Writ of amparo (recurso de amparo) filed by JORGE RAMÍREZ QUESADA, identity card 0900830526, on behalf of MADERLIN AND WAINER, BOTH RAMÍREZ MENDOZA, against the MINISTRY OF PUBLIC EDUCATION AND THE MINISTRY OF PUBLIC SECURITY.
Findings:
Justice Cruz Castro drafts the opinion; and,
Considering:
I.Subject matter of the writ.- The petitioner, the father of the protected minors, considers their right to education to have been violated because the temporary school established due to the closure of Escuela La Flor del Roble, in Sabalito de Coto Brus (closed because of the poor condition of its infrastructure), was also closed by the Ministry of Public Security. Consequently, the students are not receiving classes, and the closure was carried out without coordination with the Ministry of Public Education or the Patronato Nacional de la Infancia, even though there are students from indigenous groups.
II.Proven facts.- The following facts are deemed duly established and relevant to the disposition of this matter, either because they have been substantiated or because the respondent failed to address them as required in the initial order:
a. Because the Escuela La Flor building had reached the end of its useful life, the school was initially relocated to the community’s Catholic church to complete the 2016 school year, with 47 students and 7 grade levels (see the school principal’s report).
b. Because the church premises were very small, however, the Ministry rented a wooden house with an open lower level, which underwent several modifications (see the school principal’s report).
c. By official letter n°SCEC-06-033-17 dated April 17, 2017, the educational-facilities supervisor ordered the closure of the residence being used as school premises. On April 18, 2017, the principal informed the parents of the closure and that classes were suspended until further notice, and communicated the measure of sending the students to the nearest educational facilities, to which the parents objected (see the school principal’s report).
d. During a visit with the supervisor on Monday, April 24, 2017, the supervisor verbally instructed that classes be resumed for a specified period of five months, until the community hall could be made available for relocation. Meanwhile, they would proceed with construction of the new building and undertook to visit the current premises, the donated land, and the community hall under construction. Classes resumed on April 25, 2017 (see the school principal’s report).
e. There is currently a parcel of land for the school donated by the development association at an extraordinary assembly held on December 17, 2016, and ratified on April 09, 2017, as well as a community hall under construction (see the school principal’s report).
a. That the Ministry of Public Security participated in closing the residence where classes for Escuela La Flor were being taught temporarily.
IV.The right to health, the right to enjoy a healthy and ecologically balanced environment, and the right to continuity of the public education service in educational facilities.- The right to health recognized in Articles 21 of the Political Constitution, 1 and 11 of the American Declaration of the Rights and Duties of Man, 4 of the American Convention on Human Rights, and 10 of the Additional Protocol to the American Convention on Human Rights in the Area of Rights is closely linked to the right to live in a healthy and balanced environment, enshrined in Article 50 of the Constitution. Environmental quality is a fundamental measure of quality of life, as are health, food, work, housing, and education, among others. Consequently, the State has an obligation to ensure adequate protection of the environment, for which purpose it must take the measures necessary to keep the environment free from pollution and to ensure that alterations caused by either human activity or nature, in the immediate or distant surroundings, do not harm the environment or the health of the people who live there.
This right is especially recognized when it is associated with other fundamental rights, such as the right to education. The latter constitutes a fundamental right embodied in the public service provided by the State at the country’s various educational facilities. Therefore, at a minimum, when providing this public service, the State must not violate the principle of continuity or other fundamental rights, such as the right to health and to a healthy environment, of either the students or the educational institution’s teaching and administrative staff.
V.On the specific case.- From the reports submitted by the representatives of the respondent authority—which are deemed to have been given under oath, with the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for the resolution of this matter, this Chamber finds that Escuela La Flor was initially relocated to the community’s Catholic church to complete the 2016 school year due to infrastructure problems. However, because that church was too small to accommodate 47 students across 7 grade levels, the school was moved to a wooden stilt house, which was rented and underwent several modifications. Subsequently, by official communication n°SCEC-06-033-17 of April 17, 2017, the supervisor of educational centers ordered the house premises closed because he did not consider them suitable. On April 18, 2017, the Principal informed the parents of the closure and that classes were suspended until further notice, and indicated that the students would be sent to the nearest educational centers, to which the parents objected.
