SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las once horas y cinco minutos de veintitrés de enero de dos mil diecinueve.
Proceedings are instituted on the constitutional challenge (acción de inconstitucionalidad) filed by [Nombre 001], holder of identity card [Valor 001], legal representative of the company [Valor 002] S.A., and [Nombre 002], holder of identity card [Valor 003], legal representative of HACIENDA CIRUELAS SP S.A., seeking a declaration that Ley No. 9610 of 17 de octubre de 2018, “Amendment of the Boundaries of Reserva Biológica Lomas de Barbudal for the Development of the Water Supply Project for the Middle Basin of Río Tempisque and Coastal Communities,” is unconstitutional, on the grounds that it violates Articles 7, 11, 45, 50, and 176 of the Political Constitution, as well as the procedure established in Article 208 bis of the Reglamento de la Asamblea Legislativa and the constitutional principles of non-regression in environmental matters (no regresividad en materia ambiental), in dubio pro natura, reasonableness and proportionality, economy and efficiency, budgetary balance, and legal certainty (seguridad jurídica).
The PROCURADOR GENERAL DE LA REPÚBLICA, the PRESIDENTE DE LA ASAMBLEA LEGISLATIVA, the MINISTRO DE AMBIENTE Y ENERGÍA, and the GERENTE GENERAL DEL SERVICIO NACIONAL DE AGUAS SUBTERRÁNEAS, RIEGO Y AVENAMIENTO are granted fifteen days to submit their views. The challenged law is intended to remove the protected status (desafectar) of 113 hectares of Reserva Biológica Lomas de Barbudal (RBLB)—which enjoys an absolute level of protection similar to that of a national park—and change their use so that the land may be flooded in order to construct the Embalse Río Piedras and thereby supply water to the middle basin of Río Tempisque and coastal communities. This project is known as PAACUME and provides for a reservoir with a surface area of 850 hectares, as well as the expansion and improvement of Canal Oeste and the construction of 300 kilometers of canals to convey and distribute water in the cantons of Carrillo, Santa Cruz, and Nicoya.
The challenged law also seeks to offset the area that would be removed from RBLB with other privately owned lands adjacent to the biological reserve belonging to ASETREK Tres Azul S.A., Hacienda Ciruelas SP S.A., and [Valor 002] S.A. (known as Brindis de Amor or Brindis de Amor en Liberia). According to the petitioners, in compliance with the Convention on Wetlands of International Importance Especially as Waterfowl Habitat (Convención Relativa a los Humedales de Importancia Internacional Especialmente como Hábitat de Aves Acuáticas, Convención RAMSAR), the Costa Rican State included Parque Nacional Palo Verde and Refugio de Vida Silvestre Caño Negro on the list of wetlands of international importance. They assert that Parque Nacional Palo Verde forms part of Área de Conservación de Tempisque and that this conservation area includes Refugio de Vida Silvestre Caballero, Parque Nacional Barra Honda, and Reserva Biológica Lomas de Barbudal (RBLB).
They add that the official RAMSAR website, in the section entitled “RAMSAR Sites Information Service,” contains the technical information sheet for the expansion of Sitio RAMSAR Palo Verde, Costa Rica, which expressly identifies RBLB as part of that international wetland. Because RBLB forms part of Humedal de Palo Verde, Consejo Regional del Área de Conservación Arenal Tempisque warned Asamblea Legislativa at the time that it was necessary to inform the Convention on Wetlands of International Importance Especially as Waterfowl Habitat of the intention to undertake this project and to initiate any other procedure required to fulfill the country’s commitments (see official communication SINAC-CORACAT-049-2018). However, no such communication was made; that is, RAMSAR was not notified of the removal of the RBLB area from protected status or of the change to the boundaries of that biological reserve.
This omission breaches our country’s international commitments and therefore violates Article 7 of the Political Constitution. They add that Article 4, subsection 2), of the RAMSAR Convention provides that when a Contracting Party, for urgent reasons of national interest, deletes a wetland from the list or restricts the boundaries of a wetland included therein, it must, as far as possible, compensate for any loss of wetland resources and, in particular, create additional nature reserves for waterfowl and for the protection of an adequate portion of their original habitat, either in the same region or elsewhere. They state that the modification of RBLB’s boundaries has not been declared a matter of urgent national interest. They further allege that the same official communication (No. SINAC-CORACAT-049-2018) indicated that it was necessary to analyze whether the PAACUME project could have any indirect impact on the Área de Conservación Guanacaste World Heritage Site and to assess whether the appropriate mechanisms should be initiated to notify the World Heritage Centre of this initiative.
This was not done. They contend that, consequently, the UNESCO World Heritage Convention was also violated. They assert that, according to various rulings of Sala Constitucional concerning Article 50 of the Constitution, that constitutional provision incorporated science and technology into environmental decisions, whether legislative or administrative, such that State actions in environmental matters must be grounded in, and may not contradict, the unequivocal rules of science and technology, in order to ensure the full and universal enjoyment of a healthy and ecologically balanced environment and, moreover, greater well-being for all inhabitants of the country. This has been termed the principle of objectification of environmental protection (principio de objetivación de la tutela ambiental). They allege that Ley No. 9610 violates the aforementioned Article 50 of the Constitution because it does not incorporate a serious, comprehensive, and objective study of the consequences of removing 113 hectares of RBLB from protected status and replacing or compensating for them with approximately 500 hectares of privately owned land intended to be incorporated into the biological reserve.
