*170203060007CO* Decision No. 2018001185 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine thirty a.m. on veintiseis de enero de dos mil dieciocho.
Amparo proceeding (recurso de amparo) processed under case number 17-020306-0007-CO, filed by JOSÉ ANTONIO CHÁVES VILLALOBOS, identity card number 0203960191, against the MINISTERIO DE SALUD.
Findings of Fact (Resultando):
He indicates that professionals specializing in the matter at the different management levels of this Ministry have also been consulted, which is why the petitioner refers in the appeal to official communications DPAH-UASSAH-2702 and HPAH-UASSAH-3166-2017, issued respectively on 31 de agosto and 9 de octubre de 2017, both signed by Engineer Ana Villalobos Villalobos, Head of the Unidad de Administración de Servicios de Salud en Ambiente Humano. He adds that the recommendations contained in those communications are being addressed both by the company Mediclean CR and by this Área Rectora through health orders whose compliance periods had not expired as of the date of the report. He states that the protected party (amparado) filed an extraordinary appeal for review (recurso extraordinario de revisión) against sanitary operating permit number 1164-16, issued by the respondent authority (autoridad recurrida) for industrial laundry service operations under the name of the developer TDM Ambiental S.A. He mentions that the appeal was dismissed as inadmissible through decision (resolución) DM-CB-7871-17, in which the Acting Minister of Health and Head of the Health, Nutrition and Sports Sector dismissed the appeal not only for the reasons stated in that decision, but also because the company’s sanitary operating permit had been issued in accordance with the law.
He contends that, regarding the response to the appeal for review, decision No. DM-CB-7871-2017, dated 12 de diciembre de 2017, clarified to the petitioner that, pursuant to Article 353 of the Ley General de la Administración Pública, the filing of an appeal for review requires the occurrence of one of the following circumstances: “a) When, in issuing them, a manifest error of fact was committed that is apparent from the documents included in the case file; b) When documents of essential value to the resolution of the matter emerge that were unknown when the decision was issued or could not then have been submitted for inclusion in the case file; c) When the act was materially influenced by documents or testimony declared false by a final court judgment issued before or after the act, provided that, in the former case, the interested party was unaware of the declaration of falsity; and d) When the act was issued as a result of malfeasance, bribery, violence, or other fraudulent scheme and such circumstance has been so declared by a court judgment.” He explains that, upon analyzing that appeal, none of the aforementioned requirements was met, in addition to the fact that the petitioner was not a party to the proceeding and therefore lacked standing (legitimación) to file any appeal.
He contends that, in resolving that appeal, the petitioner was urged, if he knew of any irregularity involving the company or its operations, to file a complaint with the corresponding Área Rectora de Salud in accordance with the established procedure, because the respondent authority cannot intervene in a company merely because the petitioner disagrees with the issuance of the laundry’s sanitary operating permit, since the company fully complies with the documentation required for issuance of that permit and its operations have been monitored through the corresponding health orders. They request that the appeal be denied.
Justice Garro Vargas authored the opinion; and, Whereas (Considerando):
I.Subject matter of the appeal. The petitioner alleges that on 4 de octubre de 2017 he filed an extraordinary appeal for review with the respondent authority because he considered that the company Mediclean CR did not comply with the sworn statement (declaración jurada) supporting the sanitary operating permit. However, through official communication DM-CB-7871-17, rather than addressing the substance of the matter, the appeal was dismissed as inadmissible, and it was determined that he lacked standing to file any appeal concerning the issuance of the sanitary operating permit; nevertheless, it was acknowledged that the matter was environmental in nature.
1. On 12 de setiembre de 2016, the Área Rectora de Salud Alajuela 1 received documentation concerning Mediclean CR Lavandería’s application for a sanitary operating permit to conduct laundry operations (see report of the respondent authority).
2. According to official communication CN-URS-0961-2016 of 30 de setiembre de 2016, the inspection conducted at Mediclean CR-División Lavandería Industrial y Sanitaria established that it had occupational health, emergency response, and solid- and liquid-waste management plans, as well as protocols for cleaning and disinfecting equipment, vehicles, and facilities; personal protective equipment manuals; and work procedures. It had also implemented a wastewater (aguas residuales) pretreatment system to reduce detergent use, and the energy-consumption system to be used would involve ozonation, among other benefits, as well as the use of biodegradable detergents to reduce environmental pollution (see attached evidence).
3. Through decision No. 1618-2016-SETENA issued at 9:30 on 2 de setiembre de 2016, SETENA granted environmental clearance (viabilidad ambiental) to the Industrial Laundry Service project processed under administrative case file No. D1-17547-2016-SETENA (see attached evidence).
4. On 6 de octubre de 2016, the Área Rectora de Salud Alajuela 1 issued sanitary operating permit number 1164-16 for the activity of “Industrial Laundry Service” under the name Mediclean CR Lavandería, expiring on 6 de octubre de 2021 (see report of the respondent authority).
