Amparo proceeding (recurso de amparo) processed under case No. 16-016779-0007-CO, filed by JOSÉ RAFAEL RODRÍGUEZ CASTRO, identity card No. 0115960507, JUAN CARLOS BADILLA FERNÁNDEZ, identity card No. 0116100910, KATHERINE ZÚÑIGA JUÁREZ, identity card No. 0604290758, and MARÍA LAURA SOLANO LÓPEZ, identity card No. 0116560035, against the MUNICIPALIDAD DE PUNTARENAS, the MINISTERIO DE SALUD, and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AyA).
Findings:
Justice Rueda Leal drafts the opinion; and,
Whereas:
I.Subject matter of the proceeding. The petitioners allege that in Barrio El Carmen de Puntarenas there are two potable-water storage tanks belonging to AyA that have had major leaks for more than 7 years. They consider that the wastage of this vital resource threatens the human right of access to potable water, particularly in view of the scarcity of water resources experienced in the area, which has even necessitated the use of tanker trucks. They allege that the rights to health and to a healthy and ecologically balanced environment are also being violated because pools of stagnant water have formed, producing foul odors and breeding grounds for disease-transmitting mosquitoes. They allege that the Administration has failed to act to resolve this problem.
II.Proven facts (hechos probados). The following facts are deemed duly established and relevant to the disposition of this matter, either because they have been substantiated or because the respondent failed to address them as required by the initial order:
<![if !supportLists]>a. <![endif]>The Los Caites tanks are owned by AyA, were built in the late 1960s, form part of the potable-water supply system for the canton of Puntarenas, and make it possible to supply the population during the system’s peak-demand hours (see report submitted and evidence provided); <![if !supportLists]>b. <![endif]>The Los Caites tanks leak at a rate of 3.5 to 4 liters per second (see evidence provided); <![if !supportLists]>c. <![endif]>In 2011, AyA opened abbreviated tendering procedure (licitación abreviada) 2011LA-74-PRI to waterproof the Los Caites tanks; however, the successful bidder failed to fulfill the purpose of the contract because the water leaks persisted (see evidence provided and reports submitted); <![if !supportLists]>d. <![endif]>In 2014, the Ministry of Health issued instructions to AyA to remedy the leaks in the Los Caites tanks (see report submitted and evidence provided); <![if !supportLists]>e. <![endif]>In marzo de 2015, the Puntarenas Health Governing Area issued sanitary order Nº68-Reg-2015, requiring AyA to submit “a corrective-action plan in order to resolve the problem of leaks in the potable-water Storage (sic.) tanks located in Barrio El Carmen”; however, AyA did not submit any plan (see report submitted and evidence provided); <![if !supportLists]>f. <![endif]> On 19 de setiembre de 2016, the petitioners reported to the Ministry of Health, the Municipalidad de Puntarenas, and AyA de Puntarenas the potable-water leak originating from the Los Caites tanks (see evidence provided); <![if !supportLists]>g. <![endif]>By a written submission dated 23 de setiembre de 2016, the Mayor of the Municipalidad de Puntarenas forwarded the petitioners’ complaint to the AyA Regional Director in Puntarenas (see evidence provided); <![if !supportLists]>h. <![endif]>In connection with the complaint (denuncia) filed by the petitioners (accionantes) in setiembre de 2016, on 5 de octubre the Área Rectora de Salud de Puntarenas conducted an on-site inspection (inspección in situ) of the Los Caites tanks, which yielded the following findings: “the tanks have considerable water leaks, and the soils are saturated (…) Although there is an overflow system (sistema de desfogue) leading to the sewer system, it does not have the capacity to channel the volume of water generated by the tanks.
According to the AyA official, during a recent flow measurement (aforo), an average flow rate of 4 L/s was calculated. It is also evident that the curb and gutter (cordón y caño) in the areas surrounding the tanks’ protective walls are saturated or overwhelmed, and this, combined with the lack of maintenance, causes water to stagnate. No Aedes aegypti larvae were observed in the areas of standing water due to factors such as direct sunlight and biological control (…) this situation has remained unresolved for years” (see evidence submitted); <![if !supportLists]>i. <![endif]>AyA, in coordination with the Municipalidad de Puntarenas, has been carrying out cleanup work in the area affected by water spilling from the Los Caites tanks. They have also undertaken works to channel the water from the leaks. The most recent work was performed on 5 de diciembre de 2016 (see evidence submitted and report filed); <![if !supportLists]>j. <![endif]>On 21 de diciembre de 2016, the Área Rectora de Salud de Puntarenas conducted an on-site inspection of the Los Caites tanks, which yielded the following findings: “under clear-sky weather conditions, with no rain having fallen in the community for at least four days, it can be observed that the aforementioned tanks are spilling the potable water stored in them (…) this causes the soils immediately surrounding the tanks, where there is grass, stone, and concrete, to become saturated.
