Optional legislative consultation on constitutionality (consulta legislativa facultativa de constitucionalidad) submitted by Deputies GERARDO VARGAS ROJAS, GONZALO RAMÍREZ ZAMORA, HUMBERTO VARGAS CASCANTE, JOHNNY RAFAEL LEIVA BADILLA, JORGE RODRÍGUEZ ARAYA, JOSÉ ALBERTO ALFARO JIMÉNEZ, LUIS ALBERTO VASQUEZ CASTRO, MARIO REDONDO POVEDA, OSCAR ANDRÉS LÓPEZ ARIAS, OTTO GUEVARA, RAFAEL ANGEL ORTÍZ FABREGA, and ROSIBEL RAMOS MADRIGAL, concerning the approval of the bill “Strengthening of the Instituto Costarricense de Ferrocarriles (Incofer) and Promotion of the Interurban Electric Train of La Gran Área Metropolitana,” legislative file No. 18252.

BACKGROUND

  1. 1In a written submission filed with this Constitutional Chamber at 10:20 hrs. on 29 de abril de 2016, the consulting Deputy and Deputies submit an optional legislative consultation on constitutionality concerning the bill “Strengthening of the Instituto Costarricense de Ferrocarriles (INCOFER) and Promotion of the Interurban Electric Train of La Gran Área Metropolitana,” legislative file No. 18252, because they have doubts concerning the constitutionality of Article 3, subsections a) and ch), Article 16, subsection ch), and Article 39 of the referenced bill. Article 16 creates a special administrative procurement regime (régimen especial de contratación administrativa) for the benefit of INCOFER that could violate the principle of equality (principio de igualdad) among public entities. The provision introduces a differentiated framework for the benefit of that entity, similar to the one currently enjoyed by ICE and which the Legislature created in the past in response to the opening of the Telecommunications Sector market following the signing of the Dominican Republic–Central America–United States Free Trade Agreement and its subsequent approval through Law No. 8622.That law contains certain prerogatives that do not apply to other public entities generally, but which, in the case of ICE, were fully justified by its imminent entry into the telecommunications market as a new provider. This Constitutional Chamber is asked whether, considering the institutional circumstances of INCOFER, which differ from the circumstances that justified the enactment of the cited Law No. 8660, the current legislature may incorporate subsection ch) into Article 16 of the bill in order to apply to Instituto Costarricense de Ferrocarriles a regulatory framework similar to the one currently governing ICE. Through this provision, the bill seeks to expand the scope of authority (marco competencial) of INCOFER without specifying precisely which services are meant when the provision states that the institution may provide “related services” (servicios conexos), as can be inferred from the proposed amendment to Article 3, subsection a), of Law 7001.This provision establishes the possibility of autonomous borrowing (endeudamiento autónomo), both domestically and externally, up to a maximum limit of 40% relative to its total assets. INCOFER could negotiate, enter into, and execute medium- and long-term foreign loans (créditos externos) up to the indicated debt level without needing to obtain legislative approval. Such authority constitutes a clear constitutional defect (vicio de constitucionalidad) because, under the Costa Rican legal system, public contracts (contratos públicos) related to public credit (crédito público) and entered into by the Executive Branch are subject—for their validity and subsequent performance—to the necessary approval of the Legislative Assembly, which is the only body constitutionally empowered to approve or reject them. Lastly, INCOFER is authorized to establish “encumbrances” (gravámenes). However, pursuant to subsection 14 of Article 121 of the Political Constitution, one of the powers of the Legislative Assembly is to decree the disposal (enajenación) of assets belonging to the Nation or to designate them for public uses.In this regard, the constitutional provision expressly establishes that assets such as railroads may not be removed from state ownership (dominio estatal). Accordingly, because INCOFER is the institute that administers these assets in the country, a provision as broad as the one contained in the referenced paragraph could conceivably cause confusion unless its content is clarified. There could be a conflict with the Constitution (roce constitucional) under Article 121, subsection 14, of the Political Constitution when a general authorization to dispose of real property is granted, since, under that constitutional provision, such authorization must be granted by the Legislative Assembly through prior legislation.
  2. 2By decision issued at 11:18 hrs. on 29 de abril de 2016, the Presidency of the Chamber deemed the referenced consultation to have been duly submitted and requested transmission of legislative file No. 18252 or a certified copy thereof. It also noted that the period established by Article 101 of the Law on Constitutional Jurisdiction begins to run once the materials necessary for adjudication are available—that is, after receipt of the requested documents—because it is from that point that a Justice is internally assigned to begin examining the merits (fondo) of the matters submitted for consultation.
  3. 3The certified copy of legislative file No. 18252 was received by the Chamber on 03 de mayo de 2016, and, by decision issued at 8:12 hrs. on 04 de mayo de 2016, the matter was assigned to the chambers of Justice Cruz Castro. Consequently, the deadline for responding to the consultation expires on 03 de junio of the current year.
  4. 4The proceedings have complied with the provisions of Article 100 of the Law on Constitutional Jurisdiction, and this decision is issued within the period established by Article 101 thereof.

Justice Cruz Castro authors the decision; and,

CONSIDERING:

I. ADMISSIBILITY OF THE CONSULTATION AND STANDING OF THE CONSULTING PARTIES

Article 96, subsection b), of the Law on Constitutional Jurisdiction provides that this Chamber may issue prior advisory opinions (opiniones consultivas previas) on legislative bills when the consultation is submitted by no fewer than ten Deputies. The purpose of the legislative consultation (consulta legislativa) is to review bills after their approval in the first debate and before final approval (second debate, Article 124 of the Constitution). Because the requirements established by that provision have been met, this consultation is therefore admissible as to the merits of the bill “Strengthening of the Instituto Costarricense de Ferrocarriles (INCOFER) and Promotion of the Interurban Electric Train of La Gran Área Metropolitana,” legislative file No. 18252, hereinafter also referred to as legislative file No. 18252.

II.Pursuant to Article 96, subsection b), of the Law on Constitutional Jurisdiction, an optional legislative consultation was submitted by more than ten Deputies; therefore, in such cases, the Chamber is required to review only those matters specifically and concretely challenged by the consulting parties, and not every general issue concerning the constitutionality of the bill containing the challenged provisions, as provided by Article 99 of the law governing this jurisdiction. Likewise, this Chamber considers that the ruling issued herein does not conclusively prejudge what this same body may decide regarding this law when ruling on constitutional challenges (acciones de inconstitucionalidad) filed on the basis of different reasoning or evidentiary considerations.

III. CHRONOLOGY OF THE PROCESSING OF LEGISLATIVE FILE No

18252. For purposes of the issues raised in this consultation, it is relevant to summarize the following significant events in the processing of this legislative file:

It recommended consolidating (refundir) both bills under expediente No. 18252; accordingly, it issued an unfavorable committee opinion (dictamen negativo) on project No. 18310 because those proposals were incorporated into project No. 18252, on which it issued a favorable committee opinion (dictamen positivo) and submitted substitute text for the project (folio 284 al 312 del expediente).

IV. REGARDING THE TEXT OF THE BILL UNDER REVIEW

The text of the bill that is the subject of this consultation concerns Article 16, subsection ch), as well as Article 3, subsections a) and ch), and Article 39 of the bill, which provide, respectively:

“ Article 16.- The duties and powers of the Board of Directors are:

(…)

ch) To approve the Instituto’s acquisitions of goods and services in accordance with the special public procurement regime (Régimen especial de contratación administrativa) established in Chapter IV of Title II of Ley N.° 8660, Fortalecimiento y Modernización de las Entidades Públicas del Sector de Telecomunicaciones, of 8 de agosto de 2008, as well as with the regulations issued for that purpose. To that end, the Instituto Costarricense de Ferrocarriles shall be governed by the provisions of those rules, shall possess the same authority and powers that said law grants to the Instituto Costarricense de Electricidad, and its public procurement activities shall be audited by the Contraloría General de la República.” “ Article 3.- The Instituto’s principal objectives are:

  • a)To strengthen the country’s economy through the administration of a modern rail transportation system for passenger and freight service throughout the national territory. It may also provide services related to that system and undertake other investments and infrastructure works on real property that it owns or, subject to a prior agreement between the parties, on real property belonging to other public institutions, municipal utility companies, rural electrification cooperatives and their consortia, governed by Ley N.° 8345, Participación de las Cooperativas de Electrificación Rural y de las Empresas de Servicios Públicos Municipales en el Desarrollo Nacional, of 26 de febrero de 2003, and its amendments, as necessary for the construction, operation, and maintenance of the railway system. Likewise, it may undertake other investments or works on real property that it owns that generate resources to finance its rail transportation projects, provided that such activities do not affect its provision of transportation services.

ch) To electrify, rebuild, realign, and extend its entire existing railway network. For these purposes, the Instituto is authorized to negotiate, contract for, and execute, autonomously, medium- and long-term domestic and foreign borrowing up to a maximum debt level of forty percent (40%) in relation to its total assets, as well as to create encumbrances and obtain domestic or foreign resources by any lawful means. The debt level shall be calculated on the basis of the consolidated total value of the Instituto’s total assets as of 31 de diciembre of the preceding year; short-term liabilities shall be excluded from the calculation. Changes in the Instituto’s total liabilities resulting from exchange-rate fluctuations shall not be taken into account when measuring the net change in total liabilities for purposes of calculating the debt level governed by this Article. The Instituto shall maintain adequate accounting records, which must be updated periodically, concerning institutional assets, or shall employ other suitable mechanisms to ensure an accurate valuation of those assets.

If the required borrowing exceeds the percentage specified in the preceding paragraph, approval from the Asamblea Legislativa must be obtained." “ Article 39.- For all legal purposes, the Instituto shall have the status of an administrative entity serving the public interest (ente administrativo de utilidad pública). To enable it to fulfill its objectives promptly and efficiently, State agencies, particularly the Ministerio de Obras Públicas y Transportes (MOPT), as well as autonomous institutions—except for the Caja Costarricense de Seguro Social (CCSS)—semi-autonomous institutions, and public enterprises are authorized to assign, transfer, manage, negotiate, collaborate, donate, or lease, free of charge, all types of resources, services, movable and immovable property, materials, and equipment, and to transfer personnel to the Instituto, without requiring authorization or approval from any other public agency.”

V. REASONS FOR SUBMITTING THIS CONSULTATION

In the brief submitted to the Constitutional Chamber (Sala), the consulting Deputies seek this Court’s opinion on substantive matters relating to the following issues: 1. Regarding Article 16, subsection ch). They consider that this provision creates a special administrative procurement regime (régimen especial de contratación administrativa) for INCOFER that could violate the principle of equality among public entities. This is because it establishes for that entity a differentiated framework similar to the one currently enjoyed by ICE, which the Legislature created in the past in response to specific circumstances that justified its creation, namely: the opening of the Telecommunications Sector market following the signing of the Dominican Republic–Central America–United States Free Trade Agreement and its subsequent approval by Law No. 8622. Indeed, after that sector was opened and for the purpose of protecting the Instituto Costarricense de Electricidad from the harm it could suffer by having to relinquish its monopoly and face free competition, the Legislature deemed it appropriate to strengthen that public entity by releasing it from the obligation to comply with the ordinary administrative procurement framework (esquema ordinario de contratación administrativa).

To that end, it provided ICE with a special regime that would enable it to compete on equal terms with its private-sector competitors, which, because of their legal status, enjoyed greater flexibility in competing in the market. The laws enacted at that time for the benefit of ICE were the Ley General de Telecomunicaciones, No. 8642, and the Ley de Fortalecimiento y Modernización de las Entidades Públicas del Sector Telecomunicaciones, No. 8660, whose procurement regime INCOFER now seeks to apply to itself. The latter law contains certain prerogatives that do not apply generally to other public entities but that, in the case of ICE, were fully justified by its imminent entry as a new provider in the telecommunications market after it ceased providing its services under monopoly conditions due to the signing of the FTA. The possibility of doing so under the aforementioned Law No. 8660 was even endorsed by this high Court, as evidenced by Decision No. 8672-2010, in which the Justices considered that it would be neither appropriate nor advisable for the opening of the markets to weaken or lead to the eventual extinction of the public entities that would thereafter offer their services under the new competitive regime.

Accordingly, to balance their position—subject to the rigid requirements of public law (Derecho público)—the Constitutional Chamber accepted that the State could grant ICE a series of compensatory measures intended to enable that entity to conduct its business, commercial, or industrial activities through this framework. Such activities are otherwise natural and inherent to persons governed by private law (sujetos del Derecho privado), who, moreover, because they are not subject to the tendering procedures (procesos licitatorios) governing the State’s commercial activity, may employ more expeditious mechanisms that in turn allow them to operate in these markets with greater flexibility. Based on the foregoing background and reasoning, this Constitutional Chamber is asked whether, considering INCOFER’s institutional circumstances, which differ from the premises that justified the enactment of the aforementioned Law No. 8660, the current Legislature may incorporate subsection ch) into Article 16 of the bill so as to apply to the Instituto Costarricense de Ferrocarriles the same regulatory framework that currently governs ICE and that, as noted, was created to address a factual situation that INCOFER does not currently face, namely, competition in the railway market.

