Amparo proceeding (recurso de amparo) processed under expediente number 17-004089-0007-CO, filed by GERARDO CASTILLO MARTÍNEZ, identity card No. 0601380233, against THE PRESIDENT OF THE TRIBUNAL AMBIENTAL ADMINISTRATIVO, THE DIRECTOR OF THE ÁREA DE CONSERVACIÓN PACÍFICO CENTRAL (ACOPAC), THE HEAD OF THE OFICINA SUBREGIONAL DE PURISCAL OF THE ÁREA DE CONSERVACIÓN PACÍFICO CENTRAL, AND THE DIRECTOR DE AGUAS, ALL OF THE MINISTERIO DE AMBIENTE Y ENERGÍA
Findings:
3. Ligia Umaña Ledezma, in her capacity as President of the Tribunal Ambiental Administrativo (TAA), states under oath that on 23 de setiembre del 2014 this Tribunal received Oficio PSAM-074-2014, signed by Mr. Manuel Espinoza Campos in his capacity as Mayor of the Municipalidad de Puriscal, through which he filed a formal environmental complaint seeking an investigation into the events that occurred on the property recorded under San José folio registration number 502010, located in Palmichal de Acosta. See folios 35 through 41 of the administrative case file. She adds that this complaint was incorporated into administrative case file N° 296-14-02TAA, which was subsequently consolidated with case file N° 282-14-03-TAA. She further states that Report ACOPAC-ASRP-QJ-10992014 of 29 de setiembre del 2014 appears at folios 85 through 95 of the administrative case file. She adds that folios 42 through 66 of the administrative case file contain oficio TAA-DT-01 12-14 dated 13 de octubre del 2014, corresponding to the Field Inspection Report concerning the inspection conducted on 2 de octubre del año 2014 at the property located in San Pablo, Palmichal, Acosta, San José, Hoja Cartográficas Abra 3345 I, Edición 3 IGNCR 1989, Geographic Location N 9" 50' 27.3 W 84° 10' 19.6, WGS84 projection.
She indicates that resolution N" 1007-14-TAA, issued at 08:20 hours on 12 de noviembre del año 2014 in administrative case file N" 282-14-03-TAA, established the following: First: Request that Mr. Eng. Alfonso Duarte Marín, in his capacity as Director of the Área de Conservación Pacifico Central (ACOPAC), or whoever holds that position, conduct an on-site visual inspection (inspección ocular “in situ”) of Río Tarbacia (this Office does not have a more precise address) to verify the facts described in the complaint, namely an apparent extraction of timber, sedimentation, and harm to the flora and fauna of the area. Likewise, if possible, identify the person allegedly responsible for the above-mentioned acts. If any significant adverse impact is found, he shall, within the scope of his authority, prepare the corresponding Economic Valuation of Environmental Damage (Valoración Económica del Daño Ambiental) and submit it to this Office.
See folios 2 and 3 of the administrative case file. By resolution N° 1324 5-TAA, issued at 13:52 hours on 16 de febrero de 2015 in administrative case file N° 296-14-02-TAA, the following was requested: “(...) FIRST: In the case at hand, this Office considers it of the utmost importance, for the purpose of establishing the substantive truth (verdad real) of the reported facts, to order Mr. Luis Alberto Durán Gamboa, in his capacity as Mayor of the Municipalidad de Acosta, or whoever holds that position, to: 1) certify to this Office the identity of the registered owner of the property located in San José, Acosta, Palmichal, San Pablo, at the specified coordinates, WGS84 projection, apparently owned by Grupo Ganadero Roqueta S.A., corporate identification number 3-101-318767, represented by Mr. Edgar Ureña Salazar, identity card number 1-0424.0292; 2) inform this Office whether any permits have been granted for the specified property and, if so, what type.
Likewise, provide any other information deemed relevant to this case file. SECOND: To verify the substantive truth of the facts, this Tribunal considers it appropriate to request that Mr. José Miguel Zeledón Calderón, in his capacity as Director of Agua-MINAE, or whoever holds that position, conduct an on-site inspection (inspección in situ) at the location in San José, Acosta, Palmichal, San Pablo, coordinates N 9° 50` 273" W 84° 10` l9.6", WGS 84 projection, apparently owned by Grupo Ganadero Roqueta S.A., corporate identification number 3-l01-318767, represented by Mr. Edgar Ureña Salazar, identity card number l-0424-0292, and submit a report to this Office regarding the conditions at the site in relation to the bodies of water present on the property, determining their type and whether they are being affected by the works carried out there; if they are springs (nacientes), whether they have been tapped and whether the relevant permits for their use have been obtained.
Where appropriate, he is requested to submit to this Office the corresponding economic valuation of any potential environmental damage affecting the bodies of water. For assistance in locating the site of the events, he may contact Mr. Efraín Monge Hernández, Oficina Subregional de Puriscal, Área de Conservación Pacífico Central, at telephone number 2416-6576. THIRD: To verify the substantive truth of the facts, this Tribunal considers it appropriate to request that Mr. Efraín Monge Hernández, in his capacity as Head of the Oficina Subregional de Puriscal, Área de Conservación Pacífico Central, or whoever holds that position, state whether the property located in San José, Acosta, Palmichal, San Pablo, coordinates N 9° 50` 27.3" W 84" l0` 19.6", WGS 84 projection:
The area disturbed on the basis of a certificate of origin (certificado de origen) was not only subject to the cutting and removal of exotic species (cypress), but native species not covered by that document were also harvested. The coordinates specified in the certificates of origin for carrying out the disturbance do not match the coordinates where it was actually performed. It is evident that a logging road (trocha) was opened to remove the timber. That road was opened partly within forest lands. The road and timber harvesting (aprovechamiento de madera) were carried out on land with little stability due to its friable nature, as well as on steep slopes exceeding 70%. As a result of soil destabilization, landslides occurred at several points within the disturbed area. The clearing of the land, the road, and the destabilization caused material to flow into the Río Tabarcia and a possible stream, as well as into their protection areas, adversely affecting forest areas and native and indigenous species.
Some trees were cut within the protection area of the Río Tabarcia and of a possible stream, and even within the protection areas of possible springs (nacientes). The property subject to harvesting, or at least the disturbed area, is located entirely within the boundaries of the ZPCE and within the Corredor Biológico Paso de las Lupas. ADESSARU states that the disturbance of the land would affect the human-consumption water intake located in the Río Tabarcia because of sediment contamination. The soils present in this area could be classified as Class VIII soils because of stoniness, steep slopes, shallow effective depth, and low fertility, as well as the presence of a protected wildlife area (Área Silvestre Protegida, ASP). Without asserting that this is correct, it is the opinion of the undersigned that this area could qualify as a groundwater recharge area (área de recarga acuífera). Because it is a protected wildlife area and because of the earthworks (movimientos de tierra) performed, SETENA’s opinion should have been requested regarding the possibility of obtaining environmental viability (viabilidad ambiental), considering that the property is located within a protected wildlife area and given the fragility or vulnerability of the area.

In addition to the foregoing, by official letter number DA-UHTPCOSJ-0202-2016 (appearing at folios 187 and 188 of the case file), signed by Eng. Jesús Monge Mejía, an official of the Dirección de Agua del MINAE, the presence of 4 permanent-flow springs located in the reported sector is certified. (…) . This Court considers it appropriate to adopt a precautionary measure (medida cautelar) consisting of the following: To order GRUPO GANADERO ROQUETA SOCIEDAD ANONIMA, legal entity identification number 3-101-3I8767, represented by Mr. EDGAR UREÑA SALAZAR, holder of identity card 1-0424-0292, to refrain absolutely from cutting trees without the proper authorization of the Administración Forestal del Estado, as well as from performing earthworks within the protection areas of the identified springs, respecting their protection areas in accordance with the Ley Forestal and the Ley de Aguas (15 meters along the banks of streams or rivers, 50 horizontal meters if the terrain is rugged, 100 meters if springs exist, and 200 meters if the spring is used as a water intake), on the property registered under real-property folio number 1-109600, located in the sector of Palmichal, Acosta, San José, and recorded in the name of GRUPO GANADERO RÓQUETA SOCIEDAD ANÓNIMA, legal entity identification number 3-101-318767, represented by Mr.
EDGAR UREÑA SALAZAR, holder of identity card 110424-0292. The effects of this interlocutory precautionary measure (medida cautelar interlocutoria) shall remain in force until this Office issues the final administrative act (acto final) in these ordinary administrative investigation proceedings or rules otherwise. Mr. Edgar Ureña Salazar, holder of identity card 1-0424-0292, in his capacity as President of GRUPO GANADERO ROQUETA SOCIEDAD ANÓNIMA, legal entity identification number 3-101-318767, is hereby advised that failure to comply fully with the precautionary measure could render him liable for the offense of disobedience to authority, established and punishable by imprisonment under Article 314 of the Código Penal. A motion for reconsideration (recurso de revocatoria) may be filed against this precautionary measure within the third business day following service of this decision, pursuant to Article 346 of the Ley General de Administración Pública.
For the implementation of this precautionary measure, Eng. Efraín Monge, in his capacity as Head of the Oficina Sub Regional de Puriscal, or whoever holds that position, is hereby commissioned and shall submit reports every two months verifying compliance with the precautionary measure imposed. Having reviewed and analyzed complaint letters numbers ACOPACOSRP-DEN-021-141 ACOPAC-OSRP-DEN-02045 and ACOPAC-OSRP-DEN-017-2016, signed by officials of the Oficina SubRegional de Puriscal del Área de Conservación Pacífico Central, this Office considers it necessary to order Eng. Alfonso Duarte Marín, in his capacity as Director of the Área de Conservación Pacífica Central, or whoever holds that position, to conduct the corresponding Economic Valuation of Environmental Damage (Valoración Económica del Daño Ambiental) resulting from the reported acts, specifying the mitigation measures (medidas de mitigación) to be applied in this particular case.
The foregoing shall be completed within ten calendar days counted from the first business day following service of this decision. (...)”. He states that he has carried out the procedural acts inherent to the preliminary investigation proceedings, namely requesting the corresponding reports and scheduling an on-site visual inspection (inspección ocular “in situ”) to ascertain the factual truth of the reported acts. He requests that the appeal be denied.
4. Efraín Monge Hernández, in his capacity as Head of the Puriscal Subregional Office of the Área de Conservación Pacifico Central (ACOPAC) of the Sistema Nacional de Áreas de Conservación (SINAC) of the Ministerio del Ambiente y Energía (MINAE), states under oath that the Puriscal Subregional Office received the documentation for certificate of origin under the forest plantation category (plantación forestal) N°53514 H (ADVZ-2014-004), with forestry oversight form (formulario de regencia forestal) N° 10644 F, on 26 de agosto del 2014, issued by forestry overseer (regente forestal) Eng. Alfonso Javier del Valle Zúñiga. The Puriscal Subregional Office then opened the case file “PC-PC01-CO-PF-193-14 Grupo Ganadero la Roqueta S.A. Plantación Forestal.” He adds that on 27 de setiembre del 2014, the submitted documentation was entered into the Sistema de Información para el Control del Aprovechamiento Forestal (SICAF), where it was registered under expediente PC-PC01-CO-PF-193-14.