Accordingly, the closure remained in effect until approximately April 25, ONE WEEK later, when the supervisor directed that classes resume for a defined period of five months, until the community hall could be made ready for the relocation. From all of the foregoing, this Chamber concludes that the rights to health, the environment, and education were violated. First, it is surprising that an educational center should reach such conditions that a sanitary order must be issued against it and the students immediately relocated. This suggests that, for several months, the students were subjected to conditions unsuitable for their educational process, threatening their rights to health, life, the environment, and education. Second, it has been established that the minors have been subjected to repeated relocations, since they moved from the educational center to the church and from there to a rented house, causing instability in their educational process.
Third, the temporary premises operating as an educational center (the rented house) did in fact remain closed from approximately April 18 to April 24, 2017, interrupting the students’ educational process. No involvement by the Ministerio de Seguridad Pública in this regard has been established; rather, the proven facts show that the closure resulted from the supervisor’s order. That closure was ordered without anticipating whether the alternative of sending the minors to other centers would be feasible for their parents and without considering that the educational process would be interrupted. The respondents’ actions must certainly take into account the minors’ safety and integrity, but they must do so through preventive measures and must not allow the situation to become so serious that the minors are left without an educational center to attend. In conclusion, because it has been established that the Ministerio de Educación Pública was remiss and negligent in maintaining Escuela La Flor, and because the temporary educational center was ordered closed, interrupting the minors’ educational process, this Chamber finds that the Ministerio de Educación Pública violated the protected minors’ rights to health, life, the environment, and education.
The amparo proceeding (recurso de amparo) must therefore be granted, with the consequences stated in the operative portion of this decision. As to the Ministerio de Seguridad Pública, the proceeding is denied because it has not been proven that it participated in the closure.
The undersigned Justice clarifies that, although he refers environmental matters involving administrative action of any kind to the administrative litigation jurisdiction (jurisdicción contencioso administrativa), he will not do so in the case of complaints alleging pollution and deplorable sanitary conditions affecting the students of a school. This is because other rights of the protected parties are at stake, including their rights to health and to enjoy a dignified quality of life.
I have agreed with the position maintained by Justice Jinesta Lobo on this matter; accordingly, in environmental matters, it is also the view of the undersigned that, if the Public Administration has already intervened, jurisdiction to hear and resolve the matter lies with the administrative litigation jurisdiction. Nevertheless, I do address the merits of a matter when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Constitución Política), as in this case, in which pollution and extremely poor sanitary conditions affecting the students of an educational center are alleged, in violation of their right to enjoy a healthy and ecologically balanced environment.
I have consistently dissented in cases seeking, through an amparo proceeding, to remedy mere administrative inaction concerning infrastructure works such as sidewalks, bridges, street gravelling, culverts, and others, on the ground that such matters may be litigated through ordinary legality proceedings, because I consider that the Chamber is not, and should not become, a sole or omnipresent forum that diminishes the other judicial remedies established for that purpose by the constituent authority and the legislature. I have clarified, however, that I do consider cases of administrative inaction concerning the aforementioned matters to be subject to protection through this proceeding when that inaction directly affects the exercise of fundamental rights enshrined in the Constitución Política or in international human-rights treaties, provided that they are capable of being heard in a highly expedited proceeding of the special nature and urgency of amparo as a procedural institution. This is the situation in the present proceeding, in which the claim concerns deficiencies that directly affect the right to education of minors. I have therefore considered it necessary for the Chamber to exercise its jurisdiction to determine whether the alleged omissions violate the fundamental rights of the protected persons, as stated in the petition.
The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, such items must be collected from the court office within a maximum period of 30 business days from the date notice of this judgment is given. Otherwise, any materials not collected within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on May 3, 2012, Article LXXXI.

