Mandatory legislative consultation on constitutionality (consulta legislativa preceptiva de constitucionalidad) submitted by the Directorio de la Asamblea Legislativa concerning the bill entitled “Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region,” legislative file (expediente legislativo) number 18.587.

Whereas (Resultando):

  1. 1The consultation, submitted in compliance with subsection a) of Article 96 of the Ley de la Jurisdicción Constitucional, was received by the Secretariat of the Sala at sixteen hours and twenty-five minutes on veintitrés de junio de dos mil quince, together with a certified copy of the legislative file. The Presidency of the Sala deemed the consultation filed by a ruling issued at ten hours and six minutes on veinticuatro de junio del dos mil quince. The deadline for responding to it expires on veintitrés de Julio del año en curso.
  2. 2The formalities established by law were observed in the proceedings.

Magistrado Cruz Castro is the author of the opinion; and, Considerations (Considerando):

I.Preliminary matter (De previo).- The first step required in responding to the consultation is to verify the procedures followed in this case, in accordance with Article 98 of the Ley de la Jurisdicción Constitucional, which provides that the consultation must be submitted after the bill has been approved in the first debate and before its final approval, and that, when responding to it, the Sala shall issue an opinion on any aspects or grounds it deems relevant from a constitutional standpoint, although its opinion shall be binding only with respect to procedural matters. For the foregoing purposes and because of the importance of the matter at issue, the following consideration provides a chronological summary of the bill.

II.The processing of file number 18.587 in the Asamblea Legislativa.- The consulted bill, “Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region,” which is being processed under legislative file No. 18.587, followed the chronological sequence set out below:

  • a)Costa Rica is a party to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region, the “Cartagena Convention,” which was approved by Law number 7227 of 22 de abril de 1991 and published in the Diario Oficial La Gaceta N|91 of 15 de mayo de 1991. The “Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region” was signed by Costa Rica on 06 de octubre de 1999 in Oranjestad, Aruba (File number 18587, folios 02 and 05).
  • b)At 10:25 hours on 25 de setiembre del 2012, the bill entitled “Approval of the Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region,” introduced by the Poder Ejecutivo, was submitted to the Secretaría del Directorio de la Asamblea Legislativa (folios 1 and following of the legislative file); c) On the same 25 de setiembre de 2012, the bill entitled “Approval of the Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region,” introduced by the Poder Ejecutivo, was presented to the Asamblea Legislativa and referred to the Comisión Permanente de Asuntos Relaciones Internacionales y de Comercio Exterior for consideration (folio 40 of the legislative file); d) On 01 de noviembre de 2012, a true copy of file N°18.587 was delivered to the Departamento de Estudios, Referencias y Servicios Técnicos, in accordance with Article 118 of the Reglamento de la Asamblea Legislativa ((folio 41 of the legislative file); e) In Supplement N°187 to La Gaceta N°226 of 22 de noviembre de 2012, the bill entitled “Approval of the Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region” was published (Diario Oficial, La Gaceta, N° 226 of 22 de noviembre de 2012).
  • f)On 23 de noviembre de 2012, the Comisión Permanente de Asuntos Relaciones Internacionales y de Comercio Exterior received the bill in question from the Departamento de Archivo (folio 43 of the legislative file).
  • g)On 05 de abril de 2013, the Directora de Departamento de Servicios Técnicos de la Asamblea Legislativa forwarded to the Comisión de Relaciones Internacionales y Comercio Exterior the consolidated legal and socio-environmental report (informe integrado jurídico-socioambiental) on the bill entitled “Approval of the Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region” (folios 46 to 67 of the legislative file).
  • g)In the minutes of session N°3 of 12 de junio de 2014, the Comisión de Relaciones Internacionales y Comercio Exterior referred the file for consultation to the Ministerio de Ambiente y Energía, the Ministerio de Relaciones Exteriores, and the Secretaría Técnica Nacional Ambiental-Setena (folio 75 of the legislative file).
  • h)By Executive Decree N°38542-MP, the Asamblea Legislativa was convened for special sessions beginning on 01 de agosto de 2014 so that bill 18587 could be considered (folios 104 and 109 of the legislative file).
  • i)In the minutes of session N° 11, the Comisión de Relaciones Internacionales y Comercio Exterior referred file 18587 for consultation to the Ministerio de Hacienda and the Ministerio de Planificación Nacional y Política Económica (folios 121 and 125 of the legislative file).
  • j)In the minutes of session N°18 of 25 de setiembre de 2014, during the second period of ordinary sessions, the Comisión de Relaciones Internacionales y Comercio Exterior approved the Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region and issued an affirmative majority report (dictamen de mayoría afirmativo) (folios 172, 176, 177, and 180 to 215 of the legislative file).
  • k)On 13 de octubre de 2014, the Comisión Permanente Especial de Relaciones Internacionales y Comercio Exterior delivered to the Secretaría del Directorio the affirmative majority report on the bill entitled Approval of the Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region (folios 216 and 217 of the legislative file).
  • l)On 12 de mayo de 2015, Diputada Natalia Díaz Quintana requested that the Secretaría del Directorio place on the agenda and continue processing the bill entitled Approval of the Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region (folio 218 of the legislative file).
  • m)At ordinary session N°024 of 15 de junio de 2015, substantive discussion (discusión por el fondo) of legislative file N°18587 began as part of the first-debate proceedings (folios 219 and 221 of the legislative file).
  • n)On 16 de junio de 2015, the Director de la Secretaría de la Asamblea Legislativa delivered to the Comisión Permanente Especial de Redacción the file for the bill entitled Approval of the Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region, which had been approved in the first debate at ordinary session N°24 of 16 de junio de 2015 (folios 236 and 237 of the legislative file).
  • o)On 17 de junio de 2015, during the first period of ordinary sessions, the final wording of the Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region was approved, and file number 18.587 was sent to the Secretaría del Directorio so that its processing could continue (folios 291 to 324 of the legislative file).
  • p)By order of 22 de junio d5 2015, the Directorio de la Asamblea Legislativa forwarded to the Sala Constitucional file N°18.587, “Approval of the Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region” (acknowledgment of receipt, 23 de junio de 2015, legislative file, Volume II).

III.The procedure in this specific case.- The Sala must first determine whether the constitutional provisions governing the approval of an agreement of this nature were observed. In general terms, based on the foregoing and on an analysis of the procedure, it may be inferred that the approval of the bill under consultation complied with all procedural provisions that the Constitución Política (Articles 7, 121 subsection 4), 124, and 140 subsection 10)) and the Reglamento de la Asamblea Legislativa (Articles 85 subsection ch), 113, 117, 119, 121, 122, 129, 132, 134, and 143) require the bodies involved in the execution and approval of international treaties—principally the Poder Ejecutivo and the Asamblea Legislativa—to follow. The bill was submitted to the Asamblea Legislativa by the Poder Ejecutivo, represented by the Ministro de la Presidencia. It was referred to the Comisión Permanente de Relaciones Internacionales y de Comercio Exterior for study, and the Ministros de Ambiente y Energía, Relaciones Exteriores, Hacienda, and Planificación Nacional y Política Económica, as well as the Secretaría Técnica Nacional Ambiental-Setena, were given a hearing and an opportunity to present their views concerning it.

Once the legal technical report (dictamen técnico jurídico) had been issued without raising any constitutional objection to the bill under review, the Comisión Permanente Especial de Relaciones Internacionales y Comercio Exterior approved by affirmative majority report the bill entitled “Approval of the Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region,” being processed under legislative file N°18.587, which was delivered on 13 de octubre de 2014 to the Secretaría del Directorio (folio 216 of the legislative file). Once the record was received, substantive discussion began as part of the first-debate proceedings for legislative file N°18.587, and it was approved at ordinary session N°024 of 15 de junio de 2015 (folios 219 and 221 of the legislative file). Accordingly, this Constitutional Court finds no substantial or material procedural defect in the approval process for the bill approving the “Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region,” being processed under legislative file N°18.587, that would invalidate the bill.

IV.Observations on the substance of the bill. The bill approving the “Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region,” which is being processed under legislative file N°18.587, constitutes an international instrument signed on 06 de octubre de 1999 in Oranjestad, Aruba (File number 18587, pages 02 and 05). It seeks to implement a series of measures to prevent, reduce, and control the negative impact on the environment and human health caused by pollution from land-based sources and activities in the Wider Caribbean Region. It is one of the three protocols to the Cartagena Convention, the environmental legal agreement binding the Wider Caribbean Region in the protection and development of the environment, which has two additional protocols: the Protocol Concerning Cooperation in Combating Oil Spills and the Protocol Concerning Specially Protected Areas and Wildlife (FTCM, its acronym in Spanish). Costa Rica is a party to the Protocol Concerning Cooperation in Combating Oil Spills, approved by Ley N°7227 of 22 de abril de 1991, but is not a party to the other protocols.

The Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region contains nineteen articles and four annexes. Article 1 establishes definitions for the purposes of the Protocol. Article 2 sets forth provisions of general application. Article 3 establishes the obligations of the contracting parties (partes contratantes) to prevent, reduce, and control pollution in the area of application of the Convention and to ensure sound environmental management (ordenación racional del medio), using for these purposes the most practicable means at their disposal and in accordance with their capabilities. Article 4 refers to the Annexes to the Protocol. Annex I establishes a list of sources, activities, and pollutants of specific concern to the Wider Caribbean Region. Annex II establishes the process for developing controls for specific regional sources identified in Anexo 1 or other sources, as determined by the contracting parties.

Annex III, entitled Domestic Wastewater, provides regional effluent limits for controlling wastewater discharged into and affecting the marine environment. Annex IV is entitled Non-Point Sources of Agricultural Pollution and provides for the development of national plans to control pollutants originating from agricultural areas and the raising of domestic animals. Article 5 governs cooperation and assistance among the contracting parties in fulfilling their obligations. Article 6 establishes the duty of the contracting States to formulate and implement monitoring and assessment programs (programas de monitoreo y evaluación). Article 7 states the duty of the contracting parties to formulate and adopt guidelines concerning environmental impact assessments (evaluaciones de impacto ambiental). Article 8 states that information systems must be developed at the subregional, regional, or global level in order to facilitate implementation of the Protocol.

Article 9 establishes the communication that must take place between the parties if the pollution is transboundary (transfronteriza). Article 10 establishes the obligation to promote public access to information and documentation concerning pollution in the area of application of the Convention. Article 11 states the duty to formulate and implement environmental education and awareness programs (programas de educación y concientización ambientales) for the public. Article 12 governs the submission of reports containing data on the measures adopted and the results achieved in implementing the Protocol. Article 13 governs the institutional mechanisms to be implemented by the contracting party that assumes liaison functions with the organization. Article 14 establishes a scientific, technical, and advisory committee composed of one qualified expert representing each contracting party. It also establishes a list of functions.

Article 15 governs the ordinary and extraordinary meetings held by the contracting parties. Article 16 provides for the financing of activities related to the Protocol. Article 17 establishes mechanisms for the adoption and entry into force of new annexes and amendments thereto. Article 18 establishes rules on ratification, acceptance, approval, and accession, and the final Article 19 provides for the signing of this Protocol.

In light of the foregoing, this Court finds no issues concerning the substance of the treaty that, at a general level, could be deemed harmful to the Political Constitution.-

V.Conclusion. Based on the foregoing paragraphs, this Chamber concludes that none of the matters analyzed, as interpreted in this judgment, reveals any formal or substantive constitutional defects concerning the bill approving the “Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region,” which is being processed under legislative file number 18.587.

The mandatory consultation (consulta preceptiva) is answered to the effect that the procedure followed for the bill approving the “Protocol Concerning Pollution from Land-Based Sources and Activities to the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region,” which is being processed under legislative file number 18.587, is not unconstitutional. As to its substance, the bill is deemed not to infringe the Law of the Constitution (Derecho de la Constitución). Consulta legislativa preceptiva de constitucionalidad formulada por el Directorio de la Asamblea Legislativa, sobre el proyecto de «Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe», expediente legislativo número 18.587.

Resultando:

  1. 1La consulta, que se formula en cumplimiento de lo que establece el inciso a) del artículo 96 de la Ley de la Jurisdicción Constitucional, fue recibida en la Secretaría de la Sala a las dieciséis horas veinticinco minutos del veintitrés de junio de dos mil quince, con una copia certificada del expediente legislativo. La Presidencia de la Sala tuvo por presentada la consulta mediante resolución de las

las diez horas y seis minutos del veinticuatro de junio del dos mil quince. El término para evacuarla vence el día veintitrés de Julio del año en curso.

  1. 2En el procedimiento se cumplió con las formalidades establecidas en la ley.

Redacta el Magistrado Cruz Castro; y,

Considerando:

I.De previo .- Lo primero que procede, a los efectos de evacuar la consulta, es verificar los trámites seguidos en este caso, en concordancia con lo que señala el artículo 98 de la Ley de la Jurisdicción Constitucional, al disponer que la consulta deberá hacerse después de aprobado el proyecto en primer debate y antes de la aprobación definitiva y que, al evacuarla, la Sala dictaminará sobre cualesquiera aspectos o motivos que estime relevantes desde el punto de vista constitucional, pero vinculante sólo en lo que se refiere a los trámites. Para los efectos anteriores y por la importancia del asunto de que se trata, en el siguiente considerando se hará una síntesis cronológica del proyecto de ley.

II.La tramitación del expediente número 18.587 en la Asamblea Legislativa.- El proyecto de de ley consultado «Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe»el cual se tramita en el expediente legislativo No. 18.587, ha seguido el siguiente orden cronológico:

  • a)Costa Rica es parte del Convenio par la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe, “Convenio de Cartagena”, que fue aprobado por la ley número 7227 del 22 de abril de 1991 y fue publicado en el Diario Oficial La Gaceta N|91 del 15 de mayo de 1991. El «Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe», fue firmado por Costa Rica el 06 de octubre de 1999 en Oranjestad, Aruba (Expediente número 18587, folios 02 y 05).
  • b)A las 10:25 horas del 25 de setiembre del 2012, el proyecto de ley «Aprobación del Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe», que es iniciativa del Poder Ejecutivo, fue presentado a la Secretaría del Directorio de la Asamblea Legislativa (folios 1 y siguientes del expediente legislativo); c) El mismo 25 de setiembre de 2012 fue presentado a conocimiento de la Asamblea Legislativa el proyecto de ley «Aprobación del Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe», iniciativa del Poder Ejecutivo; y trasladado a conocimiento de la Comisión Permanente de Asuntos Relaciones Internacionales y de Comercio Exterior (folios 40 del expediente legislativo); d) El 01 de noviembre de 2012 se procedió a la entrega de una copia fiel del expediente N°18.587 al Departamento de Estudios, Referencias y Servicios Técnicos, de conformidad con el artículo 118 del Reglamento de la Asamblea Legislativa ((folios 41 del expediente legislativo); e) En el Alcance N°187 de la Gaceta N°226 del 22 de noviembre de 2012, fue publicado el proyecto «Aprobación del Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe», (Diario Oficial, La Gaceta, N° 226 del 22 de noviembre de 2012).
  • f)El 23 de noviembre de 2012 la Comisión Permanente de Asuntos Relaciones Internacionales y de Comercio Exterior recibe del Departamento de Archivo, el proyecto en cuestión (folio 43 del expediente legislativo).
  • g)El 05 de abril de 2013, la Directora de Departamento de Servicios Técnicos de la Asamblea Legislativa remite a la Comisión de Relaciones Internacionales y Comercio Exterior, el informe integrado jurídico-socioambiental del proyecto de ley «Aprobación del Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe» (folio 46 a 67 del expediente legislativo).
  • g)En acta de sesión N°3 de 12 de junio de 2014 la Comisión de Relaciones Internacionales y Comercio Exterior envía a consulta el expediente al Ministerio de Ambiente y Energía, al Ministerio de Relaciones Exteriores y a la Secretaría Técnica Nacional Ambiental-Setena (folio 75 del h) Por decreto ejecutivo N°38542-MP se convoca a sesiones extraordinarias a la Asamblea Legislativa a partir del 01 de agosto de 2014 a fin de que se conozco el proyecto de ley 18587 (folio 104 y 109 del expediente legislativo).
  • i)En acta de sesión N° 11 la Comisión de Relaciones Internacionales y Comercio Exterior envía a consulta el expediente 18587, a los Ministerios de Hacienda y al de Planificación Nacional y Política Económica (folios 121 y 125 del expediente legislativo).
  • j)En acta de sesión N°18 de 25 de setiembre de 2014, en segundo período de sesiones ordinarias, la Comisión de Relaciones Internacionales y Comercio Exterior aprueba el Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe y rinde dictamen de mayoría afirmativo (folios 172 y 176, 177 y 180 a 215 del expediente legislativo) k) El 13 de octubre de 2014, la Comisión Permanente Especial de Relaciones Internacionales y Comercio Exterior, entrega a la Secretaría del Directorio el dictamen afirmativo de mayoría del proyecto Aprobación del Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe (folios 216 y 217 del expediente legislativo).
  • l)El 12 de mayo de 2015, la Diputada Natalia Díaz Quintana, solicita a la Secretaría del Directorio, que ponga a despacho y continúe el trámite del proyecto de ley Aprobación del Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe (folio 218 del m) En sesión ordinaria N°024 de 15 de junio de 2015 se dio inicio a la discusión por el fondo en el trámite de primer debate del 221 del expediente legislativo).
  • n)El 16 de junio de 2015 el Director de la Secretaría de la Asamblea Legislativa entrega a la Comisión Permanente Especial de Redacción el expediente del proyecto de ley Aprobación del Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe, aprobado en primer debate en sesión ordinaria N°24, de 16 de junio de 2015 (folios 236 y 237 del expediente legislativo).
  • o)El 17 de junio de 2015, en el primer período de sesiones ordinarias, se aprueba la redacción final del Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe y se envía a la Secretaría del Directorio el expediente número 18.587 para que continúe su trámite respectivo (folios 291 a 324 del expediente legislativo).
  • p)Por el auto de 22 de junio d5 2015, el Directorio de la Asamblea Legislativa remite a la Sala Constitucional el expediente N°18.587 “Aprobación del Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe” (acuse de recibido, 23 de junio de 2015, expediente legislativo, Tomo II).

III.El procedimiento en el caso concreto.- Corresponde a la Sala analizar, en primer lugar, si se han respetado las disposiciones constitucionales relativas a la aprobación de un convenio de esta naturaleza. En términos generales, a partir de lo dicho en el punto anterior, y del análisis que se hace del procedimiento es posible inferir que la aprobación del proyecto en consulta ha respetado todas las disposiciones procedimentales que la Constitución Política (artículos 7, 121 inciso 4), 124, 140 inciso 10) y el Reglamento de la Asamblea Legislativa (artículos 85 inciso ch), 113, 117, 119, 121, 122, 129, 132, 134 y 143) le ordenan seguir a los órganos involucrados en la suscripción y aprobación de los tratados internacionales: el Poder Ejecutivo y la Asamblea Legislativa, básicamente. El proyecto fue presentado a la Asamblea Legislativa por parte del Poder Ejecutivo, representado por el Ministro de la Presidencia.

Fue pasado a estudio a la Comisión Permanente de Relaciones Internacionales y de Comercio Exterior para su estudio, se dio audiencia y participación a los Ministros de Ambiente y Energía, Relaciones Exteriores, Hacienda y al de Planificación Nacional y Política Económica; así como a la Secretaría Técnica Nacional Ambiental-Setena, para técnico jurídico, sin objeción de constitucionalidad alguna al proyecto de estudio, fue aprobado por la Comisión Permanente Especial de Relaciones Internacionales y Comercio Exterior por dictamen afirmativo de mayoría el proyecto de ley " proyecto «Aprobación del Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe», que se tramita en el expediente legislativo N°18.587, el que fue entregado el 13 de octubre de 2014 a la Secretaría del Directorio (folio 216 del expediente legislativo).

Una vez recibidos los autos se dio inicio a la discusión por el fondo en el trámite de primer debate del expediente legislativo N°18.587 y fue aprobado en sesión ordinaria N°024 de 15 de junio de 2015 (folios 219 y 221 del expediente legislativo). De esta forma, este Tribunal Constitucional no advierte que en el trámite de aprobación del Proyecto de Ley de aprobación del «Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe», que se tramita en el algún vicio sustancial o de trascendencia que invalide el proyecto.

IV.Observaciones en cuanto al fondo del proyecto. El proyecto de aprobación del «Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe», que se tramita en el expediente legislativo N°18.587, constituye un instrumento internacional que se suscribió el 06 de octubre de 1999 en Oranjestad, Aruba (Expediente número 18587, folios 02 y 05). Busca implementar una serie de medidas para prevenir, reducir y controlar, el impacto negativo en el medio ambiente y la salud humana, por la contaminación procedente de fuentes y actividades terrestres en la Región del Gran Caribe. Es uno de los tres protocolos de Convenio de Cartagena, que es el acuerdo legal ambiental que vincula a la Región del Gran Caribe en la protección y desarrollo del medio ambiente y que cuenta con dos protocolos más: El Protocolo relativo a la Cooperación para Combatir los Derrames de Hidrocarburos y el Protocolo relativo a las Áreas y a la Flora y Fauna Silvestres Especialmente Protegidas (FTCM por sus siglas en español). Costa Rica es parte del Protocolo relativo a la Cooperación para Combatir Derrames de Hidrocarburos, aprobado mediante la Ley N°7227 del 22 de abril de 1991, pero no así de los otros protocolos.

El Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe, contiene diecinueve artículos y cuatro anexos. El artículo 1 establece definiciones para fines del Protocolo. El numeral 2 dispone disposiciones de aplicación general. El artículo 3 establece las obligaciones de las partes contratantes para prevenir, reducir y controlar la contaminación de la zona de aplicación del Convenio y para asegurar una ordenación racional del medio, utilizando a estos efectos los medios más viables de que dispongan y en la medida de sus posibilidades. El artículo 4 remite a los Anexos del Protocolo. El Anexo I establece una lista de fuentes, actividades y contaminantes de interés específico para la Región del Gran Caribe. El anexo II establece el proceso para desarrollar controles sobre fuentes específicas regionales identificadas en el Anexo 1 u otras fuentes, según lo determinado por las partes contratantes.

El anexo III, se titula Aguas residuales domésticas y proporciona los límites de efluentes regionales para el control de la aguas residuales que se descargan y afectan el ambiente marino. El Anexo IV se titula Fuentes no puntuales de contaminación agrícola, y contempla la elaboración de planes nacionales para el control de los contaminantes provenientes de áreas agrícolas y cría de animales domésticos. El numeral 5 regula la cooperación y asistencia entre las partes contratantes para el cumplimiento de las obligaciones. El artículo 6 establece el deber de los Estados contratantes de formular y ejecutar programas de monitoreo y evaluación. El numeral 7 indica el deber de las partes contratantes de formular y adoptar directrices relativas a las evaluaciones de impacto ambiental. El numeral 8 indica que se deben desarrollar sistemas de información, ya sea a nivel subregional, regional o a nivel mundial, a fin de facilitar la aplicación del protocolo.

El artículo 9 establece la comunicación que debe darse entre las partes si la contaminación es transfronteriza. El numeral 10 dispone la obligación de promover el acceso público a la información y documentación relativas a al contaminación de la zona de aplicación del Convenio. El numeral 11 indica el deber de formular y ejecutar programas de educación y concientización ambientales para el público . El artículo 12 regula la presentación de informes con datos sobre las medidas adoptadas y los resultados obtenidos en la aplicación de Protocolo. El artículo 13 regula los mecanismos institucionales que debe implementar la parte contratante que asume funciones de enlace con la organización. El artículo 14 establece un comité científico, técnico y asesor que estará integrado por un experto calificado que representa de cada parte contratante. Asimismo establece un listado de funciones. El numeral 15 regula las reuniones ordinarias y extraordinarias que celebran las partes contratantes.

El artículo 16 estipula el financiamiento para las actividades relacionadas con el Protocolo. El numeral 17 establece mecanismos de adopción y entrada en vigor de nuevos anexos y enmiendas a los mismos. El artículo 18 establece normas de ratificación, a aceptación, aprobación y adhesión y el 19 último la rúbrica del presente protocolo.

De lo expuesto, no encuentra este Tribunal, en cuanto al fondo del tratado, que existan –a nivel general- cuestiones que puedan entenderse como lesivas de la Constitución Política.-

V.Conclusión . A partir de lo expuesto en los párrafos que anteceden, esta Sala llega a la conclusión de que en ninguno de los aspectos analizados, en la forma como fueron interpretados en esta sentencia, es posible observar vicios formales o sustanciales de constitucionalidad, respecto del proyecto de aprobación del "Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe” que se tramita en el expediente legislativo número 18.587

Por tanto:

Se evacua la consulta preceptiva en el sentido que el trámite seguido por el proyecto de aprobación del "Protocolo relativo a la Contaminación procedente de Fuentes y Actividades Terrestres del Convenio para la Protección y el Desarrollo del Medio Marino de la Región del Gran Caribe” que se tramita en el expediente legislativo número 18.587, no resulta inconstitucional. En cuanto al fondo, se estima que el proyecto de ley no infringe el Derecho de la Constitución. Comuníquese al Directorio de la Asamblea Legislativa y a los diputados consultantes.
