Amparo proceeding (recurso de amparo) processed under case number 17-004109-0007-CO, filed by KATHERINE MARIE O´NEILL ACOSTA, identity card 1-592-595, against THE MUNICIPALITY OF MORAVIA.
Background:
Area Tree Quantity South side, 60 cm green area Chinese Apple and White Tucuico 8 West side, 210 cm green area Pink and White Jupiter 16 North side, 140 com green area Pink and White Jupiter 8 The approximate distance between each tree will be 8 m; they must likewise be placed at least 8m from corners and traffic signs and at least 2 m from the cemetery entrances. The trees must have a base diameter of at least 4 cm and a minimum height of 1.5 m, because planting smaller trees reduces their chances of survival. Based on the work schedule, tree cutting is scheduled to begin on Wednesday, February 8, followed by reforestation beginning Wednesday, March 1. Mr. Alberto Díaz will be responsible for this planting and will coordinate receipt of the trees from the Management of Club La Guaria. Because the trees will be planted during the dry season, assistance will be needed from the Head of Parks and Beautification and the Head of the Cemetery to ensure that the trees are maintained, particularly because of the scarcity of rainwater; accordingly, to ensure their survival, they must be watered daily.
A budgetary provision will be made to purchase other trees if these do not survive and must be replaced. To that end, on Monday, January 09 of this year, a budget amendment was requested through official letter CAMM 003-01-2017 so that the necessary arrangements could be made to purchase them.” He also cites the provisions of official letter CAMM 015-03-2017 dated March 27, 2017, in which the Director of Engineering stated the following: “1. In February of this year, 35 trees were removed: 10 Indian laurels (south side) and 25 queen’s crape-myrtles (north and west sides). Indian laurel and queen’s crape-myrtle are exotic species with very strong roots that damage infrastructure and roads. In this particular case, the sidewalks were in very poor condition because of the roots of these trees. In compliance with Articles 75 and 76 of the Municipal Code, the Municipality of Moravia rebuilt the sidewalk surrounding the Cemetery.
To prevent the roots from damaging the infrastructure again, a reforestation plan was implemented that included cutting down these trees and, within a short period, planting Chinese Apple and White Tucuico (8) and Pink and White Jupiter (24), native species that do not damage infrastructure and have ornamental, beautifying characteristics. Native species were selected because they provide nesting sites and food for native fauna, thereby encouraging the attraction of these species and preventing the appearance of exotic fauna and flora that could disrupt existing interactions within the country’s ecosystems. On February 2, a letter was received from Club La Guaria confirming the donation of the aforementioned species, an undertaking to be coordinated among Mr. Mariano Solano, head of the municipal works yard; Mr. Alberto Díaz, head of street and park cleaning; and Club La Guaria. Photographs showing the cut trees appear below. 2.
Regarding the cutting of trees at Colegio Nuestra Señora del Sión, according to our records, the Municipality of Moravia was not involved in this cutting…” It is therefore demonstrated that the trees on the west and south sides of the cemetery were cut down because of the need to control species not native to the area. These were exotic (introduced) species whose inherent characteristics include strong, shallow, and very large roots, which in turn damaged the cemetery infrastructure and the adjacent sidewalks. In addition, he emphasizes that a short-term reforestation plan involving native species was initiated together with the tree-cutting process. Because of their natural composition, these species would not damage the existing structures and also have ornamental, beautifying characteristics. The trees will be planted during the rainy season, using species such as Chinese Apple, White Tucuico, and Pink and White Jupiter.
He indicates that the tree-replacement process will be overseen by the Environmental Manager of the Municipality of Moravia, thereby ensuring that the municipal government’s intervention is professional and responsible. Accordingly, he considers it untrue that environmental damage occurred; rather, the felling took place as part of the tree-replacement project being carried out on the west and south sides of the Moravia cemetery. Nor will the fauna (parakeets, parrots, and squirrels) be adversely affected because, as demonstrated by the technical opinion attached to this report, issued by Engineer Iván Arce Vargas and Environmental Manager Adriana Umaña Vargas, the new species are in fact a primary source of food and nesting sites for the fauna native to the area. They will also attract birds and insects, promoting the integration of the area’s native flora and fauna. In summary, the trees being replaced are specimens whose specific biological characteristics make them unsuitable for the area, where it is preferable to establish smaller species that have a stronger relationship with the site’s biodiversity.