It is evident that the existing system for channeling and discharging the water spilling from the tanks in question does not collect all of the water (…) this spilled water flows beyond the wall (…) the wall and sidewalk on the northern side (…) have moss that could pose a fall hazard to pedestrians; water accumulates in the holes in the northern sidewalk (…) without all of this water reaching the sewer inlet grate (…) less accumulated water is observed than during previous inspections (…) there are worm-like larvae and other types of insects that were not identified at the time, but they have been ruled out as Aedes aegypti larvae (…) it is evident that the underlying problem of potable-water spillage persists and that a certain amount of water will continue to accumulate in the northern curb and gutter until the leaks are completely sealed; additionally, the current structural condition of the tanks in question is unknown, making it impossible to determine whether there is any risk to maintenance personnel or the general public traveling through the surrounding area” (see evidence submitted);
“This Court has recognized, as part of Constitutional Law (Derecho de la Constitución), the fundamental right to potable water, derived from the rights to health, life, a healthy environment, food, and adequate housing, among others. International human-rights instruments applicable in Costa Rica have taken the same position; thus, this right is expressly included in the Convention on the Elimination of All Forms of Discrimination against Women (Article 14) and the Convention on the Rights of the Child (Article 24); it is also stated in the International Conference on Population and Development held in El Cairo (Principle 2). Within the Inter-American Human Rights System, Costa Rica is particularly bound in this matter by Article 11.1 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights (the 1988 “Protocolo de San Salvador”), which provides, as relevant here: “Article 11.
Right to a healthy environment. 1. Everyone shall have the right to live in a healthy environment and to have access to basic public services.” Moreover, within the Universal System for the Protection of Human Rights, the United Nations Committee on Economic, Social and Cultural Rights reiterated that access to water is a human right that, in addition to being indispensable for leading a healthy life, is a prerequisite for the realization of all other human rights. On the basis of these rules, it is clear that the Costa Rican State is required to ensure the efficient and timely provision of potable-water service. The Political Constitution itself implicitly enshrines the fundamental right of persons subject to the Administration (administrados) to the proper and efficient operation of public services, meaning that such services must be provided according to high quality standards.” (judgment Nº 2000-04595 at 09:06 on 2 de junio del 2000; to the same effect, see, among many others, judgments Nº 2014-14669, Nº 2015-6424, and Nº 2015-7340).
IV.Regarding the specific case. The petitioners allege that Barrio El Carmen de Puntarenas has two potable-water storage tanks belonging to AyA that have had major leaks for more than 7 years. They contend that the waste of this vital resource threatens the human right of access to potable water, especially considering the shortage of water resources in the area, which has even necessitated the use of tanker trucks. They further allege that this infringes the rights to health and to a healthy and ecologically balanced environment because pools of standing water have formed, producing foul odors and breeding grounds for disease-carrying mosquitoes. They accuse the Administration of failing to act to resolve this problem.
A review of the record establishes that the Los Caites tanks belong to AyA, were built in the late 1960s, form part of Puntarenas’s potable-water supply system, and make it possible to supply the population during peak-demand hours; however, these structures have leaks of 3.5 to 4 liters per second. It is established that this loss of water resources dates back to 2011, when AyA initiated abbreviated bidding procedure (licitación abreviada) 2011LA-74-PRI to waterproof the Los Caites tanks. However, the respondent authority (autoridad recurrida) itself acknowledges that the successful bidder failed to fulfill the purpose of the contract because the water leaks persisted. It has also been demonstrated that, in 2014, the Ministerio de Salud instructed AyA to resolve the problem. Subsequently, in marzo de 2015, the Área Rectora de Salud de Puntarenas issued health order (orden sanitaria) Nº68-Reg-2015, ordering AyA to submit “a corrective action plan to resolve the problem of leaks in the potable-water Storage (sic.) tanks located in Barrio El Carmen”; however, the institute did not submit any plan.
