Amparo proceeding (recurso de amparo) processed under case number 17-009127-0007-CO, filed by JOSÉ ROBERTO RAMÍREZ SOLÍS, identity card 0112620600, against the WATER DIRECTORATE OF THE MINISTRY OF ENVIRONMENT AND ENERGY (MINAE).
Findings of Fact:
Justice Salazar Alvarado drafts the opinion; and,
Whereas:
I.Subject matter of the action. It is alleged that Article 50 of the Constitución Política was violated because a concession for the use of water from a well was renewed without a prior technical study and, moreover, because only a sworn declaration of environmental commitments was required rather than an environmental impact study (estudio de impacto ambiental).
II.Regarding the withdrawal. With respect to the withdrawal requested by the appellant in the document filed with the Sala, the right involved in this amparo proceeding is the right to a healthy and ecologically balanced environment, established in Article 50 of the Constitución Política. That right cannot be regarded as proprietary or waivable within the meaning of Article 52, second paragraph, of the Ley de la Jurisdicción Constitucional; the merits of the action must therefore be considered.
III.Proven facts. The following facts relevant to the decision in this matter are deemed duly established, either because they have been proven or because the respondent failed to address them, as directed in the initial order:
IV.Merits. This appeal claims that, when the concession for the use of water from a well was renewed, no prior technical study had been prepared and, furthermore, only a sworn declaration of environmental commitments was required rather than an environmental impact study (estudio de impacto ambiental), thereby violating Article 50 of the Political Constitution (Constitución Política). The record and the sworn report submitted by the respondent authority duly establish that the authorization file for the well at issue began processing before the Water Directorate of MINAE in the year 1998, when it was filed as an application for a well-drilling permit (permiso de perforación del pozo) and assigned number AB-1862. For that initial proceeding, SENARA was afforded a hearing (audiencia), to which it responded through official letter AP-291-98 of 19 de junio de 1998, stating: “this Area has no objection, and number AB-1862 is assigned (to the well).” Thus, SENARA was aware of the requested water use from the outset.
Accordingly, by decision 277-2000-AGUAS-MINAE, dated 29 de junio del 2000, a concession was granted for the use of groundwater from well AB-1862 for a term of ten years, to be used by Mr. Anglin Edwads Lloyd Walter; that concession expired in the year 2010. The record shows that on 30 de junio del 2010, the interested party again submitted the application for the well concession, and, upon consultation, SENARA stated the following in the conclusions of official letter 297-10: “1- There is insufficient technical information regarding the condition of the aquifer to issue an opinion concerning the water-use concession. 2- In view of the lack of information on the aquifer’s water balance, MINAET, as the entity that grants water concessions, is advised to generate the data necessary to support the concession decision and to establish an extraction and concession-granting policy that will maintain the balance of the aquifer in question.” In this regard, the record established that, in abril de 2007, SENARA prepared a study entitled “Potential Recharge of the Colima and Barva Aquifer, Valle Central, Costa Rica,” and that the study covered the following cartographic location: approximately between topographic coordinates 212.000-235.000 North and 505.000-545.000 East on the Brava, Abra, Naranjo, Río Grande, Carrillo, and Istarú map sheets.
The site covered by SENARA’s analysis corresponds to the location where the well AB-1862 at issue was drilled. The cited study was conducted to assess the aquifer’s existing water balance, for which purpose it calculated the potential recharge and the estimated extraction through wells already drilled, including well AB-1862. Consistent with the foregoing, the report stated that every water concession is granted only after a technical study assessing the applicant’s actual needs in light of the Allocation Manual previously approved by the respondent Directorate. In the specific case of this concession, the corresponding technical report was prepared through technical report AT-2228-2011, dated 06 de diciembre del 2011, based on the water availability determined by the SENARA study cited supra. Furthermore, as reported, this is the flow rate that has been granted to the concession holder from the outset, namely, since the year 2000, and all of this was taken into account in the SENARA study.
The appellant’s allegation that there were no studies is therefore refuted because, as indicated, the renewal of the water use was supported by SENARA’s study from the year 2007, as well as by the corresponding technical report from diciembre de 2011. Based on these studies and reports, the Water Directorate of MINAE—the competent body for granting water concessions—renewed the existing concession by decision R-0593-2013-AGUAS-MINAE, dated 21 de agosto del 2013, for a total of 0.20 liters per second and for a term of ten years. Regarding the environmental instrument required to grant the concession, it was established that the Water Directorate of MINAE does not determine which environmental instruments concession holders must submit to that Directorate, as this falls within the authority of the Secretaría Técnica Nacional Ambiental (SETENA), which, after reviewing the application and the form submitted for that purpose by the interested party, decides which environmental legal instrument must be provided, whether an environmental impact assessment, a declaration of environmental commitments, or another instrument.
