Decision No. 2016009493 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine forty-five a.m. on ocho de julio de dos mil dieciséis.

Constitutional challenge (acción de inconstitucionalidad) brought by José Francisco Alfaro Carvajal, of legal age, married, bearer of identity card No. 0105180468, resident of Concepción de San Rafael de Heredia, against Articles 27 and 29 of the Ley Forestal and Articles 90 and 91 of its Regulations, Decreto Ejecutivo No. 25721-MINAE of 17 de octubre de 1996.

Background:

  1. 1By a written submission received by the Secretariat of the Chamber at eleven seventeen a.m. on veintitrés de febrero de 2016, the petitioner, together with other signatories, requests that the members of the Legislative Assembly be ordered to take the appropriate action to ensure immediate compliance with Decision No. 2007-003923 and to remedy the absence of precautionary measures (medidas precautorias) ensuring the proper application of Article 28 of the Ley Forestal.
  2. 2By a decision issued at one forty-seven p.m. on uno de marzo de 2016, the Justice assigned to the constitutional challenge granted the president of the Legislative Assembly, Mr. Rafael Ortiz Fábrega, a hearing for fifteen business days so that he could address the allegations and submit the evidence relating to the acts and omissions attributed to him.
  3. 3By a written submission filed at one forty-two p.m. on veintiocho de marzo de 2016, the president of the Legislative Assembly opposes the applicants’ claim. Specifically, he states that, following the declaration of unconstitutionality, the following legislative initiatives were introduced: File No. 18765, entitled “Amendment to Article 28 of the Ley Forestal,” which proposed that, before authorization to cut down trees could be obtained, an ex ante inspection would be required, from which any mitigation and precautionary measures necessary to protect the environment could result. The bill entered the legislative process on 7 de mayo de 2005 and was archived on 15 de diciembre de 2015 after receiving a Unanimous Negative Report from the Special Environmental Committee, because it was considered not to meet the requirements of the judgment of unconstitutionality and because other initiatives could remedy the situation.He clarifies that the report does not specify what those initiatives were. The other initiative, File No. 17472, “Amendment to Article 28 of the Ley Forestal,” entered the legislative process on 4 de agosto de 2009 but was archived on 6 de agosto de 2013 upon expiration of the four-year period. Specifically, it sought to provide legal certainty for investments in forest plantations and proposed not to incorporate precautionary measures, but instead to establish a procedure for proceeding without authorization in cases where a management plan (plan de manejo) already existed, which essentially required adherence to that plan, or, where no such previously approved plan existed, certification by an environmental manager (regente ambiental) that no harm would be caused. This file was archived. These are the only two initiatives that could be identified: one aimed at legislating as directed by the Chamber, and the other instead responding to that decision by seeking to restore the original purpose of the provision.

Moreover, he states that the petitioner seeks to give it the effects of a judgment in an amparo proceeding (recurso de amparo) against material actions or administrative acts of public officials and the Administration in general, but not against acts belonging to the Branches of Government themselves and, in particular, not against generally applicable laws enacted by the Legislative Assembly, as expressly provided in Article 30(a) of the Ley de la Jurisdicción Constitucional. The regulations governing such proceedings are set forth in Articles 53 and 71 of the aforementioned law. The regulations governing constitutional challenges begin in Title IV, under which judgments in constitutional challenges have declaratory effect, bearing solely on the effectiveness or validity of the challenged or contested provision (Article 91 of the Ley de la Jurisdicción Constitucional). It is improper and manifestly inadmissible to allege noncompliance with a judgment in a constitutional challenge that never established a specific deadline but merely found Article 28 of the Ley Forestal unconstitutional by omission (inconstitucionalidad por omisión).

The operative portion (por tanto) of Judgment No. 2007-03923 merely establishes that the Legislative Assembly has jurisdiction to remedy the identified omission; it in no way contains an express order to legislate, much less a specific deadline for doing so. The Chamber must take into account that Article 105 of the Constitución Política itself establishes the principle of legislative sovereignty, clearly stating that: “the power to legislate resides in the people, who delegate it to the Legislative Assembly through suffrage. Such power may not be relinquished or subjected to limitations through any agreement or contract, directly or indirectly….” It is clear that the Legislative Assembly is the body that legislates and that the Constitutional Chamber may identify omissions—unconstitutionality by omission—but may not decide when or how legislation is to be enacted because, in that event, it would assume the functions of the legislature.

The situation is different where there is an express constitutional mandate to legislate, in which case the order or mandate derives from the Constitution itself and the Constitutional Chamber merely applies that provision. Notice of the judgment to the Legislative Assembly does not have the same scope as notice given in an amparo proceeding. It is therefore established that alleging noncompliance with a judgment in a constitutional challenge is wholly inadmissible where that judgment merely declared an omission unconstitutional and only observed or established that the Legislative Assembly has jurisdiction to remedy that omission, but the Chamber never issued any order. He requests that the application be denied.

  1. 4Article 12 of the Ley de la Jurisdicción Constitucional provides that judgments issued by the Chamber may be clarified or supplemented at the request of a party if requested within three days, and by the Chamber on its own initiative at any time, including during enforcement proceedings, insofar as necessary to ensure full compliance with the substance of the decision.

Drafted by Justice Cruz Castro; and,

Considerations:

I.Arguments of the president of the Legislative Assembly.- Mr. Rafael Ortiz Fábrega, in his capacity as president of the Legislative Assembly, reports that two bills were processed for the purpose of addressing the gap identified by the Chamber in its Judgment No. 2007-3923 of fifteen hours and two minutes on 21 de marzo de 2007; although they entered the legislative process, they were not approved by the legislative plenary. Based on the statements made at this hearing, the only two bills that could be identified were: one intended to comply with the decision, and the other intended to restore the original purpose of the provision declared unconstitutional. Thus, one of the primary objectives of the hearing granted by this Chamber to the Legislative Assembly has been achieved: namely, to determine whether a bill intended to fill the regulatory gap (vacío normativo) declared unconstitutional by the judgment does in fact exist in the legislative process and, among other things, to determine its progress or status. Specifically, however, there are no further elements supporting the conclusion that another bill aimed at resolving that gap, within the parameters established by the Chamber and thereby remedying the constitutional violations identified in the aforementioned judgment, has been introduced in the Legislative Assembly.

