SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine twenty on tres de agosto de dos mil dieciocho.
Writ of amparo (recurso de amparo) filed by ANA IBIS ANTONIA HERNÁNDEZ CASTAÑEDA, identity card 05-0127-0290, on behalf of the ASOCIACIÓN DE DESARROLLO INTEGRAL DE PASO TEMPISQUE, against the INSTITUTO DE DESARROLLO RURAL (INDER), LA MUNICIPALIDAD DE CARRILLO, and LA COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS, INVESTIGACIÓN Y ANÁLISIS DE RIESGO (CNE).
FINDINGS OF FACT:
That, given the binding nature conferred upon them by the Sala Constitucional, they immediately implement the recommendations that the technical experts of the CNE and the academic institutions have repeatedly provided to them over many years, of which they are aware, concerning concrete and timely actions to safeguard human life in areas of recognized risk and imminent danger. The studies and technical recommendations historically issued in each case shall be available to the municipalities at the offices of the CNE. The Internal Audit Offices and the Municipal Councils shall ensure compliance with these provisions. Disobedience shall be deemed a breach of official duties (incumplimiento de deberes) and shall be brought by the Internal Audit Offices to the attention of the corresponding authority (...) d. Formally communicate this Agreement to all Mayors, both male and female, and to the Defensorio de los Habitantes. e. Publish this Agreement and the national summary map of natural hazards (available on the website, www.cne.go.cr) in the official gazette and in a newspaper with nationwide circulation.” At this point, it is necessary to recall that, because the administration of the canton’s local interests and services falls under the jurisdiction of the Local Government pursuant to a constitutional mandate, and, in this specific case, the Municipalidad de Moravia, as a state legal entity with its own assets and legal personality (Article 2 of the Código Municipal), has full legal capacity to execute all acts and contracts necessary to fulfill its purposes.
It asserts that the CNE is the governing public institution responsible for coordinating efforts to prevent situations of imminent risk and to mitigate and respond to emergency situations; it is a maximally decentralized body (órgano de desconcentración máxima) attached to the Presidencia de la República, with instrumental legal personality (personería jurídica instrumental) for managing and administering its budget and investing its resources, and with its own assets and budget. Its actions must be guided by the principles established by Law No. 8488 in Article 3, including a state of necessity and urgency (estado de necesidad y urgencia), understood as a situation of danger to a legally protected interest that can be safeguarded only by infringing another legally protected interest, causing the least possible harm to the latter and subject to subsequently rendering the accounts required by economic, legal, and fiscal oversight laws; protection of life, based on the principle that persons within the national territory must have their lives, physical integrity, property, and environment protected against disasters or hazardous events that may occur; and, finally, prevention, meaning advance action intended to reduce vulnerability, as well as measures taken to prevent or mitigate the impacts of hazardous events or disasters. By their very nature, these actions or measures are in the public interest and are mandatory.
It explains that, as part of its extraordinary powers, Law No. 8488 authorizes the CNE to address local and minor emergencies through the mechanism known as “Initial Impacts” (“Primeros Impactos”), since the final paragraph of Article 15 states: “(...) Except as provided in the preceding subsections, the Commission shall address, without an emergency declaration by the Poder Ejecutivo, local and minor emergencies which, because of the high frequency with which they occur and the serious effects they cause in communities, require the provision of an initial-impact humanitarian service, consisting of the delivery of blankets, food, and sleeping mats and, if necessary, the purchase of materials to restore basic services and make shelters operational, as well as the procurement of a maximum of one hundred machine-hours to clean the most severely affected area of the zone.” It states that the final paragraph of Article 15 refers to an initial-impact humanitarian service.
The Law uses the term “initial impact” to refer to the first phase of the response to a declared emergency. Indeed, Article 30 of the Law, which divides that response into the response, rehabilitation, and, finally, reconstruction phases, establishes that the response phase immediately follows the occurrence of the event. This phase includes urgent initial-impact measures aimed at safeguarding life, vital public-service infrastructure, property, and the environment. It also includes mitigation works intended to protect the population, infrastructure, and the environment. Article 4 defines response as the actions taken immediately following an emergency; they seek to bring a situation under control in order to safeguard works and lives, prevent further damage, and stabilize the area of the region directly impacted by the emergency. Accordingly, without an emergency declaration, the Commission may address local and minor emergencies, for which purpose it may procure a maximum of 100 machine-hours to clean the affected area.
Likewise, Article 30(a) of the same law establishes that the response phase, which is an operational phase occurring immediately after the event, includes urgent initial-impact measures aimed at safeguarding life, vital public-service infrastructure, and the production of vital goods and services through warning, alarm, evacuation, and relocation actions, among others.
It explains that the Exceptional Regime (Régimen de Excepción) arises from a Declaration of a State of Emergency (Declaratoria de Estado de Emergencia), which is issued by the Poder Ejecutivo, as provided in Article 29 of Law No. 8488. The Declaration of Emergency allows exceptional treatment notwithstanding budgetary rigidity, pursuant to Article 180 of the Constitución Política, so that the Government may swiftly obtain sufficient financial, material, or other resources to assist the persons, property, and services affected or at risk, as required during the various stages of the emergency established by Article 30 of the aforementioned law. To use the Exceptional Regime, there must be a causal nexus (nexo de causalidad) between the event giving rise to the state of necessity and urgency and the damage actually caused.
Once a State of Emergency has been declared, the emergency response is carried out in three phases, as established by Article 30 of the aforementioned law. These consist of a response phase aimed at implementing urgent measures to protect life, vital public-service infrastructure, and the production of vital goods and services; a rehabilitation phase involving stabilization of the affected region through actions aimed at temporarily restoring vital water, transportation, telecommunications, health, commercial, electricity, and other services; and, finally, a reconstruction phase intended to restore the normal operation of affected public services, including the reconstruction and replacement of damaged public and social-interest infrastructure, as well as the implementation of land-use regulation measures (medidas de regulación del uso del suelo) intended to prevent subsequent damage.
Once the Poder Ejecutivo has issued the decree declaring the state of emergency, the Commission, through its Dirección Ejecutiva and in consultation with its Presidency, shall immediately convene the Institutions having jurisdiction, as well as any others it deems necessary because they are located within the area affected by the emergency, to prepare the General Emergency Plan (Plan General de la Emergencia), an instrument that will permit the rational, efficient, and systematic planning and channeling of the actions to be undertaken, the necessary supervision, and the allocation of the required resources. For this purpose, it states, within a maximum period of 2 months, the convened institutions must submit an official report on the damage suffered within their respective areas of jurisdiction, including an estimate of the costs and needs to be covered. This damage report must unequivocally establish a cause-and-effect relationship. The General Emergency Plan shall be prepared on the basis of the submitted reports and any other supporting documentation provided by the Commission.