In this regard, they refer to the report issued by Dr. Jorge Arturo Lobo Segura—commissioned by Escuela de Biología de la Universidad de Costa Rica to respond to a request from Secretaría Técnica Nacional Ambiental (SETENA) for information relating to the PAACUME project—which concludes that the study by Organización de Estudios Tropicales (OET), on which the aforementioned removal and compensation are purportedly based, is “insufficient to define the change in the boundaries of Lomas de Barbudal and does not demonstrate that this change will be fully compensated for by additional areas in other sectors of the Reserve. The ASETREK property, which the consultants studied in greater detail, is ultimately acknowledged to be insufficient to justify the land exchange, and other nearby properties are hastily invoked to balance the compensation—an exercise that, in my view, lacks seriousness because it is not properly substantiated.” The report also states that “the unknown environmental impacts of the Embalse Río Piedras on the Biological Reserve and on all the wetland ecosystems of Bajo Tempisque must be determined before accepting the flooding of a sector of Reserva de Lomas de Barbudal and, more generally, of the ecosystems affected by the future PAACUME reservoir.” They allege that this violation of Article 50 of the Constitution is compounded by the violation of the principles of non-regression in environmental matters and in dubio pro natura.
They insist that the study conducted by OET is neither complete, objective, scientific, nor technical, because it contains numerous omissions and weaknesses. In this regard, they reiterate that the study focuses almost entirely on a portion of one of the three private properties intended to compensate for the 113 hectares removed from protected status by the law, but did not include studies of the biological conditions of the other two properties. It therefore cannot be scientifically determined that those properties actually possess environmental characteristics capable of replacing the ecosystem functions of the area whose protected status will be removed. They add that the potential impact on Parque Nacional de Palo Verde was not analyzed either, even though it is a wetland afforded international protection under the RAMSAR Convention and includes RBLB. They further allege that the challenged law was enacted even though the environmental impact study (Estudio de Impacto Ambiental) for the PAACUME project has not yet been approved, despite the fact that the project entails constructing a reservoir with a surface area of 850 hectares in a dry-forest area, which would unquestionably affect Río Piedras and the internationally designated Humedal de Palo Verde.
They therefore allege that, during the consideration of the bill that gave rise to the challenged legislation, the authorities proceeded to “put the cart before the horse.” Ley No. 9610 also violates Article 45 of the Constitution because three legal entities are deprived of private property in order to incorporate into RBLB nearly 500 hectares of privately owned land as compensation for removing from protected status 113 hectares belonging to the State and forming part of RBLB. This deprivation of private property occurs without a legally established public interest and without prior compensation. Report No. AL-DEST-CJU-068-2018 of Departamento de Servicios Técnicos de la Asamblea Legislativa states that the bill that ultimately became Ley No. 9610 modified the original boundaries of Reserva Biológica Lomas de Barbudal, bringing private property within those boundaries. It further states that, by “modifying the original boundaries of Reserva Biológica Lomas Barbudal, private property is being interfered with, while the bill fails to specify that such properties will be acquired through expropriation, leaving the privately owned parcels within the new boundaries subject to environmental restrictions.” They add that the second paragraph of Article 45 of the Political Constitution clearly provides that Asamblea Legislativa may impose limitations in the social interest on property for reasons of public necessity; however, several requirements must be satisfied before such limitations in the social interest may take effect.
First, passage of a law imposing such limitations requires 38 votes. Although the challenged law was indeed passed by more than 38 votes, a substantial portion of the legislative process was conducted under an expedited procedure based on Article 208 bis of the Reglamento de la Asamblea Legislativa. This renders the law unconstitutional for violation of legislative procedure because that expedited procedure may not be used for bills whose passage requires the votes of a qualified majority of legislators. Article 45 of the Constitution also provides that private property may be expropriated or encumbered if prior compensation is paid. That requirement has not been met either, because the aforementioned private properties have never been expropriated. Nor was or has an appraisal (avalúo) of the affected private properties been conducted, and no budget appropriation existed before the bill was passed to pay the corresponding compensation.
They allege that, upon the entry into force of this challenged law, which encompasses private properties belonging to three legal entities (ASETREK, Hacienda Ciruelas S.P. S.A., and Brindis de Amor), those properties became subject to the resulting restrictions.
