Constitutional rights protection action (recurso de amparo) processed under expediente No. 16-003205-0007-CO, filed by WÁLTER BRENES SOTO, identity card 0206450800, on behalf of ALEXANDER ANTONIO ORTEGA VILLANEA, identity card 0401580519, ANDRÉS ALPÍZAR MURILLO, identity card 0109940600, ERNESTO RIVAS ALCÓN, identity card 0109700655, FRANKLIN OSVALDO SÁNCHEZ CHAVES, identity card 0109620704, MARÍA TERESA PÉREZ VARGAS, identity card 0109840975, and ROSAURA DEL GERARDO MORALES VÁSQUEZ, identity card 0204460208; against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

Resultando:

  1. 1By a filing received by the Chamber at 16:20 on 27 de febrero de 2017, the petitioner filed a constitutional rights protection action. He states that Alexander Ortega Villanea owns property registered in Alajuela under No. 497018-000; María Teresa Pérez Vargas owns property registered in Alajuela under No. 497019-000; Franklin Osvaldo Sánchez Chavez owns property registered in Alajuela under No. 441521-000; Andrés Aplizar Murillo owns property registered in Alajuela under No. 441520-001; Rosaura Morales Vásquez owns property registered in Alajuela under No. 425137-000; and Ernesto Rivas Alcón owns property registered in Alajuela under No. 441514-000. He alleges that the Institute endorsed each of the plans for those properties with respect to the water-supply system. He notes that, pursuant to Articles 1 and 2(a) and (i) of the Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, that institution is required to provide the protected parties with drinking-water service and even to construct, expand, or modify the water-supply system in order to supply them with drinking water. He considers that the Institute’s refusal to provide water service violates their right to health and to a healthy and ecologically balanced environment. He requests that the respondent Institute be ordered to connect the petitioners’ properties to the public water-supply system.
  2. 2By ruling issued at 12:26 on 1 de marzo de 2016, the action was admitted for processing.
  3. 3In a filing received by the Chamber on 10 de marzo de 2017, Juan Carlos Villalobos and Johnny Rodríguez Alvarado, respectively Director and Head of the Oficina Cantonal de Alajuela, both of the Dirección Regional Central Oeste del Instituto Costarricense de Acueductos y Alcantarillados, submitted a report under oath. They state that in 2006, 2007, and 2012, the ICAA affixed a seal of approval for drinking-water availability solely to the plans corresponding to properties in the province of Alajuela, real-property folio registration numbers: 497018-000, 497019-000, 441521-000, 425137-000, 441514-000. They clarify that this seal never constituted approval to connect the described properties to the water-supply system administered and operated by the ICAA in the La Guácima de Alajuela area. They indicate that the purpose of the seal is to certify, for a period of 12 months, the actual and current existence of water-resource and hydraulic capacity for a particular property, and that it is also one of the requirements for the local Municipality to approve the municipal endorsement.They explain that affixing the drinking-water-availability seal for subsequent municipal endorsement was discontinued upon implementation of the Drinking-Water Availability Certificate, which is governed by Articles 5, 18, and 19 of the Reglamento para la Prestación de los Servicios de ICAA. They state that the Certificate of Availability of Water-Supply and Sanitary-Sewer Services is a requirement for the Municipalities and the INVU to approve subdivision (fraccionamiento) and construction permits pursuant to Articles 38,57 and 58 of Ley de Planificación Urbana No. 4240 and Articles 308, 309, 310. 311, 312, and 313 of Ley General de Salud No. 5395. They explain that it was created to determine, before approval of a cadastral plan, the current existence of water-resource and hydraulic capacity, collection capacity, and environmental conditions. They note that issuance of the Service Availability Certificate is neither authorization for connection nor approval of the services, since the procedural requirements established in the ICAA regulations must be met for that purpose.They state that the protected parties should have formally applied to the ICAA for new drinking-water service pursuant to Articles 30, 31, and 32 or 33 of the Reglamento de Prestación de Servicios a Clientes de 1996 (which was in force at that time) in order to obtain a connection at that time to the drinking-water systems administered and operated by the ICAA. They argue that, to obtain