The undersigned Deputies share the opinion of the Office of the Comptroller General (Órgano Contralor) that, in the absence of such market competition, Parliament would not be authorized to allow INCOFER to circumvent the controls inherent in the ordinary procurement regime applicable to public institutions generally. 2. Regarding Article 3, subsections a) and ch). The constitutionality of this provision is questioned because it seeks to expand INCOFER’s scope of authority (marco competencial) without specifying precisely which services are meant when the provision states that the institution may provide “related services,” as follows from the proposed amendment to Article 3, subsection a), of Law 7001. Because the content of this provision is overly broad and generic, it would improperly permit the expansion of INCOFER’s scope of authority, allowing that institute to make other investments in real property it owns.

This is sufficient reason to require the Plenary to define and delimit more precisely the content of those “related services,” because such laxity creates the risk that INCOFER could improperly apply the mechanisms and resources granted to it under the two provisions submitted for consultation. With regard to subsection ch) of the same article, the consulting Deputies contend that this provision establishes the possibility of autonomous borrowing (endeudamiento autónomo), both domestically and externally, up to a maximum limit of 40% of its total assets. In other words, INCOFER could negotiate, enter into, and execute medium- and long-term foreign loans up to the stated debt level without needing to obtain legislative approval. They consider that the provision contains a clear constitutional defect (vicio de constitucionalidad), because public contracts (contratos públicos) relating to public credit (crédito público) and entered into by the Executive Branch are subject—for their validity and subsequent performance—to the necessary approval of the Legislative Assembly, which is the only body constitutionally empowered to approve or reject them.

This follows from the provisions contained in Articles 124, 121 subsection 15), and 140 subsection 19 of the Political Constitution (Carta Política). The proposed provision therefore limits the oversight function (función tutela) and the exercise of parliamentary political control (control político parlamentario) in a matter essential to the State’s financial balance, namely, its indebtedness. If this legislative oversight were curtailed, Parliament would be unable to review matters relating to performance and other issues concerning the contract’s domestic validity, such as those relating to its performance, tax exemptions, etc. All of this is possible only through the statute approving the contract (ley aprobatoria del contrato), which Parliament alone is empowered to enact. Regarding the provision at issue, both the Contraloría General de la República and the Departamento de Servicios Técnicos de la Asamblea Legislativa raised significant objections when the former responded to the legislative consultation and the latter issued its Report on the Bill.

Indeed, in its Official Letter DFOE-IFR-0628, appearing at folios 577 to 588 of the legislative file, the Office of the Comptroller General stated that there are no criteria justifying the determination of that percentage in relation to the value of INCOFER’s assets as a parameter for setting its debt limit. Together with other considerations raised by the Office of the Comptroller General, this could create a risk for decision-making and the sound management of institutional finances, all of which runs counter to sound public-finance doctrine (buena doctrina hacendaria) by removing that institution from the borrowing policies that should be centrally managed by the Ministerio de Hacienda. This fact constitutes—in itself—a manifest failure to protect the Public Treasury (Hacienda Pública) by excluding the financial and economic activities carried out by INCOFER from such oversight. This could potentially create risks not only of a financial nature for the institution but also of a macroeconomic and social nature for the country, arising precisely from the lack of oversight over borrowing and public investment advocated by the sponsors of this initiative.

Furthermore, the Departamento de Servicios Técnicos de la Asamblea Legislativa has also objected to the third paragraph of subsection ch) submitted for consultation, for two reasons: First, because: “In the opinion of this advisory department, the proposed amendment to subsection ch) of Article 3 must be modified so as not to contravene the constitutional provisions, particularly Article 121 subsection 15, because, as previously stated, any foreign debt negotiated and contracted by this Institute, regardless of its amount or the percentage of the institution’s total assets that it represents, must be considered and approved by the Legislative Assembly.” The second reason relates directly to the percentage suggested in the bill for INCOFER’s borrowing based on a specified value of its total assets. In this regard, the Departamento de Servicios Técnicos de la Asamblea Legislativa itself stated that, from an economic standpoint: “...the foreign-debt ratios used internationally as indicators for assessing countries’ repayment capacity are: the outstanding balance of external public debt relative to GDP and external public-debt service relative to exports of non-factor goods and services.

According to the economic literature consulted by BCCR, the maximum limit for these ratios should be approximately 35% or 40% for the first ratio and 15% or 20% for the second.” This means that Parliament should consider not only the value of the assets but also the country’s repayment capacity when rejecting or approving a loan agreement (empréstito); accordingly, the corresponding approval must be obtained. In the opinion of the undersigned Deputies, the proposed amendment to subsection ch) of Article 3 must be modified so as not to contravene the constitutional provisions, particularly Article 121 subsection 15, because, as previously stated, any foreign debt negotiated and contracted by this Institute, regardless of its amount or the percentage of the institution’s total assets that it represents, must be considered and approved by the Legislative Assembly. Under the amendment, the Institute is also authorized to obtain domestic or foreign resources, but, with respect to borrowing, it eliminates the approval of the Executive Branch and instead provides that, if such borrowing exceeds 40% of INCOFER’s total assets, the Institute must obtain the approval of the Legislative Assembly.

In this regard, it should be noted, as stated above, that foreign borrowing will always require approval by the Legislative Branch pursuant to the Constitution. The substantive difference lies in the fact that domestic borrowing has not, to date, required such legislative approval, but only the approval of the Executive Branch. One final matter warranting attention, which appears in the same paragraph under analysis, concerns the authorization granted to INCOFER to establish “encumbrances” (gravámenes), since, pursuant to Article 121 subsection 14 of the Political Constitution, one of the powers of the Legislative Assembly is to decree the alienation or dedication to public uses of property belonging to the Nation. In this regard, the constitutional provision expressly establishes that property such as railways may not be excluded from State ownership. Accordingly, because INCOFER is the institute that administers this property in the country, a provision as open-ended as the one contained in the aforementioned paragraph could cause confusion unless its content is clarified further. 3. Regarding Article 39.

Although it is true that the authorization granted to autonomous institutions does not conflict with the principle of autonomy enjoyed by these entities, because it is optional for each entity, there is a constitutional conflict with Article 121, subsection 14, of the Constitution when it grants a general authorization for the alienation (enajenación) of real property, which, pursuant to that constitutional provision, must be granted by the Legislative Assembly through prior legislation. In this regard, the Constitutional Chamber has stated the following: “Article 121.14 of the Political Constitution contains three clearly distinct rules: “a) The first is a provision empowering the Legislative Assembly to order the alienation or allocation to public uses of property belonging to the Nation. On the one hand, this provision is unrestricted insofar as it applies to all property belonging to the Nation; on the other, it reserves the matter to legislation, invalidating administrative acts of alienation or allocation to public uses that are not based on prior legislation. b) The second prescribes which property may not permanently leave the state domain (dominio del Estado).

For those categories, which are set forth in subsections a), b), and c), the restriction against leaving the state domain is total and absolute; immediately thereafter, however, the provision tempers its severity by specifying that such categories of property may be exploited by the Public Administration or by private parties in accordance with the law or through a special concession. c) The third is a provision that refers specifically to certain property (railroads, docks, and national airports in operation) not included in the three categories of the preceding provision.” S.C.V.6240-93

VI. REGARDING ARTICLE 16, SUBPARAGRAPH CH)

In connection with the inquiry submitted by the legislators concerning subparagraph ch) of Article 16 proposed in the bill, the petitioners argued that the creation of a differentiated procurement regime (régimen de contratación diferenciado), such as that created through Law No. 8660, Ley de Fortalecimiento Modernización de las Entidades Públicas del Sector Telecomunicaciones, specifically Chapter IV of Title II, constitutes a violation of the principle of equality (principio de igualdad) among public entities. In the proposed bill, subparagraph ch) of Article 16 allows the Board of Directors of Incofer to approve acquisitions of goods and services in accordance with the special administrative procurement regime (Régimen especial de contratación administrativa) established in the aforementioned legislation. Accordingly, it is stated that Incofer will have the powers and authority conferred upon the Instituto Costarricense de Electricidad. Likewise, all administrative procurement activities (contratación administrativa) will be audited by the Contraloría General de la República. In this regard, this Tribunal Constitucional considers that the use of a special administrative procurement regime is not contrary to Constitutional Law (Derecho de la Constitución).

Rights in favor of public bodies and entities are recognized when they are corporate-based entities (entidades de base corporativa), in which case such recognition is understood to benefit their members (see vote No. 1994-2665). However, in certain very limited circumstances, for fundamental reasons of justice and equity, some procedural guarantees (garantías instrumentales) do apply to public entities, specifically: the right to equality of arms (derecho de igualdad de armas), the right to fair due process (derecho a un debido proceso justo), the right to property (derecho de propiedad), etc., because otherwise an intrinsically unjust situation would be created, contrary to constitutional values, principles, and provisions. This is even more true in the case of public entities whose activities are commercial, financial, and industrial in nature and that operate in a competitive market, not only alongside public entities but also alongside private-law persons (sujetos de derecho privado). In this specific case, however, the petitioners contend that Article 16 of the bill under review violates the right to equality, a situation that could not arise under the arguments set forth above, because these are not circumstances in which the protection of the fundamental rights of public bodies and entities is warranted.

Furthermore, Article 182 of the Constitución Política provides that, “Contracts for the performance of public works entered into by the Branches of Government, Municipalities, and autonomous institutions, purchases made with funds belonging to those entities, and sales or leases of property belonging to them shall be carried out through competitive bidding (licitación), in accordance with the law with respect to the applicable amount”; in other words, under that provision the ordinary legislature is permitted to establish by law the conditions for conducting competitive-bidding procedures and the method of review, with complete freedom to do so. Under the model proposed in the bill under review, oversight is conducted ex post, as established by the referenced legislation (Law No. 8660). In that regard, in an inquiry answered by this Tribunal in connection with an optional legislative constitutional inquiry (consulta facultativa legislativa), specifically concerning the cited law, it was stated that the procedure used and the method of review are compatible with Constitutional Law.

Thus, this Tribunal held that, “…the development of comptroller approval (refrendo contralor) as a specific form of approval, in the exercise of administrative oversight or intersubjective direction (dirección intersubjetiva) performed by the Contraloría General de la República, which gives effect to certain acts, is a matter of ordinary law, except in the general circumstances in which the original constituent authority requires it” (judgment No. 08-11210 of 15:00 on 16 de julio de 2008). As stated, the application of a special procurement regime would not exempt Incofer from the application of a procurement regime; on the contrary, the bill provides for the application of a special regime instead of the ordinary regime. Under the foregoing reasoning, the proposed text does not contravene Constitutional Law on any equality-related ground, because, as noted, that right is not enforceable on behalf of the State.

It should be noted that Incofer’s activity as a State institute is unique and does not compete with any other State or private institution. The model proposed in the bill under review is supported by the fact that the constitutional text does not prescribe a single model for the procurement of goods and services by the State and its institutions; rather, it refers regulation of the matter to statute, which entails legislative action by the petitioners themselves to determine the procurement method, since the constituent authority provided freedom with respect to the types of administrative procurement. In this regard, this Tribunal has held that “Article 182 of the Constitución Política recognizes that contracts for the performance of public works, as well as purchases made by autonomous institutions, shall be carried out through the public bidding procedure (procedimiento de licitación pública), in accordance with the law in relation to the applicable amount.

Under the foregoing, it is for the legislature to define, in each case, the administrative procurement procedures, including special systems and differentiated amounts based on the characteristics of the activity and the institution concerned, with the amount being precisely the distinguishing parameter in the design of different types of administrative procurement procedures.” (judgment No. 08-11210 of 15:00 on 16 de julio de 2008). Furthermore, it must be emphasized that, even if Incofer is permitted to use a special administrative procurement model, it is not excluded from the oversight constitutionally assigned to the Contraloría General de la República, an issue addressed in the cited judgment. Under this interpretation, the procurement method contained in the bill does not violate Constitutional Law, because the use of a procurement regime similar to that of another institution does not constitute an unconstitutionality; it is merely one procurement method among various types, whose content does not exclude the Constitution’s mandatory requirements. The oversight and evaluations performed by the oversight body (órgano contralor), as well as transparency requirements, remain unchanged.

VII. REGARDING ARTICLE 3, SUBPARAGRAPHS A) AND CH)

The petitioning Deputies question the constitutionality of this provision because it seeks to expand Incofer’s sphere of authority (marco competencial), in their view, without precisely defining the services to which it refers when the provision states that the institution may provide “related services (servicios conexos),” as follows from the proposed amendment to Article 3, subparagraph a), of Law 7001.The petitioning Deputies question the constitutionality of this provision because it seeks to expand Incofer’s sphere of authority, in their view, without precisely defining the services to which it refers when the provision states that the institution may provide “related services,” as follows from the proposed amendment to Article 3, subparagraph a), of Law 7001. First, it should be noted that Article 99 of the Ley de la Jurisdicción Constitucional provides that optional legislative constitutional inquiries (consultas legislativas de constitucionalidad, de carácter facultativo) must be submitted in a reasoned petition (memorial razonado) identifying the challenged aspects of the bill and the grounds for doubts or objections regarding their constitutionality.

