Constitutional challenge (acción de inconstitucionalidad) brought by Marco Levy Virgo, known as Marco Machore Virgo, of legal age, single, holder of identity card number 0700690314, against Article 1 of Decreto Ejecutivo Nº 34202-MAG-MS-MINAE-MOPT-MGSP, dated 21 de mayo de 2007, which, in turn, amends Article 70 of Decreto Ejecutivo Nº 31520-MS-MAG-MOPT-MGSP, Reglamento para las actividades de Aviación Agrícola, dated 16 de octubre de 2003. The Procuraduría General de la República, the Ministerio de Salud, the Ministerio de Agricultura y Ganadería, the Ministerio de Obras Públicas y Transportes, the Ministerio de Ambiente y Energía, and the Ministerio de Gobernación y Policía y Seguridad Pública are parties to the proceeding. Also participating are the Director General de la Dirección General de Aviación Civil and the Presidente del Consejo de Aviación Civil and, as supporting respondents (coadyuvantes pasivos), Jorge Arturo Sauma Aguilar, in his capacity as Gerente General de Corporación Bananera Nacional S.A. (CORBANA), and Jorge Arturo Osborne Escalante, in his capacity as Presidente and legal representative of the Asociación Cámara Nacional de Bananeros (CONABA).
Background:
4.- In a written submission filed at 10:37 hours on 22 de octubre de 2014, María Elena López Núñez, in her capacity as Minister of Health, submitted the requested report, in which she stated that, pursuant to report N° DRPIS-UNC-ESJ-2287-10-2014, dated 14 de octubre de 2014, prepared by Licenciada Elizabeth Solórzano Jiménez, an official of the Unidad de Normalización y Control-DRPIS, and Ingeniero Ricardo Morales Vargas, an official of the UNSSAH-Dirección Protección al Ambiente Humano, it is clear that not only do the environmental and health problems alleged by the appellant not occur, but what he raises is a matter of legality, since the claim concerns the alleged failure to comply with the regulations established in the Executive Decree at issue, a matter beyond the constitutional review (control de constitucionalidad) exercised by the Chamber (Sala). She adds that the Ministerio de Salud is the governing authority for health matters and is obligated to guarantee the highest quality of health for the entire population; accordingly, if the challenged Executive Decree contained errors detrimental to public health, that Ministry would not have participated in it.
She maintains that Decreto Ejecutivo N° 34202-S-MAG-MINAE-MOPT-MGPSP retains an aerial no-application distance (distancia de no aplicación aérea) of one hundred meters where there is no buffer zone (zona de amortiguamiento) (similar to Article 75 of Decreto Ejecutivo N° 15846-MOPT-MAG, del 6 de noviembre de 1984), and provides an exception allowing an aerial no-application distance of thirty meters, provided that, on the basis of technical studies, duly reforested and functional zones are in place and the established flight altitude, droplet size, length of the aircraft’s spray booms, GPS, automatic sprayer shutoff, and meteorological conditions at the time of application (wind speed and direction, temperature, and relative humidity), among other requirements, are met. This means that scientific evidence exists showing that the thirty-meter distance, as a no-application zone (zona de no aplicación), has a technical justification and that, in addition, the challenged Article 70 adds a functional buffer zone (zona buffer funcional); both elements, acting together, are sufficient to prevent spray drift (deriva).
Therefore, there is no regression (regresividad) in this matter, because producers may not reduce the distance without complying with the aforementioned regulations (no-application zone plus vegetative buffer barrier providing coverage (barrera área vegetativa de cobertura)). She requests that the constitutional challenge (acción de inconstitucionalidad) filed be dismissed because the challenged Executive Decree does not contain the alleged constitutional defects (vicios de inconstitucionalidad), nor does it leave any constitutionally protected rights without protection; on the contrary, it has been scientifically and technically demonstrated that reducing the setback areas or zones (áreas o zonas de retiro) does not entail a greater risk to health or the environment.
5.- The Procuraduría General de la República submitted its report in a written filing presented at 11:44 hours on 24 de octubre de 2014, in which it stated that the fundamental right to a healthy and ecologically balanced environment is expressly recognized and clearly established as an individual right (Voto N° 1394- 1994) through the amendment introduced to Article 50 of the Constitution by Ley N° 7412 de 3 de junio de 1994. That right is related to provision 21: “Human life is inviolable,” from which the right to health derives, and for which environmental protection is a necessary prerequisite: “people’s health depends largely on the environmental conditions surrounding them” (Voto N° 180-1998); and to Article 69, from which the principle of rational use of land derives, imposing on both private parties and the State the obligation to protect and preserve renewable natural resources (Votos N° 2233-1993, 4818-2003 y 6322-2003).
This right is also enshrined in provision 11 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights (“Protocolo de San Salvador”), signed in 1988 and approved by Ley N° 7907 de 3 de setiembre de 1999. It states that the connection between environmental protection and the right to health (also enshrined in Article 46 of the Constitution and provision 10 of the Protocolo de San Salvador) and quality of life—environmental quality is a fundamental parameter of quality of life (Votos N° 3705-1993, 2219-1999, 6716- 2002, 4818-2003,6322-2003 y 16276-2006)—is particularly close in relation to this subject, as established by the Sala in Votos N° 3705-1993 y 3341-1996. Both rights have two aspects: they constitute subjective rights (derechos subjetivos) of individuals and are established as goals or purposes of State action (Votos N° 644-1999, 9193-2000 y 6322-2003), which has the obligation to guarantee, defend, and safeguard them.
The State is required to ensure the proper use of pesticides and the prevention of their harmful effects on health and the environment. Thus, in Voto N° 13968-2004, through which the application for constitutional protection (recurso de amparo) filed against report N° FOE-AM-19/2004, prepared by the Área de Servicios Agropecuarios y de Medio Ambiente de la División de Fiscalización Operativa y Evaluativa de la Contraloría General de la República (concerning the evaluation of State management in relation to the control of agricultural pesticides), was dismissed, the Sala Constitucional characterized the use of chemical substances in agricultural activities as “one of the most pressing environmental problems the country must resolve” and emphasized the “need for the State to intervene by exercising a regulatory function over the use of agrochemicals, thereby guaranteeing... the protection of the health of the general public and its right to a healthy and ecologically balanced environment.” Likewise, when ruling on the legislative constitutional consultation (consulta legislativa de constitucionalidad) concerning the bill entitled “Approval of the Stockholm Convention on Persistent Organic Pollutants” found in certain pesticides, the Sala, in Sentencia N° 9565-2006, emphasized the Costa Rican State’s duty “to act effectively and in advance to prevent the occurrence of events that degrade the environment and compromise its sustainability.” The Sala reiterated this position when ruling on the legislative constitutional consultation concerning the bill entitled “Approval of the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade” (Sentencia N° 018207-2008), as well as when upholding the constitutional objections (reparos de inconstitucionalidad) raised against the Regulation on the registration, use, and control of formulated synthetic pesticides, technical-grade active ingredients, adjuvants, and related substances for agricultural use (Sentencia N° 16937-2011).
In Voto N° 12394-2012, the Sala stated that environmental matters and the preservation of the rights to health and life are matters of public interest and that the State has an unavoidable responsibility to act to protect those rights; it therefore has the authority to issue regulations in order to anticipate the potential adverse effects and impacts that the various activities carried out by individuals may cause. In this regard, the State may require compliance with new requirements or conditions that ensure protection of the right to a healthy and ecologically balanced environment, with the public interest in environmental matters and the protection of the rights to health and life prevailing over an individual’s private interest in carrying out a particular activity. It states that constitutional case law (jurisprudencia constitucional) has addressed the State’s responsibility to prevent pesticide contamination and to ensure that people’s health is not harmed by third parties in the aerial application of those substances (Votos N° 4463-1999, N° 17992-2006, N° 12094-2009, N° 12692-2009 y N° 2720-2014, among others).
The principle of objective environmental protection (principio de la objetivación de la tutela ambiental), or the principle of adherence to science and technology (principio de la vinculación a la ciencia y a la técnica), is itself recognized as a constitutional principle that governs State action in protecting the environment (Voto N° 6322-2003), and it is related to the principle of reasonableness (principio de razonabilidad) as a standard of constitutionality (Voto N° 2410-2007). The foregoing is closely related to the principle prohibiting arbitrariness (principio de interdicción de la arbitrariedad), as defined by the Sala in Voto N° 11155-2007. For its part, in Voto N° 13367-2012, the Tribunal Constitucional developed the principle of progressive and non-regressive environmental protection (principio de progresividad y no regresión de la protección ambiental). Similarly, because harm to the environment often has serious, cumulative, and generally irreversible consequences, preventing it is of paramount importance.
Environmental Law (Derecho Ambiental) therefore has a preventive focus, embodied in one of its basic principles: the precautionary principle (principio precautorio), which establishes a form of presumption in favor of the environment so that, when there is no scientific certainty regarding the adverse effects that an action might produce, the action is prohibited, restrictions are imposed upon it, or protective measures are adopted; this principle is set forth in Article 11 of the Ley de Biodiversidad. This principle reverses the burden of proof (carga de la prueba), as established in Article 109 of the aforementioned law, under which the burden of proving the absence of unauthorized contamination, degradation, or harm rests with the person requesting approval or a permit. Within the sphere of international instruments, the concept of precaution was included in Principle 11 of the World Charter for Nature.
The Sala, for its part, has recognized this principle in its case law and accorded it constitutional status (among others, Votos N° 5893-1995, 2219-1999, 5048-2001 y 2515-2002). The precautionary principle, or principle of prudent avoidance (principio de la evitación prudente), is closely related to the prevention principle (principio de prevención), which is also contained in Article 11 of the Ley de Biodiversidad. In the most recently cited decisions, as well as in Voto N° 13367-2012, the Sala highlighted the connection between these two principles. The importance of these principles with respect to pesticides dispersed or released into the environment as a result of aerial application, whether during or after such application, is demonstrated by the study “Aerial Application of Mancozeb and Urinary Ethylene Thiourea Concentrations among Pregnant Women in Costa Rica: The Infants’ Environmental Health Study (ISA),” conducted in the canton of Matina, Limón, by researchers from the Instituto Regional en Sustancias Tóxicas de la Universidad Nacional (IRET-UNA), coordinated by Berna van Wendel de Joode, in collaboration with researchers from Lund University and the Karolinska Institute (Sweden), the University of Quebec in Montreal (Canada), and the University of California at Berkeley (United States), and published on 8 de setiembre de 2014 in the journal “Environmental Health Perspectives.” The study took measurements to detect pesticide residues in the urine of pregnant women living near agricultural plantations where aerial spraying is conducted and found residues of Mancozeb, which can alter thyroid function, an essential factor in fetal brain development.
Its findings indicate that the regulations currently governing aerial pesticide-spraying activities do not protect pregnant women and fetuses from exposure to ETU, a Mancozeb residue. They identify replacing aerial application with less dispersive application techniques and implementing additional technical measures to reduce off-target drift as useful means of decreasing environmental and occupational exposure to that substance. To reduce contamination reaching homes, they recommend, at a minimum, increasing the distance between banana plantations and residential areas and establishing natural barriers. It states that Decreto N° 34202, according to recital 8° (considerando 8°), is based on the document “Drift Management in Aerial Pesticide Applications on Farms with Buffer Zones,” published by CORBANA S.A. in 2007 and prepared by Roberto Valenciano Mora of Corporación de Desarrollo Agrícola Del Monte S.A., Sergio Laprade Coto of CORBANA S.A., Álvaro Fournier Leiva of CARIBANA S.A., and Eduardo Trejos Obando of Standard Fruit Co.
According to its text, the purpose of that document is “to set out in detail the principal technical considerations for the aerial application of pesticides in order to minimize drift on banana farms having buffer zones at least 30 meters wide.” In the opinion of the Procuraduría, the first question arising with respect to the decree’s technical basis is whether the results of this document, prepared by members of the banana industry, may be extrapolated to other types of crops, as the decree does. Thus, for example, regarding flight altitude, the document states: “For banana cultivation, an altitude no greater than 5 meters above plantation level is recommended,” which is the same altitude adopted by the decree. Likewise, regarding the droplet size of the mixture, the document states: “Moreover, very large droplets do not achieve adequate pesticide coverage on foliage, making it difficult to control black Sigatoka [identified there as the principal phytosanitary problem on banana plantations].
Studies conducted by the Banana Industry in Costa Rica (Washington, et al, 2001) agree with the findings reported in the international literature, and working with a droplet size of between 200 and 300 µm is recommended” (p.5). This is the same droplet size required by the decree. With respect to buffer zones (zonas de amortiguamiento), the document specifies: “Studies conducted in Costa Rica indicate that, under the conditions in which pesticides are applied to bananas, drift does not exceed 26 meters... It is recommended that buffer zones be reforested, preferably with native species, and have a minimum width of 30 meters.” (p.8), the width required by the decree.
Likewise, the decree reproduces verbatim the document’s recommendation that wind speed not exceed 15 km/h “when crop-growing areas adjacent to buffer zones (áreas de amortiguamiento) are sprayed,” which, in the Procuraduría’s view, creates uncertainty because of the imprecision of the word “adjacent”; for example, how large are the adjacent areas? Moreover, it conflicts with Article 63 of the Regulations being amended, which provides that the maximum wind-speed limit must be 15 km/h for spraying operations (throughout the entire cultivated area). The second question raised by the Procuraduría concerning the technical basis of the Decree relates to the portions of the provision that differ from the underlying document. For example, while the document states that relative humidity must exceed 60%, the Decree provides that it must exceed 70%; and while the document states that “if the application is carried out perpendicular to the buffer zone, an additional forty-meter strip must be left within the cultivated area in which pesticides must not be sprayed, in order to reduce the effect of spray drift (arrastre),” the decree provides that this distance must be maintained when the application is performed by airplane.
This leaves open the question whether, a contrario sensu, that strip would not be required when a helicopter is used. It also provides that “[t]he pesticide-free application strip (franja de no aplicación de productos) may be omitted in the case of internal roads or paths used exclusively for cultivation, provided that no dwellings are present,” thereby reducing the 40-meter strip recommended by the study to distances as short as the 6 meters that internal roads may measure. In addition, doubts could arise regarding the scientific objectivity of a document sponsored and prepared by members of the banana industry, who could be influenced by that sector’s private interests. Questions also arise regarding the decree’s adequate technical basis insofar as it extrapolates the results of this document to other types of crops and, finally, regarding the portions of the decree that introduce matters not contained in the study on which it is based.
All of this makes the reasonableness of the provision uncertain with respect to its suitability for achieving its stated purposes of protecting the environment and human health, under the standards established by the Sala in Judgments N° 6322-2003, N° 3933-1998, N° 11013-2000, N° 3445-2000, N° 8744-2000, N° 6678-2001, N° 12953-2001 and N° 2569-2012, among others, given that the purpose of Article 70 of the Regulations Governing Agricultural Aviation Activities is “to prevent persons, animals, houses, populated areas, roads, pastureland, water sources, watering places, and crops or farms... from being contaminated as a result of pesticide drift or carryover.” It asserts that Voto N° 16276-2006 declared the reduction of the no-aerial-application strip unconstitutional because it was deemed to violate a series of constitutional standards and principles concerning the protection of the environment and human health.
The Procuraduría states that there is doubt as to whether the meteorological conditions required by the decree during the application period can be monitored by the public authority in the exercise of its police power (poder de policía), under the terms of Voto N° 16276-2006, or even by the pilots responsible for applying the pesticides. It notes that this does not involve measuring the conditions prevailing at the agricultural aerodrome, airstrip, or landing field, which may be several kilometers from the crop to be fumigated, but rather the conditions prevailing in the areas adjacent to the buffer zones. In this regard, it states that, for example, publications available on the internet describe a Mesoamerican Agroclimatic Monitoring System (MAWMS) operated by WWF (World Wild Life or Fondo Mundial para la Naturaleza), with meteorological stations in agricultural fields in Honduras and Belize that permit real-time meteorological data to be used as a tool for selecting the appropriate time to apply pesticides according to weather conditions and microclimates; they also describe a network of meteorological stations installed in twenty-nine rice-producing provinces of Argentina, whereas nothing similar can be found in Costa Rica.
To answer this question, the Procuraduría, in its capacity as Advisory Body to this Sala, considers it appropriate for this Tribunal Constitucional to request the opinion of the Consejo Técnico de Aviación Civil regarding the widespread use of instruments and stations for measuring the meteorological conditions that the decree requires to be monitored before and during pesticide spraying in areas adjacent to buffer zones. Decreto N° 34202 also contains gaps that call into question whether the provision is sufficient to prevent contamination caused by pesticide drift or carryover affecting water sources and waterways, houses, schools, crops, etc., located less than one hundred meters from plantations on which these substances are applied aerially. One such gap is temperature inversion (inversión térmica)—which is not mentioned—recognized as one of the causes of drift during the aerial application of pesticides and as a condition affecting whether that activity may be carried out, to the extent that the Guidelines on Good Practice for Aerial Application of Pesticides issued by the Food and Agriculture Organization of the United Nations (2002) provide that “spraying must not be carried out where there is upward air movement or where a temperature inversion prevents the spray cloud from settling on the treated area.” It notes that another gap concerns the characteristics that a buffer zone must have to ensure that it effectively serves “as a barrier to reduce drift from aerial applications,” since, for example, Technical Report “Buffer Zones for Conservation: Guidelines for Designing Buffer Zones, Corridors, and Greenways,” issued by the Southern Research Station of the Forest Service of the United States Department of Agriculture, recommends in subsection 5.3, Buffer Zones and Pesticide Drift, providing a barrier with a density of 40 to 50% and a height at least twice that of the crop, using fine-leaved vegetation that is tolerant of the chemical substance to be applied, arranged in several rows and consisting of a mixture of plant forms to ensure that there are no gaps.
Finally, it states that Considerando 4° of Decreto N° 34202 and the document “Management of Drift in Aerial Pesticide Applications on Farms with Buffer Zones” cite advances in science and technology relating to air navigation and aerial spraying as justifications for the provision. Nevertheless, the amendment introduced by Decreto N° 34202 is inconsistent with more recent environmental regulations in other countries—with access to technology equal to or greater than ours—such as Paraguay, Chile, and Spain, because in the first two countries the minimum safety strip for aerial pesticide application is set at two hundred meters, whereas in the last it is set at one hundred meters. The Procuraduría considers that it is for this Sala, on the basis of the technical evidence and justification provided by the ministries afforded a hearing, to determine whether the challenged provision complies with the principle of reasonableness (principio de razonabilidad) with respect to its technical basis and suitability.
In the absence of scientific and technical certainty that this reduction of the no-aerial-application strip does not entail a greater risk to health or the environment, the challenged provision would be unconstitutional under the constitutional principle establishing the State’s duty to safeguard and protect them, the precautionary principle (principio precautorio), and the principle of non-regression in environmental protection (principio de no regresión de la protección ambiental). Accordingly, this Tribunal Constitucional must verify the existence of the technical and scientific basis, as well as its reasonableness. It therefore recommends that the Sala Constitucional uphold the action if it determines that Decreto Ejecutivo N° 34202 does not comply with the principle of reasonableness with respect to its technical basis and suitability.
6.- Edgar E. Gutiérrez Espeleta, in his capacity as Ministro de Ambiente y Energía, in a brief filed at 7:48 hours on 27 de octubre de 2014, responded to the hearing granted and stated that the petitioner fails to clarify that the reduction—from one hundred to thirty meters—of the distance for aerial pesticide applications from population centers and farms, where a buffer zone (zona de amortiguamiento) is provided and a series of requirements set forth in Article 1 of the challenged Decree are met, applies only in exceptional cases, since Article 70 of the Decree itself establishes, in its first paragraph, as a general rule that “an aerial no-application strip of no less than 100 meters must be maintained, so that persons, animals, houses, settlements, roads, pastures, water sources, watering places, and crops or farms (…) are not contaminated by pesticide drift or carryover.” Nor is the principle of environmental non-regression (principio de no regresión ambiental) violated, because if the provisions of the former Article 70 of Decreto Ejecutivo N° 31520-MS-MAG-MINAE-MOPT-MGPSP were reviewed and replaced by the current Article 1 of Decreto Ejecutivo N° 34202-MS-MAG-MOPT-MGSP, it was precisely to comply with the order issued by the Sala Constitucional in Resolución N° 2006-16276, which held that there was no technical or scientific basis justifying the reduction of the strip.
Thus, through Decreto Ejecutivo N° 34202-MS-MAG-MOPT-MGSP, the technical and scientific basis justifying the reduction of the spraying area is stated in its recitals (parte considerativa). He contends that the study Manejo de la Deriva en las Aplicaciones Áreas de Fungicidas, en fincas que posean zonas de amortiguamiento (Revista de investigaciones CORBANA, San José, 2007, Separata Número 1), conducted by Roberto Valenciano Mora, Sergio Laprade Coto, Álvaro Fournier Leiva and Eduardo Trejos Obando, demonstrated that the reduction of the buffer zone to as little as thirty meters is justified because technological advances have minimized the impacts of aerial spraying to the point that it does not impair the right to life, health, or a healthy and ecologically balanced environment; and that the most relevant aspects of safe aerial application consisted of application accuracy and application management.
Accordingly, Article 70 of Decreto Ejecutivo N° 31520-MS-MAG-MINAE-MOPT-MGSP, amended by Article 1 of Decreto Ejecutivo N° 34202-MS-MAG-MOPT-MGSP, expressly specifies the conditions necessary for maintaining a thirty-meter no-spray area from population centers or farms. Those requirements condition the exercise of the activity in order to protect human health and the environment. He argues that every aerial pesticide application must be accompanied by a professional prescription (receta profesional), issued in quadruplicate by a member of the Colegio de Ingenieros Agrónomos who is registered and authorized for that purpose, specifying the product(s), dosage, and application method, through which that professional assumes responsibility for recommending the pesticide application in the specific area designated for that purpose; additionally, those products must be registered with the Servicio Fitosanitario del Estado.
