Writ of amparo (recurso de amparo) filed by Oscar Isidro Ceciliano Mora, identity card number 6-088-944, against the Ministerio de Salud and the Municipalidad de Santa Bárbara de Heredia.

Facts:

  1. 1In a filing received by the Secretariat of the Chamber at 09:46 on January 17, 2017, the petitioner filed a writ of amparo against the Ministerio de Salud and the Municipalidad de Santa Bárbara de Heredia. He states that activities related to agriculture were traditionally carried out in Santa Bárbara de Heredia. He explains that, for this purpose, irrigation ditches (acequias) were established to distribute water throughout the canton for irrigation. He indicates that after the land-use change (cambio de uso de suelo), and as the canton developed, the irrigation ditches remained operational even though they no longer served the purpose for which they had been created. He asserts that the respondent municipality issued construction permits without requiring residents to install septic tanks and drainage systems or to provide proper channeling of stormwater (aguas pluviales). He states that this situation encouraged residents to discharge stormwater, wastewater (aguas residuales), and sewage (aguas negras) into the irrigation ditch.He mentions that in 1980 they were forced to install 30 used pipes on part of the property where his house is built so that the water conveyed by the irrigation ditch would not wash away or sweep through his coffee plantation and the neighboring coffee plantations. Nevertheless, as the number of construction permits has increased, that portion of the sewer system (alcantarillado) can no longer accommodate the volume of water it receives or conveys. Consequently, the culvert (alcantarilla) has collapsed and threatens to bring down the wall around his house. He alleges that, given the seriousness of the problems affecting him, he initiated proceedings so that the respondent authorities would investigate who was responsible and identify the houses from which the water causing foul odors and enabling mosquitoes to breed, thereby endangering public health, originated. He indicates that he has petitioned the respondent municipality to carry out the corresponding layout of the 197 meters of sewer system and eliminate the problem that arises specifically during the rainy season, when the culvert becomes saturated and overflows near his house, as occurred in September 2016.However, despite his numerous petitions, the problems persist, notwithstanding visits and reports stating that measures are necessary and urgent. He requests that the Chamber grant the petition, with all attendant legal consequences.
  2. 2By a ruling of the Office of the Presidency issued at 16:50 on January 17, 2017, the proceeding was admitted.
  3. 3In a filing received by the Secretariat of the Chamber at 10:52 on January 25, 2017, María Antonieta Acuña Hernández, in her capacity as Director of the Área Rectora de Salud de Santa Bárbara de Heredia of the Ministerio de Salud, reports under oath that the health and environmental problem was not caused by the health authorities of the Área Rectora de Salud. Rather, the problem stems from certain community residents and the land-use change that occurred before the amparo petition was filed. She states that the matter reported falls within the jurisdiction of the Municipalidad de Santa Bárbara. She indicates that, in any event, the ministry has issued a series of administrative acts (actos administrativos) in response to the complaint. She states that on January 6, 2016, that Área Rectora received 7 complaints from the petitioner against several residents living near his property concerning problems involving sewage, wastewater, stormwater, and foul odors.She asserts that, in connection with complaint N° 3-2016, tests using dye yielded negative results on January 15, 2016, and decision N° CN-ARS-SB-345-2016 was issued on April 5, 2016. She maintains that, in connection with complaint N° 4-2016, 3 attempts were made to conduct an inspection; furthermore, a dye test yielded a positive result on February 1, 2016, health order (orden sanitaria) N° 11-2016 was issued, and compliance with the health order was verified on August 24, 2016. She explains that, in connection with complaint N° 5-2016, 3 attempts were made to conduct an inspection, a dye test yielded a positive result on February 1, 2016, and health order N° 12-2016 was issued. She alleges that, in connection with complaint N° 6-2016, 2 attempts were made to conduct an inspection and a dye test yielded a positive result on January 27, 2016; therefore, health order N° 10-2016 was issued, and compliance with the health order was subsequently verified on September 14, 2016.She mentions that, with respect to complaint N° 7-2016, a dye test yielded a negative result on September 21, 2016. She states that, in connection with complaint N° 8-2016, a dye test yielded a