07598 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at eleven hours and eighteen minutes on the twenty-third of December, nineteen ninety-four.

Optional legislative consultation on constitutionality (consulta legislativa facultativa de constitucionalidad) submitted by Deputies Rodolfo Méndez Mata, Gonzalo Fajardo Salas, Alexander Salas Araya, Lorena María Vázquez Badilla, Orlando González Villalobos, Hernán Bravo Trejos, Rodolfo Brenes Gómez, Bernal Aragón Barquero, José Antonio Lobo Solera, Hernán Founier Origgi, Anabella Diez Martín and Bernardo Benavides Benavides, concerning the Draft Law on the Ordinary and Extraordinary Fiscal and Program-Based Budget of the Republic for Fiscal Year 1995 (Draft Law), legislative expediente No. 11.992.

BACKGROUND

  1. 1The Deputies state that, through the allocation in the Draft Law of resources for the payment of officials of the Ministerio de Desarrollo Rural, under title 104 of the Presidencia de la República, one of the higher constitutional bodies of the State Administration is established, namely the Ministro de Desarrollo Rural, and the positions of Viceministro and Oficial Mayor of a ministry that has not been created by ordinary law are legitimized, with the resulting disadvantage that the allocation of resources for programs of other legally established Ministries is affected. They also point out that Article 12, subsection 14, of the Budget Execution Rules (Normas de Ejecución del Presupuesto) authorizes the Ministerio de Hacienda, by executive decree (decreto ejecutivo), to transfer resources among the subitems and programs under the public-debt title and to create subitems and programs for those purposes, as well as to transfer surpluses from personal services under all budget programs and all pension schemes funded from the National Budget to the public-debt service.They believe that the foregoing is intended to circumvent ex post budgetary oversight, allowing the Administration to dispose of surplus funds and budget them for other purposes before they have been liquidated and without undergoing the legislative approval procedure required to use them again. With regard to Article 12, subsection 18, of the Budget Execution Rules, they state that it authorizes payment of the 1995 year-end bonus (aguinaldo) from expenditure appropriations under a legally nonexistent National Budget, namely that of 1996. They consider that Article 12, subsections 19 and 22, and Article 25 of the Budget Execution Rules violate the State’s single-treasury principle (principio de caja única) because they authorize the creation of funds to be managed through special checking accounts opened and maintained at banks within the Sistema Bancario Nacional. With regard to these provisions, they also point out that the third paragraph of subsection 22 allows the Ministerio de Educación Pública to regulate the sales margin on school materials and supplies, which likewise exceeds the scope of budgetary matters.They state that Article 12, subsection 23, of the Budget Execution Rules undermines legal certainty (seguridad jurídica), because it authorizes changes to the staffing schedule (relación de puestos) for special services by executive decree. They consider that Article 12, subsection 25, of the Budget Execution Rules, which authorizes the Ministro de Educación to transfer or reassign positions and teaching hours among the country’s educational institutions, to create such educational institutions as the Minister deems appropriate, and to transfer or reassign administrative and service-staff positions among educational institutions, governs matters unrelated to the budget law. They indicate that Article 12, subsection 29, of the Budget Execution Rules, which orders the Refinadora Costarricense de Petróleo (RECOPE) to transfer its resources directly to the Ministerio de Hacienda to cover operating expenses, personal services, and social-security contributions, prevents the Asamblea Legislativa from exercising its oversight authority and its exclusive constitutional power to approve budgets.They state that Article 12, subsection 31, of the Budget Execution Rules seeks to vary the application of the limitation periods (términos de prescripción) established in the Código de Trabajo and the Estatuto de Servicio Civil with respect to officials of the Ministerio de Educación Pública, which they believe not only concerns a matter unrelated to the budget but also violates the principle of equality protected by Article 33 of the Constitución Política. They point out that Article 12, subsection 32, of the Budget Execution Rules governs a matter unrelated to budgetary issues because it establishes a procedure for selecting the students who will benefit from transportation services paid for by the State. They consider that Article 12, subsection 33, of the Budget Execution Rules violates the legally established public-procurement procedures by authorizing the Ministerio de Obras Públicas y Transportes (M0PT) to conduct the bidding process (licitación) for awarding routes and concessions for student transportation.They believe that the provision contained in Article 12, subsection 36, of the Budget Execution Rules is atypical because it does not govern budgetary matters, since it authorizes the Ministerio de Hacienda, by an executive decree requested by the Ministerio de Relaciones Exteriores y Culto, to modify the staffing schedule of the Servicio Exterior. They consider that Article 13 of the Budget Execution Rules, which authorizes the expenses incurred in operating the Dirección General de Desarrollo Social y Asignaciones Familiares to be paid with resources from the same fund, contravenes the purpose for which that fund was created. They point out that Article 21 of the Budget Execution Rules governs a matter unrelated to the budget and removes public credit (crédito público) from legislative oversight by authorizing the Ministerio de Hacienda and the Banco Central to pursue a new restructuring of Costa Rica’s Bilateral External Debt with the member countries of the Club de París.They state that Article 23 of the Budget Execution Rules not only governs a non-budgetary matter but also violates Articles 191 and 192 of the Constitución Política because it establishes special conditions under which officials who have held positions originating from the experimental stations and incorporated into the staffing schedule of the Ministerio de Agricultura y Gandería may be appointed under the Civil Service System (Régimen de Servicio Civil). They consider that Article 24 of the Budget Execution Rules, which authorizes the Ministerio de Hacienda to offset the reciprocal obligations existing between Nombre1494 and the State, is detrimental to sound fiscal administration because it removes from the budget and from legislative consideration revenues or expenditures that must be budgeted. They believe that Article 27 of the Budget Execution Rules violates the principle of autonomy of autonomous institutions by allocating 10% of the total approved budgets earmarked for information and advertising by the bodies of the Branches of the Republic and by autonomous and semi-autonomous institutions to the operating expenses of the Sistema Nacional de Radio y Televisión (SINART).They indicate that Article 28 of the Budget Execution Rules governs a strictly tax-related matter reserved for ordinary legislation. They state that Article 29 of the Budget Execution Rules appears to violate the State’s single-treasury principle because it establishes the purposes for which funds obtained by the State through the provision of communications services must be used, while leaving those resources indeterminate. They request that the Chamber also rule on financing the budget through the issuance of domestic-debt bonds, because they consider that every citizen has the right to have the State finance itself rationally and that large bond issues affect inflation and interest rates.
  2. 2In a submission appearing at folios 21 to 27 of the expediente, the Deputies expand the consultation and request that the Chamber rule on Article 9 of the Draft Law, Title 113 of the Ministerio de Educación Pública, concerning the staffing schedule for permanent positions for the year 1995, which incorporates motion 296-C approved by the Comisión de Asuntos Hacendarios, whereby the positions of Subdirector de Educación in all provinces are excluded from the Civil Service System. They consider that this amendment of ordinary law through a budget law is intended to eliminate the application of certain requirements imposed by law for these positions. They state that this provision modifies Articles 16 and 18 of the Estatuto de Servicio Civil and infringes Articles 191 and 192 of the Constitución Política.
  3. 3The statutory time limits and requirements have been observed in the proceedings.

Justice Mora Mora is the author of the opinion; and

CONSIDERING

I.CONCERNING THE AUTHORITY GRANTED TO THE MINISTERIO DE HACIENDA TO AUTHORIZE, BY EXECUTIVE DECREE, REALLOCATION, MODIFICATION, TRANSFER, OR SHIFTING AMONG BUDGET APPROPRIATIONS (ARTICLE 12, SUBSECTION 14, PARAGRAPHS A AND B OF THE BUDGET EXECUTION RULES).

The Deputies consider that these provisions allow oversight by the Asamblea Legislativa to be circumvented with respect to surplus budget funds by authorizing the Administration to budget them for other purposes without their having first been liquidated. Article 12, subsection 14, of the Budget Execution Rules contained in the Draft Law under consultation provides:

“The Ministerio de Hacienda is hereby authorized to modify the following by executive decree:

  • a)To transfer resources among the subitems and programs under the public-debt title and to create the subitems and programs necessary for those purposes.
  • b)To transfer surpluses from personal services under all budget programs and all pension schemes funded from the National Budget to the Public Debt Service, to appropriations for the payment of pensions and statutory benefits payable by the Central Government, and vice versa, for the purpose of covering shortfalls in appropriations and transfers for salaries in State institutions, as well as meeting salary determinations issued by the Dirección General de Servicio Civil and the Autoridad Presupuestaria.

In decision No.1716-90 at 15:00 hours on 27 de noviembre de 1990, the Chamber stated the following on this matter:

“… What is not possible from a constitutional standpoint is for revenues, whether or not incorporated by decree, to lack a specified purpose in the Budget (Presupuesto), since in this area there is an absolute reservation of authority (reserva absoluta). Indeed, expenditures and their purpose must be expressly authorized by the Asamblea Legislativa, pursuant to Articles 176 and 178 through 180, in relation to Article 121, subsection 11, all of our Constitución Política. Thus, if the Asamblea Legislativa expressly provides how it will spend or what purpose it will assign to revenues incorporated in the foreseeable future, its powers will not be infringed, because those revenues will not be allocated to any purpose not authorized in the Budget; rather, the Single Treasury Account (Caja Unica) concept is merely strengthened to reinforce the financing of already authorized expenditures. Nevertheless, if the Budget does not specify the purpose to which those revenues will be assigned, the Asamblea would be granting the Executive a blank authorization to spend, which is impermissible even through express delegation because it is contrary to Articles 9, 121, subsection 11, 178, the final paragraph of 180, and the logic of 125, all of the Constitución Política... the provisions... are unconstitutional insofar as they allow the Executive to evade the Asamblea’s control over expenditures, which would effectively amount to authorizing the Poder Ejecutivo to enact a separate, uncontrolled budget, rendering unnecessary any reforms or amendments to the Ordinary Budget (Presupuesto Ordinario), or the enactment of extraordinary budgets...

If the Executive may not even exercise the right of veto in budgetary matters, it certainly cannot claim the power to enact the Budget, a power that cannot be delegated by statute. The Asamblea Legislativa, therefore, is the only body that, as stated, may, through its approval or rejection, determine the purpose of expenditures, since it is charged with limiting the actions of public authorities in the use and disposition of State resources... Provisions... numbers 46, 48—which would not be unconstitutional if the transfer is made within the same budget line (partida)—and 49 are unconstitutional insofar as they would implicitly, but very clearly, authorize the Executive to create budget lines or alter the purpose of already authorized expenditures, thereby evading the Asamblea Legislativa’s constitutional control over this matter. Only in the cases cited and under the conditions set forth in the final paragraph of Article 180, already mentioned, may the Executive alter the purpose of a budget line...

It should be noted, in any event, that when the provisions under review or other similar provisions validly authorize Ministries or Ministers to regulate certain matters by executive decree (decreto ejecutivo), that authorization must be understood as having been granted to the Poder Ejecutivo in accordance with Article 140 of the Constitución Política.” (emphasis not in the original text).

The foregoing holding was reiterated in Judgment No.4606-94 at 11:30 hours on 30 August 1994, Considerando V, which held:

“… it must be stated that the amendments intended to be introduced into this provision through the amendment under review, even though they entail authorization for the Poder Ejecutivo within the total amount generated by the Agreement, effectively grant that Branch powers that are reserved to statute and, ultimately, reserved for approval by the Poder Legislativo. This is so because such a situation would authorize the Poder Ejecutivo to alter the purpose or use of funds already budgeted for specific works. For that reason, allowing powers to modify the purpose of funds approved by the Asamblea Legislativa to be delegated to the Executive would be unconstitutional, because doing so would circumvent Article 180 of the Constitución Política, which provides that the Executive may alter the purposes of authorized budget lines or open supplementary appropriations (créditos adicionales) only when necessary to meet urgent or unforeseen needs in cases of war, internal unrest, or public calamity.

Those circumstances are obviously not present at this time and therefore cannot permit the delegation of a legislative function established in Article 121, subsection 11) of the Constitución Política; otherwise, Article 9 of our Magna Carta would be violated, since no Branch may delegate the exercise of its own functions, and there can be no doubt that budgetary matters are definitively reserved to statute. Accordingly, any amendment required to the National Budget (Presupuesto Nacional) should be made solely through a statute duly approved by the Asamblea Legislativa.” In accordance with the cited Judgment No. 1716-90, it must be clarified, with respect to the challenged provisions, that the authority they grant cannot be understood as having been conferred upon the Ministerio de Hacienda, but rather upon the Poder Ejecutivo, as provided in Article 140 of the Constitución Política. Based on the foregoing judicial precedent, the provisions contained in paragraphs a) and b) of Article 12, subsection 14, of the Budget Execution Rules (Normas de Ejecución del Presupuesto) are not unconstitutional, insofar as the authorization granted to the Poder Ejecutivo to transfer resources by decree between approved budget lines is exercised within the same program, because in that case the authority constitutionally assigned to the Asamblea Legislativa to authorize expenditures and their purpose would not be infringed.

II. REGARDING ARTICLE 12, SUBSECTIONS 23, FINAL PARAGRAPH, 25, AND 36 OF THE BUDGET EXECUTION RULES

The deputies consider that these provisions present the problems of regulating matters unrelated to the budget and infringing the principle of legal certainty (principio de seguridad jurídica). Article 12, subsections 23, final paragraph, 25, and 36 of the Budget Execution Rules authorizes the Ministerio de Hacienda to amend by executive decree (which, in the case of the Ministerio de Educación Pública programs, requires a joint decree from those two Ministries) the staffing schedule (relación de puestos) for special services, the staffing schedules for Ministerio de Educación Pública programs numbers 505, 506, 507 and 508, and that of Servicio Exterior program number 081. It is important to note that these general provisions regulate budgetary matters because they concern the staffing schedules included in the budget. Nevertheless, they grant the Ministerio de Hacienda and the Ministerio de Educación Pública (the latter with respect to its programs) the authority to alter those staffing schedules by decree.

At this point, it must be clarified that such authority cannot be understood as having been conferred upon those Ministries because, in accordance with Article 140 of the Constitución Política, it belongs to the Poder Ejecutivo (see Decision No.1716-90). Granting the Poder Ejecutivo the authority to alter the staffing schedules included in the budget means that duly approved budget lines may be amended. Consequently, based on the precedent cited in the preceding Whereas (Considerando), the Sala considers that the provisions challenged here are not unconstitutional if changes to the staffing schedules are made within the same program.

