Aunque tanto la Municipalidad de Garabito, como el MINAE, procedieron a suspender los permisos otorgados a la empresa desarrolladora, la SETENA y el SINAC, avalaron su proceder, concediendo una prórroga a la viabilidad ambiental del proyecto y la corta de 9 árboles, a pesar de la duda en relación con la existencia de las nacientes de agua. Allí es, precisamente, donde se evidencia la omisión de las autoridades legalmente encargadas de velar por la protección al ambiente, de comunicarse y coordinar entre sí. A lo dicho, se suma que ante la incertidumbre y dudas generadas sobre los cuerpos de agua existentes en la propiedad y los terrenos donde se desarrollaría un proyecto de esa envergadura por un tercero, en este caso una empresa privada, ni siquiera se requirió la valoración o aprobación del Servicio Nacional de Aguas Subterráneas Riego y Avenamiento, entidad que, bajo juramento, fue prístina en esgrimir que hasta tanto ellos no validaran la información hidrogeológica del sitio, no se debía permitir la prosecución de la construcción. Es decir, el proyecto original no fue sometido a conocimiento de SENARA, ni siquiera cuando surgieron las dudas sobre la naturaleza y condición de los cuerpos de agua en mención, siendo que cuando surgió duda al respecto, la comunicación y el dictado de las medidas cautelares, se produjo únicamente entre las accionadas, y estando ya interpuesto el amparo.

Findings of Fact:
Otherwise, the constitutional principles already cited would be violated, particularly Article 34 of the Constitution. In its view, “Until that occurs, the prior determinations issued by the Dirección de Aguas, which served as the basis for granting environmental viability (Viabilidad Ambiental) and the municipal permit (Permiso Municipal), remain fully valid and effective. Likewise, the construction permit (Permiso de Construcción), the suspension of which is now being ordered by the Municipalidad de Garabito, remains fully valid and effective, as acknowledged in the challenged decision itself. My client has not been notified of any administrative proceeding initiated by this Municipality seeking a declaration of nullity of the construction permit granted and currently in force (...) As we have repeatedly stated throughout this challenge, more than four months have elapsed since the precautionary suspension measure (medida cautelar de suspensión) against my client was issued.
Throughout that time, the institutions involved, including the Municipal Corporation, have shown enormous neglect in deciding the challenges and providing certainty to the regulated party. The instrumental and PROVISIONAL nature of a measure as burdensome as the one adopted has been lost. Public and private interests are being materially affected by the adoption of this precautionary measure (order partially suspending the construction permit). On the one hand, there is INS’s public interest in the construction of a health center so urgently needed by the canton of Garabito and the entire Central Pacific region and, on the other, my client’s interest in carrying out the project awarded to it and recovering the substantial investment already made.” It requests that the application be denied in its entirety because the requested extremely urgent precautionary measure (medida cautelar urgentísima) no longer presents a current interest, since the various authorities involved, following the change in the position of the Dirección de Aguas of MINAE, proceeded to suspend work in the area of the alleged watercourse (cauce).
Justice Araya García drafts the opinion; and,
Considering:
I.Admissibility of the remedy of amparo (recurso de amparo). Article 57 of the Law on Constitutional Jurisdiction, with respect to amparo proceedings against private-law entities, establishes that this type of claim may be granted against the actions or omissions of private-law entities when they act or are required to act in the exercise of public functions or powers, or when they are, as a matter of law or fact, in a position of power in relation to which ordinary judicial remedies are clearly insufficient or untimely to guarantee the fundamental rights or freedoms referred to in Article 2(a) of that same Law. In the case under consideration, the respondent company is in a position of power in relation to which ordinary judicial remedies are clearly insufficient or untimely to ensure that the rights of the protected parties have been respected. Consequently, the remedy of amparo is admissible against JAEA S.A.
II.Subject matter of the proceeding. The petitioners contend that the actions of the respondent authorities violated fundamental rights. They express their disagreement with the issuance to JAEA S.A. of construction permit No. PC-4364-2019. They consider that the issuance of that permit and the environmental approval (viabilidad ambiental) for the project they challenge demonstrates a disregard for the preventive and precautionary principles in environmental matters, because there are irrefutable facts concerning the existence of a spring (naciente) in the area. They believe that continuation of the work affects the spring and the trees on the site, causing irreversible damage to the environment.
V.On the right to health and to a healthy and ecologically balanced environment. It should be noted that the fundamental rights (derechos fundamentales) to health and to a healthy and ecologically balanced environment are recognized both constitutionally (Articles 21, 50, 73 and 89 of the Political Constitution) and through the international regulations applicable in Costa Rica. In this regard, in Judgment No. 2006-005928 at 15:00 hours on 2 de mayo del 2006, this Court ruled: “The right to life recognized in Article 21 of the Constitution is the cornerstone upon which the other fundamental rights of the inhabitants of the Republic rest. Likewise, that provision of the Political Constitution provides the basis for the right to health, since life is inconceivable unless human beings are guaranteed the minimum conditions necessary for an adequate and harmonious psychological, physical, and environmental balance.
Public health and the right to a healthy and ecologically balanced environment are constitutionally recognized in Articles 21, 50, 73 and 89 of the Political Constitution. Specifically, Article 50 of the Constitution expressly recognizes the right of all inhabitants of the country to enjoy a healthy and perfectly balanced environment. That right is a fundamental guarantee for the protection of life and public health. In support of the foregoing, this Court has employed the concept of ‘environmental quality’ (calidad ambiental) precisely as a measure of people’s quality of life, in conjunction with other elements such as health, food, work, and housing, noting that every person has the right to use the environment for their own development, but not without limitation, since there is also a duty to protect and preserve the environment for present and future generations—the sustainable development principle (principio de desarrollo sostenible)—” Likewise, Article 50 of the Political Constitution establishes the State’s obligation to protect the environment.
That provision states: “The State shall seek the greatest well-being of all inhabitants of the country by organizing and promoting production and the most appropriate distribution of wealth. Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that infringe that right and to seek reparation for the harm caused. The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding liabilities and penalties.” This confirms that the various public authorities have an inescapable duty to preserve, defend, and guarantee every person’s fundamental right to health and to a healthy and ecologically balanced environment.”
VI.Coordination among public institutions in the comprehensive protection of the environment. The State—as a whole—is obligated to take the measures necessary to protect the environment in order to prevent levels of pollution, deforestation, extinction of flora and fauna, or excessive or improper use of natural resources that endanger the health of persons subject to the administration (administrados). For purposes of this duty, “public institution” means both the Central Administration—Ministries, such as the Ministerio del Ambiente y Energía and the Ministerio de Salud—which, by reason of their subject-matter jurisdiction, have broad participation and responsibility with respect to environmental conservation and preservation and which act, in most cases, through their specialized departments in this field. Municipalities likewise bear substantial responsibility for this duty within their territorial jurisdiction.
Given the diversity of actors that may be involved, it might be thought that this shared responsibility would cause chaos in administrative management. Therefore, to avoid the simultaneous coexistence of spheres of authority of differing origin and nature, the duplication of national and local efforts, and confusion concerning the rights and obligations of the various parties involved, it is necessary to establish a series of coordination arrangements among the various departments of the Executive Branch and decentralized institutions, and between those bodies and the municipalities, so that they may carry out the functions entrusted to them. This Chamber has previously addressed the principle of coordination between public agencies and municipalities in pursuing common purposes, stating in Judgment No. 5445-99, at 14:30 hours on 14 de julio de 1999, that: “Coordination is the ordering of the relationships among these various independent activities, taking account of their convergence upon the same object or entity in order to make it useful to an overall public plan, without eliminating the mutual independence of the acting parties.
