Constitutional challenge (acción de inconstitucionalidad) filed by WILLIAM ALBERTO MEZA FALLAS, of legal age, single, environmental adviser, resident of Paraíso de Cartago, identity card No. 3-465-623, in his capacity as Vice-President and general attorney-in-fact of ASOCIACIÓN PRESERVE PLANET, legal entity identification No. 3-002-519830, domiciled in Cartago, La Unión, residencial Santa Lucía, casa 59, against Decreto Ejecutivo No. 39724-MOPT-MINAE-S, Regulations for the Control of Polluting Emissions Produced by Motor Vehicles with Internal Combustion Engines.

WHEREAS:

  1. 1In a written submission received by the Secretariat of the Sala Constitucional at 14:45 hrs. on 5 de septiembre de 2016, the petitioner filed this constitutional challenge against Decreto Ejecutivo No. 39724-MOPT-MINAE-S, Regulations for the Control of Polluting Emissions Produced by Motor Vehicles with Internal Combustion Engines, and states that said decree contains a series of shortcomings that impair the enjoyment of the right proclaimed in Article 50 of the Constitución Política. Although said Decree establishes a progressive mechanism for compliance with the EURO technical standards, under which vehicles imported during 2017 must comply with the EURO 3 standards and progressively advance until reaching EURO 6 in 2021, those technical standards are updated every 4 years, such that the criterion to be applied in 2021 will already be obsolete. Furthermore, although said Decree establishes a series of inspection procedures that must be conducted when each vehicle enters the country, the authorities of the Ministerio de Hacienda have acknowledged that those regulations cannot be applied in practice and therefore must be entirely revised.He argues that those regulations fail to regulate the emissions of vehicles currently in circulation, and consequently that sector remains subject to the limits established in Decreto Ejecutivo No. 28280-MOPT-MINAE-S. He asserts that although the challenged Decree provides for the lambda factor, its application is classified solely as a minor defect in the Vehicle Technical Inspection (Inspección Técnica Vehicular). The challenged regulations are an exact copy of those in force since 1999, meaning that they are 20 years old. The issuance of the challenged Decree in the terms in which it was drafted constitutes noncompliance with the ruling of the Sala Constitucional in judgment No. 2015-19634 of 09:05 hrs. on 18 de diciembre de 2015. In Articles 14 and 20 and Transitorio IV, the regulatory text refers all inspection procedures to the Manual de Procedimientos para la revisión técnica de vehículos automotores en los centros de revisión técnica vehicular, which dates from 2012 and does not define the procedures for the dynamic tests specified in Article 8º, thereby requiring continued use of the static tests dating from 1993 and contained in Decreto Ejecutivo No. 28280-MOPT-MINAE-S.The Agreement on Technical Barriers to Trade contained in Anexo 1.A of Ley No. 7475, “Aprobación del Acta Final en que se incorporan los Resultados de la Ronda Uruguay de Negociaciones Comerciales Multilaterales,” sets forth a series of principles and commitments that member States must observe when creating and implementing technical regulations, including that such regulations must not create unnecessary obstacles to international trade. The challenged regulations were issued without observing the provisions governing the issuance of technical regulations, which affects the suitability of their provisions. He considers that the regulations in question violate the principle of legality (principio de legalidad). He requests that the challenge be granted and the challenged regulations declared unconstitutional.
  2. 2The Presidency of the Sala Constitucional, by means of the decision issued at 10:02 hrs. on 6 de septiembre de 2016, ordered: “Petitioner WILLIAM ALBERTO MEZA FALLAS, of legal age, single, environmental adviser, resident of Paraíso de Cartago, identity card No. 3-465-623, in his capacity as Vice-President and general attorney-in-fact of ASOCIACION PRESERVE PLANET, legal entity identification No. 3-002-519830, is hereby ordered, within three days counted from the day following service of this decision and subject to the warning that the challenge will be denied processing in the event of noncompliance, TO STATE the legal provision and circumstances on which he bases his claim of standing (legitimación) to bring this constitutional challenge against Decreto Ejecutivo No. 39724-MOPT-MINAE-S, ‘Reglamento para el control de emisiones contaminantes producidas por los vehículos automotores con motor de combustión interna.’ This is because, upon reviewing the submission instituting the challenge, that argument is found to be absent. Let notice be served.”
  3. 3In a written submission received by the Secretariat of the Sala Constitucional at 13:48 hrs. on 8 de septiembre de 2016, the petitioner appeared in the proceedings and complied with the terms of the order. He requests a ruling accordingly.
  4. 4Article 9º of the Ley de la Jurisdicción Constitucional authorizes the Chamber, at any time and even upon filing, to summarily dismiss or dismiss on the merits any application submitted for its consideration that is manifestly inadmissible, when it finds sufficient grounds for dismissal, or when the application merely reiterates or reproduces a previously rejected identical or similar application.