Regarding tree-cutting permits, he specifies that Article 28 of the Ley Forestal literally provides: “ARTICLE 28.- Exception from tree-cutting permit requirements. Forest plantations, including agroforestry systems, individually planted trees, and their products shall not require permits for cutting, transportation, industrial processing, or export. However, in cases where, before this law took effect, a forestry contract was entered into with the State for the receipt of Forestry Investment Certificates or an income-tax deduction, cutting must be performed in accordance with the management plan approved by the State Forestry Administration.” This means that, because the trees that were cut down are not endemic species, no State tree-cutting permit is required. As can be seen, this municipal government has protected the right to a healthy and ecologically balanced environment by carrying out planned tree cutting supported by technical studies, accompanied by tree replacement conducted under technical supervision.
Regarding the alleged cutting of trees that, according to the complainant, occurred during the week of March 6 through 10, 2017, at Colegio Nuestra Señora de Sion, a report issued by Mr. Alberto Díaz Chaves, Head of Park Cleaning and Maintenance and Street Cleaning Services, states that it occurred inside the institution without the Municipality’s authorization. In fact, the local government was unaware of it until the work had been completed. He states that, under the Ley Forestal, oversight and authorization of tree-cutting processes fall within the authority of the State Forestry Administration. Consequently, the Municipality did not fail to act and did not violate any constitutional provision. He requests that the amparo proceeding be dismissed.
Drafted by Justice Salazar Murillo; and,
Whereas:
I.Subject Matter of the Appeal (recurso). The appellant alleges that in February of this year several trees located in the community cemetery were felled, and that the same occurred in March at Colegio Nuestra Señora de Sión, even though they are ecological heritage, and therefore she considers Article 50 of the Constitution to have been violated.
II.Proven Facts (hechos probados). The following facts are deemed duly established and relevant to the decision in this matter:
<![if !supportLists]>a. <![endif]>The Municipalidad de Moravia rebuilt the sidewalk surrounding the cemetery and, in order to prevent the tree roots from damaging the infrastructure again, implemented a reforestation plan (plan de reforestación), which included felling these trees and planting Manzana china and Tucuico blanco (8), as well as Júpiter rosado and Júpiter blanco (24), within a short period. These native species do not damage infrastructure and have ornamental characteristics that enhance the surroundings (see attached evidence).
<![if !supportLists]>b. <![endif]>On January 18 of this year, the Contraloría Ambiental of the respondent Municipality delivered official letter CAMM 010012017 to the General Manager of Club La Guaria, requesting assistance through the donation of 32 trees to replace the trees that had been removed (see attached evidence).
<![if !supportLists]>c. <![endif]>On February 2, 2017, the Contraloría Ambiental received a letter from the General Manager of Club La Guaria in which he agreed to donate the 32 trees (see attached evidence).
<![if !supportLists]>d. <![endif]>The species selected by the respondent Municipality for reforestation were Júpiter Rosado, Júpiter Blanco, Tucuico Blanco, and Manzana China, whose root growth does not cause structural problems in sidewalks, streets, or cemetery facilities and which also have ornamental characteristics that enhance the city (see attached evidence).
<![if !supportLists]>e. <![endif]>In February of this year, the respondent Municipality felled 35 trees: 10 of the Laurel de la India species (located on the south side of the cemetery) and 25 of the Orgullo de la India species (located on the north and west sides of the cemetery). These are exotic species with very strong roots that caused damage to infrastructure and roads (see attached evidence).
<![if !supportLists]>f. <![endif]>The respondent Municipality selected native species for reforestation because they provide nesting sites and food for native wildlife, encourage the attraction of those species, and prevent the emergence of exotic flora and fauna that could alter existing interactions within the country’s ecosystems (see reports submitted).
<![if !supportLists]>g. <![endif]>The alleged felling of trees, which the appellant claims occurred from March 6 to 10, 2017, at Colegio Nuestra Señora de Sion, took place within the educational institution, without the respondent Municipality’s prior authorization or knowledge (see reports submitted).
<![if !supportLists]>h. <![endif]>Reforestation of the cemetery grounds was scheduled to begin on March 1 of this year (see reports submitted).
IV.The Specific Case. A review of the record shows that, in February of this year, officials of the respondent Municipality did indeed proceed to fell 35 trees, of which 10 were Laurel de la India and 25 were Orgullo de la India, located along the sides of the cemetery. However, this action was not arbitrary, because these are exotic species with very strong roots that damaged infrastructure, sidewalks, and roads. The Municipalidad de Moravia rebuilt the sidewalk surrounding the cemetery and, in order to prevent the tree roots from damaging infrastructure again, implemented a reforestation plan that included felling these trees and planting Manzana china and Tucuico blanco (8), as well as Júpiter rosado and Júpiter blanco (24), within a short period. These native species do not affect infrastructure and have ornamental characteristics that enhance the surroundings. Thus, this was a duly planned action intended not only to ensure access routes and personal safety, but also to replace those tree species with others that beautify the community, provide nesting sites for wildlife, and have roots that do not cause structural problems, as the felled species did.