5. Through health order No. CZ-068-2017 of 3 de julio de 2017, the company Mediclean was ordered to submit the following documentation within 5 business days: “A. Sampling at the pretreatment water outlet before it enters the sewer system of the free-trade zone’s wastewater treatment plant. B. Submit a report on the pretreatment system including, at a minimum, the design calculations and information on its operation and maintenance. C. Submit a sketch (plan) detailing the entire pretreatment system of the company you represent” (see attached evidence).
6. On 4 de octubre de 2017, the protected party filed an extraordinary appeal for review with the respondent authority because he considered that the company did not comply with the sworn statement supporting the sanitary operating permit, alleging that the wastewater was not adequately treated and was therefore polluting Río Segundo. He requested that an effective process be established to review the documentation submitted, that the applicable regulations be enforced under the classification of special wastewater (aguas especiales) (CIUU 9301), and that the sanitary operating permit be suspended until the requirements of Article 15 of Decreto Ejecutivo 33601-S-MINAE were satisfied (see attached evidence).
7. Through health order No. CZ-090-2017 of 1 de noviembre de 2017, the company Mediclean was ordered to submit the following documentation within 15 calendar days: “A. Obtain authorization for the preliminary treatment system from the competent entity, based on its complexity, type of process, and the raw materials used by the company you represent at the laundry in question, as established by Decreto 33601-S-MINAE. B. Submit to this Área Rectora de Salud an operating report on the wastewater generated by the operations of the company you represent, based on the current flow rate; pursuant to Decreto 33601-S-MINAE, it must be submitted every six months. The operating reports must include laboratory reports containing the results for the universal parameters and for the supplementary parameters of phosphates and hydrocarbons, for review and assessment under Tables 2 and 3 of Decreto 33601-S-MINAE. C. Clarify for this Área Rectora de Salud the location where the sample was taken for the operating report submitted to this Área Rectora de Salud and received on 10 de Julio del 2011, chemical-analysis results report N° l0072017” (see attached evidence).
8. On 12 de diciembre de 2017, the respondent authority dismissed the appeal filed by the petitioner through decision DM-CB-7871-17 because the petitioner was not a party to the proceeding and therefore lacked standing to file any appeal; none of the circumstances specified in Article 353 of the Ley General de Administración Pública was present; the company’s sanitary operating permit had been issued in accordance with the law; and, if he was aware of any irregularity, the proper course was to file a complaint (see attached evidence).
9. By sanitary order (orden sanitaria) No. CZ-0004-2018 dated 9 de enero de 2018, the following was decided: “l. Mediclean’s wastewater (aguas residuales) operational reports are accepted, and the administrator is hereby warned to correct section 2 in future operational reports submitted to this Área Rectora de Salud. 2. The construction plans (planos constructivos) are rejected and, therefore, the project must be processed as a Survey, Remodeling and/or Expansion, under the classification of wastewater treatment systems for other uses established in the APC, and all requirements established in chapter 3 of Decreto 39887-S-MINAE must be attached. In view of the foregoing and in compliance with official communications CN-URS-950-2017 and CN-URS-0942-2017, fifteen calendar days are granted for submission to this Área Rectora de Salud of the items required under point two of this sanitary order” (see attached evidence).
10. By sanitary order No. CZ-0005-2018 dated 9 de enero de 2018, the company Mediclean was ordered to submit the following documentation within 15 calendar days: “l. Submit the construction plans and corresponding documentation through the APC platform of the Colegio Federado del Ingenieros y Arquitectos, in accordance with Decreto 36550-MP-MlVAH-S-MEIC, for the preliminary system present at the establishment, which must address the observations and conclusions set forth, in compliance with Decreto 39887-S-MINAE, Reglamento de Aprobación de Sistemas de Tratamiento de Aguas Residuales. 2. Continue submitting wastewater operational reports in accordance with the Reglamento de Vertidos y Reúso de Aguas Residuales under Decreto 33601-S-MINAE” (see attached evidence).
11. At the time the challenged authority submitted its report to this Court, Mediclean CR-División Lavandería Industrial y Sanitaria still had time to comply with the sanitary orders issued by the challenged Área Rectora de Salud (see report submitted under oath).
IV.Regarding the specific case. The petitioner considers that the challenged authority violated his fundamental rights because, he alleges, he filed an extraordinary motion for review (recurso extraordinario de revisión) concerning the issuance of the health operating permit (permiso sanitario de funcionamiento) to Mediclean CR-División Lavandería Industrial y Sanitaria; however, it was rejected for lack of standing (falta de legitimación), despite the environmental impact. The record shows that, on 6 de octubre de 2016, Área Rectora de Salud Alajuela 1 issued health operating permit number 1164-16 for the activity of “Industrial laundry service” to Mediclean CR Lavandería, expiring on 6 de octubre de 2021, because at that time it had demonstrated compliance with the requirements. It was not until one year later, on 4 de octubre de 2017, that the petitioner filed an extraordinary motion for review, arguing that the company was not complying with the sworn statement supporting the health operating permit because, he alleged, the wastewater was not being treated properly and was therefore polluting Río Segundo.