III. REGARDING ARTICLE 23 OF THE BUDGET EXECUTION RULES

With respect to this provision, the deputies consider that it regulates matters unrelated to the budget and contravenes Articles 191 and 192 of the Constitución Política. On repeated occasions (see Decisions numbers 121-89 at 11:00 hours on 23 November 1989, 568-90 at 17:00 hours on 23 April 1990 and 1262-90 at 16:00 hours on 9 October 1990), the Sala has stated that the inclusion of provisions whose content is not budgetary in budget statutes is contrary to the constitutional provisions governing the authority or jurisdiction of the Asamblea Legislativa to enact, amend, or repeal ordinary statutes and those granting it jurisdiction or standing to enact the Republic’s ordinary or extraordinary budgets—that is, subsections 1.) and 11.) of Article 121 and Articles 123 through 128 and 176 through 180 of the Constitución Política. It has therefore held that:

“… it is entirely proper to include ‘general provisions’ in budget rules, provided that they are connected to the specialized nature of that subject matter—that is, to budget execution (ejecución del presupuesto). What may not be included in budget statutes are provisions that do not have that character, because they must be governed by the rules applicable to common or ordinary statutes... Although Article 105 of the Constitución Política provides, among other things, that legislative power rests with the people, who delegate it by suffrage to the Asamblea Legislativa, subsections 1.) and 11.) of Article 121 of the Carta Política distinguish between two different methods and forms of legislating, depending on the subject matter concerned. The first provision exclusively grants the Poder Legislativo the power to ‘Enact statutes, amend them, repeal them, and provide their authentic interpretation, except as stated in the article concerning the Tribunal Supremo de Elecciones.’ Subsection 11.), in turn, also exclusively grants that Branch the power to ‘Enact the Republic’s ordinary and extraordinary budgets.’ As may be observed, the authority granted by subsection one is very broad and generally concerns ordinary or common statutes, whereas the authority granted by subsection 11.) is specialized in nature, and its implementation is addressed in Articles 176, 177, 178, 179 and 180, in relation to the concluding clause of Article 125, which prevents the Poder Ejecutivo from exercising a veto over budget legislation.

Thus, if the Constitución separately provides for these powers, it is because they involve legislative acts of different natures and content, even though the budget is a statute in both the formal and substantive sense and other statutes must likewise have that character.

IV.Article 176 of our Constitution provides, among other things, that “the ordinary budget of the Republic comprises all probable revenues and all authorized expenditures of the Public Administration during the fiscal year... The Budget of the Republic shall be enacted for a term of one year, from January 1 to December 31.” Articles 177 et seq. of the Constitution further elaborate on the special procedures that the Executive Branch and Congress must follow in processing that law. The same is true of the Rules of Order, Governance, and Internal Discipline of the Legislative Assembly. Accordingly, this Chamber concludes that the budget of the Republic is a law in both the formal and substantive senses, but is special because of its subject matter and the procedure discussed above. It follows from the texts cited above that the authority or standing constitutionally conferred upon the Legislative Assembly with respect to such an important matter is the power to establish in the budgets the probable revenues and authorized expenditures of the Public Administration, subject to the conditions that the Constitution itself prescribes for amendments thereto and for extraordinary budgets.

Consequently, the Legislative Branch may not, under the aforementioned budgetary power, regulate matters whose nature or content differs from that specialty. The foregoing is consistent with the Executive Branch’s exclusive authority to prepare the proposed ordinary budget and to initiate amendments thereto and extraordinary budgets, as well as with the Legislative Assembly’s authority to enact them, and also with the condition already analyzed that, pursuant to Article 125 of the Constitution, the Executive Branch has no authority to veto their approval.” (judgment 121-89 of 11:00 hours on November 23, 1989).

The provision under review establishes special conditions for officials who have held positions funded through special account No. 20.239-0-MAG, experimental stations (Estación Experimental Los Diamantes), and incorporated into the position roster of the Ministerio de Agricultura y Ganadería, to be appointed under the Civil Service Regime (Régimen de Servicio Civil). In accordance with the case law cited above, that provision is unconstitutional because it regulates a non-budgetary matter and establishes conditions for admission to the Civil Service Regime outside those governed by the Civil Service Statute (Estatuto de Servicio Civil) and its Regulations.

IV.REGARDING ARTICLE 12, SUBSECTION 31 OF THE BUDGET IMPLEMENTATION RULES (NORMAS DE EJECUCIÓN DEL PRESUPUESTO), WHICH ESTABLISHES THE POINT FROM WHICH THE LIMITATION PERIODS (TÉRMINOS DE PRESCRIPCIÓN) PRESCRIBED BY THE LABOR CODE (CÓDIGO DE TRABAJO) AND THE CIVIL SERVICE STATUTE SHALL BEGIN TO RUN WITH RESPECT TO OFFICIALS OF THE MINISTERIO DE EDUCACION PUBLICA.

The legislators state that the provision at issue amends ordinary law and violates the principle of equality (principio de igualdad). Article 12, subsection 31 of the Budget Implementation Rules provides that the limitation periods prescribed by the Labor Code and the Regulations to the Civil Service Statute (Reglamento del Estatuto de Servicio Civil) shall not begin to run for employees of the Ministerio de Educación Pública, with respect to claims or ordinary applications for the payment of wages, wage differentials, or salary supplements, until the Ministry’s Personnel Department personally or by certified mail notifies them that the application is inadmissible, or that payment cannot be made sua sponte or through the ordinary payroll process. This provision clearly does not regulate a budgetary matter and, moreover, alters for one group of officials—those who work for the Ministerio de Educación Pública—the point from which the limitation period must be calculated in the event of wage claims.

Considering that this period begins to run at the time prescribed by ordinary law and that the amendment will affect only the employment relationship of one group of officials, the provision under review is unconstitutional because it violates Articles 121, subsections 1) and 13), 123 and 128 (which govern the enactment of ordinary legislation), and 33 (which protects the principle of equality) of the Political Constitution.

V.REGARDING THE PROVISIONS GOVERNING PUBLIC TRANSPORTATION SERVICES FOR STUDENTS (ARTICLE 12, SUBSECTIONS 32 AND 33 OF THE BUDGET IMPLEMENTATION RULES).

The legislators state that the provisions challenged here regulate matters unrelated to the budget and contravene the rules establishing public procurement procedures (procedimientos de contratación pública). As already indicated, budgetary provisions must be limited to establishing the probable revenues and authorized expenditures of the Public Administration; they may not impose duties, establish prohibitions, create powers, or organize public activities. In this regard, Article 12, subsection 32 of the Budget Implementation Rules contains subject matter foreign to a budget law and exceeds the authority constitutionally conferred upon the Legislative Assembly in that area by empowering the Ministerio de Educación Pública to prepare a socioeconomic study of students at educational institutions who will be beneficiaries of the transportation service to be funded by the State. On the basis of the same reasoning, Article 12, subsection 33 of the Budget Implementation Rules is also unconstitutional insofar as it authorizes the Comisión Técnica de Transporte Automotor to conduct the bidding process (licitación) for the award of student transportation routes or concessions and grants the Ministerio de Educación Pública the authority to define the routes, assign the number of students per route, and process the corresponding payment through a special commitment of funds (reserva de crédito especial).

VI.REGARDING THE USE OF RESOURCES FROM THE FONDO DE ASIGNACIONES FAMILIARES (ARTICLE 13 OF THE BUDGET IMPLEMENTATION RULES).

The legislators consider that this provision contravenes the purpose of the law that created the Fondo de Desarrollo Social y Asignaciones Familiares. Article 13 of the Budget Implementation Rules provides that expenses arising from the operation of the Dirección General de Desarrollo Social y Asignaciones Familiares shall continue to be paid from the resources of that same fund until they are included in the ordinary or extraordinary budget of the Republic. As already mentioned, since resolution No. 121-89 of 11:00 hours on November 23, 1989, the Chamber has maintained that laws approving budgets must not include provisions that enact, amend, or repeal laws of a non-budgetary nature. The provision under review seeks to have the resources forming part of the Fondo de Desarrollo Social y Asignaciones Familiares used to finance the administrative expenses of the Dirección de Desarrollo Social y Asignaciones Familiares. This manner of disposing of the funds not only amends Articles 3, 4 and 5 of the Ley de Desarrollo Social y Asignaciones Familiares (No. 5662 of December 23, 1974), which distribute the resources comprising the Fund among social assistance programs and services, but also conflicts with a provision that expressly prohibits the use of those assets to cover administrative expenses. In this regard, Article 17 of Ley No. 5662 provides:

“The fund established by this law is the property of all beneficiaries and may under no circumstances and for no purpose be allocated to objectives other than those specified by this law. Consequently, the funds received by the institutions responsible for programs and services may not be used for administrative expenses, but exclusively for payment of those programs and services.” In view of the foregoing, and because the challenged budgetary provision seeks to amend the existing legal system contrary to what is expressly stipulated in a provision of ordinary law, it is unconstitutional because it violates Articles 121, subsections 1 and 11, 124, 125, 176, first paragraph, 177 and 180, first paragraph, of the Political Constitution, and Articles 75 et seq. of the Rules of Order, Governance, and Internal Discipline of the Legislative Assembly.

VII.REGARDING ARTICLE 28 OF THE BUDGET IMPLEMENTATION RULES IN RELATION TO THE REQUIREMENT OF ORDINARY LEGISLATION IN TAX MATTERS (RESERVA DE LEY ORDINARIA EN MATERIA TRIBUTARIA).

With respect to this provision, the legislators state that it regulates a strictly tax-related matter reserved for ordinary law. Article 28 of the Budget Implementation Rules establishes the percentage of tax that must be paid by events that are essentially sporting in nature, as provided in Leyes No.3 of December 14, 1918, No.841 of January 15, 1974, No.228 of October 13, 1948 and No.3632 of December 16, 1965; defines what shall be understood as events that are essentially sporting in nature; and determines who must pay the tax, how and when it must be paid, as well as the institution that will benefit from its collection. In a case in which a budgetary article contained a tax exemption (exoneración tributaria), the Chamber stated:

“Article 121, subsection 13 of the Political Constitution provides that the Legislative Assembly has the authority to ‘Establish national taxes and contributions and authorize municipal taxes.’ This ‘statutory reservation’ (Reserva de Ley) is developed by Article 5 of the Tax Rules and Procedures Code (Código de Normas y Procedimientos Tributarios), which provides in general terms that only the Law may create, amend, or abolish taxes; define the taxable event (hecho generador) giving rise to the tax relationship (relación tributaria); grant exemptions, reductions, or benefits; establish privileges; and so forth. There can be no doubt that, in accordance with the foregoing recitals and this one, an ordinary law is required in order for the benefits addressed by the budgetary provision under review to be granted...” (judgment No. 121-89 of 11 hours on November 23, 1989).

Because the challenged provision regulates tax matters, and because there is no basis for departing from the foregoing criterion, the Chamber finds Article 28 of the Budget Implementation Rules unconstitutional.

VIII.REGARDING ARTICLE 27 OF THE BUDGET IMPLEMENTATION RULES IN RELATION TO THE INDEPENDENCE OF AUTONOMOUS AND SEMI-AUTONOMOUS INSTITUTIONS.

The deputies state that this provision commits the resources of autonomous and semi-autonomous institutions, thereby infringing their independence. Article 27 of the Budget Execution Rules establishes that 10% of the total approved budgets allocated to information and advertising by the Bodies of the Branches of the Republic and autonomous and semi-autonomous institutions shall be assigned to provide financial support for SINART. In the Chamber’s view, the budgetary provision under review is problematic because it seeks to allocate a percentage of the resources in the approved budgets of autonomous and semi-autonomous institutions to provide financial support for SINART. The problem is that autonomous and semi-autonomous institutions do not have a financial regime incorporated into the National Budget. The Constitución Política itself, in Article 184, subsection 2), grants the Contraloría General de la República the authority to examine, approve, or reject the budgets of autonomous institutions and to oversee their execution and settlement; therefore, the authority granted by the Constitution itself to the Asamblea Legislativa to enact the ordinary and extraordinary budgets of the Republic cannot be understood as affecting the exercise of an authority specifically conferred upon the Contraloría General de la República, which, although an auxiliary institution of the Asamblea Legislativa, enjoys absolute functional and administrative independence, concepts expressed in Article 83, first paragraph, of the Constitución Política and in section 2 of its Organic Law (No.7428 of 4 de noviembre de 1994).

In this regard, it is important to note that the procedure for approving the budgets of autonomous and semi-autonomous institutions is regulated by Articles 18 and 19 of the Organic Law of the Contraloría General de la República and Chapter VIII of the Ley de la Administración Financiera de la República. Accordingly, seeking to allocate resources of autonomous and semi-autonomous institutions that have been budgeted for specific purposes to provide financial support for SINART violates Article 184, subsection 2), of the Constitution and the ordinary laws governing the procedure for preparing, approving, executing, and settling the budgets of those institutions. With respect to autonomous institutions, disposing of their resources through a general budget provision also infringes the administrative independence granted to them by Article 188 of the Constitución Política and changes the use that their respective enabling laws assign to those resources for fulfillment of the purposes entrusted to them. Consequently, the Chamber considers that the budgetary provision under review violates the aforementioned constitutional provisions.

IX.REGARDING ARTICLE 12, SUBSECTION 29, OF THE BUDGET EXECUTION RULES, WHICH ORDERS Nombre1494 TO TRANSFER TO THE MINISTERIO DE HACIENDA THE RESOURCES NEEDED TO COVER THE EXPENSES OF PROGRAM 227 (FUEL CONTROL AND QUALITY OF THE MINISTERIO DE ECONOMIA INDUSTRIA Y COMERCIO).

The deputies state that this provision prevents the Asamblea Legislativa from exercising its constitutional oversight authority and exclusive power to approve budgets. Although the Chamber does not agree with the ground of unconstitutionality asserted by the deputies, it considers that the provision violates the constitutional order for the reasons set forth below. The Chamber has repeatedly stated that the general provisions of the Budget must regulate only the manner in which the regime included in the National Budget will be implemented (appropriations and programs under the Budget Law). In decision No. 1743-91 at 14:38 hours on 5 de setiembre de 1991, the Chamber stated:

“Indeed, as the public enterprise that it is, Nombre1494 is responsible for establishing its own organization in order to ensure the efficient and economical distribution of petroleum products... Nombre1494’s legal regime is that of a public enterprise...” In accordance with the cited decision, Nombre1494 is a public enterprise whose financial regime is not included in the National Budget. In this regard, Article 18 of the Organic Law of the Contraloría General de la República authorizes that body to examine and approve the budgets of public enterprises. Based on the foregoing, Article 12, subsection 29, of the Budget Execution Rules violates Articles 176, 177, 178, 179, and 180, in relation to section 125, all of the Constitución Política, because it regulates a matter unrelated to the budget and disposes of Nombre1494’s resources to finance ordinary budget expenses, disregarding the authority assigned by law in this area to the Contraloría General de la República.

