Constitutional challenge (acción de inconstitucionalidad) filed by Cámara Nacional de Radio and another, seeking a declaration that Article 178 of Law No. 6995 of 22 de julio de 1985 and Executive Decree No. 17318-G of 24 de noviembre de 1986, published in La Gaceta No. 231 of 4 de diciembre de 1986, are inapplicable on grounds of unconstitutionality because they are contrary to Articles 9, 105, 121 subsections 1), 11), 13), and 20), 123, 124, 125, 129, and 176 et seq. of the Political Constitution.
BACKGROUND:
I.The petitioners request that Article 178 of Law No. 6995 of veintidós de julio de mil novecientos ochenta y cinco and Executive Decree No. 17318-G of veinticuatro de noviembre de mil novecientos ochenta y seis be declared unconstitutional.
II.Article 178 of Law No. 6995 provides for the transfer of Unidad de Control Nacional de Radio, Code 06.104, to Dirección Nacional de Comunicaciones as an attached unit. It further provides that Junta Administrativa de la Dirección Nacional may establish, modify, or eliminate fees and revenues to be collected, and take the pertinent measures relating thereto, by virtue sic of the services provided by Unidad de Control Nacional de Radio.
III.The same challenged article repeals the provisions concerning the amounts of fees and rates established by Law No. 1758 of diecinueve de junio de mil novecientos cincuenta y cuatro, as amended (Ley de Radio y Televisión), and its Regulations. It likewise establishes that Unidad Nacional de Control de Radio shall be included for all purposes in every provision of Law No. 5870 of once de diciembre de mil novecientos setenta y cinco, as amended (Ley de Creación de la Dirección Nacional de Comunicaciones), and that fifty percent of the funds collected by CORTEL (Dirección de Correos y Telégrafos Nacionales) on this account must be deposited into a special-purpose account. The remainder shall be used for the development and modernization of Unidad de Control Nacional de Radio and for scholarships and training for its personnel, pursuant to the regulations to be issued by Ministerio de Gobernación within thirty days following the enactment of this law.
IV.To implement that article, the Executive Branch promulgated Executive Decree No. 17318-G of veinticuatro de noviembre de mil novecientos ochenta y seis, published in La Gaceta No. 231 of cuatro de diciembre de mil novecientos ochenta y seis.
V.The petitioners instituted special tax proceedings (juicio especial tributario) before Sección Segunda del Tribunal Superior Contencioso Administrativo, on the grounds that “Executive Decree No. 17318-G of 24 de noviembre de 1986” and the acts arising therefrom “are not in accordance with law.”
VI.On diez de agosto de mil novecientos ochenta y ocho, this action was filed with Secretaría General de la Corte Suprema de Justicia, and on veinte de octubre de mil novecientos ochenta y nueve, this Chamber assumed jurisdiction over it.
VII.The petitioners allege that Article 178 of Law No. 6995 and Executive Decree 17318-G violate Articles 9, 105, 121 subsections 1), 11), and 13), 123, 124, and 125, in relation to Articles 176 through 182 of the Political Constitution, because they created new taxes through provisions included in ordinary and extraordinary budgets, thereby exercising through a budget law a power belonging to ordinary legislation. They further violate Article 129 by repealing the amounts of fees established by law; and subsection 20) of Article 121 is violated by creating government agencies by decree, when, under the constitutional provisions, such agencies must be created in accordance with ordinary legislation and its governing provisions.
IX.This judgment is rendered as an interlocutory decision (sentencia interlocutoria) pursuant to Article 9 of Ley de la Jurisdicción Constitucional.
CONSIDERING:
I.By express provision of subsection 11) of Article 121 of the Political Constitution, the Legislative Assembly has jurisdiction to enact the Republic’s ordinary and extraordinary budgets, a mandate constituting a special regime governed by Articles 176 through 180 of the Constitution.
II.The challenged Article 178 of Law No. 6995 was enacted under the authority of the aforementioned subsection 11) of Article 121 ibidem, in conjunction with constitutional Articles 177 and 178, and sought to regulate tax matters through a law that must necessarily contain exclusively budgetary provisions. Article 178, which is challenged as unconstitutional, is intended to amend, with the purpose of repealing, Articles 18 et seq. of Law No. 1758 of 19 de junio de 1954, its Regulations, and their respective amendments. Those provisions were enacted under subsection 13) of Article 121 of the Constitution and, therefore, a law of the Republic cannot be repealed through a special procedure different from that used to enact it.
