FINDINGS OF FACT (RESULTANDO):
Justice Cruz Castro drafts the opinion; and,
WHEREAS:
The petitioners explain that they are residents of the areas known as Alto de la Casilda, calle Corazón de Jesús, la Cataluña, and Proyecto Jesús de Nazaret. They report the following problems: 1) Irregularities involving the building lines, inspection chambers, curbs, and drainage channels. The streets have not been paved. 2) There is a drainage channel that comes from Alto de la Casilda and borders municipally owned land, into which Fábrica del Valle discharges contaminated water, causing foul odors and the proliferation of insects. The drainage channel has become an open-air garbage dump used by several residents. 3) Despite the request submitted, the Ministerio de Obras Públicas y Transportes has not installed a Bailey bridge in place of the suspension footbridge currently existing in the locality.
The following facts are deemed duly established and relevant to the resolution of this matter, either because they have been proven or because the respondent failed to address them as ordered in the initial ruling:
<![if !supportLists]>a. <![endif]>MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES: The suspension footbridge is located on a road belonging to the cantonal road network (see documentation); <![if !supportLists]>b. <![endif]>MINISTERIO DE SALUD: Before filing this writ of amparo, the petitioners had not submitted any complaint to the Ministerio de Salud (see documentation); <![if !supportLists]>c. <![endif]>MUNICIPALIDAD DE MORAVIA: In the year 2012, the bridge was closed because it presented a hazardous structural condition. Its route did not provide access to healthcare or educational facilities. Alternative exit routes exist with better transportation services (see documentation); <![if !supportLists]>d. <![endif]>MUNICIPALIDAD DE VÁSQUEZ DE CORONADO: 1) The municipal entity is evaluating the road bordering the canton of Moravia, road codes C-1-113 and C-1- 11-149. 2) The Municipalidad continually cleans the open-air dump. Residents deposit the garbage there (see documentation); <![if !supportLists]>e. <![endif]>The Municipalidades de Moravia y Vázquez de Coronado dispute their jurisdiction to serve the areas known as Alto de la Casilda, Calle Corazón de Jesús, La Cataluña, and Proyecto Jesús de Nazaret (see documentation).
One of the guiding principles of administrative organization is the coordination that must exist among all public entities and bodies when exercising their powers and providing the services assigned to them by the legal system. Insofar as it ensures administrative efficiency and effectiveness, coordination is an implicit constitutional principle that permeates the entire body of administrative law and is binding upon all public entities. Coordination may be inter-organizational (interorgánica)—among the various bodies comprising a public entity that are not subject to a hierarchical relationship—or inter-entity (intersubjetiva), that is, among public entities, each having legal personality, its own budget, autonomy, and specific powers. The administrative or other degree of autonomy held by public entities requires them to coordinate their actions, since, owing to their inter-organizational nature, they cannot be reciprocally subject to hierarchical relationships.
The purpose of administrative coordination is to prevent duplication and omissions in the performance of each public entity’s administrative functions, so that those functions are carried out rationally and systematically. Coordination is achieved by establishing fluid and permanent levels or channels of information among public entities, which may be accomplished through meetings, reports, or the creation of formal coordination mechanisms. Thus, in ruling Nº 3404-2005 issued at 18:29 hours on 29 de marzo de 2005, this Chamber held as follows:
“(…) under the coordination principle (principio de coordinación), the State is required to ensure that its entities adopt and implement all measures necessary to organize and harmonize their actions so that administrative management is as expeditious and effective as possible for the benefit of the person subject to the administration. With regard to internal relations within an Administration, this principle refers to the various responsibilities that, in processing a matter from its initial submission through the final decision, fall to different departments, whether or not they are subject to a vertical hierarchical relationship with one another, but which in all cases belong to a single public-law legal entity. In such a situation, the various internal offices of an entity responsible for preparing and deciding certain sub-stages in the processing of applications submitted to it must coordinate with one another in order to ensure an expeditious and effective administrative proceeding (procedimiento administrativo) for the benefit of the citizen. If a delay in any such sub-stage causes an overall delay in the entire proceeding relating to an administrative claim, regardless of the particular liability borne by the body or department directly involved in the delay, the fact remains that the entity as such is likewise responsible for it (…)”
The petitioners, who are residents of the communities of Alto de la Casilda, calle Corazón de Jesús, la Cataluña and Proyecto Jesús de Nazaret, allege that there are irregularities involving the building lines (alineamiento), inspection boxes (cajas registradoras), curbs (cordones) and gutters (caños). The streets have not been paved. The reports submitted by the representatives of the respondent authorities—which are deemed to have been given under oath, with the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for the resolution of the matter duly establish that these communities are located in the border area between the Cantones de Moravia y Vásquez de Coronado. Both municipalities dispute responsibility for addressing the reported problems, as each considers those areas to fall outside its jurisdiction.