Consequently, on 19 de setiembre de 2016, the petitioners herein reported to the Ministerio de Salud, the Municipalidad de Puntarenas, and AyA de Puntarenas the waste of potable water from the Los Caites tanks. Accordingly, in a written communication dated 23 de setiembre de 2016, the Mayor of the Municipalidad de Puntarenas forwarded the petitioners’ complaint to the Regional Director of AyA in Puntarenas. For its part, the Área Rectora de Salud de Puntarenas conducted an on-site inspection on 5 de octubre de 2016, which found that “the tanks have considerable water leaks, and the soils are saturated (…) Although there is an overflow system leading to the sewer system, it does not have the capacity to channel the volume of water generated by the tanks. According to the AyA official, during a recent flow measurement, an average flow rate of 4 L/s was calculated. It is also evident that the curb and gutter in the areas surrounding the tanks’ protective walls are saturated or overwhelmed, and this, combined with the lack of maintenance, causes water to stagnate.
No Aedes aegypti larvae were observed in the areas of standing water due to factors such as direct sunlight and biological control (…) this situation has remained unresolved for years.” The AyA authorities acknowledge the ongoing loss of potable water from the Los Caites tanks and report that, in coordination with the Municipalidad de Puntarenas, they conducted cleanup work in noviembre and diciembre de 2016 in the area affected by the spilled water and channeled the water from the leaks (the most recent works were performed on 5 de diciembre de 2016). Nevertheless, this Court finds that, despite the work performed, the problem persists, since the on-site inspection conducted on 21 de diciembre de 2016 by the Área Rectora de Salud de Puntarenas concluded: “under clear-sky weather conditions, with no rain having fallen in the community for at least four days, it can be observed that the aforementioned tanks are spilling the potable water stored in them (…) this causes the soils immediately surrounding the tanks, where there is grass, stone, and concrete, to become saturated.
It is evident that the existing system for channeling and discharging the water spilling from the tanks in question does not collect all of the water (…) this spilled water flows beyond the wall (…) the wall and sidewalk on the northern side (…) have moss that could pose a fall hazard to pedestrians; water accumulates in the holes in the northern sidewalk (…) this water from the tanks remains and accumulates in that gutter along approximately 50 meters of the gutter, without all of it reaching the sewer inlet grate (…) less accumulated water is observed than during previous inspections (…) there are worm-like larvae and other types of insects that were not identified at the time, but they have been ruled out as Aedes aegypti larvae (…) it is evident that the underlying problem of potable-water spillage persists and that a certain amount of water will continue to accumulate in the northern curb and gutter until the leaks are completely sealed; additionally, the current structural condition of the tanks in question is unknown, making it impossible to determine whether there is any risk to maintenance personnel or the general public traveling through the surrounding area.” (emphasis added) In view of the foregoing, neither foul odors nor disease-carrying vectors have been established in the pools caused by water spilling from the Los Caites tanks.
On the other hand, with respect to the leaks, AyA reports that the waste of 3.5 to 4 liters per second of drinking water falls within the institutionally acceptable loss parameters (parámetros de pérdida aceptable). However, the respondent authority must be cautioned that this does not exempt it from diligently adopting the necessary measures to resolve the problem promptly and thereby safeguard the precious water resource. Nevertheless, in the case at bar (sub lite), it is evident that the problem dates back at least to the year 2011; notwithstanding this, years later, it still persists. AyA does not identify in its report any concrete and specific short-term measures aimed at definitively stopping the waste of drinking water. It states only that coordination is under way with the Subgerencia de Ambiente y Desarrollo to find a solution to the problem, whether through the repair or reconstruction of the tanks. In this regard, the case file contains official letter GSP-RCP-2016-269 of 9 de diciembre de 2016, according to which demolition and construction of new tanks in Los Caites are scheduled to begin in the year 2019. However, waiting this long is unacceptable, as it would entail 2 more years of drinking-water loss at a rate of 3.5 - 4 liters per second, which amounts to approximately 345600 liters per day (10368000 liters per month).