X.REGARDING THE AUTHORIZATION GRANTED TO THE MINISTERIO DE HACIENDA TO SET OFF THE RECIPROCAL OBLIGATIONS EXISTING BETWEEN Nombre1494 AND THE STATE (ARTICLE 24 OF THE BUDGET EXECUTION RULES).

With respect to this provision, the deputies state that it removes from the budget, and therefore from legislative oversight, revenues and expenditures that must be budgeted. The Chamber considers that Article 24 of the Budget Execution Rules violates the constitutional text for the same reasons as Article 12, subsection 29, because debts cannot be set off between a public enterprise whose financial regime is excluded from the National Budget and the State, since this would entail disposing of funds that must be budgeted, whether as expenses or revenues, by the Contraloría General de la República. Consequently, the provision is unconstitutional because it regulates a matter unrelated to the budget by disposing of funds that are not included in the National Budget.

XI.REGARDING PAYMENT OF THE ANNUAL BONUS (AGUINALDO) Placa15190 CHARGED TO THE EXPENDITURE APPROPRIATIONS OF THE 1996 NATIONAL BUDGET (ARTICLE 12, SUBSECTION 18, OF THE BUDGET EXECUTION RULES).

The deputies believe that the provision challenged here is contrary to the Constitution because it authorizes payment of the 1995 annual bonus from appropriations under a legally nonexistent budget, namely, the 1996 budget. It must be noted that the budget of the Republic is enacted for a one-year term, running from primero de enero to treinta y uno de diciembre, as provided in Article 176, third paragraph, of the Constitución Política. This means that the principle of budget annuality (principio de anualidad del presupuesto) is constitutionally protected and coincides with the calendar year. Consistent with the foregoing, the first paragraph of the cited article establishes that the ordinary budget “includes all probable revenues and all authorized expenditures of the Public Administration during the fiscal year.” Therefore, authorizing the Executive Branch to pay the annual bonus for 1995 from the expenditure appropriations corresponding to the 1996 National Budget, as provided by Article 12, subsection 18, of the Budget Execution Rules, violates the principle of budget annuality.

This is because the 1995 annual bonus, which is paid at the end of the calendar year, constitutes an expense corresponding to 1995 and, as such, must be included in the expenditure appropriations of that year’s budget. Likewise, the revenues intended to cover that expense must be included among the probable revenues for the fiscal year in question. This conclusion is not altered by the fact that Article 50 of the Ley de la Administración Financiera de la República provides that obligations actually incurred and remaining outstanding from the preceding period may be settled or recognized within a period of six months, because this case does not concern expenses that must be included in the expenditure appropriations of a particular year being transferred to the appropriations of the following year.

XII.REGARDING THE PROVISIONS OF ARTICLES 12, SUBSECTIONS 19 AND 22; 25; AND 29 OF THE BUDGET EXECUTION RULES IN RELATION TO THE STATE’S SINGLE-TREASURY PRINCIPLE (PRINCIPIO DE CAJA ÚNICA DEL ESTADO).

The deputies consider that these provisions violate the State’s single-treasury principle. The issue in this case is whether the general budget provisions under review grant bodies other than the Asamblea Legislativa and the Tesorería Nacional the authority to receive, budget, and disburse public funds, in violation of Articles 176, 180, and 185 of the Constitución Política. Regarding the State’s single-treasury principle, the Chamber stated:

“... The financial powers assigned to that Directorate stand out in the Bill. Indeed, Articles 3 and 9.ch) seek to have the Directorate act as a treasury vested with a special status vis-à-vis the Tesorería Nacional by receiving, budgeting, and disbursing public funds, which directly conflicts with ‘TITLE XIII’ concerning the ‘PUBLIC TREASURY’ of the Constitution, specifically Articles 176, 180, and 185; the first provides:

‘Article 176.- The budget of the Republic includes all probable revenues and all authorized expenditures of the Public Administration throughout the fiscal year. Under no circumstances may the amount of budgeted expenditures exceed probable revenues.

Municipalities and autonomous institutions shall observe the foregoing rules when enacting budgets.

The Budget of the Republic shall be enacted for a one-year term, from primero de enero to treinta y uno de diciembre.’ This clause regulates what has been called the State’s single-treasury principle, under which all revenues must be incorporated into the Budget of the Republic and are allocated to the different State agencies in accordance with public needs.

VIII.The Constitution would also prevent the Dirección de Hidrocarburos from preparing its own revenue and expenditure budget, a task reserved to the Executive Branch (President and Ministro de Hacienda, art.140 CP) by Article 177 of the Constitution; moreover, the oversight function of the Asamblea Legislativa would be absent, without whose approval those expenditures could not be disbursed. In this regard, Article 180 of the Constitution clearly declares that State officials’ powers are limited by the provisions of the ordinary and extraordinary budgets of the Republic. See the text:

‘Article 180.- The ordinary and extraordinary Budgets constitute the limits on the actions of the Public Branches regarding the use and disposition of State resources and may be amended only by laws initiated by the Executive Branch.

Any proposed amendment entailing an increase in or creation of expenditures shall be subject to the provisions of the preceding article.

However, when the Asamblea Legislativa is in recess, the Executive Branch may change the designated use of an authorized appropriation or open additional credits, but only to meet urgent or unforeseen needs in cases of war, internal unrest, or public calamity. In such cases, the Contraloría may refuse to approve the ordered expenditures, and the corresponding decree shall entail convening the Asamblea Legislativa in extraordinary session for its consideration.’ The contents of the budget may therefore be amended through new laws, and not through administrative acts issued by the head of the Ministry’s Dirección de Hidrocarburos.”

IX.In addition to these aspects concerning the collection and allocation of the line items for which these public resources will be used, Articles 3 and 9.ch) of the Bill would allow the Directorate to disburse directly the monies collected from the exploitation of hydrocarbon natural resources, thereby committing another violation of the Constitution, this time of Article 185, which reads as follows:

"Article 185.- The National Treasury is the operations center for all national revenue offices; this body alone has the legal authority to make payments on behalf of the State and to receive the amounts that, as revenue or for any other reason, must enter the national treasury."

X.It is therefore wholly unconstitutional to authorize a Directorate that forms part of a Ministry of the Executive Branch, whose head is a mandatory collaborator of the President of the Republic and not the President’s peer, to collect, budget, and disburse public funds entirely at its own discretion; this also entails another constitutional violation, namely, of the text and doctrine of Articles 121, subsection 11), 176 et seq., which govern the National Budget and, consequently, the forecasting, express legislative authorization, management, disposition, and settlement of public funds, thereby creating through the Bill what is popularly known as "petty cash funds," outside the rules, prudence, and oversight governing the management of the Public Treasury." (judgment No.6240-93 at 14:00 hours on November 26, 1993).

"...With respect to this amendment, it must be noted that the principle established in Article 185 of the Constitution is being respected, under which the National Treasury is the operations center for all national revenue offices and is the only body legally authorized to make payments on behalf of the State and to receive amounts of money derived from revenue or entering the national treasury for any other reason. From this standpoint, the National Treasurer is the only person who may disburse monies, even when authorization to do so comes from other officials. Regarding this point, the members of the Legislative Assembly, by means of a written submission appearing at folios 5 et seq., ask whether the participation of the Minister of MIDEPLAN in this particular case could violate the State’s unified treasury principle (principio de Caja Unica del Estado), enshrined in Article 185 of the Political Constitution.

That concern is answered by stating that the authorization granted to the aforementioned Government Minister would in no way constitute a violation of that principle, because, as the procedure was structured, the funds concerned must be incorporated into the budget as revenue, and the corresponding expenditure appropriations must likewise be incorporated into the National Budget, from which they are then disbursed to the beneficiary institutions and bodies." (judgment No.4606-94 at 11:30 hours on August 30, 1994).

Without prejudice to what the Chamber has stated, it is important to indicate that the State’s unified treasury principle is expressly regulated by Article 51 of the Financial Administration Law of the Republic, which provides that all public revenues or resources shall constitute an indivisible fund from which the expenses of the Public Administration shall be covered. Article 52 of that Law, in turn, provides that no earmarked revenues or funds (rentas o fondos con destino especial) shall be created, except in the cases provided for in the Political Constitution. Both Articles 51 and 52 form part of Chapter IV, Revenue Budget, of Title II, National Budget, of that Law. The establishment of 6% of the ordinary expenditures calculated for the fiscal year, to be allocated to the Judicial Branch, is the instance of earmarked revenue or a fund established by the Constitution. Apart from this case and certain specifications established by the Constitution itself concerning the revenues that cover the needs of the Caja Costarricense de Seguro Social and the budget of the Tribunal Supremo de Elecciones, all other instances of earmarked funds or revenues are expressly prohibited by the aforementioned Article 52.

Article 12, subsections 19 and 22, of the Budget Implementation Rules (Normas de Ejecución del Presupuesto) authorizes the National Treasury and the Executive Branch to create the revolving funds (fondos rotatorios) of Adaptación Social and Almacén Nacional Escolar; these have a specific purpose: in the first case, meeting the requirements for materials, merchandise, and services essential to the operation of the Dirección General de Adaptación Social and, in the second, purchasing materials and general services used for the operation of the Almacén Escolar. Both funds shall be managed through special checking accounts at State-owned banks, against which disbursements may be made with the joint signatures of the Minister of Justice, or the Minister’s designee, and that Ministry’s Comptroller General, and of the Minister of Public Education, or the Minister’s designee, and the Director of the Financial Department, respectively.

Based on the cited case law, the creation of those funds is contrary to the Political Constitution because, through general budgetary rules, it constitutes a tacit repeal of a provision of an ordinary statute that remains in force, namely Article 52 of the Financial Administration Law of the State, which expressly prohibits the creation of earmarked revenues or funds, and because it violates Article 185 of the Political Constitution by allowing officials other than the National Treasurer to disburse the resources comprising the fund entirely at their own discretion, with their actions limited only by the purpose that the budgetary rule assigns to those resources in general terms. Furthermore, Article 25 of the Budget Implementation Rules authorizes the Directorate of External Resources of the Ministry of Agriculture and Livestock (MAG) to open and maintain bank accounts that ensure the implementation of funds—derived from external financing resources and their counterpart funds, specific projects, donations, technical cooperation programs, and income from financial productive factors—allocated to these programs and used solely to cover duly budgeted expenditures.

In this case, the resources derived from the sources specified in that Article will not be incorporated into the revenue budget, that is, into the indivisible pool of funds comprising the National Budget, as required by Article 51 of the Financial Administration Law of the State, because they will be transferred, as they are received, to the bank accounts opened for that purpose by the Directorate of External Resources of MAG. Although the budgetary rule provides that those funds may be used solely to cover duly budgeted expenditures, the problem is that such revenues are not budgeted unless they are included in supplementary budgets (presupuestos extraordinarios) or the Executive Branch incorporates them into the ordinary budget by decree (see decision No.1716-90 at 15:00 hours on November 27, 1990). Because Article 25 of the Budget Implementation Rules allows funds that do not form part of the revenue pool of the ordinary or supplementary budgets to cover duly budgeted expenditures, it violates the State’s unified treasury principle protected by Article 51 of the Financial Administration Law and tacitly repeals the ordinary statute, and is therefore unconstitutional.

In another respect, Article 29 of the Budget Implementation Rules authorizes the Administrative Board of the Dirección Nacional de Comunicaciones to incorporate into its budget the amounts collected during fiscal year 1995 from providing the services specified in that budgetary rule and states that those funds shall be used to finance the mechanization and automation of postal services, equipment, furniture, construction, additions, improvements, and the purchase of land and buildings, giving priority to the construction of the post offices and the Gobernación de Cartago, as well as the Centro de Clasificación de Correspondencia building. First, the rule presents the problem of authorizing the Administrative Board of the Dirección Nacional de Comunicaciones to incorporate into its budget the amounts collected for the services it provides, meaning that those funds will not form part of the revenue pool of the ordinary or supplementary budgets, thereby violating Article 51 of the Financial Administration Law.

Second, the rule permits the creation of earmarked funds, which is expressly prohibited by Article 52 of the Financial Administration Law. Consequently, this rule is unconstitutional because it tacitly repeals the cited ordinary statutory provisions by contradicting what is expressly provided in the ordinary statute.

XIII. ON THE ALLOCATION OF RESOURCES FOR THE PAYMENT OF OFFICIALS OF THE MINISTRY OF RURAL DEVELOPMENT

The members of the Legislative Assembly state that the program budget, Title 104 of the Presidency of the Republic, includes an appropriation of nine million colones for the payment of the Minister, Deputy Minister, and Chief Administrative Officer of the Ministry of Rural Development, even though a budget appropriation cannot be used to establish one of the supreme constitutional bodies of the State Administration, namely the Minister of Rural Development, or to legitimize the positions of Deputy Minister and Chief Administrative Officer of a Ministry that has not been created by ordinary statute, thereby affecting the allocation of resources to programs of other legally established Ministries. Regarding the members’ statement concerning the creation, through budgetary rules, of one of the supreme constitutional bodies of the State Administration, as Ministers are termed in Article 21 of the General Law of Public Administration, it must be noted that Article 141 of the Political Constitution establishes that the Government Ministers shall be those determined by law.

Accordingly, this determination is subject to a statutory reservation (reserva de ley). In this regard, Article 23 of the General Law of Public Administration, pursuant to the delegation conferred by the constitutional provision, determines in subsection 1. which Ministerial Portfolios shall exist. This Article was amended by Law No.6812 of September 14, 1982; in its previous version, that provision included a subsection 2. granting the President of the Republic authority to appoint Government Ministers without Portfolio. It is also important to indicate that Article 24 of the General Law of Public Administration expressly prohibits the creation, abolition, or modification of Ministries through the budget law. Based on the foregoing, the Chamber considers that the inclusion of the appropriation of nine million colones in Program No.020 of Casa Presidencial under the 1995 Program Budget, Title 104-Presidency of the Republic, for the payment of the Minister, Deputy Minister, and Chief Administrative Officer of the Ministry of Rural Development, is not unconstitutional as a mere authorization of an expenditure that the budget must provide for during the calendar year, unless that appropriation is intended to create the Ministry of Rural Development, whose establishment must be reserved for ordinary legislation.

XV.ON THE AUTHORITY GRANTED TO THE MINISTRY OF FINANCE AND THE CENTRAL BANK TO NEGOTIATE A NEW RESTRUCTURING OF COSTA RICA’S BILATERAL EXTERNAL DEBT WITH THE MEMBER COUNTRIES OF THE PARIS CLUB AND TO ENTER INTO THE CORRESPONDING AGREEMENTS (ARTICLE 21 OF THE BUDGET IMPLEMENTATION RULES).