In this regard, the Sala finds the arguments put forward by the municipal governments of Moravia and Vásquez de Coronado to be without merit. On the contrary, in accordance with the administrative coordination principle (principio de coordinación administrativa), both municipal entities must take the necessary steps to resolve the problems described by the residents of the communities of Alto de la Casilda, calle Corazón de Jesús, la Cataluña and Proyecto Jesús de Nazaret. It is important to emphasize that the officials of the Municipalidad de Moravia and the Municipalidad de Vásquez de Coronado acknowledge the existence of irregularities involving the building lines, inspection boxes, curbs and gutters, and that the streets in the communities of Alto de la Casilda, calle Corazón de Jesús, la Cataluña and Proyecto Jesús de Nazaret have not been paved. Accordingly, the appropriate course is to grant the petition for constitutional relief (recurso) and order Roberto Zoch Gutiérrez, Alcalde del Cantón de Moravia; Rolando Méndez Soto, Alcalde; the Presidente de la Junta Vial Cantonal; and Ing. Gilbert Benitez Rodríguez, encargado del Departamento de Gestión Ambiental y Coordinación de Inspección, the latter three of the Municipalidad Vázquez de Coronado, or whoever may hold those offices in their stead, to prepare a remedial plan for the matter within the non-extendable period of 2 months, with proper planning and the necessary budgetary provisions for resources so that, subject to the availability thereof, an effective solution to the problem presented may be provided within 2 years following notice of this judgment.
The petitioners allege that a gutter originating in Alto de la Casilda borders municipally owned land where Fábrica del Valle discharges contaminated water, causing foul odors and an infestation of insects. The gutter has become an open-air garbage dump used by several residents. For their part, the Áreas Rectoras de Salud emphatically state that, prior to receiving notice that this petition had been filed, they were unaware of this complaint. Once informed of the situation, they proceeded to take the actions necessary to address the problem. In this regard, the Sala finds no evidence that the petitioners filed any complaint with the authorities of the Ministerio de Salud. Consequently, the respondent authority has not committed any omission contrary to Constitutional Law (Derecho de la Constitución), since no complaint had been filed with that authority. Consistent with the foregoing analysis, this aspect of the petition must be denied because no omissions that violated the fundamental rights of the protected persons have been established. It should be recalled, as this Tribunal held in Judgment No. 2012-018538 at 9:05 a.m. on December 21, 2012, that “this Sala Constitucional is not a forum for processing complaints, and therefore the parties must appear before the Ministerio de Salud to submit the relevant claims.” Consequently, the appropriate course is to deny the petition.
The petitioners allege that, despite the request submitted, the Ministerio de Obras Públicas y Transportes has not installed a Bailey bridge in place of the suspension footbridge located in the community. For their part, the representatives of the Ministerio de Obras Públicas y Transportes explain that the bridge is situated on a road belonging to the cantonal road network (red vial cantonal), and therefore territorial jurisdiction must be determined between the municipalities involved and named as respondents. In light of the foregoing, the Sala rejects the contention that the representatives of the Ministerio de Obras Públicas y Transportes were remiss in their handling of this matter. Consequently, the appropriate course is to deny the petition.
The petitioners complain that, as of this date, the Bailey bridge in that area has not been repaired. For their part, the authorities of the Municipalidad de Moravia explain that in 2012 they proceeded to close the aforementioned bridge because it was in an extremely hazardous structural condition. A formal record (acta) was drawn up at that time after it was determined that the bridge provided no access to any priority services, such as health centers or educational institutions, and that better alternative exit routes exist in the Coronado sector (the road toward la Gallera), where good bus service is available. Travel time via the alternative routes does not exceed ten minutes, and therefore reconstruction of the bridge is not warranted. Accordingly, the possibility that the authorities of the Municipalidad de Moravia acted negligently in addressing the construction of the bridge is ruled out, since its demolition was undertaken to protect the physical safety of residents in the area. It should be noted that the municipal entity emphasizes that safer routes are available. Consequently, the appropriate course is to deny the petition.