Furthermore, the president of the Legislative Assembly states that the judgment in question presents several problems. First, the noncompliance procedure that is being invoked does not apply to declaratory proceedings concerning the unconstitutionality of provisions or unconstitutional omissions, whose effect is very different, since such a procedure is intended to adjudicate acts or omissions in amparo and habeas corpus proceedings, which serve to declare constitutional violations arising from material omissions and omissions by administrative authorities. Second, it has significant implications that this Chamber must address, since the president of the Legislative Assembly invokes a prerogative of the Legislative Branch set forth in Article 105 of the Constitución Política, under which representation of the people is vested in the members of the Legislative Assembly and the sovereignty of the people is delegated to their representatives, thereby conferring responsibility for directing and managing the legislative process. Finally, as a third issue, the reporting president states that the operative portion contains no specific order with which to comply.

II.Analysis by the Chamber. The first step is to transcribe the concluding and operative portions of Judgment No. 2007-003923, issued at fifteen hours and two minutes on veintiuno de marzo de dos mil siete, which established that:

“… in light of the foregoing, this Chamber considers that this case involves relative unconstitutionality by omission (inconstitucionalidad por omisión relativa). Nevertheless, although the Constitutional Chamber has jurisdiction to declare a provision unconstitutional, a violation of this nature must be remedied by the Legislative Assembly by extending the application of the law to cases not expressly contemplated therein, such as, in this case, the species and areas left unprotected under the current definition of forest, as well as by adopting prevention and control measures for areas in which tree cutting is permitted. In light of all the foregoing, we conclude that the challenged Article 28 violates Article 50 of the Constitución Política. However, to avoid violating the principle of separation of powers, we deem it appropriate to grant the Legislative Assembly a reasonable period within which to remedy the identified violation.

VI.Conclusion. In light of all the foregoing, the challenge is granted solely with respect to the relative omission in Article 28 of the Ley Forestal to establish precautionary measures ensuring the protection of the environment in this regard. In all other respects, the challenge is denied. Justice Jinesta dissents and would deny the challenge.

Therefore:

The challenge is granted solely with respect to the omission in Article 28 of the Ley Forestal to establish precautionary measures ensuring the protection of the environment. The Legislative Assembly shall remedy the absence of precautionary measures ensuring, in advance, the proper application of Article 28 in protection of the environment, as stated in the considerations of this judgment. Notice of this judgment shall be given to the Legislative and Executive Branches. This ruling shall be summarized in the Official Gazette “La Gaceta” and published in full in the Boletín Judicial. In all other respects, the challenge is denied. Justice Jinesta dissents and would deny the challenge.” In accordance with the report submitted by the President of the Asamblea Legislativa, and given that more than a reasonable period has elapsed for undertaking the amendment identified in the transcribed judgment, it is appropriate to reiterate the order issued in judgment number 2007-003923 de las quince horas y dos minutos del veintiuno de marzo de dos mil siete, requiring the Asamblea Legislativa to enact the precautionary measures (medidas precautorias) necessary to ensure environmental protection in the application of artículo 28 de la Ley Forestal, as indicated in the reasoning section (parte considerativa) of the decision alleged to have been disregarded.

Furthermore, it is necessary to establish, from a procedural standpoint, that although the report was submitted by Mr. Rafael Ortiz Fabrega, former President of the Asamblea Legislativa, it is likewise public and well known that, as of 1° de mayo, there is a new legislative term and a new composition of the Directorio Legislativo; accordingly, the order is directed to its new President, Antonio Álvarez Destanti, who, by virtue of his position, must endeavor to accomplish this task.-

III. Dissenting Opinion (Voto Salvado) of Justice Castillo Víquez

As may be seen from the foregoing, despite the Court’s intention to establish a time limit for supplementing the law that it found deficient—an issue that is highly controversial in legal scholarship and case law, as intimated by the President of the Asamblea Legislativa—the fact remains that the Court did not so provide in the operative part (parte dispositiva) of the judgment; instead, a “reasonable” period was left for the legislature to amend artículo 28 de la Ley Forestal. It is true that unconstitutionality by omission (inconstitucionalidad por omisión) entails specific effects regarding legislative inaction when a constitutional or international obligation imposes certain specific duties on the Costa Rican State. Thus, guided by the operative part, and although the issue of a “reasonable” period was mentioned in the reasoning section, the result is that this Chamber did not define it; consequently, it would indeed be left to the legislature’s sound judgment and discretion to determine the manner, timing, and appropriate occasion for deciding how it will comply with the aforementioned judgment.

IV. Note of Justice Rueda Leal.-

In judgment number 2015-11533 de las 11:46 horas del 26 de julio de 2015, concerning an application alleging noncompliance (gestión por incumplimiento) with the ruling in a constitutional challenge (acción de inconstitucionalidad), this Chamber held as follows:

“After examining the case, the Chamber considers that the application alleging disobedience (gestión de desobediencia) must be dismissed for the following reasons. The proceeding in which that judgment was rendered concerned the constitutionality of the challenged provision, as governed by artículos 73 y siguientes de la Ley de la Jurisdicción Constitucional. Accordingly, on that occasion this Court undertook to examine the challenged provisions in light of the body of constitutional law (bloque de constitucionalidad) and thereby determined the constitutional parameters applicable to those provisions, which were ultimately set forth in the operative part of the respective judgment. Thus, the decision does not establish a specific order imposed by the Chamber on any authority, nor does it even contain a duty to perform any specific action; rather, as stated above, it established the constitutional parameters applicable to the provision.

In that regard, in order to allege disobedience of a judgment of the Chamber, there must necessarily be an order directed to a specified or ascertainable official, with a warning of the legal consequences of noncompliance, and the order must also be personally served. It should even be noted that disobedience of the Chamber’s orders is punishable by law in amparo and habeas corpus proceedings (but not in constitutional challenges), since it is in those proceedings that such orders are issued (artículos 71 y 72 de la Ley de la Jurisdicción Constitucional). Accordingly, because the judgment at issue contains no order directed to any specific authority, it is legally improper to file an application alleging disobedience (see, to the same effect, resoluciones Nº 2015-1475 de las 14:30 horas del 3 de febrero de 2015 y Nº 2013-13347 de las 14:30 horas del 9 de octubre de 2013) …” (Emphasis not in the original).