Because there is no hierarchical relationship among decentralized institutions, or between the State itself and the municipalities, specific courses of conduct cannot be imposed upon them. This gives rise to the indispensable interinstitutional ‘concerted action’ (concierto), in the strict sense, whereby autonomous and independent centers of action agree upon that preventive and overall framework, in which each performs a role with a view to a mission entrusted to the others. Thus, relations between municipalities and other public entities may be conducted only on an equal footing, resulting in agreed forms of coordination and excluding any compulsory arrangement that would impair their autonomy by subjecting corporate entities to a coordination framework without or against their consent; this nevertheless allows for the necessary subordination of these entities to the State and in its interest (through the State’s ‘administrative supervision’ (tutela administrativa), specifically its function of reviewing legality, which entails powers of general oversight over the entire sector.”
VII.Regarding the environmental function of the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento in matters related to water resources (recurso hídrico). Consistent with Judgment No. 2009-000262 at 14:32 hours on 14 de enero de 2009, regarding SENARA’s participation in environmental matters related to water resources and their protection, it is useful to reproduce certain considerations previously expressed by this Court, given their significance to the case under review:
“XVII.- On scientific certainty regarding the existence of water resources and exploitation of the Acuífero Sardinal. A central issue in the violations alleged by the petitioners is the absence of conclusive hydrogeological studies ensuring the existence of sufficient water resources in the Acuífero Sardinal for it to be exploited under the terms contemplated and sought by the ICAA. In this regard, the Chamber reiterates the obligation of public institutions to firmly observe and apply the precautionary principle (principio precautorio) in environmental matters, which gives rise to the obligation to prevent the execution of works lacking the technical certainty necessary to conclude that their implementation is harmless to the environment and, in this specific case, to the aquifer in question (...) It is important to note that this account of the facts makes no mention or reference whatsoever to the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento—SENARA—because, although the ICAA had been developing the project concept since marzo de dos mil seis, and although SENARA is a vital entity with respect to the use of groundwater resources (recurso hídrico subterráneo)—such as the Acuífero Sardinal—it was not until the filing of the writ of amparo (recurso de amparo) that this entity began evaluating the ICAA’s actions within the scope of its authority.
XVIII.Regarding the National Groundwater, Irrigation and Drainage Service (Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento). As explained in Considerando III of this judgment, SENARA’s powers extend beyond matters concerning irrigation districts, as they have a nationwide scope derived from its own institutional history. Likewise, Article three of the SENARA Founding Law, law number 6877, provides, insofar as relevant, that: “ARTICLE 3.- The functions of SENARA are: (…) ch) To investigate, protect, and promote the use of the country’s water resources, both surface water and groundwater. (…) h) To oversee compliance with the legal provisions governing matters within its purview. Decisions made by the Service for that reason concerning the drilling of wells and the exploitation, maintenance, and protection of water resources—by public institutions and private parties—shall be final and binding.
Nevertheless, such decisions may be appealed within the tenth day on grounds of illegality before the Higher Administrative Litigation Court. The Court shall rule within no more than ninety days.” (emphasis added). Thus, by express provision of its founding law, SENARA has the authority to protect the country’s water resources, and its decisions concerning their exploitation, maintenance, and protection shall therefore be final and binding. For its part, Article one hundred fifty-seven of the Water Law—still in force—states that: “Article 157.- Municipalities have a duty to consult the Department of Agriculture and obtain the corresponding permit from it before disposing of, mortgaging, leasing, sharecropping, or directly exploiting any land they own or acquire when such land contains usable public-domain waters. The Department of Agriculture shall determine whether such land falls within the foregoing category and whether its intended use could affect the conservation of the water used by the population.
The same obligation shall apply to Boards of Education, Social Protection Boards and, in general, every public body.” (emphasis not in the original) This statutory provision must be interpreted and applied in accordance with Article twenty-one of the Soil Use, Management and Conservation Law—from which it is established that the Ministry of Agriculture and Livestock, or Department of Agriculture in the terminology used by the Water Law, retains secondary or residual authority in this matter—a provision that clearly states: “ARTICLE 21.- In water-related matters, the Ministry of Agriculture and Livestock shall coordinate with the National Irrigation and Drainage Service and any other competent institution in promoting hydrological, hydrogeological, and agrological research in the country’s watersheds, as well as practices for the improvement, conservation, and protection of soils within those watersheds, in accordance with the powers of the aforementioned Service…” Accordingly, an integrated reading of the provisions just cited establishes that, in order to use public-domain waters, every public entity—without distinction—must obtain the corresponding permit from SENARA, to the extent that the duly reasoned decisions adopted by SENARA in that regard shall be final and binding.
This determination is far from a rhetorical statement by the Chamber; on the contrary, it derives from the responsible integration of the broad regulatory framework governing the matter, which, as stated, requires the progressive development and recognition inherent in the sphere of human rights, since the right to water and the right to a healthy and ecologically balanced environment are fundamental human rights. The Chamber notes that this clarification places SENARA in a particularly important position regarding the management of the nation’s water resources, which is significant given the eminently technical nature of this administrative agency, a position that must be strengthened and exercised through the necessary and proper interinstitutional coordination among the various entities involved—ICAA, SETENA, MAG, Municipalities, among others. In this regard, seeking to carry out projects for the extraction and exploitation of water resources without SENARA’s proper authorization and involvement violates the statutory provisions protecting the environment, because the necessary technical inputs for determining the availability of and potential use of public-domain waters would be lacking.”
VIII.Regarding the specific case. In order to define the scope of the matter under review, the following is a factual account of the events surrounding the project developed by JAEA S.A., including details of the actions taken by each and every one of the respondent authorities and parties, in order to facilitate an understanding of the determination issued by the Chamber in this judgment.
However, as explained by the respondent municipal entity, after learning that uncertainty existed regarding the public nature of the channel, it ordered a precautionary measure (medida cautelar) suspending building permit No. PC 4364, which had been granted to JAEA S.A. Accordingly, on 1° de marzo de 2019, the Legal Department of the respondent Municipality issued an opinion On 1° de marzo de 2019, the Legal Department of the respondent Municipality issued an opinion concerning official letter No. ST 067-2018-FS-I, which stated that uncertainty existed regarding the public nature of the channel and that, therefore, a precautionary measure halting the construction work should be imposed based on the in dubio pro natura principle (principio indubio pro natura). Consequently, the building permit was suspended through the issuance of document ST-061-2019, dated 18 de marzo de 2019.