positive result on January 11, 2016; furthermore, health order N° 09-2016 was issued and served on September 23, 2016. Compliance with that order was consequently verified on January 3, 2017, at which time noncompliance with the health order was detected. The case was therefore referred to the Prosecutor’s Office for Disobedience of Authority, and remains open and pending resolution. She clarifies that, in connection with complaint N° 9-2016, dye tests yielded negative results on January 13, 2016. She adds that no sewage problem or odors could be substantiated in any of the cases. She states that complaint N° 8-2016 remains under follow-up because the respondent lacks the financial resources to comply with the health order but is willing to perform the repairs that were ordered; therefore, the case remains open and under follow-up.She reports that on January 3, 2017, the petitioner was provided with a summary of the actions taken by that office. She indicates that on January 3, 2017, that Area Directorate asked the Alcalde de Santa Bárbara to conduct a joint inspection within no more than 8 days. She states that, according to inspection report N° CN-ARS-SB-LHC-20-2017, a joint inspection was conducted on January 12, 2017, with the Director de la Unidad Técnica de Gestión Vial of the municipality. She asserts that report N° UTGVM-018-2017 of January 23, 2017, was issued as a result of that inspection. It concluded that the current situation of the owner of property identified by cadastral plan (plano catastrado) N° H461374-82 had been reviewed and that no specific impact on the public road was observed at the indicated location. However, it was noted that the natural terrain had been cut to level it for construction of the house, thereby affecting the depth of the irrigation ditch and, consequently, its capacity to receive a greater flow during the rainy season.She maintains that the owner of the property identified by the cadastral plan is obligated to receive the water that flows naturally during rainy periods. She explains that, at this time of year, the flow is insufficient to cause flooding. She alleges that cleaning and maintenance are the owner’s responsibility because he altered the natural watercourse (cauce natural) by placing it in pipes. She requests that the Chamber deny the petition against her.
  4. 4In a filing added to the digital case record at 14:19 on January 25, 2017, Héctor Luis Arias Vargas, in his capacity as Alcalde de Santa Bárbara, reports under oath that, according to the Unidad Técnica de Gestión Vial of that municipality, the current situation of the owner of property identified by cadastral plan N° H461374-82 was reviewed and no specific impact on the public road was observed at the indicated location. However, it was noted that the natural terrain had been cut to level it for construction of the house, thereby affecting the depth of the irrigation ditch and, consequently, its capacity to receive a greater flow during the rainy season. He maintains that the owner of the property identified by the cadastral plan is obligated to receive the water that flows naturally during rainy periods. He explains that, at this time of year, the flow is insufficient to cause flooding.He alleges that cleaning and maintenance are the owner’s responsibility because he altered the natural watercourse by placing it in pipes. He contends that matters involving wastewater and sewage fall within the jurisdiction of the Ministerio de Salud. He states that, during ordinary session N° 23-2016 of October 4, 2016, the Concejo Municipal de Santa Bárbara agreed to ask the Administration to indicate whether any budget had been allocated to address the irrigation ditch in question. Furthermore, the amparo petitioner was informed that wastewater did not fall within the municipality’s jurisdiction because it was a matter for the Ministerio de Salud. He reports that on January 11, 2016, the Concejo Municipal de Santa Bárbara received a letter signed by several residents, who stated that, for reasons unknown to them, the flow of water coming from the mountain—which was used to irrigate crops and also to drain rainwater—had been blocked several years earlier.He indicates that on October 5, 2016, the Office of the Mayor attempted to bring the parties together to discuss the matter and hear their positions, but one group refused to engage in dialogue. He states that official letter N° OAMSB-584-16 informed them that the Administration wished to listen to them, engage in dialogue, and reach decisions concerning Barrio La Unión. He therefore considers it important to arrange a new meeting to hear them and analyze the position of each party so that unilateral decisions will not have to be made, an extreme outcome that it wishes to avoid. He requests that the Chamber deny the petition.
  5. 5The statutory requirements have been observed in the proceedings conducted.