The proceeding is declared PARTIALLY GRANTED, solely with respect to the actions and omissions of the Ministerio de Educación Pública. Consequently, SONIA MARTA MORA ESCALANTE, in her capacity as Ministra de Educación Pública, or whoever holds that office in her stead, is ordered to immediately issue such instructions as fall within the scope of her authority in order to ensure that the minors attending Escuela La Flor continue their educational process continuously and without interruption, under suitable conditions and with respect for their rights to health, life, and the environment. The foregoing is ordered with the warning that she may incur the offense defined in Article 71 of the Ley de la Jurisdicción Constitucional, which provides that any person who receives an order issued in an amparo proceeding that he or she is required to comply with or enforce, and fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years, or fined an amount equivalent to twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The State is ordered to pay the legal costs and the damages and losses caused by the facts underlying this declaration, which shall be assessed during enforcement of the judgment before the administrative litigation jurisdiction. The proceeding is denied with respect to the Ministerio de Seguridad Pública. SONIA MARTA MORA ESCALANTE, in her capacity as Ministra de Educación Pública, or whoever holds that office in her stead, shall be personally served with notice. Justice Jinesta Lobo files a note. Recurso de amparo interpuesto por JORGE RAMÍREZ QUESADA, cédula de identidad 0900830526, a favor de MADERLIN Y WAINER, AMBOS RAMÍREZ MENDOZA, contra el MINISTERIO DE EDUCACIÓN PÚBLICA Y EL MINISTERIO DE SEGURIDAD PÚBLICA.
Resultando:
Redacta el Magistrado Cruz Castro; y,
Considerando:
I.Objeto del recurso.- El recurrente, padre de los menores amparados, considera violados su derecho a la educación por cuanto, la escuela provisional habilitada por estar cerrada la Escuela La Flor del Roble, en Sabalito de Coto Brus (cerrada por el mal estado de infraestructura), también fue cerrada por el Ministerio de Seguridad Pública. Motivo por el cual los estudiantes no están recibiendo clases, cierre que se hizo sin coordinar con el Ministerio de Educación Pública ni el Patronato Nacional de la Infancia, pues hay estudiantes de grupos indígenas.
II.Hechos probados.- De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
a. Que debido a que el edificio de la escuela La Flor cumplió su vida útil, se ubicó en primera instancia en la iglesia católica de la comunidad, para finalizar el curso lectivo 2016, con 47 alumnos y 7 niveles (ver informe de Directora del centro).
b.Pero al ser el lugar muy pequeña la iglesia, el Ministerio alquiló una casa de socalo de madera, a la que se le hicieron varias modificaciones (ver informe de Directora del centro).
c. El supervisor de centros educativos, mediante oficio n°SCEC-06-033-17 del 17 de abril del 2017 ordena el cierre del local casa. El 18 de abril del 2017, la Directora informa a los padres del cierre y que las clases se suspenden hasta nuevo aviso, e indica la medida de enviar a los estudiantes a los centros educativos más cercanos, a lo cual los padres se opusieron (ver informe de Directora del centro).
d.En visita del lunes 24 de abril del 2017 con el supervisor, indica verbalmente reanudar las clases, por un tiempo definido de cinco meses, hasta que se habilite el salón comunal de la comunidad, para la reubicación. Mientras proceden con la construcción del nuevo inmueble, y así se comprometen a realizar una visita al inmueble actual, terreno donado y al salón comunal en proceso. Las lecciones se reanudaron el 25 de abril del 2017 (ver informe de Directora del centro).
e. Actualmente para la escuela se cuenta con un terreno donado por la asociación de desarrollo en asamblea extraordinaria del 17 de diciembre del 2016 y ratificada el 09 de abril del 2017, además de un salón comunal en proceso de construcción (ver informe de Directora del centro).
a. Que el Ministerio de Seguridad Pública hubiera participado en el cierre de la casa donde se impartían provisionalmente lecciones de la escuela La Flor.
