San José, at sixteen hours and fifteen minutes on thirteen October nineteen ninety-eight.- Action of unconstitutionality (acción de inconstitucionalidad) brought by Nombre176627 , WIDOWED, IDENTITY CARD CED61520, SERGIO ZUÑIGA AGUILAR, MARRIED, IDENTITY CARD CED131747, AND Nombre176628, IDENTITY CARD CED61519, against ARTICLE 71 OF LAW NO. 7575 (LEY FORESTAL OF 13 FEBRUARY 1996).

Findings of Fact:

  1. 1The petitioners request that Article 71 of Law No. 7575, Ley Forestal of 13 February 1996, be declared unconstitutional. They allege that the challenged provision is contrary to Article 50 of the Political Constitution. In addition to the scientific criteria recognizing that Zona Protectora Tivives constitutes one of the country’s most important wetland formations and contains the best-preserved mangrove forest on Costa Rica’s Pacific coast, the petitioners argue that the boundary modification established by the challenged provision reduces the area by fourteen percent. The effects of reducing the area encompassed by the protected zone (zona protectora) would include: 1. promoting a change in land use (uso del suelo) contrary to the capacity and potential of slopes and intermediate areas, causing sedimentation of the mangrove forest and degradation of the principal resource that led to the creation of the area; 2. causing biodiversity loss and the destruction of buffer zones (zonas de amortiguamiento), habitats, and biological corridors, as well as a severe impact on the area’s principal ecosystem: the mangrove forest; 3. harming the area’s tourism potential and degrading the natural landscape; 4. expanding the agricultural frontier onto unsuitable land; 5. fragmenting the conservation unit and some of its habitats.Furthermore, the challenged provision is not supported by technical criteria, constitutes a politically motivated action that is environmentally unjustified, and legitimizes actions declared unlawful by the Sala Constitucional in a prior proceeding, thereby evading enforcement of its judgment and the administration of justice.
  2. 2By decision issued at ten hours and seventeen minutes on thirty April nineteen ninety-seven (appearing at folio 23 of the case file), the action was admitted for processing, and the Procuraduría General de la República was granted a hearing.
  3. 3The corresponding notices were published in Boletines Judiciales numbers 93, 94 and 95, dated 16, 19 and 20 May 1997.
  4. 4The Procuraduría General de la República submitted its report, appearing at folios 27 through 40, in which it concludes: FIRST. That because Article 73 of Ley Forestal No. 7575 of 13 February 1996 repealed Ley Forestal No. 4465 of 25 November 1969, which was the legal basis for Executive Decree No. 17023 of 6 May 1986—an executive regulation—Zona Protectora Tivives, created by the latter legislation, legally ceased to exist. SECOND. That the legal framework contained in Law No. 4465 and Executive Regulatory Decree 17023 was repealed by the new legal framework represented by Ley Forestal No. 7575, Article 71 of which—the challenged provision—directly creates Zona Protectora Tivives with the geographical dimensions specified therein. THIRD. That if Article 71 of Ley Forestal No. 7575 of 16 April 1996 were annulled, the protected zone would legally disappear and would no longer exist under any of the traditional forms of legislation, namely statutes or executive regulations; consequently, the action does not constitute a reasonable means of protecting the diffuse right or interest (interés difuso) allegedly infringed and should have been summarily dismissed at the appropriate time.FOURTH. That the request to annul Article 71 of Ley Forestal No. 7575 of 16 April 1996 on the ground that it violates Article 50 of the Constitution likewise does not constitute a reasonable means of protecting the alleged diffuse interest, because the requested annulment would result in the definitive extinction of the protected zone whose protection is sought. FIFTH. That this action must be dismissed.

Legal Analysis:

I. ADMISSIBILITY

The action is admissible because the petitioners have standing (legitimación) under Article 75 of Ley de la Jurisdicción Constitucional. Indeed, because this matter concerns the defense of a diffuse interest—namely, environmental protection—it is unnecessary for there to be a prior proceeding in which the unconstitutionality now alleged had been raised, as this Chamber has repeatedly held. Accordingly, the exception set forth in the second paragraph of the aforementioned Article 75 applies, and the action is therefore admissible.

II. MERITS

The challenged provision, Article 71 of Law No. 7575, Ley Forestal of 13 February 1996, provides:

“Article 71.- Modification of Boundaries.- The boundaries of Zona Protectora Tivives are hereby modified with respect to the lands encompassing the Mata de Limón and Tivives mangrove forests, as well as the existing remnant of tropical dry forest located on Barranca map sheet N( 32451, at a scale of 1 :50.000 of Instituto Geográfico Nacional, as follows: beginning at the intersection of the railway line and the Alto Cascabel-Salinas road, at coordinates 212650 N and 460450 E; the boundary follows the railway line for approximately 250 meters to coordinates 212900 N, 460200 E, and then continues in a generally SW direction until reaching the boundary of the mangrove forest. It then continues along the dividing line between mangrove forest and freshwater land to the point at coordinates 212500 N and 458500 E in the Mata de Limón estuary (estero); it crosses the estuary in a generally westward direction until reaching the mangrove forest again at the point at coordinates 211900 N and 458180 E, once again in the Mata de Limón estuary.

From this last point, in a generally NE direction, the boundary continues to the point at coordinates 212050 N and 458500 E, located on the eastern bank of the Mata de Limón estuary. From there, the boundary continues along the dividing line between mangrove forest and freshwater land to the point at coordinates 211520 N and 459250 E. From there, it proceeds in a straight line in a generally SW direction along the boundary of Hacienda Salinas to an intermittent stream (quebrada intermitente) located at the point at coordinates 210200 N and 458950 E, and then follows that stream downstream to its mouth at the sea. The boundary follows the coastline to the point at coordinates 207540 N and 457180 E, at Playa Tivives. From this last point, it proceeds on a bearing of N 75( E for an approximate distance of 230 meters, to the point at coordinates 207600 N and 457400 E, then continues along the maritime-terrestrial zone (zona marítimo terrestre) line at Playa Tivives until it again reaches the boundary of the mangrove forest at coordinates 207000 N and 45860 E. It then follows the boundary of the mangrove forest to a point near the western bank of Río Jesús María at coordinates 205650 N and 459850 E and continues in a generally SW direction for a distance of 350 meters to the point at coordinates 205300 N and 457750 E, located at the mouth of Río Jesús María; from there it continues upstream along the eastern bank to coordinates 205440 N and 460500 E and proceeds along the edge of the mangrove forest to the point at coordinates 207750 N and 459350 E, located on the main road to Playa Tivives.

From this point, the boundary continues in a straight line in a generally NW direction for a distance of 100 meters to the point at coordinates 207800 N and 459250 E, and then in a straight line in a generally NE direction for a distance of 680 meters to coordinates 208400 N and 459450 E. It then continues in a straight line on a bearing of Dirección20694 for a distance of 270 meters to coordinates 208350 N and 459800 E, and proceeds in a straight line in the Dirección20695 direction for a distance of 280 meters to the point at coordinates 208500 N and 460000 E; it then continues due north for a distance of 500 meters to coordinates 209000 N and 460000 E. From this point, it proceeds due east for a distance of 300 meters to coordinates 20900 N and 460300 E, and continues due north for a distance of 130 meters until intersecting a road at coordinates 210300 N and 460300 E; it then follows a straight line in a generally NE direction for a distance of 1200 meters to the point at coordinates 211050 N and 461250 E. It proceeds in a generally NE direction for a distance of 200 meters until intersecting the Carretera Costanera Sur connecting Caldera and Orotina, at the point at coordinates 211200 N and 461400 E. The boundary follows the coastal highway in a general direction for an approximate distance of 900 meters to the point at coordinates 210800 N and 462250 E, located on the contour line 20 meters above sea level; from this point, the boundary follows that contour line in a generally NE direction, skirting Cerro Coyolar (Cambalache), for a distance of 1400 meters to the point at coordinates 211800 N and 462800 E, and then proceeds in a generally NW direction for a distance of 300 meters to the point at coordinates 212100 N and 462650 E; the boundary then continues due west for a distance of 600 meters to coordinates 212100 N and 462050 E. It continues in a generally SW direction for a distance of 1500 meters until intersecting the Carretera Costanera Sur at the point at coordinates 211250 N and 460900 E. From this point, it proceeds in a generally SW direction for a distance of 1000 meters to coordinates 211000 N and 460000 E. It then proceeds on a NW bearing for a distance of 700 meters to the point at coordinates 211650 N and 459750 E, located adjacent to the mangrove forest, and continues on a generally NE bearing, skirting the Mata de Limón mangrove forest, until reaching the starting point of this description at coordinates 212650 N and 460450 E.” From the literal wording of the transcribed provision, it follows that it constitutes an amendment to the delimitation (delimitación) established in Decreto No. 17023-MAG dated 6 de mayo de 1996, Article 1 of which creates the "Zona Protectora Tivives" and specifies its boundaries and area.