This clearly violates Article 45 of the Political Constitution, since that encumbrance is imposed without prior compensation. Furthermore, the manner in which it was decided to expropriate (expropiar) the Brindis De Amor property in order to incorporate it into the RBLB excludes and leaves landlocked within the reserve a property of approximately 14 hectares belonging to Inversiones y Desarrollos Costa Rica Pacifico del Mar CMP S.A., but forming part of the overall Brindis de Amor project. That property remains landlocked within the new boundaries of the RBLB, without access to a public road. They reiterate that the law challenged through this action of unconstitutionality (acción de inconstitucionalidad) was processed, to a large extent, under an expedited procedure (procedimiento abreviado) based on the provisions of Article 208 bis of the Reglamento de la Asamblea Legislativa. They allege that this violated the limitations established in said Article 208 bis, which provides that the Asamblea Legislativa may establish special procedures for processing amendments to its regulations and bills whose passage requires an absolute majority; whereas the bill at issue, which subsequently became Ley No. 9610, required a qualified majority (mayoría calificada) for passage, because it clearly affected private properties by incorporating them into the RBLB as compensation for the area that would be declassified (desafectaría).
On this issue, the Departamento de Servicios Técnicos stated in the aforementioned report AL-DESTCJU-068-2018: “In view of the foregoing, a defect is evident in the processing of the Bill through the Comisión Especial created by procedural motion and governed by Article 208 bis, which provides that only bills whose passage requires an absolute majority may be processed thereunder, whereas in this specific case the Bill requires a vote of two-thirds of the members of the Legislative Plenary…” That procedural defect, identified by the Departamento de Servicios Técnicos, is clear and evident. They also allege that there is a memorandum sent by the Instituto Geográfico Nacional (IGN) to the Asamblea Legislativa (official letter DIG-0388-2018) in response to the consultation submitted to it through official letter AL-DSDI-OFI-0313-2018, from which a violation of the principle of legal certainty (principio de seguridad jurídica) arises.
This is because inconsistencies and errors have been identified in the coordinates included in the law ultimately enacted. They argue that the enactment of Ley No. 9610 resulted in several violations of the principle of legality (principio de legalidad) (Article 11 of the Political Constitution). The Ley Orgánica del Ambiente (Ley No. 7554), specifically Articles 32, 34, 36, 37 and 38 thereof, was violated because the requirements established in those provisions were not met during the process of modifying the boundaries of the RBLB so as to declassify 113 hectares and include approximately 500 hectares of privately owned land within the new boundaries of the biological reserve. For example, no preliminary physiographic or biological-diversity studies were conducted on all the private properties incorporated into the RBLB. Nor were any socioeconomic studies conducted to justify, on the one hand, the declassification and, on the other, the expansion of the RBLB by nearly 500 hectares of privately owned land.
Nor was any study conducted concerning the technical feasibility and land tenure (tenencia de la tierra) of all potential parcels that could have been considered to compensate for the 113 hectares declassified from the RBLB. Nor was the minimum funding available to acquire, protect, and manage the area (there is not even an appraisal of the properties to be expropriated). Moreover, compensation for the private land incorporated into the RBLB was not paid in advance. Finally, no technical studies were conducted on two of the three properties ultimately incorporated into the RBLB, in violation of Article 50 of the Political Constitution and the principles of environmental non-regression (no regresividad en materia ambiental) and in dubio pro natura. Article 58 of the Ley de la Biodiversidad (Ley No. 7788) was also violated because there was no technical report containing recommendations and justifications for including within the biological reserve two of the three properties that ultimately fell within the new boundaries of the RBLB.
Articles 71 and 72 of the Reglamento a la Ley de Biodiversidad were likewise violated because the report prepared by the OET does not indicate that the mandatory consultations were conducted with the communities that could be affected by the declassification of 113 hectares of the biological reserve or by the creation of a large reservoir with a water-surface area of approximately 850 hectares. Nor was an analysis conducted of land tenure around the RBLB to determine which area was best suited to compensate for the area declassified from that biological reserve. SENARA determined which lands would be used as compensation. This was not the result of a detailed land-tenure study. The requirement to verify the availability of sufficient financial resources to acquire the land in the proposed area was not met. Finally, as may be seen from a review of the OET technical report, that report was not coordinated by the appropriate SINAC unit, in clear violation of Article 71 of the Reglamento a la Ley de Biodiversidad.
The Ley de Creación del Servicio de Parques Nacionales (Ley No. 6084) was also violated. That article makes clear the type of restrictions on property imposed upon properties declared to be a biological reserve. In this case, however, no technical studies were conducted on two of the three properties included in the biological reserve. In addition, a parcel landlocked within the biological reserve was excluded from the expropriation area. Article 36 of the Ley del Ambiente establishes that, in order to create new state-owned protected wilderness areas (áreas silvestres protegidas), regardless of the management category (categoría de manejo) established, certain requirements must first be met, including minimum funding to acquire, protect, and manage the area. They contend that this requirement was not met in the case of Ley No. 9610. The ordinary budget for 2018, which was being executed when Ley No. 9610 was enacted, contained no budget appropriation to pay for the expropriation of the private properties incorporated into the RBLB by that law.