the service, the protected parties must now apply again for the required availability, comply with the requirements, and, if the technical and legal determination is favorable, request the new service pursuant to Articles 6, 13, and 25 of the new Reglamento para la Prestación de los Servicios de ICAA, published in 2015. They state that, as of the date on which the constitutional rights protection action was filed, there is no evidence in the OPEN Integrated Commercial System that either the protected parties or the petitioner Walter Brenes Soto had formally appeared before the ICAA to request provision of the service claimed.They allege that the Dirección Regional Central Oeste and its Oficina Cantonal de Alajuela have issued no administrative act or de facto administrative action (vía de hecho) formally or arbitrarily denying access to the service provided by the ICAA and thereby violating the fundamental rights of an administered party. They indicate that Technical Report No. GSP-RCO-2017-00457, issued on 7 de marzo de 2017 by the Systems Operations and Maintenance Area Engineer of that Regional Directorate, confirms that properties 4970118-000, 441521-000, 425137-000, 441514-000 do have a drinking-water supply. They obtain it through a self-supply system installed within the residential development and provided by a third party unrelated to the ICAA, because that residential project has no drinking-water distribution network. The study determined that properties 2-497018-000, 2-441520-001, 2-441514-000, 2-441521-0000, 2-497019-000, and 2-425137-000 contain buildings intended for residential use and human habitation.They clarify that none of the homes or apartments used as residences is supplied by the ICAA; nevertheless, they have drinking water through individual meters. It is stated that, during the inspection, the protected parties Andrés Alpízar Murillo and Ernesto Rivas Alcón appeared and affirmed that they currently receive a drinking-water supply, for which they pay Mr. Mario Gurdián Hurtado. The interviewees also indicated that they had purchased the properties subject to the existing conditions; in other words, on the understanding that the water supply would be provided by Mr. Mario Gurdián Hurtado, who is the president and judicial and extrajudicial representative of Quelite Azul Sociedad Anónima and the former owner of the petitioners’ properties. It is noted that the protected party Rivas Alcón also enjoys drinking-water service provided by Mr. Mario Gurdián Hurtado and therefore does not lack access to water.The study concludes that the action was filed because of the protected parties’ dissatisfaction with Mr. Gurdián Hurtado’s failure to pursue the legal process before the ICAA to regularize the easement (servidumbre) access arrangement that would allow service to be provided to each property. With respect to the application initiated by Mr. Mario Gurdián Hurtado, its feasibility is under review in order to legalize access (public street and right-of-way easement), in accordance with the technical requirements established in the Reglamento and compliance with the conditions set forth in official letter CCO2015-334 of 3 de noviembre de 2015. The subdivision was reported to the Municipalidad de Alajuela through official letter No. RCO-A-2016-00244. They allege that the complaint was addressed by the Municipality, resulting in official letter No. MA-PPCI-0555-2016 of 19 de setiembre de 2016 from the Director del Proceso de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela.They emphasize that the ICAA’s provision of the public drinking-water and sanitary-sewer service is governed by the principle of legality enshrined in Article 11 of the Constitución Política. Under that provision, it performs only those acts and provides only the public service entrusted to it by Ley Constitutiva No. 2726, as well as under Articles 11 and 13 of Ley General de la Administración Pública; consequently, the ICAA could not approve the connection of basic drinking-water services to the protected parties’ properties unless they first formally applied for drinking-water availability and subsequently for installation of the new service. They indicate that the Sala Constitucional has found no violations of administered parties’ fundamental rights in cases similar to this one. They cite this Chamber’s rulings No. 2010013354 and No. 2015004869. They consider that no administrative act or de facto administrative action violating the petitioners’ fundamental rights has been issued.
  4. 4The statutory requirements have been observed in the proceedings conducted.

