Writ of amparo (recurso de amparo) processed under expediente number 15-17083-0007-CO, filed by [NOMBRE 01], identity card number [VALOR 01], against the CAJA COSTARRICENSE DE SEGURO SOCIAL.

Having considered:

  1. 1By a written submission received through the Chamber’s fax system at 8:53 on November 16, 2015, the petitioner filed a writ of amparo against the Caja Costarricense de Seguro Social. She states that she was referred for gallbladder surgery on September 4, 2014; however, to date she has neither been given an appointment nor received any communication. She considers that the Administration’s omission violates her right to health.
  2. 2By a Presidency order issued at 9:34 on November 17, 2015, the amparo proceeding was admitted and a report was requested from the Director General and the Head of the General Surgery Service, both of Hospital San Rafael de Alajuela. The respondent authorities and the treating physician were also ordered to evaluate the petitioner and determine the medical treatment to be followed until the Chamber ruled on the writ by judgment or ordered otherwise.
  3. 3By a written submission received through the Chamber’s fax system at 15:37 on November 25, 2015, Marcela Leandro Ulloa, in her capacity as Acting Director General of Hospital San Rafael de Alajuela, reports under oath that the petitioner was evaluated by the Surgery Service on September 4, 2014. She specifies that the petitioner was referred for cholelithiasis, reported no pain, and was issued an order for hospitalization for surgery. She adds that if the petitioner were to experience pain, she should go to the Emergency Service. She states that patients with cholelithiasis whose orders were entered in 2014 are currently undergoing surgery, and therefore it is likely that the petitioner will be scheduled and called in the coming months. She requests that the writ be denied.
  4. 4A certification issued by Judicial Technician 3 and the Secretary of the Chamber stated that the Head of the General Surgery Service of Hospital San Rafael de Alajuela failed to comply with the directive issued at 9:34 on November 17, 2015.
  5. 5The applicable legal requirements have been observed in the proceedings.

Justice Rueda Leal delivers the opinion; and,

Whereas:

I.Preliminary matter. Given that the Head of the General Surgery Service of Hospital San Rafael de Alajuela failed to submit the report within the period established by this Court in the order issued at 9:34 on November 17, 2015, the facts concerning that official are deemed true, and the constitutional analysis shall proceed on the basis of the petitioner’s statements and the report from the other respondent authority.

II.Subject matter of the writ. The petitioner considers that her right to health has been infringed because she requires gallbladder surgery; however, she is on a waiting list.

III. Proven facts. The following facts are deemed duly established and relevant to the disposition of this matter

a. The petitioner is 45 years old and is a patient of the Surgery Service of Hospital San Rafael de Alajuela (see the report submitted under oath by the respondent authority).

b. The petitioner was evaluated by the Surgery Service of the respondent hospital on September 4, 2014, where she was diagnosed with cholelithiasis and issued an order for hospitalization for surgery (as stated under oath by the respondent authority).

c. The surgery prescribed for the petitioner is not classified as requiring urgent resolution (as stated under oath by the respondent authority).

d. The petitioner is on a waiting list (see the report submitted under oath by the respondent authority).

IV.The specific case. Based on the foregoing considerations and the statements of the respondent authorities, the violation of the petitioner’s constitutional right to health has been established. The Administration must promptly and timely take the necessary actions to safeguard not only the health and lives of its users, but also a better quality of life. It has been established that the petitioner is 45 years old and is a patient of the Surgery Service of Hospital San Rafael de Alajuela. She was evaluated on September 4, 2014, when she was diagnosed with cholelithiasis and issued an order for hospitalization for surgery. The respondent authority reports that the prescribed surgery is not classified as requiring urgent resolution. She is currently on a waiting list. Because there is no definite date for the operation she requires and the condition adversely affects her quality of life, a violation of the petitioner’s right to health has been established. Under these circumstances, the writ must be granted.

