Amparo proceeding (recurso de amparo) filed by MARÍA JOSÉ CORRALES CHACÓN, identity card 0206650715, against the VICEMINISTRA DE GESTIÓN AMBIENTAL DEL MINISTERIO DE AMBIENTE Y ENERGÍA (MINAE).
Background:
Justice Hernández López drafts the decision; and,
Considering:
I.Subject matter of the proceeding. The petitioner states that, on 28 de junio de 2018, she requested from the respondent official information concerning the environmental impact in the Crucitas area. However, as of the date on which this amparo proceeding was filed, she had not received a specific response.
III.Specific case.- Under these circumstances, as has been fully established, the petitioner has not been given access to the matter she submitted to the respondent authority on 28 de junio de 2018 and has now been waiting for 7 months. The case record shows that, after that initial request for information, Ms. Corrales Chacón requested information from the Viceministra de Gestión Ambiental concerning the environmental impact in the Crucitas area on two occasions. Nevertheless, she has not received an accurate and specific response. According to the evidence submitted, those inquiries were made on 31 de julio de 2018 and 10 de diciembre de ese mismo año. In response, the respondent authority issued two reports: one containing information inconsistent with what had been requested (Official Letter DVGA-067-2018), dated 6 de diciembre de 2018, and the second through Official Letter DVGA-081-2018 dated 20 de diciembre de 2018, in which it stated that the information sought by Ms.
Corrales Chacón would be provided in full during enero de 2019. However, the record establishes that, as of the date on which the respondent authority submitted its report—15 de enero de 2019—the protected party had not been provided with pertinent and accurate information. Based on the foregoing, the Chamber finds that the petitioner’s fundamental rights were violated. It should be noted that the information requested in junio de 2018 had not been delivered as of the date on which the respondent authority submitted its report—15 de enero de 2019. Consequently, the appropriate course is to grant the proceeding and order the respondents to take all necessary steps to ensure that the protected party receives a response to her request.
The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence stored on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the court office within a maximum period of 30 business days from service of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at Session N° 27-11 held on 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial No. 19 on 26 de enero del 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial at Session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.

The State is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, the amounts of which shall be determined during enforcement of the judgment before the administrative litigation jurisdiction (jurisdicción de lo contencioso administrativo). Recurso de amparo interpuesto por MARÍA JOSÉ CORRALES CHACÓN, cédula de identidad 0206650715, contra la VICEMINISTRA DE GESTIÓN AMBIENTAL DEL MINISTERIO DE AMBIENTE Y ENERGÍA (MINAE).
Resultando:
Redacta la Magistrada Hernández López; y,
Considerando:
I.Objeto del recurso. La recurrente indica que, el 28 de junio de 2018 solicitó a la funcionaria recurrida, información relacionada con el impacto ambiental existente en la zona de Crucitas. Sin embargo a la fecha de interposición del presente recurso de amparo, no cuenta con una respuesta concreta.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
III.Caso concreto.- En esta tesitura, como se encuentra plenamente acreditado, la recurrente no ha tenido acceso a la gestión que peticionó a la autoridad recurrida el 28 de junio de 2018, siendo a la fecha, una espera de 7 meses. De los autos se extrae que, posterior a esa primera solicitud de información, la señora Corrales Chacón, ha consultado a la Viceministra de Gestión Ambiental, información relacionada con el impacto ambiental existente en la zona de Crucitas en dos ocasiones. No obstante no ha recibido respuesta correcta y concreta. Según prueba aportada, dichas consultan fueron realizadas el 31 de julio de 2018 y el 10 de diciembre de ese mismo año. Al respecto, la autoridad recurrida emitió dos informes, uno con información contraria a lo peticionado (oficio DVGA-067-2018), de fecha 6 de diciembre de 2018, y el segundo mediante oficio DVGA-081-2018 del 20 de diciembre de 2018, donde asegura que la información comprendida por la señora Corrales Chacón será comunicada de manera completa durante el mes de enero de 2019.
Ahora bien, consta que a la fecha en que la autoridad recurrida rinde su informe -15 de enero de 2019-, a la amparada no se le ha brindado información pertinente y exacta. De lo anterior, la Sala constata la violación a los derechos fundamentales de la señora recurrente. Nótese que lo requerido en el mes de junio de 2018, no ha sido entregado a la fecha en la cual la autoridad recurrida rinde su informe -15 de enero de 2019-. En consecuencia, lo procedente es declarar con lugar el recurso y ordenar a los accionados que procedan a realizar todas las gestiones necesarias para que a la amparada se le conteste lo peticionado.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a María Celeste López Quirós en su condición de Viceministra de Gestión Ambiental, o a quien en su lugar ejerza ese cargo, bajo pena de desobediencia que en el término improrrogable de 10 días contados a partir de la notificación de esta sentencia, entregue a MARÍA JOSÉ CORRALES CHACÓN, cédula de identidad 0206650715, la información requerida por medio de solicitudes presentadas el 31 de julio -oficio FPLN-MJCCH-0072-2018- y el 10 de diciembre -oficio FPLN-MJCCH-151-2018-. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Se advierte a la recurrida que, de conformidad con el artículo 71 de la Ley de esta jurisdicción, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Notifíquese en forma personal María Celeste López Quirós, en su condición de Viceministra de Gestión Ambiental, o a quien en su lugar ejerza ese cargo.