With respect to that provision, the deputies state that it commits public credit (crédito público) and removes it from legislative oversight. As previously mentioned, budget provisions (normas presupuestarias) may not, without violating constitutional and statutory provisions, impose duties, establish prohibitions, create powers, confer authority, or organize public activities. It is evident that the provision under review grants authority to the Ministry of Finance and the Central Bank to negotiate a new restructuring of Costa Rica’s bilateral external debt with the member countries of the Paris Club, for which purpose they must enter into the corresponding agreements. That authority or power conferred by the provision bears no relation to determining the probable revenues and authorized expenditures of the Public Administration; therefore, it concerns a matter unrelated to the budget, rendering that provision unconstitutional.

XVI. ON THE ISSUANCE OF DOMESTIC DEBT BONDS TO FINANCE THE BUDGET

The deputies request the Chamber’s opinion regarding the financing of the budget through the issuance of Domestic Debt bonds, because they consider it a right of citizens that the State finance itself rationally and because large bond issuances affect inflation and interest rates, directly affecting all citizens. The issuance of Domestic Debt bonds must be analyzed in relation to the concept of the budget and the limits imposed by the Constitution on the bodies responsible for preparing, approving, implementing, and closing it out. In decision No. 760-92 at 15:15 hours on 11 de marzo de 1992, the Chamber stated:

“...Article 176 of the Political Constitution provides that the Republic’s ordinary budget includes all probable revenues and authorized expenditures of the Public Administration during the fiscal year. The concept of the ordinary budget has evolved to such an extent that it is currently understood not only as a legal accounting document but also as a technical instrument for organizing the State’s economy, thereby consolidating its planning and oversight function. It is important to observe, in accordance with Article 176 of the Constitution, that the budget is presented as a mere forecast or accounting calculation of revenues, whereas with respect to public expenditures it retains a threefold effect: authorization of public spending, limitation of the amount to be spent, and determination of the purpose for which the appropriations approved in the budget are to be used... All the foregoing provides a clear idea of the nature of the budget as a projection of revenues to cover the authorized expenditures of the Public Administration; it therefore consists of an expression, in accounting terms, of the Government’s action plan for a given period...” It follows from the Chamber’s statements that the National Budget is not merely a legal accounting document, but also the expression of a plan intended to organize economically a sector of the State—namely, the Central Administration—during a given period.

Consistent with the foregoing is the fact that both the power to introduce ordinary and extraordinary budget laws and the preparation of draft budgets fall to the Executive Branch (Articles 140, subsection 15, 177 and 180 of the Political Constitution and 35 of the Financial Administration Law of the Republic), a power that is not affected by the authority granted to the Legislative Assembly under Article 179 of the Constitution to increase the expenditures budgeted by the Executive, provided that it identifies the revenues that will cover them and first obtains a report from the Office of the Comptroller General of the Republic regarding their fiscal adequacy. In this regard, the budget results from the Legislative Branch’s approval of the Executive’s proposal concerning how it intends to administer and distribute public funds during a given year. From this perspective, it is the province of the Executive Branch, as part of its powers, to determine how the financing of State expenditures will be provided.

The limits imposed by the Constitution on the bodies involved in the process of approving the budget law and its subsequent implementation and closing do not refer to any particular means of financing public expenditure; instead, they define the powers of each body, establish procedures and deadlines for their actions, and impose, as the sole requirement regarding the substantive content of the budget, what is known as the principle of financial balance (principio de equilibrio financiero), under which the amount of budgeted expenditures may not exceed probable revenues. In other words, at the constitutional level, no directive is imposed on the Executive Branch concerning the manner in which it must finance the budget. The deputies are correct in stating that the actions of all State bodies must be aimed at securing the greatest well-being of all persons through the reasonable exercise of their powers.

Nevertheless, the Constitution does not impose on the Executive Branch a formula limiting the manner in which it may obtain the funds required to cover public expenditures. Consequently, the issuance of Domestic Debt bonds as a means of financing part of the budget’s authorized expenditures is not contrary to constitutional provisions.

XVII.ON THE POSITIONS OF PROVINCIAL DEPUTY DIRECTORS OF EDUCATION GOVERNED BY ARTICLE 9 OF THE DRAFT BUDGET LAW, TITLE 113 OF THE MINISTRY OF PUBLIC EDUCATION.

In a supplement to the legislative consultation filed in a brief appearing at pages 21 through 27 of the case file, the deputies state that the exclusion of the positions of provincial Deputy Directors of Education—established in the list of permanent positions of the Ministry of Public Education for 1995 (Title 113 of Article 9 of the Draft Law)—from the Civil Service Regime (Régimen de Servicio Civil) is unconstitutional because it modifies existing ordinary statutory provisions through a budget law, including Article 8 of the Civil Service Statute and Articles 191 and 192 of the Political Constitution. First, it is necessary to note that, based on the concept of the Republic’s budget adopted by the Chamber in Considerando IV of decision No. 121-89 at 11:00 hours on 23 de noviembre de 1989, the budget constitutes a law in both the formal and substantive sense and is special because of the subject matter it governs and its approval procedure.

Accordingly, normative force must be recognized not only for the budget’s general provisions but also for the remainder of its provisions, which cannot be regarded as mere lists or accounts of revenues and expenditures. Notwithstanding the foregoing, there is no denying the difficulty the Chamber faces because such provisions are not structured as ordinary statutory provisions. Therefore, with respect to this specific case, it may be said that the mere appearance of a letter in parentheses next to the name of a position does not provide sufficient grounds for the Chamber to issue an opinion on whether it is unconstitutional. Nevertheless, it is important to indicate, with respect to the challenged provision, that placing an (e) next to the positions of provincial Deputy Directors of Education appearing in the list of permanent positions of the Ministry of Public Education does not, in itself, have the effect of excluding those positions from the Civil Service Regime, in accordance with the jurisprudential criteria previously issued by the Chamber on this matter.

In deciding other cases, including applications for amparo relief (recursos de amparo) concerning positions of trust (puestos de confianza) and the Legislative Consultation concerning the Draft Hydrocarbons Law, this Court expressed its view on the matter and stated that, in principle, every position paid from the public treasury must be included in the Civil Service Regime. In this regard, the Chamber stated in Considerando V of judgment No.1696-92, concerning the adoption of Articles 191 and 192 of the Political Constitution:

“...It is also clear from the foregoing that the constituent assembly intended to adopt a Civil Service regime covering all public servants. Thus, those provisions sought to set forth the principles by which the statutory regime governing public employees was to be regulated, in order to prevent improper interference with the functions entrusted to its personnel...” This criterion was reinforced by the Chamber’s statements in decision No.6240-93 at 14:00 hours on 26 de noviembre de 1993, Considerando XXI, which held:

“...the Chamber considers that both decentralization and deconcentration within the Public Administration must be interpreted as the transfer of the exercise of specialized functions to public entities or bodies in order to permit the technical development of the purposes selected by the legislature; however, this condition of decentralization or deconcentration does not presuppose the establishment of a separate public-service regime that could allow distinctions detrimental to, or privileges favoring, the employees of such public agencies... It is clear that, in referring to a single regime applicable to public servants, the Constitution did not restrict the concept of ‘statute’ to a single legal instrument, but instead sought to establish a uniform regime of principles and safeguards governing the protection of public servants’ employment rights, particularly their right to stability.

Likewise, a universal regime will ensure that the Public Administration has human resources of the highest quality and qualifications, thereby enabling the efficient performance of its functions.” Notwithstanding the foregoing, the positions excluded from the Civil Service Regime are those specified in Articles 3, 4 and 5 of the Civil Service Statute and those excluded by other ordinary laws. In this regard, it is also understood that, concerning positions of trust, where the circumstances set forth in subsections a) through e) of Article 4 of the Civil Service Statute are not present, a reasoned decision by the Civil Service General Directorate is required for positions occupied by personnel subordinate to Ministers and Deputy Ministers to be declared positions of trust and therefore excluded from the Civil Service Regime, with respect to no more than ten officials (Article 4, subsection f) of the Civil Service Statute).

It is also noted that positions created through a budget law that have not been included in the Civil Service Regime must be reported to the Civil Service General Directorate so that it may decide whether to assign them to or exclude them from the Regime. Consequently, if the (e) next to the position were interpreted by the Administration as a means of excluding those positions from the Civil Service Regime, and if that exclusion were carried out contrary to the Chamber’s holding in this Considerando, it would constitute an abuse of power contrary to constitutional provisions and could be reviewed by the Chamber through an application for amparo relief.

XVIII.Justice Piza dissents and declares that the authorizations contained in the aforementioned subsections 14, 23, 25 and 36 of Article 12 are also unconstitutional.

Por tanto

The consultation is answered to the effect that the following provisions are unconstitutional: subsections 18, 19, 22, 29, 31, 32, and 33 of Article 12, and Articles 13, 22, 23, 24, 25, 27, 28, and 29. The provisions of subsections 14, paragraphs a and b, 23, final paragraph, 25, final paragraph, and 36, all of Article 12, are not unconstitutional, insofar as the authorization granted to the Executive Branch to modify, by decree, the approved list of positions or budget items is exercised within the same program.

07598 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las once horas dieciocho minutos del veintitrés de diciembre de mil novecientos noventa y cuatro.

Consulta legislativa facultativa de constitucionalidad formulada por los Diputados Rodolfo Méndez Mata, Gonzalo Fajardo Salas, Alexander Salas Araya, Lorena María Vázquez Badilla, Orlando González Villalobos, Hernán Bravo Trejos, Rodolfo Brenes Gómez, Bernal Aragón Barquero, José Antonio Lobo Solera, Hernán Founier Origgi, Anabella Diez Martín y Bernardo Benavides Benavides, sobre el Proyecto de Ley de Presupuesto Ordinario y Extraordinario de la República Fiscal y por Programas, para el Ejercicio Fiscal de 1995 (Proyecto), expediente legislativo No. 11.992.

RESULTANDO

  1. 1Manifiestan los Diputados que por medio de la asignación de recursos para el pago de funcionarios del Ministerio de Desarrollo Rural, otorgados en el Proyecto, título 104 de la Presidencia de la República, se constituye uno de los órganos constitucionales superiores de la Administración del Estado, como es el Ministro de Desarrollo Rural y se legitiman las figuras de Viceministro y Oficial Mayor de una cartera que no ha sido creada por ley ordinaria, con el inconveniente de que se afecta la asignación de recursos a favor de programas de otros Ministerios legalmente constituidos. También señalan que el artículo 12, inciso 14, de las Normas de Ejecución del Presupuesto, faculta al Ministerio de Hacienda para efectuar, mediante decreto ejecutivo, la transferencia de recursos entre las subpartidas y los programas del título de la deuda pública y para crear subpartidas y programas para esos fines, así como para que traslade los sobrantes de los servicios personales de todos los programas presupuestarios y de todos los regímenes de pensiones con cargo al Presupuesto Nacional, al servicio de deuda pública.Con lo anterior estiman que se pretende evitar el control presupuestario a posteriori, permitiendo a la Administración disponer de los fondos sobrantes, presupuestarlos para otros fines sin que hayan sido liquidados y sin contar con el procedimiento de aprobación legislativa para volver a utilizarlos. En relación con el artículo 12, inciso 18, de las Normas de Ejecución del Presupuesto, manifestan que autoriza el pago del aguinaldo de 1995, con cargo a las partidas de gastos de un Presupuesto Nacional legalmente inexistente, como es el de 1996. Consideran que el artículo 12, incisos 19 y 22 y el artículo 25, de las Normas de Ejecución del Presupuesto, lesionan el principio de caja única del Estado porque autorizan la creación de fondos que se manejarán por medio de cuentas corrientes especiales que se abrirán y mantendrán en los bancos del Sistema Bancario Nacional. En relación con estas normas también señalan que el párrafo tercero del inciso 22 permite al Ministerio de Educación Pública regular el margen de venta de los materiales y útiles escolares, lo que también rebasa la materia presupuestaria.Manifiestan que lesiona la seguridad jurídica lo dispuesto en el artículo 12, inciso 23, de las Normas de Ejecución del Prespuesto, toda vez que autoriza la modificación de la relación de puestos de servicios especiales mediante decreto ejecutivo. Consideran que el artículo 12, inciso 25, de las Normas de Ejecución del Presupuesto, que autoriza al Ministro de Educación a efectuar traslados o cambios de plazas y horas lectivas entre los centros educativos del país, a crear los centros educativos que estime convenientes y a efectuar traslados o cambios de plazas del personal administrativo y de servicio entre los centros educativos, regula materia ajena a la ley de presupuesto. Indican que lo dispuesto en el artículo 12, inciso 29, de las Normas de Ejecución del Presupuesto, que ordena a la Refinadora Costarricense de Petróleo (RECOPE) a transferir directamente al Ministerio de Hacienda sus recursos para cubrir gastos operativos, por servicios personales y cargas sociales, impide a la Asamblea Legislativa ejercer su facultad de control y exclusividad constitucional de aprobar los presupuestos.Manifiestan que el artículo 12, inciso 31, de las Normas de Ejecución del Presupuesto, pretende que los términos de prescripción fijados en el Código de Trabajo y en el Estatuto de Servicio Civil, varíen en su aplicación con respecto a los funcionarios del Ministerio de Educación Pública, lo que consideran no solo constituye materia ajena al presupuesto, sino que violenta el principio de igualdad tutelado en el artículo 33 de la Constitución Política. Señalan que el artículo 12, inciso 32, de las Normas de Ejecución del Presupuesto, regula materia ajena a la cuestión presupuestaria pues, establece un procedimiento para la selección de los estudiantes que se beneficiarán del servicio de transporte cuyo costo correrá a cargo del Estado. Consideran que el artículo 12, inciso 33, de las Normas de Ejecución del Presupuesto violenta los procedimientos legales establecidos en materia de contratación pública al autorizar al Ministerio de Obras Públicas y Transportes (M0PT) a realizar el trámite de licitación para adjudicar las rutas y concesiones para el transporte de estudiantes.Estiman que es atípico, por no regular materia presupuestaria, el contenido de la norma del atículo 12, inciso 36, de las Normas de Ejecución del Presupuesto, porque faculta al Ministerio de Hacienda a modificar, mediante decreto ejecutivo solicitado por el Ministerio de Relaciones Exteriores y Culto, la relación de puestos del Servicio Exterior. Consideran que lo dispuesto en el artículo 13 de las Normas de Ejecución del Presupuesto, que autorizan a cubrir los gastos ocasionados por el funcionamiento de la Dirección General de Desarrollo Social y Asignaciones Familiares, con recursos del mismo fondo, contraviene el fin con el que se creó ese fondo. Señalan que el artículo 21 de las Normas de Ejecución del Presupuesto, regula materia ajena al presupuesto y sustrae el crédito público del control legislativo, al autorizar al Ministerio de Hacienda y al Banco Central para que gestionen una nueva reestructuración de la Deuda Externa Bilateral de Costa Rica con los países miembros del Club de París.Manifiestan que el artículo 23 de las Normas de Ejecución del Presupuesto, no solo regula materia no presupuestaria sino que lesiona lo dispuesto en los artículos 191 y 192 de la Constitución Política, porque establece condiciones especiales para que los funcionarios que hayan ocupado puestos provenientes de las estaciones experimentales incorporados en la relación de puestos del Ministerio de Agricultura y Gandería, sean nombrados bajo el Régimen de Servicio Civil. Consideran que el artículo 24 de las Normas de Ejecución del Presupuesto, que autoriza al Ministerio de Hacienda a compensar las obligaciones recíprocas existentes entre Nombre1494 y el Estado, atenta contra la sana administración fiscal porque extrae del presupuesto y del conocimiento legislativo, ingresos o egresos que deben ser presupuestados. Estiman que el artículo 27 de las Normas de Ejecución del Presupuesto, lesiona el principio de autonomía de las instituciones autónomas al asignar un 10% del total de los presupuestos aprobados destinados a información y publicidad, por parte de los organismos de los Poderes de la República y de las instituciones autónomas y semiautónomas, para gastos de operación del Sistema Nacional de Radio y Televisión (SINART).Indican que el artículo 28 de las Normas de Ejecución del Presupuesto, regula materia estrictamente tributaria que está reservada a la ley común. Manifiestan que el artículo 29 de las Normas de Ejecución del Presupuesto, parece lesionar el principio de caja única del Estado porque establece los destinos que han de tener los fondos obtenidos por el Estado en la prestación de servicios de comunicaciones, existiendo una indeterminación de los recursos. Solicitan que la Sala se pronuncie también sobre el financiamiento del presupuesto con la emisión de bonos de deuda interna, porque consideran que es derecho de todo ciudadano que el Estado se financie en forma racional y las altas emisiones en bonos inciden en la inflación y las tasas de interés.
  2. 2En escrito de folios 21 a 27 del expediente, los Diputados amplían la consulta y solicitan a la Sala que se pronuncie sobre el artículo 9 del Proyecto, Título 113 del Ministerio de Educación Pública, relativo a la relación de puestos de cargos fijos para el año 1995, que recoge la moción 296-C aprobada por la Comisión de Asuntos Hacendarios, por medio de la cual se excluyen del Régimen de Servicio Civil los puestos de Subdirector de Educación de todas las provincias. Consideran que con esta modificación vía ley de presupuesto de la ley ordinaria, se pretende eliminar la aplicación de ciertos requisitos que la ley exige para estos puestos. Manifiestan que con esta norma se modifica lo dispuesto en los artículos 16 y 18 del Estatuto de Servicio Civil y se transgreden los artículos 191 y 192 de la Constitución Política.
  3. 3En los procedimientos se han observado los términos y las prescripciones de ley.

Redacta el Magistrado Mora Mora; y

CONSIDERANDO

I.SOBRE LA FACULTAD DADA AL MINISTERIO DE HACIENDA PARA QUE MEDIANTE DECRETO EJECUTIVO AUTORICE EL TRASPASO, MODIFICACION, TRANSFERENCIA O TRASLADO ENTRE PARTIDAS DEL PRESUPUESTO (ARTICULO 12, INCISO 14, PARRAFOS A Y B DE LAS NORMAS DE EJECUCION DEL PRESUPUESTO).

Consideran los diputados que esas normas permiten evitar el control de la Asamblea Legislativa en relación con los fondos sobrantes del presupuesto, facultando a la Administración para que los presupueste para otros fines sin que sean liquidados previamente. El artículo 12, inciso 14, de las Normas de Ejecución del Presupuesto cuyo proyecto de ley se consulta, dispone:

"Facúltese al Ministerio de Hacienda, a modificar mediante decreto ejecutivo, lo siguiente:

  • a)Efectuar transferencias de recursos entre las subpartidas y los programas del título de deuda pública y para crear las subpartidas y programas necesarios para esos fines.
  • b)Trasladar los sobrantes, de los servicios personales de todos los programas presupuestarios y de todos los regímenes de pensiones con cargo al Presupuesto Nacional, al Servicio de la Deuda Pública, a las partidas para el pago de pensiones y de prestaciones legales a cargo del Gobierno Central y viceversa, con el propósito de cubrir faltantes en las partidas y transferencias para salarios en las instituciones del Estado, así como para hacerles frente a las resoluciones salariales, emitidas por la Dirección General de Servicio Civil y la Autoridad Presupuestaria.

En resolución No.1716-90 de las 15:00 horas de 27 de noviembre de 1990, sobre esta materia la Sala señaló:

"... Lo que no es posible desde el punto de vista Constitucional, es que ingresos incorporados o no mediante Decreto, no tengan especificado en el Presupuesto, cuál será su destino, pues en esta materia existe una reserva absoluta. En efecto, los gastos y su destino deben quedar expresamente autorizados por la Asamblea Legislativa, según lo dispuesto en el artículo 176, 178 a 180, en relación con el artículo 121, inciso 11, todos de nuestra Constitución Política. De esta forma, si la Asamblea Legislativa expresamente prevee, de qué forma gastará o qué destino dará a los ingresos que se incorporen en un futuro mediato, no se estarán vulnerando sus potestades, pues no se estarán destinando a ningún fin no autorizado en el Presupuesto, únicamente, se fortalece el concepto de Caja Unica, para reforzar la financiación de los gastos ya autorizados. No obstante, si no se especifica en el Presupuesto qué destino se le dará a esos ingresos, la Asamblea estaría ortorgando una autorización en blanco al Ejecutivo para gastar, la cual no es posible ni aún por delegación expresa, por ser contraria a los artículos 9, 121, inciso 11, 178, 180 párrafo final, y lógica del 125, todos de la Constitución Política... son inconstitucionales las normas... en la medida en que permitan al Ejecutivo burlar el control de la Asamblea en materia de gastos, lo cual equivaldría en el fondo a autorizar al Poder Ejecutivo a dictar un presupuesto por aparte y sin control, haciendo innecesarias las reformas o modificaciones al Presupuesto Ordinario, o la emisión de presupuestos extraordinarios...Si no puede el Ejecutivo ni ejercer el derecho de veto en materia presupuestaria, mucho menos puede pretender ser el que dicte el Presupuesto, delegación que no puede hacerse en virtud de la Ley.

La Asamblea Legislativa, es entonces, la única que como se dijo puede mediante su aprobación o nó, indicar el destino de los gastos, pues es la llamada a limitar la acción de los poderes públicos en el uso y disposición de los recursos del Estado...Normas...números 46, 48, -los cuales no serían inconstitucionales si el traspaso se realiza en una misma partida- y 49 son inconstitucionales, en la medida en que se estaría de una manera implícita, pero muy clara, autorizando al Ejecutivo a crear partidas, o a variar el destino de los gastos ya autorizados, burlándose con ello, el control constitucional de la Asamblea Legislativa en ésta materia. Unicamente en los casos citados y bajo las condiciones previstas en el párrafo final del artículo 180, ya citadas, puede el Ejecutivo variar el destino de una partida... Cabe advertir, en todo caso, que cuando válidamente las normas consultadas u otras similares autorizan a Ministerios o Ministros para disponer de determinadas materias mediante decreto ejecutivo, esa autorización se debe entender otorgada al Poder Ejecutivo de conformidad con lo dispuesto en el artículo 140 Constitucional." (el realce no es del texto original).

El criterio anterior fue reiterado en la sentencia No.4606-94 de las 11:30 horas de 30 de agosto de 1994, Considerando V, que dispuso:

"...es preciso indicar que las modificaciones que se pretenden introducir en este numeral mediante la enmienda consultada, aún cuando implique para el Poder Ejecutivo autorización dentro del monto global generado por el Convenio, en el fondo está otorgando a tal Poder atribuciones que están reservadas a la ley y en definitiva reservadas para ser aprobadas por el Poder Legislativo. Ello es así por cuanto con tal situación se estaría autorizando al Poder Ejecutivo para que varíe el destino o la utilización de fondos que ya fueron presupuestados para determinadas obras. Por tal razón, sería inconstitucional el permitir que se deleguen en el Ejecutivo atribuciones para modificar el destino de los fondos que fueron aprobados por la Asamblea Legislativa, pues ello implica burlar el artículo 180 constitucional, el cual establece que el Ejecutivo sólo podrá variar los destinos de partidas autorizadas o abrir créditos adicionales cuando se trata de satisfacer necesidades urgentes o imprevistas en casos de guerra, conmoción interna o calamidad pública, los cuales obviamente no se están presentando en este momento como para permitir la delegación de una función legislativa establecida en el artículo 121 inciso 11) de la Constitución Política, pues en caso contrario se estaría produciendo una violación del artículo 9 de nuestra Carta Magna, ya que ningún Poder puede delegar el ejercicio de funciones que le son propias, y la materia presupuestaria no cabe ninguna duda que está definitivamente reservada a la ley.

En tal sentido, cualquier modificación que se tuviere que hacer al Presupuesto Nacional debería hacerse únicamente a través de una ley debidamente aprobada por la Asamblea Legislativa." De conformidad con la sentencia No. 1716-90 citada, es necesario precisar, en relación con las normas que se impugnan, que la facultad que otorga no puede entenderse conferida al Ministerio de Hacienda, sino al Poder Ejecutivo, según dispone el artículo 140 de la Constitución Política. Con base en el criterio jurisprudencial anteriormente expuesto, no son inconstitucionales las normas contenidas en los párrafos a) y b) del artículo 12, inciso 14, de las Normas de Ejecución del Presupuesto, en el tanto la autorización que se otorga al Poder Ejecutivo para que mediante decreto transfiera recursos entre las partidas aprobadas, se realice dentro de un mismo programa, porque en este caso no se estaría lesionando la competencia que constitucionalmente se atribuye a la Asamblea Legislativa en la autorización de los gastos y su destino.

II. SOBRE EL ARTICULO 12, INCISOS 23 PARRAFO FINAL, 25 Y 36 DE LAS NORMAS DE EJECUCION DEL PRESUPUESTO

Consideran los diputados que dichas normas presentan el problema de regular materia ajena a la presupuestaria y de lesionar el principio de seguridad jurídica. El artículo 12, incisos 23 párrafo final, 25 y 36 de las Normas de Ejecución del Presupuesto, autoriza al Ministerio de Hacienda a modificar mediante decreto ejecutivo (que en caso de los programas del Ministerio de Educación Pública requiere un decreto conjunto de estos dos Ministerios), la relación de puestos de servicios especiales, la de los programas del Ministerio de Educación Pública números 505, 506, 507 y 508 y la del programa número 081 del Servicio Exterior. Es importante indicar que esas normas generales regulan materia presupuestaria porque se refieren a las relaciones de puestos incluídas en el presupuesto. Sin embargo, otorgan al Ministerio de Hacienda y al Ministerio de Educación Pública (a este último en relación con sus programas) la facultad de variar, mediante decreto, esas relaciones de puestos.

A este punto, es necesario precisar que dicha facultad no puede entenderse conferida a esos Ministerios, pues de conformidad con lo dispuesto en el artículo 140 de la Constitución Política, corresponde al Poder Ejecutivo (ver resolución No.1716-90). Ahora bien, el que se confiera al Poder Ejecutivo la facultad de variar las relaciones de puestos incluídas en el presupuesto, implica que se podrán modificar partidas presupuestarias debidamente aprobadas. En consecuencia, con base en la jurisprudencia citada en el Considerando anterior, la Sala considera que no son inconstitucionales las normas que aquí se impugnan si las variaciones en las relaciones de puestos operan dentro de un mismo programa.

III. SOBRE EL ARTICULO 23 DE LAS NORMAS DE EJECUCION DEL PRESUPUESTO

En relación con esa norma, consideran los diputados que regula materia ajena a la presupuestaria y transgrede lo dispuesto en los artículos 191 y 192 de la Constitución Política. En reiteradas ocasiones (ver resoluciones números 121-89 de las 11:00 horas del 23 de noviembre de 1989, 568-90 de las 17:00 horas del 23 de abril de 1990 y 1262-90 de las 16:00 horas del 9 de octubre de 1990) la Sala ha señalado que la inclusión de disposiciones de contenido no presupuestario en las leyes de presupuesto es contraria a los preceptos constitucionales que se refieren a la atribución o competencia de la Asamblea Legislativa para dictar, reformar o derogar las leyes ordinarias y las que le otorgan competencia o legitimación para dictar los presupuestos ordinarios o extraordinarios de la República, es decir, los incisos 1.) y 11.) del artículo 121 y 123 a 128 y 176 a 180 de la Constitución Política. Es así como ha considerado que:

"... es enteramente procedente que se incluyan "normas generales" en las normas de presupuesto, siempre y cuando ellas se encuentren ligadas a la especialidad que esa materia significa, o lo que es lo mismo decir, a la ejecución del presupuesto. Lo que no es posible incluir en las leyes de presupuesto son las normas que no tienen ese carácter, ya que ellas deben regularse por lo dispuesto para las leyes comunes u ordinarias... Si bien el artículo 105 de la Constitución Política, dispone entre otras cosas, que la potestad de legislar reside en el pueblo, el cual la delega por medio del sufragio en la Asamblea Legislativa, es en los incisos 1.) y

  • 11)del artículo 121 de la Carta Política que se distingue entre dos diferentes modos y formas de legislar según corresponda a la materia de que se trate. El primer texto atribuye de manera exclusiva al Poder Legislativo la potestad de "Dictar las leyes, reformarlas, derogarlas y darles interpretación auténtica, salvo lo dicho en el artículo referente al Tribunal Supremo de Elecciones." Por su parte el inciso
  • 11)atribuye también de manera exclusiva al citado Poder la potestad de "Dictar los presupuestos ordinarios y extraordinarios de la República". Como podrá observarse la atribución del inciso primero constituye una potestad muy amplia que atañe en general a las leyes ordinarias o comunes, en tanto que la del inciso
  • 11)es de carácter especial cuyo desarrollo se contempla en los artículos 176, 177, 178, 179 y 180 en relación con el numeral 125 in fine que impide al Poder Ejecutivo el veto en materia de legislación presupuestaria. Es así, que si la Constitución contempla por separado esas facultades, es porque se trata de actos legislativos de diferente naturaleza y contenido, aunque el presupuesto sea una ley formal y material y las demás leyes deban tener también ese carácter.