However, in the opinion of the Procuraduría General de la República, this is not an amendment but an entirely new provision because, in its view, the cited decree was implicitly repealed (implícitamente derogado) by the enactment of Ley N( 7575, since that law repealed Ley Forestal N( 4465, which had served as its legal basis. The Procuraduría’s position cannot be accepted because, as will be discussed below (Considerando VI), the decree in question was not automatically repealed by Ley N( 7575 and, consequently, Article 71 thereof does amend the boundaries of the "Zona Protectora Tivives." Thus, the constitutional review (análisis de constitucionalidad) of the challenged provision must be conducted on the basis that it is an amendment to the cited decree, rather than an entirely new provision. Likewise, it must be borne in mind that, according to the petitioners’ statements, the evidence they submitted, and the corresponding legislative record (expediente legislativo), the approved boundary change does not entail an increase in the size of the zone, but rather a reduction in the area subject to protection.

The dispute centers precisely on whether that reduction in area—that is, the removal of protection (desprotección) from part of the zone that was previously protected—is unconstitutional because it is contrary to Article 50 of the Constitución Política.

III.Article 50 of the Constitución Política, which the petitioners claim has been violated, recognizes the right of all inhabitants of the country to enjoy a healthy and balanced environment:

"The State shall seek the greatest well-being of all inhabitants of the country by organizing and promoting production and the most appropriate distribution of wealth.

Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that violate that right and to seek compensation for the harm caused.

The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding liabilities and penalties." This Chamber has previously addressed the matter of protected areas (áreas protegidas) and their possible declassification (desafectación). Thus, in Judgment N( 8743-97, issued at dieciocho horas cincuenta y un minutos on veintitrés de diciembre de mil novecientos noventa y siete, this Court stated:

"II. CERTAIN CONSIDERATIONS REGARDING THE LEY DE PROTECCION DEL PARQUE LA SABANA PADRE CHAPUI (N(7361 del 10/11/93).

This Law was unquestionably enacted under a strictly conservationist approach toward what has come to be known as the "Parque La Sabana Padre Chapuí," and a greater scope of protection in that regard can be discerned because, under the preceding Ley Orgánica de la Dirección General de Educación Física y Deportes, the aforementioned area, then known by another name, had been designated "for the direct or indirect service of physical education and sports in the country" (Ley N(3656, del 6 de enero de 1966, Article 5( first paragraph). In addition, it should be noted that the law stated that "its designated use may be changed only by law," thereby justifying the single article of Ley N(7361, which provides:

"The construction of structures in the Parque La Sabana Padre Chapuí, understood as the property described in the first paragraph of Article 5 of Ley N( 3656 del 6 de enero de 1966, is hereby prohibited." It is therefore apparent that the permitted use of the entire La Sabana area was made more restrictive. It is highly significant that the very same Article 1(, in the following paragraph, establishes as an exception, in the nature of an authoritative interpretation (interpretación auténtica) incorporated into the statutory text itself, "the construction of playing fields and other sports facilities, provided that they are outdoors and are not enclosed by barriers, fences, or similar structures." This reveals a progression in the legislature’s thinking, as it gradually came to consider it necessary to grant the park statutory protection, thereby preventing a return to the times when portions of it were progressively taken away and ensuring that, from that point forward, the passage of time and repeated small encroachments would not frustrate the purpose originally intended by the donor of these lands.

III. REGARDING AN IMPLICIT DECLASSIFICATION THROUGH THE ONE-TIME AUTHORIZATION CONTAINED IN THE BILL

To summarize the foregoing, it may be observed that, while Ley N(3656/66 required that the designated use of the Llano de La Sabana be changed only by another law, N( 7361/93 prohibited all types of construction except outdoor sports facilities, provided that they were not enclosed by barriers, fences, or similar structures. The preceding recital (considerando) referred to this as a tightening of the purposes for which the area in question was designated, which thereafter were identified strictly as those relating to "sports and recreational activities." Upon further analysis, this also represents a major change from the prior legislation, which declared that La Sabana was intended for the "direct or indirect" service of physical education and sports.

In practice, and not solely by virtue of the Laws cited herein, La Sabana must be recognized as a protected tract of land specifically intended to ensure a healthy and ecologically balanced environment, as that concept may be expressed under Article 50 of the Constitución Política.

It is precisely for this reason that the Chamber considers that the statement contained in the Bill now under review—that this is an exception to the general rule and is authorized "on a one-time basis"—does not cure its unconstitutionality. The park’s use for sports and recreation is consistent with Article 50 of the Constitution, whereas the right that is now intended to be promoted—namely, art or culture in general—which also falls within the purposes of the State, certainly can and must be fulfilled without diminishing the purposes that sports have been guaranteed in La Sabana from the outset, even though, as noted, there may have been more than one departure from those purposes in the past. The Chamber finds unreasonable the implicit declassification of the Park, notwithstanding the Bill’s own effort to limit the construction area, because the pretext of a one-time authorization could be used to continue encroaching upon this protected environment, whose exclusive public use for sports and recreation was deemed legitimate, particularly given the critically important function that La Sabana serves amid the increasingly complex conditions of urban development.

Alongside other developments in the past, this Bill represents another step in the historical trend of assigning other purposes to the area under discussion, in violation of the right to a healthy environment. The argument that this is an exception would therefore do nothing to prevent identical or similar reasons from being invoked periodically to establish yet another exception, resulting in a further violation; indeed, the "one-time basis" argument could ultimately nullify the Park’s specific purpose, which existed even before a Law formally established that designated use. Thus, maintaining that the legislature is subject to no limits in this regard would lead to the conclusion that it could even repeal all legislation of this type, which would also conflict with a designation that the State accepted in good faith when Padre Chapuí donated these lands.

IV. FINAL CONSIDERATIONS

Lastly, it should be noted that the State has other entirely legitimate means of providing art and culture with appropriate spaces for their full expression and development, since the objective is not to prevent the public from accessing this type of right. Promoting culture on the land under discussion would occur virtually at the expense of the right to the environment and of a legitimate or appropriate use. Accordingly, the only reasonable course is to maintain the status quo, as the parties requesting the advisory opinion contend. It bears noting that Ley N(7361 effectively froze the types of sports facilities that could be built in the Parque La Sabana, and it must be recalled that this law was enacted specifically in connection with the expansion of Dirección20098 , a project whose public-interest nature no one would deny, but which, as the parties requesting the advisory opinion state, was and remains inconsistent with the original spirit and designated use of the land.

Thus, common experience indicates that impairing the widespread use of the protected area for sports, physical education, recreation, contemplation, the mere enjoyment of its natural and scenic qualities, or the benefits it provides for urban oxygenation would cause greater harm than the benefit sought through the expansion of the Museo de Arte Costarricense’s premises. This is compounded by the aforementioned fact that no one can guarantee that, in the short or medium term, the need to provide the Museo with additional space to perform its important service will not again be presented "on another one-time basis." Accordingly, the State’s responsibilities toward the Museo de Arte Costarricense, or toward art in general, must be fulfilled, but not at the cost of unreasonably limiting the quality of life derived from the use of the various areas of the Parque La Sabana. If there is a need to provide the Museo with appropriate space, that space must be found elsewhere and through the use of other resources, rather than through what the Bill under review proposes.