He requested the establishment of an effective process for reviewing the documentation submitted, the application of the relevant regulations under the classification of special wastewater (CIUU 9301), and the suspension of the health operating permit until the provisions of artículo 15 of Decreto Ejecutivo 33601-S-MINAE were satisfied. Indeed, by decision DM-CB-7871-17 dated 12 de diciembre de 2017, the challenged authority rejected the petitioner’s motion, informing him that he was not a party to the proceeding, that the circumstances set forth in artículo 353 of the Ley General de Administración Pública were not present, because the company’s health operating permit had been issued in accordance with law, and that, if he was aware of any irregularity, the appropriate course was to file a complaint. Thus, although he was indeed informed that he was not a party to the proceeding, the motion was rejected on substantive grounds in point 5 of that decision, which addressed the conditions under which the permit had been issued at that time and found it to be lawful.
The foregoing warrants two clarifications: first, pursuant to artículo 105 of the Ley de Biodiversidad, environmental matters are subject to what is known as a popular action (acción popular). According to that provision, “Every person has standing in administrative or judicial proceedings to defend and protect biodiversity.” Therefore, the motion in question should not have been rejected on the basis that the protected party lacked standing. This does not mean that proceedings already closed may be reopened or reviewed unless the conditions established by law itself are met, such as the circumstances specified in artículo 353 of the Ley General de Administración Pública, a discussion of which would require an analysis of mere legality in light of the protected party’s disagreement with the decision rendered therein. Second, it is unacceptable that, after determining that the avenue identified by the challenged authority was unavailable, and despite the protected party’s warning that a company was not properly treating its wastewater and was discharging polluted water into a river, the authority did not itself direct the complaint to the appropriate proceeding so that the environment and the protected party’s rights could be safeguarded in a timely manner.
Accordingly, regardless of whether a motion for review may be brought against a health operating permit, the fact remains that the protected party reported a possible environmental violation that must be addressed by the challenged authority through whatever avenue it deems appropriate, with any precautionary measures (medidas cautelares) and consequences that may ultimately arise from the outcome thereof. For the reasons stated, the petition is granted, with the consequences indicated below.
V.Separate reasoning by Justice Jinesta Lobo regarding the rejection of the motion for review for lack of standing. The undersigned Justice agrees that this part of the petition should be granted, but for the following reason: First, I must clarify that although I refer environmental matters involving administrative intervention of any kind to the contentious-administrative jurisdiction (jurisdicción contencioso administrativa), I will not do so in cases involving complaints alleging improper or incorrect disposal of wastewater. This is because other rights of those living near the source of the pollution are at stake, such as health and the right to enjoy a dignified quality of life. In the case at bar (sub lite), it was fully and properly established that Área Rectora de Salud Alajuela 1 rejected the motion for review submitted by the petitioner because it considered that he lacked standing, as he was not a party to the respective proceeding.
The protected party sought to challenge the sworn statement supporting the health operating permit granted to a company because, he asserts, the wastewater is not being treated properly and is polluting Río Segundo. Pursuant to paragraph 2° of artículo 50 of the Constitución Política: “(…) Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that infringe that right and to seek compensation for the harm caused (...)”. Under that constitutional provision, because this matter concerns an environmental issue, I consider that the motion should not have been rejected for lack of standing.
VI.Justice Hernández López dissents (voto salvado) with respect to the claim alleging a violation of artículo 50 of the Constitución Política.
1. The historical context that once prompted the Court’s extensive intervention in environmental matters has changed considerably, requiring this body to reconsider the conditions governing its involvement in safeguarding the right of persons to a healthy and balanced environment, as protected under artículo 50 of the Constitución Política. Indeed, the current situation—characterized by extremely extensive statutory and regulatory enactments that include substantive rules, procedures, and the creation of bodies charged with ensuring compliance with the Fundamental Charter—is radically different from the prior situation, in which the absence of regulations and state bodies with appropriate authority compelled the Court to assume a leading, virtually exclusive role in defending the aforementioned constitutional right.
2. Today, we face a “dense web” of environmental regulations—as Justice Jinesta Lobo aptly described it in his dissenting opinion on this issue—which has produced two significant phenomena: the first and most obvious is the emergence of comprehensive legal regulation of activities whose impact on the environment had previously been subject to little or no regulation, as well as the creation of state bodies with powers to monitor and control the effects of human activity on the environment. The second phenomenon is that this increasing legalization—predominantly through statutes and regulations—necessarily entails the involvement of both administrative justice and the ordinary courts, primarily the contentious-administrative courts, but also the criminal courts. Consistent with the importance of environmental law, broad procedural avenues and inclusive means of establishing standing have been established within those jurisdictions so that members of the public may enforce the provisions of the extensive legal framework concerning environmental matters.
3. In that context, it is neither legally nor functionally appropriate for the Constitutional Court to displace—or, worse still, replace—the ordinary judicial bodies in carrying out their task, which is also constitutional in nature, of ensuring effective compliance with statutes and regulations. It is legally improper because, in the vast majority of these cases, the Court is asked to interpret and enforce statutory and regulatory provisions, thereby risking an overlap between its jurisdiction and that of other judicial bodies specifically created to perform those tasks; it is also functionally unsound because the design of its proceedings is ill-suited to the complexity present in numerous environmental disputes involving series of technically and legally complex facts and acts. Well-known examples exist regarding both issues in which the Court has issued a partial or technically incomplete decision, or in which unnecessary friction and harm to legal certainty have resulted.