V.Dissenting Opinion of Justice Cruz Castro. I depart from the majority opinion of the Chamber and would deny the writ because I consider that the Caja Costarricense de Seguro Social has not violated any fundamental right of the petitioner, as I have concluded in numerous similar cases. In this matter, not only is there no support from a medical professional regarding the need to perform the patient’s surgery urgently, but there is also no express medical opinion stating that the petitioner is at risk. Thus, rather than safeguarding the petitioner’s right to health, granting the amparo creates a risk of infringing the rights of other patients whose surgery dates would have to be changed to give priority to the petitioner.

VI.Documentation submitted in the expediente. The parties are advised that if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the court office within a maximum period of 30 business days from notice of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session number 27-11 of August 22, 2011, article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session number 43-12 held on May 3, 2012, article LXXXI.

Por tanto:

The writ is granted. Marcela Leandro Ulloa, in her capacity as Acting Director General of Hospital San Rafael de Alajuela, or whoever holds that position, is ordered to issue the appropriate directives and undertake all actions within the scope of her authority so that, within one month from notice of this judgment, the petitioner’s required surgery is performed under the strict responsibility and supervision of her treating physician, provided that no change in the patient’s medical circumstances contraindicates the procedure and that she has satisfied all preoperative requirements. Likewise, if necessary, her care must be coordinated with another hospital that has available capacity. The respondent authority is advised that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, imprisonment for three months to two years or a fine of twenty to sixty days shall be imposed on any person who receives an order issued in a writ of amparo proceeding that the person must comply with or enforce, and who fails to comply with or enforce it, provided that the offense is not subject to a more severe penalty.

The Caja Costarricense de Seguro Social is ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment in the administrative litigation proceedings (ejecución de sentencia de lo contencioso administrativo). This decision shall be personally served on Marcela Leandro Ulloa, in her capacity as Acting Director General of Hospital San Rafael de Alajuela, or whoever holds that position. Recurso de amparo que se tramita en el expediente número 15-17083-0007-CO, interpuesto por [NOMBRE 01], cédula de identidad número [VALOR 01], contra la CAJA COSTARRICENSE DE SEGURO SOCIAL.

Resultando:

  1. 1Por escrito recibido mediante el sistema de fax de la Sala a las 8:53 horas del 16 de noviembre de 2015, la accionante interpuso recurso de amparo contra la Caja Costarricense de Seguro Social. Manifiesta que desde el 4 de setiembre de 2014 fue remitida para cirugía de vesícula; sin embargo, a la fecha no se le ha otorgado cita, ni ha recibido comunicación alguna. Considera que la omisión de la Administración violenta su derecho a la salud.
  2. 2Por resolución de Presidencia de las 9:34 horas del 17 de noviembre de 2015, se dio curso al amparo y se solicitó informe al Director General y Jefe del Servicio de Cirugía General, ambos del Hospital San Rafael de Alajuela. Asimismo, se ordenó a las autoridades recurridas y al médico tratante valorar a la recurrente y determinar el tratamiento médico a seguir, hasta tanto la Sala no resolviera en sentencia el recurso, o no dispusiera otra cosa.
  3. 3Por escrito recibido mediante el sistema de fax de la Sala a las 15:37 horas del 25 de noviembre de 2015, informa bajo juramento Marcela Leandro Ulloa, en su condición de Directora General a.i. del Hospital San Rafael de Alajuela, que la accionante fue valorada en el Servicio de Cirugía el 4 de setiembre de 2014. Precisa que la recurrente fue referida por colelitiasis, no refirió dolor, y se le dio orden de internamiento para cirugía. Acota que si la accionante tuviera dolor debe acudir al Servicio de Emergencias. Sostiene que se están operando pacientes de colelitiasis que ingresaron la orden en el 2014, por lo que es probable que la recurrente sea programada y llamada en los próximos meses. Solicita que se declare sin lugar el recurso.
  4. 4Por constancia emitida por el Técnico Judicial 3 y Secretario de la Sala, se indicó que el Jefe del Servicio de Cirugía General del Hospital San Rafael de Alajuela, incumplió la prevención de las 9:34 horas del 17 de noviembre de 2015.
  5. 5En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Rueda Leal; y,

Considerando:

I.Cuestión preliminar. En vista de que el Jefe del Servicio de Cirugía General del Hospital San Rafael de Alajuela, omitió rendir el informe dentro del plazo fijado por este Tribunal en la resolución de las 9:34 horas del 17 de noviembre de 2015, se tienen por ciertos los hechos en lo que a ese funcionario atañe y se procede a analizar la constitucionalidad con base en lo expuesto por la accionante y el informe de la otra autoridad recurrida.