For the foregoing reasons, the Chamber considers that the Bill is unconstitutional insofar as it affects Article 50 of the Constitution, expressly clarifying that it has refrained from addressing the possible existence, in legislative matters, of a principle prohibiting the individual repeal of a law (principio de inderogabilidad singular de la ley), because that issue was not expressly raised by the parties requesting the advisory opinion." It is clear from the judgment transcribed that once a given area has been declared a protected zone (zona protectora) by an act of the State, the State may not simply remove that designation (desafectarlo), in whole or in part, to protect other interests—public or private—to the detriment of the enjoyment of a healthy environment, in accordance with Article 50 of the Constitution. Now, the fact that a provision, regardless of its rank, has declared a given area a protected zone does not mean that an immutable zone has been established, such that its area may under no circumstances be reduced by subsequent legislation.

Nevertheless, it must be borne in mind that the declaration and delimitation of a protected zone, in compliance with Article 50 of the Constitution, entails the protection of the fundamental right to the environment and, therefore, any reduction in its area must not impair that right, a matter that must be determined in each specific case. It is not necessarily unconstitutional for a subsequent law to reduce the area of a protected zone, a forest reserve (reserva forestal), a National Park, or any other site of environmental interest, provided that the measure is justified insofar as it does not violate the right to the environment. It may be that, owing to various circumstances, a particular site has lost, at least in part, the environmental significance that originally prompted its designation, which, once the relevant studies have been conducted, would justify its modification or reduction, in application of the constitutional principle of reasonableness (principio de razonabilidad constitucional).

Likewise, the initial delimitation of a protected zone—or an area of another kind—may ultimately prove insufficient and, for that reason, warrant the adoption of an amendment expanding its area. In the opinion of this Chamber, these are the matters that must be examined in the specific case of Article 71 of Ley N( 7575.

IV.The Legislative Assembly has enacted a body of provisions aimed at environmental conservation. Particularly noteworthy is the establishment of a series of classifications currently recognized under the common designation of “protected wild areas” (áreas silvestres protegidas); in this regard, reference must be made to Article 32 of the Ley Orgánica del Ambiente, No. 7554 of October 4, 1995:

“Article 32.- Classification of protected wild areas. The Executive Branch, through the Ministerio del Ambiente y Energía, may establish protected wild areas under any of the management categories (categorías de manejo) that may be established and those listed below:

  • a)Forest reserves.
  • b)Protected zones.
  • c)National parks.
  • d)Biological Reserves.
  • e)National wildlife refuges.
  • f)Wetlands.
  • g)Natural monuments.

Those management categories and any created in the future shall be administered by the Ministerio del Ambiente y Energía, except for those established in Article 33 of this law. Municipalities must assist in the protection of these areas.

The same cited body of law specifies powers and procedures for the creation of protected wild areas and the reduction of their surface area:

“Article 36.- Requirements for creating new areas. To create new State-owned protected wild areas, regardless of the management category established, the following requirements must first be met:

  • a)Preliminary physiographic, biological-diversity, and socioeconomic studies substantiating their creation.
  • b)Definition of the area’s objectives and location.
  • c)Technical-feasibility and land-tenure study.
  • d)Minimum funding to acquire, protect, and manage the area.
  • e)Preparation of maps.
  • f)Issuance of the respective law or decree.” “Article 38.- Reduction of protected wild areas. The surface area of protected wild areas constituting the State’s natural heritage (patrimonio natural del Estado), regardless of their management category, may be reduced only by a Law of the Republic, after the technical studies substantiating the measure have been conducted.” Both provisions require compliance with mandatory requirements for both the creation and the reduction of protected wild areas, which include those designated as “protected zones.” For their establishment, this entails the existence of “preliminary physiographic, biological-diversity, and socioeconomic studies substantiating their creation”; where the proposed measure is a reduction of the surface area subject to the aforementioned regime, it entails “technical studies substantiating” that measure. Both provisions are binding, including upon the Legislative Assembly, which shares with the Executive Branch the power to create protected wild areas and holds the exclusive authority to reduce their surface area.

Under the provisions transcribed above, and considering the specific case submitted for decision, the Legislative Assembly cannot validly approve a reduction in the surface area of a protected zone without first having a technical study substantiating its decision. Such action is contrary to the Political Constitution because it violates the constitutional principle of reasonableness in relation to Article 121, subsection 1), and Article 129 of the Political Charter. There is a precedent from this Chamber that is relevant to this issue, both because of the similarity of the alleged violation and because it concerns a situation in which failure to comply with certain requirements results in the violation of substantive constitutional provisions or principles. It is Judgment No. 2009, issued at 10 hours 30 minutes on April 21, 1995, in connection with an optional legislative consultation (consulta legislativa facultativa) concerning a bill intended to create a new canton. On that occasion, the Chamber stated:

“IV ).- CONSTITUTIONAL PROVISION AND LEGAL REGIME FOR THE CREATION OF NEW CANTONS.- Article 168 of the Political Constitution provides, insofar as relevant, that for Public Administration purposes the national territory is divided into provinces, cantons, and districts; the creation of new cantons requires approval by the Legislative Assembly by a vote of no fewer than two-thirds of all its members. The Political Constitution contains no other provision concerning the creation of new cantons. It is a general principle of Constitutional Law that every territorial jurisdiction existing when the supreme provision recognizing it and elevating it to the status of a decentralized institution of constitutional rank comes into being—in this case, the cantons—acquires the right to its full existence and identity, to the autonomy conferred upon it by a provision of equal rank (art. 170 id.), and to preserve its integrity and status as a decentralized administrative entity (the latter does not, of course, mean that it constitutes a form of State or government excluding all other forms of political administration, because, like any form of decentralization, it leaves the constituent power and even the State’s legislative power intact).

The necessary legal and constitutional conclusion therefore leads us to determine that it falls to the Legislative Branch to develop, or not to develop, the power contained in Article 168 of the Political Constitution concerning the creation of cantons, by establishing the requirements and formalities that give reasonable and proportionate content to the principles contemplated by the higher-ranking provision itself and, in any event, to such complementary principles as, although not contained in the original provision, are appropriate to make the exercise of that power possible.

V. LEY SOBRE DIVISION TERRITORIAL ADMINISTRATIVA (No

4366 of August 19, 1969).- This is precisely the law enacted by the Legislative Branch to govern the creation of new cantons. It must be noted that, by providing in the final paragraph of Article 168 that the affirmative vote of at least two-thirds of all members of the Legislative Assembly is required to create a canton, the Political Constitution gives a clear indication of the importance that the original constituent authority attached to territorial integrity and to all matters related to the territorial subdivision of the Provinces. In the Chamber’s opinion, the general principle of Law establishing that legal provisions bind even the authority that enacted them and, within the scope of its powers, its superior, means that a law regulating the operation of the Legislative Assembly in the exercise of a power that is also constitutional binds it in the specific cases in which it is to exercise that power.

This is merely an application of the general principle that a provision may not be set aside in a specific case (principio general de la inderogabilidad singular de la norma para el caso concreto); a general principle of constitutional rank, insofar as it applies to the legal system as a whole, as both a consequence and a condition of the rule of law in its entirety. In relation to the present matter, all of this means that, in creating a new municipal territorial entity, the Legislative Assembly must comply with the law it enacted for that purpose, without prejudice, of course, to its power to repeal or amend that law before exercising such authority.” (Underlining not in the original) According to the foregoing, mutatis mutandi, if, for the creation of a protected wild area, the Legislative Assembly established by law that specific requirements must be met in order to determine whether the designation in question is justified, it logically follows that certain requirements—such as conducting technical environmental studies—must also be met for its partial or total de-designation, in order to determine that the de-designation does not contravene Article 50 of the Constitution.