This failure violates the principle of budgetary balance (principio de equilibrio presupuestario) (Article 176 of the Political Constitution), because the law assumes new payment obligations that were not provided for in the budget law, although such provision is in all cases a requirement for expanding protected areas. Ley No. 9610 declassifies 113 hectares of the RBLB so that they may be flooded. To accomplish that declassification, compensation is made with more than 500 hectares of privately owned land. However, the question arises as to why those properties were selected instead of other properties adjoining the RBLB, including less valuable land or more than 300 hectares of state-owned land adjoining Reserva Biológica Lomas de Barbudal that already have a protection category far lower than that of a biological reserve. They allege that this consequently constitutes a violation of the principle of reasonableness and proportionality (principio de razonabilidad y proporcionalidad), because there is no justification for spending billions of colones to compensate for the 113 hectares of the RBLB declassified through the challenged law when options exist ranging from no cost to the State to substantially lower costs.
Finally, they state that, in the context of the challenged law, the principle of economy and efficiency (principio de economía y eficiencia) is closely related to the aforementioned principle of reasonableness and proportionality. They allege that the constitutional principle of economy and efficiency is violated when the law requires the expropriation of more than 500 hectares to compensate for the 113 hectares being declassified, when more than 300 hectares of state-owned land having a management and protection category lower than that of a national park or biological reserve could readily be incorporated into the RBLB at no cost to the public treasury. Nor was the necessary work performed to review all properties adjacent to the RBLB in order to determine how compensation could be provided at the lowest possible cost. That cost-benefit analysis was not conducted for all properties adjacent to the RBLB.
This action is admitted because it meets the requirements set forth in Articles 73 to 79 of the Ley de la Jurisdicción Constitucional. The applicants’ standing (legitimación) derives from Section 75, paragraph 2, of the Ley de la Jurisdicción Constitucional, insofar as the action is brought in defense of diffuse interests (intereses difusos) to safeguard the right to a healthy and ecologically balanced environment. Notice of the filing of the action shall be published in the Boletín Judicial on three consecutive occasions. If the President considers that the aforementioned requirements have been met, the Procuraduría General de la República and the opposing party appearing in the principal matter shall be granted a hearing for a period of fifteen days so that they may state whatever they deem appropriate.
At the same time, the President shall direct that notice be sent to the court or body hearing the matter, instructing it not to issue a final decision before the Chamber has ruled on the action, and shall order that notice be published in the Boletín Judicial on three consecutive occasions, informing the courts and the bodies that exhaust administrative remedies that the action has been filed, so that no final decision shall likewise be issued, until the Chamber has rendered its ruling in the matter, in any cases or proceedings in which the application of the law, decree, provision, agreement, or decision is disputed. If the action is filed by the Procurador General de la República, the hearing shall be granted to the person appearing as the opposing party in the principal matter.” “Article 82. SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las once horas y cinco minutos de veintitrés de enero de dos mil diecinueve.
Se da curso a la acción de inconstitucionalidad interpuesta por [Nombre 001], portadora de la cédula de identidad [Valor 001] , representante legal de la sociedad [Valor 002] S.A., y [Nombre 002], portador de la cédula de identidad [Valor 003], representante legal de la sociedad HACIENDA CIRUELAS SP S.A., para que se declare inconstitucional la Ley No. 9610 del 17 de octubre de 2018, “Modificación de límites de la Reserva Biológica Lomas de Barbudal para el desarrollo del Proyecto de Abastecimiento de Agua para la Cuenca Media del Río Tempisque y Comunidades Costeras”, por estimar que lesiona los artículos 7, 11, 45, 50 y 176 de la Constitución Política, así como el procedimiento establecido en el artículo 208 bis del Reglamento de la Asamblea Legislativa y los principios constitucionales de no regresividad en materia ambiental, in dubio pro natura, razonabilidad y proporcionalidad, economía y eficiencia, equilibrio presupuestario y seguridad jurídica.
Se confiere audiencia por quince días al PROCURADOR GENERAL DE LA REPÚBLICA, al PRESIDENTE DE LA ASAMBLEA LEGISLATIVA, al MINISTRO DE AMBIENTE Y ENERGÍA y al GERENTE GENERAL DEL SERVICIO NACIONAL DE AGUAS SUBTERRÁNEAS, RIEGO Y AVENAMIENTO. La ley impugnada tiene por objeto desafectar 113 hectáreas de la Reserva Biológica Lomas de Barbudal (RBLB) –la cual tiene un nivel de protección absoluta, similar a la de un parque nacional- y cambiar su uso para proceder a inundar dicho terreno, para construir el Embalse Río Piedras y así llevar agua a la cuenca media del río Tempisque y comunidades costeras. A ese proyecto se le conoce como PAACUME, que contempla un embalse con un espejo de agua de 850 hectáreas, así como la ampliación y mejoras del Canal Oeste y la construcción de 300 kilómetros de canales para conducir y distribuir el agua en los cantones de Carrillo, Santa Cruz y Nicoya. Con la ley impugnada se pretende, además, compensarse el área que se reduciría de la RBLB con otros terrenos privados adyacentes a la reserva biológica, que pertenecen a las sociedades ASETREK Tres Azul S.A., Hacienda Ciruelas SP S.A. y [Valor 002] S.A. (conocida como Brindis de Amor o Brindis de Amor en Liberia).