On 2 de setiembre del 2014, expediente PC-PC01-CO-PF-193-14 was assigned for entry of the information into the SICAF system registry. On 16 de setiembre de 2014, Mr. Rodrigo Cascante Vargas, President of the Asociación de Desarrollo Sostenible San José Rural (ADESSARU), filed a complaint concerning irregularities in timber harvesting (aprovechamiento maderable) and the opening of tracks (apertura de trochas) in the protection area (área de protección) of Río Tabarcia. On 21 de setiembre de 2014, officials from the Puriscal Subregional Office (OSRP), accompanied by Fuerza Pública officers, conducted a site visit, which resulted in official letter ACOPAC-OSRP-1059-14. That letter mentions the existence of an old track and states that no new roads had been built in the protection area, that Article 33 of the Ley Forestal had not been violated, and that the felling of a cypress plantation had been confirmed.
He states that on 23 de setiembre de 2014, the Departamento de Gestión Ambiental of the Municipalidad de Acosta submitted, through official letter FMGA-101-2014, a request for an inspection in San Pablo de Palmichal de Acosta. Through official letter ACPPAC-OSRP-1099-2014 of 29 de setiembre de 2014, preparation of the inspection report concerning the springs (nacientes) of Palmichal, San Pablo de Palmichal de Acosta, commenced. On 09 de octubre de 2014, a copy of official letter ACPOCA-OSRP-1099-14 was delivered to the Dirección Regional del ACOPAC, Municipalidad de Puriscal. Through official letter ACOPAC-ORS-019-14, an environmental complaint (denuncia ambiental) was filed against Grupo Ganadero Roqueta S.A., represented by Mr. Edgar Ureña Salazar, and a copy was delivered to the Ministerio Público Fiscalía de Puriscal on 10 de octubre de 2014. On 16 de octubre de 2014, harvesting report (informe de aprovechamiento) N°53539-H al 53540 H, issued by Alfonso Javier del Valle Zúñiga, was received; it states that he conducted a visit on 21 de setiembre de 2014 and provides a description of the condition of the property and recommendations made upon closing that harvesting operation.
On 21 de octubre de 2014, Mr. Edgar Ureña Salazar requested a copy of the complaint filed by Mr. Rodrigo Cascante Vargas. On 23 de marzo de 2015, through official letter OSRP-996-14, the certificate-of-origin information was entered because that case file had been under investigation (due to the length of time the case file remained under investigation, when it was entered into the system, a recommendation that it be denied was recorded on that date). He states that the OSRP opened expediente ACOPAC-OSRP-056-15 upon receiving by fax, on 25 de marzo de 2015, decision 132-15-TAA, expediente N°296-14-02-TAA, from the Tribunal Ambiental Administrativo against Edgar Ureña Salazar, filed by the Alcalde de Puriscal for impacts on springs, tree cutting (corta de árboles), and the opening of a track, which had been submitted on 23 de setiembre de 2014. This matter was addressed through official letters ACOPAC-OSRP-1059-14 and ACOPAC-OSRP-1099-2014.
EL expediente 282-14-03-TAA, filed (sic) by Mr. Rodrigo Cascante Vargas, President of ADESSARU, against Grupo Ganadero la Roqueta S.A. (Edgar Ureña Salazar), concerns the same matter as expediente N°296-14-02-TAA (that case file was consolidated with 282-14-03-TAA), with the OSRP case file being N°ACOPAC-OSRP-056-15, while the information was retained in expediente PC-PC01-CO-PF-193-14; these case files remain pending. He states that, regarding other actions involving Edgar Ureña’s properties or properties located in the Nacientes de Palmichal area, expediente administrativo EXP-ACOPAC-OSRP-DEN-211-14 concerns a complaint against Edgar Ureña Salazar that was submitted to the TAA through complaint letter ACOPAC-OSRP-DEN-021-14 of 10 de octubre de 2014 and accepted and processed by the Tribunal Ambiental Administrativo under expediente 339-14-03-TAA of 01 de junio de 2015. For that complaint, the TAA found a connection between the subregional office’s expediente administrativo EXP. ACOPAC-OSRP-DEN-2011-14 TRAMITADA MEDIANTE EXPEDIENTE n°339-14-03-TAA and N°296-14-02-TAA, and consolidated the latter with 282-14-03-TAA even though they concerned different sites.
On 01 de julio de 2015, regarding expediente ACOPAC-OSRP-DEN-211-14, Mr. Ureña was served with an administrative warning (advertencia administrativa) ordering the suspension of work in protection areas surrounding springs, forests, and streams. He adds that the complaint filed by Mr. Hernán Ramírez Alfaro against Grupo Ganadero Roqueta S.A. was processed under expediente ACOPAC-OSRP-DEN-059-15 and addressed through ACOPAC-OSRP-DEN-020-15 of 16 de junio de 2015, concerning the encroachment upon protection areas surrounding springs and streams. Because the properties that were the subject of the complaint were already known under expediente N°WXP-ACOPAC-OSRP-DEN-2011 14, Mr. Ureña was served, on 01 de julio del 2015, with an administrative warning ordering the suspension of work in protection areas surrounding springs, forests, and streams. He concludes that, contrary to the appellant’s assertions, the Puriscal Subregional Office acted diligently by addressing the complaints promptly, thereby preventing greater harm, and referring them to the appropriate administrative and judicial authorities; a precautionary measure (medida cautelar) suspending the work was also issued to prevent the harm from continuing.
He explains that once the active administration (Administración activa) brings a matter to the attention of the administrative and judicial authorities, it is bound by their decisions. Nevertheless, inspections continued to be conducted at the site to verify that the impacts did not continue. The appellant has also provided a very extensive description of the actions taken by the Subregional Office and is fully aware that this office has acted in accordance with the regulations in force to safeguard the integrity of the species and ecosystems in that area. Furthermore, although he alleges that 3 years is too long to resolve an environmental matter in which environmental damage (daños ambientales) was documented, that office is not responsible for or charged with resolving the matter or issuing the corresponding judicial or administrative decision. He requests that the appeal be denied.
Justice Cruz Castro drafted the decision; and,
Considering:
I.Subject matter of the petition. The petitioner alleges that the various administrative complaints concerning environmental damage, filed before the Tribunal Ambiental Administrativo and the other respondent authorities more than three years ago, have not been addressed, and that the only action taken by the TAA has been to consolidate case files N°296-14-02-TAA and 282-14-03-TAA. This is despite the environmental alteration and its serious effects, with no administrative action having been taken since the complaint was filed and three years having already elapsed without intervention to correct this serious problem. He contends that his fundamental rights have been violated and therefore requests that the petition be granted, with the consequences prescribed by law.
II.Proven facts. For purposes of deciding this matter, the following facts are deemed duly established, either because they have been proven or because the respondent failed to address them as required by the initial order:
Regarding the TAA:
a. On September 23, 2014, Manuel Espinoza Campos, in his capacity as Alcalde of the Municipalidad de Puriscal, submitted to the TAA official letter PSAM-074-2014, through which he formally filed an environmental complaint seeking an investigation into the events that occurred on the property registered under San José real-property folio 502010, located in Palmichal de Acosta. (See folios 35 to 41 of the administrative case file and the report of the President of the TAA).
b. The complaint was incorporated into administrative case file N° 296-14-02TAA, which was subsequently consolidated with case file N° 282-14-03-TAA (report of the President of the TAA).
c. Official letter TAA-DT-01 12-14 dated October 13, 2014, submitted the Field Visit Report concerning the visit conducted on October 2, 2014, to the property located in San Pablo, Palmichal, Acosta, San José, Hoja Cartográficas Abra 3345 I, Edición 3 IGNCR 1989, Ubicación Geográfica N 9" 50' 27.3 W 84° 10' 19.6 proyección WGS84 (Report ACOPAC-ASRP-QJ-10992014 dated September 29, 2014, appears at folios 85 to 95 of the administrative case file, according to the report of the President of the TAA).
d. By Resolution N" 1007-14-TAA at 08:20 hours on 12 de noviembre del año 2014, issued in administrative expediente N" 282-14-03-TAA, the following was established: First: To request that Mr. Eng. Alfonso Duarte Marín, in his capacity as Director of the Área de Conservación Pacifico Central (ACOPAC), or whoever holds that position, conduct an on-site visual inspection (inspección ocular "in situ") of the Río Tarbacia (this Office does not have a more precise address) for the purpose of verifying the facts described in the complaint: an apparent extraction of timber, sedimentation, and damage to the flora and fauna of the area. Likewise, if possible, the alleged party responsible for the aforementioned acts shall be identified. If any significant adverse impact is found, he shall, within the scope of his authority, prepare the corresponding Economic Valuation of Environmental Damage (Valoración Económica del Daño Ambiental) and submit it to this Office.
(See folios 2 and 3 of the administrative expediente and (report of the President of the TAA) e. By Resolution N° 1324 5-TAA at 13:52 hours on 16 de febrero de 2015, administrative expediente N° 296-14-02-TAA, the following was requested: "(...] FIRST: In the case before us, this Office considers it of the utmost importance, for purposes of establishing the substantive truth (verdad real) of the reported facts, to order Mr. Luis Alberto Durán Gamboa, in his capacity as Mayor of the Municipalidad de Acosta, or whoever holds that position, to: 1) certify to this Office who the registered owner (propietario registral) is of the property located in San José, Acosta, Palmichal, San Pablo, coordinates N 9° 50` 27.3" W $4° l0` l9.6", WGS84 projection, apparently owned by the company Grupo Ganadero Roqueta S.A., corporate identification number 3-101-318767, represented by Mr. Edgar Ureña Salazar, identity card number 1-0424.0292; 2) inform this Office whether any permits have been granted for the indicated property and, if so, what type.
Likewise, provide any other information deemed relevant to this expediente (report of the President of the TAA) f. For the purpose of verifying the substantive truth of the facts, the Tribunal requested that the Director de Agua-MINAE conduct an inspection at the site located in San José, Acosta, Palmichal, San Pablo, coordinates N 9° 50` 273" W 84° 10` l9.6", WGS84 projection, apparently owned by the company Grupo Ganadero Roqueta S.A., and submit a report on conditions at the site regarding the bodies of water present on the property, determining what type they are and whether they are being affected by the works carried out there. If they are springs (nacientes), the report shall state whether they have been tapped and whether the relevant permits for their use have been obtained. It further requested that the corresponding economic valuation of any potential environmental damage be submitted to that Office if such damage to the bodies of water exists (report of the President of the TAA) g. The TAA requested that the Head of the Oficina Subregional de Puriscal, Área de Conservación Pacífico Central, state whether the property located in San José, Acosta, Palmichal, San Pablo, coordinates N 9° 50` 27.3" W 84" l0` 19.6", WGS84 projection:
l. By Official Letter DA-UHTPCOSJ›0250-2016 of 30 de marzo del 2016, signed by Eng. Marilyn Mora Vega in her capacity as Coordinator of the Unidad Hidrológica Tárcoles Pacífico Central of the Dirección de Agua, she stated that there are four permanent-flow springs (nacientes de cauce permanente) (report of the President of the TAA) m. After analyzing the documents comprising this administrative expediente, by Resolution N° 3762017-TAA at 11:37 hours on 28 de marzo del año 2017, the TAA ordered an interim measure (medida cautelar) and conducted an on-site visual inspection for the purpose of investigating the reported facts. In Official Letter number TAA-DT-0112-014, signed by Eng. Alexis Madrigal Chaves and Biologist Juan Sánchez Ramírez, both in their capacity as officials of the Departamento Técnica, the following was concluded: The property of Grupo Ganadero Roqueta S.A. is apparently located entirely within the boundaries of the ZPCE.
