Findings:
“(...) I hereby inform you that this phenomenon occurred during the nighttime hours of 03 September 2015. A mass nesting event (arribada) is a mass-nesting behavior characterized by a large concentration of females, a high density of nests, and synchronous nesting behavior among females (Valverde & Gates 2000). A mass nesting event is declared when the number of turtles reaching the beach is so great that directly counting them becomes impossible. This phenomenon may last between 2 or 10 nights (Cornelius 1982). The causes of this reproductive synchronization may be related to the lunar phase, winds, tidal cycle, rainfall patterns, temperature, and intrinsic factors associated with the behavior and physiology of these individuals (Pritchard 1969; Omns ef al. 1982; Mendonca and Pritcherd 1986; Cornelius and Robinson 1986). According to data generated by the scientific research conducted by Dr. Roldan Valverde and Dr. Carlos M. Orrego, it is estimated that 153.000 individuals nested on this occasion (C. Orrego, pers. comm.). The mass nesting event extended along approximately 3.8 km of beach. In addition, solitary nesting increased throughout the remainder of the 7 km comprising Playa Ostional and Playa Nosara. During mass nesting events, it is common for a turtle to come ashore more than once because, on occasion, turtles do not complete the process; consequently, the number of times the turtles came ashore is greater than the number of individuals that nested. This detail is extremely important because, if a turtle abandons nest construction or turns back while climbing toward the dune, it will return later. Observation of sea-turtle nesting at this site is regulated by Decreto Ejecutivo N' 32627-MINAE, Reglamento de Uso Público del Refugio Nacional de Vida Silvestre Ostional. Tourist visitation is a form of non-consumptive use (uso no consuntivo) that has occurred for years and is considered one of the most viable alternatives for reducing the community’s pressure on and dependence upon the use of eggs (Campbell et al. 2007). Furthermore, the impacts can be properly managed because, while nesting during mass nesting events, turtles exhibit extremely tolerant behavior toward the presence of humans, as well as other wild animals or other disturbances that these individuals would not tolerate during solitary nesting behavior. During the first days of mass nesting events, particularly in the rainy season, it is common to see turtles nesting in daylight in numbers that increase at dusk and reach their maximum during the night and at high tide. This occurred during the mass nesting event in question, on the afternoons of Friday 04 and Saturday 05 beginning at around 3 p.m., and on Sunday 06 September beginning at 5 p.m. It should be noted that several conditions during this mass nesting event contributed to the high level of tourist visitation: 1. Extensive circulation on social networks and coverage by mass media. 2. Good access conditions to the community of Ostional, including bridges over the largest rivers and roads in good condition. 3. Dry weather conditions during a season that is normally very rainy, making access possible for all types of vehicles. 4. A public road constituting a national route runs parallel to the nesting beach within the refuge, facilitating visitor entry into several sectors of the refuge. 5. The beach has several access points that facilitate visitor entry, including 6 entrances from the public road that lead to the beach and several other trails. 6. The mass nesting event began early on a Friday morning, providing sufficient time for it to be publicized on social networks and in the press and for visitors consequently to arrive on Saturday. As a result, visitation during this mass nesting event was entirely exceptional and unpredictable in terms of the number of visitors who came to observe the phenomenon. To provide an idea of what occurred, the line of vehicles parked in the town of Ostional extended for approximately 3 km (H. Lobo, pers. comm.). The work carried out in responding to the mass nesting event involved personnel from ACT-SINAC (4 officials), monitors from the Asociación de Desarrollo de Ostional (ADIO), 33 local guides, 3 members of the Fuerza Pública, and 3 members of the Policía Turística. The mass nesting event was also monitored by two groups of researchers. All of the foregoing was regulated by both the Reglamento de Uso Público del Refugio Nacional de Vida Silvestre Ostional and the Plan Quinquenal de Manejo y Conservación de tortuga lora del Refugio Nacional de Vida Silvestre Ostional, approved through Resolución ACT-OR-94-12 of 17 August 2012. In the specific case of this mass nesting event, egg harvesting (aprovechamiento de huevos) was authorized through Resolución ACT-OR-DR-076-2015, of 04 September 2015. Progress in implementing the Plan Quinquenal is evaluated annually, with the principal participation of UCR, INCOPESCA, ADIO, and SINAC-ACT. The Fuerza Pública, Servicio Nacional de Guardacostas, and SENASA also participate in this process. Even with a group of more than 50 collaborators supporting all control and supervision activities, it was impossible to limit access. The presence of these stakeholders in this protected wilderness area (área silvestre protegida) is due to the existence of a project with a high and sustained level of community participation, which has been one of the pillars of its success; this situation supports the response to the Ostional mass nesting events and is essential to the participatory management that has been conducted for decades (Ordóñez et al. 1993).- Regarding the possible biological impacts on the nesting process, it must be considered that females of this turtle species may lay eggs on at least two occasions per season and, for that purpose, remain near the coast during the internesting periods (Piotkin et ai 1994). It is presumed that olive ridley turtles are capable of retaining their eggs internally for longer periods than other sea-turtle species and that this egg retention may continue until nesting conditions are suitable. (Lrcnt et ar. 1982; Pritchard 1969; Plotkin et at. 1995). This makes it possible to understand that, if the high level of tourist visitation during the first mass nesting event in September had been harmful to the turtles, they have the physiological capacity to adapt and return at another time to lay their eggs. This forms part of the species’ natural behavior and its behavioral adaptations during mass nesting; accordingly, the extensive human presence is not considered to have caused any greater impact on the nesting process in this case, whereas the situation would have been very different had the nesting behavior been solitary. The mass-nesting behavior of olive ridley turtles itself causes a considerable increase in the destruction of nests due to the excess excavation they perform over previously deposited nests. In addition, the embryonic viability of the eggs under those conditions is low because of environmental factors and the substantial presence in the sand of microorganisms such as bacteria and fungi, which cause the developing embryo to die (Comelius et al. 1991). Excessive visitation occurred primarily during daylight hours; therefore, any disturbance to the nesting habitat, such as compaction of the sand, was nullified by the nesting of turtles that arrived during the night, because they themselves excavated over nests deposited during previous hours and days. Moreover, during daylight hours, deposited nests are more vulnerable because of excessive heat and high temperatures, which cause the sand to become extremely dry and affect the nest-construction process.”
Furthermore, the aforementioned Deputy Director of the Área de Conservación Tempisque of SINAC added in his report that, because this year is one in which the Fenómeno de El Niño is present, the pattern in the size of mass nesting events also changes and is smaller than during previous peak periods; in view of this climatic situation and the prolonged dry season, mass nesting events can be seen to be very small. Nevertheless, despite this, the trend remains that mass nesting events occurring during the rainy season are larger than those occurring during the dry season. He adds that, according to data generated by the regional turtle-monitoring project headed by Dr. Canes Mano Orrego, the first mass nesting event in September was, up to that time, the largest of the year, resulting in a total of 153.330 olive ridley turtles successfully laying their eggs and completing the nesting process.
He maintains that the foregoing demonstrates that, despite the high level of tourist visitation during the first mass nesting event in September of the present year, the number of turtles that successfully laid their eggs was very high, even considering the influence of Fenómeno de El Niño. In view of the foregoing, he considers that the high level of tourist visitation did not cause any major impacts on the natural mass-nesting process of olive ridley turtles in Ostional, owing to the turtles’ high capacity for both physiological and behavioral adaptation when nesting in mass nesting events. Nevertheless, as the Deputy Director of the Área de Conservación Tempisque correctly stated in his report, such extensive and uncontrolled visitation in a protected wilderness area is by no means advisable and undoubtedly creates, in the first instance, a very unpleasant visual impact, restricts control measures and officials’ enforcement of regulations, and, in an emergency, makes managing such a massive gathering of people extremely difficult.