Según alegan los accionantes, en cumplimiento de la Convención Relativa a los Humedales de Importancia Internacional Especialmente como Hábitat de Aves Acuáticas (Convención RAMSAR), el Estado costarricense incluyó el Parque Nacional Palo Verde y el Refugio de Vida Silvestre Caño Negro en la lista de humedales de importancia internacional. Aseveran que el Parque Nacional Palo Verde forma parte del Área de Conservación de Tempisque y esta área incluye al Refugio de Vida Silvestre Caballero, al Parque Nacional Barra Honda y a la Reserva Biológica Lomas de Barbudal (RBLB). Añaden que en el sitio oficial de RAMSAR en Internet, en la sección denominada “Servicio de información sobre sitios RAMSAR”, puede observarse la ficha técnica para ampliación del Sitio RAMSAR Palo Verde, Costa Rica, en el que claramente se menciona a la RBLB como parte de ese humedal internacional. En tanto que la RBLB forma parte del Humedal de Palo Verde, el Consejo Regional del Área de Conservación Arenal Tempisque advirtió a la Asamblea Legislativa, en su momento, que era necesario que se comunicara a la Convención Relativa a los Humedales de Importancia Internacional especialmente como Hábitat de Aves Acuáticas la intención de realizar este proyecto y activar cualquier otro procedimiento para cumplir con los compromisos del país (ver oficio SINAC-CORACAT-049-2018); sin embargo, tal comunicación no se realizó, sea, no se notificó a RAMSAR sobre la desafectación del área de la RBLB, ni del cambio en los límites de esa reserva biológica, lo que supone una omisión que infringe los compromisos internacionales de nuestro país y, por ende, una violación al artículo 7 de la Constitución Política.
Agregan que el Convenio de RAMSAR establece, en su artículo 4, inciso 2), que cuando una Parte Contratante, por motivos urgentes de interés nacional, retire de la lista o reduzca los límites de un humedal incluido en ella, deberá compensar, en la medida de lo posible, la pérdida de recursos de humedales y, en particular, crear nuevas reservas naturales para las aves acuáticas y para la protección de una porción adecuada de su hábitat original, en la misma región o en otro lugar. Señalan que la modificación de los límites de la RBLB no ha sido declarada de urgente interés nacional. Alegan, además, que en ese mismo oficio (No. SINAC-CORACAT-049-2018) se indicó que era necesario analizar si el proyecto PAACUME podía tener algún impacto indirecto en el sitio patrimonio mundial Área de Conservación Guanacaste y valorar la activación de los mecanismos pertinente para comunicar al Centro de Patrimonio Mundial esta iniciativa.
Lo que no se hizo. Reclaman que, en consecuencia, también se violentó la Convención de Patrimonio Mundial de la UNESCO. Afirman que, conforme a diversos pronunciamientos de la Sala Constitucional, referentes al artículo 50 constitucional, tal norma constitucional introdujo la ciencia y la técnica en las decisiones ambientales, sean estas legislativas o administrativas, de tal manera que las actuaciones estatales en materia ambiental deben fundarse y no pueden contradecir las reglas unívocas de la ciencia y la técnica en aras de lograr el goce pleno y universal a un ambiente sano y ecológicamente equilibrado y, además, un mayor bienestar para todos los habitantes del país. A eso se le ha denominado el principio de objetivación de la tutela ambiental. Acusan que la Ley No. 9610 violenta el citado artículo 50 constitucional, ya que no incorpora un estudio serio, integral y objetivo, sobre las consecuencias de la desafectación de 113 hectáreas de la RBLB y la sustitución o compensación con unas 500 hectáreas de propiedades privadas que se pretenden incorporar a la reserva biológica.
Remiten, al efecto, al informe emitido por el Dr. Jorge Arturo Lobo Segura –comisionado por la Escuela de Biología de la Universidad de Costa Rica para responder a un requerimiento de información de la Secretaría Técnica Nacional Ambiental (SETENA) relacionada con el proyecto PAACUME-, en donde se concluye sobre el estudio de la Organización de Estudios Tropicales (OET) -mediante el cual pretenden justificar la referida desafectación y compensación- que es “insuficiente para definir el cambio de límites de Lomas de Barbudal, y no demuestra que este cambio será plenamente compensado por áreas adicionales en otros sectores de la Reserva. La finca ASETREK, estudiada con más detalle por los consultores, al final se reconoce como insuficiente para justificar el canje de tierra, y se acude precipitadamente a otras fincas cercanas para balancear la compensación, a mi parecer un ejercicio poco serio porque no está debidamente fundamentado”.