Based on a certificate of origin (certificado de origen), the intervened area was used not only for the cutting and extraction of exotic species (cypress) but also for the harvesting of native species that were not covered by the indicated document. The coordinates stated in the certificates of origin for carrying out the intervention do not match the coordinates where it was actually performed. A track was opened to extract the timber. That track was opened within forest lands. The track and timber harvesting were carried out on land with little stability because of its friable nature and steep slopes exceeding 70%. As a result of soil destabilization, landslides occurred at several points in the intervened area. The clearing of the land, the track, and the destabilization carried material into the Río Tabarcia and a possible stream, as well as into their protected areas, and caused impacts on forest areas and native and indigenous species.
Some trees were cut within the protected area of the Río Tabarcia and of a possible stream, and even within the protected areas of possible springs. The property subject to harvesting, or at least the intervened area, is located entirely within the boundaries of the ZPCE and within the Corredor Biológico Paso de las Lupas (report of the President of the TAA) n. ADESSARU stated that the intervention on the land would affect the intake of water for human consumption located in the Río Tabarcia because of sediment impacts. The soils in this area could be classified as Class VIII soils due to rockiness, steep slopes, shallow effective depth, and low fertility, as well as the presence of an ASP. Without asserting that this is correct, the signatories are of the opinion that this area could qualify as a groundwater recharge area (área de recarga acuífera). Because it is an ASP and because of the earthworks (movimientos de tierra) carried out, SETENA should have been consulted regarding the possibility of obtaining environmental approval (viabilidad ambiental), given that the property is located within an ASP and considering the fragility or vulnerability of the area.
(…)". (report of the President of the TAA) o. By Official Letter number DA-UHTPCOSJ-0202-2016, signed by Eng. Jesús Monge Mejía, an official of the Dirección de Agua of MINAE, the presence of 4 permanent-flow springs located in the reported sector is certified (appearing at folios 187 and 188 of the expediente).
p. The TAA ordered an interim measure against Grupo Ganadero Roqueta Sociedad Anónima and absolutely prohibited it from cutting trees without proper authorization from the Administración Forestal del Estado, as well as from carrying out earthworks within the protected area of the identified springs, respecting their protected areas in accordance with the provisions of the Ley Forestal and the Ley de Aguas (15 metros along the banks of streams or rivers, 50 metros horizontally if the terrain is broken, 100 metros if springs exist, and 200 metros if it is a tapped spring), on the property registered under real-property folio (matrícula folio real) 1-109600, located in the sector of Palmichal, Acosta, San José. The effects of this interlocutory interim measure (medida cautelar interlocutoria) shall remain in force until that Office issues the final administrative act (acto final) in this ordinary administrative investigation proceeding (procedimiento ordinario administrativo de investigación), or until it rules otherwise (report of the President of the TAA) q. For implementation of this interim measure, Eng.
Efraín Monge, in his capacity as Head of the Oficina Sub Regional de Puriscal, or whoever holds that position, was commissioned and shall submit bimonthly reports verifying compliance with the interim measure imposed (report of the President of the TAA) r. After analyzing complaint Official Letters numbers ACOPACOSRP-DEN-021-141 ACOPAC-OSRP-DEN-02045 and ACOPAC-OSRP~DEN-017-2016, signed by officials of the Oficina Sub Regional de Puriscal of the Área de Conservación Pacífico Central MCOPAC), the TAA ordered the Director of the Área de Conservación Pacífica Central MCOPAC) to prepare the corresponding economic valuation of environmental damage resulting from the reported acts, indicating the mitigation measures (medidas de mitigación) to be applied in this particular case. The foregoing shall be completed within ten calendar days, counted from the first business day following service of this resolution. (...) (report of the President of the TAA) From the Área de Conservación Pacífico Central:
s. On 26 de agosto de 2014, the documentation for certificate of origin (certificado de origen) under forest plantation category N°53514 H (ADVZ-2014-004), together with forestry oversight form (formulario de regencia forestal) N° 10644 F issued by forestry overseer Ing. Alfonso Javier Del Valle Zúñiga, was received at the Oficina Subregional Puriscal, and the Oficina Subregional de Puriscal proceeded to open the case file "PC-PC01-CO-PF-193-14 Grupo Ganadero la Roqueta S.A. Plantación Forestal." (report by Efraín Monge Hernández, in his capacity as Head of ACOPAC, of SINAC of MINAE).
t. On 27 de setiembre del 2014, the documentation submitted was entered into the Sistema de Información para el Control del Aprovechamiento Forestal (SICAF), where it was registered under case file number PC-PC01-CO-PF-193-14 (report by Efraín Monge Hernández, in his capacity as Head of ACOPAC, of SINAC of MINAE).
u. On 2 de setiembre del 2014, case file PC-PC01-CO-PF-193-14 was assigned for entry of the information into the SICAF system registry (report by Efraín Monge Hernández, in his capacity as Head of ACOPAC, of SINAC of MINAE).
v. On 16 de setiembre de 2014, Rodrigo Cascante Vargas, President of the Asociación de Desarrollo Sostenible San José Rural (ADESSARU), filed a complaint regarding irregularities in timber harvesting (aprovechamiento maderable) and the opening of trails (apertura de trochas) within the protection area (área de protección) of Río Tabarcia (report by Efraín Monge Hernández, in his capacity as Head of ACOPAC, of SINAC of MINAE).
w. On 21 de setiembre de 2014, officials from the Oficina Subregional de Puriscal (OSRP), accompanied by Fuerza Pública officers, conducted a site visit, which resulted in official letter ACOPAC-OSRP-1059-14. The letter states that an old trail existed, that no new roads had been built within the protection area, that article 33 of the Ley Forestal had not been violated, and that the cutting of a cypress plantation had been verified (report by Efraín Monge Hernández, in his capacity as Head of ACOPAC, of SINAC of MINAE).
x. On 23 de setiembre de 2014, a request to inspect San Pablo de Palmichal de Acosta was received from the Departamento de Gestión Ambiental de la Municipalidad de Acosta through official letter FMGA-101-2014 (report by Efraín Monge Hernández, in his capacity as Head of ACOPAC, of SINAC of MINAE).
y. Through official letter ACPPAC-OSRP-1099-2014 of 29 de setiembre de 2014, preparation of the inspection report concerning the springs (nacientes) of Palmichal, San Pablo de Palmichal de Acosta, was initiated (report by Efraín Monge Hernández, in his capacity as Head of ACOPAC, of SINAC of MINAE).
z. On 09 de octubre de 2014, a copy of official letter ACPOCA-OSRP-1099-14 was delivered to the Dirección Regional del ACOPAC, Municipalidad de Puriscal (report by Efraín Monge Hernández, in his capacity as Head of ACOPAC, of SINAC of MINAE).
aa. Through official letter ACOPAC-ORS-019-14, an environmental complaint (denuncia ambiental) was filed against Grupo Ganadero Roqueta S.A., represented by Edgar Ureña Salazar, and a copy was delivered to the Ministerio Público Fiscalía de Puriscal on 10 de octubre de 2014 (report by Efraín Monge Hernández, in his capacity as Head of ACOPAC, of SINAC of MINAE).
bb. On 16 de octubre de 2014, harvesting report N°53539-H al 53540 H, issued by Alfonso Javier del Valle Zúñiga, was received. It states that he conducted a visit on 21 de setiembre de 2014 and describes the condition of the property and provides recommendations for closing out that harvesting operation (report by Efraín Monge Hernández, in his capacity as Head of ACOPAC, of SINAC of MINAE).
cc. On 21 de octubre de 2014, Edgar Ureña Salazar requested a copy of the complaint filed by Rodrigo Cascante Vargas (report by Efraín Monge Hernández, in his capacity as Head of ACOPAC, of SINAC of MINAE).
dd. On 23 de marzo de 2015, through official letter OSRP-996-14, the certificate-of-origin information was entered because the case file had been under investigation (due to the length of time the case file remained under investigation, when it was entered into the system a recommendation for denial was entered on this date (report by Efraín Monge Hernández, in his capacity as Head of ACOPAC, of SINAC of MINAE).
ee. The OSRP office opened case file ACOPAC-OSRP-056-15 upon receiving by fax, on 25 de marzo de 2015, resolution 132-15-TAA, case file N°296-14-02-TAA, of the Tribunal Ambiental Administrativo against Edgar Ureña Salazar, which had been filed by the Alcalde de Puriscal for impacts on springs, tree cutting, and the opening of a trail, and submitted on 23 de setiembre de 2014 (report by Efraín Monge Hernández, in his capacity as Head of ACOPAC, of SINAC of MINAE).
ff. Case file 282-14-03-TAA, filed (sic) by Rodrigo Cascante Vargas, President of ADESSARU, against Grupo Ganadero la Roqueta S.A. (Edgar Ureña Salazar), corresponds to the same case file N°296-14-02-TAA (that case file was consolidated into 282-14-03-TAA), with the OSRP case file being N°ACOPAC-OSRP-056-15, while the information remained in case file PC-PC01-CO-PF-193-14; these case files remain pending (report by Efraín Monge Hernández, in his capacity as Head of ACOPAC, of SINAC of MINAE).
gg. Administrative case file (expediente administrativo) EXP-ACOPAC-OSRP-DEN-211-14, in which the complaint against Edgar Ureña Salazar was processed, was submitted to the TAA through complaint letter ACOPAC-OSRP-DEN-021-14 of 10 de octubre de 2014, and the Tribunal Ambiental Administrativo accepted and processed it under case file number 339-14-03-TAA of 01 de junio de 2015 (report by Efraín Monge Hernández, in his capacity as Head of ACOPAC, of SINAC of MINAE).
hh. For that complaint, the TAA ordered the joinder due to relatedness (conexidad) of the subregional office’s administrative case file EXP. ACOPAC-OSRP-DEN-2011-14, processed under case file N°339-14-03-TAA, with N°296-14-02-TAA, and consolidated the latter into 282-14-03-TAA despite their involving different sites. (report by Efraín Monge Hernández, in his capacity as Head of ACOPAC, of SINAC of MINAE) ii. On 01 de julio de 2015, with respect to case file ACOPAC-OSRP-DEN-211-14, Mr. Ureña was served with an administrative warning (advertencia administrativa) ordering the cessation of work in protection areas for springs, forests, and streams (report by Efraín Monge Hernández, in his capacity as Head of ACOPAC, of SINAC of MINAE).
jj. The complaint filed by Hernán Ramírez Alfaro against Grupo Ganadero Roqueta S.A. was processed in case file ACOPAC-OSRP-DEN-059-15 and addressed through ACOPAC-OSRP-DEN-020-15 of 16 de junio de 2015, concerning the encroachment upon protection areas for springs and streams (report by Efraín Monge Hernández, in his capacity as Head of ACOPAC, of SINAC of MINAE).
kk. On 01 de julio del 2015, Mr. Ureña was served with an administrative warning ordering the cessation of work in protection areas for springs, forests, and streams.
From the Dirección de Aguas del Ministerio de Ambiente y Energía ll. Through resolution 017-15-TAA issued by the Tribunal Ambiental Administrativo in case file 339-14-03-TAA, the Dirección de Aguas was requested to "conduct an on-site inspection of the property located in Palmichal de Acosta, 200 metros east of the ADESARO facilities, whose apparent registered owner is Edgar Ureña Salazar, in order to verify the existence of 8 possible springs, whose status must be certified." (Report by José Miguel Zeledón Calderón, in his capacity as Director de Aguas del Ministerio de Ambiente y Energía) mm. The Dirección conducted a site inspection and determined that only 4 springs with permanent flow existed. Through technical report DA-UHTPCOSJ-0202-2016, it transmitted those findings to the TAA, and the report was added to the TAA case file (Report by José Miguel Zeledón Calderón, in his capacity as Director de Aguas del Ministerio de Ambiente y Energía)
a. That, before this action was filed, the TAA adopted timely precautionary measures (medidas cautelares) to stop or prevent the reported activities that create an environmental risk in the affected area.