IV.Sobre el derecho a la salud, el derecho a gozar de un ambiente sano y ecológicamente equilibrado, y el derecho a la continuidad del servicio público de educación, en los Centros de Educación.- El derecho a la salud reconocido en los artículos 21 de la Constitución Política, 1 y 11 de la Declaración Americana de los Derechos y Deberes del Hombre, 4 de la Convención Americana sobre Derechos Humanos y 10 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos, se encuentra íntimamente ligado al derecho a vivir en un ambiente sano y equilibrado, consagrado en el artículo 50 constitucional. La calidad ambiental es un parámetro fundamental de la calidad de vida; al igual que la salud, alimentación, trabajo, vivienda, educación, entre otros. En consecuencia, el Estado tiene la obligación de procurar una protección adecuada al ambiente, para lo cual debe tomar las medidas necesarias a fin de que el medio esté libre de contaminación, y que las alteraciones producidas tanto por el hombre como por la naturaleza, en el entorno próximo o lejano, no constituyan una lesión al ambiente ni a la salud de las personas que en él habitan.
Se reconoce especialmente este derecho cuando está asociado a otros derechos fundamentales, como lo sería el derecho a la educación. Este último se configura como un derecho fundamental, el cual se traduce en el servicio público que brinda el Estado en los distintos centros educativos del país. Por lo tanto, lo menos que puede hacer el Estado es que al brindar la prestación de este servicio público no lesione el principio de continuidad, ni otros derechos fundamentales, como sería el derecho a la salud y a un ambiente sano, tanto de los estudiantes como del personal docente y administrativo de la institución educativa.
V.Sobre el caso concreto.- De los informes rendidos por los representantes de la autoridad recurrida -que se tienen por dados bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción-, y la prueba aportada para la resolución del presente asunto, esta Sala comprueba que, la escuela La Flor se ubicó en primera instancia en la iglesia católica de la comunidad para finalizar el curso lectivo 2016, y ante problemas de infraestructura. Pero tal iglesia, al ser un lugar muy pequeño para albergar 47 estudiantes en 7 niveles, se trasladó a una casa de socalo de madera, la cual fue rentada, y a la que se le hicieron varias modificaciones. Luego, el supervisor de centros educativos, mediante oficio n°SCEC-06-033-17 del 17 de abril del 2017 ordena el cierre del local casa, pues no la considera apta. El 18 de abril del 2017, la Directora informa a los padres del cierre y que las clases se suspenden hasta nuevo aviso, e indica la medida de enviar a los estudiantes a los centros educativos más cercanos, a lo cual los padres se opusieron.
Así que, se mantuvo dicho cierre hasta el 25 abril, aproximadamente UNA SEMANA después, en que, el supervisor indica reanudar las clases, por un tiempo definido de cinco meses, hasta que se habilite el salón comunal de la comunidad, para la reubicación. De todo lo cual concluye esta Sala que ha habido una violación del derecho a la salud, al ambiente y a la educación. En primer lugar, sorprende que un centro educativo tenga que llegar a tales condiciones en que proceda una orden sanitaria en su contra, y el inmediato traslado de los estudiantes. Eso hace suponer que durante varios meses, los estudiantes estuvieron sometidos a condiciones inidóneas para su proceso educativo, en amenaza a su derecho a la salud, a la vida, al ambiente y a la educación. En segundo lugar, se comprueba que los menores han estado siendo objeto de traslados continuos, pues del centro educativo pasaron a la iglesia, y de esta, a una casa rentada.
Provocando inestabilidad en su proceso educativo. En tercer lugar, ciertamente el lugar provisional que operaba como centro educativo (casa rentada), permaneció cerrado, aproximadamente del 18 de abril al 24 de abril del 2017, interrumpiendo el proceso educativo de los estudiantes. No se comprueba participación alguna del Ministerio de Seguridad Pública en cuanto a este aspecto, sino que de los hechos probados se tiene que la clausura obedeció a la orden del supervisor. Clausura que se ordenó sin preveer que la alternativa de enviar a los menores a otros centros fuera viable para los padres de familia, y sin tomar en consideración que el proceso educativo se vería interrumpido. Ciertamente las acciones de los recurridos deben tomar en cuenta la seguridad e integridad de los menores, pero como medidas preventivas y no dejar que la situación llegue a un punto tal de gravedad, que estos se queden sin centro educativo al cual asistir.