4. Among the technical considerations I have assessed, I would add that this jurisdiction lacks judges responsible for enforcing judgments who could adequately monitor compliance with those judgments—which are generally complex—and which sometimes entail monitoring remediation plans, among other measures, involving interinstitutional coordination and follow-up lasting months or even years.
5. From that perspective, this Court’s decision to step aside in environmental matters should not be viewed as an abandonment of environmental matters, but rather, on the contrary, as ensuring their proper protection in the forum best suited to the nature of their complexity and diversity. Nor should it be viewed as this forum’s relinquishment of its task of protecting the constitutional rights entrusted to it by the Political Constitution and its Organic Law, which, in my view, remains reserved in this area for specific cases. Instead, it is an exercise in reallocating the burdens and duties assigned to the various State bodies, so that each may fully perform its work within its assigned sphere, as well as an exercise of determining its own jurisdiction, as established by Article 7 of its Organic Law.
6. It is clear that the Chamber does not intend to leave the task of protecting people’s rights in environmental matters to other jurisdictions. It is well known that, although any claim alleging a violation of statutory and regulatory provisions may be brought within the constitutional sphere, there are cases whose resolution requires nothing more than the application of constitutional law. The aim, then, is for the Chamber to become one of several leading participants, so that—collectively, and each within its own sphere—the full range of situations involved in protecting the right to a healthy and ecologically balanced environment may be addressed within a society in which other equally pressing needs also exist. With this position, I firmly believe that citizens do not lose the slightest degree of protection, while substantial gains are made in breadth, perspective, and respect for the balance and distribution of powers, the latter being a principle that must necessarily be considered because it governs the constitutional dynamics of any liberal and democratic system such as ours.- 7.
Consistent with the foregoing, I maintain that this Chamber should refrain from hearing claims submitted to it for alleged violation of Article 50 of the Political Constitution, leaving them to be heard by the administrative adjudicatory bodies and the administrative litigation jurisdiction (jurisdicción contenciosa administrativa). The foregoing is stated as a general rule, without prejudice to recognizing the existence of particular cases or groups of cases that, in my opinion, would still be better protected by this Chamber and should therefore be heard and decided by it.- Among such groups of cases, and without this enumeration being regarded as a closed and definitive list, I would note that the Chamber should retain jurisdiction over situations such as claims involving environmental violations that also directly endanger people’s health or access to or the quality of water; cases involving gross and direct violations of the environment in which there is an evident lack of protection by State authorities, provided also that the nature of the claim allows it to be addressed through the constitutional protection proceeding (recurso de amparo), as a summary and special procedural mechanism, because I believe that the proceeding should not be converted into an ordinary proceeding to address, even in the cases cited, matters that exceed its capacity to deal with them adequately.
8. In this specific case, according to the facts established as proven, none of the exceptions mentioned is present, and the situation raised falls within those cases in which recourse to the Administration’s protective mechanisms and the ordinary courts provides a broader and more comprehensive avenue for addressing the matter under discussion, which involves extensive evidence, monitoring, and studies that exceed the scope of the constitutional protection proceeding. Accordingly, Article 9 of the Constitutional Jurisdiction Law (Ley de la Jurisdicción Constitucional) should have been applied and the petition summarily dismissed; nevertheless, because this did not occur, the constitutional protection petition must now be denied.
VII.Documentation submitted to the case file (expediente). The parties are advised that, if they have submitted any paper document, as well as objects or evidence stored on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the court office within a maximum period of 30 business days from service of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Full Court at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 de enero del 2012, as well as the resolution approved by the Superior Council of the Judiciary at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.
Por tanto:
The petition is granted. María Virginia Murillo Murillo and Henry Gutiérrez Fariñas, respectively Acting Minister of Health and Head of the Health, Nutrition, and Sports Sector, and Acting Director of the Área Rectora de Salud Alajuela 1, or whoever holds those offices, are ordered, within the scope of their authority, immediately to refer the matters reported by the petitioner in the petition filed on 4 de octubre de 2017 to the competent authority so that they may be investigated and decided, and the protected party notified of the outcome, within no more than two months from service of this judgment. The foregoing is ordered with the warning that, as established by Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in a constitutional protection proceeding that the person must comply with or cause to be complied with, and who fails to comply with it or cause it to be complied with, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The State is ordered to pay the legal costs, damages, and losses caused by the events underlying this ruling, which shall be quantified during enforcement of the judgment before the administrative litigation jurisdiction. This decision shall be served personally on María Virginia Murillo Murillo and Henry Gutiérrez Fariñas, respectively Acting Minister of Health and Head of the Health, Nutrition, and Sports Sector, and Acting Director of the Área Rectora de Salud Alajuela 1, or whoever holds those offices. Recurso de amparo que se tramita en expediente número 17-020306-0007-CO, interpuesto por JOSÉ ANTONIO CHÁVES VILLALOBOS, cédula de identidad número 0203960191, contra el MINISTERIO DE SALUD.