Before examining the merits of the claim—concerning the alleged violation of the right to proceedings conducted and concluded without undue delay (derecho a un procedimiento pronto y cumplido)—it must be clarified that, since judgment No. 2008-02545 of 8:55 hrs. de 22 de febrero de 2008, this Chamber has referred to the contentious-administrative jurisdiction (jurisdicción contencioso administrativa)—with some exceptions—those matters in which the issue is whether the public administration complied with the time limits established by the Ley General de la Administración Pública (artículos 261 y 325) or by sectoral laws governing special administrative proceedings, either to conclude an administrative proceeding—initiated sua sponte or at a party’s request—by issuing a final administrative act, or to decide the applicable administrative appeals. This matter specifically presents an exception because it concerns a request made within an environmental-protection proceeding (procedimiento de tutela medio ambiental), placing the case within one of the exceptions and making it appropriate to examine the merits, as is done below. First, the TAA’s actions will be addressed, followed by an analysis of the actions of the other respondent authorities.
V.Regarding the TAA. The statement of proven facts demonstrates that, on 23 de setiembre del 2014, Manuel Espinoza Campos, in his capacity as Mayor of the Municipalidad de Puriscal, filed a formal environmental complaint (denuncia de carácter ambiental) with the TAA, requesting an investigation into the events that occurred on the property registered under real-property folio number San José 502010, located in Palmichal de Acosta. By Resolution N° 1437-15-TAA, issued at 07:45 hours on 12 de noviembre del 2015 in Expediente N°296-14-02-TAA, the complaint processed under that case file was consolidated (acumular) with administrative case file N° 28244-03-TAA. Four months later, through Official Letter DA-UHTPCOSJ-0250-2016 of 30 de marzo del 2016 from the Coordinator of the Unidad Hidrológica Tárcoles Pacífico Central of the Dirección de Agua, it was reported that there were four permanent-flow springs (nacientes de cauce permanente) in the reported area.
It was not until the end of March 2017, by Resolution N" 3762017-TAA, issued at 11:37 hours on 28 de marzo del año 2017, and in connection with this proceeding, that the TAA ordered a precautionary measure (medida cautelar) and conducted an on-site visual inspection (inspección ocular “in situ”) to investigate the reported facts on the property of Grupo Ganadero Roqueta S.A., involving the cutting and removal of exotic species (cypress), the harvesting (aprovechamiento) of native species, the opening of a track (trocha) through forest land to remove timber, and soil destabilization at several locations within the disturbed area, which caused landslides. The clearing of the land, the track, and the destabilization carried material into the Río Tabarcia and a possible stream, as well as into their protection areas (áreas de protección), and adversely affected forest areas and native and indigenous species.
Some trees were cut within the protection area of the Río Tabarcia and of a possible stream, and even within the protection areas of possible springs. The TAA also determined that the disturbance of the land would affect the drinking-water intake located in the Río Tabarcia because of sediment contamination. The soils in this area could be classified as Class VIII soils because of their stoniness, steep slopes, effective depth, and low fertility, as well as the presence of a Protected Wild Area (Área Silvestre Protegida, ASP). Without asserting that this is correct, the area could qualify as an aquifer-recharge area (área de recarga acuífera). Because it is an ASP and because of the earthworks (movimientos de tierra) performed, SETENA’s opinion should have been requested regarding the possibility of obtaining environmental approval (viabilidad ambiental), considering that the property is located within an ASP and the fragility or vulnerability of the area.
From the factual circumstances described, considered together with the report submitted to this Chamber by the President of the TAA, it is apparent that the respondent Tribunal ordered Grupo Ganadero Roqueta Sociedad Anónima—as a precautionary measure—to refrain absolutely from cutting trees without proper authorization from the Administración Forestal del Estado and from carrying out earthworks within the protection areas of the identified springs, while respecting their protection areas in accordance with the Ley Forestal and the Ley de Aguas (15 metros a lo larga de las riberas de las quebradas o ríos, 50 metros horizontales si el terreno es quebrada, 100 metros si existen nacientes y 200 metros si es una naciente captada, on the property registered under real-property folio number 1-109600, located in Palmichal, Acosta, San José), almost three years after the first complaint was filed with the TAA in September 2014.
It was only in connection with this proceeding that it decided to adopt a precautionary measure to prevent further environmental damage, which was plainly too late to provide protection because, in this matter, the respondent authority itself acknowledges the negative effects of the unlawful activity that it has been investigating with extreme slowness, without adopting precautionary measures (medidas precautorias) to avert the risks described by the petitioner. The petition must therefore be granted insofar as it is directed against the TAA, as is hereby ordered.
VI.Regarding the Área de Conservación Pacífico Central. From a specific analysis of the actions taken by the Área de Conservación Pacífico Central, particularly the Oficina Subregional de Puriscal, this Chamber observes that, after receiving the various complaints, it processed them and, in July 2015, ordered a precautionary measure suspending the works (paralización de obras) to prevent the damage from continuing. Although the reporting officials from the Área de Conservación state that inspections continued to be conducted to verify that the adverse impacts did not persist, there is no record that any action was taken in response to the private party’s failure to comply with those measures or that those authorities informed the TAA of such noncompliance. Ordering precautionary measures is not sufficient to prevent environmental damage; when imposed measures are disregarded, the respondent authority must initiate the mechanisms afforded by the legal system to enforce them and ensure that the consequences arising from their noncompliance are imposed. The petition must therefore be granted insofar as it is directed against the Área de Conservación, under the terms to be set forth in the operative portion (parte dispositiva) of this judgment.
Insofar as the petition is directed against the Dirección de Aguas, this Chamber observes from the various reports that the agency conducted the inspection of the property located in Palmichal de Acosta that the TAA had ordered in the case file and determined that springs existed at the site (technical report DA-UHTPCOSJ-0202-2016, submitted to the TAA). There is no indication that, when this petition was filed, any information requested by the Tribunal Ambiental from that office remained pending for purposes of supplementing the information submitted. Consequently, no violation of the rights invoked by the petitioner is apparent, and the petition must be dismissed insofar as it is directed against the Dirección de Aguas, as is hereby ordered.
VIII.Conclusion. For purposes of deciding the petition filed by the claimant in this matter, it is clear that the TAA has taken actions aimed at investigating properties, analyzing activities involving the felling and harvesting of trees, and the unauthorized opening of a track in protected areas. It has also identified the alleged offenders involved and coordinated with the various entities responsible for assisting with the investigation. Nevertheless, it was not until this petition was filed, in March 2017, that it decided to issue a precautionary measure warning the alleged offender not to commit the acts deemed harmful to the environment, which was both untimely and unjustifiable. The Administration is required to decide matters submitted to it within a reasonable time; and although this Chamber has made clear that Article 41 of the Constitución Política has not constitutionalized a right to specific deadlines, but rather the fundamental right of every person to have their case decided within a reasonable time, the fact remains that, in this matter, the evidence submitted does not establish that any of the respondent administrative environmental authorities empowered to do so took timely preventive action—before the final decision on the environmental complaint—to prevent or halt the risk posed by a strong presumption of conduct clearly harmful to the environment, such as, in this case, the unauthorized felling and harvesting of trees, the construction of a track in a protected area, and a series of prohibited activities that damage the environment.
This is authorized by Article 99 of the Ley Orgánica del Ambiente, N°7554 del 04 de octubre de 1995, which establishes, in its section on administrative penalties (sanciones administrativas), a series of protective preventive measures that the Administración Pública must apply in cases involving violations of the environmental-protection rules contained both in the Ley Orgánica del Ambiente and in other provisions protecting the environment or biological diversity, as well as in response to conduct harmful to the environment. The provisional measures (medidas provisorias) include: “… d) Partial or total restrictions, or an order for the immediate suspension of the acts giving rise to the complaint. e) Total or partial, temporary or permanent closure of the acts or events giving rise to the complaint…. h) Modification or demolition of buildings or works that damage the environment.” Accordingly, the petition must be granted on this ground, and the respondent Administration is advised of its obligation to decide complaints that may affect the environment within a reasonable time. However, for the reasons stated in Considerando VII, the petition must be dismissed insofar as it is directed against the Director de Aguas, as is hereby ordered.
IX.Regarding the Defensoría de los Habitantes. Given the inaction in this matter by the competent administrative authorities in response to the serious reported events that are harming the environment on the property at issue, located in San José, Acosta, Palmichal, San Pablo, and that may harm the inhabitants, this judgment shall be served on the Defensoría de los Habitantes for such action as may fall within its authority.
X.Note by Justice Cruz Castro: This matter involves serious harm to the environment. So much time has passed without an effective response from the authorities responsible for protecting the environment. Events that are extremely serious from an environmental standpoint were not addressed in a timely manner, because the reported acts date back to 2014, without a timely response. It is indisputable that the tribunal ambiental administrativo faces an extremely serious backlog; this deficiency has been reported in the press, particularly in an article published by the weekly newspaper Universidad on 17 febrero del 2016. The news report was written by Diego Arguedas Ortiz. The article is titled: “Cases Against Pineapple Producers Languish, Stalled in the Tribunal Ambiental.” In those matters, cases involving pineapple producers that had been reported as far back as 2001 remained pending without judgments. The press report states that each judge handles between five hundred and six hundred case files in the tribunal. Fundamental rights founder in the face of such a slow and delayed response. That is what this matter demonstrates. The physical integrity and health of the inhabitants are at risk, without a response commensurate with the legal interests at stake. Excessive workloads, insufficient resources, and lack of coordination do not justify what has occurred in this matter.
Justices Jinesta Lobo and Salazar Alvarado agree that the application for amparo (amparo) should be partially granted, but for different reasons. Specifically, they would dismiss it with respect to the violation of the right to the environment, but grant it solely on the ground of infringement of the right to prompt and proper administrative proceedings (procedimiento administrativo pronto y cumplido); as to that ground, they order the authorities to issue a decision immediately.
A.- REGARDING THE INFRINGEMENT OF THE RIGHT TO THE ENVIRONMENT.
B.- REGARDING THE VIOLATION OF THE RIGHT TO PROMPT AND PROPER ADMINISTRATIVE PROCEEDINGS. We agree that the amparo action should be granted with respect to the unjustified delay by the Tribunal Ambiental Administrativo and the Área de Conservación Pacífico Central in addressing the complaint filed. Nevertheless, unlike the majority, we order that it be resolved immediately, given that almost two and a half years have elapsed since it was filed, which, in our view, is unreasonable.
The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced through new technologies, these must be retrieved from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as pursuant to the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.
Por tanto:
The action is partially granted insofar as it is directed against the Área de Conservación Pacífico Central del Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía and the Tribunal Ambiental Administrativo. Efraín Monge Hernández, in his capacity as Head of the Oficina Subregional de Puriscal del Área de Conservación Pacifico Central del Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía, and Ligia Umaña Ledezma, in her capacity as President of the Tribunal Ambiental Administrativo, or whoever holds those positions, are ordered not to repeat the omissions that place the environment at risk, as occurred in this case, and to take the necessary measures to ensure that the precautionary measures (medidas cautelares) currently in effect and ordered in this matter are duly implemented and that the matter is resolved within a reasonable period.