In this regard, we may speak of degrees of de-designation. Thus, not every de-designation of a protected area is unconstitutional, insofar as it entails no impairment of or threat to the right to the environment. Hence, to reduce any protected wild area, the Legislative Assembly must do so on the basis of sufficient and necessary technical studies establishing that the environment will neither be harmed nor placed at risk and, therefore, that Article 50 of the Constitution will not be violated. The principle of reasonableness, in relation to the fundamental right to the environment, requires that provisions enacted on this subject be duly supported by rigorous technical studies, even if no other legislation expressly so required. In the opinion of this Constitutional Court, the requirement contained in Article 38 of the Ley Orgánica del Ambiente N( 7554—that, before a protected wild area may be reduced by formal legislation, technical studies substantiating the measure must be conducted—is simply the concrete embodiment of the principle of reasonableness in matters of environmental protection.

V.It should also be emphasized, as noted above, that for Article 50 of the Political Constitution to be given effect and complied with, it is not enough for public authorities to enact measures protecting the environment. It is also essential that, in the exercise of their offices, those same officials refrain from issuing acts that contradict the aforementioned constitutional principle, as occurs with the provision whose constitutionality is under review, which, having been approved through a procedure that omitted a substantive requirement mandated by a law in force, provides for the reduction of an area declared to be a protected zone. Therefore, the challenged statutory provision, Article 71 of Ley No. 771 of Ley 7575, Ley Forestal of February 13, 1996, is also contrary to Article 50 of the Political Constitution.

VI.Regarding the reasonableness of the action brought as a means of protecting the constitutional right (derecho constitucional) that the petitioners consider to have been violated, it should be noted that the action is appropriate, and that the declaration of unconstitutionality (declaratoria de inconstitucionalidad) of Article 71 of Ley N( 7575 does not invalidate the Zona Protectora Tivives. First, even though Decreto No. 17023-MAG is based in part on the text of Ley No. 4465, Ley Forestal of 25 November 1969, a statute then in force that supported the creation of the Zona Protectora Tivives, the repeal of that legislation does not entail the automatic repeal of the aforementioned decree. It must not be forgotten that, ultimately, both Ley N( 4465—now repealed—and Decreto N( 17023-MAG merely implement the substance of Article 50 of the Constitution; thus, even though the immediate legislation that provided the basis for the decree has been replaced by other legislation, the decree remains in force both because it was promulgated pursuant to the legislation in force at the time and because its ultimate basis lies in the aforementioned constitutional article.

Moreover, the decree does not have the status of an executive regulation (reglamento ejecutivo) of the aforementioned law, as it lacks normative scope (alcance normativo) (see Article 121 of the Ley General de la Administración Pública). Likewise, the category known as a “protected zone” (zona protectora) is recognized in other provisions of the legal system, which provide a sufficient regulatory framework for Decreto No. 17023-MAG, notwithstanding the repeal of Ley No. 4465, Ley Forestal of 25 November 1969, or the declaration that section 71 of Ley No. 7575, Ley Forestal of 13 February 1996, is unconstitutional. The provisions referenced include section 32 of Ley No. 7554, Ley Orgánica del Ambiente of 4 October 1995, transcribed in Considerando IV. There are also provisions contained in international conventions governing the type of conservation areas (zonas de conservación) referenced herein, including the Convención Relativa a los Humedales de Importancia Internacional Especialmente como Habitat de Aves Acuáticas “Convención de Ramsar,” signed on 2 February 1971 and approved by the Asamblea Legislativa through Ley No. 7224 of 2 April 1991, and the Convención para la Protección de la Flora, de la Fauna y de las Bellezas Escénicas Naturales de los Países de América, approved through Ley No. 3763 of 19 October 1976.

In short, contrary to the opinion expressed by the Procuraduría General de la República, the creation and delimitation of the Zona Protectora Tivives is based on Decreto Ejecutivo N( 17023-MAG, whose area was modified by the provision now challenged; for the reasons stated, that decree was not implicitly repealed when Ley N( 4465 was repealed by Ley N( 7575.

VII.Consequently, the proper course is to grant the action of unconstitutionality (acción de inconstitucionalidad) brought and annul Article 71 of Ley N( 7575, Ley Forestal, of 13 February 1996. Pursuant to Article 91 of the Ley de la Jurisdicción Constitucional, this judgment has declaratory and retroactive effect (efecto declarativo y retroactivo) as of the date on which the provision now declared unconstitutional entered into force. Decreto No. 17023-MAG, which creates and delimits the Zona Protectora Tivives, is understood to remain in force.

Por tanto:

The action is granted. Consequently, Article 71 of Ley No. 7575, Ley Forestal of 13 February 1996, is annulled. This judgment has declaratory and retroactive effects as of the effective date of the annulled provision, without prejudice to rights acquired in good faith (derechos adquiridos de buena fe). A summary of this ruling shall be published in the Diario Oficial La Gaceta, and the ruling shall be published in full in the Boletín Judicial. Let notice be given. Let it be communicated to the Legislative, Executive, and Judicial Branches.

07294 Inconstitucionalidad Fecha: 13/10/1998 Res: 07294-98 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las dieciséis horas con quince minutos del trece de octubre de mil novecientos noventa y ocho.- Acción de inconstitucionalidad promovida por Nombre176627 , VIUDA, CEDULA DE IDENTIDAD CED61520, SERGIO ZUÑIGA AGUILAR, CASADO, CEDULA DE IDENTIDAD CED131747 Y Nombre176628 , CEDULA DE IDENTIDAD CED61519, contra EL ARTICULO 71 DE LA LEY NO. 7575 (LEY FORESTAL DEL 13 DE FEBRERO DE 1996).

Resultando:

  1. 1Los accionantes solicitan que se declare la inconstitucionalidad del artículo 71 de la Ley No. 7575, Ley Forestal del 13 de febrero de 1996. Alegan que la disposición impugnada es contraria al artículo 50 de la Constitución Política. Se señala en la argumentación de los accionantes, además de los criterios científicos que reconocen que la Zona Protectora Tivives constituye una de las formaciones humedales más importantes del país y contiene el manglar mejor conservado en el Pacífico costarricense, que mediante la modificación de límites acordada en la norma recurrida se reduce en un catorce por ciento. La reducción del área que comprende la zona protectora tendría dentro de sus efectos: 1. promover un cambio en el uso del suelo contra su capacidad y potencial en laderas y partes intermedias,ocasionando la sedimentación del manglar y la degradación del recurso principal que originó la creación del área; 2. provocar pérdida de biodiversidad, la destrucción de zonas de amortiguamiento, habitats y corredores biológicos, así como un alto impacto al ecosistema principal del área: el manglar; 3. perjudicar el potencial turístico de la zona y degradar el paisaje natural; 4. ampliar la frontera agrícola en terrenos no aptos; 5. desintegrar la unidad de conservación y algunos de sus habitats.Además, la norma cuestionada no está respaldada en criterios técnicos, es una acción política injustificada ambientalmente y legitima acciones declaradas ilegales por la Sala Constitucional en un proceso anterior, evadiendo la ejecución de su sentencia y la acción de la justicia.
  2. 2Por resolución de las diez horas diecisiete minutos del treinta de abril de mil novecientos noventa y siete (visible a folio 23 del expediente), se le dio curso a la acción, confiriéndosele audiencia a la Procuraduría General de la República.
  3. 3Los edictos respectivos fueron publicados en los Boletines Judiciales números 93, 94 y 95, de los días 16, 19 y 20 de mayo de 1997.
  4. 4La Procuraduría General de la República rindió su informe visible a folios 27 a 40, en el cual concluye: PRIMERO. Que al derogar el artículo 73 de la Ley Forestal No. 7575 de 13 de febrero de 1996 la Ley Forestal No. 4465 de 25 de noviembre de 1969, fundamento del Decreto Ejecutivo No. 17023 de 6 de mayo de 1986 -que es un reglamento ejecutivo- desapareció jurídicamente la Zona Protectora Tivives creada en esta última normativa. SEGUNDO. Que el ordenamiento contenido en la Ley No. 4465 y el Decreto Reglamento Ejecutivo 17023, es derogado por el nuevo orden jurídico representado por la Ley Forestal No. 7575 cuyo, artículo 71 -impugnado- crea directamente la Zona Protectora Tivives con las dimensiones geográficas allí precisadas. TERCERO. Que de accederse a la anulación del artículo 71 de la Ley Forestal No. 7575 de 16 de abril de 1996, la zona protectora desaparecería jurídicamente y ya no existiría en ninguno de los ordenamientos jurídicos tradicionales, como son la ley o el reglamento ejecutivo, razón por la cual la acción no constituye un medio razonable para amparar el derecho o el interés difuso que se considera lesionado, y debió rechazarse de plano oportunamente.CUARTO. Que la pretensión de anular el artículo 71 de la Ley Forestal No. 7575 de 16 de abril de 1996, por atribuírsele que lesiona el artículo 50 constitucional, no constituye tampoco un medio razonable para proteger el interés difuso alegado, por cuanto la anulación solicitada provocaría la extinción definitiva de la zona protectora cuya defensa se reclama. QUINTO. Que la presente acción debe ser desestimada.
  5. 5La vista señalada en los artículos 10 y 85 de la Ley de la Jurisdicción Constitucional se celebró el día 19 de junio de 1998, a las nueve horas diez minutos, con la presencia de los señores Magistrados Mora Mora (quien presidió), Piza Escalante, Solano Carrera, Sancho González, Arguedas Ramírez, Calzada Miranda y Armijo Sancho; y en representación de la Procuraduría General de la República, el Lic. Farid Beirute Brenes y el Dr. Odilón Méndez Ramírez.
  6. 6En los términos y procedimientos se han observado las prescripciones de Ley.