The General Emergency Plan is the planning instrument that establishes the causal relationship between the event that occurred, the actions taken, and the investment made to address the emergency. It consists of a description of the causal event, an assessment of the damage, and an estimate of the resulting losses, broken down by canton and sector; it also includes a delineation of the actions to be performed by each institution, including the Commission itself, as well as details of the amount of investment required during each phase of the emergency response, from the response phase through reconstruction of the affected area. It states that all institutions are required by this Law to contribute the necessary information and technical support for preparing the General Emergency Plan. The drafting of this Plan, as well as the responsibilities relating to its subsequent implementation, shall take priority over the ordinary duties of each individual institution for as long as the state of emergency remains in effect.
To carry out the actions, works, and contracts, the Commission shall designate as Executing Units (Unidades Ejecutoras) those public institutions having jurisdiction in the area where the actions are to be undertaken, provided that they have a structure sufficient to meet the commitments. The designation of Executing Units permits the allocation of emergency resources, which entails the use and management of those resources in accordance with the applicable procedures. In this regard, it must be taken into account that the second paragraph of Article 51 of the Law provides that the procurement of goods and services financed with resources from the Fund for declared emergency response shall be governed by the principles of the Ley de la Contratación Administrativa, the provisions of the Reglamento Interno de la Proveeduría institucional, and any specific provisions issued for such procurement.
In this regard, it emphasizes that “(...) the CNE was never notified of the note dated 24 de octubre de 2017, contrary to the appellant’s assertion, since ONE NEED ONLY EXAMINE THE COPY SUBMITTED BY THE DISSATISFIED PARTY AS PART OF HER BODY OF EVIDENCE TO DETERMINE THAT THE NOTES WERE RECEIVED BY THE MAYOR’S OFFICE AND BY THE SECRETARIAT OF THE MUNICIPAL COUNCIL OF CARRILLO. AND NOT BY THE CNE. NOR BY THE RISK RESEARCH AND ANALYSIS UNIT. In other words, nowhere in the appellant’s petition was there any indication, emphasis, or proof of a communication RECEIVED BY THE CNE; that argument cannot be accepted or in any way constitute a violation of her fundamental protections concerning the right of petition and prompt resolution. In other words, the right of petition is the ‘right to request and obtain a response, not the right to obtain what was not requested.’” Based on the foregoing, it concludes that there can be no doubt that the petitioner’s arguments against the CNE are extremely limited and lack any legal basis upon which relief could be granted by the judicial authority, as they are based on an assessment having no evidentiary value whatsoever and which undermines the standing of the CNE by attributing to it a failure that has not been demonstrated or substantiated.
From that perspective, and taking into account that the party bringing the action “simply says nothing and demonstrates nothing regarding the case under review .” It further notes that, it having been established that the Commission has not violated the protection of the petitioner’s right to petition (derecho de petición) and to receive a prompt response, and given that the institutional guiding principles of that Administration are transparency and good faith and, above all, respect for the public interest and protection of human life as the most important legally protected interest (bien jurídico) to be safeguarded by the Costa Rican State, as well as the physical integrity of all citizens, as part of its institutional duties it has prepared 2 technical reports through the Unidad de Investigación y Análisis de Riesgo de la CNE concerning risk assessments in the area, namely: “Technical Report IAR-INF-0730-2015, entitled ‘Risk Assessment of Land in Palmira de Carrillo, Guanacaste, as Part of the Process for Possible Acquisition by INDER’”; and “Technical Report DPM-INF-1109-2008, entitled ‘Regulations on Land Use (uso del suelo) Due to Flooding in the Central District of Carrillo, Guanacaste, Costa Rica.’” Those reports were prepared pursuant to its governing authority over the Risk Management Policy (Política de Gestión del Riesgo), as explained supra, so that coordinating bodies or the various requesting public institutions may carry out their risk- and hazard-prevention duties within the scope of their authority. It requests that the appeal be denied.
Opinion drafted by Justice Araya Garcia; and,
CONSIDERING:
I.Preliminary matter. Before analyzing the merits of the case—in relation to the alleged violation of the right to prompt and proper proceedings (derecho a un procedimiento pronto y cumplido)—it must be clarified that, beginning with Judgment No. 2008-02545 at 08:55 on February 22, 2008, this Chamber has referred to the contentious-administrative jurisdiction (jurisdicción contencioso administrativa), with certain exceptions, those matters involving a dispute as to whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings (procedimientos administrativos especiales), either to conclude an administrative proceeding—initiated ex officio or at the request of a party—through a final administrative act (acto final), or to hear the applicable administrative appeals (recursos administrativos). Specifically, the case at bar presents an exceptional situation because it involves an environmental petition (gestión ambiental) that allegedly has neither been decided nor addressed within a reasonable period. That point having been clarified, the Court proceeds to decide the specific situation raised in this amparo proceeding.
II.Subject matter of the petition. The appellant, an older adult who serves as the representative of the Asociación de Desarrollo Integral de Paso Tempisque, states that on October 4, 2017, as a result of Tropical Storm Nate, the residents of Paso Tempisque suffered flooding that caused them property losses. She alleges that the disaster was exacerbated by a retaining wall built on Finca del Guaco, which is owned by Inder. She asserts that, on October 25, 2017, the corresponding complaint was filed with the Municipalidad de Carrillo and the CNE; nevertheless, despite the time elapsed and the steps taken by the residents of the affected communities, the problem has not yet been resolved. Accordingly, she considers that fundamental rights (derechos fundamentales) have been infringed and requests that the wall, section, or fill (relleno) on Finca El Guaco be demolished.
Since 2007, the Municipalidad de Carrillo has maintained a complaint before the Tribunal Ambiental Administrativo against Claudio Alfonso Rojas Marín (former owner of Finca el Guaco) concerning work performed within that property; the complaint is being processed under expediente 88-07-01-TAA (case file).