The petitioners allege that the respondent municipalities do not provide garbage-collection services in the area, specifically at the open-air dump. In this regard, the Municipalidad de Vásquez de Coronado maintains that it periodically cleans the area, but residents continuously deposit garbage at that location. Accordingly, it has been established that the municipal entity does provide garbage-collection services, but that the site remains dirty for reasons attributable to the residents. Consequently, the appropriate course is to deny the petition.
IX.Finally, regarding the permissibility of land donations by the respondent municipalities, it is clarified that this matter must be litigated through ordinary legal proceedings (vía de legalidad), given the jurisdiction applicable to it. It is not for this Tribunal to determine whether the donation of public-domain property (bien demanial) is permissible. The appropriate course is therefore to dismiss this aspect of the petition.
The undersigned Magistrado clarifies that although he refers environmental matters involving administrative action of any kind to the administrative litigation jurisdiction (jurisdicción contencioso administrativa), he will not do so when the complaints allege pollution caused by overflowing contaminated water, illegal dumps and insect infestations. This is because other rights of residents living near the source of pollution are at stake, such as the rights to health and to enjoy a dignified quality of life. Furthermore, it is important to emphasize that, in matters relating to the repair or construction of various infrastructure works, I concur in the result while finding that administrative inaction is a matter properly brought before the ordinary courts. The foregoing does not apply where other fundamental rights are implicated, such as life, physical integrity, private property and housing, or where protection is sought for disadvantaged groups.
In the sub lite, because it was alleged that the respondent authorities had failed to take the actions necessary to protect the health, life and physical integrity of local residents, given the reported irregularities involving the building lines, inspection boxes, gutters, gutter curbs and street paving, it was deemed appropriate to consider the merits of the petition for constitutional protection (amparo). From this perspective, this case constitutes an exception to the rule governing this subject. Finally, it must be noted that the operative portion of the judgment did not order personal service of notice upon the respondent authorities. In my view, such service is absolutely necessary to safeguard due process (debido proceso) and to avoid prejudicing the protected persons in exercising their right of access to justice should noncompliance occur and criminal liability be sought.
XI.Separate Reasons of Magistrado Rueda Leal. I concur with the reasoning of the majority opinion. However, I consider it necessary to delimit the effects of this decision for the following reasons. The lack of coordination between the municipal entities has been clearly established, which warrants granting the petition to that extent. Nevertheless, the petitioners’ claims extend even to the paving of streets. The Sala cannot order such paving without a technical opinion (criterio técnico)—for example, one based on health grounds—indicating that such action is necessary. Accordingly, I consider that the respondents cannot be compelled to satisfy that claim. The situation is different with respect to gutter curbs, inspection boxes, gutters and other such elements, because those infrastructure components do affect interests such as a healthy environment and the safety of roads and persons.
The Political Constitution establishes various means of protecting individual rights, for which purpose it has created different forums and levels of protection. Among them, it created the Constitutional Jurisdiction (Jurisdicción Constitucional) in Article 10 as a specialized forum whose purpose is defined in its governing law: to “guarantee the supremacy of constitutional norms and principles and of the International or Community Law in force in the Republic, their uniform interpretation and application, as well as the fundamental rights and freedoms enshrined in the Constitution or in the international human rights instruments in force in Costa Rica” (Article 1 LJC). In addition, it had previously created the ordinary jurisdiction (jurisdicción ordinaria) (Article 153) and the labor jurisdiction (jurisdicción laboral) (Article 70), and likewise established, in Article 49, the existence of an administrative litigation jurisdiction (jurisdicción contencioso administrativa), whose purpose it defined with particular clarity as “guaranteeing the legality of the administrative function of the State, its institutions, and every other public-law entity.” Practically since its creation, establishing criteria for appropriately allocating the various types of claims has been a priority for this Chamber, based on the understanding that the principle of constitutional supremacy does not necessarily entail recognizing unlimited jurisdiction in the body designated to protect it.
On the contrary, an appropriate allocation of responsibilities that adheres to the constitutional text indicates that the constitutional jurisdiction must hear—in accordance with the purpose for which it was created—those matters involving violations, by act or omission, of fundamental rights and constitutional supremacy that are capable of being heard in a highly expedited proceeding of a special and urgent nature, such as the remedy of amparo (amparo) as a procedural mechanism.