Considerando:

I. SOBRE LA ADMISIBILIDAD

La acción es admisible, pues los recurrentes están legitimados en los términos del artículo 75 de la Ley de la Jurisdicción Constitucional. En efecto, por tratarse de la defensa de un interés difuso, sea, la protección del ambiente, no es necesaria la existencia de un asunto provia donde se hubiese alegado la inconstitucionalidad que ahora se reclama, como en reiteradas ocasiones lo ha manifestado esta Sala. Es aplicable, entonces, la excepción prevista en el pátrafo segundo del artículo 75 citado y, por ende, la acción es admisible.

II. SOBRE EL FONDO

La norma cuestionada, artículo 71 de la Ley No. 7575, Ley Forestal del 13 de febrero de 1996, establece:

"Artículo 71.- Modificación de límites.- Se modifican los límites de la zona protectora Tivives, en los terrenos comprendidos en los manglares de Mata de Limón y Tivives, así como el reducto de bosque tropical seco existente, ubicado en la hoja cartográfica Barranca N( 32451, a escala 1 :50.000 del Instituto Geográfico Nacional de la siguiente forma: partiendo de la intersección de la línea férrea con el camino Alto Cascabel-Salinas, en las coordenadas 212650 N y 460450 E; el límite sigue sobre la línea férrea, aproximadamente 250 metros, hasta las coordenadas 212900 N, 460200 E y continúa luego con rumbo general SO, hasta encontrar el límite del manglar. Luego continúa por la línea divisoria manglar-tierra dulce, hasta el punto de las coordenadas 212500 N y 458500 E en el estero de Mata de Limón; pasa sobre el estero, con un rumbo general Oeste, hasta encontrar nuevamente el manglar hasta el punto de las coordenadas 211900 N y 458180 E, otra vez en el estero Mata de Limón.

De este último punto, con un rumbo general NE, el límite prosigue hasta el punto de las coordenadas 212050 N y 458500 E, ubicado en el margen oriental del estero de Mata de Limón. De aquí prosigue el lindero sobre la línea divisoria del manglar-tierra dulce, hasta el punto de las coordenadas 211520 N y 459250 E. De ahí se parte, con una línea recta y dirección general SO sobre el lindero de la Hacienda Salinas, hasta una quebrada intermitente ubicada en el punto de las coordenadas 210200 N y 458950 E y se sigue, aguas abajo de dicha quebrada hasta su desembocadura en el mar. El límite sobre la línea de costa, hasta el punto de las coordenadas 207540 N y 457180 E, en la playa Tivives. De este último punto, con rumbo N 75( E y una distancia aproximada de 230 metros. hasta el punto de las coordenadas 207600 N y 457400 E, continúa sobre la línea de la zona marítimo terrestre en la playa Tivives, hasta encontrar nuevamente el límite del manglar en las coordenadas 207000 N y 45860 E. Luego pasa por el límite de manglar, hasta un punto cercano a la margen occidental del río Jesús María en las coordenadas 205650 N y 459850 E y continúa, con dirección general SO, una distancia de 350 metros, hasta el punto de las coordenadas 205300 N y 457750 E, ubicado en la boca del río Jesús María; por ahí prosigue aguas arriba por la margen oriental, hasta las coordenadas 205440 N y 460500 E y continúa bordeando el manglar, hasta el punto de coordenadas 207750 N y 459350 E, ubicado en el camino principal de playa Tivives.

A partir de este punto, el límite continúa en la línea recta con dirección general NO, una distancia de 100 metros, hasta el punto de las coordenadas 207800 N y 459250 E y luego, en línea recta con dirección general NE, una distancia de 680 metros, hasta las coordenadas 208400 N y 459450 E. Continúa después en línea recta, con rumbo Dirección20694, una distancia de 270 metros, hasta las coordenadas 208350 N y 459800 E y prosigue en línea recta con dirección Dirección20695, una distancia de 280 metros, hasta el punto de las coordenadas 208500 N y 460000 E; luego continúa con rumbo Norte franco, una distancia de 500 metros, hasta las coordenadas 209000 N y 460000 E. De este punto, con rumbo Este franco, se prosigue por una distancia de 300 metros, hasta las coordenadas 20900 N y 460300 E y se continúa con rumbo Norte franco, una distancia de 130 metros, hasta intersectarse con un camino en las coordenadas 210300 N y 460300 E, se sigue en línea recta con dirección general NE, una distancia de 1200 metros, hasta el punto de las coordenadas 211050 N y 461250 E. Se prosigue con dirección general NE, una distancia de 200 metros, hasta intersectarse con la carretera costanera Sur que comunica Caldera con Orotina, en el punto de las coordenadas 211200 N y 461400 E. El límite se traza por la carretera costanera con dirección general una distancia aproximada de 900 metros, hasta el punto de las coordenadas 210800 N y 462250 E, ubicado en la curva de nivel de 20 metros sobre el nivel del mar; a partir de este punto, el límite continúa por esa curva con dirección general NE, bordeando el cerro Coyolar (Cambalache), una distancia de 1400 metros, hasta el punto de las coordenadas 211800 N y 462800 E y va con dirección general NO una distancia de 300 metros, hasta el punto de las coordenadas 212100 N y 462650 E y el límite sigue con dirección Oeste franco, una distancia de 600 metros, hasta las coordenadas 212100 N y 462050 E. Continúa con dirección general SO, una distancia de 1500 metros, hasta intersectarse con la carretera costanera Sur, en el punto de las coordenadas 211250 N y 460900 E. A partir de este punto, se prosigue con dirección general SO una distancia de 1000 metros, hasta las coordenadas 211000 N y 460000 E. Se prosigue con rumbo NO, una distancia de 700 metros, hasta el punto de coordenadas 211650 N y 459750 E, ubicado contiguo al manglar y se continúa con rumbo general NE, bordeando el manglar de Mata de Limón, hasta encontrar el punto inicial de esta descripción en las coordenadas 212650 N y 460450 E." De la literaliad de la norma transcrita se colige que se trata de una modificación a la delimitación establecida en el Decreto No. 17023-MAG del día 6 de mayo de 1996, cuyo artículo 1o. crea la "Zona Protectora Tivives" y señala sus límites y área.