That report considered the possible existence of an intermittent spring (naciente) at latitude coordinate 177.194 and longitude coordinate 468.192, but no flowing water was observed nearby during the field inspection; therefore, because no new evidence existed, the position stated in official letter No. IMN-DA-1796-06 was maintained. Subsequently, through memorandum No. PSCCI-032-2018, signed by an official of the Municipalidad de Garabito, a new determination was requested concerning the body of water located on property 149667-000. Accordingly, coordination was undertaken with officials from the Municipalidad de Garabito, and an inspection and a new assessment by the Water Directorate were conducted. This resulted in technical reports No. DA-UHTPCOSR-0059-2019 and DA- UHTPCOSJ-0440-2019, which concluded that: “An intermittent spring is hereby identified at latitude coordinate 177.194 and longitude coordinate 468.215 (Costa Rica Lambert North Coordinate System).” “A stream (quebrada) is hereby identified along the specified section between latitude coordinate 177.910 and longitude coordinate 468.125 and latitude coordinate 177.179 longitude coordinate 467.915; it crosses beneath the public street on the north side of the Municipality through a pipe, runs through the property containing the Municipal building, and emerges from the pipe on the south side of the JABA S.A. property (cadastral plan No. 6-01849709-2015), continuing to the quebrada Usa.” In light of the foregoing, the Office of the Head of the Tárcoles Hydrological Unit, which is responsible for the Jacó area, issued an order through official letter No. DA-UHTPCOSJ-0447-2019 of 5 de marzo de 2019 requiring activities affecting the stream to cease, since a new determination was pending.
Furthermore, because inconclusive determinations existed regarding the body of water, the Térraba Pacífico Sur Hydrological Unit and the San Juan Hydrological Unit, both belonging to the Water Directorate of MINAE, were asked to jointly conduct a study and analysis pursuant to the Internal Support Guide for Determining Bodies of Water, officially adopted through official letter No. DA-563-2017 of 13 de junio del 2017, in order to determine with scientific certainty the type and characteristics of the body of water in question. That report concluded that they were indeed dealing with 2 unnamed springs and, therefore, with public-domain channels.
It was also asserted that, although the plan was updated in the year 2015, it was not the plan used to grant Environmental Viability. Accordingly, they object that, when granting the permit, the authorities were aware of the bodies of water present in the project area; therefore, a mandatory condition for any project affected by them was compliance with the setbacks (retiros) or protection zones (áreas de protección), as established by article 33 of the Ley Forestal. In addition, any project intended for development must respect bodies of water and their setback areas; for this reason, SETENA does not authorize any project that fails to comply with the provisions of the Law. Finally, technical report No. IT-DT-ASA-0159-2019 established that the Centro Comercial Jacó project, administrative file No. D1-204-2007-SETENA, was complying with its environmental commitments (compromisos ambientales), as well as with the environmental monitoring and control instruments (instrumentos de control y seguimiento ambiental).
It indicates that no trees were cut on that date because the tree-cutting permits then in effect had expired and their extension was pending. It also alleged that the plan recorded the existence of a stream (Quebrada Lisa), which borders the property to the west; however, it is not part of that property, is not being affected, and is not the subject of this litigation or of any type of complaint. It further explains that the plan contains no specification of a 10 metros setback. It also states that, in the year 2015, the company it represents prepared a new plan that did not show the alleged stream because it had not been declared a public-domain watercourse (cauce de dominio público). Thus, on 6 de marzo del 2019, through official letter No. DA-UHTPCOSJ-0447-2019 of 5 de marzo de 2019, and in view of opinion No. DA-UHTPCOSJ-0440-2019, an administrative interim measure (medida cautelar administrativa) was issued, ordering the company it represents to cease “(...) all activity affecting the streambed and return it to its original condition.” It states that this administrative act (acto administrativo) was challenged in due time and proper form and remains pending a final decision.
It asserts that the same has occurred before other administrative bodies, as the administrative interim measures issued by the Dirección de Aguas, SINAC, and Municipalidad de Garabito render unfeasible the procurement project that gave rise to the works challenged here. It adds that the notices and stop-work orders issued by the Departamento de Aguas del MINAE, SINAC, and Municipalidad de Garabito were challenged by the company it represents; nevertheless, more than 4 meses have elapsed since the first interim measure was issued, and it remains unclear what will happen to the project because those authorities have not ruled on its challenges and, therefore, have not initiated any administrative proceeding (procedimiento administrativo) or proceeding for a declaration of injuriousness (proceso de lesividad), nor have they scientifically determined whether the channel through which sewage flows along the southern side of the property of the company it represents is a public-domain watercourse.
IX.The matters set forth in the preceding recital (considerando) show that, although the actions taken by the authorities and the intervening party were consistent with the substance of the technical information available since the year 2006 regarding the existence of the springs, the fact remains that, in this Chamber’s view, and in full observance of the precedent cited in the seventh recital of this judgment, it was established that the authorities responsible for granting Environmental Viability and construction permits, in an evident lack of coordination, failed to involve SENARA, because, in matters related to water resources, as noted supra, this entity’s duly reasoned decisions are necessary, final, and binding.
Indeed, as early as the year 2018, there was a technical report, namely No. DA-UHTPCOSR-0061-2018 of 20 de marzo de 2018, which, although it maintained the position that the watercourses in question were a stormwater and sewage channel, did consider the possible existence of an intermittent spring at coordinates latitude 177.194 and longitude 468.192. In other words, from that time onward, there was a lingering uncertainty regarding the status of the bodies of water.
It is therefore apparent that, when this uncertainty arose, the agencies involved in issuing permits and reviewing the environmental circumstances should have consulted SENARA. Accordingly, the following must be reiterated: “The Chamber notes that this clarification places SENARA in a particularly significant position regarding the management of national water resources, which is important considering the eminently technical nature of this administrative agency, a position that must be reinforced and exercised through the necessary and proper interinstitutional coordination among the various entities involved—ICAA, SETENA, MAG, Municipalidades.” In situations such as the one examined, that participation was vital because, in light of the differing positions advanced, uncertainty persisted as to whether springs, streams, or watercourses existed at the site.
In short, based on the references set forth above, this Chamber established the existence of a series of irregularities and discrepancies relating to the reports of the respondent authorities, particularly those of the Municipalidad de Garabito, Ministerio de Ambiente y Energía, Secretaría Técnica Nacional Ambiental, and Sistema Nacional de Áreas de Conservación, as will be explained below.
In the first instance, both the Municipalidad de Garabito and MINAE stated that the permits granted, as well as the conduct of the development company, had complied with the applicable legal requirements. Likewise, both consistently argued that, because there was a contradiction between the documents and official communications asserting that there were no springs (nacientes) at the development site, but rather a channel through which sewage flowed, a study was promptly requested to determine conclusively the status of the body of water—in this regard, see the official communication of 8 de marzo de 2019, addressed to the Officials of the Dirección de Aguas, in which the Director of the Dirección de Aguas of MINAE requested that a definitive opinion be issued within 8 days regarding the results of the various assessments and the status of the bodies of water found. In light of the uncertainty, and pending the issuance of a final report, the precautionary measures (medidas cautelares) noted above were ordered.
It bears mentioning that technical study No. DA-UHSAN-0197-2019 of 25 de marzo de 2019, prepared by technical personnel from the 2 Unidades Hidrológicas of MINAE, concluded that the site contained an “(...) unnamed spring (naciente Sin Nombre), an intermittently flowing body of water in the public domain. • Source 2, assessed in this report, coincides with the assessment of source 2 contained in official communications DA-UHTPCOSJ-04402019 and DAUHTPCOSR-0059-2019; therefore, it is concluded that the same assessment remains in effect, namely, that it is an unnamed stream (Quebrada Sin Nombre), a body of water in the public domain, intermittent in section 1; in section 2, it was not possible to determine its nature; and permanent in section 3.” In other words, the presence of bodies of water in the public domain was confirmed.