The aforementioned authorities are warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo action that the person must comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. The State is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the administrative-litigation judgment. The action is denied in all other respects. Efraín Monge Hernández, in his capacity as Head of the Oficina Subregional de Puriscal del Área de Conservación Pacifico Central) del Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía, and Ligia Umaña Ledezma, in her capacity as President of the Tribunal Ambiental Administrativo, or whoever holds those positions, shall be personally served.
Justice Cruz Castro appends a separate note. Justices Jinesta Lobo and Salazar Alvarado agree that the amparo should be partially granted, but for different reasons: they deny it with respect to the violation of the right to the environment and grant it solely with respect to the violation of the right to prompt and proper administrative proceedings; on that issue, they order the authorities to issue a decision immediately. The parties and the Defensoría de los Habitantes shall be notified for the appropriate purposes.

Recurso de amparo que se tramita en expediente número 17-004089-0007-CO, interpuesto por GERARDO CASTILLO MARTÍNEZ, cédula de identidad No. 0601380233, contra EL PRESIDENTE DEL TRIBUNAL AMBIENTAL ADMINISTRATIVO, EL DIRECTOR DEL ÁREA DE CONSERVACIÓN PACÍFICO CENTRAL (ACOPAC), EL JEFE DE LA OFICINA SUBREGIONAL DE PURISCAL DEL ÁREA DE CONSERVACIÓN PACÍFICO CENTRAL Y EL DIRECTOR DE AGUAS, TODOS DEL MINISTERIO DE AMBIENTE Y ENERGÍA
Resultando:
3. Informa bajo juramento Ligia Umaña Ledezma, en su condición de Presidenta del Tribunal Ambiental Administrativo (TAA) que el 23 de setiembre del 2014 se recibe en este Tribunal el Oficio PSAM-074-2014 suscrito por el señor Manuel Espinoza Campos en su condición de Alcalde del Municipalidad de Puriscal mediante el cual interpone formal denuncia de carácter ambiental para investigar lo acontecido en la finca inscrita bajo matrícula de folio San José 502010 ubicada en Palmichal de Acosta. Ver folios 35 al 41 del expediente administrativo. Añade que la presente denuncia se incorporó al expediente administrativo N° 296-14-02TAA que luego se acumuló al ACOPAC-ASRP-QJ-10992014 del 29 de setiembre del 2014 se encuentra visible a los folios 85 al 95 del expediente administrativo. Añade que a folios 42 al 66 del expediente administrativo consta el oficio TAA-DT-01 12-14 de fecha 13 de octubre del 2014 el cual corresponde al Informe de Gira realizado el día 2 de octubre del año 2014 a la propiedad ubicada en San Pablo, Palmichal, Acosta, San José, Hoja Cartográficas Abra 3345 I, Edición 3 IGNCR 1989, Ubicación Geográfica N 9" 50' 27.3 W 84° 10' 19.6 proyección WGS84.
Indica que por la resolución N" 1007-14-TAA de las 08:20 horas del 12 de noviembre del año 2014 dictada en el expediente administrativo N" 282-14-03-TAA se estableció Primero: Solicitar al señor Ing. Alfonso Duarte Marín, en su condición de Director del Área de Conservación Pacifico Central (ACOPAC) o a quien ocupe su cargo, que proceda a realizar una inspección ocular "in situ" al Río Tarbacia (no cuenta este Despacho con una dirección más exacta) con la intención de verificar los hechos descritos en la denuncia, una aparente extracción de madera, sedimentación y daño a la flora y fauna del lugar. Asimismo en caso de ser posible determinar el presunto responsable de los hechos supra indicados. En caso de determinarse alguna afectación negativa significativa deberá proceder a elaborar dentro del ámbito de sus competencias la respectiva Valoración Económica del Daño Ambiental y remitirla a este Despacho.
Ver folios 2 y 3 del expediente administrativo. Por resolución N° 1324 5-TAA de las 13:52 horas del 16 de febrero de 2015 expediente administrativo N° 296-14-02-TAA. se solicitó: "(...) PRIMERO: Que en el caso que nos ocupa, considera este Despacho de suma importancia para el establecimiento de la verdad real de los hechos denunciados, ordenar al señor Luis Alberto Durán Gamboa, en condición de Alcalde de la Municipalidad de Acosta, o a quién ocupe su cargo, que proceda a: 1) certificar a este Despacho quien es el propietario registral de la finca ubicada en San José, Acosta, Palmichal, San Pablo, coordenadas indicadas, proyección WGS84, aparentemente propiedad de la sociedad Grupo Ganadero Roqueta S.A., cédula jurídica número 3-101-318767, representada por el señor Edgar Ureña Salazar, cédula de identidad número 1-0424.0292; 2) indicar a este Despacho si se han otorgado permisos sobre la propiedad indicada y de qué tipo.
Asimismo, aporte cualquier otra información que considere relevante para el presente expediente. SEGUNDO: Que con el fin de verificar la verdad real de los hechos, este Tribunal considera pertinente solicitar al señor José Miguel Zeledón Calderón en condición de Director de Agua-MINAE, o quien ocupe su cargo, que realice una inspección situ" ubicado en San José, Acosta, Palmichal, San Pablo, coordenadas N 9° 50` 273" W 84° 10` l9.6" proyección WGS 84, aparentemente propiedad de la sociedad Grupo Ganadero Roqueta S.A., cédula jurídica número 3-l01-318767, representada por el señor Edgar Ureña Salazar, cédula de identidad número l-0424-0292, y remita un informe a este Despacho de la situación en el lugar en relación con los cuerpos de aguas presentes en la finca, determinar de qué tipo son y si se están viendo afectadas por las obras realizadas en el lugar, de ser nacientes, si las mismas están captadas y si cuentan con los permisos pertinentes para su aprovechamiento.
De ser del caso, se le solicita que remita a este Despacho la correspondiente valoración económica del posible daño ambiental en caso de existir el mismo sobre los cuerpos de agua_ Para una mejor ubicación del lugar de los hechos podrá contactar con el señor Efraín Monge Hernández, Oficina Subregional de Puriscal, Área de Conservación Pacífico Central, al teléfono 2416-6576. TERCERO: Que con el fin de verificar la verdad real de los hechos, este Tribunal considera pertinente solicitar al señor Efraín Monge Hernández, en su condición de Jefe de la Oficina Subregional de Puriscal, Área de Conservación Pacífico Central, o quien ocupe su cargo, que indique si la propiedad ubicada en San José, Acosta, Palmichal, San Pablo, coordenadas N 9° 50` 27.3" W 84" l0` 19.6" proyección WGS 84:
4. Informa bajo juramento Efraín Monge Hernández, en su calidad de Jefe de la Oficina Subregional de Puriscal del Área de Conservación Pacifico Central (ACOPAC) del Sistema Nacional de Áreas de Conservación (SINAC) del Ministerio del Ambiente y Energía (MINAE) que en la Oficina Subregional Puriscal se recibe la documentación del certificado de origen en modalidad de plantación forestal N°53514 H (ADVZ-2014-004) con formulario de regencia forestal N° 10644 F el 26 de agosto del 2014 emitido por el regente forestal Ing. Alfonso Javier del Valle Zúñiga. Se procede a conformar por parte de la Oficina Subregional de Puriscal el expediente "PC-PC01-CO-PF-193-14 Grupo Ganadero la Roqueta S.A. Plantación Forestal".Añade que el día 27 de setiembre del 2014 se ingresa al Sistema de Información para el Control del Aprovechamiento Forestal (SICAF), la documentación presentada al cual se registra mediante número de expediente PC-PC01-CO-PF-193-14.
El día 2 de setiembre del 2014 se asigna el expediente PC-PC01-CO-PF-193-14 para ingresar la información al registro del sistema SICAF. El 16 de setiembre de 2014 el señor Rodrigo Cascante Vargas, Presidente de la Asociación de Desarrollo Sostenible San José Rural (ADESSARU) presenta denuncia por irregularidades en el aprovechamiento maderable y apertura de trochas en el área de protección del Río Tabarcia. El 21 de setiembre de 2014 se realiza visita al sitio por parte de funcionarios de la Oficina Subregional de Puriscal (OSRP) en compañía de funcionarios de la Fuerza Pública, el cual dio origen al oficio ACOPAC-OSRP-1059-14, en el cual menciona la existencia de una trocha antigua no habiendo construido caminos nuevos en el área de protección, no afectándose el artículo 33 de la Ley Forestal y corroborada la corta de una plantación de ciprés. Dice que el 23 de setiembre de 2014 se recibe por parte del Departamento de Gestión Ambiental de la Municipalidad de Acosta, la solicitud de inspección a San Pablo de Palmichal de Acosta mediante el oficio FMGA-101-2014.
Por oficio ACPPAC-OSRP-1099-2014 de 29 de setiembre de 2014 se inicia la realización del informe de inspección a nacientes de Palmichal San Pablo de Palmichal de Acosta. El 09 de octubre de 2014 se entrega copia del oficio ACPOCA-OSRP-1099-14 a la Dirección Regional del ACOPAC, Municipalidad de Puriscal. Por medio del oficio ACOPAC-ORS-019-14 se presenta la denuncia ambiental en contra el grupo Ganadero Roqueta S.A. y representada por el señor Edgar Ureña Salazar entregándose copia al Ministerio Público Fiscalía de Puriscal, el 10 de octubre de 2014. El 16 de octubre de 2014 se recibe el informe de aprovechamiento N°53539-H al 53540 H emitido por Alfonso Javier del Valle Zúñiga donde indica que realiza visita el 21 de setiembre de 2014 y da la descripción del estado de la propiedad y recomendaciones al realizar el cierre de dicho aprovechamiento. El 21 de octubre de 2014 el señor Edgar Ureña Salazar solicita copia de la denuncia interpuesta por el señor Rodrigo Cascante Vargas.
El día 23 de marzo de 2015, por oficio OSRP-996-14 se incorpora la información del certificado de origen ya que dicho expediente se encontraba en investigación (debido al tiempo que el expediente estuvo en investigación cuando se realizó la incorporación al sistema se realizó la recomendación de denegada en esta fecha). Dice que en la Oficina OSRP se abre el resolución 132-15-TAA expediente N°296-14-02-TAA del Tribunal Ambiental Administrativo contra Edgar Ureña Salazar presentada por el Alcalde de Puriscal por afectación de nacientes, corta de árboles y apertura de trocha presentada el 23 de setiembre de 2014. Este es atendido por los oficios ACOPAC-OSRP-1059-14, oficio ACOPAC-OSRP-1099-2014. EL expediente 282-14-03-TAA presentada (sic) por el señor Rodrigo Cascante Vargas Presidente de ADESSARU contra Grupo Ganadero la Roqueta S.A. (Edgar Ureña Salazar) corresponde al mismo expediente N°296-14-02-TAA (dicho expediente se acumula al 282-14-03-TAA) siendo el expediente de la OSRP el N°ACOPAC-OSRP-056-15, manteniendo la información en el expediente PC-PC01-CO-PF-193-14, expedientes que se encuentran en trámite.
