto, se rechaza que la cuestión de la accionante se trate de una Petición Pura y simple de información en poder de la Procuraduría, como se quiere dar a entender por ella.

Tal como lo puede comprobar esa Sala de la copia del aludido oficio que ella misma aporta a los autos, la recurrente en su condición de diputada, formuló una consulta y por ende, requirió el criterio técnico jurídico de la Procuraduría General de la República, respecto al siguiente tema: “si el pago realizado por las municipalidades con recursos provenientes de dicha ley es legal y de no serlo, qué sucedería con las plazas que existen en las municipalidades y que durante años han sido cubiertas por la Ley 8114.” Se rechaza, por consiguiente, desde ahora – y sin perjuicio de la explicación más detallada que haré en el apartado siguiente del presente escrito – que la gestión de la accionante pueda enmarcarse dentro de lo dispuesto por los artículos 27 y 30 constitucionales, en relación con el artículo 32 de la Ley de la Jurisdicción Constitucional, que cita como parte de sus fundamentos de Derecho, pues repito, no se trata de una petición pura y simple de información, sino de una consulta sobre un tema que por su amplitud y complejidad requiere el debido tiempo para su estudio y evacuación.

También quiero hacer ver a ese alto Tribunal, que como consulta que es, nuestro pronunciamiento no resulta enjuiciable a la luz de los citados derechos fundamentales de petición, ni acceso a la información, como tampoco del derecho a una pronta resolución y justicia administrativa del artículo 41 de la Carta Fundamental, pues nuestra competencia consultiva y asesora viene dada por norma de rango legal, concretamente, de los artículos 1, 2, 3, letra b) y 4 de nuestra Ley Orgánica (n.°681S del 27 de setiembre de 1982); de la que no se establece ningún tipo de obligación formal de atender las consultas que los diputados formulen a la Procuraduría General de la República en dicha condición, únicamente de la Administración Pública. Lo que se hace, como ya tantas veces lo hemos advertido a la Asamblea Legislativa, en un afán de colaborar en las labores tan relevantes que sus miembros tienen encomendadas y siempre que no se entorpezca el cumplimiento de nuestras funciones ordinarias dadas por ley.

Por consiguiente, rechazamos que de alguna forma se hayan vulnerado los derechos fundamentales de la recurrente, al haber planteado una solicitud de criterio jurídico en su condición de legisladora.

SEGUNDO: Se acepta.

TERCERO: Se acepta en los siguientes términos. Si bien es cierto que a la fecha de interposición del amparo no se había dado respuesta a la consulta hecha mediante el citado oficio n.°PRN-DXRH-019-19, lo cierto es que la misma ya fue evacuada mediante la opinión jurídica OJ-128-2019, del 5 de noviembre del año en curso, notificada al despacho de la recurrente en la Asamblea Legislativa el día siguiente, como lo puede verificar esa honorable Sala de las copias certificadas adjuntas.

CUARTO: Se rechaza. En primer lugar, se rechaza la alusión al Ministerio de Relaciones Exteriores y Culto debido a su falta de pertinencia, pues la Procuraduría General de la República carece de todo vínculo orgánico con dicha cartera. La recurrente olvida que la Procuraduría es un órgano del Ministerio de Justicia dotado de independencia administrativa, conforme con la letra a) del artículo 6 de la Ley Orgánica del mencionado ministerio (n.°6739 del 28 de abril de 1982). En segundo lugar, que con motivo de la notificación hasta el pasado 6 de noviembre del pronunciamiento OJ-128-2019, se le haya causado un estado de indefensión a la recurrente o cualquier otro tipo de lesión a sus derechos fundamentales, ante la inexistencia de un mandato constitucional o legal que obligue a la Procuraduría a prestar asesoramiento jurídico a través de sus pronunciamientos a todo otro sujeto o persona que no sea la propia Administración Pública, lo que se terminará de explicar de seguido.