Furthermore, given the type of trees felled (exotic) and the type of planting, no prior municipal permit was required under Article 28 of the Ley Forestal: “ARTICLE 28.- Exception from felling permit (permiso de corta) requirement. Forest plantations (plantaciones forestales), including agroforestry systems (sistemas agroforestales) and individually planted trees and their products, shall not require a permit for felling, transportation, processing, or export. However, in cases where, prior to the entry into force of this law, a forestry contract was entered into with the State to receive Certificados de Abono Forestal or an income-tax deduction, felling must be carried out in accordance with the provisions of the management plan (plan de manejo) approved by the Administración Forestal del Estado.” Consequently, the action at issue complied with the law.
V.With respect to the alleged felling of trees during the week of March 6 to 10, 2017, at Colegio Nuestra Señora de Sion, the respondent authority stated that it had no prior knowledge thereof because it occurred within the educational institution and without authorization from the respondent Municipality. Nor is there any indication that the appellant filed a complaint concerning the matter with the respondent authority or MINAE, which bears primary responsibility for overseeing the State’s forestry administration. In light of the foregoing, no constitutional violation by omission can be attributed to the respondent Municipality. Should the appellant consider the school’s action arbitrary, she may, if she so chooses, file the corresponding complaint with MINAE so that it may verify the allegations in that regard. For all the reasons stated above, the appeal must be dismissed in its entirety.
VI.Separate Opinion of Justice Hernández López Concerning the Claim of a Violation of Article 50 of the Political Constitution.
1. The historical context that once prompted the Chamber’s extensive involvement in environmental matters has changed considerably, requiring this body to reconsider the conditions governing its participation in safeguarding the right of individuals to a healthy and ecologically balanced environment, as protected by Article 50 of the Political Constitution. Indeed, the current situation—characterized by an extremely extensive body of legislation and regulations that includes substantive rules, procedures, and the creation of bodies responsible for enforcing the provisions of the Fundamental Charter—is radically different from the previous situation, in which the absence of regulations and of State entities with appropriate jurisdiction compelled the Chamber to assume a leading, nearly exclusive role in defending the aforementioned constitutional right.
2. Today, we are faced with a “dense framework” of environmental regulations—as Justice Jinesta Lobo aptly described it in his dissenting opinion (voto salvado) on this subject—which has produced two significant developments. The first and most obvious is the emergence of comprehensive legal regulation governing activities whose impact on the environment was previously subject to little or no regulation, as well as the creation of State bodies vested with powers to monitor and control the effects of human activity on the environment. The second development is that this increasing legalization—predominantly through legislation and regulations—necessarily entails the involvement of both administrative justice and the ordinary courts, primarily the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa), but also the criminal jurisdiction. In keeping with the importance of environmental law, these jurisdictions have established broad procedural avenues and inclusive rules of standing (legitimación), enabling individuals subject to the Administration to enforce the provisions of the extensive legal framework concerning environmental matters.
3. In that context, it is neither legally nor functionally appropriate for the Constitutional Chamber to displace—or, worse still, replace—the ordinary judicial bodies in performing their task, which is also constitutional in rank, of ensuring effective compliance with statutes and regulations. It is legally inappropriate because, in the vast majority of these cases, the Chamber is being asked to interpret and enforce statutory and regulatory provisions, thereby risking an overlap between its jurisdiction and that of other judicial bodies that were specifically created to perform such tasks. It is also functionally inappropriate because the design of its proceedings is ill-suited to the complexity of numerous environmental disputes involving sequences of technically and legally complex facts and actions. There are well-known examples concerning both issues in which the Chamber has issued a partial or technically incomplete ruling, or in which unnecessary friction and harm to legal certainty have resulted.
4. Among the technical considerations I have assessed, I would add the fact that this jurisdiction has no judges responsible for enforcing judgments who could provide proper follow-up for such judgments—which are generally complex and sometimes involve monitoring remediation plans (planes remediales), among other measures, through interinstitutional coordination and oversight lasting months or even years.