En conclusión, dado que se comprueba que el Ministerio de Educación ha sido omiso y negligente en el mantenimiento del centro educativo La Flor, dado que se ha ordenado la clausura del centro educativo provisional, interrumpiendo el proceso educativo de los menores, se constata la violación al derecho a la salud, a la vida, al ambiente, y a la educación, de los menores amparados, por parte del Ministerio de Educación Pública, procediendo la estimatoria de este recurso, con las consecuencias que se indican en la parte dispositiva de esta resolución. En cuanto al Ministerio de Seguridad, se desestima el recurso, porque no se prueba que haya participado en la clausura.
El suscrito Magistrado aclara que si bien los asuntos ambientales, cuando hay intervención administrativa de cualquier índole, los remite a la jurisdicción contencioso administrativa, lo cierto es que tratándose de denuncias donde se alega contaminación y condiciones sanitarias deplorables que afectan a los estudiantes de una escuela, no lo hará así. Esto, por cuanto, se encuentran en juego otros derechos de los amparados, tales como la salud y a gozar de un nivel digno de calidad de vida.
He coincidido con la posición sustentada por el Magistrado Jinesta Lobo en esta materia, por lo que, en asuntos ambientales, es también criterio del suscrito que, si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusa contaminación y pésimas condiciones sanitarias que afectan a los estudiantes de un centro, con violación de su derecho a disfrutar de un ambiente sano y ecológicamente equilibrado.
He venido salvado el voto en aquellos casos que se trate de corregir por medio del recurso de amparo la simple inactividad de la administración, en obras de infraestructura tales como aceras, puentes, lastreado de calles, alcantarillas entre otras, con el argumento de que pueden ser discutidos en la vía de legalidad ordinaria, considerando que la Sala no es, ni debe constituirse, en una instancia única u omnipresente que demerite las otras vías de tutela judicial creadas por el constituyente y el legislador al efecto. He aclarado sin embargo que sí estimo como tutelables en esta vía casos de inactividad de la administración en los temas señalados si con ella se produce afectación directa al ejercicio de derechos fundamentales regulados en la Constitución Política o a los tratados internacionales de derechos humanos, siempre que sean susceptibles de ser conocidos en un proceso muy sumario y de especial naturaleza y urgencia como es el amparo como instituto procesal. Tal es el caso de este recurso en donde el reclamo gira alrededor de deficiencias que inciden de manera directa en el derecho a la educación de personas menores de edad, y por ello he considerado necesario que la Sala ejerciera su competencia, para comprobar o descartar si las omisiones señaladas, vulneran los derechos fundamentales de las personas amparadas según se indica en el escrito de interposición.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara PARCIALMENTE CON LUGAR el recurso, únicamente en cuanto a las acciones y omisiones del Ministerio de Educación Pública. En consecuencia se ordena a SONIA MARTA MORA ESCALANTE, en su calidad de Ministra de Educación Pública, o quien en su lugar ocupe dicho cargo, proceder de inmediato a girar las instrucciones que estén dentro del ámbito de sus competencias para proceder a garantizar que los menores que asisten a la Escuela La Flor continúen su proceso educativo, de forma continua e ininterrumpida, y bajo condiciones adecuadas, en respeto de su derecho a la salud, la vida y al ambiente. Lo anterior, bajo apercibimiento de que podría incurrir en el delito tipificado en el artículo 71 de la Ley de la Jurisdicción Constitucional, el cual dispone que se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Se desestima el recurso en cuanto al Ministerio de Seguridad Pública. Notifíquese de forma personal a SONIA MARTA MORA ESCALANTE, en su calidad de Ministra de Educación Pública, o a quien en su lugar ocupe dicho cargo. El Magistrado Jinesta Lobo pone nota.
