Petition for constitutional relief (recurso de amparo) filed by JOSÉ ÁNGEL ROVIRA UGARTE, holder of identity card 05 0317 0401, against the DIRECTORA and the ASESORA LEGAL, both of the Dirección Regional de Educación de Liberia of the Ministerio de Educación Pública.
Findings of Fact:
Magistrada Hernández López drafts the opinion; and,
Whereas:
Before addressing the merits of this matter, it is noted that the respondent officials did not submit the report required in the order issued at 11:23 on 30 de enero de 2015. Consequently, this Chamber deems the facts alleged by the petitioner to be true, pursuant to article number 45 of the Ley de la Jurisdicción Constitucional.-
The petitioner alleges that his rights of petition (derecho de petición) and access to information (derecho de información) have been violated, because he has not been provided with the information requested through note number CC-JARU-113-10-2014 dated 29 de octubre de 2014.-
The following facts, which are material to the determination of this matter, are deemed duly proven, either because they were stated as such in reports submitted under oath or because they were not disputed by the parties: a) On 29 de octubre de 2014, the petitioner requested, through note CC-JARU-113-10-2014, a copy of the Asesora Legal’s logbook for that Dirección Regional, specifically the folios corresponding to 27, 28 and 29 de octubre de 2014 (documentation submitted by the petitioner); b) As of the date on which this petition for constitutional relief was filed, the petitioner had not received a response to his request (undisputed fact).-
None relevant to this specific case.-
In the case at bar (sub lite), it is alleged that the respondent officials have not provided the requested information, namely: a copy of the Asesora Legal’s logbook for that Dirección Regional, specifically the folios corresponding to 27, 28 and 29 de octubre de 2014. Given that the respondent authorities did not submit the report requested in the order issued at 11:23 on 30 de enero de 2015, this Chamber deems the facts alleged by the petitioner, and the resulting violation of the rights of petition and access to information, to be true, because, although more than four months have elapsed since the request was submitted, the petitioner has still not received the requested documentation. Consequently, the petition must be granted, with the consequences set forth below.-
Ley #9097, de Regulación del Derecho de Petición, dated 26 de octubre de 2012, states in its article 12 that this Chamber has jurisdiction over cases in which a violation of provision 27 of the Constitution and provision 32 of the Ley de la Jurisdicción Constitucional is invoked. I consider that this rule has no effect whatsoever on the guidelines already established by a majority of this Court regarding that subject because, in addition to the power to delineate the boundaries of its jurisdiction being expressly and exclusively reserved to the Chamber (article 7° of the Ley de la Jurisdicción Constitucional), the draft of Ley #9097 was not referred to this judicial body for consultation, in clear violation of the mandatory procedure regulated in article 96 subsection a) of the Ley de la Jurisdicción Constitucional, in conjunction with article 10.2 subsection b) of the Constitución Política. Submission for mandatory prior consultation before this Chamber is an essential requirement for any rule purporting to modify the Chamber’s powers and structure. Otherwise, it will be entirely ineffective, as is the case here.
“II. ABUSIVE AND IMPROPER EXERCISE OF THE RIGHT OF PETITION. The Chamber has also had occasion to rule in exceptional cases involving abusive and improper exercise of the right. In such cases, a person does indeed claim to have been adversely affected by a public authority, which the person accuses of violating the right of petition; however, the circumstances surrounding the case demonstrate that the administration is being subjected to repetitive, excessive, absurd, or even offensive requests. For that reason, the case law protects the administration and the authority heading it, insofar as its work, which is in principle intended to fulfill public purposes—that is, to meet community needs—cannot be held hostage to the whims of a person who devotes himself to harassing it with such requests. The right of petition is conceived—and cannot be understood otherwise—to satisfy a personal need of the person exercising it, without that need having to be expressly stated in the request. There are situations, however, in which it is clear that there is an intention to disrupt the administration’s ordinary work, and therefore this Chamber cannot be expected to provide the constitutional protection established for the situation first described. Thus, judgment N°6246-93, issued at fourteen hours and eighteen minutes on veintiséis de noviembre de mil novecientos noventa y tres, stated:
“... Although it is true that provision 27 of the Carta Magna establishes every citizen’s right to submit petitions to and obtain a response from the Administration, it is also true that requests must be made in a proper and appropriate manner. As may be inferred from the quoted passage and the entirety of Mr. Rodas Gómez’s letter, that did not occur in the case under review; therefore, the claim asserted cannot be upheld...”