Likewise, Article 66 prohibits the use of flaggers (banderilleros) (persons); instead, they are to be replaced by temporary markers or signals, or by an electronic guidance system. Furthermore, Article 68 of the same body of regulations prohibits pesticide spraying and dusting in aquifer zones (zonas acuíferas). For the foregoing reasons, there are insufficient legal or technical grounds to declare Article 1 of Decreto Ejecutivo N° 34202-MS-MAG-MOPT-MGSP, which amends Article 70 of Decreto Ejecutivo N° 31520-MS-MAG-MINAE-MOPT-MGPSP, unconstitutional, since it does not contravene Articles 7, 21 and 50 of the Constitución Política, Principle 7 of the Declaración de Río sobre Medio Ambiente y Desarrollo, the principle of environmental non-regression, the precautionary principle (principio precautorio), or the principle of sustainable development (principio de desarrollo sostenible), particularly when the specific conditions of Article 70 and the other regulations contained in Decreto Ejecutivo N° 31520-MS-MAG-MINAE-MOPT-MGPSP are considered.
He states that what is necessary is to review the effective implementation of the oversight provisions assigned to the institutions identified in the Reglamento, as well as the allocation of tasks and responsibilities, in order to ensure compliance with each and every one of them and to prevent gaps or uncertainty when identifying which institution or institutions are responsible or whether their areas of authority overlap. He requests that the action be denied.
7.- Mauricio González Quesada, in his capacity as Ministro de Obras Públicas y Transportes, in a brief filed at 10:33 hours on 27 de octubre de 2014, responded to the hearing granted and stated that the petitioner challenges only Article 1° of Decreto Ejecutivo N° 34202-IWAG-S-MINAE-MOPT-G-MSP of 21 de mayo del 2007, published in La Gaceta N° 8 of 11 de enero del 2008, which amended Article 70 of Decreto Ejecutivo N° 31520-MP-MAG-MOPT-MGSP; specifically, the challenge is limited to the first paragraph of that Article 1°, insofar as it permits the buffer zone to be reduced from one hundred to thirty meters. A reading of that article shows that it is a fundamentally technical provision and that, although it reduces the distance established in the original Decree from one hundred to thirty meters, its enactment had extensive technical support, establishing the objective conditions under which that reduction could be applied and giving particular prominence to concern for environmental protection, in accordance with Article 50 of our Constitución Política and the international treaties entered into for that purpose.
This is evident from the recitals supporting the issuance of that Decreto Ejecutivo, which the petitioner omits from his brief. Thus, far from being an arbitrary or unsupported regulatory act, the amendment introduced by Article 1° of Decreto Ejecutivo N° 34202-MAG-MS-MINAER-MOPT-G-MSP provides effective protection for the environment and health. He notes that the petitioner asserts, without support from any technical study, that conditions have not changed and that the risk to residents’ health and the harm to the environment remain the same, contrary to what is stated, with ample support, in the recitals of the Decreto Ejecutivo in question. Likewise, he considers that the applicant invokes the principle of environmental non-regression to infer, also without support from any technical study, that the amendment introduced by Article 1° of that Decree constitutes a setback in environmental protection because of the change in distance from one hundred to thirty meters.
In that regard, he states that the importance of protecting the environment and health, as well as the need to adopt the best measures to ensure that these essential legally protected interests (bienes jurídicos esenciales) are effectively safeguarded, is not in dispute, because that Ministry fully endorses the legal and constitutional standards governing the protection of essential legally protected interests such as life, safety, health, a healthy environment, and so forth, as well as the application of the corresponding legal principles. He contends that the matter fundamentally involves an allegation concerning both environmental and health matters arising from the promulgation of an amendment to a Decreto Ejecutivo. Accordingly, the reports specifically submitted in this case by the Ministerio de Agricultura y Ganadería, the Ministerio de Salud, and the Ministerio del Ambiente are essential for purposes of the merits analysis.
As regards that Ministry, he states that it signed the proposed amendment that gave rise to Article 1°, now under challenge, because it was required to sign it pursuant to the statutory authority conferred upon it in the field of aviation activities under the provisions of the Ley General de Aviación Civil, but did so on the basis of the technical criteria established for the implemented amendment by the Ministerio de Agricultura y Ganadería and the Ministerio de Salud, as reflected in the recitals of the aforementioned Decree. He argues that the petitioner’s allegations lack support from any technical study demonstrating that, for example, from 2007 (when the provision whose constitutionality is now challenged was promulgated) until the date the action was filed—seven years later—the aforementioned fumigation has caused actual, rather than hypothetical, deterioration of the environment or harm to communities.
Nor does the petitioner refute or demonstrate, through appropriate documentation (studies, etc.), that the technical justifications underlying the amendment in question and set forth in the recitals of the respective Decree are inaccurate; indeed, he fails to address them at all. For the foregoing reasons, he considers that, in this case, the petitioner’s allegations lack any technical support and therefore amount merely to opinions or presumptions based on constitutional legal standards and principles concerning environmental and health protection—which are not in dispute—but noncompliance with those standards and principles cannot be inferred merely by asserting their existence or their alleged violation. Rather, concrete and specific proof of an actual or imminent violation is essential, and no such proof exists in this case. He requests that the action brought against Article 1° of Decreto Ejecutivo N° 34202-MAG-MS-MINAER-MOPT-G-MSP be denied in all respects, because this constitutional challenge (acción de inconstitucionalidad) lacks any technical basis demonstrating an actual and effective violation of constitutional rules and principles, despite the many years that have elapsed since the enactment of those regulations, which was sufficient time to detect and demonstrate any actual, rather than hypothetical, situation affecting essential legally protected interests such as health and the protection of a healthy environment.
Justice Salazar Alvarado drafts the opinion; and,
Considering:
I.Admissibility. The petitioner brings this action before the Chamber to protect diffuse interests (intereses difusos) in defense of the right to health and the right to a healthy and ecologically balanced environment, protected by Articles 21 and 50, respectively, of the Constitución Política. In such cases, this Chamber has recognized that the matter concerns the protection of diffuse interests, pursuant to the second paragraph of Article 75 of the Ley de la Jurisdicción Constitucional, and therefore any inhabitant of the Republic may apply directly through this avenue without requiring a prior proceeding to establish standing (legitimación). Indeed, this Court has stated in this regard:
“…numerous decisions of this Chamber recognize that the protection of public health and environmental balance are typical cases of diffuse interests for purposes of directly filing actions of unconstitutionality (acciones de inconstitucionalidad), pursuant to the second paragraph of Article 75 of the Ley de la Jurisdicción Constitucional (see, for example, judgments number 2009-009201 at 9:07 hours on 12 de junio del 2009 and 2011-002699 at 15:06 hours on 2 de marzo del2011).” (Voto N° 16937-2011).
Likewise, in Voto N° 8239-01 at 16:07 hours on 14 de agosto de 2001, it stated the following regarding diffuse interests:
“(…) Under the first of the circumstances contemplated in paragraph 2° of Article 75 of the Ley de la Jurisdicción Constitucional, the challenged provision must not be susceptible to specific application that would subsequently permit a challenge to the implementing act and its consequent use as the underlying matter. (...) Second, the possibility of seeking relief in defense of diffuse interests (intereses difusos) is provided for (...) Diffuse interests, although difficult to define and even more difficult to identify, cannot under our law—as this Chamber has already held—be merely collective interests (intereses colectivos); neither can they be so diffuse that their ownership is indistinguishable from that of the national community as a whole, nor so specific that particular persons or identifiable groups, or groups that are readily identifiable, stand in relation to them, whose standing (legitimación) would derive not from diffuse interests but from the corporate interests that concern a community as a whole.
They are therefore individual interests, but at the same time are dispersed among more or less extensive and amorphous groups of persons who share an interest and who consequently suffer actual or potential harm that is more or less equal for all. Thus, it is rightly said that these are equal interests held by groups situated in particular circumstances and, at the same time, by each of their members. In other words, diffuse interests have a dual nature, since they are both collective—because they are common to the public at large—and individual, and may therefore be asserted as such. (...) In summary, diffuse interests are those held by groups of persons who are not formally organized but are united by a particular social need, a physical characteristic, their ethnic origin, a particular personal or ideological orientation, the consumption of a certain product, etc.(…)”.
Given that, in this matter, the petitioner bases his standing on abstract constitutional review (control de constitucionalidad abstracto) and invokes the defense of diffuse interests, insofar as he seeks to protect health and the environment, those circumstances confer upon him direct standing to institute these proceedings because he invokes the defense of interests concerning the national community as a whole, such as the rights to health and to enjoy a healthy and ecologically balanced environment, protected, respectively, under Articles 21 and 50 of the Constitution (Carta Magna), as already stated. Accordingly, this action of unconstitutionality (acción de inconstitucionalidad) is admissible for consideration and a ruling on the merits.
The petitioner considers that the amendment made to Article 70 of the Reglamento para las actividades de Aviación Agrícola, Decreto Ejecutivo N° 31520-MS-MAG-MOPT-MGSP of October 16, 2003, amended by Article 1° of Decreto Ejecutivo N° 34202 of May 21, 2007, insofar as it permits the distance or buffer strip between the field subject to aerial pesticide application and any road, population center, dwelling, building in which personnel are working, water source, and adjacent crops or neighboring farms susceptible to adverse effects from the pesticide applied to be reduced from one hundred to thirty meters, is unconstitutional because it violates Articles 7, 21, and 50 of the Political Constitution (Constitución Política).
III.Challenged provision. Article 1° of Decreto Ejecutivo N° 34202 of May 21, 2007, which amends Article 70 of the Reglamento para las actividades de Aviación Agrícola, Decreto Ejecutivo N° 31520-MS-MAG-MOPT-MGSP of October 16, 2003, adds the following to the first paragraph of the latter article:
“Article 1°. Article 70 of Decreto Ejecutivo Nº 31520-MS-MAG-MOPT-MGPSP, ‘Reglamento para las actividades de Aviación Agrícola,’ of October 16, 2003, is amended by adding the following to its first paragraph:
The distance may be reduced from 100 to as little as 30 meters if a buffer zone (zona de amortiguamiento) is provided and the following conditions are met:
These zones must be areas reforested with tree species, preferably native, taller than the crop and having a minimum width of 30 meters, to serve as barriers to reduce spray drift (deriva) from aerial applications when the application is conducted parallel to the buffer zone. If the application is performed by aircraft and perpendicular to the crop row, an additional 40-meter strip must be left within the crop in which no spraying may occur, in order to reduce the effects of drift (arrastre). The competent administrative authority may increase this distance by means of a reasoned decision (resolución razonada) when particular and objective circumstances in the area to be sprayed require a greater distance despite the existence of the buffer zone. The product no-application strip may be omitted in the case of internal roads or pathways used exclusively for the crop, provided that no dwellings exist.
It must be equal to or less than 5 meters above the plantation canopy, so that the concentration of particles that may be carried by the wind is reduced, thereby minimizing drift and evaporation of the sprayed product.
An average droplet size of between 200 and 300 microns (µm) must be used to minimize drift through an application having a slower free-fall velocity and allowing easier evaporation.
To ensure effective application and the proper dosage of products, a technician trained in the field must verify droplet size and sprayer flow at the following frequency: 1) Nozzle flow: semiannually, 2) Number of droplets: semiannually, 3) Dosage: daily. Before and after aerial applications, a technician must conduct an inspection to ensure the good condition of the hose system, sprayers, valves, satellite guidance system, and Automatic Flow Meter.
All aircraft must have a satellite guidance system to make it possible to ensure the proper application of products in crop areas and to provide graphic evidence thereof. The graphics generated by the satellite guidance system must be retained by the spraying company for a minimum of two years. An automatic sprayer shutoff system must be installed, within one year, on all aircraft that spray farms having buffer zones.
The effective length of the boom must not exceed 80% of the length of each aircraft wing.
On farms having buffer zones, only products registered and authorized in accordance with Article 69 of these regulations may be applied aerially. Such products must be of moderate toxicity.”
In general terms, the petitioner raises two types of constitutional objections: some concern factual matters arising from a series of failures to comply with the regulations in force, with adverse effects or consequences for human health and the environment; others are strictly legal and relate to the specific content of the challenged provision and its alleged conflict with Constitutional Law (Derecho de la Constitución). As to the factual matters alleged by the petitioner, such as the absence of buffer zones on most banana farms; distances between springs (nacientes) or streams and the crop area subject to aerial spraying that are shorter than those required by law; failure by companies, private parties, and institutions involved in aerial spraying to comply with the applicable regulations and failure by the competent administrative authorities to discharge their oversight and monitoring obligations; the review or verification of the conditions under which crops, principally bananas, are sprayed; and the adverse impact of aerial spraying on water resources, they are not matters appropriate for consideration in these proceedings.
This is because an action of unconstitutionality involves a purely legal dispute—or, in other words, a strictly legal analysis—in accordance with Articles 73 et seq. of the Ley de la Jurisdicción Constitucional, in which the content of a provision and whether or not it conflicts with Constitutional Law are examined, but not arguments concerning factual circumstances. In this regard, factual matters are, in principle, outside the scope of an action of unconstitutionality, as they are properly addressed, where applicable, through an amparo proceeding (recurso de amparo) or ordinary legality proceedings (vía de legalidad). Accordingly, this Chamber’s analysis is confined to comparing the content of the challenged provision with Constitutional Law, without considering the factual aspects alleged. That is, this Court will focus its analysis solely on the legal issues invoked, specifically whether the provision at issue results in diminished protection of the rights to health, life, and a healthy and ecologically balanced environment, as compared with the prior regulations amended by it, amounting to a regression in the protection and safeguarding of those fundamental rights because the amendment lacks a technical and scientific basis that would make it rational, in violation of the principle of non-regression (principio de no regresión) in this field.
V.Prior decisions of the Chamber concerning the issue raised. On two previous occasions, this Chamber has ruled on the constitutionality of the provision challenged here, namely:
“V.- The current content of Article 70 of the Reglamento para las Actividades de Aviación Agrícola provides a lower level of protection than Article 75 of the previous Regulations, which established a no-application buffer zone (franja de no aplicación) of 100 to 200 meters, depending on pesticide toxicity, flight altitude, particle size, and wind speed, stating in general terms, “in such a manner that houses, populated areas, roads, pastures, watering places, and other sites are not contaminated.” Although Article 70 establishes a 100-meter aerial no-application buffer zone, it nevertheless allows the zone to be reduced to 30 meters if, between the field to be fumigated and the houses, populated areas, and other sites, there are buffer zones (zonas de amortiguamiento) reforested with native species, provided that pesticides of moderate toxicity are used and the application is carried out under conditions of flight altitude, particle size, and wind speed that reduce spray drift (deriva), that the aircraft has equipment for that purpose, and that it flies parallel to the buffer zone.
Sala has held that the precautionary principle (principio precautorio) must be applied in such cases (see, among others, judgment number 7294-98), particularly considering that there is no scientific or technical basis justifying the reduction of the zone. The challenged Regulations do not specify the permitted percentages of pesticide spray drift and establish the possibility of reducing the application buffer zone to 30 meters, subject to toxicological, climatic, and flight conditions that cannot even be monitored in advance by the public authority, thereby endangering the fundamental rights to health and to a healthy and ecologically balanced environment, because this is a polluting activity involving toxic substances in which the levels of protection established by the previous regulation may not be reduced. In this respect, Sala declares unconstitutional the following passage of the challenged Article 70:
“This buffer zone may be reduced to a minimum of 30 meters if, between the field to be treated and the indicated sites, there are buffer zones reforested preferably with native species, provided that, in addition, pesticides of no more than moderate toxicity are applied and the application is carried out under appropriate conditions of flight altitude, particle size, and wind speed that, taken together, reduce spray drift, that the aircraft has appropriate equipment for that purpose, and that it flies parallel to the buffer zone.
If the application is carried out perpendicular to that zone, an additional strip of no less than 40 meters must be left within the crop, in which pesticides may not be applied by airplane, in order to reduce the effects of drift; the respective area may be treated by helicopter or another means that ensures control of the drift. The pesticide no-application buffer zone may be omitted in the case of internal roads or paths used exclusively for the crop to be treated, provided that there are no dwellings and none of the circumstances referred to in the first paragraph of this article arise.” It is readily apparent from this judgment that Sala found that the amendment to Article 70 of Decreto Ejecutivo N° 31520-MS-MAG-MINAE-MOPT-MGPSP, Reglamento para las Actividades de Aviación Agrícola, was contrary to the Law of the Constitution (Derecho de la Constitución) because it represented a regression in the protection of fundamental rights, since there was no scientific or technical basis justifying the reduction of the zone and, moreover, those Regulations did not specify the permitted percentages of pesticide spray drift and established the possibility of reducing the application buffer zone to thirty meters, subject to toxicological, climatic, and flight conditions that could not even be monitored in advance by the public authority.
In Sala’s view, this endangered the fundamental rights to health and to a healthy and ecologically balanced environment, because this is a polluting activity involving toxic substances in which the levels of protection established by the previous regulation may not be reduced. It is therefore clear that reducing the protection zone (zona de protección) to thirty meters is not in itself unconstitutional, but only insofar as it lacks a technical and scientific basis establishing that such reduction does not result in diminished protection—or a lack of protection—of the fundamental rights to health and to a healthy and ecologically balanced environment, provided, moreover, that the toxicological, climatic, and flight conditions to which the activity is subject can be monitored in advance by the public authority. This is so because, if there is no scientific certainty that the reduction does not diminish the protection that legislation had afforded in this area to the right to a healthy and ecologically balanced environment, the precautionary principle would apply, pursuant to which, in cases of doubt, the more protective regulation must be maintained. This is closely related to the principle that there may be no regression in the protection of fundamental rights.
“IV.- ON THE TECHNICAL BASIS FOR REDUCING THE DISTANCE FOR AERIAL PESTICIDE APPLICATIONS AND THE ALLEGED VIOLATION OF THE FUNDAMENTAL RIGHTS TO HEALTH AND TO THE ENVIRONMENT. First, the petitioners allege that, without any technical basis and in clear violation of the fundamental rights enshrined in Articles 21 and 50 of the Constitución Política, Article 1° of Decreto Ejecutivo No. 34202 of 21 de mayo de 2007 reduced, from 100 to 30 meters, the distance required between the field to be treated and any road, population center, dwelling, building occupied by personnel, water source, or adjoining crop or neighboring property for purposes of carrying out aerial pesticide applications. The petitioners contend that the decree in question has the same deficiencies as the former Article 70 of Decreto Ejecutivo No. 31520 of 16 de octubre de 2003, whose content was declared unconstitutional by Sala Constitucional in Voto No. 16276-2006, because it was determined that there was no technical or scientific basis justifying the reduction of the distance from 100 to 30 meters for carrying out the aforementioned aerial fumigations.
Notwithstanding the foregoing, this Tribunal Constitucional does not find that the petitioners are correct in this case. Analysis of Decreto Ejecutivo No. 34202 of 21 de mayo de 2007 makes it abundantly clear that the reduction in the distance at issue for aerial pesticide fumigation, namely, from 100 to 30 meters, is indeed based on and justified by technical and scientific criteria and studies conducted for that purpose. In this regard, it should be noted that the recitals (considerandos) of the Decreto Ejecutivo in question expressly stated the following:
“(…) 6º —That, due to a lack of technical and scientific grounds for reducing the spraying area, Sala Constitucional, through decision 2006-16276 of 8 de noviembre 2006 concerning (sic) Articles 24, 54, 68, 70, and 71 of the Reglamento para las Actividades de Aviación Agrícola, Decreto Ejecutivo Nº 31520-MS-MAG-MOPT-MGPSP, of 16 de octubre del 2003, partially granted the action and partially annulled (sic) Article 70, leaving only the first paragraph in effect, but not the second and third paragraphs. The basis of the ruling is that, with respect to the right to a healthy and ecologically balanced environment enshrined in Article 50 of the Constitution, any reduction must be based on scientific and technical criteria demonstrating that the new measure is harmless to the environment.
7º—That, from the very moment the constitutional challenge was filed, before any judgment had been issued, CORBANA and Poder Ejecutivo, in compliance with the Precautionary Principle established in the Costa Rican legal system and provided for by in the (sic) Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo, known as the Declaración de Río, under which prevention seeks to anticipate the adverse effects of human activity and ensure the protection, conservation, and proper management of resources, decided to initiate a series of scientific and technical studies aimed at establishing the current state of science and aerial spraying technology and demonstrating that reducing the distance from 100 to 30 meters where buffer zones exist will not affect the environment or the health or lives of persons, as well as establishing requirements for conducting aerial spraying activities so that they may be properly controlled and inspected.
8º—That, in compliance with the precautionary principle of Environmental Law (Derecho ambiental), in this year 2007 a scientific study initiated when the Constitutional Challenge was filed was completed, identified as follows: Roberto Valenciano Mora, Sergio Laprade Coto, Álvaro Fournier Leiva and Eduardo Trejos Obando, “Management of Spray Drift in Aerial Fungicide Applications on Farms with Buffer Zones” (“Manejo de la deriva en las aplicaciones aéreas de fungicidas en fincas que poseen zonas de amortiguamiento”) (Revista Investigaciones CORBANA, San José, 2007, Separata Nº 1). The authors are renowned researchers, scientists, and experts in the field at the Latin American level. The research demonstrates that reducing the buffer area to 30 meters is justified because technological advances have minimized the impact of aerial spraying to the point that it does not impair the rights to life, health, and a healthy and ecologically balanced environment.