En el citado informe se dice, también, que “el desconocimiento de los impactos ambientales del embalse Río Piedras sobre la Reserva Biológica y sobre todos los ecosistemas de humedales del Bajo Tempisque debe ser conocido antes de aceptar la inundación de un sector de la Reserva de Lomas de Barbudal y de en general de los ecosistemas afectados por el futuro embalse de PAACUME”. Alegan que tal violación al artículo 50 de la Constitución se complementa con la violación a los principios de no regresividad en materia ambiental y de indubio pro natura. Insisten que el estudio realizada por la OET no es completo, ni objetivo, ni científico, ni técnico, ya que adolece de muchas omisiones y debilidades. Reiteran, al efecto, que tal estudio se centra prácticamente en una porción de una de las tres propiedades privadas con las que se pretende compensar las 113 hectáreas que se desafectan con la ley, pero no incorporó estudios sobre las condiciones biológicas de las otras dos propiedades, por lo que no se puede determinar, científicamente, que se trate de propiedades que efectivamente cuenten con características medioambientales que reemplacen las funciones eco sistémicas del área que se va a desafectar.
A lo que se añade que tampoco se analizó la afectación que podría ocasionarle al Parque Nacional de Palo Verde, el cual es un humedal con protección internacional brindada por la Convención de RAMSAR, del cual forma parte la RBLB. Acusan, además, que se aprobó la ley impugnada, pero aun no se ha aprobado el Estudio de Impacto Ambiental para realizar el proyecto PAACUME, pese que tal proyecto implica realizar un embalse con un espejo de agua de 850 hectáreas en una zona de bosque seco, lo que en definitiva afectaría el Río Piedras y el humedal de categoría internacional de Palo Verde. Alegan que, en consecuencia, en la tramitación del proyecto de ley que dio origen a la normativa impugnada se procedió a “poner la carreta delante de los bueyes”. La Ley No. 9610 violenta, además, el artículo 45 de la Constitución, ya que se priva de propiedad privada a tres personas jurídicas para incorporarle a la RBLB casi 500 hectáreas de propiedades privadas como compensación de una desafectación de 113 hectáreas pertenecientes al Estado y que son parte de la RBLB.
Esa privación de la propiedad privada se hace sin que haya un interés público que hubiere sido legalmente comprobado y sin indemnización previa. En el informe del Departamento de Servicios Técnicos de la Asamblea Legislativa No. AL-DEST-CJU-068-2018 se señala que el proyecto que finalmente derivó en la Ley No. 9610 modificaba los límites originales de la Reserva Biológica Lomas de Barbudal, subsumiendo en sus límites propiedad privada. Se indica, además, que al “modificarse los límites originales de la Reserva Biológica Lomas Barbudal se está frente a la intervención de la propiedad privada, siendo omiso el proyecto en indicar que tales propiedades serán adquiridas por expropiación, quedando los fundos privados en sus nuevos límites bajo limitaciones ambientales”. Agregan que es claro que el párrafo segundo del artículo 45 de la Constitución Política establece que, por motivos de necesidad pública, la Asamblea Legislativa podrá imponer a la propiedad limitaciones de interés social; sin embargo, dichas limitaciones de interés social requieren de varios requisitos para materializarse.
En primer lugar, la aprobación de la ley que impone tales limitaciones requiere de 38 votos; en cuyo caso, si bien es cierto que la ley impugnada se aprobó por más de 38 votos, lo cierto es que buena parte del procedimiento parlamentario se realizó mediante un procedimiento abreviado basado en el artículo 208 bis del Reglamento de la Asamblea Legislativa, lo que implica la inconstitucionalidad de la ley por violación al procedimiento parlamentario, ya que ese procedimiento abreviado está vedado para proyectos que requieren para su aprobación el voto de una mayoría calificada de diputados. Asimismo, el artículo 45 constitucional establece que podrá expropiarse o afectarse la propiedad privada si hubiera indemnización previa. Ese requisito tampoco se ha cumplido, ya que en ningún momento se han realizado un avalúo de las propiedades privadas afectadas, ni había una partida presupuestaria antes de aprobarse el proyecto de ley para cancelar la indemnización correspondiente.
Acusan que, a partir de la entrada en vigencia de esta ley impugnada, la cual involucra propiedades privadas pertenecientes a tres personas jurídicas (ASETREK, Hacienda Ciruelas S.P. S.A. y Brindis de Amor), estas quedan afectadas. Esto claramente violenta el artículo 45 de la Constitución Política, ya que esa afectación se hace sin previa indemnización. Además, la forma en que se decide expropiar la propiedad de Brindis De Amor para incorporarla a la RBLB deja por fuera y enclavada dentro de la reserva una propiedad de aproximadamente 14 hectáreas perteneciente a la sociedad Inversiones y Desarrollos Costa Rica Pacifico del Mar CMP S.A., pero que forma parte de todo el proyecto de Brindis de Amor. Propiedad que queda enclavada dentro de los nuevos límites de la RBLB, sin acceso a calle pública. Reiteran que la ley que se está impugnando mediante esta acción de inconstitucionalidad fue tramitada en una buena parte mediante un procedimiento abreviado basado en lo dispuesto por el artículo 208 bis del Reglamento de la Asamblea Legislativa.