IV.Establece el artículo 176 de nuestra Constitución, entre otras cosas que "el presupuesto ordinario de la República comprende todos los ingresos probables y todos los gastos autorizados, de la Administración Pública, durante el año económico... El Presupuesto de la República se emitirá para el término de un año, del primero de enero al treinta y uno de diciembre." Con fundamento en los artículos 177 y siguientes de la Constitución se profundiza más en los procedimientos especiales que el Poder Ejecutivo y el Congreso deben observar en la tramitación de dicha ley. Lo mismo ocurre en el Reglamento de Orden, Dirección y Disciplina Interior de la Asamblea Legislativa. Es por ello que esta Sala concluye en el sentido de que el presupuesto de la República es una ley formal y material pero especial por la materia que la constituye y por el procedimiemto ya comentado. De los textos antes citados se desprende que la competencia o legitimación que constitucionalmente se atribuye a la Asamblea Legislativa sobre tan importante materia, es para fijar en los presupuestos los ingresos probables y los gastos autorizados de la Administración Pública con las modalidades que para sus modificaciones y para sus presupuestos extraordinarios la misma Constitución señala.

No puede en consecuencia, el Poder Legislativo bajo la potestad presupuestaria que se apunta, regular materias de diferente naturaleza o contenido a esa especialidad. Lo expuesto es congruente con la atribución exclusiva del Poder Ejecutivo de elaboración del proyecto de presupuesto ordinario y la iniciativa de sus modificaciones y de los extraordinarios, así como de la Asamblea Legislativa en cuanto a su dictado, además, con la modalidad ya analizada de que el Poder Ejecutivo no tiene atribución de veto sobre su aprobación, a tenor del numeral 125 de la Carta Fundamental." (sentencia 121-89 de las 11:00 horas del 23 de noviembre de 1989).

La norma que se analiza establece condiciones especiales para que los funcionarios que hayan ocupado puestos provenientes de la cuenta especial No. 20.239-0-MAG, estaciones experimentales (Estación Experimental Los Diamantes), incorporados en la relación de puestos del Ministerio de Agricultura y Ganadería, sean nombrados bajo el Régimen de Servicio Civil. De conformidad con la jurisprudencia citada anteriormente dicha norma resulta inconstitucional, porque regula materia no presupuestaria y fija condiciones de ingreso al Régimen de Servicio Civil al margen de las reguladas en el Estatuto de Servicio Civil y su Reglamento.

IV.SOBRE EL ARTICULO 12, INCISO 31 DE LAS NORMAS DE EJECUCION DEL PRESUPUESTO QUE ESTABLECE EL MOMENTO A PARTIR DEL CUAL EMPEZARAN A CORRER LOS TERMINOS DE PRESCRIPCION QUE FIJAN EL CODIGO DE TRABAJO Y EL ESTATUTO DE SERVICIO CIVIL EN RELACION CON LOS FUNCIONARIOS DEL MINISTERIO DE EDUCACION PUBLICA.

Los diputados manifiestan que la norma que aquí consultan modifica la ley ordinaria y lesiona el principio de igualdad. El artículo 12, inciso 31 de las Normas de Ejecución del Presupuesto, establece que los términos de prescripción que fijan el Código de Trabajo y el Reglamento del Estatuto de Servicio Civil, no empezarán a correr para los servidores del Ministerio de Educación Pública, con respecto a su reclamo o a gestiones normales por el pago de salarios, diferencias salariales o sobresueldos, antes que el Departamento de Personal del Ministerio les notifique, personalmente o por medio de correo certificado, la improcedencia de la gestión, o que el pago no sea factible de oficio o por la vía ordinaria de planilla. Esta norma, evidentemente, no regula materia presupuestaria y además modifica para un grupo de funcionarios, los que laboran para el Ministerio de Educación Pública, el momento a partir del cual debe contarse el término de prescripción en caso de reclamos salariales.

Considerando que ese término cuenta a partir del momento que fija la ley ordinaria y que además la mofificación solo incidirá en la relación laboral de un grupo de funcionarios, la norma que se analiza resulta inconstitucional por violación de los artículos 121 incisos 1) y 13), 123 y 128 (que regulan la creación de la legislación ordinaria) y 33 (que tutela el principio de igualdad) de la Constitución Política.

V.SOBRE LAS NORMAS QUE REGULAN LO RELATIVO AL SERVICIO DE TRANSPORTE PUBLICO DE LOS ESTUDIANTES (ARTICULO 12, INCISOS 32 Y 33 DE LAS NORMAS DE EJECUCION DEL PRESUPUESTO).

Manfiestan los diputados que las normas que aquí cuestionan regulan materia ajena a la presupuestaria y transgreden las normas que establecen los procedimientos de contratación pública. Como ya se indicó las normas presupuestarias deben limitarse a fijar los ingresos probables y los gastos autorizados de la Administración Pública, pero no pueden imponer deberes, establecer prohibiciones, crear competencias u organizar actividades públicas. En este sentido, constituye un contenido ajeno a la ley de presupuesto y rebasa la competencia que constitucionalmente se le atribuye a la Asamblea Legislativa sobre esa materia, el que el artículo 12, inciso 32 de las Normas de Ejecución del Presupuesto, faculte al Ministerio de Educación Pública a elaborar un estudio socioeconómico de los estudiantes de las instituciones educativas que resultarán beneficiarios del servicio de transporte que costeará el Estado.

Con fundamento en la misma argumentación, resulta también inconstitucional lo dispuesto en el artículo 12, inciso 33, de las Normas de Ejecución del Presupuesto, que autoriza a la Comisión Técnica de Transporte Automotor a realizar la licitación para adjudicar las rutas o concesiones de transporte de estudiantes y que le otorga la facultad al Ministerio de Educación Pública de definir las rutas, asignar el número de estudiantes por ruta y tramitar el pago correspondiente por medio de reserva de crédito especial.

VI.SOBRE LA UTILIZACION DE LOS RECURSOS DEL FONDO DE ASIGNACIONES FAMILIARES (ARTICULO 13 DE LAS NORMAS DE EJECUCION DEL PRESUPUESTO).

Consideran los diputados que lo dispuesto en esa norma contraviene el espíritu de la ley que creó el Fondo de Desarrollo Social y Asignaciones Familiares. El artículo 13 de las Normas de Ejecución del Presupuesto dispone que los gastos ocasionados por el funcionamiento de la Dirección General de Desarrollo Social y Asignaciones Familiares, se continuarán sufragando con recursos del mismo fondo, hasta tanto no se incluyan en el presupuesto ordinario o extraordinario de la República. Como ya se mencionó, a partir de la resolución No. 121-89 de las 11:00 horas del 23 de noviembre de 1989, la Sala ha mantenido la tesis de que en las leyes que aprueban los presupuestos no deben incluírse normas que aprueben, modifiquen o deroguen leyes de carácter no presupuestario. La norma bajo análisis pretende que los recursos que forman parte del Fondo de Desarrollo Social y Asignaciones Familiares, se utilicen para financiar gastos administrativos de la Dirección de Desarrollo Social y Asignaciones Familiares.

Esta forma de disponer de los fondos no solo modifica lo dispuesto en los artículos 3, 4 y 5 de la Ley de Desarrollo Social y Asignaciones Familiares (No. 5662 de 23 de diciembre de 1974), que distribuyen los recursos que conforman el Fondo entre los programas y servicios de asistencia social, sino que se opone a una norma que expresamente prohibe utilizar ese patrimonio para sufragar gastos administrativos. En este sentido, el artículo 17 de la Ley No. 5662 dispone:

"El fondo establecido por esta ley es patrimonio de todos los beneficiarios y en ningún caso y para ningún efecto podrá ser destinado a otras finalidades que no sean las señaladas por esta ley. En consecuencia, los fondos que reciban las instituciones encargadas de programas y servicios no podrán ser utilizados en gastos administrativos, sino exclusivamente en el pago de esos programas y servicios." En consideración a lo expuesto, y en virtud de que la norma presupuestaria que se impugna pretende modificar el ordenamiento jurídico vigente, contra lo estipulado expresamente en una norma de ley común, resulta inconstitucional por violar lo preceptuado en los artículos 121, incisos 1 y 11, 124, 125, 176, párrafo primero, 177 y 180 párrafo primero, de la Constitución Política y los artículos 75 y siguientes del Reglamento, Orden, Dirección y Disciplina Interior de la Asamblea Legislativa.

VII.SOBRE LO DISPUESTO EN EL ARTICULO 28 DE LAS NORMAS DE EJECUCION DEL PRESUPUESTO EN RELACION CON LA RESERVA DE LEY ORDINARIA EN MATERIA TRIBUTARIA.

En relación con esa norma los diputados manifiestan que regula materia estrictamente tributaria, reservada para la ley común. El artículo 28 de las Normas de Ejecución del Presupuesto fija el porcentaje del impuesto que deben pagar los espectáculos esencialmente deportivos, según lo dispuesto en las Leyes No.3 del 14 de diciembre de 1918, No.841 del 15 de enero de 1974, No.228 del 13 de octubre de 1948 y No.3632 del 16 de diciembre de 1965; define lo que se entenderá como espectáculos esencialmente deportivos y determina quién, cómo y cuándo se debe pargar el impuesto, así como la institución a la que beneficiará su recaudación. En un caso en que un artículo presupuestario contenía una exoneración tributaria, la Sala indicó:

"Señala el artículo 121 inciso 13 de la Constitución Política que es atribución de la Asamblea Legislativa "Establecer los impuestos y contribuciones nacionales, y autorizar los municipales." La presente "Reserva de Ley", es desarrollada por el artículo 5 del Código de Normas y Procedimientos Tributarios, el cual en términos generales estipula que sólo la Ley puede crear, modificar o suprimir tributos; definir el hecho generador de la relación tributaria, otorgar exenciones, reducciones o beneficios, establecer privilegios, etcétera. No cabe la menor duda de que conforme a lo expuesto en los considerandos anteriores y en este, se requiere de una ley ordinaria para que se puedan otorgar los beneficios a que se contrae la norma presupuestaria objeto de pronunciamiento..." (sentencia No. 121-89 de 11 horas de 23 de noviembre de 1989).

En virtud de que la norma impugnada regula materia tributaria y por no encontrarse motivo para variar el criterio expuesto, la Sala concidera inconstitucional el artículo 28 de las Normas de Ejecución del Presupuesto.

VIII.SOBRE LO DISPUESTO EN EL ARTICULO 27 DE LAS NORMAS DE EJECUCION DEL PRESUPUESTO, EN RELACION CON LA INDEPENDENCIA DE LAS INSTITUCIONES AUTONOMAS Y SEMIAUTONOMAS.

Manifiestan los diputados que esa norma compromete los recursos de las instituciones autónomas y semiautónomas, transgrediendo su independencia. El artículo 27 de las Normas de Ejecución del Presupuesto establece que se asignará un 10% del total de los presupuestos aprobados destinados a información y publicidad, por parte de los Organismos de los Poderes de la República y de las instituciones autónomas y semiautónomas, para el sustento económico del SINART. A criterio de la Sala la norma presupuestaria que se consulta, presenta el problema de pretender asignar un porcentaje de los recursos de los presupuestos aprobados a las instituciones autónomas y semiatónomas, para proveer al sustento económico del SINART. El inconveniente radica en que las instituciones autónomas y semiautónomas no poseen un régimen financiero incorporado en el Presupuesto Nacional. La misma Constitución Política, en su artículo 184, inciso 2), confiere a la Contraloría General de la República la atribución de examinar, aprobar o improbar los presupuestos de las instituciones autónomas y fiscalizar su ejecución y liquidación; por lo que no puede entenderse que la competencia que la misma Constitución otorga a la Asamblea Legislativa para dictar los presupuestos ordinarios y extraordinarios de la República, pueda incidir en el ejercicio de una atribución específicamente conferida a la Contraloría General de la República que, si bien es una institución auxiliar de la Asamblea Legislativa, tiene absoluta independencia funcional y administrativa, conceptos que se expresan en el artículo 83, párrafo primero de la Constitución Política y en el numeral 2 de su Ley Orgánica (No.7428 de 4 de noviembre de 1994).

En este sentido, es importante indicar que el procedimiento para la aprobación de los presupuestos de las instituciones autónomas y semiautónomas se encuentra regulado en los artículos 18 y 19 de la Ley Orgánica de la Contraloría General de la República y en el Capítulo VIII de la Ley de la Administración Financiera de la República. Por lo que el pretender asignar recursos de las instituciones autónomas y semiautónomas que se encuentran presupuestados con determinados fines, para sustentar económicamente al SINART, lesiona el artículo 184, inciso 2), de la Constitución y las normas ordinarias que regulan el procedimiento de preparación, aprobación, ejecución y liquidación de los presupuestos de dichas instituciones. En lo que se refiere a las instituciones autónomas, el disponer de sus recursos, mediante una norma general del presupuesto, también lesiona la independencia administrativa que les confiere la Constitución Política en su artículo 188 y modifica el destino que sus respectivas leyes de creación fijan a los recursos para cumplir los fines que les fueron encomendados. En consecuencia, la Sala considera que la norma presupuestaria que se consulta lesiona las citadas disposiciones constitucionales.

IX.SOBRE EL ARTICULO 12, INCISO 29, DE LAS NORMAS DE EJECUCION DEL PRESUPUESTO QUE ORDENA A Nombre1494 TRANSFERIR AL MINISTERIO DE HACIENDA LOS RECURSOS PARA CUBRIR LOS GASTOS DEL PROGRAMA 227 (CONTROL Y CALIDAD DE COMBUSTIBLES DEL MINISTERIO DE ECONOMIA INDUSTRIA Y COMERCIO).

Los diputados manifiestan que esta norma impide a la Asamblea Legislativa ejercer su facultad de control y exclusividad constitucional de aprobar los presupuestos. La Sala, aunque no comparte el motivo de inconstitucionalidad que exponen los diputados, considera que la norma lesiona el orden constitucional por las razones que se dirán. La Sala ha manifestado en forma reiterada que las normas generales del Presupuesto deben regular únicamente la forma en que se dará cumplimiento al régimen incluído en el Presupuesto Nacional (partidas y programas de la Ley de Presupuesto). En la resolución No. 1743-91 de las 14:38 horas de 5 de setiembre de 1991, la Sala señaló:

"En efecto a Nombre1494 como empresa pública que es, le corresponde darse su propia organización, con el objeto de asegurarse la distribución eficiente y económica de los derivados del petróleo... El régimen jurídico de Nombre1494 es el de empresa pública..." De conformidad con la citada resolución, se tiene que Nombre1494 es una empresa pública, cuyo régimen financiero no se encuentra incluído en el Presupuesto Nacional. En este sentido, el artículo 18 de la Ley Orgánica de la Contraloría General de la República autoriza a este órgano para que examine y apruebe los presupuestos de las empresas públicas. Con fundamento en lo expuesto, el artículo 12, inciso 29, de las Normas de Ejecución del Presupuesto, resulta violatorio los artículos 176, 177, 178, 179 y 180 en relación con el numeral 125, todos de la Constitución Política, por regular materia ajena a la presupuestaria y por disponer de los recursos de Nombre1494 para financiar gastos ordinarios del presupuesto, desconociendo la competencia que en esta materia corresponde por ley a la Contraloría General de la República.