Ahora bien, en criterio de la Procuraduría General de la República, no se trata de una modificación, sino de una norma enteramente nueva, pues, a su juicio, el citado decreto fue implícitamente derogado por la promulgación de la Ley N( 7575, toda vez que ésta derogó la Ley Forestal N( 4465, que era el fundamento de aquél. La tesis de la Procuraduría no es de recibo, ya que, según se analizará más adelante (Considerando VI), el decreto en cuestión no fue automáticamente derogado por la Ley N( 7575 y, en consecuencia, el artículo 71 de ésta sí reforma los límites de la "Zona Protectora Tivives". Así, pues, el análisis de constitucionalidad la norma cuestionada debe hacerse tomado como base el hecho de que es una reforma al decreto citado, no una norma enteramente nueva. De igual modo, debe tenerse en cuenta que, de conformidad con las manifestaciones de los accionantes, los medios probatorios por ellos aportados y el respectivo expediente legislativo, el cambio de linderos aprobado no implica un aumento de la cabida de la zona, sino una reducción del área sometida a protección.

Precisamente, la discusión se centra en el hecho de si esa reducción de cabida, es decir, esa desprotección de parte de la zona que antes estaba protegida, es inconstitucional por ser contraria a lo dispuesto en el artículo 50 de la Constitución Política.

III.El artículo 50 de la Constitución Política, el cual los accionantes invocan como infrinjido, reconoce el derecho de todos los habitantes del país a disfrutar de un ambiente sano y equilibrado:

"El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza.

Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado.

El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes." Ya esta Sala ha abordado el tema de las áreas protegidas y su posible desafectación. Así, en sentencia N( 8743-97 de las dieciocho horas cincuenta y un minutos del veintitrés de diciembre de mil novecientos noventa y siete, este Tribunal dijo:

"II. ALGUNAS CONSIDERACIONES SOBRE LA LEY DE PROTECCION DEL PARQUE LA SABANA PADRE CHAPUI (N(7361 del 10/11/93).

Ciertamente, esta Ley se emitió con criterio estrictamente proteccionista de lo que se ha llegado a denominar "Parque La Sabana Padre Chapuí", pudiendo notarse un dimensionamiento mayor en ese sentido, ya que en la antecedente Ley Orgánica de la Dirección General de Educación Física y Deportes, bajo otra denominación, la citada área había quedado afectada "al servicio directo o indirecto de la educación físico-deportiva del país" (Ley N(3656, del 6 de enero de 1966, artículo 5( párrafo primero). Adicionalmente, hay que precisar que allí se indicaba que "su destino no podrá ser variado sino en virtud de una ley" y de tal manera quedaba justificado un único artículo en la Ley N(7361, que dispone:

"Prohíbese realizar construcciones en el Parque La Sabana Padre Chapuí, entendido éste como la propiedad descrita en el párrafo primero del artículo 5 de la Ley N( 3656 del 6 de enero de 1966." Se nota allí, pues, que se rigidizó la utilización de toda el área de La Sabana. Resulta muy significativo que ese mismo artículo 1(, en párrafo seguido, se ocupe de establecer como excepción, a modo de una interpretación auténtica incorporada en el propio texto legal, "la construcción de canchas y de otras instalaciones deportivas, siempre y cuando sean al aire libre y no se encuentren aisladas por vallas, cercas u obras parecidas". Esto es lo que permite identificar una progresión en el pensamiento del legislador, que poco a poco estimó que resultaba necesario otorgar la protección de la ley al parque, evitando así que se regresara a los tiempos en que se le fueron cercenando espacios, evitando a partir de aquí que, con el paso del tiempo, a través de pequeños zarpazos, se llegara a inutilizar el fin que inicialmente tuvo el donador de estos terrenos.

III. SOBRE UNA DESAFECTACION IMPLICITA A TRAVES DE LA AUTORIZACION POR UNA UNICA VEZ CONTENIDA EN EL PROYECTO DE LEY

Si recapitulamos lo que se lleva dicho, podremos observar que mientras la Ley N(3656/66 exigía que el destino del Llano de La Sabana solamente pudiera modificarse a través de otra ley, la N( 7361/93 prohibió realizar todo tipo de construcción, excepto instalaciones deportivas al aire libre, siempre que no quedaran aisladas por vallas, cercas u obras parecidas. A esto se refería el considerando anterior, estimándolo como una rigidización de los fines a que quedaba destinada el área en cuestión, que en adelante quedaban identificados como los que tenían que ver con "prácticas deportivas y de recreación" en sentido estricto, lo cual, si se sigue con el análisis también implica un gran cambio respecto de la legislación anterior, que declaraba a La Sabana, destinada al servicio "directo o indirecto" de la educación físico deportiva.

En la práctica, y no solamente por virtud de las Leyes aquí citadas, debe reconocerse en La Sabana un espacio de terreno protegido y específicamente destinado a la satisfacción de un ambiente sano y ecológicamente equilibrado, tal y como podría decirse en términos del artículo 50 de la Constitución Política.

Precisamente por ello, estima la Sala que la mención contenida en el Proyecto ahora analizado, en el sentido de que se trata de una excepción a la norma general, y que es "por una sola vez", no permite salvarlo de la inconstitucionalidad, porque el uso para la práctica del deporte y la recreación del parque, se conforma con lo preceptuado por el artículo 50 constitucional, mientras que el derecho que ahora se desea potenciar, es decir, el arte o la cultura en general, que también está dentro de los fines del Estado, ciertamente puede y debe ser satisfecho sin mengua de los fines que desde el inicio tiene garantizado el deporte en La Sabana, aun cuando, como se dijo, en el pasado hubiera más de una claudicación en ese sentido. La Sala no encuentra razonable la desafectación que implícitamente se da del Parque, aun con el esfuerzo que el propio proyecto establece de una área de construcción limitada, ya que a través del prurito de una única vez, se podría continuar con el acecho a ese entorno protegido, cuyo uso público exclusivo para el deporte y la recreación se dijo resultaba legítimo, sino también por la importantísima función que cumple La Sabana en las condiciones cada día más complejas del desarrollo urbano.

A la par de otras vicisitudes del pasado, este proyecto es un paso más en la tendencia histórica de darle otros fines al área de comentario, con transgresión del derecho a un ambiente sano. El argumento de que se trata de una excepción, entonces, en nada obstaría para que cada cierto tiempo se acuda con idénticas o parecidas razones con el propósito de establecer una nueva excepción, operándose una nueva transgresión, y porque a través de ese argumento de "por una única vez" se podría hasta dejar sin efecto el fin específico que tenía el Parque, aún antes de que una Ley viniera a establecer que tal era su destino. Así, sostener que el legislador no tiene límites en tal sentido, llevaría hasta entender que incluso podría derogar toda legislación de este tipo, lo que choca, por otra parte, con una afectación que el Estado aceptó, de buena fe, cuando el Padre Chapuí realizó la donación de esos terrenos.

IV. CONSIDERACIONES FINALES

Por último, habría que señalar que el Estado tiene otros medios, perfectamente legítimos, para otorgar al arte y a la cultura, espacios apropiados para su plena vigencia y desarrollo, pues no se trata de impedir el acceso de la población a este tipo de derecho. El progreso de la cultura en los terrenos de comentario, se daría prácticamente a costa del derecho al ambiente y a una utilización legítima o conforme. De tal manera, que la única vía razonable resulta el mantener el statu quo, como lo sostienen los consultantes. No resulta ocioso indicar que la Ley N(7361 vino prácticamente a congelar el tipo de instalaciones deportivas que podrían levantarse en el Parque La Sabana y debemos recordar que esta ley se dictó precisamente a propósito de la ampliación de Dirección20098 , una obra a la que nadie le negaría carácter de interés público, pero que como citan los consultantes chocaba y choca aún con el espíritu y destino original del terreno.