Justice Campos Calvo authored the opinion; and,

Considerando:

I.Subject matter of the action. The petitioner claims that the ICAA endorsed the plans for the protected parties’ properties (properties registered in Alajuela under No. 497018-000, No. 497019-000, No. 441521-000, No. 441520-001, No. 425137-000, and No. 441514-000). Nevertheless, to date it has not connected those properties to the public water-supply system.

II.Proven facts. The following facts are deemed duly established and relevant to the resolution of this matter, either because they were proven as such or because the respondent failed to address them, as warned in the initial order:

a. In 2006, 2007, and 2012, the ICAA affixed the seal of approval for drinking-water availability to the plans corresponding to properties in the province of Alajuela, real-property folio registration numbers: 497018-000, 497019-000, 441521-000, 425137-000, 441514-000. (See report submitted).

b. The properties at issue in this action contain buildings intended for residential use and human habitation. All facilities receive drinking-water service from well AB-700. (See official letter GSP-RCO-2017-00457).

c. The Regional Unit has no record of any application by the protected parties for water availability or a service connection. (See official letter GSP-RCO-2017-00457).

d. There is no record in the OPEN Integrated Commercial System that the protected parties or the petitioner formally requested from the ICAA the provision of the service claimed in the constitutional rights protection action. (See report submitted).

III.Regarding the specific case. The petitioner alleges a violation of the protected parties’ right to water (derecho al agua), given that the respondent Institute has not interconnected the properties with the public water-supply system (sistema de acueducto público), despite having approved the plans. After reviewing the record, the Chamber found it proven that, in 2006, 2007 and 2012, ICAA approved the availability of drinking water for the properties in the province of Alajuela, real property registration folio numbers: 497018-000, 497019-000, 441521-000, 425137-000. 441514-000. As to the substantive question, namely, whether there has been a violation of the protected parties’ right to water, the Chamber found it proven, based on the evidence submitted, that those properties are supplied with drinking water from a well, and therefore there is no indication that the protected parties lack such water or that any situation exists that infringes the aforementioned right.

Regardless of the foregoing, another reason for dismissing the petition is the absence of an application by the interested parties (gestión de parte) for a service connection on behalf of the protected parties. In this regard, it was stated under oath—with the responsibility and solemnity that this entails—that there is no record in the OPEN Integrated Commercial System that the protected parties or the petitioner formally requested from ICAA the provision of the service sought in the amparo proceeding (amparo). The evidence submitted is relevant in establishing that the Regional Unit has no record of any request by the protected parties for water availability or a service connection. In the absence of an application by the interested parties, there is no actionable omission by the respondent Institute. In view of the foregoing, the petition is dismissed.

IV. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they submitted any document in paper form, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical or telematic device or produced using new technologies, such materials must be retrieved from the court within a maximum period of 30 business days counted from notice of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court at session N° 27-11 of 22 de agosto del 2011, article XXVI, and published in Judicial Bulletin number 19 of 26 de enero del 2012, as well as the resolution approved by the Superior Council of the Judiciary at session N° 43-12 held on 3 de mayo del 2012, article LXXXI.

Recurso de amparo que se tramita en expediente No. 16-003205-0007-CO, interpuesto por WÁLTER BRENES SOTO, cédula de identidad 0206450800, a favor de ALEXANDER ANTONIO ORTEGA VILLANEA, cédula de identidad 0401580519, ANDRÉS ALPÍZAR MURILLO, cédula de identidad 0109940600, ERNESTO RIVAS ALCÓN, cédula de identidad 0109700655, FRANKLIN OSVALDO SÁNCHEZ CHAVES, cédula de identidad 0109620704, MARÍA TERESA PÉREZ VARGAS, cédula de identidad 0109840975 y ROSAURA DEL GERARDO MORALES VÁSQUEZ, cédula de identidad 0204460208; contra el INSTITUTO COSTARRICENSE DE ACUEDUTOS Y ALCANTARILLADOS.