The most relevant aspects of safe aerial application consists (sic) of application accuracy and spray-drift management. The term spray drift is defined as the movement, outside the crop area, of liquid particles in the air in the form of droplets or vapor at the time of application. Although extensive scientific and technical information exists on the subject, including information issued by the Food and Agriculture Organization of the United Nations (FAO), the United States Environmental Protection Agency (EPA), the State of California, the National Agricultural Aviation Association (NAAA), and a consortium of expert associations in the field (SPRAY DRIFT TASK FORCE), a group of Costa Rican experts conducted studies with the aim of validating the information from these Organizations.
9º—That this study examines the Costa Rican context in greater depth regarding aspects such as the use of products of, at most, moderate toxicity, which largely ensure respect for human health and life, thereby making the banana-growing industry eligible for environmental certifications without which it could not export to international markets. It also highlights that, since 2000, spraying may be conducted using satellite and digital technologies, through GPS (Global Position System), and that the software used in aerial spraying has become more sophisticated and refined, allowing the sprayers to turn on and off at the established boundaries of the aerial application area, preventing the pilot from spraying beyond them; with an average margin of error of 0.9 meters, this significantly reduces risks to the environment and to human life and health, and minimizes costs. The studies demonstrated the need to update the legislation in line with technological advances, which have provided a precision guidance system and improved management of spray drift (deriva), involving the interaction of several factors, such as proper application techniques, proper use of equipment, suitable weather conditions during application, type of product formulation, and the establishment of buffer zones (zonas de amortiguamiento). Accordingly, the measures necessary to minimize the risk of human error are virtually guaranteed.
Furthermore, it should be noted that the aforementioned study entitled “Manejo de la deriva en las aplicaciones aéreas de fungicidas en fincas que poseen zonas de amortiguamiento”—which was added to the case record—expressly states the following in its conclusions:
“1. There is sufficient information at the national and global levels indicating that drift from pesticide (plaguicida) applications must be managed through application practices and not exclusively through distances.
2. The application techniques and associated practices used to reduce drift in banana plantations in Costa Rica meet and exceed the recommendations of the United States Environmental Protection Agency (USEPA), the “Spray Drift Task Force (SDTF),” and the Food and Agriculture Organization of the United Nations (FAO).
3. Drift must be managed through appropriate climatic conditions, such as wind speed, which must not exceed 15 km/h, and wind direction, which must be away from sensitive areas.
4. The average droplet size of the application mixture must be between 200 and 300 um.
5. Flight altitude must not exceed 5 m above the crop canopy (dosel), and the length of the spray boom must not exceed 80% of the wing length.
6. A 30-meter buffer zone planted with trees taller than the crop is one of the best methods for minimizing drift, since the trees act as a barrier against pesticides moving beyond the application field.
7. The technology available in Costa Rica allows pesticides to be applied aerially and precisely, targeting the intended crop, with assurance that neither people nor the environment will be affected.” Hence, in the opinion of this Chamber, the omissions and lack of technical and scientific studies that were indeed identified by this constitutional jurisdiction in Voto No. 16276-2006 at 14:56 hrs. on 8 de noviembre de 2006, with respect to the distance reduction established by the now-annulled Article 70 of Decreto Ejecutivo No. 31520 of 16 de octubre de 2003, have now been remedied through Decreto Ejecutivo No. 34202. Because Decreto Ejecutivo No. 34202 is based on scientific studies supporting the distance reduction at issue, this Constitutional Court does not find that the fundamental rights to health and to a healthy and ecologically balanced environment have been violated.” In accordance with this Chamber’s ruling in that most recent judgment, the provision challenged here is the result of technical and scientific studies supporting the amendment and the reduction of the buffer zone from one hundred to thirty meters.
Accordingly, through Decreto Ejecutivo N° 34202, the omissions and lack of technical and scientific studies previously identified by this constitutional jurisdiction in Voto N° 16276-2006 at 14:56 hrs. on 8 de noviembre de 2006 were remedied with respect to the distance reduction established by Article 70 of Decreto Ejecutivo N° 31520 of 16 de octubre de 2003, which had resulted in its annulment as unconstitutional. Nevertheless, in view of this new challenge, the Chamber shall reexamine the matter.
VI.Review of the issue. As stated in the preceding whereas clause (considerando), this Chamber has already examined the provision challenged here and determined that it is based on technical and scientific criteria that guarantee adequate protection of the right to health and to a healthy and ecologically balanced environment, under the terms of Articles 21 and 50 of the Constitution. On this matter, the Chamber has recognized the principle of evidence-based environmental protection (principio de la objetivación de la tutela ambiental), or the principle of adherence to science and technology, in relation to State action to protect the environment. Thus, in Judgment N° 2006-17126 at 15:05 hours on 28 de noviembre de 2006, it stated:
“4.- On evidence-based environmental protection : (,,,) as this Court stated in Judgment number 14293-2005, at catorce horas cincuenta y dos horas on diecinueve de octubre del dos mil cinco, this is a principle that must in no way be confused with the preceding principle [the precautionary principle or principle of prudent avoidance], because, as derived from Articles 16 and 160 of the Ley General de la Administración Pública, it entails the need to support decision-making in this area with technical studies, both in relation to administrative acts and to provisions of general application—whether statutory or regulatory—giving rise to the requirement of ‘adherence to science and technology,’ which constrains the Administration’s discretion in this area. Accordingly, based on the results of such technical studies—such as environmental impact studies (estudios de impacto ambiental)—if objective technical criteria demonstrate the likelihood of clear harm to the environment, natural resources, or human health, the proposed project, works, or activity must be rejected; and where there is ‘reasonable doubt,’ decisions must be made in favor of the environment under the pro-nature principle (principio pro-natura), which may entail the adoption of both compensatory and precautionary measures in order to protect the environment adequately.” Specifically, as this Chamber held, the amendment made to Article 70 of Decreto Ejecutivo N° 31520 of 16 de octubre de 2003, Reglamento para las Actividades de Aviación Agrícola, is based on technical and scientific criteria that justify the measure or decision adopted to reduce the distance at issue from 100 to 30 meters; that is, there are objective reasons for doing so, thereby complying with the principle of adherence to science and technology, provided, of course, that the technical criteria contained in the provision are observed.
In this regard, the Chamber has established that the State must act as guarantor of the proper use of pesticides and the prevention of their harmful effects on health and the environment. In this respect, in Judgment N° 2004-13968 at 11:35 hours on 3 de diciembre de 2014, it stated:
“III.- That report [FOE-AM-19/2004 of 20 de octubre del 2004, prepared by the Área de servicios agropecuarios y de medio ambiente de la División de fiscalización operativa y evaluativa de la Contraloría General de la República, concerning the evaluation of State management in relation to the control of agricultural pesticides] arose from the need to audit the administrative process associated with one of the most urgent environmental problems the country must address: the use of chemical, biological, or related substances in agricultural activities. It also arose from the need for the State to intervene by exercising a regulatory function over the use of agrochemicals (agroquímicos), ensuring that farmers have access on the market to effective pest-control products while also protecting the health of the general public and its right to a healthy and ecologically balanced environment. The report stated that this oversight is exercised primarily by the Ministerio de Agricultura y Ganadería through the Servicio Fitosanitario del Estado, which must work in coordination with the Ministerio de Salud and the Ministerio del Ambiente y Energía regarding oversight of impacts on health and the environment, as well as with the Ministerio de Hacienda regarding the importation and tax exemption of such products.
Its general objective was to evaluate State management regarding the control of pesticides used in agricultural activities and their effects on the environment and human health, principally the actions of the Servicio Fitosanitario del estado del Ministerio de Agricultura y Ganadería (MAG); and the study’s specific objectives were: a) to evaluate national policies and governing authority in the field of oversight of pesticide use, identifying the participating institutions and their powers; b) to evaluate the pesticide-registration process in the country and the associated regulations; c) to evaluate the pesticide-exemption and importation process in the country; and d) to evaluate oversight and monitoring of pesticide use.
IV.In that report, the Office of the Comptroller concluded that the Servicio Fitosanitario del Estado (SFE) does not fulfill the purposes for which it was created efficiently and in accordance with the principle of legality, which require it to regulate, implement, and oversee the registration and use of agrochemicals within the framework of agricultural activity conducted in harmony with nature and in faithful observance of the constitutional principles concerning the rights to life, health, and a healthy environment. It determined that, on the contrary, the actions of that body are aimed at facilitating the registration and marketing of such substances, justified by an alleged interest in improving the competitiveness of agricultural producers; however, those objectives instead appear to be directed toward promoting competition in the pesticide (plaguicida) market, above the constitutional rights of the farmers themselves and the principles concerning the environment and human health.
It concluded that the companies benefiting most from the SFE’s facilitative role have been those engaged in the sale of agrochemicals, particularly so-called generic products, to the detriment of producers and consumers of agricultural goods. It clarified that this does not mean that pesticides of this type may not be registered in the country, but rather that their registration must be carried out in compliance with the applicable regulations and in a manner that ensures protection of the health of the Costa Rican population and of its fundamental right to a healthy and ecologically balanced environment (ambiente sano y ecológicamente equilibrado), while protecting the national farmer’s right to access good-quality inputs; without prejudice to the necessary actions the State must take to pursue the gradual reduction of pesticide use and promote alternative mechanisms. These considerations led the Contraloría General de la República to issue a series of final directives addressed to the Presidente de la República and the Ministros de Planificación Nacional y Política Económica, Agricultura y Ganadería, Salud, Ambiente y Energía, and Economía, Industria y Comercio, as well as to the Auditor Interno del Ministerio de Agricultura y Ganadería.”
Similarly, in Voto N° 2006-09565 at 16:08 on 5 de julio de 2006, this Court held:
“(…) it is evident that the Costa Rican State has a duty to act effectively and proactively to prevent the occurrence of events that degrade the environment and compromise its sustainability.” And in Sentencia N° 2011-016937 at 14:36 on 7 de diciembre de 2011, it stated:
“V.- ON THE RIGHT TO HEALTH AND TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT. This Chamber has repeatedly recognized that the State’s primary and fundamental obligations include the duty to respect, protect, and guarantee the fundamental right to health of its inhabitants (E.g.: judgments 1992-1915 at 14:12 on 22 de julio de 1992, 2004-10039 at 14:39 on 13 de setiembre del 2004, and 2008-001003 at 14:56 on 23 de enero del 2008). Recently, in order to guarantee a higher level of protection, the Chamber recognized that the fundamental right to health is an autonomous fundamental right (Reference may be made, for this purpose, to judgment number 2011-02932 at 15:47 on 22 de marzo de 2011. To the same effect, judgments number 2011-007768 at 19:54 on 14 de junio del dos mil once and number 2011-008876 at 15:01 on 5 de julio del 2011). Moreover, this Chamber has also recognized and guaranteed a high level of protection for the fundamental right to a healthy and ecologically balanced environment.
It did so even before Article 50 of the Constitución Política was amended. Through constitutional amendment law number 7412 of 3 de junio de 1994, two paragraphs were added to Article 50 of the Constitución Política in order to expressly recognize every person’s fundamental right to a healthy and ecologically balanced environment, as well as the Costa Rican State’s duty to guarantee, defend, and preserve that right. (Regarding the content and scope of that fundamental right, see judgment number 2006-17126 at 15:05 on 28 de noviembre del 2006). Finally, it bears reiterating the inseparable relationship between environmental protection and the effective guarantee of the fundamental rights to life and health and, more generally, of the ability of human beings to lead an existence consistent with their inherent dignity (Sentencia Nº 5691-98 at 17:15 on 5 de agosto de 1998). The right to a healthy and ecologically balanced environment affords special protection to biodiversity and groundwater; accordingly, and pursuant to the precautionary principle (principio precautorio) in environmental matters, economic activities having an environmental impact may be authorized only when there is scientific certainty that such impact does not pose a risk or threat of permanent and irreversible damage to the environment.
For this reason, in cases where it is warranted, the Administration must conduct an environmental assessment (evaluación ambiental) using the instruments it deems appropriate; that assessment must be publicly shared with the affected population so that, following a rigorous and detailed analysis, the Administration may issue a reasoned decision granting the corresponding environmental feasibility approval (viabilidad ambiental). Failure to address or comply with these requirements, as defined by law and case law, constitutes a violation of the aforementioned right to a healthy environment; consequently, administrative actions ordered in this manner likewise violate that fundamental right (See, among others, judgments of this Chamber numbers 5893-95, 5445-99, 2001-6503, 2003-6322, 2004-13414, 2006-7994, 2010-6922). It is therefore concluded that constitutional law indisputably establishes the Costa Rican State’s power and duty (poder-deber) to ensure the effective and timely protection of public health and of the right to a healthy and ecologically balanced environment, thereby raising the population’s standard of living.” In that same judgment, it further stated:
“VIII.- ON THE REGULATION OF PESTICIDE REGISTRATION. The proper use of pesticides may be useful for controlling and eliminating pests, for the benefit of the population’s food security and of economic activity based on agricultural production. Nevertheless, the potential risk that the use of such substances may pose to human health and the environment must be acknowledged. This has even prompted the adoption of international instruments expressly intended to protect human health—including the health of consumers and workers—and the environment from the potentially harmful effects of pesticides, as in the case of the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade, which Costa Rica approved through Ley No. 8705 of 13 de febrero del 2009.
(…) this Court has recognized the risk that pesticide use may entail and the importance of adopting suitable measures to regulate their use. The Costa Rican legal system contains various statutory and regulatory provisions establishing that the importation, manufacture, marketing, and use of pesticides are strictly subject to the State’s police power (potestad de policía), in order to guarantee the rights to health and to a healthy and ecologically balanced environment.” In this Court’s view, the technical and scientific studies underlying the regulatory amendment challenged here—and duly identified in the recitals (considerandos) of the Decreto Ejecutivo in question—guarantee the State’s fulfillment of its obligation to protect the rights to health and the environment. Indeed, a copy of the study entitled “Management of Spray Drift in Aerial Fungicide Applications on Farms with Buffer Zones” has been submitted to the case record, and it contains the following conclusions:
“1. There is sufficient information at the national and global levels indicating that drift management (manejo de la deriva) in pesticide applications must be carried out through application practices and not exclusively through distances.
2. The application techniques and practices used to reduce drift in banana plantations in Costa Rica meet and exceed the recommendations of the United States Environmental Protection Agency (USEPA), the “Spray Drift Task Force (SDTF),” and the Food and Agriculture Organization of the United Nations (FAO).
3. Drift must be managed through appropriate weather conditions, such as a wind speed that must not exceed 15 km/h and a wind direction away from sensitive areas.
4. The average droplet size of the application mixture must be between 200 and 300 µm.
5. The flight altitude must not exceed 5 m above the crop canopy, and the length of the spray boom must not exceed 80% of the wing length.
6. A 30-meter buffer zone (zona de amortiguamiento), planted with trees taller than the crop, is one of the best methods for minimizing drift, because the trees act as a barrier against pesticides traveling beyond the application area.
7. The technology available in Costa Rica makes it possible to apply pesticides aerially in a precise manner, directed at the target crop, with certainty that neither people nor the environment will be harmed.” In light of the foregoing, it is established that the amendment in question does not suffer from the omissions and lack of technical and scientific studies that affected the now-annulled Article 70 of Decreto Ejecutivo N° 31520 del 16 de octubre de 2003, and that prompted this Chamber, by Judgment N° 2006-016276 de las 14:56 horas del 8 de noviembre de 2006, to declare it unconstitutional. There are, therefore, scientific and technical grounds justifying the reduction of the distance that must be maintained between the land on which aerial pesticide applications are conducted and population centers and other locations. In this regard, the petitioner must understand that the reduction in question is not, in itself, unconstitutional, nor does it necessarily entail a regression in the protection of the right to health or the environment.
It must first be borne in mind that the general rule is that a distance of one hundred meters must be maintained between the crop subject to aerial spraying and roads, population centers, dwellings, buildings in which personnel are working, water sources, and adjacent crops or neighboring properties susceptible to adverse effects from the pesticide applied (Article 70 of Decreto Ejecutivo N° 31520). The reduction of that distance to thirty meters is permitted only as an exception and requires compliance with a series of requirements set forth in the same provision. Those requirements have a scientific and technical basis and are therefore neither arbitrary nor capricious, which makes the provision reasonable in relation to the objectives of protecting the right to health and the right to a healthy and ecologically balanced environment. One of the conclusions reached by the aforementioned study is that the management of spray drift (deriva) in pesticide applications does not depend solely on distance, but rather on application practices.
At present, technological advances allow spray drift to be controlled very efficiently, to such an extent that, under certain circumstances—regulated in the Decree in question—and with the use of new technologies available in the country, aerial pesticide applications can be carried out so precisely that even a distance of thirty meters may provide greater protection than one of one hundred meters, provided, of course, that the other technical requirements contained in the provision, which ensure that spray drift will not extend beyond the protection zone (zona de protección), are met. Distance is not a determining factor in whether the right to health and the environment receives greater or lesser protection; rather, such protection depends on the use of technological resources that allow spraying operations to be performed with greater precision and with virtually no spray drift. Nevertheless, the Office of the Attorney General of the Republic (Procuraduría General de la República), in its capacity as advisory body to this Court, made several observations in its report concerning the technical and scientific study underlying the challenged Decree, which are important to examine.
V.On the position of the Procuraduría General de la República regarding the merits of this action. The Procuraduría states that Decreto N° 34202, according to Whereas Clause 8 (considerando 8°), is based on the document “Management of Spray Drift in Aerial Pesticide Applications on Farms with Buffer Zones (Manejo de la deriva en las aplicaciones aéreas de plaguicidas en fincas con zonas de amortiguamiento),” published by CORBANA S.A. in 2007 and prepared by Roberto Valenciano Mora, of Corporación de Desarrollo Agrícola Del Monte S.A.; Sergio Laprade Coto, of CORBANA S.A.; Álvaro Fournier Leiva, of CARIBANA S.A.; and Eduardo Trejos Obando, of Standard Fruit Co. In the advisory body’s opinion, this raises a number of questions regarding the technical basis for extrapolating the results of that document, prepared by members of the banana industry, to other types of crops, as the challenged Decree does.
It further notes that the provision differs in certain respects from the document providing its scientific and technical support: while the document states that relative humidity must exceed 60%, the Decree provides that it must exceed 70%; and while the document states that “if the application is carried out perpendicular to the buffer zone, an additional strip of 40 meters must be left within the crop in which pesticides must not be sprayed, in order to reduce the effect of drift,” the Decree provides that this distance must be maintained when the application is performed by airplane. This leaves open the question of whether, a contrario sensu, that strip need not be maintained when a helicopter is used. The Decree also provides that “The product-free application strip may be omitted in the case of internal roads or paths used exclusively for the crop, provided that there are no dwellings,” thereby reducing the forty-meter strip recommended by the study to distances as short as the six meters that internal roads may measure.
Lastly, it also questions the scientific objectivity of the study underlying the challenged Decree because it was sponsored and conducted by members of the banana industry, who could be influenced by the sector’s private interests. The matters identified by the Procuraduría General would necessarily require this Chamber to review and assess the technical and scientific grounds of the Decree in question. That is not feasible because this Constitutional Chamber is not a technical body in this field and therefore lacks jurisdiction to examine the merits of those technical and scientific criteria and thereby determine, among other matters, whether the reduction of the established distance for aerial pesticide applications is warranted on the basis of those criteria. This Court already stated the foregoing in Judgment N° 14948-2007 de las 14:58 horas de 16 de octubre de 2007, which held in this regard:
“(…) A) On the lack of jurisdiction of the Constitutional Chamber to determine the number of active ingredients that must undergo bioequivalence testing (pruebas de bioequivalencia): The issue raised is that requiring therapeutic-equivalence testing (pruebas de equivalencia terapéutica) for only seven of the active ingredients in multisource medicinal products posing a health risk (productos de los medicamentos multiorigen de riesgo sanitario) is insufficient, and that more or all of them should be required to undergo such testing. In this regard, the claim is inadmissible in these constitutional proceedings because this Court lacks jurisdiction to determine whether the number should be seven, thirty, or forty. Moreover, the health authorities do not indicate that the number or quantity of active ingredients to undergo bioequivalence testing poses a danger to health, essentially because the list is to be expanded progressively.
Accordingly, it is not for this Chamber to determine whether limiting the requirement to only seven multisource pharmaceutical products posing a health risk—and thus making them the only multisource pharmaceutical products (generic medicines) that may be required to undergo equivalence testing before registration—poses a health risk or a danger to human health. This Chamber further observes that, under Article 29 of the aforementioned Decreto n°28466-S—and in accordance with WHO criteria—there are three groups of generic medicines that, because of their characteristics, warrant different treatment: those requiring in vivo therapeutic-equivalence studies as a prerequisite for registration; those that, while not requiring in vivo studies, do require proof of in vitro therapeutic equivalence; and, finally, those that are not required to demonstrate therapeutic equivalence. It is not possible in these constitutional proceedings to assess and determine which generic medicines belong to each category.
For these reasons, because the specialized entity with political responsibility for the matter has determined that seven products is a reasonable number, this Constitutional Court cannot issue either a favorable or an unfavorable ruling on the matter, because it is not a technical body in this field and lacks evidence conclusively showing that requiring bioequivalence testing for a greater number of active ingredients affords greater protection to the right to health, or conversely, that requiring such testing for fewer active ingredients affords less protection to the right to health. As stated above, determining the number is a matter of expediency, on the understanding that such determination does not endanger health, in view of the authorities’ statements. It should be noted that there is no universally accepted benchmark against which to compare the list in question. The petitioners state that Appendix I of Annex n°9 to the 34th Report of the WHO Expert Committee on Specifications for Pharmaceutical Preparations of 1996 contains no fewer than 188 products that, in Germany, Canada, and the United States, undergo therapeutic-equivalence studies before their sale is authorized.