In the case under examination (sub examine), the operative part of judgment number 2007-003923 de las 15:02 horas del 21 de marzo de 2007 (in whose drafting I did not participate) does not appear to have issued any order directed to a specific authority, since it actually refers to the Asamblea Legislativa in general. For that reason, in this particular case, it is not appropriate to certify and refer the relevant portions of the record (testimoniar piezas) under the terms of Capítulo IV de la LJC.

The foregoing does not prevent the Chamber from seeking enforcement of its judgments, including in constitutional challenges, since artículo 56 de la LJC provides that “the enforcement of judgments falls to the Sala Constitucional, except with respect to the assessment and payment of compensation and monetary liabilities, or in other matters that the Chamber itself deems appropriate, in which case enforcement shall proceed through the contentious-administrative jurisdiction under the judgment-enforcement procedure provided for in the law governing that jurisdiction.” That provision does not distinguish among constitutional proceedings, since otherwise the principle of constitutional supremacy would be impaired in its essential content.

Consequently, I agree with the majority that the President of the Asamblea Legislativa should again be directed to comply with the provisions of the judgment that is the subject of this application.

V. Separate Note of Justice Hernández López.-

Our legal system does not grant, under the Ley de la Jurisdicción Constitucional, any authority to compel the Asamblea Legislativa to respect the constitutional order within a specified period, unless the Constitution itself establishes such a period or imposes a specific obligation to act or refrain from acting upon the Asamblea Legislativa. Other legal systems—generally those of developed countries—provide remedies for situations of this kind and expressly grant Constitutional Courts the authority to compel Parliament to comply with an order or even to issue substitute rules while the omission is remedied. However, in the absence of an express provision to that effect, I consider that the Chamber may not prescribe specific time limits for the Poder Legislativo to remedy a constitutional omission. Accordingly, what this Court may do in fulfillment of its duty is identify the omission so that the Asamblea Legislativa may determine how and when to remedy it, which has already occurred in this case through the cited ruling.

This is undoubtedly a problem of constitutional design that must eventually be remedied, because in a constitutional state governed by the rule of law, all constituted bodies and branches of government are subordinate to the Constitution and must therefore, without exception, be subject to it. Allowing zones of immunity to exist prolongs an unconstitutional state of affairs in certain areas and erodes the democratic system as a whole.

Those bearing the foremost obligation to comply with the rule of law are the representatives of the nation, and in this case there is an evident inertia that is moreover becoming customary when compliance with the Constitution is at issue, since there are several cases in this situation. This reflects the fact that, for some, the oath to uphold the Constitution as their first act upon assuming office is merely symbolic.

In that regard, as I stated when the noncompliance with the judgment issued in expediente 10-00477 was considered, the foregoing does not mean that, as a constituted body, the Asamblea Legislativa is not required to comply with the Constitución Política. Thus, in a State governed by the rule of law, once an unconstitutional omission on its part has been declared, it is required to remedy it. Nevertheless, out of respect for its status and function as a Branch of the Republic, it must do so according to its own timetable and procedures, while seeking to comply within a reasonable period.

Having said that, and by reason of that same respect for the formal and substantive order of the Fundamental Charter (Carta Fundamental), I am required to comply with, and to ensure compliance through appropriate means with, what has been ordered in a valid and effective judgment of the Sala Constitucional—even though I did not join it—and for that reason I concur in the decision made herein to reiterate to the Asamblea Legislativa the provisions of the cited judgment 2007-003923.

VI. Separate Note of Justice Cruz Castro.-

There is no need to impose a time limit on Parliament, because its legal and political status does not require a coercive instrument compelling it to fulfill its institutional obligations. The first branch of the Republic has an unavoidable obligation to comply with a judicial decision, particularly when the matter concerns environmental protection. Even with a time limit, there are too many ambiguities, fostered by those in power, that prevent compliance with a judgment of this Court. At the highest levels of government, there must be institutional self-restraint (autocontención) that imposes the obligation to comply with a mandate issued by a court constitutionally entrusted with safeguarding society’s fundamental compact. Whether Parliament was or was not given a time limit is a technical nicety that does not resolve a flagrant failure to fulfill a fundamental obligation. When one branch of government disregards a judicial mandate, it commits an arbitrary act by refusing to recognize the substance of a judicial mandate that would indeed be enforceable against all other citizens.

I cannot imagine the Ministerio Público investigating Parliament for knowingly failing to comply with a judicial mandate. Here, self-restraint and institutional prudence are indeed warranted. The mandate contained in the judgment is very clear, particularly when the following paragraph of the judgment is read (voto 3923-2007):

“…..As already explained, the provision is deficient because the Ley Forestal does not provide for prior measures, which may range from authorization to an inspection before the trees are felled, irrespective of their nature and the size of the area. The legislature’s failure to provide for preventive measures in this regard constitutes what is known as relative unconstitutionality by omission (inconstitucionalidad por omisión relativa). This omission arises in cases where a statutory provision regulates a particular legal situation but does so defectively, omitting one of its dimensions from that regulation. In this type of silence, the subject of review is the explicit statutory rule, even though the basis for challenging it is not its text, but precisely what the text does not say, and that omission creates a situation contrary to the Constitution. A typical example of unconstitutionality by omission (inconstitucionalidad por omisión) is found in the provisions of a law that violate the principle of equality (principio de igualdad), either because they expressly exclude, without any apparent reason, a particular group of individuals from a benefit to which they would be entitled or in which they would have a legitimate expectation; or because, in regulating that benefit, the provision grants it to a particular group and remains silent as to everyone else (as in the case before us).

According to legal scholarship, a provision may remain silent regarding a legal situation that warrants protection because the Constitution so requires. An implicit rule may therefore be derived from the provision, regulating the legal situation subject to constitutional protection differently from the explicit rule, as in this case with the right to a healthy and ecologically balanced environment (derecho a un ambiente sano y ecológicamente equilibrado), which implicitly encompasses the precautionary principle (principio de precaución). According to the analysis conducted of the challenged article, the legislature modified the concept of forest (bosque) upon which the protections, restrictions, and permits granted under the Ley Forestal are based—as is the case with article 28 at issue, ‘Exemption from a felling permit (Excepción de permiso de corta)’—thereby restricting, without technical grounds, the former concept of forest contained in the law before its amendment.