Now, as regards SETENA and SINAC, unlike the position asserted by the Municipalidad and MINAE, it is apparent that they granted their approvals on the premise that springs existed at the development site. Once again, both maintained that they had acted in accordance with the law.
X.In accordance with the considerations set forth in the preceding section, this Court finds that the principle of coordination (principio de coordinación) was also violated.
The particular circumstances identified in the conduct of the 4 authorities mentioned above reveal an evident lack of coordination, which in some measure confirms the arguments made by the petitioners in their initial filing concerning harm to the environment. Although both the Municipalidad de Garabito and MINAE suspended the permits granted to the development company, SETENA and SINAC endorsed its actions by granting an extension of the project’s environmental viability (viabilidad ambiental) and authorizing the cutting of 9 trees, despite the uncertainty concerning the existence of the water springs.
It is precisely there that the failure of the authorities legally responsible for protecting the environment to communicate and coordinate with one another becomes evident. Moreover, despite the uncertainty and doubts concerning the bodies of water existing on the property and the land where a third party—in this case, a private company—would develop a project of that scale, the assessment or approval of the Servicio Nacional de Aguas Subterráneas Riego y Avenamiento was not even requested. Under oath, that entity unequivocally stated that construction should not be allowed to continue until it had validated the site’s hydrogeological information. In other words, the original project was not submitted to SENARA for review, not even when doubts arose regarding the nature and status of the bodies of water in question. When those doubts arose, communication and the issuance of the precautionary measures occurred only among the respondent authorities, and only after the amparo action (amparo) had already been filed.
It is on that basis that the Court finds a violation of fundamental rights by the Municipalidad de Garabito, the Ministerio de Ambiente y Energía, the Secretaría Técnica Nacional Ambiental, and the Sistema Nacional de Áreas de Conservación. Accordingly, the action against those authorities must be granted, in accordance with the provisions of the Por tanto section of this decision.
XI.As regards the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, the amparo action must be denied because that authority has not yet been brought into the situation arising from the existence of the water springs on the referenced property. Nevertheless, the order specified in the operative portion of this judgment must be issued to it so as to ensure the proper involvement that must be afforded to this institution in cases of this kind.
This Chamber also finds that the company JAEA did not commit any violation of fundamental rights detrimental to the environment. In this regard, the record shows that the company complied with the opinions of the participating authorities and the permits granted by each of them. No direct constitutional harm to the environment is attributable to the company; rather, the harm was caused and brought about by the authorities that failed to coordinate properly among themselves and to bring SENARA into the proceedings as the entity responsible for issuing an opinion concerning water resources (recurso hídrico).
Finally, regarding the respondent company’s assertions that, in its view, the respondent authorities violated its fundamental rights, the appropriate course is for it, if it deems it appropriate, to submit its arguments or objections before whichever bodies it considers appropriate. Although those matters relate to the case now under review, they clearly fall outside the specific core and subject matter raised by the petitioners, which is what warrants this Chamber’s review through this amparo action.
XII.Documentation submitted to the case file. The parties are advised that, if they submitted any paper document, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the Court’s offices within a maximum period of 30 business days from the date notice of this judgment is served. Otherwise, any material not retrieved within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, article LXXXI.
Por tanto:
The action is partially granted, solely against the Municipalidad de Garabito, the Ministerio de Ambiente y Energía, the Secretaría Técnica Nacional Ambiental, and the Sistema Nacional de Áreas de Conservación. José Miguel Zeledón Calderón, Director of the Dirección de Agua of the Ministerio de Ambiente y Energía; José Martínez Meléndez, special representative of the Mayor of the Municipalidad de Garabito; Cynthia Barzuna Gutiérrez, Secretary General of the Secretaría Técnica Nacional Ambiental; and Grettel Vega Arcea, Executive Director of the Sistema Nacional de Áreas de Conservación, or whoever holds those positions, are ordered to establish the necessary coordination mechanisms so that, within a maximum period of FIVE DAYS from service of notice of this judgment, all documentation concerning the identification of the watercourses (cauces de agua) referenced in this judgment is forwarded to the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento.
Patricia Quirós Quirós, Manager of the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, is likewise ordered to establish the necessary coordination mechanisms so that, within one month from receipt of the documentation that the aforementioned authorities must provide to her, SENARA issues a determination concerning the existence and nature of any possible watercourses around the construction project in question and any potential effects upon them, and communicates that determination to all institutions participating herein. Cynthia Barzuna Gutiérrez, Secretary of the Secretaría Técnica Nacional Ambiental, is similarly ordered, within a maximum period of one month from receipt of that study from SENARA, to issue the appropriate decision regarding the environmental viability granted to the construction project and to communicate it to all participating authorities. Finally, José Miguel Zeledón Calderón, Director of the Dirección de Agua of the Ministerio de Ambiente y Energía; José Martínez Meléndez, special representative of the Mayor of the Municipalidad de Garabito; Cynthia Barzuna Gutiérrez, Secretary General of the Secretaría Técnica Nacional Ambiental; and Grettel Vega Arcea, Executive Director of the Sistema Nacional de Áreas de Conservación, are ordered, within a maximum period of fifteen days from communication of the decision that SETENA must issue concerning the environmental viability of the construction project, to determine as appropriate whether to validate, continue, or suspend the project being undertaken by the company JAEA, as well as all measures issued in that regard.
They are warned that failure to comply with the aforementioned orders could constitute the offense of disobedience and that, pursuant to article 71 of the Ley la Jurisdicción Constitucional, any person who receives an order issued in an amparo action that the person must comply with or cause to be complied with, and who fails to comply with it or cause it to be complied with, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State and the Municipalidad de Garabito are ordered to pay the costs, damages, and losses caused by the facts underlying this judgment, which shall be assessed in enforcement proceedings before the administrative litigation jurisdiction (contencioso administrativo). In all other respects, the action is denied. This decision shall be personally served upon the respondent authorities.

identidad 0112110329, contra el MINISTERIO DE AMBIENTE Y ENERGÍA, EL SERVICIO NACIONAL DE RIEGO Y AVENAMIENTO, LA SECRETARÍA TÉCNICA NACIONAL AMBIENTAL y la MUNICIPALIDAD DE GARABITO.
Resultando:
Redacta el Magistrado Araya García; y,
Considerando:
I.Sobre la admisibilidad del amparo. El artículo 57 de la Ley de la Jurisdicción Constitucional, en relación con los amparos contra sujetos de derecho privado, establece que esta clase de demandas se conceden contra las acciones u omisiones de sujetos de derecho privado, cuando estos actúen o deban actuar en ejercicio de funciones o potestades públicas, o, se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2, inciso a) de la misma Ley. En el caso de estudio, la sociedad recurrida se encuentra en una posición de poder, frente a la cual, los remedios jurisdiccionales comunes resultan claramente insuficientes o tardíos para garantizar que los derechos de los amparados se hayan respetado. En consecuencia, el recurso de amparo es admisible contra la empresa JAEA S.A.