In the year 2015, UNESCO’s World Water Assessment Programme, through its report “Water for a Sustainable World” (http://unesdoc.unesco.org/images/0023/002318/231823E.pdf), warned that by the year 2030 the world is expected to face a global water deficit of 40%. That report explains that the downward trend in drinking-water availability is a serious global problem, exacerbated by various factors such as climate change, population growth, urbanization, industrialization, and increased production. It further emphasizes that in regions such as Latin America and the Caribbean, the problem of water scarcity is due largely to inadequate management of water resources, rather than to an actual shortage of water. Consistent with this, the UN Sustainable Development Goals (A/69/L.85, setiembre de 2015)—which establish the global development agenda through the year 2030—set the following target: “Goal Nº6: Ensure availability and sustainable management of water and sanitation for all.(…)6.4. By 2030, substantially increase water-use efficiency across all sectors and ensure sustainable withdrawals and supply of freshwater to address water scarcity and substantially reduce the number of people suffering from water scarcity.” In light of the foregoing, it is evident that sound management and the efficient and sustainable use of drinking water are key elements in counteracting water scarcity.
At the national level, AyA, in its capacity as the governing institute for drinking-water services, is required to act diligently to safeguard this vital resource and guarantee the efficient, effective, and sustainable provision of the service. Although the respondent authority states that the leaks from the Los Caites tanks have not prevented the system from maintaining acceptable water pressure for the provision of drinking-water service, the fact remains that the constant waste of water at an approximate rate of 345600 liters per day violates the principle of continuity of public services (principio de continuidad de los servicios públicos), because the wasted water could lead to future supply shortages due to insufficient drinking water.
Accordingly, this Chamber finds that AyA’s inaction in definitively resolving the persistent drinking-water leaks from the Los Caites tanks violates the human right of access to drinking water (derecho humano al acceso al agua potable) and the principle of continuity of public services.
In view of the considerations stated above, the petition must be granted solely with respect to AyA.
IV.Documentation submitted to the case file (Documentación aportada al expediente). The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, these must be retrieved from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, article XXVI and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, article LXXXI.

Yamileth Astorga Espeleta, José Alberto Moya Segura, and Danilo Chavarría Velázquez, respectively Presidenta Ejecutiva, Gerente General, and Jefe Cantonal de Puntarenas, all of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever may hold those positions in their stead, are ordered, within the scope of their authority, to take all necessary and appropriate steps so that, within 6 months from notification of this ruling, the problem of the leaks from the drinking-water storage tanks in Los Caites, Puntarenas, is definitively resolved. All of the foregoing is ordered with the warning that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order from this Chamber that they are required to comply with or enforce, and fails to do so, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not punishable by a more severe penalty.
The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay the costs, damages, and losses caused by the events underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative-litigation jurisdiction (jurisdicción de lo contencioso administrativo). This ruling shall be served personally upon Yamileth Astorga Espeleta, José Alberto Moya Segura, and Danilo Chavarría Velázquez, respectively Presidenta Ejecutiva, Gerente General, and Jefe Cantonal de Puntarenas, all of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever may hold those positions in their stead.

Recurso de amparo que se tramita en expediente Nº 16-016779-0007-CO, interpuesto por JOSÉ RAFAEL RODRÍGUEZ CASTRO, cédula de identidad No. 0115960507, JUAN CARLOS BADILLA FERNÁNDEZ, cédula de identidad No. 0116100910, KATHERINE ZÚÑIGA JUÁREZ, cédula de identidad No. 0604290758 y MARÍA LAURA SOLANO LÓPEZ, cédula de identidad No. 0116560035, contra la MUNICIPALIDAD DE PUNTARENAS, el MINISTERIO DE SALUD y el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AyA).