Considerations:

I.Subject matter of the petition. The petitioner considers that his fundamental rights have been violated because the irrigation ditches in his community cause pollution, as residents discharge stormwater, wastewater, and sewage into the irrigation ditch. Despite the foregoing, the respondent authorities have not remedied the problem.

II.Proven facts (hechos probados) relating to the Ministerio de Salud. The following facts are deemed duly established and relevant to the resolution of this matter, either because they have been proven or because the respondent failed to address them as required in the initial order: a) on 6 de enero de 2016, the respondent Área Rectora received 7 complaints from the petitioner concerning problems involving sewage, wastewater, and stormwater, as well as foul odors (see the report submitted under oath by the respondent authority and the evidence provided); b) with respect to complaint N° 3-2016, negative dye tests were conducted on 15 de enero de 2016, and resolution N° CN-ARS-SB-345-2016 of 5 de abril de 2016 was issued (see the report submitted under oath by the respondent authority and the evidence provided); c) with respect to complaint N° 4-2016, 3 attempts were made to conduct a site visit; in addition, a positive dye test was conducted on 1° de febrero de 2016, health order (orden sanitaria) N° 11-2016 was issued, and compliance with the health order was verified on 24 de agosto de 2016 (see the report submitted under oath by the respondent authority and the evidence provided); d) with respect to complaint N° 5-2016, 3 attempts were made to conduct a site visit, a positive dye test was conducted on 1° de febrero de 2016, and health order N° 12-2016 was issued (see the report submitted under oath by the respondent authority and the evidence provided); e) with respect to complaint N° 6-2016, 2 attempts were made to conduct a site visit; in addition, a positive dye test was conducted on 27 de enero de 2016, as a result of which health order N° 10-2016 was issued; compliance with the health order was subsequently verified on 14 de setiembre de 2016 (see the report submitted under oath by the respondent authority and the evidence provided); f) with respect to complaint N° 7-2016, a negative dye test was conducted on 21 de setiembre de 2016 (see the report submitted under oath by the respondent authority and the evidence provided); g) with respect to complaint N° 8-2016, a positive dye test was conducted on 11 de enero de 2016; in addition, health order N° 09-2016 was issued and served on 23 de setiembre de 2016, and compliance with that order was therefore verified on 3 de enero de 2017; noncompliance with the health order was detected, and the case was consequently referred to the Prosecutor’s Office for Disobedience to Authority (see the report submitted under oath by the respondent authority and the evidence provided); h) with respect to complaint N° 9-2016, dye tests yielding negative results were conducted on 13 de enero de 2016 (see the report submitted under oath by the respondent authority and the evidence provided); i) on 3 de enero de 2017, the petitioner was provided with a summary of the actions taken by that agency (see the report submitted under oath by the respondent authority and the evidence provided).

III.Proven facts relating to the Municipalidad de Santa Bárbara de Heredia. The following facts are deemed duly established and relevant to the resolution of this matter, either because they have been proven or because the respondent failed to address them as required in the initial order: a) at ordinary session N° 23-2016 of 4 de octubre de 2016, the Concejo Municipal de Santa Bárbara resolved to ask the Mayor’s Office to indicate whether funding had been allocated to undertake work on the irrigation ditch in question (see the report submitted under oath by the respondent authority and the evidence provided); b) on 12 de enero de 2017, according to inspection report N° CN-ARS-SB-LHC-20-2017, a joint site visit was conducted with the Director de la Unidad Técnica de Gestión Vial del municipio and the respondent Área Rectora (see the report submitted under oath by the respondent authority and the evidence provided); c) as a result of that visit, report N° UTGVM-018-2017 of 23 de enero de 2017 was issued, concluding that the existing conditions had been reviewed and that a cut into the natural ground had been identified; the cut had been made to level the land for construction of the adjoining house, thereby affecting the depth of the irrigation ditch and, consequently, its capacity to receive a greater flow during the rainy season (see the report submitted under oath by the respondent authority and the evidence provided); d) through official letter N° OAMSB-584-16, the respondent municipality informed the residents of the disputed area that it wished to engage in dialogue and reach decisions concerning Barrio La Unión, for which purpose a new meeting was necessary (see the report submitted under oath by the respondent authority and the evidence provided).

IV.The specific case. In the matter under review (sub examine), the petitioner claims that his fundamental rights have been infringed because the irrigation ditches in his community cause pollution, as residents discharge stormwater, wastewater, and sewage into the irrigation ditch. Despite the foregoing, the respondents have not remedied the problem. With respect to the Ministerio de Salud, however, the Chamber finds that the petitioner’s claim is unfounded. As is readily apparent from the established facts, the respondent Área Rectora de Salud promptly addressed the 7 complaints filed by the protected party. It issued health orders in the cases that warranted them. It also monitored compliance with each of those orders and, in one case in which the person refused to comply with the order, the corresponding complaint was even filed with the Ministerio Público for the offense of Disobedience to Authority. Therefore, in this Court’s view, the Ministerio de Salud has fulfilled its responsibilities and, in that regard, has taken steps to safeguard the protected party’s rights to health and to a healthy environment. The petitioner should note that he was recently informed of all the actions taken by that Área Rectora to address the reported problem. Accordingly, the writ of amparo (recurso de amparo) against that authority is denied.

V.With respect to the Municipalidad de Santa Bárbara, however, the Chamber finds that the writ of amparo should be granted. As is apparent from the established facts, it was not until 12 de enero de 2017 that a joint site visit was conducted with the Director de la Unidad Técnica de Gestión Vial del municipio and the respondent Área Rectora. As a result of that visit, report N° UTGVM-018-2017 of 23 de enero de 2017 was issued, concluding that the existing conditions had been reviewed and that a cut into the natural ground had been identified; the cut had been made to level the land for construction of the adjoining house, thereby affecting the depth of the irrigation ditch and, consequently, its capacity to receive a greater flow during the rainy season. In other words, the existence of a problem affecting the proper drainage of water in that portion of the irrigation ditch was indeed established.