In this respect, the record established that, in cases involving water concessions that had already been granted, SETENA stated in official letter SG-DEA-1121-2010-SETENA dated 06 de abril del 2010 and served on 07 de abril del 2010: “Longstanding water uses operating before 28 de junio del 2004 are not required to complete the Environmental Feasibility (License) procedure before SETENA, since Decreto Ejecutivo 25705-MINAE does not require it.” Accordingly, the circumstance raised by the protected party—whether an environmental impact study rather than a sworn declaration of environmental commitments was required to authorize the water use—is a matter of ordinary legality (legalidad ordinaria) that must be examined in the ordinary legal proceedings, particularly since the record shows that the appellant brought this amparo proceeding (recurso de amparo) before the Chamber only after nearly four years had elapsed since the renewal of the water concession was approved. Consequently, the appeal must be dismissed, as is hereby ordered.
Since judgment No. 2012-00975 issued at 09:05 hrs. on 27 de enero de 2012, in environmental matters involving prior administrative action through the issuance of administrative acts (actos administrativos) by various public entities and bodies, I have referred the matter to the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa). Nevertheless, upon further consideration, where the matter also involves the right to drinking water because an aquifer is affected, I do consider that the matter should be heard and resolved within this constitutional jurisdiction. I will do likewise where the contamination or destruction of a wetland is alleged, given its protection under the Convention on Wetlands of International Importance Especially as Waterfowl Habitat, the “Ramsar Convention,” and its importance to freshwater ecosystems and groundwater recharge.
In cases involving petitions concerning environmental matters, my general position is that this Chamber should refrain from hearing claims brought before it alleging a violation of Article 50 of the Political Constitution, leaving their consideration to the administrative justice system and the contentious-administrative jurisdiction (jurisdicción contenciosa administrativa). However, I have also noted that my position does not preclude recognizing the existence of particular cases or categories of cases that, in my judgment, would still be better protected by this Chamber and must therefore be heard and decided by it.- Among such categories of cases, and without this enumeration being considered a closed and definitive list, I may indicate that the Chamber should retain jurisdiction over situations such as claims concerning environmental violations that also directly endanger human health or the accessibility or quality of water; cases involving flagrant and direct violations of the environment in which there is a manifest lack of protection by State authorities, provided that the nature of the claim also allows it to be addressed through the amparo proceeding (amparo) as a summary and special procedural mechanism, since I believe that amparo should not be converted into an ordinary proceeding in order to address, even in the aforementioned cases, matters exceeding its capacity to deal with them adequately.
In this particular case, the situation presented falls within those exceptional cases because it concerns an alleged threat to sources of drinking water for human consumption that could be affected by the Administration’s inaction or misguided actions; accordingly, in this situation I agree with the majority that this Court must hear and decide the merits of this case, as it has done.
In environmental matters, it is the undersigned’s view that if the Public Administration has already intervened, the consideration and resolution of the matter falls within the contentious-administrative jurisdiction. Nevertheless, I do consider the merits when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Political Constitution), as occurs in this case, in which possible harm to an aquifer (manto acuífero) is alleged, affecting nearby communities and violating the right to enjoy a healthy and ecologically balanced environment and a dignified standard of quality of life.
The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computing, magnetic, optical, or telematic device or produced through new technologies, these must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Full Court at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 de enero del 2012, as well as the resolution approved by the Superior Council of the Judiciary at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.

Recurso de amparo que se tramita en expediente número 17-009127-0007-CO interpuesto por JOSÉ ROBERTO RAMÍREZ SOLÍS, cédula de identidad 0112620600, contra la DIRECCIÓN DE AGUAS DEL MINISTERIO DEL AMBIENTE Y ENERGÍA (MINAE).
Resultando:
Redacta el Magistrado Salazar Alvarado; y,
Considerando:
I.Objeto del recurso. Se alega que al otorgarse la renovación de una concesión de aprovechamiento de agua de un pozo, sin establecerse un estudio técnico anteriormente, y que además, solo se exigió una declaración jurada de compromisos ambientales, y no un estudio de impacto ambiental, se violenta el artículo 50, de la Constitución Política.
