Application for amparo relief (recurso de amparo) filed by MAURICIO ÁLVAREZ MORA, identity card number 1-877-217, representative of the FEDERACIÓN COSTARRICENSE PARA LA CONSERVACIÓN DEL AMBIENTE; ROBERTO MOLINA UGALDE, identity card number 5-195-151, secretary-general of the ASOCIACIÓN SINDICAL DE TRABAJADORES DEL MINAE; LUIS DIEGO MARÍN SCHUMACHER, identity card number 1-753-303, president of the ASOCIACIÓN PRESERVE PLANET; EDUARDO JOAQUÍN CARRILLO JIMÉNEZ, identity card number 1-575-493; LUCIANO CAPELLI CALANCA; JAZMÍN ROSS LEMUS; GRACE WONG REYES, identity card number 6-165-096; and MARIO ANDRÉS BOZA LORÍA, identity card number 1-297-932; against the MINISTERIO DE AMBIENTE Y ENERGÍA and the MINISTERIO DE HACIENDA.
BACKGROUND:
Eduardo Carrillo, of the Universidad Nacional, states that as early as 2003 he warned of a significant decline in the populations of white-lipped peccaries (chanchos de monte) and jaguars in Corcovado; he refers to the threats he has received because of his research and his efforts to save the jaguars of this national park, and also says that “if you have 400 or 500 gold miners (oreros) hunting inside the park, the problem is extremely serious....” The article also reproduces comments by Mr. Roberto Molina, secretary of the Sindicato del Minae, in which he explains that the park rangers (guardaparques) are powerless against the “enemies of nature” because they have very few resources compared with them; that they have unsuccessfully requested better weapons and bulletproof vests; that each of these officials must protect 4.500 hectares; and that, since 1998, no additional positions have been created for the appointment of new park rangers.
On 26 de julio del 2015, the newspaper La Nación published an article entitled “South America Seeks a United Front Against Illegal Mining in the Amazon.” That article graphically describes how illegal mining (minería ilegal) for gold in the Peruvian Amazon has caused the complete deforestation of approximately 60.000 ha of rainforest. The photographs accompanying the article are truly striking and clearly show how the original primary forest (bosque primario) was completely razed to extract gold. The question we must ask ourselves is: will this be the fate of the majestic primary forests of the Península de Osa if the current illegal-mining situation continues? It is evident that the result would be “scorched earth.” The respondent authorities (autoridades recurridas) have not only failed to fulfill their duty to take urgent action to resolve the serious crisis facing the Park and the Reserve, but have also failed to provide the park rangers working in these protected areas (áreas protegidas) with the minimum gear and equipment necessary to confront armed intruders.
Although the Corcovado park rangers have reported this situation on several occasions, the respondent authorities have failed to make the investments necessary to provide them with basic equipment such as suitable weapons and bulletproof vests. Consequently, because of the inaction and lack of planning by the respondent authorities, the few park rangers remaining in the Park and the Reserve find themselves “with their hands tied” when confronting illegal gold miners, hunters, and deforesters who are destroying the natural heritage of the State (Patrimonio Natural del Estado). Parque Nacional Corcovado and Reserva Forestal Golfo Dulce are short by at least 80 park rangers needed to meet the minimum protection requirements of these densely vegetated and difficult-to-access areas. Each official currently assigned to the Park must protect 4.500 hectares, which is unquestionably humanly impossible.
The situation in the Reserve is even worse. Although the respondent authorities are aware of this serious staffing deficit, no additional positions have been created for the appointment of new park rangers since 1998. Worse still, the Poder Ejecutivo and the Ministerio de Hacienda have been applying to the Ministerio de Ambiente y Energía Presidential Directives N° 013-H (published in Alcance Digital N° 13-A of La Gaceta N° 45, on 4 de marzo del 2011) and N° 026-H (published in La Gaceta N° 100 of 25 de mayo del 2011), which prohibit filling positions that become vacant and creating new positions for the appointment of new public officials. These prohibitions are mechanically applied to the appointment of new park rangers to protect Parque Nacional Corcovado and Reserva Forestal Golfo Dulce, disregarding the critical emergency affecting these protected areas. The Contraloría General de la República has also warned of the adverse consequences that inadequate management of protected wildlife areas (áreas silvestres protegidas) and the State’s failure to allocate the resources necessary for their protection are having on Parque Nacional Corcovado.
Nevertheless, the respondent authorities have not adequately acted upon its conclusions. In Report N° DFOE-AE-IF-16-2014 of 15 de diciembre del 2014, the oversight body stated: “SINAC’s management regarding the provision of the resources necessary for the operation and consolidation of the Protected Wildlife Areas was found to be only moderate, thereby jeopardizing the achievement of the objectives of biodiversity conservation and sustainable use. [...] The lack of financial resources adversely affected the performance of at least 80% of the essential activities of 91 Protected Wildlife Areas, while in 24 cases essential activities depended on nonrecurring revenue for funding, thereby jeopardizing the sustainability of their management. [...] Both enforcement and protection, as well as the response to environmental disasters and emergencies, are essential to counter threats to biodiversity, which have affected groups of mammals at the top of the food chain, such as the jaguar and the puma, as well as important ecosystems, including tropical dry forest and wetlands.
The principal threats identified involve timber extraction, agricultural practices, human-caused fires, mineral extraction, hunting, fishing, infrastructure construction, unauthorized human occupation, and organized-crime activities.” This Report includes a box entitled “Case Study of Parque Nacional Corcovado.” The box states that “Parque Nacional Corcovado is threatened by the adverse impact of illegal gold-mining activity. [...] The presence of persons who feed on wildlife species highly vulnerable to extinction, such as the white-lipped peccary Tayassu pecari, and other endangered species, such as the red brocket deer Mazama americana and the lowland paca Cuniculus paca, also contributes to the fragility of the Park’s biodiversity. Other contributing factors include the felling of trees to build temporary settlements, the use of firewood for cooking, and the use of timber to construct extraction works.” It can be observed that the box identifies the Administración del Parque Nacional Corcovado as the source of this information, which means that the information is official.
Anexo 2 of this Report mentions wildlife species and the principal threats to them. Regarding the jaguar, this annex states that “The figure on the left shows the abundance of the jaguar (Pantera once) in Parque Nacional Corcovado, Costa Rica, according to data from the Observatorio Ambiental de la Universidad Nacional.” However, it should be noted that the information provided by the CGR in this figure extends only through 2009. Based on Icomvis/UNA data, the current situation of the jaguar in the Península de Osa is far more serious, to the point that the species is on the verge of extinction in this area. In this annex, the CGR also presents information on the Baird’s tapir and the nazareno tree, both found in Osa and respectively subject to poaching and deforestation, indicating that they are endangered. Management and Implementation Report of the Programa de Control del Área de Conservación Osa.
This Report, which covers the first quarter of the current year, states that during the first quarter of this year, park rangers, with support from Fuerza Pública officials, found 49 active workings and 17 abandoned workings (Evidence N° 13). Although it does not indicate how many gold miners were working at each site, it is known that there were several. This Report also provides a map showing the distribution of enforcement actions, which demonstrates that gold miners have penetrated the entire mountainous area of Parque Corcovado, covering approximately two-thirds of its total area. The information provided by this Report suggests that the park rangers of Área de Conservación Osa are doing everything they can to protect the Park and the Reserve. Nevertheless, because of their limited numbers and lack of equipment and weapons, their work and that of Fuerza Pública are wholly insufficient to resolve the problem, which has grown enormous because of the lack of action in the past.
To ensure that the State does not continue allowing violations of the extensive legislation cited above—which protects our parks and reserves, endangered wildlife, and our country’s natural heritage—the institutions involved must make a serious effort to protect the extraordinary biological diversity found in Parque Corcovado and Reserva Golfo Dulce. Analysis of the facts described confirms beyond any doubt that the respondent authorities have acted negligently in fulfilling their obligation to adopt effective measures aimed at safeguarding and defending protected wildlife areas, as well as protecting endangered plant and animal species, by combating utterly destructive activities such as illegal mining, timber theft, and the illegal hunting of wild animals in Parque Nacional Corcovado and Reserva Forestal Golfo Dulce. The omissions (conducta omisiva) of those authorities severely violate the fundamental right protected by the second paragraph of Article 50 of our Constitución Política, which provides that “every person has the right to a healthy and ecologically balanced environment.” It adds that the creation of a national park or forest reserve entails a compelling obligation to take action and provide protection to prevent the protected ecosystems from being destroyed by human activity.
In the case of the Park and the Reserve, the State has not discharged these duties and, on the contrary, has allowed the problem to grow over the years to its current scale. The State’s failure to take effective action to evict the persons who have invaded Parque Corcovado and Reserva Golfo Dulce constitutes a clear breach of the obligations assumed by the Costa Rican State when it created these important protected areas. If more than 400 illegal gold miners are currently operating inside the Park, the State cannot confine itself to conducting routine operations with insufficient and poorly equipped personnel. It must confront the situation for what it is—an emergency—and adopt corrective measures that are genuinely effective and proportionate to the magnitude of that emergency. Nevertheless, those measures have yet to be adopted. They emphasize that the omissions of the respondent authorities severely violate the fundamental right protected by the second paragraph of Article 50 of our Constitución Política, which provides that “every person has the right to a healthy and ecologically balanced environment,” a right recognized in the Constitución Política itself and in numerous international treaties and conventions. They request that the appeal (recurso) be granted and that the respondent authorities be ordered to do the following:
“To Edgar Gutiérrez Espoleta, Minister of Environment and Energy:
a. Within one month of service of this judgment, organize and carry out a special operation to expel from Parque Nacional Corcovado and Reserva Forestal Golfo Dulce all persons who have invaded them for the purpose of mining gold, poaching, and illegally cutting down trees, assigning personnel from other protected areas of the country to the conflict zone.
b. For these purposes, MINAE shall assume institutional coordination of said operation with the other competent State agencies and institutions and may resort, if necessary, to exceptional measures such as a declaration of emergency or a temporary closure of the affected areas, in order to ensure that park rangers (guardaparques)—together with Public Force officers—can focus on eradicating illegal activities, as well as to secure the other conditions and resources necessary to carry out said operation successfully.
c. Within three months of service of this decision, urgently adopt the measures necessary to provide the park rangers or security and surveillance officers who protect Parque Corcovado and Reserva Golfo Dulce with the equipment necessary to protect their physical safety and enable them to perform their control and protection duties efficiently. This equipment must consist of regulation revolvers and rifles, means of transportation, holsters, bulletproof vests, field uniforms, first-aid kits, tactical boots, rain capes, backpacks, sunglasses, tactical gloves, pepper spray, defensive weapons, cameras, cellular and satellite telephones, binoculars, tactical flashlights, global positioning devices (GPSs), night-vision devices, handcuffs, packs, mountain equipment, and evidence-sealing tape.
d. Process the budget amendments (modificaciones presupuestarias) and include in the Republic’s forthcoming ordinary or extraordinary budgets the respective appropriations necessary to provide Parque Nacional Corcovado and Reserva Forestal Golfo Dulce with the financial and material resources required to protect the ecosystems and combat illegal mining, illegal hunting, and timber theft.
To Luis Guillermo Mata Vega, Minister of Public Security:
a. Coordinate with the Minister of Environment and Energy the regular conduct of operations involving park rangers together with personnel from this Ministry. For this purpose, a sufficient number of Public Force personnel must be assigned to each operation to resolve the problem within no more than one month. These actions must be supported by the necessary equipment and materials and by air transportation that facilitates the operation and makes it more effective.
b. Once all gold miners, poachers, and loggers who have invaded the Park and the Reserve have been expelled, assign a minimum of 20 Public Force personnel to remain in both protected areas for at least one year c. to prevent new invasions along the rivers and in the areas from which the gold miners have been expelled.
To Helio Fallas Venegas, Minister of Finance:
a. Within three months of service of this judgment, adopt the measures necessary to authorize the Ministry of Environment and Energy to fill security and surveillance officer positions that have become or may become vacant and to create new security and surveillance officer positions to gradually and progressively remedy the shortage of 80 park rangers dedicated to protecting Parque Nacional Corcovado and Reserva Forestal Golfo Dulce in Area de Conservación Osa. These measures shall include processing urgent exceptions to Presidential Directives N° 013-H (published in Alcance Digital N° 13-A to La Gaceta N° 45, on 4 de marzo del 2011) and N° 026-H (published in La Gaceta N° 100 of 25 de mayo del 2011), in view of the urgent need to halt the destruction of the State Natural Heritage (Patrimonio Natural del Estado) in Parque Nacional Corcovado and Reserva Forestal Golfo Dulce.
b. Process and authorize the budgets and budget amendments submitted by the Ministry of Environment and Energy to comply with the provisions set forth in points 1 .b) and c) of this petition.
2. That the respondent authorities be ordered to provide full reparation and compensation for the harm and losses caused to the environment and wildlife by the omissions and negligence giving rise to this amparo proceeding (proceso de amparo). The amount of such harm and the reparation and compensation measures shall be determined during the judgment-enforcement proceedings (proceso de ejecución de sentencia).
3. That the respondent authorities be ordered to refrain in the future from engaging in omissions and negligence such as those giving rise to this Amparo Appeal (Recurso de Amparo), and to comply permanently, in accordance with the preventive principle (principio preventivo), with their obligation to protect Parque Nacional Corcovado and Reserva Forestal Golfo Dulce.
4. That the State be ordered to pay the costs of these proceedings.”
Although restrictions were indeed imposed on the creation of new positions and the use of vacant positions in the Public Sector, Article Two of Directive 013-H provided that the Budgetary Authority could consider requests to use vacant positions that were essential for the provision of public services. Likewise, Article Four of that Directive provided that public entities could reassign and reorganize their personnel within their organizational structure in accordance with the applicable regulations. The cited Directives were in no way an insurmountable obstacle preventing MINAE or its deconcentrated body (órgano desconcentrado), SINAC, from requesting the use of vacant positions or even reorganizing internally to fulfill objectives they considered priorities. Therefore, in its view, the petitioners (recurrentes) are seriously mistaken in attempting to invoke the cited Directives to hold the Ministry of Finance responsible for the failure to use vacant positions to address any priority that MINAE deemed necessary to resolve.
It reiterates that, within the sphere of authority of the Ministry of Finance, not only have the constitutional rights of the public been respected through the responsible management of public funds amid the serious fiscal situation facing the country, but resources have also been allocated so that the institutions charged with safeguarding the preservation of the environment and wilderness areas (áreas silvestres) may fulfill their legal obligations, since in this case MINAE and its deconcentrated body are responsible for administering and expending the resources allocated in the budget so that they may perform the functions assigned to them by law. It requests that the petition (recurso) be dismissed.
Regarding the damage caused by gold mining in Parque Nacional Corcovado, Área de Conservación Osa (ACOSA), with support from the Executive Secretariat of SINAC and the Office of the Vice-Ministry of Environment, has been increasing the number of enforcement measures intended to minimize the aforementioned impacts, with 1243 enforcement actions having been conducted. He states that during the period from 2013 to 2015, the following actions, among others, were carried out: 9 visual inspections with judges or officers; responses to 289 complaints; 1 inspection concerning the possession of wildlife, rescue centers, wildlife breeding facilities and zoos; 2 inspections of commercial establishments; 39 highway operations; 62 operations in marine areas; 733 reconnaissance and enforcement patrols; and staffing at 78 fixed posts. Regarding the techniques and equipment used by illegal gold miners in Parque Nacional Corcovado, he states that Área de Conservación Osa, with support from the Executive Secretariat of SINAC and the Office of the Vice-Ministry of Environment, has been carrying out operations to seize such machinery and equipment.
For example, in 2013 and 2014, officers from the Programa de Control y Protección de Corcovado seized 33 metal bars, 31 machetes, 18 chupacabras, 22 cateadoras, 11 diving lamps, 41 shovels, 15 flashlights, 2 electric generators, 4 cell phones, 3 rakes, 15 canoes, 10 grills, 7 jars of gold, 5 communication radios, one weapon, and other devices required for gold extraction. This demonstrates that the State has taken action to seize all the equipment and machinery identified in this paragraph.
Regarding illegal hunting, Área de Conservación Osa, SINAC and MINAE have been carrying out specific enforcement measures within Parque Nacional Corcovado, including the following: 1. A group of officers is stationed at Centro Operativo Los Planes, whose primary function is to conduct enforcement activities during the dry season in the lowland sector to control illegal hunting in Parque Nacional Corcovado. 2. There is likewise a support group stationed at Centro Operativo Los Patos; this group specifically conducts patrols in another sector of Parque Nacional Corcovado, reinforcing and supporting the enforcement activities carried out by Centro Operativo Los Planes. 3. At the end of 2013, an enforcement strategy was designed for 2014 and subsequent years, identifying illegal hunting as a threat in Parque Nacional Corcovado; operational and strategic measures were likewise established to minimize the impact of these unlawful activities inside and outside the Parque Nacional.