Moreover, at ordinary session N° 23-2016 of 4 de octubre de 2016, the Concejo Municipal de Santa Bárbara resolved to ask the Mayor’s Office to indicate whether funding had been allocated to undertake work on the irrigation ditch in question. Thus, the situation has been known since that date and has not been adequately addressed. In addition, the respondent municipality informed the residents of the disputed area that it wished to engage in dialogue and reach decisions concerning Barrio La Unión, for which purpose a new meeting was necessary. Under these circumstances, the Chamber finds that the matter remains unresolved despite the time that has already elapsed. This constitutes a clear infringement of the protected party’s fundamental rights, as well as a violation of Article 169 of the Constitution. The writ is therefore granted solely against the respondent municipality.

VI.Separate note by Justice Jinesta Lobo. The undersigned Justice clarifies that, although I refer environmental matters involving administrative action of any kind to the contentious-administrative jurisdiction (jurisdicción contencioso administrativa), I will not do so where the complaints concern the improper management of stormwater, wastewater, and sewage that, in turn, affects a residential area or a place where homes are located. This is because other rights of residents near the source of pollution are at stake, including the rights to health and to enjoy a decent quality of life.

VII.Separate note by Justice Hernández López. As a general rule, I maintain that claims concerning failures to address infrastructure matters can and should be handled by the competent administrative and oversight bodies, as well as by the ordinary courts. However, I have also stated the exception that endangerment of rights such as physical integrity or health warrants the intervention of this Court. That is the situation in this specific case, as demonstrated by the established facts, which support the conclusion that there is an imminent danger to human health and that the appropriateness of the manner in which the competent authorities have addressed the problem is in dispute. For these reasons, I concur in the majority decision.

VIII.Separate note by Justice Salazar Alvarado. Based on the same considerations drafted by Justice Jinesta Lobo in similar matters, which I have joined, concerning environmental issues, I make the following observations: The undersigned clarifies that, although I refer environmental matters involving administrative action of any kind to the contentious-administrative jurisdiction, I will not do so where the complaints concern pollution, as in this case, in which the discharge of stormwater, wastewater, and sewage into an irrigation ditch is alleged, affecting people’s property and possessions, because other rights are at stake, including the rights to health and to enjoy a decent quality of life, particularly where, as in the matter at hand (sub lite), the area is populated and residents may be affected by the circumstances described.

IX.Documentation submitted to the case file. The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, they must retrieve such materials from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, article LXXXI.

Por tanto:

The amparo action is partially granted, solely against the respondent Municipality. Héctor Luis Arias Vargas, in his capacity as Mayor of Santa Bárbara, or whoever holds that office in his stead, is ordered to issue the pertinent directives and carry out all actions within the scope of his authority so that, within 6 MONTHS from notification of this judgment, the problem concerning the management of the waters in the irrigation ditch (acequia) reported by the petitioner in this matter is definitively resolved. The foregoing is ordered with the warning that, pursuant to Article 71 of the Constitutional Jurisdiction Law (Ley de la Jurisdicción Constitucional), anyone who receives an order issued in an amparo action that must be complied with or enforced and who fails to comply with or enforce it shall be sentenced to imprisonment for three months to two years or fined twenty to sixty days, provided that the offense is not subject to a more severe penalty.