Magistrate Jinesta Lobo drafts the judgment; and,

CONSIDERING:

I. SUBJECT MATTER OF THE CHALLENGE

The petitioner challenges the compliance with Constitutional Law (Derecho de la Constitución) of Decreto Ejecutivo No. 39724-MOPT-MINAE-S, Regulations for the Control of Polluting Emissions Produced by Motor Vehicles with Internal Combustion Engines, which was issued precisely in response to the order entered by the Sala Constitucional in judgment No. 2015-19634 at 09:05 hrs. on 18 de diciembre de 2016 concerning the Executive Branch’s failure to regulate the provisions of Article 38 and Transitorio XII of Ley No. 9078, Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial, regarding the control of polluting gas emissions from every motor vehicle operating in this country. According to the petitioner, this Decree contains a series of shortcomings that impair the enjoyment of the right proclaimed in Article 50 of the Constitución Política. In general terms, the petitioner disagrees with the technical criteria underpinning those regulations, most of which he considers outdated and obsolete, and further argues that the prescribed procedure for issuing a regulation of that nature was not followed. According to the petitioner, that situation is unlawful and violates Constitutional Law.

II. INADMISSIBILITY OF THE CHALLENGE BECAUSE, AT BOTTOM, THE MATTER DISPUTED BY THE PETITIONER IS ONE OF ORDINARY LEGALITY

After assessing the petitioner’s arguments challenging the compliance with Constitutional Law of Decreto Ejecutivo No. 39724-MOPT-MINAE-S, Regulations for the Control of Polluting Emissions Produced by Motor Vehicles with Internal Combustion Engines, and specifically the various technical criteria embodied in those regulations, which he considers inappropriate and outdated, the Chamber finds that, at bottom, and despite the petitioner’s considerable argumentative effort, the matter disputed in the present case is not one that should be heard by this Constitutional Court. Rather, it is plainly a dispute concerning ordinary legality that must be heard exclusively within the ordinary judicial jurisdiction, specifically by the Contentious-Administrative Jurisdiction (Jurisdicción Contenciosa Administrativa).

III.Indeed, it clearly exceeds the scope of these constitutional-review proceedings to determine whether the considerations of expediency and advisability reflected in the challenged regulations comply with the legal system, or to analyze whether the technical criteria on which those provisions are based are appropriate, as the petitioner seeks. All such matters must be litigated before the ordinary courts and not before this Constitutional Court, whose jurisdiction is limited solely to assessing whether subconstitutional rules comply with the Constitución Política or to safeguarding the fundamental rights protected by that Fundamental Text or by the International Human Rights Instruments applicable in the Republic. All of this is unrelated to the matter raised by the petitioner, which in any event involves the analysis of various complex items of evidence that far exceed the purpose and nature of constitutional review, under paragraph 2º of Article 75 of the Ley de la Jurisdicción Constitucional. On this point, in a case analogous to the present one, in which the validity of the technical criteria supporting the allocation of import tariff quotas was challenged in connection with Decreto Ejecutivo No. 30900-COMEX-MAG of 20 de diciembre de 2002, the Sala Constitucional, by means of judgment No. 2016-4282 at 09:30 hrs. on 30 de marzo de 2016, held:

“III.- SUMMARY DISMISSAL OF THE CHALLENGE BECAUSE THE ASSESSMENT OF THE TECHNICAL CRITERIA SUPPORTING THE ALLOCATION OF TARIFF QUOTAS IS A MATTER OF ORDINARY LEGALITY. The Sala Constitucional, by means of judgment No. 2015-010346 at 14:50 hrs. on 14 de julio de 2015, held that assessing the technical criteria supporting the actions taken by the Ministerio de Comercio Exterior when allocating the tariff quotas resulting from the application of the multilateral commitments undertaken by the Costa Rican State before the Organización Mundial del Comercio and under the free-trade agreements in force constitutes a matter plainly concerning ordinary legality that must be litigated before the ordinary courts, based on the following considerations:

“I.- The petitioner (recurrente) requests assistance from this Chamber because the respondent (recurrido) applied a tariff-quota allocation mechanism (mecanismo de asignación de contingentes arancelarios) that is disproportionate with respect to the importation of milled rice and, consequently, to free competition. He states that this mechanism is based on an Executive Decree that he considers unconstitutional because it was not submitted for public consultation. He therefore requests that the challenged administrative acts (actos administrativos), official letters DMR-00026-15 and DMR-00027-15, and the tariff-quota compensation and distribution mechanism established by that ministry be annulled. Nevertheless, it must be stated that this Chamber is not an overseer of the legality of the actions or decisions of the Administration, and it is not for this Court to review, under the applicable law, whether the tariff-quota allocation mechanism challenged by the petitioner should or should not have been applied, since that task properly belongs in the ordinary administrative and judicial proceedings (vía común -administrativa y jurisdiccional-).

Likewise, it is observed that the disagreement with the agreements and clauses considered during the compensation negotiations between the Government of Costa Rica and the República Argentina and the República Oriental del Uruguay, in which parameters for the administration of the quotas were agreed upon and access was defined for rice importers and the domestic rice industry, constitutes a dispute that must properly be brought before the Executive Branch itself so that it may assess the possible circumstances and the petitioner’s claims. Furthermore, if his intent is to challenge the regulations underlying those agreements, the applicant may, if he sees fit, pursue the corresponding legal remedies so that the matter may be resolved as required by law. In view of the foregoing considerations, the appeal is inadmissible, and it must be summarily dismissed (rechazo de plano), pursuant to Article 9 of the Ley de la Jurisdicción Constitucional.” Based on the considerations outlined in the judgment transcribed above, the Chamber finds that the assessment of the technical criteria supporting the allocation, in the present case, of a tariff quota of 80% to applicants with a historical record, as opposed to the 20% allocated to new applicants, in connection with sugar imports, is plainly a matter of legality.

All of this must be analyzed within the context of the ordinary jurisdiction (Jurisdicción ordinaria), through the exercise of the causes of action provided by the legal system for that purpose. The situation challenged by the claimants is not reviewable before the Constitutional Chamber (Sala Constitucional); consequently, this matter must be summarily dismissed.” Moreover, in Judgment No. 2015-18871, at 14:30 hrs. on 1 de diciembre de 2015, the Sala Constitucional held:

“In addition, this Constitutional Court cannot replace MINAE in the exercise of its powers for the purpose of ruling in the abstract (…) on the suitability of the quotas and qualification methods established in Decreto N° 39083-MINAET, since that task requires an analysis of technical criteria and considerations of legality, timeliness, and appropriateness.”

IV.Note that, in this specific case, the claimant does not actually put forward any argument concerning the conformity of the challenged Executive Decree with Constitutional Law (Derecho de la Constitución), but instead alleges possible violations of the principle of legality (principio de legalidad) arising from the application and interpretation of those regulations. This matter must be heard within the context of the ordinary jurisdiction, rather than before the constitutional jurisdiction (Jurisdicción Constitucional). It should be noted that no comment is made on this occasion regarding the claims raised by the claimant, precisely so that this issue may be discussed and resolved in the appropriate jurisdiction.

V. CONCLUSION

Accordingly, because the dispute arising from the application of the aforementioned Executive Decree is deemed, in the present case, to exceed the scope of the powers of this Jurisdicción Constitucional, the action must be summarily dismissed.

VI. DOCUMENTATION SUBMITTED TO THE CASE FILE (EXPEDIENTE)

The parties are hereby advised that, if they have submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as pursuant to the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.

THEREFORE:

Acción de inconstitucionalidad promovida por WILLIAM ALBERTO MEZA FALLAS, mayor, soltero, asesor ambiental, vecino de Paraíso de Cartago, cédula de identidad No. 3-465-623, en su condición de Vicepresidente y apoderado general de la ASOCIACIÓN PRESERVE PLANET, cédula jurídica No. 3-002-519830, con domicilio en Cartago, La Unión, residencial Santa Lucía, casa 59, contra el Decreto Ejecutivo No. 39724-MOPT-MINAE-S, Reglamento para el Control de las Emisiones Contaminantes Producidas por los Vehículos Automotores con Motor de Combustión Interna.