Señala que sobre otras actuaciones realizadas relacionadas con las propiedades de Edgar Ureña o en la zona ubicadas en Nacientes de Palmichal, en el expediente administrativo presentada al TAA mediante oficio de denuncia ACOPAC-OSRP-DEN-021-14 de 10 de octubre de 2014 y a la cual el Tribunal Ambiental Administrativo acoge y tramita mediante número de expediente 339-14-03-TAA de 01 de junio de 2015. Para dicha denuncia el TAA realiza una conexidad del expediente administrativo de la oficina subregional EXP. ACOPAC-OSRP-DEN-2011-14 TRAMITADA MEDIANTE 282-14-03-TAA a pesar de ser sitios diferentes. El 01 de julio de 2015, respecto del expediente ACOPAC-OSRP-DEN-211-14 se realiza notificación al señor Ureña como advertencia administrativa de paralización de trabajos en áreas de protección de nacientes, bosque y quebradas. Añade que la denuncia presentada por el señor Hernán Ramírez Alfaro contra el Grupo Ganadero Roqueta S.A. se tramita en el expediente ACOPAC-OSRP-DEN-059-15 la que fue atendida por ACOPAC-OSRP-DEN-020-15 de 16 de junio de 2015, por la invasión de áreas de protección de nacientes y quebradas.
Al ser las propiedades objeto de denuncia, conocidas bajo expediente N°WXP-ACOPAC-OSRP-DEN-2011 14, se notifica al señor Ureña, advertencia administrativa de paralización de trabajos en áreas de protección de nacientes, bosque y quebradas, el día 01 de julio del 2015.Concluye que contrario a lo que afirma el recurrente, la oficina subregional de Puriscal actuó diligentemente atendiendo las denuncias oportunamente, lo que evitó que los daños fueran mayores, remitiendo las mismas a los entes administrativos y judiciales correspondientes, asimismo se dictó una medida cautelar de paralización de obras, para evitar que los daños continuaran. Explica que una vez que la Administración activa da conocimiento a los entes administrativos y judiciales queda sujeta a lo que estas resuelvan. Sin embargo, en el sitio se siguieron realizando inspecciones para verificar que las afectaciones no continuaran.
También el recurrente ha sido muy amplio en la descripción de las acciones realizadas por la Oficina subregional y está en pleno conocimiento que esa instancia ha actuado en apego a la normativa vigente en pro de salvaguardar la integridad de las especies y ecosistemas de esa zona. Además, si bien alega que 3 años es mucho tiempo para resolver un tema ambiental donde se evidenciaron daños ambientales, no es esa instancia la responsable o la encargada de resolver o dictar sentencia judicial o administrativa correspondiente. Pide se declare sin lugar el recurso.
Redacta el Magistrado Cruz Castro; y,
Considerando:
I.Objeto del recurso Reclama el recurrente que las distintas denuncias administrativas por daños ambientales planteadas ante el Tribunal Ambiental Administrativo y demás autoridades recurridas desde hace más de tres años, no han sido atendidas y lo único que ha hecho el TAA ha sido acumular los expedientes N°296-14-02-TAA y 282-14-03-TAA. Ello pese a la alteración ambiental con graves efectos, sin acción administrativa alguna desde que se interpuso la denuncia, acumulando ya tres años de espera para la intervención y corrección de este grave problema. Estima que le han violado sus derechos fundamentales, lo que solicita se declare con lugar el recurso con las consecuencias de ley.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
Del TAA:
a. El 23 de setiembre del 2014 Manuel Espinoza Campos en su condición de Alcalde del Municipalidad de Puriscal presenta ante el TAA el Oficio PSAM-074-2014 mediante el cual interpone formal denuncia de carácter ambiental para investigar lo acontecido en la finca inscrita bajo matrícula de folio San José 502010 ubicada en Palmichal de Acosta. (Ver folios 35 al 41 del expediente administrativo e informe de Presidenta del TAA) b. La denuncia se incorporó al expediente administrativo N° 296-14-02TAA que luego se acumuló al expediente N° 282-14-03-TAA (informe de Presidenta del TAA).
c. Por el oficio TAA-DT-01 12-14 de fecha 13 de octubre del 2014 se rinde el Informe de Gira realizado el día 2 de octubre del año 2014 a la propiedad ubicada en San Pablo, Palmichal, Acosta, San José, Hoja Cartográficas Abra 3345 I, Edición 3 IGNCR 1989, Ubicación Geográfica N 9" 50' 27.3 W 84° 10' 19.6 proyección WGS84 (El Informe ACOPAC-ASRP-QJ-10992014 del 29 de setiembre del 2014 se encuentra visible a los folios 85 al 95 del expediente administrativo, según informe de Presidenta del TAA) d. Por la resolución N" 1007-14-TAA de las 08:20 horas del 12 de noviembre del año 2014 dictada en el expediente administrativo N" 282-14-03-TAA se estableció Primero: Solicitar al señor Ing. En caso de determinarse alguna afectación negativa significativa deberá proceder a elaborar dentro del ámbito de sus competencias la respectiva Valoración Económica del Daño Ambiental y remitirla a este Despacho. (Ver folios 2 y 3 del expediente administrativo e (informe de Presidenta del TAA) e. Por resolución N° 1324 5-TAA de las 13:52 horas del 16 de febrero de 2015 expediente administrativo N° 296-14-02-TAA. se solicitó: "(...] PRIMERO: Que en el caso que nos ocupa, considera este Despacho de suma importancia para el establecimiento de la verdad real de los hechos denunciados, ordenar al señor Luis Alberto Durán Gamboa, en condición de Alcalde de la Municipalidad de Acosta, o a quién ocupe su cargo, que proceda a: 1) certificar a este Despacho quien es el propietario registral de la finca ubicada en San José, Acosta, Palmichal, San Pablo, coordenadas N 9° 50` 27.3" W $4° l0` l9.6" proyección WGS84, aparentemente propiedad de la sociedad Grupo Ganadero Roqueta S.A., cédula jurídica número 3-101-318767, representada por el señor Edgar Ureña Salazar, cédula de identidad número 1-0424.0292; 2) indicar a este Despacho si se han otorgado permisos sobre la propiedad indicada y de qué tipo.
Asimismo, aporte cualquier otra información que considere relevante para el presente expediente (informe de Presidenta del TAA) f. Con el fin de verificar la verdad real de los hechos, el Tribunal pidió al Director de Agua-MINAE, que realice una inspección en el lugar ubicado en San José, Acosta, Palmichal, San Pablo, coordenadas N 9° 50` 273" W 84° 10` l9.6" proyección WGS84, aparentemente propiedad de la sociedad Grupo Ganadero Roqueta S.A., y remita un informe de la situación en el lugar en relación con los cuerpos de aguas presentes en la finca, determinar de qué tipo son y si se están viendo afectadas por las obras realizadas en el lugar. De ser nacientes, si las mismas están captadas y si cuentan con los permisos pertinentes para su aprovechamiento. Además pide que remita a ese Despacho la correspondiente valoración económica del posible daño ambiental en caso de existir el mismo sobre los cuerpos de agua (informe de Presidenta del TAA) g. El TAA pidió al Jefe de la Oficina Subregional de Puriscal, Área de Conservación Pacífico Central, que indique si la propiedad ubicada en San José, Acosta, Palmichal, San Pablo, coordenadas N 9° 50` 27.3" W 84" l0` 19.6"proyección WGS84:
l. Mediante el Oficio DA-UHTPCOSJ›0250-2016 de 30 de marzo del 2016 suscrito por la Ing. Marilyn Mora Vega, en su condición de Coordinadora de la Unidad Hidrológica Tárcoles Pacífico Central de la Dirección de Agua, indica que hay cuatro nacientes de cauce permanente (informe de Presidenta del TAA) m. Analizados los documentos que conforman el presente expediente administrativo por resolución N° 3762017-TAA de las 11:37 horas del 28 de marzo del año 2017, el TAA dicta una medida cautelar y procede a realizar inspección ocular "in situ" con el objetivo de investigar las hechos denunciados, y por oficio número TAA-DT-0112-014 suscrito por el Ing. Alexis Madrigal Chaves y el Biól Juan Sánchez Ramírez, ambos en su condición de funcionarios del Departamento Técnica, se concluyó lo siguiente: La propiedad del Grupo Ganadero Roqueta S.A.. se localiza, en apariencia totalmente dentro de los límites de la ZPCE.
El área intervenida, con base en un certificado de origen no solo fue objeto de corta y extracción de especies exóticas (ciprés) sino que se aprovechó especies nativas que no estaban contempladas en el documento indicado. Las coordenadas indicadas en los certificados de origen para ejecutar la intervención no concuerdan con las coordenadas de la ejecución real. Se abrió una trocha para extraer la madera. Trocha que, se abrió dentro de terrenos de bosque. La trocha y el aprovechamiento de madera se ejecutó en terrenos con poca estabilidad debido a su naturaleza deleznable, así como a las pendientes abruptas superiores al 70%. Producto de la desestabilización de los suelos, en varios puntos del área intervenida, se produjeron deslizamientos. La apertura de terreno, trocha y la desestabilización acarrearon material hacia el Río Tabarcia y una posible quebrada, así como a sus áreas de protección y provocaron afectación a las áreas de bosque y especies nativas a autóctonas.
Algunos árboles fueron cortados dentro del área de Protección del Río Tabarcia y de una posible quebrada, en incluso, dentro de ls áreas de protección de posibles nacientes. La propiedad objeto de aprovechamiento, o al menos el área intervenida, se ubica totalmente dentro de los límites de la ZPCE y dentro del Corredor Biológico Paso de las Lupas (informe de Presidenta del TAA) n. Por parte de ADESSARU se indica que la intervención del terreno afectaría la toma de agua para consumo humano ubicada en el Río Tabarcia, por la afectación con sedimentos. Los suelos en esta zona podrían ser calificados como suelos Clase VIII por pedregosidad, pendientes abruptas, profundidad efectiva y fertilidad baja, así como por la presencia de un ASP. Sin asegurar que esta sea correcto, es criterio de los suscritos que esa zona podría calificar como área de recarga acuífera. Por ser un ASP y los movimientos de tierra realizadas debió pedirse el criterio de la SETENA sobre la posibilidad de obtener viabilidad ambiental, considerando que la propiedad se ubica en un ASP y por la fragilidad o vulnerabilidad de la zona.