II.Sobre el desistimiento. Con respecto al desistimiento solicitado por el recurrente en el documento presentado a la Sala, el derecho involucrado en el presente amparo es el derecho a un ambiente sano y ecológicamente equilibrado, contemplado en el artículo 50, de la Constitución Política, el cual no puede ser considerado como patrimonial o renunciable, en los términos del artículo 52, párrafo segundo, de la Ley de la Jurisdicción Constitucional, por lo que procede conocer el fondo del recurso.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos, según lo prevenido en el auto inicial:
IV.Sobre el fondo. Se reclama en este recurso, que al otorgarse la renovación de una concesión de aprovechamiento de agua de un pozo, no se estableció un estudio técnico con anterioridad y, además, que solo se exigió una declaración jurada de compromisos ambientales, y no un estudio de impacto ambiental, por lo que se violenta el artículo 50, de la Constitución Política. De los autos y del informe rendido bajo juramento por la autoridad recurrida, se tiene como debidamente acreditado que el expediente de autorización del pozo objeto del recurso, inició su trámite en la Dirección de Aguas del MINAE en el año 1998, donde ingresó como una solicitud de permiso de perforación del pozo, al cual se le asignó el número AB-1862. Para dicho trámite inicial, se confirió audiencia al SENARA, la cual fue contestada mediante el oficio AP-291-98 de 19 de junio de 1998, en el que se indicó "esta Área no tiene objeción, y se le asigna el número (al pozo) AB-1862”, por lo que, desde el inicio, el SENARA tenía conocimiento del aprovechamiento de agua solicitado.
De esa manera, en el trámite realizado, mediante resolución 277-2000-AGUAS-MINAE, del 29 de junio del 2000, se otorgó concesión para el aprovechamiento de las aguas subterráneas del pozo AB-1862, por un plazo de diez años, para ser utilizada por el señor Anglin Edwads Lloyd Walter, concesión que venció en el año 2010. Consta en el expediente que en fecha 30 de junio del 2010, se presenta nuevamente la solicitud de la concesión del pozo por parte del interesado y en consulta al SENARA, este, mediante oficio 297-10, en sus conclusiones indica: “1- No se cuenta con información técnica suficiente acerca del estado del acuífero para manifestarse en relación con la concesión para el aprovechamiento de aguas. 2- Se recomienda al MINAET como ente que otorga las concesiones de agua, en vista de la falta de información del balance hídrico del acuífero, generar los datos necesarios para fundamentar el acto de concesión y determinar una política de explotación y otorgamiento de concesiones que permita mantener el equilibrio del acuífero en cuestión”.
Con respecto a lo anterior, se estableció en el expediente, que el SENARA, en abril de 2007, confeccionó un estudio denominado "Recarga Potencial del Acuífero Colima y Barva, Valle Central, Costa Rica”, y dicho estudio se elaboró en la siguiente ubicación cartográfica: entre las coordenadas topográficas aproximadamente 212.000-235.000 Norte y 505.000-545.000 Este de las hojas cartográficas Brava, Abra, Naranjo, Río Grande, Carrillo e Istarú, y el sitio de estudio que abarcó el análisis del SENARA, corresponde al lugar de ubicación donde se encuentra perforado el pozo AB-1862 en cuestión. El estudio citado, se realizó a fin de valorar el balance hídrico existente en el acuífero, calculando para ello la recarga potencial y la extracción calculada por medio de los pozos ya perforados, entre los que encontraba el pozo AB-1862. Conforme a lo anterior, se manifestó en el informe rendido, que toda concesión de agua, se otorga después de un estudio técnico que valore las necesidades reales del solicitante, a la luz del Manual de Dotaciones previamente aprobado por la Dirección recurrida, y para el caso específico de esta concesión, mediante el informe técnico AT-2228-2011, de fecha 06 de diciembre del 2011, se elaboró el informe técnico correspondiente, conforme la disponibilidad de agua que arrojó el estudio realizado por SENARA, citado supra, además, como se informó, es el caudal que se le ha otorgado al concesionario desde un inició, sea en el año 2000, para todo lo cual, fue tomado en cuenta el estudio del SENARA.