Administrative inaction (inactividad de la administración), as a dysfunction capable of affecting individual rights, may, depending on its effects and circumstances, be challenged in one forum or another according to the degree to which it directly affects the fundamental rights governed by the Political Constitution or by the international human rights treaties in force. The constitutional jurisdiction cannot and must not become the sole forum in a manner that diminishes the other forms of judicial protection created by the constituent authority and the legislature. It follows that not every omission or instance of State inaction must, per se, be remedied in the constitutional forum. In this case, the facts deemed proven show that the State’s omissions regarding the construction of road infrastructure, sidewalks, and other works have not directly and specifically affected persons belonging to vulnerable populations. I therefore consider that jurisdiction over and protection of the rights of those subject to the Administration lies with the administrative litigation jurisdiction, and that the relief sought in this amparo proceeding must consequently be claimed before that jurisdiction. Accordingly, I dismiss the appeal.
XIII.NOTE BY JUSTICE HERNÁNDEZ GUTIÉRREZ.- The undersigned Justice is of the view that, in matters involving public works, an amparo appeal (recurso de amparo) should be heard and granted when it is established that the absence or poor condition of the work results in the direct infringement of a fundamental right of a specific person. I have therefore repeatedly dissented when that causal relationship could not be demonstrated. In the case now under review, however, I agree with this Chamber’s decision to partially grant the appeal because it is alleged that the right to a healthy and ecologically balanced environment (derecho a un ambiente sano y ecológicamente equilibrado) has been affected, a right which, as this Chamber itself has recognized, is held by all persons. Accordingly, to guarantee the proper protection that must be afforded to this right, it is appropriate to examine the merits of this amparo proceeding and to issue the partial grant ultimately adopted.
THEREFORE:
The appeal is partially granted. Roberto Zoch Gutiérrez, Mayor of the Canton of Moravia; Rolando Méndez Soto, Mayor; the President of the Cantonal Road Board; and Eng. Gilbert Benitez Rodríguez, head of the Department of Environmental Management and Inspection Coordination, the latter two of the Municipalidad Vázquez de Coronado, or whoever may hold those positions in their stead, are ordered to prepare a remedial plan for the matter within the non-extendable period of 2 months, with the proper planning and necessary budgetary provisions for resources so that, subject to their availability, an effective solution to the problem raised is provided within 2 years from notice of this judgment. The respondents are advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that they must comply with or cause to be complied with, and who fails to comply with it or cause it to be complied with, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The Municipalidad de Moravia and the Municipalidad de Vásquez de Coronado are ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the administrative litigation judgment. As to the Ministerio de Salud and the Ministerio de Obras Públicas y Transportes, the appeal is dismissed. Justice Jinesta Lobo adds a note and orders that personal notice of the judgment be served on the respondent authorities. Justice Rueda Leal provides separate reasons. MORAVIA Y LA MUNICIPALIDAD DE VÁSQUEZ DE CORONADO.
RESULTANDO:
Redacta el Magistrado Cruz Castro; y,
CONSIDERANDO:
Explican los accionantes que son vecinos de las zonas denominadas Alto de la Casilda, calle Corazón de Jesús, la Cataluña y Proyecto Jesús de Nazaret. Denuncian los siguientes problemas: 1) Irregularidades con el alineamiento, las cajas registradoras, los cordones y los caños. No se han pavimentado las calles. 2) Que hay un caño que viene del Alto de la Casilda y colinda con un terreno propiedad municipal, en el cual la Fábrica del Valle vierte aguas contaminadas, lo que provoca malos olores y proliferación de insectos. Caño que se ha convertido en un botadero de basura a cielo abierto para varios vecinos. 3) El Ministerio de Obras Públicas y Transportes, a pesar de la gestión realizada no ha colocado un puente Bailey en lugar del puente de hamaca que existe en la localidad.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
<![if !supportLists]>a. <![endif]>MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES: Que el puente de hamaca se ubica en una vía de la red vial cantonal (ver documentación); <![if !supportLists]>b. <![endif]>MINISTERIO DE SALUD: Que los accionantes con antelación a la presentación de este recurso de amparo no han presentado alguna denuncia ante el Ministerio de Salud (ver documentación); <![if !supportLists]>c. <![endif]>MUNICIPALIDAD DE MORAVIA: Que en el año 2012 se clausuró el puente, por mantener una condición estructural riesgosa. Su recorrido no daba acceso a centros de salud o a centros de estudio. Existen rutas alternas de salida con mejores condiciones de servicios de transporte (ver documentación); <![if !supportLists]>d. <![endif]>MUNICIPALIDAD DE VÁSQUEZ DE CORONADO: 1) Que el ente municipal se encuentra realizando una valoración de la calle limítrofe con el cantón de Moravia, códigos de caminos C-1-113 y C-1- 11-149. 2) Que la Municipalidad realiza limpieza continúas en el botadero a cielo abierto. Los vecinos colocan esa basura en el lugar (ver documentación); <![if !supportLists]>e. <![endif]>Que Municipalidades de Moravia y Vázquez de Coronado discuten su competencia para atender las zonas denominadas Alto de la Casilda, Calle Corazón de Jesús, La Cataluña y Proyecto Jesús de Nazaret (ver documentación).