The Municipalidad de Santa Bárbara is ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment in the contentious-administrative jurisdiction (contencioso administrativo). In all other respects, the action is denied. This decision shall be personally served on Héctor Luis Arias Vargas, in his capacity as Mayor of Santa Bárbara, or whoever holds that office in his stead. Justice Jinesta Lobo files a separate note. Recurso de amparo interpuesto por Oscar Isidro Ceciliano Mora, cédula de identidad número 6-088-944; contra el Ministerio de Salud y la Municipalidad de Santa Bárbara de Heredia.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 09:46 horas del 17 de enero de 2017, el recurrente interpuso recurso de amparo contra el Ministerio de Salud y la Municipalidad de Santa Bárbara de Heredia. Señala que en Santa Bárbara de Heredia, tradicionalmente, se realizaron labores afines con la agricultura. Refiere que, en ese sentido, se habilitaron acequias cuya finalidad era el riego, por lo que distribuían el agua por el cantón. Indica que una vez que se cambió el uso de suelo y conforme se fue desarrollando el cantón, las acequias se mantuvieron habilitadas, pese a que ya no cumplían la función para la cual fueron creadas. Manifiesta que la municipalidad recurrida otorgó permisos de construcción sin exigir a los administrados la instalación de tanques sépticos y drenajes, lo mismo que la correcta canalización de las aguas pluviales. Señala que dicha situación fomentó que los vecinos descarguen las aguas pluviales y las aguas residuales y negras a la acequia.Menciona que en 1980 se vieron obligados a colocar 30 tubos de segunda, en parte de la propiedad en la cual tiene construida su casa, con la finalidad que el agua que conducía esa acequia no lavara o barriera el cafetal y el resto de los cafetales de los vecinos; no obstante, como los permisos de construcción han aumentado, la cantidad de agua que soporta o transporta esa parte del alcantarillado no da abasto, por lo que dicha alcantarilla está colapsada y amenaza derrumbar la tapia de su casa. Acusa que ante la gravedad de los problemas que le aquejan, inició gestiones con el objetivo que las autoridades recurridas investigaran quiénes son las personas responsables y cuáles son las casas de donde provienen las aguas que provocan malos olores y permiten la cría de zancudos que atenta contra la salud pública. Indica que se ha gestionado ante la municipalidad recurrida el correspondiente trazado de los 197 metros de alcantarillado y la eliminación del problema generado, específicamente, en invierno al saturarse y desbordarse la alcantarilla a la altura de su casa, como sucedió en setiembre de 2016; sin embargo, por más gestiones realizadas, los problemas persisten, pese a las visitas e informes, en los cuales se ha manifestado la necesidad y urgencia de tomar medidas. Solicita a la Sala que declare con lugar el recurso, con las consecuencias legales que ello implique.
  2. 2Mediante resolución de Presidencia de las 16:50 horas del 17 de enero de 2017, se dio curso al proceso.
  3. 3Por escrito recibido en la Secretaría de la Sala a las 10:52 horas del 25 de enero de 2017, informa bajo juramento María Antonieta Acuña Hernández, en su condición de Directora del Área Rectora de Salud de Santa Bárbara de Heredia del Ministerio de Salud, que el problema sanitario y ambiental no ha sido ocasionado por las autoridades de salud del Área Rectora de Salud; al contrario, el problema deviene de unos vecinos de la comunidad con el cambio de uso de suelo que se diera anterior a la presentación del amparo. Refiere que lo denunciado es de competencia de la Municipalidad de Santa Bárbara. Indica que, en todo caso, ese ministerio ha emitido una serie de actos administrativos en atención a lo denunciado. Señala que el 6 de enero de 2016 ingresó a esa Área Rectora 7 denuncias del recurrente contra una serie de vecinos, aledaños a su propiedad, por problemas de aguas negras, residuales y pluviales, así como malos olores.Afirma que para la denuncia N° 3-2016 se realizaron pruebas de coloración negativa el 15 de enero de 2016, y se emitió la resolución N° CN-ARS-SB-345-2016 del 5 de abril de 2016. Sostiene que para la denuncia N° 4-2016, se realizaron 3 intentos de visita; además, se efectuó una prueba de coloración positiva el 1° de febrero de 2016, se dictó la orden sanitaria N° 11-2016 y la verificación de cumplimiento de la orden sanitaria se dio el 24 de agosto de 2016. Explica que para la denuncia N° 5-2016, se realizaron 3 intentos de visita, se efectuó prueba de coloración positiva el 1° de febrero de 2016, dictándose la orden sanitaria N° 12-2016. Alega que en la denuncia N° 6-2016 se realizaron 2 intentos de visita, además se efectuó prueba de coloración positiva el 27 de enero de 2016, por lo que se emitió la orden sanitaria N° 10-2016, posteriormente se hizo la verificación de cumplimiento de la orden sanitaria el 14 de setiembre de 2016.Menciona que en cuanto a la denuncia N° 7-2016, se