With respect to the constitutional inquiry concerning Article 3, subparagraph a), the requirement for submitting an inquiry to this Tribunal Constitucional is not strictly satisfied, because no violation of the constitutional text is identified; instead, an issue concerning the expediency of the proposed text is raised, which is clearly among the powers of the ordinary legislature. In this regard, it should be recalled that the objections raised are not subject to prior constitutional review (control de constitucionalidad a priori) under Articles 96-101 of the Ley de la Jurisdicción Constitucional. On this matter, it is appropriate to reiterate the position expressed by this Tribunal Constitucional in advisory opinion No. 2008-004569 of 14:30 hrs. on 26 de marzo de 2008, which stated as follows:

“(...) In this regard, it should be noted that, under the sphere of authority entrusted to this Tribunal Constitucional, it is not its role, through a legislative constitutional inquiry, to review the rigor and precision of legislative drafting (técnica legislativa). Indeed, pursuant to Article 1° of the Ley de la Jurisdicción Constitucional, it is the responsibility of the constitutional jurisdiction (jurisdicción constitucional) to guarantee the supremacy of the constitutional rules and principles and of the International or Community Law in force in the Republic, their uniform interpretation and application, as well as the fundamental rights and freedoms enshrined in the Constitution or in the international human-rights instruments in force in Costa Rica. Likewise, Article 3° provides that ‘The Constitución Política shall be deemed infringed when such infringement results from comparing the text of the challenged provision or act, its effects, or its interpretation or application by public authorities with constitutional rules and principles.’ With respect to the alleged grievance identified by the petitioning legislators, this Tribunal considers that it does not constitute an alleged constitutional defect (vicio de constitucionalidad), but rather a matter of legislative drafting. (...)” (Emphasis not in the original).

As in the considerations set forth above, it must be reiterated that it is not the role of this Tribunal Constitucional to oversee the rigor and precision of legislative drafting because, fundamentally, this is not a constitutional defect (see, to the same effect, this Tribunal’s ruling No. 2008-011210 of 15:00 hrs. on 16 de julio de 2008). In any event, a provision establishing a flexible categorization does not constitute an unconstitutionality, because the provision’s content is subject to administrative and judicial review. The use of an indeterminate legal concept (concepto jurídico indeterminado) is not incompatible with the Constitution unless the Constitution contains an express restriction, which is not the case in the matter under review.

Regarding subparagraph ch) of Article 3, the petitioners contend that this provision establishes the possibility of autonomous borrowing (endeudamiento autónomo), both domestically and externally, up to a maximum limit of 40% of its total assets. In other words, Incofer could negotiate, contract for, and execute medium- and long-term external loans (créditos externos) up to the stated debt level without having to obtain legislative approval. They consider that the provision in question is clearly constitutionally defective, because public contracts (contratos públicos) relating to public credit (crédito público) and entered into by the Executive Branch are subject—for their validity and subsequent performance—to the required approval of the Asamblea Legislativa, which is the only body constitutionally empowered to approve or reject them. This follows from the provisions contained in Articles 124, 121 subparagraph 15), and 140 subparagraph 19 of the Carta Política.

The bill under review clearly intends to provide Incofer with the tools necessary to develop the country’s public rail transportation. Accordingly, the bill proposes authorizing that Institute to obtain financing through external and domestic borrowing up to 40% of its total assets, as well as empowering it to establish trusts (fideicomisos), issue securities (títulos valores), and, in general, use other financing mechanisms. It also seeks to implement the special administrative procurement regime (régimen especial de contratación administrativa) created by Ley No. 8660 del 8 de agosto de 2008 for ICE and its companies. It allows the Institute to develop its own sources of revenue to finance its rail transportation projects by entering into partnerships and cooperation agreements with other public institutions. It streamlines the expropriation regime (régimen de expropiaciones) applicable to the Institute because the regulations currently in force limit it to processing expropriations through the Executive Branch.

Lastly, it creates conditions for reactivating the national rail network through the development of strategic projects such as the Tren Eléctrico Inter Urbano de la GAM and an interoceanic train service, with the aim of reactivating and connecting the Atlantic and Pacific railway lines for freight and passenger transportation, as well as projects included in its development plans. In view of the foregoing and the analysis of the proposed text, it is considered that implementation of a special administrative verification model (modelo especial de constatación administrativa), as already stated, is not inherently contrary to the Constitución Política because Article 182 of that charter refers to the general mechanism of competitive bidding (licitación), without classifying it as public or otherwise; moreover, it removed from the constitutional sphere—and assigned to the ordinary legislature—the matter of defining the monetary thresholds for the different forms of competitive bidding—public or abbreviated—thereby clearly leaving this matter to legislative discretion (libertad de configuración legislativa).

Regarding the provisions of Article 121 subparagraph 15) of the Constitution concerning the powers of the Asamblea Legislativa to approve or reject loans or similar agreements relating to public credit, it must be understood that this power applies only to loans entered into by the Executive Branch, a circumstance that would not require Incofer to obtain prior approval to undertake such loans unless the State acts as guarantor (avalista) for the transaction. In that event, under the foregoing assumption, it should be understood that approval of this law would grant the ordinary legislature’s prior authorization, because the provision under review establishes the maximum amount of debt, pursuant to which “…the Institute is authorized to negotiate, contract for, and execute, autonomously, medium- and long-term domestic and external borrowing up to a maximum debt level of forty percent (40%) in relation to its total assets, as well as to create encumbrances (gravámenes) and, through any lawful means, obtain domestic or foreign resources.

The debt shall be calculated on the basis of the consolidated total value of the Institute’s total assets as of 31 de diciembre del año anterior; short-term liabilities shall be excluded from the calculation…” The text under review likewise states that “If the required debt exceeds the percentage stated in the preceding paragraph, approval from the Asamblea Legislativa must be obtained.” It should be noted that the text under review does not entail a failure to comply with the provisions established by the constituent authority; on the contrary, it constitutes a form of statutory authorization for the borrowing required by the Institute to fulfill the proposed purposes, a circumstance that does not conflict with the Law of the Constitution (Derecho de la Constitución) in cases in which the State is required to act as guarantor for a loan. Accordingly, this Court does not find the proposed text unconstitutional, because the legislature’s intent is to grant prior authorization to Incofer so that it may autonomously negotiate, contract for, and execute medium- and long-term domestic and external borrowing up to a maximum debt level of forty percent (40%) in relation to its total assets.

That authorization falls within the bounds of reasonableness and proportionality. For reasons of efficiency and expediency, Parliament may grant prior authorization, a possibility that does not contravene the requirements of the constitutional provision.

VIII. REGARDING ARTICLE 39

With respect to the question submitted, the constitutionality of the provision in question is challenged because it proposes a general authorization to dispose of real property (enajenar bienes inmuebles), which, pursuant to that constitutional provision, must be granted by the Asamblea Legislativa through a prior law. In this regard, as stated in the preceding consideration (considerando), some of the articles of this bill constitute a prior law through which such authorization is granted. It must be noted that real property owned by the State may be disposed of provided that it does not constitute public-domain property (bienes demaniales o dominicales), because the original constituent authority established a restriction in that regard for certain State-owned property that is not susceptible to any encumbrance or dedication, as provided by the exception set forth in subparagraph 14) of Article 121 of the constitutional text.

Such property belongs to the State by virtue of its status and, under no circumstances, may leave its ownership or control; it therefore remains dedicated exclusively to public use, outside the stream of commerce, and is characterized as inalienable, not subject to acquisitive prescription, and immune from attachment (inalienables, imprescriptibles e inembargables). Regarding the general system governing donations, Ley de Contratación Administrativa states in Article 69: “(…) Limits. The Administration may not dispose of real property dedicated to a public purpose (afectos a un fin público). Property may be released from that dedication (desafectarse) through the same procedure used to establish its current designated purpose. Express authorization from the Asamblea Legislativa shall be required when there is no record of the procedure used to establish the dedication (…)”. Under the cited provision, the restriction on making donations applies when real property is dedicated to a public purpose and therefore may not be disposed of; nevertheless, the same article provides that property may be released from that dedication through the same procedure used to establish its current designated purpose, that is, by law.

It is clear that, with regard to donations involving public entities, there must be an express law for a specific situation or, in other words, a law that generally permits a public entity to donate some of its property, whether movable or immovable, to other public entities.

Although the proposed text does not identify the property that may be disposed of, the fact remains that it could apply only to property legally capable of being subjected to such a measure. The proposed text states that “…State agencies, particularly Ministerio de Obras Públicas y Transportes (MOPT), and autonomous institutions, except Caja Costarricense de Seguro Social (CCSS), semiautonomous institutions, and public enterprises, are authorized to assign, transfer, manage, negotiate, collaborate, donate, or lease, without consideration, all types of resources, services, movable and immovable property, materials, and equipment, as well as to transfer personnel to the Institute…” Thus, the proposed text does not entail an infringement of the Law of the Constitution. In several precedents, the Sala has held that “…the legal regime governing public-domain property is special and differentiated according to the type of property involved.

The distinction between private property or things and public property or things depends, first, on the ‘title’ or ‘ownership’ of the property, because that element defines its differentiated nature and legal regime and, consequently, the applicable law, insofar as the former is governed by private law and the latter by public law. Thus, public-domain property must be understood as the body of property—both immovable and movable—whose nature and legal regime are virtually the opposite of those applicable to private property, insofar as, by the express will of the constituent authority or the legislature, such property is dedicated to the special purpose of serving the community—that is, the public interest—and therefore cannot be privately owned, meaning that it is outside the stream of commerce; in other words, it cannot belong individually to private persons or to the State—in the strict sense—because the latter is limited to its administration and protection.

Thus, State property in the public domain and State property in the private domain (fiscal property) (bienes de dominio privado del Estado (fiscales)) are distinguished by their purpose and the holder of title, insofar as the legal nature of the former is defined by the purpose assigned to that type of property, namely, that it is dedicated to and serves public use, under the terms provided in Article 261 of the Código Civil…” (judgments numbers 5399-93, 3145-96, 5027-97, 2988-99, 2000-10466, 2002-8321; 2003-3480; 2005-7158). It must always be understood that, although the authorization contemplated in the bill provides the legal possibility of transferring State real property to Incofer, such property may under no circumstances consist of property that the constituent authority determined could not cease to be public-domain property; otherwise, the transfer would constitute an act contrary to the Law of the Constitution.

It must also be emphasized that the property whose transfer is authorized would always remain within the public domain because Incofer is a public institution. Accordingly, property donated to Incofer by other institutions would not only remain dedicated to the common good and to the provision of public services, in view of the purposes it must fulfill, but would also be subject to the provisions of the constitutional text, making it impossible to alter its dedication or transfer ownership because of its new nature and public utility, as it would be dedicated to serving the community. Under the foregoing assumption, the question concerning this article is answered, and it is considered that the article has no substantive conflicts with the Constitution.

IX. CONCLUSION

As a corollary to the considerations set forth above, the question must be answered as indicated in the operative portion (parte dispositiva) of this decision.

X. NOTE BY JUSTICES JINESTA LOBO, HERNÁNDEZ LÓPEZ, AND HERNÁNDEZ GUTIÉRREZ

Drafted by the first-named Justice. We Justices submit this note to state that the discussion as to whether public entities possess fundamental rights (derechos fundamentales) is irrelevant to resolving the case at hand (sub-lite). In any event, we clarify that public or private entities may, under certain circumstances, hold certain fundamental or human rights (e.g., effective judicial protection, property, etc.), although, for obvious reasons, they do not hold those rights that presuppose a natural person (e.g., physical integrity, health, life, etc.).

XI.JUSTICE RUEDA LEAL’S INDIVIDUAL REASONS CONCERNING ARTICLE 16, SUBSECTION CH), UNDER REVIEW AND THE ALLEGED VIOLATION OF THE PRINCIPLE OF EQUALITY (PRINCIPIO DE IGUALDAD).

The consulting members of the Legislative Assembly challenge Article 16, subsection ch), of Bill No. 18252 on the ground that it creates, for the benefit of INCOFER, a special administrative procurement regime (régimen especial de contratación administrativa) that could violate the principle of equality among public entities. They add that the provision introduces, for the benefit of that entity, a differentiated framework similar to that currently enjoyed by ICE, without the prior existence of a treaty as in that case. With regard to this point, I must state, as I have emphatically done on repeated occasions, that public institutions do not enjoy fundamental rights. I so specified in Judgment No. 2013-5772 at 9:50 on 26 de abril de 2013:

“In the case that is the subject of this challenge, I depart from the majority opinion of this Constitutional Court and consider it improper to address the merits of the proceeding, for the reasons set forth below. Under Article 48 of the Political Constitution, every inhabitant of the national territory possesses the right to bring an amparo proceeding (recurso de amparo) to preserve or restore the fundamental rights enshrined in the Constitution, except for the right to liberty—freedom of movement or transit—or personal integrity, for which the remedy of habeas corpus (recurso de hábeas corpus) is available.