II.Objeto del recurso. La recurrente estima lesionado su derecho a la salud, toda vez que requiere ser intervenida quirúrgicamente de la vesícula; sin embargo, se encuentra en lista de espera.

III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

a. La accionante tiene 45 años de edad y es paciente del Servicio de Cirugía del Hospital San Rafael de Alajuela (ver informe rendido bajo juramento por la autoridad recurrida).

b. La recurrente fue valorada en el Servicio de Cirugía del hospital recurrido el 4 de setiembre de 2014, donde se le diagnosticó colelitiasis y se le dio orden de internamiento para cirugía (según indica bajo juramento la autoridad recurrida).

c. La cirugía prescrita a la accionante no es catalogada como de resolución urgente (según indica bajo juramento la autoridad recurrida).

d. La recurrente se encuentra en lista de espera (ver informe rendido bajo juramento por la autoridad recurrida).

IV.Sobre el caso concreto . A partir de los considerandos anteriores y de las manifestaciones de las autoridades recurridas, se acredita la vulneración del derecho constitucional a la salud de la accionante. La Administración debe ejecutar de manera pronta y oportuna las acciones necesarias para resguardar, no solo la salud y vida de sus usuarios, sino además una mejor calidad de vida. Se constata que la recurrente tiene 45 años de edad y es paciente del Servicio de Cirugía del Hospital San Rafael de Alajuela. Fue valorada el 4 de setiembre de 2014, donde se le diagnosticó colelitiasis y se le dio orden de internamiento para cirugía. La autoridad recurrida informa que la cirugía prescrita no es catalogada como de resolución urgente. Actualmente se encuentra en lista de espera. En la medida que no existe fecha cierta para que sea realizada la operación que requiere, y que el padecimiento incide negativamente en su calidad de vida, se verifica una violación al derecho a la salud de la accionante. Ante dicho panorama, lo procedente es acoger el recurso.

V.Voto Salvado del Magistrado Cruz Castro. Me separo de la opinión mayoritaria de la Sala y declaro sin lugar el recurso, pues considero que la Caja Costarricense de Seguro Social no ha vulnerado ningún derecho fundamental de la recurrente, tal como lo he considerado en numerosos casos similares pues, en este asunto, no solo se carece del respaldo de un profesional de medicina acerca de la necesidad de practicar la cirugía a la paciente en forma urgente, sino que además, no consta en forma expresa, el criterio médico de que la accionante corre riesgo. De este modo, más que salvaguardar el derecho a la salud de la recurrente, la estimatoria del amparo produce el riesgo de lesionar los derechos de otros pacientes, cuyas fechas de cirugía deban variarse para dar prioridad a la accionante.

VI.Documentación aportada al expediente . Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. Se ordena a Marcela Leandro Ulloa, en su condición de Directora General a.i. del Hospital San Rafael de Alajuela, o a quien ocupe ese cargo, que gire las órdenes pertinentes y lleve a cabo todas las actuaciones que estén dentro del ámbito de sus competencias, para que en el plazo de un mes contado a partir de la notificación de esta sentencia, se efectúe la cirugía que la accionante requiere, bajo estricta responsabilidad y supervisión de su médico tratante, siempre que una variación de las circunstancias médicas de la paciente no contraindiquen tal intervención y haya cumplido con todos los requerimientos preoperatorios. Asimismo, de ser necesario deberán coordinar su atención con otro centro hospitalario que tenga disponibilidad de espacios. Se advierte a la autoridad recurrida que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena a la Caja Costarricense de Seguro Social al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese esta resolución a Marcela Leandro Ulloa, en su condición de Directora General a.i. del Hospital San Rafael de Alajuela, o a quien ocupe ese cargo, en forma personal. El Magistrado Cruz Castro salva el voto y declara sin lugar el recurso.- Ernesto Jinesta L.