De tal manera, la experiencia de cualquiera de nosotros permite indicar que el aprovechamiento masivo del área protegida, a través del deporte, la educación física, la recreación, la contemplación, o el mero disfrute de lo natural y escénico, o de las ventajas que para la oxigenación urbana tiene, provocaría una lesión mayor que la ventaja que pretende lograrse con la ampliación del área del Museo de Arte Costarricense, con el agravante ya indicado, de que nadie puede garantizar que en el corto o mediano plazo no se vuelva a presentar "por otra única vez", la necesidad de dotar al Museo de mayor área para prestar su importante servicio. Así, las responsabilidades del Estado con el Museo de Arte Costarricense, o el arte en general, deben cumplirse, pero no a costa de limitar irrazonablemente la calidad de vida que se obtiene a través del uso de las diferentes áreas del Parque La Sabana. Si existe necesidad de dotar a aquél de un espacio apropiado, deberá encontrarse en otro sitio y mediante la utilización de otros recursos, no a través de lo que el Proyecto bajo análisis propone.

Por lo dicho, la Sala estima que el Proyecto es inconstitucional en cuanto afecta el artículo 50 de la Carta Fundamental, aclarando expresamente que se ha marginado de toda mención la eventual existencia en materia legislativa de un principio de inderogabilidad singular de la ley, por no ser un tema formulado expresamente por los consultantes." De la sentencia transcrita queda claro que una vez declarada una determinada área como zona protectora por un acto del Estado, no puede éste, simplemente, desafectarlo en todo o en parte, para proteger otros intereses -públicos o privados- en menoscabo del disfrute de un ambiente sano, de conformidad con lo dispuesto en el artículo 50 constitucional. Ahora bien, el hecho de que una norma, del rango que sea, haya declarado como zona protectora una determianda área, no implica la constitución de una zona pétrea, en el sentido de que, de manera alguna, su cabida pueda ser reducida por una normativa posterior.

Sin embargo, se debe tener presente que la declaratoria y delimitación de una zona protectora, en cumplimiento de lo preceptuado en el artículo 50 constitucional, implica una defensa del derecho fundamental al ambiente y, por ello, la reducción de cabida no debe implicar un detrimento de ese derecho, situación que debe establecerse en cada caso concreto. No resulta necesariamente inconstitucional el hecho de que por medio de una ley posterior se reduzca la cabida de una zona protectora, una reserva forestal, un Parque Nacional o cualesquiera otros sitio de interés ambiental, siempre y cuando ello esté justificado en el tanto no implique vulneración al derecho al ambiente. Podría ser que, por diversas circunstancias, un determinado sitio haya perdido, al menos en parte, el interés ambiental que, en su momento, provocó, lo que, hechos los estudios del caso, justificaría su modificación o reducción, todo en aplicación del principio de razonabilidad constitucional.

Del mismo modo, la delimitación inicial de una zona protectora -o de otra índole- podría, a la larga, resultar insuficiente y, en razón de esto, motivar la aprobación de una reforma para ampliar la cabida. Estos aspectos son los que, a juicio de esta Sala, han de examinarse en el caso conreto del artículo 71 de la Ley N( 7575.

IV.La Asamblea Legislativa ha dictado un conjunto de disposiciones tendentes a conservación del ambiente. En particular merece resaltarse el establecimiento de una serie de figuras reconocidas actualmente bajo la denominación común de "áreas silvestres protegidas"; sobre este punto debe hacerse referencia al artículo 32 de la Ley Orgánica del Ambiente, No. 7554 del 4 de octubre de 1995:

"Artículo 32.- Clasificación de las áreas silvestres protegidas. El Poder Ejecutivo, por medio del Ministerio del Ambiente y Energía, podrá establecer áreas silvestres protegidas, en cualquiera de las categorías de manejo que se establezcan y en las que se señalan a continuación:

  • a)Reservas forestales.
  • b)Zonas protectoras.
  • c)Parques nacionales.
  • d)Reservas Biológicas.
  • e)Refugios nacionales de vida silvestre.
  • f)Humedales.
  • g)Monumentos naturales.

Esas categorías de manejo y las que se creen en el futuro, serán administradas por el Ministerio del Ambiente y Energía, salvo las establecidas en el artículo 33 de esta ley. Las municipalidades deben colaborar en la prevención de estas áreas.

El mismo cuerpo normativo citado indica competencias y procedimientos tendentes a la creación y reducción de la superficie de las áreas silvestres protegidas:

"Artículo 36.- Requisitos para crear nuevas áreas. Para crear nuevas áreas silvestres protegidas propiedad del Estado, cualquiera sea la categoría de manejo que él establezca, deberá cumplirse previamente con lo siguiente:

  • a)Estudios preliminares fisiogeográficos, de diversidad biológica y socioeconómicos, que la justifiquen.
  • b)Definición de objetivos y ubicación del área.
  • c)Estudio de factibilidad técnica y tenencia de la tierra.
  • d)Financiamiento mínimo para adquirir el área, protegerla y manejarla.
  • e)Confección de planos.
  • f)Emisión de la ley o el decreto respectivo." "Artículo 38.- Reducción de las áreas silvestres protegidas. La superficie de las áreas silvestres protegidas, patrimonio natural del Estado, cualquiera sea su categoría de manejo, sólo podrá reducirse por Ley de la República, después de realizar los estudios técnicos que justifiquen esta medida." Ambas normas establecen el cumplimiento de requisitos obligatorios tanto para la creación como para la reducción de las áreas silvestres protegidas, dentro de las cuales se comprenden las denominadas "zonas protectoras". Se trata de la existencia de "estudios preliminares fisiogeográficos, de diversidad biológica y socioeconómicos, que la justifiquen", en el caso del establecimiento, y de "estudios técnicos que justifiquen", en el caso que la medida pretendida sea una reducción de la superficie bajo el referido régimen. Ambas disposiciones son vinculantes, inclusive para la Asamblea Legislativa, cotitular, junto con el Poder Ejecutivo, de la competencia para crear áreas silvestres protegidas, y detentadora exclusiva de la potestad de reducir su superficie.

De conformidad con las disposiciones transcritas, y tomando en consideración el caso concreto que se somete a pronunciamiento, la Asamblea Legislativa no puede aprobar válidamente la reducción de la superficie de una zona protectora, sin contar antes con estudio técnico que justifique su decisión. Dicha actuación deviene contraria a la Constitución Política por violación del principio de razonabilidad constitucional en relación con los artículo 121, inciso 1), y 129 de la Carta Política. Sobre este tema existe un precedente de la Sala que resulta atinente, tanto por la similitud de la infracción que se invoca, como por tratarse de una hipótesis en que la no observancia de determinados requisitos tiene como efecto la transgresión de normas o principios sustanciales de rango constitucional. Se trata de la sentencia No. 2009, de las 10 horas 30 minutos del 21 de abril de 1995, dictada en relación con una consulta legislativa facultativa sobre un proyecto de ley tendiente a la creación de un nuevo cantón. En esa ocasión, la Sala expresó:

"IV ).- NORMA CONSTITUCIONAL Y REGIMEN LEGAL PARA LA CREACION DE NUEVOS CANTONES.- El artículo 168 de la Constitución Política, en lo que interesa, señala que para los efectos de la Administración Pública el territorio nacional se divide en provincias, cantones y distritos; la creación de nuevos cantones requiere ser aprobada por la Asamblea Legislativa mediante votación no menor de los dos tercios del total de sus miembros. Ninguna otra disposición contiene la Constitución Política sobre la creación de nuevos cantones. Como es principio general del Derecho de la Constitución que toda jurisdicción territorial existente al momento de surgir la norma suprema que la reconoce y la eleva a la categoría de institución descentralizada con rango constitucional, en este caso, los cantones, adquiere el derecho a su existencia plena e identidad, a su autonomía otorgada por norma de igual rango (art. 170 id.), a mantener su integridad y su condición de descentralización administrativa (esto último no implica, desde luego, que se trate de una forma de Estado o de gobierno que excluye toda otra forma de administración política, porque como toda descentralización, deja intacto el poder constituyente e incluso la potestad legislativa del Estado), la conclusión jurídico-constitucional necesaria nos lleva a determinar que corresponde al Poder Legislativo desarrollar o no la competencia contenida en el artículo 168 de la Constitución Política para la creación de cantones, estableciendo los requisitos y formalidades que le den contenido razonable y proporcionado a los principios que la propia norma superior haya concebido y en todo caso, a los complementarios que, sin estar en la norma originaria, sean apropiados para hacer posible el ejercicio de la competencia.