Another important measure taken by the Programa de Control in Corcovado was to conduct two special operations: Operativo Águila Arpía and a special operation during Semana Santa in 2015 to address the hunting problem in Corcovado. One further operation, called Aguas Azules, is planned for the end of this year. 5. Support and coordination efforts were undertaken with Policía de Fronteras and the Unidad Especial de Zapadores of the Public Force to reinforce the personnel supporting the operational centers of Parque Nacional de Corcovado and Reserva Forestal Golfo Dulce.
Regarding the illegal felling of trees, he states that ACOSA, with support from the Executive Secretariat of SINAC and the Office of the Vice-Ministry of Environment, has been taking action on this matter. The operational center responsible for addressing timber theft is Centro Operativo Rancho Quemado. In addition to having a permanent staff of 6 enforcement officers, this center was reinforced during 2013 and 2014 by officers of the Public Force of Región Diez, and in 2015 efforts were made to reinforce that group with Public Force officers, including the Unidad de Zapadores and Policía de Fronteras. Similarly, the 2014 enforcement plan establishes enforcement activities intended to minimize the impact of illegal logging in Reserva Forestal Golfo Dulce. Lastly, I must state that one of the recent outcomes has been a conviction; see N. 91-2015 del 14 de agosto del 2015. Because unemployment in the area has been identified as a factor triggering the reported problem, initiatives have been undertaken to alleviate it.
Accordingly, entrepreneurship projects have been organized as part of the community-management work and, in particular, the efforts directed at groups of illegal gold miners, hunters and loggers, which exert the greatest pressure on both Parque Nacional Corcovado and Reserva Forestal Golfo Dulce. These projects are being implemented as part of the Área de Conservación Osa strategy to increase income and employment opportunities for these pressure groups, thereby reducing environmental offenses in these two protected areas. Contacts were initiated in early 2013 with Fideicomiso Osa and Fundación Costa Rica Estados Unidos to develop a project that would provide productive alternatives to illegal gold miners, hunters and loggers. Thanks to contributions from these two organizations, the project “Empredimientos y Biodiversidad en la Península de Osa” (EMBIOPO) began in July 2013. At the beginning of 2013, with support from Fundación Costa Rica – Estados Unidos (CRUSA), development began on the project “Caminos de Osa.” This project, which formally began in May 2014, seeks to promote the comprehensive development of the communities of Península de Osa by strengthening community-based rural tourism initiatives linked to a network of new trails leading to Parque Nacional Corcovado and incorporating them into the value chain of national and international tour operators (he describes the project in detail).
A project called “Manejo Forestal y Certificación del origen legal de Madera” (MAFOR-COL) has also been developed to counter illegal logging in Reserva Forestal Golfo Dulce through the promotion of sustainable forest management (Manejo Forestal Sostenible). The project will be financed with funds from the Primer Canje de Deuda por Naturaleza CR-EE.UU. and will be implemented jointly with the Escuela de Ingeniería Forestal del Instituto Tecnológico de Costa Rica.
Justice Hernandez Gutierrez drafted the opinion; and,
Considering:
The appellants seek protection of the right to a healthy and ecologically balanced environment. In this regard, they allege that since 2012 irreversible environmental damage has been occurring in both Parque Nacional de Corcovado and Reserva Golfo Dulce—both protected areas of great biological wealth—as a result of illegal activities. They contend that, to date, more than four hundred persons are unlawfully occupying Parque Nacional de Corcovado and that their activities are jeopardizing the environmental balance. All of this is occurring with the State’s tolerance, even though the situation has been reported to the competent authorities on numerous occasions. They allege, as an aggravating factor, that Directives Nos. 013-H and 026-H have been applied to Ministerio de Ambiente y Energía, preventing it from filling positions that become vacant and from creating new positions for the appointment of new public officials; these prohibitions affect the protection of Parque Nacional Corcovado and Reserva Forestal Golfo Dulce.
The appellants request that the Ministro de Ambiente y Energía be ordered to organize and carry out an operation to evict the persons engaged in gold mining, hunting, and illegal logging within Parque Nacional Corcovado and Reserva Forestal Golfo Dulce, and to provide the park rangers or security and surveillance officers with the equipment necessary to protect their physical safety and enable them to perform their control and protection duties efficiently. They request that the budget amendments (modificaciones presupuestarias) needed to protect the ecosystems and combat the stated problem be processed. They further request that, once all gold miners, poachers, and loggers have been expelled, a minimum of 20 Fuerza Pública officers be assigned to remain in both protected areas for at least one year. They request that the Ministro de Hacienda be ordered to adopt the measures necessary to fill and create new security and surveillance officer positions in order to ensure the protection of both locations, and to process and authorize the budgets and budget amendments submitted to fulfill the requested measures.
They request that the respondent authorities be ordered to provide full reparation and compensation for the damage and losses caused to the environment and wildlife by the omissions and negligence giving rise to this amparo action (recurso), that they refrain from engaging in the alleged omissions in the future, and that the State be ordered to pay the costs of these proceedings.
The following facts are deemed duly established and relevant to the determination of this matter:
1. Parque Nacional Corcovado and Reserva Forestal Golfo Dulce have been invaded by gold miners and hunters, and illegal tree felling has occurred there. (according to the report of the Director of Área de Conservación de Osa of Sistema Nacional de Áreas de Conservación OSA) 2. Through the special operation known as “ORO VERDE UNO,” carried out in April 2013, an assessment was conducted of the situation concerning the invasion of Parque Nacional Corcovado by gold miners. It identified 34 active gold-mining operations, 29 inactive operations, and 15 camps, primarily in the Río Claro, Río Madrigal, Río Rincón and Río Tigre areas, within an area of 16 hectares. The resulting damage was estimated at 9556 square meters, representing approximately 15638 cubic meters displaced by gold extraction; given the number of illegal operations within the Park, it was estimated that 130 persons might have been working in the affected area.

Based on the report from the aforementioned “ORO VERDE UNO” operation, the State invested 15.000.000 million colones in order to begin making decisions concerning the expansion of control and protection measures to minimize the impact described in the amparo petition (amparo). Specifically, Área de Conservación Osa (ACOSA), together with Secretaría Ejecutiva del SINAC and Despacho del Viceministro de Ambiente, decided to increase the number of special operations conducted with the support of Fuerza Pública to 7 operations through June 2015. Control measures were also increased to minimize the aforementioned impacts, resulting in 1243 control actions from 2013 through June 2015. (according to the report of the Executive Director of Sistema Nacional de Áreas de Conservación -SINAC-) 4.
During the period from 2013 to 2015, 9 on-site inspections (inspecciones oculares) were conducted with judges or officers; 289 complaints were handled; 1 inspection concerning the possession of wildlife, rescue centers, wildlife breeding facilities, and zoos was conducted; 2 inspections of commercial establishments were conducted; 39 highway operations, 62 operations in marine areas, and 733 reconnaissance and enforcement patrols were conducted; and services were provided at 78 permanent posts, among other actions. (According to the report of the Executive Director of the Sistema Nacional de Áreas de Conservación –SINAC–) 5. During the period from 2013 to 2014, Área de Conservación Osa, together with the Secretaría Ejecutiva del SINAC and the Office of the Vice Minister of the Environment, carried out seizure operations against gold miners, involving both machinery and equipment. Among the items seized were 33 metal bars, 31 machetes, 18 suction devices, 22 prospecting pans, 11 diving lamps, 41 shovels, 15 flashlights, 2 electric generators, 4 cell phones, 3 rakes, 15 canoes, 10 grills, 7 jars of gold, 5 communication radios, one weapon, and other implements required for gold extraction.
(According to the report of the Executive Director of the Sistema Nacional de Áreas de Conservación –SINAC–) 6. Área de Conservación Osa, SINAC, and MINAE carried out specific enforcement actions. For this purpose, a group of officials is stationed at “Centro Operativo Los Planes” and, during the dry season, patrols the lowland sector to control hunting. (According to the report of the Executive Director of the Sistema Nacional de Áreas de Conservación –SINAC–) 7. There is a group of support officials stationed at Centro Operativo Los Patos that conducts patrols in another sector of Parque Nacional Corcovado, reinforcing and supporting the enforcement activities carried out by “Centro Operativo Los Planes.” (According to the report of the Executive Director of the Sistema Nacional de Áreas de Conservación OSA –SINAC–) 8. The authorities of Sistema Nacional de Áreas de Conservación OSA designed a strategy that identified illegal hunting as a threat in Parque Nacional Corcovado and accordingly established operational enforcement measures.
Specifically, “Operativo Águila Arpía” was conducted from 21 de enero al 4 de febrero, along with another special operation during Semana Santa in 2015 to address the hunting problem in Corcovado. (According to the report of the Executive Director of the Sistema Nacional de Áreas de Conservación –SINAC–) 9. On an unspecified date, those authorities coordinated with Policía de Fronteras and Unidad Especial de Zapadores de la Fuerza Pública to address the hunting problem in Corcovado. (According to the report of the Executive Director of the Sistema Nacional de Áreas de Conservación –SINAC–) 10. On an unspecified date, Área de Conservación de OSA (ACOSA), together with SINAC and the Office of the Vice Minister of the Environment, took action regarding illegal logging and timber theft. (According to the report of the Executive Director of the Sistema Nacional de Áreas de Conservación OSA.)
11. Centro Operativo Rancho Quemado is responsible for addressing the problem of timber theft and, for this purpose, has a permanent staff of 6 enforcement officials and has made efforts to strengthen that group. (According to the report of the Executive Director of the Sistema Nacional de Áreas de Conservación –SINAC–) 12. The 2014 Enforcement Plan established enforcement activities to minimize the impact of illegal logging in Reserva Forestal Golfo Dulce. (According to the report of the Executive Director of the Sistema Nacional de Áreas de Conservación Osa.)
13. SINAC has developed a project called “Manejo Forestal y Certificación del origen legal de Madera” (MAFOR-COL), which began in the first week of agosto del 2015 and seeks to counteract illegal logging in Reserva Forestal Golfo Dulce by promoting sustainable forest management (Manejo Forestal Sostenible). (According to the report of the Executive Director of the Sistema Nacional de Áreas de Conservación –SINAC–.)
14. According to official letter ACOSA-RFGD-115-2015 dated 18 de agosto del 2015, issued by Juan José Espinoza in his capacity as Administrator of Reserva Forestal Golfo Dulce, a report was submitted on actions carried out in the area of community management (gestión comunitaria). (According to the report of the Executive Director of the Sistema Nacional de Áreas de Conservación –SINAC–.) (SEE PAGE 1043) 15. On an unspecified date, beginning in 2013, Área de Coservación de Osa (ACOSA), together with SINAC, arranged for additional supplies for the park rangers stationed at Parque Nacional de Corcovado, including the replacement of the entire weapons arsenal. Specifically, each official at Parque Nacional Corcovado was issued an M30-1 carbine. The acquisition of 8 Garmen-brand GPS units with cases, 8 tents, 8 cameras, and 20 hammocks was also arranged. (According to the report of the Executive Director of the Sistema Nacional de Áreas de Conservación –SINAC–.)
16. Because of the park’s size and the difficulty of accessing several locations, ACOSA petitioned Autoridad Presupuestaria to create new positions to serve Reserva Forestal Golfo Dulce and Parque Nacional Corcovado. (According to the report of the Executive Director of the Sistema Nacional de Áreas de Conservación –SINAC–.)
17. Since the beginning of 2013, SINAC ACOSA, with support from fundación Costa Rica Estados Unidos, launched a Fideicomiso Osa project to provide alternatives for the area’s gold miners, hunters, and illegal loggers. (According to the report of the Executive Director of the Sistema Nacional de Áreas de Conservación OSA.)
18. By official letter number STAP-1930-2013 dated 12 de agosto 2013, the Executive Director of Secretaría Técnica de la Autoridad Presupuestaria (STAP) informed the Minister serving at that time that the request for 33 special-services positions for a term of 6 months, classified and valued at the same level as “Técnico de Servicio Civil 1,” to support the protection of natural resources and to be financed using balances remaining in the “Remuneraciones” budget line, could not be granted under circular STAP-CIRCULAR-0016-2013 and Presidential Directive No 40-H. This was because surpluses or remaining balances arising in the various subitems of the Remuneraciones budget line could not be used to increase any other expenditure. 19. On 14 de septiembre de 2013, Dr. Eduardo Carrillo, Director of ICOMVIS, sent a letter to the authorities of Área de Conservación Osa of SINAC/MINAE regarding the status of the white-lipped peccary and jaguar populations in Corcovado, stating that “the white-lipped peccary populations have fallen below the levels recorded in 2005, and jaguars have declined to a level never before recorded in Corcovado during the past 22 years.” (According to documentation entered into the record.)
20. By official letter number FCTM-ICOMVIS-496-2014 dated 20 de agosto de 2014, Eduardo Carrillo, Mario A. Boza, and Álvaro Ugalde, of Instituto Internacional de Conservación y Manejo de la Vida Silvestre de la Universidad Nacional –ICOMVIS–, sent a letter to Lic. Patricia Madrigal, who was then serving as Vice Minister of MINAE, referring to the biological importance of Parque Corcovado and the damage caused by gold miners. They requested that her office coordinate assistance from Fuerza Pública, Migración, Control de Drogas, IMAS, and INDER, among other national institutions, to conduct operations capable of permanently resolving the presence of the intruders. This was to be done before the situation in the Park and the Reserve became irreversible. (Page 94 of the initial petition.)
21. By official letter number SINAC-DE-2145 dated 22 de octubre del 2014, Sistema Nacional de Áreas de Conservación (SINAC) requested authorization to use 3 vacant special-services positions to continue implementing Loan Agreement N° 1824/OC-CR for the purpose of financing Programo de Turismo en áreas Silvestres Protegidas.
22. Under agreement number 10775 adopted at Ordinary Session N° 10-2014 of 21 de noviembre del 2014, Autoridad Presupuestaria authorized the use of those positions. (According to documentation entered into the record.)
23. By official letter number FCTM-ICOMVIS-194-2015 dated 7 de abril del 2015, Dr. Eduardo Carrillo, Director of Instituto Internacional de Manejo de Vida Silvestre de la Universidad Nacional, sent a letter to the Director of Área de Conservación Osa –ACOSA– stating, among other matters, that: “It should be noted that our data (which began to be collected in 1990) show a substantial decline in the populations of white-lipped peccaries (Tayassu pecari) and jaguars (Panthera onca) [I am attaching the corresponding charts for the two aforementioned species]. This is not a new situation; it has been communicated to you through various means since abril del 2010, beginning with the meeting we held in Puerto Jiménez, where we presented the results of our research up to that time.” (Page 94 of the initial petition.)
24. By official letter number DM-250-2015 dated 23 de marzo de 2015, MINAE submitted a request to Sistema Nacional de Áreas de Conservación (SINAC) seeking the following: “Exempt SINAC from the application of Presidential Directive N.° 14-H, which was in force at the time of the request. Create 64 new positions as follows: 20 positions for 2015, 30 for 2016, and 14 positions for 2017. Include in the budget 386 positions financed with resources from Fondo Nacional de Parques, to be covered by Presupuesto Ordinario de la Republica, proposing that they be transferred as follows: 70 positions in 2015, 145 in 2016, 129 in 2017, and 106 in 2018, for a total of 450 positions.” (According to the report of Ministerio de Hacienda.)
25. By official letters Nos. SINAC-SE-GDRH-770 and SINAC-SE-DGRH-832, SINAC requested authorization from Secretaría Técnica de la Autoridad Presupuestaria (STAP) to use 2 vacant positions. (According to the report of Ministerio de Hacienda.)
26. Secretaría Técnica de la Autoridad Presupuestaria (STAP) responded to the foregoing by official letter No. STAP-2677-2014 dated 13 de noviembre de 2014, authorizing the use of those vacant positions because they were funded through “Fondo de Parques Nacionales,” that is, from the institution’s own resources. (According to the report of Ministerio de Hacienda.)
27. By official letter number ICOMVIS-D-132-2012 dated 20 de noviembre de 2014, Dr. Carrillo, Director of ICOMVIS, together with M.S. Alvaro Ugalde Víquez, a leading advocate for the creation of the national park system in Costa Rica, sent a letter to the Minister and Vice Minister of MINAE and the Executive Director of Sistema de Áreas de Conservación. The letter addressed the deteriorated condition of the Park and Reserva Golfo Dulce, particularly the considerable reduction in staffing in these two areas, the drastic decline in white-lipped peccary and jaguar populations due to hunting, the increase in gold mining, and the presence of crops within the Park, and presented 12 requests for resolving the situation. (Page 57 of the initial petition.)
