02233 Constitutional rights action (amparo) Date: 28/05/1993 Case No. 1322-E-92 DECISION No. 2233-93 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine thirty-six in the morning on the twenty-eighth day of May, nineteen ninety-three.

Constitutional rights action filed by Nombre73661 against the MINISTRO DE RECURSOS NATURALES, ENERGIA Y MINAS, LIC. HERNAN BRAVO TREJOS.

RECITALS:

FIRST: The petitioner alleges that he owns an unregistered property located in Golfito de Puntarenas; that, without his authorization, the respondent Ministry granted a mining entrepreneur permission to construct a road crossing the petitioner’s property and the Reserva Forestal de Golfo Dulce, which would provide access to mining exploration areas; that, because of the road’s construction, the forest has been cleared “excessively and without any oversight,” and that on his property—he asserts—“more than two hundred” trees have been cut down; that other persons even intend to remove the timber from the land possessed by the petitioner in order to sell it; that construction of this road will cause numerous problems for the owners in the area and for the preservation of the aforementioned reserve and the wild flora and fauna existing there, in addition to aggravating the problem caused by gold extraction in Parque Nacional de Corcovado. Finally, he argues that the respondent body not only violated the rules governing its activities but also infringed the constitutional right to property enshrined in Article 45 of the Political Constitution.

SECOND: The respondent denied the allegations and requested dismissal of the action. In essence, he states that it is true that he granted permission to construct the road, which was decided on technical grounds and in accordance with the powers granted to him by law, while also imposing on the builder a series of requirements and conditions that must be met to protect forest resources (recurso forestal). He likewise rejects the allegation of “excessive logging” made against him, asserting that the Dirección General Forestal has supervised that construction. Finally, he reports that the challenged permit was also granted with the authorization of the owners and possessors of the properties through which the road was routed and that, with respect to the petitioner, another person appears in the Registro as the owner of the property he claims as his own.

THIRD: The statutory requirements have been observed in these proceedings.

Drafted by Magistrate Sancho González; and,

CONSIDERING:

I.This constitutional rights action seeks protection of the legally protected interest consisting of forest resources, which ultimately means protecting and preserving the integrity of the natural environment existing at the site where the road giving rise to the dispute was laid out. In response to the question of whether that legally protected interest, in all its dimensions, meaning, and relationships, is a constitutional value or fundamental right, the answer is unquestionably yes. Much is said today about the vital need of humankind—as a species—for such protection and preservation, and its resulting obligation to ensure them. This constitutes a worldwide position from which our country is not exempt, as demonstrated by Costa Rica’s evident interest in participating in international forums where ecological issues are discussed. But the conduct of our people is not manifested only in that way, because domestically—and this is of primary importance—we have also acted by enacting laws intended to provide such protection. Thus, for example, and insofar as relevant here, the Ley Forestal currently in force, No. 7174 of 28 de junio de 1990, provides in Article 1:

“This law establishes as an essential function and priority of the State the duty to ensure the protection, conservation, utilization, industrialization, administration, and promotion of the country’s forest resources, in accordance with the principle of rational use of renewable natural resources.” For its part, consistent with the principle or standard of legal regularity, such legislation and the aforementioned position are grounded in our Constitución Política, which provides as follows in relation to this subject:

“Article 89.- The cultural purposes of the Republic include protecting natural beauty and preserving and developing the Nation’s historical and artistic heritage....” “Article 6.- ...It also exercises—the reference is to the State—special jurisdiction over the seas adjacent to its territory for a distance of two hundred miles from that same line, for the purpose of exclusively protecting, preserving, and exploiting all natural resources and wealth existing in the waters, soil, and subsoil of those areas, in accordance with those principles” (the underlining does not appear in the original).

But that is not all, because Article 69 of the Political Constitution also refers to the “rational exploitation of land,” which constitutes a fundamental principle. Consequently, such protection and preservation, as well as the rational exploitation of the resources mentioned, are tenets of the constitutional order.