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
I.Objeto del recurso. Los accionantes aducen que en el Barrio El Carmen de Puntarenas hay dos tanques contenedores de agua potable, pertenecientes al AyA, que presentan grandes fugas hace más de 7 años. Consideran que el desperdicio del líquido vital amenaza el derecho humano de acceso al agua potable, máxime tomando en consideración la escasez de recurso hídrico que se ha presentado en la zona, lo que ha obligado incluso al uso de camiones cisterna. Aducen que también se atenta contra el derecho a la salud y a un ambiente sano y ecológicamente equilibrado, ya que se han formado estancamientos de agua que generan malos olores y criaderos de mosquitos transmisores de enfermedades. Acusan inercia de la Administración para resolver esta problemática.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
<![if !supportLists]>a. <![endif]>Los tanques de Los Caites son propiedad del AyA, se construyeron a finales de la década de los años 60, forman parte del sistema de abastecimiento de agua potable para el cantón de Puntarenas y permiten abastecer a la población en las horas de demanda máxima del sistema (véase informe rendido y prueba aportada); <![if !supportLists]>b. <![endif]>Los tanques de Los Caites presentan fugas a una tasa de de 3.5 a 4 litros por segundo (véase prueba aportada); <![if !supportLists]>c. <![endif]>En el año 2011, el AyA abrió la licitación abreviada 2011LA-74-PRI para impermeabilizar los tanques de Los Caites; sin embargo, la adjudicataria incumplió el objetivo de la contratación, toda vez que las fugas de agua persistieron (véase prueba aportada e informes rendidos); <![if !supportLists]>d. <![endif]>En el año 2014, el Ministerio de Salud giró instrucciones al AyA a efectos de solucionar las fugas de los tanques de Los Caites (véase informe rendido y prueba aportada); <![if !supportLists]>e. <![endif]>En marzo de 2015, el Área Rectora de Salud de Puntarenas emitió la orden sanitaria Nº68-Reg-2015, mediante la que se ordenaba al AyA presentar “un plan de acciones correctivas con el fin solucionar la problemática de fugas en los tanques de Almacenamiento (sic.) de agua potable ubicados en el Barrio El Carmen”; sin embargo, el AyA no presentó plan alguno (véase informe rendido y prueba aportada); <![if !supportLists]>f. <![endif]> El 19 de setiembre de 2016, los accionantes denunciaron ante el Ministerio de Salud, la Municipalidad de Puntarenas y el AyA de Puntarenas la fuga de agua potable proveniente de los tanques de Los Caites (véase prueba aportada); <![if !supportLists]>g. <![endif]>Mediante escrito del 23 de setiembre de 2016, el Alcalde de la Municipalidad de Puntarenas remitió la denuncia de los accionantes al Director Regional del AyA en Puntarenas (véase prueba aportada); <![if !supportLists]>h. <![endif]>Con ocasión de la denuncia interpuesta por los accionantes en setiembre de 2016, el 5 de octubre el Área Rectora de Salud de Puntarenas realizó una inspección in situ a los tanques Los Caites, la cual arrojó los siguientes resultados: “los tanques presentan fugas considerables de agua, los suelos se encuentran saturados (…)Si bien es cierto existe un sistema de desfogue hacia el alcantarillado, el mismo no tiene la capacidad de canalizar el caudal de agua generado por los tanques.
Según indico (sic.) el funcionario del AyA en un aforo reciente se calculó un caudal promedio de 4 L/s. Se evidencia además que el cordón y caño, en las zonas perimetrales a los muros protectores de los tanques se encuentran saturados o colapsados y sumado a la falta de mantenimiento provoca el estancamiento de agua. No se observaron larvas de Aedes aegypti en los sitios de agua estancada debido a factores como luz solar directa y control biológico (…) esta situación lleva años in poderse resolver” (véase prueba aportada); <![if !supportLists]>i. <![endif]>El AyA, en coordinación con la Municipalidad de Puntarenas, han estado realizando trabajos de limpieza en la zona afectada por el agua derramada de los tanques de Los Caites. Además, han efectuado obras a fin de canalizar las aguas provenientes de las fugas. Los últimos trabajos se realizaron el 5 de diciembre de 2016 (véase prueba aportada e informe rendido); <![if !supportLists]>j. <![endif]> El 21 de diciembre de 2016, el Área Rectora de Salud de Puntarenas realizó inspección in situ en los tanques de Los Caites, que arrojó los siguientes resultados: “en condiciones climatológicas de cielo despejado y sin que haya llovido en la comunidad en al menos cuatro días; se logra observar que los citados tanques presentan derrame del agua potable que se almacena (…) esto provoca que los suelos de los alrededores inmediatos a los tanques, donde hay césped, piedra y concreto, se encuentran saturados.