28. By official letter STAP-2774-2014 dated 25 de noviembre del 2014, the Executive Director of the STAP informed SINAC of agreement number 10775, adopted by the Autoridad Presupuestaria at Ordinary Session number 10-2014, authorizing the use of the 3 vacant special-services positions (plazas por servicios especiales), from 1 de B1 through 30 de junio del 2015. (according to the report of the Ministerio de Hacienda) 29. By official letter No. STAP-0526-2015 dated 09 de abril de 2015, the STAP responded to MINAE—with a copy to SINAC—indicating that the Executive Branch was implementing Presidential Directives 09-H and 14-H because of the country’s difficult fiscal situation and that resources therefore had to be allocated based on priorities to ensure better use thereof. (according to the report of the Ministerio de Hacienda) 30. By resolution number 575-15 of 9:00 hours on 20 de abril del 2015, the Office of the Ministerio de Seguridad Pública ordered the ejectment (lanzamiento) of the occupants of the unregistered property (finca sin inscribir) depicted on cadastral plans (planos catastrados) P-2732250 and P-279308-95, located in Puntarenas, Boca Ganado, Reserva Forestal Golfo Dulce.

By official letter SINAC-SE-GIDRH-309 dated 21 de abril de 2015, in compliance with agreement N° 10 from Ordinary Session N° 11-2014 of 24 de noviembre de 2014, Miriam Valerio Bolaños requested that the regional directors provide justification for creating new positions and explain the need to unfreeze vacant SINAC positions. (According to the report of the Sistema Nacional de Área de Conservación (SINAC) of the Ministerio de Ambiente y Energía) 32. According to official letter SINAC-ACOSA-D-107-15 dated 29 de abril de 2015, Etilma Morales Mora, in her capacity as Director of ACOSA, responded to the request made in official letter SINAC-SE-GIDRH-309 dated 21 de abril de 2015. (According to the report of the Sistema Nacional de Área de Conservación (SINAC) of the Ministerio de Ambiente y Energía) 33. By official letter N° DE-0375-2015 dated 15 de junio del 2015, the Secretaría Técnica de la Autoridad Presupuestaria informed the Ministerio de Ambiente y Energía and the Sistema Nacional de Áreas de Conservación that, pursuant to Article 13 of Presidential Directive N°.023-H, the use of 13 vacant positions was authorized in order to provide the various substantive services furnished by SINAC in the country’s different Áreas de Conservación.
(according to the report of the Ministerio de Hacienda) 34. On 16 de junio de 2015, MINAE sent official letter No. DM-0498-2015 in response to official letter STAP-0526-2015, providing additional information regarding the creation of 20 permanent positions (plazas por cargos fijos) for the Sistema Nacional de Áreas de Conservación. (according to the report of the Ministerio de Hacienda) 35. According to official letter SINAC-DE-1038 dated 07 de julio de 2015, Dr. Julio Jurado Fernández, Executive Director of SINAC, submitted an expanded justification for the 20 positions to be created for Área de Conservación Osa, in fulfillment of the target established in the Plan Nacional de Desarrollo for the 2015-2018 period. (According to the report of the Sistema Nacional de Área de Conservación (SINAC) of the Ministerio de Ambiente y Energía) 36. By official letter number DE-0325-2015 dated 7 de julio del 2015, the Secretaría Técnica de la Autoridad Presupuestaria requested that the Dirección General de Presupuesto Nacional issue its opinion regarding the creation of 20 positions for the Sistema Nacional de Áreas de Conservación (SINAC) for 2015, so that the matter could be submitted to the Autoridad Prespuestaria.
(according to the report of the Ministerio de Hacienda) 37. By Agreement No. 11084 from Ordinary Session 07-2015 of 27 de julio de 2015, the Autoridad Presupuestaria authorized the use of 13 vacant positions because SINAC, through official letters Nos. SINAC-SE-GIRH-674 and 712, stated that Nos. 503187 and 56539, included therein, would be used in accordance with Article 12 of Presidential Directive 023-H. (according to the report of the Ministerio de Hacienda) 38. By official letter No. STAP-1409-2015 dated 29 de julio de 2015, the STAP informed SINAC of agreement number 11084 from Ordinary Session 07-2015 of 27 de julio de 2015 regarding the use of the 15 positions that had become vacant. (according to the report of the Ministerio de Hacienda). III.- UNPROVEN FACTS. The following facts relevant to the resolution of this matter are not deemed to have been duly established:
1. That the 20 requested positions were created pursuant to the favorable opinion of the Secretaría Técnica de la Autoridad Presupuestaria, issued through report No. DE-0325-2015 and forwarded on 29 de junio de 2015 by Sonia Herrera Ramírez, Sector Analyst A, to Carlos Mena Rodríguez, Sector Head A, both of the aforementioned Secretaría.
2. That the eviction (desalojo) and ejectment of the occupants of the unregistered property depicted on cadastral plans P-2732250 and P-279308-95, located in Puntarenas, Boca Ganado, Reserva Forestal Golfo Dulce, were carried out as ordered by resolution number 575-15 of 9:00 hours on 20 de abril del 2015, issued by the Office of the Ministerio de Seguridad Pública.
3. That there is an overall shortage of 80 park-ranger positions (plazas de guarda parques) needed to provide a definitive solution to the problems raised.
In judgment No. 2011-03114 of 9:03 hrs. on 11 de marzo de 2011, this Chamber ruled as follows:
“II.- The right to a healthy and ecologically balanced environment. Article fifty of the Constitución Política establishes every person’s right to a healthy and ecologically balanced environment as a fundamental right. Even before Article 50 was amended to expressly address environmental matters, the Chamber, through its case law, had derived this right from the constitutional provisions contained in Articles 21—the right to life and health—69—the rational use of land—and 89—the protection of natural beauty. The Chamber has adopted a broad, or macro-level, view of the concept of the environment and the protection afforded to it, extending beyond the basic or primary protection of soil, air, water, marine and coastal resources, minerals, forests, plant and animal diversity, and landscapes to include elements relating to the economy, the generation of foreign currency through tourism, agricultural production, and other matters. Thus, in judgment number 5893-095, issued at nine hours and forty-eight minutes on 27 de octubre de 1993, the Chamber held that:
“[E]nvironmental law (Derecho Ambiental) should not be associated solely with nature, since nature is only part of the environment. Nature-protection policy also extends to other matters, such as the protection of hunting, forests, natural parks, and natural resources. It is therefore a macro-environmental concept, intended to avoid excluding important concepts and thereby unify the body of law that we call environmental law.”
III.The State’s duty to protect the environment. The amendment of constitutional Article 50, which expressly enshrined the environmental right as a fundamental right, also unequivocally established the State’s obligation to guarantee, defend, and protect that right, thereby making the State the guarantor of the protection and safeguarding of the environment and natural resources. It is pursuant to this provision, in conjunction with Articles 20, 69, and 89 of the Constitución Política, that the State’s responsibility to exercise a protective and governing role in this field was derived, as provided by the constitutional rule under discussion—a role implemented through environmental legislation. The constitutional mandate thus establishes the State’s duty to guarantee, defend, and preserve that right. In this connection, it must be noted that the applicable legislation designates the Ministerio del Ambiente y Energía as the governing body for the natural-resources, energy, and mining sector, as provided in Article 2 of the Ley Orgánica of that Ministry, number 7152, of 4 de junio de 1990.
In the Chamber’s view, this governing role in environmental matters encompasses not only the establishment of appropriate regulations for the use of forest resources and natural resources, as also provided in Article 56 of the Ley Orgánica del Ambiente, but also confers upon it the important responsibility of exercising leadership in environmental matters, which entails maintaining a predominant role in this field. In this respect, the oversight and inspection of environmental matters and activities constitute an essential function of the State under Article 50 of the Constitution, whose third paragraph provides, insofar as relevant: “The State shall guarantee, defend, and preserve that right.” This is consistent with the constitutional principle established in the second paragraph of Article 9 of the Constitución Política, which expressly prohibits the Branches of Government from delegating the exercise of their own functions, particularly when those functions are essential.
Accordingly, with respect to environmental protection, the State, acting through its various administrative agencies, is responsible for the governance, oversight, and inspection of environmental matters.
IV.Prevention of environmental risk. Since this obligation of the State is established at the constitutional level, it is important to consider how international human-rights instruments also establish specific obligations that must be observed. In environmental matters, a duty of prevention has been defined; the Rio Declaration, adopted at the United Nations Conference on Environment and Development, provides:
“Principle 15.- In order to protect the environment, States shall widely apply the precautionary approach (criterio de precaución) according to their capabilities. Where there is a threat of serious and irreversible harm, a lack of full scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.” Prevention seeks to anticipate adverse effects and ensure the protection, conservation, and proper management of resources. Consequently, the governing principle of prevention (principio rector de prevención) is based on the need to take and implement every precautionary measure required to avoid or contain potential harm to the environment or human health. Thus, where there is a risk of serious or irreversible harm—or uncertainty in that regard—a precautionary measure must be adopted, including, where appropriate, postponement of the activity in question.
This is because, in environmental matters, after-the-fact enforcement is ineffective: once harm has occurred, the biologically and socially harmful consequences may be irreparable. Punitive action may carry moral significance, but it is unlikely to compensate for the damage caused to the environment. As stated both in the cited international instrument and in constitutional Article fifty itself, the State is charged with carrying out this preventive function, as this Chamber recognized in judgment number 2001-6503 of 6 de julio de 2001, holding that:
“The third paragraph of Article 50 of the Constitution states with absolute clarity that the State must guarantee, defend, and preserve every person’s right to a healthy and ecologically balanced environment; this means that public entities are not only obligated to enforce environmental legislation with respect to private parties and other public entities, but also, and above all, must conform their own actions to the provisions of those protective bodies of law. State institutions are the first called upon to comply with protective environmental legislation, and there is no justification whatsoever for exempting them from compliance with environmental requirements such as, for example, the environmental impact study (estudio de impacto ambiental) required by the Ley Orgánica del Ambiente for activities undertaken by public entities that, by their nature, may alter or destroy the environment.” (emphasis added)
V.Coordination among public institutions in the comprehensive protection of the environment. The State—as a whole—is obligated to take the measures necessary to protect the environment, in order to prevent levels of pollution, deforestation, extinction of flora and fauna, and excessive or improper use of natural resources that endanger the health of the governed population. For purposes of this task, public institutions include both the Central Administration—Ministries such as the Ministerio del Ambiente y Energía and the Ministerio de Salud, which, by reason of their subject matter, have extensive involvement and responsibility with regard to environmental conservation and preservation and which most often act through their specialized departments, such as the Dirección General de Vida Silvestre, the Dirección Forestal, and the Secretaría Técnica Nacional Ambiental (SETENA)—and decentralized institutions such as the Instituto Nacional de Vivienda y Urbanismo, SENARA, the Instituto Costarricense de Turismo, and the Instituto Costarricense de Acueductos y Alcantarillados.
Municipalities likewise bear substantial responsibility for this task within their territorial jurisdiction. Given the diversity of actors that may be involved, one might think that this shared responsibility would cause chaos in administrative management. Therefore, to prevent the simultaneous coexistence of spheres of authority having different origins and natures, the duplication of national and local efforts, and confusion regarding the rights and obligations of the various parties involved, it is necessary to establish a series of coordinating relationships among the various agencies of the Executive Branch and decentralized institutions, and between those institutions and the municipalities, so that they may carry out the functions entrusted to them. This Chamber has previously addressed the principle of coordination between public agencies and municipalities in pursuing common purposes, stating in judgment number 5445-99, issued at fourteen hours thirty minutes on July 14, 1999, that:
“[C]oordination is the ordering of the relationships among these various independent activities, taking account of their convergence upon the same object or entity so as to make it useful to an overall public plan, without eliminating the mutual independence of the acting entities. Because there is no hierarchical relationship among decentralized institutions, or between the State itself and the municipalities, particular conduct cannot be imposed upon the latter; hence the indispensable need for interinstitutional ‘concerted action’ in the strict sense, whereby autonomous and independent centers of action agree upon that preventive and comprehensive framework, within which each fulfills a role with a view toward a mission entrusted to the others. Thus, relations between municipalities and other public entities may be conducted only on an equal footing, resulting in agreed forms of coordination and excluding any mandatory arrangement detrimental to their autonomy that would subject corporate entities to a coordination framework without or against their consent; this nevertheless allows for the necessary subordination of those entities to the State and in the State’s interest (through the State’s ‘administrative oversight’ (tutela administrativa), specifically its function of reviewing legality, with powers of general supervision over the entire sector).” Furthermore, failures to fulfill the duty to protect the environment and comply with environmental regulations are constitutionally significant because the Administration’s inaction in this area may cause harm to the environment and natural resources, sometimes with consequences similar to or greater than those resulting from the Administration’s actions.
Examples include authorizing land-use plans (planes reguladores) or construction projects without SETENA’s approval of the environmental impact study; failure by the Dirección General de Vida Silvestre of the Ministerio del Ambiente y Energía to monitor and supervise the implementation of management plans (planes de manejo) for protected areas (áreas protegidas); allowing companies to operate without the required health permits regarding wastewater treatment—the Instituto Costarricense de Acueductos y Alcantarillados and the Ministerio de Salud—or failure to verify noise controls in bars, restaurants, or event venues—the municipalities and the Ministerio de Salud.
VI.The role of municipalities in environmental matters. In accordance with the foregoing, municipalities, as integral components of the whole that is the State, bear substantial responsibility for environmental matters within the scope of their powers and obligations, whether by directly approving permits or licenses for which prior compliance with requirements demonstrating proper environmental management to other public authorities is required, or through regular inspections and referral of hazardous situations to the authorities having greater powers of intervention. It has already been established that local governments are subject to the obligation of environmental coordination and prevention within their territorial jurisdiction; municipalities are therefore clearly important actors in the task of protecting the environment. Local governments unquestionably have the authority to establish their own land-use planning (ordenación territorial) through land-use plans; however, the existence of such plans—most of which lack planning components addressing a healthy and ecologically balanced environment—does not render protective environmental legislation inapplicable.
On the contrary, the Chamber considers it a fundamental requirement, one that does not infringe the constitutional principle of municipal autonomy, that every land-use plan, before being approved and implemented, undergo an environmental impact assessment (examen del impacto ambiental) from the perspective established by Article 50 of the Constitution, so that land-use regulation and its various regimes are compatible with the scope of the higher-ranking provision. This is particularly important because that provision establishes the right of all inhabitants to receive an environmentally responsive decision from all public authorities, undoubtedly including municipalities, which are not exempt from application of the constitutional provision and its implementing legislation. It is evident that national and local interests fully coincide in this instance; accordingly, local governments may and must require compliance with environmental requirements within their territory and, in the event of a conflict with the authorities governing environmental matters, may submit the disputes to the appropriate judicial review body according to the nature of the violation.
For this reason, environmental protection provisions are not constitutionally incompatible with the powers and authority of municipalities, which are obligated, by mandate of Article 50 of the Constitución Política, to devote themselves to protecting the environment—see, in this regard, judgment number 2006-7994, issued at eight hours fifty-seven minutes on June 2, 2006—.” (criterion reiterated in judgment No. 2016002830 at 09:30 hours on February 26, 2016)
From the review of the case record and the reports submitted under oath, the Chamber finds it clearly established that there is a serious environmental problem, as alleged by the appellant, concerning the illegal activities of gold mining (orería), hunting (caza), logging (tala), and timber theft (robo de madera) carried out within the protected areas (áreas protegidas) of Parque Nacional de Corcovado and Reserva Golfo Dulce. This Chamber notes the numerous measures undertaken in connection with this problem, as well as various actions by the authorities intended to ensure the proper safeguarding, securing, protection, and conservation of natural resources in order to prevent possible harm to the environment. Thus, for example, it has been confirmed that in abril de 2013, the Sistema Nacional de Áreas de Conservación conducted an assessment of the incursion of gold miners into Parque Nacional Corcovado and, as a result, that same month carried out the first special operation, called “ORO VERDE UNO,” through which it detected 34 active gold-mining operations, 29 inactive operations, and 15 camps, primarily in the areas of Río Claro, Río Madrigal, Río Rincón, and Río Tigre, within an area of 16 hectares.
A projection of the damage caused was also prepared; it was estimated at 9556 square meters, that is, approximately 15638 cubic meters disturbed by gold extraction, and it was therefore estimated that there could have been 130 people working in the affected area. According to the respondent authorities, based on that report the State invested 15.000.000 million colones to begin making decisions regarding the expansion of control and protection measures that could minimize the impact identified in the amparo proceeding (amparo). In this regard, it was established that Área de Conservación Osa (ACOSA), together with the Secretaría Ejecutiva del SINAC and the Despacho del Viceministro de Ambiente, increased the number of special operations conducted with the support of the Fuerza Pública during the period from 2013 to 2015 to a total of 7 operations, and expanded control measures to minimize the aforementioned impacts, carrying out 1243 control actions, as well as 9 on-site inspections (inspecciones oculares) with judges or officers; responding to 289 complaints; conducting 1 inspection concerning the keeping of wildlife, rescue centers, wildlife breeding facilities, and zoos; performing 2 inspections of commercial establishments, 39 highway operations, and 62 operations in marine areas; conducting 733 reconnaissance and control patrols; and staffing 78 fixed posts, among other actions.
Likewise, during the period from 2013 to 2014, Área de Conservación Osa, together with the Secretaría Ejecutiva del SINAC and the Despacho del Viceministro de Ambiente, carried out seizures (decomisos) of machinery and equipment from gold miners, including 33 metal bars, 31 machetes, 18 chupacabras, 22 cateadoras, 11 diving lamps, 41 shovels, 15 flashlights, 2 generators, 4 cell phones, 3 rakes, 15 canoes, 10 grills, 7 jars of gold, 5 two-way radios, one weapon, and other items necessary for gold extraction. With respect to illegal hunting, it was also established that Área de Conservación Osa, SINAC, and MINAE carried out specific control measures and, as they stated, a group of officials stationed at “Centro Operativo Los Planes” conducts patrols in the lowland sector during the summer, while a support group of officials stationed at Centro Operativo Los Patos patrols another sector of Parque Nacional Corcovado, reinforcing and supporting the control activities carried out by “Centro Operático Los Planes.” It was confirmed that SINAC conducted “Operativo Águila Arpía” from 21 de enero al 4 de febrero del 2015 and another special operation during Semana Santa of that same year in Corcovado, and coordinated with Policía de Fronteras and Unidad Especial de Zapadores de la Fuerza Pública to address the problem.
Regarding logging and timber theft in both reserves, it was established that Área de Conservación de OSA (ACOSA), together with SINAC and the Despacho del Viceministro de Ambiente, took action. According to the information provided, Centro Operativo Rancho Quemado, which is responsible for addressing timber theft, has a permanent staff of 6 enforcement officials and has made efforts to reinforce that group. Thus, Plan de Control 2014 established control activities to minimize the impact of illegal logging in Reserva Forestal Golfo Dulce. In this regard, SINAC developed the project called “Manejo Forestal y Certificación del origen legal de Madera” (MAFOR-COL), which began in agosto del 2015 for the purpose of combating illegal logging in Reserva Forestal Golfo Dulce by promoting Manejo Forestal Sostenible. It was also confirmed that Plan de Control 2014 established control activities to minimize the impact of illegal logging in Reserva Forestal Golfo Dulce.
In addition, it was established that since 2013 Área de Conservación de Osa (ACOSA), together with SINAC, has arranged for additional supplies for the park rangers stationed at Parque Nacional de Corcovado, including the replacement of the entire weapons arsenal; specifically, each official at Parque Nacional Corcovado was issued an M30-1 carbine. The acquisition of 8 Garmen-brand GPS units with cases, 8 tents, 8 cameras, and 20 hammocks was also arranged. A request was also submitted to Autoridad Presupuestaria to create new positions to serve Reserva Forestal Golfo Dulce and Parque Nacional Corcovado. Finally, it should be added that, according to the respondent authorities, one of the factors contributing to damage and exploitation in the aforementioned protected areas has been unemployment in the region; accordingly, entrepreneurship projects have been pursued since 2013, and contacts were therefore initiated with Fideicomiso de Osa and Fundación Costa Rica-Estados Unidos to develop, specifically at the beginning of 2014, the project called “Caminos de Osa,” whose purpose was to promote the comprehensive development of the communities of Península de Osa by strengthening community-based rural tourism initiatives linked to a network of new trails leading to Parque Nacional Corcovado and incorporating those initiatives into the value chain of national and international tour operators.
According to the consistent case law of this Chamber, it has been clearly established that, pursuant to International Human Rights Law and its development in domestic legislation, constitutional protection has been afforded to every person’s right to a healthy and ecologically balanced environment. This Chamber has adopted a broad form of protection that is not limited to the basic or primary protection of soil, air, water, marine and coastal resources, minerals, forests, the diversity of flora and fauna, and the landscape, but also encompasses elements relating to the economy, the generation of foreign currency through tourism, agricultural exploitation, and the protection of hunting, forests, natural parks, and natural resources, as in the case before us. Furthermore, the cited regulations have also unequivocally established the State’s obligation to guarantee, defend, and preserve every person’s right to a healthy and ecologically balanced environment.
This means that public entities are not only required to ensure that private parties and other public entities comply with environmental legislation, but, first and foremost, must align their own conduct with the mandates of those protective bodies of law. In view of that obligation, it should be added that the decrees underlying the creation of Parque Nacional de Corcovado, the Península de Osa area, and Reserva Forestal Golfo Dulce—respectively, Decreto Ejecutivo No. 5357-A, published in La Gaceta No. 207 of 31 de octubre de 1975, and Decreto Ejecutivo No. 8494-A, published in La Gaceta No. 104 of 1 de junio de 1978—clearly established that the duties of the Costa Rican State included the obligation to safeguard the protection, use, conservation, and promotion of the country’s forest resources, as well as to conserve those areas of the country possessing natural or cultural resources of exceptional importance.
Accordingly, among the considerations taken into account in creating Parque Nacional de Corcovado, the lawmakers indicated that scientists from around the world considered that watershed (cuenca) to be one of the humid tropical areas richest in flora, fauna, and natural ecosystems. Although the area had remained undisturbed for a long time because of its isolation, by the time the park was created, the destructive exploitation of its natural resources threatened to eliminate all its biological wealth. The establishment of that National Park would therefore ensure that this important part of the Cultural Heritage would provide lasting educational, research, inspirational, and recreational benefits to present and future generations of Costa Ricans. Likewise, with respect to the present Reserva Forestal Golfo Dulce, the lawmaker considered that the hills surrounding Golfo Dulce and located in Península de Osa were unsuitable for agriculture or livestock farming because of their topography and soil conditions, but that their most appropriate use would be the rational exploitation of forest resources while also protecting the watersheds that supplied water to the area’s agricultural lands.
It was further emphasized that most of those lands still had their forests intact, that those forests contained a large number of trees of high commercial value, and that they had the capacity for rapid regeneration in areas managed for sustained yield. The lawmaker further stated that the rational exploitation of those forests under an orderly sustained-yield plan regulated by the Dirección General Forestal could provide the foundation for developing a timber industry that could create jobs and improve living conditions for the people of the area. This Chamber finds it clear that the Costa Rican State, represented by its various public institutions and acting in accordance with the principle of coordination already addressed in the case law, is required to adopt appropriate and necessary measures to preserve the integrity of the Park and the Forest Reserve at issue in this proceeding and to guarantee their use and enjoyment by future generations.
Nevertheless, according to the facts deemed proven in this case, and despite the original intent of the aforementioned decrees, a serious environmental problem currently exists as a result of illegal gold mining, hunting, logging, and timber theft within the protected areas of Parque Nacional de Corcovado and Reserva Forestal Golfo Dulce. In this regard, the detailed review undertaken by this Chamber reveals the substantial number of actions and measures adopted by the respondent authorities to address the aforementioned problem, including various enforcement operations and seizures, an increase in personnel, and the allocation of various resources to the responsible officials and institutions, such as the provision of weapons to park rangers (guardaparques). This Chamber unquestionably acknowledges all of those efforts, but unfortunately they have proven insufficient to provide a complete and permanent solution to the problem described.
It should also be added that, although the authorities of the Sistema Nacional de Áreas de Conservación have stated that one of the factors triggering the challenged situation is the social problem of unemployment among the area’s residents, and that they have therefore also undertaken various initiatives to alleviate it, this Chamber considers that the existence of this problem in the region need not be addressed at the expense of, to the detriment of, or through the sacrifice of the Park and the Forest Reserve. Such an approach leads to an even greater problem: failure to comply with constitutional provisions and international instruments that expressly guarantee the fundamental rights of present and future generations. Thus, given the aforementioned obligation of State institutions, under which they are the first entities called upon to comply with protective environmental legislation, no justification—such as the insufficiency of the measures adopted or the assertion that the aforementioned social problem prevents resolution of the matter—can excuse them from such compliance.
A comprehensive solution to the challenged problem requires a properly coordinated institutional presence capable of guaranteeing permanent monitoring and protection in both Parque Nacional Corcovado and Reserva Forestal Golfo Dulce. It must adopt all necessary measures, including, for example, conducting permanent and strategic enforcement operations, increasing the number of positions in accordance with the requests made by the environmental administration, and providing current and any future park rangers with appropriate and adequate supplies. Accordingly, this Chamber considers that one of the fundamental steps toward resolving the identified problem is ensuring that the respondent authorities have adequate resources to fulfill their legal duties. Thus, although it was reported that park rangers have been provided with some equipment to perform their work, this Court also considers such equipment to be the bare minimum necessary for them to discharge their duties effectively as public officials.
The respondent authorities must therefore provide these officials with the necessary supplies to ensure the effective performance of their work, including even the use of new technologies, although this Chamber cannot determine what specific tools or work equipment must be supplied. Moreover, it should be noted that one of the specific measures taken by the authorities of the Ministerio de Seguridad Pública was the issuance of resolution number 575-15 at 9:00 hours on 20 de abril del 2015, by which that Ministry ordered the eviction (lanzamiento) of the occupants of the unregistered property depicted in cadastral plans P-2732250 and P-279308-95, located in Puntarenas, Boca Ganado, Reserva Forestal Golfo Dulce. However, that Ministry also informed this Chamber that, in response to a petition filed by the Asesora Legal Región Brunca del Instituto de Desarrollo Rural (INDER), it requested the suspension of the ordered eviction on 28 de setiembre del 2016, and the suspension was therefore granted.
As of this date—more than one year later—there is no record of any action establishing that the aforementioned Ministry has resumed the eviction proceedings or enforced the resolution cited herein. In light of the foregoing, this Chamber considers that the authorities of the Ministerio de Seguridad Pública must immediately take the necessary actions within the scope of their powers to ensure the continuation of the eviction proceeding initiated under eviction expediente 3330-14, in order to determine the legally appropriate course of action concerning the eviction order issued in the aforementioned resolution number 575-15 or, if applicable, to commence new eviction proceedings should these be deemed necessary. With respect to the foregoing, that Ministry must take and carry out whatever actions it considers appropriate and necessary to ensure faithful compliance with any eviction orders issued and to preserve the effects of their enforcement.
Likewise, the Ministerio de Seguridad Pública and the environmental authorities must jointly determine and define the measures deemed appropriate to ensure full implementation of the permanent monitoring and protection plan for Parque Nacional de Corcovado and Reserva Golfo Dulce. Furthermore, as established by the statements made by the respondent authorities, sufficient personnel are currently needed to perform the duties assigned to them. In this regard, according to the Ministro de Hacienda, it has not been possible to establish the number of personnel required, and compliance with the aforementioned institutional duty cannot be based on calculations that lack technical support or fail to ensure the availability of budgetary resources guaranteeing payment of the corresponding salaries. Nevertheless, the evidence submitted to the record shows that approval has been requested for 20 park-ranger positions.
In this regard, this Chamber considers that the corresponding technical study must be conducted to determine and justify the creation of a specified number of positions, while ensuring that the new officials assigned to those positions receive not only their salaries, as required by law, but also the supplies necessary to perform their duties properly, in furtherance of the obligations imposed on the Costa Rican State by the Constitution, International Human Rights Law, and statute.
As a corollary to the foregoing, the petition must be granted.
Justices Jinesta Lobo and Salazar Alvarado dissent and would deny the petition for the following reasons:
IX.DISSENTING OPINION (VOTO SALVADO) OF JUSTICE HERNÁNDEZ LÓPEZ REGARDING THE CLAIM ALLEGING A VIOLATION OF ARTICLE 50 OF THE POLITICAL CONSTITUTION.
1. The historical context that prompted the Chamber’s extensive involvement in environmental matters has changed considerably, requiring this body to reconsider the conditions governing its participation in safeguarding the right of individuals to a healthy and balanced environment, as protected by Article 50 of the Political Constitution. Indeed, the current situation—characterized by an extraordinarily extensive body of statutes and regulations that includes substantive rules, procedures, and the creation of bodies charged with implementing the Fundamental Charter—is radically different from the prior situation, in which the absence of rules and state bodies with appropriate jurisdiction compelled the Chamber to play a leading, almost exclusive, role in defending the aforementioned constitutional right.
2. Today, we face a “dense web” of environmental rules—as Justice Jinesta Lobo aptly described it in his dissenting opinion on this subject—which has produced two significant developments. The first and most obvious is the emergence of comprehensive legal regulation governing activities whose environmental impact previously was subject to little or no regulation, as well as the creation of state bodies with powers to monitor and control the effects of human activity on the environment. The second development is that this increasing juridification (juridificación)—predominantly through statutes and regulations—necessarily brings both administrative justice and the ordinary jurisdiction into play, primarily the administrative courts but also the criminal courts. In keeping with the importance of environmental law, those jurisdictions have been provided with broad procedural avenues and inclusive standing mechanisms (medios de legitimación), so that persons subject to government authority may enforce the provisions of the extensive body of law concerning environmental matters.
3. In this context, it is neither legally nor functionally appropriate for the Constitutional Chamber to displace—or, worse yet, replace—the ordinary judicial bodies in performing their task, itself constitutional in rank, of ensuring effective compliance with statutes and regulations. It is legally improper because, in the vast majority of these cases, the Chamber is asked to interpret and enforce statutory and regulatory provisions, thereby risking an overlap between its jurisdiction and that of other judicial bodies that, unlike the Chamber, were specifically created to perform such tasks. It is also functionally inappropriate because the design of its proceedings is ill-suited to the complexity of the many environmental disputes composed of sequences of technically and legally complex facts and acts. There are well-known examples involving both issues in which the Chamber has issued a partial or technically incomplete decision, or in which unnecessary friction and harm to legal certainty have resulted.
4. Among the technical considerations I have assessed, I would add that this jurisdiction lacks judges responsible for enforcing judgments (jueces ejecutores de sentencia), who could provide appropriate follow-up for those judgments—which are generally complex and sometimes require monitoring remedial plans, among other measures, with interinstitutional coordination and oversight lasting months or even years.
5. From that perspective, this Court’s decision to step aside in environmental matters should not be viewed as an abandonment of environmental matters, but rather, to the contrary, as ensuring their proper protection before the forum best suited to the nature of their complexity and diversity. Nor should it be viewed as this Court’s relinquishment of its duty to protect the constitutional rights imposed upon it by the Constitución Política and its Ley Orgánica, which, in my view, remains reserved in this area for specific cases. Rather, it is an exercise in reallocating the responsibilities and duties of the various State bodies, so that each may fully carry out its work within the sphere assigned to it, as well as an exercise in determining its own jurisdiction, as established by Article 7 of its Ley Orgánica.
6. It is clear that the Chamber does not intend to leave the protection of individuals’ environmental rights to other jurisdictions. It is well known that, although any claim alleging a violation of statutory or regulatory provisions may ultimately be brought within the constitutional sphere, there are cases whose resolution requires nothing more than the application of constitutional law (derecho de la Constitución). The objective, therefore, is for the Chamber to become one of several leading participants, so that—collectively, and each within its own sphere—the full range of circumstances arising in the protection of the right to a healthy and ecologically balanced environment may be addressed within a society in which other equally pressing needs also exist. With this position, I firmly believe that citizens do not lose the slightest degree of protection, while substantial gains are made in breadth, perspective, and respect for the balance and distribution of powers, the latter being a principle that must necessarily be considered because it governs the constitutional dynamics of any liberal and democratic system such as ours.- 7.
Consistent with the foregoing, I maintain that this Chamber should refrain from hearing claims brought before it for alleged violations of Article 50 of the Constitución Política, leaving such matters to administrative justice and the contentious-administrative jurisdiction (jurisdicción contenciosa administrativa). The foregoing is stated as a general rule, without prejudice to recognizing that there are particular cases or categories of cases which, in my judgment, would still be better protected by this Chamber and therefore should be heard and decided by it.- Such categories of cases, without this enumeration being regarded as a closed and definitive list, include, for example, claims concerning environmental violations that also directly endanger human health or the access to or quality of water; cases involving blatant and direct violations of the environment in which there is a manifest absence of protection by State authorities, provided also that the nature of the claim permits it to be addressed through the remedy of amparo (amparo) as a summary and special procedural mechanism, since I believe that the amparo proceeding should not be converted into an ordinary proceeding in order to address, even in the cases cited above, matters exceeding its capacity to deal with them adequately.
8. In this specific case, according to the established facts, none of the exceptions mentioned is present, and the situation raised falls within those cases in which recourse to the protective mechanisms of the Administration and the ordinary courts provides a broader and more comprehensive avenue for addressing the matter at issue, which involves a serious and extensive problem to which the issuance of a judgment granting relief by this Court would add little.- On the contrary, it is evident that coordinated intervention by numerous authorities is required, based on an assessment of the advantages and disadvantages of each course of action, which requires extensive evidence, monitoring, and studies exceeding the scope of the amparo proceeding. Accordingly, Article 9 of the Ley de la Jurisdicción Constitucional should have been applied and the petition summarily dismissed; nevertheless, because that did not occur, the appropriate course now is to deny the petition for amparo.