Prior to purchasing the El Guaco property, INDER relied on the study by MSC. Julio Madrigal Mora, a geologist with the CNE Risk Research and Analysis Unit, who stated the following in section 2 of official letter IAR-INF-1073-2015 of 2015, concerning the risk assessment (valoración de riesgo) of land in Palmira de Carrillo as part of the process for the possible acquisition of the property by INDER: “(...) the property has a system of embankments (bordos) and channels designed not only to meet the water needs of the project, but also to serve as mitigation works (obras de mitigación) against potential rises in water levels or overflows, which INDER shall ensure are maintained in good working condition.” That report was submitted to the INDER Board of Directors prior to the purchase of the property for its corresponding approval. Likewise, on the basis of that document, INDER maintains the dikes (diques) that were built by the property’s previous owner and, furthermore, “point B) The preparation of a comprehensive hydrological model of the entire watershed or micro-watershed, establishing the history of the area, maximum probable floods, maps of the area potentially subject to flooding, or construction regulation maps, mitigation works if necessary, or ruling out overflow in the project area, due to its vulnerability to this type of hazard; under point D) The Municipalidad de Carrillo must carry out mitigation works along the watercourses (cauces) to reduce the flooding problem and hazard in vulnerable areas.
Under point F) Any irregularity concerning construction techniques or failure to follow the recommendations described herein SHALL REMAIN THE SOLE RESPONSIBILITY of the institutions granting the permits, the engineer responsible for the works, and the respective Municipalidad for failing to request the corresponding reports, inspections, and corrections. Thus, this task does not fall solely to INDER; it requires interinstitutional coordination, and the local government and CNE set the guidelines as the institutions responsible for risk management (gestión del riesgo), and, as stated in the second fact, INDER has attempted to comply with the recommendations in order to mitigate potential flood damage” (case record (autos)).
The El Guaco property is owned by INDER and has been recorded in the Guanacaste Property Registry District under registration number 5-184539-000 since 8 de febrero del 2016; it was acquired with a retaining wall (muro de contención) built by the property’s previous owner (case record).
The work performed by INDER on the aforementioned property consisted of constructing roads in the rural settlement (asentamiento campesino), where culvert crossings (pasos de alcantarilla) were built with their respective headwalls and concrete boxes to channel the water; the internal roads were also graded as a preventive measure against flooding events. The work was carried out through INDER’s Settlement Infrastructure and Design Area, pursuant to Abbreviated Tender 2016LA-000024-02N, and the work was accepted on 22 de junio 2017. Official letter No. MC-IM-164-2018 from the Territorial Development Department of the Municipalidad de Carrillo certifies that the Construction Section of the Territorial Development Department has no record of a construction permit for fills (rellenos) in the channel of Río Las Palmas adjacent to Finca El Guaco, Paso Tempisque (case record).
The natural phenomenon Nate, which occurred in octubre de 2017, caused property damage throughout a large part of the national territory (case record).
On 25 de octubre de 2017, the residents of Paso Tempisque submitted a letter dated 24 de octubre to the Comisión Nacional de Emergencias, through the Office of the Municipal Council Secretary and the Mayor, both of the Municipalidad de Carrillo, describing the problems they experienced from the effects of tropical storm Nate, which, in their opinion, were caused because “(...) the new occupants have made certain alterations to the contours of their land, such as fills using ballast material and, in certain areas, the reconstruction of internal roads on this property, for which they used large quantities of material to raise the roads substantially, leading us to wonder whether these are actually walls disguised as roads, since on the day of the event these roads (walls) did not have adequate drainage to release the amount of water that accumulated there, creating a veritable dam in that sector that ultimately caused Río Palmas to flow directly into the Paso Tempisque area” (case record).
As a result of the complaint filed by the affected persons, the Concejo Municipal de Carrillo adopted resolution 3, subsection 11, issued at Ordinary Session No. 44-2017, held on 31 de octubre del 2017, resolving to express its support for the residents of Paso Tempisque and Palmira concerning the problems they were experiencing. The Municipal Mayor’s Office, through official letter MC-VAM-079-017, requested that the Comisión Nacional de Emergencias conduct a study of the situation reported and described by the residents of those communities (case record).
Through official letter MC-ALC-1745-2017 of 5 de diciembre del 2017, the Municipal Mayor’s Office and the Road Management Technical Unit of the Municipal Corporation submitted a report to the Comisión Nacional de Emergencias on the damage caused by tropical storm Nate in the Cantón de Carrillo, which included the Distrito de Palmira and the effects suffered there (case record).
By resolution No. 2, subsection 2, issued at Ordinary Session No. 50-2017 of 5 de diciembre de 2018, the Concejo Municipal resolved to grant a hearing to Ms. Ana Ibis Hernández Castañeda and the other requesting residents on 18 de enero del año 2018 (case record).
Through resolution 2, subsection 1, issued at Ordinary Session No. 51-2017, held on 6 de diciembre de 2017, the Concejo Municipal appointed council members Robert Miranda, Freddy Gómez, Roberto Canales, and Manuel Víctor to a committee tasked with conducting an inspection at Finca el Guaco in connection with the concerns expressed by residents regarding the repercussions of tropical storm Nate (case record).
At Extraordinary Session number 01-2018, held on 18 de enero de 2018, Ana Ibis Hernández Castañeda and Elmer Cortés Camacho, respectively President of the Asociación de Desarrollo Integral de Paso Tempisque and a member of the Pro Comité de Desastre Natural, were heard, at which time a new committee was formed with members of the Concejo Municipal and residents of Paso Tempisque to continue addressing the reported problems (case record).
Through official letter MC-ALC-264-2018 of 19 de marzo de 2018, First Deputy Mayor Isabel Francina Uribe Villagra requested that the Concejo Municipal hold a meeting with INDER officials and members of the affected communities to analyze the reported problems and seek joint solutions; the foregoing was undertaken at INDER’s initiative. A Special Committee was formed comprising representatives of the Concejo Municipal, the Mayor’s Office, and residents of the community of Paso Tempisque (case record).
By resolution No. 03, subsection 5, part 1, issued at Ordinary Session No. 17-2018, held on 24 de abril del 2018, the Concejo Municipal resolved to request that the Comisión Nacional de Emergencias send the report on the inspection it conducted at Finca el Guaco in the company of the Municipal Mayor. At that same session, it was resolved to add to the Special Committee one representative of INDER, one from MINAET, and 2 representatives of UZADIS, in order to coordinate the corresponding inspection and permit procedures for an inventory of dead trees in the channel of Río Las Palmas (case record).