Resultando:
Redacta la Magistrada Garro Vargas; y,
Considerando:
I.Objeto del recurso. El recurrente acusa que el 4 de octubre de 2017 presentó ante la autoridad recurrida un recurso extraordinario de revisión, por considerar que la empresa Mediclean CR no cumple con la declaración jurada que sustenta el permiso sanitario de funcionamiento. Empero, por oficio DM-CB-7871-17, lejos de entrar a conocer el tema, se rechazó por improcedente el recurso, y se determinó que no se encontraba legitimado para interponer recurso alguno sobre la emisión del permiso sanitario de funcionamiento; no obstante, se reconoce que se está ante un asunto de carácter ambiental.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
1. El 12 de setiembre de 2016, se recibió en el Área Rectora de Salud Alajuela 1, documentación referente con la solicitud del permiso sanitario de funcionamiento de parte de la empresa Mediclean CR Lavandería para desarrollar la actividad de lavandería (ver informe de la autoridad recurrida).
2. Según oficio CN-URS-0961-2016 del 30 de setiembre de 2016, de la inspección realizada a Mediclean CR-División Lavandería Industrial y Sanitaria, se pudo determinar que esta cuenta con los planes de salud ocupacional, atención de emergencias, de manejo de residuos sólidos y líquidos, además de protocolos de limpieza y desinfección de los equipos, vehículos, de instalaciones, así como manuales de protección personal, procedimiento de trabajo, y además, implementó un sistema de pre-tratamiento de las aguas residuales para reducir el uso de detergentes, y el consumo de energía que se utilizará será un sistema de ozonización entre otros beneficios, uso de detergentes biodegradables para reducir !a contaminación ambiental (ver prueba adjunta).
3. Por resolución No. 1618-2016-SETENA de las 9:30 horas del 2 de setiembre de 2016, SETENA le otorgó la viabilidad ambiental al proyecto de Servicio de Lavandería Industrial, tramitado en el expediente administrativo No. D1-17547-2016-SETENA (ver prueba adjunta).
4. El 6 de octubre de 2016, el Área Rectora de Salud Alajuela 1 procedió a otorgar el permiso sanitario de funcionamiento número 1164-16 para la actividad de “Servicio de lavandería Industrial”, a nombre de Mediclean CR Lavandería con vencimiento el 6 de octubre de 2021 (ver informe de la autoridad recurrida).
5. Por orden sanitaria No. CZ-068-2017 del 3 de julio de 2017, se ordenó a la empresa Mediclean entregar la siguiente documentación en 5 días hábiles: “A. Muestreo a la salida de agua del pretratamiento previo a la entrada al alcantarillado de la planta de tratamiento de aguas residuales de la zona franca. B. Presentar informe del sistema de pretratamiento que incluya como mínimo memoria de cálculo, operación y mantenimiento. C. Presentar croquis (plano) con detalle de todo el sistema de pretratamiento de la empresa que usted representa” (ver prueba adjunta).
6. El 4 de octubre de 2017, el amparado interpuso ante la autoridad recurrida un recurso extraordinario de revisión, por considerar que la empresa no cumple con la declaración jurada que sustenta el permiso sanitario de funcionamiento, por cuanto aduce que las aguas residuales no son tratadas adecuadamente y que, por ende, están contaminando al Río Segundo. Solicitó que se estableciera un proceso efectivo de revisión de la documentación presentada, que se aplicara la normativa pertinente bajo el concepto de aguas especiales (CIUU 9301), y que se suspendiera el permiso sanitario de funcionamiento, hasta tanto se cumpla lo dispuesto en el artículo 15 del Decreto Ejecutivo 33601-S-MINAE (ver prueba adjunta).
7. Por orden sanitaria No. CZ-090-2017 del 1 de noviembre de 2017, se ordenó a la empresa Mediclean entregar la siguiente documentación en 15 días calendario: “A. Tramitar ante la entidad competente permiso del sistema de tratamiento preliminar, según su complejidad, tipo de proceso y materias primas utilizadas por su representada en la Lavandería en mención, según lo establece el Decreto 33601-S-MINAE. B. Presentar ante esta Área Rectora de Salud reporte operacional de las aguas residuales que se generan de la actividad de su representada según el caudal actual y de acuerdo lo establece el Decreto 33601-S-MINAE será semestralmente su presentación. Los reportes operacionales deben incluir los informes de laboratorio con los resultados de los parámetros universales y de los parámetros complementarios fosfatos e hidrocarburos para su revisión y valoración de tablas 2 y 3, Decreto 33601-S-MINAE. C. Aclarar ante esta Área rectora de Salud el sitio donde se realizó la toma de muestra del reporte operacional presentado ante esta Área Rectora de Salud con fecha recibido 10 de Julio del 2011, Informe resultado de análisis químico informe N° l0072017” (ver prueba adjunta).
8. El 12 de diciembre de 2017, el recurso planteado por el recurrente se rechazó por la autoridad recurrida, mediante resolución DM-CB-7871-17, pues el recurrente no era parte del proceso, por ello, no se encontraba legitimado para la interposición de ningún recurso, no se presentaban los supuestos del artículo 353 de la Ley General de Administración Pública, pues el permiso sanitario de funcionamiento de la empresa había sido emitido conforme a derecho y que, si tenía conocimiento de alguna irregularidad, lo procedente era que interpusiera la denuncia (ver prueba adjunta).