Se evidencia que el sistema existente de canalización y desfogue de las aguas que derraman los tanques en mención, no recolectan la totalidad de las aguas (…) esta agua derramada se traslada hacia fuera del muro (…) el muro y acera del sector norte (…) presentan musgo que podría producir un riesgo de caída para peatones, en los hoyos de la acera norte se acumula agua (…) sin que logre llegar la totalidad de esta agua, hasta la parrilla de entrada de la alcantarilla (…) se observa menor cantidad de agua acumulada que en inspecciones anteriores (…) presentan larvas lombriz color y otros tipos de insectos que no fueron identificados en el momento, pero se descartan que sean larvas Aedes aegypti(…) se logra evidenciar que la problemática se raíz de derrame de agua potable persiste y continuarán presentando acumulación de cierta cantidad de agua en el cordón y caño norte, hasta tanto no sean selladas por completo las fugas de las mismas, adicionalmente, se desconoce el estado estructural actual de los tanques en cuestión, no pudiéndose determinar si existe riesgo para el personal de mantenimiento o población general, que transita en los alrededores”(véase prueba aportada);
“Este Tribunal ha reconocido como parte del Derecho de la Constitución, el derecho fundamental al agua potable, derivado de los derechos a la salud, la vida, al medio ambiente sano, a la alimentación y la vivienda digna, entre otros. En este mismo sentido se han pronunciado instrumentos internacionales sobre Derechos Humanos aplicables en Costa Rica; así, figura explícitamente en la Convención sobre la Eliminación de todas las Formas de Discriminación contra la Mujer (artículo 14) y la Convención sobre los Derechos del Niño (artículo 24); además, se enuncia en la Conferencia Internacional sobre Población y el Desarrollo de El Cairo (principio 2). En el Sistema Interamericano de Derechos Humanos, Costa Rica se encuentra particularmente obligada en esta materia por lo dispuesto en el artículo 11.1 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos Económicos, Sociales y Culturales ("Protocolo de San Salvador" de 1988), el cual dispone en lo que interesa: "Artículo 11.
Derecho a un medio ambiente sano 1. Toda persona tiene derecho a vivir en un medio ambiente sano y a contar con servicios públicos básicos". Por otro parte, en el marco del Sistema Universal de Protección de los Derechos Humanos, el Comité de Derechos Económicos, Culturales y Sociales de la Organización de las Naciones Unidas reiteró que la disposición de agua es un derecho humano que además de ser imprescindible para llevar una vida saludable, es un requisito para la realización de todos los demás derechos humanos. Partiendo de esta normativa, es claro que el Estado costarricense se encuentra obligado a garantizar un servicio de agua potable en forma eficiente y oportuna. La propia Constitución Política recoge, implícitamente, el derecho fundamental de los administrados al buen y eficiente funcionamiento de los servicios públicos, esto es, que sean prestados con elevados estándares de calidad.” (sentencia Nº 2000-04595 a las 09:06 horas del 2 de junio del 2000; en idéntico sentido véase, entre muchas otras, sentencias Nº 2014-14669, Nº 2015-6424 y Nº 2015-7340).
IV.Sobre el caso concreto. Los accionantes aducen que en el Barrio El Carmen de Puntarenas hay dos tanques contenedores de agua potable, pertenecientes al AyA, que presentan grandes fugas hace más de 7 años. Consideran que el desperdicio del líquido vital amenaza el derecho humano de acceso al agua potable, máxime tomando en consideración la escasez de recurso hídrico que se ha presentado en la zona, lo que ha obligado incluso al uso de camiones cisterna. Aducen que también se atenta contra el derecho a la salud y a un ambiente sano y ecológicamente equilibrado, ya que se han formado estancamientos de agua que generan malos olores y criaderos de mosquitos transmisores de enfermedades. Acusan inercia de la Administración para resolver esta problemática.
Del estudio de los autos, se tiene por acreditado que los tanques de Los Caites son propiedad del AyA, se construyeron a finales de la década de los años 60, forman parte del sistema de abastecimiento de agua potable de Puntarenas y permiten abastecer a la población en las horas de demanda máxima; sin embargo, dichas estructuras presentan fugas de 3.5 a 4 litros por segundo. Se verifica que esta pérdida del recurso hídrico data desde el año 2011, en el cual el AyA abrió la licitación abreviada 2011LA-74-PRI para impermeabilizar los tanques de Los Caites. Sin embargo, la propia autoridad recurrida reconoce que la adjudicataria incumplió el objetivo de la contratación, toda vez que las fugas de agua persistieron. También se tiene por demostrado que en el año 2014, el Ministerio de Salud giró instrucciones al AyA a efectos de solucionar la problemática. Posteriormente, en marzo de 2015, el Área Rectora de Salud de Puntarenas emitió la orden sanitaria Nº68-Reg-2015, mediante la que ordenó al AyA presentar “un plan de acciones correctivas con el fin solucionar la problemática de fugas en los tanques de Almacenamiento (sic.) de agua potable ubicados en el Barrio El Carmen”; sin embargo, el instituto no presentó plan alguno.