Acusan que con esto se infringieron las limitaciones establecidas en dicho artículo 208 bis, que establece que la Asamblea Legislativa podrá establecer procedimientos especiales para tramitar las reformas a su reglamento y proyectos de ley cuya aprobación requiera mayoría absoluta; en cuyo caso, el proyecto de ley de marras, que posteriormente se convirtió en la Ley No. 9610, era un proyecto que requería de mayoría calificada para su votación, ya que claramente afectaba propiedades privadas al incorporarlas dentro de la RBLB como compensación del área que se desafectaría. Sobre este tema, el Departamento de Servicios Técnicos, en el citado informe AL-DESTCJU-068-2018, indicó que: “ En virtud de lo anterior, se aprecia un vicio en la tramitación del Proyecto de Ley por medio de la Comisión Especial creada por moción de orden y regulado bajo el artículo 208 bis, el que preceptúa que sólo se pueden tramitar proyectos cuya aprobación requiera mayoría absoluta, y para el caso concreto el Proyecto de Ley requiere de una votación de los dos tercios de los diputados del Plenario Legislativo…”.
Ese vicio en el procedimiento, señalado por el Departamento de Servicios Técnicos, es claro y evidente. Acusan, asimismo, que existe una nota que el Instituto Geográfico Nacional (IGN) envió a la Asamblea Legislativa (oficio DIG-0388-2018 ) en respuesta a la consulta que se le h izo mediante oficio AL-DSDI-OFI-0313-2018, de la que se deriva una violación al principio de seguridad jurídica. Lo anterior, por cuanto, se constata la existencia de inconsistencias y errores en las coordenadas incluidas en la ley finalmente aprobada. Argumentan que con la aprobación de la Ley No. 9610 se han configurado diversas violación al principio de legalidad (artículo 11 de la Constitución Política). Se ha infringido la Ley Orgánica del Ambiente (Ley No. 7554), en sus artículos 32, 34, 36, 37 y 38, pues, en el proceso para modificar los límites de la RBLB, para desafectar 113 hectáreas e incluir aproximadamente 500 hectáreas de terrenos privados dentro de los nuevos límites de la reserva biológica, no se han cumplido requisitos establecidos en esa normativa.
Por ejemplo, no se hicieron estudios preliminares fisiogeográficos, de diversidad biológica de todas las propiedades privadas que se le incorporan a la RBLB. Tampoco se hicieron estudios socioeconómicos que justifiquen la desafectación por un lado y el aumento por otro lado de la RBLB con casi 500 hectáreas de terrenos privados. Tampoco se hizo un estudio de factibilidad técnica y tenencia de la tierra de todos los potenciales terrenos que podrían haberse considerado para compensar las 113 hectáreas que se desafectan de la RBLB. Tampoco estaba el financiamiento mínimo para adquirir el área (ni siquiera existe un avalúo sobre las propiedades a expropiar), protegerla y manejarla. Por otro lado, los terrenos privados que se incorporaron a la RBLB no se indemnizaron de previo. Finalmente, no se realizaron estudios técnicos sobre dos de las tres propiedades que finalmente se incorporaron a la RBLB, en infracción del artículo 50 de la Constitución Política y los principios de no regresividad en materia ambiental e in dubio pro natura.
También se ha infringido el artículo 58 de la Ley de la Biodiversidad (Ley No. 7788), ya que no hubo informe técnico con las recomendaciones y justificaciones para incluir dentro de la reserva biológica a dos de las tres propiedades que finalmente quedaron dentro de los nuevos límites de la RBLB. Se han infringido, asimismo, los artículos 71 y 72 del Reglamento a la Ley de Biodiversidad, dado que, el informe que elaboró la OET no consigna que se hubieren hecho las consultas obligatorias a las comunidades que podrían ser afectadas por la desafectación de 113 hectáreas de la reserva biológica, así como de la creación de un gran embalse con un espejo de agua de aproximadamente 850 hectáreas. Tampoco se hizo un análisis de la tenencia de la tierra alrededor de la RBLB para determinar cuál área era la idónea para compensar el área desafectada de esa reserva biológica. Fue el SENARA el que determinó con qué terrenos compensar.
Esto no fue producto de un estudio pormenorizado de la tenencia de la tierra. No se cumplió el requisito de verificar la existencia de recursos financieros suficientes para adquirir los terrenos del área propuesta. Finalmente, como puede observarse de la revisión del informe técnico de la OET, ese informe no estuvo coordinado por la instancia respectiva del SINAC, en clara violación a lo establecido en el artículo 71 del R eglamento a la L ey de Biodiversidad. Se violentó, adicionalmente, la Ley de Creación del Servicio de Parques Nacionales (Ley No. 6084). Dicho artículo deja claro el tipo de limitaciones a la propiedad que este caso no se hicieron estudios técnicos sobre dos de las tres propiedades que se incluyeron en la reserva biológica. Además, se dejó por fuera del área de Ley del Ambiente establece que para crear nuevas áreas silvestres protegidas propiedad del Estado, cualquiera sea la categoría de manejo que él establezca, deberá cumplirse previamente, entre otros requisitos, con el financiamiento mínimo para adquirir el área, protegerla y manejarla.
Sostienen que ese requisito no se cumplió en el caso de la Ley No. 9610. El presupuesto ordinario del 2018, en ejecución para cuando se aprobó la Ley No. 9610, no contenía una partida presupuestaria para pagar las expropiaciones de las propiedades privadas que se incorporaron a la RBLB mediante esa ley. Ese incumplimiento violenta el principio de equilibrio presupuestario (artículo 176 de la Constitución Política), ya que mediante esa ley se asumen nuevas obligaciones de pago sin que estuvieran previstas en la ley de presupuesto, lo que es requisito en todo caso para ampliar áreas protegidas. La Ley No. 9610 desafecta 113 hectáreas de la RBLB para poder inundarlas. Para poder hacer esa desafectación, se compensa con más de 500 hectáreas de terrenos privados. Sin embargo, surge el cuestionamiento de por qué se escogieron esas y no otras propiedades colindantes con la RBLB, inclusive terrenos de menor valor o terrenos que ya pertenecen al Estado colindantes con la Reserva Biológica Lomas de Barbudal y que tienen una categoría de protección muy inferior a la de una reserva biológica (más de 300 hectáreas).
Alegan que, en consecuencia, se está ante una violación del principio de razonabilidad y proporcionalidad, ya que no se justifica una erogación de dinero de miles de millones de colones para compensar 113 hectáreas de la RBLB que se desafectan mediante esta ley que se impugna, cuando existen opciones que van desde cero costo para el Estado o de costo más reducido. Indican, finalmente, que el principio de economía y eficiencia guarda una estrecha relación, en el contexto de esta ley que se impugna, con el principio de razonabilidad y proporcionalidad previamente mencionados. Acusan que se está ante una violación al principio constitucional de economía y eficiencia cuando la ley obliga a expropiar más de 500 hectáreas para compensar 113 hectáreas que se están desafectando, cuando podrían perfectamente incorporársele a la RBLB más de 300 hectáreas del Estado que tienen una categoría de manejo y protección inferior a la de un parque nacional o reserva biológica, sin costo alguno para el erario público.
Tampoco se hizo el trabajo para revisar todas las propiedades adyacentes a la RBLB con el fin de encontrar la manera de compensar con el menor costo posible. Ese análisis de costo-beneficio no se hizo con todas las propiedades adyacentes a la RBLB. Esta acción se admite por reunir los requisitos a que se refiere la Ley de la Jurisdicción Constitucional en sus artículos 73 a 79. La legitimación de los accionantes proviene del numeral 75, párrafo 2, de la Ley de la Jurisdicción Constitucional, en tanto se acciona en defensa de intereses difusos en resguardo del derecho a un ambiente sano y ecológicamente equilibrado. Publíquese por tres veces consecutivas un aviso en el Boletín Judicial sobre la interposición de la acción. Efectos jurídicos de la interposición de la acción: Se recuerdan los términos de los ordinales 81 y 82 de la Ley de la Jurisdicción Constitucional que disponen lo siguiente “Artículo 81.
Si el Presidente considerare cumplidos los requisitos de que se ha hecho mérito, conferirá audiencia a la Procuraduría General de la República y a la contraparte que figure en el asunto principal, por un plazo de quince días, a fin de que manifiesten lo que estimen conveniente. Al mismo tiempo dispondrá enviar nota al tribunal u órgano que conozca del asunto, para que no dicte la resolución final antes de que la Sala se haya pronunciado sobre la acción, y ordenará que se publique un aviso en el Boletín Judicial, por tres veces consecutivas, haciendo saber a los tribunales y a los órganos que agotan la vía administrativa que esa demanda ha sido establecida, a efecto de que en los procesos o procedimientos en que se discuta la aplicación de la ley, decreto, disposición, acuerdo o resolución, tampoco se dicte resolución final mientras la Sala no haya hecho el pronunciamiento del caso. Si la acción fuere planteada por el Procurador General de la República, la audiencia se le dará a la persona que figure como parte contraria en el asunto principal.”, “Artículo 82.
En los procesos en trámite no se suspenderá ninguna etapa diferente a la de dictar la resolución final, salvo que la acción de inconstitucionalidad se refiera a normas que deban aplicarse durante la tramitación.” Dentro de los quince días posteriores a la primera publicación del citado aviso, podrán apersonarse quienes figuren como partes en asuntos pendientes a la fecha de interposición de esta acción, en los que se discuta la aplicación de lo impugnado o aquellos con interés legítimo, a fin de coadyuvar en cuanto a su procedencia o improcedencia, o para ampliar, en su caso, los motivos de inconstitucionalidad en relación con el asunto que les interese. Se hace saber, además, que de conformidad con los artículos 81 y 82 de la Ley de Jurisdicción Constitucional y según lo ha resuelto en forma reiterada la Sala (resoluciones 0536-91, 0537-91, 0554-91 y 0881-91) esta publicación no suspende la vigencia de la norma en general sino únicamente su aplicación en los casos y condiciones señalados.