Thus, the amparo proceeding constitutes a constitutional right enjoyed by every individual and is intended to safeguard fundamental rights in the most expeditious manner possible against a threat or violation (see, to the same effect, Judgments Nos. 1991-0174 at 14:30 on 25 de enero de 1991, 1992-2890 at 09:06 on 11 de setiembre de 1992, and 2008-09851 at 14:55 on 17 de junio de 2008).

Two crucial elements underlie this provision. On the one hand, the scope of constitutional justice (justicia constitucional). On the other, the very nature of fundamental rights. First, it is important to recall that the resurgence of constitutional justice, departing from Hans Kelsen’s original proposal, arose in the middle of the last century, after the end of the Second World War, with the clear objective of preventing the recurrence of many of the disastrous consequences of that conflict, which resulted precisely from abuses and arbitrary acts attributable to various States. This, which some legal scholars have called the second wave of constitutional justice (see: Nogueira Alcalá (Humberto). ‘Tópicos sobre jurisdicción constitucional y tribunales constitucionales,’ Revista de Derecho, volume XIV, julio, 2003, Chile, Universidad Austral, p. 61), represents a particular conceptualization of constitutional jurisdiction (jurisdicción constitucional), from whose sources our legal system has also drawn, and which conceives it, in principle, as a mechanism for protecting persons from State power and its potential excesses.

There are even proposals that the traditional division of constitutional justice into two theoretical models—the North American and the Austrian—be replaced by other models in which the criterion for categorization is the protection of fundamental rights. For example, Rubio Llorente and Jiménez Campo call the system in which mechanisms for preserving the rights contained in the constitution are created alongside judicial review of the constitutionality of legal provisions the ‘rights-centered model.’ Such mechanisms operate against any action by the State (see: Rubio Llorente (Francisco) and Jiménez Campo (Javier). Estudios sobre justicia constitucional, Editorial Mc Graw-Hill, Madrid, 1997, p. 156). This would be the Costa Rican model, whose guiding principle is that persons may defend their fundamental rights before the Sala Constitucional.

This leads, second, to emphasizing that fundamental rights govern relations between individuals and the State and, where applicable, between private parties (horizontal effect (efecto horizontal)); ultimately, they are normative positions that establish duties for the State and limit its powers in relation to persons (see: Alexy (Robert). Teoría de los derechos fundamentales, CEPC, 2007, pp. 464, 484). In view of the foregoing, I consider that, even in a broad sense, the amparo proceeding is not designed to protect public-law subjects, that is, the public-law entities that make up the State apparatus, since the legal system provides other avenues through which they may defend their functions or autonomy. Allowing it would distort the ontological content of both constitutional justice and fundamental rights. In the case under consideration, the petitioner, who serves as special administrative attorney-in-fact (apoderado especial administrativo) for Banco Crédito Agrícola de Cartago in the proceeding conducted under case file number AGHS-002-2012, states that access to that case file was denied and that this situation violates his fundamental rights and those of the entity he represents.

Thus, the petitioner uses the summary amparo procedure on behalf of that public institution; however, this is improper because it is a public-law entity. Based on the foregoing, I find this amparo proceeding inadmissible.” Similarly, I also dissented in Judgment No. 2014-14599 at 16:30 on 2 de setiembre de 2014, in which, together with Justice Castillo, I stated:

“Despite the clarity surrounding the issue, the majority of this Court has proceeded to grant protection to the State against a private-law subject. In other words, the Sala has become the guarantor of State activity and an assistant in imposing the authority of the State upon those subject to the administration. The inconsistency of this reasoning lies not only in its discordance with basic human-rights rules, but also in its disregard of the State’s position of power vis-à-vis the individual. Faced with situations such as the one presented, the State may readily convene a press conference or publish paid advertising space, should it deem this necessary.

Accordingly, it must also be clarified that this Court’s case law has held that neither the State nor its institutions—in this case, the Ministerio Público—hold the right of correction or reply (derecho de rectificación o respuesta). By way of example, Judgment No. 2290-96 at 15:36 on 15 de mayo de 1996 may be cited: ‘On repeated occasions, this Sala has linguistically stated that the State, lato sensu, does not hold the right enshrined in Article 48 of the Political Constitution to appear before this Sala through an amparo proceeding in order to preserve or protect fundamental rights. As the Sala has already stated, the principle underlying the institution of amparo is to provide those subject to the administration with a means of defense against potential abuses of power; notwithstanding its broad conception, it cannot be understood as having been devised to protect public-law entities, since, in order to defend their autonomy or the authority assigned to them by their founding instrument, such entities may readily resort to other mechanisms provided by the legal system itself (in this regard, see Judgments No. 174 at fourteen hours and thirty minutes on twenty-five January nineteen ninety-one, and No. 2890 at nine hours and six minutes on eleven September nineteen ninety-two).

In the case before us, the Ministerio de Seguridad Pública is not excluded from the broad concept of the State and, consequently, is also subject to the limitation concerning standing (legitimación activa) referred to above; the Sala finds no reason to depart from the position maintained in its case law (see, to that effect, Decision No. 0506-95 at eleven hours and twenty-one minutes on twenty-seven January of the previous year).’ Accordingly, neither can it be accepted that the Fiscalía de Asuntos Indígenas, through the Oficina de Prensa del Ministerio Público, has the right to request the correction and reply sought, because that would entail accepting that this public-law entity enjoys that constitutional guarantee, which—as shown—has been rejected by the precedents of this very Sala. Therefore, we consider that the appropriate course is to dismiss the amparo proceeding.” It is evident that what was stated in those amparo proceedings is equally applicable to an action of unconstitutionality (acción de inconstitucionalidad), since it is untenable that a public institution could enjoy a fundamental right, given that only a human being may hold such a right, as is readily apparent from Article 1 of the American Convention on Human Rights:

“Article 1. Obligation to Respect Rights 1. The States Parties to this Convention undertake to respect the rights and freedoms recognized therein and to ensure to every person subject to their jurisdiction the free and full exercise thereof, without any discrimination on grounds of race, color, sex, language, religion, political or other opinions, national or social origin, economic status, birth, or any other social condition.

2. For the purposes of this Convention, ‘person’ means every human being.” Therefore, States are obligated to respect the fundamental rights of human beings, and not the reverse; that is, the State may not seek, through any judicial avenue, to have judges recognize some fundamental right on its behalf. It bears clarifying that when a municipal council member or mayor appears before this Sala, ostensibly on behalf of the municipal corporation, that person is in fact acting in defense of the residents of the corresponding municipality, in which case the amparo proceeding is proper, but the protected parties are the residents, not a public entity. In view of the foregoing, this issue submitted for review is wholly inadmissible.

THEREFORE (POR TANTO) The optional consultation (consulta facultativa) submitted is answered to the effect that the provisions reviewed (arts. 3, subsections a) and ch), 16, subsection ch), and 39)) of the bill Fortalecimiento del Instituto Costarricense de Ferrocarriles (Incofer) y Promoción del Tren Eléctrico Interurbano de La Gran Área Metropolitana, legislative case file No. 18252, contain no substantive constitutional defects. Justices Jinesta Lobo and Hernández Gutiérrez and Justice Hernández López submit a note. Justice Rueda Leal provides individual reasons.

Consulta legislativa facultativa de constitucionalidad interpuesta por los diputados GERARDO VARGAS ROJAS, GONZALO RAMÍREZ ZAMORA, HUMBERTO VARGAS CASCANTE, JOHNNY RAFAEL LEIVA BADILLA, JORGE RODRÍGUEZ ARAYA, JOSÉ ALBERTO ALFARO JIMÉNEZ, LUIS ALBERTO VASQUEZ CASTRO, MARIO REDONDO POVEDA, OSCAR ANDRÉS LÓPEZ ARIAS, OTTO GUEVARA, RAFAEL ANGEL ORTÍZ FABREGA, ROSIBEL RAMOS MADRIGAL, respecto a la aprobación del proyecto de ley “Fortalecimiento del Instituto Costarricense de Ferrocarriles (Incofer) y Promoción del Tren Eléctrico Interurbano de La Gran Área Metropolitana” expediente legislativo No. 18252.

RESULTANDO

  1. 1Mediante escrito presentado ante esta Sala Constitucional a las10:20 hrs. de 29 de abril de 2016, la Diputada y los Diputados consultantes plantean consulta Legislativa Facultativa de Constitucionalidad en relación con el proyecto de ley “Fortalecimiento del Instituto Costarricense de Ferrocarriles (INCOFER) y Promoción del Tren Eléctrico Interurbano de La Gran Área Metropolitana” expediente legislativo No. 18252 por tener dudas sobre la constitucionalidad de los artículos 3 incisos a) y ch), 16 inciso ch) y 39 del proyecto referido. El artículo 16 crea a favor del INCOFER un régimen especial de contratación administrativa que podría violentar el principio de igualdad entre entidades públicas. La norma introduce a favor de aquella entidad un esquema diferenciado similar al que actualmente goza el ICE y que en el pasado creó el Legislador para responder a la apertura del mercado del Sector de Telecomunicaciones luego de la suscripción del Tratado de Libre Comercio Centroamérica-Estados Unidos-República Dominicana y su posterior aprobación mediante la Ley N° 8622.Esta ley contiene algunas prerrogativas no aplicables a las demás entidades públicas en general, pero que para el caso del ICE se justificaban plenamente ante su inminente entrada como nuevo oferente en el mercado de telecomunicaciones. Se consulta a esta Sala Constitucional si, considerando la realidad institucional del INCOFER, que difiere de los supuestos que justificaron la emisión de la Ley N° 8660 citada, es posible para el legislador actual incorporar el inciso ch) en el artículo 16 del proyecto para aplicar a favor del Instituto Costarricense de Ferrocarriles un esquema normativo similar al que actualmente rige para el ICE. A través de esta norma se pretende ampliar el marco competencial del INCOFER, sin establecer con precisión a qué servicios se refiere cuando la norma señala que la institución puede prestar "servicios conexos", según se desprende de la modificación propuesta al artículo 3, inciso a) de la Ley 7001.Esta norma establece la posibilidad de endeudamiento autónomo, tanto a nivel interno como externo hasta un límite máximo de un 40% en relación con sus activos totales. El INCOFER podría negociar, contratar y ejecutar, créditos externos de mediano y largo plazo hasta el nivel de endeudamiento indicado sin necesidad de obtener la aprobación Legislativa. Tal potestad configura un claro vicio de constitucionalidad pues según el ordenamiento jurídico costarricense, los contratos públicos, que se relacionen con el crédito público y que sean celebrados por el Poder Ejecutivo están supeditados -para su validez y ulterior ejecución- a la necesaria aprobación por parte de la Asamblea Legislativa que es el único ente con potestad constitucional para aprobarlos o improbarlos. Por último, se autoriza al INCOFER para establecer "gravámenes". No obstante, de conformidad con lo dispuesto en el inciso 14 del artículo 121 de la Constitución Política una de las atribuciones de la Asamblea Legislativa es decretar la enajenación o la aplicación de usos públicos de los bienes propios de la Nación.En ese sentido la norma constitucional establece expresamente que bienes como los ferrocarriles no pueden ser excluidos del dominio estatal. Así las cosas, siendo el INCOFER el instituto que administra estos bienes en el país, podría pensarse que una disposición tan abierta como la contenida en el referido párrafo podría ser motivo de confusiones a menos que se aclare su contenido. Podría darse un roce constitucional con el artículo 121 inciso 14 de la Constitución Política, cuando se otorga una autorización genérica para enajenar bienes inmuebles, la cual en virtud de esa norma constitucional debe ser otorgada por la Asamblea Legislativa mediante ley previa.
  2. 2Por resolución de las 11:18 hrs. del 29 de abril de 2016, la Presidencia de la Sala tuvo por presentada la consulta señalada y solicitó la remisión del expediente legislativo No. 18252 o bien copia certificada del mismo. Asimismo, se advirtió que, el plazo que establece el artículo 101 de la Ley de la Jurisdicción Constitucional empieza a contar una vez que se tengan los elementos de juicio para conocer, es decir, después de recibidos los documentos solicitados, pues es a partir de ese momento que se procede a designar internamente un magistrado que inicie el estudio sobre el fondo de los asuntos consultados.
  3. 3La copia certificada del expediente legislativo No. 18252, se recibió en la Sala el día 03 de mayo de 2016 y, mediante resolución de las 8:12 hrs. del 04 de mayo de 2016, se dispuso turnar la gestión a la oficina del Magistrado Cruz Castro. En consecuencia, el plazo para evacuar la consulta vence el 03 de junio del año que corre.
  4. 4En los procedimientos se han acatado las disposiciones del artículo 100 de la Ley de la Jurisdicción Constitucional y esta resolución se dicta dentro del término que establece el artículo 101 ibídem.

