Constitutional relief proceeding (recurso de amparo) filed by Randall Eduardo Trejos Chaves, of legal age, married, administrator, identity card No. 1-0981-0880, resident of Rohrmoser, against the Mayor and the President of the Municipal Council, both of the Municipalidad de San José.
Whereas:
Justice Castillo Víquez writes the opinion; and,
Considering:
I.Subject matter of the proceeding. The petitioner alleges that the Municipalidad de San José has not carried out the projects necessary to resolve the flooding that occurs on the west side of Parque Bella Vista, located in Rohrmoser, such as that which occurred on 22 August and 27 October, both in 2015, when the street in front of his home filled with water contaminated by garbage, fecal matter, and mud coming from the boulevard, affecting his home and those of 15 other families.
II.Proven facts. The following facts are deemed duly established and relevant to the decision in this matter, either because they have been proven or because the respondents failed to address them as ordered in the initial ruling:
a. The Stormwater Network Section (Sección de la Red Pluvial) of the Municipalidad de San José is well aware of the problem reported by the petitioner, which is attributable to the fact that this specific site (Parque Bella Vista, located in Rohrmoser) is the lowest part of the area, where water drains from all four cardinal directions, thus forming a catchment area (Área Tributaria) of approximately 40 hectares; consequently, this topographic condition is the primary cause of the flooding (report by the respondent authorities and documentary evidence submitted) b. In the past, flooding was much more frequent, even though the stormwater drainage system has a diameter of one meter; however, approximately two years ago, the Municipalidad de San José built a detention tank (tanque de retardo) at the southwest corner of Parque Bella Vista, specifically in the flood zone. Following its construction, flooding has decreased significantly and has been reported only during extremely heavy rainfall, such as on 22 and 27 October 2015, when extraordinary rainfall occurred and caused flooding throughout the metropolitan area (report by the respondent authorities and documentary evidence submitted) c. The Municipalidad de San José conducted a comprehensive survey of the entire catchment area and is currently working on the hydraulic analysis (report by the respondent authorities and documentary evidence submitted) d. At present, the work crews of the respondent municipality continue to perform ongoing cleaning of the entire stormwater system at the site; the detention tank was serviced one week ago, and the system is in perfect condition (report by the respondent authorities and documentary evidence submitted)
III.Regarding the right to health and the right to enjoy a healthy environment. Public health and the right to a healthy and ecologically balanced environment are constitutionally recognized in Articles 21, 50, 73, and 89 of the Constitución Política, as well as under international law. Specifically, Article 50 of the Constitution expressly recognizes the right of all inhabitants of the country to enjoy a healthy and perfectly balanced environment. That right is a fundamental guarantee for the protection of life and public health. This constitutional provision is supplemented by the provisions of paragraph 11 of the “Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights.” Likewise, regarding the obligations of public authorities to guarantee the right to health and the right to a healthy environment, this Constitutional Court, in judgment No.180-98 at 16:24 hrs. on 13 January 1998, held:
“...the State not only has the inescapable responsibility to ensure that the health of each person comprising the national community is not harmed by third parties in connection with these rights, but must also assume responsibility for creating the social conditions necessary for each person to enjoy their health, that right being understood as a state of physical, psychological (or mental), and social well-being.” Accordingly, the Costa Rican State is obligated to act preventively by using oversight and direct intervention to prevent acts that harm the environment, an obligation inevitably correlated with the State’s duty to safeguard the health of its inhabitants. It should be noted that this Court, as guarantor of fundamental rights, serves as an overseer of compliance with the obligations arising from Articles 21 and 50 of the Constitution, which compel the State not only to recognize the aforementioned rights but also to use materially and legally legitimate means to guarantee them (judgment No. 2007-017341 at 15:42 hrs. on 28 November 2007).
IV.Regarding the specific case. The petitioner, a resident near Parque Bella Vista, located in Rohrmoser, complains about the lack of effective action by the local municipality to help resolve the serious flooding problem he experiences during the rainy season, caused by deficiencies in the operation of the area’s stormwater system. The mayor of San José and the president of the Concejo acknowledge that they are aware of the problem reported by the protected party (amparado), which they claim is caused by the area’s topography and its receipt of runoff from an area of approximately 40 hectares, resulting in flooding during very heavy rainfall. In their defense, however, they state that mitigation works have been carried out and have reduced flooding events compared with those occurring before such works. They state that a detention tank was built at the southwest corner of Parque Bella Vista, specifically in the flood zone, and that following its construction, flooding has decreased significantly and has been reported only during extremely heavy rainfall, such as on 22 and 27 October 2015, when extraordinary rainfall occurred and caused flooding throughout the metropolitan area.
They further argue that, because there are different hypotheses regarding the cause of flooding at the site, a comprehensive survey of the entire catchment area was conducted and they are currently working on the hydraulic analysis. In this regard, the Chamber finds that the Municipalidad de San José is aware of the serious and urgent public-health problem caused by the inadequate stormwater sewerage in the area and that, to date, the problem persists despite the improvements made. It should be noted that, in a subsequent filing, the petitioner refers to and submits evidence of flooding that occurred during the current year, specifically the events of 31 May and 9 June. He adds that the water entering the area during each flood arrives contaminated from various parts of Rohrmoser with chemicals, sewage, organic and inorganic waste, and bacteria from living or decomposing rodents, among other contaminants.
Accordingly, this Chamber considers that the municipality’s failure to adopt concrete, timely, and effective measures to definitively resolve the serious stormwater and environmental-contamination problem affecting the protected party and his neighbors violates the rights to health and to a balanced environment. Consequently, the appropriate course is to grant the application for constitutional relief (recurso de amparo), so that the respondent municipality takes the necessary and appropriate actions to provide a comprehensive and permanent solution to the flooding problem in the neighborhood where the petitioner resides.
I have agreed with the position taken by Justice Jinesta Lobo on this matter. I therefore consider, as a matter of principle, that cases concerning the failure of the Public Administration to repair, construct, modify, or demolish any infrastructure work must be dismissed, because such an omission is a question of ordinary legality, the adjudication of which belongs to the ordinary courts, where the interested person may present their objections more fully. However, when such administrative inaction results in a violation of other fundamental rights protected in this constitutional jurisdiction, or affects groups considered vulnerable, I do address the merits, because that situation constitutes an exception to my position on this matter, as occurs in this case, where it is alleged that the petitioner and 15 other families experience flooding in their homes because of problems with the sewers.
Moreover, it has also been my position that, in environmental matters, if the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the administrative-law courts (jurisdicción contenciosa administrativa). Nevertheless, I do address the merits when other rights of the persons affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Constitución Política), as occurs in this case, where contamination is alleged due to the overflow of water polluted with waste, fecal matter, and mud, in violation of the right to enjoy a healthy and ecologically balanced environment and a dignified quality of life.
The parties are advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced through new technologies, these must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary,” approved by the Corte Plena at session N° 27-11 of 22 August 2011, Article XXVI, and published in the Boletín Judicial number 19 of 26 January 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 May 2012, Article LXXXI.

The application for constitutional relief is granted. Johnny Francisco Araya Monge, mayor of San José, and Luis Rolando Murillo Cruz, president of the Concejo de San José, or whoever holds their respective offices, are ordered to implement the necessary measures so that, within twelve months from notification of this decision, the flooding problem reported by the petitioner is permanently resolved. Those officials are warned that failure to comply with the foregoing orders will constitute the offense of disobedience and that, pursuant to Article 71 of the Law governing this jurisdiction, anyone who receives an order issued in an application for constitutional relief that they must comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years or fined twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. The Municipalidad de San José is ordered to pay the legal costs, damages, and losses caused by the facts underlying this judgment, which shall be assessed during enforcement proceedings before the administrative-law courts. This decision shall be served personally upon Johnny Francisco Araya Monge and Luis Rolando Murillo Cruz, or whoever holds the offices of mayor and president of the Concejo de la Municipalidad de San José. Recurso de amparo interpuesto por Randall Eduardo Trejos Chaves, mayor, casado, administrador, cédula de identidad No. 1-0981-0880, vecino de Rohrmoser, contra el Alcalde y el Presidente del Concejo, ambos de la Municipalidad de San José.
Resultando:
Redacta el Magistrado Castillo Víquez; y,
Considerando:
I.Objeto del recurso. El recurrente alega que la Municipalidad de San José no ha realizado las obras necesarias a fin de solucionar las inundaciones que se producen al costado oeste del Parque Bella Vista, ubicado en Rohrmoser, como las que se presentaron el 22 de agosto y el 27 de octubre, ambos de 2015, cuando la calle ubicada frente a su casa de habitación se llenó de agua contaminada con basura, restos fecales y barro provenientes del boulevard, lo que afectó su vivienda y la de 15 familias más.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque los recurridos hayan omitido referirse a ellos según lo prevenido en el auto inicial:
a. La Sección de la Red Pluvial de la Municipalidad de San José tiene amplio conocimiento de la problemática denunciada por el recurrente, la cual responde a que ese sitio específico (Parque Bella Vista, ubicado en Rohrmoser), es la parte más baja de la zona, a donde escurren aguas desde los cuatro puntos cardinales, conformándose así un Área Tributaria de aproximadamente 40 hectáreas, de manera que esa condición topográfica es la principal generadora de las inundaciones (informe de las autoridades recurridas y prueba documental aportada) b. En el pasado las inundaciones eran mucho más frecuentes, aun y cuando el sistema para evacuar las aguas de lluvia tiene una dimensión de un metro de diámetro, pero aproximadamente hace dos años la Municipalidad de San José construyó un tanque de retardo en la esquina suroeste del Parque Bella Vista, específicamente, en la zona de inundación y posterior a dicha construcción las inundaciones, han disminuido representativamente y se han reportado solo cuando hay altísimas precipitaciones, como el 22 y el 27 de octubre del 2015, fechas en las que se dieron lluvias extraordinarias y se generaron inundaciones en toda el área metropolitana (informe de las autoridades recurridas y prueba documental aportada) c. La Municipalidad de San José realizó un levantamiento integral de toda el Area Tributaria y actualmente trabajan en el análisis hidráulico (informe de las autoridades recurridas y prueba documental aportada) d. En este momento, las cuadrillas del ayuntamiento recurrido continúan con limpieza permanente de todo el sistema pluvial en el sitio, al tanque de retardo se le dio mantenimiento hace una semana y el sistema se encuentra en perfectas condiciones (informe de las autoridades recurridas y prueba documental aportada)
III.Sobre el derecho a la salud y el derecho a gozar de un ambiente sano. La salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente en los artículos 21, 50, 73 y 89 de la Constitución Política, así como a través de la normativa internacional. Específicamente, el artículo 50 constitucional reconoce de forma expresa el derecho de todos los habitantes del país a disfrutar de un medio ambiente saludable y en perfecto equilibrio. Ese derecho es garantía fundamental para la protección de la vida y la salud pública. Esta disposición constitucional se complementa por lo establecido en el numeral 11 del "Protocolo Adicional a la Convención Americana sobre Derechos Humanos en materia de Derechos Económicos, Sociales y Culturales". Asimismo, en relación con las obligaciones que tienen las autoridades públicas de garantizar el derecho a la salud y el derecho a un ambiente sano, este Tribunal Constitucional mediante la sentencia No.180-98 de 16:24 hrs. del 13 de enero de 1998 dispuso:
"...el Estado no solo tiene la responsabilidad ineludible de velar para que la salud de cada una de las personas que componen la comunidad nacional, no sufra daños por parte de terceros, en relación a estos derechos, sino que, además, debe asumir la responsabilidad de lograr las condiciones sociales propicias a fin de que cada persona pueda disfrutar de su salud, entendido tal derecho, como una situación de bienestar físico, psíquico (o mental) y social." En ese sentido, el Estado costarricense se encuentra en la obligación de actuar preventivamente evitando, mediante una fiscalización e intervención directa, la realización de actos que lesionen el medio ambiente, la cual está, inevitablemente, correlacionada con la obligación del Estado de velar por la preservación de la salud de sus habitantes. Cabe señalar que este Tribunal como garante de los derechos fundamentales, se erige como un contralor del cumplimiento de las obligaciones que derivan de lo dispuesto en los artículos 21 y 50 constitucionales, que constriñen al Estado no sólo a reconocer los derechos señalados, sino además a utilizar los medios material y jurídicamente legítimos para garantizarlos (sentencia No. 2007-017341 de las 15:42 hrs. del 28 de noviembre del 2007).
IV.Sobre el caso concreto. El recurrente, vecino del Parque Bella Vista, ubicado en Rohrmoser, reclama por la falta de una acción efectiva por parte del Ayuntamiento del lugar que le ayude a solucionar el grave problema de inundaciones que sufre durante la época lluviosa ocasionada por la deficiencia en el funcionamiento del sistema pluvial de la zona. El alcalde de San José y el presidente del Concejo, reconocen tener conocimiento del problema denunciado por el amparado, el cual alegan obedece a que la condición topográfica y receptora de escorrentía de un área aproximada de 40 hectáreas hace que durante precipitaciones de gran intensidad, la zona sea inundada. Aunque en su descargo acotan que se han realizado obras de mitigación, que han reducido los eventos de inundación con relación a los ocurridos antes de dichas obras. Refieren que se construyó un tanque de retardo en la esquina suroeste del Parque Bella Vista, específicamente, en la zona de inundación y posterior a dicha construcción las inundaciones, han disminuido representativamente y se han reportado solo cuando hay altísimas precipitaciones, como el 22 y el 27 de octubre del 2015, fechas en las que se dieron lluvias extraordinarias y se generaron inundaciones en toda el área metropolitana.
Aparte de que también argumentan que por existir diferentes hipótesis sobre el por qué de las inundaciones en el sitio, se realizó un levantamiento integral de toda el Area Tributaria y actualmente trabajan en el análisis hidráulico. Al respecto la Sala determina que la Municipalidad de San José conoce del grave y urgente problema de salud pública provocado por el deficiente alcantarillado de aguas pluviales que existe en la zona, siendo que, a la fecha el problema persiste, a pesar de las mejoras que se ha realizado. Nótese que, en gestión posterior, el recurrente hace referencia y aporta prueba de inundaciones acaecidas en el presente año, en específico de los eventos que se presentaron el 31 de mayo y el 9 de junio. A lo que agrega que eI agua que reciben en cada inundación viene contaminada desde distintos puntos de Rohrmoser con químicos, aguas negras, basura orgánica e inorgánica, bacterias de roedores vivos o descompuestos, entre otros.
De manera que, esta Sala considera que en la especie se produce el quebranto a los derechos a la salud y a un ambiente equilibrado por la inercia de la municipalidad en adoptar medidas concretas, oportunas y eficaces para resolver en definitiva el grave problema de aguas pluviales y contaminación ambiental que afecta al amparado y sus vecinos. En consecuencia, lo procedente es declarar con lugar el recurso a fin de que la Municipalidad recurrida tome las acciones necesarias y pertinentes que permitan dar una solución integral y definitiva al problema de inundaciones generado en el vecindario donde habita el recurrente.
He coincidido con la posición sustentada por el Magistrado Jinesta Lobo en esta materia, por lo que considero, en tesis de principio, que los casos relacionados con la inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa omisiva se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en que se reclama que el recurrente y 15 familias más sufren problemas de inundaciones en sus viviendas por problemas con las alcantarillas.
Por otra parte, ha sido también criterio del suscrito, que, en los asuntos ambientales, si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusa contaminación por desbordamiento de aguas contaminadas con basura, restos fecales y barro, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial ", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a Johnny Francisco Araya Monge, alcalde de San José y a Luis Rolando Murillo Cruz, presidente del Concejo de San José, o a quienes en sus lugares ejerzan los cargos, disponer las medidas necesarias para que en el plazo de doce meses, contado a partir de la notificación de esta resolución, se resuelva en forma definitiva el problema de inundaciones denunciado por el recurrente. Se les advierte a dichos funcionarios que de no acatar las órdenes anteriores incurrirán en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de San José al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que serán liquidados en ejecución de sentencia de lo contencioso administrativo. Notifíquese la presente resolución a Johnny Francisco Araya Monge y Luis Rolando Murillo Cruz, o a quienes ocupen los cargos de alcalde y presidente del Concejo de la Municipalidad de San José, en forma personal.