The respondent authorities, however, state that at the Latin American level we are moving faster than other countries, that individualized studies and extensive training are required, and that Argentina has only 12 active ingredients. Accordingly, this matter falls within the political responsibility of the respondent authorities, and this Chamber cannot express an opinion on the decision as to which or how many medicines must undergo testing. It is true that the Chamber already held (see voto 2001-12226) that the registration of multisource medicines posing a health risk without therapeutic-equivalence studies is unconstitutional. It cannot now be maintained, however, that establishing only seven medicines as posing a health risk—and therefore requiring only those seven to undergo therapeutic-equivalence testing—is likewise unconstitutional, because the number of substances requiring testing to safeguard health cannot be debated in these proceedings.
In the previous decision, the action was upheld because no testing whatsoever was being conducted. Now that it has been determined that seven active ingredients must undergo testing, however, the constitutional analysis can go no further. On what basis, other than a mere a contrario sensu presumption drawn from the statements of the competent authorities, could the Chamber conclude that establishing only seven active ingredients—the only ones subjected to therapeutic-equivalence testing—is insufficient? Thus, because there are no determinative criteria for stating that the number must be seven, fourteen, twenty-one, or more—apart from the criterion of the politically responsible body, which has already determined that the number is seven—it is not possible to issue any ruling on the matter. Lastly, it is likewise not appropriate to assess whether the Decree in question is adequately supported.
In conclusion, this Constitutional Chamber is not the forum responsible for deciding a matter as technical as the one under discussion, nor does it have sufficient grounds to conclude that the reduction to seven products infringes the right to health.” From the foregoing, it is clear that this Chamber lacks jurisdiction to review the technical and scientific criteria underlying the Decree challenged in these proceedings or to decide among differing technical criteria that might exist in this regard (to the same effect, see this Chamber’s rulings N° 11114-2001 of 12:53 on 26 de octubre de 2001, N° 14349-2005 of 09:14 on 21 de octubre de 2005, N° 11343-2007 of 09:36 on 10 de agosto de 2007, N° 3216-2009 of 10:08 on 27 de febrero de 2009, and N° 12282-2011 of 11:23 on 9 de septiembre de 2011). Similarly, regarding those respects in which the Executive Decree in question departs from or contains regulations differing from the study on which it is based—as noted by the Procuraduría General de la República in its report—it should be stated that not only were those matters not challenged by the petitioner—and therefore are not at issue in this action—but they are also matters that, where appropriate, must be reviewed in legality proceedings (vía de legalidad).
Moreover, the fact that the study underlying the challenged Decree was prepared by scientists affiliated with the banana industry is not sufficient grounds to invalidate it, because, as framed, that would constitute a circumstantial ad hominem fallacy: the invalidating argument would be based solely on the circumstances surrounding the scientists who prepared the study—their affiliation with the banana industry—and not on specific challenges to the objectivity and truthfulness of the conclusions reached in the study. Accordingly, in this Chamber’s judgment, the challenged provision is rational as an appropriate means of achieving its stated objectives of protecting the environment and human health, given its technical and scientific basis. Those objectives, established in article 70 of the Regulations, are to prevent the contamination of roads, population centers, dwellings, buildings where personnel are working, water sources, and adjacent crops or neighboring properties due to pesticide drift or carryover.
Not only is there scientific evidence that a thirty-meter no-application zone (zona de no aplicación) has a technical justification, provided that the technical conditions and requirements set forth in the challenged regulations are met, but those regulations also add a buffer or functional protection zone (zona buffer o de protección funcional); together, both elements are sufficient to prevent drift, according to the technical and scientific studies conducted. There is therefore no regression in this matter, since the reduction in distance is conditional upon compliance with a series of requirements (a no-application zone plus an area covered by a vegetative barrier), all of which is reasonable. Technological advances make it possible to achieve greater and better control of drift, allowing the existing distance between the crop area subject to aerial spraying (fumigación aérea) and population centers and other locations to be reduced from one hundred to thirty meters without reducing the degree of protection previously afforded, before the amendment, to the right to health and to a healthy and ecologically balanced environment.
Indeed, it may be considered that, through the application of technological advances, greater protection of those rights is now possible than was previously afforded, despite the reduction of the aforementioned distance. Furthermore, it is clear that the technological advances referenced in the scientific study underlying the Decree challenged here are not exclusive to banana cultivation, even though the study refers specifically to that type of crop. Rather, technological advances in aerial spraying are being applied to that type of crop. This is clear from the summary of the study underlying the challenged decree, which states: “This paper presents an analysis of the latest available technology and the experience gained in Costa Rica in the field of aerial pesticide applications.” Thus, this study is not limited to banana cultivation but instead addresses aerial pesticide applications generally, regardless of the crop involved.
Consequently, the reservations expressed by the Procuraduría General regarding this point are unfounded (see, to this effect, the Technical Report on Aerial Applications and Buffer Zones N° CAAA-008-2014 of 24 de octubre de 2014, prepared for this action by Engineer Emmanuel Villalobos Sánchez, President of the Comisión Asesora para el Control y la Regulación de las Actividades de la Aviación Agrícola). Likewise, the required density of the buffer zone (zona de amortiguamiento), as well as the height of the trees, are technical matters that cannot be reviewed in these proceedings.
VI.Monitoring of weather conditions at the time of spraying. Regarding the monitoring of the weather conditions prevailing when aerial pesticide application is performed, according to the report submitted by the Director General of the Dirección General de Aviación Civil and the President of the Consejo de Aviación Civil, requested as additional evidence to assist in reaching a decision, aerial application operations do not have an “aviation technician” as such to verify the weather conditions of the field or property to be treated. Instead, they use a “Field Supervisor” or “Irrigation Supervisor,” who is responsible for observing wind, temperature, visibility, cloud ceiling, and other conditions that may affect the application. This person is generally an employee of the property or the owner of the crop to be treated who, based on their experience and knowledge of the application site, provides the pilot with the corresponding report on conditions so that the pilot may begin the flight from the airport. These personnel usually have a portable anemometer with which they take specific readings of wind speed and direction, temperature, and relative humidity. In addition, agricultural operators specify the duties and responsibilities of these personnel in their Operations Manuals, as established in article 54.2.3 of the Reglamento de Actividades Agrícolas.
These verifications are also performed by the Unidad de Operaciones Aeronáuticas through its Inspectors, who conduct regular inspections of agricultural operations in accordance with the Annual Surveillance Plan. Regarding satellite guidance systems, altitude, and calibration of application equipment, the Director General of the Dirección General de Aviación Civil and the President of the Consejo de Aviación Civil stated in their report that these are automated systems adjusted from the pilot’s cockpit, into which the pilot enters the coordinates of the property to be treated and the application parameters, such as the number of gallons to be applied per hectare. Because the system is automated, it makes the adjustments necessary to maintain the desired application. As for equipment calibration, the equipment is factory-calibrated, and the agricultural operator also has specific procedures for performing such calibrations, whether at the customer’s request (the property) or under its maintenance program; those procedures are likewise established in its Operations Manual.
Accordingly, this Chamber finds that, when aerial spraying is performed, there is adequate monitoring of the weather conditions necessary to prevent drift beyond the buffer zone, with respect to verifying wind speed and direction, temperature, relative humidity, satellite guidance systems, flight altitude, and calibration of the application equipment. This Chamber understands that all these conditions are duly verified and supervised, as appropriate, by the competent authorities in order to safeguard human health.
VII.Study on the health effects of aerial spraying on pregnant women in Matina. Both the petitioner and the Procuraduría General de la República refer to the study by the Instituto Regional en Sustancias Tóxicas de la Universidad Nacional (IRET) and others entitled “Aerial Application of Mancozeb and Urinary Concentrations of Ethylene Thiourea (ETU) in Pregnant Women in Costa Rica: Infants and Environmental Health Study (ISA).” This study detected chemicals dispersed during aerial spraying in the urine of pregnant women living in the banana-growing area of Matina, which constitutes a serious health problem. In this regard, the study concludes that “[t]he measured urinary ETU concentrations in the women were more than five times higher than those reported for other general populations (…). The urinary ETU concentrations in the pregnant women are concerning, and aerial spraying of mancozeb may be the primary source of exposure.” This Chamber does not question the serious health consequences affecting pregnant women in the banana-growing area of Matina or that the probable cause is the aerial spraying of those crops.
This probability alone is sufficient for this Court, applying the precautionary principle (principio precautorio) in environmental and human-health matters in amparo proceedings (vía de amparo), to protect those fundamental rights. However, in constitutional-review proceedings (acción de inconstitucionalidad), it must be established that a cause-and-effect relationship exists between the enactment of the challenged regulations and the alleged infringement of the right to health and to the enjoyment of a healthy and ecologically balanced environment. In other words, it must also be established that the enactment of the challenged Executive Decree, which reduces the distance between crops subject to the aerial application of substances and dwellings or population centers, has diminished the protection of those fundamental rights in a manner constituting an impermissible regression in this area.
It should be noted that, on the one hand, the petitioner does not demonstrate that reducing the buffer zone from one hundred to thirty meters, subject to compliance with the conditions established for that purpose by the challenged provision, is the cause of this health problem, or that the problem is not instead attributable to noncompliance with the applicable regulations and failure to fulfill the monitoring and enforcement obligations borne in this regard by the competent administrative authorities.
As stated above, this Chamber lacks jurisdiction to review the technical criteria underlying the Executive Decree in question or to determine, among differing criteria, which should apply or prevail. Its role is to verify that the decision to reduce the distance between the area subject to spraying and homes or population centers is supported by scientific and technical criteria. If those criteria are erroneous or if the method used contains inconsistencies, that is a matter that must be litigated in ordinary proceedings (vía ordinaria), where the criteria may be reviewed on the basis of extensive evidence and the correct one may be established. In any event, technical and scientific criteria represent contingent and provisional truths that are always subject to review. It is also clear that new scientific and technological advances could provide new elements for improving the regulations in force. But that possibility for improvement does not mean that the rule is unconstitutional, except insofar as it is contrary to Constitutional Law, such as where, in the protection of fundamental rights, the new regulations provide less protection than has already been achieved.
In this connection, neither is it for this Chamber to review whether the methodology used in the study of pregnant women in Matina contains methodological errors that invalidate the conclusions reached. Thus, in these proceedings, the findings and conclusions of that study cannot be challenged on the basis of the objections concerning methodological aspects set forth in Official Letter No. GG-505-2014, dated 16 de octubre de 2014, signed by Engineer Jorge A. Sauma A., General Manager of Corbana S.A., and Engineer Sergio Laprade Coto, Coordinator of the Comisión Ambiental Bananera, or those raised in Report No. DRPIS-UNC-ESJ-2287-10-2014, dated 14 de octubre de 2014, prepared by Licda. Elizabeth Solórzano Jiménez, an official of the Unidad de Normalización y Control-DRPIS, and Engineer Ricardo Morales Vargas, an official of the UNSSAH-Dirección Protección al Ambiente Humano, both of the Ministerio de Salud, since that dispute belongs in legality proceedings (vía de legalidad).
It is in those proceedings that it may be established whether the cited study does in fact suffer from a series of methodological errors that cast doubt on its conclusions, such as the absence of a target or control population unrelated to banana production that could serve as a comparison, which means that other variables, such as food intake, are not differentiated, given that mancozeb is used on many crops intended for direct human consumption and in processed foods in the population’s diet; accordingly, the assumption that all exposure is attributable to aerial pesticide application is not conclusive. Likewise, the study suggests that the possible presence of ETU is due to aerial applications, but it does not consider genetics, applications to other crops in the area, or the origin of the individuals as other variables, even though, for example, it was determined that migrants had higher ETU levels than Costa Rican women.
Similarly, it is stated that the handling and analysis of the samples are unclear, that the chain of custody (cadena de custodia) is unknown, and that no laboratory accredited for good laboratory practices (GLP) testing was used. It is noted that the study does not present the r2, which serves to determine the degree to which the variables are related, for the relationship between the distance from the home and ETU levels in individuals; this suggests that it is very small and, therefore, using the distance between farms and homes together with ETU levels is not a correct predictor of exposure. Nor is harm to individuals demonstrated, and the product is described as carcinogenic while disregarding what the Agencia Internacional de Investigación en Cáncer (AIRC) of the Organización Mundial de la Salud states on the matter. It is also noted that outdated toxicological parameters from 1996 were used, although the applicable intake parameter at the time the report was prepared was from 2013; this invalidates the study’s conclusions because, when the estimated daily intake (EDI) obtained in the study is compared with the 2013 reference daily dose (RfD) levels, it is found to be fifteen times below the permitted value, which completely changes the study’s conclusions.
Likewise, Doctor Freddy Arias Mora, a toxicologist at the Facultad de Farmacia of the Universidad de Costa Rica, upon analyzing the study of ETU concentrations in pregnant women in Matina, concludes that the mathematical formula used to determine the possible concentration of ETU in blood contains an error due to a flaw in the toxicokinetic model used, and that the data do not represent the dose resulting from chronic exposure to the fungicide mancozeb or its metabolite ETU, because the toxicokinetic model contains calculation errors. This, together with the failure to consider the dynamics of absorption and elimination of the substance and the influence of the duration of pesticide exposure, renders the results invalid, and therefore no possible adverse effect on human health can be asserted.
All of those methodological objections raised against the study “Aerial Application of Mancozeb and Urinary Concentrations of Ethylene Thiourea (ETU) in Pregnant Women in Costa Rica: Infants and Environmental Health Study (ISA),” which cast doubt on the conclusions reached in that study, are not matters to be heard in these proceedings, because legality proceedings are the proper forum for analyzing the merits and determining whether the conclusions in question can be sustained. For the same reason, neither is it appropriate in these proceedings to assess the conclusions reached by the researchers who conducted the study entitled “Drift Management in Aerial Pesticide Applications on Farms with Buffer Zones.” Among other matters, this latter research study concludes that sufficient information exists nationally and worldwide indicating that drift (deriva) from pesticide applications must be managed through application practices and not exclusively through distances, and that a thirty-meter buffer zone (zona de amortiguamiento), planted with trees taller than the crop, is one of the best methods for minimizing drift, because the trees act as a barrier preventing pesticides from moving beyond the application area.
This study is based on the universal laws of physics and on specific techniques, such that if spraying is carried out with appropriate technology and in compliance with certain scientifically and technically established requirements—which are incorporated into the challenged Executive Decree—it can be scientifically established that drift will be almost nonexistent and that a thirty-meter buffer zone planted with trees taller than the crop ensures that any drift that occurs will not pass beyond it, provided that all required technical conditions are met (droplet size of the mixture to be applied, spray-boom length, flight altitude, weather conditions, etc.). Under these circumstances, drift toward population centers could not occur, as that would entail defying the physical laws that universally govern the behavior of matter.
Accordingly, the challenged Decree is supported by a scientific study that cannot be questioned in these proceedings, even through another technical study that challenged its conclusions. That divergence would necessarily have to be resolved in legality proceedings.
In addition, a variety of studies and information concerning aerial pesticide spraying and the issue of possible drift have been submitted in the record of this action: Technical Report on Aerial Applications and Buffer Zones by the Comisión Asesora para el Control y la Regulación de las Actividades de la Aviación Agrícola; Good Application Practices for Extensive Field Crops: Distances from Urban Areas, Criteria and Solutions, by Alberto Etiennol and Augusto Piazza of the Universidad Argentina de la Empresa; Assessment and Mitigation of Spray Drift in Spraying, by Allan S. Felsot of Washington State University; Summary of Aerial Application Studies; Pesticide Drift, by Susan Cordell and Paul B. Baker of the School of Agriculture at the University of Arizona; Drift Filtration by Natural and Artificial Collectors: A Review of the Literature, by Andrew J. Hewitt of Stewart Agricultural Research Services; and Natural and Artificial Barriers for Spray Drift: Exposure Mitigation in South Australia, a research project for Primary Industries and Resources South Australia (PIRSA), by Andrew Hewitt PhD, Gary Dorr PhD, Peter Hughes, and Toni Axford (PIRSA) of the Centre for Pesticide Application and Safety at the University of Queensland, Gatton.
All of this research ultimately concludes that the drift produced by aerial pesticide spraying can be reduced almost to zero and prevented from reaching homes or population centers adjacent to the crop being sprayed, provided that certain requirements are met, such as the existence of a buffer zone planted with trees taller than the crop and the use of state-of-the-art spraying technologies; spraying must also be conducted under specific scientifically and technically established weather conditions. Under these conditions, reducing the distance between the crop and homes or population centers to only thirty meters does not entail any diminution in the protection of the local inhabitants’ right to health or any impairment of the right to enjoy a healthy and ecologically balanced environment, protected under Articles 21 and 50 of the Constitución Política.
Thus, if all the requirements and conditions referred to in the challenged Executive Decree are met, there is no way that drift could cause the adverse health effects alleged by the petitioner and asserted in the study concerning pregnant women in Matina. This could occur only if those conditions were not met. The petitioner himself confirms this, stating in his complaint AEL-063-2015, dated in Limón on 15 de junio de 2015, that there are no physical barriers on the banana farms in Matina—that is, there is no thirty-meter buffer zone between the crop being sprayed and the homes of the affected individuals. This is also substantiated by the response to that complaint issued by the Director of the Área Rectora de Salud de Matina in Official Letter HC-ARS-M-2382-2015 of 30 de junio de 2015. Consequently, in the case of Matina, the regulations contained in the challenged Decree are not applicable because the conditions for their application are not met; therefore, the health problems affecting pregnant individuals are not related to the rule alleged to be unconstitutional but, instead, to possible noncompliance with the regulations governing aerial spraying, which is not a matter within the scope of these proceedings.
Consequently, this Chamber finds that the provision at issue has sufficient scientific support and, to that extent, is rational; it therefore entails no regression in the protection of fundamental rights, particularly health and the enjoyment of a healthy and ecologically balanced environment. Accordingly, the challenge against Decreto Ejecutivo N° 34202-MAG-MS-MINAE-MOPT-MGSP, which amends Article 70 of Decreto Ejecutivo N° 31520-MS-MAG-MOPT-MGSP, “Reglamento para las actividades de Aviación Agrícola”, of 16 de octubre del 2003, must be dismissed in its entirety.
VIII.Regarding the petitioner’s request that the Defensoría de los Habitantes be granted a hearing. In a filing submitted at 10:05 hours on 4 de diciembre de 2014, the petitioner requests that this Chamber grant the Defensoría de los Habitantes a hearing so that it may state its position regarding Decreto Ejecutivo N° 34202-MAG-MS-MINAE-MOPT-MGSP, which amends Article 70 of Decreto Ejecutivo N° 31520-MS-MAG-MOPT-MGSP, “Reglamento para las actividades de Aviación Agrícola”, of 16 de octubre del 2003, challenged in this action. Consideration of that filing was deferred until the appropriate procedural stage (Presidency ruling issued at 11:19 hours on 4 de diciembre de 2014). Upon review, the petitioner’s request is inadmissible because, on the one hand, the Defensoría de los Habitantes has no direct connection with the application of the challenged Decreto Ejecutivo and, on the other, this Court does not consider that it could provide additional information for deciding the merits of this matter, particularly given that the advisory body to this Chamber in constitutional challenges (acciones de inconstitucionalidad) is the Procuraduría General de la República, which issued its opinion regarding the challenged provision.
IX.Conclusion. Based on the foregoing considerations, the action filed must be dismissed in its entirety, because this Chamber finds that Article 1 of Decreto Ejecutivo N° 31520-MS-MAG-MOPT-MGSP, Reglamento para las actividades de Aviación Agrícola, is not in itself unconstitutional, provided that the competent authorities strictly monitor the buffer zone (zona de amortiguamiento) and the other conditions required by the Decreto in specific instances of its application, in order to safeguard human health. Justice Cruz Castro dissents and would grant the action in its entirety.
X.Dissenting opinion (voto salvado) of Justice Cruz Castro. With the utmost respect for the majority of the Constitutional Court, and based on the same considerations for which I previously dissented in Judgment N° 2012-011064 at 16:31 hours on 14 de agosto de 2012, I disagree with the reasoning set forth by the Chamber in the majority judgment, which finds that Article 1º of Decreto Ejecutivo No. 34202 of 21 de mayo de 2007 does not violate Constitutional Law (Derecho de la Constitución), particularly the rights protected under Articles 21 and 50 of the Constitución Política. In this regard, the undersigned Justice reiterates the position adopted in Judgment No. 2006-16276 at 14:46 hrs. on 8 de noviembre de 2006, which declared unconstitutional Article 70 of the Reglamento para las Actividades de Aviación Agrícola, Decreto Ejecutivo No. 31520-MS-MAG-MOPT-MGSP of 16 de octubre de 2003, insofar as it provides:
“This strip may be reduced to a minimum of 30 meters if, between the field to be treated and the indicated sites, there are buffer zones reforested preferably with native species, provided also that pesticides of no more than moderate toxicity are applied and that the application is performed under appropriate conditions of flight altitude, particle size, and wind speed that, taken together, allow pesticide drift (deriva) to be reduced; that the aircraft is equipped with appropriate devices for that purpose; and that it flies parallel to the buffer zone. If the application is performed perpendicular to that zone, an additional strip of no less than 40 meters must be left within the crop, in which pesticides may not be applied by aircraft, in order to reduce the effect of drift; the corresponding area may be treated by helicopter or another means that ensures drift control. The pesticide-free application strip may be omitted in the case of internal roads or paths used exclusively for the crop to be treated, provided that there are no dwellings and none of the circumstances referred to in the first paragraph of this Article arise.” This provision is similar in substance to the one challenged here, namely Article 1º of Decreto Ejecutivo N° 34202 of 21 de mayo de 2007, which reduced from one hundred to thirty meters the required distance between the field to be treated and any highway, population center, dwelling, building occupied by workers, water source, adjacent crop, or neighboring property for the purpose of aerial pesticide application.