5. From that perspective, this Court’s decision to step aside in environmental matters should not be viewed as abandoning such matters but, on the contrary, as ensuring their proper protection before the forum best suited to their complex and diverse nature. Nor should it be viewed as this body’s relinquishment of its duty to protect the constitutional rights entrusted to it by the Political Constitution and its Organic Law, a duty that, in my view, remains reserved in this field for specific cases. Rather, it constitutes a readjustment of the burdens and tasks assigned to the various State bodies, so that each may fully perform its work within its assigned sphere, as well as an exercise of the authority to define its own jurisdiction, as established in Article 7 of its Organic Law.
6. It is clear that the Chamber does not contemplate leaving the protection of individuals’ rights in environmental matters entirely to other jurisdictions. It is well established that, although any claim alleging a violation of statutory or regulatory provisions may ultimately be framed as a constitutional matter, some cases require no more than the application of constitutional law. The aim, therefore, is for the Chamber to become one of several leading actors, so that—collectively, and each within its own sphere—they may address the full range of situations involved in protecting the right to a healthy and ecologically balanced environment within a society that also has other equally pressing needs. I firmly believe that, under this position, citizens lose not one iota of protection, while substantial gains are made in breadth, perspective, and respect for the balance and distribution of powers, the latter being a principle that must necessarily be considered because it governs the constitutional dynamics of any liberal and democratic system such as ours.- 7.
In line with the foregoing, I maintain that this Chamber should refrain from hearing claims brought before it for alleged violations of Article 50 of the Constitución Política, leaving their adjudication to the administrative justice system and the administrative-litigation jurisdiction (jurisdicción contenciosa administrativa). The foregoing is stated as a general principle, without prejudice to recognizing the existence of particular cases or groups of cases that, in my view, would still be better protected by this Chamber and therefore should be heard and decided by it.- Among such groups of cases, and without this enumeration being deemed a closed and definitive list, I may indicate that the Chamber should retain jurisdiction over situations such as claims concerning environmental violations that also directly endanger human health or access to or the quality of water; cases involving gross and direct violations of the environment in which there is a manifest absence of protection by state authorities, provided that the nature of the claim also allows it to be addressed through the remedy of constitutional injunction (amparo) as a summary and special procedural mechanism, since I also believe that the constitutional injunction should not be converted into an ordinary proceeding in order to address, even in the aforementioned cases, matters that exceed its capacity to deal with them adequately.
8. In this specific case, according to the facts found to have been proven, none of the exceptions mentioned is present, and the situation raised falls within those cases in which recourse to the protective mechanisms of the Administration and the ordinary courts constitutes a broader and more comprehensive avenue for addressing the matter at issue. Accordingly, Article 9 of the Ley de la Jurisdicción Constitucional should have been applied and the petition summarily dismissed; however, since that did not occur, the constitutional injunction filed must now be denied.
The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the court office within a maximum period of 30 business days counted from notification of this judgment. Otherwise, any material not collected within this period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.

Resultando:

Los árboles deberán tener un diámetro a la base de al menos 4 cm y una altura mínima de 1.5 m, ya que si se colocan árboles de menor tamaño se reducen las posibilidades de sobrevivencia. De acuerdo a los tiempos de ejecución de las obras se programa la corta de los árboles para iniciar el día miércoles 8 de febrero, para la posterior reforestación a partir miércoles 1 de marzo. Esta siembra estará a cargo del señor Alberto Díaz, el cual coordinará la recepción de los mismos por parte de la Gerencia del Club La Guaria.
Como los árboles se sembrarán en época de verano se necesitará la colaboración del Encargado de Parques y Ornato y del Encargado del Cementerio para que se les de mantenimiento a los árboles, principalmente por la escasez de agua de lluvia, por lo que para garantizar su sobrevivencia se le deberá proveer de agua cotidianamente. Se contará con una previsión presupuestaria para compra de otros árboles en caso de que estos no sobrevivan y se deban substituir. Para lo cual el día lunes 09 de enero del presente año, se solicitó por medio de oficio CAMM 003-01-2017 la modificación presupuestaria para realizar las gestiones para la compra de los mismos.”. Asimismo, cita lo dispuesto en el oficio CAMM 015-03-2017 del 27 de marzo de 2017, en el que el Director de Ingeniería expuso lo siguiente: “1. En febrero del presente año, se llevó a cabo la eliminación de 35 árboles, 10 de laurel de la india (costado sur) y 25 de orgullo de la india (costados norte y oeste).
El laurel de la india y el orgullo de la india son especies exóticas que poseen raíces muy fuertes, generando daños en infraestructuras y carreteras. Para este caso en particular, las aceras se encontraban en muy malas condiciones como consecuencia de las raíces de estos árboles. Como parte del cumplimiento de los artículos 75 y 76 del Código Municipal, la Municipalidad de Moravia reconstruyó la acera que rodea el Cementerio, y con el objetivo de evitar que las raíces volvieran a causar daños en la infraestructura, se puso en acción un plan de reforestación el cual incluyó la corta de estos árboles y la plantación en un corto plazo, de Manzana china y Tucuico blanco (8) y Júpiter rosado y blanco (24),especies nativas que no provocan daños en las infraestructuras y que poseen características ornamentales de embellecimiento. Se seleccionó la introducción de especies nativas debido a que éstas son fuente de anidación y alimento de fauna autóctona, lo que estaría promoviendo la atracción de estas especies y evitando la aparición de fauna y flora exótica que puede alterar las interacciones existentes dentro de los ecosistemas del país.
El 2 de febrero se recibió una carta de parte del Club La Guaria, en la que se confirma la donación de las especies antes mencionadas, acción que se coordinará entre el Sr. Mariano Solano, jefe del plantel municipal, el sr. Alberto Díaz, jefe de aseo de vías y parques y el Club La Guaria. A continuación se presentan unas fotografías en donde se aprecia los árboles cortados. 2. Con respecto a la corta de árboles del Colegio Nuestra Señora del Sión, de acuerdo con nuestros registros, la Municipalidad de Moravia no se vio involucrada esta corta…” Así queda demostrado, que la corta de árboles en los costados oeste y sur del cementerio se dio por la necesidad de controlar especies no nativas de la zona, las cuales eran especies exóticas (introducidas), ya que las características propias de estas especies, entre otras, son las fuertes raíces, además superficiales y de gran tamaño, lo cual a su vez dañaba la infraestructura del cementerio y de las aceras aledañas.
Aunado a lo dicho, resalta que junto con el proceso de corta de árboles, se inició un plan de reforestación de corto plazo de especies nativas, que por su composición natural, no provocarían daño a las estructuras existentes, pero que además tienen características ornamentales de embellecimiento. La plantación arbórea se realizará en época lluviosa y se utilizarán especies como Manzana China, Tucuico Blanco, Júpiter Rosado y Blanco. Indica que el proceso de sustitución de árboles estará regido por la Gestora Ambiental de la Municipalidad de Moravia, lo cual garantiza que se trata de una intervención profesional y responsable del ayuntamiento. Así las cosas, considera que no es cierto que se haya producido un daño ambiental, sino que la tala fue con ocasión del proyecto de sustitución de árboles que se desarrolla en el costado oeste y sur del cementerio de Moravia. Tampoco se afectará con ello la fauna (pericos, loras y ardillas), ya que como se demuestra con el criterio técnico adjunto a este informe, emitido por el Ingeniero Iván Arce Vargas, y la gestora ambiental Adriana Umaña Vargas, más bien las nuevas especies son fuente primaria de alimentación y anidación para la fauna propia de la zona, además de que atraerán aves e insectos, promoviendo una integración de la flora y fauna nativas de la zona.
Entonces, recapitulando, la sustitución de árboles se da con respecto a individuos que por sus características biológicas específicas no son aptos para la zona, en la cual es preferible establecer especies de menos tamaño y con una mayor interrelación con la biodiversidad del sitio. En cuanto a las licencias para la corta, precisa que el artículo 28 de la Ley Forestal, de forma literal señala: “ARTÍCULO 28.- Excepción de permiso de corta. Las plantaciones forestales, incluidos los sistemas agroforestales y los árboles plantados individualmente y sus productos, no requerirán permiso de corta, transporte, industrialización, ni exportación. Sin embargo, en los casos en que antes de la vigencia de esta ley exista un contrato forestal, firmado con el Estado para recibir Certificados de Abono Forestal o deducción del impuesto sobre la renta, la corta deberá realizarse conforme a lo establecido en el plan de manejo aprobado por la Administración Forestal del Estado”, lo cual significa que, en razón de que los árboles cortados no son especies endémicas, no se requiere permiso de corta del Estado.
Como puede verse, este ayuntamiento ha tutelado el derecho a un ambiente sano y ecológicamente equilibrado, al realizar una corta de árboles programada y amparada en estudios técnicos, la cual estará acompañada de una sustitución arbórea desarrollada bajo una supervisión técnica. En relación con la supuesta corta de árboles que señala la recurrente que se dio durante la semana del 6 al 10 de marzo del 2017 en el Colegio Nuestra Señora de Sion, según informe emitido por el señor Alberto Díaz Chaves, Jefe de Servicios de Limpieza y Mantenimiento de Parques y Aseo de Vías, la misma ocurrió a lo interno del centro sin autorización de la Municipalidad. De hecho el gobierno local no tuvo conocimiento hasta el momento que se finalizó. Refiere que conforme a la Ley Forestal, la fiscalización y autorización en procesos de corta de árboles es competencia de la Administración Forestal del Estado, por consiguiente, la Municipalidad no fue omisiva, y no quebrantó ninguna norma constitucional. Solicita que se desestime el amparo.