II.Objeto del recurso. Los recurrentes estiman que con la actuación de las autoridades recurridas, fueron lesionados derechos fundamentales. Exponen su disconformidad con el otorgamiento a favor de la empresa JAEA S.A., del permiso de construcción No. PC-4364-2019. Consideran que el otorgamiento de dicho permiso y de la viabilidad ambiental al proyecto que cuestionan, evidencia una burla a los principios preventivo y precautorio en materia ambiental, ya que existen hechos irrefutables sobre la existencia de una naciente en la zona. Estiman que la continuidad de las obras afecta la naciente y los árboles del sitio, causando un daño irreversible al medioambiente.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
V.Sobre el derecho a la salud y a un ambiente sano y ecológicamente equilibrado. Debe indicarse que los derechos fundamentales a la salud y a un ambiente sano y ecológicamente equilibrado, se encuentran reconocidos tanto constitucionalmente (artículos 21, 50, 73 y 89, de la Constitución Política), como por medio de la normativa internacional aplicable en Costa Rica. En este sentido, en sentencia No. 2006-005928 de las 15:00 horas del 2 de mayo del 2006, este Tribunal resolvió: “El derecho a la vida reconocido en el numeral 21 de la Constitución es la piedra angular sobre la cual descansan el resto de los derechos fundamentales de los habitantes de la república. De igual forma, en ese ordinal de la carta política encuentra asidero el derecho a la salud, puesto que, la vida resulta inconcebible si no se le garantizan a la persona humana condiciones mínimas para un adecuado y armónico equilibrio psíquico, físico y ambiental.
Ahora bien, la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente en los artículos 21, 50, 73 y 89 de la Constitución Política. Específicamente, el artículo 50 constitucional reconoce de forma expresa el derecho de todos los habitantes del país a disfrutar de un medio ambiente saludable y en perfecto equilibrio. Ese derecho es garantía fundamental para la protección de la vida y la salud pública. En apoyo de lo anterior este Tribunal ha recurrido a la utilización de la noción de "calidad ambiental" como un parámetro, precisamente, de la calidad de vida de las personas, que se conjuga con otros elementos tales como la salud, la alimentación, el trabajo y la vivienda, haciendo referencia a que toda persona tiene derecho a hacer uso del ambiente para su propio desarrollo pero no de manera ilimitada, ya que, también, existe un deber de protección y preservación del medio ambiente para las generaciones presentes y futuras -principio de desarrollo sostenible-” Asimismo, del artículo 50, de la Constitución Política, se deriva la obligación del Estado de proteger el ambiente.
Norma que establece al efecto: “El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza. Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado. El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes”. Con lo que se corrobora que las distintas autoridades públicas tienen el deber ineludible de preservar, defender y garantizar el derecho fundamental de toda persona a la salud y a un ambiente sano y ecológicamente equilibrado”.
VI.La coordinación de las instituciones públicas en la protección integral al ambiente. Existe una obligación para el Estado -como un todo- de tomar las medidas necesarias para proteger el ambiente, a fin de evitar grados de contaminación, deforestación, extinción de flora y fauna, o el uso desmedido o inadecuado de los recursos naturales, que pongan en peligro la salud de los administrados. En esta tarea, por institución pública se entiende tanto a la Administración Central-Ministerios, como el Ministerio del Ambiente y Energía y el Ministerio de Salud-, que en razón de la materia, tienen una amplia participación y responsabilidad en lo que respecta a la conservación y preservación del ambiente; los cuales actúan, la mayoría de las veces, a través de sus dependencias especializadas en la materia. Del mismo modo, en esta tarea tienen gran responsabilidad las municipalidades en lo que respecta a su jurisdicción territorial.
Debido a la diversidad de actores que pueden intervenir, podría pensarse que esta múltiple responsabilidad provocaría un caos en la gestión administrativa. Por ello, a fin de evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos nacionales y locales, así como la confusión de derechos y obligaciones entre las diversas partes involucradas, se hace necesario establecer una serie de relaciones de coordinación entre las diversas dependencias del Poder Ejecutivo y las instituciones descentralizadas, y entre éstas con las municipalidades, a fin de poder llevar a cabo las funciones que les han sido encomendadas. Esta Sala se ha referido ya al principio de coordinación de las dependencias públicas con las municipalidades en la realización de fines comunes, al señalar mediante sentencia No. 5445-99, de las 14:30 horas del 14 de julio de 1999, que: "La coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes.
Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible «concierto» interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros. Así, las relaciones de las municipalidades con los otros entes públicos, sólo pueden llevarse a cabo en un plano de igualdad, que den como resultado formas pactadas de coordinación, con exclusión de cualquier forma imperativa en detrimento de su autonomía, que permita sujetar a los entes corporativos a un esquema de coordinación sin su voluntad o contra ella; pero que sí admite la necesaria subordinación de estos entes al Estado y en interés de éste (a través de la «tutela administrativa» del Estado, y específicamente, en la función de control la legalidad que a éste compete, con potestades de vigilancia general sobre todo el sector".
VII.Tocante a la función del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, en materia ambiental relacionada con el recurso hídrico. Acorde con el texto de la sentencia No. 2009-000262 de las 14:32 horas del 14 de enero de 2009, en lo tocante a la participación del SENARA en cuestiones de índole ambiental, relacionadas con el recurso hídrico y su protección, resulta de interés transcribir algunas consideraciones vertidas en su oportunidad por este Tribunal. Lo anterior, por ser de trascendencia para el caso en estudio:
"XVII.- Sobre la certeza científica en cuanto a la existencia del recurso hídrico y la explotación del Acuífero Sardinal. Punto medular en las violaciones aducidas por los recurrentes, es la carencia de estudios hidrogeológicos contundentes que aseguren la existencia del recurso hídrico suficiente en el Acuífero Sardinal, para que el mismo sea explotado en los términos previstos y queridos por el ICAA. Sobre el particular, la Sala reitera la obligación de las instituciones públicas de respetar y aplicar de manera sólida el principio precautorio en materia ambiental, de donde surge la obligación de impedir la realización de obras que carezcan de la certeza técnica necesaria para concluir que su ejecución resulta inocua para el ambiente, y, en el caso concreto, para el acuífero en cuestión (...) Resulta importante apreciar que en esta relación de hechos es nula la mención o referencia al Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento –SENARA-, pues a pesar que desde marzo de dos mil seis el ICAA venía elaborando la idea del proyecto, y ser el SENARA una entidad vital en cuanto a la utilización del recurso hídrico subterráneo –como lo es el Acuífero Sardinal- no fue sino con la interposición del recurso de amparo que esta entidad inició a evaluar las actuaciones del ICAA en el ámbito de sus competencias.
XVIII.Sobre el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento. Según se ha explicado en el III considerando de esta sentencia, las competencias del SENARA trascienden lo concerniente a los distritos de riego, siendo así que las mismas resultan tener una vocación nacional derivada de sus mismos antecedentes institucionales. Asimismo, el artículo tres de la Ley de Creación del SENARA, ley número 6877, dispone, en lo conducente que: “ARTÍCULO 3º.- Son funciones del SENARA: (…) ch) Investigar, proteger y fomentar el uso de los recursos hídricos del país, tanto superficiales como subterráneos. (…) h) Vigilar el cumplimiento de las disposiciones legales en las materias de su incumbencia. Las decisiones que por ese motivo tome el Servicio, referentes a la perforación de pozos, y a la explotación, mantenimiento y protección de las aguas -que realicen las instituciones públicas y los particulares- serán definitivas y de acatamiento obligatorio.