9. Por orden sanitaria No. CZ-0004-2018 del 9 de enero de 2018, se resolvió lo siguiente: “l. Se aceptan los reportes operacionales de aguas residuales de Mediclean y se le apercibe al administrador corregir la sección 2 en los futuros reportes operacionales a presentar ante esta Área rectora de Salud. 2. Se rechazan la presentación de los planos constructivos y por tanto deberá de tramitar como Levantamiento, remodelación y/o Ampliación, bajo clasificación de sistemas de tratamiento de aguas residuales otros usos, estipulados en el APC, y poder adjuntar todos los requisitos que establece el capítulo 3 del Decreto 39887-S-MINAE. Por lo antes descrito y en acato a los oficios CN-URS-950-2017 y CN-URS-0942-2017 se le otorgan quince días calendario para que presente ante esta Área Rectora de Salud lo requerido en el punto dos de esta Orden sanitaria”(ver prueba adjunta).
10. Por orden sanitaria No. CZ-0005-2018 del 9 de enero de 2018, se ordenó a la empresa Mediclean entregar la siguiente documentación en 15 días calendario: “l. Presentar los planos constructivos y documentación respectiva ante la plataforma APC del Colegio Federado del Ingenieros y Arquitectos, de acuerdo a lo establece Decreto 36550-MP-MlVAH-S-MEIC, del sistema preliminar presente en el establecimiento el cual debe contemplar las observaciones y conclusiones Sistemas de Tratamiento de Aguas Residuales. 2. Mantener la presentación de los reportes operacionales de aguas residuales, de acuerdo al Reglamento de Vertidos y Reúso de Aguas Residuales en el Decreto 33601-S-MINAE” (ver prueba adjunta).
11. Al momento de rendir el informe la autoridad recurrida a este Tribunal, la empresa Mediclean CR-División Lavandería Industrial y Sanitaria tenía plazo para cumplir las órdenes sanitarias dictadas por el área recurrida (ver informe rendido bajo juramento).
IV.Sobre el caso concreto. El recurrente considera que la autoridad recurrida ha vulnerado sus derechos fundamentales, por cuanto acusa haber interpuesto un recurso extraordinario de revisión del otorgamiento del permiso sanitario de funcionamiento a la empresa Mediclean CR-División Lavandería Industrial y Sanitaria; sin embargo, se rechazó el mismo por falta de legitimación, a pesar de afectar al ambiente. Del estudio de los autos se tiene que, desde el 6 de octubre de 2016, el Área Rectora de Salud Alajuela 1 procedió a otorgar el permiso sanitario de funcionamiento número 1164-16 para la actividad de “Servicio de lavandería Industrial”, a nombre de Mediclean CR Lavandería con vencimiento el 6 de octubre de 2021, por haber demostrado en aquella oportunidad el cumplimiento de los requisitos. No es sino un año después, que el recurrente interpone el 4 de octubre de 2017, un recurso extraordinario de revisión, por considerar que la empresa no cumple con la declaración jurada que sustenta el permiso sanitario de funcionamiento, por cuanto aduce que las aguas residuales no son tratadas adecuadamente y que, por ende, están contaminando al Río Segundo.
Solicitó que se estableciera un proceso efectivo de revisión de la documentación presentada, que se aplicara la normativa pertinente bajo el concepto de aguas especiales (CIUU 9301) y que se suspendiera el permiso sanitario de funcionamiento, hasta tanto se cumpla lo dispuesto en el artículo 15 del Decreto Ejecutivo 33601-S-MINAE. Efectivamente, por resolución DM-CB-7871-17 del 12 de diciembre de 2017, el recurso planteado por el recurrente fue rechazado por la autoridad recurrida, indicándole que no era parte en el proceso, que no se presentaban los supuestos del artículo 353 de la Ley General de Administración Pública, pues el permiso sanitario de funcionamiento de la empresa había sido emitido conforme a derecho y que, si tenía conocimiento de alguna irregularidad, lo procedente era que interpusiera la denuncia. De manera que, aun cuando en efecto se le indicó que no era parte procesal, el recurso fue rechazado por aspectos de fondo en el punto 5 de dicha resolución, al entrar a pronunciarse sobre las condiciones en que se emitió dicho permiso en aquella oportunidad, considerándolo ajustado a derecho.