Redacta el Magistrado Salazar Murillo; y,
Considerando:
I.Objeto del recurso. La recurrente alega que en febrero de este año se talaron varios árboles que estaban en el cementerio de la localidad, y lo mismo pasó en marzo en el Colegio Nuestra Señora de Sión, a pesar de que son patrimonio ecológico, por lo que estima lesionado el artículo 50 constitucional.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
<![if !supportLists]>a. <![endif]>La Municipalidad de Moravia reconstruyó la acera que rodea el cementerio y con el objetivo de evitar que las raíces de los árboles volvieran a causar daños en la infraestructura, puso en acción un plan de reforestación, el cual incluyó la corta de estos árboles y la plantación en un corto plazo de Manzana china y Tucuico blanco (8) así como Júpiter rosado y blanco (24), especies nativas que no provocan daños en las infraestructuras y poseen características ornamentales de embellecimiento (ver prueba adjunta).
<![if !supportLists]>b. <![endif]>El 18 de enero de este año, la Contraloría Ambiental de la Municipalidad recurrida entregó el oficio CAMM 010012017 al Gerente General del Club La Guaria, en el cual le solicitó colaboración para la donación de 32 árboles que remplazarán los árboles eliminados (ver prueba adjunta).
<![if !supportLists]>c. <![endif]>El 2 de febrero de 2017, la Contraloría Ambiental recibió la nota del Gerente General del Club La Guaria, en la cual aceptó donar los 32 árboles (ver prueba adjunta).
<![if !supportLists]>d. <![endif]>Las especies elegidas por la Municipalidad recurrida para reforestar fueron Júpiter Rosado, Júpiter Blanco, Tucuico Blanco y Manzana China, cuyo crecimiento radicular no genera problemas estructurales en las aceras, calles y las instalaciones del cementerio, además de que poseen características ornamentales para el embellecimiento de la ciudad (ver prueba adjunta).
<![if !supportLists]>e. <![endif]>En febrero de este año, la Municipalidad recurrida llevó a cabo la corta de 35 árboles, 10 de la especie Laurel de la India (ubicados al costado sur del cementerio) y 25 de la especie Orgullo de la India (ubicados al costado norte y oeste del cementerio), los cuales son especies exóticas con raíces muy fuertes, lo que causó daños en infraestructuras y carreteras (ver prueba adjunta).
<![if !supportLists]>f. <![endif]>La municipalidad recurrida seleccionó la introducción de especies nativas para reforestar, debido a que son fuente de anidación y alimento de fauna autóctona, promueve la atracción de estas especies, y evita la aparición de fauna y flora exótica que puede alterar las interacciones existentes dentro de los ecosistemas del país (ver informes rendidos).
<![if !supportLists]>g. <![endif]>La alegada corta de árboles, que la recurrente afirma habese dado del 6 al 10 de marzo del 2017 en el Colegio Nuestra Señora de Sion, ocurrió a lo interno del centro educativo, sin autorización ni conocimiento previo de la municipalidad recurrida (ver informes rendidos).
<![if !supportLists]>h. <![endif]>La reforestación del área del cementerio iniciaría a partir del 1 de marzo de este año (ver informes rendidos).
IV.Sobre el caso concreto. Del estudio de los autos, se tiene que, efectivamente, en febrero de este año, funcionarios de la Municipalidad recurrida procedieron a cortar 35 árboles, de los cuales 10 eran especies de Laurel de la India, y 25 eran Orgullo de la India, ubicados en los costados del cementerio. Sin embargo, dicha actuación no fue arbitraria, pues se trata de especies exóticas con raíces muy fuertes que dañaron infraestructuras, aceras y carreteras. La Municipalidad de Moravia reconstruyó la acera que rodea el cementerio, y, con el objetivo de evitar que las raíces de los árboles volvieran a dañar infraestructura, puso en acción un plan de reforestación, el cual incluyó la corta de estos árboles y la plantación en un corto plazo de Manzana china y Tucuico blanco (8), así como de Júpiter rosado y blanco (24), especies nativas que no afectan las infraestructuras y que poseen características ornamentales de embellecimiento.