III.This Chamber has already established case law on the matter at issue here. Judgment No. 568-90, rendered at seventeen hours on veintitrés de mayo último, stated: “II- The nature of budget laws, their special and qualified legislative procedure, and the possibility and/or necessity that they contain budget-implementation provisions have indeed long been debated in Costa Rican constitutional adjudication (Jurisdicción Constitucional). To identify the most recent decision on this matter, we must cite the holding of this same Chamber in its decision No. 121 at 11 hours on 23 de noviembre último. It stated:
“... For all these reasons, this Chamber concludes that the Republic’s budget is a law in both the formal and substantive sense, but is special because of its subject matter and the procedure already discussed. The foregoing texts show that the authority or legal competence constitutionally conferred upon the Legislative Assembly in this important area is to establish in the budgets the anticipated revenues and authorized expenditures of the Public Administration, subject to the procedures that the Constitution itself prescribes for amendments and extraordinary budgets. Consequently, the Legislative Branch may not, under the aforementioned budgetary authority, regulate matters of a nature or content different from that specialized subject matter. This conclusion is consistent with the Executive Branch’s exclusive authority to prepare the ordinary budget bill and initiate amendments thereto and extraordinary budgets, as well as with the Legislative Assembly’s authority to enact them, together with the already analyzed feature that, pursuant to Article 125 of the Constitution, the Executive Branch has no veto power over their approval...” And further on, with respect to the specific case of a budget provision that would contain a tax exemption (exoneración tributaria), it stated:
“Article 121 subsection 13) of the Political Constitution provides that the Legislative Assembly has the authority to—‘Establish national taxes and contributions and authorize municipal ones.’ This statutory reservation (Reserva de Ley) is implemented by Article 5 of Código de Normas y Procedimientos Tributarios, which generally provides that only a statute may create, modify, or abolish taxes; define the taxable event (hecho generador) giving rise to the tax relationship; grant exemptions, reductions, or benefits; establish privileges; and so forth. In accordance with the preceding and present considerations, there can be no doubt that an ordinary statute is required to grant the benefits contemplated by the budget provision under review...”
IV.Article 178 manifestly does not concern budgetary matters because it provides for the transfer of government agencies; authorizes the modification or elimination of rates and revenues for services and the adoption of measures relating thereto; and also repeals provisions regarding the amounts of rates and other matters that, as already stated, are plainly outside the budgetary sphere. Therefore, this is not the procedure that should have been used for its enactment; rather, it should have followed the pertinent procedure under subsections 1) and 13) of Article 121 of the Constitution. It thus infringes those provisions, Articles 123 through 128, which govern the enactment of ordinary legislation, and Articles 176 through 180, which govern the enactment of special budget legislation.
V.Executive Decree No. 17318-G of 24 de noviembre de 1986 shares the fate of the provision that it implements because it is ancillary to and dependent upon the validity of that provision, which, for the reasons already stated, did not exist, as shall be expressly declared. The aforementioned Executive Decree is therefore unconstitutional by derivation (inconstitucional por derivación) (Article 10 of the Political Constitution.
VI.As a consequence of the ruling herein, the legal provisions affected by the provisions deemed void are reinstated and restored to full force.
THEREFORE:
In view of the foregoing and pursuant to Articles 10 and 11 of the Political Constitution, as well as Articles 1,3, 9, 13, 88, 89, 90, 91, and 93 of Ley de la Jurisdicción Constitucional, the constitutional challenge is granted and, consequently, Article 178 of Law No. 6995 of 22 de julio de 1985 and Executive Decree No. 17318-G of 24 de noviembre de 1986 are annulled. As a consequence of the foregoing, the legal provisions that may have been affected or repealed by the legislation annulled herein are restored to full force. The State shall reimburse, together with the corresponding statutory interest, all excess amounts collected and paid by the petitioners and by all other persons, whether natural or legal, who made the required payment, calculated from the date of payment. This judgment shall be published in full in Boletín Judicial, and a summary thereof shall be published in the Official Gazette La Gaceta. Notice shall be served on the President of Asamblea Legislativa, Procurador General de la República, and the petitioners through their legal representatives.

San José, a las quince horas treinta minutos del veintiséis de junio de mil novecientos noventa.
Acción de inconstitucionalidad interpuesta por la Cámara Nacional de Radio y otro para que se declaren inaplicables por inconstitucionales el artículo 178 de la Ley No. 6995 de 22 de julio de 1985 y el Decreto Ejecutivo No. 17318-G de 24 de noviembre de 1986, publicado en La Gaceta No. 231 de 4 de diciembre de 1986, por ser contrarios a los artículos 9, 105, 121 incisos 1), 11), 13) y 20), 123, 124, 125, 129 y 176 y siguientes de la Constitución Política.
RESULTANDO:
I.Los accionantes solicitan que se declare la inconstitucionalidad del artículo 178 de la Ley No. 6995 de veintidós de julio de mil novecientos ochenta y cinco y el Decreto Ejecutivo No. 17318-G de veinticuatro de noviembre de mil novecientos ochenta y seis.