X.SOBRE LA AUTORIZACION DADA AL MINISTERIO DE HACIENDA PARA COMPENSAR LAS OBLIGACIONES RECIPROCAS EXISTENTES ENTRE Nombre1494 Y EL ESTADO (ARTICULO 24 DE LAS NORMAS DE EJECUCION DEL PRESUPUESTO).

En relación con esta norma los diputados manifiestan que extrae del presupuesto y por ende del control legislativo, ingresos y egresos que deben ser presupuestados. La Sala considera que el artículo 24 de las Normas de Ejecución del Presupuesto, lesiona el texto constitucional por las mismas razones que el artículo 12, inciso 29, debido a que no es posible una compensación de deudas entre una empresa pública, cuyo régimen financiero se encuentra excluído del Presupuesto Nacional y el Estado, puesto que se estaría disponiendo de fondos que deben ser presupuestados, ya sea como gastos o ingresos, por la Contraloría General de la República. En consecuencia, la norma resulta inconstitucional por regular materia ajena a la presupuestaria, por disponer de fondos que no se incluyen en el Presupuesto Nacional.

XI.SOBRE EL PAGO DEL AGUINALDO Placa15190 CARGO A LAS PARTIDAS DE GASTOS DEL PRESUPUESTO NACIONAL DE 1996 (ARTICULO 12, INCISO 18, DE LAS NORMAS DE EJECUCION DEL PRESUPUESTO).

Estiman los diputados que la norma que aquí cuestionan es contraria a la Constitución porque autoriza el pago del aguinaldo de 1995, con partidas de un presupuesto legalmente inexistente, el de 1996. Es necesario indicar que el presupuesto de la República se emite por el término de un año, que va del primero de enero al treinta y uno de diciembre, según dispone la Constitución Política en su artículo 176, párrafo tercero. Lo anterior determina que el principio de anualidad del presupuesto esté tutelado constitucionalmente y que coincida con el año calendario. Conforme con lo expuesto, en el párrafo primero del citado artículo, se establece que el presupuesto ordinario "comprende todos los ingresos probables y todos los gastos autorizados de la Administración Pública, durante el año económico". Por lo que resulta violatorio del principio de anualidad del presupuesto el que se autorice al Poder Ejecutivo para pagar el aguinaldo del año 1995, con cargo a las partidas de gastos correspondientes al Presupuesto Nacional para 1996, como dispone el artículo 12, inciso 18, de las Normas de Ejecución del Presupuesto.

Lo anterior en virtud de que el aguinaldo de 1995, que se cancela al final del año calendario, constituye un gasto que corresponde a 1995 y como tal debe incorporarse en las partidas de egresos del presupuesto de ese año. Así también los ingresos con los que se pretenda cubrir ese gasto, deberán estar incluídos entre los probables del año económico que se trate. No modifica el criterio anterior el que la Ley de la Administración Financiera de la República, en su artículo 50, establezca que los compromisos efectivamente adquiridos que queden pendientes del período anterior, puedan liquidarse o reconocerse dentro del términos de seis meses, porque en este caso no se pretende que los gastos que deban incorporarse en las partidas de egresos del presupuesto de un determinado año, sean trasladados a las partidas del año siguiente.

XII.SOBRE LO DISPUESTO EN LOS ARTICULOS 12, INCISOS 19 y 22; 25 Y 29 DE LAS NORMAS DE EJECUCION DEL PRESUPUESTO EN RELACION CON EL PRINCIPIO DE CAJA UNICA DEL ESTADO.

Consideran los diputados que esas normas lesionan el principio de caja única del Estado. De lo que se trata en este caso es de determinar si las normas generales del presupuesto que aquí se consultan, confieren a órganos diferentes de la Asamblea Legislativa y la Tesorería Nacional, potestades para recibir, presupuestar y girar fondos públicos, transgrediendo los artículos 176, 180 y 185 de la Constitución Política. En relación con el principio de caja única del Estado, la Sala manifestó:

"... Resaltan del Proyecto las atribuciones hacendarias que se asignan a esa Dirección. En efecto, los artículos 3 y 9.ch) pretenden que la Dirección funja como una tesorería revestida de un fuero especial frente a la Tesorería Nacional recibiendo, presupuestando y girando fondos públicos, lo que se enfrenta abiertamente al "TITULO XIII" sobre la "HACIENDA PUBLICA" de la Constitución, en concreto con los artículo 176, 180, y 185; dice el primero:

"Artículo 176.- El presupuesto de la República comprende todos los ingresos probables y todos los gastos autorizados, de la Administración Pública, durante todo el año económico. En ningún caso el monto de los gastos presupuestos podrá exceder el de los ingresos probables.

Las municipalidades y las instituciones autónomas observarán las reglas anteriores para dictar presupuestos.

El Presupuesto de la República se emitirá para el término de un año, del primero de enero al treinta y uno de diciembre" Esta cláusula regula lo que se ha denominado el principio de caja única del Estado por el que todos los ingresos han de incorporarse al Presupuesto de la República y son asignados a las diferentes dependencias estatales de conformidad con las necesidades públicas.

VIII.La Constitución también le impediría a la Dirección de Hidrocarburos preparar su propio presupuesto de ingresos y de gastos, labor reservada al Poder Ejecutivo (Presidente y Ministro de Hacienda, art.140 CP) por el artículo 177 de la constitución; y estaría ausente la función de tutela de la Asamblea Legislativa sin cuya aprobación esos gastos no podrían girarse. Al respecto, el artículo 180 de la Constitución es claro en cuanto declara que los agentes del Estado ven limitadas sus atribuciones por lo dispuesto en los presupuestos ordinarios y extraordinarios de la República. Veáse el texto:

"Artículo 180.- El Presupuesto ordinario y los extraordinarios constituyen el límite de acción de los Poderes Públicos para el uso y disposición de los recursos del Estado, y sólo podrán ser modificados por leyes de iniciativa del Poder Ejecutivo.

Todo Proyecto de modificación que implique aumento o creación de gastos deberá sujetarse a lo dispuesto en el artículo anterior.

Sin embargo, cuando la Asamblea Legislativa esté en receso, el Poder ejecutivo podrá variar el destino de una partida autorizada, o abrir créditos adicionales, pero únicamente para satisfacer necesidades urgentes o imprevistas en casos de guerra, conmoción interna o calamidad pública. En tales casos la Contraloría podrá negar su aprobación a los gastos ordenados y el decreto respectivo implicará la convocatoria de la Asamblea Legislativa a sesiones extraordinarias para su conocimiento." Es entonces por medio de nuevas leyes que se puede modificar el contenido de lo presupuesto y no por actos administrativos dictados por el jerarca de la Dirección de Hidrocarburos del Ministerio.

IX.Aunado a estos aspectos de captación y asignación de los renglones en los que se emplearán estos recursos públicos, los artículos 3 y 9.ch) del Proyecto permitirían a la Dirección girar directamente los dineros captados en virtud de la actividad de explotación de los recursos naturales hidrocarburados, incurriendo en otra transgresión a la Constitución, en esta ocasión al artículo 185 cuyo texto es este:

"Artículo 185.- La tesorería nacional es el centro de operaciones de todas las oficinas de rentas nacionales; este organismo es el único que tiene facultad legal para pagar a nombre del Estado y recibir las cantidades que a título de rentas o por cualquier otro motivo, deban ingresar a las arcas nacionales."

X.Por ello es absolutamente inconstitucional autorizar a una Dirección que forma parte de una Cartera del Poder Ejecutivo, cuyo titular es un obligado colaborador del Presidente de la República y no su par, para percibir, presupuestar y girar fondos públicos a su entera conveniencia; lo cual implica, además, otra violación constitucional la del texto y doctrina de los artículos 121 inciso 11), 176 y siguientes que regulan el Presupuesto Nacional y, por consiguiente la previsión, la autorización legislativa expresa, el manejo, la disposición y la liquidación de los fondos públicos, creándose en el Proyecto lo que el lenguaje popular ha bautizado con el nombre de "cajas chicas", al margen de las normas, la prudencia y el control en el manejo de la Hacienda Pública." (sentencia No.6240-93 de las 14:00 horas del 26 de noviembre de 1993).

"...Respecto a esta modificación es preciso señalar que se está respetando el principio establecido por el numeral 185 constitucional, según el cual la Tesorería Nacional es el centro de operaciones de todas las oficinas de rentas nacionales y es el único que tiene la facultad legal para hacer los pagos en nombre del Estado y recibir las cantidades de dinero provenientes de rentas o que por cualquier otro motivo ingrese a las arcas nacionales. Desde este punto de vista, es el Tesorero Nacional el único que puede girar dineros, aún cuando la autorización para ello provenga de otros funcionarios. En cuanto a este punto los señores diputados, mediante escrito que consta a folios 5 y siguientes, consultan en el sentido de si la participación del Ministro de MIDEPLAN en este caso concreto podría ser violatoria del principio de Caja Unica del Estado consagrado en el numeral 185 de la Constitución Política.

Tal inquietud se evacua diciendo que de ningún modo la autorización contenida al referido Ministro de Gobierno implicaría una violación del citado principio, pues como se estructuró el procedimiento los fondos aquí relacionados deben incorporarse al presupuesto como ingresos y las correspondientes partidas de gastos igualmente se incorporan en el Presupuesto Nacional y partiendo de allí se gira a las instituciones y órganos beneficiados." (sentencia No.4606-94 de las 11:30 horas de 30 de agosto de 1994).

Sin perjuicio de lo que la Sala ha expresado, es importante indicar que el principio de caja única del Estado se encuentra regulado expresamente en el artículo 51 de la Ley de la Administración Financiera de la República que dispone que todos los ingresos o recursos públicos, constituirán un fondo indivisible con el que se cubrirán los gastos de la Administración Pública. El artículo 52 de la citada Ley, por su parte, dispone que no se crearán rentas o fondos con destino especial, salvo los casos previstos en la Constitución Política. Tanto el artículo 51 como el 52 corresponden al Capítulo IV, Del Presupuesto de Ingresos, del Título II, Del Presupuesto Nacional, de esa Ley. La fijación de un 6% de los gastos ordinarios calculados para el año económico, que será asignado al Poder Judicial, es el caso de renta o fondo con destino específico establecido en la Constitución. Fuera de este caso y de ciertas especificaciones que la misma Constitución dispone en relación con las rentas que cubren las necesidades de la Caja Costarricense de Seguro Social y el presupuesto del Tribunal Supremo de Elecciones, los demás casos de fondos o rentas con destinos específicos están expresamente prohibidos en el artículo 52 citado.

El artículo 12, incisos 19 y 22 de las Normas de Ejecución del Presupuesto, autoriza a la Tesorería Nacional y al Poder Ejecutivo para la creación de los fondos rotatorios de Adaptación Social y del Almacén Nacional Escolar; que cuentan con un destino específico, en el primer caso, la atención de los requerimientos de materiales, mercaderías y servicios indispensables para el funcionamiento de la Dirección General de Adaptación Social y, en el segundo caso, la compra de materiales y servicios generales que se utilizan para el funcionamiento del Almacén Escolar. Ambos fondos se manejarán por medio de cuentas corrientes especiales de bancos del Estado, contra las que pueden girar, las firmas conjuntas del Ministro de Justicia, o su designado, y el Contralor General de ese Ministerio y el Ministro de Educación Pública, o su designado, y el Director del Departamento Financiero, respectivamente.

Con fundamento en la jurisprudencia citada, la creación de dichos fondos resulta contraria a la Constitución Política, porque constituye una derogatoria tácita, por medio de normas generales del presupuesto, de una norma vigente de ley común, sea el artículo 52 de la Ley de la Administración Financiera del Estado, que prohibe expresamente la creación de rentas o fondos con destino específico y porque lesiona lo dispuesto en el artículo 185 de la Constitución Política, al permitir que funcionarios diferentes del Tesorero Nacional, puedan girar los recursos que integran el fondo, a su entera conveniencia, viendo limitada su actuación únicamente por el destino que, en términos generales, fija la norma presupuestaria a esos recursos. Por otra parte, el artículo 25 de las Normas de Ejecución del Presupuesto autoriza a la Dirección de Recursos Externos del Ministerio de Agricultura y Ganadería (MAG), para abrir y mantener cuentas bancarias que garanticen la ejecución de los fondos -provenientes de recursos de financiamiento externo y sus contrapartidas, proyectos específicos, donaciones, programas de cooperación técnica y rentas de factores productivos financieros- que se asignen a estos programas y se utilicen para cubrir únicamente gastos debidamente presupuestados.

En este caso los recursos provenientes de las fuentes que se señalan en el citado artículo no se incorporarán al presupuesto de ingresos o sea a la masa indivisible de fondos que integra el Presupuesto Nacional, como dispone el artículo 51 de la Ley de la Administración Financiera del Estado, en virtud de que conforme vayan ingresando serán trasladados a las cuentas bancarias que la Dirección de Recursos Externos del MAG haya abierto con ese propósito. A pesar de que la norma presupuestaria disponga que esos fondos pueden utilizarse únicamente para cubrir gastos debidamente presupuestados, se presenta el problema de que esos ingresos no se encuentran presupuestados a menos que se incluyan en los presupuestos extraordinarios o que el Poder Ejecutivo los introduzca en el presupuesto ordinario mediante decreto (ver resolución No.1716-90 de las 15:00 horas del 27 de noviembre de 1990). En virtud de que el artículo 25 de las Normas de Ejecución del Presupuesto permite que fondos que no integran la masa de ingresos del presupuesto ordinario o de los extraordinarios, cubran gastos que están debidamente presupuestados, lesiona el principio de caja única del Estado tutelado en el artículo 51 de la Ley de la Administración Financiera y deroga tácitamente la ley ordinaria, resultando inconstitucional.

En otro orden de cosas se tiene que el artículo 29 de las Normas de Ejecución del Presupuesto autoriza a la Junta Administrativa de la Dirección Nacional de Comunicaciones para que incorpore en su presupuesto lo que recaude en el período fiscal de 1995, por la prestación de los servicios que se especifican en esa norma presupuestaria y señala que esos fondos se utilizarán para financiar la mecanización y automatización de los servicios postales, el equipo, el mobiliario, las construcciones, las adiciones, las mejoras y la compra de terrenos y edificios, dando prioridad a la construcción de las oficinas de correos y de la Gobernación de Cartago y del edificio del Centro de Clasificación de Correspondencia. En primer lugar, la norma presenta el problema de autorizar a la Junta Administrativa de la Dirección Nacional de Comunicaciones a incorporar a su presupuesto lo que se recaude por concepto de los servicios que presta, lo que determina que dichos fondos no integrarán la masa de ingresos del presupuesto ordinario o de los extraordinarios, lesionando lo dispuesto en el artículo 51 de la Ley de la Administración Financiera.

En segundo lugar, la norma posibilita la creación de fondos con destino específico, lo que se encuentra expresamente prohibido en el artículo 52 de la Ley de la Administración Financiera. En consecuencia, esta norma resulta inconstitucional por derogar tácitamente las normas ordinarias citadas, al contrariar lo dispuesto expresamente en la ley común.

XIII. SOBRE LA ASIGNACION DE RECURSOS PARA EL PAGO DE FUNCIONARIOS DEL MINISTERIO DE DESARROLLO RURAL

Manifiestan los diputados que en el presupuesto por programas, título 104 de la Presidencia de la República, se incluye una partida de nueve millones de colones para el pago del Ministro, Viceministro y Oficial Mayor del Ministerio de Desarrollo Rural, a pesar de que no es posible que, mediante una partida presupuestaria, se constituya uno de los órganos constitucionales superiores de la Administración del Estado, como es el Ministro de Desarrollo Rural, y se legitimen las figuras de Viceministro y Oficial Mayor de un Ministerio que no ha sido creado por ley ordinaria, afectándose la asignación de recursos a favor de programas de otros Ministerios legalmente constituidos. En relación con lo que manifiestan los diputados en cuanto a la creación por vía de normas presupuestarias de uno de los órganos constitucionales superiores de la Administración del Estado, como se denomina a los Ministros en el artículo 21 de la Ley General de la Administración Pública, es necesario indicar que el artículo 141 de la Constitución Política, establece que los Ministros de Gobierno, serán los que determine la ley.

Por lo que en este punto existe reserva de ley para dicha determinación. En este sentido, el artículo 23 de la Ley General de la Administración Pública, por la delegación conferida en la norma constitucional, en su inciso 1. determina cuales serán las Carteras Ministeriales. Este artículo fue reformado por Ley No.6812 de 14 de setiembre de 1982, dicha norma en su versión anterior contaba con un inciso 2. que otorgaba competencia al Presidente de la República para designar Ministros de Gobierno sin Cartera. También es importante indicar que el artículo 24 de la Ley General de la Administración Pública prohibe expresamente la creación, supresión o modificación de los Ministerios por medio de la ley de presupuesto. Con base en lo expuesto, la Sala considera que la inclusión de la partida de nueve millones de colones en el Programa No.020 de Casa Presidencial del Presupuesto por Programas 1995, Título 104-Presidencia de la República, para el pago del Ministro, Viceministro y Oficial Mayor del Ministerio de Desarrollo Rural, no resulta inconstitucional como mera autorización de un gasto que el presupuesto debe preveer para el año calendario, salvo que con dicha partida se pretenda crear el Ministerio de Desarrollo Rural, cuya existencia debe resevarse a la ley común.

XV.SOBRE LA FACULTAD OTORGADA AL MINISTERIO DE HACIENDA Y AL BANCO CENTRAL PARA QUE GESTIONEN UNA NUEVA REESTRUCTURACION DE LA DEUDA EXTERNA BILATERAL DE COSTA RICA CON LOS PAISES MIEMBROS DEL CLUB DE PARIS Y SUSCRIBAN LOS CORRESPONDIENTES ACUERDOS (ARTICULO 21 DE LAS NORMAS DE EJECUCION DEL PRESUPUESTO).

En relación con esa norma, los diputados manifiestan que compromete el crédito público y lo sustrae del control legislativo. Como ya se mencionó anteriormente las normas presupuestararias no pueden, sin incurrir en una violación a normas constitucionales y legales, imponer deberes, establecer prohibiciones, crear competencias, conferir atribuciones u organizar las actividades públicas. Es evidente que la norma consultada otorga competencia al Ministerio de Hacienda y al Banco Central para que gestionen una nueva reestructuración de la deuda externa bilateral de Costa Rica con los países miembros del Club de París, para lo cual deberán suscribir los correspondientes acuerdos. Esa competencia o facultad conferida por la norma no tiene relación con la fijación de los ingresos probables y los gastos autorizados de la Administración Pública, por tanto, se otorga sobre materia ajena a la presupuestaria, de lo que resulta la inconstitucionalidad de dicha disposición.

XVI. SOBRE LA EMISION DE BONOS DE DEUDA INTERNA PARA FINANCIAR EL PRESUPUESTO

Los diputados solicitan la opinión de la Sala en relación con en financiamiento del presupuesto con la emisión de bonos de Deuda Interna, porque consideran que es un derecho ciudadano el que el Estado se financie en forma racional y las altas emisiones de bonos inciden en la inflación y las tasas de interés, afectando directamente a todos los ciudadanos. La emisión de bonos de Deuda Interna debe analizarse en relación con el concepto que se tiene del presupuesto y con los límites que la Constitución impone a los órganos encargados de elaborarlo, aprobarlo, ejecutarlo y liquidarlo. La Sala en la resolución No. 760-92 de las 15:15 horas del 11 de marzo de 1992, señaló:

"...El artículo 176 de la Constitución Política expresa que el presupuesto ordinario de la República comprende todos los ingresos probables y los gastos autorizados de la Administración Pública, durante el año económico. El concepto de presupuesto ordinario ha evolucionado a tal punto que actualmente se entiende, no solo como un documento jurídico contable, sino como un instrumento técnico organizador de la economía del Estado, consolidándose así su función de plan y control. Es importante observar, de conformidad con el artículo 176 constitucional, que el presupuesto se presenta como un acto de mera previsión o cálculo contable de los ingresos, mientras que respecto a los egresos públicos, mantiene el triple efecto: autorización del gasto público, limitación de la cantidad a gastar, fijación del destino que haya de darse a los créditos aprobados en el presupuesto... Todo lo expuesto da una idea clara de la naturaleza del presupuesto como proyección de ingresos que cubra los gastos autorizados de la Administración Pública, por lo que consiste en una expresión de términos contables del plan de acción del Gobierno para un período determinado..." De lo manifestado por la Sala se desprende que el Presupuesto Nacional no sólo constituye un documento jurídico contable, sino la expresión de un plan por medio del cual se pretende organizar económicamente a un sector del Estado, entiéndase la Administración Central, en un período determinado.

Congruente con lo anterior se tiene el hecho de que tanto la iniciativa en las leyes de presupuestos ordinarios y extraordinarios, como la preparación de sus proyectos, corresponde al Poder Ejecutivo (artículos 140, inciso 15, 177 y 180 de la Constitución Política y 35 de la Ley de la Administración Financiera de la República), potestad que no se ve afectada por la facultad que el artículo 179 de la Constitución otorga a la Asamblea Legislativa para aumentar los gastos presupuestos por el Ejecutivo, siempre que señale los ingresos que han de cubrirlos, previo informe de la Contraloría General de la República sobre la efectividad fiscal de los mismos. En este sentido, el presupuesto resulta de la aprobación que el Poder Legislativo otorga a la proposición que le formula el Ejecutivo de la forma en que pretende administrar y distribuir los fondos públicos durante un año. Desde esta perspectiva es propio del Poder Ejecutivo, como parte de las atribuciones que le competen, resolver la forma en va a proveer el financiamiento de los gastos del Estado y dentro de los límites que la Constitución impone a los órganos que intervienen en el procedimiento de aprobación de la ley de presupuesto y de su posterior ejecución y liquidación, no hacen referencia a una determinada forma de financiar el gasto público, sino que, determinan las competencias de cada órgano, estableciéndoles formas y plazos para su actuación y plantean como única exigencia, en relación con el contenido material del presupuesto, lo que se conoce como el principio de equilibrio financiero, que determina que el monto de los gastos presupuestos no podrá exceder el de los ingresos probables.

Es decir, a nivel constitucional al Poder Ejecutivo no se le impone una directriz sobre la forma en que debe proveer el financiamiento del presupuesto. Llevan razón los diputados al manifestar que la actuación de todos los órganos del Estado debe tener como fin el procurar el mayor bienestar de la totalidad de las personas, a través del ejercicio razonable de sus atribuciones, sin embargo, la Constitución no impone al Poder Ejecutivo una fórmula que lo limite en la forma de obtener los fondos que se requieran para solventar los gastos públicos. En consecuencia, la emisión de bonos de Deuda Interna, como forma de financiar parte de los gastos autorizados del presupuesto, no resulta contraria a las disposiciones constitucionales.

XVII.SOBRE LOS PUESTOS DE SUBDIRECTORES DE EDUCACION DE LAS PROVINCIAS REGULADOS EN EL ARTICULO 9 DEL PROYECTO DE LEY DE PRESUPUESTO, TITULO 113 DEL MINISTERIO DE EDUCACION PUBLICA.

Los diputados, en una ampliación que presentan a la consulta legisltativa en escrito de folios 21 a 27 del expediente, manifiestan que la exclusión de los puestos de Subdirectores de Educación de las provincias -establecidos en la relación de cargos fijos del Ministerio de Educación Pública para el año de 1995 (Título 113 del artículo 9 del Proyecto)- del Régimen de Servicio Civil, es inconstitucional porque modifica por ley de presupuesto normas ordinarias vigentes, como el artículo 8 del Estatuto de Servicio Civil y los artículos 191 y 192 de la Constitución Política. En primer lugar, es necesario señalar que con base en el concepto que la Sala dio del presupuesto de la Républica en el Considerando IV de la resolución No. 121-89 de las 11:00 horas del 23 de noviembre de 1989, éste constituye una ley formal y material, especial por la materia que regula y por el procedimiento de aprobación.

De confomidad con lo anterior, es necesario reconocer carácter normativo no solo a las normas generales del presupuesto, sino al resto de sus disposiciones, que no pueden considerarse como simples listados o cuentas de ingresos y egresos. Sin perjuicio de lo expuesto, es innegable la dificultad que para la Sala determina el que tales disposiciones no se encuentren estructuradas como normas de ley común, por lo que tratándose del caso concreto puede decirse que la simple aparición de una letra entre paréntesis a la par del nombre de un puesto, no proporciona elementos de juicio suficientes para que la Sala emita un criterio sobre su falta o no de constitucionalidad. Sin embargo, es importante indicar, en relación con la norma que se impugna, que el poner una (e) a la par de los puestos de Subdirectores de Educación de las provincias, que aparecen en la relación de cargos fijos del Ministerio de Educación Pública, no tiene, por sí sola, la virtud de excluir dichos puestos del Régimen de Servicio Civil, de conformidad con los criterios jurisprudenciales que en esta materia ya ha emitido la Sala.

Este Tribunal al resolver otros casos entre los que se cuenta los recursos de amparo relacionados con puestos de confianza y la Consulta Legislativa sobre el Proyecto de la Ley de Hidrocarburos, expresó su criterio en esta materia y manifestó que, en principio, todo puesto pagado por el erario público debe estar incluído en el Régimen de Servicio Civil, al repesto expresó la Sala, en el Considerando V de la sentencia No.1696-92, en relación con la aprobación de los artículos 191 y 192 de la Constitución Política:

"...Está claro, también, conforme lo expuesto, que el constituyente quiso adoptar el régimen del Servicio Civil, que cubriera a todos los servidores públicos. Así, dichos numerales buscaron enunciar los principios por los que debía regularse el régimen estatutario del empleado público, con el objeto de evitar injerencias extrañas en las funciones propias de sus servidores..." Este criterio se reforzó con lo manifestado por la Sala en la resolución No.6240-93 de las 14:00 horas del 26 de noviembre de 1993, Considerando XXI, que dispuso:

"...estima la Sala que tanto la descentralización como la desconcentración dentro de la Administración Pública, deben interpretarse como el traslado del ejercicio de funciones especializadas hacia entes u órganos públicos con el objeto de permitir el desarrollo técnico de los fines elegidos por el legislador; pero esta condición de descentralización o de desconcentración no presupone la constitución de un régimen de servicio público segregado que pudiese admitir diferencias en detrimento o de privilegio de los servidores de este tipo de agencias públicas...Es claro que la Constitución al hablar de un sólo régimen aplicable a los servidores públicos, no restringió el concepto de estatuto» al de un instrumento jurídico único, sino que pretende concretar un régimen uniforme de principios y garantías que regulen la protección de los derechos laborales del servidor público; especialmente atendiendo al de su derecho a la estabilidad.

Asimismo un régimen universal será una garantía para la Administración Pública de que contará con recursos humanos de la mejor calidad y condición, lo que permitirá el desarrollo eficiente de las funciones." Sin perjuicio de lo expuesto, se admiten como puestos excluídos del Régimen de Servicio Civil los que disponen los artículos 3, 4 y 5 del Estatuto de Servicio Civil y a los que excluyan otras leyes ordinarias. En este sentido, también se tiene que en relación con los puestos de confianza, de no estarse en los presupuestos de los incisos a) a e) del artículo 4 del Estatuto de Servicio Civil, para que los puestos de los servidores subordinados a Ministros y Viceministros sean declarados de confianza y por tanto excluídos del Régimen de Servicio Civil, debe mediar una resolución razonada de la Dirección General de Servicio Civil, en relación con una cantidad de funcionarios que no puede ser mayor de diez (artículo 4, inciso f) del Estatuto de Servicio Civil).

También se indica que en caso de puestos creados mediante una la ley de presupuesto, que no hayan sido incluídos en el Régimen de Servicio Civil, deben comunicarse a la Dirección General de Servicio Civil para que ésta decida si los asigna o los excluye del Régimen. En consecuencia, en caso que la (e) a la par del puesto, fuera intepretada por la Administración como la forma de excluir dichos puestos del Régimen de Servicio Civil, y que esta exclusión se haya efectuado contra lo dispuesto por la Sala en este Considerando, se estaría incurriendo en un abuso de poder contrario a los preceptos constitucionales, que sería suceptible de ser analizado por la Sala en la vía del recurso de amparo.

XVIII.El Magistrado Piza salva el voto y declara que también son inconstitucionales las autorizaciones contenidas en los citados inicisos 14, 23, 25 y 36 del artículo 12.

POR TANTO

Se evacua la consulta en el sentido de que son inconstitucionales las disposiciones: del artículo 12, los incisos 18, 19, 22, 29, 31, 32 y 33 y los artículos 13, 22, 23, 24, 25, 27, 28 y 29. No son inconstitucionales las normas de los incisos 14, párrafos a y b, 23 párrafo final, 25 párrafo final y 36, todas del artículo 12, en el tanto la autorización que se consigna para que el Poder Ejecutivo, por decreto pueda variar la relación de puestos o partidas aprobadas, se realice dentro del mismo programa.