By resolution No. 03, subsection 5, parts 2-3, issued at Ordinary Session No. 17-2018, held on 24 de abril del 2018, the Concejo Municipal resolved to request that MINAET conduct an inventory and grant the respective permits to remove fallen trees from the channel of Río Las Palmas, from the bridge at Comunidad to the Puente de Chalaco. Part 2-4 of that same municipal resolution provided that CNE be requested to clear the river channel (case record).
On 15 de mayo de 2018, the Comisión Especial del Guaco reported to the Concejo Municipal on the problems described by the residents of Paso Tempisque, during which the matters to be raised by the petitioner in the amparo action (recurso de amparo) to be filed were analyzed. Likewise, upon reviewing the CNE report of 2015, they resolved to request a technical study indicating whether the dikes constructed on the property had contributed to the flooding of 4 de octubre de 2017 (case record).
The Municipalidad and the Concejo Municipal have worked with representatives of the Comunidades de Palmira y Paso Tempisque to resolve the problems affecting them; they have taken the actions falling within the scope of their authority and established channels of communication with other State institutions, such as INDER, MINAET, and CNE, as well as with private entities such as UZADIS and the Asociación de Desarrollo Integral de Paso Tempisque (case record).
CNE has prepared 2 technical reports through its Risk Research and Analysis Unit concerning risk assessments in the area, namely: “Technical Report IAR-INF-0730-2015, entitled ‘Risk Assessment of Land in Palmira de Carrillo, Guanacaste, as Part of the Process for Possible Acquisition by INDER’”; and “Technical Report DPM-INF-1109-2008, entitled ‘Land-Use Regulations (regulaciones en el uso del suelo) Due to Flooding in the Central District of Carrillo, Guanacaste, Costa Rica.’” These reports were prepared pursuant to the Risk Management Policy (Política de Gestión del Riesgo), so that coordinating bodies or the various requesting public institutions could perform their risk and hazard prevention duties within the scope of their authority (see report submitted under oath and evidence added to the case file (expediente)).
IV.Unproven facts. Of relevance to the resolution of this matter, it was not proven that: 1) The wall alleged by the petitioner, or the work performed by INDER in 2017, had intensified the flooding in the Paso Tempisque area when tropical storm Nate passed through. 2) The affected persons and residents of the area had processed or filed any complaint with CNE regarding the problems they experienced as a result of the flooding caused by tropical storm Nate. 3) The respondent Municipalidad had provided the persons affected by the storm’s devastation and the signatories to the complaint with a written response to the complaint filed in octubre de 2017.
V.On the right to prompt and effective justice. In light of Article 41 of the Constitution, the Administration has an obligation to guarantee citizens prompt and effective justice, without denial thereof. In the sphere of administrative justice (justicia administrativa), this entails its obligation to decide diligently and expeditiously on claims filed by persons subject to the Administration (administrados), so that its decision addresses the claims asserted, and to notify the interested parties of the decision, all within a reasonable period. Thus, the “reasonableness” of the duration of administrative action is determined on a case-by-case basis according to various factors, such as the technical complexity of the administrative matter, the extent of the evidence to be received, or the degree to which the challenged act affects the person or the environment. It follows that there is no strict right to have time limits constitutionalized, but rather a right to constitutional review (control de constitucionalidad) of those actions of the Administration for which there are insufficient grounds to justify the time taken to resolve any type of administrative matter.
VI.Regarding the right to a healthy and ecologically balanced environment. Public health and the right to a healthy and ecologically balanced environment are constitutionally recognized (Articles 21, 50, 73 and 89 of the Constitution), as well as under international law. In this regard, in judgment No. 3705-93 at 15:00 hours on 30 de julio de 1993, this Court stated: “(...) Environmental quality is one measure of that quality of life; other equally important measures are health, food, work, housing, education, etc. More important, however, is understanding that although human beings have the right to use the environment for their own development, they also have a duty to protect and preserve it for present and future generations. This is not particularly novel, because it is merely the application to this field of the principle of ‘injury,’ already consolidated in ordinary law, under which the legitimate exercise of a right has two essential limits: on the one hand, the equal rights of others and, on the other, the rational exercise and beneficial enjoyment of the right itself.” The State likewise has an obligation to protect the environment, expressly set forth in the second paragraph of Article 50 of the Political Constitution, which provides: “Every person has the right to a healthy and ecologically balanced environment.
Accordingly, every person has standing to report acts that violate that right and to seek reparation for the harm caused.” This provision is supplemented by the terms of Article 11 of the “Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights.” When both provisions are interpreted harmoniously, the precautionary principle (principio precautorio) may be derived, according to which the State must take all necessary measures—within the scope permitted by law—to prevent irreversible environmental harm. In connection with the foregoing, in judgment No.180-98 at 16:24 hours on 13 de enero de 1998, this Chamber reasoned: “(...) the State not only has the unavoidable responsibility to ensure that the health of every person comprising the national community is not harmed by third parties in relation to these rights, but must also assume responsibility for creating favorable social conditions so that every person may enjoy health, with that right understood as a state of physical, psychological (or mental), and social well-being.”
VII.Concerning the specific case. In this case, the record shows that Finca El Guaco is indeed owned by Inder and was acquired with a retaining wall constructed by the property’s former owner. Subsequently, in 2017, Inder performed a series of works on the aforementioned property involving the construction of roads in the rural settlement, where culvert crossings with their respective headwalls and concrete boxes were built to channel water; gravel was also laid on the internal roads. This work was carried out through the Área de Infraestructura y Diseño de Asentamientos del lnder, pursuant to Licitación Abreviada 2016LA-000024-02N. The record also shows that, following the natural phenomenon Nate, which occurred in octubre de 2017, the affected residents of Paso Tempisque submitted, on 25 de octubre de 2017, a letter dated 24 de octubre solely to the Secretaría del Concejo Municipal and the Alcalde, both of the Municipalidad de Carrillo.
In that letter, they described the problems they had suffered as a result of Tropical Storm Nate, which, in their view, were caused because “(...) the new occupants have made certain modifications to the terrain of their land, such as gravel fills and, in certain areas, the remodeling of internal roads on this property, for which they used large quantities of material to raise the roads substantially. This leads us to wonder whether these are actually walls disguised as roads, since on the day of the event these streets (walls) lacked adequate drainage to release the volume of water that accumulated there, creating a veritable dam in that area, which ultimately caused the Río Palmas to flow directly into the Paso Tempisque area.” Now, the reports submitted under oath and the evidence added to the case file show that, although the Municipalidad de Carrillo, in response to the aforementioned complaint, has mediated in an effort to find a solution for those affected by the storm, and interdisciplinary committees have even been formed to address these problems, the fact remains that it was not established that those joint efforts had resulted in a solution or that the Municipalidad de Carrillo had informed the signatories of the 2017 complaint in writing of the progress made or the status of the proceeding.