De ahí que el 19 de setiembre de 2016, los aquí accionantes denunciaron ante el Ministerio de Salud, la Municipalidad de Puntarenas y el AyA de Puntarenas el desperdicio de agua potable proveniente de los tanques de Los Caites. En consecuencia, mediante escrito del 23 de setiembre de 2016, el Alcalde de la Municipalidad de Puntarenas remitió la denuncia de los recurrentes al Director Regional del AyA en Puntarenas. Por su parte, el Área Rectora de Salud de Puntarenas realizó el 5 de octubre de 2016 una inspección in situ, de conformidad con la cual “los tanques presentan fugas considerables de agua, los suelos se encuentran saturados (…) Si bien es cierto existe un sistema de desfogue hacia el alcantarillado, el mismo no tiene la capacidad de canalizar el caudal de agua generado por los tanques. Según indico (sic.) el funcionario del AyA en un aforo reciente se calculó un caudal promedio de 4 L/s.
Se evidencia además que el cordón y caño, en las zonas perimetrales a los muros protectores de los tanques se encuentran saturados o colapsados y sumado a la falta de mantenimiento provoca el estancamiento de agua. No se observaron larvas de Aedes aegypti en los sitios de agua estancada debido a factores como luz solar directa y control biológico (…) esta situación lleva años in poderse resolver.” Las autoridades del AyA reconocen la actual pérdida de agua potable en los tanques de Los Caites e informan que, en coordinación con la Municipalidad de Puntarenas, en noviembre y diciembre de 2016, realizaron trabajos de limpieza en la zona afectada por el agua derramada y canalizaron el líquido proveniente de las fugas (las últimas obras se hicieron el 5 de diciembre de 2016). No obstante, este Tribunal constata que, pese a las labores realizadas, el problema persiste, toda vez que la inspección in situ efectuada el 21 de diciembre de 2016 por el Área Rectora de Salud de Puntarenas concluyó: “ en condiciones climatológicas de cielo despejado y sin que haya llovido en la comunidad en al menos cuatro días; se logra observar que los citados tanques presentan derrame del agua potable que se almacena (…) esto provoca que los suelos de los alrededores inmediatos a los tanques, donde hay césped, piedra y concreto, se encuentran saturados.
Se evidencia que el sistema existente de canalización y desfogue de las aguas que derraman los tanques en mención, no recolectan la totalidad de las aguas (…) esta agua derramada se traslada hacia fuera del muro (…) el muro y acera del sector norte (…) presentan musgo que podría producir un riesgo de caída para peatones, en los hoyos de la acera norte se acumula agua (…) esta agua proveniente de los tanques, permanece y se acumula en dicho caño, a lo largo de aproximadamente 50 metros del caño, sin que logre llegar la totalidad de esta agua, hasta la parrilla de entrada de la alcantarilla (…) se observa menor cantidad de agua acumulada que en inspecciones anteriores (…) presentan larvas lombriz color y otros tipos de insectos que no fueron identificados en el momento, pero se descartan que sean larvas Aedes aegypti(…) se logra evidenciar que la problemática se raíz de derrame de agua potable persiste y continuarán presentando acumulación de cierta cantidad de agua en el cordón y caño norte, hasta tanto no sean selladas por completo las fugas de las mismas, adicionalmente, se desconoce el estado estructural actual de los tanques en cuestión, no pudiéndose determinar si existe riesgo para el personal de mantenimiento o población general, que transita en los alrededores .” (énfasis agregado) En mérito de lo anterior, no se acreditan malos olores ni vectores trasmisores de enfermedades en los charcos causados por el agua derramada de los tanques Los Caites.
Por otro lado, con respecto a las fugas, el AyA informa que el desperdicio de 3.5 a 4 litros por segundo de agua potable se encuentra dentro de los parámetros de pérdida aceptable a nivel institucional. Empero, debe advertir la autoridad recurrida que ello no lo exonera de adoptar diligentemente las medidas necesarias para solucionar el problema de una manera pronta, y resguardar así el preciado recurso hídrico. Sin embargo, en el sub lite se observa que la problemática data al menos desde el año 2011; no obstante, años después, todavía persiste. El AyA no refiere en su informe medidas concretas y específicas a corto plazo a efectos de solventar definitivamente el desperdicio de agua potable. Solo refieren que se está coordinando con la Subgerencia de Ambiente y Desarrollo a fin de buscar una solución a la problemática, ya sea mediante la reparación o reconstrucción de los tanques. En este sentido, consta en autos el oficio GSP-RCP-2016-269 del 9 de diciembre de 2016, conforme el cual, se tiene proyectado iniciar en el año 2019 la demolición y construcción de unos nuevos tanques en Los Caites. Sin embargo, aguardar este plazo resulta inadmisible, por cuanto implicaría 2 años más de una pérdida de líquido potable a una tasa de 3.5 - 4 litros por segundo, que se traduce aproximadamente en unos 345600 litros al día (10368000 litros por mes).