De manera que se trata de una actuación debidamente planificada, que no solo busca garantizar las vías de acceso y la integridad de las personas, sino que además, pretende sustituir dichas especies de árboles por otras que embellezcan a la comunidad, sean objeto de anidación de la fauna, y cuyas raíces no causen problemas estructurales, tal como sí ocurrió con las especies cortadas. Por otro lado, dado el tipo de árboles talados (exóticos) y clase de plantación, no se requería de un permiso municipal previo, según lo dispuesto en el artículo 28 de la Ley Forestal: “ARTÍCULO 28.- Excepción de permiso de corta. Las plantaciones forestales, incluidos los sistemas agroforestales y los árboles plantados individualmente y sus productos, no requerirán permiso de corta, transporte, industrialización ni exportación. Sin embargo, en los casos en que antes de la vigencia de esta ley exista un contrato forestal, firmado con el Estado para recibir Certificados de Abono Forestal o deducción del impuesto sobre la renta, la corta deberá realizarse conforme a lo establecido en el plan de manejo aprobado por la Administración Forestal del Estado.” Por consiguiente, la actuación de marras se ha ajustado a derecho.
V.En relación con la acusada corta de los árboles durante la semana del 6 al 10 de marzo de 2017 en el Colegio Nuestra Señora de Sion, la autoridad recurrida afirmó que no tuvo conocimiento previo de ello, ya que se produjo a lo interno del centro educativo y sin autorización de la municipalidad recurrida. Tampoco consta que la recurrente haya planteado denuncia alguna al respecto ante la autoridad recurrida o el MINAE, que es el responsable principal de velar por la administración forestal del Estado. Dado lo expuesto, no puede acreditársele al municipio recurrido violación constitucional alguna por omisión. En caso de que la parte recurrente determinara estimar arbitraria la actuación de dicho colegio, deberá plantear, si a bien lo tiene, la denuncia respectiva ante el MINAE, a fin de que sea este quien verifique lo alegado en tal sentido. En razón de todo lo expuesto, lo procedente es declarar sin lugar el recurso en todos sus extremos.
VI.Nota separada la Magistrada Hernández López respecto del reclamo por infracción del artículo 50 de la Constitución Política.
1. El contexto histórico que motivó en su momento la amplia intervención de la Sala en materia ambiental, ha tenido una considerable variación que impone a este órgano reconsiderar las condiciones para su participación en el aseguramiento del derecho de las personas a un ambiente sano y equilibrado, tal y como ha sido tutelado en el artículo 50 de la Constitución Política. En efecto, la situación actual –caracterizada por una amplísima producción legal y reglamentaria que incluye reglas de fondo, procedimientos y creación de órganos para el cumplimiento de lo ordenado en la Carta Fundamental- es radicalmente diferente de la anterior, en la cual la ausencia de normativa y de instancias estatales con competencia apropiada, le impuso a la Sala un papel de protagonista, casi único, en la defensa del precitado derecho constitucional.
2. Hoy en día, nos encontramos frente a un “denso entramado” de normativa ambiental –tal y como acertadamente lo ha descrito el Magistrado Jinesta Lobo en su voto salvado sobre este tema- lo cual ha producido dos fenómenos relevantes: el primero y más obvio, es el surgimiento de una abarcadora regulación jurídica respecto de actividades cuya incidencia en el ambiente estaba poco o nada ordenada, así la creación de órganos estatales con potestades de vigilancia y control sobre los efectos de la actividad humana en el entorno. El segundo fenómeno consiste en que esa creciente juridificación –predominantemente legislativa y reglamentaria– trae aparejada una ineludible entrada en escena tanto de la justicia administrativa como de la jurisdicción ordinaria -prioritariamente la contencioso administrativa, pero también la penal. En ellas, acorde con la importancia del derecho ambiental, se han regulado de forma amplia vías procesales y medios de legitimación incluyentes, de manera que los administrados puedan hacer valer lo establecido en ese amplio orden jurídico que se relaciona con el tema ambiental.
3. En ese contexto, no resulta apropiado jurídicamente, ni desde el punto de vista funcional, que la Sala Constitucional desplace, o -peor aún- sustituya, a los órganos de justicia ordinarios en la realización de su tarea, también de rango constitucional, de velar por el efectivo cumplimiento de leyes y reglamentos. Es impropio jurídicamente porque en la inmensa mayoría de estos casos lo que se solicita es que interprete y haga valer normas legales y reglamentarias con lo que arriesga traslapar sus competencias con las de otros órganos jurisdiccionales que –ellos sí- han sido creados para ejecutar tales tareas; y resulta también funcionalmente incorrecto, porque el diseño de sus procesos se aviene mal con la complejidad que está presente en numerosos conflictos ambientales que se componen de series de hechos y actos técnica y jurídicamente complejos. Sobre ambas cuestiones existen conocidos ejemplos en los que la Sala ha arrojado una resolución a medias o técnicamente incompleta, o bien se han generado fricciones innecesarias y afectación de la seguridad jurídica.