II.ACERCA DE LA INEXISTENCIA DE UN MANDATO DERIVADO DEL EJERCICIO DE UN DERECHO FUNDAMENTAL O DISPUESTO POR LEY, PARA QUE LA PROCURADURÍA GENERAL DE LA REPÚBLICA PRESTE SU LABOR CONSULTIVA A LOS LEGISLADORES TOMANDO EN CUENTA LA NATURALEZA JURÍDICA DE LA SOLICITUD PLANTEADA

Tal como indicamos en el apartado de hechos, la solicitud que plantea la señora diputada y aquí recurrente Xiomara Priscilla Rodríguez Hernández a esta Procuraduría es para que emitamos un pronunciamiento en ejercicio de nuestra función consultiva, la que por sí disponerlo el propio legislador en nuestra ley orgánica (n.°6815), únicamente debe ejercerse en relación con el Estado y sus instituciones como parte de su quehacer administrativo, a decir, respecto a la Administración Pública (central y descentralizada), en coherencia con lo dispuesto por su artículo 1:

“ARTÍCULO 1o. NATURALEZA JURÍDICA: La Procuraduría General de la República es el órgano superior consultivo, técnico-jurídico, de la Administración Pública, y el representante legal del Estado en las materias propias de su competencia.

Tiene independencia funcional y de criterio en el desempeño de sus atribuciones.” (El subrayado no es del original) En consecuencia, la Procuraduría no tiene la obligación legal de asesorar, ni atender las consultas jurídicas que le formulen los particulares, entre ellos, los señores Diputados de la Asamblea Legislativa, tampoco cuando actúan en ejercicio de esa alta investidura, pues es claro que en esa condición no forman parte de la Administración Pública, ni están realizando función administrativa.

La gestión de la recurrente hecha mediante el referido oficio n.°PRN-DXRH-019-19 se enmarca justamente – según lo precisamos en la contestación a los hechos del recurso -dentro del supuesto de una solicitud de criterio jurídico.

Sin embargo, como de forma reiterada lo ha advertido nuestra jurisprudencia administrativa a los mismos diputados cada vez que consultan a la Procuraduría, se la da curso a sus inquietudes como excepción a las competencias ordinarias que este órgano tiene encomendadas por ley, en un mero afán de colaborar en el ejercicio de sus funciones legislativas y de control político atribuidas constitucionalmente, en atención a las importantes labores encomendadas a los miembros de la Asamblea, pero bajo el entendido de que no existe obligación legal de atender las consultas planteadas por la Asamblea Legislativa o por sus diputados individualmente.

De ahí la razón por la que los pronunciamientos dirigidos a los diputados salgan como opiniones jurídicas, que a diferencia de nuestros dictámenes, carecen de un criterio vinculante, como excepción también a lo dispuesto por el artículo 2 de nuestra Ley orgánica, con el único compromiso de ser atendida con la misma rigurosidad y objetividad jurídica y en el menor tiempo posible en atención al alto volumen de consultas formuladas por la Administración Pública, sobre las que sí existe una obligación legal de dar respuesta a través de dictámenes vinculantes y al orden de ingreso de cada una de ellas.

En ese sentido, y como se le suele advertir a los señores diputados en las repetidas ocasiones que consultan el criterio técnico jurídico de este órgano consultivo, aun cuando ellos no son jerarcas administrativos, ni ejercen función administrativa, la Procuraduría evacua las consultas que formulan por una deferencia al cargo tan relevante que desempeñan, a efecto de facilitarles el ejercicio de las altas funciones que la Constitución les atribuye. Es este el caso de las opiniones no vinculantes que se rinden en relación con un determinado proyecto de ley o en relación con aspectos que pueden considerarse cubiertos por la función de control político y que razonablemente puedan considerarse de interés general.

Por lo que, es claro que esta forma de colaboración no dispuesta en la Ley tiene como objeto, reiteramos, colaborar en la satisfacción de las funciones parlamentarias y ello mediante un asesoramiento de índole estrictamente jurídico. Asesoramiento que no puede desnaturalizar la función consultiva de la Procuraduría y particularmente mediatizar su función, al punto de impedirle suministrar la asesoría a quien está legitimado para solicitársela, sea la Administración Pública. Así, el asesoramiento a los señores diputados tiene como límite el contenido propio de la función consultiva, su eficiente ejercicio respecto de la Administración Pública y la razonabilidad y mesura de la consulta que se formule.

En todo caso, cuando se atienden gestiones de los legisladores, el estudio jurídico que se realiza tiene la misma profundidad y seriedad que los casos en los que emitimos un dictamen, de los que regula los artículos 2° y 3 inciso b) de nuestra Ley Orgánica, aunque, repetimos, no se emiten como tales, sino como Opiniones Jurídicas. Lo anterior implica que, en el procedimiento de asignación y estudio de lo peticionado, se siga el mismo procedimiento que las gestiones presentadas por el resto de la Administración Pública.