V. LEY SOBRE DIVISION TERRITORIAL ADMINISTRATIVA (No

4366 de 19 de agosto de 1969).- Es esta ley, precisamente, la que ha emitido el Poder Legislativo para regular la creación de los nuevos cantones. Es necesario señalar que al fijar la Constitución Política en el párrafo final del artículo 168, que se requiere el voto afirmativo de por lo menos dos tercios de la totalidad de los miembros de la Asamblea Legislativa para la creación de un cantón, da una clara idea de la importancia que el constituyente originario le ha dado a la integridad territorial y a toda la materia relacionada con la subdivisión territorial de las Provincias. A juicio de la Sala, el principio general de Derecho que establece que las normas jurídicas obligan incluso a la autoridad que las ha dictado y, dentro de su competencia, a su superior, implica que la ley que disciplina el funcionamiento de la Asamblea Legislativa para el ejercicio de una competencia también constitucional, la vincula en los casos concretos en que haya de ejercerla, lo cual no es más que aplicación del principio general de la inderogabilidad singular de la norma para el caso concreto; principio general de rango constitucional, como que es aplicable a la totalidad del ordenamiento jurídico, como derivación y a la vez condición del Estado de Derecho en su integridad.

Todo lo cual significa, en relación con el presente asunto, que para la creación de un nuevo ente territorial municipal la Asamblea Legislativa debe observar la ley que ha dictado con tal propósito, desde luego, sin perjuicio de su potestad de derogarla o reformarla previamente a su ejercicio." (Los subrayados no son del original) De acuerdo con lo citado, mutatis mutandi, si para la creación de un área silvestre protectora la Asamblea Legislativa, por medio de una ley, estableció el cumplimiento de unos requisitos específicos, a fin de determinar si la afectación en cuestión es justificada, lo lógico es que, para su desafectación parcial o total, también se deban cumplir determinados requisitos -como la realización de estudios técnicos ambientales- para determinar que con la desafectación no se transgrede el contenido del artículo 50 constitucional. En este sentido, podemos hablar de niveles de desafectación.

Así, no toda desafectación de una zona protegida es inconstitucional, en el tanto implique menoscabo al derecho al ambiente o amenaza a éste. De allí que, para reducir un área silvestre protegida cualquiera, la Asamblea Legislativa debe hacerlo con base en estudios técnicos suficientes y necesarios para determinar que no se causará daño al ambiente o se le pondrá en peligro y, por ende, que no se vulnera el contenido del artículo 50 constitucional. El principio de razonabilidad, en relación con el derecho fundamental al ambiente, obliga a que las normas que se dicten con respecto a esta materia estén debidamente motivadas en estudios técnicos serios, aún cuando no existiera otra normativa legal que así lo estableciera expresamente. A juicio de este Tribunal Constitucinal, la exigencia que contiene el artículo 38 de la Ley Orgánica del Ambiente N( 7554, en el sentido de que para reducir un área silvestre protegida por ley formal deben realizarse, de previo, los estudios ténicos que justifiquen la medida, no es sino la objetivación del principio de razonabilidad en materia de protección al ambiente.

V.Debe rescatarse además, como se señaló líneas arriba, que para otorgar vigencia y cumplir con el numeral 50 de la Constitución Política no basta que las autoridades públicas dicten medidas protectoras del ambiente. También es indispensable que en ejercicio de sus cargos esos mismos funcionarios no emitan actos contradictorios con el citado postulado constitucional, tal y como sucede con referencia a la norma cuya constitucionalidad se examina, la cual, aprobada mediante un procedimiento en que se omite un requisito sustancial, exigido por una ley vigente, establece la reducción de una superficie declarada como zona protectora. Por tanto, la disposición legal cuestionada, artículo 71 de la Ley No. 771 de la Ley No. 7575, Ley Forestal del 13 de febrero de 1996, también es contraria al artículo 50 de la Constitución Política.

VI.Sobre la razonabilidad de la acción planteada como medio para tutelar el derecho constitucional que los accionantes consideran violado, debe señalarse que la misma resulta idónea, y que la declaratoria de inconstitucionalidad del artículo 71 de la Ley N( 7575 no deja insubsistente la Zona Protectora Tivives. En primer lugar, aún cuando el Decreto No. 17023-MAG se fundamente parcialmente en el texto de la Ley No. 4465, Ley Forestal del 25 de noviembre de 1969, normativa de rango legal vigente que en su momento amparó la creación de la Zona Protectora Tivives, la derogatoria de dicho ordenamiento no implica la derogatoria automática del referido decreto. No debe olvidarse que, en última instancia, tanto la Ley N( 4465 -hoy derogada- como el Decreto N( 17023-MAG no son sino desarrollo del contenido del artículo 50 constitucional, de modo que, aún cuando la normativa inmediata que dio fundamento al decreto haya sido sustituida por otra, éste subsiste tanto por haber sido promulgado al amparo de la normativa vigente en su momento, como por tener su último fundamente en el citado artículo constitucional.

Por otra parte, el referido decreto no tiene el rango de reglamento ejecutivo de la citada ley, pues carece de alcance normativo (véase el artículo 121 de la Ley General de la Administración Pública). Asímismo, la figura denominada "zona protectora" se encuentra reconocida en otros textos del ordenamiento, que sirven de marco normativo suficiente al Decreto No. 17023-MAG, pese a la derogatoria de la Ley No. 4465, Ley Forestal del 25 de noviembre de 1969, o a la declaratoria de inconstitucionalidad del del numeral 71 de la Ley No. 7575, Ley Forestal del 13 de febrero de 1996. Dentro de las disposiciones a que se hace referencia está el numeral 32 de la Ley No. 7554, Ley Orgánica del Ambiente del 4 de octubre de 1995, transcrito en el Considerando IV. Existen también normas contenidas en convenios internacionales que regulan el tipo de zonas de conservación a las que se hace referencia, entre ellas la Convención Relativa a los Humedales de Importancia Internacional Especialmente como Habitat de Aves Acuáticas "Convención de Ramsar", suscrita el 2 de febrero de 1971, aprobada por la Asamblea Legislativa mediante Ley No. 7224 del 2 de abril de 1991, y la Convención para la Protección de la Flora, de la Fauna y de las Bellezas Escénicas Naturales de los Países de América, aprobada mediante Ley No. 3763 del 19 de octubre de 1976.

En fin, contrario al criterio externado por la Procuraduría General de la República, la creación y delimitación de la Zona Protectora Tivives tiene su fundamento en el Decreto Ejecutivo N( 17023-MAG, cuya cabida reformó la norma ahora impugnada, decreto que, por las razones dichas, no quedó derogado implícitamente por la derogatoria de la Ley N( 4465 por Ley N( 7575.

VII.En consecuencia, lo que procedente es acoger la acción de inconstitucionalidad planteada y anular el artículo 71 de la Ley N( 7575, Ley Forestal, del trece de febrero de mil novecientos noventa y seis. De conformidad con lo establecido en el artìculo 91 de la Ley de la Jurisdicciòn Constitucional, esta sentencia tiene efecto declarativo y retroactivo a la fecha de la vigencia de la norma ahora declarada inconstitucional. Se entiende que queda vigente el Decreto No. 17023-MAG, que crea y delimita la Zona Protectora Tivives.

Por tanto:

Se declara con lugar la acción. En consecuencia, se anula el artículo 71 de la Ley No. 7575, Ley Forestal del trece de febrero de mil novecientos noventa y seis. Esta sentencia tiene efectos declarativos y retroactivos a la fecha de vigencia de la norma anulada, sin perjuicio de derechos adquiridos de buena fe. Reséñese este pronunciamiento en el Diario Oficial La Gaceta y publíquese íntegramente en el Boletín Judicial. Notifíquese. Comuníquese a los Poderes Legislativo, Ejecutivo y Judicial.