... Mr. ..., the petitioner herein, has exercised his right of petition at his discretion before the Municipalidad of the canton in which he resides, a fact of which this Court has exceptional firsthand knowledge, since he has filed numerous amparo proceedings alleging that it violated his right. These include, apart from the present proceeding, petitions numbers 8715-98, 7621-98, 6433-98, 8716-98, 265-99 792-99. Some were granted and others dismissed. The Chamber denied some of them; for example, in case 8715-98 (decided in judgment N°241-99), although the Alcalde Municipal had responded regarding how many administrative departments the Municipalidad was divided into, as well as the academic qualifications, length of service, and salary of each municipal employee, he insisted that the information was incomplete and that he was being denied access to public information. Another amparo proceeding, N°792-99 (decided in judgment N°995-99), was summarily denied on the merits because there he argued that the information requested concerning the Municipalidad’s purchases of motor vehicles and the purchase of lubricants for those vehicles had been provided not by the Alcalde, as he sought, but by the Auditor.
Here, the petitioner contends that he requested information from the year 1990 to the present concerning construction permits issued by the Municipalidad and the number of culverts, sheets of zinc, and sacks of cement purchased or donated. He also requested information on how taxes relating to agricultural land are calculated, how many employees and council members live on municipal land, and what procedure has been followed in managing specific budget allocations and public funds earmarked for buildings, among other matters.
Under these circumstances, this Court has no doubt that the petitioner has displayed an excessive approach in making his requests, since the various amparo proceedings cited above, as well as this one, show that he has set out to request information on every conceivable matter, in a list that cannot even be said to be nearing exhaustion because, with that approach, he could readily continue making requests of any kind relating to municipal activities, with the evident intent (ánimus) to cause annoyance. Despite everything, the Alcalde provided him with information to the extent reasonable and, for example, regarding taxes, even attached a copy of the relevant law so that the interested party himself could identify the criteria used in calculating them. Finally, the Alcalde informed him that they did not have staff who could be assigned exclusively to gathering data spanning as broad a historical period as the petitioner sought.

It is also clear that some of the requests referred to in this amparo proceeding had previously been made by the petitioner and fulfilled by the respondent. It also bears noting that this Chamber has taken the view that, when the information requested by a person is overly broad or is scattered throughout the files or documents of the public office from which it is requested, it would be lawful and feasible to inform the interested party of the cost that must be paid for obtaining it; otherwise, an avalanche of requests such as the one now before us would completely paralyze a public entity that, like the Municipalidad de Sarapiquí, must address many problems in that extensive canton every day, which is the purpose for which its existing staff is assigned by law. In the present case, however, that is not the issue; rather, these are requests that Mr.
González has submitted and continues to submit in bursts to the Municipalidad, with no discernible purpose, so varied and even unimaginable have been those that this Chamber has had occasion to examine through the amparo proceedings filed.” (Judgment 01747-99 issued at 16:39 on 9 de marzo de 1999).- That criterion has been reiterated in multiple rulings, such as judgments numbers 2014-020417 at 14:30 hours on 16 de diciembre de 2014, 2013-010347 at 14:30 hours on 31 de julio de 2013, and 2012-001681 at 9:05 hours on 10 de febrero de 2012.