Resultando:

  1. 1Por escrito recibido en la Sala a las 16:20 horas de 27 de febrero de 2017, el recurrente interpone recurso de amparo. Manifiesta que Alexander Ortega Villanea es propietario de la finca del partido de Alajuela N° 497018-000, que María Teresa Pérez Vargas es propietaria de la finca del partido de Alajuela N° 497019-000, que Franklin Osvaldo Sánchez Chavez es propietario de la finca del partido de Alajuela N° 441521-000, que Andrés Aplizar Murillo es propietario de la finca del partido de Alajuela N° 441520-001, que Rosaura Morales Vásquez es propietaria de la finca del partido de Alajuela N° 425137-000 y que Ernesto Rivas Alcón es propietario de la finca del partido de Alajuela N° 441514-000. Alega que el Instituto visó cada uno de los planos de dichas propiedades con el Sistema de Acueducto. Señala que según los artículos 1 y 2 incisos a) e i) de la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, esta institución está obligada a proveer a los amparados el servicio de agua potable e incluso construir, ampliar o reformar el sistema de acueducto para suplir a dichos amparados, agua potable.Considera que la negativa a brindar el servicio de agua por parte del Instituto, violenta su derecho a la salud y a un ambiente sano y ecológicamente equilibrado. Solicita que se le ordene al Instituto accionado realizar la interconexión de las propiedades de los recurrentes al sistema de acueductos público.
  2. 2Por resolución de las 12:26 horas de 1 de marzo de 2016, se le dio curso al amparo.
  3. 3Por escrito recibido en la Sala el 10 de marzo de 2017, informan bajo juramento Juan Carlos Villalobos y Johnny Rodríguez Alvarado, por su orden Director y Jefe de la Oficina Cantonal de Alajuela, ambos de la Dirección Regional Central Oeste del Instituto Costarricense de Acueductos y Alcantarillados. Manifiestan que en 2006, 2007 y 2012 el ICAA estampó un sello de V°B° de Disponibilidad de Agua Potable únicamente para los planos que corresponden a las fincas de la provincia de Alajuela, folio real matrículas: 497018-000, 497019-000, 441521-000, 425137-000, 441514-000. Aclaran que dicho sello nunca implicó la aprobación de la interconexión de los inmuebles descritos con el sistema de acueducto administrado y operado por el ICAA en el sector de La Guácima de Alajuela. Indican que el fin del sello es certificar por el plazo de 12 meses la existencia real y actual de capacidad hídrica e hidráulica frente a determinado inmueble y que también es uno de los requisitos para que la Municipalidad local aprobara el visado municipal.Explican que la estampa del sello de disponibilidad de agua potable para posterior visado municipal fue derogada con la aplicación de la Constancia de Disponibilidad de Agua Potable que se regula en los artículos 5, 18 y 19 del Reglamento para la Prestación de los Servicios de ICAA. Comentan que la Constancia de Disponibilidad de Servicios de Acueductos y Alcantarillados Sanitarios es un requisito para que las Municipalidad y el INVU aprueben los permisos de fraccionamiento y construcción según los artículos 38,57 y 58 de la Ley de Planificación Urbana N° 4240 y los artículos 308, 309, 310. 311, 312 y 313 de la Ley General de Salud N° 5395. Explican que fue creada para determinar con anterioridad a la aprobación de un plano catastro, la realidad actual de existencia de capacidad hídrica, hidráulica, recolección y condiciones de carácter ambiental. Señalan que la emisión de la Constancia de Disponibilidad de Servicios no es una autorización de interconexión ni aprobación de los servicios, pues para esto se deben cumplir los requisitos de procedimientos previstos en la normativa del ICAA.Declaran que los amparados debieron de solicitar formalmente al ICAA el nuevo servicio de agua potable conforme a los artículos 30, 31 y 32 o 33 del Reglamento de Prestación de Servicios a Clientes de 1996 (que era el vigente en aquel momento) para poder obtener en su momento la conexión de los sistemas de agua potable administrados y operados por el ICAA. Argumentan que para adquirir el servicio, los amparados deben actualmente volver a gestionar la disponibilidad requerida, cumpliendo los requisitos y, en caso de ser técnica y legalmente positiva, solicitar el nuevo servicio conforme a los artículos 6, 13 y 25 del nuevo Reglamento para la Prestación de los Servicios de