Consequently, non-native species and forested areas smaller than two hectares were left without statutory protection, with the result that, under the challenged article 28, no permit to fell trees, or even prior inspection, is required to ensure that the circumstances are those the provision sought to encourage: any forest plantation (plantación forestal), agroforestry system (sistema agroforestal), or any planted tree. This leaves exposed areas that, because of their location, size, and the function they have performed for many years, warrant conservation and regulation of their felling, irrespective of the nature of the species and the nature of the land on which they are located. Accordingly, in light of the foregoing, this Chamber finds that relative unconstitutionality by omission exists in this case. Nevertheless, although the Constitutional Chamber has jurisdiction to declare a provision unconstitutional, a violation of this nature must be remedied by the Legislative Assembly by extending the application of the law to cases not expressly contemplated therein, such as, in this case, the species and areas left unprotected under the current concept of forest, and by adopting prevention and oversight measures for the areas in which felling is permitted.

For all the foregoing reasons, we find that the challenged article 28 violates article 50 of the Political Constitution. However, in order not to violate the principle of separation of powers (principio de separación de poderes), we consider it appropriate to grant the Legislative Assembly a reasonable period within which to remedy the stated violation….”.

This mandate from a court of the Republic is clear: Parliament, as the preeminent branch of government in a democratic state, must comply with a constitutionally imposed obligation. Nevertheless, nine years have passed, and the citizens’ representatives believe that they are not required to comply with that mandate, despite the environmental harm caused by their omission. This is an obligation to the environment, and failure to fulfill it demonstrates the weakness of their commitment to safeguarding Mother Nature. The country known worldwide for its commitment to the environment, which has declared peace with nature, knowingly fails to honor its commitment to safeguarding Mother Earth. Noncompliance with the judgment becomes irrelevant, whether or not a deadline was imposed, because Parliament could not be subjected to proceedings for disobedience: when dealing with the most important formal branches of government, compliance is secured not through coercion but through conviction and the values of a political culture that voluntarily submits to a judicial mandate without the need for coercion.

It is not a good sign for democracy or for the continued vitality of the social and democratic rule-of-law state (estado social y democrático de derecho) that Parliament should fail for nine years to comply with a judicial mandate. Prudence, self-restraint, and moderation are the virtues of power, demonstrated in each of its actions. Deadlines and coercive measures should not be necessary for the citizens’ representatives to comply with the mandate of a court constitutionally entrusted with protecting fundamental rights (derechos fundamentales). It must not be forgotten that the legitimacy of a branch of government derives not from its laws or coercive power, but from acceptance of its mandate without the need for compulsion. Just as citizens strengthen the legitimacy of government when they comply with a mandate, those who exercise formal authority, such as Parliament, likewise disregard the legitimacy of the system when they knowingly disobey a judgment.

Prolonged disobedience is a troubling sign of a branch of government that disregards the obligations arising from the Constitution. In a Republic, those who exercise authority are expected to comply with what a constitutional court has ordered. This is a situation in which the ethics of power must prevail, without dependence on deadlines or coercive instruments.

VII.For all the foregoing reasons, the appropriate course is to reiterate the order issued by this Chamber in judgment number 2007-003923 de las quince horas y dos minutos del veintiuno de marzo de dos mil siete, directing the Legislative Assembly to enact, with respect to article 28 of the Ley Forestal, the precautionary measures (medidas precautorias) necessary to ensure protection of the environment.

Justice Castillo Víquez dissents and declares that the application submitted must be denied. Justices Cruz Castro and Rueda Leal and Justice Hernández López submit separate opinions.

Por tanto:

Antonio Álvarez Desanti, in his capacity as president of the Legislative Assembly, or whoever holds that office, is again ordered to comply with the provisions of judgment number 2007-003923 de las quince horas y dos minutos del veintiuno de marzo de dos mil siete, by ensuring that the Legislative Assembly enacts, with respect to article 28 of the Ley Forestal, the precautionary measures necessary to ensure protection of the environment. Let notice be given, a summary prepared, and this judgment published in full.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas cuarenta y cinco minutos del ocho de julio de dos mil dieciséis.

Acción de inconstitucionalidad promovida por José Francisco Alfaro Carvajal, mayor, casado, portador de la cédula de identidad No. 0105180468, vecino de Concepción de San Rafael de Heredia; contra los artículos 27 y 29 de la Ley Forestal y los artículos 90 y 91 de su Reglamento, Decreto Ejecutivo No. 25721-MINAE de 17 de octubre de 1996.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las once horas diecisiete minutos del veintitrés de febrero de 2016, el accionante junto a otros firmantes solicitan que se le prevenga a los diputados (as) de la Asamblea Legislativa realizar lo que corresponda para que inmediatamente se cumpla lo ordenado en la resolución No. 2007-003923, y para que se remedie la ausencia de medidas precautorias que aseguren la correcta aplicación del artículo 28 de la Ley Forestal.
  2. 2Por resolución de las trece horas cuarenta y siete minutos de uno de marzo de 2016, el magistrado instructor de la acción otorgó audiencia por quince días hábiles al presidente de la Asamblea Legislativa, señor Rafael Ortiz Fábrega, para que se refiriera a lo denunciado y aportara las pruebas correspondientes a los hechos y omisiones que se le atribuyen.
  3. 3Por escrito presentado a las trece horas cuarenta y dos minutos del veintiocho de marzo de 2016, el presidente de la Asamblea Legislativa se opone a la pretensión de los gestionantes. En concreto, señala que a raíz de la declaratoria de inconstitucionalidad fueron presentados las siguientes iniciativas de Ley: que proponía que, previo a contar con la autorización para talar árboles, debía contarse con una inspección ex ante, de la cual podían resultar las medidas de mitigación y precautorias que fueran necesarias para la protección del ambiente. El proyecto ingresó a la corriente legislativa de 7 de mayo de 2005, y fue archivado el 15 de diciembre de 2015, a causa de recibir Dictamen Unánime Negativo en la Comisión Especial de Ambiente, porque se consideró que no cumplía con los requerimientos de la sentencia de inconstitucionalidad, y porque había otras iniciativas que podrían subsanar la situación.Aclara que el dictamen no aclara cuáles era esas iniciativas. El otro, Expediente No. 17472 “Reforma al artículo 28 de la Ley Forestal”, fue presentado a la corriente legislativa el 4 de agosto de 2009, pero fue archivado por vencimiento del plazo cuatrienal el 6 de agosto de 2013. Precisamente, intentaba dar certeza jurídica a las inversiones en plantaciones forestales, y proponía no incorporar medidas precautorias, sino un procedimiento para proceder sin autorización en los casos en que ya exista un plano de manejo, que básicamente era apegarse a él, o contar con la certificación de un regente ambiental de que no se produciría un daño, cuando no se contara con eses plan previamente aprobado. Este expediente fue archivado. Estas son las dos únicas iniciativas que se ha logrado identificar: una tendiente a legislar en el sentido que lo indicó la Sala y la otra más bien como respuesta a ese fallo, buscando rescatar el espíritu original de la norma.