This situation, never before seen in the Refuge, has required measures to be taken to prevent it from recurring and thereby ensure that the Refuge is properly managed in all spheres: social, environmental, and administrative. He reports that another fact minimizing any impact that tourist visitation may have caused to sea-turtle nesting during the mass nesting event of 04 September was that, only 12 days after the first mass nesting event ended, a new one began during the early morning hours of 22 September 2015. This was due to a change in the lunar phase during which the second mass nesting event occurred—from a waning moon to a waxing moon—a behavior that occurs frequently and is therefore extremely difficult to predict; accordingly, probable mass nesting dates are used when planning the response to these events. He further clarifies that, because the nests of this turtle species take between 45 and 55 days to hatch, the excavation performed by turtles from the second mass nesting event while constructing their nests in the same sector of the beach is destroying, as part of the natural process, almost all the nests deposited during the first September mass nesting event.
This second mass nesting event (arribada) occurred along approximately 3 km of Ostional Beach and may end on Monday, 28 de setiembre, with an estimated nesting total of approximately 250.000 turtles. To manage this mass nesting event, a response operation was established with the support of 20 SINAC officials, 10 officers from the Grupo de Apoyo Operacional de la Fuerza Pública (GAO), 7 members of the Fuerza Pública de Santa Cruz, 3 members of the Policía de Tránsito, 3 members of the Policía Turística, 12 COVIRENAS volunteers and brigade members, 30 local tour guides, and 12 members of the monitoring corps of the Asociación de Desarrollo Integral de Ostional (ADIO). According to the aforementioned Deputy Director, although tourist visitation during this second mass nesting event has been relatively low, a control operation has remained in place to ensure that every visitor entering the beach to observe the mass nesting event does so accompanied by a local guide.
This operation has remained in place throughout the mass nesting event and has resulted in orderly and regulated visitation, without adverse impacts on sea turtle nesting. In addition, with respect to control and protection against nest poaching, five seizures (decomisos) or discoveries of illegally extracted eggs have been made, totaling approximately 3.200 eggs. Likewise, an official press release was issued explaining the regulations established by the Reglamento de Uso Público del Refugio so that visitors would be better informed in this regard. This information was broadcast on the Telenoticias news program on jueves 24 de setiembre de 2015. In summary, these regulations are: “1. Entry to the nesting beach is permitted only with an authorized local guide. 2. The maximum group size is 10 persons, including the guide. 3. Only red light is permitted, except that control and protection personnel may use white light. 4.
Turtles must not be touched or handled, nor may noises or blows be made that affect them. 5. The excavation and collection of eggs, hatchlings, and any sea turtle by-product are prohibited. 6. Visitors must enter without radios, recorders, or any sound equipment. 7. Stones, shells, or any other animal or plant product must remain on the beach. 8. Entry by land or water vehicles is permitted exclusively in emergencies. 9. Bonfires, grills, and hot plates are prohibited on the beach. 10. Photographs must be taken without flash or artificial lighting. 11. There are no camping areas on the beach. 12. Visitors must enter the beach without suitcases, briefcases, backpacks, or coolers. 13. Entry by persons under the influence of alcohol or drugs is prohibited. 14. The entry of pets and domestic animals onto the beach, including horseback riding, is restricted. 15. Smoking is prohibited. 16. Surfing and swimming are prohibited during mass nesting events. 17.
Egg collection is permitted only by the Asociación de Desarrollo Integral de Ostional (ADIO), in accordance with the established regulations. 18. Any visitor who fails to comply with these provisions will be asked to leave the Refugio.” He states that, in response to the second mass nesting event, a series of measures was implemented to prevent a recurrence of the situation experienced during the first mass nesting event of setiembre de 2015, including: “1. A planning and coordination meeting was held to manage the mass nesting event, with participation by the stakeholders involved, namely officials from the Refugio administration and the Dirección Regional del ACT; 12 ADIO representatives from the monitoring corps, local guides, board of directors, and project oversight; representatives of the Asociación de Guías Locales de Ostional (AGLO); independent local guides; Fuerza Pública de Santa Cruz Nosara and Policía Turística; and the persons responsible for the Refugio’s monitoring and research program. 2.
Officials were mobilized from other operational offices of ACT, ACG, and ACAT because the limited staffing at this location makes adequate control during this phenomenon impossible. 3. Because ACT officials are insufficient to cover an operation of this nature, assistance has been coordinated with other Áreas de Conservación, Fuerza Pública, GAO, Policía Turística, Policía Municipal, as well as volunteer personnel such as Brigadistas, Covirenas, and ASVO. 4. The operation to control the mass nesting event has been conducted through the incident command system (sistema de comando de incidentes), so that management of the event is coordinated in a structured manner. 5. All access points to the Refugio have been kept completely closed, for which assistance has been coordinated with volunteers and local guides. 6. Only two visitor entrances have been opened, at which duly identified local guides must be present to provide guiding services, as established in the Reglamento de Uso Público del Refugio. 7.
Signs have been posted indicating the regulations established in the Reglamento de Uso Público del Refugio in order to properly inform visitors. 8. The implemented regulations have been publicized through the media so that visitors who decide to come are informed and comply with the measures adopted. 9. Road operations have been conducted in which vehicles and buses were inspected to prevent the illegal transportation of eggs. 10. The maximum tour duration during mass nesting events has been set at 30 a 45 minutos. 11. Trials have been conducted using drones provided by the Área de Conservación Guanacaste to assess their effectiveness in control and protection activities (...).” In view of the foregoing, he considers that the Sistema Nacional de Áreas de Conservación, through the Oficina del Área de Conservación Tempisque, has made efforts to comply with the applicable regulations and specifically with the provisions of Decreto Ejecutivo N° 32627-MINAE, entitled “Reglamento de Uso Público del Refugio Nacional de Vida Silvestre Ostional,” and, as indicated in the aforementioned official letter, SINAC has conducted all control and supervision activities in coordination with all active members of the Ostional community for the protection of this protected wildland (área silvestre), and especially for the protection of the olive ridley sea turtles (Tortugas Lora). He requests that the appeal (recurso) filed be dismissed.
Justice Pacheco Salazar authors the opinion; and,
Whereas:
I.Subject matter of the application.- The petitioners state that the Refugio Nacional de Fauna Silvestre Ostional was created by Law number 6919 of 17 November 1983 for the purpose of protecting and conserving wildlife. They state that, because that Law was ineffective, decree number 16531-MAC of 26 September 1985 expanded the refuge in question to include an area extending two hundred meters from the ordinary high-tide line, from the left bank of the mouth of the río Nosara to Punta Guiones, for the purpose of protecting turtle nesting. By Decree number 22251-MIRENEM of 8 October 1993, the refuge was expanded once again on the grounds that it was one of the world’s two most important mass nesting sites for olive ridley sea turtles, which would help ensure the long-term viability of their population. Under Law number 8325 of 28 November 2002, certain marine-turtle nesting and egg-laying systems, including the Refugio Nacional de Vida Silvestre Ostional, were declared to be of ecotourism interest, and the Asociación de Desarrollo Integral de Ostional, composed of residents of the area, created a plan to establish a symbiotic relationship under which, in exchange for protecting the turtles and the area, residents could receive a percentage of the eggs.