II.El artículo 178 de la Ley No. 6995 dispone trasladar la Unidad de Control Nacional de Radio Código 06.104 a la Dirección Nacional de Comunicaciones, como una unidad adscrita. Dispone además que la Junta Administrativa de la Dirección Nacional podrá fijar, modificar, eliminar y tomar las medidas pertinentes referentes a las tasas e ingresos por cobrar, en virtud sic los servicios que presta la Unidad de Control Nacional de Radio.
III.Por el mismo artículo impugnado, se derogan las disposiciones en cuanto al monto de las tasas y tarifas de la Ley No. 1758 de diecinueve de junio de mil novecientos cincuenta y cuatro y sus reformas (Ley de Radio y Televisión), y su Reglamento. De igual manera, se establece que en todas las disposiciones de la Ley No. 5870 de once de diciembre de mil novecientos setenta y cinco y sus reformas (Ley de Creación de la Dirección Nacional de Comunicaciones), quede incluida para todos sus efectos, la Unidad Nacional de Control de Radio y que en un cincuenta por ciento de los fondos recaudados por CORTEL (Dirección de Correos y Telégrafos Nacionales) por este concepto, deberán ser depositados en una cuenta especial para fines específicos. El resto será para el desarrollo y modernización de la Unidad de Control Nacional de Radio y para becas y capacitación de su personal, según el reglamento que emitirá el Ministerio de Gobernación dentro de los treinta días siguientes a la promulgación de la presente ley.
IV.Para la ejecución de ese artículo, el Poder Ejecutivo promulgó el Decreto Ejecutivo No. 17318-G de veinticuatro de noviembre de mil novecientos ochenta y seis, publicado en La Gaceta No. 231 de cuatro de diciembre de mil novecientos ochenta y seis.
V.Los accionantes interpusieron juicio especial tributario, ante la Sección Segunda del Tribunal Superior Contencioso Administrativo, por "no ser conformes a Derecho el Decreto Ejecutivo No. 17318-G de 24 de noviembre de 1986" y los actos que de él se derivan.
VI.El diez de agosto de mil novecientos ochenta y ocho, fue presentada la presente acción ante la Secretaría General de la Corte Suprema de Justicia y el día veinte de octubre de mil novecientos ochenta y nueve, esta Sala se arrogó su conocimiento.
VII.Los accionantes alegan que el artículo 178 de la Ley No. 6995 y el Decreto Ejecutivo 17318-G, violan los artículos 9, 105, 121 incisos 1), 11) y 13), 123, 124 y 125, en relación con los artículos 176 a 182 de la Constitución Política, por haber creado nuevos tributos a través de normas incluidas en los presupuestos ordinarios y extraordinarios, ejerciendo en la ley de presupuesto una facultad de competencia de la legislación ordinaria. Además se violenta el artículo 129, por derogar montos de tasas existentes en una ley; y el inciso 20) del artículo 121 es violado, por crear dependencias por decreto, cuando estas deben nacer, según las disposiciones constitucionales, de conformidad con la legislación ordinaria y las normas que la conforman.
IX.Esta sentencia se dicta en forma interlocutoria de conformidad con lo dispuesto por el artículo 9 de la Ley de la Jurisdicción Constitucional.
CONSIDERANDO:
I.Por disposición expresa del inciso 11) del artículo 121 de la Constitución Política, se atribuye a la Asamblea Legislativa la competencia para dictar los presupuestos ordinarios y extraordinarios de la República, mandato que constituye un régimen especial y que regulan los artículos 176 al 180 de la Carta Magna.
II.El impugnado artículo 178 de la Ley No. 6995 se dictó amparado en lo que dispone el citado inciso 11) del artículo 121 ibídem, en concordancia con los artículos 177 y 178 constitucionales, pretendiendo regular la materia tributaria a través de una ley que debe necesariamente tener un contenido netamente presupuestario. El acusado de inconstitucionalidad artículo 178, tiene la finalidad de transformar, con la intención de derogar, los artículos 18 y siguientes de la Ley No. 1758 de 19 de junio de 1954, su reglamento y sus respectivas reformas, normativa esta que se promulgó con apoyo en el inciso 13) del artículo 121 de la Carta Fundamental y por lo tanto no es posible derogar una ley de la República, por medio de un procedimiento distinto y calificado, que el utilizado para promulgarla.
III.Ya esta Sala ha establecido jurisprudencia en la materia que aquí se discute. En la sentencia No. 568-90, de las diecisiete horas del veintitrés de mayo último, se dijo: "II- Efectivamente es de larga data la discusión en la Jurisdicción Constitucional costarricense, sobre la naturaleza de las leyes de presupuesto, su tramitación legislativa especial y calificada, así como la posibilidad y/o necesidad de que contengan normas de ejecución presupuestaria. Para ubicamos en la más reciente decisión sobre ese particular, debemos citar lo establecido por esta misma Sala en su resolución No. 121 de 11 horas del 23 de noviembre último. En ella dijo:
"... Es por todo ello que esta Sala concluye en el sentido de que el presupuesto de la República es una ley formal y material pero especial por la materia que la constituye y por el procedimiento ya comentado. De los textos antes citados se desprende que la competencia o legitimación que constitucionalmente se atribuye a la Asamblea Legislativa sobre tan importante materia, es para fijar en los presupuestos los ingresos probables y los gastos autorizados de la Administración Pública con las modalidades que para sus modificaciones y para presupuestos extraordinarios la misma Constitución señala. No puede en consecuencia, el Poder Legislativo bajo la potestad presupuestaria que se apunta, regular materias de diferente naturaleza o contenido de esa especialidad. Lo expresado es congruente con la atribución exclusiva del Poder Ejecutivo de elaboración del proyecto de presupuesto ordinario y la iniciativa de sus modificaciones y de los extraordinarios, así como la de la Asamblea Legislativa en cuanto a su dictado, además con la modalidad ya analizada de que el Poder Ejecutivo no tiene atribución de veto sobre su aprobación, a tenor del numeral 125 de la Carta Fundamental..." Y más adelante se indicó para el caso específico de un artículo presupuestario que contendría una exoneración tributaria:
"Señala el artículo 121 inciso 13) de la Constitución Política que es atribución de la Asamblea Legislativa - "Establecer los impuestos y contribuciones nacionales, y autorizar los municipales." La presente "Reserva de Ley", es desarrollada por el artículo 5 del Código de Normas y Procedimientos Tributarios, el cual en términos generales estipula que sólo la Ley puede crear, modificar o suprimir tributos; definir el hecho generador de la relación tributaria; otorgar exenciones, reducciones o beneficios, establecer privilegios, etcétera. No cabe la menor duda que conforme a lo expuesto en los considerandos anteriores y en éste, se requiere de una ley ordinaria para que se puedan otorgar los beneficios a que se contrae la norma presupuestaria objeto de pronunciamiento..."
IV.Que dicho artículo 178, manifiestamente no se refiere a materia presupuestaria, ya que dispone el traslado de dependencias; permite modificar, eliminar y tomar medidas referentes a tarifas e ingresos por concepto de servicios; asimismo, deroga disposiciones en cuanto al monto de tarifas y otros aspectos, que a todas luces están fuera del ámbito presupuestario como ya se dijo, y por lo tanto, no es la vía que debe utilizarse para su aprobación, debiéndose sujetar al trámite pertinente, de acuerdo con lo que dispone la Constitución Política en los incisos 1) y 13) del numeral 121 de la Carta Fundamental, infringiéndose éstos y los artículos de 123 al 128, normas que regulan la creación de la legislación ordinaria, y del 176 al 180, normas que regulan la promulgación de la legislación especial de presupuesto.
V.El Decreto Ejecutivo No. 17318-G de 24 de noviembre de 1986, sigue la misma suerte de la norma que reglamenta, pues es accesorio y está sujeto a su validez, la que por lo ya dicho, no existió, según se declarará expresamente. El citado Decreto Ejecutivo entonces, es inconstitucional por derivación (artículo 10 de la Constitución Política.
VI.Como consecuencia de lo que aquí se dispone las disposiciones legales afectadas por las disposiciones que se consideran nulas, quedan restablecidas en su vigencia.
POR TANTO:
En mérito de lo expuesto y con fundamento en los artículos 10 y 11 de la Constitución Política, así como 1,3, 9, 13, 88, 89, 90, 91, y 93 de la Ley de la Jurisdicción Constitucional, se declara con lugar la acción de inconstitucionalidad interpuesta y, en consecuencia, se anula el artículo 178 de la Ley No. 6995 de 22 de julio de 1985 y el Decreto Ejecutivo No. 17318-G de 24 de noviembre de 1986. Como consecuencia de lo anterior, se restablece la vigencia de las disposiciones legales que hubieren sido afectadas o derogadas por la legislación que aquí se anula. El Estado debe reintegrar, con los respectivos intereses legales, todas las sumas cobradas de más y pagadas por los accionantes y por todas aquellas personas, tanto físicas como jurídicas, que hayan efectuado el pago exigido, a partir de la fecha de pago. Publíquese íntegramente esta sentencia en el Boletín Judicial y reséñese en el Diario Oficial La Gaceta. Notifíquese al señor presidente de la Asamblea Legislativa, al señor procurador general de la República y a los señores accionantes por intermedio de sus apoderados.