4. Como parte de los aspectos técnicos que he valorado, añado que está el hecho de que esta jurisdicción no cuenta con jueces ejecutores de sentencia que permitan darle seguimiento adecuado a las mismas -generalmente complejas-, que implican en ocasiones el seguimiento de planes remediales, entre otros, con coordinación interinstitucional y seguimiento de meses y hasta años.
5. Desde esa perspectiva, la decisión de dar un paso al lado en la materia ambiental por parte de este Tribunal no debe ser vista como un abandono de la materia ambiental, sino al contrario, de su adecuada tutela en la instancia que mejor se aviene a la naturaleza de su complejidad y diversidad. Asimismo tampoco debe ser visto como la declinación de esta instancia en su tarea de protección de los derechos constitucionales que le imponen la Constitución Política y su Ley Orgánica, que desde mi punto de vista, queda reservada en esta materia para casos específicos. Se trata más bien, de un ejercicio de reacomodo de las cargas y tareas que corresponden a los distintos órganos estatales, de manera que cada uno de ellos, pueda desplegar plenamente su labor dentro del ámbito que se le ha asignado, así como del ejercicio de fijar su propia competencia, según lo establece el artículo 7 de su Ley Orgánica.
6. Queda claro que la Sala no se plantea abandonar a otras jurisdicciones la labor de protección de los derechos de las personas en materia ambiental. Es conocido que si bien todo reclamo por infracción de normas legales y reglamentarias puede ser reconducido hasta el ámbito constitucional, existen casos cuya resolución no exige más que la aplicación del derecho de la Constitución. Se trata entonces de lograr que la Sala se convierta en protagonista junto con otros, de manera que –entre todos y cada uno en su espacio- se pueda cubrir toda la variedad de situaciones que presenta una protección del derecho a un medio ambiente sano y equilibrado dentro de una sociedad en la que también existen otras necesidades igual de acuciantes. Con esta posición creo firmemente que el ciudadano no pierde un ápice de protección pero se gana sustancialmente en amplitud, en perspectiva y en respeto al equilibrio y distribución de poderes, principio este último de obligada consideración, puesto que rige la dinámica constitucional de cualquier sistema liberal y democrático como el nuestro.- 7.
En línea con lo anterior, sostengo que esta Sala debe abstenerse de conocer los reclamos que se le presenten por supuesta infracción al artículo 50 de la Constitución Política para dejar en manos de la justicia administrativa y la jurisdicción contenciosa administrativa su conocimiento. Lo anterior se deja afirmado con carácter general, sin perjuicio de reconocer la existencia de casos particulares o grupos de casos que, según mi criterio, si resultarían aún mejor tutelados por esta Sala y por tanto deben ser conocidos y resueltos por ella.- Dentro de tales grupos de casos, y sin que esta enunciación pueda considerarse como una lista cerrada y definitiva, puedo señalar que la Sala debe reservarse el conocimiento de situaciones como por ejemplo los reclamos por infracciones ambientales que además pongan en riesgo directo la salud de las personas, o el acceso o calidad del agua; los casos de violaciones groseras y directas al ambiente y en los cuales se constate una palmaria ausencia de la protección por parte de las autoridades estatales, siempre y cuando además la naturaleza del reclamo permita ser abordado mediante el instrumento del amparo como instituto procesal sumario y especial, ya que estimo que tampoco se debe “ordinariar” el amparo para abordar, aún en estos casos citados, temas que rebasen la capacidad de ser atendidos adecuadamente en el mismo.
8. En el caso concreto, de conformidad con los hechos probados no se presenta ninguna de las excepciones que mencionan y la situación planteada se ubica dentro de aquellos casos en las que la intervención de los medios de protección de la Administración y la justicia ordinaria, resultan ser una vía más amplia y completa para el tema discutido. De tal modo, debió aplicarse el artículo 9 de la Ley de la Jurisdicción Constitucional y rechazar de plano el recurso, no obstante, al no haber ocurrido así, procede ahora declarar sin lugar el amparo interpuesto.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara sin lugar el recurso. La Magistrada Hernández López pone nota separada.