RESULTANDO:

  1. 1Por escrito recibido en la Secretaría de la Sala Constitucional a las 14:45 hrs. de 5 de septiembre de 2016, el actor interpone la presente acción de inconstitucionalidad contra el Decreto Ejecutivo No. 39724-MOPT-MINAE-S, Reglamento para el Control de las Emisiones Contaminantes Producidas por los Vehículos Automotores con Motor de Combustión Interna y manifiesta que dicho decreto contiene una serie de falencias que cercenan el goce del derecho proclamado en el artículo 50 de la Constitución Política. Aunque dicho Decreto establece un mecanismo progresivo de cumplimiento de las normas técnicas EURO, según el cual, los vehículos que se importen durante el año 2017, deben cumplir las normas EURO 3 y, progresivamente, hasta alcanzar el EURO 6, en el año 2021, dichas normas técnicas se renuevan cada 4 años, de tal modo que el criterio que se aplicará en el año 2021 ya estará obsoleto. Además, si bien dicho Decreto establece una serie de procesos de control que deben efectuarse al ingreso de cada vehículo del país, las autoridades del Ministerio de Hacienda han reconocido que dicha normativa no es aplicable en la práctica, por lo que debe ser renovada en su totalidad.Sostiene que ese reglamento es omiso en regular las emisiones del flujo vehicular circulante, en la actualidad, por lo que este sector mantiene vigentes los límites establecidos en el Decreto Ejecutivo No. 28280-MOPT-MINAE-S. Afirma que, aunque en el Decreto impugnado se estipula el factor lambda, se establece su aplicación, únicamente, como un defecto leve en la Inspección Técnica Vehicular. La normativa cuestionada es una copia exacta de la vigente desde 1999, es decir, con 20 años de antigüedad. La emisión del Decreto cuestionado, en los términos en que ha sido redactado, supone un incumplimiento de lo resuelto por la Sala Constitucional en la sentencia No. 2015-19634 de las 09:05 hrs. de 18 de diciembre de 2015. El texto reglamentario, en sus artículos 14, 20 y Transitorio IV, establece la remisión de todos los procedimientos de inspección al Manual de Procedimientos para la revisión técnica de vehículos automotores en los centros de revisión técnica vehicular, el cual, data de 2012 y no define los procedimientos para las pruebas dinámicas determinadas en el artículo 8º, lo que obliga a que se continúe con la aplicación de las pruebas estáticas, que provienen del año 1993 y que están contenidas en el Decreto Ejecutivo No. 28280-MOPT-MINAE-S.El Acuerdo sobre Obstáculos Técnicos de Comercio contenido en el Anexo 1.A de la Ley No. 7475, “Aprobación del Acta Final en que se incorporan los Resultados de la Ronda Uruguay de Negociaciones Comerciales Multilaterales”, estipula una serie de principios y compromisos que los Estados miembros deben observar a la hora de crear e implementar reglamentos técnicos, entre los cuales, se puede mencionar que no sean objeto de obstáculos innecesarios al comercio internacional. La normativa cuestionada fue emitida sin observar las disposiciones que regulan la emisión de reglamentos técnicos, lo que repercute sobre la pertinencia de sus disposiciones. Considera que la normativa en cuestión vulnera el principio de legalidad. Solicita que se declare con lugar la acción y la inconstitucionalidad de la normativa impugnada.
  2. 2La Presidencia de la Sala Constitucional, por medio de la resolución de las 10:02 hrs. de 6 de septiembre de 2016, dispuso: “ Se previene al accionante WILLIAM ALBERTO MEZA FALLAS, mayor, soltero, asesor ambiental, vecino de Paraíso de Cartago, cédula de identidad No. 3-465-623, en su condición de Vicepresidente y apoderado general de la ASOCIACION PRESERVE PLANET, cédula jurídica No. 3-002-519830, que dentro del tercer día, contado a partir del siguiente a la notificación de esta resolución y bajo apercibimiento de denegarle el trámite a la acción en caso de incumplimiento, DEBERÁ indicar con sustento en qué norma y bajo cuál situación, considera que goza de legitimación para promover esta acción de inconstitucionalidad contra el Decreto Ejecutivo No. 39724-MOPT-MINAE-S "Reglamento para el control de emisiones contaminantes producidas por los vehículos automotores con motor de combustión interna". Lo anterior, por cuanto, tras revisar el memorial de interposición de la acción, se echa de menos esa argumentación. Notifíquese”.
  3. 3En escrito recibido en la Secretaría de la Sala Constitucional a las 13:48 hrs. de 8 de septiembre de 2016, el actor se apersona al proceso y satisface los términos de la pretensión. Pide que se resuelva conforme.
  4. 4El artículo 9º de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Jinesta Lobo; y,