In this regard, it must be recognized, as it was in Judgment N° 2006-16276, that this Chamber has extensively developed the scope of the fundamental right to a healthy and ecologically balanced environment, as set forth in Judgment N° 2003-06322 at catorce horas con catorce minutos on tres de julio del dos mil tres, without prejudice to subsequent expansions and qualifications from which a series of parameters and principles are derived and summarized as follows:
“1. the State’s obligation to guarantee, defend, and safeguard this right, whereby the State becomes the guarantor of the protection and safeguarding of the environment and natural resources. It must secure and protect that right against any risk or necessity; to defend means to bar, prohibit, and prevent any activity that infringes upon the right; and to preserve means taking action aimed at safeguarding the right in advance against possible dangers so that it will endure for future generations. The State must assume a dual obligation to act and to refrain from acting: on the one hand, it must itself refrain from infringing upon the right to a healthy and ecologically balanced environment; on the other, it must undertake the task of enacting measures that make it possible to satisfy constitutional requirements” (Judgment number 9193-2000, at dieciséis horas veintiocho minutos on diecisiete de octubre del dos mil).
2. the oversight and supervision of environmental matters and activities constitute an essential function of the State pursuant to Article 50 of the Constitution; 3. the principle of rational resource use, so as to maintain the necessary balance between the country’s development and the right to the environment; 4. the principle of environmental quality, according to which environmental quality is a fundamental parameter of quality of life, as are health, food, work, housing, and education, among others; 5. the precautionary principle (principio precautorio): One of the essential principles comprising environmental law is the ‘precautionary principle,’ or ‘principle of prudent avoidance’ (principio de la evitación prudente), as embodied in the United Nations Conference on Environment and Development, Rio Declaration, pursuant to which prevention seeks to anticipate adverse effects and ensure the protection, conservation, and proper management of resources.
Consequently, the guiding principle of prevention is founded on the need to take and adopt all precautionary measures to avoid or contain possible harm to the environment or human health; 6. the requirement to conduct an environmental impact study (estudio de impacto ambiental) before commencing works and activities that may cause measurable environmental damage and pollution, such as the presence of toxic substances or external elements that produce harmful environmental characteristics, both for biological diversity—including flora and fauna—and, above all, for human life, as reflected in human health or well-being—soil, habitat, air, water, etc.—the impact of these elements requires scientific evaluation and treatment; 7. the obligation of State institutions to comply with environmental legislation in their ordinary activities; 8. the rule that only a declared state of necessity exempts compliance with environmental standards; 9. the principle that a lack of financial resources on the part of public institutions is not an excuse justifying a failure to protect the right to the environment; 10. the principle of coordination among the various public agencies in order to guarantee environmental protection.” To all the foregoing must be added the constitutional recognition of the fundamental right to health and the requirements arising from that recognition, both for public authorities and for private parties, in carrying out any activities that may endanger it.
Accordingly, the Public Administration (Administración) has been vested with specific powers and obligations concerning the performance of such activities. Thus, regarding the scope of Article 70 of the Reglamento para las Actividades de Aviación Agrícola, Decreto Ejecutivo N° 31520-MS-MAG-MOPT-MGSP of 16 de octubre de 2003, the Constitutional Chamber held in Judgment No. 2006-16276 that:
“Although Article 70 establishes a 100-meter no-aerial-application strip, it nevertheless permits that strip to be reduced to 30 meters if there are buffer zones reforested with native species between the field to be fumigated and the dwellings, populated areas, and other locations, provided that pesticides of moderate toxicity are applied and that the application is carried out under conditions of flight altitude, particle size, and wind speed that allow drift to be reduced, and provided that the aircraft has equipment for that purpose and flies parallel to the buffer zone. The Chamber has held that the precautionary principle must be applied in such cases (see, among others, Judgment number 7294-98), particularly considering that there is no scientific or technical basis justifying the reduction of the strip. The challenged Reglamento does not specify the permissible percentages of pesticide drift and allows the application strip to be reduced to 30 meters, subject to toxicity, weather, and flight conditions that cannot even be monitored in advance by the public authorities.
It thereby endangers the fundamental rights to health and to a healthy and ecologically balanced environment because this is a polluting activity involving toxic substances, in which it is impermissible to reduce the levels of protection established under the previous regulations.” Accordingly, the reasons offered on this occasion by the majority of the Constitutional Court to justify the compatibility with constitutional law of the provisions of Article 1 of Executive Decree No. 34202 of May 21, 2007, in no way justify the change in precedent that has occurred in this particular case, which has affected the full enjoyment of the rights protected under Articles 21 and 50 of the Political Constitution and, in particular, the precautionary principle (principio precautorio) governing environmental law (derecho ambiental). Based on the foregoing, the undersigned Justice dissents and declares the challenged provision unconstitutional, insofar as it contains a provision similar to the one already annulled by this Constitutional Court in Decision No. 2006-16276.
Por tanto:
The action is dismissed, as Article 1 of Executive Decree No. 31520-MS-MAG-MOPT-MGSP, Regulations for Agricultural Aviation Activities, is deemed not to be unconstitutional in itself, provided that the competent authorities strictly monitor the buffer zone (zona de amortiguamiento) and the other conditions required under the Decree in specific acts of enforcement, in order to safeguard human health. Notice shall be given. Justice Cruz Castro dissents and would grant the action.- Ernesto Jinesta L.

*140117590007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las diez horas y cincuenta minutos de quince de noviembre de dos mil diecisiete.
Acción de inconstitucionalidad promovida por Marco Levy Virgo, conocido como Marco Machore Virgo, mayor de edad, soltero, con cédula de identidad número 0700690314,contra el artículo 1°, del Decreto Ejecutivo Nº 34202-MAG-MS-MINAE-MOPT-MGSP, del 21 de mayo de 2007, que, a su vez, reforma el artículo 70, del Decreto Ejecutivo Nº 31520-MS-MAG-MOPT-MGSP, Reglamento para las actividades de Aviación Agrícola, del 16 de octubre de 2003. Intervienen en el proceso la Procuraduría General de la República, el Ministerio de Salud, el Ministerio de Agricultura y Ganadería, el Ministerio de Obras Públicas y Transportes, el Ministerio de Ambiente y Energía y el Ministerio de Gobernación y Policía y Seguridad Pública. Participan también, el Director General de la Dirección General de Aviación Civil y el Presidente del Consejo de Aviación Civil y, como coadyuvantes pasivos, Jorge Arturo Sauma Aguilar, en su condición de Gerente General de Corporación Bananera Nacional S.A. (CORBANA) y Jorge Arturo Osborne Escalante, en su condición de Presidente y representante judicial de la Asociación Cámara Nacional de Bananeros (CONABA).
Resultando:
Redactael Magistrado Salazar Alvarado; y,
Considerando:
I.Sobre la admisibilidad. El accionante acude en esta Sala en resguardo de intereses difusos por defensa del derecho a la salud y a un ambiente sano y ecológicamente equilibrado, tutelados en los artículos 21 y 50, respectivamente, de la Constitución Política. En estos casos, esta Sala ha reconocido que se trata de la protección de intereses difusos, de conformidad con lo dispuesto en el párrafo segundo, del artículo 75, de la Ley de la Jurisdicción Constitucional, motivo por el cual cualquier habitante de la República puede acudir directamente a esta vía, sin necesidad de un asunto previo que le legitime para ello. En efecto, al respecto ha dicho este Tribunal:
“…numerosos pronunciamientos de esta Sala reconocen que la protección de la salud pública y del equilibrio ambiental constituyen típicos casos de interés difuso para los efectos de la interposición directa de acciones de inconstitucionalidad, al amparo del párrafo segundo del artículo 75 de la Ley de la Jurisdicción Constitucional (ver, por ejemplo, sentencias número 2009-009201 de las 9:07 horas del 12 de junio del 2009 y 2011-002699 de las 15:06 horas del 2 de marzo del2011)”. (Voto N° 16937-2011).
También, en Voto N° 8239-01 de las 16:07 horas del 14 de agosto de 2001, sobre los intereses difusos, dijo:
“(…) De acuerdo con el primero de los supuestos previstos por el párrafo 2° del artículo 75 de la Ley de la Jurisdicción Constitucional, la norma cuestionada no debe ser susceptible de aplicación concreta, que permita luego la impugnación del acto aplicativo y su consecuente empleo como asunto base. (...) En segundo lugar, se prevé la posibilidad de acudir en defensa de intereses difusos (...) Los intereses difusos, aunque de difícil definición y más difícil identificación, no pueden ser en nuestra ley -como ya lo ha dicho esta Sala- los intereses meramente colectivos; ni tan difusos que su titularidad se confunda con la de la comunidad nacional como un todo, ni tan concretos que frente a ellos resulten identificados o fácilmente identificables personas determinadas, o grupos personalizados, cuya legitimación derivaría, no de los intereses difusos, sino de los corporativos que atañen a una comunidad en su conjunto.
Se trata entonces de intereses individuales, pero a la vez, diluidos en conjuntos más o menos extensos y amorfos de personas que comparten un interés y, por ende reciben un perjuicio, actual o potencial, más o menos igual para todos, por lo que con acierto se dice que se trata de intereses iguales de los conjuntos que se encuentran en determinadas circunstancias y, a la vez, de cada una de ellas. Es decir, los intereses difusos participan de una doble naturaleza, ya que son a la vez colectivos -por ser comunes a una generalidad- e individuales, por lo que pueden ser reclamados en tal carácter. (...) En síntesis, los intereses difusos son aquellos cuya titularidad pertenece a grupos de personas no organizadas formalmente, pero unidas a partir de una determinada necesidad social, una característica física, su origen étnico, una determinada orientación personal o ideológica, el consumo de un cierto producto, etc.(…)”.
Dado que en este asunto, el accionante fundamenta su legitimación por vía del control de constitucionalidad abstracto e invoca la defensa de intereses difusos, toda vez que, acude en protección de la salud y del ambiente, tales circunstancias configuran a su favor una legitimación directa para la interposición de este proceso por invocar la defensa de intereses que atañen a la colectividad nacional en su conjunto, tal y como lo son los derechos a la salud y a disfrutar de un ambiente sano y ecológicamente equilibrado, tutelados, respectivamente, en los artículos 21 y 50, de la Carta Magna, como ya se dijo. Por lo anterior, resulta admisible esta acción de inconstitucionalidad para su conocimiento y resolución por el fondo.
II.Objeto de la acción. El accionante considera que la reforma operada en el artículo 70, del Reglamento para las actividades de Aviación Agrícola, Decreto Ejecutivo N° 31520-MS-MAG-MOPT-MGSP del 16 de octubre del 2003, reformado por el artículo 1°, del Decreto Ejecutivo N° 34202 del 21 de mayo del 2007, en cuanto permite reducir de cien a treinta metros la distancia o franja existente entre el campo objeto de aplicación aérea de plaguicidas y cualquier carretera, centros de población, casas de habitación, edificios donde permanezca personal laborando, fuentes de agua y cultivos aledaños o fincas vecinas susceptibles a efectos negativos derivados del plaguicida aplicado, es inconstitucional por violar los artículos 7, 21 y 50, de la Constitución Política
III.Normativa impugnada. El artículo 1°, del Decreto Ejecutivo N° 34202 del 21 de mayo del 2007, que reforma el artículo 70, del Reglamento para las actividades de Aviación Agrícola, Decreto Ejecutivo N° 31520-MS-MAG-MOPT-MGSP del 16 de octubre del 2003, adiciona al párrafo primero, del último artículo citado, lo siguiente:
“Artículo 1°. Se reforma el artículo 70 del Decreto Ejecutivo Nº 31520-MS-MAG-MOPT-MGPSP, “Reglamento para las actividades de Aviación Agrícola”, del 16 de octubre del 2003, para adicionar al primer párrafo el siguiente:
La distancia podrá reducirse de 100 hasta 30 metros si se dispone de una zona de amortiguamiento y se cumplen las siguientes condiciones:
IV.Sobre el fondo. El accionante plantea, en términos generales, dos clases de reparos de constitucionalidad: unos, relativos a cuestiones de hecho por una serie de incumplimientos de la normativa vigente, con efectos o consecuencias negativas sobre la salud humana y el medio ambiente; y otros, propiamente de derecho, relacionados con el concreto contenido de la norma cuestionada y su alegada contradicción con el Derecho de la Constitución. En cuanto a las cuestiones de hecho que alega el accionante, tales como la inexistencia de las zonas de amortiguamientos en la mayoría de las fincas bananeras; distancias menores a las que exige la ley debe mediar entre las nacientes de agua, quebradas o riachuelos y el área de cultivo objeto de la fumigación aérea; inobservancia por parte de empresas, particulares e instituciones involucrados en las fumigaciones aéreas de lo que prescribe la normativa aplicable al respecto y de las obligaciones de control y vigilancia que pesan sobre las administraciones competentes en la materia; la revisión o constatación de las condiciones bajo las cuales se lleva a cabo la fumigación de los cultivos, principalmente, de banano; así como el impacto negativo que producen las fumigaciones áreas sobre el recurso hídrico, no son propias de ser conocidas en esta vía, toda vez que la acción de inconstitucionalidad se trata de una discusión de puro derecho, o lo que es lo mismo, de un análisis estrictamente jurídico, de conformidad con lo dispuesto en los artículos 73, y siguientes, de la Ley de la Jurisdicción Constitucional, en el que se examina el contenido de una norma y su contradicción o no con el Derecho de la Constitución, pero no argumentos que aluden a situaciones fácticas.
Las cuestiones de hecho, en este sentido, son, en principio, ajenas a la vía de la acción de inconstitucionalidad, ya que son propias del recurso de amparo, en su caso, o de la vía de legalidad. De modo, que el análisis de esta Sala se circunscribe al contraste entre el contenido de la norma impugnada y el Derecho de la Constitución, con prescindencia de los aspectos de hecho alegados. Es decir, este Tribunal centrará su análisis, únicamente, en los aspectos de derecho invocados, en concreto, en si la norma en cuestión implica, o no, una desprotección al derecho a la salud, a la vida y al medio ambiente sano y ecológicamente equilibrado, en relación con la normativa anterior objeto de la reforma, que signifique un retroceso en la protección y tutela de esos derechos fundamentales por carecer de un fundamento técnico y científico que haga racional la reforma, con violación del principio de no regresión en esta materia.
V.Antecedentes de la Sala sobre el tema planteado. En dos oportunidades anteriores, esta Sala se ha pronunciado sobre la constitucionalidad de la norma aquí cuestionada, a saber:
“V.- El actual contenido del artículo 70 del Reglamento para las Actividades de Aviación Agrícola constituye un menor nivel de protección en relación al artículo 75 del Reglamento anterior que establecía una franja de no aplicación de 100 a 200 metros, de acuerdo con la toxicidad del plaguicida, la altura del vuelo, el tamaño de las partículas y la velocidad del viento, indicando, de manera genérica “de tal forma que no se contaminen casas, poblados, carreteras, pastizales, abrevaderos y otros”. Si bien es cierto que el artículo 70 establece una franja de no aplicación aérea de 100 metros, permite, sin embargo, que la franja se reduzca a 30 metros, si entre el campo a fumigar y las casas, poblados y otros existen zonas de amortiguamiento reforestadas con especies nativas, siempre y cuando se apliquen plaguicidas de moderada toxicidad y la aplicación se realice en condiciones de altura de vuelo, tamaño de la partícula y velocidad del viento que permitan la reducción de la deriva y de que la aeronave disponga de implementos para ese fin y vuele en forma paralela a la zona de amortiguamiento.
La Sala ha considerado que en estos casos debe aplicarse el principio precautorio (v. entre otras, la sentencia número 7294-98), sobre todo, tomando en cuenta que no hay un fundamento científico ni técnico que justifique la disminución de la franja. El Reglamento impugnado no indica los porcentajes de deriva del plaguicida admitidos y establece la posibilidad de reducir la franja de aplicación a 30 metros, sujeta a unas condiciones del tóxico, climáticas y del vuelo, que ni siquiera pueden ser previamente controladas por la autoridad pública, con lo cual, pone en peligro los derechos fundamentales a la salud y al medio ambiente sano y ecológicamente equilibrado, porque se trata de una actividad contaminante, con sustancias tóxicas, en la cual no es admisible reducir los niveles de protección establecidos en la anterior regulación. En este aspecto, la Sala declara la inconstitucionalidad del artículo 70 impugnado, en la frase que dispone:
“Dicha franja podrá ser reducida hasta un mínimo de 30 metros, si entre el campo a tratar y los sitios indicados, existen zonas de amortiguamiento reforestadas preferiblemente con especies nativas, siempre y cuando además se apliquen plaguicidas de moderada toxicidad a lo sumo, y la aplicación se realice bajo condiciones adecuadas de altura de vuelo, tamaño de la partícula, velocidad del viento que en conjunto permitan la reducción de la deriva y que la aeronave disponga de implementos adecuados para ese fin y que se vuele en forma paralela a la zona de amortiguamiento.
En caso de que la aplicación se realice en forma perpendicular a dicha zona, deberá dejarse además una franja no menor de 40 metros dentro del cultivo, en la que no se podrán aplicar plaguicidas por avión para reducir el efecto del arrastre, pudiéndose aplicar el área respectiva con helicóptero u otro medio que asegure el control del arrastre. La franja de no aplicación de plaguicidas podrá omitirse en caso de vías o caminos internos de uso exclusivo para el cultivo que se va a tratar y en el tanto no existan viviendas ni se produjeren ninguno de los supuestos a que se refiere el párrafo primero del presente artículo”.
De la lectura de esta sentencia, salta a la vista, que la Sala consideró que aquella reforma al artículo 70, del Decreto Ejecutivo N° 31520-MS-MAG-MINAE-MOPT-MGPSP, Reglamento para las Actividades de Aviación Agrícola, resultaba contraria al Derecho de la Constitución por implicar un retroceso en materia de protección de derechos fundamentales, toda vez que no había un fundamento científico ni técnico que justificara la disminución de la franja y, además, ese reglamento no indicaba los porcentajes de deriva del plaguicida admitidos y establecía la posibilidad de reducir la franja de aplicación a treinta metros, sujeta a unas condiciones del tóxico, climáticas y del vuelo, que ni siquiera podían ser, previamente, controladas por la autoridad pública, lo cual, en criterio de esta Sala, ponía en peligro los derechos fundamentales a la salud y al medio ambiente sano y ecológicamente equilibrado, porque se trata de una actividad contaminante, con sustancias tóxicas, en la cual no es admisible reducir los niveles de protección establecidos en la anterior regulación.
Queda claro, entonces, que la reducción a treinta metros de la zona de protección no es, en sí misma considerada, inconstitucional, sino en el tanto no cuente con un fundamento técnico y científico que determine que esa reducción no implica una menor protección -o desprotección- a los derechos fundamentales a la salud y al medio ambiente sano y ecológicamente equilibrado, siempre y cuando, además, las condiciones del tóxico, climáticas y del vuelo, a que esté sujeta esa actividad pueden ser, previamente, controladas por la autoridad pública. Esto es así, por cuanto, en caso de no existir certeza científica de que esa reducción no implica una disminución en la protección que la legislación venía dando al derecho a un ambiente sano y ecológicamente equilibrado en esta materia, entraría a aplicarse el principio precautorio, de conformidad con el cual, en caso de duda, se debe mantener la regulación más protectora, lo cual está íntimamente relacionado con el principio de que en tema de tutela de derechos fundamentales no puede haber regresión.
“IV.- SOBRE EL FUNDAMENTO TÉCNICO DE LA REDUCCIÓN DE DISTANCIA PARA REALIZAR APLICACIONES AÉREAS DE PLAGUICIDAS Y LA PRESUNTA VIOLACIÓN A LOS DERECHOS FUNDAMENTALES A LA SALUD Y AL AMBIENTE. En primer término, los accionantes aducen que, sin fundamento técnico alguno y, en claro quebranto a los derechos fundamentales consagrados en los ordinales 21 y 50 de la Constitución Política, el artículo 1° del Decreto Ejecutivo No. 34202 de 21 de mayo de 2007, redujo la distancia que debe existir -entre el campo a tratar y cualquier carretera, centros de población, casas de habitación, edificios donde permanezca personal laboral, fuentes de agua y cultivos aledaños o fincas vecinas-, de 100 hasta 30 metros, a efecto de realizar aplicaciones áreas de plaguicidas. Sostienen los gestionantes que el decreto en cuestión posee las mismas carencias que el anterior numeral 70 del Decreto Ejecutivo No. 31520 de 16 de octubre de 2003, cuyo contenido fue declarado inconstitucional por la Sala Constitucional según el Voto No. 16276-2006, en virtud de haberse determinado que no se contaba con fundamento técnico o científico alguno que justificara la reducción de la distancia de 100 a 30 metros para llevar a cabo las mencionadas fumigaciones aéreas.
No obstante lo anterior, este Tribunal Constitucional no estima que, en la especie, lleven razón los interesados. Del análisis del Decreto Ejecutivo No. 34202 de 21 de mayo de 2007, se logra desprender, con meridiana claridad, que la reducción de la distancia en cuestión para efectuar fumigaciones aéreas de plaguicidas, sea, de 100 hasta 30 metros, sí se encuentra fundamentada y justificada en criterios y estudios técnicos y científicos llevados a cabo al efecto. Así, nótese que, dentro de los considerandos del Decreto Ejecutivo en cuestión, se indicó, de modo expreso, lo siguiente:
“(…) 6º —Que debido a una falta de fundamentos técnicos y científicos de la reducción del área para la aspersión, la Sala Constitucional mediante el voto 2006-16276 del 8 de noviembre 2006 contra (sic) los artículos 24, 54, 68, 70 y 71 del Reglamento para las Actividades de Aviación Agrícola, Decreto Ejecutivo Nº 31520-MS-MAG-MOPT-MGPSP, del 16 de octubre del 2003, declaró parcialmente con lugar la acción y anuló el parcialmente (sic) el artículo 70, dejando vigente solo el primer párrafo, no así el segundo y tercero. El fundamento del fallo es que tratándose del derecho al ambiente sano y ecológicamente equilibrado consagrado en el artículo 50 constitucional cualquier tipo de reducción debe estar fundada en criterios científicos y técnicos que demuestren la inocuidad al ambiente con la nueva medida.
7º—Que desde el momento mismo de la presentación de la acción de inconstitucionalidad, sin que se hubiere dictado ninguna sentencia, CORBANA y el Poder Ejecutivo, en cumplimiento del Principio Precautorio contemplado en el ordenamiento jurídico costarricense y previsto por en la (sic) Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo, denominada Declaración de Río, por el cual la prevención pretende anticiparse a los efectos negativos de la actividad humana, y asegurar la protección, conservación y adecuada gestión de los recursos, decidió iniciar un conjunto de estudios científicos y técnicos conducentes a fundamentar el estado actual de la ciencia y la técnica aérea de aspersión, y que la reducción de esta de 100 a 30 metros cuando hayan zonas de amortiguamiento no va a afectar el medio ambiente, ni la salud, ni la vida de las personas, e igualmente a fijar requisitos para la ejecución de actividades de aspersión aérea para el correcto control y fiscalización.
8º—Que en cumplimiento del principio precautorio del Derecho ambiental en este año 2007 se terminó un estudio científico iniciado desde que se presentó la Acción de Inconstitucionalidad identificado así: Roberto Valenciano Mora, Sergio Laprade Coto, Álvaro Fournier Leiva y Eduardo Trejos Obando “Manejo de la deriva en las aplicaciones aéreas de fungicidas en fincas que poseen zonas de amortiguamiento” (Revista Investigaciones CORBANA, San José, 2007, Separata Nº 1). Los autores son reconocidos investigadores, científicos, y conocedores de la materia a nivel latinoamericano. La investigación evidencia que la disminución del área de amortiguamiento hasta 30 metros, se encuentra justificada en razón de que los avances tecnológicos han minimizado el impacto de la aspersión aérea, al punto de no menoscabar el derecho a la vida, la salud y a un medio ambiente sano y ecológicamente equilibrado.
Los aspectos más relevantes relacionados con una aplicación aérea segura consiste (sic) en la precisión de la aplicación y en el manejo de la deriva. El término deriva se define como el movimiento, fuera del área de cultivo, de partículas líquidas en el aire en la forma de gotas o vapor al momento de la aplicación. A pesar de que existe vasta información científica y técnica sobre el tema, como la emitida por la Organización de las Naciones Unidas para la Agricultura y la Alimentación (FAO), Agencia de Protección del Ambiente (EPA) de Estados Unidos, el Estado de California, la Asociación Nacional de Aviación Agrícola (NAAA), y de un conglomerado de asociaciones expertas en el tema (SPRAY DRIFT TASK FORCE), un grupo de expertos costarricenses realizó estudios con el objetivo de validar la información de estos Organismos.
9º—Que este estudio profundiza en la realidad costarricense en aspectos como la utilización de productos de toxicidad moderada a lo sumo, garantizan en gran medida el respeto a la salud y la vida de las personas, lo que hace a la actividad bananera acreedora de certificaciones de tipo ambiental sin las cuales no podría exportar a los mercados internacionales. Igualmente destacan que desde el 2000 se puede asperjar mediante técnicas de carácter satelital y digital, mediante GPS (Global Position System) o bien el software que se utiliza en aspersión aérea se ha sofisticado y perfeccionado, permitiendo que se abran y se cierren los aspersores en los límites establecidos para la zona de aplicación aéreas, inhabilitando al piloto a asperjar fuera de estos, y presentando un margen promedio de error de 0.9 metros reduce significativamente el riesgo para el ambiente, para la vida y la salud humana y minimiza los costos.
Los estudios demostraron la necesidad de actualizar la legislación acorde con los avances tecnológicos, los cuales han venido a proporcionar un sistema de guía de precisión y un mejor manejo de la deriva, en donde interactúan varios factores como las técnicas adecuadas de aplicación, uso adecuado del equipo, condiciones meteorológicas idóneas durante la aplicación, tipo de formulación de producto y el establecimiento de zonas de amortiguamiento. Por lo anterior, prácticamente se garantizan las medidas necesarias para minimizar el riesgo por error humano.
De otra parte, conviene destacar que el referido estudio denominado “Manejo de la deriva en las aplicaciones aéreas de fungicidas en fincas que poseen zonas de amortiguamiento” -el cual fue adjuntado a los autos-, en sus conclusiones, indica, “1. Existe suficiente información a nivel nacional y mundial que señalan que el manejo de la deriva en las aplicaciones de plaguicidas se debe hacer por medio de prácticas de aplicación y no por distancias exclusivamente.
2. Las técnicas de aplicación y las prácticas asociadas a reducir la deriva en las plantaciones de banano en Costa Rica cumplen y superan las recomendaciones de la Agencia de Protección Ambiental de los Estados Unidos (USEPA), del “Spray Drift Task Force (SDTF)”, y de la Organización de las Naciones Unidas para la Agricultura y la Alimentación (FAO).
3. La deriva se debe manejar por medio de adecuadas condiciones climáticas como la velocidad del viento que no debe ser mayor a 15 km/h y su dirección debe ser contraria a zonas sensibles.
4. El tamaño de la gota de la mezcla de aplicación, debe ser en promedio de 200 y 300 um.
5. La altura de vuelo no debe ser mayor de 5 m sobre el dosel del cultivo y la longitud de la barra de aspersión no debe exceder el 80% de la longitud del ala.
6. Una zona de amortiguamiento de 30 metros, sembrada de árboles, de mayor porte que el cultivo, es uno de los mejores métodos para minimizar la deriva, ya que actúan como una barrera al traslado de plaguicidas fuera del campo de aplicación.
7. La tecnología disponible en Costa Rica, permite realizar aplicaciones aéreas de plaguicidas en forma precisa, dirigida al cultivo objetivo, con la certeza de que no se afecte a las personas, ni al ambiente.” De ahí que, en criterio de esta Sala, las omisiones y carencias de estudios técnicos y científicos que, ciertamente, fueron apuntadas por esta jurisdicción constitucional en el Voto No. 16276-2006 de las 14:56 hrs. de 8 de noviembre de 2006, con respecto a dicha reducción de distancia que se estableció mediante el hoy anulado numeral 70 del Decreto Ejecutivo No. 31520 de 16 de octubre de 2003, actualmente, han sido subsanadas a través del Decreto Ejecutivo No. 34202. Al estar fundamentando el Decreto Ejecutivo No. 34202 en estudios científicos que justifican la reducción de distancia en cuestión, este Tribunal Constitucional no observa violentados los derechos fundamentales a la salud y a disfrutar de un ambiente sano y ecológicamente equilibrado”.
De acuerdo con lo resuelto por esta Sala en esta última sentencia, la norma aquí cuestionada es el resultado de estudios técnicos y científicos que respaldan la reforma y reducción de la zona de amortiguamiento de cien a treinta metros, motivo por el cual, a través del Decreto Ejecutivo N° 34202, se subsanaron las omisiones y carencias de estudios técnicos y científicos que, en su momento, señaló esta jurisdicción constitucional en el Voto N° 16276-2006 de las 14:56 hrs. del 8 de noviembre de 2006, con respecto a la reducción de la distancia que se estableció mediante el numeral 70, del Decreto Ejecutivo N° 31520 de 16 de octubre de 2003, lo que motivó su anulación por inconstitucional. No obstante, en vista de este nuevo cuestionamiento, procede la Sala a reexaminar el asunto.
VI.Revisión del problema. Según lo dicho en el considerando anterior, esta Sala ya examinó la norma aquí cuestionada y determinó que está basada en criterios técnicos y científicos que garantizan una adecuada protección al derecho a la salud y a un ambiente sano y ecológicamente equilibrado, en los términos de los artículos 21 y 50, Constitucionales. Sobre este tema, la Sala ha reconocido el principio de la objetivación de la tutela ambiental, o principio de la vinculación a la ciencia y a la técnica, en relación de la actuación del Estado en la protección del ambiente. Así, en Sentencia N° 2006-17126 de las 15:05 horas del 28 de noviembre de 2006, expresó:
“4.- De la objetivación de la tutela ambiental : (,,,) tal y como lo señaló este Tribunal en sentencia número 14293-2005, de las catorce horas cincuenta y dos horas del diecinueve de octubre del dos mil cinco, es un principio que en modo alguno puede confundirse con el anterior [principio precautorio o principio de la evitación prudente], en tanto, como derivado de lo dispuesto en los artículos 16 y 160 de la Ley General de la Administración Pública, se traduce en la necesidad de acreditar con estudios técnicos la toma de decisiones en esta materia, tanto en relación con actos como de las disposiciones de carácter general –tanto legales como reglamentarias–, de donde se deriva la exigencia de la "vinculación a la ciencia y a la técnica", con lo cual, se condiciona la discrecionalidad de la Administración en esta materia. De manera que en atención a los resultados que se deriven de esos estudios técnicos –tales como los estudios de impacto ambiental–, si se evidencia un criterio técnico objetivo que denote la probabilidad de un evidente daño al ambiente, los recursos naturales o a la salud de las personas, es que resulta obligado desechar el proyecto, obra o actividad propuestas; y en caso de una "duda razonable" resulta obligado tomar decisiones en pro del ambiente (principio pro-natura), que puede traducirse en la adopción, tanto de medidas compensatorias como precautorias, a fin de proteger de la manera adecuada el ambiente”.
Precisamente, conforme lo resolvió esta Sala, la reforma operada en el artículo 70, del Decreto Ejecutivo N° 31520, de 16 de octubre de 2003, Reglamento para las Actividades de Aviación Agrícola, se basa en criterios técnicos y científicos que justifican la medida o decisión adoptada de reducir la distancia en cuestión de 100 a 30 metros, es decir, existen razones objetivas para ello, con lo cual se cumple el principio de vinculación a la ciencia y la técnica, siempre y cuando, por supuesto, se observen los criterios técnicos que la norma contiene. En torno a esto, la Sala ha establecido que el Estado debe tener un papel de garante con respecto al uso adecuado de plaguicidas y la evitación de sus efectos nocivos sobre la salud y el ambiente. En este sentido, en Sentencia N° 2004-13968 de las 11:35 horas del 3 de diciembre de 2014, indicó:
“III.- Ese informe [FOE-AM-19/2004 del 20 de octubre del 2004, efectuado por el Área de servicios agropecuarios y de medio ambiente de la División de fiscalización operativa y evaluativa de la Contraloría General de la República, sobre la evaluación de la gestión del Estado en relación con el control de plaguicidas agrícolas] se originó por la necesidad de fiscalizar el proceso administrativo relacionado con uno de los problemas ambientales más apremiantes que debe resolver el país, que es el empleo de sustancias químicas, biológicas o afines en las actividades agrícolas, y ante la necesidad de que el Estado intervenga ejerciendo una función reguladora sobre el uso de agroquímicos, que garantice a los agricultores la disponibilidad en el mercado de productos eficaces para el combate de las plagas y, a la vez, la protección de la salud de la ciudadanía en general y el derecho de ésta a un ambiente sano y ecológicamente equilibrado.
Se indicó en el informe que ese control lo ejerce principalmente el Ministerio de Agricultura y Ganadería, por medio del Servicio Fitosanitario del Estado, quien debe trabajar en coordinación con el Ministerio de Salud y el Ministerio del Ambiente y Energía, en cuanto al control sobre los impactos en la salud y el ambiente, así como con el Ministerio de Hacienda respecto a la importación y exoneración de tales productos. Su objetivo general fue evaluar la gestión del Estado en relación con el control de plaguicidas utilizados en actividades agrícolas y su efecto sobre el ambiente y la salud humana, principalmente el accionar del Servicio Fitosanitario del estado del Ministerio de Agricultura y Ganadería (MAG); y los objetivos específicos del estudio fueron: a) evaluar las políticas nacionales y la rectoría en el campo del control sobre el uso de plaguicidas, identificando las instituciones participantes y sus competencias, b) evaluar el proceso de registro de plaguicidas en el país y la normativa asociada, c) evaluar el proceso de exoneración e importación de plaguicidas en el país y, d) evaluar la fiscalización y monitoreo sobre el uso de plaguicidas.
IV.En ese informe concluyó la Contraloría que el Servicio Fitosanitario del Estado (SFE) no cumple sus objetivos de creación con eficiencia y apego al principio de legalidad, que lo llaman a regular, ejecutar y fiscalizar el registro y uso de agroquímicos, en el marco de una actividad agrícola en armonía con la naturaleza y con fiel cumplimiento de los principios constitucionales de derecho a la vida, a la salud y a un ambiente sano. Determinó que, por el contrario, el accionar de dicho órgano se orienta a facilitar el registro y comercialización de tales sustancias, justificado en un supuesto interés de mejorar la competitividad de los productores agrícolas, pero más bien, esos objetivos parecen dirigirse a fomentar la competencia en el mercado de los plaguicidas, por encima de los derechos constitucionales de los mismos agricultores y de los principios ambientales y de salud de las personas.
Concluyó que las empresas más beneficiadas con la función facilitadora del SFE, han sido las empresas que se dedican a la venta de agroquímicos, especialmente a los denominados genéricos, en detrimento de los productores y consumidores de bienes agrícolas. Aclaró que ello no significa que no puedan registrarse en el país, plaguicidas de este tipo, sino más bien que su registro se debe hacer respetando la normativa y asegurando a la población costarricense la protección de su salud y el derecho fundamental que tiene a un ambiente sano y ecológicamente equilibrado, y protegerle al agricultor nacional su derecho a contar con insumos de buena calidad; sin perjuicio de las necesarias acciones que el Estado debe ejecutar para buscar la paulatina reducción del uso de plaguicidas y el fomento de mecanismos alternativos. Estas consideraciones motivaron a la Contraloría General de la República a dictar una serie de disposiciones finales dirigidas al Presidente de la República y a los Ministros de Planificación Nacional y Política Económica, Agricultura y Ganadería, Salud, Ambiente y Energía, y Economía, Industria y Comercio, así como al Auditor Interno del Ministerio de Agricultura y Ganadería”.
De igual modo, en Voto N° 2006-09565 de las 16:08 horas del 5 de julio de 2006, este Tribunal consideró:
“(…) es evidente que el Estado costarricense está en el deber de actuar en forma eficaz y anticipada, para evitar la ocurrencia de eventos que degraden el medio ambiente y comprometan su sostenibilidad".
Y, en Sentencia N° 2011-016937 de las 14:36 horas del 7 de diciembre de 2011, indicó:
“V.- SOBRE EL DERECHO A LA SALUD Y A UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO. Esta Sala ha reconocido de forma reiterada que, como parte de las obligaciones primarias y fundamentales del Estado, está el deber de respetar, proteger y garantizar el derecho fundamental a la salud de sus habitantes (P. ej.: sentencias 1992-1915 de las 14:12 horas del 22 de julio de 1992, 2004-10039 de las 14:39 horas del 13 de setiembre del 2004 y 2008-001003 de las 14:56 horas del 23 de enero del 2008). Recientemente, con el fin de garantizar un nivel más elevado de protección, la Sala ha reconocido al derecho fundamental a la salud su carácter de derecho fundamental autónomo (Se puede citar, al efecto, la sentencia número 2011-02932 de las 15:47 horas de 22 de marzo de 2011. En este mismo sentido, sentencias número 2011-007768 de las 19:54 horas del 14 de junio del dos mil once y número 2011-008876 de las 15:01 horas del 5 de julio del 2011).
Por otra parte, esta Sala también ha reconocido y garantizado un nivel elevado de protección al derecho fundamental a un ambiente sano y ecológicamente equilibrado. Incluso, antes que se reformara el artículo 50 de la Constitución Política. Mediante Ley de reforma constitucional número 7412 del 3 de junio de 1994, se adicionaron dos párrafos al artículo 50 de la Constitución Política, a fin de reconocer expresamente el derecho fundamental de todo persona a un ambiente sano y ecológicamente equilibrado, así como el deber del Estado costarricense de garantizar, defender y preservar ese derecho. (En cuanto al contenido y alcances del referido derecho fundamental, véase la sentencia número 2006-17126 de las 15:05 horas del 28 de noviembre del 2006). Finalmente, debe reiterarse la indisoluble relación que se plantea entre la protección al medio ambiente y la efectiva garantía de los derechos fundamentales a la vida, a la salud y, en general, a la posibilidad del ser humano de desarrollar una existencia en concordancia con su dignidad intrínseca (Sentencia Nº 5691-98 de las 17:15 horas del 5 de agosto de 1998).
El derecho a un ambiente sano y ecológicamente equilibrado otorga una protección especial a la biodiversidad y las aguas subterráneas, razón por la cual y en aplicación del principio precautorio en materia ambiental, las actividades económicas con impacto ambiental deben ser autorizadas cuando exista certeza científica de que ese impacto no implique un riesgo o amenaza de daño permanente e irreversible al ambiente. Es por esta razón que la administración debe realizar en los casos que así se amerite, la evaluación ambiental mediante los instrumentos que estime pertinentes, evaluación que debe ser compartida públicamente con la población afectada, para que luego de un análisis riguroso y detallado la administración emita de manera fundamentada la viabilidad ambiental correspondiente. La desatención e inobservancia de estos aspectos definidos normativa y jurisprudencialmente, deviene en la vulneración del referido derecho a un ambiente sano, por lo que las actuaciones administrativas así dispuestas resultan igualmente violatorias de este derecho fundamental (Ver, entre otras, sentencias de esta Sala números 5893-95, 5445-99, 2001-6503, 2003-6322, 2004-13414, 2006-7994, 2010-6922).
Se concluye, de esta forma, que del Derecho de la Constitución se deriva, de forma incontestable, el poder-deber del Estado costarricense de procurar por la tutela efectiva y oportuna de la salud pública y del derecho a un ambiente sano y ecológicamente equilibrado, elevando el nivel de vida de la población”.
En esa misma sentencia expresó, además:
“VIII.- SOBRE LA REGULACIÓN EN MATERIA DE REGISTRO DE LOS PLAGUICIDAS. El uso adecuado de los plaguicidas puede resultar útil para el control y eliminación de las plagas, en beneficio de la seguridad alimentaria de la población y de la actividad económica sustentada en la producción agrícola. Sin embargo, debe reconocerse el riesgo potencial que puede implicar para la salud humana y el ambiente el uso de tales sustancias. Lo que incluso ha motivado la adopción de instrumentos internacionales con el objetivo consumidores y de los trabajadores- y el medio ambiente frente a los posibles efectos perjudiciales de los plaguicidas, como es el caso del Convenio de Rotterdam para la Aplicación del Procedimiento de Consentimiento Fundamentado Previo a Ciertos Plaguicidas y Productos Químicos Peligrosos Objeto del Comercio Internacional, que fue aprobado por Costa Rica, por medio de Ley No. 8705 del 13 de febrero del 2009.
(…) este Tribunal ha reconocido el riesgo que puede entrañar el uso de los plaguicidas y la trascendencia de adoptar medidas idóneas para regular su empleo. En el ordenamiento jurídico costarricense existe diversa normativa legal y reglamentaria de la que se deriva que la actividad de importación, fabricación, comercialización y empleo de los plaguicidas está fuertemente sometida a la potestad de policía del Estado, en aras de garantizar el derecho a la salud y al medio ambiente sano y ecológicamente equilibrado”.
En criterio de este Tribunal, los estudios técnicos y científicos que están a la base de la reforma reglamentaria que aquí se impugna -y que se encuentran debidamente relacionados en los considerandos del Decreto Ejecutivo en cuestión-, son garantía del cumplimiento, por parte del Estado, de su obligación de protección del derecho a la salud y al ambiente. En efecto, a los autos se ha aportado copia del estudio denominado “Manejo de la deriva en las aplicaciones aéreas de fungicidas en fincas que poseen zonas de amortiguamiento”, el cual contiene las siguientes conclusiones:
“1. Existe suficiente información a nivel nacional y mundial que señalan que el manejo de la deriva en las aplicaciones de plaguicidas se debe hacer por medio de prácticas de aplicación y no por distancias exclusivamente.
2. Las técnicas de aplicación y las prácticas asociadas a reducir la deriva en las plantaciones de banano en Costa Rica cumplen y superan las recomendaciones de la Agencia de Protección Ambiental de los Estados Unidos (USEPA), del “Spray Drift Task Force (SDTF)”, y de la Organización de las Naciones Unidas para la Agricultura y la Alimentación (FAO).
3. La deriva se debe manejar por medio de adecuadas condiciones climáticas como la velocidad del viento que no debe ser mayor a 15 km/h y su dirección debe ser contraria a zonas sensibles.
4. El tamaño de la gota de la mezcla de aplicación, debe ser en promedio de 200 y 300 µm.
5. La altura de vuelo no debe ser mayor de 5 m sobre el dosel del cultivo y la longitud de la barra de aspersión no debe exceder el 80% de la longitud del ala.
6. Una zona de amortiguamiento de 30 metros, sembrada de árboles, de mayor porte que el cultivo, es uno de los mejores métodos para minimizar la deriva, ya que actúan como una barrera al traslado de plaguicidas fuera del campo de aplicación.
7. La tecnología disponible en Costa Rica, permite realizar aplicaciones aéreas de plaguicidas en forma precisa, dirigida al cultivo objetivo, con la certeza de que no se afecte a las personas, ni al ambiente”.
Con lo anterior, queda establecido que la reforma en cuestión no adolece de las omisiones y carencia de estudios técnicos y científicos que afectaban al hoy anulado artículo 70, del Decreto Ejecutivo N° 31520 del 16 de octubre de 2003, y que motivaron que esta Sala, por Sentencia N° 2006-016276 de las 14:56 horas del 8 de noviembre de 2006, lo declarara inconstitucional. Existen, entonces, fundamentos científicos y técnicos que justifican la reducción de la distancia que debe mediar entre el terreno en el que se realizan las aplicaciones aéreas de plaguicidas y los centros de población y otros. Al respecto, debe tener claro el accionante, que la reducción en cuestión, por sí sola, no es inconstitucional, ni, necesariamente, implica un retroceso en la protección del derecho a la salud o al medio ambiente. Se debe tener presente, en primer lugar, que el principio general es que debe mediar una distancia de cien metros entre el cultivo objeto de la fumigación aérea y la carretera, centros de población, casas de habitación, edificios donde permanezca personal laborando, fuentes de agua y cultivos aledaños o fincas vecinas susceptibles a efectos negativos derivados del plaguicida aplicado (artículo 70, del Decreto Ejecutivo N° 31520).
La reducción de esa distancia a treinta metros es por vía de excepción y, para ello, es indispensable el cumplimiento de una serie de requisitos que prevé la misma norma, requisitos que tienen un asidero científico y técnico y, por ende, no resultan arbitrarios ni antojadizos, lo que hace razonable la norma, en relación con los objetivos de protección al derecho a la salud y a un ambiente sano y ecológicamente equilibrado. Entre las conclusiones a las que arriba el estudio anteriormente citado, está que el manejo de la deriva en la aplicación de plaguicidas no depende solo de la distancia, sino más bien de las prácticas de aplicación. Hoy por hoy, los avances tecnológicos permiten un control muy eficiente de la deriva a tal punto que, bajo determinadas circunstancias -reguladas en el Decreto en cuestión-, y con el uso de nuevas tecnologías disponibles en el país, es posible realizar aplicaciones aéreas de plaguicidas en forma precisa al punto que, incluso, una distancia de treinta metros resulte más protectora aún que una de cien metros, si se cumplen, claro está, los demás requisitos técnicos que permiten garantizar que la deriva no traspasará la zona de protección y que la norma en cuestión contiene.
La distancia no es un factor determinante de la mayor o menor protección al derecho a la salud y al ambiente, sino que esta depende, más bien, del uso de recursos tecnológicos que permiten una mayor precisión en las labores de fumigación, con una deriva casi nula. No obstante, la Procuraduría General de la República, como órgano asesor de este Tribunal, hizo algunas observaciones, en su informe, con respecto al estudio técnico y científico que sirve de base al Decreto cuestionado, las cuales es importante revisar.
V.Sobre la posición de la Procuraduría General de la República en torno al fondo de esta acción. La Procuraduría señala que el Decreto N° 34202, según el considerando 8°, se basa en el documento “Manejo de la deriva en las aplicaciones aéreas de plaguicidas en fincas con zonas de amortiguamiento”, publicado por CORBANA S.A. en el 2007 y efectuado por Roberto Valenciano Mora, de Corporación de Desarrollo Agrícola Del Monte S.A.; Sergio Laprade Coto, de CORBANA S.A.; Álvaro Fournier Leiva, de CARIBANA S.A. y Eduardo Trejos Obando, de Standard Fruit Co., lo cual, a juicio del órgano asesor, plantea una serie de dudas sobre el fundamento técnico que permita extrapolar los resultados de ese documento, hecho por miembros de la industria bananera, a otros tipos de cultivo, tal y como lo hace el Decreto impugnado. Además, señala que la norma difiere del documento que le da sustento científico y técnico en algunos aspectos, ya que mientras el documento señala que la humedad relativa debe ser superior al 60%, el Decreto dispone que debe ser superior al 70%, y mientras el documento indica que “si la aplicación se realiza perpendicularmente a la zona de amortiguamiento, adicionalmente se debe dejar una franja de 40 metros dentro del cultivo, en la que no se deberá asperjar plaguicidas para reducir el efecto del arrastre”, el decreto dispone que esa distancia deberá dejarse cuando la aplicación se realice con avión, lo que deja la duda de si, a contrario sensu, con helicóptero no habría que dejar esa franja, y que “La franja de no aplicación de productos podrá omitirse en caso de vías o caminos internos de uso exclusivo para el cultivo y mientras no existan viviendas”, con lo cual se reduce la franja de cuarenta metros que recomienda el estudio, a distancias incluso de seis metros que pueden medir los caminos internos.
Por último, también cuestiona la objetividad científica del estudio que da fundamento al Decreto impugnado, ya que fue patrocinado y realizado por miembros de la industria bananera, quienes podrían verse influidos por el interés particular del sector. Los aspectos que señala la Procuraduría General obligarían, necesariamente, a esta Sala, a entrar a revisar y valorar los fundamentos técnicos y científicos del Decreto en cuestión, lo que es inviable, ya que esta Sala Constitucional no es un órgano técnico en la materia, por lo que carece de competencia para analizar por el fondo los referidos criterios técnicos y científicos y, de ese modo, determinar, si con fundamento en los mismos, resulta procedente o no, entre otros aspectos, la reducción de la distancia establecida para realizar las aplicaciones aéreas de plaguicidas. Lo anterior, ya fue señalado por este Tribunal en Sentencia N° 14948-2007 de las 14:58 horas de 16 de octubre de 2007, que al respecto indicó:
“(…) A) Sobre la incompetencia de la Sala Constitucional para determinar el número de principios activos a los que se deben someter a pruebas de bioequivalencia: El tema planteado es que exigir a sólo siete de los principios activos de los productos de los medicamentos multiorigen de riesgo sanitario las pruebas de equivalencia terapéutica es poco, y que deben ser más o todos. Al respecto, la pretensión no es admisible en esta instancia constitucional, pues este Tribunal no tiene competencia para determinar si deben ser siete, treinta o cuarenta. Además, las autoridades de Salud no señalan que el número o cantidad de principios activos a someter a pruebas de bioequivalencia implique un peligro la salud, básicamente porque la lista se debe ir ampliando progresivamente. Así entonces, a esta Sala no le corresponde determinar si solamente siete de los productos farmacéuticos multiorigen de riesgo sanitario, y por tanto, los únicos productos farmacéuticos multiorigen (medicamentos genéricos) a los cuales cabe exigírseles pruebas de equivalencia antes de procederse a su inscripción, implica un riesgo sanitario o un peligro a la salud de las personas.
Además, observa esta Sala que, según el artículo 29 del citado decreto n°28466-S –y conforme con los criterios de la OMS- existen tres grupos de medicamentos genéricos, que por sus características, merecen un trato diferenciado. Los que requieren estudios de equivalencia terapéutica in vivo, como requisito para ser registrados; los que sin requerir estudios in vivo sí requieren comprobar la equivalencia terapéutica in vitro; y finalmente los que no requieren demostrar su equivalencia terapéutica; sin que se pueda valorar y determinar en esta instancia constitucional cuáles medicamentos genéricos corresponden a una u otra categoría. Por estas razones, debido a que el criterio del ente especializado y políticamente responsable del tema ha establecido los siete productos como lo razonable, este Tribunal Constitucional no pueda verter un pronunciamiento positivo o negativo al respecto, porque no es un órgano técnico en la materia, ni se cuenta con los elementos probatorios que concluyan ciertamente que entre mayores sean los principios activos a los que se les exige pruebas de bioequivalencia mayor sea la protección al derecho a la salud, o a la inversa, entre menores sean los principios activos a los que se les exige pruebas de bioequivalencia menor es la protección al derecho a la salud.
Tal como se dijo, la determinación del número responde a criterio de oportunidad, asumiendo que tal determinación no pone en peligro la salud, en virtud de lo manifestado por las autoridades. Nótese que no se cuenta con un parámetro universalmente aceptado con qué comparar la lista en cuestión, pues los recurrentes dicen que con el anexo n°9 del 34° Informe del Comité de Expertos de la OMS en Especificaciones para las Preparaciones Farmacéuticas de 1996, apéndice I contiene no menos de 188 productos que son sometidos en Alemania, Canadá y EEUU a estudios de equivalencia terapéutica de previo a autorizar su venta; pero los recurridos dicen que a nivel Latinoamericano vamos más rápido que otros países y que requiere de estudios individualizados y mucha capacitación, y que en Argentina sólo existen 12 principios activos. Así entonces, este tema es responsabilidad política de los recurridos, y esta Sala no puede emitir criterio sobre la decisión de cuáles o cuántos medicamentos deben someterse a pruebas.
Ciertamente, la Sala ya estableció (véase el voto 2001-12226) que la inscripción de medicamentos multiorigen de riesgo sanitario, sin estudios de equivalencia terapéutica, es inconstitucional; pero no podría afirmarse ahora que es igualmente inconstitucional que se establezcan únicamente siete medicamentos como de riesgo sanitario y por tanto, que únicamente esos siete deban someterse a dichas pruebas de equivalencia terapéutica, pues no se puede discutir en esta instancia el número de sustancias que requieren la prueba para asegurar la salud. En el voto anterior la acción se declaró con lugar porque no se realizaba ninguna prueba, pero ahora que se determinó que eran siete los principios activos que deben ser sometidos a pruebas, el análisis constitucional no puede ir más allá, pues ¿con qué criterios, más que una simple presunción a contrario sensu de lo indicado por las autoridades competentes, puede decir la Sala que el establecimiento de solamente siete principios activos (únicos a los que se someten a pruebas de equivalencia terapéutica) es insuficiente?
De esta forma, como no se cuentan con criterios determinantes para decir que deben ser siete, catorce, veintiuno, o más -salvo el criterio del órgano políticamente responsable, quien ya determinó que eran siete- no es posible verter pronunciamiento alguno al respecto. Finalmente no corresponde tampoco valorar la falta o no de fundamentación del decreto en cuestión. En conclusión, esta Sala Constitucional no es la instancia a la que corresponde definir un tema tan técnico como el que está en discusión, ni cuenta con el criterio suficiente como para concluir que la reducción a siete productos sea lesivo del derecho a la salud”.
De lo anterior, queda claro que esta Sala no tiene competencia para revisar los criterios técnicos y científicos que sirven de base al Decreto impugnado en esta vía, ni decidir sobre distintos criterios técnicos que pudieran darse al respecto (en este mismo sentido, puede consultarse lo señalado por esta Sala en Sentencias N° 11114-2001 de las 12:53 horas del 26 de octubre de 2001, N° 14349-2005 de las 09:14 horas del 21 de octubre de 2005, N° 11343-2007 de las 09:36 horas del 10 de agosto de 2007, N° 3216-2009 de las 10:08 horas del 27 de febrero de 2009 y N° 12282-2011 de las 11:23 horas del 9 de septiembre de 2011). De igual forma, en cuanto a los aspectos en los cuales el Decreto Ejecutivo en cuestión se separa o contiene regulaciones diferentes en relación con el estudio que le sirve de base -y que apunta la Procuraduría General de la República en su informe-, cabe indicar, que no solo esos aspectos no fueron cuestionados por el accionante -y, por ende, no son objeto de esta acción-, sino que, además, son aspectos que deberán, en su caso, ser revisados en la vía de legalidad.
Por otra parte, el hecho de que el estudio base del Decreto cuestionado haya sido elaborado por científicos que pertenecen a la industria bananera, no es motivo suficiente para invalidarlo, pues ello constituiría, así planteado, una falacia ad hominem circunstancial, ya que el argumento invalidante se basaría, únicamente, en las condiciones que rodean a los científicos que elaboraron el estudio -su pertenencia a la industria bananera-, pero no a cuestionamientos concretos sobre la objetividad y veracidad de conclusiones a las que se arribó en el estudio. De modo, que a juicio de esta Sala, la norma impugnada resulta racional como medio idóneo para alcanzar los fines de protección al medio ambiente y a la salud humana que se propone como objetivo, habida cuenta de su fundamento técnico y científico, fines establecidos en el artículo 70, del Reglamento, sea, evitar la contaminación de carreteras, centros de población, casas de habitación, edificios donde permanezca personal laborando, fuentes de agua y cultivos aledaños o fincas vecinas por efecto de la deriva o arrastre de plaguicidas.
No solo, existe evidencia científica de que la distancia de treinta metros como zona de no aplicación tiene una justificación técnica, siempre y cuando se dé en las condiciones y requisitos técnicos que prevé la normativa cuestionada, sino que, además, esa normativa adiciona una zona buffer o de protección funcional; ambos elementos en conjunto resultan suficientes para que la deriva no se produzca, según los estudios técnicos y científicos llevados a cabo. Por lo que no existe regresividad en esta materia, pues la reducción de la distancia está condicionada al cumplimiento de una serie condiciones (zona de no aplicación más área de barrera vegetativa de cobertura), todo lo cual resulta razonable. Es gracias a los avances tecnológicos, que se logra un mayor y mejor control de la deriva, lo cual permite reducir la distancia existente entre el área de cultivo objeto de la fumigación aérea y los centros de población y otros, de cien a treinta metros, sin que, con esa medida, se reduzca el grado de protección que se había venido dando, antes de la reforma, al derecho a la salud y a un ambiente sano y ecológicamente equilibrado.
Más aún, puede considerarse, que con la aplicación de los avances tecnológicos, hoy por hoy, es posible una mayor protección a esos derechos que la que se había venido dando, pese a la reducción de la citada distancia. Por lo demás, es claro que los avances tecnológicos a los que hace referencia el estudio científico que da fundamento al Decreto aquí cuestionado, no son exclusivos para el cultivo del banano, aún cuando el estudio se refiere, específicamente, a ese tipo de cultivo. Lo que se hace es aplicar los avances tecnológicos en materia de fumigación aérea a ese tipo de cultivo. Esto queda claro en el resumen del estudio que da base al decreto impugnado, en el que se consigna: “El presente trabajo presenta un análisis de la última tecnología disponible y la experiencia generada en Costa Rica, en el campo de las aplicaciones aéreas de plaguicidas”. De modo, que, este estudio no se limita al cultivo del banano, sino que trata, en general, de las aplicaciones aéreas de plaguicidas, con independencia del cultivo de que se trate.
Por lo cual, las reservas que manifiesta la Procuraduría General en relación con este punto, no tienen razón de ser (ver, en este sentido, el Informe Técnico sobre Aplicaciones Aéreas y Zonas de Amortiguamiento N° CAAA-008-2014 del 24 de octubre de 2014, elaborado para esta acción por el Ingeniero Emmanuel Villalobos Sánchez, Presidente de la Comisión Asesora para el Control y la Regulación de las Actividades de la Aviación Agrícola). De igual modo, la espesura que debe tener la zona de amortiguamiento, así como la altura de los árboles, son aspectos técnicos que no cabe revisar en esta sede.
VI.Sobre el control de las condiciones meteorológicas al momento de la fumigación. En cuanto al control de las condiciones meteorológicas imperantes al momento de realizar la aplicación aérea de plaguicidas, de acuerdo con el informe rendido por el Director General de la Dirección General de Aviación Civil y el Presidente del Consejo de Aviación Civil, solicitado como prueba para mejor resolver, se tiene que, en las operaciones de aplicación aérea, no se cuenta con un “técnico de aviación” como tal, que verifique las condiciones meteorológicas del campo o finca a tratar, sino con la figura del “Supervisor de Campo” o “Supervisor de Riego”, que es la persona encargada de realizar las observaciones referentes a viento, temperatura, visibilidad, techo de nubes y otras condiciones que puedan afectar la aplicación. Esta persona, por lo general, es un funcionario de la finca o propietario del cultivo a tratar, quien, basado en su experiencia y conocimiento del lugar de la aplicación, emite el respectivo reporte de las condiciones al piloto para que este último inicie el vuelo desde su aeropuerto.
Usualmente, dichos funcionarios cuentan con un anemómetro portátil con el cual realizan las lecturas sobre los datos específicos de velocidad y dirección del viento, temperatura y humedad relativa. Además, los operadores agrícolas, en sus Manuales de Operaciones, establecen las obligaciones y responsabilidades de dicho personal, tal y como se establece en el artículo 54.2.3, del Reglamento de Actividades Agrícolas.
Asimismo, esas verificaciones también se realizan por medio de la Unidad de Operaciones Aeronáuticas, a través de los Inspectores, quienes realizan inspecciones regulares de las operaciones agrícolas, de conformidad con el Plan Anual de Vigilancia. Con respecto a los sistemas de señalamiento satelital, altura y calibración de equipos de aplicación, en su informe, el Director General de la Dirección General de Aviación Civil y el Presidente del Consejo de Aviación Civil indicaron que son sistemas automatizados que se ajustan desde la cabina del piloto y en el cual el piloto ingresa las coordenadas de la finca a tratar, así como los valores de la aplicación, tales como los galones que se quieren aplicar por hectárea. El sistema, al ser automatizado, realiza los ajustes necesarios para mantener la aplicación deseada. En cuanto a la calibración de los equipos, estos vienen calibrados de fábrica y, a la vez, el operador agrícola cuenta con procedimientos específicos para realizar dichas calibraciones, ya sea por requerimiento del cliente (finca) o por su programa de mantenimiento; dichos procedimientos, igualmente, se encuentran establecidos en su Manual de Operaciones.
Con lo cual, estima esta Sala, existe un adecuado control, a la hora de la realización de la fumigación aérea, de las condiciones meteorológicas necesaria para evitar la deriva más allá de la zona de amortiguamiento, en relación con la verificación de la velocidad y dirección del viento, la temperatura, la humedad relativa, los sistemas de señalamiento satelital, la altura del vuelo y calibración del equipo de aplicación, condiciones todas que, entiende esta Sala, son debidamente verificadas y fiscalizadas, en su momento, por las autoridades competentes, en resguardo de la salud de las personas.
VII.Sobre el estudio de afectación a la salud de mujeres en estado de embarazo en Matina debido a la fumigación aérea. Tanto el accionante, como la Procuraduría General de la República, hacen referencia al estudio del Instituto Regional en Sustancias Tóxicas de la Universidad Nacional (IRET) y otros denominado “Aplicación Aérea de Mancozeb y Concentraciones Urinarias de Etilentourea (ETU) en Mujeres Embarazadas de Costa Rica: Estudio Infantes y Salud Ambiental (ISA)”. En este estudio, se detectó la presencia de químicos que se esparcen en fumigaciones aéreas, en la orina de mujeres embarazadas que viven en las zona bananera de Matina, lo que implica un grave problema de salud. Al respecto, en ese estudio se concluye que “[l]as concentraciones urinarias medidas de ETU de las mujeres eran más de cinco veces mayores que las reportadas para otra poblaciones en general (…). Las concentraciones urinarias de ETU en las mujeres embarazadas son preocupantes, y es posible que la fuente principal de exposición sea la fumigación de mancozeb por vía aérea”.
Esta Sala, no pone en tela de duda las graves consecuencias que sobre la salud de las mujeres embarazadas se está presentando en la zona bananera de Matina y que la causa probable es la fumigación aérea de esos cultivos. Esta sola probabilidad, es suficiente para que este Tribunal, en aplicación del principio precautorio en materia ambiental y de salud humana, en vía de amparo, tutele esos derechos fundamentales. Sin embargo, en vía de acción de inconstitucionalidad, se debe determinar, que existe una relación de causa a efecto entre la promulgación de la normativa cuestionada y la afectación al derecho a la salud y al disfrute de un ambiente sano y ecológicamente equilibrado que se aduce. Es decir, es necesario, además, establecer que, ciertamente, con la promulgación del Decreto Ejecutivo impugnado, por medio del cual se reduce la distancia entre el cultivo objeto de la aplicación aérea de sustancias y las viviendas o centros de población, se ha causado una desprotección a esos derechos fundamentales que implique un retroceso inadmisible en esta materia.
Es de notar que, por una parte, el accionante no demuestra que la reducción de la zona de amortiguamiento, de cien a treinta metros, con el cumplimiento de las condiciones que la norma impugnada establece al efecto, sea la causa de ese problema de salud y, que el problema no se deba, más bien, a la inobservancia de la normativa vigente al efecto y al incumplimiento de las obligaciones de control y vigilancia que, al respecto, pesan sobre autoridades administrativas competentes.
Como se dijo anteriormente, esta Sala carece de competencia para revisar los criterios técnicos que sirven de base el Decreto Ejecutivo en cuestión, así como para determinar, entre distintos criterios divergentes, cuál es el que debe aplicarse o prevalecer. Le corresponde verificar que la decisión de reducir la distancia entre la zona objeto de fumigación y las viviendas o centros de población tenga asidero en un criterio científico y técnico. Si este criterio es erróneo o si el método utilizado presenta inconsistencias, esto es un asunto que debe discutirse en la vía ordinaria, ya que allí, con amplitud de pruebas, podrá revisarse el criterio y establecerse cuál es el correcto. En todo caso, los criterios técnicos y científicos representan verdades contingentes y provisionales, siempre sometidas a revisión. Claro está también que nuevos avances científicos y tecnológicos podrían aportar nuevos elementos para mejorar la regulación vigente. Pero esa posibilidad de mejora no implica que la norma sea inconstitucional, sino solo en el tanto y en el cuanto resulte contraria al Derecho de la Constitución como, por ejemplo, que en materia de tutela de derechos fundamentales, la nueva normativa implique una menor protección a la ya alcanzada.