Más aún, señala que el accionante busca conferirle efectos de una sentencia de amparo contra acciones materiales o actos administrativos de servidores públicos y de la Administración en general, pero no en contra de los actos propios de los Poderes del Estado, y en particular, no contra las leyes de carácter general que dicta la Asamblea Legislativa, según dispone expresamente en el artículo 30 inciso a) de la Ley de la Jurisdicción Constitucional. Las regulaciones propias de estos procesos están en los artículos 53 y 71 de la ley mencionada. Las regulaciones de las acciones comienzan a partir del Título IV, donde las sentencias de las acciones de inconstitucionalidad tienen un efecto declarativo, los cuales recaen únicamente sobre la eficacia o validez de la norma cuestionada o impugnada (artículo 91 de la Ley de la Jurisdicción Constitucional). Es indebido y manifiestamente improcedente, acusar de desobediencia a una sentencia de acción de inconstitucionalidad que nunca ordenó plazo concreto, sino que, simplemente, se limitó a constatar la inconstitucionalidad por omisión del artículo 28 de la Ley Forestal.

En el por tanto de la sentencia No. 2007-03923 únicamente se constata que es la Asamblea Legislativa la competente para subsanar la omisión señalada, pero, de ningún modo, hay una orden expresa de legislar, ni mucho menos, un plazo concreto para hacerlo. Debe tomar en cuenta la Sala que la propia Constitución Política establece el principio de soberanía de la ley en el artículo 105, que diáfanamente señala que: “que la potestad de legislar reside en el pueblo, el cual la delega en la Asamblea Legislativa por medio del sufragio. Tal potestad no podrá ser renunciada ni estar sujeta a limitaciones mediante ningún convenio o contrato, directa o indirectamente…”. Está claro que la Asamblea Legislativa es quien legisla, y que la Sala Constitucional puede constatar omisiones (inconstitucionalidad por omisión), pero no decidir cuándo ni cómo se legisla, porque, en este caso, asumiría las funciones del legislador.

Diferente ha sido cuando existe expresamente un mandato constitucional de legislar, en cuyo caso la orden o mandato deviene de la misma Constitución, y la Sala Constitucional se limita a aplicar dicha norma. La notificación de la sentencia a la Asamblea Legislativa no tiene los mismos alcances que la que se notifica en un recurso de amparo. Queda asentado que es absolutamente improcedente acusar de desobediencia en el cumplimiento de una sentencia de una acción de inconstitucionalidad, que únicamente declaró una inconstitucionalidad por omisión, y se limitó a observar o constatar que la Asamblea Legislativa es la competente para subsanar tal omisión, pero que la Sala nunca giró orden alguna. Solicita se rechace la solicitud.

  1. 4El artículo 12 de la Ley de la Jurisdicción Constitucional señala que las sentencias que dicte la Sala podrán ser aclaradas o adicionadas a petición de parte, si se solicitare dentro de tercero día, y de oficio en cualquier tiempo, incluso en los procedimientos de ejecución, en la medida en que sea necesario para dar cabal cumplimiento al contenido del fallo.

Redacta el Magistrado Cruz Castro; y,

Considerando:

I.Alegatos del presidente de la Asamblea Legislativa.- El señor Rafael Ortiz Fábrega, en su condición de presidente de la Asamblea Legislativa, informa que fueron tramitados dos proyectos de ley cuyo fin era atender el vacío señalado por la Sala en su sentencia No. 2007-3923 de las quince horas dos minutos del 21 de marzo de 2007, que si bien ingresaron a la corriente legislativa no gozaron de su aprobación por el plenario legislativo. Con base en lo señalado en esta audiencia, se tiene que los únicos dos proyectos que se pudieron identificar fueron: uno para dar cumplimiento a lo resuelto, y el otro, para retomar el espíritu original de la norma declarada inconstitucional. Por lo tanto, se logra uno de los primeros objetivos de la audiencia otorgada por esta Sala a la Asamblea Legislativa, es decir, constatar si en efecto existe en la corriente legislativa un proyecto de ley, determinar cuál es su avance o progreso, entre otras cosas, tendiente a llenar el vacío normativo declarado inconstitucional por la sentencia. Pero en forma concreta, no hay más elementos que permitan concluir que la Asamblea Legislativa tiene presentado otro proyecto de ley tendiente a solucionar ese vacío, dentro de los parámetros señalados por la Sala, y con ellos, solventar las violaciones constitucionales indicadas en la mencionada sentencia.

Por otra parte, el presidente de la Asamblea Legislativa expresa que la referida sentencia adolece de varios problemas: el primero, es que el procedimiento por incumplimiento que se intenta aplicar, no corresponde a un proceso declaratorio de inconstitucionalidad o de omisión inconstitucional de normas, cuyo efecto es muy distinto, toda vez que estaría dispuesto para juzgar actos u omisiones en los recursos de amparo y habeas corpus, los que sirven para declarar las infracciones constitucionales contra omisiones materiales y de las autoridades administrativas. De segundo, tiene repercusiones importantes que esta Sala debe abordar, toda vez que el presidente de la Asamblea Legislativa invoca una prerrogativa del Poder Legislativo, señalado en el artículo 105 de la Constitución Política, con el que se deposita la representación del pueblo en los (las) legisladores (as) de la Asamblea Legislativa, y por la delegación de la soberanía del pueblo a favor de sus representantes, lo que implica la dirección como el manejo para legislar. Finalmente, como tercer tema el presidente informante expresa que la parte dispositiva no contiene una orden concreta que cumplir.

II.Análisis de la Sala. Lo primero que debe hacer es transcribir la parte final y dispositiva de la sentencia No. 2007-003923 de las quince horas dos minutos del veintiuno de marzo de dos mil siete, en la que se estableció que:

“… esta Sala considera de conformidad con lo expuesto, que en este caso, se produce una inconstitucionalidad por omisión relativa. No obstante, si bien la Sala Constitucional es la competente para declarar la inconstitucionalidad de una norma, una violación de esta naturaleza debe ser subsanada por la Asamblea Legislativa, extendiendo la aplicación de la ley a los casos no contemplados expresamente por ella, como en este caso, a las especies y áreas que quedaron desprotegidas en el concepto de bosque actual, así como tomar medidas de prevención y control sobre las áreas en las que son permitidas la tala. Por todo lo expuesto, estimamos que el artículo 28 cuestionado lesiona el artículo 50 de la Constitución Política. Sin embargo, con el fin de no violentar el principio de separación de poderes, resulta procedente a nuestro criterio, otorgar un plazo prudencial a la Asamblea Legislativa para que subsane la violación indicada.

VI.Conclusión. Por todo lo expuesto, la acción se declara con lugar únicamente por la omisión relativa del artículo 28 de la Ley Forestal de establecer medidas precautorias que aseguren la protección del ambiente respecto. En lo demás, se declara sin lugar la acción. El Magistrado Jinesta salva el voto y declara sin lugar la acción.

Por tanto:

Se declara con lugar la acción únicamente, por la omisión del artículo 28 de la Ley Forestal de establecer medidas precautorias que aseguren la protección del ambiente. Corresponde a la Asamblea Legislativa subsanar la ausencia de medidas precautorias, que aseguren de previo, la correcta aplicación de lo dispuesto en el artículo 28 en tutela del ambiente, según lo señalado en la parte considerativa de esta sentencia. Comuníquese esta sentencia a los Poderes Legislativo y Ejecutivo. Reséñese este pronunciamiento en el Diario Oficial “La Gaceta” y publíquese íntegramente en el Boletín Judicial. En lo demás, se declara sin lugar la acción. El Magistrado Jinesta salva del voto y declara sin lugar la acción”.

De conformidad con lo informado por el presidente de la Asamblea Legislativa, y habiendo transcurrido sobradamente un tiempo razonable para proceder a la reforma señalada en la sentencia transcrita, lo propio es reiterar la orden emitida en la sentencia número 2007-003923 de las quince horas y dos minutos del veintiuno de marzo de dos mil siete, para que la Asamblea Legislativa dicte las medidas precautorias que permitan asegurar la protección del ambiente en la aplicación del artículo 28 de la Ley Forestal, tal y como se indica en la parte considerativa de la resolución que se acusa como incumplida. Por otra parte, siendo necesario establecer desde el punto de vista procesal que si bien el informe fue rendido por el señor Rafael Ortiz Fabrega, anterior presidente de la Asamblea Legislativa, es de igual manera público y notorio, que a partir del 1° de mayo hay una nueva legislatura e integración del Directorio Legislativo, se imparte la órden a su nuevo presidente, Antonio Álvarez Destanti, en cuya posición debe procurar este cometido.-

III. Voto Salvado del magistrado Castillo Víquez

Como se observa de lo anterior, a pesar de la intención del Tribunal de establecer un plazo para adicionar la ley que encontró omisa, tema muy controversial en la doctrina y la jurisprudencia, tal y como lo deja entrever el presidente de la Asamblea Legislativa, lo cierto del caso es que el Tribunal no lo dispuso así en la parte dispositiva de la sentencia, y más bien quedó librado un tiempo “prudencial” para que el legislador realizara la reforma al artículo 28 de la Ley Forestal. Es cierto que la inconstitucionalidad por omisión supone unos efectos concretos sobre la inactividad del legislador, cuando hay una obligación constitucional, o internacional que impone determinadas y concretas obligaciones sobre el Estado costarricense. De manera que guiado por la parte dispositiva, y a pesar de que la parte considerativa se hubiese anunciado el tema del plazo “prudencial”, el resultado es que esta Sala no lo concretó, por lo que en efecto quedaría a la sensatez y a la discrecionalidad del legislador establecer la forma, el momento, así como la oportunidad para definir cómo cumplirá la sentencia mencionada.

IV. Nota del Magistrado Rueda Leal.-

En la sentencia número 2015-11533 de las 11:46 horas del 26 de julio de 2015, relacionada con una gestión por incumplimiento a lo dispuesto en el voto de una acción de inconstitucionalidad, esta Sala se pronunció en este sentido:

“Luego de estudiar el caso, la Sala considera que la gestión de desobediencia debe ser desestimada por los siguientes motivos. El proceso en que recayó dicha sentencia versó sobre la constitucionalidad de la norma impugnada, según lo regulado por artículos 73 y siguientes de la Ley de la Jurisdicción Constitucional. Congruentemente, este Tribunal se abocó en dicha ocasión al estudio de los numerales cuestionados a la luz del bloque de constitucionalidad y determinó, de esa manera, los parámetros de constitucionalidad de tales normas, lo cual quedó plasmado finalmente en la parte dispositiva de la respectiva sentencia. Así, la resolución no establece una orden específica que fuera impuesta a alguna autoridad por la Sala, ni siquiera contiene el deber de ejecutar alguna acción concreta, sino que, como se dijo, estableció los parámetros de constitucionalidad de la norma. En ese sentido, para acusar la desobediencia a una sentencia de la Sala, debe existir necesariamente una orden dirigida a un funcionario determinado o determinable, con advertencia de las consecuencias de ley en caso de incumplimiento y, además, la orden debe ser notificada personalmente.

Nótese inclusive que la desobediencia a las órdenes de la Sala es sancionada por la ley en los procesos de amparo y hábeas corpus (no de acciones de inconstitucionalidad), pues es en ellos en los que se gira semejantes órdenes (artículos 71 y 72 de la Ley de la Jurisdicción Constitucional). Así las cosas, en la sentencia de marras, como no existe una orden dirigida a alguna autoridad en específico, resulta jurídicamente improcedente plantear una gestión de desobediencia (véase en el mismo sentido las resoluciones Nº 2015-1475 de las 14:30 horas del 3 de febrero de 2015 y Nº 2013-13347 de las 14:30 horas del 9 de octubre de 2013) …” (El destacado no corresponde al original).

En el sub examine, no se advierte de la parte dispositiva de la sentencia número 2007-003923 de las 15:02 horas del 21 de marzo de 2007 (en cuya redacción no participé), que se haya emitido alguna orden dirigida a una autoridad en específico, puesto que en realidad se hace alusión a la Asamblea Legislativa en general. Por tal razón, en este caso en particular, no procede testimoniar piezas en los términos del Capítulo IV de la LJC.

Lo anterior no impide que la Sala procure la ejecución de sus sentencias, incluso en acciones de inconstitucionalidad, toda vez que el artículo 56 de la LJC dispone que “la ejecución de las sentencias corresponde a la Sala Constitucional, salvo en lo relativo a la liquidación y cumplimiento de indemnizaciones y responsabilidades pecuniarias, o en otros aspectos que la propia Sala considere del caso, en que se hará en la vía contencioso administrativa por el procedimiento de ejecución de sentencia previsto en la ley reguladora de esa jurisdicción.” Dicha norma no distingue entre procesos de constitucionalidad, pues de lo contrario se vería afectado, en su contenido esencial, el principio de supremacía de la Constitución.

En consecuencia, coincido con la mayoría en reiterarle al Presidente de la Asamblea Legislativa el cumplimiento de lo dispuesto en la sentencia objeto de esta gestión.

V. Nota Separada de la Magistrada Hernández López .-

Nuestro ordenamiento jurídico, no contiene en la Ley de la Jurisdicción Constitucional potestad alguna para conminar con plazo a la Asamblea Legislativa a respetar el orden constitucional, salvo que sea la propia Constitución la que lo establezca o señale una obligación de hacer o no hacer específica a la Asamblea Legislativa. Otros ordenamientos jurídicos -generalmente de países desarrollados-, tienen remedios para este tipo de situaciones y regulan expresamente potestades a los Tribunales Constitucionales para conminar al Parlamento a acatar una orden o bien incluso para emitir reglas sustitutivas mientras la omisión se subsana. Sin embargo, al no existir una disposición expresa en ese sentido, considero que la Sala no puede dar plazos específicos al Poder Legislativo para suplir una omisión constitucional. Así las cosas, lo que este Tribunal puede hacer en cumplimiento de su deber, es señalar la omisión para que sea la Asamblea Legislativa la que determine cómo y cuándo suplir una determinada omisión, lo cual ya en este caso se ha dado en el voto citado.

Es sin duda un problema de diseño constitucional que en algún momento debe ser suplido ya que en un estado constitucional de derecho, todos los órganos y poderes constituidos estamos debajo de la Constitución y por lo tanto sin excepciones debemos estar sometidos a ella. Permitir que existan zonas de inmunidad, es prolongar un estado de cosas inconstitucional, en determinados ámbitos, que erosiona el sistema democrático en su totalidad.

Los primeros obligados a cumplir con el estado de derecho, son los representantes de la patria, y en este caso, trasluce una inercia que además ya se va haciendo costumbre cuando de cumplir con la Constitución se trata, porque son varios los casos en esta situación, lo cual es reflejo de que cuando se jura cumplir con la Constitución como primer acto a partir del nombramiento, para algunos es meramente simbólico.

En ese sentido, tal como expresé al conocerse el incumplimiento de la sentencia emitida en el expediente 10-00477, lo anterior no significa que como órgano constituido que es, la Asamblea Legislativa no esté obligada a cumplir con la Constitución Política por lo que, en un Estado de Derecho, declarada una omisión inconstitucional de su parte, ella está obligada a ponerle remedio, No obstante, en respeto de su condición de Poder de la República de su función, debe hacerlo en sus tiempos y con sus formas procurando cumplir en un plazo razonable.

Dicho lo anterior, y en razón de ese mismo respeto al orden formal y material de la Carta Fundamental, estoy obligada a cumplir, y hacer cumplir por los medios apropiados, lo que se ha dispuesto en una sentencia válida y eficaz de la Sala Constitucional -aunque no la haya suscrito-, y por ese motivo concurro en la decisión que aquí se toma, de reiterar a la Asamblea Legislativa lo dispuesto en la sentencia 2007-003923 citada.

VI. Nota separada del Magistrado Cruz Castro.-

Al parlamento no es necesario darle plazo, porque la condición jurídico política que ostenta, no requiere un instrumento coactivo que le obligue a cumplir con sus obligaciones institucionales. Existe una obligación ineludible del primer poder de la república de acatar una decisión judicial, máxime si se trata de un tema vinculado con la protección del ambiente. Aún con el plazo, hay demasiadas imprecisiones, prohijadas desde el poder, que impiden acatar un fallo de este tribunal. En las cúpulas del poder debe imperar una autocontención que imponga la obligación de acatar un mandato proveniente de un tribunal al que constitucionalmente se le ha dado la misión de tutelar el pacto fundamental de la sociedad. Si se le dio plazo al parlamento o si no se le dio, son filigranas que no resuelven un flagrante incumplimiento de una obligación fundamental. Cuando un poder ignora un mandato judicial, incurre en un acto arbitrario, desconociendo el contenido de un mandato judicial, que sí sería exigible para el resto de los ciudadanos. No puedo imaginar al Ministerio Público investigando al parlamento por incumplir, conscientemente, un mandato judicial. Aquí sí vale la autocontención, la prudencia institucional. El mandato que contiene el fallo es muy claro, especialmente si se lee el siguiente párrafo del fallo (voto 3923-2007):

“…..Como ya fue expuesto, la norma resulta omisa al no contemplar la Ley Forestal medidas previas, que pueden ir desde la autorización, hasta la inspección previa a la corta de los árboles, independientemente de su naturaleza y área. El no haber contemplado el legislador medidas preventivas al respecto, se constituye lo denominado inconstitucionalidad por omisión relativa. Esta omisión consiste en aquellos casos en que un enunciado legal, regula una determinada situación jurídica, pero lo hace defectuosamente, omitiendo en su regulación alguna de sus dimensiones. En este tipo de silencio, lo que es objeto de control es la norma legal que justamente, no dice el texto, y esa omisión crea una situación contraria a la Constitución. Ejemplo típico de la inconstitucionalidad por omisión, lo es el de los enunciados de una ley que vulnera el principio de igualdad, bien porque excluye expresamente a un grupo determinado de individuos sin razón aparente, de un beneficio al que tendrían derecho o una expectativa fundada; o bien, porque el enunciado al regular ese beneficio, lo hace a favor de un grupo determinado y guarda silencio sobre el resto (como el caso que nos ocupa).

Según la doctrina, puede suceder que la disposición, guarde silencio sobre una situación jurídica que amerita ser tutelada, porque así lo ordena la Constitución. Del enunciado cabe derivar entonces una norma implícita, que regula de modo distinto en la norma explícita, la situación jurídica objeto de protección constitucional, como en este caso, el derecho a un ambiente sano y ecológicamente equilibrado, que lleva implícito el principio de precaución. Según el análisis practicado al artículo impugnado, el legislador modificó el concepto de bosque a partir del cual se desarrolla la protección, restricciones y permisos otorgados en la Ley Forestal -como es el caso del artículo 28 en cuestión "Excepción de permiso de corta"-, de tal manera que, restringió sin fundamento técnico, el concepto anterior de bosque existente en la ley previo a su reforma. De modo que fueron dejadas sin protección vía ley, las especies no autóctonas y las áreas inferiores a dos hectáreas que constituyeran bosque, trayendo como consecuencia, que a través del artículo 28 impugnado, no se requiera de permiso para talar, ni siquiera de inspección previa, que permita asegurar que se trata del supuesto que la norma quiso incentivar, toda plantación forestal, sistema agroforestal o cualquier árbol plantado, quedando expuestas áreas que por su ubicación, cantidad y la función que han ejercido durante muchísimos años, amerita la conservación y regulación de su tala, independientemente de la naturaleza de su especie y de la naturaleza del terreno donde se ubique.

Así las cosas, esta Sala considera de conformidad con lo expuesto, que en este caso, se produce una inconstitucionalidad por omisión relativa. No obstante, si bien la Sala Constitucional es la competente para declarar la inconstitucionalidad de una norma, una violación de esta naturaleza debe ser subsanada por la Asamblea Legislativa, extendiendo la aplicación de la ley a los casos no contemplados expresamente por ella, como en este caso, a las especies y áreas que quedaron desprotegidas en el concepto de bosque actual, así como tomar medidas de prevención y control sobre las áreas en las que son permitidas la tala. Por todo lo expuesto, estimamos que el artículo 28 cuestionado lesiona el artículo 50 de la Constitución Política. Sin embargo, con el fin de no violentar el principio de separación de poderes, resulta procedente a nuestro criterio, otorgar un plazo prudencial a la Asamblea Legislativa para que subsane la violación indicada….”.

Este mandato de un tribunal de la República, es claro, el parlamento, como poder preponderante en un estado democrático, debe acatar una obligación impuesta constitucionalmente. Sin embargo, han pasado nueve años y los representantes de los ciudadanos, estiman que no están obligados a acatar tal mandato, a pesar del daño ambiental que provoca su omisión. Se trata de una obligación con el ambiente, su incumplimiento evidencia la debilidad del compromiso en la tutela de la madre naturaleza. El país que es conocido mundialmente por su compromiso con el ambiente, el que ha declarado la paz con la naturaleza, incumple, conscientemente, su compromiso con la tutela de la Madre Tierra. El incumplimiento de la sentencia, pierde relevancia, con plazo o sin él, porque no podríamos someter al parlamento a un proceso de desobediencia, porque frente a los poderes formales de máxima relevancia, no se impone la coercitividad, sino la convicción y los valores de una cultura política que se somete, voluntariamente, a un mandato judicial, sin necesidad de la coercitividad.

No es un buen síntoma para la democracia y para la vigencia del estado social y democrático de derecho, que el parlamento, durante nueve años, incumpla un mandato judicial. La prudencia, la autocontención, la moderación, son las virtudes del poder, demostradas en cada una de sus acciones. No son necesarios los plazos, las medidas coercitivas para que los representantes de los ciudadanos acaten el mandato de un tribunal que constitucionalmente se encarga de la protección de los derechos fundamentales. No hay que olvidar que la legitimidad de un poder no deriva de sus leyes o de su poder coercitivo, sino de la aceptación del mandato, sin requerir coacción. Así como el ciudadano fortalece la legitimidad del poder cuando acata un mandato, de igual forma, los que ejercen un poder formal como el parlamento, desconocen la legitimidad del régimen cuando conscientemente desobedecen una sentencia.

La desobediencia prolongada, es un mal síntoma de un poder que desconoce las obligaciones derivadas de la Constitución. En una República se espera que los que ejercen autoridad, acaten lo que un tribunal constitucional ha ordenado. Esta es una situación en que la ética del poder es la que debe imperar, sin depender de plazos o de instrumentos coercitivos.

VII.Por todo lo expuesto, lo que procede es reiterar la orden emitida por esta Sala por sentencia número 2007-003923 de las quince horas y dos minutos del veintiuno de marzo de dos mil siete, para que la Asamblea Legislativa dicte para el artículo 28 de la Ley Forestal, las medidas precautorias que aseguren la protección del ambiente.

El magistrado Castillo Víquez salva el voto y declara que no ha lugar a la gestión formulada. Los magistrados Cruz Castro, Rueda Leal y la magistrada Hernández López ponen notas separadas

Por tanto:

Se reitera a Antonio Álvarez Desanti, en su calidad de presidente de la Asamblea Legislativa, o a quién ocupe su cargo, el cumplimiento de lo dispuesto en la sentencia número 2007-003923 de las quince horas y dos minutos del veintiuno de marzo de dos mil siete, para que la Asamblea Legislativa dicte para el artículo 28 de la Ley Forestal, las medidas precautorias que aseguren la protección del ambiente. Notifíquese, reséñese y publíquese integralmente esta sentencia.

El magistrado Castillo Víquez salva el voto y declara que no ha lugar a la gestión formulada. Los magistrados Cruz Castro, Rueda Leal y la magistrada Hernández López ponen notas separadas.