Notwithstanding the foregoing, on 4 September 2015, as part of an academic field trip organized by the Universidad de Costa Rica, they went to the beach to observe the mass turtle-nesting event (arribada); however, they encountered a large number of people taking photographs with all types of electronic devices and obstructing the turtles’ passage. This frightened away the females, which returned to the sea without nesting. Late that same night, groups of people were observed entering without the respective guides required by the Reglamento de uso público de Ostional and carrying white-light flashlights, which are prohibited under that regulation (photographic evidence). They allege that the same situation continued on the following 5 September despite the presence of the Fuerza Pública, whose officers stated that regulating those events was not within their authority. In their view, the cited regulations contain gaps, including with respect to the application of the precautionary and preventive principles in environmental matters.
a. During the nighttime hours of 03 September 2015, a mass turtle-nesting event occurred in the Refugio Nacional de Fauna Silvestre Ostional. This phenomenon is a form of mass nesting behavior characterized by a large concentration of females, a high density of nests, and synchronous nesting behavior among females. A mass nesting event is declared when the number of turtles arriving at the beach is so great that directly counting them becomes impossible (undisputed fact); b. The mass nesting event of 3 September 2015 extended along approximately 3.8 km of beach. In addition, solitary nesting increased along the remaining portion of the 7 km comprising Playa Ostional and Playa Nosara (see documentation and report submitted under oath); c. Observation of marine-turtle nesting at this site is governed by Decreto Ejecutivo No. 32627-MINAE, Reglamento de Uso Público del Refugio Nacional de Vida Silvestre Ostional (see documentation and report submitted under oath); d. During the afternoon of Friday the 04th—the date on which the petitioners arrived at the Refugio Nacional de Fauna Silvestre de Ostional—and on Saturday the 05th beginning at approximately 3 p.m., and Sunday, September 06, beginning at 5 p.m., a major mass nesting event (arribada) of turtles occurred at the National Refuge in question, because several conditions favored high tourist visitation: 1.
Extensive dissemination through social media and coverage by mass media outlets. 2. Good access conditions to the community of Ostional, including bridges over the largest rivers and roads in good condition. 3. Dry weather conditions during a season that is normally very rainy, making access possible for all types of vehicles. 4. A public road, which is a national route, runs parallel to the nesting beach (playa de anidación) in the refuge, facilitating visitor access through several areas of the refuge. 5. The beach has several access points that facilitate visitor entry, including 6 entrances from the public road that lead to the beach, as well as several other trails. 6. The mass nesting event began early Friday morning, leaving sufficient time for information to spread through social media and the press and, consequently, for visitors to arrive on Saturday. The foregoing caused visitation during this mass nesting event to be wholly exceptional and unpredictable because of the number of visitors who arrived to observe this phenomenon (see documentation and reports submitted under oath); e. The work performed in responding to the mass nesting event involved personnel from ACT-SINAC (4 officials), wardens from the Asociación de Desarrollo de Ostional (ADIO), 33 local guides, 3 members of the Fuerza Pública, and 3 members of the Policía Turística.
The mass nesting event was also monitored by two groups of researchers. All of the foregoing was governed by both the Reglamento de Uso Público del Refugio Nacional de Vida Silvestre Ostional and the Plan Quinquenal de Manejo y Conservación de tortuga lora del Refugio Nacional de Vida Silvestre Ostional, approved through Resolución ACT-OR-94-12 of August 17, 2012 (see documentation and reports submitted under oath); f. On September 4, 2015, Mr. Juan Arrieta, President of the Asociación de Desarrollo de Ostional, requested security assistance from the Fuerza Pública for the first time because turtles were laying eggs (desove) that day (see documentation and report submitted under oath by the Acting Director General of the Fuerza Pública); g. In the specific case of this mass nesting event, the harvesting of eggs (aprovechamiento de huevos) was authorized through Resolución ACT-OR-DR-076-2015, dated September 04, 2015, because progress in implementing the Plan Quinquenal is evaluated annually, with the principal participation of UCR and INCOPESCA, ADIO, and SINAC-ACT.
The Fuerza Pública, the Servicio Nacional de Guardacostas, and SENASA also participate in this process (see documentation and reports submitted under oath); h. The mass nesting event from September 3 to 5, 2015, was supported by a group of 50 collaborators assisting with all oversight and monitoring activities, who were unable to limit access by the several thousand people who appeared at the site (see documentation and reports submitted under oath); i. The excessive visitation occurred mainly during daylight hours, and therefore any disturbance to the nesting habitat (hábitat de anidación), such as compaction of the sand that may have occurred, was undone by the nesting of the turtles that arrived during the night, because they themselves dug over the nests laid during prior hours and days (see documentation and reports submitted under oath); j. According to the data generated by the regional turtle-monitoring project led by Dr. Canes Mano Orrego, the first mass nesting event in September was, up to that point, the largest of the year, resulting in a total of 153.330 olive ridley sea turtles (tortugas lora) that succeeded in laying their eggs and completing the nesting process.
Despite the high level of tourist visitation during the first mass nesting event of September of the current year, the number of turtles that succeeded in laying their eggs was very high, even considering the influence of Fenómeno de El Niño (see documentation and reports submitted under oath); k. The high level of tourist visitation did not cause any major impacts on the natural process of mass nesting by olive ridley sea turtles in Ostional, due to the strong physiological and behavioral adaptability of the olive ridley sea turtles that nest during mass nesting events. Nevertheless, as the Deputy Director of the Área de Conservación Tempisque rightly stated in his report, having so many visitors in an uncontrolled manner within a protected wildlife area (área silvestre protegida) is by no means advisable and undoubtedly creates, in the first instance, a highly unpleasant visual impact, restricts officials’ monitoring activities and enforcement of regulations, and, in the event of an emergency, makes it extremely difficult to manage such a massive gathering of people (see documentation and reports submitted under oath); l. Because of the unprecedented mass visitation, the Sistema Nacional de Áreas de Conservación decided to adopt social, environmental, and administrative measures to prevent this from happening again at the Refugio Nacional de Vida Silvestre Ostional.
These measures were reflected during the second mass nesting event, which began in the early morning hours of September 22, 2015, and would possibly end on Monday, September 28, with an estimated nesting total of approximately 250.000 turtles (see documentation and reports submitted under oath); m. To respond to that second mass nesting event, an operational response was established with the support of 20 SINAC officials, 10 officers from the Grupo de Apoyo Operacional de la Fuerza Pública (GAO), 7 members of the Fuerza Pública de Santa Cruz, 3 members of the Policía de Tránsito, 3 members of the Policía Turística, 12 COVIRENAS volunteers and brigade members, 30 local tour guides, and 12 members of the surveillance corps of the Asociación de Desarrollo Integral de Ostional (ADIO). Consequently, a series of measures was implemented, including a monitoring operation requiring every visitor entering the beach to observe the mass nesting event to do so accompanied by a local guide, in an orderly and regulated manner, without negative impacts on sea-turtle nesting (see documentation and reports submitted under oath); n. During the nesting event from September 22 to 28, there were five seizures or discoveries of illegally extracted eggs, totaling approximately 3.200 eggs (see documentation and reports submitted under oath); o. SINAC issued an official press release setting forth the regulations established by the Reglamento de Uso Público del Refugio so that visitors would be better informed about them.
It was broadcast on the Telenoticias news program on Thursday, September 24, 2015, and contained the following regulations: “1. Entry to the nesting beach is permitted only with an authorized local guide. 2. The maximum group size is 10 people, including the guide. 3. Only red light is permitted, except that monitoring and protection personnel may use white light. 4. Turtles must not be touched or handled, nor may noises or impacts be made that affect them. 5. Digging for and collecting eggs, hatchlings (neonatos), and any sea-turtle byproduct is prohibited. 6. Entry must be without radios, recorders, or any sound equipment. 7. Stones, shells, or any other animal or plant product must remain on the beach. 8. The entry of land or water vehicles is permitted exclusively in emergencies. 9. Bonfires, grills, and camp stoves are prohibited on the beach. 10. Photographs must be taken without flash or artificial lighting. 11.
There are no camping areas on the beach. 12. Entry to the beach must be without suitcases, briefcases, backpacks, or coolers. 13. Entry by persons under the influence of alcohol or drugs is prohibited. 14. The entry of pets and domestic animals onto the beach, including horseback riding, is restricted. 15. Smoking is prohibited. 16. Surfing and swimming are prohibited during mass nesting events. 17. Egg collection is permitted only for the Asociación de Desarrollo Integral de Ostional (ADIO), in accordance with the established regulations. 18. Any visitor who fails to comply with these provisions will be asked to leave the Refuge.” In addition, a meeting was convened among the responsible agencies and individuals (see documentation and reports submitted under oath).
III.On the merits (Sobre el fondo). In this application for constitutional relief (amparo), the petitioners allege that on September 4, 2015, as part of an academic field trip organized by the Universidad de Costa Rica, they went to the beach to observe the mass nesting event; however, they found a large number of people taking photographs with all types of electronic devices and obstructing the turtles’ path, which frightened away the females, causing them to return to the sea without nesting. Late that same night, groups of people were observed entering without the respective guides required by the Reglamento de uso público de Ostional and carrying white-light flashlights, which are prohibited under that same regulation (photographic evidence). They allege that the same situation continued on the following day, September 5, despite the presence of the Fuerza Pública, whose members stated that regulating such events was outside their jurisdiction. In their view, the cited regulations contain gaps, including with respect to the application of the precautionary and preventive principles (principio precautorio y preventivo) in environmental matters. The application therefore focuses on the protection of the right to the environment (derecho al medio ambiente), which entails safeguarding the Refuge from activities other than those directed toward its conservation.
IV.With regard to the preservation of natural beauty and the environment, as well as the oversight that the State must exercise in this respect, the Chamber held in judgment # 5893-95 at 9:48 a.m. on October 27, 1995:
“From all the foregoing, it is clear that the State is obligated to protect natural beauty and the environment (Articles 50 and 89 of the Political Constitution), since there is an evident private and social interest in doing so, an objective that, in order to be achieved, requires the enactment of laws that adequately regulate the subject. Certainly, human beings have the right to use the environment for their own development, but they also have the corresponding duty to protect and preserve it for present and future generations. Thus, for example, the Stockholm Conference states that “human beings have the fundamental right to freedom, equality, and the enjoyment of adequate living conditions in an environment of such quality as to permit a life of dignity and well-being, and they bear a solemn obligation to protect and improve the environment for present and future generations.” It must not be overlooked that soil, water, air, marine, coastal, and mineral resources, forests, biological diversity, and the landscape form the environmental framework without which basic needs such as living space, food, energy, housing, sanitation, and recreation would be impossible to satisfy.
Likewise, our economy is also closely linked to the condition of the environment and natural resources; thus, for example, both the generation of foreign exchange through agricultural and tourism activities and the success of major investments and infrastructure ultimately depend on their conservation. Accordingly, Environmental Law should not be associated solely with nature, since nature is only one part of the environment. Nature-protection policy also encompasses other matters, such as the protection of hunting, forests, natural parks, and natural resources. It is therefore a macro-environmental concept intended to ensure that important concepts are not omitted and thereby to unify the body of law that we call Environmental Law.” In this regard, the issue raised in the action involves the fundamental right to a healthy and ecologically balanced environment, specifically, in this case, the protection of marine fauna within a conservation refuge.
The State bears the inescapable responsibility of defending and preserving that environment, which is the common heritage of all its inhabitants. Private parties must also participate in its sustainable conservation and use. The alteration of nature may cause environmental harm, such as that alleged here, where it is claimed that the administration failed in its duty to guarantee, defend, and preserve that right.
V.The Refugio Nacional de Vida Silvestre Ostional was declared as such by Decreto Ejecutivo # 13200-A, published in the Diario Oficial La Gaceta on 7 de enero de 1982, and ratified by the Ley de Fauna Silvestre, # 6919, de 1983, which was repealed in 1992 and replaced by the Ley de Conservación de Vida Silvestre # 7317 del 7 de diciembre de 1992. Decreto Ejecutivo # 16531-MAG, published in La Gaceta on 26 de noviembre de 1985, extended the boundaries of the Refuge to the Punta Guiones sector. This delimitation was ratified in Transitorio I of the Ley de Conservación de Vida Silvestre with respect to the two-hundred-meter strip of the maritime-terrestrial zone (zona marítimo terrestre), and in Decreto Ejecutivo # 22551-MIRENEM del 8 de octubre de 1993. The Refuge encompasses the two hundred meters of the maritime-terrestrial zone and three nautical miles of the territorial waters in the sector extending from Punta India to Punta Guiones, in the canton of Nicoya, province of Guanacaste.
Through Ley número 8325 del 28 de noviembre de 2002, some of the nesting and egg-laying systems of sea turtles, including the Refugio Nacional de Vida Silvestre Ostional, were declared to be of ecotourism interest, and the Asociación de Desarrollo Integral de Ostional, composed of local residents, created a plan under which a symbiotic relationship would be developed whereby, in exchange for protecting the turtles and the area, residents could receive a percentage of the eggs.
VI.Specific case. The reports submitted by the respondent authorities of the Sistema Nacional de Áreas de Conservación and the Ministerio de Ambiente y Energía—which are deemed to have been given under oath, with the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for resolution of the matter duly establish that, during the nighttime hours of 03 de setiembre de 2015, an olive ridley sea turtle mass nesting event (arribada de tortugas lora) occurred at the Refugio Nacional de Vida Silvestre Ostional, a phenomenon involving mass nesting behavior characterized by a large concentration of females. That mass nesting event of 3 de setiembre de 2015 extended along approximately 3.8 km of beach. In addition, there was an increase in solitary nesting throughout the remaining 7 km comprising Playa Ostional and Playa Nosara.
Although the observation of sea-turtle nesting at this site is regulated by Decreto Ejecutivo No. 32627-MINAE, Reglamento de Uso Público del Refugio Nacional de Vida Silvestre Ostional, this Chamber has deemed it established that during the afternoon of Friday 04—the date on which the appellants arrived at the Refugio Nacional de Fauna Silvestre de Ostional—and on Saturday 05 beginning at around 3 p.m., and on Sunday 06 de setiembre beginning at 5 p.m., a large mass nesting event occurred at the National Refuge in question. This resulted in heavy tourist visitation that caught the authorities of the Ministerio de Ambiente y Energía by surprise, as only ACT-SINAC personnel (4 officials), guards from the Asociación de Desarrollo de Ostional (ADIO), 33 local guides, 3 members of the Fuerza Pública, and 3 members of the Policía Turística were available. The mass nesting event was also monitored by two groups of researchers.
In light of the foregoing, it is concluded that the mass nesting event from 3 al 5 de setiembre de 2015 had only a group of 50 collaborators supporting all control and supervision activities, and they were unable to restrict access by the several thousand people who came to the site. Although, in the view of the Director of SINAC and the Director of the Área de Conservación Tempisque, the excessive visitation occurred mainly during daylight hours and therefore any disturbance to the nesting habitat, such as compaction of the sand, was reversed by the nesting activity of the turtles that arrived during the night, since they themselves over-excavated the nests deposited during previous hours and days, the fact remains that, as the respondents acknowledge, the mass tourist visitation caught them by surprise. They lacked the onsite capacity to contain the uncontrolled entry onto the beach and, even less, the personnel needed to explain to visitors the measures and restrictions that had to be observed when entering the Refugio Nacional de Vida Silvestre de Ostional and approaching the turtles.
This was remedied through the measures taken during the second olive ridley sea turtle mass nesting event, which occurred between 22 al 28 de setiembre de 2015. For that event, a response operation was established with support from a total of 97 people—practically twice the number of collaborators available during the first mass nesting event from 3 al 5 de setiembre—broken down as follows: 20 SINAC officials, 10 officers from the Grupo de Apoyo Operacional de la Fuerza Pública (GAO), 7 members of the Fuerza Pública de Santa Cruz, 3 members of the Policía de Tránsito, 3 members of the Policía Turística, 12 COVIRENAS volunteers and brigade members, 30 local tour guides, and 12 members of the security corps of the Asociación de Desarrollo Integral de Ostional (ADIO). The foregoing warrants granting this action, since it has been established that the authorities responsible for protecting biodiversity at the Refugio Nacional de Vida Silvestre de Ostional—in this case, the Sistema Nacional de Áreas de Conservación of the Ministerio de Ambiente y Energía—failed to take, in advance and in observance of the precautionary principle in environmental matters (principio precautorio en materia ambiental), the corresponding administrative measures needed to effectively regulate the entry of private individuals into the aforementioned national refuge, with the appropriate safeguards, during the mass nesting event received between 3 al 5 de setiembre de 2015, when more than 153.330 olive ridley sea turtles were counted on the beach.
Although they attempted to remedy the situation through a series of measures for the mass nesting event that occurred from 22 al 28 de setiembre, in this Court’s judgment those measures are insufficient unless a future action and control plan is prepared for the upcoming mass nesting events. For the reasons stated, the action must be granted, subject to the considerations set forth in the operative portion (parte dispositiva).
VI.Regarding the Fuerza Pública and the Municipalidad de Santa Cruz. As may be seen from the reports submitted and the attached evidence, with respect first to the Fuerza Pública, it is an assisting body whose cooperation at the site was requested belatedly and in response to the unexpectedly large number of visitors on 4 de setiembre de 2015. Accordingly, there was no administrative failure to act on its part, but rather a lack of practical effectiveness by SINAC in coordinating an operation in advance; consequently, the action must be dismissed with respect to the Fuerza Pública. As to the Municipalidad de Santa Cruz, the Presidente del Concejo and the Alcalde de la Municipalidad de Santa Cruz are correct in stating that, although the Refugio Nacional de Vida Silvestre Ostional is located within the territorial jurisdiction of Santa Cruz, Guanacaste, responsibility for its management plan (Plan de manejo) does not lie with that Municipality. The Municipality therefore lacks authority to regulate its use and management, since those matters fall within the authority of the Sistema Nacional de Áreas de Conservación. Accordingly, the constitutional protection action (amparo) must also be dismissed with respect to the respondent municipality.
Justices Jinesta Lobo and Salazar Alvarado dissent and would deny the action for the following reasons:
Por tanto:
The remedy is partially granted solely with respect to the alleged failure of the Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía to carry out the corresponding actions and measures for the purpose of coordinating an operation that would have been effective in accommodating tourist visitation during the olive ridley sea turtle nesting event between 3 and 5 September 2015 at the Refugio Nacional de Vida Silvestre Ostional. The foregoing was detrimental to the right to a healthy and ecologically balanced environment guaranteed by Article 50 of the Political Constitution. Patricia Madrigal Cordero, Viceministra de Ambiente y Energía, as well as Julio Jurado Fernández, Director Ejecutivo, and Nelson Marín Mora, Director Regional del Área de Conservación Tempisque, both of the Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, are ordered to immediately establish a transitional (or temporary) action plan for the orderly admission of the various groups of persons received each month by the Refugio Nacional de Vida Silvestre Ostional, which must comply with the rules established in the Reglamento de Uso Público de Ostional.
They are likewise ordered, within three months of notice of this judgment, to prepare, in coordination and jointly with the appropriate departments, a preventive action or control plan for tourist visitation to the Refugio Nacional de Vida Silvestre Ostional. That plan must be implemented within the same period for the purpose of strengthening environmental protection, particularly protection of the marine fauna in that protected wilderness area. Patricia Madrigal Cordero, Viceministra de Ambiente y Energía, as well as Julio Jurado Fernández, Director Ejecutivo, and Nelson Marín Mora, Director Regional del Área de Conservación Tempisque, both of the Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, or whoever may hold those positions, are hereby warned that failure to comply with the foregoing order will constitute the offense of disobedience and that, pursuant to Article 71 of the Law governing this jurisdiction, any person who receives an order issued in amparo proceedings that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The State is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be quantified during enforcement of the contentious-administrative judgment. With respect to the Fuerza Pública and the Municipalidad de Santa Cruz, the remedy is denied. Justices Jinesta Lobo and Salazar Alvarado dissent and would deny the remedy.

Resultando:
Redacta la Magistrada Pacheco Salazar; y,
Considerando:
I.Objeto del recurso.- Los recurrentes manifiestan que por Ley número 6919 del 17 de noviembre de 1983, se creó el Refugio Nacional de Fauna Silvestre Ostional, con el propósito de proteger y conservar la fauna silvestre. Manifiestan que por ineficiencia de la Ley mencionada, por decreto número 16531-MAC del 26 de setiembre de 1985, se amplió el refugio en cuestión, doscientos metros a partir del pleamar ordinaria, comprendida desde el margen izquierdo de la desembocadura del río Nosara hasta Punta Guiones con la finalidad de proteger la anidación de tortugas. Por Decreto número 22251-MIRENEM del 8 de octubre de 1993, se amplió nuevamente dicho refugio, bajo la justificación de ser uno de los dos sitios más importantes a nivel mundial de arribo de Tortugas Lora, lo que contribuiría a asegurar la viabilidad de la población de las mismas a largo plazo. Mediante la Ley número 8325 del 28 de noviembre de 2002, se declaró de interés ecoturístico algunos de los sistemas de anidamiento y desove de tortugas marinas, dentro de los que se encuentra el Refugio Nacional de Vida Silvestre Ostional, y la Asociación de Desarrollo Integral de Ostional, conformada por vecinos de la zona, creó un plan en el cual se desarrollara una relación simbiótica, donde a cambio de brindar protección a las tortugas y a la zona, los pobladores pudiesen optar por un porcentaje de los huevos.
Pese a lo expuesto, el 4 de setiembre de 2015, como parte de una gira académica de la Universidad de Costa Rica, se apersonaron a la playa para observar la arribada de tortugas; sin embargo, encontraron una gran cantidad de personas tomando fotografías con todo tipo de aparatos electrónicos, obstruyendo el paso de las tortugas, lo cual ahuyentaba a las hembras, las cuales regresaban al mar sin anidar; y a altas horas de la noche del mismo día, se observó el ingreso de grupos de personas sin los respectivos guías estipulados en el Reglamento de uso público de Ostional, con focos de luz blanca, las cuales son prohibidas por el mismo (elenco fotográfico). Alegan que la misma situación continuó el 5 de setiembre siguiente, pese a la presencia de la Fuerza Pública, quienes indicaron que no era de su competencia regular dichos acontecimientos. En su criterio, la reglamentación citada posee vacíos, entre ellos la aplicación del principio precautorio y preventivo en materia ambiental.
a. El 03 de setiembre de 2015 en horas de la noche se dio una arribada de tortugas en el Refugio Nacional de Fauna Silvestre Ostional, fenómeno que se da como una conducta de anidación masiva que se caracteriza por la gran concentración de hembras, la alta densidad de anidamientos y un comportamiento de anidación sincrónica en hembras. El fenómeno de arribada es declarado cuando la cantidad de tortugas que llegan a la playa es tan grande que se imposibilita su conteo directo (hecho no controvertido); b. La arribada del 3 de setiembre de 2015, se extendió a lo largo de aproximadamente 3.8 km de playa. Además, se de un incremento de la anidación solitaria en el resto de los 7 km que conforman Playa Ostional y Playa Nosara (ver documentación e informe rendido bajo fe de juramento); c. La observación de la anidación de tortugas marinas en este sitio, es regulada el Decreto Ejecutivo No. 32627-MINAE, Reglamento de Uso Público del Refugio Nacional de Vida Silvestre Ostional (ver documentación e informe rendido bajo fe de juramento); d. Durante la tarde del viernes 04 –fecha en la cual arribaron los recurrentes al Refugio Nacional de Fauna Silvestre de Ostional- y el sábado 05 a partir de alrededor de las 3 p.m. y el domingo 06 de setiembre desde las 5 p.m, se dio una gran arribada de tortugas al Refugio Nacional en cuestión, pues se dieron algunas condiciones que favorecieron la alta visitación turística: 1.
Una alta difusión por las redes sociales y divulgación en medios de comunicación masiva. 2. Buenas condiciones de acceso a la comunidad de Ostional incluyendo puentes sobre los ríos más grandes y caminos en buen estado. 3 Condiciones climáticas secas en una época que normalmente es muy lluvioso, con lo cual el acceso fue posible en todo tipo de vehículo. 4. Paralelo a la playa de anidación en de refugio existe una calle pública, ruta nacional lo cual favorece el ingreso del visitante en varios sectores del refugio. 5. La playa tiene varios accesos lo que facilita el ingreso de los visitantes, entre ellos 6 ingresos desde la calla pública que llegan a la playa y varios otros senderos. 6. La arribada inició un viernes en la madrugada por lo que existió tiempo suficiente para que se diera la divulgación en redes sociales y prensa y con ello los visitantes llegaran sábado. Lo anterior provocó que la visitación que ocurrió durante esta arribada fuera totalmente excepcional e impredecible por la cantidad de visitantes que llegaron a observar este fenómeno (ver documentación e informes rendidos bajo fe de juramento); e. El trabajo que se realizó durante la atención de la arribada contó con personal del ACT-SINAC (4 funcionarios), vigilantes de la Asociación de Desarrollo de Ostional (ADIO), 33 guías locales, 3 miembros de la Fuerza Pública y 3 miembros de la Policía Turística.
La arribada también fue monitoreada por dos grupos de investigadores. Todo lo anterior, regulado tanto por el Reglamento de Uso Público del Refugio Nacional de Vida Silvestre Ostional y por el Plan Quinquenal de Manejo y Conservación de tortuga lora del Refugio Nacional de Vida Silvestre Ostional, aprobado mediante la Resolución ACT-OR-94-12 del 17 de agosto del 2012 (ver documentación e informes rendidos bajo fe de juramento); f. El día 4 de setiembre del 2015, el señor Juan Arrieta, Presidente de la Asociación de Desarrollo de Ostional, solicitó por primera vez colaboración de seguridad a la Fuerza Pública, por desove de tortugas ese día (ver documentación e informe rendido bajo fe de juramento por el Director General a.i. de la Fuerza Pública); g. En el caso específico de esta arribada el aprovechamiento de huevos fue autorizado mediante la Resolución ACT-OR-DR-076-2015, del 04 de setiembre de 2015, pues anualmente se hace una evaluación de los avances en la implementación del Plan Quinquenal, en la cual participan principalmente la UCR a INCOPESCA, la ADIO y el SINAC-ACT.
De este proceso también participan la Fuerza Pública, el Servicio Nacional de Guardacostas y SENASA (ver documentación e informes rendidos bajo fe de juramento); h. La arribada del 3 al 5 de setiembre de 2015, contó con un grupo de 50 colaboradores apoyando en todas las acciones de control y supervisión, los cuales no pudieron limitar el acceso de varios miles de personas que se apersonaron al sitio (ver documentación e informes rendidos bajo fe de juramento); i. La visitación excesiva se dio principalmente en horas del día por lo que la perturbación sobre el hábitat de anidación tal como compactación de la arena que pudiera haber existido, se anuló con la anidación de las tortugas que llegaron durante la noche, dado que ellas mismas sobreexcavaron los nidos depositados en horas y días previos (ver documentación e informes rendidos bajo fe de juramento); j. De acuerdo a los datos generados por el proyecto regional de monitoreo de tortugas a cargo del Dr. Canes Mano Orrego, se tiene como resultado que la primera arribada del mes de setiembre fue hasta ese momento la mas grande del año, generando como resultado un total de 153.330 tortugas lora que lograron desovar y completar el proceso de anidación con éxito, pese a la alta visitación turística en la primera arribada del mes de setiembre del presente año, la cantidad de tortugas que lograron desovar fue muy alta, incluso considerando la influencia de Fenómeno de El Niño (ver documentación e informes rendidos bajo fe de juramento); k. La alta visitación turística no generó mayores impactos en el proceso natural de anidación masiva de las tortugas lora en Ostional, esto debido a la alta capacidad de adaptación, tanto fisiológica como de comportamiento, que poseen las tortugas lora que anidan en arribadas; no obstante, como bien lo indicó el Subdirector del Área de Conservación Tempisque en su informe tener tanta visitación y de manera descontrolada en un área silvestre protegida no es para nada recomendable y sin duda genera en primer instancia un impacto visual muy desagradable, limita las acciones de control y la aplicación de regulaciones por parte de funcionarios, y ante una emergencia, se vuelve sumamente complicado el tener que manejar una concurrencia tan masiva de personas (ver documentación e informes rendidos bajo fe de juramento); l. Debido a la visitación masiva de personas nunca antes vista, el Sistema Nacional de Áreas de Conservación, dispuso tomar medidas en el ámbito social, ambiental y administrativo para evitar que esto se repita nuevamente en el Refugio Nacional de Vida Silvestre Ostional, las cuales se vieron reflejadas en la segunda arribada del 22 de setiembre de 2015 en horas de madrugada y posiblemente finalice el lunes 28 de setiembre, con un estimado de anidación de alrededor de 250.000 tortugas (ver documentación e informes rendidos bajo fe de juramento); m. Para la atención de esa segunda arribada se estableció un operativo de abordaje en el cual se contó con el apoyo de 20 funcionario de SINAC, 10 efectivos da Grupo de Apoyo Operacional de la Fuerza Pública (GAO), 7 miembros de la Fuerza Pública de Santa Cruz, 3 miembros de la Policía de Tránsito 3 miembros de la Policía Turística, 12 voluntarios de COVIRENAS y brigadistas, 30 guías turísticos locales y 12 miembros del cuerpo de vigilancia de la Asociación de Desarrollo Integral de Ostional (ADIO), y en consecuencia, se ejecutaron una serie de medidas como un operativo de control para que todo visitante que ingrese a la playa a observar la arribada, lo haga acompañado de un guía local de forma ordenada y regulada, sin impactos negativos sobre la anidación de las tortugas marinas (ver documentación e informes rendidos bajo fe de juramento); n. En la anidación del 22 al 28 de setiembre se realizaron cinco decomisos o hallazgos de huevos extraídos ilegalmente alcanzando un número de alrededor de 3.200 huevos (ver documentación e informes rendidos bajo fe de juramento); o. El SINAC emitió un comunicado de prensa oficial en donde se expusieron las regulaciones que establece el Reglamento de Uso Público del Refugio de manera que los visitantes estén mejor informados al respecto, el cual fue divulgado en el noticiero Telenoticias el jueves 24 de setiembre de 2015, bajo las siguientes regulaciones: “ 1.
El ingreso a la playa de anidación es permitido solo con un guía local autorizado. 2. El tamaño máximo de grupos es de 10 personas incluido el guía. 3. Solo se permite luz roja excepto luz blanca a personal de control y protección. 4. No se deben tocan manipular a las tortugas ni hacer ruidos o golpes que las afecten. 5. Se prohíbe la excavación y recolección de huevos, neonatos y cualquier subproducto de las tortugas marinas. 6. Se debe ingresar sin radios, grabadoras o cualquier equipo de sonido. 7. Las piedras conchas o cualquier otro producto animal o vegetal debe permanecer en la playa. 8. El ingreso de vehículos terrestres o acuáticos es permitido exclusivamente en caso de emergencias. 9. Se prohíben las fogatas, asadores y plantillas en la playa. 10. Las fotos deben ser sin flash o luces artificiales. 11. No existen áreas de acampar en la playa. 12. El ingreso debe ser sin maletas, maletines, mochilas o hieleras dentro de la playa. 13.
Se prohíbe el ingreso de personas bajo los efectos del licor o drogas 14. Este restringido e ingreso a la playa de mascotas y animales domésticos, incluyendo las cabalgatas. 15. Se prohíbe fumar. 16. Se prohíbe el surf y la natación durante las arribadas. 17. La recolección de huevos solo se permite a la Asociación de Desarrollo Integral de Ostional (ADIO) según las regulaciones establecidas. 18. El visitante que no acate estas disposiciones se le invitará a abandonar el Refugio”, y además se convocó a una reunión entre las dependencias y personas responsables (ver documentación e informes rendidos bajo fe de juramento).
III.Sobre el fondo. El presente amparo, los recurrentes acusan que el 4 de setiembre de 2015, como parte de una gira académica de la Universidad de Costa Rica, se apersonaron a la playa para observar la arribada de tortugas; sin embargo, encontraron una gran cantidad de personas tomando fotografías con todo tipo de aparatos electrónicos, obstruyendo el paso de las tortugas, lo cual ahuyentaba a las hembras, las cuales regresaban al mar sin anidar; y a altas horas de la noche del mismo día, se observó el ingreso de grupos de personas sin los respectivos guías estipulados en el Reglamento de uso público de Ostional, con focos de luz blanca, las cuales son prohibidas por el mismo (elenco fotográfico). Alegan que la misma situación continuó el 5 de setiembre siguiente, pese a la presencia de la Fuerza Pública, quienes indicaron que no era de su competencia regular dichos acontecimientos. En su criterio, la reglamentación citada posee vacíos, entre ellos la aplicación del principio precautorio y preventivo en materia ambiental. El amparo, se enfoca, entonces, desde la perspectiva de la protección del derecho al medio ambiente que implica salvaguardar el Refugio de actividades diversas a la de su conservación.
IV.En relación con la preservación de la belleza natural y del medio ambiente, así como de la vigilancia que sobre el particular debe ejercer el Estado, dispuso la Sala por sentencia # 5893-95 de las 9:48 horas del 27 de octubre de 1995:
“De todo lo anterior, es claro que es obligación del Estado la protección de la belleza natural y del medio ambiente (artículos 50 y 89 de la Constitución Política), pues en ello hay un evidente interés particular y social, fin que para poderlo alcanzar es necesario la promulgación de leyes que regulen en forma adecuada la materia. Ciertamente, el hombre tiene el derecho de hacer uso del ambiente para su propio desarrollo, pero también tiene el correlativo deber de protegerlo y preservarlo para el uso de generaciones presentes y futuras. Así por ejemplo, en la Conferencia de Estocolmo se afirma que "el hombre tiene el derecho fundamental a la libertad, la igualdad y el disfrute de condiciones de vida adecuadas en un medio de calidad tal que le permita llevar una vida digna y gozar de bienestar y tiene la solemne obligación de proteger y mejorar el medio para las generaciones presentes y futuras." No debe perderse de vista que el suelo, el agua, el aire, los recursos marinos, costeros y minerales, los bosques, la diversidad biológica y el paisaje conforman el marco ambiental sin el cual las demandas básicas como espacio vital, alimentación, energía, vivienda, sanidad y recreación serían imposibles.
De igual modo, nuestra economía también está íntimamente ligada al estado del ambiente y de los recursos naturales; así, por ejemplo, tanto la generación de divisas por explotación agrícola y turística, como el éxito de importantes inversiones e infraestructuras dependen, en última instancia, de la conservación de aquéllos. Por lo anterior, el Derecho Ambiental no debe asociarse sólo con la naturaleza, pues ésta es únicamente parte del ambiente. La política de protección a la naturaleza se vierte también sobre otros aspectos como la protección de la caza, de los bosques, de los parques naturales y de los recursos naturales. Se trata, entonces, de un concepto macroambiental, para no dejar conceptos importantes por fuera y así lograr unificar el conjunto jurídico que denominamos Derecho Ambiental.” El tema planteado en el recurso involucra, en este sentido, el derecho fundamental a un ambiente sano y ecológicamente equilibrado, en este caso concreto la protección a la fauna marina dentro de un refugio de conservación.
Al Estado le corresponde la responsabilidad ineludible de defender y preservar tal ambiente, que es patrimonio común de todos sus habitantes. También los particulares deben participar en su conservación y utilización sostenibles. La modificación de la naturaleza puede implicar un daño al medio ambiente, como el que aquí se denuncia, alegando que la administración ha incumplido su misión de garantizar, defender y preservar ese derecho.
V.El Refugio Nacional de Vida Silvestre Ostional fue declarado como tal mediante Decreto Ejecutivo # 13200-A, publicado en el Diario Oficial La Gaceta del 7 de enero de 1982, ratificado por la Ley de Fauna Silvestre, # 6919, de 1983, derogada en 1992 y sustituida por la Ley de Conservación de Vida Silvestre # 7317 del 7 de diciembre de 1992. En el Decreto Ejecutivo # 16531-MAG, publicado en La Gaceta del 26 de noviembre de 1985, se extendió los límites del Refugio hasta el sector de Punta Guiones. Esta delimitación fue ratificada en el Transitorio I de la Ley de Conservación de Vida Silvestre sobre la franja de los doscientos metros de la zona marítimo terrestre, y en el Decreto Ejecutivo # 22551-MIRENEM del 8 de octubre de 1993. El Refugio comprende los doscientos metros de la zona marítimo terrestre y tres millas marítimas de las aguas territoriales del sector comprendido entre Punta India hasta Punta Guiones, en el cantón de Nicoya, provincia de Guanacaste.
Mediante la Ley número 8325 del 28 de noviembre de 2002, se declaró de interés ecoturístico algunos de los sistemas de anidamiento y desove de tortugas marinas, dentro de los que se encuentra el Refugio Nacional de Vida Silvestre Ostional, y la Asociación de Desarrollo Integral de Ostional, conformada por vecinos de la zona, creó un plan en el cual se desarrollara una relación simbiótica, donde a cambio de brindar protección a las tortugas y a la zona, los pobladores pudiesen optar por un porcentaje de los huevos.