Se desprende 10 expuesto, que no estamos frente al ejercicio de los derechos consagrados en los numerales 27 y 30 de la Constitución Política y 32 de la Ley de la Jurisdicción Constitucional, pues lo que la recurrente pretende no es el acceso a información de carácter público bajo custodia de la Institución que represento. Si se analiza la solicitud que se presentó es claro que se nos requiere un análisis jurídico y no corresponde a una petición pura y simple de información, que es la que se encuentra sujeta al plazo de los 10 días a que se hace referencia.

El derecho de petición y pronta respuesta ha sido definido por esa Sala Constitucional como la obligada atención de las gestiones realizadas por los administrados para que la Administración les brinde información o resuelva sobre algún aspecto o reclamación que afecte sus intereses. En este derecho se consideran incluidos dos tipos de gestión distintas: una que se ha llamado simple petición y que está orientada a satisfacer la necesidad del administrado de tener acceso a la información que consta en las oficinas públicas; y otra relacionada con las gestiones destinadas a que la Administración se pronuncie sobre algún punto específico que le afecta, la cual hace a través de un reclamo, recurso o pretensión. ...

[Al respecto se cita el voto de esta Sala Constitucional número 753-98] De lo anterior se desprende que la función consultiva de la Procuraduría no queda contemplada dentro de los supuestos que ha reconocido esa Sala como parte del contenido esencial de los derechos fundamentales alegados.

Básicamente, porque por mandato expreso del legislador, la función consultiva de la Procuraduría está reservada para los órganos de la Administración activa, y específicamente a los jerarcas de la institución (artículo 4 de nuestra Ley Orgánica, n.°6815 del 27 de setiembre de 1982). En otras palabras, en ejercido de esa labor, únicamente está autorizada a relacionarse con los órganos y entes de la Administración Pública, no con los particulares, ni con los diputados. Por consiguiente, estos carecen de un derecho fundamental a que el órgano superior consultivo les conteste las consultas de naturaleza jurídica que les plantean.

Sobre el particular, hacemos eco de las palabras del señor Presidente de la Sala Constitucional, magistrado Castillo Víquez en la nota separada que hizo en la sentencia n.°2012-2828 de las 14:30 horas del 29 febrero del 2012, tramitado bajo el expediente de amparo n.°12-002233-0007-C0, que declaró sin lugar el recurso de amparo que en su momento interpusieron dos diputados en contra de la Procuraduría alegando la conculcación de los mismos derechos que alega la aquí recurrente:

[Se cita aquí la nota separada del Magistrado Castillo Víquez en sentencia número 2012-2828] De conformidad con lo expuesto, dada la naturaleza jurídica de la gestión planteada y que la recurrente no pretende el acceso a información de carácter público que competa a mi representada, no ha habido – como así lo acusa ella – ningún tipo de incumplimiento de mi parte, ni de la institución que representó a deber alguno de suministrar “información completa... en el plazo de ley”, razón por la cual, se estima que el amparo resulta improcedente, debiendo declarase sin lugar la gestión formulada.

III. SOBRE LA APLICACIÓN DE CRITERIOS DE RAZONABILIDAD Y PROPORCIONALIDAD EN EL CASO CONCRETO

Sin perjuicio de lo indicado en el apartado anterior, y a pesar de que ya ha sido respondida la consulta de la recurrente, debemos insistir que la función consultiva de la Procuraduría no está sujeta a plazos específicos regulados en la ley. Razón por la cual, debe estarse a criterios de razonabilidad y proporcionalidad tomando en consideración el alto circulante de asuntos que maneja la institución que represento.

La función consultiva, al igual que la labor jurisdiccional, requiere un estudio detallado de las normas jurídicas de relevancia. Sobre la función consultiva propiamente dicha este órgano ha manifestado:

“La función consultiva es una declaración de juicio, no de voluntad que tiende a asesorar o aclarar a la autoridad administrativa sobre la titularidad de su competencia y los principios extensión y modalidades de ejercicio de esa competencia, conforme el ordenamiento jurídico.” (C-329-2002 de 4 de diciembre de 2002 y OJ-135-2003 de 7 de agosto de 2003).

Por otro lado, debemos señalar que la institución debe priorizar la inversión de sus limitados recursos humanos, tomando en cuenta que los juicios donde la Procuraduría acude en defensa del Estado cuentan con plazos que deben ser atendidos en forma inmediata, contrario a lo que sucede con la labor consultiva donde como indicamos, no existen plazos expresamente regulados. Esto cobra especial relevancia a partir de la constatación de que la mayoría de los Procuradores no solo tienen asignadas consultas y opiniones jurídicas -como la que se discute en este caso-, sino que también atienden procesos jurisdiccionales.