En el año 2015, el Programa Mundial de Evaluación de los Recursos Hídricos de la UNESCO, mediante su informe “Agua Para Un Mundo Sostenible ” (http://unesdoc.unesco.org/images/0023/002318/231823E.pdf), alertó que en el año 2030 se prevé que el mundo tendrá que enfrentarse a un déficit mundial del 40% de agua. Dicho informe expone que la tendencia a la baja en la disponibilidad de agua potable es una grave problemática a escala mundial, exacerbada por diversos factores como el cambio climático, el crecimiento demográfico, la urbanización, la industrialización y el aumento de la producción. Además, destaca que en regiones como América Latina y el Caribe, el problema de la escasez de agua obedece en gran parte a la inadecuada gestión del recurso hídrico, más que a la propia carestía del líquido. En consonancia con ello, los Objetivos de Desarrollo Sostenible de la ONU (A/69/L.85, setiembre de 2015) –que marcan la agenda de desarrollo mundial hasta el año 2030- estipulan como meta: “Objetivo Nº6: Garantizar la disponibilidad de agua y su gestión sostenible y el saneamiento para todos.(…)6.4.
Para 2030, aumentar sustancialmente la utilización eficiente de los recursos hídricos en todos los sectores y asegurar la sostenibilidad de la extracción y el abastecimiento de agua dulce para hacer frente a la escasez de agua y reducir sustancialmente el número de personas que sufren de escasez de agua”. Al tenor de lo anterior, se denota cómo la buena gestión y el uso eficiente y sostenible del agua potable son elementos claves para contrarrestar la escasez del líquido.
En el ámbito nacional, el AyA, en su carácter de instituto rector del servicio de agua potable, está compelido a gestionar diligentemente en aras de salvaguardar el recurso vital y garantizar la prestación eficiente, eficaz y sostenible del servicio. Si bien la autoridad recurrida refiere que las fugas de los tanques Los Caites no han impedido que el sistema mantenga una presión de agua aceptable para brindar el servicio de agua potable, lo cierto es que un constante desperdicio del líquido a una tasa aproximada de 345600 litros al día, atenta contra el principio de continuidad de los servicios públicos, por cuanto el líquido desaprovechado podría acarrear futuros desabastecimientos por carestía de suficiente agua potable.
Así las cosas, considera esta Sala que la inercia del AyA para resolver definitivamente las perennes fugas de agua potable en los tanques de Los Caites, atenta contra el derecho humano al acceso al agua potable y el principio de continuidad de los servicios públicos.
En mérito de las consideraciones esgrimidas, se impone declarar con lugar el recurso únicamente en lo que respecta al AyA.
IV.Documentación aportada al expediente . Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso únicamente contra el Instituto Costarricense de Acueductos y Alcantarillados. Se le ordena a Yamileth Astorga Espeleta, José Alberto Moya Segura y Danilo Chavarría Velázquez, por su orden, Presidenta Ejecutiva, Gerente General y Jefe Cantonal de Puntarenas, todos del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes en su lugar ocupen los cargos que, dentro del ámbito de sus competencias, gestionen lo necesario y pertinente a efectos de que, en el plazo de 6 meses contado a partir de la notificación de este pronunciamiento, se resuelva definitivamente el problema de las fugas en los tanques de almacenamiento de agua potable de Los Caites en Puntarenas. Todo lo anterior se dicta con la advertencia que de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá pena de prisión de tres meses a dos años o de veinte a sesenta día multa a quien reciba una orden de esta Sala que deba cumplir o hacer cumplir y la inobserve, siempre que el delito no esté más gravemente penado.
Se condena al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese este pronunciamiento a Yamileth Astorga Espeleta, José Alberto Moya Segura y Danilo Chavarría Velázquez, por su orden, Presidenta Ejecutiva, Gerente General y Jefe Cantonal de Puntarenas, todos del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes en su lugar ocupen los cargos, en forma personal.