VI.Caso concreto. De los informes rendidos por las autoridades accionadas del Sistema Nacional de Áreas de Conservación y del Ministerio de Ambiente y Energía -que se tienen por dados bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto ha sido debidamente acreditado que el 03 de setiembre de 2015 en horas de la noche se dio una arribada de tortugas lora en el Refugio Nacional de Vida Silvestre Ostional, fenómeno que se da como una conducta de anidación masiva que se caracteriza por la gran concentración de hembras. Dicha arribada del 3 de setiembre de 2015, se extendió a lo largo de aproximadamente 3.8 km de playa. Además, se de un incremento de la anidación solitaria en el resto de los 7 km que conforman Playa Ostional y Playa Nosara. Ahora bien, pese a que la observación de la anidación de tortugas marinas en este sitio, es regulada en el Decreto Ejecutivo No. 32627-MINAE, Reglamento de Uso Público del Refugio Nacional de Vida Silvestre Ostional, esta Sala ha tenido por demostrado que durante la tarde del viernes 04 –fecha en la cual arribaron los recurrentes al Refugio Nacional de Fauna Silvestre de Ostional- y el sábado 05 a partir de alrededor de las 3 p.m. y el domingo 06 de setiembre desde las 5 p.m, se dio una gran arribada de tortugas al Refugio Nacional en cuestión, lo cual provocó una alta visitación turística que tomó por sorpresa a las autoridades del Ministerio de Ambiente y Energía, pues únicamente se contó con personal del ACT-SINAC (4 funcionarios), vigilantes de la Asociación de Desarrollo de Ostional (ADIO), 33 guías locales, 3 miembros de la Fuerza Pública y 3 miembros de la Policía Turística.
La arribada también fue monitoreada por dos grupos de investigadores. Debido a lo dicho, se concluye que la arribada del 3 al 5 de setiembre de 2015, contó con apenas un grupo de 50 colaboradores apoyando en todas las acciones de control y supervisión, los cuales no pudieron limitar el acceso de varios miles de personas que se apersonaron al sitio. Ahora bien, pese a que bajo criterio del Director del SINAC y el Director del Área de Conservación Tempisque, la visitación excesiva se dio principalmente en horas del día por lo que la perturbación sobre el hábitat de anidación tal como compactación de la arena que pudiera haber existido, se anuló con la anidación de las tortugas que llegaron durante la noche, dado que ellas mismas sobreexcavaron los nidos depositados en horas y días previos, lo cierto, es que según lo aceptan los accionados la visitación turística en masa los tomó por sorpresa y no contaron las capacidad locativa para contener el ingreso desmedido a la playa, ni menos aún, pudieron contar con el personal necesario que pudiera explicarles a los visitantes sobre las medidas y restricciones que se debían respetar para ingresar al Refugio Nacional de Vida Silvestre de Ostional y acercarse a las tortugas.
Lo cual se solventó con las medidas tomadas en la segunda arribada de tortugas lora, la cual se dio entre el 22 al 28 de setiembre de 2015, para la cual se estableció un operativo de abordaje en el cual se contó con el apoyo de 97 personas en total –prácticamente el doble de colaboradores que en la primera arribada del 3 al 5 de setiembre-, lo cual se desgloso de esta manera, 20 funcionario de SINAC, 10 efectivos da Grupo de Apoyo Operacional de la Fuerza Pública (GAO), 7 miembros de la Fuerza Pública de Santa Cruz, 3 miembros de la Policía de Tránsito, 3 miembros de la Policía Turística, 12 voluntarios de COVIRENAS y brigadistas, 30 guías turísticos locales y 12 miembros del cuerpo de vigilancia de la Asociación de Desarrollo Integral de Ostional (ADIO). Lo anterior, conlleva la estimatoria de este recurso, pues se ha tenido por demostrado que las autoridades responsables de la protección de la biodiversidad en el Refugio Nacional de Vida Silvestre de Ostional, en este caso el Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, omitieron tomar de forma previa y en resguardo del principio precautorio en materia ambiental, las medidas administrativas correspondientes para regular de manera efectiva el ingreso de particulares al refugio nacional citado con las medidas del caso, en la arribada recibida entre el 3 al 5 de setiembre de 2015, fechas en las cuales se contabilizaron más de 153.330 tortugas lora en la playa.
Si bien es cierto trataron de solventar la situación con una serie de medidas para la arribada acontecida del 22 al 28 de setiembre, a juicio de este Tribunal, dichas medidas son insuficientes si no se elabora un plan de acción y control a futuro para las próximas arribadas. Debido a lo expuesto, procede la estimatoria del recurso bajo las consideraciones que se dirán en la parte dispositiva.
VI.Respecto a la Fuerza Pública y a la Municipalidad de Santa Cruz. Según se observa de los informes aportados y la prueba adjunta, en primer plano respecto a la Fuerza Pública, se tiene que constituye un órgano coadyuvante al cual se le solicitó su colaboración en el sitio de forma tardía, y en ocasión, a la sorpresa por la cantidad de visitantes el día 4 de setiembre de 2015, por lo que no se aprecia una inercia administrativa en actuar, sino una falta de efectividad material del SINAC en coordinar un operativo de manera previa, y en consecuencia, respecto a la Fuerza Pública el recurso debe ser desestimado. Respecto a la Municipalidad de Santa Cruz, llevan razón el Presidente del Concejo y el Alcalde de la Municipalidad de Santa Cruz, en el sentido que si bien es cierto el Refugio Nacional de Vida Silvestre Ostional se ubica en la jurisdicción territorial de Santa Cruz, Guanacaste, su Plan de manejo no corresponde a esa Municipalidad, por lo que no tienen competencia para la reglamentación sobre su uso y manejo, pues lo citado es competencia del Sistema Nacional de Áreas de Conservación, por lo que en lo respecta al municipio accionado, el amparo también debe ser desestimado.
Los Magistrados Jinesta Lobo y Salazar Alvarado salvan el voto y declaran sin lugar el recurso por las razones siguientes:
Por tanto:
Se declara parcialmente con lugar el recurso, únicamente en cuanto a la alegada omisión del Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía en ejecutar las acciones y medidas respectivas con la finalidad de coordinar un operativo que hubiera sido eficaz para recibir la visitación turística en la arribada de la tortuga lora entre el 3 al 5 de setiembre de 2015, en el Refugio Nacional de Vida Silvestre Ostional. Lo anterior, en perjuicio del derecho a un ambiente sano y ecológicamente equilibrado, garantizado en el artículo 50 de la Constitución Política. Se le ordena a Patricia Madrigal Cordero, Viceministra de Ambiente y Energía, así como a Julio Jurado Fernández, Director Ejecutivo y a Nelson Marín Mora, Director Regional del Área de Conservación Tempisque, ambos del Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, que de manera inmediata establezcan un plan transitorio (o temporal) de acción para el ingreso ordenado de los diversos grupos de personas que recibe mensualmente el Refugio Nacional de Vida Silvestre Ostional, el cual deberá ser acorde con las reglas dispuestas en el Reglamento de Uso Público de Ostional.
De igual forma, se les ordena que en el plazo de tres meses, contados a partir de la notificación de esta sentencia, elaboren de forma coordinada y en conjunto con las dependencias que correspondan, un plan de acción o control preventivo para visitación de turistas al Refugio Nacional de Vida Silvestre Ostional, mismo plazo en el cual deberá implementarse con la finalidad de reforzar la protección al ambiente, y en especial, a la fauna marina de dicha área silvestre. Se advierte a Patricia Madrigal Cordero, Viceministra de Ambiente y Energía, así como a Julio Jurado Fernández, Director Ejecutivo y a Nelson Marín Mora, Director Regional del Área de Conservación Tempisque, ambos del Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, o a quienes ocupen esos cargos, que de no acatar la orden dicha, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo que respecta a la Fuerza Pública y a la Municipalidad de Santa Cruz, se declara sin lugar el recurso. Los Magistrados Jinesta Lobo y Salazar Alvarado salvan el voto y declaran sin lugar el recurso.