Redacta el Magistrado Cruz Castro; y,

CONSIDERANDO:

I. ADMISIBILIDAD DE LA CONSULTA Y LEGITIMACIÓN DE LOS CONSULTANTES

El artículo 96 inciso b) de la Ley de la Jurisdicción Constitucional, dispone la posibilidad de que esta Sala emita opiniones consultivas previas sobre los proyectos legislativos, cuando la consulta sea presentada por un número no menor de diez Diputados. La figura de la consulta legislativa tiene como objeto conocer proyectos de ley luego de su aprobación en primer debate y antes del definitivo (segundo debate, artículo 124 constitucional). Al haberse cumplido lo establecido por tal disposición resulta entonces admisible esta gestión de consulta en relación con el fondo proyecto de ley “Fortalecimiento del Instituto Costarricense de Ferrocarriles (INCOFER) y Promoción del Tren Eléctrico Interurbano de La Gran Área Metropolitana” expediente legislativo No. 18252, en adelante citado también como el expediente legislativo No. 18252.

II.De conformidad con lo que dispone el artículo 96 inciso b) de la Ley de la Jurisdicción Constitucional, se planteó una consulta legislativa facultativa, por más de diez Diputados, por lo que en estos casos la Sala está obligada a revisar, únicamente, aquellos extremos cuestionados de manera específica y concreta por los consultantes y no cualquier aspecto general de constitucionalidad del proyecto de Ley que contiene las normas impugnadas, según lo dispone el artículo 99 de la ley que rige esta jurisdicción. De igual forma, considera esta Sala que lo que aquí se resuelva, no prejuzga de forma absoluta sobre lo que este mismo órgano pueda decidir sobre esta ley con ocasión de la resolución de acciones de inconstitucionalidad que se presenten con fundamento en distintos razonamientos o elementos de juicio.

III. CRONOLOGÍA DE LA TRAMITACIÓN DEL EXPEDIENTE LEGISLATIVO No

18252 . Para efectos de los temas que se han planteado en esta consulta, resulta relevante reseñar los siguientes elementos importantes en la tramitación de este expediente legislativo:

<![if !supportLists]>1. <![endif]>El 19 de setiembre de 2011, se presenta ante la Secretaría de la Asamblea Legislativa, el proyecto de ley “Fortalecimiento del Instituto Costarricense de Ferrocarriles (INCOFER) y Promoción del Tren Eléctrico Interurbano de La Gran Área Metropolitana” expediente legislativo No. 18252 (folios 1 al 21 del expediente legislativo).

<![if !supportLists]>3. <![endif]>El 08 de setiembre de 2011, se entregó el expediente al Departamento de Estudios, Referencias y Servicios Técnicos, de conformidad con el Artículo 1 del Reglamento de la Asamblea Legislativa (folio 23 del expediente).

<![if !supportLists]>4. <![endif]>El 03 de octubre de 2011, se envía solicitud de publicación del proyecto al Diario Oficial la Gaceta de conformidad con lo que establece el Artículo 117 del Reglamento de la Asamblea Legislativa (folio 24 del expediente).

<![if !supportLists]>5. <![endif]>El 26 de octubre de 2011, fue publicado el proyecto en el Alcance No. 82 de La Gaceta No. 20 del 26 de octubre de 2011 (folio 25 del expediente).

<![if !supportLists]>6. <![endif]>El 27 de octubre de 2011, la Comisión Permanente de Ambiente recibe el expediente del Departamento de Archivo (folio 25 del expediente).

<![if !supportLists]>7. <![endif]>El 03 de noviembre de 2011, la Comisión Permanente de Ambiente aprueba moción para que el proyecto sea consultar el proyecto al Instituto Costarricense de Ferrocarriles, al Instituto Costarricense de Electricidad, al Ministerio de Obras Públicas y Transportes, al Ministerio de Ambiente Energía y Telecomunicaciones, a las Municipalidades de todo el país, a las instituciones autónomas, a empresas públicas, a la Procuraduría General de la República, a la Contraloría General de la República y a las Universidades Públicas (folios 26 al 33 del expediente).

La Subcomisión rinde informe de los expedientes No. 18252 “Fortalecimiento del Instituto Costarricense de Ferrocarriles (INCOFER) y Promoción del Tren Eléctrico Interurbano de La Gran Área Metropolitana” y No. 18310 “Reforma y adición de varios artículos de la Ley Orgánica del Instituto Costarricense de Ferrocarriles (INCOFER), No. 7001 de 19 de setiembre de 1985”, en razón de que ambos expedientes tienen como propósito dotar al INCOFER de las herramientas necesarias para desarrollar el transporte público ferroviario del país y sentar las bases para que esa institución cuente con las condiciones económicas legales y técnicas para construir y operar un tren eléctrico en la Gran área Metropolitana. Recomienda refundir ambos proyectos en el expediente No. 18252, para lo cual rinde dictamen negativo del proyecto No. 18310 pues esas propuestas se incorporan en el proyecto No. 18252, al cual rinde dictamen positivo y presenta texto sustitutivo del proyecto (folio 284 al 312 del expediente).

IV. SOBRE EL TEXTO DEL PROYECTO CONSULTADO

El texto del proyecto sobre el cual se realiza esta consulta se refiere a los artículos 16 inciso ch), así como también los artículos 3 incisos a) y ch) y el artículo 39 del proyecto de ley que por su orden establecen:

“ Artículo 16.- Son deberes y atribuciones del Consejo Directivo:

(…)

ch) Aprobar las adquisiciones de bienes y servicios del Instituto, de conformidad con el Régimen especial de contratación administrativa establecido en el capítulo IV del título II de la Ley N.° 8660, Fortalecimiento y Modernización de las Entidades Públicas del Sector de Telecomunicaciones, de 8 de agosto de 2008, así como con el reglamento que se emita al efecto. Para ello, el Instituto Costarricense de Ferrocarriles se regirá por las disposiciones de dicha normativa, ostentará las mismas competencias y potestades que dicha ley atribuye al Instituto Costarricense de Electricidad, y su actividad de contratación administrativa será fiscalizada por la Contraloría General de la República.” “ Artículo 3.- Los objetivos principales del Instituto son:

  • a)Fortalecer la economía del país mediante la administración de un moderno sistema de transporte ferroviario para el servicio de pasajeros y de carga en todo el territorio nacional. Además, podrá prestar servicios conexos con el citado sistema y desarrollar otras inversiones y obras de infraestructura en inmuebles de su propiedad, o bien, previo convenio entre las partes, de otras instituciones públicas, las empresas de servicios municipales, las cooperativas de electrificación rural y sus consorcios, reguladas en la Ley N.° 8345, Participación de las Cooperativas de Electrificación Rural y de las Empresas de Servicios Públicos Municipales en el Desarrollo Nacional, de 26 de febrero de 2003, y sus reformas, necesarias para la construcción, la operación y el mantenimiento del sistema ferroviario. De igual forma, podrá desarrollar en inmuebles de su propiedad otras inversiones u obras que le generen recursos para financiar sus proyectos de transporte ferroviario, siempre y cuando dichas actividades no afecten la prestación de los servicios de transporte a su cargo.

ch) Electrificar, reconstruir, rectificar y extender toda su red ferroviaria existente. Para estos fines, el Instituto queda autorizado para negociar, contratar y ejecutar, de manera autónoma, endeudamientos internos y externos de mediano y largo plazos hasta un nivel de endeudamiento máximo del cuarenta por ciento (40%) en relación con sus activos totales, así como para constituir gravámenes y, en cualquier forma legal, obtener recursos nacionales o extranjeros. El endeudamiento se calculará con base en el total consolidado del valor de los activos totales del Instituto al 31 de diciembre del año anterior; para el cálculo se excluirán los pasivos de corto plazo. Los cambios en el pasivo total del Instituto, como consecuencia de las variaciones en los tipos de cambio, no serán considerados para efectos de medir la variación neta del pasivo total, para el cálculo del nivel de endeudamiento regulado en este artículo. El Instituto deberá contar con un registro contable suficiente, que deberá actualizar de forma periódica, sobre los activos institucionales, o bien otros mecanismos idóneos para asegurar de manera precisa el valor de dichos activos.

Si el endeudamiento requerido excede el porcentaje indicado en el párrafo anterior, deberá obtenerse la aprobación de la Asamblea Legislativa." “ Artículo 39.- Para todos los efectos legales, el Instituto tendrá el carácter de ente administrativo de utilidad pública. Con el propósito de que lleve a cabo con prontitud y eficiencia el cumplimiento de sus objetivos, los organismos del Estado, en especial el Ministerio de Obras Públicas y Transportes (MOPT) y las instituciones autónomas, salvo la Caja Costarricense de Seguro Social (CCSS), semiautónomas y empresas públicas, quedan autorizados para ceder, traspasar, gestionar, negociar, colaborar, donar o arrendar, a título gratuito, todo tipo de recursos, servicios o bienes muebles e inmuebles, materiales y equipo, así como a trasladar personal a favor del Instituto, sin que al efecto sea necesaria la autorización o aprobación de ningún otro organismo público.”

V. RAZONES PARA EL PLANTEAMIENTO DE ESTA CONSULTA

En el escrito que han hecho llegar a la Sala, las Diputadas y Diputados consultantes buscan el criterio de este Tribunal sobre aspectos de fondo relacionados con los siguientes aspectos: 1. Sobre el artículo 16 inciso ch). Estiman que esta norma crea a favor del INCOFER un régimen especial de contratación administrativa que podría estar violentando el principio de igualdad entre entidades públicas. Lo anterior, porque introduce a favor de aquella entidad un esquema diferenciado similar al que actualmente goza el ICE y que en el pasado creó el Legislador para responder a unas circunstancias específicas que justificaban su creación, a saber: La apertura del mercado del Sector de Telecomunicaciones luego de la suscripción del Tratado de Libre Comercio Centroamérica-Estados Unidos-República Dominicana y su posterior aprobación mediante la Ley N° 8622. En efecto, tras la apertura de aquél sector y con la finalidad de proteger al Instituto Costarricense de Electricidad de los perjuicios en que podría incurrir al tener que dejar su monopolio y enfrentarse a la libre competencia, el Legislador creyó oportuno fortalecer ese ente público liberándolo de la obligación de tener que ajustarse al esquema ordinario de contratación administrativa.

Para tales efectos le dotó de un régimen especial capaz de permitirle competir, en igualdad de condiciones con los otros competidores de naturaleza privada que, por su condición jurídica, gozaban de mayor flexibilidad para competir en el mercado. Las leyes que se dictaron entonces para favorecer al ICE fueron la Ley General de Telecomunicaciones, N° 8642, y la Ley de Fortalecimiento y Modernización de las Entidades Públicas del Sector Telecomunicaciones, N° 8660, cuyo régimen de contratación ahora el INCOFER desea aplicar para sí. La última ley citada contiene algunas prerrogativas no aplicables a las demás entidades públicas en general, pero que para el caso del ICE se justificaban plenamente ante su inminente entrada como nuevo oferente en el mercado de telecomunicaciones, tras dejar de brindar sus servicios en condiciones de monopolio por la firma del TLC. La posibilidad de que esto se hiciera dentro de la Ley N° 8660 citada fue avalada incluso por este alto Tribunal, según se desprende del Voto N° 8672-2010 en el que los señores Magistrados estimaron que no resultaba oportuno ni conveniente que la apertura de los mercados supusiera un debilitamiento o provocara la eventual extinción de los entes públicos. que ahora ofrecerían sus servicios bajo el nuevo régimen de competencia, de ahí que para equilibrar su situación -sometida a las rígidas formas del Derecho público- la Sala Constitucional aceptó que el Estado le otorgara al ICE una serie de compensaciones y medidas tendientes a que esta entidad pudiera ahora desplegar por esa vía su actividad empresarial, mercantil o industrial.

Actividades que por demás son naturales y propias de los sujetos del Derecho privado, los cuales además al no estar sujetos a los procesos licitatorios que regulan la actividad comercial del Estado, les permite a aquellos aplicar mecanismos más expeditos que a su vez les permiten manejarse en estos mercados con mayor flexibilidad. A partir de los antecedentes y razonamientos expuestos, se consulta a esta Sala Constitucional si, considerando la realidad institucional del INCOFER, que difiere de los supuestos que justificaron la emisión de la Ley N° 8660 citada, es posible para el legislador actual incorporar el inciso ch) dentro del artículo 16 del proyecto para aplicar a favor del Instituto Costarricense de Ferrocarriles el mismo esquema normativo similar que actualmente rige para el ICE y que como se dijo fue creado para atender una realidad fáctica que actualmente el INCOFER no tiene, a saber la competencia en el mercado de Ferrocarriles.

Los suscritos diputados comparten la opinión del Órgano Contralor que, ante la ausencia de esa situación de competencia de mercado, el Parlamento no estaría legitimado para permitir al INCOFER evadir los controles propios del régimen contratación ordinaria que opera para las instituciones públicas en general. 2. Sobre el artículo 3 incisos a) y ch). Se consulta la constitucionalidad de esta norma porque a través de ella se le pretende ampliar el marco competencial del INCOFER, sin establecer con precisión a qué servicios se refiere cuando la norma señala que la institución puede prestar "servicios conexos", según se desprende de la modificación propuesta al artículo 3, inciso a) de la Ley 7001. Al ser el contenido de esta norma demasiado amplio y genérico, se estaría permitiendo que el marco competencial del INCOFER se amplíe de manera inadecuada, permitiéndole a ese instituto desarrollar otras inversiones en inmuebles de su propiedad, razón suficiente para que se obligue al Plenario a precisar y delimitar mejor en contenido de aquellos "servicios conexos", pues ante tal laxitud se corre el peligro de que INCOFER pueda aplicar inadecuadamente los mecanismos y recursos que se le otorgan en las dos norma consultadas.

En relación con el inciso ch) del mismo articulado, plantean los consultantes que, esta norma establece la posibilidad de endeudamiento autónomo, tanto a nivel interno como externo hasta un límite máximo de un 40% en relación con sus activos totales. En otras palabras, el INCOFER podría negociar, contratar y ejecutar, créditos externos de mediano y largo plazo hasta el nivel de endeudamiento indicado sin necesidad de obtener la aprobación Legislativa. Estiman que, existe un claro vicio de constitucionalidad en la norma indicada pues, los contratos públicos, que se relacionen con el crédito público y que sean celebrados por el Poder Ejecutivo están supeditados -para su validez y ulterior ejecución- a la necesaria aprobación por parte de la Asamblea Legislativa que es el único ente con potestad constitucional para aprobarlos o improbarlos. Así se desprende de las disposiciones contenidas en los artículos 124, 121 inciso15) y 140 inciso 19 de la Carta Política.

La norma propuesta limita, en consecuencia, función tutela y, el ejercicio del control político parlamentario en una materia esencial para el equilibrio financiero del Estado, como lo es el endeudamiento de este. Si se coarta esta tutela legislativa sería imposible para el Parlamento revisar aspectos relacionados con la ejecución y otros extremos relacionados con la vigencia interna del contrato, como podrían ser, por ejemplo, aquellos relacionados con su ejecución, exenciones tributarias, etc., Todo lo cual sólo es posible a través de la ley aprobatoria del contrato que de manera exclusiva corresponde al Parlamento adoptar. Sobre la norma en cuestión tanto la Contraloría General de la República como el Departamento de Servicios Técnicos de la Asamblea Legislativa señalaron importantes objeciones al momento en que el primero respondió la consulta legislativa y en que el segundo emitió su Informe sobre el Proyecto de Ley.

En efecto, en su Oficio DFOE-IFR-0628, visible a los folios 577 a 588 del expediente legislativo, el Órgano Contralor expresó que no existen criterios que justifiquen la determinación de ese porcentaje en relación con el valor de sus activos como parámetro para fijar su límite de endeudamiento, lo cual junto a otras consideraciones dada por el Órgano Contralor podría constituirse en un riesgo para la toma de decisiones y para el sano manejo de las finanzas institucionales, todo cual atenta contra la buena doctrina hacendaría, al alejar a esa institución de las políticas de endeudamiento que debería de manejar de manera centralizada el Ministerio de Hacienda. Este hecho supone -en sí mismo- una desprotección abierta a la Hacienda Pública al dejar al margen las actividades financieras y económicas que realice el INCOFER, lo que eventualmente podría generar riesgos no solo de carácter financiero para la institución, sino también de carácter macroeconómico y social para el país, que podrían surgir precisamente por esa ausencia de control en el endeudamiento y en la inversión pública que promueven los impulsores de esta iniciativa.

Por otra parte, el Departamento de Servicios Técnicos de la Asamblea Legislativa también ha objetado el párrafo tercero del inciso ch) en consulta por dos razones: La primera porque: "En criterio de esta asesoría la reforma propuesta al inciso ch) del numeral 3 debe ser modificada, para no contravenir lo dispuesto en las normas constitucionales, en especial el artículo 121 inciso 15, pues como se ha dicho anteriormente cualquier endeudamiento externo que negocie y contrate este Instituto, sin importar su monto o el porcentaje que represente de los activos totales de esta institución, debe ser conocido y aprobado por la Asamblea Legislativa." La segunda razón tiene que ver directamente con el porcentaje sugerido en el proyecto de ley para endeudar al INCOFER a partir de un determinado valor de sus activos totales. A este respecto el mismo Departamento de Servicios Técnicos de la Asamblea Legislativa señaló que desde el punto de vista económico: “...las razones de endeudamiento externo utilizadas internacionalmente indicadores para evaluar la capacidad de pago de los países son: el saldo de la deuda pública externa e con respecto al PIB y el servicio de la deuda pública externa con respecto a las exportaciones de bienes y servicios no factoriales.

Conforme a la literatura económica consultada por el BCCR se tiene que el límite máximo de esas razones debe ubicarse en el orden del 35% o 40% para la primera razón y de 15% o 20% para la segunda” . Ello significa que el Parlamento no solo debería tener como referencia el valor de los activos, sino la capacidad de pago del país para improbar o aprobar un empréstito, por ello, debe tener el aval correspondiente. A criterio de los suscritos diputados la reforma propuesta al inciso ch) del numeral 3 debe ser modificada, para no contravenir lo dispuesto en las normas constitucionales, en especial el artículo 121 inciso 15, pues como se ha dicho anteriormente cualquier endeudamiento externo que negocie y contrate este Instituto, sin importar su monto o el porcentaje que represente de los activos totales de esta institución, debe ser conocido y aprobado por la Asamblea Legislativa. En la reforma, el Instituto también está autorizado para obtener recursos nacionales o extranjeros, pero en el tema de endeudamiento elimina el aval del Poder Ejecutivo y en su lugar señala que en caso de que dicho endeudamiento exceda el 40% de los activos totales del INCOFER, ese Instituto debe contar con la aprobación de la Asamblea Legislativa.

Sobre este particular se debe indicar que según lo dicho antes que el endeudamiento externo siempre requerirá por disposición constitucional ser aprobado por el Poder Legislativo, la diferencia sustancial radica en el hecho de que el endeudamiento interno hasta la fecha no ha requerido de tal aprobación legislativa, solamente el aval del Poder Ejecutivo. Un último aspecto que merece la atención y que se encuentra en el mismo párrafo que se analiza, tiene que ver con la autorización que se le otorga al INCOFER para establecer "gravámenes" pues, de conformidad con lo dispuesto en el inciso 14 del artículo 121 de la Constitución Política una de las atribuciones de la Asamblea Legislativa es decretar la enajenación o la aplicación de usos públicos de los bienes propios de la Nación, en ese sentido la norma constitucional establece expresamente que bienes como los ferrocarriles no pueden ser excluidos del dominio estatal.

Así las cosas, siendo el INCOFER el instituto que administra estos bienes en el país, podría pensarse que una disposición tan abierta como la contenida en el referido párrafo podría ser motivo de confusiones a menos que se aclare aún más su contenido. 3. Sobre el artículo 39. Si bien es cierto la autorización otorgada a las instituciones autónomas no roza con el principio de autonomía de que gozan estos entes por ser de carácter facultativo para cada entidad, si existe un roce constitucional con el artículo 121 inciso 14 de la Carta Magna, cuando otorga una autorización genérica para enajenar bienes inmuebles, la cual en virtud de esa norma constitucional debe ser otorgada por la Asamblea Legislativa mediante ley previa. En ese sentido la Sala Constitucional ha externado lo siguiente: “El artículo 121.14 de la Constitución Política contiene tres reglas distintas claramente diferenciadas: “a) La primera es una norma que habilita a la Asamblea Legislativa para decretar la enajenación o la aplicación a usos públicos de los bienes propios de la Nación.

Por una parte, esta norma es irrestricta en cuanto a se refiere a todos los bienes propios de la Nación y por otra, reserva a la ley la materia, invalidando actos administrativos de enajenación o aplicación a usos públicos no fundados en ley previa, b) La segunda, prescribe que bienes no podrán salir definitivamente del dominio del Estado. Para esas categorías, que están enunciadas en los incisos a), b) y c), la restricción es total y absoluta en cuanto a salir del dominio del Estado, pero, de inmediato, la norma modera su severidad advirtiendo que tales categorías de bienes pueden ser explotados por la Administración Pública o por particulares de acuerdo con la ley o mediante concesión especial; c) La tercera, es una norma que se refiere específicamente a ciertos bienes (ferrocarriles, muelles y aeropuertos nacionales en servicio) no incluidos en las tres categorías de norma precedente.” S.C.V.6240-93

VI. SOBRE EL ARTÍCULO 16 INCISO CH)

En relación con la consulta planteada por parte de los parlamentarios, relacionada con el inciso ch) del artículo 16 propuesto en el proyecto los consultantes argumentaron que la creación de un régimen de contratación diferenciado como lo es el creado mediante la Ley No. 8660 Ley de Fortalecimiento Modernización de las Entidades Públicas del Sector Telecomunicaciones, específicamente, en el Capítulo IV del Título II, constituye una violación del principio de igualdad entre entidades públicas. En el proyecto propuesto, el inicio ch) del artículo 16, permite el Consejo Directivo del Incofer, aprobar adquisiciones de bienes y servicios de conformidad con el Régimen especial de contratación administrativa establecido en la normativa señalada. En razón de lo anterior, se indica que el Incofer contará con las competencias y potestades que atribuye al Instituto Costarricense de Electricidad. Asimismo, toda la actividad de contratación administrativa será fiscalizada por la Contraloría General de la República. Al respecto, estima este Tribunal Constitucional, que la utilización de un régimen especial de contratación administrativa no resulta contrario al Derecho de la Constitución.

Los derechos en favor de los órganos y entes públicos se admiten cuando se trata de entidades de base corporativa, en cuyo caso se entiende que se hace a favor de sus miembros (ver voto No. 1994-2665). Sin embargo, en ciertos supuestos muy limitados, por razones elementales de justicia y equidad, hay ciertas garantías instrumentales que sí resultan aplicables a los entes públicos, concretamente: el derecho de igualdad de armas, el derecho a un debido proceso justo, el derecho de propiedad, etc., pues si no fuese así, se estaría creando una situación intrínsecamente injusta, lo que resultaría contrario a los valores, principios y normas constitucionales. Lo anterior es aún más cierto, cuando se trata de entidades públicas cuyo giro es de naturaleza comercial, financiero e industrial, que actúan en un mercado competitivo, no solo frente a entes públicos sino ante sujetos de derecho privado. Ahora bien, en el caso concreto los consultantes señalan que el artículo 16 del proyecto consultado vulnera el derecho de igualdad, situación que no podría configurarse conforme a los argumentos expuestos, pues no se trata de situaciones en las que se justifica la tutela de los derechos fundamentales de órganos y entes públicos.

De otra parte, el artículo 182 de la Constitución Política señala que, “Los contratos para la ejecución de obras públicas que celebren los Poderes del Estado, las Municipalidades y las instituciones autónomas, las compras que se hagan con fondos de estas entidades y las ventas o arrendamientos de bienes pertenecientes a las mismas, se harán mediante licitación, de acuerdo con la ley en cuanto al monto respectivo”, es decir, bajo ese supuesto se permite al legislador ordinario el desarrollo de la ley y condiciones para realizar los procesos licitatorios y la forma de revisión, para lo cual tienen absoluta libertad. En el modelo propuesto en el proyecto consultado, el control se realiza ex post, tal como lo establece la normativa de referencia (Ley No. 8660), en ese sentido, en consulta evacuada por este Tribunal, con ocasión de una consulta facultativa legislativa, particularmente de la ley citada, se indicó que el procedimiento empleado y la forma de revisión son compatibles con el Derecho de la Constitución.

De esta manera, señaló este Tribunal que, “…el desarrollo del refrendo contralor como una forma específica de aprobación, en el ejercicio de la tutela administrativa o dirección intersubjetiva ejercida por la Contraloría General de la República, que dota de eficacia a determinados actos, es una cuestión de legalidad ordinaria, salvo los supuestos genéricos en que el constituyente originario lo impone” (sentencia No. 08-11210 de las 15:00 del 16 de julio de 2008) , tal como se indicó, la aplicación de un régimen especial de contratación no eximiría al Incofer de la aplicación de un régimen de contratación y, por el contrario, supone el proyecto la aplicación de un régimen especial en lugar del régimen ordinario. Bajo el anterior razonamiento, el texto propuesto, no contraviene el Derecho de la Constitución bajo algún supuesto de igualdad, derecho que, como se indicó, no resulta amparable al Estado.

Nótese, que la actividad el Incofer como Instituto del Estado es única y no se encuentra en competencia con alguna otra Institución Estatal o privada. El modelo propuesto en el proyecto consultado, tiene asidero en cuanto el texto constitucional no indica un modelo único para la contratación de bienes y servicios por parte del Estado y sus Instituciones y, por el contrario, refiere a la ley para su regulación, lo que supone la actividad legislativa de los propios consultantes para determinar la modalidad de contratación pues el constituyente dispuso la libertad en cuanto a los tipos de contratación administrativa. En este sentido se ha pronunciado este Tribual al indicar que “El artículo 182 de la Constitución Política reconoce que los contratos de ejecución de obras públicas, así como, las compras que realicen las instituciones autónomas, se realizarán mediante el procedimiento de licitación pública, de acuerdo con la ley en relación al monto correspondiente.

De conformidad con lo anterior, le corresponderá al legislador definir, en cada caso, los procedimientos de contratación administrativa, disponiendo, incluso, de sistemas especiales y cuantías diferenciadas, en relación a las características de la actividad y de la institución de la que se trate, siendo, precisamente, la cuantía, el parámetro discriminante en el diseño de diversos tipos de procedimientos de contratación administrativa.” (sentencia No. 08-11210 de las 15:00 del 16 de julio de 2008). De otra parte, debe recalcarse que, aun cuando se permita al Incofer un modelo especial para la contratación administrativa, lo cierto es que, no se excluye de los controles constitucionalmente atribuidos a la Contraloría General de la República, situación abordada en la sentencia citada. Bajo esta inteligencia, la modalidad de contratación contenido en el proyecto de ley no infringe el Derecho de la Constitución pues la utilización de un régimen de contratación similar al de otra institución, no configura una inconstitucionalidad, solo es una modalidad de contratación, dentro de diversas tipologías, cuyo contenido no excluye las exigencias ineludibles de la constitución. Los controles y evaluaciones del órgano contralor y las exigencias de transparencia se mantienen inalterables.

VII. SOBRE EL ARTÍCULO 3 INCISOS A) Y CH)

Los Diputados consultantes cuestionan la constitucionalidad de esta norma porque a través de ella se le pretende ampliar el marco competencial del Incofer, en su criterio, sin establecer con precisión a qué servicios se refiere cuando la norma señala que la institución puede prestar "servicios conexos", según se desprende de la modificación propuesta al artículo 3, inciso a) de la Ley 7001.Los Diputados consultantes cuestionan la constitucionalidad de esta norma porque a través de ella se le pretende ampliar el marco competencial del Incofer, en su criterio, sin establecer con precisión a qué servicios se refiere cuando la norma señala que la institución puede prestar "servicios conexos", según se desprende de la modificación propuesta al artículo 3, inciso a) de la Ley 7001. En primer término, debe señalarse que la Ley de la Jurisdicción Constitucional en el artículo 99 dispone que las consultas legislativas de constitucionalidad, de carácter facultativo, deberán formularse en memorial razonado, con expresión de los aspectos cuestionados del proyecto, así como de los motivos por los cuales se tuvieren dudas u objeciones sobre su constitucionalidad.

Respecto a la consulta de constitucionalidad del artículo 3 inciso a), el requisito de consulta ante este Tribunal Constitucional no se cumple en sentido estricto, pues no se señala infracción alguna al texto constitucional y, por el contrario, se plantea una situación de conveniencia del texto propuesto, lo que a todas luces es una de las potestades del legislador ordinario. En este sentido, debe recordarse que las objeciones señaladas, no son objeto de control de constitucionalidad a priori en los términos de los artículos 96-101 de la Ley de la Jurisdicción Constitucional. Sobre el particular, cabe reiterar el criterio vertido por este Tribunal Constitucional en la opinión consultiva No. 2008-004569 de las 14:30 hrs. de 26 de marzo de 2008 que, dispuso lo siguiente:

“(...) Al respecto, cabe indicar que conforme al marco de competencias encomendado a este Tribunal Constitucional, no le corresponde revisar mediante la consulta legislativa de constitucionalidad el rigor y precisión de la técnica legislativa. En efecto, de conformidad con el artículo 1° de la Ley de la Jurisdicción Constitucional, le corresponde a la jurisdicción constitucional garantizar la supremacía de las normas y principios constitucionales y del Derecho Internacional o Comunitario vigente en la República, su uniforme interpretación y aplicación, así como los derechos y libertades fundamentales consagrados en la Constitución o en los instrumentos internacionales de derechos humanos vigentes en Costa Rica. Asimismo, el artículo 3° dispone que 'Se tendrá por infringida la Constitución Política cuando ello resulte de la confrontación del texto de la norma o acto cuestionado, de sus efectos, o de su interpretación o aplicación por las autoridades públicas, con las normas y principios constitucionales'. En relación al supuesto agravio apuntado por los legisladores consultantes, estima este Tribunal que no se trata de un supuesto vicio de constitucionalidad, sino de técnica legislativa. (...)” (Lo resaltado no corresponde al original).

Al igual que en las consideraciones expuestas, debe reiterarse que no le corresponde a este Tribunal Constitucional controlar el rigor y la precisión de la técnica legislativa, puesto que, en el fondo, no es un vicio de constitucionalidad (ver en el mismo sentido la resolución de este Tribunal No. 2008-011210 de las 15:00 hrs. de 16 de julio de 2008). En todo caso, una norma que establece una categorización flexible, no configura una inconstitucionalidad, porque el contenido de la norma está sometido al control administrativo y judicial. La previsión de un concepto jurídico indeterminado no es incompatible con la constitución, salvo que esta contenga una restricción expresa, lo que no ocurre en la hipótesis que se consulta.

Sobre el inciso ch) del artículo 3, plantean los consultantes que, esta norma establece la posibilidad de endeudamiento autónomo, tanto a nivel interno como externo hasta un límite máximo de un 40% en relación con sus activos totales. En otras palabras, el Incofer podría negociar, contratar y ejecutar, créditos externos de mediano y largo plazo hasta el nivel de endeudamiento indicado sin necesidad de obtener la aprobación Legislativa. Estiman que, existe un claro vicio de constitucionalidad en la norma indicada pues, los contratos públicos, que se relacionen con el crédito público y que sean celebrados por el Poder Ejecutivo están supeditados -para su validez y ulterior ejecución- a la necesaria aprobación por parte de la Asamblea Legislativa que es el único ente con potestad constitucional para aprobarlos o improbarlos. Así se desprende de las disposiciones contenidas en los artículos 124, 121 inciso15) y 140 inciso 19 de la Carta Política.

El proyecto en consulta tiene la clara intención de dotar al Incofer de las las herramientas necesarias para desarrollar el transporte público ferroviario del país. En razón de lo anterior, el proyecto propone autorizar a dicho Instituto para obtener financiamiento mediante el endeudamiento externo e interno hasta por un 40% de sus activos totales, así como facultarlo para a constituir fideicomisos, emitir títulos valores y en general, utilizar otros mecanismos de financiamiento. Pretende además, implementar el régimen especial de contratación administrativa creado mediante Ley No. 8660 del 8 de agosto de 2008 para el ICE y sus empresas. Permite al Instituto desarrollar fuentes propias de ingresos que permitan financiar sus proyectos de transporte ferroviario, por medio de la suscripción de alianzas y convenios de cooperación con otras instituciones públicas. Agiliza el régimen de expropiaciones que aplica el Instituto, debido a que la normativa vigente lo limita a tramitar expropiaciones a través del Poder Ejecutivo.

Por último, genera condiciones para reactivar la red ferroviaria nacional, mediante el desarrollo de proyectos estratégicos como el Tren Eléctrico Inter Urbano de la GAM y un servicio de Tren Interoceánico, con el objetivo de reactivar y conectar la vía férrea del Atlántico y el Pacífico para transporte de carga y pasajeros, así como aquellos proyectos incluidos en sus planes de desarrollo. En razón de lo anterior, y del análisis del texto propuesto, se estima que la implementación de un modelo espacial de constatación administrativa, como ya se indicó, en esencia no es contrario a lo establecido en la Constitución Política, pues en el ordinal 182 de la mencionada carta, se refiere a la figura general de la licitación, sin calificarla de pública o no, de otra parte desconstitucionalizó -asignándole al legislador ordinario- el tema de la definición de los montos para que procedan las distintas modalidades de licitación -pública o abreviada- con lo cual se trata, claramente, de un extremo librado a libertad de configuración legislativa.

En relación con lo preceptuado en el artículo 121 inciso 15) de la Constitución, respecto a las facultades de la Asamblea Legislativa para aprobar o improbar empréstitos o convenios similares que se relacionen con el crédito público, debe entenderse que esta facultad aplica, únicamente, cuando se trate de empréstitos celebrados por el Poder Ejecutivo, situación que no obligaría al Incofer a tener aprobación previa para realizar estos empréstitos salvo que el Estado sirva como avalista de esa operación. En tal caso, bajo el supuesto anterior, debería entenderse que, con la aprobación de la presente ley, se otorgaría la autorización previa del legislador ordinario, pues se establece el monto máximo de endeudamiento en la norma consultada, según la cual “… el Instituto queda autorizado para negociar, contratar y ejecutar, de manera autónoma, endeudamientos internos y externos de mediano y largo plazos hasta un nivel de endeudamiento máximo del cuarenta por ciento (40%) en relación con sus activos totales, así como para constituir gravámenes y, en cualquier forma legal, obtener recursos nacionales o extranjeros.

El endeudamiento se calculará con base en el total consolidado del valor de los activos totales del Instituto al 31 de diciembre del año anterior; para el cálculo se excluirán los pasivos de corto plazo…”, así mismo, señala el texto consultado que, “Si el endeudamiento requerido excede el porcentaje indicado en el párrafo anterior, deberá obtenerse la aprobación de la Asamblea Legislativa”. Nótese que el texto consultado no supone un incumplimiento de lo preceptuado por el constituyente y, por el contrario, se trata de un tipo de autorización legal para el endeudamiento que requiere el Instituto para cumplir con los fines propuestos, situación que no roza con el Derecho de la Constitución, en los casos en los cuales se requiera que el Estado sirva de avalista de un empréstito. Así las cosas, no observa este Tribunal que el texto propuesto sea inconstitucional, pues, la intención del legislador es autorizar de forma previa al Incofer de manera que pueda negociar, contratar y ejecutar, de manera autónoma, endeudamientos internos y externos de mediano y largo plazos hasta un nivel de endeudamiento máximo del cuarenta por ciento (40%) en relación con sus activos totales.

Esa autorización está dentro de márgenes de razonabilidad y proporcionalidad. por motivos de eficiencia y celeridad puede el parlamento dar una autorización previa, lo cual, es una posibilidad que no conculca las exigencias de la norma constitucional.

VIII. SOBRE EL ARTÍCULO 39

En relación a la consulta planteada, se cuestiona la constitucionalidad de la norma indica por cuanto propone una autorización genérica para enajenar bienes inmuebles, la cual en virtud de esa norma constitucional debe ser otorgada por la Asamblea Legislativa mediante ley previa. Sobre el particular, al igual que lo señalado en el considerando anterior, este proyecto supone en algunos de los artículos una ley previa mediante la cual se otorga dicha autorización. Se debe advertir, que la enajenación de los inmuebles propiedad del Estado, es susceptible de enajenación, en aquellos que no se trate de bienes demaniales o dominicales, pues el constituyente originario estableció en ese sentido una restricción sobre algunos bienes propiedad del Estado, los cuales, no susceptibles de afectación alguna, excepción que señala el inciso 14) del artículo 121 del texto constitucional. Se trata entonces de bienes que por su condición pertenecen al Estado y, bajo ningún supuesto, pueden salir de su dominio o control, quedando por ello afectados de forma exclusiva a un uso público, fuera del comercio de los hombres y, caracterizados por ser inalienables, imprescriptibles e inembargables.

En relación con el régimen general de donaciones la Ley de Contratación Administrativa, en su artículo 69 señala: “(…) Límites. La Administración no podrá enajenar los bienes inmuebles afectos a un fin público. Los bienes podrán desafectarse por el mismo procedimiento utilizado para establecer su destino actual. Se requerirá la autorización expresa de la Asamblea Legislativa, cuando no conste el procedimiento utilizado para la afectación (…)”, la limitación para efectuar donaciones según la norma señalada radica en el caso de que el inmueble está afecto a una finalidad pública no se puede enajenar, sin embargo, el mismo numeral dispone que los bienes pueden desafectarse por el mismo procedimiento utilizado para establecer su destino actual, es decir, mediante ley. Está claro que, en materia de donaciones, tratándose de entidades públicas, debe existir una ley expresa (para una determinada situación) o bien, es decir, una ley que, en forma genérica permita que una entidad pública done parte de sus bienes (muebles o inmuebles) en favor de otras entidades públicas.

Si bien el texto propuesto no indica los bienes que pueden ser objeto de enajenación, lo cierto es que podría tratarse únicamente de bienes sobre los cuales sea posible tal afectación. El texto propuesto indica que “…los organismos del Estado, en especial el Ministerio de Obras Públicas y Transportes (MOPT) y las instituciones autónomas, salvo la Caja Costarricense de Seguro Social (CCSS), semiautónomas y empresas públicas, quedan autorizados para ceder, traspasar, gestionar, negociar, colaborar, donar o arrendar, a título gratuito, todo tipo de recursos, servicios o bienes muebles e inmuebles, materiales y equipo, así como a trasladar personal a favor del Instituto…”, de tal manera, no supone el texto propuesto una afectación al Derecho de la Constitución. En diversos precedentes, la Sala ha considerado que “…el régimen jurídico de los bienes de dominio público es especial y diferenciado en atención al tipo de bienes de que se trata.

La distinción entre bienes o cosas privadas y bienes y cosas públicas se hace depender, en primer lugar, en la "titularidad" o "dominio" del bien, por cuanto de este elemento se define su naturaleza y régimen jurídico diferenciados; y en consecuencia, del derecho aplicable, en tanto el primero se sujeta al derecho privado, y el segundo al derecho público. Es así, como por bienes demaniales o dominicales deben de entenderse el conjunto de bienes –tanto inmuebles como muebles– que tienen una naturaleza y régimen jurídico virtualmente opuesto a los privados, en tanto se trata de bienes que por expresa voluntad del constituyente o el legislador, se encuentran afectos a un destino especial de servir a la comunidad, sea al interés público, y que por ello, no pueden ser objeto de propiedad privada, de modo que están fuera del comercio de los hombres, es decir, no pueden pertenecer individualmente a los particulares, ni al Estado –en sentido estricto–, por cuanto éste se limita a su administración y tutela.

Así, los bienes de dominio público y los de dominio privado del Estado (fiscales) se diferencian por su finalidad y el sujeto titular, en tanto lo que define la naturaleza jurídica de los primeros es el destino que se da a este tipo de bienes, sea, en tanto se afectan y están al servicio del uso público, en los términos previstos en el artículo 261 del Código Civil…” (sentencias número 5399-93, 3145-96, 5027-97, 2988-99, 2000-10466, 2002-8321; 2003-3480; 2005-7158). Siempre en el entendido de que la autorización pretendida en el proyecto plantea la posibilidad legal de traspasar inmuebles del Estado a favor del Incofer, estos no podrán, bajo ningún supuesto, tratarse de aquellos bienes que el constituyente consideró que no podrían dejar de ser bienes del dominio público pues de lo contrario, se trataría de un acto contrario al Derecho de la Constitución. Además, debe recalcarse, que los bienes cuyo traspaso se autoriza, quedarían siempre dentro del dominio público, porque Incofer es una institución pública.

De esta manera, los bienes donados por parte de otras instituciones al Incofer, no sólo continuarían afectados a la utilidad común y satisfacer el servicio público, en razón de los fines que deben de cumplir, sino que, estarían afectados por lo preceptuado en el texto constitucional no siendo posible su afectación o traslado de dominio debido a su nueva naturaleza y utilidad pública, afectados al servicio de la colectividad. Bajo el anterior supuesto, se evacúa la consulta en lo que respecta a este artículo y se estima que no tienen roces de fondo con la constitución.

IX. CONCLUSIÓN

Como corolario de las consideraciones realizadas, se debe evacua la consulta según se indica en la parte dispositiva de esta resolución.

X. NOTA DE LOS MAGISTRADOS JINESTA LOBO, HERNÁNDEZ LÓPEZ Y HERNÁNDEZ GUTIÉRREZ

Con redacción del primero. Los Magistrados consignamos la presente nota en el sentido que la discusión sobre si los entes públicos tienen o no derechos fundamentales resulta irrelevante para resolver el sub-lite. En todo caso aclaramos que los entes públicos o privados, pueden, eventualmente, ser titulares de algunos derechos fundamentales o humanos (v. gr. tutela judicial efectiva, propiedad, etc.), aunque, por razones obvias, no son titulares de aquellos que presuponen a la persona física (v. gr. integridad física, salud, vida, etc).

XI.RAZONES PARTICULARES DEL MAGISTRADO RUEDA LEAL EN RELACIÓN CON EL ARTÍCULO 16 INCISO CH) CONSULTADO Y LA ALEGADA VIOLACIÓN AL PRINCIPIO DE IGUALDAD.

Las diputadas y diputados consultantes cuestionan que el ordinal 16 inciso ch) del Proyecto de Ley No. 18252 crea, a favor del INCOFER, un régimen especial de contratación administrativa que podría violentar el principio de igualdad entre entidades públicas. Agregan que la norma introduce, a favor de aquella entidad, un esquema diferenciado similar al que actualmente goza el ICE, sin la existencia previa de un tratado como en ese caso. En cuanto a este punto, debo indicar, como enfáticamente lo he hecho en reiteradas ocasiones, que las instituciones públicas no gozan de derechos fundamentales. Así lo precisé en la sentencia No. 2013-5772 de las 9:50 horas del 26 de abril de 2013:

“En el caso objeto de esta impugnación, me separo del criterio de mayoría de este Tribunal Constitucional y considero improcedente conocer el fondo del recurso, por las razones que a continuación esgrimo. A la luz de numeral 48 de la carta política, todo habitante del territorio nacional ostenta el derecho a ejercer el recurso de amparo para mantener o restablecer los derechos fundamentales consagrados en la Carta Magna, con la salvedad del derecho de libertad -circulación o tránsito- o la integridad personal, ya que para ese último se halla el recurso de hábeas corpus.

Es así que el recurso de amparo representa un derecho constitucional que disfruta todo individuo y está dirigido a resguardar los derechos fundamentales de la forma más expedita posible frente a una amenaza o vulneración (ver en el mismo sentido las sentencias número 1991-0174 de las 14:30 del 25 de enero de 1991, 1992-2890 de las 09:06 horas del 11 de setiembre de 1992 y 2008-09851 de las 14:55 horas del 17 de junio de 2008).

Subyacen a esta disposición dos elementos cruciales. De un lado, los alcances de la justicia constitucional. Del otro, la naturaleza misma de los derechos fundamentales. Es importante recordar, en primer lugar, que el resurgimiento de la justicia constitucional, alejada de la propuesta original de Hans Kelsen, surgió a mediados del siglo pasado, finalizada la Segunda Guerra Mundial, con el claro objetivo de evitar que muchas de las nefastas consecuencias de aquella conflagración, fruto, precisamente, de abusos y arbitrariedades atribuibles a varios Estados, pudieran repetirse. Eso, que algún sector de la doctrina ha denominado la segunda ola de la justicia constitucional (ver: Nogueira Alcalá (Humberto). “Tópicos sobre jurisdicción constitucional y tribunales constitucionales”, Revista de Derecho, volumen XIV, julio, 2003, Chile, Universidad Austral, p. 61) representa una particular conceptualización de la jurisdicción constitucional, de cuyas fuentes nuestro sistema jurídico ha bebido también, que la concibe, en principio, como un mecanismo para proteger a las personas del poder estatal y sus posibles excesos.

Incluso es posible encontrar propuestas en el sentido de que la vieja división de la justicia constitucional en dos modelos teóricos: el norteamericano y el austriaco se reemplace por otras en las que el criterio de categorización sea la protección de los derechos fundamentales. Por ejemplo, Rubio Llorente y Jiménez Campo llaman “modelo centrado en los derechos” aquel en el que junto al control de la constitucionalidad de las normas se crean mecanismos de preservación de los derechos que la constitución contiene. Frente a cualquier actuación del Estado (ver: Rubio Llorente (Francisco) y Jiménez Campo (Javier). Estudios sobre justicia constitucional, Editorial Mc Graw-Hill, Madrid, 1997, p. 156). Este sería el caso costarricense que contempla, como principio rector, que las personas ejerzan una defensa de sus derechos fundamentales ante la Sala Constitucional.

Ello conduce, en segundo lugar, a subrayar que los derechos fundamentales regulan las relaciones entre los individuos de cara al Estado y, eventualmente, los particulares (efecto horizontal), son, en definitiva, posiciones normativas que fundamentan deberes del Estado y limitan sus competencias para con las personas (ver: Alexy (Robert). Teoría de los derechos fundamentales, CEPC, 2007, pp. 464, 484). En virtud de lo anterior, considero que, aun en un sentido amplio, el recurso de amparo no está concebido para proteger a los sujetos públicos, es decir a las entidades de Derecho Público que conforman el aparato estatal, toda vez que para tal efecto existen otras vías que el ordenamiento ofrece para defender su labor o autonomía. Permitirlo supone desnaturalizar el contenido ontológico tanto de la justicia constitucional, como de los derechos fundamentales. En el caso bajo estudio, el recurrente, quien funge como apoderado especial administrativo del Banco Crédito Agrícola de Cartago en el proceso tramitado bajo el expediente número AGHS-002-2012, manifiesta que se negó el acceso a dicho expediente y, tal situación violenta sus derechos fundamentales y los de su representada.

De manera que el recurrente emplea la vía sumaria del amparo a favor de la referida institución pública; empero, lo anterior es improcedente, pues se trata de un sujeto de derecho público. En mérito de lo expuesto anteriormente, estimo que este recurso de amparo es improcedente.”.

En sentido similar, también salvé el voto en la sentencia No. 2014-14599 de las 16:30 horas del 2 de setiembre de 2014, en donde, junto con el Magistrado Castillo, señalé:

“A pesar de la claridad que existe en torno al tema, la mayoría de este Tribunal ha procedido a amparar al Estado frente a un sujeto de derecho privado. En otras palabras, la Sala se ha tornado en garante de la actividad estatal y coadyuvante en la imposición del imperio del Estado frente al administrado. La incongruencia de este razonamiento radica no solo en su discordancia con las normas básicas de derechos humanos, sino también en el desconocimiento de la posición de poder del Estado frente al individuo. Ante situaciones como la planteada, bien puede el Estado convocar a una conferencia de prensa o publicar un campo pagado, en caso de considerarlo necesario.

En ese tanto, también es preciso aclarar que la jurisprudencia de este Tribunal se ha pronunciado en el sentido de que ni el Estado ni sus instituciones (en este caso, el Ministerio Público) son titulares del derecho de rectificación o respuesta. Verbigracia, puede citarse la sentencia número 2290-96 de las 15:36 horas del 15 de mayo de 1996: "En reiteradas oportunidades, ésta Sala ha lingüística que el Estado, lato sensu. no es titular del derecho consagrado en el artículo 48 de la Constitución Política de acudir ante esta Sala, en la vía del recurso de amparo, para mantener o preservar los derechos fundamentales. Como ya lo ha invocado la Sala. El principio inspirador del instituto del amparo es brindar a los administrados un medio de defensa contra los eventuales abusos del poder, y no obstante su amplia concepción. no puede entenderse concebido para proteger a entidades de Derecho Público pues para que éstas puedan defender su autonomía, o la competencia que les ha sido asignada por el acto de creación, perfectamente pueden acudir a otros mecanismos previstos por el propio ordenamiento jurídico (al respecto véanse sentencias número 174 de las catorce horas treinta minutos del veinticinco de enero de mil novecientos noventa y uno, y 2890 de las nueve horas seis minutos horas del once de setiembre de mil novecientos noventa y dos).

En el caso que nos ocupa, el Ministerio de Seguridad Pública no se encuentra excluido del concepto amplio de Estado, por lo que consecuentemente también participa de la limitación en cuanto a la legitimación activa a que se ha hecho aludido, no encontrando la Sala motivos para variar el criterio sostenido en su Jurisprudencia (ver en ese sentido resolución número 0506-95 de las once horas veintiún minutos del veintisiete de enero del año anterior)”. Así las cosas, tampoco puede admitirse que la Fiscalía de Asuntos Indígenas, a través de la Oficina de Prensa del Ministerio Público. tenga el derecho de solicitar la rectificación y respuesta pretendida, ya que implicaría aceptar que esa entidad de Derecho Público goza de esa garantía constitucional, lo cual -como se vio- ha sido descartado por los precedentes de esta propia Sala. Ergo, consideramos que lo correspondiente es desestimar el recurso de amparo.” Es evidente que lo dicho en tales amparos, resulta igualmente válido respecto de una acción de inconstitucionalidad, por cuanto es insostenible que una institución pública pueda gozar de un derecho fundamental, toda vez que titular de este solo puede serlo un ser humano, como fácilmente se extrae del numeral 1 de la Convención Americana sobre Derechos Humanos:

“Artículo 1. Obligación de Respetar los Derechos 1. Los Estados Partes en esta Convención se comprometen a respetar los derechos y libertades reconocidos en ella y a garantizar su libre y pleno ejercicio a toda persona que esté sujeta a su jurisdicción, sin discriminación alguna por motivos de raza, color, sexo, idioma, religión, opiniones políticas o de cualquier otra índole, origen nacional o social, posición económica, nacimiento o cualquier otra condición social.

2. Para los efectos de esta Convención, persona es todo ser humano.” Ergo, los Estados son los obligados a respetar los derechos fundamentales de los seres humanos, y no al revés, es decir, que por alguna vía jurisdiccional, el Estado pretenda que los jueces les reconozcamos algún derecho fundamental. Vale aclarar que cuando un regidor o alcalde acude a esta Sala aparentemente en nombre de su corporación municipal, en realidad lo hace en defensa de los munícipes de la localidad correspondiente, caso en que el amparo procede pero teniendo como amparados a los munícipes, no a una entidad pública. En virtud de lo expuesto, este aspecto consultado es del todo inadmisible.

POR TANTO

Se evacua la consulta facultativa formulada, en el sentido de que las normas consultadas (arts. 3 inciso a) y ch), 16 inciso ch) y 39)) del proyecto de ley Fortalecimiento del Instituto Costarricense de Ferrocarriles (Incofer) y Promoción del Tren Eléctrico Interurbano de La Gran Área Metropolitana expediente legislativo No. 18252, no presentan vicios de constitucionalidad en cuanto al fondo. Los Magistrados Jinesta Lobo, Hernández Gutiérrez y, la Magistrada Hernández López ponen nota. El Magistrado Rueda Leal da razones particulares.