Lo anterior amerita realizar dos precisiones al respecto: la primera, es que de conformidad con lo dispuesto en el artículo 105 de la Ley de Biodiversidad, en materia ambiental existe lo que se denomina una acción popular. Según ese ordinal, “Toda persona está legitimada en sede administrativa o jurisdiccional, en defensa y protección de la biodiversidad” . De manera que, no procedía el rechazo del recurso en cuestión basado en la falta de legitimación del amparado. Ello no quiere decir que puedan reabrirse o revisarse procesos ya archivados, si no se cumplen las condiciones establecidas por la propia ley, tal como lo supuestos señalados en el artículo 353 de la Ley General de Administración Pública, cuya discusión ya implicaría realizar un análisis de mera legalidad frente a la disconformidad del tutelado con lo ahí resuelto. Y en segundo orden, es inaceptable que ante la improcedencia de la vía señalada por la autoridad recurrida, a pesar de que el tutelado está advirtiendo que una empresa no está tratando adecuadamente sus aguas y las vierte contaminadas a un río, no diligencie por sí misma dicha denuncia al trámite que corresponda, a los efectos de que el ambiente y los derechos del amparado sean tutelados oportunamente.
Así las cosas, independientemente de que proceda o no un recurso de revisión contra el permiso sanitario de funcionamiento, lo cierto es que el tutelado denunció una posible violación ambiental que debe ser tutelada por la autoridad recurrida por la vía que estime pertinente, con las medidas cautelares y consecuencias que, eventualmente, del resultado de esta se deriven. En razón de lo expuesto, procede el recurso interpuesto con las consecuencias que se indican a continuación.
V.Razones diferentes del Magistrado Jinesta Lobo, en lo que respecta al rechazo del recurso de revisión, por falta de legitimación. El suscrito Magistrado coincide con la estimatoria de este extremo del recurso, pero, por lo siguiente: En primer lugar, debo aclarar que si bien los asuntos ambientales, cuando hay intervención administrativa de cualquier índole, los remito a la jurisdicción contencioso administrativa, lo cierto es que tratándose de denuncias donde se alega mala o incorrecta disposición de aguas residuales, no lo haré así. Esto, por cuanto, se encuentran en juego otros derechos de los vecinos de la fuente contaminante, tales como la salud y a gozar de un nivel digno de calidad de vida. Ahora bien, en el sub lite quedó plena e idóneamente demostrado que el Área Rectora de Salud Alajuela 1, rechazó el recurso de revisión presentado por el recurrente, por considerar que carecía de legitimación, al no ser parte en el procedimiento respectivo.
El tutelado pretendía cuestionar la declaración jurada que sustenta el permiso sanitario de funcionamiento otorgado a una empresa, por cuanto, asegura las aguas residuales no son tratadas, adecuadamente, y están contaminando el río Segundo. De conformidad con lo dispuesto por el párrafo 2° del artículo 50 de la Constitución Política: “(…) Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello, está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado (...)”. Conforme a esa norma constitucional, al versar el presente asunto sobre un tema ambiental, considero no procedía el rechazo del recurso, por falta de legitimación.
VI.Voto salvado la Magistrada Hernández López respecto del reclamo por infracción del artículo 50 de la Constitución Política.
1. El contexto histórico que motivó en su momento la amplia intervención de la Sala en materia ambiental, ha tenido una considerable variación que impone a este órgano reconsiderar las condiciones para su participación en el aseguramiento del derecho de las personas a un ambiente sano y equilibrado, tal y como ha sido tutelado en el artículo 50 de la Constitución Política. En efecto, la situación actual –caracterizada por una amplísima producción legal y reglamentaria que incluye reglas de fondo, procedimientos y creación de órganos para el cumplimiento de lo ordenado en la Carta Fundamental- es radicalmente diferente de la anterior, en la cual la ausencia de normativa y de instancias estatales con competencia apropiada, le impuso a la Sala un papel de protagonista, casi único, en la defensa del precitado derecho constitucional.
2. Hoy en día, nos encontramos frente a un “denso entramado” de normativa ambiental –tal y como acertadamente lo ha descrito el Magistrado Jinesta Lobo en su voto salvado sobre este tema- lo cual ha producido dos fenómenos relevantes: el primero y más obvio, es el surgimiento de una abarcadora regulación jurídica respecto de actividades cuya incidencia en el ambiente estaba poco o nada ordenada, así la creación de órganos estatales con potestades de vigilancia y control sobre los efectos de la actividad humana en el entorno. El segundo fenómeno consiste en que esa creciente juridificación –predominantemente legislativa y reglamentaria– trae aparejada una ineludible entrada en escena tanto de la justicia administrativa como de la jurisdicción ordinaria -prioritariamente la contencioso administrativa, pero también la penal. En ellas, acorde con la importancia del derecho ambiental, se han regulado de forma amplia vías procesales y medios de legitimación incluyentes, de manera que los administrados puedan hacer valer lo establecido en ese amplio orden jurídico que se relaciona con el tema ambiental.
3. En ese contexto, no resulta apropiado jurídicamente, ni desde el punto de vista funcional, que la Sala Constitucional desplace, o -peor aún- sustituya, a los órganos de justicia ordinarios en la realización de su tarea, también de rango constitucional, de velar por el efectivo cumplimiento de leyes y reglamentos. Es impropio jurídicamente porque en la inmensa mayoría de estos casos lo que se solicita es que interprete y haga valer normas legales y reglamentarias con lo que arriesga traslapar sus competencias con las de otros órganos jurisdiccionales que –ellos sí- han sido creados para ejecutar tales tareas; y resulta también funcionalmente incorrecto, porque el diseño de sus procesos se aviene mal con la complejidad que está presente en numerosos conflictos ambientales que se componen de series de hechos y actos técnica y jurídicamente complejos. Sobre ambas cuestiones existen conocidos ejemplos en los que la Sala ha arrojado una resolución a medias o técnicamente incompleta, o bien se han generado fricciones innecesarias y afectación de la seguridad jurídica.