The parties are hereby advised that, if they submitted any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, such materials must be retrieved from the court office within a maximum period of 30 business days following notification of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as pursuant to the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.
POR TANTO:
The petition is granted. JULIO JURADO FERNÁNDEZ, in his capacity as Director Ejecutivo del Sistema Nacional de Área de Conservación (SINAC) del Ministerio de Ambiente y Energía; ÓLGER MÉNDEZ FALLAS, in his capacity as Director del Área de Conservación de Osa del Sistema Nacional de Áreas de Conservación (SINAC); ÉDGAR E. GUTIÉRREZ ESPELETA, in his capacity as Ministro de Ambiente y Energía; HELIO FALLAS, in his capacity as Ministro de Hacienda; and LUIS GUSTAVO MATA VEGA, in his capacity as Ministro de Seguridad Pública, or whoever holds their respective offices, are ordered, within two months following notification of this judgment, to coordinate the necessary measures for the preparation and implementation of a plan guaranteeing the permanent surveillance and protection of Parque Nacional de Corcovado and Reserva Forestal Golfo Dulce against illegal gold mining, hunting, logging, and timber theft.
Likewise, the Ministerio de Seguridad Pública shall immediately take the necessary actions within the scope of its authority to ensure the continuation of the eviction proceedings (proceso de desalojo) instituted under expediente No. 3330-14, as well as any other new proceedings necessary to evict trespassers engaged in illegal gold mining, hunting, and logging. The respondents are warned that failure to comply with this order could constitute the offense of disobedience and that, pursuant to Article 71 of the Ley la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years, or a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. The State is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction.

Recurso de amparo interpuesto por MAURICIO ÁLVAREZ MORA, cédula de identidad número 1-877-217, representante de la FEDERACIÓN COSTARRICENSE PARA LA CONSERVACIÓN DEL AMBIENTE, ROBERTO MOLINA UGALDE, cédula de identidad número 5-195-151, secretario general de la ASOCIACIÓN SINDICAL DE TRABAJADORES DEL MINAE, LUIS DIEGO MARÍN SCHUMACHER, cédula de identidad número 1-753-303, presidente de la ASOCIACIÓN PRESERVE PLANET, EDUARDO JOAQUÍN CARRILLO JIMÉNEZ, cédula de identidad número 1-575-493, LUCIANO CAPELLI CALANCA, JAZMÍN ROSS LEMUS, GRACE WONG REYES, cédula de identidad número 6-165-096, y, MARIO ANDRÉS BOZA LORÍA, cédula de identidad número 1-297-932; contra el MINISTERIO DE AMBIENTE Y ENERGÍA y el MINISTERIO DE HACIENDA.
RESULTANDO:
“A Edgar Gutiérrez Espoleta, Ministro de Ambiente y Energía:
a. En el plazo de un mes a partir de la notificación de la presente sentencia organizar y ejecutar un operativo especial para expulsar del Parque Nacional Corcovado y de la Reserva Forestal Golfo Dulce, a todas las personas que lo han invadido con el propósito de integrando personal de otras áreas protegidas del país a la zona en conflicto.
b. Para estos efectos, el MINAE deberá asumir la coordinación institucional de dicho operativo con las demás dependencias del Estado e instituciones competentes y podrá recurrir, de ser necesario, a medidas excepcionales como una declaratoria de emergencia o un cierre temporal de las áreas afectadas con la finalidad de garantizar que los guardaparques -junto con oficiales de la fuerza pública- puedan concentrarse en la erradicación de actividades ilegales, así como asegurar las demás condiciones y los recursos necesarios para llevar a cabo con éxito dicho operativo.
c. En el plazo de tres meses a partir de la notificación de esta resolución adoptar con carácter de urgencia las medidas necesarias para dotar a los guardaparques o agentes de seguridad y vigilancia, que protegen al Parque Corcovado y a la Reserva Golfo Dulce del equipo necesario que proteja su integridad física y que les permita cumplir eficientemente con su trabajo de control y protección. Este equipo debe estar constituido por revólveres y rifles de reglamento, medios de transporte, cartucheras, chalecos antibalas, uniformes de campo, botiquines de primeros auxilios, botas tácticas, capas, mochilas, anteojos para sol, guantes tácticos, gas pimienta, armas de defensa, cámaras fotográficas, teléfonos celulares y satelitales, binoculares, focos tácticos, aparatos de posicionamiento global (GPSs), visores nocturnos, esposas, salveques, utensilios para montaña y cintas para decomisos.
d. Tramitar las modificaciones presupuestarias e incluir las partidas respectivas en los próximos presupuestos ordinarios o extraordinarios de la República que sean necesarias para dotar al Parque Nacional Corcovado y a la Reserva Forestal Golfo Dulce de los recursos económicos y materiales requeridos para proteger los ecosistemas y combatir la minería ilegal, la caza ilegal y el robo de madera.
A Luis Guillermo Mata Vega, Ministro de Seguridad Pública:
a. Coordinar con el Ministro de Ambiente y Energía la realización regular de operativos, en los que participen los guardaparques junto con efectivos de este Ministerio. Para este propósito se debe asignar para cada operativo el número suficiente de efectivos de la Fuerza Pública como para solucionar el problema en un plazo no mayor de un mes. Estas acciones deben estar apoyadas por los equipos y materiales necesarios y por el transporte aéreo que facilite y haga más efectiva la operación.
b. Una vez concluida la expulsión de todos los oreros, cazadores furtivos y madereros que han invadido el Parque y la Reserva, destinar un mínimo de 20 efectivos de la Fuerza Pública para que permanezcan en ambas áreas protegidas durante al menos un año c. para evitar nuevas invasiones en los ríos y en las áreas en los cuales los oreros hayan sido expulsados.
A Helio Fallas Venegas, Ministro de Hacienda:
a. En el plazo de tres meses a partir de la notificación de esta sentencia adoptar las medidas que sean necesarias para autorizar al Ministerio de Ambiente y Energía a utilizar las plazas que hayan quedado y queden vacantes de agentes de seguridad y vigilancia y a crear nuevas plazas de agentes de seguridad y vigilancia para cubrir de forma gradual y progresiva el faltante de 80 guardaparques dedicados a la protección del Parque Nacional Corcovado y la Reserva Forestal Golfo Dulce en el Area de Conservación Osa. Estas medidas incluirán el trámite de las excepciones por razones de urgencia a las directrices presidenciales N° 013-H (publicada en el Alcance Digital N° 13-A a La Gaceta N° 45, el 4 de marzo del 2011) y N° 026-H, (publicada en La Gaceta N° 100 del 25 de mayo del 2011), en vista de la necesidad impostergable de frenar la destrucción del Patrimonio Natural del Estado en el Parque Nacional Corcovado y la Reserva Forestal Golfo Dulce.
b. Tramitar y autorizar los presupuestos y las modificaciones presupuestarias presentadas por el Ministerio de Ambiente y Energía para cumplir con las disposiciones establecidas en los puntos 1 .b) y c) de esta petitoria.
2. Se condene a las autoridades recurridas a la reparación e indemnización integral de los daños y perjuicios ocasionados al ambiente y la vida silvestre por las conductas omisivas y negligentes que motivan el presente recurso. La cuantía de estos daños y las medidas de reparación e indemnización se concretarán en el proceso de ejecución de sentencia.
3. Se ordene a las autoridades recurridas abstenerse de incurrir en el futuro en conductas omisivas y negligentes como las que motivaron el presente Recurso de Amparo, así como cumplir, de forma permanente y de conformidad con el principio preventivo, su obligación de proteger el Parque Nacional Corcovado y la Reserva Forestal Golfo Dulce.
4. Se condene al Estado al pago de las costas de este proceso.”
Redacta el Magistrado Hernandez Gutierrez; y,
Considerando:
Los recurrentes acuden en tutela del derecho a un ambiente sano y ecológicamente equilibrado. En ese sentido, alegan que tanto en el Parque Nacional de Corcovado, como la Reserva Golfo Dulce, -ambas áreas protegidas de gran riqueza biológica-, se ha estado produciendo, desde el 2012, un daño ambiental irreversible a causa de las actividades ilegales. Aducen que a la fecha, existen más de cuatrocientas personas que ocupan en forma irregular el Parque Nacional de Corcovado, quienes con sus actividades están poniendo en riesgo el equilibrio ambiental. Todo esto sucede bajo la tolerancia estatal pese a que en múltiples oportunidades, se ha denunciado esta situación ante las autoridades competentes. Alegan que como agravante, se han venido aplicando al Ministerio de Ambiente y Energía las Directrices Nos. 013-H y 026-H, que impiden utilizar plazas que queden vacantes y crear nuevas plazas para el nombramiento de nuevos funcionarios públicos, prohibiciones que se aplican para proteger el Parque Nacional Corcovado y la Reserva Forestal Golfo Dulce.
Solicitan los recurrentes se ordene al Ministro de Ambiente y Energía, organizar y ejecutar operativo para desalojas a las personas dedicadas a la orerìa, caza, y tala ilegas dentro del Parque Nacional Corcovado y de la Reserva Forestal Golfo Dulce, dotar a los guarda parques o agentes de seguridad y vigilancia del equipo necesario que proteja su integridad física y les permita cumplir eficientemente su trabajo de control y protección. Se tramiten las modificaciones presupuestarias requeridas para proteger los ecosistemas y combatir la problemática señalada. Que una vez concluida la expulsión de todos los oreros, cazadores furtivos y madereros, se destine un mínimo de 20 efectivos de la Fuerza Pública para que permanezcan en ambas áreas protegidas durante al menos un año. Al Ministro de Hacienda se le ordene adoptar las medidas que sean necesarias para utilización y creación de nuevas plazas de agentes de seguridad y vigilancia para cubrir cumplir con la protección ambos lugares, tramitar y autorizar presupuestos y las modificaciones presupuestarias presentadas para cumplir lo solicitado.
Se condene a las autoridades recurridas a la reparación e indemnización integral de los daños y perjuicios ocasionados al ambiente y la vida silvestre por las conductas omisivas y negligentes que motivan el presente recurso. Y se abstenerse de incurrir en el futuro en las conductas omisivas reclamadas y se condene al Estado al pago de las costas de este proceso
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
1. Que el Parque Nacional Corcovado y la Reserva Forestal Golfo Dulce ha sufrido una invasión de oreros, de cazadores y se ha producido la tala ilegal de arboles. (según informe del Director del Área de Conservación de Osa del Sistema Nacional de Áreas de Conservación OSA) 2. Con el operativo especial denominado “ORO VERDE UNO”, realizado en abril del 2013, se realizó diagnóstico de la situación sobre la invasión de oreros en el Parque Nacional Corcovado y se detectó la presencia de 34 actividades de orería activas, 29 actividades no activas, y 15 campamentos, todo esto en las zonas de Río Claro, Río Madrigal, Río Rincón y Río Tigre, principalmente en un área de 16 hectáreas. Se realizó la proyección del daño realizado; el cual se estimó en 9556 metros cuadrados, sea aproximadamente 15638 metros cúbicos removidos por la extracción de oro, que por la cantidad de trabajos ilegales dentro del parque, se estimaba que podrían haber 130 personas trabajando en el área afectada.
(según informe del Director Ejecutivo del Sistema Nacional de Áreas de Conservación -SINAC-) 3. Con base en el informe del referido operativo “ORO VERDE UNO”, el Estado invirtió 15.000.000 millones de colones para empezar a tomar decisiones sobre incrementar las acciones de control y protección para minimizar el impacto señalado en el amparo. Y específicamente el Área de Conservación Osa (ACOSA) en conjunto con la Secretaría Ejecutiva del SINAC y el Despacho del Viceministro de Ambiente, tomaron la decisión de incrementar la cantidad de operativos especiales con apoyo de la fuerza pública, en un número de 7 operativos hasta junio de 2015, además se incrementaron las acciones de control para minimizar los impactos mencionados, por lo cual se realizaron 1243 acciones de control desde el 2013 y hasta junio del 2015. (según informe del Director Ejecutivo del Sistema Nacional de Áreas de Conservación -SINAC-) 4.
En el período 2013 al 2015 se realizaron, 9 inspecciones oculares con jueces o agentes; 289 atenciones de quejas, 1 control de tenencia de fauna silvestre, centros de rescate, zoocriaderos y zoológicos, 2 inspecciones a establecimientos comerciales, 39 operativos en carretera, 62 operativos en áreas marinas, 733 patrullajes de reconocimiento y control, atención en 78 puestos fijos, entre otras actuaciones más. (según informe del Director Ejecutivo del Sistema Nacional de Áreas de Conservación –SINAC-) 5. Entre el período 2013 al 2014 el Área de Conservación Osa en conjunto con la Secretaria Ejecutiva del SINAC y el Despacho del Viceministro de Ambiente realizaron acciones de decomisos a los oreros, tanto de maquinarias como equipos, entre ellas decomisaron 33 barras metálicas, 31 machetes. 18 chupacabras, 22 cateadoras, 11 lámparas de buceo, 41 palas, 15 focos, 2 plantas eléctricas, 4 celulares, 3 rastrillos, 15 canoas, 10 parrillas, 7 frascos de oro, 5 radios de comunicación, un arma, entre otros artefactos que son necesarios para la extracción de oro.
(según informe del Director Ejecutivo del Sistema Nacional de Áreas de Conservación –SINAC-) 6. El Área de Conservación Osa, el SINAC y el MINAE realizaron acciones de control específicas, y para ello existe un grupo de funcionarios ubicados en el “Centro Operativo Los Planes” que durante el verano realizan patrullaje en el sector de la bajura, para controlar la casería. (según informe del Director Ejecutivo del Sistema Nacional de Áreas de Conservación -SINAC-) 7. Que existe un grupo de funcionarios de apoyo que están destacados en el Centro Operativo Los Patos, el cual realiza patrullajes en otro sector del Parque Nacional Corcovado reforzando y apoyando las actividades de control que realiza el “Centro Operativo Los Planes” (según informe del Director Ejecutivo del Sistema Nacional de Áreas de Conservación OSA -SINAC-) 8. Las autoridades del Sistema Nacional de Áreas de Conservación OSA, diseñaron una estrategia que identificó la amenaza de cacería ilegal en el Parque Nacional Corcovado y por ello se establecieron acciones operativas para el control.
Específicamente se realizó el “Operativo Águila Arpía” del 21 de enero al 4 de febrero y otro operativo especial en Semana Santa del año 2015 para atender la problemática de la cacería en Corcovado. (según informe del Director Ejecutivo del Sistema Nacional de Áreas de Conservación -SINAC-) 9. En fecha indeterminada, esas autoridades coordinaron con la Policía de Fronteras y la Unidad Especial de Zapadores de la Fuerza Pública, para atender la problemática de la cacería en Corcovado. (según informe del Director Ejecutivo del Sistema Nacional de Áreas de Conservación -SINAC-) 10. En fecha indeterminada el Área de Conservación de OSA (ACOSA) en conjunto con el SINAC y el Despacho del Viceministro de Ambiente, realizaron acciones en cuanto a la tala ilegal y robo de madera. (según informe del Director Ejecutivo del Sistema Nacional de Áreas de Conservación OSA).
11. El Centro Operativo Rancho Quemado es el responsable de atender la problemática del robo de madera y para ello cuenta con una planilla de 6 funcionarios de control de forma permanente, y ha realizado esfuerzos para reforzar ese grupo de funcionarios. (según informe del Director Ejecutivo del Sistema Nacional de Áreas de Conservación –SINAC-) 12. Que en el Plan de Control 2014, se establecieron actividades de control para minimizar el impacto de la tala ilegal en la reserva Forestal Golfo Dulce. (según informe del Director Ejecutivo del Sistema Nacional de Áreas de Conservación Osa) 13. El SINAC ha desarrollado el proyecto denominado “Manejo Forestal y Certificación del origen legal de Madera” (MAFOR-COL), el cual ha iniciado a partir de la primera semana del mes de agosto del 2015 del que pretende contrarrestar la tala ilegal en la Reserva Forestal Golfo Dulce a través de la promoción del Manejo Forestal Sostenible (según informe del Director Ejecutivo del Sistema Nacional de Áreas de Conservación –SINAC-) 14.
Según oficio ACOSA-RFGD-115-2015 del 18 de agosto del 2015 emitido por Juan José Espinoza, en su condición de Administrador de la Reserva Forestal Golfo Dulce, se rinde informe de acciones realizadas en materia de gestión comunitaria. (según informe del Director Ejecutivo del Sistema Nacional de Áreas de Conservación –SINAC-). (VER FOLIO 1043) 15. En fecha indeterminada desde el año 2013 el Área de Coservación de Osa (ACOSA) en conjunto con el SINAC han gestionado ampliación de insumos para los guardaparques destacados en el Parque Nacional de Corcovado, entre ellos la renovación de todo el arsenal de armas, específicamente se le entregó a cada funcionario del Parque Nacional Corcovado, una carabinas M30-1. También se gestionó la adquisición de 8 GPS marca Garmen, con sus estuches, 8 tiendas de campaña, 8 cámaras fotográficas y 20 hamacas. (según informe del Director Ejecutivo del Sistema Nacional de Áreas de Conservación -SINAC-) 16.
En razón de la extensión del parque y la dificultad de acceso a varios lugares ACOSA gestionó ante la Autoridad Presupuestaria, la apertura de nuevas plazas para atender la Reserva Forestal Golfo Dulce y el Parque Nacional Corcovado. (según informe del Director Ejecutivo del Sistema Nacional de Áreas de Conservación -SINAC-) 17. Desde inicios del 2013 el SINAC ACOSA, con apoyo de la fundación Costa Rica Estados Unidos, inició un proyecto Fideicomiso Osa, para proporcionar alternativas a los oreros, cazadores y madereros clandestinos de la zona. (según informe del Director Ejecutiva del Sistema Nacional de Áreas de Conservación OSA-) 18. Mediante oficio número STAP-1930-2013 del 12 de agosto 2013, la Directora Ejecutiva de la Secretaría Técnica de la Autoridad Presupuestaria (STAP) le indicó al Ministro de en esa fecha, que en relación con la solicitud de 33 puestos para servicios especiales por un plazo de 6 meses, con clasificación y valoración igual a la de “Técnico de Servicio Civil 1" con el fin de apoyar la protección de los recursos naturales, las cuales sería financiadas con remanentes de la partida de “Remuneraciones”, resultaba improcedente dicha solicitud según circular STAP-CIRCULAR-0016-2013 y la Directriz Presidencial No 40-H, pues no se pueden tomar sobrantes o remanentes que se produzcan en las diferentes subpartidas de la partida presupuestaria de Remuneraciones, para incrementar cualquier otro gasto.
(según informe del Ministerio de Hacienda) 19. El 14 de septiembre de 2013, el Dr. Eduardo Carrillo, Director de ICOMVIS dirige nota a las autoridades del Área de Conservación Osa del Sinac/Minae, sobre la situación con las poblaciones de chanchos de monte y jaguares en Corcovado, afirmando que “las poblaciones de chancho de monte ha caído a niveles más bajos que los que tenía en el 2005 y los jaguares han disminuido a un nivel que nunca se había registrado en Corcovado en los últimos 22 años”. (según documentación allegada a los autos) 20. Mediante oficio número FCTM-ICOMVIS-496-2014 del 20 de agosto de 2014, los señores Eduardo Carrillo, Mario A. Boza y Álvaro Ugalde, del Instituto Internacional de Conservación y Manejo de la Vida Silvestre de la Universidad Nacional -ICOMVIS-, enviaron nota a la Lic. Patricia Madrigal, quien se encontraba nombrada como Viceministra del Minae, en la cual hacían referencia a la importancia biológica del Parque Corcovado y a los daños producidos por los oreros, y se solicitaba que ese despacho coordinara la colaboración de la Fuerza Pública, de Migración, de Control de Drogas, del IMAS y del Inder, entre otras instituciones nacionales, para hacer operativos que permitieran resolver en forma permanente la presencia de los invasores.
Ello antes de que la situación en el Parque y en la Reserva se volviera irreversible. (folio 94 del escrito inicial del recurso) 21. Mediante oficio número SINAC-DE-2145 del 22 de octubre del 2014, el Sistema Nacional de Áreas de Conservación (SINAC), solicitó autorización para utilizar 3 plazas vacantes por servicios especiales para continuar ejecutando el Contrato de Préstamo N° 1824/OC-CR con el fin de financiar el Programo de Turismo en áreas Silvestres Protegidas.
22. Según acuerdo número 10775 de la Sesión Ordinaria N° 10-2014 del 21 de noviembre del 2014 la Autoridad Presupuestaria autorizó la utilización de dichas plazas. (Según documentación allegada a los autos) 23. Mediante oficio número FCTM-ICOMVIS-194-2015 del 7 de abril del 2015, el Dr. Eduardo Carrillo, Director del Instituto Internacional de Manejo de Vida Silvestre de la Universidad Nacional remite nota a la Directora del Área de Conservación Osa -ACOSA-, que indica entre otros temas, que “Es menester mencionar que nuestros datos (que comenzaron a recopilarse en 1990) muestran una disminución substancial de las poblaciones de chanchos de monte (Tayassu pécari) y de jaguares (Panthera onca) [adjunto los gráficos correspondientes a las dos especies mencionadas]. Esta no es una situación nueva, a ustedes se les ha comunicado por diferentes medios desde abril del 2010, comenzando con la reunión que tuvimos en Puerto Jiménez y en donde expusimos los resultados de nuestras investigaciones hasta ese momento” (folio 94 del escrito inicial del recurso) 24.
Por oficio número DM-250-2015 del 23 de marzo de 2015 el MINAE remitió gestión ante el Sistema Nacional de Áreas de Conservación (SINAC) solicitando lo siguiente: “Exceptuar al SINAC, de la aplicación de la Directriz presidencial N.° 14-H vigente al momento de la solicitud. Crear la cantidad de 64 plazas nuevas de la siguiente forma: 20 plazas para el año 2015. 30 para 2016 y 14 plazas para el 2017. Incorporar presupuestariamente 386 plazas que se financian con recursos del Fondo Nacional de Parques, a cargo del Presupuesto Ordinario de la Republica, planteando el traslado de la siguiente forma: 70 plazas en el 2015, 145 para el 2016, 129 en 2017 y 106 en el año 2018 para un total de 450 plazas” (según informe del Ministerio de Hacienda) 25. Mediante oficios Nos. SINAC-SE-GDRH-770, SINAC-SE-DGRH-832, el SINAC solicitó a la Secretaría Técnico de la Autoridad Presupuestario (STAP), la utilización de 2 plazas vacantes.
(según informe del Ministerio de Hacienda) 26. La Secretaría Técnica de la Autoridad Presupuestario (STAP) respondió lo anterior mediante oficio No. STAP-2677-2014 del 13 de noviembre de 2014, donde se autorizó la utilización de dichas plazas vacantes, dado que los puestos se cancelan con “Fondo de Parques Nacionales” es decir recursos propios. (según informe del Ministerio de Hacienda) 27. Mediante oficio número ICOMVIS-D-132-2012 del 20 de noviembre de 2014, el Dr. Carrillo Director de ICOMVIS junto con el M.S. Alvaro Ugalde Víquez, promotor de la creación del sistema de parques nacionales en Costa Rica, envía nota al Ministro y a la Viceministra del MINAE y al Director Ejecutivo del Sistema de Áreas de Conservación, haciendo referencia a la situación de deterioro en la que se encontraban el Parque y la Reserva Golfo Dulce, y en particular a la considerable disminución del personal de estas dos áreas, al drástico descenso de las poblaciones de chanchos de monte y jaguares debido a la cacería, al aumento del oreo y a la presencia de cultivos dentro del Parque, y presentaban 12 solicitudes para resolver la situación.
(folio 57 del escrito inicial del recurso) 28. Mediante oficio STAP-2774-2014 del 25 de noviembre del 2014 el Director Ejecutivo de la STAP comunica al SINAC el acuerdo número 10775 tomado par la Autoridad Presupuestaria en la Sesión ordinaria número 10-2014, mediante el cual se autoriza la utilización de las 3 plazas por servicios especiales vacantes, del 1 de B1 y hasta el 30 de junio del 2015. (según informe del Ministerio de Hacienda) 29. Mediante oficio No. STAP-0526-2015 del 09 de abril de 2015, la STAP responde al MINAE, -con copia al SINAC-, indicando que las Directrices Presidenciales 09-H y 14-H las implementa el Poder Ejecutivo dado la difícil situación fiscal del país, por lo que los recursos deben asignarse con base en las prioridades para un mejor aprovechamiento. (según informe del Ministerio de Hacienda) 30. Que por resolución número 575-15 de las 9:00 horas del 20 de abril del 2015, el Despacho del Ministerio de Seguridad Pública ordenó el lanzamiento de los ocupantes de la finca sin inscribir con plano catastrados P-2732250 y P-279308-95, ubicadas en Puntarenas, Boca Ganado, Reserva Forestal Golfo Dulce.
(Según informe del Ministerio de Seguridad Pública) 31. Mediante oficio SINAC-SE-GIDRH-309 del 21 de abril de 2015, en acatamiento del acuerdo N° 10 de la sesión Ordinaria N° 11-2014 del 24 de noviembre de 2014, Miriam Valerio Bolaños, solicita a los directores regionales, justificación para la creación de plazas nuevas y necesidad de descongelar plazas vacantes del SINAC. (Según informe del Sistema Nacional de Área de Conservación (SINAC) del Ministerio de Ambiente y Energía) 32. Según oficio SINAC-ACOSA-D-107-15 del 29 de abril de 2015, Etilma Morales Mora, en su calidad de Directora de ACOSA, da respuesta a lo solicitado en el oficio SINAC-SE-GIDRH-309 del 21 de abril de 2015. (Según informe del Sistema Nacional de Área de Conservación (SINAC) del Ministerio de Ambiente y Energía) 33. Mediante oficio N° DE-0375-2015 del 15 de junio del 2015 la Secretaría Técnica de la Autoridad Presupuestaria le comunica al Ministerio de Ambiente y Energía y al Sistema Nacional de Áreas de Conservación, que con fundamento en lo estipulado en el artículo 13 de la Directriz Presidencial N°.023-H, se autoriza la utilización de 13 plazas vacantes, para la atención de los diferentes servicios sustantivos que brinda el SINAC en las diferentes Áreas de Conservación en el país.
(según informe del Ministerio de Hacienda) 34. El 16 de junio de 2015, el MINAE remitió el oficio No. DM-0498-2015, que responde el oficio STAP-0526-2015, aportando información adicional sobre la creación de 20 plazas por cargos fijos para el Sistema Nacional de Áreas de Conservación. (según informe del Ministerio de Hacienda) 35. Según oficio SINAC-DE-1038 del 07 de julio de 2015, el Dr. Julio Jurado Fernández, Director Ejecutivo del SINAC, envía ampliación de justificación de 20 puestos a crear para el Área de Conservación Osa, en cumplimiento de la meta establecido en el Plan Nacional de Desarrollo para el período 2015-2018. (Según informe del Sistema Nacional de Área de Conservación (SINAC) del Ministerio de Ambiente y Energía) 36. Por oficio número DE-0325-2015 del 7 de julio del 2015 la Secretaría Técnica de la Autoridad Presupuestaria solicita a la Dirección General de Presupuesto Nacional la emisión de su criterio sobre la creación de 20 plazas para el Sistema Nacional de Áreas de Conservación (SINAC) para el 2015, a fin de elevarlo ante la Autoridad Prespuestaria.
(según informe del Ministerio de Hacienda) 37. Mediante Acuerdo No. 11084 de la Sesión Ordinaria 07-2015 del 27 de julio de 2015, la Autoridad Presupuestaria autorizó la utilización de 13 plazas vacantes, dado que, el SINAC mediante los oficios Nos. SINAC-SE-GIRH-674 y 712 señaló que los No. 503187 y 56539, incluidos en los mismos, serán utilizados de conformidad con lo dispuesto en el artículo 12 de la Directriz Presidencial 023-H. (según informe del Ministerio de Hacienda) 38. Mediante oficio No. STAP-1409-2015 del 29 de julio de 2015, la STAP le comunica al SINAC, acuerdo número 11084 de la Sesión Ordinaria 07-2015 del 27 de julio de 2015, sobre la utilización de las 15 plazas que adquirieron condición de vacantes. (según informe del Ministerio de Hacienda). III.- HECHOS NO PROBADOS. No se estiman como debidamente demostrados los siguientes hechos de relevancia para la resolución de este asunto:
1. Que se haya procedido a la creación de las 20 plazas solicitadas, según criterio afirmativo de la Secretaria Técnica de la Autoridad Presupuestaria, emitido mediante informe No. DE-0325-2015, y remitido el 29 de junio de 2015, por parte de Sonia Herrera Ramírez Analista Sectorial A, a Carlos Mena Rodríguez Jefe Sectorial A, ambos de la Secretaría referida.
2. Que se haya realizado el desalojo y lanzamiento de los ocupantes de la finca sin inscribir con plano catastrados P-2732250 y P-279308-95, ubicadas en Puntarenas, Boca Ganado, Reserva Forestal Golfo Dulce, según lo dispuesto en la resolución número 575-15 de las 9:00 horas del 20 de abril del 2015, el Despacho del Ministerio de Seguridad Pública.
3. Que exista un faltante de 80 plazas de guarda parques, en total para dar solución definitiva a las problemáticas planteadas
En sentencia No. 2011-03114 de las 9:03 hrs. del 11 de marzo de 2011, esta Sala se pronunció, en los siguientes términos:
“II.- El derecho a un ambiente sano y ecológicamente equilibrado. El artículo cincuenta de la Constitución Política establece como fundamental el derecho de toda persona a un ambiente sano y ecológicamente equilibrado. De previo a la modificación de este artículo 50 para considerar de manera expresa lo relativo al ambiente, ya la Sala, a través de su labor jurisprudencial, había derivado este derecho a partir de las disposiciones constitucionales de los artículos 21 -derecho a la vida y a la salud-, 69 -explotación racional de la tierra- y 89 -protección de las bellezas naturales-. La Sala ha optado por una consideración abierta o macro del concepto ambiente y de la protección que se brinda al mismo, trascendiendo de la protección básica o primaria del suelo, el aire, el agua, los recursos marinos y costeros, minerales, bosques, diversidad de flora y fauna, y paisaje, para considerar también elementos referentes a la economía, a la generación de divisas a través del turismo, la explotación agrícola y otros. Así, mediante sentencia número 5893-095, de las nueve horas cuarenta y ocho minutos del 27 de octubre de 1993, la Sala estableció que:
“[E]l Derecho Ambiental no debe asociarse sólo con la naturaleza, pues ésta es únicamente parte del ambiente. La política de protección a la naturaleza se vierte también sobre otros aspectos como la protección de la caza, de los bosques, de los parques naturales y de los recursos naturales. Se trata, entonces, de un concepto macro-ambiental, para no dejar conceptos importantes por fuera y así lograr unificar el conjunto jurídico que denominamos Derecho Ambiental"
III.El deber del Estado en la tutela del ambiente. A partir de la reforma del artículo 50 constitucional, en la cual se consagró expresamente el derecho ambiental como un derecho fundamental, se estableció también -en forma terminante- la obligación del Estado de garantizar, defender y tutelar este derecho, con lo cual, el Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. Es a tenor de esta disposición, en relación con los artículos 20, 69 y 89 de la Constitución Política, que se derivó la responsabilidad del Estado de ejercer una función tutelar y rectora en esta materia, según lo dispone la propia norma constitucional en comentario, función que desarrolla la legislación ambiental. Es así como el mandato constitucional establece el deber para el Estado de garantizar, defender y preservar ese derecho. En este orden de ideas, debe considerarse que la normativa establece al Ministerio del Ambiente y Energía como el órgano rector del sector de los recursos naturales, energía y minas, según lo dispuesto en el artículo 2 de la Ley Orgánica de este ministerio, número 7152, de 4 de junio de 1990.
Esta función de rectoría en la materia ambiental, a criterio de la Sala, comprende no solo el establecimiento de regulaciones adecuadas para el aprovechamiento del recurso forestal y los recursos naturales, según lo dispone también el artículo 56 de la Ley Orgánica del Ambiente, sino que le confiere la importante función de ejercer la rectoría en la materia ambiental, consistente en mantener un papel preponderante en esta materia. En este sentido, el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado según lo dispuesto en el artículo 50 de la Constitución, en tanto dispone en lo que interesa en el párrafo tercero: "El Estado garantizará, defenderá y preservará ese derecho"; lo cual resulta concordante con el principio constitucional establecido en el párrafo segundo del artículo 9 de la Constitución Política, que expresamente prohíbe a los Poderes del Estado la delegación del ejercicio de funciones que le son propias, máxime cuando se constituyen en esenciales.
De esta manera, tratándose de la protección ambiental, las funciones de rectoría, control y fiscalización de la materia ambiental, corresponden al Estado, a cargo de las diversas dependencias administrativas.
IV.La prevención del riesgo ambiental . Estableciéndose a nivel constitucional esta obligación del Estado, resulta importante apreciar cómo a nivel de los instrumentos internacionales de protección de los derechos humanos también se establecen obligaciones concretas que deben ser respetadas. En materia ambiental se ha definido el deber de prevención que debe existir en este ámbito; la Declaración de Río, adoptada en la Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo, dispone que:
"Principio 15.- Con el fin de proteger el medio ambiente, los Estados deberán aplicar ampliamente el criterio de precaución conforme a sus capacidades. Cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente".