Por tanto:
The petition is granted. María Auxiliadora Obando Obando and Belbeth Chacón Ramírez, in their respective capacities as Directora Regional and Asesora Legal de la Dirección Regional de Liberia del Ministerio de Educación Pública, or whoever holds those positions, are ordered to take such actions as fall within the scope of their authority so that, within FIFTEEN DAYS from notification of this judgment, the protected party is provided with a copy of the documentation requested through note CC-JARU-113-10-2014 dated 29 de octubre del 2014. The respondents are advised that failure to comply with this order will constitute the offense of disobedience and that, pursuant to artículo 71 of the Ley de esta jurisdicción, anyone who receives an order issued in an amparo proceeding (recurso de amparo) that must be obeyed or enforced and who fails to obey or enforce it shall be subject to imprisonment for three months to two years, or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The State is ordered to pay the legal costs (costas), damages, and losses caused by the acts underlying this ruling, which shall be assessed during enforcement of the judgment (ejecución de sentencia) before the administrative litigation jurisdiction (contencioso administrativo). This judgment shall be personally served on María Auxiliadora Obando Obando and Belbeth Chacón Ramírez, in their respective capacities as Directora Regional and Asesora Legal de la Dirección Regional de Liberia del Ministerio de Educación Pública, or whoever holds those positions. Recurso de amparo promovido por JOSÉ ÁNGEL ROVIRA UGARTE, portador de la cédula de identidad 05 0317 0401, contra la DIRECTORA y la ASESORA LEGAL, ambas de la Dirección Regional de Educación de Liberia del Ministerio de Educación Pública.
Resultando:
Redacta la Magistrada Hernández López; y,
Considerando:
Previo a entrar a conocer el fondo del presente asunto, se observa que las funcionarias recurridas no rindieron el informe requerido en la resolución dictada a las 11:23 horas del 30 de enero de 2015. En consecuencia, esta Sala tiene por ciertos los hechos alegados por el recurrente, de conformidad con lo establecido en el artículo número 45 de la Ley de la Jurisdicción Constitucional.-
El recurrente alega que se han vulnerado sus derechos de petición e información, dado que no se le ha entregado la información solicitada mediante la nota número CC-JARU-113-10-2014 del 29 de octubre de 2014.-
III.HECHOS PROBADOS.De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, ya sea porque así se indicaron en los informes rendidos bajo juramento o porque los mismos no fueron refutados por las partes: a) Que el día 29 de octubre de 2014, el recurrente solicitó, mediante nota CC-JARU-113-10-2014, copia de la bitácora de la Asesora Legal de dicha Dirección Regional, específicamente de los folios correspondientes a los días 27, 28 y 29 de octubre de 2014 (documentación aportada por el recurrente); b) Que, a la fecha de interposición del presente recurso de amparo, el recurrente no ha recibido respuesta a la solicitud planteada (hecho no controvertido).-
Ninguno de relevancia para el caso concreto.-
En el sub lite, se acusa que la funcionarias accionadas no han brindado la información requerida, a saber: copia de la bitácora de la Asesora Legal de dicha Dirección Regional, específicamente de los folios correspondientes a los días 27, 28 y 29 de octubre de 2014. Siendo que las autoridades recurridas no rindieron el informe solicitado en la resolución dictada a las 11:23 horas del 30 de enero de 2015, esta Sala tiene por cierto los hechos alegados por el accionante y la subsiguiente lesión a los derechos de petición e información, pues, habiendo transcurrido más de cuatro meses desde que se planteó la solicitud en ese sentido, el recurrente aún no ha recibido la documentación requerida. En consecuencia, se impone declarar con lugar el recurso, con las consecuencias que se dirán.-
La Ley #9097, de Regulación del Derecho de Petición, del 26 de octubre de 2012, indica en su artículo 12 que corresponde a esta Sala el conocimiento de los casos en los cuales se invoque la infracción de las disposiciones 27 de la Constitución y 32 de la Ley de la Jurisdicción Constitucional. Considero que esa norma no incide de forma alguna sobre los lineamientos que ha establecido ya, por mayoría, este Tribunal en relación con esa materia, pues, además de estar expresa y exclusivamente reservada a la Sala la atribución de demarcar los límites de su competencia (artículo 7° de la Ley de la Jurisdicción Constitucional), se omitió remitir el proyecto de la Ley #9097 a consulta de este órgano jurisdiccional, con clara infracción del procedimiento preceptivo regulado en el artículo 96 inciso a) de la Ley de la Jurisdicción Constitucional en relación con el artículo 10.2 inciso b) de la Constitución Política. Es un requisito esencial de toda norma que pretenda modificar las potestades y configuración de la Sala ser sometida a consulta previa obligatoria en esta sede. De lo contrario, ella carecerá de toda eficacia, como sucede en este caso.
“II. EJERCICIO ABUSIVO Y TORCIDO DEL DERECHO DE PETICIÓN. La Sala también ha tenido oportunidad de pronunciarse en casos calificados, de uso abusivo y perverso del derecho. En esos casos, efectivamente, una persona afirma ser afectada por la autoridad pública, a la que atribuye haberle violado su derecho de petición, pero a través de las circunstancias que rodean el caso planteado, se llega a comprobar que la administración está siendo sometida a peticiones repetitivas, desmesuradas, absurdas o incluso ofensivas, motivo por el cual la jurisprudencia protege a la administración y la autoridad que la encabeza, en el tanto su quehacer, de principio destinado al cumplimiento de fines públicos, valga decir, dirigidos a satisfacer necesidades de la comunidad, no puede quedar cautivo del capricho de una persona que se dedica a hostigarla con aquel tipo de peticiones. El derecho de petición está concebido —no puede entenderse de otra manera— para la satisfacción de una necesidad personal de quien lo ejerce, sin que sea necesario que haya sido explicitado en su gestión.
Hay situaciones, sin embargo, en que resulta claro que existe un designio de perturbar el normal quehacer de la administración, por lo que no puede esperarse que esta Sala brinde la protección constitucional que está prevista para la hipótesis primeramente señalada. Así, en la sentencia N°6246-93, de las catorce horas y dieciocho minutos del día veintiséis de noviembre de mil novecientos noventa y tres, se dijo:
“... Si bien es cierto que el numeral 27 de la Carta Magna establece el derecho de todo ciudadano de peticionar y obtener respuesta de la Administración, lo cierto es que las solicitudes deben dirigirse de una manera correcta y apropiada, mas como se colige de la transcripción hecha y de la totalidad de la misiva del señor Rodas Gómez, eso no se ha dado en el caso en examen, por lo que no es de recibo el reclamo que se intenta...”
III.EL CASO CONCRETO DEL SEÑOR ... El señor ..., aquí recurrente, ha ejercido a discreción su derecho de petición ante la Municipalidad del cantón en que él reside, de lo cual es testigo de excepción este Tribunal, pues ha radicado muchos amparos en que alegó quebranto por parte de aquélla a su derecho. Entre ellos, y aparte del presente, pueden verse los recursos números 8715-98, 7621-98, 6433-98, 8716-98, 265-99 792-99. Algunos votados con lugar y otros desestimados. Algunos, la Sala los ha declarado sin lugar y, como en el caso del 8715-98 (resuelto en sentencia N°241-99), no obstante que el Alcalde Municipal había debido responderle en cuántos departamentos administrativos estaba dividida la Municipalidad, el grado académico, el tiempo de laborar, así como el salario de cada servidor municipal, insistía en que la información era incompleta y que se trataba de negársele acceso a información de carácter público.
Otro amparo, el N°792-99 (votado en sentencia N°995-99), le fue rechazado por el fondo, ya que allí discutía que la información pedida sobre compra de vehículos motores por parte de la Municipalidad, compras y lubricantes para los mismos, le había sido brindada no por el Alcalde como él pretendía, sino por el Auditor. Aquí, el recurrente discute que solicitó información desde el año 1990 a esta parte, sobre permisos de construcción otorgados por la Municipalidad, la cantidad de alcantarillas, láminas de zinc y sacos de cemento comprados o donados. También información acerca de cómo se calculan los impuestos relacionados con terrenos agrícolas, cuántos empleados y regidores viven en terrenos municipales, cuál ha sido el procedimiento para el manejo de partidas específicas y fondos públicos destinados a edificios, etc.
Puestas así las cosas, a este Tribunal no le queda duda acerca de una actitud desorbitada en las peticiones que formula el recurrente, pues a lo largo de los diversos amparos que se han citado y en este, se pone de manifiesto que él se ha propuesto requerir información sobre cualquier aspecto, en una lista que ni siquiera puede decirse está por agotarse, porque en esa actitud puede perfectamente seguir produciendo peticiones de cualquier género, relacionadas con el quehacer municipal, con evidente ánimus de molestar. A pesar de todo, el Alcalde le brindó la información en la medida de lo razonable y, por ejemplo, en materia de impuestos, le adjuntó hasta una copia de la ley correspondiente, a fin de que el propio interesado pudiera encontrar los criterios que se utilizan en el cálculo de aquéllos. Finalmente, el Alcalde le indica que no cuentan con personal como para dedicarlo en exclusiva a recabar datos con una amplitud histórica como la que el recurrente deseaba.
Ver copia del documento que corre a folios 19 y 20 del expediente. También está claro que algunas de las peticiones a que se refiere este amparo, habían sido realizadas en otro momento por el recurrente y satisfechas por la recurrida. No está de más agregar que esta Sala ha sido del criterio de que cuando la información que solicita una persona es demasiado amplia o se encuentra dispersa en archivos o documentos de la oficina pública requerida, sería legítimo y posible que se le indicara al interesado el costo que debe cubrir para ello, pues de lo contrario, una avalancha de peticiones como la que ahora nos ocupa paralizaría del todo a un ente público que, como la Municipalidad de Sarapiquí, debe atender cotidianamente muchos problemas de ese extenso cantón, para lo que legalmente está destinado el personal con que cuenta. En el presente caso, de toda suerte, no se trata de ello, sino de peticiones que, a modo de fogonazos, presenta y ha presentado el señor González a la Municipalidad, sin que se advierta cuál es su propósito, tan variadas y hasta inimaginables han sido las que esta Sala ha tenido oportunidad de conocer a través de los amparados presentados.” (Sentencia 01747-99 de las 16:39 horas del 9 de marzo de 1999).- Tal criterio ha sido reiterado en múltiples pronunciamientos, como las sentencias números 2014-020417 de las 14:30 horas del 16 de diciembre de 2014, 2013-010347 de las 14:30 horas del 31 de julio de 2013 y 2012-001681 de las 9:05 horas del 10 de febrero de 2012.

Por tanto:
Se declara con lugar el recurso. Se ordena a María Auxiliadora Obando Obando y Belbeth Chacón Ramírez, en sus calidades respectivas de Directora Regional y Asesora Legal de la Dirección Regional de Liberia del Ministerio de Educación Pública, o a quienes ocupen esos puestos, realizar las actuaciones que se encuentren dentro del ámbito de su competencia, para que en el plazo de QUINCE DÍAS contado a partir de la notificación de esta sentencia, se brinde al amparado copia de la documentación requerida mediante nota CC-JARU-113-10-2014 de fecha 29 de octubre del 2014. Se le advierte a los recurridos que de no acatar dicha orden, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71, de la Ley de esta jurisdicción, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
Notifíquese en forma personal esta sentencia a María Auxiliadora Obando Obando y Belbeth Chacón Ramírez, en sus calidades respectivas de Directora Regional y Asesora Legal de la Dirección Regional de Liberia del Ministerio de Educación Pública, o a quienes ocupen esos puestos. El Magistrado Armijo Sancho pone nota. El Magistrado Rueda Leal salva el voto y declara sin lugar el recurso.- Gilbert Armijo S.
