Proceeding for the remedy of amparo (recurso de amparo) processed under case file N° 19-007087-0007-CO, filed by HEILIN DE LOS ÁNGELES MÉNDEZ HERNÁNDEZ, identity card 01100320105, against LA MUNICIPALIDAD DE COTO BRUS.
RESULTS:
-Installation of a new culvert crossing, consisting of a double crossing one meter in diameter and eleven meters long, as well as construction of its corresponding headwalls (cabezales).
-Construction of a concrete box (caja de concreto) at the end of the crossing installed under the preceding item.
-Installation, after the concrete box, of a double crossing one meter in diameter and eighteen meters long.
-At the end of the double crossing, continuation with an open channel (canal abierto) constructed of concrete blocks and measuring fifty-two meters in length, extending to the culvert crossing measuring one meter and fifty centimeters.

They add that, at Ordinary Session N° 158, held on 07 May of the current year, the Municipal Council approved the extraordinary budget, which includes the funding for the specified project, and they are therefore awaiting approval by the Contraloría General de la República in order to begin the procurement procedures (procedimientos de contratación). Based on the foregoing, they request that the remedy be denied with respect to the respondent municipality.

CONSIDERING:
The petitioner states that six years ago, a low-capacity culvert system (alcantarillado) was installed on the main access road to Barrio La Paz, creating a kind of bottleneck that prevents the water from following its normal course; instead, the water becomes stagnant, which in turn causes several properties to flood, including her home. She indicates that she has submitted multiple requests to the respondent municipality but, as of the date on which she sought amparo relief, no solution had been provided for the problem.
The following relevant facts are deemed duly established and material to the resolution of this proceeding:
The case law of this Chamber has repeatedly recognized that public health and the right to a healthy and ecologically balanced environment are protected both constitutionally and under international law. It has held that the legitimate exercise of this right requires resources to be used rationally and that the State is responsible for protecting the environment in accordance with the precautionary principle (principio precautorio) governing environmental matters. This principle requires the State to take all necessary measures, within the scope permitted by law, to prevent irreversible environmental damage; to that end, it is responsible for creating social conditions conducive to each person’s enjoyment of health, understood as a state of physical, psychological or mental, and social well-being (see Judgment Nº 180-98 issued at 16:24 on 13 January 1998). The State’s objective obligation (obligación objetiva) regarding environmental protection does not necessarily entail a subjective right (derecho subjetivo) for individuals to demand through the courts that a particular measure be taken, but it does entail the right to have appropriate measures adopted to protect that right when public authorities, or natural and legal persons, act with manifest negligence.
The State thus assumes the obligation to regulate those areas of social life that may give rise to dangers to the physical existence of the inhabitants of its territory, as well as those that may harm the environment, which it may do through statutes, regulations, agreements, or other measures concerning administrative organization and procedures. Consequently, the ability to judicially demand, through the remedy of amparo, a specific type of affirmative action (actividad prestacional) by the State in fulfillment of its duty to protect the life, health, or environmental rights of its inhabitants is limited to situations in which a clear and imminent threat to those individual rights has been established. It follows that intervention by the constitutional jurisdiction (jurisdicción constitucional) is warranted only upon proof of State inaction, through its competent bodies, in addressing requests made by the country’s inhabitants in the exercise of their rights.
With particular regard to Local Governments, Article 169 of our Constitución Política establishes that they are responsible for administering local interests and services in each canton. In this regard, this Court has already held that a local interest is understood as any public interest that directly and immediately concerns the canton, such that the respective municipality is not only empowered but also obligated to address everything that benefits its canton (see, to similar effect, Judgment N° 2018010391 issued at 9:20 on 29 June 2018).