(…)". (informe de Presidenta del TAA) o. Por oficio número DA-UHTPCOSJ-0202-2016 suscrito por el Ing Jesús Monge Mejía, funcionario de la Dirección de Agua del MINAE, se certifica la presencia de 4 nacientes de cauce permanente localizados en el sector denunciado(visto a folios 187 y 188 del expediente),.
p. El TAA ordena medida cautelar a Grupo Ganadero Roqueta Sociedad Anónima, y le prohibe absoluta de cortar árboles sin contar con Ia debida autorización por parte de la Administración Forestal del Estado, así como la realización de movimientos de tierra dentro del área de protección de las nacientes dictaminadas respetando su área de protección de conformidad con lo establecido por la Ley Forestal y la Ley de Aguas (15 metros a lo larga de las riberas de las quebradas o ríos, 50 metros horizontales si el terreno es quebrada, 100 metros si existen nacientes y 200 metros si es una naciente captada, en la propiedad matrícula folio real 1-109600 localizado en el sector de Palmichal, Acosta, San José. Los efectos de la presente medida cautelar interlocutoria persistirán hasta que ese Despacho proceda a dictar el acto final en el presente procedimiento ordinario administrativo de investigación o hasta que el mismo se pronuncie de manera distinta (informe de Presidenta del TAA) q. Para la implementación de la presente medida cautelar se comisiona al Ing. Efraín Monge, en su condición de Jefe de la Oficina Sub Regional de Puriscal o a quien ocupe su cargo,quien deberá presentar informes bimensuales en las que se verifique el cumplimiento de la medida cautelar impuesta (informe de Presidenta del TAA) r. Analizados los oficios de denuncia números ACOPACOSRP-DEN-021-141 ACOPAC-OSRP-DEN-02045 y ACOPAC-OSRP~DEN-017-2016 suscritas por funcionarios de la Oficina Sub Regional de Puriscal del Área de Conservación Pacífico Central MCOPAC), el TAA ordena al Director del Área de Conservación Pacífica Central MCOPAC) que proceda a ejecutar la respectiva valoración económica del daño ambiental producto de los hechos denunciados, indicando las medidas de mitigación a ser aplicadas en el caso en particular La anterior deberá cumplirse en el plazo de diez días naturales contados a partir del primer día hábil siguiente de notificada la presente resolución. (...) (informe de Presidenta del TAA) Del Área de Conservación Pacífico Central:
s. El 26 de agosto de 2014, en la Oficina Subregional Puriscal se recibe la documentación del certificado de origen en modalidad de plantación forestal N°53514 H (ADVZ-2014-004) con formulario de regencia forestal N° 10644 F emitido por el regente forestal Ing. Alfonso Javier Del Valle Zúñiga y se procede a conformar por parte de la Oficina Subregional de Puriscal el expediente "PC-PC01-CO-PF-193-14 Grupo Ganadero la Roqueta S.A. Plantación Forestal". (informe Efraín Monge Hernández, en su calidad de Jefe de la ACOPAC, del SINAC del MINAE).
t. El 27 de setiembre del 2014 se ingresa al Sistema de Información para el Control del Aprovechamiento Forestal (SICAF), la documentación presentada al cual se registra mediante número de expediente PC-PC01-CO-PF-193-14 (informe Efraín Monge Hernández, en su calidad de Jefe de la ACOPAC, del SINAC del MINAE).
u. El día 2 de setiembre del 2014 se asigna el sistema SICAF (informe Efraín Monge Hernández, en su calidad de Jefe de la ACOPAC, del SINAC del MINAE).
v. El 16 de setiembre de 2014 el señor Rodrigo Cascante Vargas, Presidente de la Asociación de Desarrollo Sostenible San José Rural (ADESSARU) presenta denuncia por irregularidades en el aprovechamiento maderable y apertura de trochas en el área de protección del Río Tabarcia (informe Efraín Monge Hernández, en su calidad de Jefe de la ACOPAC, del SINAC del MINAE).
w. El 21 de setiembre de 2014 se realiza visita al sitio por parte de funcionarios de la Oficina Subregional de Puriscal (OSRP) en compañía de funcionarios de la Fuerza Pública, el cual dio origen el oficio ACOPAC-OSRP-1059-14, en el cual menciona la existencia de una trocha antigua no habiendo construido caminos nuevos en el área de protección, no afectándose el artículo 33 de la Ley Forestal y corroborada la corta de una plantación de ciprés (informe Efraín Monge Hernández, en su calidad de Jefe de la ACOPAC, del SINAC del MINAE).
x. El 23 de setiembre de 2014 se recibe por parte del Departamento de Gestión Ambiental de la Municipalidad de Acosta, la solicitud de inspección a San Pablo de Palmichal de Acosta mediante el oficio FMGA-101-2014 (informe Efraín Monge Hernández, en su calidad de Jefe de la ACOPAC, del SINAC del MINAE).
y. Por oficio ACPPAC-OSRP-1099-2014 de 29 de setiembre de 2014 se inicia la realización del informe de inspección a nacientes de Palmichal San Pablo de Palmichal de Acosta (informe Efraín Monge Hernández, en su calidad de Jefe de la ACOPAC, del SINAC del MINAE).
z. El 09 de octubre de 2014 se entrega copia del oficio ACPOCA-OSRP-1099-14 a la Dirección Regional del ACOPAC, Municipalidad de Puriscal (informe Efraín Monge Hernández, en su calidad de Jefe de la ACOPAC, del SINAC del MINAE).
aa. Por medio del oficio ACOPAC-ORS-019-14 se presenta la denuncia ambiental en contra el grupo Ganadero Roqueta S.A. y representada por el señor Edgar Ureña Salazar entregándose copia al Ministerio Público Fiscalía de Puriscal, el 10 de octubre de 2014 (informe Efraín Monge Hernández, en su calidad de Jefe de la ACOPAC, del SINAC del MINAE).
bb. El 16 de octubre de 2014 se recibe el informe de aprovechamiento N°53539-H al 53540 H emitido por Alfonso Javier del Valle Zúñiga donde indica que realiza visita el 21 de setiembre de 2014 y da la descripción del estado de la propiedad y recomendaciones al realizar el cierre de dicho aprovechamiento (informe Efraín Monge Hernández, en su calidad de Jefe de la ACOPAC, del SINAC del MINAE).
cc. El 21 de octubre de 2014 el señor Edgar Ureña Salazar solicita copia de la denuncia interpuesta por el señor Rodrigo Cascante Vargas (informe Efraín Monge Hernández, en su calidad de Jefe de la ACOPAC, del SINAC del MINAE).
dd. El día 23 de marzo de 2015, por oficio OSRP-996-14 se incorpora la información del certificado de origen ya que dicho expediente se encontraba en investigación (debido al tiempo que el expediente estuvo en investigación cuando se realizó la incorporación al sistema se realizó la recomendación de denegada en esta fecha (informe Efraín Monge Hernández, en su calidad de Jefe de la ACOPAC, del SINAC del MINAE).
ee. En la Oficina OSRP se abre el expediente ACOPAC-OSRP-056-15 al recibir vía fax el día 25 de marzo de 2015 la resolución 132-15-TAA expediente N°296-14-02-TAA del Tribunal Ambiental Administrativo contra Edgar Ureña Salazar presentada por el Alcalde de Puriscal por afectación de nacientes, corta de árboles y apertura de trocha presentada el 23 de setiembre de 2014 (informe Efraín Monge Hernández, en su calidad de Jefe de la ACOPAC, del SINAC del MINAE).
ff.El expediente 282-14-03-TAA presentada (sic) por el señor Rodrigo Cascante Vargas Presidente de ADESSARU contra Grupo Ganadero la Roqueta S.A. (Edgar Ureña Salazar) corresponde al mismo expediente N°296-14-02-TAA (dicho expediente se acumula al 282-14-03-TAA) siendo el (informe Efraín Monge Hernández, en su calidad de Jefe de la ACOPAC, del SINAC del MINAE).
gg. El expediente administrativo Salazar, presentada al TAA mediante oficio de denuncia ACOPAC-OSRP-DEN-021-14 de 10 de octubre de 2014 y a la cual el Tribunal Ambiental Administrativo acoge y tramita mediante número de expediente 339-14-03-TAA de 01 de junio de 2015 (informe Efraín Monge Hernández, en su calidad de Jefe de la ACOPAC, del SINAC del MINAE).
hh. Para dicha denuncia el TAA realiza una conexidad del expediente administrativo de la oficina subregional EXP. ACOPAC-OSRP-DEN-2011-14 tramitada mediante expediente N°339-14-03-TAA con la N°296-14-02-TAA y este último lo acumula al 282-14-03-TAA a pesar de ser sitios diferentes. (informe Efraín Monge Hernández, en su calidad de Jefe de la ACOPAC, del SINAC del MINAE) ii. El 01 de julio de 2015, respecto del advertencia administrativa de paralización de trabajos en áreas de protección de nacientes, bosque y quebradas (informe Efraín Monge Hernández, en su calidad de Jefe de la ACOPAC, del SINAC del MINAE).
jj. La denuncia presentada por el señor Hernán Ramírez Alfaro contra el Grupo Ganadero Roqueta S.A. se tramita en el expediente ACOPAC-OSRP-DEN-059-15 la que fue atendida por ACOPAC-OSRP-DEN-020-15 de 16 de junio de 2015, por la invasión de áreas de protección de nacientes y quebradas (informe Efraín Monge Hernández, en su calidad de Jefe de la ACOPAC, del SINAC del MINAE).
kk. Se notifica al señor Ureña, advertencia administrativa de paralización de trabajos en áreas de protección de nacientes, bosque y quebradas, el día 01 de julio del 2015.
De la Dirección de Aguas del Ministerio de Ambiente y Energía ll. Por resolución 017-15-TAA dictada por el Tribunal Ambiental Administrativo en el expediente 339-14-03-TAA solicitó a la Dirección de Aguas "realizar inspección in situ, al inmueble ubicado en Palmichal de Acosta 200 metros al este de las instalaciones de ADESARO cuyo aparente propietario registral es el señor Edgar Ureña Salazar, con la intención de verificar la existencia de 8 posibles nacientes de las cuales deberá certificarse su condición". (Informe de José Miguel Zeledón Calderón, en su condición de Director de Aguas del Ministerio de Ambiente y Energía) mm. La Dirección realizó inspección al sitio en la que determinó la existencia de sólo 4 nacientes con flujo permanente y mediante el informe técnico DA-UHTPCOSJ-0202-2016, envió lo indicado al TAA, lo que fue agregado al expediente del TAA (Informe de José Miguel Zeledón Calderón, en su condición de Director de Aguas del Ministerio de Ambiente y Energía)
a. Que el TAA haya adoptado las medidas cautelares oportunas, para detener o evitar las actividades denunciadas, que producen el riesgo ambiental en la zona afectada, antes de la interposición de este recurso.
De previo a analizar el fondo del alegato – por la presunta violación del derecho a un procedimiento pronto y cumplido– debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 hrs. de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa – con algunas excepciones– aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo – instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en este asunto, se plantea un supuesto de excepción, pues, se está ante una gestión en el marco de un procedimiento de tutela medio ambiental, lo que hace que el caso encuadre en uno de los supuestos de excepción y proceda analizar el asunto por el fondo, lo que en efecto se hace, En primer lugar en relación con las actuaciones del TAA y seguidamente se analizará la actuación de las demás autoridades recurridas.
De la relación de hechos probados se tiene por demostrado que efectivamente el 23 de setiembre del 2014 Manuel Espinoza Campos en su condición de Alcalde del Municipalidad de Puriscal presentó ante el TAA formal denuncia de carácter ambiental para que investigara lo acontecido en la finca inscrita bajo matrícula de folio real San José 502010 ubicada en Palmichal de Acosta. Por la resolución N° 1437-15-TAA de las 07:45 horas del 12 de noviembre del 2015, dictada en el Expediente N°296-14-02-TAA se procede a acumular la denuncia tramitada bajo este expediente al expediente administrativo N° 28244-03-TAA. Cuatro meses después, por el Oficio DA-UHTPCOSJ-0250-2016 de 30 de marzo del 2016 de la Coordinadora de la Unidad Hidrológica Tárcoles Pacífico Central de la Dirección de Agua, se indica que hay cuatro nacientes de cauce permanente en la zona denunciada. Es hasta finales de marzo de 2017, por resolución N" 3762017-TAA de las 11:37 horas del 28 de marzo del año 2017, y con ocasión de este recurso, que el TAA dicta una medida cautelar y procede a realizar inspección ocular "in situ" con el objetivo de investigar las hechos denunciados, en la propiedad del Grupo Ganadero Roqueta S.A.. por objeto de corta y extracción de especies exóticas (ciprés) aprovechamiento de especies nativas, por haberse abierto una trocha dentro de terrenos de bosque, para extraer la madera, desestabilización de los suelos, en varios puntos del área intervenida, que produjeron deslizamientos.