Uno de los principios rectores de la organización administrativa lo constituye la coordinación que debe mediar entre todos los entes y órganos públicos al ejercer sus competencias y prestar los servicios que el ordenamiento jurídico les ha asignado. La coordinación, en cuanto asegura la eficiencia y eficacia administrativas, es un principio constitucional virtual o implícito que permea el entero ordenamiento jurídico administrativo y obliga a todos los entes públicos. La coordinación puede ser interorgánica -entre los diversos órganos que conforman un ente público no sujetos a una relación de jerarquía- o intersubjetiva, esto es, entre los entes públicos, cada uno con personalidad jurídica, presupuesto propio, autonomía y competencias específicas. La autonomía administrativa o de otro grado de cuya titularidad gozan los entes públicos los obliga a coordinar sus acciones, puesto que, no pueden estar sometidos recíprocamente a relaciones de jerarquía por su naturaleza interorgánica.
La coordinación administrativa tiene por propósito evitar las duplicidades y omisiones en el ejercicio de las funciones administrativas de cada ente público, esto es, que sean desempeñadas de forma racional y ordenada. La coordinación se logra a través del establecimiento de niveles o canales fluidos y permanentes de información entre los entes públicos, todo lo cual se puede lograr a través de reuniones, informes o la creación de instancias formales de coordinación. Así, esta Sala, en el voto Nº 3404-2005 de las 18:29 horas del 29 de marzo de 2005, dispuso lo siguiente:
“(…) según el principio de coordinación, el Estado está obligado a que sus entidades adopten e implementen todas aquellas medidas requeridas para organizar y armonizar sus actuaciones para que la gestión administrativa sea lo más célere y efectiva posible en beneficio del administrado. En lo que concierne a las relaciones internas dentro de una Administración, ese principio se refiere a las diversas responsabilidades que en la tramitación de un asunto, desde su planteamiento inicial hasta la decisión definitiva, corresponden a diferentes departamentos, sujetos o no a una relación vertical de jerarquía entre sí pero, en todo caso, pertenecientes a una única persona jurídica de derecho público. En tal situación, las diversas dependencias internas de una entidad, responsables de gestar y decidir determinadas sub-etapas para la tramitación de las gestiones ante ella presentadas, deben coordinar entre sí a efectos de procurar un procedimiento administrativo ágil y efectivo en provecho del ciudadano. Si por un atraso en alguna de tales sub-etapas se produce un retardo general de toda el procedimiento relativo a un reclamo administrativo, independientemente de la responsabilidad particular que le incumba al órgano o departamento involucrado directamente en la demora acaecida, lo cierto es que la entidad como tal resulta igualmente responsable de la misma (…)”
Acusan los accionantes vecinos de la comunidades de Alto de la Casilda, calle Corazón de Jesús, la Cataluña y Proyecto Jesús de Nazaret que existen irregularidades con el alineamiento, las cajas registradoras, los cordones y los caños. No se han pavimentado las calles. De los informes rendidos por los representantes de las autoridades recurridas -que se tienen dados bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto ha sido debidamente acreditado que esas comunidades están en la zona limítrofe entre los Cantones de Moravia y Vásquez de Coronado. Que ambas municipalidades discuten la responsabilidad de atender la problemática denunciada por considerar que esas zonas no son de su competencia.