A modo de información en el año 2018, la Procuraduría mantuvo la atención de 55.934 expedientes judiciales que permanecieron activos y que corresponden propiamente a procesos donde existe contención por parte del Estado. Adicionalmente, se dio atención a 18.793 expedientes que fenecieron durante ese año, para un gran total de 74.727 procesos.

También, existen expedientes judiciales correspondientes a otros procesos en los que no hay contención por parte del Estado, tales como las informaciones posesorias.

Estas, son un tipo de proceso que demanda mucho tiempo de los procuradores que les atienden, y por demás el volumen de ingresos es muy alto. Puntualmente, durante el mismo año 2018 se atendieron la suma de 19.397 notificaciones referidas a este tipo de expedientes.

Asimismo, con respecto a la función consultiva en el 2018 se emitieron 341 dictámenes, 133 opiniones jurídicas y 2 opiniones legales, para una producción consultiva total de 476 criterios.

Dentro de las competencias que tiene la Procuraduría también se encuentra la de ser asesor imparcial de la Sala Constitucional. En este sentido, durante el año 2018, se mantuvo la participación en la elaboración de 80 informes para la Sala.

Finalmente, con respecto a la atención de los actos notariales, durante el año 2018 se realizó un total de 14 certificaciones notariales y un total de 345 escrituras.

El total de Procuradores es de 102, incluida la jerarquía, lo que implica un alto volumen de trabajo asignado a cada uno.

Con lo anterior, puede justificarse claramente que dada la amplitud de atribuciones otorgadas a la Procuraduría General de la República y la cantidad de trabajo que atiende, el plazo en que se atendió la consulta de la recurrente no es ni irrazonable ni desproporcionado (al respecto, puede verse también la sentencia recién citada n.°2012-2828).

En definitiva, es importante que esa Sala Constitucional tenga claro que la recurrente no ha realizado ninguna petición de información ante la Procuraduría General de la República, por lo que no existe un deber constitucional de respuesta a su favor en el plazo dispuesto por el artículo 32 de la Ley que regula esta Jurisdicción. Esta Procuraduría ha recibido una solicitud de emitir una consulta que por su naturaleza y contenido no constituye una simple petición sino que, por el contrario, como se comprueba de la respuesta emitida por esta Institución, es una pretensión que implicó un análisis jurídico profundo de la jurisprudencia administrativa y legislación atinentes, por lo que el tiempo transcurrido no es irrazonable ni desproporcionado. Antes bien, se cumple a cabalidad con la labor consultiva a cargo de la institución que represento, aspecto que elimina cualquier quebranto constitucional como el alegado por el recurrente”.

Con base en lo anterior, el Procurador General solicitó lo siguiente:

“Con base en la normativa que rige la materia y la jurisprudencia constitucional, solicitamos a los Honorables Magistrados de la Sala Constitucional declarar sin lugar el presente recurso en todos sus extremos, y que se exima al Estado y a los funcionarios de esta Procuraduría General de todo tipo de responsabilidad”.

  1. 5En la substanciación del proceso se han observado las prescripciones legales.

Redacta el Magistrado Delgado Faith; y,

Considerando:

I.Objeto. La recurrente alegó que, en enero de 2019, presentó una gestión ante la Procuraduría General de la República, de la cual no ha recibido aún respuesta.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos: 1) El 29 de enero de 2019, la recurrente presentó ante la autoridad recurrida una gestión, oficio PRNDXRH-019-19, en el que planteó lo siguiente: “(…) Por medio de la presente deseo realizar un consulta sobre la siguiente situación, es de mi conocimientos que algunas municipalidades del país utilizan recursos de la Ley 8114 para pagos de sus planillas, por lo que le solicito respetuosamente indicarme si el pago realizado por las municipalidades con recursos provenientes de dicha ley es legal y de no serlo, qué sucedería con las plazas que existen en las municipalidades y que durante años han sido cubiertas por la Ley 8114” (informe rendido y copia de la gestión). 2) El 6 de noviembre de 2019, la Procuraduría General de la República comunicó a la recurrente la opinión jurídica OJ-128-2019, en la que da respuesta a la gestión presentada (informe rendido y copia de la opinión jurídica).

III.Sobre el fondo. La recurrente alegó que la Procuraduría General de la República no le ha dado respuesta a una gestión que presentó, lo que, a su juicio, lesiona los artículos 27 y 30 de la Constitución Política y el artículo 32 de la Ley de la Jurisdicción Constitucional. Se demostró que, en efecto, la recurrente presentó la gestión que indica. Sin embargo, del texto mismo se desprende que no se trata de una solicitud pura y simple de información. La recurrente, en realidad, formuló una consulta y, más específicamente, de naturaleza jurídica. Al pronunciarse, en general, sobre consultas en las que se pretende obtener un criterio jurídico, esta Sala se pronunció en sentencia número 2014017155 de las 9:05 horas del 17 de octubre de 2014, de la siguiente manera:

“Una vez analizadas las manifestaciones vertidas por el tutelado dentro del escrito de interposición del presente recurso, así como los elementos probatorios aportados al expediente, se infiere que lo pretendido por él es que el Ministro recurrido le solucione algunas dudas en torno al pago del ejercicio profesional liberal en días feriados y el cobro de horas extras que explica, resultan de su interés. En ese sentido, como lo que requiere el recurrente es que se le brinde una asesoría sobre un supuesto en particular, la falta de respuesta de la parte accionada a este respecto no violenta lo tutelado en los ordinales 27 y 41, de la Constitución Política. Ello es así, por cuanto lo requerido por el petente no puede encuadrarse ni en los supuestos de peticiones puras y simples de información -artículo 27-, ni tampoco, con su misiva obliga a la Administración a solucionar algún tipo de reclamo o denuncia, tan siquiera, la conmina a determinar si acoge o no su solicitud -artículo 41-”.

Específicamente, sobre las consultas planteadas ante la Procuraduría General de la República, esta Sala hizo las siguientes precisiones en sentencia número 2016014230 de las 9:05 horas del 30 de septiembre de 2016:

“El derecho de petición, contemplado en el numeral 27 de la Constitución Política, faculta a los administrados a formular peticiones ante las autoridades públicas, sobre asuntos de interés general o particular, siempre y cuando el objeto de dicha petición sea legalmente posible. No obstante, es necesario distinguir entre las peticiones puras y simples de otras solicitudes [...]; en lo que se refiere a las consultas, lo que se pretende es que la Administración consultada vierta un criterio técnico-jurídico respecto de algún punto que resulta de interés del solicitante; lo cual, necesariamente, significa que el funcionario o la entidad consultada deben estudiar, analizar y determinar si el asunto expuesto se encuentra encuadrado dentro de uno u otro supuesto. Evidentemente, una gestión de esta naturaleza no puede equipararse a una petición pura y simple, por lo que no está enmarcada dentro del artículo 27 constitucional. Tampoco podría estimarse como una solicitud de información cobijada por el numeral 30 de la Constitución, pues lo pretendido por los recurrentes no es obtener una documentación de naturaleza pública […] sino que lo solicitado es un criterio jurídico [...]”.

Más adelante, tras examinar las particularidades del caso concreto, agregó lo siguiente:

“Esto, indudablemente, significa que la Procuraduría General de la República debe emitir un pronunciamiento técnico jurídico a fin de resolver la cuestión planteada por el Ministerio de Obras Públicas y Transportes. Tal y como se expuso en el considerando anterior, una solicitud hecha a efectos de que se evacue una consulta técnico-jurídica no es un supuesto residenciable en esta sede, pues esta no se ajusta a ninguno de los supuestos previstos por las normas constitucionales que regulan lo relativo a los trámites que son presentados por los particulares para conocimiento de la Administración Pública lato sensu”.

De manera más específica, al conocer un recurso de amparo interpuesto por razones similares, por varios Diputados de la República, esta Sala ya se había pronunciado en sentencia número 2012002828 de las 14:30 horas del 29 de febrero de 2012, de la siguiente manera:

“En la especie, la gestión interpuesta por los recurrentes no consistió en una petición pura y simple, toda vez que la Procuraduría General de la República se vio obligada a efectuar un análisis jurídico complejo, que obligó a indagaciones jurídicas sistemáticas, exhaustivas y minuciosas [...]”.

En este nuevo amparo es claro que la recurrente pretende que la Procuraduría General de la República emita un criterio jurídico. De conformidad con las razones expuestas de manera reiterada por este Tribunal, una consulta así planteada no constituye parte del ejercicio de los derechos consagrados en los artículos 27 y 30 de la Constitución Política. Por consiguiente, no hay razón para estimar el recurso.

IV.Documentación aportada al expediente. Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, deberá retirarlos del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el «Reglamento sobre Expediente Electrónico ante el Poder Judicial», aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara sin lugar el recurso.
