Amparo appeal filed by [Nombre 001], identity card [Valor 001] and [Nombre 002], identity card [Valor 002], against the ASADA DE TUCURRIQUE DE JIMÉNEZ DE CARTAGO.
Findings:

Considerations:
The appellants, one of whom is an older adult, state that they inherited a 500-meter lot on which they managed to build their homes. They allege that they had been receiving water supplied to them by a neighbor; however, a short time ago, the Asociación Administradora del Acueducto Rural (ASADA) de Tucurrique appeared at the site and disconnected the adjoining property owner’s water service connection, which directly affected them. They state that they approached that ASADA to explain their situation and seek assistance because they are seriously ill. They explain that the association’s president informed them that a public water tap would be installed for them; however, no actual solution to their problem was provided because the tap was installed approximately 150 meters from their property, making it difficult for them to transport the water to their homes. They mention that the ASADA discontinued the neighbor’s water service because the neighbor was supplying water to them, and they now have only a pipe on the public road from which to obtain water. They consider their fundamental rights to have been violated.
In the case at hand (sub lite), neither the filing instituting the appeal nor the evidence entered into the record establishes that the petitioners formally requested potable water service from the respondent authority or that any technical impediment to providing it exists. The filing confirms that, for some time, the petitioners benefited from potable water supplied by a neighbor whose service was suspended by the respondent authority. Since it has been established that the protected parties are neither the holders of a water service connection nor parties to a tenancy relationship (relación de inquilinato) with the person whose service was discontinued, constitutional review (control de constitucionalidad) cannot be applied with respect to the public tap. It should be noted that this Chamber has guaranteed access to potable water through the installation of a public tap only in cases where service has been suspended for the holder of the water service connection or the tenant, and not for the benefit of third parties, as in the case of the protected parties.
Consequently, the actions of the respondent ASADA are not considered arbitrary. Finally, it should be stated that it is not the responsibility of this Jurisdiction to determine whether the appellants meet the technical requirements for the installation of a water service connection, because that determination properly belongs in ordinary legal proceedings (vías de legalidad ordinaria), which they may pursue to assert their claims. Consequently, the appeal is declared inadmissible.
The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, these must be retrieved from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period will be destroyed, in accordance with the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Full Court at session N° 27-11 of August 22, 2011, article XXVI and published in Judicial Bulletin number 19 of January 26, 2012, as well as the agreement approved by the Superior Council of the Judiciary at session N° 43-12 held on May 3, 2012, article LXXXI.

*190022590007CO* PROCESO: RECURSO DE AMPARO RESOLUCIÓN Nº 2019002957 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del veinte de febrero de dos mil diecinueve .
Recurso de amparo interpuesto por [Nombre 001], cédula de identidad [Valor 001] y [Nombre 002], cédula de identidad [Valor 002], contra la ASADA DE TUCURRIQUE DE JIMÉNEZ DE CARTAGO.
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
Las recurrentes, de las cuales una es adulta mayor, manifiestan que recibieron una herencia de un lote de 500 metros, en el que lograron construir sus casas. Alegan que se estaban beneficiando del agua que un vecino les facilitaba; empero, hace poco tiempo la Asociación Administradora del Acueducto Rural (ASADA) de Tucurrique se apersonó al sitio y desconectó la paja de agua del colindante, lo que les ha afectado directamente. Señalan que acudieron ante dicha ASADA a fin de exponer su situación y buscar ayuda, pues están muy enfermas. Detallan que el presidente de la asociación les comunicó que se les instalaría una toma de agua pública; sin embargo, no se les brindó una solución real a su problema, pues la fuente se colocó aproximadamente a 150 metros de su propiedad, lo cual les dificulta trasladar el líquido hasta las viviendas. Menciona que la ASADA quitó el servicio de agua al vecino por el hecho de facilitarles el líquido a ellas y ahora únicamente cuenta con un tubo en la vía pública para abastecerse. Estiman conculcados sus derechos fundamentales.
En el sub lite, del memorial de interposición del recurso y de la prueba aportada en autos no se constata que las accionantes hayan solicitado formalmente ante la autoridad accionada el servicio de agua potable y que exista alguna imposibilidad técnica para brindarlo. Del memorial de interposición se confirma que las petentes se vieron beneficiados por algún tiempo de la dotación de agua potable por parte de un vecino, a quien la autoridad accionada le suspendió el servicio. Al tenerse por acreditado que las amparadas ni son titulares de una paja de agua ni forman parte de una relación de inquilinato con la persona a la que se le canceló el servicio, no resulta viable aplicar el control de constitucionalidad respecto de la fuente pública. Adviértase, que esta Sala ha garantizado el acceso al agua potable por medio de la instalación de una fuente pública, únicamente en los casos de suspensión de un servicio a favor del titular de la paja o del inquilino, no así en beneficio de terceras personas, como en el caso de las amparadas.
Por consiguiente, la actuación de la ASADA recurrida no se considera arbitraria. Finalmente, conviene indicar que no le corresponde a esta Jurisdicción determinar si las recurrentes cumplen o no con los requisitos técnicos para que se les instale una paja de agua, por cuanto corresponde a una labor propia de las vías de legalidad ordinaria, ante las cuales podrán acudir a efectos de hacer vales sus pretensiones. En consecuencia, el recurso se declara improcedente.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se rechaza por el fondo el recurso.
