FEDERACIÓN COSTARRICENSE PARA LA CONSERVACIÓN DEL AMBIENTE.

CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at ten fifty-eight a.m. on cuatro de diciembre de dos mil diecinueve.

The constitutional challenge filed by [Nombre 001], of legal age, holder of identity card number [Valor 001], in his capacity as representative of FEDERACIÓN COSTARRICENSE PARA LA CONSERVACIÓN DEL AMBIENTE, corporate identification number [Valor 001], is hereby admitted for processing, seeking a declaration that the “Regulation for the Registration of Unnumbered Wells and Authorization of the Groundwater Concession Procedure” (“Reglamento de registro de pozos sin número y habilitación del trámite de concesión de aguas subterráneas”), Decreto Ejecutivo No. 41851-MP-MINAE-MAG, is unconstitutional on the grounds that it is contrary to Articles 7, 21, 50, and 89 of the Political Constitution. The Office of the Attorney General of the Republic, the Minister of Environment and Energy, and the Minister of Agriculture and Livestock are granted a fifteen-day hearing. The petitioner states that the Decree is unconstitutional because its purpose is to grant concessions (concesiones) and to “bring into legal compliance” the situation of persons who have wells operating under irregular conditions and without studies prior to the last amnesty of 2010, regardless of whether ecosystems, biodiversity, or other persons are adversely affected.

This action is admitted because it meets the requirements set forth in Articles 73 through 79 of the Constitutional Jurisdiction Act (Ley de la Jurisdicción Constitucional). The petitioner’s standing (legitimación) arises from Article 75, paragraph 2, of the Ley de la Jurisdicción Constitucional, insofar as he appears in defense of diffuse interests (intereses difusos).

A notice concerning the filing of the action shall be published in the Judicial Bulletin (Boletín Judicial) on three consecutive occasions. Legal effects of filing the action: The terms of Articles 81 and 82 of the Ley de la Jurisdicción Constitucional, which provide as follows, are hereby recalled: “Article 81. If the President finds that the aforementioned requirements have been met, the President shall grant a hearing to the Office of the Attorney General of the Republic and to the opposing party appearing in the principal matter, for a period of fifteen days, so that they may state whatever they deem appropriate. At the same time, the President shall direct that a notice be sent to the court or body hearing the matter, instructing it not to issue the final decision before the Chamber has ruled on the action, and shall order that a notice be published in the Boletín Judicial on three consecutive occasions, informing the courts and the bodies that exhaust administrative remedies (agotan la vía administrativa) that such action has been filed, so that no final decision shall be issued, until the Chamber has rendered the corresponding ruling, in any cases or proceedings in which the application of the law, decree, provision, agreement, or resolution is at issue.

If the action is filed by the Attorney General of the Republic, the hearing shall be granted to the person appearing as the opposing party in the principal matter.” “Article 82. In pending proceedings, no stage other than the issuance of the final decision shall be stayed, unless the constitutional challenge concerns provisions that must be applied during the proceedings.” Within fifteen days following the first publication of the aforementioned notice, those appearing as parties in matters pending as of the date this action was filed, in which the application of the challenged provision is at issue, or those having a legitimate interest (interés legítimo), may enter an appearance (apersonarse) to support either its admissibility or inadmissibility or, where applicable, to expand the grounds of unconstitutionality relating to the matter in which they are interested. Se da curso a la acción de inconstitucionalidad interpuesta por [Nombre 001], mayor, portador de la cédula de identidad número [Valor 001], en su condición de representante de la FEDERACIÓN COSTARRICENSE PARA LA CONSERVACIÓN DEL AMBIENTE, cédula jurídica [Valor 001] para que se declare inconstitucional el "Reglamento de registro de pozos sin número y habilitación del trámite de concesión de aguas subterráneas", Decreto Ejecutivo No. 41851-MP-MINAE-MAG, por estimarlo contrario a los artículos 7, 21, 50 y 89 de la Constitución Política. Se confiere audiencia por quince días a la Procuraduría General de la República, al Ministro de Ambiente y Energía y al Ministro de Agricultura y Ganadería. Manifiesta el actor que el Decreto es inconstitucional pues tiene por objeto otorgar concesiones y “poner a derecho” la situación de las personas que tienen pozos en condiciones irregulares, carentes de estudios, antes de la última amnistía del 2010, independientemente de si existen o no afectaciones a ecosistemas, biodiversidad u otras personas.

Esta acción se admite por reunir los requisitos a que se refiere la Ley de la Jurisdicción Constitucional en sus artículos 73 a 79. Al mismo tiempo dispondrá enviar nota al tribunal u órgano que conozca del asunto, para que no dicte la resolución final antes de que la Sala se haya pronunciado sobre la acción, y ordenará que se publique un aviso en el Boletín Judicial, por tres veces consecutivas, haciendo saber a los tribunales y a los órganos que agotan la vía administrativa que esa demanda ha sido establecida, a efecto de que en los procesos o procedimientos en que se discuta la aplicación de la ley, decreto, disposición, acuerdo o resolución, tampoco se dicte resolución final mientras la Sala no haya hecho el pronunciamiento del caso.