ICAA, publicado en 2015. Expresan que a la fecha de interposición del recurso de amparo, no hay evidencia en el Sistema Comercial Integrado OPEN de que los amparados o el recurrente Walter Brenes Soto se hayan presentado formalmente al ICAA para solicitar la prestación del servicio que se reclama.Alegan que la Dirección Regional Central Oeste y su Oficina Cantonal de Alajuela no han emitido algún acto administrativo o vía de hecho que deniegue de manera formal o arbitrariamente el acceso al servicio que brinda el ICAA y, como consecuencia de ello, se lesionen los derechos fundamentales del administrado. Indican que mediante el informe Técnico N°GSP-RCO-2017-00457, emitido el 7 de marzo de 2017 por el Ingeniero del Área de Operación y Mantenimiento de sistemas de esta Dirección Regional se constata que las fincas 4970118-000, 441521-000, 425137-000, 441514-000 sí cuentan con abastecimiento de agua potable. Este lo consiguen por medio de un sistema de autoabastecimiento que se habilitó a lo interno del desarrollo habitacional y es brindado por un tercero ajeno al ICAA, debido a que dicho proyecto habitacional no cuenta con red de distribución de agua potable. En el estudio se determinó que en las fincas 2-497018-000, 2-441520-001, 2-441514-000, 2-441521-0000, 2-497019-000 y 2-425137-000 existen edificaciones destinadas al uso residencial y habitación de personas.Aclaran que ninguna de las viviendas o apartamentos dedicados a la residencia de personas es abastecida por el ICAA; sin embargo, gozan de agua potable gracias a medidores individualizados. Se expone que durante la inspección se apersonaron los amparados Andrés Alpízar Murillo y Ernesto Rivas Alcón, y afirmaron que actualmente cuentan con suministro de agua potable, el cual lo cancelan con el Sr. Mario Gurdián Hurtado. Asimismo, los entrevistados indicaron haber comprado las propiedades bajo las condiciones existentes; en otras palabras, que el suministro de agua fuera brindado por el Sr. Mario Gurdián Hurtado, quien es presidente y representante judicial y extrajudicial de Quelite Azul Sociedad Anónima y anterior dueño de las fincas propiedad de los recurrentes. Se apunta que el amparado Rivas Alcón también disfruta del servicio de agua potable provisto por el Sr. Mario Gurdián Hurtado y que, por tanto, no carece del acceso al agua.El estudio concluye que el recurso se interpuso a causa del descontento de los amparados con la inactividad de la gestión legal por parte del Sr. Gurdián Hurtado ante el ICAA para normalizar la situación del acceso por servidumbre que permita brindar el servicio en cada inmueble. Con respecto a la gestión iniciada por el Sr. Mario Gurdián Hurtado, está en estudio de viabilidad para legalizar el acceso (calle pública y servidumbre de paso), conforme a los requerimientos técnicos establecidos en las normas del Reglamento y el cumplimiento de las condiciones expuestas mediante el oficio CCO2015-334 del 3 de noviembre de 2015. Se denunció el fraccionamiento ante la Municipalidad de Alajuela por el oficio N° RCO-A-2016-00244. Alegan que la denuncia fue atendida por la Municipalidad, generando el oficio N° MA-PPCI-0555-2016 del 19 de setiembre de 2016 del Director del Proceso de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela.Recalcan que la prestación del servicio público de agua potable y alcantarillado sanitario del ICAA está regulada por el principio de legalidad consagrado en el artículo 11 de la Constitución Política. Según la norma, solo realizan aquellos actos y prestamos el servicio público que han sido encomendados por la Ley Constitutiva N° 2726 y también bajo los artículos 11 y 13 de la Ley General de la Administración Pública, por lo que el ICAA no podría aprobar la interconexión de los servicios básicos de agua potable para los inmuebles de los amparados sin que antes ellos soliciten formalmente la disponibilidad de agua potable y posterior instalación del nuevo servicio. Indican que la Sala Constitucional ha descartado lesiones a los derechos fundamentales de los administrados en casos parecidos a este. Retoman las resoluciones N° 2010013354 y N° 2015004869 de esta Sala. Consideran que no se ha emitido algún acto administrativo o vía de hecho que vulnere los derechos fundamentales de los recurrentes.
  4. 4En los procedimientos seguidos se ha observado las prescripciones. legales.