In this case, as is apparent from the statement of proven facts, it was established that the Municipalidad de Coto Brus has been aware, at least since 2013, of the lack of infrastructure for stormwater management (tratamiento aguas pluviales) and the discharge of wastewater onto the public roadway, that being the year in which the petitioner submitted requests to the municipality reporting the situation. Furthermore, although certain actions have been taken with a view to resolving the matter, the fact remains that the flooding of homes due to the insufficient capacity of the culvert system persists and continues to affect the residents of Barrio La Paz. According to the sworn statements of the authorities of the Municipalidad de Coto Brus, they are now awaiting approval of the extraordinary budget by the Contraloría General de la República in order to begin the procurement procedures for executing the works, which are intended to construct a stormwater discharge channel and install a larger-diameter culvert system so as to eliminate the problem caused by the insufficient capacity of the current system.
In view of the foregoing considerations, the alleged violation of the petitioner’s right to a healthy and ecologically balanced environment and to prompt administrative justice (justicia administrativa pronta) has been established; accordingly, the remedy is granted on the terms set forth in the operative portion (parte dispositiva) of this judgment.
I have dissented in cases seeking to remedy mere administrative inaction through a constitutional protection action (recurso de amparo) concerning infrastructure works such as sidewalks, bridges, street gravelling, culverts, and stormwater drainage systems, among others, on the grounds that such matters may be litigated through ordinary legality proceedings (vía de legalidad ordinaria), because I consider that the Chamber neither is nor should become a single or omnipresent forum that diminishes the other avenues of judicial protection established for that purpose by the constituent authority and the legislature. I have clarified, however, that I do consider cases of administrative inaction concerning the aforementioned matters eligible for protection through these proceedings when such inaction directly affects the exercise of fundamental rights governed by the Political Constitution or by international human rights treaties, provided that they are capable of being heard in a highly expedited proceeding of a special and urgent nature, as is the procedural remedy of amparo.
In this case, the list of proven facts supports the conclusion that there is insufficient evidence to establish that the alleged omission endangers the life, physical integrity, or health of the claimants. I therefore consider it necessary to deny the action so that the parties may pursue the appropriate proceedings to protect their legal rights.-
The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device, or produced using new technologies, these must be retrieved from the court office within a maximum period of thirty business days from the date notice of this judgment is served. Otherwise, any material not retrieved within this period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Full Court at Session N° 27-11, del 22 de agosto del 2011, article XXVI, and published in Boletín Judicial N° 19, del 26 de enero del 2012, as well as pursuant to the resolution approved by the Superior Council of the Judiciary at Session N° 43-12, held on 3 de mayo del 2012, article LXXXI.
POR TANTO:
The action is granted and, consequently, Rafael Ángel Navarro Umaña and Luis Carlos Obando Murillo, respectively Mayor and Director of the Department of Technical Management of Road Infrastructure, both of the Municipalidad de Coto Brus, or whoever may hold those offices in their stead, are ordered to take the appropriate measures, within the scope of their authority, so that, within SIX MONTHS from the date notice of this judgment is served, the appropriate actions are coordinated and carried out to provide a definitive solution to the reported sewerage problem that causes flooding in several homes in Barrio La Paz. The respondents (recurridos) are advised that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that must be complied with or enforced and fails to comply with or enforce it shall be sentenced to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The Municipalidad de Coto Brus is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative-law court. Justice Hernández López dissents and would deny the action. This judgment shall be served PERSONALLY on Rafael Ángel Navarro Umaña and Luis Carlos Obando Murillo, respectively Mayor and Director of the Department of Technical Management of Road Infrastructure, both of the Municipalidad de Coto Brus, or whoever may hold those offices in their stead.

Revisión del Documento *190070870007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del doce de julio de dos mil diecinueve .
Recurso de amparo que se tramita en expediente N° 19-007087-0007-CO, interpuesto por HEILIN DE LOS ÁNGELES MÉNDEZ HERNÁNDEZ, cédula de identidad 01100320105, contra LA MUNICIPALIDAD DE COTO BRUS.
RESULTANDO:
-Instalación de un nuevo paso de alcantarilla, se pretende la instalación de un paso doble de un metro de diámetro y once metros de largo, además de la construcción de sus respectivos cabezales.
-Al final del paso colocado en el punto anterior, la construcción de una caja de concreto.
-Luego de la caja de concreto, la instalación de un paso doble de un metro de diámetro y dieciocho metros de largo.