realizó prueba de coloración negativa el 21 de setiembre de 2016. Expresa que para la denuncia N° 8-2016, se realizó prueba de coloración positiva el 11 de enero de 2016; además, se dictó orden sanitaria N° 09-2016, notificada el 23 de setiembre de 2016, de modo que la verificación de cumplimiento de dicha orden se efectuó el 3 de enero de 2017, detectándose incumplimiento de orden sanitaria, por lo que se pasó el caso a la Fiscalía por Desobediencia a la Autoridad, cuyo caso está abierto y pendiente de resolución. Aclara que en relación con la denuncia N° 9-2016, se realizaron pruebas de coloración con resultado negativo el 13 de enero de 2016. Añade que en ninguno de los casos se logró evidenciar un problema de aguas negras ni olores. Manifiesta que todavía se encuentra en seguimiento la denuncia N° 8-2016, pues la parte denunciada carece de fuentes económicas de ingreso para el cumplimiento de la orden sanitaria, pero se encuentra anuente a realizar las reparaciones que se han ordenado, por lo que el caso se encuentra abierto y en seguimiento.Refiere que el 3 de enero de 2017 se le realizó un resumen al recurrente de las acciones ejecutadas por esa dependencia. Indica que el 3 de enero de 2017, esa Dirección de Área le solicitó al Alcalde de Santa Bárbara que efectuara una visita conjunta en un plazo no mayor a 8 días. Señala que el 12 de enero de 2017, según acta de inspección N° CN-ARS-SB-LHC-20-2017, se realizó visita conjunta con el Director de la Unidad Técnica de Gestión Vial del municipio. Afirma que como resultado de dicha visita se emitió el informe N° UTGVM-018-2017 del 23 de enero de 2017, en donde se concluyó que se revisó la situación actual del propietario con plano catastrado N° H461374-82, y en el sitio indicado no se observó afectación puntual a la vía pública; sin embargo, se denotó que existe un corte del terreno natural, el mismo se realizó para nivelar con la construcción de la casa, viéndose afectada la profundidad de la acequia y, por ende, la capacidad de esta para recibir mayor caudal en épocas de invierno.Sostiene que el dueño del plano catastral tiene la obligación de recibir las aguas que naturalmente fluyen en periodos de invierno. Explica que para esta época del año se observa que el caudal del mismo es insuficiente para afectar con inundaciones. Alega que la limpieza y mantenimiento le corresponde al dueño, ya que este cambió el cauce natural al entubarlo. Solicita a la Sala que declare sin lugar el recurso en su contra.
  4. 4Por escrito incorporado al expediente digital a las 14:19 horas del 25 de enero de 2017, informa bajo juramento Héctor Luis Arias Vargas, en su calidad de Alcalde de Santa Bárbara, que de conformidad con lo indicado por la Unidad Técnica de Gestión Vial de esa municipalidad, se revisó la situación actual del propietario con plano catastrado N° H461374-82, y en el sitio indicado no se observó afectación puntual a la vía pública; sin embargo, se denotó que existe un corte del terreno natural, el mismo se realizó para nivelar con la construcción de la casa, viéndose afectada la profundidad de la acequia y, por ende, la capacidad de esta para recibir mayor caudal en épocas de invierno. Sostiene que el dueño del plano catastral tiene la obligación de recibir las aguas que naturalmente fluyen en periodos de invierno. Explica que para esta época del año se observa que el caudal del mismo es insuficiente para afectar con inundaciones.Alega que la limpieza y mantenimiento le corresponde al dueño, ya que este cambió el cauce natural al entubarlo. Aduce que el tema de las aguas servidas y negras es competencia del Ministerio de Salud. Manifiesta que el Concejo Municipal de Santa Bárbara, en la sesión ordinaria N° 23-2016 del 4 de octubre de 2016, acordó solicitar a la Administración se sirviera indicar si existe presupuesto destinado para intervenir la acequia en cuestión; además, se le indicó al amparado que las aguas residuales no era competencia de la municipalidad, dado que le corresponde al Ministerio de Salud. Refiere que el 11 de enero de 2016, el Concejo Municipal de Santa Bárbara recibió nota suscrita por varios vecinos, quienes indicaron que por motivos que ignoran, hace unos años fue cerrado el paso de agua que venía de la montaña y que servía para regar sembradíos y que también servía para el desfogue de aguas llovidas.Indica que esa Alcaldía intentó el 5 de octubre de 2016 acercar a las partes para conversar y conocer los puntos, pero un grupo se opuso al diálogo. Señala que mediante oficio N° OAMSB-584-16 se les indicó que la administración lo que quiere es escucharlos, dialogar y llegar a tomar decisiones para el Barrio La Unión, por lo cual considera importante coordinar una nueva reunión para poder escucharlos y analizar cada una de las partes, con el fin de no tomar decisiones unilaterales, caso extremo al que no se desea llegar. Solicita a la Sala que declare sin lugar el recurso.
  5. 5En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Rueda Leal; y,

Considerando:

I.Objeto del recurso. El recurrente estima lesionados sus derechos fundamentales, pues las acequias que hay en su comunidad provocan contaminación ya que los vecinos descargan las aguas pluviales, residuales y negras en la acequia. Pese a lo anterior, los recurridos no han remediado el problema.

II.Hechos probados en relación con el Ministerio de Salud. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial: a) el 6 de enero de 2016 ingresó al Área Rectora recurrida 7 denuncias por parte del recurrente por problemas de aguas negras, residuales y pluviales, así como malos olores (ver informe rendido bajo juramento por la autoridad recurrida y prueba aportada); b) para la denuncia N° 3-2016 se realizaron pruebas de coloración negativa el 15 de enero de 2016, y se emitió la resolución N° CN-ARS-SB-345-2016 del 5 de abril de 2016 (ver informe rendido bajo juramento por la autoridad recurrida y prueba aportada); c) para la denuncia N° 4-2016, se realizaron 3 intentos de visita; además, se efectuó una prueba de coloración positiva el 1° de febrero de 2016, se dictó la orden sanitaria N° 11-2016 y la verificación de cumplimiento de la orden sanitaria se dio el 24 de agosto de 2016 (ver informe rendido bajo juramento por la autoridad recurrida y prueba aportada); d) para la denuncia N° 5-2016, se realizaron 3 intentos de visita, se efectuó prueba de coloración positiva el 1° de febrero de 2016, dictándose la orden sanitaria N° 12-2016 (ver informe rendido bajo juramento por la autoridad recurrida y prueba aportada); e) en la denuncia N° 6-2016 se realizaron 2 intentos de visita, además se efectuó prueba de coloración positiva el 27 de enero de 2016, por lo que se emitió la orden sanitaria N° 10-2016, posteriormente se hizo la verificación de cumplimiento de la orden sanitaria el 14 de setiembre de 2016 (ver informe rendido bajo juramento por la autoridad recurrida y prueba aportada); f) en cuanto a la denuncia N° 7-2016, se realizó prueba de coloración negativa el 21 de setiembre de 2016 (ver informe rendido bajo juramento por la autoridad recurrida y prueba aportada); g) para la denuncia N° 8-2016, se realizó prueba de coloración positiva el 11 de enero de 2016; además, se dictó orden sanitaria N° 09-2016, notificada el 23 de setiembre de 2016, de modo que la verificación de cumplimiento de dicha orden se efectuó el 3 de enero de 2017, detectándose incumplimiento de orden sanitaria, por lo que se pasó el caso a la Fiscalía por Desobediencia a la Autoridad (ver informe rendido bajo juramento por la autoridad recurrida y prueba aportada); h) en relación con la denuncia N° 9-2016, se realizaron pruebas de coloración con resultado negativo el 13 de enero de 2016 (ver informe rendido bajo juramento por la autoridad recurrida y prueba aportada); i) el 3 de enero de 2017 se le realizó un resumen al recurrente de las acciones ejecutadas por esa dependencia (ver informe rendido bajo juramento por la autoridad recurrida y prueba aportada).

III.Hechos probados en relación con la Municipalidad de Santa Bárbara de Heredia. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial: a) el Concejo Municipal de Santa Bárbara, en la sesión ordinaria N° 23-2016 del 4 de octubre de 2016, acordó solicitar a la Alcaldía se sirviera indicar si existe presupuesto destinado para intervenir la acequia en cuestión (ver informe rendido bajo juramento por la autoridad recurrida y prueba aportada); b) el 12 de enero de 2017, según acta de inspección N° CN-ARS-SB-LHC-20-2017, se realizó visita conjunta con el Director de la Unidad Técnica de Gestión Vial del municipio y el Área Rectora recurrida (ver informe rendido bajo juramento por la autoridad recurrida y prueba aportada); c) como resultado de dicha visita se emitió el informe N° UTGVM-018-2017 del 23 de enero de 2017, en donde se concluyó que se revisó la situación actual, se denotó que existe un corte del terreno natural, el mismo se realizó para nivelar con la construcción de la casa colindante, viéndose afectada la profundidad de la acequia y, por ende, la capacidad de esta para recibir mayor caudal en épocas de invierno (ver informe rendido bajo juramento por la autoridad recurrida y prueba aportada); d) mediante oficio N° OAMSB-584-16, la municipalidad accionada les indicó a los vecinos de la zona en conflicto que se quiere dialogar y llegar a tomar decisiones para el Barrio La Unión, por lo cual es necesaria una nueva reunión (ver informe rendido bajo juramento por la autoridad recurrida y prueba aportada).

IV.Sobre el caso concreto. En el sub examine, el recurrente estima lesionados sus derechos fundamentales, pues las acequias que hay en su comunidad provocan contaminación ya que los vecinos descargan las aguas pluviales, residuales y negras en la acequia. Pese a lo anterior, los recurridos no han remediado el problema. Ahora bien, en relación con el Ministerio de Salud, la Sala estima que no lleva razón el recurrente. Como bien puede apreciarse del elenco de hechos probados, el Área Rectora de Salud recurrida ha atendido oportunamente las 7 denuncias presentadas por el amparado. Ha girado las órdenes sanitarias en los casos que así ha ameritado. Además, le ha dado seguimiento al cumplimiento de cada una de esas órdenes e, incluso, en uno de los casos en que la persona no quiso cumplir con la orden, se denunció lo correspondiente ante el Ministerio Público por el delito de Desobediencia a la Autoridad. Ergo, en consideración de este Tribunal, el Ministerio de Salud sí ha cumplido con sus competencias y, en ese sentido, se ha preocupado por resguardar el derecho a la salud y al ambiente en beneficio del tutelado. Advierta el promovente que, recientemente, se le informó de todas las acciones que ha realizado esa Área Rectora para atender la problemática denunciada. Por ello, se desestima el amparo contra dicha autoridad.

V.Por su parte, en cuanto a la Municipalidad de Santa Bárbara, la Sala considera que sí debe acogerse el recurso de amparo. Como puede constatarse del elenco de hechos probados, apenas el 12 de enero de 2017 se realizó visita conjunta con el Director de la Unidad Técnica de Gestión Vial del municipio y el Área Rectora recurrida. Como resultado de dicha visita se emitió el informe N° UTGVM-018-2017 del 23 de enero de 2017, en donde se concluyó que se revisó la situación actual, se denotó que existe un corte del terreno natural, el mismo se realizó para nivelar con la construcción de la casa colindante, viéndose afectada la profundidad de la acequia y, por ende, la capacidad de esta para recibir mayor caudal en épocas de invierno. Es decir, sí se evidenció la existencia de un problema que afecta la adecuada disposición de las aguas en esa parte de la acequia. Incluso, el Concejo Municipal de Santa Bárbara, en la sesión ordinaria N° 23-2016 del 4 de octubre de 2016, acordó solicitar a la Alcaldía se sirviera indicar si existe presupuesto destinado para intervenir la acequia en cuestión.

De modo que, desde esa fecha se tiene conocimiento de la situación y no se ha atendido adecuadamente. Aunado a lo anterior, la municipalidad accionada les indicó a los vecinos de la zona en conflicto que se quiere dialogar y llegar a tomar decisiones para el Barrio La Unión, por lo cual es necesaria una nueva reunión. Así las cosas, la Sala aprecia que la situación está pendiente de resolución, pese al tiempo que ya ha transcurrido. Lo anterior implica una evidente lesión a los derechos fundamentales del amparado, así como una vulneración al ordinal 169 constitucional. De modo tal que se acoge el recurso solo contra la municipalidad accionada.

VI.Nota del Magistrado Jinesta Lobo. El suscrito Magistrado aclaro que si bien los asuntos ambientales, cuando hay intervención administrativa de cualquier índole, los remito a la jurisdicción contencioso administrativa, lo cierto es que tratándose de denuncias por el mal manejo de aguas pluviales, residuales y negras, que afecta, a su vez, un área residencial o lugar donde existen casas de habitación, no lo haré así. Esto, por cuanto, se encuentran en juego otros derechos de los vecinos de la fuente contaminante, tales como la salud y a gozar de un nivel digno de calidad de vida.

VII.Nota separada de la Magistrada Hernández López. Como línea general sostengo que los reclamos por omisiones en relación con temas de infraestructura pueden y deben ser atendidos por los órganos administrativos competentes y de control así como por la jurisdicción ordinaria.- Pero también he dejado hecha la salvedad de que la puesta en peligro de derechos como la integridad física o la salud ameritan la intervención de este Tribunal.- Ello sucede en este caso concreto, tal y como se demuestra del elenco de hechos demostrados que permiten concluir que existe un peligro inminente para la salud de las personas y se discute la propiedad con la cual las autoridades competentes han abordado el problema.- Por estas razones es que concurro con el voto de mayoría.

VIII.Nota del Magistrado Salazar Alvarado. Con base en las mismas consideraciones que en asuntos similares ha redactado el Magistrado Jinesta Lobo, y que he suscrito con él, en relación con temas ambientales, hago las siguientes observaciones: El suscrito aclara que si bien los asuntos ambientales, cuando hay intervención administrativa de cualquier índole, los remito a la jurisdicción contencioso administrativa, es lo cierto que tratándose de denuncias por contaminación, como en este caso, que se denuncia la descarga de aguas pluviales, residuales y negras en una acequia, lo que afecta la propiedad y bienes de las personas, no lo haré así, por cuanto, están en juego otros derechos, tales como la salud y gozar de un nivel digno de calidad de vida, máxime si, como en el sub lite, se trata de una zona poblada, en la cual, los vecinos se pueden ver afectados por las circunstancias indicadas.

IX.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara parcialmente con lugar el recurso, solo contra la municipalidad recurrida. Se ordena a Héctor Luis Arias Vargas, en su calidad de Alcalde de Santa Bárbara, o a quien en su lugar ocupe ese cargo, que gire las órdenes pertinentes y lleve a cabo todas las actuaciones que estén dentro del ámbito de sus competencias, para que dentro del plazo de 6 MESES contado a partir de la notificación de esta sentencia, se resuelva de manera definitiva el problema con el manejo de las aguas en la acequia denunciada por el recurrente en este asunto. Lo anterior se dicta con la advertencia de que según lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena a la Municipalidad de Santa Bárbara al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. Notifíquese esta resolución a Héctor Luis Arias Vargas, en su calidad de Alcalde de Santa Bárbara, o a quien en su lugar ocupe ese cargo, en forma personal.