Redacta la Magistrada Campos Calvo; y,

Considerando:

I.Objeto del recurso. El recurrente reclama que el ICAA visó los planos de los inmuebles de los amparados (fincas del partido de Alajuela, N° 497018-000, N° 497019-000, N° 441521-000, N° 441520-001, N° 425137-000 y N° 441514-000). Sin embargo, a la fecha no ha procedido a interconectar dichas propiedades con el sistema de acueducto público.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos, según lo prevenido en el auto inicial:

a. En 2006, 2007 y 2012, el ICAA puso el sello de visto bueno de disponibilidad de agua potable para los planos que corresponden a las fincas de la provincia de Alajuela, folio real matrículas: 497018-000, 497019-000, 441521-000, 425137-000, 441514-000. (Ver informe rendido).

b. Las propiedades objeto de este recurso tienen edificaciones destinadas al uso residencial y habitación de personas. Todas las instalaciones disfrutan del servicio de agua potable, a partir del pozo AB-700. (Ver oficio GSP-RCO-2017-00457).

c. No existe en la Unidad Regional ningún registro de solicitud de disponibilidad de agua o conexión de servicio de parte de los tutelados. (Ver oficio GSP-RCO-2017-00457).

d. No consta en el Sistema Comercial Integrado OPEN que los amparados o el recurrente hayan solicitado formalmente al ICAA la prestación del servicio que se reclama en el amparo. (Ver informe rendido).

III.Sobre el caso concreto. El recurrente acusa una lesión al derecho al agua de los tutelados, toda vez que el Instituto recurrido no ha procedido a realizar la interconexión con el sistema de acueducto público, a pesar de haber visado los planos. Tras analizar los autos, la Sala pudo tener por probado que el ICAA dio en 2006, 2007 y 2012 el visto bueno para la disponibilidad de agua potable en las fincas de la provincia de Alajuela, folio real matrículas: 497018-000, 497019-000, 441521-000, 425137-000. 441514-000. En cuanto a la pregunta de fondo, es decir, si existe una violación al derecho al agua de los tutelados, la Sala pudo tener por probado, con base en la prueba aportada, que dichas fincas son abastecidas con agua potable mediante pozo, por lo que no se observa que los tutelados carezcan de dicho líquido o que exista una situación que transgreda el apuntado derecho. Con independencia de lo anterior, otro motivo para rechazar el recurso es la ausencia de una gestión de parte para la conexión de servicio a favor de los tutelados.

Al respecto, se indicó bajo juramento -con la responsabilidad y solemnidad que ello implica- que no consta en el Sistema Comercial Integrado OPEN que los amparados o el recurrente hayan solicitado formalmente al ICAA la prestación del servicio que se reclama en el amparo. La prueba aportada es conducente al indicar que no existe registro de solicitud de disponibilidad de agua o conexión de servicio de parte de los tutelados en la Unidad Regional. Ante la ausencia de gestión de parte, no existe una omisión reprochable del Instituto recurrido. En virtud de lo

IV. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara sin lugar el recurso.