As established in the case file, although progress must be made jointly by the respondent authorities, the matter alleged to remain pending was submitted to the Concejo Municipal and the Alcalde Municipal de Carrillo. Based on the foregoing, this Chamber finds that there has indeed been an undue delay or unjustified postponement that violates the fundamental right enshrined in Article 41 of the Political Constitution, since, when the amparo proceeding (recurso de amparo) was filed, the protected parties had not been informed in writing of the outcome of their requests or the status of the case. Under these circumstances, the proper course is to grant the amparo solely against the Municipalidad de Carrillo, as hereby ordered.
VIII.The authorities of the Instituto de Desarrollo Rural and the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, Investigación y Análisis de Riesgo must bear in mind that they are likewise required to address and assist with the actions undertaken by the Municipalidad de Carrillo as a result of the requests submitted by residents of the area who state that they suffered harm from Tropical Storm Nate, so that, if necessary, it may be determined whether there is in fact any defect in the works carried out at Finca El Guaco that could pose a danger to the residents of the Paso Tempisque area.
I have consistently dissented in cases seeking to remedy, through an amparo proceeding, mere administrative inaction in the exercise of administrative powers and authority, on the ground that such matters may be litigated through ordinary legality proceedings (vía de legalidad ordinaria), because I consider that the Chamber is not, and should not become, a single or omnipresent forum that diminishes the other avenues of judicial protection created for that purpose by the constituent authority and the legislature. I have clarified, however, that I do consider cases of administrative inaction concerning the matters indicated to be eligible for protection in these proceedings when such inaction directly impairs the exercise of fundamental rights governed by the Political Constitution or international human rights treaties, provided that they are amenable to determination in a highly expedited proceeding of the special nature and urgency of amparo as a procedural mechanism. That is the situation in this proceeding, in which an intense impairment of the protected persons’ right to personal integrity and their right to property has been established. I have therefore considered it necessary for the Chamber to exercise its jurisdiction to determine or rule out whether the alleged omissions violate the fundamental rights of the protected persons, as asserted in the filing.
X.Documentation submitted to the case file. The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, or telematic device, or produced through new technologies, those materials must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.
THEREFORE:
The application is declared partially granted solely against the Municipalidad de Carrillo. Carlos Gerardo Cantillo Álvarez and Roberto Canales Canales, Mayor and President of the Concejo Municipal de Carrillo, respectively, both of the Municipalidad de Carrillo, or whoever holds those offices in their stead, are ordered to issue the necessary instructions so that, within EIGHT DAYS from service of this judgment, the affected parties are informed in writing of the status of their complaint and, thereafter, the necessary appropriate measures are taken to ensure that the case is finally resolved within a reasonable period of time. They are warned that failure to comply with this order could constitute the offense of disobedience and that, pursuant to Article 71 of the Ley la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding (recurso de amparo), which that person is required to comply with or enforce, and fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years or fined twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty.
The Municipalidad de Carrillo is ordered to pay the legal costs (costas), damages, and losses caused by the acts underlying this ruling, which shall be assessed in judgment-enforcement proceedings (ejecución de sentencia) before the contentious-administrative jurisdiction (jurisdicción de lo contencioso administrativo). This decision shall be served personally upon the respondent authorities. In all other respects, the application is denied. The authorities of the Instituto de Desarrollo Rural and the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, Investigación y Análisis de Riesgo shall take note of the statements set forth in Considerando VIII of this judgment. SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del tres de agosto de dos mil dieciocho .
Recurso de amparo interpuesto por ANA IBIS ANTONIA HERNÁNDEZ CASTAÑEDA, cédula de identidad 05-0127-0290, en representación de la ASOCIACIÓN DE DESARROLLO INTEGRAL DE PASO TEMPISQUE, contra el INSTITUTO DE DESARROLLO RURAL (INDER), LA MUNICIPALIDAD DE CARRILLO Y LA COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS, INVESTIGACIÓN Y ANÁLISIS DE RIESGO (CNE).
RESULTANDO:
Redacta el Magistrado Araya Garcia; y,
CONSIDERANDO:
I.De previo. De previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse, que a partir de la Sentencia No. 2008-02545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones-, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo – instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues, se está ante una gestión ambiental que, presuntamente, no ha sido resuelta ni atendida en un plazo razonable. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
II.Objeto del recurso. La recurrente, adulta mayor, quien funge como representante de la Asociación de Desarrollo Integral de Paso Tempisque, refiere que el 4 de octubre de 2017, a raíz de la tormenta Nate, los vecinos de Paso Tempisque sufrieron inundaciones, lo cual, les provocó pérdidas materiales. Acusa que dicho desastre fue potenciado por un muro de contención que se construyó en la finca del Guaco, la cual, es propiedad del Inder. Aduce que, el 25 de octubre de 2017, se presentó la respectiva denuncia ante la Municipalidad de Carrillo y la CNE; no obstante, a pesar del tiempo transcurrido y de las gestiones realizadas por los vecinos de las comunidades afectadas, la problemática aún no ha sido resuelta. Por lo anterior, estima lesionados derechos fundamentales y, solicita se proceda al derribo del muro, tramo o relleno de la Finca El Guaco.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
La Municipalidad de Carrillo, desde el año 2007, presentó una denuncia ante el Tribunal Ambiental Administrativo contra el señor Claudio Alfonso Rojas Marín (antiguo propietario de la Finca el Guaco), por los trabajos realizados dentro de ese inmueble, denuncia se tramita bajo el expediente 88-07-01-TAA (autos).
El Inder, de previo a la compra de la finca El Guaco, se basó en el estudio del MSC. Julio Madrigal Mora, Geólogo de la Unidad de Investigación y Análisis del Riesgo de la CNE, que señaló en el acápite 2 del oficio IAR-INF-1073-2015 de 2015, relativo a la valoración de riesgo de terreno en Palmira de Carrillo, como trámite para la posible adquisición de finca por parte del Inder, lo siguiente: "(...) la finca tiene un diseño de construcción de bordos y canales, pensados no solo para satisfacer necesidades de agua para ser utilizadas en el proyecto, sino además como obras de mitigación ante eventuales crecidas o desbordamiento, obras que el lnder velará para que los mismos se mantengan en buenas condiciones de funcionamiento”. Dicho informe fue presentado previo a la compra de la finca ante la Junta Directiva del lnder para su correspondiente aprobación. Asimismo, basado en dicho documento, el Inder da mantenimiento a los diques que fueron construidos por el dueño anterior de la propiedad y, además “punto B) La elaboración de un modelo hidrológico exhaustivo toda la cuenca o micro cuenca, donde se establezcan los antecedentes de la zona, máxima avenidas probables, mapas del área potencial por inundación, o de regulación para construcción, obras de mitigación de ser necesarias o de descartar desbordamiento el área del proyecto, debido a la vulnerabilidad de este tipo de amenaza, en el punto D) La Municipalidad de Carrillo debe realizar obras de mitigación sobre los cauces, las cuales disminuyan la problemática y amenaza de inundación en los sectores vulnerables.
En el punto F) Cualquier anomalía en cuanto a técnicas de construcción u omisión a las recomendaciones aquí descritas, QUEDA BAJO TOTAL RESPONSABILIDAD de las instituciones que otorgan los permisos, del ingeniero responsable de la obra y de la Municipalidad respectiva de no solicitar los informes, inspecciones y correcciones correspondientes. De esta forma la labor no compete únicamente a INDER; es un trabajo de coordinación interinstitucional y el gobierno local y la CNE marcan la pauta como instituciones reguladoras en materia de gestión del riesgo, y tal como se ha indicado en a hecho segundo, a lnder ha tratado de cumplir las recomendaciones con la finalidad de mitigar posibles daños por inundaciones" (autos).
La finca El Guaco es propiedad del Inder, se encuentra inscrita en el Partido de Guanacaste, matrícula 5-184539-000, desde el 8 de febrero del 2016 y, fue adquirida con un muro de contención construido por el propietario anterior del bien (autos).
Los trabajos efectuados por Inder en la finca de cita, corresponden a la construcción de caminos en el asentamiento campesino, donde se construyeron pasos de alcantarilla con sus respectivos cabezales y cajas de concreto para la canalización de las aguas, además, se rastrearon los caminos internos, ello, como medida preventiva a eventos de inundación. La obra se llevó a cabo a través del Área de Infraestructura y Diseño de Asentamientos del lnder, mediante la Licitación Abreviada 2016LA-000024-02N, siendo que la recepción de la obra acaeció el 22 de junio 2017. Por oficio No. MC-IM-164-2018 del Departamento de Desarrollo Territorial de la Municipalidad de Carrillo, se certifica que no existe en el Departamento de Desarrollo Territorial sección de Construcciones, registro de permiso de construcciones para Rellenos en el cauce de Río Las Palmas, colindante a la Finca El Guaco, Paso Tempisque (autos).
El fenómeno natural Nate, acaecido en el mes de octubre de 2017, causó daños materiales en gran parte del territorio nacional (autos).
Los vecinos de Paso Tempisque, presentaron el 25 de octubre de 2017 la nota fechada 24 de octubre dirigida a la Comisión Nacional de Emergencias, ante la Secretaría del Concejo Municipal y el Alcalde, ambos de la Municipalidad de Carrillo, donde exponen la problemática que sufrieron con los efectos de la tormenta Nate, mismos que, en su criterio, fueron provocados por "(...) los nuevos inquilinos han realizado algunas modificaciones en el relieve de sus terrenos, tales como, rellenos con lastre y ciertas partes con la remodelación de carreteras internas de esta finca, en las cuales utilizaron grandes cantidades de material para levantar en importantes medidas las carreteras, lo que más bien nos deja pensar si estos más bien son muros disfrazados de carreteras, ya que el día del evento estas calles (muros) no presentaron un adecuado alcantarillado para poder liberar la cantidad de agua que ahí se generó, provocando una verdadera represa en ese sector, que acabó con la entrada directa del Río Palmas al sector de Paso Tempisque" (autos).
Producto de la denuncia interpuesta por los afectados, el Concejo Municipal de Carrillo, tomó el acuerdo 3, inciso 11, emitido en la Sesión Ordinaria No. 44-2017, celebrada el 31 de octubre del 2017, donde se acordó dar un voto de apoyo a los vecinos de Paso Tempisque y Palmira por la problemática que estaban sufriendo; siendo que, la Alcaldía Municipal, mediante oficio MC-VAM-079-017, solicitó a la Comisión Nacional de Emergencias un estudio de la situación denunciada y expuesta por los vecinos de esas comunidades (autos).
Por oficio MC-ALC-1745-2017 del 5 de diciembre del 2017, la Alcaldía Municipal y la Unidad Técnica de Gestión Vial de la Corporación Municipal, brindaron un informe a la Comisión Nacional de Emergencias sobre los daños causados por la tormenta Nate en el Cantón de Carrillo, dentro del cual, se incluyó el Distrito de Palmira y sus afectaciones (autos).
Por acuerdo No. 2, inciso 2, emitido en la Sesión Ordinaria No. 50-2017 de 5 de diciembre de 2018, el Concejo Municipal acordó concederle audiencia a la señora Ana Ibis Hernández Castañeda y a los demás vecinos solicitantes, para el día 18 de enero del año 2018 (autos).
El Concejo Municipal, mediante acuerdo 2, inciso 1, emitido en la Sesión Ordinaria No. 51-2017, celebrada el 6 de diciembre de 2017, nombró en comisión a los regidores Robert Miranda, Freddy Gómez, Roberto Canales y Manuel Víctor, para realizar una inspección en Finca el Guaco, relacionada con las inquietudes externadas por los vecinos sobre las repercusiones de la Tormenta Nate (autos).
En la Sesión Extraordinaria número 01-2018 celebrada el 18 de enero de 2018, fueron escuchados los señores Ana Ibis Hernández Castañeda y Elmer Cortés Camacho, Presidenta de la Asociación de Desarrollo Integral de Paso Tempisque y miembro del Pro Comité de Desastre Natural respectivamente, momento en que, se conformó una nueva Comisión con miembros del Concejo Municipal y vecinos de Paso Tempisque, con el fin de seguir tratando la problemática Por oficio MC-ALC-264-2018 de 19 de marzo de 2018, la Primera Vicealcaldesa Isabel Francina Uribe Villagra, solicitó al Concejo Municipal, efectuar una reunión con los personeros del Inder y miembros de las comunidades afectadas, para analizar la problemática expuesta y buscar soluciones en conjunto; lo anterior, a iniciativa del Inder. Se constituyó una Comisión Especial conformada por representantes del Concejo Municipal, Alcaldía y vecinos de la comunidad de Paso Tempisque (autos).
Por acuerdo No. 03, inciso 5, aparte 1, emitido en la Sesión Ordinaria No. 17-2018 celebrada el día 24 de abril del 2018, el Concejo Municipal acordó solicitar a la Comisión Nacional de Emergencias se sirva a enviar el informe de la inspección realizada por ellos en Finca el Guaco en campaña del señor Alcalde Municipal. En esa misma sesión, se acordó integrar a la Comisión Especial a un representante de INDER, uno del MINAET y 2 representantes de UZADIS, con el fin de coordinar el trámite de inspección y permisos correspondientes para inventario de árboles muertos en el cauce del río Las Palmas (autos).
Por acuerdo No. 03, inciso 5, aparte 2-3, emitido en la Sesión Ordinaria No. 17-2018 celebrada el 24 de abril del 2018, el Concejo Municipal acordó solicitarle al MINAET realizar un inventario y otorgar los permisos respectivos para retirar los árboles caídos en el cauce del Río Las Palmas desde el puente de Comunidad, hasta el Puente de Chalaco. En el apartado 2-4 de ese mismo acuerdo municipal, se dispuso solicitar a la CNE limpiar el cauce de dicho río (autos).
El 15 de mayo de 2018, la Comisión Especial del Guaco informa al Concejo Municipal, el tema de la problemática analizaron los temas a incoar por la parte recurrente en el recurso de amparo a interponer. Asimismo, al conocer el informe de la CNE de 2015, acordaron solicitar un estudio técnico que indique si los diques construidos en la finca, tuvieron o no injerencia en las inundaciones del pasado 4 de octubre de 2017 (autos).
La Municipalidad y el Concejo Municipal han trabajado junto con los representantes de las Comunidades de Palmira y Paso Tempisque, para resolver la problemática que les aqueja.; siendo que se han tomado las acciones que dentro del ámbito de sus competencias tienen, estableciendo canales de comunicación con otras instituciones del Estado como INDER, MINAET y CNE, así como, con entidades privadas como la UZADIS y la Asociación de Desarrollo Integral de Paso Tempisque (autos).
La CNE ha realizado 2 informes técnicos de la Unidad de Investigación y Análisis de Riesgo de la CNE, relacionados con valoraciones de riesgo en la zona, a saber "Informe Técnico IAR-INF-0730-2015, denominado "Valoración de riesgo de terreno en Palmira de Carrillo, Guanacaste, como trámite para posible adquisición por parte del INDER" e; "Informe Técnico DPM-INF-1109-2008, denominado "Regulaciones en el uso del suelo por inundaciones en el distrito Central de Carrillo, Guanacaste, Costa Rica". Informes que se efectuaron en razón de la Política de Gestión del Riesgo, para que las instancias de coordinación o las diferentes instituciones públicas solicitantes, realicen sus labores de prevención de riesgos y amenazas dentro del ámbito de sus competencias (ver informe rendido bajo juramento y prueba aportada al expediente).
IV.Hechos no probados. De importancia para la resolución de este asunto, no fue probado que: 1) El muro que alega la recurrente, o bien, las obras efectuadas por el Inder en el 2017, hubieran potenciado las inundaciones en la zona del Paso Tempisque, con ocasión del paso de la tormenta Nate. 2) Ante la CNE los afectados y vecinos de la zona, hubieran tramitado o presentado alguna denuncia acerca del tema de los problemas que sufrieron a raíz de las inundaciones provocadas por la tormenta Nate. 3) A los afectados por los estragos de la tormenta y firmantes de la denuncia, la Municipalidad recurrida les hubiera contestado por escrito la denuncia incoada en el mes de octubre de 2017.
V.Sobre el derecho a una justicia pronta y cumplida. La Administración, a la luz del artículo 41, Constitucional, tiene la obligación de garantizarle a la ciudadanía el cumplimiento de la justicia pronta y cumplida, sin denegación, lo que implica, en el ámbito de la justicia administrativa, su obligación de decidir con diligencia y celeridad los reclamos planteados por los administrados, de tal manera que su resolución sea congruente con los extremos alegados, así como de comunicarles a los interesados lo dispuesto, todo ello dentro de un plazo razonable. Así, el carácter "razonable" de la duración de la actividad administrativa se determina casuísticamente con base en diversos elementos, tales como, la complejidad técnica del asunto administrativo, la amplitud de la prueba por evacuar o el grado de afectación a la persona o al ambiente del acto impugnado, de lo cual se infiere que no existe un derecho estricto a la constitucionalización de los plazos, sino más bien, un derecho a que se aplique el control de constitucionalidad sobre aquellas actuaciones de la Administración, en las cuales no existan motivos suficientes para justificar el tiempo demorado en la solución de algún tipo de gestión administrativa.
VI.Relativo al derecho a un ambiente sano y ecológicamente equilibrado. La salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente (artículos 21, 50, 73 y 89 de la Carta Magna), así como a través de la normativa internacional. En este sentido, este Tribunal en sentencia No. 3705-93 de las 15:00 horas del 30 de julio de 1993 indicó: "(...) La calidad ambiental es un parámetro de esa calidad de vida; otros parámetros no menos importantes son salud, alimentación, trabajo, vivienda, educación, etc., pero más importante que ello es entender que si bien el hombre tiene el derecho de hacer uso del ambiente para su propio desarrollo, también tiene en deber de protegerlo y preservarlo para el uso de las generaciones presentes y futuras, lo cual no es tan novedoso, porque no es más que la traducción a esta materia del principio de la "lesión", ya consolidado en el derecho común, en virtud del cual el legítimo ejercicio de un derecho tiene dos límites esenciales: Por un lado, los iguales derechos de los demás y, por el otro, el ejercicio racional y el disfrute útil del derecho mismo".
Asimismo, existe una obligación del Estado de proteger el ambiente que se encuentra contemplada expresamente en el segundo párrafo del artículo 50 de la Constitución Política, que dispone: " Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado". Esta disposición se complementa por lo establecido en el numeral 11 del "Protocolo Adicional a la Convención Americana sobre Derechos Humanos en materia de Derechos Económicos, Sociales y Culturales ". Interpretando armónicamente ambas normas, se puede derivar el principio precautorio, según el cual, el Estado tiene que disponer todo lo que sea necesario -dentro del ámbito permitido por la ley- a efecto de impedir que se produzcan daños irreversibles en el medio ambiente. En relación con lo de enero de 1998 esgrimió: "(...) el Estado no solo tiene la responsabilidad ineludible de velar para que la salud de cada una de las personas que componen la comunidad nacional, no sufra daños por parte de terceros, en relación a estos derechos, sino que, además, debe asumir la responsabilidad de lograr las condiciones sociales propicias a fin de que cada persona pueda disfrutar de su salud, entendido tal derecho, como una situación de bienestar físico, psíquico (o mental) y social ".