La apertura de terreno, trocha y la desestabilización acarrearon material hacia el Río Tabarcia y una posible quebrada, así como a sus áreas de protección y provocaron afectación a las áreas de bosque y especies nativas a autóctonas. Algunos árboles fueron cortados dentro del área de Protección del Río Tabarcia y de una posible quebrada, en incluso, dentro de las áreas de protección de posibles nacientes. Asimismo, el TAA logró determinar que la intervención del terreno afectaría la toma de agua para consumo humano ubicada en el Río Tabarcia, por la afectación con sedimentos. Los suelos en esta zona podrían ser calificados como suelos Clase VIII por pedregosidad, pendientes abruptas, profundidad efectiva y fertilidad baja, así como por la presencia de un Area Silvestre Protegida (ASP). Sin asegurar que esto sea correcto, esa zona podría calificar como área de recarga acuífera. Por ser un ASP y los movimientos de tierra realizadas debió pedirse el criterio de la SETENA sobre la posibilidad de obtener viabilidad ambiental, considerando que la propiedad se ubica en un ASP y por la fragilidad o vulnerabilidad de la zona.
Del cuadro fáctico descrito, en relación con el informe dado a esta Sala por la Presidenta del TAA, se observa que el Tribunal recurrido ordenó la medida cautelar a Grupo Ganadero Roqueta Sociedad Anónima, -que le prohibe de manera absoluta cortar árboles sin contar con la debida autorización por parte de la Administración Forestal del Estado, así como la realización de movimientos de tierra dentro del área de protección de las nacientes dictaminadas respetando su área de protección de conformidad con lo establecido por la Ley Forestal y la Ley de Aguas (15 metros a lo larga de las riberas de las quebradas o ríos, 50 metros horizontales si el terreno es quebrada, 100 metros si existen nacientes y 200 metros si es una naciente captada, en la propiedad matrícula folio real 1-109600 localizado en el sector de Palmichal, Acosta, San José) -, casi tres años después de planteada la primera denuncia ante el TAA en setiembre de 2014.
Es con ocasión de este recurso que resuelve adoptar una medida cautelar para prevenir más daños en el ambiente, lo que a todas luces ha resultado tardío para darle protección pues, en este asunto, la propia autoridad recurrida reconoce los efectos negativos que ha tenido la actividad ilegal que con extrema lentitud investiga, sin haber adoptado las medidas precautorias que eviten los riesgos que describe el recurrente. Es por ello que procede acoger el recurso en cuanto se dirige contra el TAA, lo que en efecto se dispone.
VI.Del Área de Conservación Pacífico Central. Del análisis concreto de las actuaciones realizadas por el Área de Conservación Pacífico Central y en concreto la Oficina Subregional de Puriscal, observa esta Sala que desde que recibió las diferentes denuncias les dio trámite y en julio de 2015 dictó una medida cautelar de paralización de obras, para evitar que los daños continuaran. No obstante señalan los informantes del Área de Conservación que se siguieron realizando inspecciones para verificar que las afectaciones no continuaran, no consta que se haya tomado ninguna acción frente a la desatención de tales medidas por parte del particular o que esas autoridades hayan puesto al TAA en conocimiento de las mismas. No basta para prevenir daños al ambiente dictar medidas precautorias, pues en caso de desatención de las medidas impuestas debe la autoridad recurrida iniciar los mecanismos que le da el ordenamiento jurídico, para hacerlas efectiva y que se den las consecuencias que su desatención genera. Es por ello que procede declarar con lugar el recurso en cuanto se dirige contra el Área de Conservación, en los términos que se indicará en la parte dispositiva de esta sentencia.
En cuanto el recurso se dirige contra la Dirección de Aguas, observa esta Sala de los distintos informes, que esta hizo la inspección al inmueble ubicado en Palmichal de Acosta que le ordenara el TAA dentro del expediente y determinó la existencia de nacientes en el lugar (informe técnico DA-UHTPCOSJ-0202-2016, enviado al TAA). No se advierte que al momento de presentarse este recurso, esté pendiente alguna información que requiera el Tribunal Ambiental por parte de esa oficina, a fin de ampliar la información presentada. Como consecuencia, no se observa ninguna infracción a los derechos invocados por el recurrente y procede desestimar el recurso en cuanto se dirige contra la Dirección de Aguas, lo que en efecto se hace.
VIII.Conclusión En este asunto para la resolución del recurso planteado por el accionante; es claro que el TAA ha realizado actos dirigidos a la investigación de propiedades, análisis de actividades de tala y aprovechamiento de árboles y apertura de trocha sin autorización y en zonas protegidas. Asimismo ha logrado la identificación de los presuntos infractores involucrados, realizando la coordinación con los distintos entes encargos de prestar colaboración para realizar la investigación. No obstante, es hasta la interposición de este recurso, en marzo de 2017, que resuelve girar la medida cautelar que prevenga al supuesto infractor de no cometer los actos que se estiman lesivos del medio ambiente, lo que es tardío e injustificable. La Administración está obligada a resolver en un plazo razonable los asuntos que le son planteados, y si bien esta Sala es clara en que el artículo 41 de la Constitución Política, no ha constitucionalizado un derecho a los plazos, sino el derecho fundamental de toda persona a que su causa sea resuelta dentro de un plazo razonable; lo cierto en este asunto, es que de la prueba aportada no se determina que ninguna de las autoridades ambientales administrativas recurridas con autoridad para hacerlo, haya adoptado la oportuna acción anticipada -a la resolución final de la queja ambiental- referida a evitar o hacer cesar el riesgo que supone la presunción grave de conductas claramente dañinas al ambiente, como lo son, en este caso, la tala y aprovechamiento de árboles sin autorización, así como hacer una trocha en una zona protegida y una serie de actividades prohibidas que dañan el ambiente.
Lo anterior, con autorización de lo dispuesto en el artículo 99 de la Ley Orgánica del Ambiente, N°7554 del 04 de octubre de 1995, que establece en el aparte de sanciones administrativas, una serie de medidas preventivas protectoras, que debe aplicar la Administración Pública ante la violación de las normativas de protección ambiental tanto de la Ley Orgánica del Ambiente como de otras disposiciones de protección ambiental o de la diversidad biológica; y frente a conductas dañinas al ambiente. Entre las medidas provisorias están: “… d) Restricciones, parciales o totales, u orden de paralización inmediata de los actos que originan la denuncia. e) Clausura total o parcial, temporal o definitiva, de los actos o hechos que provocan la denuncia…. h) Modificación o demolición de construcciones u obras que dañen el ambiente. Así las cosas, procede acoger el recurso en cuanto a este extremo y se advierte a la Administración recurrida su obligación de resolver las denuncias que puedan afectar al medio ambiente, en un plazo razonable. Ahora bien, por las razones indicadas en el Considerando VII, procede desestimar el recurso en cuanto se dirige contra el Director de Aguas, como en efecto se ordena.
IX.De la Defensoría de los Habitantes . Al advertirse en este asunto la inercia de las autoridades administrativas competentes frente a los graves hechos denunciados que lesionan el ambiente en la propiedad indicada en este asunto, ubicada en San José, Acosta, Palmichal, San Pablo, y que pueden perjudicar a los habitantes, se notifica esta sentencia a la Defensoría de los Habitantes para lo que le corresponda.
X.Nota del Magistrado Cruz Castro: En este asunto hay una grave lesión al ambiente. Tanto tiempo que ha pasado sin una reacción efectiva de las autoridades encargadas de la tutela del ambiente. Hechos muy graves desde el punto de vista ambiental, no son abordados oportunamente, porque los actos denunciados datan del año 2014, sin una respuesta oportuna. Es indiscutible que el tribunal ambiental administrativo enfrenta un gravísimo retraso; esta deficiencia la ha reportado la prensa, especialmente un reportaje del semanario Universidad de 17 febrero del 2016. La información periodística la suscribe Diego Arguedas Ortiz. El reportaje se titula: “Casos contra Piñeras se añejan atorados en el Tribunal Ambiental”. En estos casos tenían pendientes, sin sentencias, casos de piñeras denunciados desde el 2001. La información de prensa señala que cada juez tramita en el tribunal entre quinientos y seiscientos expedientes. Los derechos fundamentales naufragan ante una respuesta tan lenta, tan tardada. Este es el caso que se evidencia en este caso. Peligra la integridad física y la salud de los habitantes, sin que haya una respuesta a la altura de los bienes jurídicos en juego. El exceso de trabajo, la falta de recursos, la descoordinación, no justifican lo que ocurre en este asunto.
Los Magistrados Jinesta Lobo y Salazar Alvarado coinciden con la estimatoria parcial del amparo, pero por razones diferentes. Lo anterior, dado que, lo desestiman en cuanto a la violación del derecho al ambiente, pero lo acogen, únicamente, por la infracción del derecho a un procedimiento administrativo pronto y cumplido; extremo respecto del que le ordenan a las autoridades resolver inmediatamente.
A.- RESPECTO A LA INFRACCIÓN DEL DERECHO AL AMBIENTE.

B.- EN REFERENCIA A LA INFRACCIÓN A UN PROCEDIMIENTO ADMINISTRATIVO PRONTO Y CUMPLIDO. Coincidimos con la estimatoria del recurso de amparo, en lo atinente a la tardanza injustificada, por parte del Tribunal Ambiental Administrativo y del Área de Conservación Pacífico Central, en atender la denuncia presentada; no obstante, a diferencia de la mayoría, ordenamos se resuelva de inmediato, en tanto han transcurrido, prácticamente, dos años y medio, desde el momento en el cual fue interpuesta, lo que, en nuestro criterio, es irrazonable.
XII.DOCUMENTACIÓN APORTADA AL papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso en cuanto se dirige contra el Área de Conservación Pacífico Central del Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía y el Tribunal Ambiental Administrativo. Se ordena a Efraín Monge Hernández, en su calidad de Jefe de la Oficina Subregional de Puriscal del Área de Conservación Pacifico Central del Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía así como a Ligia Umaña Ledezma, en su condición de Presidenta del Tribunal Ambiental Administrativo o a quienes en tales lugares ejerzan esos cargos, no incurrir nuevamente en las omisiones que ponen en riesgo el ambiente, como en este caso, así como tomar las previsiones que sean necesarias para que las medidas cautelares vigentes y ordenadas en este asunto sean debidamente atendidas y que el mismo sea resuelto en un plazo razonable. Se apercibe a las autoridades antes dichas que con base en lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás se declara sin lugar el recurso. Notifíquese personalmente a Efraín Monge Hernández, en su calidad de Jefe de la Oficina Subregional de Puriscal del Área de Conservación Pacifico Central) del Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía así como a Ligia Umaña Ledezma, en su condición de Presidenta del Tribunal Ambiental Administrativo o a quienes ocupen tales cargos. El Magistrado Cruz Castro pone nota. Los Magistrados Jinesta Lobo y Salazar Alvarado coinciden con la estimatoria parcial del amparo, pero por razones diferentes, dado que, lo desestiman en cuanto a la violación del derecho al ambiente, pero lo acogen, únicamente, por la infracción del derecho a un procedimiento administrativo pronto y cumplido; extremo respecto del que le ordenan a las autoridades resolver inmediatamente. Notifíquese a las partes y a la Defensoría de los Habitantes para lo que le corresponda.