La prevención pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos. Consecuentemente, el principio rector de prevención se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar o contener la posible afectación del ambiente o la salud de las personas. De esta forma, en caso de que exista un riesgo de daño grave o irreversible -o una duda al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Lo anterior debido a que en materia ambiental la coacción a posteriori resulta ineficaz, por cuanto de haberse producido el daño, las consecuencias biológicas y socialmente nocivas pueden ser irreparables; la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados al ambiente. Tal como lo señala el instrumento internacional de cita como el mismo artículo cincuenta constitucional, es el Estado el llamado a efectuar esta labor de prevención, y así lo ha reconocido esta Sala al afirmar, mediante sentencia número 2001-6503, de 6 de julio de 2001, que:
“El párrafo tercero del numeral 50 Constitucional señala con toda claridad que el Estado debe garantizar, defender y preservar el derecho de todas persona a un ambiente sano y ecológicamente equilibrado; lo que implica afirmar que los entes públicos no sólo están en la obligación de hacer cumplir -a los particulares y otros entes públicos- la legislación ambiental, sino también, ante todo, que deben ajustar su accionar a los dictados de esos cuerpos normativos tutelares. Las instituciones del Estado son las primeras llamadas a cumplir con la legislación tutelar ambiental, sin que exista justificación alguna para eximirlas del cumplimiento de requisitos ambientales como, a manera de ejemplo, el estudio de impacto ambiental que exige la Ley Orgánica del Ambiente para las actividades que emprendan los entes públicos que, por su naturaleza, puedan alterar o destruir el ambiente." (énfasis añadido)
V.La coordinación de las instituciones públicas en la protección integral al ambiente. Existe una obligación para el Estado -como un todo- de tomar las medidas necesarias para proteger el ambiente, a fin de evitar grados de contaminación, deforestación, extinción de flora y fauna, uso desmedido o inadecuado de los recursos naturales, que pongan en peligro la salud de los administrados. En esta tarea, por institución pública se entiende tanto a la Administración Central -Ministerios, como el Ministerio del Ambiente y Energía y el Ministerio de Salud, que en razón de la materia, tienen una amplia participación y responsabilidad en lo que respecta a la conservación y preservación del ambiente; los cuales actúan, la mayoría de las veces, a través de sus dependencias especializadas en la materia, como por ejemplo, la Dirección General de Vida Silvestre, la Dirección Forestal, y la Secretaría Técnica Nacional Ambiental (SETENA)-, así como también las instituciones descentralizadas como el Instituto Nacional de Vivienda y Urbanismo, el SENARA, el Instituto Costarricense de Turismo o el Instituto Costarricense de Acueductos y Alcantarillados.
Del mismo modo, en esta tarea tienen gran responsabilidad las municipalidades en lo que respecta a su jurisdicción territorial. Debido a la diversidad de actores que pueden intervenir, podría pensarse que esta múltiple responsabilidad provocaría un caos en la gestión administrativa. Por ello, a fin de evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos nacionales y locales, así como la confusión de derechos y obligaciones entre las diversas partes involucradas, se hace necesario establecer una serie de relaciones de coordinación entre las diversas dependencias del Poder Ejecutivo y las instituciones descentralizadas, y entre éstas con las municipalidades, a fin de poder llevar a cabo las funciones que les han sido encomendadas. Esta Sala se ha referido ya al principio de coordinación de las dependencias públicas con las municipalidades en la realización de fines comunes, al señalar mediante sentencia número 5445-99, de las catorce horas treinta minutos del 14 de julio de 1999, que:
"[L]a coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes. Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible «concierto» interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros. Así, las relaciones de las municipalidades con los otros entes públicos, sólo pueden llevarse a cabo en un plano de igualdad, que den como resultado formas pactadas de coordinación, con exclusión de cualquier forma imperativa en detrimento de su autonomía, que permita sujetar a los entes corporativos a un esquema de coordinación sin su voluntad o contra ella; pero que sí admite la necesaria subordinación de estos entes al Estado y en interés de éste (a través de la «tutela administrativa» del Estado, y específicamente, en la función de control la legalidad que a éste compete, con potestades de vigilancia general sobre todo el sector).” Por otro lado, las omisiones al deber de protección del ambiente y de cumplimiento de la normativa ambiental son de relevancia constitucional, por cuanto como consecuencia de la inercia de la Administración en esta materia, se puede producir un daño al ambiente y a los recursos naturales, a veces, de similares o mayores consecuencias que de las derivadas de las actuaciones de la Administración; como lo es la autorización de planes reguladores, o construcciones sin la aprobación del estudio de impacto ambiental por parte de la Secretaría Técnica Nacional Ambiental, o la falta de control y fiscalización en la ejecución de los planes de manejo de las áreas protegidas por parte de la Dirección General de Vida Silvestre del Ministerio del Ambiente y Energía, el permitir el funcionamiento de empresas sin los permisos de salud en lo que respecta al tratamiento de aguas residuales -Acueductos y Alcantarillados y Ministerio de Salud-, o no verificar los controles sónicos en bares, restaurantes o centros de fiestas -municipalidades y Ministerio de Salud-.
VI.El papel de las municipalidades en materia ambiental. De conformidad con lo dicho, las municipalidades, como parte integrante del todo que es el Estado, tienen dentro del ámbito de sus competencias y obligaciones una alta dosis de responsabilidad en materia ambiental, sea mediante la aprobación directa de permisos o licencias para las cuales se exija el previo cumplimiento de requisitos que acrediten ante otras instancias del poder público el adecuado manejo ambiental, como mediante inspecciones regulares y canalización de situaciones de riesgo ante las instancias con mayor competencia de intervención. Ha quedado establecido ya que a los gobiernos locales les alcanza la obligación de coordinación y prevención en materia ambiental dentro del ámbito de su jurisdicción territorial, de donde resulta que ciertamente las municipalidades son actores importantes en la tarea de protección al ambiente.
Es indubitable la facultad de los gobiernos locales para darse su propia ordenación territorial a través de los planes reguladores; pero la existencia de éstos -que en su mayoría carecen de complementos de ordenación desde el punto de vista del ambiente sano y ecológicamente equilibrado- no produce la desaplicación de la legislación tutelar ambiental. Por el contrario, estima la Sala que debe ser requisito fundamental, que no atenta contra el principio constitucional de la autonomía municipal, el que todo plan regulador deba considerar, de previo a ser aprobado y desarrollado, con un examen del impacto ambiental desde la perspectiva que da el artículo 50 constitucional, para que el ordenamiento del suelo y sus diversos regímenes sean compatibles con los alcances de la norma superior, sobre todo, valorando que esta disposición establece el derecho de todos los habitantes a obtener una respuesta ambiental de todas las autoridades públicas y ello incluye, sin duda, a las municipalidades, quienes no están exentas de la aplicación de la norma constitucional y de su legislación de desarrollo.
Es evidente que en este caso, es totalmente coincidente el interés nacional y el local, y por ello los gobiernos locales pueden y deben exigir el cumplimiento de requisitos ambientales en su territorio, y en caso de conflicto con las autoridades rectoras de la materia ambiental, pueden someter las controversias al contralor jurisdiccional que corresponda según la naturaleza de la infracción. Es por lo anterior que las normas tutelares del ambiente no son incompatibles, desde el punto de vista constitucional, con las facultades y competencias de las municipalidades, las que están obligadas, por imperativo del artículo 50 de la Constitución Política, a prodigarse en la protección del ambiente -ver, en este sentido, sentencia número 2006-7994, de las ocho horas cincuenta y siete minutos del 2 de junio de 2006-”. (criterio reiterado en sentencia No. 2016002830 de las 09:30 horas del 26 de febrero de 2016)
Del estudio de los autos y de los informes rendidos bajo fe de juramento, la Sala tiene claramente acreditado que existe un grave problema ambiental, según reclama la parte recurrente- en cuanto a las actividades ilegales de orería, de caza, tala y robo de madera, que se realizan dentro de las áreas protegidas del Parque Nacional de Corcovado, y la Reserva Golfo Dulce. Constata esta Sala las múltiples gestiones realizadas en relación con dicha problemática así como logra constatar diversas actuaciones por parte de las autoridades, a efecto de procurar el adecuado resguardo, aseguramiento, protección y conservación de los recursos naturales con el fin de evitar la posible afectación del ambiente. Así por ejemplo, se corrobora cómo en abril de 2013, el Sistema Nacional de Áreas de Conservación, realizó un diagnóstico sobre la invasión de oreros en el Parque Nacional Corcovado y en virtud de éste, ese mismo mes se llevó a cabo el primer operativo especial denominado “ORO VERDE UNO”, por medio del cual se detectó la presencia de 34 actividades de orería activas, 29 actividades no activas, y 15 campamentos, todo esto en las zonas de Río Claro, Río Madrigal, Río Rincón y Río Tigre, principalmente en un área de 16 hectáreas.
Asimismo, se realizó una proyección del daño causado; el cual fue estimado en 9556 metros cuadrados, sea aproximadamente de 15638 metros cúbicos removidos por la extracción de oro, por lo cual se estimó que podrían haber 130 personas trabajando en el área afectada. Según informaron las autoridades accionadas, con base en dicho informe el Estado invirtió 15.000.000 millones de colones, para iniciar la toma de decisiones en cuanto al incremento las acciones de control y protección que podrían minimizar el impacto señalado en el amparo. En este sentido se acreditó que el Área de Conservación Osa (ACOSA) en conjunto con la Secretaría Ejecutiva del SINAC y el Despacho del Viceministro de Ambiente, incrementaron durante el período del 2013 al 2015, la cantidad de operativos especiales con apoyo de la fuerza pública, en un número de 7 operativos, se incrementaron las acciones de control, para minimizar los impactos mencionados, de manera que se realizaron 1243 acciones de control, así como 9 inspecciones oculares con jueces o agentes; 289 atenciones de quejas, 1 control de tenencia de fauna silvestre, centros de recate, zoocriaderos y zoológicos, 2 inspecciones a establecimientos comerciales, 39 operativos en carretera, 62 operativos en áreas marinas, 733 patrullajes de reconocimiento y control, atención en 78 puestos fijos, entre algunas otras acciones.
Igualmente durante el período 2013 al 2014 el Área de Conservación Osa en conjunto con la Secretaria Ejecutiva del SINAC y el Despacho del Viceministro de Ambiente realizaron acciones de decomisos a los oreros, tanto de maquinarias como equipos, entre ellas decomisaron 33 barras metálicas, 31 machetes, 18 chupacabras, 22 cateadoras, 11 lámparas de buceo, 41 palas, 15 focos, 2 plantas eléctricas, 4 celulares, 3 rastrillos, 15 canoas, 10 parrillas, 7 frascos de oro, 5 radios de comunicación, un arma, entre otros artefactos que son necesarios para la extracción de oro. Por otra parte en cuanto a la actividad ilegal de cacería se logró acreditar también que el Área de Conservación Osa, el SINAC y el MINAE realizaron acciones de control específicas, y según señalaron para ello existe un grupo de funcionarios ubicados en el “Centro Operativo Los Planes” realizado patrullaje en el sector de la bajura durante el verano y existe un grupo de funcionarios de apoyo, destacados en el Centro Operativo Los Patos, que realiza patrullajes en otro sector del Parque Nacional Corcovado reforzando y apoyando las actividades de control que realiza el “Centro Operático Los Planes”.
Se constató que el SINAC realizó el “Operativo Águila Arpía” del 21 de enero al 4 de febrero del 2015 y otro operativo especial en Semana Santa de ese mismo año en Corcovado, y coordinar con la Policía de Fronteras y la Unidad Especial de Zapadores de la Fuerza Pública, para atender esa problemática. Ahora bien, en relación con la actividad de tala y robo de madera en ambas reservas, se acreditó que el Área de Conservación de OSA (ACOSA) en conjunto con el SINAC y el Despacho del Viceministro de Ambiente, realizaron acciones. Según se informa el Centro Operativo Rancho Quemado, es el responsable de atender la problemática del robo de madera cuenta con una planilla de 6 funcionarios de control de forma permanente, y ha realizado esfuerzos para reforzar ese grupo. Así en el Plan de Control 2014, se establecieron actividades de control para minimizar el impacto de la tala ilegal en la reserva Forestal Golfo Dulce.
En punto a lo indicado el SINAC desarrolló el proyecto denominado “Manejo Forestal y Certificación del origen legal de Madera” (MAFOR-COL), el cual dio inicio en el mes de agosto del 2015, con el propósito de contrarrestar la tala ilegal en la Reserva Forestal Golfo Dulce, ello mediante la promoción del Manejo Forestal Sostenible. Asimismo se constató que en el Plan de Control 2014, se establecieron actividades de control para minimizar impacto de la tala ilegal en la Reserva Forestal Golfo Dulce. Aunado a lo anterior se constata que desde el año 2013 el Área de Conservación de Osa (ACOSA) en conjunto con el SINAC han gestionado ampliación de insumos para los guardaparques destacados en el Parque Nacional de Corcovado, entre ellos mediante la renovación de todo el arsenal de armas, específicamente se le entregó a cada funcionario del Parque Nacional Corcovado, una carabinas M30-1. También se gestionó la adquisición de 8 GPS marca Garmen, con sus estuches, 8 tiendas de campaña, 8 cámaras fotográficas y 20 hamacas.
Asimismo, se gestionó ante la Autoridad Presupuestaria, la apertura de nuevas plazas para atender la Reserva Forestal Golfo Dulce y el Parque Nacional Corcovado. Finalmente cabe agregar, que según informaron las autoridades recurridas, una de los detonantes de daño y explotación en las áreas protegidas referidas, ha sido el desempleo en la zona, por lo cual desde el 2013 se ha trabajado proyectos de emprendedurismo, y por ello se iniciaron contactos con el Fideicomiso de Osa y la Fundación Costa Rica-Estados Unidos para desarrollar específicamente a inicios del 2014, el proyecto denominado “Caminos de Osa”, cuyo objeto era promover el desarrollo integral de las comunidades de la Península de Osa, mediante el fortalecimiento de iniciativas de turismo rural comunitario ligadas a una red de nuevos senderos hacia el Parque Nacional Corcovado y su incorporación a la cadena de valor de tour operadores nacionales e internacionales.
Según la jurisprudencia reiterada por esta Sala, ha quedado claramente establecido que conforme al Derecho Internacional de los Derechos Humanos y su desarrollo en la legislación interna, a nivel constitucional se ha desarrollado la protección del derecho de toda persona a un derecho a un ambiente sano y ecológicamente equilibrado, optando esta Sala por una protección abierta que no solo se circunscribe a la protección básica o primaria del suelo, el aire, el agua, los recursos marinos y costeros, minerales, bosques, diversidad de flora y fauna, y paisaje, sino considerar también elementos referentes a la economía, a la generación de divisas a través del turismo, la explotación agrícola, la protección de la caza, de los bosques, de los parques naturales y de los recursos naturales, como en el caso que nos ocupa. Ahora bien, en la normativa referida se establecido también -en forma terminante- la obligación del Estado de garantizar, defender y preservar el derecho de toda persona a un ambiente sano y ecológicamente equilibrado; lo que implica afirmar que los entes públicos no sólo están en la obligación de hacer cumplir –a los particulares y otros entes públicos- la legislación ambiental, sino también, ante todo, que deben ajustar su accionar a los dictados de esos cuerpos normativos tutelares.
Con miras en dicha obligación, cabe agregar que los decretos que dan fundamento a la creación del Parque Nacional de Corcovado, la zona de la Península de Osa y la Reserva Forestal Golfo Dulce, sean respectivamente el Decreto Ejecutivo No. 5357-A publicado en La Gaceta No. 207 de 31 de octubre de 1975, y mediante Decreto Ejecutivo No. 8494-A, publicado en La Gaceta No. 104 de 1 de junio de 1978, establecieron claramente que dentro de las funciones del Estado costarricense, se encontraba la obligación de velar por la protección, aprovechamiento, conservación y fomento de los recursos forestales del país, así como la de la conservación de aquellas zonas del país que poseían recursos naturales o culturales de importancia excepcional. Por lo cual, como parte de las consideraciones que se tomaron en cuanta para la creación del Parque Nacional de Corcovado, los legisladores indicaron que esa cueca había sido considerada por científicos de todo el mundo, como una de las áreas tropicales húmedas de mayor riqueza en flora, fauna y ecosistemas naturales, y que si bien por mucho tiempo el área se había mantenido inalterada -debido a su aislamiento-, a la fecha de creación del parque la explotación destructiva de sus recursos naturales amenazaba con hacer desaparecer toda la riqueza biológica del mismo, por lo que el establecimiento de ese Parque Nacional aseguraría que esa importante parte del Patrimonio Cultural suministrara beneficios permanentes de educación, investigación, inspiración y recreación para las actuales y futuras generaciones de costarricenses.