4. Como parte de los aspectos técnicos que he valorado, añado que está el hecho de que esta jurisdicción no cuenta con jueces ejecutores de sentencia que permitan darle seguimiento adecuado a las mismas -generalmente complejas-, que implican en ocasiones el seguimiento de planes remediales, entre otros, con coordinación interinstitucional y seguimiento de meses y hasta años.
5. Desde esa perspectiva, la decisión de dar un paso al lado en la materia ambiental por parte de este Tribunal no debe ser vista como un abandono de la materia ambiental, sino al contrario, de su adecuada tutela en la instancia que mejor se aviene a la naturaleza de su complejidad y diversidad. Asimismo tampoco debe ser visto como la declinación de esta instancia en su tarea de protección de los derechos constitucionales que le imponen la Constitución Política y su Ley Orgánica, que desde mi punto de vista, queda reservada en esta materia para casos específicos. Se trata más bien, de un ejercicio de reacomodo de las cargas y tareas que corresponden a los distintos órganos estatales, de manera que cada uno de ellos, pueda desplegar plenamente su labor dentro del ámbito que se le ha asignado, así como del ejercicio de fijar su propia competencia, según lo establece el artículo 7 de su Ley Orgánica.
6. Queda claro que la Sala no se plantea abandonar a otras jurisdicciones la labor de protección de los derechos de las personas en materia ambiental. Es conocido que si bien todo reclamo por infracción de normas legales y reglamentarias puede ser reconducido hasta el ámbito constitucional, existen casos cuya resolución no exige más que la aplicación del derecho de la Constitución. Se trata entonces de lograr que la Sala se convierta en protagonista junto con otros, de manera que –entre todos y cada uno en su espacio- se pueda cubrir toda la variedad de situaciones que presenta una protección del derecho a un medio ambiente sano y equilibrado dentro de una sociedad en la que también existen otras necesidades igual de acuciantes. Con esta posición creo firmemente que el ciudadano no pierde un ápice de protección pero se gana sustancialmente en amplitud, en perspectiva y en respeto al equilibrio y distribución de poderes, principio este último de obligada consideración, puesto que rige la dinámica constitucional de cualquier sistema liberal y democrático como el nuestro.- 7.
En línea con lo anterior, sostengo que esta Sala debe abstenerse de conocer los reclamos que se le presenten por supuesta infracción al artículo 50 de la Constitución Política para dejar en manos de la justicia administrativa y la jurisdicción contenciosa administrativa su conocimiento. Lo anterior se deja afirmado con carácter general, sin perjuicio de reconocer la existencia de casos particulares o grupos de casos que, según mi criterio, si resultarían aún mejor tutelados por esta Sala y por tanto deben ser conocidos y resueltos por ella.- Dentro de tales grupos de casos, y sin que esta enunciación pueda considerarse como una lista cerrada y definitiva, puedo señalar que la Sala debe reservarse el conocimiento de situaciones como por ejemplo los reclamos por infracciones ambientales que además pongan en riesgo directo la salud de las personas, o el acceso o calidad del agua; los casos de violaciones groseras y directas al ambiente y en los cuales se constate una palmaria ausencia de la protección por parte de las autoridades estatales, siempre y cuando además la naturaleza del reclamo permita ser abordado mediante el instrumento del amparo como instituto procesal sumario y especial, ya que estimo que tampoco se debe “ordinariar” el amparo para abordar, aún en estos casos citados, temas que rebasen la capacidad de ser atendidos adecuadamente en el mismo.
8. En el caso concreto, de conformidad con los hechos probados no se presenta ninguna de las excepciones que mencionan y la situación planteada se ubica dentro de aquellos casos en las que la intervención de los medios de protección de la Administración y la justicia ordinaria, resultan ser una vía más amplia y completa para el tema discutido, el cual involucra abundante prueba, seguimientos y estudios que exceden el ámbito del amparo. De tal modo, debió aplicarse el artículo 9 de la Ley de la Jurisdicción Constitucional y rechazar de plano el recurso, no obstante, al no haber ocurrido así, procede ahora declarar sin lugar el amparo interpuesto
VII.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a María Virginia Murillo Murillo y a Henry Gutiérrez Fariñas, por su orden Ministra a.i. de Salud y Rectora del Sector Salud, Nutrición y Deporte, y Director a.i. del Área Rectora de Salud Alajuela 1, o a quienes ejerzan esos cargos, que en el ámbito de sus atribuciones, de manera inmediata redireccionen lo denunciado por el recurrente en el recurso planteado el 4 de octubre de 2017, ante la autoridad competente, a fin de que sea verificado, resuelto y notificado dicho resultado al amparado en un plazo no mayor a dos meses, contado a partir de la notificación de esta sentencia. Lo anterior se dicta con la advertencia de que según lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena al Estado al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