CONSIDERANDO:

I. SOBRE EL OBJETO DE LA ACCIÓN

Impugna la parte actora la conformidad con el Derecho de la Constitución del Decreto Ejecutivo No. 39724-MOPT-MINAE-S, Reglamento para el Control de las Emisiones Contaminantes Producidas por los Vehículos Automotores con Motor de Combustión Interna, que fue emitido, justamente, en razón de la orden dictada por la Sala Constitucional, en la sentencia No. 2015-19634, de las 09:05 hrs. de 18 de diciembre de 2016, con respecto a la omisión del Poder Ejecutivo de reglamentar lo previsto por el artículo 38 y el Transitorio XII de la Ley No. 9078, Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial, en cuanto al control de emisiones con gases contaminantes para todo vehículo automotor que circule en este país. Según el accionante, este Decreto contiene una serie de falencias que cercenan el goce del derecho proclamado en el artículo 50 de la Constitución Política. En términos generales, el actor se muestra inconforme con los criterios técnicos que sustentan esa normativa, los cuales, en su gran mayoría, los estima desfasados y obsoletos, además que no se ha observado el procedimiento regulado para la emisión de una norma de esa índole. Tal situación, según la parte actora, es ilegítima y lesiona el Derecho de la Constitución.

II. SOBRE LA IMPROCEDENCIA DE LA ACCIÓN, PUES EN EL FONDO LO DISCUTIDO POR LA PARTE ACTORA ES UN ASUNTO DE MERA LEGALIDAD

Tras valorar los argumentos que formula la parte actora, dirigidos a cuestionar la conformidad con el Derecho de la Constitución del Decreto Ejecutivo No. 39724-MOPT-MINAE-S, Reglamento para el Control de las Emisiones Contaminantes Producidas por los Vehículos Automotores con Motor de Combustión Interna y, en concreto, con los diversos criterios técnicos que se plasman en esa normativa, los cuales los considera inoportunos y desactualizados, la Sala aprecia que, en el fondo, y pese al notable esfuerzo argumentativo del accionante, lo discutido, en el caso presente, no es un asunto que deba ser conocido por este Tribunal Constitucional. Se trata, más bien, de una disputa de franca legalidad que debe ser ventilada, únicamente, en el ámbito de la Jurisdicción ordinaria, en concreto, por la Jurisdicción Contenciosa Administrativa.

III.En efecto, a todas luces excede el objeto de este proceso de control de constitucionalidad determinar la conformidad con el ordenamiento jurídico de los criterios de oportunidad y conveniencia que recoge la normativa cuestionada, así como analizar la pertinencia o no de los criterios técnicos en que se sustenta esas disposiciones, como lo pretende la parte actora, todo lo cual debe ser discutido por los tribunales ordinarios, y no por este Tribunal Constitucional, cuyas competencias se circunscriben, únicamente, a valorar la conformidad con respecto a la Constitución Política de las normas infra-constitucionales, o bien, la defensa de los derechos de carácter fundamental protegidos en ese Texto Fundamental, o en los Instrumentos Internacionales en materia de Derechos Humanos aplicables en la República, todo lo que resulta ajeno al asunto planteado por la parte actora, lo que involucra, en todo caso, el análisis de diversos y complicados elementos de prueba que exceden, sobradamente, el propósito y la naturaleza del control de constitucionalidad, en los términos del párrafo 2º, del artículo 75, de la Ley de la Jurisdicción Constitucional.

Sobre el particular, en un caso análogo al presente, en que se cuestionó la validez de los criterios técnicos que justifican la asignación de los contingentes arancelarios de importación, con ocasión del Decreto Ejecutivo No. 30900-COMEX-MAG de 20 de diciembre de 2002, la Sala Constitucional, por medio de la sentencia No. 2016-4282, de las 09:30 hrs. de 30 de marzo de 2016, dispuso:

“III.- SOBRE EL RECHAZO DE PLANO DE LA ACCIÓN, PORQUE LA VALORACIÓN DE LOS CRITERIOS TÉCNICOS QUE JUSTIFICAN LA ASIGNACIÓN DE LOS CONTINGENTES ARANCELARIOS ES UN EXTREMO DE MERA LEGALIDAD. La Sala Constitucional, por medio de la sentencia No. 2015-010346 de las 14:50 hrs. de 14 de julio de 2015, consideró que constituye un extremo de franca legalidad, que debe ser ventilado ante la Jurisdicción ordinaria, la valoración de los criterios técnicos que justifican los actos dictados por el Ministerio de Comercio Exterior, a la hora de asignar los contingentes arancelarios que resultan de la aplicación de los compromisos multilaterales que, ante la Organización Mundial del Comercio y los tratados de libre comercio vigentes, ha suscrito el Estado costarricense, con sustento en el siguiente orden de consideraciones:

“I.- El recurrente solicita ayuda a esta Sala debido a que el recurrido aplicó un mecanismo de asignación de contingentes arancelarios que resulta desproporcionado para la importación de arroz pilado, y por ende, para la libre competencia. Dice que tal mecanismo, se fundamenta en un Decreto Ejecutivo que considera inconstitucional, por no haber sido sometido a consulta pública. Por ello, solicita se anulen los actos administrativos impugnados, oficios DMR-00026-15 y DMR-00027-15, y del mecanismo de compensación y distribución del contingente arancelario, dispuesto por ese ministerio. No obstante, debe indicarse que esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones de la Administración, y no corresponde a este Tribunal revisar, de conformidad con la ley aplicable, si debía o no, aplicarse el mecanismo de asignación de contingentes arancelarios que cuestiona el recurrente, toda vez que se trata de una labor propia de la vía común -administrativa y jurisdiccional-.

Asimismo, se observa que la disconformidad con los acuerdos y cláusulas que se tomaron en cuenta en las negociaciones de compensación del Gobierno de Costa Rica con la República Argentina y de la República Oriental del Uruguay, en que se acordaron parámetros para la administración de los contingentes y definieron el acceso a los importadores de arroz y a la industria arrocera nacional, constituye una discusión propia de plantearse ante el mismo Poder Ejecutivo, para que valoren las posibles circunstancias y las pretensiones del recurrente. Además, si lo que pretende es impugnar la normativa que da sustento a esos acuerdos, podrá el petente, si a bien lo tiene, acudir a los medios legales correspondientes, para que se resuelva conforme en derecho proceda. Dadas las consideraciones dichas, el recurso es inadmisible y procede su rechazo de plano, de conformidad con lo dispuesto en el artículo 9 de la Ley de la Jurisdicción Constitucional.” Partiendo de las consideraciones esbozadas en la sentencia transcrita, la Sala estima que constituye un aspecto de franca legalidad la valoración de los criterios técnicos que justifican que, en el caso presente, se asigne un contingente arancelario de un 80% a los solicitantes que tienen un registro histórico, frente al 20% que se atribuye a los solicitantes nuevos, con respecto a la importación del azúcar, todo lo cual debe ser analizado en el contexto de la Jurisdicción ordinaria, mediante el ejercicio de las acciones que el ordenamiento estipula con ese fin. No es revisable la situación impugnada por los actores ante la Sala Constitucional y, por ende, lo que procede es el rechazo de plano de este asunto”.

Más aún, en la sentencia No. 2015-18871, de las 14:30 hrs. de 1 de diciembre de 2015, la Sala Constitucional consideró:

“A ello se suma que este Tribunal constitucional tampoco puede reemplazar al MINAE en la gestión de sus competencias, a efecto de pronunciarse en abstracto, (…) sobre la idoneidad de la cuotas y formas de calificación establecidas en el Decreto N° 39083-MINAET, pues ello es una labor que requiere analizar criterios técnicos, de legalidad, oportunidad y conveniencia”.

IV.Nótese que, en el caso concreto, no formula el actor, en realidad, ningún argumento relativo a la conformidad con el Derecho de la Constitución del Decreto Ejecutivo cuestionado, sino, al contrario, posibles infracciones al principio de legalidad a propósito de la aplicación y la interpretación esa normativa, lo que debe ser ventilado en el contexto de la Jurisdicción ordinaria, y no así, ante la Jurisdicción Constitucional. Cabe mencionar que, en esta ocasión, no se realiza comentario alguno sobre los extremos que plantea la parte actora, a fin que este punto sea discutido y resuelto, justamente, en la Jurisdicción correspondiente.

V. CONCLUSIÓN

De este modo, al considerarse, en el caso presente, que el conflicto que supone la aplicación del Decreto Ejecutivo aludido desborda el ámbito de las competencias de esta Jurisdicción Constitucional, lo que procede es el rechazo de plano de la acción.

VI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:
