Writ of amparo (recurso de amparo) filed by Sergio Emeryk Sequeira Marín, identity card number 1-626-785, against the Contraloría General de la República (CGR) and the Ministerio de Ambiente y Energía (MINAE).
Background:
Justice Rueda Leal authors the opinion; and,
Whereas:
I.Subject matter of the appeal. The appellant alleges that MINAE is pursuing the purchase of a weather radar for IMN; however, there is no technical or environmental study assessing the need for, benefits of, or environmental and human impacts that a specific X-band radar may have. He further contends that the installation of that radar on the roof of the respondent institute is located very close to the patients of Hospital Doctor Rafael Ángel Calderón Guardia.
II.Proven facts. The following facts are deemed duly established and relevant to the resolution of this matter, as they have been substantiated: a) through official letter number 084-2015-IMN of 24 de marzo de 2015, IMN submitted to CGR a request to make a direct purchase of a weather radar from Enterprise Electronics Corporations (see statements made under oath and evidence submitted); b) through official letter number 5851 (DCA-0958) of 27 de abril de 2015, CGR authorized IMN to conduct a competitive direct procurement process to acquire the radar, but did not authorize direct procurement from Enterprise Electronics Corporations (see statements made under oath and evidence submitted); c) through procurement procedure number 2015CD-000117-88800, the Institutional Procurement Office of MINAE processed the purchase of a weather radar; the aforementioned procurement procedure has now been completed, and an administrative appeal for reversal (recurso de revocatoria) has been filed against the award decision (see statements made under oath and evidence submitted); d) through official letter number 213-2015-IMN, the Director of IMN stated: “(…) With respect to environmental and human impacts, installing the X-band radar on the roof of the IMN headquarters was considered appropriate; the only environmental impact is the visual impact on the building.
Regarding the human impact, we consider it beneficial, since it protects human life through the establishment of early-warning systems for extreme rainfall and electrical storms, as well as monitoring the paths of volcanic ash, which currently poses an imminent risk at Volcán Turrialba. Furthermore, insofar as it is asserted that the X-band radar causes human impacts through the radar’s own operation, Decreto Ejecutivo Nº 36324-S of the Ministerio de Salud issued the ‘Regulations Governing Exposure to Electromagnetic Fields from Non-Ionizing Radiation Emitted by Wireless Systems with Frequencies of up to 300 GHZ.’ In this regard, Chapter V establishes the maximum permissible occupational exposure and safety limits and also regulates the scope of the uses specified therein, in accordance with the Unión internacional de Telecomunicaciones (UIT). Accordingly, the ranges established by manufacturers fall within the margins permitted under the aforementioned regulations (...).
According to the technical information submitted by the successful bidder, the radar’s emissions are within a range below the emission levels that could cause environmental and human impacts (...)” (see statements made under oath and evidence submitted); e) in the tender specifications for competitive direct procurement procedure Nº 2015CD-000117-88800, the Institutional Procurement Office of MINAE included the following requirement: “Health Certificate. A health certificate must be provided stating that the signal emitted by the radar system has no harmful effect whatsoever on persons, whether those providing technical support or those exposed to it, regardless of their distance from the radar,” a requirement that was accepted by the successful bidder in the aforementioned procurement procedure (see statements made under oath and evidence submitted).
III.The right to a healthy and ecologically balanced environment. In judgment number 2015-009900 at 09:20 on 03 de julio de 2015, this Chamber stated as follows: “On repeated occasions, the case law of this Chamber has recognized that public health and the right to a healthy and ecologically balanced environment are protected both constitutionally and under international law. It has held that the legitimate exercise of that right requires resources to be used rationally and that the State is responsible for protecting the environment in accordance with the precautionary principle (principio precautorio) governing environmental matters. This principle requires the State to take all necessary measures, within the scope permitted by law, to prevent irreversible environmental damage; to that end, it is responsible for creating favorable social conditions so that every person may enjoy health, this right being understood as a state of physical, psychological (or mental), and social well-being (see judgment Nº 180-98 at 16:24 on 13 de enero de 1998).
The State’s objective obligation regarding environmental protection does not necessarily entail a subjective right of individuals to demand through judicial bodies that a particular measure be taken, but it does entail a right to the adoption of measures suitable for safeguarding that right in the face of manifestly negligent conduct by public authorities or by natural or legal persons. Thus, the State assumes the obligation to regulate those areas of social life from which dangers to the physical existence of the inhabitants of its territory may arise, as well as those that harm the environment, which it may do through statutes, regulations, agreements, or other measures relating to administrative organization and procedures. Consequently, the possibility of judicially demanding, through an amparo proceeding (recurso de amparo), a specific type of affirmative action by the State in fulfillment of its duty to protect the life, health, or environmental rights of its inhabitants is limited to cases in which an imminent threat to those individual rights is clearly established.
It follows that intervention by the constitutional jurisdiction is viable only where it has been established that the State, through its competent bodies, has failed to address demands made by the country’s inhabitants in the exercise of their rights.”
IV.Regarding the specific case. In the case at bar (sub lite), the petitioner alleges that MINAE is promoting the purchase of a weather radar for IMN; however, there is no technical or environmental study assessing the necessity, benefits, or environmental and human impacts that a specific X-band radar may have. Furthermore, he maintains that the installation of that radar on the roof of the respondent institute is located very close to the patients of Hospital Doctor Rafael Ángel Calderón Guardia. In this regard, the Chamber deems it proven that, indeed, by official letter number 084-2015-IMN dated March 24, 2015, IMN submitted to CGR a request to make a direct purchase of a weather radar from Enterprise Electronics Corporations. Subsequently, through official letter number 5851 (DCA-0958) dated April 27, 2015, CGR authorized IMN to conduct a competitive direct procurement process (contratación directa concursada) to acquire the radar, but not to contract directly with Enterprise Electronics Corporations.
Accordingly, through procurement number 2015CD-000117-88800, the Institutional Procurement Office (Proveeduría Institucional) of MINAE processed the purchase of a weather radar; the aforementioned procurement has now been completed, and a motion for reconsideration (recurso de revocatoria) has been filed against the award decision (acto de adjudicación). Regarding the alleged absence of technical studies determining the risk that the radar could pose because of its proximity to Hospital Calderón Guardia, it should be noted that, through official letter number 213-2015-IMN, the Director of IMN stated: “(…) Regarding environmental and human impacts, the installation of the X-band radar on the roof of the IMN headquarters was deemed appropriate; the only environmental impact is the visual impact on the building. Regarding the human impact, we consider it beneficial because it safeguards human life through the establishment of early-warning systems for extreme rainfall and thunderstorms, as well as through the monitoring of volcanic ash trajectories, which, at present at Volcán Turrialba, pose an imminent risk.
Furthermore, if the reference is to human impacts generated by the inherent operation of the X-band radar, Executive Decree Nº 36324-S of the Ministry of Health issued the ‘Regulations Governing Exposure to Electromagnetic Fields from Non-Ionizing Radiation Emitted by Wireless Systems with Frequencies of up to 300 GHZ.’ In that regard, Chapter V establishes the maximum permissible occupational exposure and safety limits and also regulates the scope of the uses indicated therein, according to the International Telecommunication Union (UIT). Therefore, the ranges established by the manufacturers fall within the limits permitted under the aforementioned regulations (...). According to the technical information submitted by the successful bidder, the radar emissions are within a range below the emission levels capable of producing environmental and human impacts (...).” In addition, in the bidding specifications (cartel) for competitive direct procurement Nº 2015CD-000117-88800, the Institutional Procurement Office of MINAE requested the following requirement: “Health Certificate.
A health certificate must be provided stating that the signal emitted by the radar system has no harmful effect whatsoever on persons, whether those providing technical support or those exposed to it, regardless of their distance from the radar,” a requirement that was accepted by the successful bidder in the aforementioned procurement. Given these circumstances, the Chamber considers that the petition must be dismissed. The established facts show that the bidding specifications for the competitive direct procurement at issue specifically included an item or requirement concerning the submission of a health certificate stating that the signal emitted by the radar system has no harmful effect whatsoever on persons, and that certificate was provided by the successful bidder. Furthermore, in official letter number 213-2015-IMN, the Director of IMN emphasizes that the only environmental impact is the visual impact on the building; likewise, he clarifies that, according to the technical information submitted by the successful bidder, the radar emissions are within a range below the emission levels capable of producing environmental and human impacts.
On that understanding, the amparo petition (amparo) must be dismissed. If the protected party disagrees with the type of requirements established in the relevant bidding specifications to demonstrate the safety of the radar at issue, or believes that they are insufficient to protect public health, this is a matter of ordinary legality that may not be adjudicated in these constitutional proceedings. Thus, if the petitioner continues to disagree with the requirements or studies requested, he must bring his claims through the appropriate ordinary proceedings. Accordingly, this Court concludes that the amparo must be dismissed because no improper threat or risk to human health or the environment was established.

Recurso de amparo interpuesto por Sergio Emeryk Sequeira Marín, cédula de identidad número 1-626-785; contra la Contraloría General de la República (CGR) y el Ministerio de Ambiente y Energía (MINAE).
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
I.Objeto del recurso. El recurrente alega que el MINAE está promoviendo la compra de un radar meteorológico para el IMN; empero, no se cuenta con un estudio técnico ni ambiental que valore la necesidad, beneficios o impactos ambientales y humanos que un radar específico de Banda X pueda tener. Además, sostiene que la instalación de dicho radar en la azotea del instituto recurrido se encuentra muy cercana a los pacientes del Hospital Doctor Rafael Ángel Calderón Guardia.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, porque así han sido acreditados: a) mediante oficio número 084-2015-IMN del 24 de marzo de 2015, el IMN presentó ante la CGR una solicitud para realizar la compra directa de un radar meteorológico a la empresa Enterprise Electronics Corporations (ver manifestaciones rendidas bajo juramento y prueba aportada); b) mediante oficio número 5851 (DCA-0958) del 27 de abril de 2015, la CGR autorizó al IMN la realización del proceso de contratación directa concursada para adquirir el radar, no así la contratación directa con la empresa Enterprise Electronics Corporations (ver manifestaciones rendidas bajo juramento y prueba aportada); c) mediante contratación número 2015CD-000117-88800, la Proveeduría Institucional del MINAE tramitó proceso de compra de un radar meteorológico; actualmente, la mencionada contratación se llevó a cabo y sobre la misma se ha interpuesto recurso de revocatoria en contra del acto de adjudicación (ver manifestaciones rendidas bajo juramento y prueba aportada); d) mediante oficio número 213-2015-IMN, el Director del IMN indicó que: “(…) Con respecto a impactos ambientales y humanos, se consideró oportuna la instalación del radar de banda X en la azotea de la sede del IMN, el único impacto ambiental que se presenta es la visual en el edificio.
Con relación al impacto humano, consideramos que más bien es beneficioso porque resguarda la vida humana, gracias al establecimiento de sistemas de alerta temprana para lluvias y tormentas eléctricas extremas, así como el monitoreo de las trayectorias de las cenizas volcánicas, en este momento en el Volcán Turrialba, es un riesgo inminente. Por otra parte, si se hace referencia que el radar banda X genera impactos humanos por la acción propia del radar, mediante Decreto Ejecutivo Nº 36324-S del Ministerio de Salud, se emite el “Reglamento para regular la exposición a campos electromagnéticos de radiaciones no ionizantes, emitidos por sistemas inalámbricos con frecuencias de hasta 300 GHZ”. En ese sentido, en el Capítulo V se establecen los límites máximos permisibles de exposición y seguridad ocupacional, además regula los alcances en los usos ahí indicados, según la Unión internacional de Telecomunicaciones (UIT).
Por lo que los rangos establecidos por los fabricantes se encuentran dentro de los márgenes a utilizar según el reglamento mencionado (...). De acuerdo con la información técnica enviada por la empresa adjudicada, las emisiones del radar están en un rango por debajo de las emisiones que puedan producir impactos ambientales y humanos (...)" (ver manifestaciones rendidas bajo juramento y prueba aportada); e) en el cartel de la contratación directa concursada Nº 2015CD-000117-88800, la Proveeduría Institucional del MINAE solicitó el siguiente requerimiento: “Certificado de Salud. Se debe suplir un certificado de salud en donde indique que la señal emitida por el sistema del radar no tiene efecto perjudicial alguno en las personas, ya sea para las que le dan soporte técnico como para las que se vean expuestas al mismo, independientemente de la distancia a la que se encuentren del radar” , requisito que fue aprobado por la firma adjudicataria de la contratación mencionada (ver manifestaciones rendidas bajo juramento y prueba aportada).
III.Sobre el derecho a un ambiente sano y ecológicamente equilibrado. En sentencia número 2015-009900 de las 09:20 horas del 03 de julio de 2015, esta Sala indicó lo siguiente: “En reiteradas ocasiones, la jurisprudencia de esta Sala ha reconocido que la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos tanto a nivel constitucional como a través de la normativa internacional. Se ha indicado que el ejercicio legítimo de ese derecho requiere que los recursos sean utilizados de manera racional, y que corresponde al Estado la protección del ambiente, según el principio precautorio que rige en materia ambiental. Este principio obliga al Estado a disponer todo lo que sea necesario, dentro del ámbito permitido por la ley, a efectos de impedir que se produzcan daños irreversibles al ambiente, para cuyo efecto es responsable de lograr las condiciones sociales propicias a fin de que cada persona pueda disfrutar de su salud, entendido este derecho como una situación de bienestar físico, psíquico (o mental) y social (véase sentencia Nº 180-98 de las 16:24 horas del 13 de enero de 1998).
La obligación objetiva del Estado en materia de protección ambiental no apareja, ineludiblemente, un derecho subjetivo de las personas a exigir, a través de los organismos judiciales, que se tome una medida determinada, pero sí a que se adopten las que sean idóneas en tutela de ese derecho, ante actitudes abiertamente negligentes de las autoridades públicas, o bien, de personas físicas y jurídicas. De este modo, el Estado adquiere la obligación de regular las áreas de la vida social de las cuales puedan surgir peligros para la existencia física de los habitantes de su territorio así como también aquellas que vulneren el ambiente, lo cual puede hacer a través de leyes, reglamentos, acuerdos u otras medidas relacionadas con la organización y los procedimientos administrativos. En consecuencia, la posibilidad de exigir judicialmente, a través del recurso de amparo, un tipo específico de actividad prestacional por parte del Estado en cumplimiento de su deber de protección a la vida, salud o derecho al ambiente en beneficio de sus habitantes, está restringida a la clara verificación de un peligro inminente contra esos derechos de las personas.
De lo que se desprende que la injerencia de la jurisdicción constitucional solamente es viable ante la inercia comprobada del Estado, a través de sus órganos competentes, en atender las demandas que en ejercicio de sus derechos realicen los habitantes del país”.
IV.Sobre el caso concreto. En el sub lite , el recurrente acusa que el MINAE está promoviendo la compra de un radar meteorológico para el IMN; empero, no se cuenta con un estudio técnico ni ambiental que valore la necesidad, beneficios o impactos ambientales y humanos que un radar específico de Banda X pueda tener. Además, sostiene que la instalación de dicho radar en la azotea del instituto recurrido se encuentra muy cercana a los pacientes del Hospital Doctor Rafael Ángel Calderón Guardia. Al respecto, la Sala tiene por demostrado que, efectivamente, mediante oficio número 084-2015-IMN del 24 de marzo de 2015, el IMN presentó ante la CGR una solicitud para realizar la compra directa de un radar meteorológico a la empresa Enterprise Electronics Corporations. Posteriormente, a través del oficio número 5851 (DCA-0958) del 27 de abril de 2015, la CGR autorizó al IMN la realización del proceso de contratación directa concursada para adquirir el radar, no así la contratación directa con la empresa Enterprise Electronics Corporations.
Es así como mediante contratación número 2015CD-000117-88800, la Proveeduría Institucional del MINAE tramitó proceso de compra de un radar meteorológico; actualmente, la mencionada contratación se llevó a cabo y sobre la misma se ha interpuesto recurso de revocatoria en contra del acto de adjudicación. Ahora bien, en relación con la supuesta falta de estudios técnicos que determinen el riesgo que podría generar el radar por encontrarse cerca del Hospital Calderón Guardia, es preciso acotar que mediante oficio número 213-2015-IMN, el Director del IMN indicó que: “(…) Con respecto a impactos ambientales y humanos, se consideró oportuna la instalación del radar de banda X en la azotea de la sede del IMN, el único impacto ambiental que se presenta es la visual en el edificio. Con relación al impacto humano, consideramos que más bien es beneficioso porque resguarda la vida humana, gracias al establecimiento de sistemas de alerta temprana para lluvias y tormentas eléctricas extremas, así como el monitoreo de las trayectorias de las cenizas volcánicas, en este momento en el Volcán Turrialba, es un riesgo inminente.
Por otra parte, si se hace referencia que el radar banda X genera impactos humanos por la acción propia del radar, mediante Decreto Ejecutivo Nº 36324-S del Ministerio de Salud, se emite el “Reglamento para regular la exposición a campos electromagnéticos de radiaciones no ionizantes, emitidos por sistemas inalámbricos con frecuencias de hasta 300 GHZ”. En ese sentido, en el Capítulo V se establecen los límites máximos permisibles de exposición y seguridad ocupacional, además regula los alcances en los usos ahí indicados, según la Unión internacional de Telecomunicaciones (UIT). Por lo que los rangos establecidos por los fabricantes se encuentran dentro de los márgenes a utilizar según el reglamento mencionado (...). De acuerdo con la información técnica enviada por la empresa adjudicada, las emisiones del radar están en un rango por debajo de las emisiones que puedan producir impactos ambientales y humanos (...)".
Aunado a lo anterior, en el cartel de la contratación directa concursada Nº 2015CD-000117-88800, la Proveeduría Institucional del MINAE solicitó el siguiente requerimiento: “Certificado de Salud. Se debe suplir un certificado de salud en donde indique que la señal emitida por el sistema del radar no tiene efecto perjudicial alguno en las personas, ya sea para las que le dan soporte técnico como para las que se vean del radar” , requisito que fue aprobado por la firma adjudicataria de la contratación mencionada. Ante este panorama, la Sala considera que se debe declarar sin lugar el recurso. Del elenco de hechos probados se desprende que dentro del cartel de la contratación directa concursada en cuestión, se incluyó precisamente un rubro o requisito relacionado con la presentación de un certificado de salud que indique que la señal emitida por el sistema del radar no tiene efecto perjudicial alguno en las personas, mismo que fue aportado por la firma adjudicataria.
Además, en el oficio número 213-2015-IMN, el Director del IMN enfatiza en que el único impacto ambiental que se presenta es el visual en el edificio; del mismo modo, aclara que de acuerdo con la información técnica enviada por la empresa adjudicataria, las emisiones del radar están en un rango por debajo de las emisiones que puedan producir impactos ambientales y humanos. Bajo esa inteligencia, corresponde desestimar el amparo. Ahora bien, si el tutelado se encuentra disconforme con el tipo de requisitos solicitados dentro del cartel correspondiente para demostrar la seguridad del radar en cuestión, o bien, estima que son insuficientes para proteger la salud pública, es un tema de legalidad que no compete ser ventilado en esta vía constitucional. De este modo, de mantener el recurrente alguna discrepancia con los requisitos o estudios solicitados, deberá plantear sus reclamos en la vía ordinaria pertinente. Por lo anterior, este Tribunal concluye que debe desestimarse el amparo, ya que no se acreditó la amenaza o riesgo indebido para la salud de las personas o para el medio ambiente.
Por tanto:
