Findings of Fact (Resultando):
As a result of the facts and law invoked, it is concluded that this agency has not infringed any constitutional right or neglected its obligations; on the contrary, the facts referred to in this report and the supporting documents confirm prompt administrative conduct in accordance with the law, insofar as a formal response was provided to the petitioners’ submissions. Based on the stated factual and legal grounds, it requests that the requested report be deemed duly submitted and that this amparo proceeding (recurso de amparo) against SETENA be dismissed, since no constitutional right has been violated. As evidence, they submit official communications UE-DEA-014-2014, ASA-0075-2014, and DEA-0291-2014, as well as certified copies of several documents from case files 459-2002-SETENA, D1-8869-2012-SETENA, and D1-1322-2011-SETENA.
. That they are awaiting a new inspection to determine whether the 1.1 dB reduction was achieved. That the current operating schedule is the one specified in the Sworn Declaration of Environmental Commitments (Declaración Jurada de Compromisos Ambientales). That they have not violated the appellants’ constitutional rights. They request that the appeal be dismissed.
20. By written submission received by the Secretariat of this Chamber on November 2, 2015, the Minister of Health complied with the order issued by this Chamber in the decision rendered at 15:11 hours on October 23, 2015. He also describes the various actions taken by the Área Rectora de Salud de Aserrí in connection with compliance with the recommendations contained in official letter DM-MA-5724-15 and the alleged noise pollution (contaminación sónica) caused by trucks entering the Huazo de Aserrí sanitary landfill (relleno sanitario) at night. In official letter DM-MA-5724-2015 of June 18, 2015, signed by the Vice Minister of Health, the Head of the Unidad de Administración de Servicios de Salud en Ambiente Humanos, and the Director de Protección al Ambiente Humano, they informed the Minister of Health of the results of an inspection they conducted at the El Huaso Aczerrí sanitary landfill together with officials from the Área Rectora de Salud de Aserrí and the Dirección Región Central Sur, which concluded as follows: 1.
The company must submit an updated survey detailing the project’s civil works referred to in item 7. 2. Construct a treatment system for the sludge generated by the Leachate Treatment System (Sistema de Tratamiento Lixiviados) or, alternatively, submit a technical justification demonstrating that such works are unnecessary. 3. Submit a schedule of activities specifying or scheduling the periods for recirculation and discharge of wastewater according to the time of year. 4. Keep the working face (frente de trabajo) limited in size in order to reduce odors, as is currently being done. 5. Do not operate or carry out construction work on the expansion of cell 3 until the required construction permits have been obtained. 6. Do not carry out batch-type discharges without prior authorization from the Área Rectora de Salud. If required, a maintenance and cleaning plan for the treatment system must be submitted 15 days before its implementation for review and approval by the Área Rectora de Salud. 7.
Direct all wastewater (sewage–leachate) to the treatment system or to its first unit. 8. The Área Rectora de Salud must conduct a fluorescein test when there is effluent in the wastewater treatment system in order to verify which pipe conveys it to the receiving body of water (cuerpo receptor). If there is any doubt, the storm-sewer networks must be dyed with a solution of Red 40 mixed with fluorescein to verify that they convey only rainwater. These tests must be conducted at different times; that is, they must not be performed simultaneously. 9. The Área Rectora de Salud must continue conducting periodic visits in coordination with the Regional Level or Central Level to follow up on the requirements. By sanitary order (orden sanitaria) No. RH-103-2015 of September 21, 2015, the Área Rectora de Salud ordered Parque Tecnológico Ambiental Casería (Relleno Sanitario) as follows: “1. The company must submit an updated survey detailing the project’s civil works referred to in item 7 of official letter DM-MA-5724-2015.
2. Construct a treatment system for the sludge generated by the Leachate Treatment System or, alternatively, submit a technical justification demonstrating that such works are unnecessary. 3. Direct all wastewater (sewage–leachate) to the treatment system or to its first unit (immediate deadline).
Justice Cruz Castro drafted the opinion; and,
Considering:
Because of its exceptional nature, the ordinary processing of amparo proceedings (recursos de amparo) against private-law entities requires first determining whether the case falls within any of the circumstances making such proceedings admissible and, subsequently, if so, deciding whether the claim has merit. In this regard, Article 57 of the Ley de la Jurisdicción Constitucional sets forth the circumstances under which an amparo action against the acts or omissions of private-law entities is admissible: when such entities act or are required to act in the exercise of public functions or powers, or when, as a matter of law or fact, they occupy a position of power in relation to which ordinary judicial remedies are clearly insufficient or untimely to guarantee the fundamental rights or freedoms referred to in Article 2°, subsection a), of that same Law. In the present case, those requirements are clearly satisfied because the respondent is a private-law entity that provides a public service and is capable of violating Articles 21 and 50 of the Constitución Política, while no ordinary judicial remedies exist for their protection. Accordingly, the merits of the amparo action must be examined.
The applicants allege that Parque de Tecnología Ambiental Aczarrí, located in Aserrí, causes serious environmental pollution problems due to the excessive noise produced by collection trucks, as well as strong biogas odors at night because the garbage is not covered, and the large amount of dust generated by earthworks (remoción de tierra). These conditions affect the health of residents in the area, thereby violating Articles 21 and 50 of the Constitución Política. They further allege that the Tribunal Ambiental Administrativo, the Secretaría Técnica Nacional Ambiental, and the Ministerio del Ambiente y Energía have not ruled on the deficiencies of the sanitary landfill (relleno sanitario) in question.
The following facts are deemed duly proven and relevant to the decision in this matter, either because they have been established as such or because the respondent failed to address them as ordered in the initial ruling:
a. Parque de Tecnología Ambiental Aczarrí, located in Aserrí, holds sanitary operating permit (permiso sanitario de funcionamiento) number RCS-ARSA-344-2012, valid until 17 de julio del 2017. Its legal representative is Mr. Durán Víquez, and the business name is Empresa Berthier EBI Costa Rica S.A., legal entity identification number 3-101-215741, for the activity of treating and disposing of domestic solid waste through a mechanized process (sanitary landfill). (Report submitted by the Director of the Área Rectora de Salud de Aserrí).
b. By Resolution No. 1573-2013-SETENA of 19 de junio de 2013, the Secretaría Técnica Ambiental granted environmental approval (viabilidad ambiental) to the project in question under case file (expediente) D1-8869-2012-SETENA. This was based on the completion of the processing of case file No. 1322-2011 (report of the respondent authority).
c. According to information provided by the Departamento de Auditoría y Seguimiento Ambiental of SETENA, project 8869-2012 has complied with the applicable procedures through their respective current stages, and no instances of noncompliance have been identified (report of the respondent authorities).
d. On 16 de enero del 2014, officials from the Área Rectora de Salud conducted an inspection at the facilities of Parque de Tecnología Ambiental Aczarrí, located in Aserrí, where they verified that the biogas passive extraction and combustion system was operating and that no waste from the previous day was observed without the corresponding cover material. In addition, no foul odors were detected, and the dimensions of the cell’s working face were adequate, thereby ensuring proper waste compaction. They stated that, as its principal dust-mitigation measure, the project administration irrigates the main roads within the landfill and the principal roads surrounding it using tanker trucks, as well as sprinkler irrigation on slopes. The project has a network for channeling and conveying leachate (lixiviados) to a treatment system located at the northwestern end. That system consists of 3 units (demisting chamber + aeration chamber + sedimentation chamber) and uses aeration systems to remove contaminants from the leachate and reduce the organic load before discharge into the Guatuso River, in compliance with the discharge parameters established in the regulations in force.
The inspection also confirmed proper operation, the absence of foul odors, and a dark-brown color of the leachate in the aeration tank, which indicates favorable aeration conditions. The dissolved-oxygen and pH parameters were measured in situ in the aeration tank, yielding favorable results of pH 8,43 (it must be between 5 and 9) and dissolved oxygen 5,67 (it must not be below 2). (Report of the respondent authorities).
e. At 21:00 hours on 20 de mayo del 2014, officials from the Área de Salud de Aserrí conducted a sound-level measurement (medición sónica) at the residence of Ms. Mora Pérez, located 50 meters west of the Ebais del Llano on the main access road to Parque de Tecnología Ambiental Aczarrí. Based on the results obtained, it was determined that national legislation was not being violated (report of the respondent authorities).
f. At 22:00 hours on 20 de mayo del 2014, officials from the Área Rectora de Salud de Aserrí conducted a sound-level measurement at the home of Mr. Guzmán Ureña, which produced the following results: ambient noise plus generating source, 51,1 dB; and ambient noise alone, 47,7 dB. These levels exceeded the parameters established by the Reglamento para el Control de Contaminación por Ruido, Decreto No. 28718-S (report of the respondent authorities).
g. Through sanitary order (orden sanitaria) No. RH-065-14 of 10 de junio del 2014, the Área Rectora de Salud de Aserrí determined that there was already a record of a noise-mitigation plan submitted by the company in 2012. Nevertheless, based on the results of the sound-level measurement cited above, it ordered the company to immediately suspend the entry of garbage collection trucks into the sanitary landfill until it submitted a Noise-Mitigation Plan (Plan de Mitigación de Ruido) (report of the respondent authorities).
h. In sanitary order No. RH-009-2015 of 10 de febrero del 2015, the Área Rectora de Salud de Aserrí stated the following: “1. Two visits were made to the site to follow up on the complaint concerning noise caused by the entry and departure of waste collection trucks at Parque de Tecnología Ambiental Aczarrí, one on 6 de octubre and the other on 20 de noviembre del 2014. Both were conducted at the residence of Mr. Germán Segura Ureña, located 75 meters from the entrance to the sanitary landfill. In addition, Lic. Rafael Ángel Vega Alfaro of the Dirección Regional de Rectoría de Salud Centra participated on the first occasion, Msc. Ana Lucrecia Hernández participated on the second occasion, and Ing. Eugenio Androvetto Villalobos, Director de Protección al Ambiente Humanos, participated on both occasions; Mr. Segura Ureña was also present. 1. The measurement results show that, when vehicles pass, the emission exceeds the limits established by Decreto No. 28718-S Reglamento para el Control de Contaminación por Ruido for a residential area during nighttime hours, 45 (dB). 2.
The current conditions observed at the site, as well as those reflected in the information submitted by SETENA, differ from the original construction project submitted to this Ministry in 2006, which was planned for cadastral property (finca catastral) SJ-249003-95. 3. The original sanitary landfill project approved in 2006, whose construction plans are kept in the offices adjacent to the treatment plant, shows three monitoring wells on the site plan for the waste-disposal cells. However, the locations shown on the plans do not match those identified at the site, and the location of the third well is unclear, as only two wells intended for this purpose can be identified within the facility. It is unknown whether, subsequent to this proposal, an updated project supporting the current conditions and specifying the location of that alternative was processed before the competent entities. 4.
At the time of the inspection visit, the working face appeared to be quite large. 5. The technical design criteria used to determine the location, number, and distribution of the environmental-deodorant sprinklers, as well as the type of liquid to be used, are unknown. This raises concerns as to whether the solution is sufficient and, because the activity is performed manually, depends on the decision of the person on duty rather than on sensors that issue warnings when odors that may cause discomfort to residents are produced. Based on the foregoing, the Área Rectora in question ordered Parque Tecnológico Ambiental Aczerri (Relleno Sanitario) to do the following: 1. In view of the results of the sound-level measurements reflecting the problems caused by operation of the sanitary landfill at night, operating hours are limited to 10 p.m. 2. Submit a detailed site plan identifying the boundaries and the consolidation of the various identified cadastral properties comprising the property where the sanitary landfill project is being developed; the plan must show the various components of the activity (Deadline of 1 month). 3.
Define the recirculation periods and the discharge period during the year. Accordingly, discharge into the receiving body must continue throughout the entire rainy season (Immediate deadline consistent with the rainy season). 4. Prepare and submit to the Ministerio de Salud a project for construction of a system to treat sludge from the leachate-treatment system, as well as the intended uses of the biosolids (Deadline of one month to submit the project, including the implementation schedule). 5. Submit to the Ministerio de Salud authorization from the administration of the ASADA well and the respective technical documentation substantiating that this well, together with the other two monitoring wells existing within the sanitary landfill, is representative for monitoring the groundwater associated with this sanitation facility. 6. The working face must be reduced to facilitate management and odor control, particularly during the rainy season (immediate deadline). 7.
Submit a protocol stating how the possible measures to be taken will be determined in order to address events that may result in the release of unpleasant odors affecting residents. In the event of noncompliance, notice is hereby given that the Ministry may close the establishment pursuant to Articles 355, 356, 357, and 363 of the Ley General de Salud and initiate the corresponding criminal proceedings, including reporting those responsible for disobedience of authority pursuant to Article 314 of the Código Penal. Furthermore, item 1 of that order was amended to limit operating hours to 20:00 hours through official letter (oficio) No. CS-ARS-AS-195-2015 issued at 11:30 on 12 de febrero del 2015. The foregoing was served at 14:27 hours on 12 de febrero del 2015 on the legal representative of Berthier EBI de Costa Rica (report of the respondent authorities).
i. The company in question filed a motion for reconsideration with an alternative appeal (recurso de revocatoria con apelación en subsidio) against the foregoing, both of which were denied. Through Resolution DM-CP-4215-15, the Ministro de Salud dismissed the appeal (report of the respondent authorities).
j. In official letter No. DPAH-D-518-2015 of 18 de mayo del 2015, the Director of Human Environmental Protection of the Ministerio de Salud requested that Dr. Guillermo Flores Galindo, Regional Director of Health Governance for the Región Central Sur, use his good offices concerning Sanitary Order (Orden Sanitaria) No. RH-009-2015 so that the Área Rectora de Salud would follow up on points 2,3,4,5,6 and 7 of that order, since the established deadlines had expired, as it had been issued on 10 de febrero del 2015. The foregoing was based on a copy of the email sent to him by the Director of the Área Rectora de Salud de Aserrí on 14 de mayo del 2015, stating that, with respect to the plans requested, that Area had not received any documentation from the company; she also clarified that the Directorate had not received any plan or report from the company EBI that complied with the requirements of the sanitary order. Nevertheless, he considered that if the generation of particulate matter (material particulado) resulting from operation of the landfill (relleno) were observed during follow-up, its administrator should be ordered to apply water by spraying frequently throughout the day in order to suppress dust and prevent disturbances to neighboring residents (report of the respondent authorities).
k. In official letter DM-MA-5724-2015 of 18 de junio del 2015, signed by the Deputy Minister of Health, the Head of the Unidad de Administración de Servicios de Salud en Ambiente Humanos, and the Director of Human Environmental Protection, they informed the Minister of Health of the results of an inspection conducted at the El Huaso Aczerrí sanitary landfill (relleno sanitario), accompanied by officials from the Área Rectora de Salud de Aserrí and the Dirección Región Central Sur, which concluded as follows: 1. The company must submit an updated survey (levantamiento) detailing the project’s civil works identified in point 7. 2. Construct the treatment system for the sludge generated by the Leachate Treatment System (Sistema de Tratamiento Lixiviados) or, alternatively, submit a technical justification demonstrating that this facility is not required. 3. Submit a schedule of activities delimiting or scheduling the periods for recirculation and discharge of wastewater (aguas residuales) according to the time of year. 4.
Keep the working face small in order to reduce odors, as is currently being done. 5. Do not operate or carry out construction work on the expansion of cell 3 until the construction permits have been obtained. 6. Do not carry out batch discharges (descargas tipo batch) without prior authorization from the Área Rectora de Salud. If required, a maintenance and cleaning plan for the treatment system must be submitted 15 días before its implementation for review and approval by the Área Rectora de Salud. 7. Direct all wastewater (sewage – leachate) to the treatment system or to its first unit. 8. The Área Rectora de Salud must conduct a fluorescein test when effluent is present in the wastewater treatment system in order to verify which pipe conveys it to the receiving water body (cuerpo receptor). In case of doubt, the storm-sewer networks must be dyed with a solution of Red 40 mixed with fluorescein to verify that they convey only rainwater.
These determinations must be made at different times; that is, they must not be performed simultaneously. 9. The Área Rectora de Salud must continue conducting periodic visits in coordination with the Regional or Central Level to follow up on the requirements (report of the respondent authorities).
l. In sanitary order No. RH-084-2015 of 23 de julio del 2015, the Área Rectora de Salud de Aserrí ordered the company Parque Tecnológico to submit the following information: “1. Submit a general survey encompassing all properties currently owned by the company Berthier EBI de Costa Rica S.A. and located in the community of Huazo de Aserrí. 2. Submit certified cadastral plans (planos catastrados) for each of the properties comprising the entire estate. 3. Submit a copy of the environmental viability approval (viabilidad ambiental) issued by SETENA for each property comprising the current estate (report of the respondent authorities).
m. By sanitary order No. RH-103-2015 of 21 de septiembre del 2015, the Área Rectora de Salud ordered Parque Tecnológico Ambiental Casería (Relleno Sanitario) as follows: “1. The company must submit an updated survey detailing the project’s civil works identified in point 7. of official letter DM-MA-5724-2015. 2. Construct the treatment system for the sludge generated by the Leachate Treatment System or, alternatively, submit a technical justification demonstrating that this facility is not required. 3. Submit a schedule of activities delimiting or scheduling the periods for recirculation and discharge of wastewater according to the time of year. 4. Keep the working face small in order to reduce odors, as is currently being done (immediate deadline). 5. Do not operate or carry out construction work on the expansion of cell 3 until the construction permits have been obtained. 6. Do not carry out batch discharges without prior authorization from the Área Rectora de Salud.
If required, a maintenance and cleaning plan for the treatment system must be submitted 15 días before its implementation for review and approval by the Área Rectora de Salud (immediate deadline). 7. Direct all wastewater (sewage – leachate) to the treatment system or to its first unit (immediate deadline).” The representatives of the aforementioned company were notified of the foregoing at 15:00 hours on 2 de octubre del 2015 (report of the respondent authorities).
n. By official letter DM-MA-8649-2015 of 7 de octubre del 2015, the Deputy Minister of Health informed the Regional Director of Health Governance for Central Sur that, as part of the follow-up to the Relleno Sanitario Casería case, the Área Rectora de Salud de Aserrí had issued sanitary order No. RH-103-2015. A topographic survey (levantamiento topográfico) would not be necessary because the company’s own administrator admitted during the inspection that he had prepared an area for cell construction outside the zone authorized by the Ministerio de Salud, according to the plans. Given that officials of the Region under his authority and of the Dirección de Protección del Ambiente Humano had applied differing criteria regarding compliance with the regulations, and that some neighboring residents had questioned the company’s operation, it was decided that verification of the aforementioned administrative act (acto administrativo) would be performed by the Dirección Regional de Rectoría de la Salud Occidente (report of the respondent authorities).
o. In official letter CS-ARS-AS-918-2015 of 19 de octubre del 2015, the Director of the Área de Salud de Aserrí informed the General Manager, based on the information provided regarding completion of the work at the Parque de Tecnología Ambiental Aczarri facility, as established in the Mitigation Plan (Plan de Mitigación) submitted to that Área Rectora. In addition, the General Manager of Empresa EBI Berthier de Costa Rica was authorized to allow garbage collection trucks to enter after 8 p.m.; once the sound-level measurement (medición sónica) was performed to verify and confirm the effectiveness of the improvements, the results would be communicated to them (evidence submitted by the petitioner on 6 de noviembre del 2015).
p. In official letter DM-MA-8889-2015 of 3 de noviembre del 2015, the Deputy Minister of Health requested the support of the Dirección Central Occidente because of the complexity of the situation and because it had a professional experienced in sanitary-landfill management.
q. In official letter CO-URS-RS-753-2015 of 17 de noviembre del 2015, Engineer Méndez Castro of the Dirección Regional Central Occidente reported as follows: “(…) Preliminary Analysis: After reviewing the documentation received, I consider that, in order to coordinate verification of the administrative act (sanitary order RH-084-2015) issued against the Parque Tecnológico Aczerri sanitary landfill and to follow up on the case, an analysis of the current situation is required, given that the case has a history spanning several years of operation, after which an action plan may be prepared. The documentation received is insufficient to prepare a plan for monitoring the sanitary order issued and following up on the case; in view of the foregoing, it is considered necessary to have additional information, resources, and time to coordinate, among other matters, the transmission of a copy of the sanitary order and the decisions (official letters) on which it was based, and to request support from the local and regional levels (Región Central Sur), as well as from the Dirección de Protección al Ambiente Humano, in order to obtain the necessary information concerning follow-up on the case.
Once the situation has been analyzed, visits to the sanitary landfill will be scheduled in order to verify information on site and, where appropriate, operating requirements. II. RECOMMENDATION. Request the support required to address the case from the Área de Salud and the Regional Level involved, as well as from the Dirección de Protección al Ambiente Humano. Provide the time and resources necessary to prepare the action plan required to coordinate verification of compliance with the administrative act (sanitary order RH-084-2015) issued against the Parque Tecnología Ambiental Acserrí sanitary landfill and to follow up on the case.” (report of the respondent authorities).
r. By official letter DR-CO-3043-2015 of 5 de noviembre del 2015, the Regional Director of the Dirección Regional Rectoría de Salud Central Occidente requested that the Head of the Unidad Rectoría de Salud of the Dirección Regional Rectoría de Salud Central Occidente, in connection with official letter DM-MA-8889-2015 issued by the Deputy Minister of Health: a) schedule Engineer Méndez Castro to address the case. b) Keep him informed of the actions taken. c) Dra. Anchía sent the original, unpaginated case file and the plan showing the survey of existing infrastructure and updated fences, which were forwarded to him for review of the case (report of the respondent authorities).
s. According to a police observation report issued at 23:25 hours on 23 de noviembre del 2015 by the Delegación Policial de Desamparados, San Miguel of the Dirección Regional de San José of the Ministerio de Seguridad Pública, 7 garbage-container vehicles were observed leaving the El Huazo sanitary landfill of the Municipalidad de San José (evidence submitted by the petitioner on 25 de noviembre del 2015).
t. On 24 de noviembre del 2015, the authorities of the Dirección Regional de Rectoría de Salud Central Occidente under his authority held their first working session to learn the details of the sanitary-landfill case at Parque Tecnología Ambiental Acserrí. For this purpose, the files located at the Dirección Regional de Rectoría de la Salud Central Sur, the Área Rectora de Salud Aserrí, and the Ministerio de Ambiente y Energía had to be reviewed (report of the respondent authorities).
u. On 26 de noviembre del 2015, personnel from the Dirección Regional de Rectoría de la Salud Central Occidente visited the Dirección Regional de Rectoría de la Salud Central Sur and reviewed the file concerning the sanitary landfill in question, focusing on the relevant matters strictly related to sanitary order No. RH-103-2015 (report of the respondent authorities).
v. The Administrative Environmental Tribunal (Tribunal Ambiental Administrativo) is processing administrative case file (expediente administrativo) No. 175-07-01-TAA, in which it is awaiting an assessment of the alleged environmental damage (daño ambiental) caused to the environment. This assessment was previously requested from engineer Guzmán Ortiz, in her capacity as Director of the Directorate of Environmental Management and Quality (Dirección de Gestión y Calidad Ambiental, DIGECA), in several decisions, namely: decisions No. 1141-10-TAA del 17 de agosto del 2010, 1347-10-TAA del 20 de septiembre del 2010, 1666-10-TAA del 23 de noviembre del 2010, 415-11-TAA del 13 de 2011, No. 041-14-TAA, and 789-14-TAA del 18 de septiembre del 2014 (report of the respondent authority (autoridad recurrida)).
Article 50 of the Political Constitution establishes that all persons have the right to a healthy and ecologically balanced environment, since the protection of this right is one of the factors that guarantee the exercise of the right to health enshrined in Article 21 of the Constitution. Likewise, Article 89 of the Constitution (Carta Magna) contains the State’s duty to maintain and protect natural resources. Along the same lines, this Court, in judgment number 3705-93 at 15:00 hours del 30 de julio de 1993, stated as follows:
“...Environmental quality is one parameter of that quality of life; other no less important parameters are health, food, work, housing, education, etc. More important, however, is understanding that although human beings have the right to use the environment for their own development, they also have the duty to protect and preserve it for present and future generations. This is not particularly novel, because it is merely the application in this field of the principle of ‘injury’ (lesión), already well established in ordinary law (derecho común), under which the lawful exercise of a right has two essential limits: on the one hand, the equal rights of others and, on the other, the rational exercise and beneficial enjoyment of the right itself...”.
Accordingly, in addition to the right to a healthy environment and each person’s duty to make rational use of natural resources, the State has a duty to ensure their protection and conservation, as well as the corresponding authority to impose the applicable sanctions for failure to comply with those duties. Thus, Article 50 of the Constitution (Carta Fundamental) provides as follows:
“...Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing (legitimación) to report acts that infringe that right and to seek reparation for the damage caused.
The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding liabilities and sanctions.” It follows clearly from the foregoing that the State, through the bodies designated for that purpose, is responsible for guaranteeing all persons a healthy and balanced environment, using the mechanisms made available to it by law in order to prevent irreversible harm to the environment and public health. In addition, it must promote the measures necessary to ensure that each person enjoys the right to health, understood in all its dimensions, whether physical, mental, or social. Furthermore, the General Health Law (Ley General de Salud) authorizes the Ministry of Health to adopt general or individual measures and provisions that ensure the application of and compliance with health regulations, as well as environmental protection. The cited body of law also provides that the Ministry of Health may coordinate with other health agencies regarding the measures necessary to protect individuals’ public and personal health.
In judgment number 2011-004776 at 11:50 hours del 8 de abril del 2011, this Chamber established that a series of environmental problems had occurred at the “Parque de Tecnología Ambiental Aczarrí,” particularly biogas (biógas) leaks, surfacing, leakage, overflow, and discharge of leachate (lixiviados) and sediment into the río Guatuso, foul odors, discharge of untreated water into the stormwater system, and improper drainage of stormwater. It also established noncompliance with the authorized design and truck entry schedule, as well as the failure to cover the waste. Based on the foregoing, the operative portion (parte dispositiva) ordered:
“The petition is granted. Juan Vicente Durán Víquez, María Luisa Ávila Agüero, and Carolina Umaña Cisneros, in their respective capacities as General Manager of ‘Empresas Berthier EBI de Costa Rica Sociedad Anónima,’ Minister of Health, and Director of the Área Rectora de Salud de Aserrí, or whoever may hold those offices in their stead, are ordered to take immediately all necessary measures to remedy permanently the pollution problems occurring at the Parque de Tecnología Ambiental Aczarri. The respondents are advised that, pursuant to Article 71 of the Law on Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional), anyone who receives an order issued in an amparo proceeding (recurso de amparo) that they are required to comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years, or to a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty.
Berthier EBI de Costa Rica Sociedad Anónima and the State are ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be quantified during enforcement of the judgment before the civil and administrative litigation courts. This decision shall be personally served on Juan Vicente Durán Víquez, María Luisa Ávila Agüero, and Carolina Umaña Cisneros, in their respective capacities as General Manager of ‘Empresas Berthier EBI de Costa Rica Sociedad Anónima,’ Minister of Health, and Director of the Área Rectora de Salud de Aserrí, or whoever may hold those offices in their stead.” VI.- REGARDING NOISE POLLUTION (CONTAMINACIÓN SÓNICA). First, the petitioners allege that the Parque de Tecnología Ambiental Aczarrí, located in Aserrí, causes serious environmental pollution problems for nearby residents due to the excessive noise caused by garbage collection trucks traveling at night.
In this regard, it has been established that the Parque de Tecnología Ambiental Aczarrí, located in Aserrí, holds health operating permit (permiso sanitario de funcionamiento) number RCS-ARSA-344-2012, valid until 17 de julio del 2017, whose legal representative is Mr. Durán Víquez, and whose corporate name is Empresa Berthier EBI Costa Rica S.A., legal entity identification number 3-101-215741, for the mechanically processed treatment and disposal of household solid waste (sanitary landfill (relleno sanitario)). Furthermore, the respondent authorities reported that at 21:00 hours on 20 de mayo del 2014, personnel from the Área de Salud de Aserrí conducted a sound-level measurement (medición sónica) at the residence of Ms. Mora Pérez, located 50 meters west of the Ebais del Llano on the main access road to Parque de Tecnología Ambiental Aczarrí, where it was determined, based on the results obtained, that national law was not being violated.
It was also established that at 22:00 hours on 20 de mayo del 2014, personnel from the Área Rectora de Salud de Aserrí conducted a sound-level measurement at the home of Mr. Guzmán Ureña, which yielded the following results: ambient noise plus generating source, 51,1 dB, and ambient noise alone, 47,7 dB, exceeding the parameters prescribed by the Reglamento para el Control de Contaminación por Ruido, Decreto No. 28718-S. Based on the foregoing, the Área Rectora de Salud issued health order (orden sanitaria) No. RH-065-14 of 10 de junio del 2014, in which it determined that there was already a noise mitigation plan (plan de mitigación de ruido) submitted by the company in 2012; nevertheless, based on the results of the sound-level measurement cited above, it ordered the company to immediately suspend the entry of garbage collection trucks into the sanitary landfill until it submitted a Noise Mitigation Plan (Plan de Mitigación de Ruido).
It was further established that the Área Rectora de Salud de Aserrí issued health order No. RH-009-2015 of 10 de febrero del 2015, which determined, insofar as relevant: “1. Two site visits were conducted to follow up on the reported noise caused by garbage collection trucks entering and leaving Parque de Tecnología Ambiental Aczarrí, one on 6 de octubre and the other on 20 de noviembre del 2014. Both were conducted at the residence of Mr. Germán Segura Ureña, located 75 meters from the entrance to the sanitary landfill. In addition, Lic. Rafael Ángel Vega Alfaro from the Dirección Regional de Rectoría de Salud Centra participated on the first occasion, and Msc. Ana Lucrecia Hernández on the second; Ing. Eugenio Androvetto Villalobos, Director de Protección al Ambiente Humanos, participated on both occasions, and Mr. Segura Ureña was present. 1. The measurement results show that, when vehicles passed, emissions exceeded the limits established in Decreto No. 28718-S Reglamento para el Control de Contaminación por Ruido for residential areas during nighttime hours, 45 (dB).” Based on the foregoing, the Área Rectora in question ordered the company Parque Tecnológico Ambiental Aczerri (Relleno Sanitario) as follows: “1.
In view of the results of the sound-level measurements, which reflect the problems caused by the operation of the sanitary landfill at night, its hours of operation are limited to 10 p.m.” Moreover, item 1 of that order was amended to limit the hours of operation to 20 hours through official letter (oficio) No. CS-ARS-AS-195-2015, issued at 11:30 on 12 de febrero del 2015. The foregoing was served at 14:27 hours on 12 de febrero del 2015 on the legal representative of Berthier EBI de Costa Rica. Subsequently, in official letter CS-ARS-AS-918-2015 of 19 de octubre del 2015, the Director of the Área de Salud de Aserrí informed the General Manager of Berthier EBI, in response to the information provided regarding completion of the work at the Parque de Tecnología Ambiental Aczarri facility, that the work had been completed as established in the Mitigation Plan submitted to this Área Rectora.
The General Manager of Empresa EBI Berthier de Costa Rica was also authorized to allow garbage collection trucks to enter after 8 p.m.; once the sound-level measurement was conducted to verify and confirm the effectiveness of the improvements, the results would be communicated to the company. Notwithstanding the foregoing, the evidence in the record (autos) in this case shows that, to date, the authorities of the Área Rectora de Salud de Aserrí have not conducted the measurements necessary to determine whether, following the work performed at the sanitary landfill as set forth in the Mitigation Plan submitted by the company in question, garbage collection trucks traveling at night—after 8 p.m.—comply with the parameters prescribed by the Reglamento para el Control de Contaminación por Ruido, Decreto No. 28718-S. The evidence in the record further establishes that the inspections through which the noise pollution problem was confirmed were conducted after this constitutional relief petition (recurso) was filed, and the evidence in the record does not establish that the problems for which the two health orders, No. RH-065-14 and No. RH-009-2015, were issued have been definitively resolved, despite the time elapsed.
This demonstrates permissive conduct by the authorities of the Ministerio de Salud in overseeing compliance to ensure that garbage collection trucks traveling at night do not exceed the levels established by the applicable legislation, which clearly constitutes a violation of Articles 21 and 50 of the Constitución Política. Accordingly, the petition must be granted with respect to this claim, as is hereby ordered.
Furthermore, the appellants allege that the Parque de Tecnología Ambiental Aczarrí, located in Aserrí, causes serious environmental pollution problems due to strong biogas (biogás) odors at night because the waste is not covered, as well as the large amount of dust generated by earthworks (remoción de tierra). In this regard, it has been established that on 16 de enero del 2014 personnel from the Área Rectora de Salud inspected the facilities of the Parque de Tecnología Ambiental Aczarrí, located in Aserrí, and confirmed that the passive biogas extraction and flaring system was operating; moreover, no waste from the previous day was observed without the corresponding cover material. In addition, no foul odors were detected, and the dimensions of the cell’s working face were adequate, thereby ensuring proper compaction of the waste. They state that, as its principal dust-mitigation measure, the project’s Administration irrigates the principal roads within the landfill (relleno) and the main roads around it using tanker trucks, as well as sprinkler irrigation of slopes (taludes).
The project has a network for channeling and conveying leachate (lixiviados) to a treatment system located at the northwestern end. That system consists of 3 units (demisting chamber + aeration chamber + sedimentation chamber) which, through aeration systems, remove contaminants from the leachate and reduce its organic load so that it may be discharged into the Guatuso River in compliance with the discharge parameters established by the regulations in force. Furthermore, proper operation, the absence of foul odors, and a dark-brown color of the leachate in the aeration tank were confirmed, the latter indicating favorable aeration conditions; the in situ parameters for dissolved oxygen and pH were measured in the aeration tank, yielding favorable results of pH 8,43 (it must be between 5 and 9) and dissolved oxygen of 5,67 (it must not be below 2). Notwithstanding the foregoing, and in view of the existence of new evidence, the Área Rectora de Salud de Aserrí issued health order No. RH-009-2015 of 10 de febrero del 2015, stating as follows: “1.
Two visits were made to the site to follow up on the complaint regarding noise caused by the entry and departure of waste-collection trucks at the Parque de Tecnología Ambiental Aczarrí, one on 6 de octubre and another on 20 de noviembre del 2014. Both were conducted at the residence of Mr. Germán Segura Ureña, located 75 meters from the entrance to the sanitary landfill (relleno sanitario). In addition, Lic. Rafael Ángel Vega Alfaro of the Dirección Regional de Rectoría de Salud Centra participated on the first occasion, and Msc. Ana Lucrecia Hernández on the second; on both occasions, Ing. Eugenio Androvetto Villalobos, Director de Protección al Ambiente Humanos, and Mr. Segura Ureña were present. 1. The measurements taken as vehicles passed show that the noise emission exceeds the limits established in Decreto No. 28718-S Reglamento para el Control de Contaminación por Ruido for residential areas during nighttime hours, 45 (dB). 2.
The current condition observed at the site, as well as that shown in the information submitted by SETENA, differs from the original construction project presented to this Ministerio in 2006, which was planned for cadastral property SJ-249003-95. 3. The original sanitary-landfill project approved in 2006, whose construction plans are located in the offices adjacent to the treatment plant, shows three monitoring wells on the site plan for the waste-disposal cells; however, the location detailed in the plans does not coincide with the location identified at the site, and the location of the third well is unclear, as only two wells for this purpose are identified within the facility. It is unknown whether, after this proposal, an updated project supporting the current condition and identifying the location of that alternative was processed before the competent authorities. 4. At the time of the inspection visit, the working face appeared to be quite extensive. 5.
The technical design criteria used to define the location, number, and distribution of the environmental-deodorant sprinklers, as well as the type of liquid to be used, are unknown, raising the concern that the solution may be insufficient and that, because the operation is manual, it depends on the decision of the person on duty rather than on sensors that provide an alert when odors capable of disturbing neighboring residents are produced.” Based on the foregoing, the Área Rectora in question ordered the company Parque Tecnológico Ambiental Aczerri (Relleno Sanitario) to do the following: “1. Given the results of the sound measurements, which reflect the problems caused by operation of the sanitary landfill at night, operating hours shall be limited to 10 at night. 2. Submit a detailed site plan identifying the boundaries and the consolidation of the various identified cadastral properties that make up the property on which the sanitary-landfill project is being developed; the various components of the activity must be shown on that plan (Time limit: 1 month). 3.
Define the recirculation and discharge periods during the year. Accordingly, discharge into the receiving water body must continue throughout the rainy season (Immediate time limit, consistent with the rainy season). 4. Prepare and submit to the Ministerio de Salud a project for construction of a system to treat sludge from the leachate-treatment system, as well as the intended uses of the biosolids (Time limit: one month to submit the project, including the implementation schedule). 5. Submit to the Ministerio de Salud authorization from the administration of the ASADA well and the corresponding technical documentation demonstrating that this well, as well as the other two monitoring wells existing within the sanitary landfill, are representative for monitoring the groundwater at this sanitary facility. 6. The working face must be reduced to facilitate management and odor control, especially during the rainy season (immediate time limit). 7.
Submit a protocol indicating how the possible actions to be taken will be determined in response to events that could result in the release of unpleasant odors affecting neighboring residents.” In the event of noncompliance, the company was warned that the Ministerio could close the establishment in accordance with Articles 355, 356, 357 and 363 of the Ley General de Salud and pursue the corresponding criminal actions, including reporting it for disobedience of authority pursuant to Article 314 of the Código Penal. In official letter No. DPAH-D-518-2015 of 18 de mayo del 2015, the Director de Protección al Ambiente Humano of the Ministerio de Salud requested that Dr. Guillermo Flores Galindo, Director Regional de Rectoría de Salud de la Región Central Sur, use his good offices to ensure that the Área Rectora followed up on items 2,3,4,5,6 and 7 of that order, because the established deadlines had expired, as the order had been issued on 10 de febrero del 2015.
Subsequently, in official letter DM-MA-5724-2015 of 18 de junio del 2015, signed by the Viceministro de Salud, the Jefe de la Unidad de Administración de Servicios de Salud en Ambiente Humanos, and the Director de Protección al Ambiente Humano, the Ministro de Salud was informed of the results of an inspection they conducted at the El Huaso Aczerrí sanitary landfill in the company of officials from the Área Rectora de Salud de Aserrí and the Dirección Región Central Sur, which concluded as follows: 1. The company must submit an updated survey detailing the project’s civil works referred to in item 7. 2. Construct the treatment system for the sludge generated by the Sistema de Tratamiento Lixiviados or, alternatively, submit a technical justification demonstrating that this facility is not required. 3. Submit a schedule of activities defining or calendaring the episodes of wastewater recirculation and discharge according to the season of the year. 4.
Keep the working face reduced in order to lessen odors, as is currently being done. 5. Do not operate or perform construction work on the expansion of cell 3 until the construction permits have been obtained. 6. Do not make batch-type discharges without prior authorization from the Área Rectora de Salud. A maintenance and cleaning plan for the treatment system, if required, must be submitted 15 days before its implementation for review and approval by the Área Rectora de Salud. 7. Convey all wastewater (sewage–leachate) to the treatment system or to its first unit. 8. The Área Rectora de Salud must conduct a fluorescein test when effluent is present in the wastewater-treatment system to verify which pipe conveys it to the receiving water body. If there is any doubt, the stormwater-sewer networks must be dyed with a solution of red 40 mixed with fluorescein to verify that they convey only rainwater.
These tests must be conducted at different times; that is, they must not be performed simultaneously. 9. The Área Rectora de Salud must conduct periodic visits in coordination with the Nivel Regional or Nivel Central to follow up on the requested measures. Based on the foregoing, health order No. RH-084-2015 of 23 de julio del 2015 was issued, by which the Área Rectora de Salud de Aserrí ordered the company Parque Tecnológico to submit the following information: “1. Submit a general survey that includes all properties currently owned by the company Berthier EBI de Costa Rica S.A. and located in the community of Huazo de Aserrí. 2. Submit certified cadastral plans for each of the properties comprising the entire property. 3. Submit a copy of the environmental approval (viabilidad ambiental) issued by SETENA for each property comprising the current property.” The foregoing was served on the company’s General Manager on 23 de julio del 2015.
Furthermore, the evidence in the record establishes that, through health order No. RH-103-2015 of 21 de septiembre del 2015, the Área Rectora de Salud ordered Parque Tecnológico Ambiental Casería (Relleno Sanitario) to do the following: “1. The company must submit an updated survey detailing the project’s civil works referred to in item 7. of official letter DM-MA-5724-2015. 2. Construct the treatment system for the sludge generated by the Sistema de Tratamiento Lixiviados or, alternatively, submit a technical justification demonstrating that this facility is not required. 3. Submit a schedule of activities defining or calendaring the episodes of wastewater recirculation and discharge according to the season of the year. 4. Keep the working face reduced in order to lessen odors, as is currently being done (immediate time limit). 5. Do not operate or perform construction work on the expansion of cell 3 until the construction permits have been obtained. 6. Do not make batch-type discharges without prior authorization from the Área Rectora de Salud.
They must submit a maintenance and cleaning plan for the treatment system (sistema de tratamiento), if required, 15 days prior to its implementation, for review and approval by the Área Rectora de Salud (immediate deadline). 7. Direct all wastewater (aguas residuales) (sewage–leachate) to the treatment system or to its first unit (immediate deadline).” The foregoing was served on the representatives of the respondent company at 15:00 hours on 2 de octubre del 2015. In official letter DM-MA-8889-2015 of 3 de noviembre del 2015, the Vice Minister of Health requested assistance from the Dirección Central Occidente because of the complexity of the situation and because it had a professional experienced in sanitary landfill management. Furthermore, it is established that on 24 de noviembre del 2015, the authorities of the Dirección Regional de Rectoría de Salud Central Occidente under her authority held their first working session to learn the details of the sanitary landfill case at Parque Tecnología Ambiental Acserrí.
It should also be noted that, in the report submitted to the Office of the Clerk of this Chamber on 30 de noviembre del 2015, the Director of the Dirección Regional de Rectoría de Salud Central Occidente stated that the administrative record (expediente administrativo) contains no follow-up report by the health authorities of the Área Rectora de Salud de Aserrí concerning sanitary order (orden sanitaria) No. No. RH-103-2015. This is justified by the fact that the Vice Minister of Health instructed that such administrative action be carried out by the health authorities under the Dirección Regional de Rectoría de la Salud Central Occidente. Accordingly, this case shows that sanitary orders No. RH-009-2015 of 10 de febrero del 2015, No. RH-084-2015 of 23 de julio del 2015, and No. RH-103-2015 of 21 de septiembre del 2015 have not been duly complied with in their entirety by the authorities of the Ministerio de Salud and the company Empresa Berthier EBI Costa Rica S.A. Therefore, as to those matters, the petition must be granted due to the violation of Articles 21 and 50 of the Constitución Política, with the consequences set forth in the operative portion (parte dispositiva).
In the report submitted under oath, the authorities of the respondent Municipal Corporation stated that the matters complained of arise from the functioning and operation of the landfill in question, aspects over which the entity they represent has no authority; rather, by their nature, they fall within the jurisdiction of the company operating the landfill, SETENA, the Tribunal Ambiental Administrativo, and the Ministerio de Salud. Furthermore, it is ruled out in the present case that the protected parties (amparados) filed any complaint with the Municipal Corporation that the latter failed to process; accordingly, as regards that authority, this constitutional protection action (recurso de amparo) must be dismissed, as is hereby ordered. Notwithstanding the foregoing, it is established that, in official letter DM-MA-8649-2015 dated 7 de octubre del 2015, the Viceministra de Salud informed the Director Regional de Rectoría de Salud Central Sur that, as part of the follow-up to the Relleno Sanitario Casería case, the Área Rectora de Salud de Aserrí issued health order (orden sanitaria) No. RH-103-2015.
Regarding the topographic survey (levantamiento topográfico), it will not be necessary because the company’s own administrator admitted during the inspection that he had prepared a cell-construction area outside the zone authorized by the Ministerio de Salud, according to the plans. Based on the foregoing, the Mayor of the respondent Municipalidad shall take note and conduct an inspection to verify whether construction requiring any municipal approval (visado municipal) has been carried out at the Parque Tecnológico Ambiental Aczerri (Relleno Sanitario) and, if no such approval exists, shall proceed in accordance with the powers conferred upon him by our legal system.
Moreover, if the petitioners (recurrentes) believe that the Tribunal Ambiental Administrativo has not diligently conducted the proceedings under administrative case file (expediente administrativo) No. 175-07-01-TAA, they must file a motion alleging noncompliance (solicitud de desobediencia) within the constitutional protection action processed under case number 08-014247-0007-CO, in which judgment number 2010-014754 was issued at quince horas y treinta y nueve minutos del treinta y uno de agosto del dos mil diez. Notwithstanding the foregoing, this Chamber is deeply concerned by the unjustified delay incurred by the Tribunal Ambiental Administrativo in issuing the final decision (acto final) in case file No. 175-07-01-TAA, which constitutes an unjustified delay. As to the protected parties’ claim that the Secretaría Técnica Nacional Ambiental and the Ministerio del Ambiente y Energía have not issued a determination regarding the deficiencies of the landfill under discussion, that is a question of legality that must be determined in the proceedings pending before the Tribunal Ambiental Administrativo; accordingly, the action must be dismissed as to those matters, as is hereby ordered.
X.Lastly, the authorities of the Defensoría de los Habitantes shall take note that, because this situation affects the residents of a community and a series of decisions have previously been issued concerning it, particularly the final report containing recommendations issued in official letter No. 01190-2012-DRH dated 31 de enero del 2012, they must supervise compliance with the orders contained in the operative part (parte dispositiva) of this judgment and shall keep this Chamber informed thereof.
The undersigned Justice clarifies that, although he refers environmental matters involving administrative intervention of any kind to the contentious-administrative jurisdiction (jurisdicción contencioso administrativa), he will not do so where the complaints allege pollution caused by noise, dust, and foul odors purportedly resulting from the operation of a landfill that, in turn, affects the occupants of several nearby homes. This is because other rights of the residents living near the source of pollution are at stake, such as health and the right to enjoy a dignified quality of life.
I have agreed with the position taken by Justice Jinesta Lobo in this area; accordingly, in environmental matters, it is also the undersigned’s view that, if the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the contentious-administrative courts. Nevertheless, I do examine the merits of the matter when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy, pollution-free environment (artículo 50, de la Constitución Política), as occurs in this case, in which complaints have been made regarding pollution problems arising from the operation of the Aserrí landfill, due to the excessive noise caused by collection trucks, strong biogas odors during the night because the refuse is not covered, and the large amount of dust generated by earth removal (remoción de tierra), which affects the health of the petitioner and the other local residents, in violation of the right to enjoy a healthy and ecologically balanced environment and a dignified quality of life.
In constitutional protection actions concerning environmental harm, I adhere to the general position that this Chamber should refrain from hearing claims submitted to it alleging violations of artículo 50 de la Constitución Política, leaving their consideration to administrative justice and the contentious-administrative jurisdiction. However, I have also noted that my position does not preclude recognizing the existence of particular cases or categories of cases that, in my view, would still receive better protection from this Chamber and should therefore be heard and decided by it.- Among those categories of cases, without this enumeration being deemed a closed and definitive list, I would point out that the Chamber should retain jurisdiction over situations such as claims involving environmental violations that also directly endanger human health or access to or the quality of water; and cases involving egregious and direct violations of the environment in which there is a manifest absence of protection by state authorities, provided that the nature of the claim allows it to be addressed through the constitutional protection action as a summary and special procedural mechanism, because I also believe that the action should not be converted into an ordinary proceeding to address, even in the cited cases, matters exceeding its capacity to deal with them adequately.
In this specific case, it is apparent that the situation presented falls within those exceptional cases because it concerns the operation of a large landfill, which unquestionably affects human health. Nevertheless, the magnitude of the problem, the number of institutions involved, and the difficulty of carrying out the required work mean that a constitutional protection action is not the proper avenue for adequately assessing the alleged failings and—most importantly—the remedial measures that may be applicable.- Accordingly, I dismiss the action on the ground that the case can be better addressed by the administrative and judicial bodies possessing broad jurisdiction and more comprehensive procedures in this area.
Por tanto:
The action is GRANTED IN PART. Carolina Umaña Cisneros, in her capacity as Directora del Área Rectora de Salud de Aserrí; Eugenio Androvetto Villalobos, Director de la Dirección de Protección al Ambiente Humanos; Marvin Quesada Elizondo, in his capacity as Director Regional de la Dirección Regional de la Rectoría Central Occidente; Ronny Stanley Muñoz Salazar, in his capacity as Director de Asuntos Jurídicos del Ministerio de Salud; Juan Vicente Durán Víquez, in his capacity as Gerente General of Berthier EBI de Costa Rica S.A.; or whoever may hold those offices in their stead, are ordered, within a maximum period of TRES MESES from service of this judgment, to act in coordination to adopt the measures required within their respective areas of authority to ensure full compliance with health orders No. RH-065-14, No. RH-084-2015, and No. RH-009-2015 and definitively resolve the problems identified therein at the Parque de Tecnología Ambiental Aczarrí.
They shall report to this Chamber on the progress made during and before the expiration of the period granted in the operative part. The respondents are warned that failure to comply with the foregoing order will constitute the offense of disobedience and that, pursuant to artículo 71 de la Ley de esta jurisdicción, any person who receives an order issued in a constitutional protection action that he or she must comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. The State and Berthier EBI de Costa Rica S.A. are ordered to pay the costs, damages, and losses caused by the facts forming the basis of this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative courts and in civil proceedings, respectively.
As regards the Municipalidad de Desamparados and the Tribunal Ambiental Administrativo, the action is dismissed. Furthermore, Rafael Garro Fallas, in his capacity as Mayor of the Municipalidad de Desamparados, or whoever may hold that office in his stead, shall take note of the provisions of Considerando VIII of this judgment. The President of the Tribunal Ambiental Administrativo shall take note of the provisions of Considerando IX of the judgment. The Defensora de los Habitantes shall also take note of the order set forth in Considerando X of the judgment so that she may supervise full compliance with the orders contained herein and shall keep this Chamber informed thereof. This decision shall be served on Carolina Umaña Cisneros, in her capacity as Directora del Área Rectora de Salud de Aserrí; Eugenio Androvetto Villalobos, Director de la Dirección de Protección al Ambiente Humanos; Marvin Quesada Elizondo, in his capacity as Director Regional de la Dirección Regional de la Rectoría Central Occidente; Ronny Stanley Muñoz Salazar, in his capacity as Director de Asuntos Jurídicos del Ministerio de Salud; Juan Vicente Durán Víquez, in his capacity as Gerente General of Berthier EBI de Costa Rica S.A.; or whoever may hold those offices in their stead. Recurso de amparo número 14-000128-0007-CO, interpuesto por ALEJANDRO PADILLA MORA, cédula de identidad 0107580753, SONIA MORA PÉREZ, cédula de identidad 0106900728, y SONIA QUESADA MORALES, cédula de identidad 0105970985, contra la VICEMINISTRA DE AMBIENTE Y ENERGÍA, el SECRETARIO GENERAL DE LA SECRETARÍA TÉCNICA NACIONAL AMBIENTAL, el PRESIDENTE DEL TRIBUNAL AMBIENTAL ADMINISTRATIVO, el ALCALDE y el PRESIDENTE DEL CONCEJO MUNICIPAL, AMBOS DE LA MUNICIPALIDAD DE ASERRÍ, el ALCALDE y el PRESIDENTE DEL CONCEJO MUNICIPAL, AMBOS DE LA MUNICIPALIDAD DE DESAMPARADOS, el DIRECTOR REGIONAL CENTRAL SUR, el DIRECTOR DEL ÁREA RECTORA DE SALUD DE DESAMPARADOS, y el DIRECTOR DEL ÁREA RECTORA DE SALUD DE ASERRÍ, TODOS DEL MINISTERIO DE SALUD.
Resultando:
. Que están a la espera de que se realice una nueva inspección para que se determine si se logró reducir el 1.1 dB. Que el horario que se tiene actualmente es que se indicó en la Declaración Jurada de Compromisos Ambientales. Que no han vulnerado los derechos constitucionales de los recurrentes. Solicita que se declare sin lugar el recurso.
20. Por escrito recibido en la Secretaría de esta Sala el 2 de noviembre del 2015, el Ministro de Salud cumple con lo ordenado por ésta Sala en la resolución de las 15:11 horas del 23 de octubre del 2015. Además refiere las diversas acciones realizadas por el Área Rectora de Salud de Aserrí en relación al cumplimiento de las recomendaciones contenidas en el oficio DM-MA-5724-15 y sobre los supuestos problemas de contaminación sónica provocada por el ingreso de camiones en horas de la noche en el relleno sanitario del Huazo de Aserrí. En oficio DM-MA-5724-2015 del 18 de junio del 2015 suscrito por la Viceministro de Salud, el Jefe de la Unidad de Administración de Servicios de Salud en Ambiente Humanos y el Director de Protección al Ambiente Humano comunicaron al Ministro de Salud los resultados de una inspección que realizaron en el relleno sanitario El Huaso Aczerrí en compañía de funcionados del Área Rectora de Salud de Aserrí y de la Dirección Región Central Sur en la que se concluyó: 1.
La empresa debe presentar un levantamiento actualizado del detalle de las obras civiles del proyecto señaladas en el punto 7. 2. Construir el sistema de tratamiento para los lodos que genere el Sistema de Tratamiento Lixiviados o caso contrario presentar justificación técnica que demuestre que no necesita contar con esta obra. 3. Presentar cronograma de actividades donde delimite o calendarice los episodios de recirculación y vertido de aguas residuales acorde a la época del año. 4. Mantener el frente de trabajo reducido a fin de disminuir los olores tal y como se realiza actualmente. 5. No operar ni realizar las obras constructivas en la ampliación de la celda 3 hasta contar con los permisos constructivos. 6. No realizar las descargas tipo batch sin previa autorización del Área Rectora de Salud. Deben presentar un plan de mantenimiento y limpieza del sistema de tratamiento en caso de requerirlo, 15 días antes de su ejecución para revisión y aprobación del Área Rectora de Salud. 7.
Enviar todas las aguas residuales (servidas – lixiviados) al sistema de tratamiento, o a la primera unidad del mismo. 8. Realizar por parte del Área Rectora de Salud una prueba de fluoresceína cuando exista efluente en el sistema de tratamiento de aguas residuales, para corroborar cual es la tubería que las conduce al cuerpo receptor. En caso de duda hacer coloración con una solución de rojo 40 mezclado con fluoresceína a las redes de alcantarillado pluvial para verificar que únicamente conduce aguas de lluvia. Estas determinaciones deben realizarse en diferentes momentos, es decir, no deben hacerse al mismo tiempo. 9. Mantener por parte del Área Rectora de Salud visitas periódicas en coordinación con el Nivel Regional o Nivel Central para el seguimiento de lo solicitado. Por orden sanitaria No. RH-103-2015 del 21 de septiembre del 2015, el Área Rectora de Salud ordenó al Parque Tecnológico Ambiental Casería (Relleno Sanitario) que: “1. La empresa debe presentar un levantamiento actualizado del detalle de las obras civiles del proyecto señaladas en el punto 7. del oficio DM-MA-5724-2015.
2. Construir el sistema de tratamiento para los lodos que genere el Sistema de Tratamiento Lixiviados o caso contrario presentar justificación técnica que demuestre que no necesita contar con esta obra. 3. Presentar cronograma de actividades donde delimite o calendarice los episodios de recirculación y vertido de aguas residuales acorde a la época del año. 4. Mantener el frente de trabajo reducido a fin de disminuir los olores tal y como se realiza actualmente (plazo inmediato). 5. No operar ni realizar las obras constructivas en la ampliación de la celda 3 hasta contar con los permisos constructivos. 6. No realizar las descargas tipo batch sin previa autorización del Área Rectora de Salud. Deben presentar un plan de mantenimiento y limpieza del sistema de tratamiento en caso de requerirlo, 15 días antes de su ejecución para revisión y aprobación del Área Rectora de Salud (plazo inmediato). 7. Enviar todas las aguas residuales (servidas – lixiviados) al sistema de tratamiento, o a la primera unidad del mismo (plazo inmediato).
Redacta el Magistrado Cruz Castro; y,
Considerando:
Por su excepcional naturaleza, el trámite ordinario de los recursos de amparo contra sujetos de derecho privado exige comenzar por examinar si, en la especie, estamos o no ante alguno de los supuestos que lo hacen admisible, para -posteriormente y en caso afirmativo-, dilucidar si es estimable o no. En ese particular, la Ley de la Jurisdicción Constitucional, en su artículo 57, estipula bajo qué supuestos es admisible el amparo contra las acciones u omisiones de sujetos de derecho privado, es decir, cuando éstos actúen o deban actuar en ejercicio de funciones o potestades públicas, o, se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2°, inciso a), de la misma Ley. En el caso concreto, es claro el cumplimiento de esos presupuestos, pues se trata de sujeto de derecho privado que brinda un servicio público, al estar en posibilidad de quebrantar lo dispuesto en los artículos 21 y 50 de la Constitución Política, siendo inexistentes los remedios jurisdiccionales comunes para su tutela, razón por la cual se debe analizar el fondo del amparo.
Los recurrentes acusan que el Parque de Tecnología Ambiental Aczarrí ubicado en Aserrí ocasiona graves problemas de contaminación ambiental, por el exceso de ruido que ocasionan los camiones recolectores, además de los fuertes olores a biogás durante la noche, debido a que la basura no es tapada, además, de la gran cantidad de polvo generada por la remoción de tierra, aspectos que afectan la salud de los vecinos de la zona, lo cual vulnera lo dispuesto en los artículos 21 y 50 de la Constitución Política. Por otra parte, acusan que el Tribunal Ambiental Administrativo, la Secretaría Técnica Nacional Ambiental, y el Ministerio del Ambiente y Energía no se han pronunciado sobre las deficiencias del relleno sanitario en discusión.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
a. El Parque de Tecnología Ambiental Aczarrí ubicado en Aserrí cuenta con permiso sanitario de funcionamiento número RCS-ARSA-344-2012 vigente hasta el 17 de julio del 2017 cuyo representante legal es el señor Durán Víquez, razón social la Empresa Berthier EBI Costa Rica S.A. cédula jurídica 3-101-215741, para la actividad de tratamiento y disposición de desechos sólidos domésticos mediante proceso mecanizado (relleno sanitario). (informen rendido por la Directora del Área Rectora de Salud de Aserrí).
b. Por resolución No. 1573-2013-SETENA de 19 de junio de 2013 , la Secretaría Técnica Ambiental otorgó la viabilidad ambiental al proyecto en cuestión dentro del expediente D1-8869-2012-SETENA. Lo anterior, en razón de la conclusión en la tramitación del expediente No. 1322-2011 (informe de la autoridad recurrida).
c. El proyecto 8869-2012, según fue informado por el Departamento de Auditoría y Seguimiento Ambiental de SETENA, ha cumplido con los procedimientos respectivos hasta las etapas en que se encuentren y no se han identificado incumplimientos (informe de las autoridades recurridas).
d. En fecha 16 de enero del 2014 personeros del Área Rectora de Salud realizaron una inspección en las instalaciones del Parque de Tecnología Ambiental Aczarrí ubicado en Aserrí en donde se constató que el sistema de extracción y quema pasiva del biogás se encuentra funcionado, además no se observaron residuos del día anterior sin el correspondiente material de cobertura. Además, no se detectaron malos olores y las dimensiones del frente de la celda son adecuadas con lo que se garantiza una adecuada compactación de los residuos. Señalan que la Administración del proyecto como medida principal de mitigación del polvo implementa la irrigación de los caminos principales dentro de relleno y de las principales vías alrededor del mismo por medio de camiones cisternas y el riego por aspersión de taludes. El proyecto cuenta con una red para la canalización y conducción de lixiviados hasta una sistema de tratamiento que se encuentra ubicado en el extremo noroeste.
Dicho sistema se compone de 3 unidades (cámara de desmitificación + cámara de aireación + cámara de sedimentación) que mediante sistemas de aireación logra remover los contaminantes en el lixiviado y reducir la carga orgánica para ser vertido en el río Guatuso cumpliendo con los parámetros de vertidos estipulados en la normativa vigente. Por otra parte, se constató una operación adecuada, ausencia de malos olores, color del lixiviado en el tanque de aireación café oscuro, el cual representa condiciones favorables de aireación y se midieron los parámetros in situ de oxígeno disuelto y pH en el tanque de aireación, encontrándose resultados favorables de pH 8,43 (debe estar entre 5 y 9) y oxígeno disuelto 5,67 (no debe estar por debajo de 2). (informe de las autoridades recurridas).
e. Que a las 21:00 horas del 20 de mayo del 2014, personeros del Área de Salud de Aserrí realizaron una medición sónica en la vivienda de la señora Mora Pérez, la cual se ubica a 50 metros al oeste del Ebais del Llano, sobre la calle de acceso principal al Parque de Tecnología Ambiental Aczarrí donde se determinó con base en los resultados obtenidos que no se vulneraba la legislación nacional (informe de las autoridades recurridas).
f. Que a las 22:00 horas del 20 de mayo del 2014, personeros del Área Rectora de Salud de Aserrí realizaron una medición sónica en la casa del señor Guzmán Ureña en la cual se determinó: ruido ambiente más fuente generadora 51,1 dB y solo ruido ambiente 47,7 dB, superando los parámetros que dicta el Reglamento para el Control de Contaminación por Ruido, Decreto No. 28718-S (informe de las autoridades recurridas).
g. Por orden sanitaria No. RH-065-14 del 10 de junio del 2014, el Área Rectora de Salud de Aserrí determinó que ya existen antecedentes de un plan de mitigación de ruido por parte de la empresa entregado en el año 2012, sin embargo, le ordenó con fundamento en los resultados de la medición sónica supra citada que forma inmediata suspendiera el ingreso de camiones recolectores de basura al relleno sanitario hasta tanto no presente un Plan de Mitigación de Ruido (informe de las autoridades recurridas).
h. En orden sanitaria No. RH-009-2015 del 10 de febrero del 2015, el Área Rectora de Salud de Aserrí indicó que lo siguiente: “1. Se realizaron dos visitas al lugar con el fin de darle seguimiento a denunciado por ruido originado por le entrada y salida de camiones recolectores de residuos al Parque de Tecnología Ambiental Aczarrí, una el 6 de octubre y otra el 20 de noviembre del 2014, las mismas se realizaron en la vivienda del señor Germán Segura Ureña, ubicada a 75 metros de la entrada del relleno sanitario. Por otra parte, de la Dirección Regional de Rectoría de Salud Centra participó en la primera ocasión el Lic. Rafael Ángel Vega Alfaro, y en la segunda oportunidad Msc. Ana Lucrecia Hernández y en ambas ocasiones el Ing. Eugenio Androvetto Villalobos, Director de Protección al Ambiente Humanos y estuvo presente el Sr. Segura Ureña. 1. El resultado de las mediciones en el momento de paso de vehículos la emisión sobrepasa los límites establecidos en el Decreto No. 28718-S Reglamento para el Control de Contaminación por Ruido para zona de residencia en horas nocturnas 45 (dB). 2.
La condición actual apreciada en el sitio como la observada en la información remitida por la SETENA, varía con respecto al proyecto constructivo original presentado ante este Ministerio, en el año 2006, que se dispuso sobre la finca catastral SJ-249003-95. 3. En el proyecto original del relleno sanitario visado en el año 2006, cuyos planos constructivos se encuentran en las oficinas contiguo a la planta de tratamiento, se observa en planta de sitio de celdas de disposición de residuos, tres pozos de monitoreo, no obstante, la localización de lo detallado en los planos no coincide con la ubicación que se determina en el sitio y no queda claro el tercer pozo solamente se identifica dos para este propósito a lo interno de la actividad. Se desconoce si posterior a esta propuesta se tramitó ante las entidades competentes una actualización del proyecto que respalda la condición actual y donde se determine la ubicación de esa alternativa. 4.
En el momento de la visita de inspección se percibió que el frente de trabajo era bastante amplio. 5. Se desconoce el criterio técnico de diseño para definir la ubicación, cantidad y distribución de los rocladores de desodorante ambiental, así como la clase de líquido a utilizar, pues queda la inquietud si la solución es suficiente y al ser la actividad manual depende de la decisión de la persona de turno y no a sensores que alerten que se producen olores que puedan causar molestias a los vecinos. Con fundamento en lo anterior, el Área Rectora en cuestión ordenó a la empresa Parque Tecnológico Ambiental Aczerri (Relleno Sanitario) lo siguiente: 1. Dado los resultados de las mediciones sónicas que reflejan la problemática generada por la operación del relleno sanitario en horas de la noche, el horario de operación se limita a las 10 de la noche. 2. Presentar un detalle de planta de sitio donde se puedan determinar los linderos como la unificación de las distintas fincas catastrales identificadas que conforman la propiedad donde se desarrolla el proyecto de relleno sanitario, se debe considerar los distintos componentes de la actividad sobre dicho detalle (Plazo de 1 mes). 3.
Delimitar en el año los períodos de recirculación y el período de vertido. Por lo cual se debe mantener el vertido durante todo el período de lluvias al cuerpo receptor (Plazo inmediato acorde con la época de lluvias). 4. Elaborar y presentar al Ministerio de Salud un proyecto para la construcción del sistema de tratamiento de los lodos provenientes del sistema de tratamientos de lixividados, así como los usos que se darán a los biosólidos (Plazo un mes para presentar el proyecto que incluya el cronograma de ejecución). 5. Presentar al Ministerio de Salud autorización de la administración del pozo de la ASADA y la documentación técnica respectiva, donde se justifique que este como los otros dos pozos de monitoreo existentes a lo interno del relleno sanitario, son representativos para el control de las aguas subterráneas de esta obra sanitaria. 6. El frente de trabajo debe ser reducido para facilidad de manejo y control de olores, especialmente durante el período de época de lluvias (plazo inmediato). 7.
Presentar un protocolo que indique como se determinarán las posibles acciones a seguir para la atención de eventos que puedan repercutir en la liberación de olores, desagradables que afecten a los vecinos. En caso de incumplimiento se le previene que el Ministerio podrá clausurar el establecimiento de acuerdo a lo dispuesto en los artículos 355, 356, 357 y 363 de la Ley General de Salud y dictar las acciones penales correspondiente como denunciarlos por desobediencia a la autoridad de conformidad con el artículo 314 del Código Penal. Por otra parte, el punto 1 de esa ordenanza fue modificado en el sentido que el horario de operación se limita a las 20 horas mediante oficio No. CS-ARS-AS-195-2015 de las 11:30 del 12 de febrero del 2015. Lo anterior, le fue notificado a las 14:27 horas del 12 de febrero del 2015 al representante legal de la empresa Berthier EBI de Costa Rica (informe de las autoridades recurridas).
i. En contra de lo anterior la empresa en cuestión interpuso recurso de revocatoria con apelación en subsidio, los cuáles fueron rechazados. Por resolución DM-CP-4215-15 el Ministro de Salud declaró sin lugar el recurso de apelación (informe de las autoridades recurridas).
j. En oficio No. DPAH-D-518-2015 del 18 de mayo del 2015, el Director de Protección al Ambiente Humano del Ministerio de Salud solicitó al Dr. Guillermo Flores Galindo, Director Regional de Rectoría de Salud de la Región Central Sur indicó: Sobre el particular (Orden Sanitaria No. RH-009-2015) le solicitó interponer sus buenos oficios con el fin de que dicha Área Rectora de seguimiento a los puntos 2,3,4,5,6 y 7 del apartado de esa ordenanza, ya que los plazos establecidos se encuentran vencidos, pues la misma se giró el 10 de febrero del 2015. Lo anterior, en virtud de que recibido copia del correo electrónico de la Directora del Área Rectora de Salud de Aserrí del 14 de mayo del 2015 le dirigió donde indica que en cuanto a los planes que se solicitaron no han recibido en dicha Área ninguna documentación por parte de la empresa; al mismo tiempo aclara que la Dirección no ha recibido ningún plan o informe de la empresa EBI que cumpla con lo solicitado en la orden sanitaria. No obstante considera que si durante el seguimiento se percibe la generación de material particulado producto de la operación del relleno, se le debe ordenar al administrador del mismo aplica un método de aspersión con agua frecuentemente durante el día, al fin de aplacar el polvo y evitar molestias a los vecinos (informe de las autoridades recurridas).
k. En oficio DM-MA-5724-2015 del 18 de junio del 2015 suscrito por la Viceministro de Salud, el Jefe de la Unidad de Administración de Servicios de Salud en Ambiente Humanos y el Director de Protección al Ambiente Humano comunicaron al Ministro de Salud los resultados de una inspección que realizaron en el relleno sanitario El Huaso Aczerrí en compañía de funcionados del Área Rectora de Salud de Aserrí y de la Dirección Región Central Sur en la que se concluyó: 1. La empresa debe presentar un levantamiento actualizado del detalle de las obras civiles del proyecto señaladas en el punto 7. 2. Construir el sistema de tratamiento para los lodos que genere el Sistema de Tratamiento Lixiviados o caso contrario presentar justificación técnica que demuestre que no necesita contar con esta obra. 3. Presentar cronograma de actividades donde delimite o calendarice los episodios de recirculación y vertido de aguas residuales acorde a la época del año. 4.
Mantener el frente de trabajo reducido a fin de disminuir los olores tal y como se realiza actualmente. 5. No operar ni realizar las obras constructivas en la ampliación de la celda 3 hasta contar con los permisos constructivos. 6. No realizar las descargas tipo batch sin previa autorización del Área Rectora de Salud. Deben presentar un plan de mantenimiento y limpieza del sistema de tratamiento en caso de requerirlo, 15 días antes de su ejecución para revisión y aprobación del Área Rectora de Salud. 7. Enviar todas las aguas residuales (servidas – lixiviados) al sistema de tratamiento, o a la primera unidad del mismo. 8. Realizar por parte del Área Rectora de Salud una prueba de fluoresceína cuando exista efluente en el sistema de tratamiento de aguas residuales, para corroborar cual es la tubería que las conduce al cuerpo receptor. En caso de duda hacer coloración con una solución de rojo 40 mezclado con fluoresceína a las redes de alcantarillado pluvial para verificar que únicamente conduce aguas de lluvia.
Estas determinaciones deben realizarse en diferentes momentos, es decir, no deben hacerse al mismo tiempo. 9. Mantener por parte del Área Rectora de Salud visitas periódicas en coordinación con el Nivel Regional o Nivel Central para el seguimiento de lo solicitado (informe de las autoridades recurridas).
l. En orden sanitaria No. RH-084-2015 del 23 de julio del 2015, el Área Rectora de Salud de Aserrí ordenó a la empresa Parque Tecnológico presenta la siguiente información: “1. Presentar un levantamiento general que incluya todas las fincas que actualmente son propiedad de la empresa Berthier EBI de Costa Rica S.A. ubicadas en la comunidad del Huazo de Aserrí. 2. Presentar los planos catastrados certificados de cada una de las fincas que conforman toda la propiedad. 3. Presentar copia de la viabilidad ambiental que ha sido emitida por la SETENA para cada finca que conforma la propiedad actual (informe de las autoridades recurridas).
m. Por orden sanitaria No. RH-103-2015 del 21 de septiembre del 2015, el Área Rectora de Salud ordenó al Parque Tecnológico Ambiental Casería (Relleno Sanitario) que: “1. La empresa debe presentar un levantamiento actualizado del detalle de las obras civiles del proyecto señaladas en el punto 7. del oficio DM-MA-5724-2015. 2. Construir el sistema de tratamiento para los lodos que genere el Sistema de Tratamiento Lixiviados o caso contrario presentar justificación técnica que demuestre que no necesita contar con esta obra. 3. Presentar cronograma de actividades donde delimite o calendarice los episodios de recirculación y vertido de aguas residuales acorde a la época del año. 4. Mantener el frente de trabajo reducido a fin de disminuir los olores tal y como se realiza actualmente (plazo inmediato). 5. No operar ni realizar las obras constructivas en la ampliación de la celda 3 hasta contar con los permisos constructivos. 6.
No realizar las descargas tipo batch sin previa autorización del Área Rectora de Salud. Deben presentar un plan de mantenimiento y limpieza del sistema de tratamiento en caso de requerirlo, 15 días antes de su ejecución para revisión y aprobación del Área Rectora de Salud (plazo inmediato). 7. Enviar todas las aguas residuales (servidas – lixiviados) al sistema de tratamiento, o a la primera unidad del mismo (plazo inmediato)”. Lo anterior, le fue notificada a los representantes de la citada empresa a las 15:00 horas del 2 de octubre del 2015 (informe de las autoridades recurridas).
n. Por oficio DM-MA-8649-2015 del 7 de octubre del 2015 la Viceministra de Salud le informó al Director Regional de Rectoría de Salud Central Sur que en seguimiento al caso del Relleno Sanitario Casería, el Área Rectora de Salud de Aserrí giró la orden sanitaria No. RH-103-2015. Respecto del levantamiento topográfico, no será necesario en virtud de que el propio administrador de la empresa confesó durante la inspección que había preparado área de construcción de celdas fuera de la zona autorizada por el Ministerio de Salud, según los planos. Tomando en cuenta que han existido diferentes criterios entre los funcionario de la Región a su cargo y de la Dirección de Protección del Ambiente Humano en cuanto al cumplimiento del reglamento y el cuestionamiento de algunos vecinos sobre la operación de la empresa, se ha tomando la decisión que la verificación del acto administrativo supra sea realizado por la Dirección Regional de Rectoría de la Salud Occidente (informe de las autoridades recurridas).
o. En oficio CS-ARS-AS-918-2015 del 19 de octubre del 2015, la Directora del Área de Salud de Aserrí le comunicó al Gerente General por la información brindada sobre la conclusión de los trabajos al establecimiento Parque de Tecnología Ambiental Aczarri, tal y como se estableció en el Plan de Mitigación presentado a esta Área Rectora. Además, se les autorizó al Gerente General de la Empresa EBI Berthier de Costa Rica el ingreso de camiones recolectores de basura después de las 8 p.m. en cuanto realice la medición sónica para verificar y comprobar la efectividad de las mejoras se les estará comunicando el resultado (prueba aportada por el recurrente el 6 de noviembre del 2015).
p. En oficio DM-MA-8889-2015 del 3 de noviembre del 2015, la Viceministra de Salud solicitó el apoyo de la Dirección Central Occidente por la complejidad de la situación y por tener un profesional en el manejo de rellenos sanitarios q. En oficio CO-URS-RS-753-2015 del 17 de noviembre del 2015, el ingeniero Méndez Castro de la Dirección Regional Central Occidente informó que: “(…) Análisis Preliminar: Revisada la documentación recibida, considero que para coordinar la verificación del acto administrativo (orden sanitario RH-084-2015) girada contra el relleno sanitario Parque Tecnológico Aczerri y darle seguimiento al caso; se requiere realizar un análisis de la situación actual dado que es un caso que tiene antecedentes de varios años de operación, para posteriormente elaborar el plan de acción. La documentación recibida es insuficiente para elaborar un plan de seguimiento a la orden sanitaria emitida y darle seguimiento al caso; en virtud de lo señalado, se considera necesarios contar con más información, recursos y tiempo para coordinar entre otras cosas, el envío de copia de la orden sanitaria y las resoluciones (oficios) que la fundamentaron, solicitar el apoyo de los nieves local y regional (Región Central Sur), así como de la Dirección de Protección al Ambiente Humano, para obtener la información necesaria relacionada con el seguimiento del caso.
Una vez realizado el análisis de la situación se programará visitas al relleno sanitario, a fin de verificar información en el sitio y eventualmente requisitos de operación. II. RECOMENDACIÓN. Solicitar el apoyo requerido para la atención del caso en referencia al Área de Salud y a Nivel Regional involucrado, así como a la Dirección de Protección al Ambiente Humano. Proporcionar el tiempo y los recursos necesarios para elaborar el plan de acción requerido para coordinar la verificación del cumplimiento del acto administrativo (orden sanitaria RH-084-2015) girado contra el relleno sanitario Parque Tecnología Ambiental Acserrí y darle seguimiento al caso”. (informe de las autoridades recurridas).
r. Por oficio DR-CO-3043-2015 del 5 de noviembre del 2015, el Director Regional de la Dirección Regional Rectoría de Salud Central Occidente solicitó al Jefe Unidad Rectoría de Salud de la Dirección Regional Rectoría de Salud Central Occidente que en relación al oficio DM-MA-8889-2015 emitido por la Viceministra de Salud le solicitó: a) programar la atención del caso por le Ing. Méndez Castro. b) Mantener informado de las acciones que se realicen. c) La Dra. Anchía envió expediente del caso original y sin foliar, y del plano del levantamiento de infraestructura existente y actualización de cercas, lo cual se le remite para el estudio del caso (informe de las autoridades recurridas).
s. Por acta de observación policial de las 23:25 horas del 23 de noviembre del 2015 emitida por la Delegación Policial de Desamparados, San Miguel de la Dirección Regional de San José del Ministerio de Seguridad Pública señala que en frente al relleno sanitario El Huazo se observa la salida de 7 vehículos contenedores de basura salir del relleno sanitaria del Huazo de la Municipalidad de San José (prueba aportada por el recurrente el 25 de noviembre del 2015).
t. En fecha 24 de noviembre del 2015, las autoridades de la Dirección Regional de Rectoría de Salud Central Occidente a su cargo realizaron su primera sesión de trabajo con el fin de conocer los detalles del caso del relleno sanitario en Parque Tecnología Ambiental Acserrí. Para lo cual se requiere el estudio de expedientes ubicados en la Dirección Regional de Rectoría de la Salud Central Sur, en el Área Rectora de Salud Aserrí y en el Ministerio de Ambiente y Energía (informe de las autoridades recurridas).
u. En fecha 26 de noviembre del 2015 personeros de la Dirección Regional de Rectoría de la Salud Central Occidente visitaron la Dirección Regional de Rectoría de la Salud Central Sur y consultaron el expediente del relleno sanitario en cuestión prestando atención a los aspectos relevantes y estrictamente relacionados con la orden sanitaria No. RH-103-2015 (informe de las autoridades recurridas).
v. El Tribunal Ambiental Administrativo tramita el expediente administrativo No. 175-07-01-TAA donde están a la espera de la valoración del presunto daño ambiental ocasionado al ambiente, lo cual fue solicitado en su momento a la ingeniera Guzmán Ortiz en su condición de Directora de la Dirección de Gestión y Calidad Ambiental (DIGECA) en varias resoluciones a saber: resoluciones No. 1141-10-TAA del 17 de agosto del 2010, 1347-10-TAA del 20 de septiembre del 2010, 1666-10-TAA del 23 de noviembre del 2010, 415-11-TAA del 13 de 2011, No. 041-14-TAA, 789-14-TAA del 18 de septiembre del 2014 (informe de la autoridad recurrida).
El artículo 50 de la Constitución Política, establece que todas las personas tienen derecho a un ambiente sano y ecológicamente equilibrado, pues la protección a este derecho es una de los factores que garantizan el ejercicio del derecho a la salud contenido en el artículo 21 constitucional. Asimismo, en el artículo 89 de la Carta Magna, se encuentra contenido el deber del Estado de mantener y proteger las riquezas naturales. En ese mismo sentido, este Tribunal mediante sentencia número 3705-93 de las 15:00 horas del 30 de julio de 1993, indicó lo siguiente:
“...La calidad ambiental es un parámetro de esa calidad de vida; otros parámetros no menos importantes son salud, alimentación, trabajo, vivienda, educación, etc., pero más importante que ello es entender que si bien el hombre tiene el derecho de hacer uso del ambiente para su propio desarrollo, también tiene en deber de protegerlo y preservarlo para el uso de las generaciones presentes y futuras, lo cuál no es tan novedoso, porque no es más que la traducción a esta materia del principio de la "lesión", ya consolidado en el derecho común, en virtud del cuál el legítimo ejercicio de un derecho tiene dos límites esenciales: Por un lado, los iguales derechos de los demás y, por el otro, el ejercicio racional y el disfrute útil del derecho mismo...”.
Así las cosas, aunado al derecho a un ambiente sano y al deber de cada persona de hacer un uso racional de los recursos naturales, se encuentra el deber del Estado de velar por la protección y conservación de los mismos, así como la correlativa facultad de imponer las sanciones correspondientes por el incumplimiento de esos deberes. Es así como en el artículo 50 de la Carta Fundamental, que se establece lo siguiente:
“...Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado.
El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes.” De lo anteriormente citado, se desprende claramente, que el Estado, a través de los órganos designados al efecto, es el encargado garantizar a todas las personas, un ambiente sano y equilibrado, esto a través de los mecanismos que la ley pone a su disposición, con el fin de evitar daños irreversibles al medio ambiente y a la salud pública. Aunado a ello, debe promover las medidas necesarias, para que cada persona, disfrute de su derecho a la salud, entendida éste, en todas sus vertientes, sea, física, mental o social. Por otra parte, la Ley General de Salud, faculta al Ministerio de Salud para adoptar las medidas y disposiciones generales o individuales, que aseguren la aplicación y cumplimiento de las normas de salud, así como la protección del medio ambiente. Asimismo, el cuerpo normativo citado, establece la posibilidad de que el Ministerio de Salud coordine con otras dependencias de salud, las medidas necesarias para proteger la salud pública y personal de los individuos.
Esta Sala en sentencia número 2011-004776 de las 11:50 horas del 8 de abril del 2011 acreditó que en el “Parque de Tecnología Ambiental Aczarrí”, se ocasionaron una serie de problemáticas ambientales, en particular, escapes de biógas, afloramiento, fuga, rebalse y descarga de lixiviados y sedimentos al río Guatuso, malos olores, descarga de aguas no tratadas al sistema de aguas pluviales e incorrecta evacuación de aguas pluviales. También, se acreditó el incumplimiento del diseño autorizado y horario de ingreso de camiones, así como la falta de cobertura de los desechos. Con fundamento en lo anterior, en la parte dispositiva se ordenó:
“Se declara con lugar el recurso. Se ordena a Juan Vicente Durán Víquez, María Luisa Ávila Agüero y Carolina Umaña Cisneros, en su condición de Gerente General de “Empresas Berthier EBI de Costa Rica Sociedad Anónima”, Ministra de Salud y Directora del Área Rectora de Salud de Aserrí, respectivamente, o a quienes en su lugar ejerzan esos cargos, disponer, de inmediato, lo necesario para remediar de manera definitiva los problemas de contaminación que se presentan en el Parque de Tecnología Ambiental Aczarri. Se advierte a los recurridos que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena a Berthier EBI de Costa Rica Sociedad Anónima y al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo civil y de lo contencioso administrativo. Notifíquese esta resolución a Juan Vicente Durán Víquez, María Luisa Ávila Agüero y Carolina Umaña Cisneros, en su condición de Gerente General de “Empresas Berthier EBI de Costa Rica Sociedad Anónima”, Ministra de Salud y Directora del Área Rectora de Salud de Aserrí, respectivamente, o a quienes en su lugar ejerza esos cargos, en forma personal.”
En primer término los recurrentes acusan que el Parque de Tecnología Ambiental Aczarrí ubicado en Aserrí ocasiona graves problemas de contaminación ambiental a quienes habitan en sus cercanías, por el exceso de ruido que ocasiona el tránsito de los camiones recolectores en horario nocturno. Al respecto, se acredita que El Parque de Tecnología Ambiental Aczarrí ubicado en Aserrí cuenta con permiso sanitario de funcionamiento número RCS-ARSA-344-2012 vigente hasta el 17 de julio del 2017 cuyo representante legal es el señor Durán Víquez, razón social la Empresa Berthier EBI Costa Rica S.A. cédula jurídica 3-101-215741, para la actividad de tratamiento y disposición de desechos sólidos domésticos mediante proceso mecanizado (relleno sanitario). Por otra parte, las autoridades recurridas informaron que a las 21:00 horas del 20 de mayo del 2014, personeros del Área de Salud de Aserrí realizaron una medición sónica en la vivienda de la señora Mora Pérez, la cual se ubica a 50 metros al oeste del Ebais del Llano, sobre la calle de acceso principal al Parque de Tecnología Ambiental Aczarrí donde se determinó con base en los resultados obtenidos que no se vulneraba la legislación nacional.
Además se constata que a las 22:00 horas del 20 de mayo del 2014, personeros del Área Rectora de Salud de Aserrí realizaron una medición sónica en la casa del señor Guzmán Ureña en la cual se determinó: ruido ambiente más fuente generadora 51,1 dB y solo ruido ambiente 47,7 dB, superando los parámetros que dicta el Reglamento para el Control de Contaminación por Ruido, Decreto No. 28718-S. Con fundamento en lo anterior, el Área Rectora de Salud por emitió orden sanitaria No. RH-065-14 del 10 de junio del 2014, en la que determinó que ya existen antecedentes de un plan de mitigación de ruido por parte de la empresa entregado en el año 2012, sin embargo, le ordenó con fundamento en los resultados de la medición sónica supra citada que forma inmediata suspendiera el ingreso de camiones recolectores de basura al relleno sanitario hasta tanto no presente un Plan de Mitigación de Ruido. Por otra parte, se constata que el Área Rectora de Salud de Aserrí emitió orden sanitaria No. RH-009-2015 del 10 de febrero del 2015, en la que determinó en lo que interesa: “ 1.
Se realizaron dos visitas al lugar con el fin de darle seguimiento a denunciado por ruido originado por le entrada y salida de camiones recolectores de residuos al Parque de Tecnología Ambiental Aczarrí, una el 6 de octubre y otra el 20 de noviembre del 2014, las mismas se realizaron en la vivienda del señor Germán Segura Ureña, ubicada a 75 metros de la entrada del relleno sanitario. Por otra parte, de la Dirección Regional de Rectoría de Salud Centra participó en la primera ocasión el Lic. Rafael Ángel Vega Alfaro, y en la segunda oportunidad Msc. Ana Lucrecia Hernández y en ambas ocasiones el Ing. Eugenio Androvetto Villalobos, Director de Protección al Ambiente Humanos y estuvo presente el Sr. Segura Ureña. 1. El resultado de las mediciones en el momento de paso de vehículos la emisión sobrepasa los límites establecidos en el Decreto No. 28718-S Reglamento para el Control de Contaminación por Ruido para zona de residencia en horas nocturnas 45 (dB).
Con fundamento en lo anterior, el Área Rectora en cuestión ordenó a la empresa Parque Tecnológico Ambiental Aczerri (Relleno Sanitario) lo siguiente: 1. Dado los resultados de las mediciones sónicas que reflejan la problemática generada por la operación del relleno sanitario en horas de la noche, el horario de operación se limita a las 10 de la noche. Por otra parte, el punto 1 de esa ordenanza fue modificado en el sentido que el horario de operación se limita a las 20 horas mediante oficio No. CS-ARS-AS-195-2015 de las 11:30 del 12 de febrero del 2015”. Lo anterior, le fue notificado a las 14:27 horas del 12 de febrero del 2015 al representante legal de la empresa Berthier EBI de Costa Rica. Posteriormente, en oficio CS-ARS-AS-918-2015 del 19 de octubre del 2015, la Directora del Área de Salud de Aserrí le comunicó al Gerente General de la empresa Berthier EBI por la información brindada sobre la conclusión de los trabajos al establecimiento Parque de Tecnología Ambiental Aczarri, tal y como se estableció en el Plan de Mitigación presentado a esta Área Rectora.
Además, se les autorizó al Gerente General de la Empresa EBI Berthier de Costa Rica el ingreso de camiones recolectores de basura después de las 8 p.m. en cuanto realice la medición sónica para verificar y comprobar la efectividad de las mejoras se les estará comunicando el resultado. No obstante lo anterior, en el presente caso de las pruebas que constan en autos se descarta que las autoridades del Área Rectora de Salud de Aserrí hayan a la fecha llevado a cabo las mediciones necesarias a fin de determinar si con las trabajos realizados en el relleno sanitario que constan en el Plan de Mitigación presentado por la empresa en cuestión el tránsito de camiones recolectores de basura en horario nocturno –después de las 8 p.m.- cumple o no con los parámetros que dicta el Reglamento para el Control de Contaminación por Ruido, Decreto No. 28718-S. Además, de las pruebas que constan en autos se acredita que las inspecciones por medio de la cual se constató el problema de contaminación sónica se realizaron con posterioridad a la interposición del presente recurso sin que de las pruebas que consten en autos se acredite que la problemática por las cuales se emitieron dos ordenes sanitarias No. RH-065-14 y No. RH-009-2015 hayan sido solucionado de forma definitiva, a pesar del tiempo transcurrido, lo cual evidencia una actuación permisiva por parte de las autoridades del Ministerio de Salud en fiscalizar que el tránsito de camiones recolectores de basura en horario nocturno no sobrepase los niveles establecidos por la legislación correspondiente, lo cual evidencia a todas luces una violación de los artículos 21 y 50 de la Constitución Política, motivo por el cual en cuanto a dicho extremo el recurso debe ser estimado, como en efecto se ordena.
Por otra parte, los recurrentes acusan que el Parque de Tecnología Ambiental Aczarrí ubicado en Aserrí ocasiona graves problemas de contaminación ambiental, por los fuertes olores a biogás durante la noche, debido a que la basura no es tapada, además, de la gran cantidad de polvo generada por la remoción de tierra. Al respecto, se acredita que el 16 de enero del 2014 personeros del Área Rectora de Salud realizaron una inspección en las instalaciones del Parque de Tecnología Ambiental Aczarrí ubicado en Aserrí en donde se constató que el sistema de extracción y quema pasiva del biogás se encuentra funcionado, además no se observaron residuos del día anterior sin el correspondiente material de cobertura. Además, no se detectaron malos olores y las dimensiones del frente de la celda son adecuadas con lo que se garantiza una adecuada compactación de los residuos. Señalan que la Administración del proyecto como medida principal de mitigación del polvo implementa la irrigación de los caminos principales dentro de relleno y de las principales vías alrededor del mismo por medio de camiones cisternas y el riego por aspersión de taludes.
El proyecto cuenta con una red para la canalización y conducción de lixiviados hasta una sistema de tratamiento que se encuentra ubicado en el extremo noroeste. Dicho sistema se compone de 3 unidades (cámara de desmitificación + cámara de aireación + cámara de sedimentación) que mediante sistemas de aireación logra remover los contaminantes en el lixiviado y reducir la carga orgánica para ser vertido en el río Guatuso cumpliendo con los parámetros de vertidos estipulados en la normativa vigente. Por otra parte, se constató una operación adecuada, ausencia de malos olores, color del lixiviado en el tanque de aireación café oscuro, el cual representa condiciones favorables de aireación y se midieron los parámetros in situ de oxígeno disuelto y pH en el tanque de aireación, encontrándose resultados favorables de pH 8,43 (debe estar entre 5 y 9) y oxígeno disuelto 5,67 (no debe estar por debajo de 2).
No obstante lo anterior y ante la existencia de nuevos elementos probatorios, el Área Rectora de Salud de Aserrí emitió la orden sanitaria No. RH-009-2015 del 10 de febrero del 2015, indicó que lo siguiente: “1. Se realizaron dos visitas al lugar con el fin de darle seguimiento a lo denunciado por ruido originado por le entrada y salida de camiones recolectores de residuos al Parque de Tecnología Ambiental Aczarrí, una el 6 de octubre y otra el 20 de noviembre del 2014, las mismas se realizaron en la vivienda del señor Germán Segura Ureña, ubicada a 75 metros de la entrada del relleno sanitario. Por otra parte, de la Dirección Regional de Rectoría de Salud Centra participó en la primera ocasión el Lic. Rafael Ángel Vega Alfaro, y en la segunda oportunidad Msc. Ana Lucrecia Hernández y en ambas ocasiones el Ing. Eugenio Androvetto Villalobos, Director de Protección al Ambiente Humanos y estuvo presente el Sr. Segura Ureña. 1.
El resultado de las mediciones en el momento de paso de vehículos la emisión sobrepasa los límites establecidos en el Decreto No. 28718-S Reglamento para el Control de Contaminación por Ruido para zona de residencia en horas nocturnas 45 (dB). 2. La condición actual apreciada en el sitio como la observada en la información remitida por la SETENA, varía con respecto al proyecto constructivo original presentado ante este Ministerio, en el año 2006, que se dispuso sobre la finca catastral SJ-249003-95. 3. En el proyecto original del relleno sanitario visado en el año 2006, cuyos planos constructivos se encuentran en las oficinas contiguo a la planta de tratamiento, se observa en planta de sitio de celdas de disposición de residuos, tres pozos de monitoreo, no obstante, la localización de lo detallado en los planos no coincide con la ubicación que se determina en el sitio y no queda claro el tercer pozo solamente se identifica dos para este propósito a lo interno de la actividad.
Se desconoce si posterior a esta propuesta se tramitó ante las entidades competentes una actualización del proyecto que respalda la condición actual y donde se determine la ubicación de esa alternativa . 4. En el momento de la visita de inspección se percibió que el frente de trabajo era bastante amplio. 5. Se desconoce el criterio técnico de diseño para definir la ubicación, cantidad y distribución de los rocladores de desodorante ambiental, así como la clase de líquido a utilizar, pues queda la inquietud si la solución es suficiente y al ser la actividad manual depende de la decisión de la persona de turno y no a sensores que alerten que se producen olores que puedan causar molestias a los vecinos. Con fundamento en lo anterior, el Área Rectora en cuestión ordenó a la empresa Parque Tecnológico Ambiental Aczerri (Relleno Sanitario) lo siguiente: 1. Dado los resultados de las mediciones sónicas que reflejan la problemática generada por la operación del relleno sanitario en horas de la noche, el horario de operación se limita a las 10 de la noche. 2.
Presentar un detalle de planta de sitio donde se puedan determinar los linderos como la unificación de las distintas fincas catastrales identificadas que conforman la propiedad donde se desarrolla el proyecto de relleno sanitario, se debe considerar los distintos componentes de la actividad sobre dicho detalle (Plazo de 1 mes). 3. Delimitar en el año los períodos de recirculación y el período de vertido. Por lo cual se debe mantener el vertido durante todo el período de lluvias al cuerpo receptor (Plazo inmediato acorde con la época de lluvias). 4. Elaborar y presentar al Ministerio de Salud un proyecto para la construcción del sistema de tratamiento de los lodos provenientes del sistema de tratamientos de lixividados, así como los usos que se darán a los biosólidos (Plazo un mes para presentar el proyecto que incluya el cronograma de ejecución). 5. Presentar al Ministerio de Salud autorización de la administración del pozo de la ASADA y la documentación técnica respectiva, donde se justifique que este como los otros dos pozos de monitoreo existentes a lo interno del relleno sanitario, son representativos para el control de las aguas subterráneas de esta obra sanitaria. 6.
El frente de trabajo debe ser reducido para facilidad de manejo y control de olores, especialmente durante el período de época de lluvias (plazo inmediato). 7. Presentar un protocolo que indique como se determinarán las posibles acciones a seguir para la atención de eventos que puedan repercutir en la liberación de olores, desagradables que afecten a los vecinos” . En caso de incumplimiento se le previene que el Ministerio podrá clausurar el establecimiento de acuerdo a lo dispuesto en los artículos 355, 356, 357 y 363 de la Ley General de Salud y dictar las acciones penales correspondiente como denunciarlos por desobediencia a la autoridad de conformidad con el artículo 314 del Código Penal. En oficio No. DPAH-D-518-2015 del 18 de mayo del 2015, el Director de Protección al Ambiente Humano del Ministerio de Salud solicitó al Dr. Guillermo Flores Galindo, Director Regional de Rectoría de Salud de la Región Central Sur indicó: Sobre el particular (Orden Sanitaria No. RH-009-2015) le solicitó interponer sus buenos oficios con el fin de que dicha Área Rectora de seguimiento a los puntos 2,3,4,5,6 y 7 del apartado de esa ordenanza, ya que los plazos establecidos se encuentran vencidos, pues la misma se giró el 10 de febrero del 2015.
Posteriormente, en oficio DM-MA-5724-2015 del 18 de junio del 2015 suscrito por la Viceministro de Salud, el Jefe de la Unidad de Administración de Servicios de Salud en Ambiente Humanos y el Director de Protección al Ambiente Humano comunicaron al Ministro de Salud los resultados de una inspección que realizaron en el relleno sanitario El Huaso Aczerrí en compañía de funcionados del Área Rectora de Salud de Aserrí y de la Dirección Región Central Sur en la que se concluyó: 1. La empresa debe presentar un levantamiento actualizado del detalle de las obras civiles del proyecto señaladas en el punto 7. 2. Construir el sistema de tratamiento para los lodos que genere el Sistema de Tratamiento Lixiviados o caso contrario presentar justificación técnica que demuestre que no necesita contar con esta obra. 3. Presentar cronograma de actividades donde delimite o calendarice los episodios de recirculación y vertido de aguas residuales acorde a la época del año. 4.
Mantener el frente de trabajo reducido a fin de disminuir los olores tal y como se realiza actualmente. 5. No operar ni realizar las obras constructivas en la ampliación de la celda 3 hasta contar con los permisos constructivos. 6. No realizar las descargas tipo batch sin previa autorización del Área Rectora de Salud. Deben presentar un plan de mantenimiento y limpieza del sistema de tratamiento en caso de requerirlo, 15 días antes de su ejecución para revisión y aprobación del Área Rectora de Salud. 7. Enviar todas las aguas residuales (servidas – lixiviados) al sistema de tratamiento, o a la primera unidad del mismo. 8. Realizar por parte del Área Rectora de Salud una prueba de fluoresceína cuando exista efluente en el sistema de tratamiento de aguas residuales, para corroborar cual es la tubería que las conduce al cuerpo receptor. En caso de duda hacer coloración con una solución de rojo 40 mezclado con fluoresceína a las redes de alcantarillado pluvial para verificar que únicamente conduce aguas de lluvia.
Estas determinaciones deben realizarse en diferentes momentos, es decir, no deben hacerse al mismo tiempo. 9. Mantener por parte del Área Rectora de Salud visitas periódicas en coordinación con el Nivel Regional o Nivel Central para el seguimiento de lo solicitado. Con fundamento en lo anterior, se emitió orden sanitaria No. RH-084-2015 del 23 de julio del 2015, el Área Rectora de Salud de Aserrí ordenó a la empresa Parque Tecnológico presenta la siguiente información: “ 1. Presentar un levantamiento general que incluya todas las fincas que actualmente son propiedad de la empresa Berthier EBI de Costa Rica S.A. ubicadas en la comunidad del Huazo de Aserrí. 2. Presentar los planos catastrados certificados de cada una de las fincas que conforman toda la propiedad. 3. Presentar copia de la viabilidad ambiental que ha sido emitida por la SETENA para cada finca que conforma la propiedad actual”.
Lo anterior, le fue notificado al Gerente General de la empresa el pasado 23 de julio del 2015. Por otra parte, de las pruebas que constan en autos se acredita que por orden sanitaria No. RH-103-2015 del 21 de septiembre del 2015, el Área Rectora de Salud ordenó al Parque Tecnológico Ambiental Casería (Relleno Sanitario) que: “ 1. La empresa debe presentar un levantamiento actualizado del detalle de las obras civiles del proyecto señaladas en el punto 7. del oficio DM-MA-5724-2015. 2. Construir el sistema de tratamiento para los lodos que genere el Sistema de Tratamiento Lixiviados o caso contrario presentar justificación técnica que demuestre que no necesita contar con esta obra. 3. Presentar cronograma de actividades donde delimite o calendarice los episodios de recirculación y vertido de aguas residuales acorde a la época del año. 4. Mantener el frente de trabajo reducido a fin de disminuir los olores tal y como se realiza actualmente (plazo inmediato). 5.
No operar ni realizar las obras constructivas en la ampliación de la celda. 3 hasta contar con los permisos constructivos. 6. No realizar las descargas tipo batch sin previa autorización del Área Rectora de Salud. Deben presentar un plan de mantenimiento y limpieza del sistema de tratamiento en caso de requerirlo, 15 días antes de su ejecución para revisión y aprobación del Área Rectora de Salud (plazo inmediato). 7. Enviar todas las aguas residuales (servidas – lixiviados) al sistema de tratamiento, o a la primera unidad del mismo (plazo inmediato)”. Lo anterior, fue notificado a los representantes de la empresa recurrida a las 15:00 horas del 2 de octubre del 2015. En oficio DM-MA-8889-2015 del 3 de noviembre del 2015, la Viceministra de Salud solicitó el apoyo de la Dirección Central Occidente por la complejidad de la situación y por tener un profesional en el manejo de rellenos sanitarios.
Además, se constata que el 24 de noviembre del 2015, las autoridades de la Dirección Regional de Rectoría de Salud Central Occidente a su cargo realizaron su primera sesión de trabajo con el fin de conocer los detalles del caso del relleno sanitario en Parque Tecnología Ambiental Acserrí. Nótese además que en el informe que presentó en la Secretaría de esta Sala el 30 de noviembre del 2015, el Director de la Dirección Regional de Rectoría de Salud Central Occidente indicó que no consta en el expediente administrativo un informe de seguimiento de la orden sanitaria No. No. RH-103-2015 por parte de las autoridades de salud del Área Rectora de Salud de Aserrí, lo cual es justificable que hay indicaciones de la Viceministro de Salud para que dicha gestión administrativa sea realizada por las autoridades de salud a cargo de la Dirección Regional de Rectoría de la Salud Central Occidente. Así las, cosas en el presente caso se evidencia que las órdenes sanitarias No. RH-009-2015 del 10 de febrero del 2015, No. RH-084-2015 del 23 de julio del 2015 y No. RH-103-2015 del 21 de septiembre del 2015 no han sido debidamente cumplidas en su totalidad por las autoridades del Ministerio de Salud y la empresa Empresa Berthier EBI Costa Rica S.A. motivo por el cual en cuanto a tales extremos el recurso debe ser estimado por la infracción de lo dispuesto en los artículos 21 y 50 de la Constitución Política, con las consecuencias que se indican en la parte dispositiva.
En el informe rendido bajo juramento las autoridades de la Corporación Municipal recurrida indicaron que las cuestiones denunciadas son derivadas del funcionamiento y operación del relleno en cuestión, aspectos en los cuales no tiene injerencia su representada, sino que, por la naturaleza de las mismas, son competencia de la empresa operadora del relleno, de la SETENA, del Tribunal Ambiental Administrativo y del Ministerio de Salud. Además, se descarta en el presente caso que los amparados hayan presentado alguna denuncia ante la Corporación Municipal y que ésta no haya sido tramitada, motivo por el cual en cuanto a dicha autoridad el presente recurso debe ser desestimado, como en efecto se ordena. No obstante lo anterior, se constata que en oficio DM-MA-8649-2015 del 7 de octubre del 2015 la Viceministra de Salud le informó al Director Regional de Rectoría de Salud Central Sur que en seguimiento al caso del Relleno Sanitario Casería, el Área Rectora de Salud de Aserrí giró la orden sanitaria No. RH-103-2015.
Respecto del levantamiento topográfico, no será necesario en virtud de que el propio administrador de la empresa confesó durante la inspección que había preparado área de construcción de celdas fuera de la zona autorizada por el Ministerio de Salud, según los planos. Con fundamento en lo anterior, tome nota el Alcalde de la Municipalidad recurrida a fin de realizar una inspección y verificar si en el Parque Tecnológico Ambiental Aczerri (Relleno Sanitario) se han realizado construcciones que requieran de algún visado municipal y en caso de no ser así proceder según las competencias que le confiere nuestro ordenamiento jurídico.
Por otra parte, si los recurrentes consideran que el Tribunal Ambiental Administrativo no ha tramitado de forma diligente el procedimiento tramitado bajo el de desobediencia dentro del recurso de amparo tramitado bajo expediente número 08-014247-0007-CO en donde se emitió la sentencia número 2010-014754 de las quince horas y treinta y nueve minutos del treinta y uno de agosto del dos mil diez. No obstante lo anterior, llama poderosamente la atención de ésta Sala el retraso injustificado en que ha incurrido el Tribunal Ambiental Administrativo en emitir el acto final dentro del expediente No. 175-07-01-TAA, lo cual es una tardanza injustificada. En relación al reclamo de los amparados de que la Secretaría Técnica Nacional Ambiental, y el Ministerio del Ambiente y Energía no se han pronunciado sobre las deficiencias del relleno sanitario en discusión, ello es un extremo de legalidad que deberá ser determinado en el proceso que se tramita ante el Tribunal Ambiental Administrativo, motivo por el cual en cuanto a tales extremos el recurso debe ser desestimado, como en efecto se ordena.
X.Por último tome nota las autoridades de la Defensoría de los Habitantes que por tratarse de una situación que afecta los vecinos de una comunidad y sobre lo cual se han dictado en el pasado una serie de actos, en particular el informe final con recomendaciones emitido en el oficio No. 01190-2012-DRH del 31 de enero del 2012 deberá supervisar el cumplimiento de lo ordenado en la parte dispositiva de ésta sentencia, de lo cual deberá mantener informada a ésta Sala.
El suscrito Magistrado aclara que si bien los asuntos ambientales, cuando hay intervención administrativa de cualquier índole, los remite a la jurisdicción contencioso administrativa, lo cierto es que tratándose de denuncias donde se alega contaminación a causa del ruido, del polvo y de los malos olores provenientes, presuntamente, de la operación de un relleno sanitario que, a su vez, afecta a los ocupantes de varias casas de habitación aledañas, no lo hará así. Esto, por cuanto, se encuentran en juego otros derechos de los vecinos de la fuente contaminante, tales como la salud y a gozar de un nivel digno de calidad de vida.
He coincidido con la posición sustentada por el Magistrado Jinesta Lobo en esta materia, por lo que, en asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusan problemas de contaminación prevenientes del funcionamiento del relleno sanitario de Aserrí, por el ruido excesivo que provocan los camiones recolectores, fuertes olores a biogás durante las noche porque no se cubre la basura, así como la gran cantidad de polvo que genera la remoción de tierra, lo que afecta la salud del recurrente y la de los demás vecinos del lugar, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
En casos de recursos de amparo por lesiones ambientales sostengo como línea general que esta Sala debe abstenerse de conocer los reclamos que se le presenten por supuesta infracción al artículo 50 de la Constitución Política para dejar en manos de la justicia administrativa y la jurisdicción contenciosa administrativa su conocimiento. Pero también he advertido que mi planteamiento no impide reconocer la existencia de casos particulares o grupos de casos que, según mi criterio, si resultarían aún mejor tutelados por esta Sala y por tanto deben ser conocidos y resueltos por ella.- Dentro de tales grupos de casos, y sin que esta enunciación pueda considerarse como una lista cerrada y definitiva, puedo señalar que la Sala debe reservarse el conocimiento de situaciones como por ejemplo los reclamos por infracciones ambientales que además pongan en riesgo directo la salud de las personas , o el acceso o calidad del agua; los casos de violaciones groseras y directas al ambiente y en los cuales se constate una palmaria ausencia de la protección por parte de las autoridades estatales, siempre y cuando la naturaleza del reclamo permita ser abordado mediante el instrumento del amparo como instituto procesal sumario y especial, ya que estimo que tampoco se debe “ordinariar” el amparo para abordar, aún en estos casos citados, temas que rebasen la capacidad de ser atendidos adecuadamente en el mismo.
En el caso concreto, se observa que la situación planteada se ubica dentro tales casos de excepción pues se hace referencia a la operación de un gran relleno sanitario, lo cual indudablemente incide en la salud de las personas, sin embargo, la magnitud del problema, la cantidad de instituciones involucradas y la dificultad que existe para realizar las labores exigidas, hacen que un recurso de amparo no sea la vía apropiada para aquilatar apropiadamente las supuestas faltas y –principalmente- las acciones remediales que puedan ser aplicables.- De este modo, declaro sin lugar el recurso por entender que el caso puede ser mejor atendido por los órganos administrativos y judiciales con competencia amplia y procesos más exhaustivos en esta materia.
Por tanto:
Se declara PARCIALMENTE CON LUGAR el recurso. Se ordena a Carolina Umaña Cisneros en su condición de Directora del Área Rectora de Salud de Aserrí, Eugenio Androvetto Villalobos, Director de la Dirección de Protección al Ambiente Humanos, Marvin Quesada Elizondo, en su calidad de Director Regional de la Dirección Regional de la Rectoría Central Occidente, Ronny Stanley Muñoz Salazar en su calidad de Director de Asuntos Jurídicos del Ministerio de Salud, Juan Vicente Durán Víquez en su condición de Gerente General de la empresa Berthier EBI de Costa Rica S.A., o a quiénes en su lugar ocupen esos cargos que en el plazo máximo de TRES MESES contados a partir de la notificación de esta sentencia, procedan de forma coordinada a tomar las medidas requeridas según su competencia a fin cumplir en su totalidad con las ordenes sanitarias No. RH-065-14, No. RH-084-2015, y No. RH-009-2015 y resolver de manera definitiva los problemas en ellas evidenciados en el Parque de Tecnología Ambiental Aczarrí.
De lo anterior, deberán informar a ésta Sala sobre los avances efectuados durantes y antes del vencimiento del plazo otorgado en la parte dispositiva. Se advierte a los recurridos que de no acatar la orden dicha, incurrirán en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y a la empresa Berthier EBI de Costa Rica S.A. al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que serán liquidados en ejecución de sentencia de lo contencioso administrativa y en vía civil, respectivamente. En cuanto a la Municipalidad de Desamparados y al Tribunal Ambiental Administrativo se declara sin lugar el recurso.
Por otra parte, tome nota Rafael Garro Fallas, en su condición de Alcalde de la Municipalidad de Desamparados, o a quién en su lugar ocupe el cargo de lo dispuesto en el considerando VIII de ésta sentencia. Tome nota el Presidente del Tribunal Ambiental Administrativo de lo dispuesto en el considerando IX de la sentencia. Además tome nota la Defensora de los Habitantes de lo ordenado en el considerando X de la sentencia a fin de que supervise el cabal cumplimiento de lo ordenado en la presente sentencia, de lo cual deberá mantener informada a ésta Sala. Notifíquese la presente resolución a Carolina Umaña Cisneros en su condición de Directora del Área Rectora de Salud de Aserrí, Eugenio Androvetto Villalobos, Director de la Dirección de Protección al Ambiente Humanos, Marvin Quesada Elizondo, en su calidad de Director Regional de la Dirección Regional de la Rectoría Central Occidente, Ronny Stanley Muñoz Salazar en su calidad de Director de Asuntos Jurídicos del Ministerio de Salud, Juan Vicente Durán Víquez en su condición de Gerente General de la empresa Berthier EBI de Costa Rica S.A., o a quiénes en su lugar ocupen esos cargos.