En este orden de ideas, tampoco le corresponde a esta Sala revisar si la metodología empleada en el estudio sobre mujeres embarazada de Matina tiene errores metodológicos que falsean las conclusiones a las que se arribó. Así, no cabría, en esta vía, cuestionar los hallazgos y conclusiones de ese estudio, con base en los reparos que sobre aspectos metodológicos se señalan en el Oficio N° GG-505-2014, del 16 de octubre de 2014, suscrito por el Ing. Jorge A. Sauma A., Gerente General de Corbana S.A., y el Ing. Sergio Laprade Coto, Coordinador de la Comisión Ambiental Bananera, y los que se hacen en el informe N° DRPIS-UNC-ESJ-2287-10-2014, de fecha 14 de octubre de 2014, elaborado por la Licda. Elizabeth Solórzano Jiménez, funcionaría de la Unidad de Normalización y Control-DRPIS, y el Ing. Ricardo Morales Vargas, funcionario de la UNSSAH- Dirección Protección al Ambiente Humano, ambos del Ministerio de Salud, toda vez que esa discusión es propia de la vía de legalidad.
Es en esa vía, donde podrá establecerse si, efectivamente, el estudio citado adolece de una serie de errores metodológicos que ponen en entredicho sus conclusiones, tales como la inexistencia de una población blanco o testigo ajena a la actividad del banano que sirva de comparación, con lo cual no se discriminan otras variables como puede ser la ingesta de alimentos, dado que el mancozeb se utiliza en muchísimos cultivos de consumo humano directo y procesado en la dieta de la población, razón por la cual la suposición que toda la exposición se deba a la aplicación aérea de plaguicidas no es contundente. Asimismo, el estudio sugiere que la posible presencia de ETU es por aplicaciones aéreas, pero no se considera la genética, las aplicaciones en otros cultivos de la zona, ni el origen de las personas, como otras variables, ya que, por ejemplo, de determinó que los migrantes presentaban mayor ETU que las mujeres costarricenses.
De igual modo, se indica que el manejo y análisis de las muestras no es claro, no se conoce la cadena de custodia, ni se utiliza un laboratorio con ensayos acreditados en buenas prácticas (GLP). Se señala que en el estudio no se presenta el r 2, que sirve para determinar el grado en el que están relacionadas la variables, para la relación entre la distancia de la vivienda y los niveles de ETU en las personas, ya que esto es un indicativo de que es muy pequeño y, por ende, utilizar la distancia de las fincas con las viviendas y los niveles de ETU no es un predictor de exposición correcto. Tampoco se demuestra el daño en las personas y se señala que el producto es cancerígeno, obviando lo que indica la Agencia Internacional de Investigación en Cáncer (AIRC) de la Organización Mundial de la Salud al respecto. También se señala que se utilizan parámetros de toxicológicos desfasados en el tiempo, de 1996, siendo el parámetro de ingesta, al momento de la elaboración del informe, del 2013, el cual invalida las conclusiones del estudio, ya que al comparar la ingesta diaria estimada (EDI) obtenida en el estudio, con los niveles de la dosis de referencia diaria (RfD) del 2013, se encuentra quince veces por debajo del valor permitido, lo que varía totalmente las conclusiones de estudio.
Asimismo, el Doctor Freddy Arias Mora, Toxicólogo de la Facultad de Farmacia de la Universidad de Costa Rica al analizar el estudio sobre la concentración de ETU en mujeres embarazadas de Matina, concluye que la fórmula matemática para determinar la posible concentración en sangre del ETU tiene un error debido a una falla en el modelo toxicocinético utilizado y que los datos no representan la dosis por exposición crónica al fungicida mancozeb, ni su metabolito ETU, por cuanto el modelo toxicocinético tiene errores de cálculo, lo cual aunado a que no se consideró la dinámica de absorción y eliminación de la sustancia, así como la influencia del tiempo de exposición al plaguicida, los resultados no son válidos, por lo que no es posible afirmar una posible afectación a la salud de las personas.
Todos esos cuestionamientos metodológicos que se hacen al estudio “Aplicación Aérea de Mancozeb y Concentraciones Urinarias de Etilentourea (ETU) en Mujeres Embarazadas de Costa Rica: Estudio Infantes y Salud Ambiental (ISA)” y que ponen en entredicho las conclusiones a que se arribó en dicho estudio, no son propias de ser conocidos en esta vía, ya que es la vía de legalidad la competente para analizar el fondo del asunto y determinar si las conclusiones en cuestión se pueden mantener o no. Pero tampoco, por la misma razón, corresponde en esta vía entrar en valoraciones sobre las conclusiones a que llegaron los investigadores que realizaron el estudio denominado “Manejo de la deriva en las aplicaciones aéreas de plaguicidas en fincas con zonas de amortiguamiento”. En este último trabajo de investigación se concluye, entre otros aspectos, que existe suficiente información a nivel nacional y mundial que señalan que el manejo de la deriva en las aplicaciones de plaguicidas se debe hacer por medio de prácticas de aplicación y no por distancias exclusivamente y que una zona de amortiguamiento de treinta metros, sembrada de árboles de mayor altura que el cultivo, es uno de los mejores métodos para minimizar la deriva, pues los árboles actúan como una barrera al traslado de plaguicidas fuera del campo de aplicación.
Este estudio se basa en las leyes de la física que son universales y en determinadas técnicos, de manera que si la fumigación se lleva a cabo con la tecnología adecuada y con el cumplimiento de ciertos requisitos científica y técnicamente establecidos -los cuales recoge el Decreto Ejecutivo impugnado- se puede tener certeza científica que la deriva será casi nula y que una zona de amortiguamiento de treinta metros, sembrada de árboles de mayor altura que el cultivo, garantiza que la deriva que se produzca no la traspasará, siempre y cuando se cumplan todas las condiciones técnicas exigidas (tamaño de la gota de la mezcla a aplicar, longitud de la barra de aspersión, altura del vuelo, condiciones climáticas, etc.). En estas circunstancias, no podría producirse deriva hacia los centros de población, pues ello implicaría el desafío de las leyes físicas que gobiernan universalmente el comportamiento de la materia.
De modo, que el Decreto impugnado cuenta con un estudio científico que lo respalda, el cual no cabe cuestionar en esta vía, ni siquiera a través de otro estudio técnico que pusiera en cuestionamiento sus conclusiones. Esa divergencia tendría que ser, irremediablemente, zanjada en la vía de legalidad.
Además, en el expediente de la acción, se han aportado una diversidad de estudios e información en relación con la fumigación aérea de plaguicidas y el tema de la posible deriva: Informe Técnico sobre aplicaciones aéreas y zonas de amortiguamiento de la Comisión Asesora para el Control y la Regulación de las Actividades de la Aviación Agrícola; Buenas prácticas de aplicación en cultivos planos extensivos. Distancias a zonas urbanas. Criterios y soluciones, de Alberto Etiennol y Augusto Piazza de la Universidad Argentina de la Empresa; Evaluación y Mitigación de la deriva de rocío en la fumigación, de Allan S. Felsot de la Washington State University; Resumen de Estudios de Aplicación Aérea; Deriva de Pesticidas. Susan Cordell y Paul B. Baker, de la Escuela de Agricultura de la Universidad de Arizona; Filtración de Deriva por Captadores Naturales y Artificiales. Una Revisión de la Literatura, de Andrew J. Hewitt de Servicios de Investigación Agrícola Stewart; y Barreras Naturales y Artificiales para Deriva de Rocío.
Mitigación de Recursos Primarios, Australia del Sur (PIRSA) de Andrew Hewitt PhD, Gary Dorr PhD, Peter Hughes y Toni Axford (PIRSA) del Centro para la Aplicación y Seguridad de Pesticidas de la Universidad de Queensland, Gatton. En todos estas investigaciones, se concluye, en definitiva, que la deriva que produce la fumigación aérea de plaguicidas, se puede reducir casi a cero y evitar que llegue a las viviendas o centros de población aledaños al cultivo objeto de la fumigación, siempre y cuando se cumplan determinados requisitos, tales como la existencia de una zona de amortiguamiento sembrada con árboles de mayor altura que el cultivo y se utilicen tecnologías de punta en la fumigación, la cual, también, deberá realizarse bajo determinadas condiciones climáticas científica y técnicamente establecidas. En estas condiciones, la reducción de la distancia entre el cultivo y las viviendas o centros de población a solo treinta metros no implica ninguna desprotección al derecho a la salud de los habitantes del lugar ni afectación al derecho al disfrute de un ambiente sano y ecológicamente equilibrado, tutelados en los artículos 21 y 50, de la Constitución Política.
Así, no hay forma que, de cumplirse todos los requisitos y condiciones a que hace referencia el Decreto Ejecutivo cuestionado, se produzca, en virtud de la deriva, la afectación a la salud que acusa el accionante y que se afirma en el estudio relativo a las mujeres embarazadas de Matina. Esto solo podría entenderse, si se incumplen esas condiciones. Que esto sea así, lo corrobora el propio accionante, quien en su denuncia AEL-063-2015, fechada en Limón el 15 de junio de 2015, afirma que en las fincas bananeras de Matina no hay barreras físicas, es decir, no existe una zona de amortiguamiento de treinta metros entre el cultivo objeto de la fumigación y las viviendas de las personas afectadas, lo cual queda también acreditado por la contestación que a dicha denuncia le da la Directora del Área Rectora de Salud de Matina, en Oficio HC-ARS-M-2382-2015 del 30 de junio de 2015. De modo tal, que en el caso de Matina la normativa que contiene el Decreto cuestionado no es de aplicación, ya que no se cumplen las condiciones para ello y, por ende, los problemas de salud que aquejan a personas embarazadas no se relaciona con la norma acusada de inconstitucional, sino, más bien, con el posible incumplimiento de la normativa que regula actividad de la fumigación aérea, lo cual no es objeto de conocimiento de esta vía.
En consecuencia, esta Sala considera que la norma en cuestión tiene fundamento científico suficiente y, en ese tanto, resulta racional, por lo que no implica ningún retroceso en la protección de derechos fundamentales, particularmente la salud y el disfrute de un ambiente sano y ecológicamente equilibrado; y, por ende, la acción contra el Decreto Ejecutivo N° 34202-MAG-MS-MINAE-MOPT-MGSP, que es Reforma al artículo 70, del Decreto Ejecutivo N° 31520-MS-MAG- MOPT-MGSP, “Reglamento para las actividades de Aviación Agrícola”, del 16 de octubre del 2003, debe ser declarada sin lugar en todos sus extremos.
VIII.En relación con la gestión de audiencia a la Defensoría de los Habitantes que plantea el accionante. El accionante, en escrito presentado a las 10:05 horas del 4 de diciembre de 2014, solicita a esta Sala se dé audiencia a la Defensoría de los Habitantes, a fin de que se manifieste en relación con el Decreto Ejecutivo N° 34202-MAG-MS-MINAE-MOPT-MGSP, que es Reforma al artículo 70, del Decreto Ejecutivo N° 31520-MS-MAG- MOPT-MGSP, “ Reglamento para las actividades de Aviación Agrícola”, del 16 de octubre del 2003, impugnado en esta acción. Dicho escrito se reservó para ser conocido en el momento procesal oportuno (resolución de Presidencia de las 11:19 horas del 4 de diciembre de 2014). Analizada la solicitud del accionante, esta resulta improcedente, pues, por una parte, la Defensoría de los Habitantes no tiene relación directa con la aplicación del Decreto Ejecutivo impugnado; y, por otra, tampoco estima este Tribunal, que pueda aportar mayores elementos para la resolución del fondo de este asunto, sobre todo si se toma en cuenta que el órgano asesor de esta Sala en materia de acciones de inconstitucionalidad, es la Procuraduría General de la República, la cual vertió su opinión respecto de la norma cuestionada.
IX.Conclusión. Con base en las consideraciones que anteceden, lo procedente es declarar sin lugar la acción interpuesta en todos sus extremos, por estimar esta Sala que el artículo 1, del Decreto Ejecutivo N° 31520-MS-MAG-MOPT-MGSP, Reglamento para las actividades de Aviación Agrícola, no es en sí mismo inconstitucional, siempre y cuando exista una estricta fiscalización, por parte de las autoridades competentes, de la zona de amortiguamiento y demás condiciones exigidas en el Decreto, en los actos concretos de aplicación, en resguardo de la salud de las personas. El Magistrado Cruz Castro salva el voto y declara con lugar la acción en todos sus extremos.
X.Voto salvado del Magistrado Cruz Castro. Con el mayor respeto para la mayoría del Tribunal Constitucional, y con base en las mismas consideraciones por las cuales, en su oportunidad, salvé el voto en la Sentencia N° 2012-011064 de las 16:31 horas del 14 de agosto de 2012, discrepo del razonamiento vertido por la Sala en la sentencia de mayoría, en que se considera que lo dispuesto por el artículo 1º del Decreto Ejecutivo No. 34202 de 21 de mayo de 2007 no lesiona el Derecho de la Constitución, particularmente los derechos protegidos en los artículos 21 y 50 de la Constitución Política. Sobre el particular, el suscrito Magistrado reitera el criterio sostenido en la sentencia No. 2006-16276 de las 14:46 hrs. de 8 de noviembre de 2006, en que se declaró inconstitucional el artículo 70 del Reglamento para las Actividades de Aviación Agrícola, Decreto Ejecutivo No. 31520-MS-MAG-MOPT-MGSP de 16 de octubre de 2003, en la parte que dispone:
“Dicha franja podrá ser reducida hasta un mínimo de 30 metros, si entre el campo a tratar y los sitios indicados, existen zonas de amortiguamiento reforestadas preferiblemente con especies nativas, siempre y cuando además se apliquen plaguicidas de moderada toxicidad a lo sumo, y la aplicación se realice bajo condiciones adecuadas de altura de vuelo, tamaño de la partícula, velocidad del viento que en conjunto permitan la reducción de la deriva y que la aeronave disponga de implementos adecuados para ese fin y que se vuele en forma paralela a la zona de amortiguamiento. En caso de que la aplicación se realice en forma perpendicular a dicha zona, deberá dejarse además una franja no menor de 40 metros dentro del cultivo, en la que no se podrán aplicar plaguicidas por avión para reducir el efecto del arrastre, pudiéndose aplicar el área respectiva con helicóptero u otro medio que asegure el control del arrastre. La franja de no aplicación de plaguicidas podrá omitirse en caso de vías o caminos internos de uso exclusivo para el cultivo que se va a tratar y en el tanto no existan viviendas ni se produjeren ninguno de los supuestos a que se refiere el párrafo primero del presente artículo”.
Esta disposición tiene un contenido similar a la cuestionada en esta oportunidad, es decir, el artículo 1º del Decreto Ejecutivo N° 34202 de 21 de mayo de 2007, en que se redujo la distancia que debe existir (entre el campo a tratar y cualquier carretera, centros de población, casas de habitación, edificios donde permanezca personal laboral, fuentes de agua y cultivos aledaños o fincas vecinas) de cien hasta treinta metros, a efecto de realizar aplicaciones aéreas de plaguicidas. Sobre el particular, es preciso reconocer, tal y como se hizo en la Sentencia N° 2006-16276, que esta Sala ha desarrollado ampliamente los alcances del derecho fundamental a un medio ambiente sano y ecológicamente equilibrado, como son recogidos en la Sentencia N° 2003-06322 de las catorce horas con catorce minutos del tres de julio del dos mil tres, y sin perjuicio de otras ampliaciones y matizaciones posteriores de las cuales se derivan una serie de parámetros y principios que se resumen en:
"1. la obligación del Estado de garantizar, defender y tutelar este derecho, con lo cual, el Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. Debe asegurar y proteger ese derecho contra algún riesgo o necesidad, defender es vedar, prohibir e impedir toda actividad que atente contra el derecho, y preservar es una acción dirigida a poner a cubierto anticipadamente el derecho de posibles peligros a efectos de hacerlo perdurar para futuras generaciones. El Estado debe asumir un doble comportamiento de hacer y de no hacer; por un lado debe abstenerse de atentar él mismo contra el derecho a contar con un ambiente sano y ecológicamente equilibrado, y por otro lado, debe asumir la tarea de dictar las medidas que permitan cumplir con los requerimientos constitucionales" (sentencia número 9193-2000, de las dieciséis horas veintiocho minutos del diecisiete de octubre del dos mil).
2. el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado al tenor de lo dispuesto en el artículo 50 de la Constitución; 3. el principio del uso racional de los recursos, a fin de que exista el necesario equilibrio entre el desarrollo del país y el derecho al ambiente; 4. el principio de la calidad ambiental, según el cual la calidad ambiental es un parámetro fundamental de la calidad de vida; al igual que la salud, la alimentación, el trabajo, la vivienda y la educación, entre otros 5. el principio precautorio: Uno de los principios esenciales que componen el derecho ambiental es el "principio precautorio" o "principio de la evitación prudente", tal como está contenido en la Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo, Declaración de Río, según el cual la prevención pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos.
Consecuentemente, el principio rector de prevención se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar o contener la posible afectación del ambiente o la salud de las personas; 6. la exigencia de la realización del estudio de impacto ambiental previo a la iniciación de obras y actividades que puedan producir daños y contaminación del medio ambiente evaluables, como la presencia de sustancias tóxicas o elementos externos que provoquen en el ambiente características negativas, tanto para la diversidad biológica -comprendiendo a la flora y la fauna-, como -y sobre todo- para la vida humana, que se ve reflejada en la salud o bienestar del hombre -suelo, hábitat, aire, agua, etc.-, el impacto de estos elementos requiere de una evaluación y tratamiento científico; 7. la obligación de las instituciones del Estado de cumplir con la legislación ambiental en su actividad ordinaria; 8. la regla de que sólo el estado de necesidad declarado excepciona el cumplimiento de las normas ambientales 9. el principio de que la falta de recursos económicos de las instituciones públicas no es excusa que justifique la omisión de dar protección al derecho ambiental 10. el principio de coordinación entre las diversas dependencias públicas a fin de garantizar la protección del medio ambiente".
A todo lo anterior se agrega el reconocimiento constitucional del derecho fundamental a la salud y las exigencias que de ese reconocimiento se derivan, tanto para las autoridades públicas, como para los particulares, en el ejercicio de cualesquiera actividades que puedan ponerlo en peligro, por lo que, con relación a la Administración, se le ha dotado de facultades y obligaciones específicas en lo concerniente al desempeño de esas actividades. De este modo, con respecto a los alcances de lo dispuesto por el artículo 70, del Reglamento para las Actividades de Aviación Agrícola, Decreto Ejecutivo N° 31520-MS-MAG-MOPT-MGSP de 16 de octubre de 2003, la Sala Constitucional en la sentencia No. 2006-16276, consideró que:
“Si bien es cierto que el artículo 70 establece una franja de no aplicación aérea de 100 metros, permite, sin embargo, que la franja se reduzca a 30 metros, si entre el campo a fumigar y las casas, poblados y otros existen zonas de amortiguamiento reforestadas con especies nativas, siempre y cuando se apliquen plaguicidas de moderada toxicidad y la aplicación se realice en condiciones de altura de vuelo, tamaño de la partícula y velocidad del viento que permitan la reducción de la deriva y de que la aeronave disponga de implementos para ese fin y vuele en forma paralela a la zona de amortiguamiento. La Sala ha considerado que en estos casos debe aplicarse el principio precautorio (v. entre otras, la sentencia número 7294-98), sobre todo, tomando en cuenta que no hay un fundamento científico ni técnico que justifique la disminución de la franja. El Reglamento impugnado no indica los porcentajes de deriva del plaguicida admitidos y establece la posibilidad de reducir la franja de aplicación a 30 metros, sujeta a unas condiciones del tóxico, climáticas y del vuelo, que ni siquiera pueden ser previamente controladas por la autoridad pública, con lo cual, pone en peligro los derechos fundamentales a la salud y al medio ambiente sano y ecológicamente equilibrado, porque se trata de una actividad contaminante, con sustancias tóxicas, en la cual no es admisible reducir los niveles de protección establecidos en la anterior regulación”.
En este orden, las razones que aporta la mayoría del Tribunal Constitucional en esta ocasión para justificar la conformidad con el Derecho de la Constitución de lo dispuesto por el artículo 1º, del Decreto Ejecutivo N° 34202 de 21 de mayo de 2007, en nada justifican el cambio de criterio que se ha producido en el caso concreto, el cual ha incidido sobre el pleno goce de los derechos protegidos en los artículos 21 y 50, de la Constitución Política y, particularmente, el principio precautorio que rige el derecho ambiental. Con sustento en lo expuesto, el suscrito Magistrado salva el voto y declara la inconstitucionalidad de la norma impugnada, en la medida en que contiene una disposición similar a la que ya fue anulada por este Tribunal Constitucional en la decisión N° 2006-16276.
Por tanto:
Se declara sin lugar la acción, al estimar que el artículo 1, del Decreto Ejecutivo N° 31520-MS-MAG-MOPT-MGSP, Reglamentopara las actividades de Aviación Agrícola, no es en sí mismo inconstitucional, siempre y cuando exista una estricta fiscalización, por parte de las autoridades competentes, de la zona de amortiguamiento y demás condiciones exigidas en el Decreto, en los actos concretos de aplicación, en resguardo de la salud de las personas. Notifíquese. El Magistrado Cruz Castro salva el voto y declara con lugar la acción.- Ernesto Jinesta L.