No obstante, tales decisiones podrán apelarse dentro del décimo día por razones de ilegalidad, para ante el Tribunal Superior Contencioso Administrativo. El Tribunal resolverá en un plazo no mayor de noventa días.” (énfasis añadido). Es así, que por disposición expresa de su ley de creación, el SENARA tiene la competencia de proteger los recursos hídricos del país, razón por la cual sus decisiones en torno a la explotación, mantenimiento y protección, serán definitivas y de acatamiento obligatorio. Por su parte, el artículo ciento cincuenta y siete de la Ley de Aguas -aún vigente- señala que: “Artículo 157.- Es deber de las Municipalidades consultar al Departamento de Agricultura, y obtener de él el correspondiente permiso, antes de enajenar, hipotecar, dar en arriendo o a esquilmo o explotar por su cuenta, cualquier terreno que posean o adquieran cuando en dichos terrenos existan aguas de dominio público utilizables.
El Departamento de Agricultura decidirá si tales terrenos están comprendidos entre los mencionados y si el destino que se deseare darles pudiera afectar la conservación de las aguas que utilizan las poblaciones. Igual obligación tendrán las Juntas de Educación, Juntas de Protección Social y, en general, todo organismo de carácter público.” (el destacado no es del original) Esta disposición normativa debe interpretarse y aplicarse de conformidad con lo dispuesto en el artículo veintiuno de la Ley sobre el Uso, Manejo y Conservación de Suelos –a partir del cual se define que el Ministerio de Agricultura y Ganadería (o Departamento de Agricultura en el lenguaje utilizado por la Ley de Aguas) mantiene una competencia secundaria o residual en esta materia- norma que claramente establece que: “ARTÍCULO 21.- En materia de aguas, el Ministerio de Agricultura y Ganadería deberá coordinar, con el Servicio Nacional de Riego y Avenamiento y cualquier otra institución competente, la promoción de las investigaciones hidrológicas, hidrogeológicas y agrológicas en las cuencas hidrográficas del país, así como en las prácticas de mejoramiento, conservación y protección de los suelos en las cuencas hidrográficas, según las competencias del Servicio mencionado…” De tal forma, la integración de las normas de reciente cita informa que para el aprovechamiento de las aguas de dominio público, toda entidad pública –sin distingo- deberá obtener del SENARA el permiso correspondiente, al punto que las decisiones que de manera fundamentada adopte el SENARA en cuanto a ello, serán definitivas y de acatamiento obligatorio.
Esta definición dista de ser una manifestación retórica de la Sala; por el contrario, la misma deriva de la responsable integración del amplio marco normativo que regula la materia, que, como se dijo, requiere del progresivo avance y reconocimiento propio del ámbito de los derechos humanos, toda vez que el derecho al agua y el derecho a un ambiente sano y ecológicamente equilibrado son derechos humanos fundamentales. La Sala advierte que esta precisión sitúa al SENARA en una posición particularmente relevante en cuanto a la gestión del recurso hídrico nacional, lo cual resulta importante considerando la naturaleza eminentemente técnica de esta dependencia administrativa, posición que debe ser reforzada y ejercida mediante la necesaria y debida coordinación interinstitucional de las diferentes entidades involucradas –ICAA, SETENA, MAG, Municipalidades, entre otras-. En este sentido, pretender ejecutar proyectos de extracción y explotación del recurso hídrico sin la debida autorización y vinculación del SENARA, resulta ser violatorio de las previsiones normativas de protección al ambiente, pues se carecería de los insumos técnicos necesarios que dictaminen la disponibilidad y posibilidad de aprovechamiento de las aguas de dominio público".
VIII.Sobre el caso concreto. A fin de delimitar el asunto en estudio, de seguido se hará un recuento fáctico de lo suscitado alrededor del proyecto desarrollado por la empresa JAEA S.A., que incluirá un detalle de lo actuado por todas y cada una de las autoridades y parte recurridas, lo anterior, a fin de facilitar la comprensión de la determinación vertida por la Sala en esta sentencia.
Ahora bien, según detalló el ente municipal recurrido, luego de conocer la existencia de una incertidumbre sobre la naturaleza pública del cauce, procedió a declarar una medida cautelar de suspensión del permiso de construcción No. PC 4364, otorgado a la empresa JAEA S.A. De ahí que, el 1° de marzo de 2019, el Departamento Legal de la Municipalidad accionada, emitiera un pronunciamiento El 1° de marzo de 2019, el Departamento Legal de la Municipalidad accionada, emitió un pronunciamiento en torno al oficio No. ST 067-2018-FS-I, en el cual se afirmaba que había incertidumbre sobre la naturaleza pública del cauce, y por lo tanto, se debía de proceder a establecer una medida cautelar de paralización de obras, con base en el principio indubio pro natura. Por ende, se procedió a suspender el permiso de construcción, a través del dictado del escrito ST-061-2019, de 18 de marzo de 2019.
En dicho informe, se consideró la posible existencia de una naciente intermitente en las coordenadas latitud 177.194 y longitud 468.192, pero durante la verificación de campo no se observó agua discurriendo en las cercanías, por lo que, al no existir evidencia nueva, se mantuvo el criterio señalado en el oficio No. IMN-DA-1796-06. Posteriormente, por memorial No. PSCCI-032-2018, suscrito por un funcionario de la Municipalidad de Garabito, se solicitó un nuevo dictamen sobre cuerpo de agua ubicado en la finca 149667-000, por lo que, se coordinó con funcionarios de la Municipalidad de Garabito y se realizó una inspección, así como una nueva valoración por parte de la Dirección de Agua. De allí se generaron los informes técnicos No. DA-UHTPCOSR-0059-2019 y DA- UHTPCOSJ-0440-2019, en los cuales se concluyó que: “Se dictamina una naciente intermitente en las coordenadas latitud 177.194 y longitud 468.215 (Sistemas de Coordenadas Costa Rica Lambert Norte)”.
“Se dictamina una quebrada en el tramo indicado entre las coordenadas latitud 177.910 y longitud 468.125 y las coordenadas latitud 177.179 longitud 467.915, que atraviesa entubada la calle pública al contado norte de la Municipalidad, transcurre dentro de la propiedad del edificio Municipal, hasta salir del entubamiento en el costado sur de la propiedad de JABA S.A. (plano catastro No. 6-01849709-2015) hasta la quebrada Usa”. Conforme lo anterior, la Jefatura de la Unidad Hidrológica Tárcoles, a la que le corresponde atender la zona de Jacó, mediante oficio No. DA-UHTPCOSJ-0447-2019 del 5 de marzo de 2019, emitió una orden de cese de actividades sobre la quebrada, toda vez que se estaba a la espera de un nuevo dictamen. Incluso, debido a la existencia de dictámenes no concluyentes sobre el cuerpo de agua, se solicitó a la Unidad Hidrológica Térraba Pacífico Sur y a la Unidad Hidrológica San Juan, ambas pertenecientes a la Dirección de Aguas del MINAE, que procedieran a realizar de manera conjunta un estudio y análisis, conforme a la Guía Interna de Apoyo para dictamen de Cuerpo de Agua, oficializado según oficio No. DA-563-2017 del 13 de junio del 2017, para dictaminar con certeza científica, el tipo y características del cuerpo de agua en cuestión. Dicho informe concluyó que en efecto, estaban frente a 2 nacientes sin nombre, y por ende, frente a cauces de dominio público.
De otra parte, por determinación No. 2322-2018-SETENA del 2 de octubre de 2018, se aprobó una prórroga a la vigencia de la viabilidad ambiental para el proyecto Centro Comercial en Jacó. Asimismo, se adujo que aunque el plano fue actualizado en el año 2015, no fue el utilizado para otorgar la viabilidad ambiental. De ahí que, al otorgar el permiso, increpan que ellos tenían conocimiento de los cuerpos de agua existentes en el área del proyecto, por lo que una condición obligatoria de cualquier proyecto afectado por los mismos, era respetar los retiros o áreas de protección, según lo establece el artículo 33 de la Ley Forestal. Aunado a lo anterior, todo proyecto que desee desarrollarse, debe respetar los cuerpos de agua y sus áreas de retiro, razón por la cual SETENA no autoriza ningún proyecto en el que no se respete lo estipulado por la Ley. Finalmente, se tiene que mediante el informe técnico No. IT-DT-ASA-0159-2019, se estableció que el proyecto Centro Comercial Jacó, expediente administrativo No. D1-204-2007-SETENA, estaba cumpliendo con los compromisos ambientales, así como con los instrumentos de control y seguimiento ambiental.
En dicha fecha, indica que no se procedió con la corta de ningún árbol, en virtud que los permisos de corta de ese momento estaban vencidos y pendientes de prórroga. Asimismo, alegó que en el plano se consignó la existencia de una quebrada (Quebrada Lisa), la cual colinda al oeste con la finca; sin embargo, no es parte de esa propiedad, por lo que no está siendo afectada y no es objeto del presente litigio, ni de ningún tipo de denuncia. Detalla además, que dentro del plano indicado, no consta ninguna especificación de retiro de 10 metros. Incluso, refiere que su representada, procedió a realizar un nuevo plano en el año 2015, en el cual no se consigna la supuesta quebrada, ya que no estaba declarada como cauce de dominio público. Así, el 6 de marzo del 2019, mediante el oficio No. DA-UHTPCOSJ-0447-2019 del 5 de marzo de 2019, con vista en el dictamen No. DA-UHTPCOSJ-0440-2019, se emitió una medida cautelar administrativa y se previno a su representada para que cesara "(...) toda actividad sobre el cauce de la quebrada y retornar ésta a su condición original".
Dicho acto administrativo, asegura, fue impugnado en tiempo y forma, lo que está pendiente de resolución final. Afirma que, lo mismo ha ocurrido en otras instancias administrativas, siendo que las medidas cautelares administrativas dictadas por la Dirección de Aguas, el SINAC y la Municipalidad de Garabito, convierten en inviable el proyecto de la licitación que dio origen a las obras acá cuestionadas. A ello, agrega que las prevenciones y órdenes de suspensión de obras, efectuadas por el Departamento de Aguas del MINAE, por el SINAC y por la Municipalidad de Garabito, fueron impugnadas por su representada; empero, han transcurrido más de 4 meses desde que se emitió la primera medida cautelar, y aún no hay claridad sobre lo que ocurrirá con el proyecto, dado que las referidas autoridades no se han pronunciado acerca de sus impugnaciones, y por ende, no han iniciado ningún procedimiento administrativo o proceso de lesividad, ni determinado científicamente, si el canal por el que discurren las aguas negras y que pasa por el costado sur de la propiedad de su representada, es o no, un cauce de dominio público.
IX.De lo señalado en el anterior considerando, se evidencia que si bien las actuaciones adoptadas por las autoridades y la parte intervinientes, se ajustaron al mérito de la información técnica con que se contaba desde el año 2006 en lo tocante a la existencia de las nacientes, lo cierto es que, en criterio de esta Sala, y en plena atención a lo dispuesto en el precedente señalado en el considerando séptimo de esta sentencia, quedó constatado que las autoridades encargadas de otorgar la viabilidad ambiental, y los permisos de construcción, en una evidente falta de coordinación, omitieron traer a escena al SENARA, debido a que en temas relacionados con el recurso hídrico, como se apuntó supra, las decisiones que de manera fundada adopte esta entidad en cuanto a ello, son necesarias, definitivas y de acatamiento obligatorio.
Y es que, ya desde el año 2018, hubo un informe técnico, a saber, el No. DA-UHTPCOSR-0061-2018 de 20 de marzo de 2018, que si bien mantuvo el criterio que los cauces cuestionados correspondían a un canal pluvial y de aguas servidas, sí se consideró la posible existencia de una naciente intermitente en las coordenadas latitud 177.194 y longitud 468.192. Es decir, desde ese momento, hubo una duda latente en torno a la condición de los cuerpos de agua.
Se denota, entonces, que ante el surgimiento de dicha duda, lo propio hubiese sido que las dependencias involucradas en el otorgamiento de permisos y revisión del escenario ambiental, acudieran al SENARA. Por ende, corresponde reiterar lo siguiente "La Sala advierte que esta precisión sitúa al SENARA en una posición particularmente relevante en cuanto a la gestión del recurso hídrico nacional, lo cual resulta importante considerando la naturaleza eminentemente técnica de esta dependencia administrativa, posición que debe ser reforzada y ejercida mediante la necesaria y debida coordinación interinstitucional de las diferentes entidades involucradas –ICAA, SETENA, MAG, Municipalidades". En situaciones como la estudiada, esa participación devenía vital, pues debido a los diferentes planteamientos esgrimidos, persistía una duda sobre la existencia o no de las nacientes, quebradas o cursos de agua en el sitio.
En suma, de las referencias consignadas de previo, esta Sala logró constatar la existencia de una serie de irregularidades y discrepancias en relación con los informes de las autoridades recurridas, particularmente, los de la Municipalidad de Garabito, el Ministerio de Ambiente y Energía, la Secretaría Técnica Nacional Ambiental y el Sistema Nacional de Áreas de Conservación, por lo que de seguido se dirá.
En primera instancia, se tiene que tanto la Municipalidad de Garabito, como el MINAE, advirtieron que los permisos concedidos, así como, el comportamiento de la sociedad desarrolladora, se habían ajustado a las prerrogativas legales. Asimismo, ambas fueron contestes en esgrimir que al existir una contradicción entre los documentos y oficios que asumían que en el sitio del desarrollo no existían nacientes, sino un cauce por el que discurrían aguas servidas, de manera oportuna, fue gestionado un estudio que de manera definitiva, estatuyera la condición del cuerpo de agua -al respecto, ver oficio de 8 de marzo de 2019, dirigido a los Funcionarios de la Dirección de Aguas, donde el Director de la Dirección de Aguas del MINAE solicitó emitir un criterio definitivo en 8 días plazo, sobre el resultado de los diferentes dictámenes, y de la condición de los cuerpos de agua hallados-. Ante la duda, a la espera de la emisión de un informe definitivo, fueron dictadas las medidas cautelares de previo acotadas.