Se desacredita entonces la falta de estudios que aduce el recurrente, pues de acuerdo con lo indicado, para la renovación del aprovechamiento de agua, se contó con el estudio del SENARA del año 2007, y también con el informe técnico respectivo de diciembre de 2011. Con base en estos estudios e informes, mediante resolución R-0593-2013-AGUAS-MINAE, del 21 de agosto del 2013, de la Dirección de Aguas del MINAE, órgano competente que otorga las concesiones de agua, se renovó la concesión ya establecida, por un total de 0.20 litros por segundo, por un plazo de diez años. Ahora bien, con respecto al instrumento ambiental necesario, para el otorgamiento de la concesión, se estableció que la Dirección de Aguas del MINAE, no define los instrumentos ambientales que los concesionarios deben presentar a esa Dirección, lo cual es competencia de la Secretaría Técnica Nacional Ambiental (SETENA), quien después de analizar la solicitud y el formulario que al efecto presenta el interesado, decide cuál instrumento jurídico ambiental debe de aportarse: sea una evaluación de impacto ambiental, o una declaración de compromisos ambientales, entre otros.
En ese sentido, se acreditó en los autos que para los casos de concesiones de agua, que ya habían sido otorgadas, SETENA mediante oficio SG-DEA-1121-2010-SETENA del 06 de abril del 2010 y notificado el 07 de abril del 2010, indicó: "Para los aprovechamientos de agua antiguos que se encuentran operando antes del 28 de junio del 2004, no están obligados a presentar el trámite de Viabilidad (Licencia) Ambiental ante SETENA toda vez que el Decreto Ejecutivo 25705-MINAE no lo exige como requisito". Por lo anterior, la circunstancia que reclama el amparado, sobre si debía ser un estudio de impacto ambiental y no una declaración jurada de compromisos ambientales, lo que era exigible para el otorgamiento del aprovechamiento de agua, es un asunto de legalidad ordinaria, que corresponde ser verificado en la vía de legalidad ordinaria, esto con mayor razón, al evidenciarse en el expediente que es luego de casi cuatro años de haberse aprobado la renovación de la concesión de agua, que el recurrente acude en amparo ante la Sala. En consecuencia, procede la desestimatoria del recurso, como en efecto se dispone.
Desde la sentencia No. 2012-00975 de las 09:05 hrs. de 27 de enero de 2012, en materia ambiental, cuando hay intervención administrativa previa, mediante el dictado de actos administrativos de diversos entes y órganos públicos, remito el asunto a la jurisdicción contencioso – administrativa. No obstante, bajo una mayor ponderación, cuando el tema involucre, además, el derecho al agua potable, por afectarse un manto acuífero, sí estimo que debe conocerse y resolverse el asunto en esta jurisdicción constitucional. Igualmente lo haré cuando se alegue la contaminación o destrucción de un humedal, dada su protección por la Convención Relativa a los Humedales de Importancia Internacional Especialmente como Hábitat de Aves Acuáticas, “Convención Ramsar”, debido a su importancia para los ecosistemas de agua dulce y la recarga de aguas subterráneas.
En el caso de recursos por cuestiones ambientales sostengo como línea general que esta Sala debe abstenerse de conocer los reclamos que se le presenten por supuesta infracción al artículo 50 de la Constitución Política para dejar en manos de la justicia administrativa y la jurisdicción contenciosa administrativa su conocimiento. Pero también he advertido que mi planteamiento no impide reconocer la existencia de casos particulares o grupos de casos que, según mi criterio, si resultarían aún mejor tutelados por esta Sala y por tanto deben ser conocidos y resueltos por ella.- Dentro de tales grupos de casos, y sin que esta enunciación pueda considerarse como una lista cerrada y definitiva, puedo señalar que la Sala debe reservarse el conocimiento de situaciones como por ejemplo los reclamos por infracciones ambientales que además pongan en riesgo directo la salud de las personas, o el acceso o calidad del agua; los casos de violaciones groseras y directas al ambiente y en los cuales se constate una palmaria ausencia de la protección por parte de las autoridades estatales, siempre y cuando además la naturaleza del reclamo permita ser abordado mediante el instrumento del amparo como instituto procesal sumario y especial, ya que estimo que tampoco se debe “ordinariar” el amparo para abordar, aún en estos casos citados, temas que rebasen la capacidad de ser atendidos adecuadamente en el mismo.
En el caso concreto, se observa que la situación planteada se ubica dentro tales casos de excepción pues se hace referencia a supuesta amenaza a las fuentes de agua potable para consumo humano, susceptibles de afectarse por la inercia o acciones erradas de la administración; de tal modo en esta situación concuerdo con la mayoría en que este Tribunal debe conocer y decidir sobre el fondo de este caso, tal y como se ha hecho.
En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusa la posible afectación de un manto acuífero, lo que afecta a las poblaciones cercanas, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