-Donde termina el paso doble, se continúa con un canal abierto construido en bloques de concreto de cincuenta y dos metros de largo, hasta llegar al paso de alcantarilla de un metro y cincuenta centímetros.
-Construcción de un cabezal para tubo de un metro y cincuenta centímetros de diámetro tipo CA2, según el Manual de Normas y Diseños del MOPT.
-Construcción de caja de concreto al final del paso de alcantarilla -Construcción de canal en concreto hasta el Río Sabalito.
Agregan que en Sesión Ordinaria N° 158, celebrada el 07 de mayo del año en curso, el Concejo Municipal aprobó el presupuesto extraordinario, donde se incluye el monto para el proyecto indicado, por lo que se está a la espera de la aprobación por parte de la Contraloría General de la República, para iniciar los procedimientos de contratación. Por lo expuesto, solicitan se declare sin lugar el recurso, en cuanto al municipio recurrido.
Redacta el Magistrado Chacón Jiménez; y,
CONSIDERANDO:
La parte recurrente manifiesta que hace seis años, se colocó en el paso principal hacia el Barrio La Paz un alcantarillado de poca capacidad, lo que provocó una especie de embudo que no permite que las aguas sigan su curso normal; por el contrario, se estancan, ocasionando, a su vez, la inundación de varias propiedades, entre las cuales se encuentra su casa de habitación. Señala que ha presentado múltiples gestiones ante el municipio recurrido, sin que, a la fecha en que acude en amparo, se haya brindado una solución al problema.
De importancia para la resolución del presente recurso, se estiman como debidamente demostrados los siguientes hechos de relevancia:
En reiteradas ocasiones, la jurisprudencia de esta Sala ha reconocido que la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado, se encuentran reconocidos tanto a nivel constitucional como a través de la Normativa internacional. Se ha indicado, que el ejercicio legítimo de ese derecho requiere que los recursos sean utilizados de manera racional, y que corresponde al Estado la protección del ambiente, según el principio precautorio que rige en materia ambiental. Este principio obliga al Estado a disponer todo lo que sea necesario, dentro del ámbito permitido por la ley, a efectos de impedir que se produzcan daños irreversibles al ambiente, para cuyo efecto es responsable de lograr las condiciones sociales propicias a fin de que cada persona pueda disfrutar de su salud, entendido este derecho como una situación de bienestar físico, psíquico (o mental) y social (véase Sentencia Nº 180-98 de las 16:24 horas del 13 de enero de 1998).
La obligación objetiva del Estado en materia de protección ambiental no apareja, ineludiblemente, un derecho subjetivo de las personas a exigir, a través de los organismos judiciales, que se tome una medida determinada, pero sí a que se adopten las que sean idóneas en tutela de ese derecho, ante actitudes abiertamente negligentes de las autoridades públicas, o bien, de personas físicas y jurídicas. De este modo, el Estado adquiere la obligación de regular las áreas de la vida social de las cuales puedan surgir peligros para la existencia física de los habitantes de su territorio, así como también aquellas que vulneren el ambiente, lo cual puede hacer a través de leyes, reglamentos, acuerdos u otras medidas relacionadas con la organización y los procedimientos administrativos. En consecuencia, la posibilidad de exigir judicialmente, a través del recurso de amparo, un tipo específico de actividad prestacional por parte del Estado en cumplimiento de su deber de protección a la vida, salud o derecho al ambiente en beneficio de sus habitantes, está restringida a la clara verificación de un peligro inminente contra esos derechos de las personas.
De lo que se desprende que la injerencia de la jurisdicción constitucional solamente es viable ante la inercia comprobada del Estado, a través de sus órganos competentes, en atender las demandas que en ejercicio de sus derechos realicen los habitantes del país. En particular, respecto a los Gobiernos Locales, nuestra Constitución Política, en el numeral 169, establece que les corresponde la administración de los intereses y servicios locales en cada cantón. En ese sentido, este Tribunal ya ha dicho que el interés local se entiende como todo aquel de naturaleza pública que importa al cantón de manera directa e inmediata, de suerte tal que la municipalidad respectiva está, no solo facultada, sino también obligada a ocuparse de todo lo que favorezca a su cantón (véase en similar sentido la Sentencia N° 2018010391 de las 9:20 horas de 29 de junio de 2018).