Vale traer a colación, que el resultado del estudio técnico No. DA-UHSAN-0197-2019 del 25 de marzo de 2019, generado por técnicos de las 2 Unidades Hidrológicas del MINAE, se concluyó que en el sitio existía una "(...) naciente Sin Nombre, cuerpo de agua de dominio público de carácter intermitente. • La Fuente 2 dictaminada en el presente informe, coincide con el criterio de la fuente 2 dictaminada en oficios DA-UHTPCOSJ-04402019 y DAUHTPCOSR-0059-2019 por lo que se concluye que se mantiene el criterio de la misma siendo así Quebrada Sin Nombre cuerpo de agua de dominio público, en el tramo 1 carácter intermitente, en el tramo 2 no fue posible determinar el carácter, tramo 3 carácter permanente". Es decir, se corroboró la presencia de cuerpos de agua de dominio público.
Ahora bien, en lo que atañe a la SETENA y al SINAC, a diferencia de lo esgrimido por la Municipalidad y el MINAE, se aprecia que éstas otorgaron sus vistos buenos, bajo la premisa de la existencia de nacientes en el sitio del desarrollo. Y de nuevo, ambas afirmaron que su actuación se había gestado conforme a Derecho.
X.Conforme las previsiones sentadas en el apartado precedente, en criterio de este Tribunal, el principio de coordinación también resultó conculcado.
La particularidad detectada en torno al proceder de las 4 autoridades mencionadas supra, deriva en una evidente falta de coordinación que de alguna manera, vendría a constatar los argumentos vertidos por los recurrentes en su escrito de interposición, en relación con la lesión al medioambiente. Aunque tanto la Municipalidad de Garabito, como el MINAE, procedieron a suspender los permisos otorgados a la empresa desarrolladora, la SETENA y el SINAC, avalaron su proceder, concediendo una prórroga a la viabilidad ambiental del proyecto y la corta de 9 árboles, a pesar de la duda en relación con la existencia de las nacientes de agua.
Allí es, precisamente, donde se evidencia la omisión de las autoridades legalmente encargadas de velar por la protección al ambiente, de comunicarse y coordinar entre sí. A lo dicho, se suma que ante la incertidumbre y dudas generadas sobre los cuerpos de agua existentes en la propiedad y los terrenos donde se desarrollaría un proyecto de esa envergadura por un tercero, en este caso una empresa privada, ni siquiera se requirió la valoración o aprobación del Servicio Nacional de Aguas Subterráneas Riego y Avenamiento, entidad que, bajo juramento, fue prístina en esgrimir que hasta tanto ellos no validaran la información hidrogeológica del sitio, no se debía permitir la prosecución de la construcción. Es decir, el proyecto original no fue sometido a conocimiento de SENARA, ni siquiera cuando surgieron las dudas sobre la naturaleza y condición de los cuerpos de agua en mención, siendo que cuando surgió duda al respecto, la comunicación y el dictado de las medidas cautelares, se produjo únicamente entre las accionadas, y estando ya interpuesto el amparo.
Bajo esa inteligencia, es que se constata la lesión de derechos fundamentales por parte de Municipalidad de Garabito, el Ministerio de Ambiente y Energía, la Secretaría Técnica Nacional Ambiental y el Sistema Nacional de Áreas de Conservación, con lo cual, procede la declaratoria con lugar del recurso contra esas autoridades, acorde con lo dispuesto en el por tanto de esta resolución.
XI.En lo atinente al Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, corresponde la declaratoria sin lugar del amparo, toda vez que, dicha autoridad aún no ha sido allegada a la situación acaecida en razón de la existencia de las nacientes de agua en el terreno de cita. No obstante, sí debe girársele la orden que se indica en la parte dispositiva de esta sentencia, a efectos que se procure la debida intervención que debe otorgársele a esta institución en este tipo de casos.
Ahora, también descarta esta Sala que la sociedad JAEA hubiera incurrido en lesión alguna de derechos fundamentales en perjuicio del ambiente. En este sentido, consta que la empresa se atuvo a los criterios de las autoridades participantes y los permisos otorgados por cada una de ellas, y que de parte de la empresa no se aprecia afectación constitucional directa al medioambiente, sino la motivada y generada por las autoridades que omitieron efectuar entre ellas una debida coordinación, y traer a los autos al SENARA, como entidad encargada de emitir criterio en relación con el recurso hídrico.
Finalmente, con respecto a las manifestaciones de la empresa recurrida, en cuanto a que en su criterio, las autoridades accionadas lesionaron sus derechos fundamentales, lo propio es que, de considerarlo pertinente, exponga sus alegatos o desavenencias, ante las instancias que estime pertinentes, pues se trata de situaciones que si bien rodean el caso que ahora se conoce, ciertamente se alejan del núcleo y objeto concreto planteado por los recurrentes, que es lo que amerita el conocimiento de la Sala mediante este recurso de amparo.
XII.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso, únicamente contra la Municipalidad de Garabito, el Ministerio de Ambiente y Energía, la Secretaría Técnica Nacional Ambiental, y el Sistema Nacional de Áreas de Conservación. Se ordena a José Miguel Zeledón Calderón, Director de la Dirección de Agua del Ministerio de Ambiente y Energía; a José Martínez Meléndez, apoderado especial del Alcalde de la Municipalidad de Garabito; a Cynthia Barzuna Gutiérrez, Secretaria General de la Secretaría Técnica Nacional Ambiental; y a Grettel Vega Arcea, Directora Ejecutiva del Sistema Nacional de Áreas de Conservación, o a quienes ocupen esos cargos, que establezcan las instancias de coordinación necesarias, para que en el plazo máximo de CINCO DÍAS contado a partir de la notificación de esta sentencia, se remita al Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, toda la documentación concerniente a la identificación de los cauces de agua a que se hace referencia en esta sentencia.
Asimismo, se ordena a Patricia Quirós Quirós, Gerente del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, que establezca las instancias de coordinación necesarias para que en el plazo de un mes contado a partir de la recepción de la documentación que al respecto deben remitirle las autoridades dichas, se pronuncie sobre la existencia, naturaleza y eventuales incidencias sobre los posibles cursos de agua existentes en torno al proyecto constructivo en cuestión, y lo comunique a todas las instituciones aquí intervinientes. De igual manera, se ordena a Cynthia Barzuna Gutiérrez, Secretaria de la Secretaría Técnica Nacional Ambiental, que en el plazo máximo de un mes contado a partir de la recepción de dicho estudio por parte de SENARA, resuelva lo que corresponda respecto de la viabilidad ambiental otorgada al proyecto constructivo y así lo comunique a todas las autoridades intervinientes.
Finalmente, se ordena a José Miguel Zeledón Calderón, Director de la Dirección de Agua del Ministerio de Ambiente y Energía; a José Martínez Meléndez, apoderado especial del Alcalde de la Municipalidad de Garabito; a Cynthia Barzuna Gutiérrez, Secretaria General de la Secretaría Técnica Nacional Ambiental; y a Grettel Vega Arcea, Directora Ejecutiva del Sistema Nacional de Áreas de Conservación, que en el plazo de máximo de quince días contado a partir de la comunicación de la resolución que deberá adoptar la SETENA sobre la viabilidad ambiental del proyecto constructivo, que resuelvan lo que corresponda sobre la validación, continuación, o suspensión del proyecto a cargo de la empresa JAEA, y de todas las medidas que al respecto se han dictado. Se advierte que de no acatar las órdenes dichas, podrían incurrir en el delito de desobediencia y que, de conformidad con el artículo 71 de la Ley la Jurisdicción Constitucional, se les impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena al Estado y a la Municipalidad de Garabito, al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. Notifíquese esta resolución en forma personal a las autoridades recurridas.