Igualmente en relación con la actual Reserva Forestal Golfo Dulce, el legislador consideró que los cerros que existían alrededor del Golfo Dulce y en la Península de Osa, por su topografía y condición de los terrenos, no eran aptos para la agricultura ni para la ganadería, pero el uso más adecuado sería la explotación racional de los recursos forestales, protegiendo a la vez las cuencas hidrográficas que proveían el agua a las áreas agrícolas de la zona. Recalcando además que esas tierras en su mayoría se encontraban con sus bosques intactos, los cuales contenía un gran número de árboles de alto valor comercial, y contaban con capacidad para una regeneración rápida en las zonas manejadas para rendimiento continuo. Agregó además el legislados que la continuo, regulado por la Dirección General Forestal, podría ser la base para un desarrollo industrial maderero que podría crear empleo y mejorar las condiciones de vida para la gente de la zona.
Ahora bien, es claro para esta Sala que el Estado costarricense, representado por sus diversas instituciones públicas y en atención al principio de coordinación ya referido en la jurisprudencia, se encuentra en la obligación de adoptar las medidas adecuadas y necesarias para preservar la integridad del Parque y la Reserva Forestal objeto del recurso y garantizar a las futuras generaciones su goce y disfrute. No obstante, según los hechos que se han tenido por probados en el presente caso y aún pese al espíritu original de los decretos mencionados, en la actualidad existe un grave problema ambiental, generado por las actividades ilegales de orería, de caza, tala y robo de madera, que se realizan dentro de las áreas protegidas del Parque Nacional de Corcovado, y de la Reserva Golfo Dulce. Cabe señalar al respecto que del detallado estudio que ha realizado esta Sala, se denotan la gran cantidad de actuaciones y medidas adoptadas por parte de las autoridades accionadas, a efecto de dar solución a la problemática aludida, ello mediante la ejecución de diversos operativos y decomisos, así como con el aumento de personal realizado, la asignación de recursos varios para los funcionarios y las instituciones encargadas, entre ellos por ejemplo la provisión de armamento para los Guadaparques.
Todo lo cual sin duda reconoce esta Sala, pero lamentablemente resulta ser insuficiente, para dar solución permanente y completa a la problemática descrita. Debe agregarse también, que, si bien las autoridades del Sistema Nacional de Áreas de Conservación han referido que uno de los detonantes de la problemática impugnada, lo es la problemática social de desempleo de los habitantes de la zona, y que por ello también has realizado diversas iniciativas para paliarlo. Lo cierto es que, según estima esta Sala la existencia de esta problemática en la región, no tiene porqué serlo a costa, con merma o sacrificio del parque y la reserva forestal, pues tal cosa conduce a un problema aún mayor como lo es el incumplimiento de normas constitucionales e instrumentos internacionales que generaciones. De esta forma, dada la obligación de las instituciones del Estado, antes aludidas, en el sentido de que son las primeras llamadas a cumplir la legislación tutelar ambiental, sin que exista justificación alguna, tales como el hecho que las medidas adoptadas son insuficientes, o que la problemática social aludida no permite la solución de la problemática, ello no puede eximirle de tal cumplimiento.
Para dar una solución integral a la problemática reclamada debe existir una presencia institucional, debidamente coordinada, mediante la cual se pueda garantizar la vigilancia y protección permanente tanto en el Parque Nacional Corcovado y la Reserva Forestal Golfo Dulce como , deberá adoptar medidas que sean necesarios entre otras, por ejemplo la ejecución de operativos permanentes y estratégicos, incrementar el número de plazas, conforme a los requerimientos que ha venido haciendo la administración ambiental y dotar a los actuales y a los eventuales nuevos guarda parques, de los insumo apropiados y adecuados. Así las cosas, a criterio de esta Sala uno de los pasos fundamentales para encaminar la solución a la problemática señalada lo es que las autoridades recurridas puedan contar con los recursos adecuados para cumplir de deber legal. Así, aún cuando se informó que se ha dotado a los guarda parques de algún equipo para el desempeño de sus labores; también estima este Tribunal, que ello es una cuestión mínima, para la cumplimiento efectivo de su deber como funcionarios públicos, por ello deberán las autoridades recurridas proceder a suplir a estos funcionarios de los insumos necesarios, que garanticen el efectivo cumplimiento de sus labores, incluyendo incluso el uso de nuevas tecnologías, sin que pueda esta Sala entrar a determinar cuáles sean tales herramientas o instrumentos de trabajo.
Por otras parte, cabe señalar, que si bien dentro de las medidas concretas realizadas las autoridades del Ministerio de Seguridad Pública, se encuentra el dictado de la resolución número 575-15 de las 9:00 horas del 20 de abril del 2015, por medio de la cual ese Ministerio ordenó el lanzamiento de los ocupantes de la finca sin inscribir con plano catastrados P-2732250 y P-279308-95, ubicadas en Puntarenas, Boca Ganado, Reserva Forestal Golfo Dulce. También lo es, que según informó ese Ministerio a esta Sala, en razón de una gestión presentada por la Asesora Legal Región Brunca del Instituto de Desarrollo Rural (INDER), el 28 de setiembre del 2016, solicitó la suspensión del desalojo decretado, por lo cual ello fue así dispuesto, sin que conste actuación alguna a la fecha -más de un año después-, por medio de la cual se haya podido acreditar que el Ministerio referido, haya dado continuación al trámite del desalojo referido o haya procedido a la ejecución de la resolución aquí aludida.
En cuanto a lo descrito estima esta Sala que deberán las autoridades del Ministerio de Seguridad Pública, proceder de inmediato a realizar las actuaciones necesarias dentro del ámbito de sus competencias, para proveer la continuación del proceso de desalojo instaurado dentro del expediente de desalojo 3330-14 para determinar lo que derecho corresponda en relación con la orden de desalojo decretada en la resolución número 575-15 antes referida o en su caso proceder a realizar nuevos procesos de desalojo de determinarse que éstos son necesarios. En punto a lo señalado deberá dicho Ministerio y ejecutar las actuaciones que estime pertinentes y necesarias para dar fiel cumplimiento a los eventuales desalojo ordenados, y mantener los efectos de su ejecución. Asímismo, deberán determinarse y definirse, de forma coordinada tanto entre el Ministerio de Seguridad Pública, como con las autoridades ambientales, las medidas que se estimen pertinentes para dar cabal cumplimiento a la ejecución del plan de vigilancia y protección permanente del Parque Nacional de Corcovado y de la Reserva Golfo Dulce.
Por otra parte, según se logró comprobar de las manifestaciones vertidas por las autoridades recurridas, a la fecha existe la necesidad de contar con personal suficiente para cumplir las labores a ellas encomendadas, sobre lo cual según ha señalado el propio Ministro de Hacienda, no se ha podido comprobar el número necesario requerido para ello, además que el cumplimiento del deber institucional aludido no podría sustentarse en cálculos, sin fundamento técnico y sin asegurar la disponibilidad presupuestaria, que garanticen el pago correspondiente de sus salarios. Ahora bien, y que según consta dentro de las pruebas aportadas a los autos, se ha constatado la solicitud de aprobación de 20 plazas de guarda parque. Sobre el particular, estima esta Sala que deberá determinarse, realizarse el estudio técnico respectivo y que corresponda para determinar y justificar la creación de un número determinado de plazas, garantizando que los funcionarios nuevos asignados a estas plazas, puedan no solo contar -conforme a derecho- con su salario, sino también con los insumos necesarios para el cumplimiento de sus labores de forma adecuada, ello en aras de cumplir las obligaciones que la Constitución, el Derecho Internacional de los Derechos Humanos y la ley le imponen al Estado costarricense.
Como corolario de lo expuesto, se impone declara con lugar el recurso.
Los Magistrados Jinesta Lobo y Salazar Alvarado salvan el voto y declaran sin lugar el recurso por las razones siguientes:
IX.VOTO SALVADO DE LA MAGISTRADA HERNÁNDEZ LÓPEZ RESPECTO DEL RECLAMO POR INFRACCIÓN DEL ARTÍCULO 50 DE LA CONSTITUCIÓN POLÍTICA.
1. El contexto histórico que motivó en su momento la amplia intervención de la Sala en materia ambiental, ha tenido una considerable variación que impone a este órgano reconsiderar las condiciones para su participación en el aseguramiento del derecho de las personas a un ambiente sano y equilibrado, tal y como ha sido tutelado en el artículo 50 de la Constitución Política. En efecto, la situación actual –caracterizada por una amplísima producción legal y reglamentaria que incluye reglas de fondo, procedimientos y creación de órganos para el cumplimiento de lo ordenado en la Carta Fundamental- es radicalmente diferente de la anterior, en la cual la ausencia de normativa y de instancias estatales con competencia apropiada, le impuso a la Sala un papel de protagonista , casi único , en la defensa del precitado derecho constitucional.
2. Hoy en día, nos encontramos frente a un “denso entramado” de normativa ambiental –tal y como acertadamente lo ha descrito el Magistrado Jinesta Lobo en su voto salvado sobre este tema- lo cual ha producido dos fenómenos relevantes: el primero y más obvio, es el surgimiento de una abarcadora regulación jurídica respecto de actividades cuya incidencia en el ambiente estaba poco o nada ordenada, así la creación de órganos estatales con potestades de vigilancia y control sobre los efectos de la actividad humana en el entorno. El segundo fenómeno consiste en que esa creciente juridificación –predominantemente legislativa y reglamentaria– trae aparejada una ineludible entrada en escena tanto de la justicia administrativa como de la jurisdicción ordinaria -prioritariamente la contencioso administrativa, pero también la penal. En ellas, acorde con la importancia del derecho ambiental, se han regulado de forma amplia vías procesales y medios de legitimación incluyentes, de manera que los administrados puedan hacer valer lo establecido en ese amplio orden jurídico que se relaciona con el tema ambiental.
3. En ese contexto, no resulta apropiado jurídicamente , ni desde el punto de vista funcional, que la Sala Constitucional desplace , o -peor aún- sustituya , a los órganos de justicia ordinarios en la realización de su tarea, también de rango constitucional, de velar por el efectivo cumplimiento de leyes y reglamentos. Es impropio jurídicamente porque en la inmensa mayoría de estos casos lo que se solicita es que interprete y haga valer normas legales y reglamentarias con lo que arriesga traslapar sus competencias con las de otros órganos jurisdiccionales que –ellos sí- han sido creados para ejecutar tales tareas; y resulta también funcionalmente incorrecto, porque el diseño de sus procesos se aviene mal con la complejidad que está presente en numerosos conflictos ambientales que se componen de series de hechos y actos técnica y jurídicamente complejos. Sobre ambas cuestiones existen conocidos ejemplos en los que la Sala ha arrojado una resolución a medias o técnicamente incompleta, o bien se han generado fricciones innecesarias y afectación de la seguridad jurídica.
4. Como parte de los aspectos técnicos que he valorado, añado que está el hecho de que esta jurisdicción no cuenta con jueces ejecutores de sentencia que permitan darle seguimiento adecuado a las mismas -generalmente complejas-, que implican en ocasiones el seguimiento de planes remediales, entre otros, con coordinación interinstitucional y seguimiento de meses y hasta años.
5. Desde esa perspectiva, la decisión de dar un paso al lado en la materia ambiental por parte de este Tribunal no debe ser vista como un abandono de la materia ambiental, sino al contrario, de su adecuada tutela en la instancia que mejor se aviene a la naturaleza de su complejidad y diversidad. Asimismo tampoco debe ser visto como la declinación de esta instancia en su tarea de protección de los derechos constitucionales que le imponen la Constitución Política y su Ley Orgánica, que desde mi punto de vista, queda reservada en esta materia para casos específicos. Se trata más bien, de un ejercicio de reacomodo de las cargas y tareas que corresponden a los distintos órganos estatales, de manera que cada uno de ellos, pueda desplegar plenamente su labor dentro del ámbito que se le ha asignado , así como del ejercicio de fijar su propia competencia, según lo establece el artículo 7 de su Ley Orgánica.
6. Queda claro que la Sala no se plantea abandonar a otras jurisdicciones la labor de protección de los derechos de las personas en materia ambiental. Es conocido que si bien todo reclamo por infracción de normas legales y reglamentarias puede ser reconducido hasta el ámbito constitucional, existen casos cuya resolución no exige más que la aplicación del derecho de la Constitución. Se trata entonces de lograr que la Sala se convierta en protagonista junto con otros, de manera que –entre todos y cada uno en su espacio- se pueda cubrir toda la variedad de situaciones que presenta una protección del derecho a un medio ambiente sano y equilibrado dentro de una sociedad en la que también existen otras necesidades igual de acuciantes. Con esta posición creo firmemente que el ciudadano no pierde un ápice de protección pero se gana sustancialmente en amplitud, en perspectiva y en respeto al equilibrio y distribución de poderes, principio este último de obligada consideración, puesto que rige la dinámica constitucional de cualquier sistema liberal y democrático como el nuestro.- 7.
En línea con lo anterior, sostengo que esta Sala debe abstenerse de conocer los reclamos que se le presenten por supuesta infracción al artículo 50 de la Constitución Política para dejar en manos de la justicia administrativa y la jurisdicción contenciosa administrativa su conocimiento. Lo anterior se deja afirmado con carácter general, sin perjuicio de reconocer la existencia de casos particulares o grupos de casos que, según mi criterio, si resultarían aún mejor tutelados por esta Sala y por tanto deben ser conocidos y resueltos por ella.- Dentro de tales grupos de casos, y sin que esta enunciación pueda considerarse como una lista cerrada y definitiva, puedo señalar que la Sala debe reservarse el conocimiento de situaciones como por ejemplo los reclamos por infracciones ambientales que además pongan en riesgo directo la salud de las personas , o el acceso o calidad del agua; los casos de violaciones groseras y directas al ambiente y en los cuales se constate una palmaria ausencia de la protección por parte de las autoridades estatales, siempre y cuando además la naturaleza del reclamo permita ser abordado mediante el instrumento del amparo como instituto procesal sumario y especial, ya que estimo que tampoco se debe “ordinariar” el amparo para abordar, aún en estos casos citados, temas que rebasen la capacidad de ser atendidos adecuadamente en el mismo.
8. En el caso concreto, de conformidad con los hechos probados no se presenta ninguna de las excepciones que mencionan y la situación planteada se ubica dentro de aquellos casos en las que la intervención de los medios de protección de la Administración y la justicia ordinaria, resultan ser una vía más amplia y completa para el tema discutido, el cual involucra una grave y amplia problemática respecto de la cual poco agrega la emisión de una sentencia estimatoria de este Tribunal.- Por el contrario, es obvio que se requiere una intervención coordinada de numerosas autoridades, sobre la base de una valoración de las ventajas y desventajas de cada curso de acción, lo que requiere abundante prueba, seguimientos y estudios que exceden el ámbito del amparo. De tal modo, debió aplicarse el artículo 9 de la Ley de la Jurisdicción Constitucional y rechazar de plano el recurso, no obstante, al no haber ocurrido así, procede ahora declarar sin lugar el amparo interpuesto
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara con lugar el recurso. Se ordena a JULIO JURADO FERNÁNDEZ, en su condición de Director Ejecutivo del Sistema Nacional de Área de Conservación (SINAC) del Ministerio de Ambiente y Energía, a ÓLGER MÉNDEZ FALLAS, en su condición de Director del Área de Conservación de Osa del Sistema Nacional de Áreas de Conservación (SINAC), a ÉDGAR E. GUTIÉRREZ ESPELETA , en su condición de Ministro de Ambiente y Energía, a HELIO FALLAS , en su condición de Ministro de Hacienda y a LUIS GUSTAVO MATA VEGA, en su condición de Ministro de Seguridad Pública; o a quienes ocupen sus cargos, que dentro del plazo de dos meses contados a partir de la notificación de esta sentencia, coordinen lo pertinente para que se elabore y ejecute un plan que garantice la vigilancia y protección permanente del Parque Nacional de Corcovado y la Reserva Forestal Golfo Dulce, contra las actividades ilegales de orería, caza, tala y robo de madera.
Asimismo, el Ministerio de Seguridad Pública deberá proceder de inmediato a realizar las actuaciones necesarias dentro del ámbito de sus competencias, para proveer la continuación del proceso de desalojo instaurado mediante expediente No. 3330-14, así como cualquier otro nuevo necesario para desalojar a los invasores dedicados a la orería, caza y tala ilegal. Se advierte a los recurridos que, de no acatar la orden dicha, podrían incurrir en el delito de desobediencia y que, de conformidad con el artículo 71 de la Ley la Jurisdicción Constitucional, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
Los Magistrados Jinesta Lobo y Salazar Alvarado salvan el voto y declaran sin lugar el recurso. La Magistrada Hernández López salva el voto y declara sin lugar el recurso. Notifíquese esta resolución a los recurridos en forma personal.- Ernesto Jinesta L.