En este caso, tal y como se desprende de la relación de hechos probados, se acreditó que los problemas de falta de infraestructura para el tratamiento aguas pluviales y el depósito de aguas residuales en la vía pública, es conocido por la Municipalidad de Coto Brus, por lo menos desde el año 2013, fecha en la cual la parte recurrente presentó gestiones ante el municipio, denunciando la situación. Además, se constata que, si bien han realizado algunas actuaciones tendentes a su solución, lo cierto del caso es que el problema de inundaciones a viviendas, por la poca capacidad del alcantarillado persiste y continúa afectando a los vecinos del Barrio La Paz. Ahora bien, según indican bajo juramento las autoridades de la Municipalidad de Coto Brus, se está a la espera de la aprobación del presupuesto extraordinario, por parte de la Contraloría General de la República, para iniciar los procedimientos de contratación para la ejecución de la obra, con la cual se pretende construir un canal de desfogue pluvial, y colocar alcantarillado de un diámetro mayor, para eliminar la problemática de baja capacidad del alcantarillado actual.
En vista de las consideraciones expuestas, se acredita la acusada violación del derecho de la recurrente, a un ambiente sano y ecológicamente equilibrado y a una justicia administrativa pronta, por lo que se estima el recurso en los términos dispuestos en la parte dispositiva de esta sentencia.
He venido salvado el voto en aquellos casos que se trate de corregir por medio del recurso de amparo la simple inactividad de la administración, en obras de infraestructura tales como aceras, puentes, lastreado de calles, alcantarillas, alcantarillado pluvial entre otras, con el argumento de que pueden ser discutidos en la vía de legalidad ordinaria, considerando que la Sala no es, ni debe constituirse, en una instancia única u omnipresente que demerite las otras vías de tutela judicial creadas por el constituyente y el legislador al efecto. He aclarado sin embargo que sí estimo como tutelables en esta vía casos de inactividad de la administración en los temas señalados si con ella se produce afectación directa al ejercicio de derechos fundamentales regulados en la Constitución Política o a los tratados internacionales de derechos humanos, siempre que sean susceptibles de ser conocidos en un proceso muy sumario y de especial naturaleza y urgencia como es el amparo como instituto procesal.
En este caso el listado de hechos demostrados permite concluir que no existe ningún elemento de convicción suficiente para tener por cierto que la omisión reclamada pone en peligro la vida, la integridad o la salud de las personas reclamantes. Por ello, estimo necesario declarar sin lugar el recurso para que las partes acudan a la vía correspondiente en protección de sus derechos legales.-
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara con lugar el recurso, y en consecuencia, se ordena a Rafael Ángel Navarro Umaña y Luis Carlos Obando Murillo, por su orden Alcalde y Director del Departamento de Gestión Técnica de Infraestructura Vial; ambos de la Municipalidad de Coto Brus, o a quienes en su lugar ejerzan tales cargos, tomar las medidas correspondientes, dentro el ámbito de sus competencias para que, en el plazo de SEIS MESES, contados a partir de la notificación de esta sentencia, se coordinen y ejecuten las acciones correspondientes con el fin que se brinde la solución definitiva al problema de alcantarillado denunciado, que provoca la inundación de diversas viviendas en el Barrio La Paz. Se advierte a los recurridos que, de conformidad con lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena a la Municipalidad de Coto Brus, al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. La Magistrada Hernández López salva el voto y declara sin lugar el recurso. Notifíquese esta sentencia a Rafael Ángel Navarro Umaña y Luis Carlos Obando Murillo, por su orden Alcalde y Director del Departamento de Gestión Técnica de Infraestructura Vial; ambos de la Municipalidad de Coto Brus, o a quienes en su lugar ejerzan tales cargos, EN FORMA PERSONAL.