Al respecto la Sala estima que los argumentos esbozados por las municipalidades de Moravia y Vásquez de Coronado, no son de recibo, por el contrario, de conformidad con el principio de coordinación administrativa, ambos entes municipales deben realizar las gestiones necesarias para solventar los problemas descritos por los vecinos de las comunidades de Alto de la Casilda, calle Corazón de Jesús, la Cataluña y Proyecto Jesús de Nazaret. Es importante destacar que los personeros de la Municipalidad de la Municipalidad de Moravia y la Municipalidad de Vásquez de Coronado admiten la existencia de irregularidades con el alineamiento, las cajas registradoras, los cordones y los caños, y que no se han pavimentado las calles en las comunidades de Alto de la Casilda, calle Corazón de Jesús, la Cataluña y Proyecto Jesús de Nazaret. Por lo anterior, lo procedente es declarar con lugar el recurso y ordenar a Roberto Zoch Gutiérrez, Alcalde del Cantón de Moravia, a Rolando Méndez Soto, Alcalde, al Presidente de la Junta Vial Cantonal, y al Ing. Gilbert Benitez Rodríguez, encargado del Departamento de Gestión Ambiental y Coordinación de Inspección, ambos de la Municipalidad Vázquez de Coronado, o a quienes en sus lugares ejerzan esos cargos, que en el improrrogable plazo de 2 meses elaboren un plan remedial del caso, todo con la debida planificación y las previsiones presupuestarias necesarias de recursos para que, conforme a la disponibilidad de éstos, se dé una solución efectiva al problema planteado en el plazo de 2 años, a partir de la comunicación de esta sentencia.
Acusan los accionantes que hay un caño que viene del Alto de la Casilda y colinda con un terreno propiedad municipal, en el cual la Fábrica del Valle que vierte aguas contaminadas, lo que provoca malos olores y proliferación de insectos. Caño que se ha convertido en un botadero de basura a cielo abierto para varios vecinos. Por su parte las Áreas Rectoras de Salud son enfáticas al establecer que con antelación a la comunicación de la presentación de este recurso, no tenían conocimiento de esta queja. Que una vez enteradas de la situación procedieron a ejecutar los actos necesarios para atender esa problemática. Al respecto, la Sala determina que no consta que los accionantes hayan presentado alguna denuncia ante las autoridades del Ministerio de Salud. De manera que la autoridad recurrida no ha incurrido en ninguna omisión contraria al Derecho de la Constitución, pues en esa instancia no se había presentado ninguna denuncia.
En consonancia con lo analizado, se impone declarar sin lugar el recurso en este extremo, al no acreditarse conductas omisas que hayan vulnerado los derechos fundamentales de los tutelados. Recuérdese, como lo dispuso este Tribunal en la Sentencia No. 2012-018538 de las 9:05 horas del 21 de diciembre del 2012, que “esta Sala Constitucional no es una instancia tramitadora de denuncias, razón por la cual deberán acudir ante el Ministerio de Salud, a plantear los reclamos pertinentes”. En consecuencia, lo procedente es declarar sin lugar el recurso.
Alegan los recurrentes que el Ministerio de Obras Públicas y Transportes, a pesar de la gestión realizada no ha colocado un puente Bailey en lugar del puente de hamaca que existe en la localidad. Por su parte los representantes del Ministerio de Obras Públicas y Transportes explican que el puente se ubica en una vía de la red vial cantonal, por lo que la competencia territorial deberá dilucidarse entre las municipalidades involucradas y demandadas. Por lo expuesto, la Sala rechaza que los representantes del Ministerio de Obras Públicas y Transportes sean omisas en el conocimiento de este proceso. En consecuencia, lo procedente es declarar sin lugar el recurso.
Reclaman los accionantes que a la fecha no se ha reparado el puente Bailey en esa zona. Por su parte la autoridades de la Municipalidad de Moravia explica que en el año 2012 procedió a clausurar el mencionado puente, por cuanto este tenía una condición estructural riesgosa en extremo. En ese acto se procedió a levantar un acta, al comprobar que no brinda acceso a ningún servicio prioritario a centros de salud, centros de estudio y existen en rutas alternas de salida en mejores condiciones para el caso del sector de Coronado (calle hacia la Gallera), donde existe un buen servicio de buses. El tiempo de traslado por las rutas alternas no supera los diez minutos, por lo que no se justifica la reconstrucción del mismo. Por lo anterior, se descarta que las autoridades de la Municipalidad de Moravia actuaran de forma negligente en la atención de la construcción del puente, ya que, su demolición se da para resguardar la integridad física de los vecinos de la zona. Nótese que el ente municipal enfatiza que existen rutas más seguras de utilizar. En consecuencia, lo procedente es declarar sin lugar el recurso.
Acusan los accionantes que las municipalidades recurridas no brindan el servicio de recolección de basura en la zona, propiamente en el botadero a cielo abierto. En este sentido la Municipalidad de Vásquez de Coronado sostiene que realiza limpieza de forma periódica en la zona, pero los vecinos colocan esa basura de forma permanente en el lugar. Por lo anterior, se comprueba que el ente municipal si brinda el servicio de recolección de basura, pero se mantiene sucio el lugar por causas atribuibles a los vecinos. Por lo anterior, lo procedente es declarar sin lugar el recurso.
IX.Finalmente, en cuanto a la procedencia de donaciones de terrenos por parte de las municipalidades recurridas, se aclara que este tema debe ser discutido en la vía de legalidad en razón de su competencia. No le corresponde a este Tribunal determinar la procedencia o no de una donación de un bien demanial. Por ello lo procedente es desestimar el recurso en este extremo.
El suscrito Magistrado aclara que si bien los asuntos ambientales, cuando hay intervención administrativa de cualquier índole, los remite a la jurisdicción contencioso administrativa, lo cierto es que tratándose de denuncias donde se alega contaminación por desbordamiento de aguas contaminadas, botaderos clandestinos y proliferación de insectos, no lo hará así. Esto, por cuanto, se encuentran en juego otros derechos de los vecinos de la fuente contaminante, tales como la salud y a gozar de un nivel digno de calidad de vida. De otra parte, es importante destacar que en aquellos asuntos relacionados con la reparación o construcción de diversas obras de infraestructura, salvo el voto al estimar que la inactividad administrativa constituye una discusión propia de ser planteada ante la jurisdicción ordinaria. Lo anterior, excepto que exista de por medio la infracción a otros derechos fundamentales como la vida, la integridad física, la propiedad privada y la vivienda o bien, la tutela a grupos en desventaja.
En el sub lite, al exponerse que las autoridades recurridas, no habían ejecutado las actuaciones necesarias, para garantizar la salud, vida e integridad de los vecinos del lugar, dadas las irregularidades denunciadas en relación con el alineamiento, cajas registradoras, caños, cordones de caño y la pavimentación de las calles, se estimó procedente conocer el fondo del amparo. Desde esta perspectiva, es una excepción a la regla en esta materia. Finalmente, es preciso señalar que en la parte dispositiva de la sentencia, no se ordenó la notificación, a las autoridades recurridas, en forma personal. En mi criterio lo anterior resulta, absolutamente, necesario, para salvaguardar el debido proceso y no perjudicar a los tutelados, en el ejercicio de su derecho de acceso a la justicia, en el caso que se presente un incumplimiento y se exija la responsabilidad penal.
XI.Razones particular del Magistrado Rueda Leal. Concurro con los razonamientos del voto de mayoría. Sin embargo, considero necesario dimensionar los efectos de esta resolución por los siguientes motivos. Se logra establecer con claridad la falta de coordinación entre los entes municipales, lo que motiva que el recurso sea declarado con lugar en ese tanto. No obstante, las pretensiones los recurrente abarcan incluso la pavimentación de calles. La Sala no puede ordenar dicha pavimentación sin la existencia de un criterio técnico (por ejemplo, por razones de salud) que indique tal proceder como necesario. De esta manera, considero que no se puede compeler a los recurridos a cumplir dicha pretensión. Diferente es la situación del cordón de caño, las cajas registradora, los caños, y demás, pues tales elementos de infraestructura sí inciden en intereses como el ambiente sano y la seguridad vial y de las personas.
La Constitución Política establece distintas formas de tutelar los derechos de las personas, para lo cual ha creado distintas instancias y niveles de protección. Entre ellos, creó la Jurisdicción Constitucional en su artículo 10, como una instancia especializada, cuyo objeto está definido en su ley regulatoria, para “garantizar la supremacía de las normas y principios constitucionales y del Derecho Internacional o Comunitario vigente en la República, su uniforme interpretación y aplicación, así como los derechos y libertades fundamentales consagrados en la Constitución o en los instrumentos internacionales de derechos humanos vigentes en Costa Rica”, (artículo 1 LJC). Por otra parte, ya había creado anteriormente la jurisdicción ordinaria (artículo 153), la jurisdicción laboral (artículo 70) y estableció igualmente, en su artículo 49, la existencia de una jurisdicción contencioso administrativa a la que definió con particular claridad su objeto de , “de garantizar la legalidad de la función administrativa del Estado, de sus instituciones y de toda otra entidad de derecho público.” Prácticamente desde su creación, ha sido un tema prioritario para esta Sala, la determinación de criterios que permitan distribuir de manera apropiada los distintos tipos de reclamos, dando por hecho que el principio de supremacía constitucional no conlleva necesariamente reconocer una competencia omnímoda al órgano designado para protegerla.- Por el contrario un reparto apropiado de labores, que se apegue al texto constitucional apunta a entender que la jurisdicción constitucional debe conocer -según el propósito de su creación-, aquellos aspectos que violen por acción u omisión derechos fundamentales y de la supremacía constitucional, que sean susceptibles de ser conocidos en un proceso muy sumario y de especial naturaleza y urgencia como es el amparo como instituto procesal.
La inactividad de la administración, como patología capaz de afectar los derechos de las personas, dependiendo de sus efectos y circunstancias, podrá ser discutida en una u otra sede, según su grado de afectación directa a los derechos fundamentales regulados en la Constitución Política o a los tratados internacionales de derechos humanos vigentes y la jurisdicción constitucional no puede, ni debe constituirse en una instancia única que demerite las otras formas de tutela judicial creadas por el constituyente y el legislador. De allí que no toda omisión o inactividad del Estado per se, deba ser tutelada en sede constitucional. En este caso, de los hechos probados se concluye que las omisiones del Estado en la construcción de infraestructura vial, aceras, y otros no han afectado de forma directa y específica a personas pertenecientes a poblaciones vulnerables, por lo que estimo que la competencia y tutela de los derechos de los administrados le corresponde a la jurisdicción contencioso administrativa y por ello la pretensión contenida en este amparo debe ser reclamado en la jurisdicción contencioso administrativa. En consecuencia, declaro sin lugar el recurso.
XIII.NOTA DEL MAGISTRADO HERNÁNDEZ GUTIÉRREZ.- El suscrito Magistrado es del criterio que en materia de obras públicas, el amparo debe ser conocido y estimado cuando se acredite que la inexistencia de la obra o el mal estado de la misma, devenga en una afectación directa de un derecho fundamental de una persona concreta, por lo que de manera reiterada he salvado el voto cuando dicha relación causal no logra demostrarse. Sin embargo, en el caso que ahora se conoce, sí coincido con el criterio de esta Sala de declarar parcialmente con lugar el recurso, por cuanto se aduce la presunta afectación sobre el derecho a un ambiente sano y ecológicamente equilibrado, del cual, según se ha reconocido por esta misma Sala, todas las personas somos titulares. Ante ello, para garantizar la debida protección que debe otorgarse a este derecho, resulta procedente el conocimiento por el fondo de este amparo y la estimatoria parcial finalmente adoptada.
POR TANTO:
Se declara parcialmente con lugar el recurso. Se les ordena a Roberto Zoch Gutiérrez, Alcalde del Cantón de Moravia, a Rolando Méndez Soto, Alcalde, al Presidente de la Junta Vial Cantonal, y al Ing. Gilbert Benitez Rodríguez, encargado del Departamento de Gestión Ambiental y Coordinación de Inspección, ambos de la Municipalidad Vázquez de Coronado, o a quienes en sus lugares ejerzan esos cargos, que en el improrrogable plazo de 2 meses elaboren un plan remedial del caso, todo con la debida planificación y las previsiones presupuestarias necesarias de recursos para que, conforme a la disponibilidad de éstos, se dé una solución efectiva al problema planteado en el plazo de 2 años, a partir de la comunicación de esta sentencia. Se advierte a los recurridos que, de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena a la Municipalidad de Moravia y a la Municipalidad de Vásquez de Coronado al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto al Ministerio de Salud y el Ministerio de Obras Públicas y Transportes se declara sin lugar el recurso. El Magistrado Jinesta Lobo pone nota y ordena se notifique la sentencia, a las autoridades recurridas, en forma personal. El Magistrado Rueda Leal da razones particulares. La Magistrada Hernández López salva el voto y declara sin lugar el recurso. El Magistrado Hernández Gutiérrez pone nota.