VII.Tocante al caso concreto. En este caso, de los autos se desprende que, en efecto, la finca El Guaco es propiedad del Inder y, fue adquirida con un muro de contención construido por el propietario anterior del bien. A posteriori y, para el año 2017, el Inder efectuó una serie de trabajos en la propiedad de cita, que corresponden a la construcción de caminos en el asentamiento campesino, donde se erigieron pasos de alcantarilla con sus respectivos cabezales y cajas de concreto para la canalización de las aguas, además, se lastrearon los caminos internos; siendo que dicha obra se llevó a cabo a través del Área de Infraestructura y Diseño de Asentamientos del lnder, mediante la Licitación Abreviada 2016LA-000024-02N. Asimismo, se tiene que con el paso del fenómeno natural Nate, acaecido en el mes de octubre de 2017, los vecinos de Paso Tempisque que se vieron afectados, presentaron el 25 de octubre de 2017, la nota fechada 24 de octubre, únicamente, ante la Secretaría del Concejo Municipal y el Alcalde, ambos de la Municipalidad de Carrillo, donde Nate, mismos que, en su criterio, fueron provocados por "(...) los nuevos inquilinos han realizado algunas modificaciones en el relieve de sus terrenos, tales como, rellenos con lastre y ciertas partes con la remodelación de carreteras internas de esta finca, en las cuales utilizaron grandes cantidades de material para levantar en importantes medidas las carreteras, lo que más bien nos deja pensar si estos más bien son muros disfrazados de carreteras, ya que el día del evento estas calles (muros) no presentaron un adecuado alcantarillado para poder liberar la cantidad de agua que ahí se generó, provocando una verdadera represa en ese sector, que acabó con la entrada directa del Río Palmas al sector de Paso Tempisque ".
Ahora bien, de los informes rendidos bajo juramento, así como de las probanzas allegadas al expediente, se tiene que, aunque la Municipalidad de Carrillo, con ocasión de la denuncia de cita, ha intermediado para que se busque una solución a favor de los afectados con la tormenta, e incluso, se han conformado comisiones interdisciplinarias a fin de lidiar con estos problemas, lo cierto es que, no quedó acreditado que los esfuerzos conjuntos hubieran convergido en una solución, ni que, la Municipalidad de Carrillo, por escrito, informara a los suscribientes de la denuncia de 2017, de los avances o el estado del trámite. Según fue acreditado en el expediente, si bien, los avances deben realizarse de manera conjunta por parte de las autoridades recurridas, la gestión que se reclama pendiente, fue presentada ante el Concejo Municipal y el Alcalde Municipal de Carrillo. Con base en lo anterior, estima esta Sala que sí se ha producido una dilación indebida o retardo injustificado que vulnera el derecho fundamental consagrado en el artículo 41, de la Constitución Política, toda vez que, al momento de interposición del recurso, los amparados no han sido informados por escrito del resultado de sus gestiones y del estado del caso. Desde este panorama, lo procedente es acoger el recuso, únicamente, contra la Municipalidad de Carrillo, como en efecto se dispone.
VIII.Deben tener presente las autoridades Instituto de Desarrollo Rural y de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, Investigación y Análisis de Riesgo, que están conminados también a atender y colaborar con las gestiones realizadas por la Municipalidad de Carrillo, a raíz de las gestiones presentadas por los vecinos de la zona que, indican, sufrieron afectaciones a raíz del paso de la tormenta Nate, ello, a fin que, de ser necesario, se detecte si en efecto existe alguna anomalía en las obras gestadas en la Finca El Guaco, que pudieran potenciar peligro para los habitantes del sector de Paso Tempisque.
He venido salvando el voto en aquellos casos que se trate de corregir por medio del recurso de amparo la simple inactividad de la administración, en la actuación de sus competencias y potestades, con el argumento de que pueden ser discutidos en la vía de legalidad ordinaria, considerando que la Sala no es, ni debe constituirse, en una instancia única u omnipresente que demerite las otras vías de tutela judicial creadas por el constituyente y el legislador al efecto. He aclarado sin embargo que sí estimo como tutelables en esta vía casos de inactividad de la administración en los temas señalados si con ella se produce afectación directa al ejercicio de derechos fundamentales regulados en la Constitución Política o a los tratados internacionales de derechos humanos, siempre que sean susceptibles de ser conocidos en un proceso muy sumario y de especial naturaleza y urgencia como es el amparo como instituto procesal. Tal es el caso de este recurso en donde se tiene por demostrada la existencia de una afectación intensa del derecho a la integridad personal de las personas tuteladas y su derecho de propiedad, por ello he considerado necesario que la Sala ejerciera su competencia, para comprobar o descartar si las omisiones señaladas, vulneran los derechos fundamentales de las personas amparadas según se indica en el escrito de interposición.
X.Documentación aportada al expediente . Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara parcialmente con lugar el recurso, únicamente, contra la Municipalidad de Carrillo. Se ordena a Carlos Gerardo Cantillo Álvarez y Roberto Canales Canales, por su orden, Alcalde y Presidente del Concejo Municipal de Carrillo, ambos de la Municipalidad de Carrillo, o a quienes ocupen esos cargos en su lugar, que giren las instrucciones necesarias para en el plazo de OCHO DÍAS contado a partir de la notificación de esta sentencia, informen por escrito a los afectados del estado de su denuncia y, luego, tomen las medidas necesarias que resulten pertinentes para que el caso se resuelva de manera definitiva dentro de un plazo razonable de tiempo. Se advierte que de no acatar la orden dicha, podrían incurrir en el delito de desobediencia y que, de conformidad con el artículo 71 de la Ley la Jurisdicción Constitucional, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena a la Municipalidad de Carrillo al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese esta resolución de forma personal a las autoridades recurridas. En lo demás se declara sin lugar el recurso. Tomen nota las autoridades del Instituto de Desarrollo Rural y de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, Investigación y Análisis de Riesgo, de lo consignado en el considerando VIII de esta sentencia.