II.The case file establishes that the respondent body authorized the road at issue within a forest reserve (reserva forestal) (see resolutions 017-90-DGF and P-322-90 MIRENEM, issued at 10 hrs. 10 mts. on 21 de agosto de 1990, at pages 76-74 and 82-78 of the administrative case file), and that the first of those resolutions, issued by the Dirección General Forestal, stated that it would “not rule on the application... until the Plan de Manejo de la Reserva Forestal Golfo Dulce has been completed”; according to that same resolution, completion was scheduled for octubre de 1990. Furthermore, the second resolution, which granted the challenged permit, contains no reference or evidence indicating that it was issued on the basis of that Plan, and that decision was also dated 21 de agosto de 1990. The importance of the aforementioned “Plan” arises from the fact that the conservation, protection, and preservation of the natural environment and the rational exploitation of natural resources constitute fundamental values.

In this regard, Nombre73662 understands that the Ley Forestal establishes mechanisms or instruments for such conservation, development, and improvement. Those mechanisms are the legislative means for defending or protecting the aforementioned constitutional values. One such instrument is forest planning (planeación forestal), as a technical and objective means that also takes the principle of rational use of renewable natural resources as its standard. In other words, from the perspective of constitutional jurisdiction, forest plans are instruments for implementing and safeguarding the established fundamental principles. In summary, the State may dispose of its forest estate or authorize its utilization by private parties—to the extent and in the manner permitted by law—on the basis of management plans (planes de manejo), which, in accordance with the legal system, may be prepared either by the Administration itself or by private parties (see the following provisions of Ley Forestal, No. 7174: 8, 47, 48, 51, 55, and 61).

Therefore, if the respondent body proceeded without such a plan, it acted to the detriment of the aforementioned fundamental right, violating the Constitution and specifically the principle of legality, because the aforementioned application had to be planned and decided on that technical and legal basis, which was omitted. Accordingly, pursuant to Article 11 of the Fundamental Law, which provides that all public officials—without exception—are mere custodians of public authority and may not assume powers not granted to them by law, the appropriate course is to grant the constitutional rights action and annul the permit issued for construction of that road. This annulment does not extend to the authorizations for “tree cutting” that, as established in the proceedings, have already been granted, because they are deemed rights acquired in good faith. Likewise, this annulment is declared without prejudice to any compensation to which the road builder may be entitled.

Copies of the relevant records must also be certified so that the criminal jurisdiction may assess the facts set forth by the petitioner in his submission received on 19 de julio de 1991 (pp. 32-34 verso).

III.One final observation must be made: this decision is issued without prejudice to any determination made by the ordinary courts concerning title to the property identified by the petitioner.

THEREFORE:

The action is granted and, consequently, resolution number P-322-90 of the Ministerio de Recursos Naturales, Energía y Minas, issued at 10:10 on 21 de agosto de 1990, is annulled. The State is ordered to pay the costs and any damages and losses caused, which shall be assessed, where applicable, through enforcement-of-judgment proceedings before the Contencioso Administrativo jurisdiction. Certified copies of the relevant records shall be forwarded to the Ministerio Público for action within its authority.

02233 Amparo Fecha: 28/05/1993 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta y seis minutos del veintiocho de mayo de mil novecientos novente y tres.

Recurso de amparo interpuesto por Nombre73661 contra el MINISTRO DE RECURSOS NATURALES, ENERGIA Y MINAS, LIC. HERNAN BRAVO TREJOS.

RESULTANDO:

PRIMERO: Alega el recurrente que es dueño de una finca sin inscribir ubicada en Golfito de Puntarenas; que sin su autorización, el Ministerio recurrido otorgó permiso a un empresario miero, para que éste construya una camino que atraviesa por la propiedad del promovente y la REserva Forestal de Golfo Dulce, que servirá para el acceso a áreas de exploración minera; que por causa de la construcción del camino, se ha talado el bosque en forma "desmedida, sin control alguno", siendo que en su fndo -asevera- los árboles cortados "son más de doscientos"; pretendiéndose incluso, por tras personas, sacar la madera del terreno que el accionante posee, para venderla; que la construcción de esa vía traerá una serie de inconvenientes, para los propietarios de la zona y, para la preservación de la rferida reserva, la flor ay la fauna silvestre que ahí existen además de que agravará el probelema que se da en el Parque Nacional de Corcovado con la extracción del oro. Finalmente, argumenta que el órgano recurrido no sólo transgredió la normativa que rige su actividad, sino que también, violentó el derecho constitucional de propiedad, consagrado por el artículo 45 de la Carta Política.

SEGUNDO: El accionado contestó negativamente y solicitó la desestimación del recurso. En lo esencial, expresa que es cierto que concedió el permiso para construir el camino, lo que fue dispuesto en forma ténica y de conformidad con las facultades que la ley le concede, imponiendo además al constructor, una serie de requisitos y condiciones que debe cumplir para la protección del recurso forestal. Asimismo, rechaza el cargo sobre "tala desmedida" que se le atribuye, aseverando que la Dirección General Forestal ha ejercido vigilancia sobre esa construcción. Finalmente, informa que el permiso impugnado, se concedió además, con la autorización de los propietario y poseedores de los fundos por donde se trazó el camino, y que respecto del recurrente, es otra persona la que aparece como dueña en el REgistro, del inmueble que él alega como suyo.

TERCERO: En el pr9oceso se han observado las prescripciones de ley.

Redacta el Magistrao Sancho González; y,

CONSIDERANDO:

I.El presente amparo pretende la tutela del bien jurídico recurso forestal, lo que en último término significa la protección y preservación de la integridad del medio ambiente natural, que existe en el sitio donde se ha trazado el camino que es causa del problema. Ante la interrogante de si es ese bien jurídico, en todo su dimensión, sifnificación y relación, un valor constitucional o derecho fundamental, la respuesta es indudablememente, positiva. Mucho se habla hoy en día de la necesidad vital para el hombre -como género- y de la obligación consecuente, de esa protección y preservación, y esto constituye una actitud de carácter mundial, de la cual nuestro país no está exente, lo que se demuestra por el interés evicente de Costa Rica de participar en los foros internacionales donde se discute el tema ecológico. Pero tal conducta de nuestro pueblo no sólo se manifeista de ea manera, porque intermanente, lo que es primordial, también hemos actuado promnulgando leyes cuyo fin tiende a esa protección. Así por ejemplo, y para lo que aquí interesa, la Ley Forestal vigente, # 7174 de 28 de junio de 1990, dispone en su artículo 1:

La presente ley establece como función esencial y prioridad del Estado, velar por la protección, la conservación, el aprovechamiento, la industrialización, la administración y el fomento de los recursos forestales del país, de acuerdo con el principio de uso racional de los recursos naturales renovables".

Por su parte, en concordancia con el principio o parámetro de la regularidad jurídica, tal normativa y la actitud dicha, tienen fundamento en nuestra Constritución Política, que en lo relacionado con este tema prevé:

"Artículo 89.- Entre los fines culturales de la República están: proteger las bellezas naturales, conservar y desarrollar el patrimonio histórico y artístico de la Nación...".- "Artículo 6.- ...Ejerce además, -se refiere al Estado- una jurisdicción especial sobre los mares adyacente a su territorio en una extensión de doscientas millas a partir de la misma línea, a find de proteger, conservar y explotar con exlucisividad todos los recursos y riquezas naturales existentes en las aguas, el suelo y el subsuelo de esas zonas, de conformidad con aquellos principios" (las líneas del subrayado no son del original).

Pero eso no es todo, porque también en la norma 69, de la Carta Política habla de la "explotación racional de la tierra", lo que constituye un principio fundamental. En consecuencia, son cánones del orden constitucional, aquella protección y preservación, así como la explotación racional de los recursos que se han indicado.

II.Consta en el expediente que el órgano accionado autorizó el camino en discusión, dentro de una reserva forestal (véanse en el expediente administrativo las resoluciones 017-90-DGF y P-322-90 MIRENEM de las 10 hrs. 10 mts. del 21 de agosto de 1990, a folios 76-74 y 82-78) y que en la primera de dichas resoluciones dictada por la Dirección General Forestal .........."no resolver sobre la solicitud... hasta tanto se concluya el Plan de Manejo de la REserva Forestal Golfo Dulce"; que estaba proyectado para concluirse, según la misma resolución, en octubre de 1990. Por otra parte, no aparece en la segunda resolución que dio el permiso impugnado, ninguna alusión o evidencia, de que se hubiere dictado con base en ese Plan, siendo además, esta decisión, del 21 de agoto de 1990. La impo4tancia del referido "Plan" proviene de que conforma valores fundamentales la conservación, protección y preservación del medio ambiente natural y explotación racional de los recursos naturales.

En ese sentido, las Nombre73662 entiende que la Ley Forestal consigna mecanismos o instrumentos para la conservación, el desarrollo y el mejoramiento dichos. Esos mecanismos son los medios legislativos de defensa o protección de los valores constitucionales dichos. Uno de esos instrumentos es la planeación forestal, como medio técnico y objetivo, que tiene además como parámetro, al principio del uso racional de los recursos naturales renovables. Es decir, los planes forestales, vistos desde la perspectiva de la jurisdicción constituciona, son instrumentos para hacer efectivos y resguardar los principios fundamentales consignados. En síntesis, el EStado podrá disponer, de su patrimonio forestal, o autorizar el aprovechamiento por parte de los administrados -en la forma y medida en que la ley lo faculta-, con base en planas de manejo, que de conformidad con el ordenamiento jurídico, pueden ser elaborados por la propia Administración o los particulares (véanse las siguientes normas de la Ley Forestal, # 7174: 8, 47, 48, 51, 55 y 61).

De manera que, si el órgano accionado procedió sindicho plan, actuó en detrimento del referido derecho fundamental, quebrantando la Constitución, y específicamente el principio de legalidad, dado que era necesario haber programado y decidido la supradicha solicitud, con esa base tpénica y legal, que se omitió,. Por lo anterior, con fundamento en lo previsto por el rtículo 11 de la Ley Fundamental, que prescribe que los funcionarios públicos -todos, sin escepción- son simples depositarios de la autoridad y no pueden arrogarse facultades que la ley no les concede, lo correspodientes es acoger el amparo y anular el permiso que se concedió para la construcción de esa vía; nulidad que no se extiende a las autorizaciones para "corta de árboles" que ya fueron otorgadas -según consta en el proceso-, por tenérseles como derechos adquiridos de buena fe. Del mismo mode, esa nulidad, se declara sin perjuicio de las indemnizaciones a que tenga derecho el constructor de la vía. También, procede testimoniar piezas a efecto de que en la jurisdicción penal se valores los hechos expuestos por el recurrente en su escrito recibido el 19 de julio de 1991 (fs.32-34 v).-

III.Una última observación debe hacerse en el sentido de que, este fallo se dicta sin perjuicio de lo que en la jurisdicción ordinaria se resuelva, acerca de la titularidad sobre el inmueble que indica el accionante.

POR TANTO:

Se declara con lugar el recurso y en consecuencia, se anula la resolución del Ministerio de REcursos Naturales, Energía y Minas, número P-322-90 de las 10:10 horas del 21 de agosto de 1990. Se concena al Estado al pago de las costas, daños y perjuicios causados, los que se liquidarán, en su caso, en la vía de ejecución de sentencia de lo Contencioso Administrativo. Testimoníense piezas para ante el Ministerio Público, para lo de su cargo.
