The Chamber denied the action and left in place the provision allowing the aerial no-spray buffer to be reduced to 30 meters when the prescribed buffer-zone and technical conditions are met.
SummaryResumen
The Constitutional Chamber denied the action challenging Article 1 of Executive Decree No. 34202, which permits the no-spray buffer between crops and population centers, homes, farms, or other sensitive areas to be reduced from 100 to 30 meters when a reforested buffer zone exists and technical conditions are met. The majority found that the new regulation incorporated scientific support, control technologies, and requirements distinguishing it from the provision annulled in Judgment No. 16276-2006. The ruling reaffirms the constitutional importance of health, a healthy environment, state oversight, and the precautionary principle, but it did not find the reform unconstitutional. Two justices dissented because they considered that the risks inherent in a polluting activity involving toxic substances persisted and that lowering the prior level of protection was impermissible. Two others clarified that a manifest conflict between a regulation and a statute may raise a constitutional issue, although they found no such conflict proven here.
Key excerptExtracto clave
In addition to all the foregoing, there is constitutional recognition of the fundamental right to health and the requirements deriving from that recognition for both public authorities and private parties when carrying out any activities capable of endangering it; accordingly, the Administration has been granted specific powers and duties concerning the conduct of those activities. In this regard, the reasons offered on this occasion by the majority of the Constitutional Court to justify the conformity of Article 1 of Executive Decree No. 34202 of May 21, 2007 with constitutional law do nothing to justify the change of criterion that has occurred in this specific case, which has affected the full enjoyment of the rights protected by Articles 21 and 50 of the Political Constitution and, particularly, the precautionary principle governing environmental law.

Also participating in the action are LA PROCURADURÍA GENERAL DE LA REPÚBLICA, EL MINISTERIO DE SALUD, EL MINISTERIO DE AGRICULTURA Y GANADERÍA, and EL MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES. Also participating in these proceedings is the GENERAL JUDICIAL ATTORNEY-IN-FACT (APODERADO GENERAL JUDICIAL) OF EMPRESA CORPORACIÓN BANANERA NACIONAL S.A. (CORBANA), as a PASSIVE INTERVENOR (COADYUVANTE PASIVO).
FINDINGS:
The authors are recognized researchers, scientists, and experts in the field at the Latin American level. The research shows that the reduction of the buffer zone (área de amortiguamiento) to 30 meters is justified because technological advances have minimized the impact of aerial spraying (aspersión aérea) to the point that it does not impair the right to life, health, and a healthy and ecologically balanced environment. The most important aspects related to safe aerial application (aplicación aérea) are application precision and drift management (manejo de la deriva). The term drift (deriva) is defined as the movement, outside the cultivation area, of airborne liquid particles in the form of droplets or vapor at the time of application. Although extensive scientific and technical information exists on the subject, including information issued by the Organización de las Naciones Unidas para la Agricultura y la Alimentación (FAO), the United States Agencia de Protección del Ambiente (EPA), the State of California, the Asociación Nacional de Aviación Agrícola (NAAA), and a consortium of associations with expertise in the field (SPRAY DRIFT TASK FORCE), a group of Costa Rican experts conducted studies for the purpose of validating the information from these organizations. 9º- This study examines the Costa Rican situation in greater depth, including aspects such as the use of products having, at most, moderate toxicity, which largely guarantees respect for people’s health and lives and has enabled the banana industry to obtain environmental certifications without which it could not export to international markets.
They likewise emphasize that, since 2000, spraying can be performed using satellite and digital technologies through GPS (Global Position System), and that the software used in aerial spraying has become more sophisticated and refined, allowing the sprayers to open and close at the established boundaries of the aerial application zone, preventing the pilot from spraying outside those boundaries and, with an average margin of error of 0.9 meters, significantly reducing risks to the environment and to human life and health while minimizing costs. The studies demonstrated the need to update the legislation in accordance with technological advances, which have provided a precision guidance system and improved drift management, involving the interaction of several factors such as appropriate application techniques, proper equipment use, suitable meteorological conditions during application, the type of product formulation, and the establishment of buffer zones.
Accordingly, the measures necessary to minimize the risk of human error are virtually guaranteed. 10.- Based on advances in science and technology, duly substantiated by studies and research, the Poder Ejecutivo has decided to regulate aerial spraying by adding to Article 70 of Decreto Ejecutivo Nº 31520-MS- MAG -MOPT-MGPSP, “Reglamento para las actividades de Aviación Agrícola”, dated October 16, 2003, under the terms specified by the Sala Constitucional, in order to comply with the principle of the right to a healthy and ecologically balanced environment by requiring the use of appropriate application techniques so as to prevent particles from falling outside the plantation perimeter. Measures for reducing the potential danger of drift include: flight altitude, flight speed, droplet size, nozzle type, equipment calibration, satellite positioning equipment, spray-boom length, management of meteorological conditions, product type, and buffer zones, in order to ensure that agricultural production is conducted in harmony with the environment and the constitutional rights of individuals, thereby safeguarding their health, their lives, and their surroundings.
(…)”. It maintained that it is incumbent upon the Tribunal Constitucional, in light of the foregoing recitals (considerandos) and the studies, evidence, and technical justification provided by the ministries afforded a hearing in this action, to determine whether a sufficient technical and scientific basis existed that, in this case, served as the grounds for issuing Decreto No. 34202. It stated that, regarding the other two constitutional objections raised in Sentencia No. 16276-2006, Decreto No. 34202 does appear to address the specification of both pesticide application doses and the parameters governing the conditions under which such application is to take place. It noted that it may therefore be presumed that, because those conditions have been specifically defined, the competent authorities, including the Ministerio de Salud, the Ministerio de Agricultura y Ganadería, and the Ministerio de Obras Públicas y Transportes, will be able to verify compliance with them in practice.
It added that, on this matter, the Reglamento para la actividades de la Aviación Agrícola itself imposes on those ministries the duty to ensure faithful compliance with the provisions of both that regulatory instrument and, within their respective areas of responsibility, the Ley de Protección Fitosanitaria, the Ley General de Salud, and the Ley General de Aviación Civil; for that purpose, they may also adopt the measures and impose the penalties prescribed by those laws. It stated that those ministerial bodies, in turn, have other powers, such as suspending an operation when it is determined that products are being applied over water sources or that aircraft are flying over population centers, as well as detaining agrochemicals that are not authorized for aerial application (Articles 96 and 97 of the aforementioned regulations). In accordance with the arguments set forth above, it recommended dismissing this constitutional challenge (acción de inconstitucionalidad), unless it is found—notwithstanding the applicants’ deficient substantiation based on factual rather than legal circumstances—that no technical studies support the challenged provisions or that such studies are insufficient or unreasonable to sustain them.
Justice Jinesta Lobo is the authoring Justice; and,
WHEREAS:
Pursuant to artículo 75, párrafo 2°, of the Ley de la Jurisdicción Constitucional, a prior case pending resolution shall not be required when, due to the nature of the matter, there is no individual and direct injury, or when the case concerns the defense of diffuse interests (intereses difusos) affecting the community as a whole. In this regard, this Constitutional Court, in Voto No. 8239-01 de las 16:07 hrs. de 14 de agosto de 2001, addressed diffuse interests in the following terms:
“(…) Under the first of the circumstances contemplated in párrafo 2° of artículo 75 of the Ley de la Jurisdicción Constitucional, the challenged provision must not be susceptible to specific application that would subsequently permit the implementing act to be challenged and then used as the underlying case. (...) Second, the possibility of seeking relief in defense of diffuse interests is contemplated (...) Although difficult to define and even more difficult to identify, diffuse interests cannot under our law—as this Chamber has already stated—be merely collective interests; nor may they be so diffuse that their holders are indistinguishable from the national community as a whole, or so specific that particular persons or identifiable groups are identified or readily identifiable in relation to them, whose standing would derive not from diffuse interests but from corporate interests affecting a community as a whole.
They are, therefore, individual interests that are simultaneously dispersed among more or less extensive and amorphous groups of persons who share an interest and consequently suffer actual or potential harm that is more or less the same for all. It is therefore rightly said that these are equal interests belonging both to the groups situated in particular circumstances and, at the same time, to each person within them. In other words, diffuse interests have a dual nature: they are collective because they are common to a broad class, yet also individual, and may therefore be asserted as such. (...) In short, diffuse interests are those held by groups of persons who are not formally organized but are united by a particular social need, a physical characteristic, their ethnic origin, a particular personal or ideological orientation, the consumption of a certain product, etc. (…)”.
In the present matter, the petitioners assert standing through abstract constitutional review (control de constitucionalidad abstracto) and invoke the defense of diffuse interests, since they seek to protect health and the environment. Consequently, these circumstances give the petitioners direct standing (legitimación directa) to institute this proceeding because, as stated, they invoke the defense of interests affecting the national community as a whole, namely the rights to health and to enjoy a healthy and ecologically balanced environment, protected respectively by artículos 21 y 50 of the Constitution (Carta Magna). Accordingly, the present constitutional challenge may properly be heard and decided.
The petitioners challenge artículo 1° of Decreto Ejecutivo No. 34202 de 21 de mayo de 2007, which reduces from 100 to 30 metros the required distance between the field to be treated and any road, population center, dwelling, building occupied by workers, water source, adjoining crop, or neighboring property for purposes of conducting aerial pesticide applications. They contend that this provision specifically presents the following constitutional defects: a) violation of the fundamental rights to health and the environment, because the distance reduction lacks any technical or scientific basis; and b) violation of the principles of hierarchy of laws (principios de jerarquía de las normas) and legality, because the provision in question contradicts numerales 1°, 2°, 7°, 38, 262, 264 y 275 of the Ley General de Salud—Ley No. 5395—and 1°, 50 y 51 of the Ley Orgánica del Ambiente—Ley No. 7554—.
This constitutional challenge contests artículo 1° of Decreto Ejecutivo No. 34202 de 21 de mayo de 2007, which amends numeral 70 of Decreto Ejecutivo No. 31520, known as Reglamento para las actividades de Aviación Agrícola, de 16 de octubre de 2003. The challenged provision expressly states as follows:
“Artículo 70 of Decreto Ejecutivo Nº 31520-MS-MAG-MOPT-MGPSP, ‘Reglamento para las actividades de Aviación Agrícola’, del 16 de octubre del 2003, is hereby amended by adding the following to the first paragraph:
“The distance may be reduced from 100 to 30 meters if a buffer zone (zona de amortiguamiento) is provided and the following conditions are met:
IV.ON THE TECHNICAL BASIS FOR REDUCING THE DISTANCE FOR AERIAL PESTICIDE APPLICATIONS AND THE ALLEGED VIOLATION OF THE FUNDAMENTAL RIGHTS TO HEALTH AND THE ENVIRONMENT. First, the petitioners contend that, without any technical basis and in clear violation of the fundamental rights enshrined in Articles 21 and 50 of the Political Constitution, Article 1 of Decreto Ejecutivo No. 34202 de 21 de mayo de 2007 reduced the distance that must exist—between the field to be treated and any road, population center, dwelling, building in which personnel work, water source, and adjacent crops or neighboring farms—from 100 to 30 meters for the purpose of carrying out aerial pesticide applications. The petitioners maintain that the decree in question has the same deficiencies as the former Article 70 of Decreto Ejecutivo No. 31520 de 16 de octubre de 2003, the content of which was declared unconstitutional by the Sala Constitucional pursuant to Voto No. 16276-2006, because it was determined that there was no technical or scientific basis justifying the reduction of the distance from 100 to 30 meters for carrying out the aforementioned aerial spraying.
Notwithstanding the foregoing, this Constitutional Court does not find that the interested parties are correct in this case. An analysis of Decreto Ejecutivo No. 34202 de 21 de mayo de 2007 makes it abundantly clear that the reduction of the distance in question for carrying out aerial pesticide spraying—that is, from 100 to 30 meters—is indeed based on and justified by technical and scientific criteria and studies conducted for that purpose. Thus, it should be noted that the recitals (considerandos) of the Executive Decree in question expressly stated the following:
“(…) 6º —That, because of a lack of technical and scientific grounds for reducing the spraying area, the Sala Constitucional, through voto 2006-16276 del 8 de noviembre 2006 against (sic) Articles 24, 54, 68, 70, and 71 of the Reglamento para las Actividades de Aviación Agrícola, Decreto Ejecutivo Nº 31520-MS-MAG-MOPT-MGPSP, del 16 de octubre del 2003, partially sustained the action and partially annulled (sic) Article 70, leaving only the first paragraph in force, but not the second and third paragraphs. The basis of the ruling is that, where the right to a healthy and ecologically balanced environment enshrined in Article 50 of the Constitution is concerned, any reduction must be based on scientific and technical criteria demonstrating that the new measure is harmless to the environment.
7º—That, from the very moment the constitutional challenge (acción de inconstitucionalidad) was filed, before any judgment had been issued, CORBANA and the Executive Branch, in compliance with the Precautionary Principle (Principio Precautorio) established in the Costa Rican legal system and provided for by in the (sic) Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo, known as the Declaración de Río, under which prevention seeks to anticipate the negative effects of human activity and ensure the protection, conservation, and proper management of resources, decided to initiate a series of scientific and technical studies intended to establish the current state of science and aerial-spraying technology and to demonstrate that reducing the distance from 100 to 30 meters where buffer zones exist will not affect the environment or the health or lives of individuals, as well as to establish requirements for conducting aerial-spraying activities so that they may be properly monitored and supervised.
8º—That, in compliance with the precautionary principle of environmental law (Derecho ambiental), in this year 2007 a scientific study initiated when the Constitutional Challenge was filed was completed, identified as follows: Roberto Valenciano Mora, Sergio Laprade Coto, Álvaro Fournier Leiva y Eduardo Trejos Obando “Manejo de la deriva en las aplicaciones aéreas de fungicidas en fincas que poseen zonas de amortiguamiento” (Revista Investigaciones CORBANA, San José, 2007, Separata Nº 1). The authors are recognized researchers, scientists, and experts in the field at the Latin American level. The research shows that reducing the buffer area to 30 meters is justified because technological advances have minimized the impact of aerial spraying to the point that it does not impair the rights to life, health, and a healthy and ecologically balanced environment. The most important aspects related to safe aerial application are application precision and drift management.
The term drift is defined as the movement, outside the crop area, of liquid particles in the air in the form of droplets or vapor at the time of application. Although extensive scientific and technical information exists on the subject, including information issued by the Organización de las Naciones Unidas para la Agricultura y la Alimentación (FAO), the Agencia de Protección del Ambiente (EPA) de Estados Unidos, the Estado de California, the Asociación Nacional de Aviación Agrícola (NAAA), and a consortium of expert associations in the field (SPRAY DRIFT TASK FORCE), a group of Costa Rican experts conducted studies to validate the information from these Organizations.
9º—That this study examines the Costa Rican context in greater depth in such matters as the use of products having, at most, moderate toxicity, which largely ensures respect for the health and lives of individuals and qualifies the banana industry for environmental certifications without which it could not export to international markets. They likewise emphasize that, since 2000, spraying can be performed using satellite and digital technologies through GPS (Global Position System), and that the software used in aerial spraying has become more sophisticated and refined, allowing the sprayers to open and close at the established boundaries of the aerial-application zone, preventing the pilot from spraying outside those boundaries and, with an average margin of error of 0.9 meters, significantly reducing risks to the environment and to human life and health, while minimizing costs. The studies demonstrated the need to update the legislation in accordance with technological advances, which have provided a precision guidance system and improved drift management involving the interaction of several factors, such as appropriate application techniques, proper equipment use, suitable meteorological conditions during application, the type of product formulation, and the establishment of buffer zones. Accordingly, the measures needed to minimize the risk of human error are virtually guaranteed.
Moreover, it should be emphasized that the aforementioned study entitled “Drift Management in Aerial Fungicide Applications on Farms with Buffer Zones” —which was added to the case file— expressly states the following in its conclusions:
“1. There is sufficient information at the national and international levels indicating that drift management (manejo de la deriva) in pesticide applications must be carried out through application practices and not exclusively through distances.
2. The application techniques and practices associated with reducing drift in banana plantations in Costa Rica meet and exceed the recommendations of the United States Environmental Protection Agency (USEPA), the “Spray Drift Task Force (SDTF),” and the Food and Agriculture Organization of the United Nations (FAO).
3. Drift must be managed through appropriate weather conditions, such as a wind speed that must not exceed 15 km/h, with the wind direction being away from sensitive areas.
4. The average droplet size of the application mixture must be between 200 and 300 um.
5. The flight altitude must not exceed 5 m above the crop canopy, and the length of the spray boom must not exceed 80% of the wing length.
6. A 30-meter buffer zone (zona de amortiguamiento), planted with trees taller than the crop, is one of the best methods for minimizing drift, since the trees act as a barrier against the movement of pesticides beyond the application area.
7. The technology available in Costa Rica makes it possible to perform aerial pesticide applications precisely and directly on the target crop, with the assurance that neither people nor the environment will be harmed.” Hence, in the opinion of this Chamber, the omissions and lack of technical and scientific studies that were indeed identified by this constitutional jurisdiction in Voto No. 16276-2006 at 14:56 hrs. on 8 de noviembre de 2006, regarding the distance reduction established by the now-annulled section 70 of Decreto Ejecutivo No. 31520 of 16 de octubre de 2003, have now been remedied through Decreto Ejecutivo No. 34202. Because Decreto Ejecutivo No. 34202 is based on scientific studies that justify the distance reduction at issue, this Constitutional Court finds no violation of the fundamental rights to health and to a healthy and ecologically balanced environment.
V.That said, as a separate matter, it should be clarified to the petitioners that this Constitutional Chamber is not a technical body in the subject matter discussed above and therefore lacks jurisdiction—as they request—to conduct an in-depth analysis of the aforementioned technical and scientific criteria and thereby determine whether, on that basis, the reduction of the distance established for aerial pesticide applications is appropriate. In this regard, in Judgment No. 14948-2007 at 14:58 hrs. on 16 de octubre de 2007, this Constitutional Court explained the following:
“(…) A) Regarding the Constitutional Chamber’s lack of jurisdiction to determine the number of active ingredients (principios activos) that must undergo bioequivalence testing (pruebas de bioequivalencia): The issue raised is that requiring therapeutic-equivalence testing (pruebas de equivalencia terapéutica) for only seven active ingredients in multisource medicinal products (medicamentos multiorigen) posing a health risk is insufficient, and that more or all of them should be tested. In this regard, the claim is inadmissible before this constitutional court, because this Court lacks jurisdiction to determine whether the number should be seven, thirty, or forty. Furthermore, the health authorities do not state that the number or quantity of active ingredients subject to bioequivalence testing poses a danger to health, essentially because the list must be progressively expanded. Accordingly, it is not for this Chamber to determine whether limiting the requirement to only seven multisource pharmaceutical products posing a health risk, and therefore making them the only multisource pharmaceutical products (generic medicines) that may be required to undergo equivalence testing before registration, entails a health risk or danger to human health.
Furthermore, this Chamber notes that, under article 29 of the aforementioned decreto n°28466-S—and in accordance with WHO criteria—there are three groups of generic medicines that, because of their characteristics, merit different treatment: those requiring in vivo therapeutic-equivalence studies as a prerequisite for registration; those that, while not requiring in vivo studies, do require proof of in vitro therapeutic equivalence; and, finally, those that do not require proof of therapeutic equivalence. It is not possible in these constitutional proceedings to assess and determine which generic medicines belong to each category. For these reasons, because the specialized and politically responsible authority on the matter has established that seven products is a reasonable number, this Constitutional Court cannot issue a favorable or unfavorable ruling in that regard, because it is not a technical body in this field and there is no evidence conclusively establishing that requiring bioequivalence testing for more active ingredients affords greater protection of the right to health, or, conversely, that requiring such testing for fewer active ingredients affords less protection of the right to health.
As stated, determining the number is a matter of administrative discretion (criterio de oportunidad), on the understanding that this determination does not endanger health, in light of the authorities’ statements (…) Accordingly, this matter is the political responsibility of the respondents, and this Chamber cannot express an opinion on the decision as to which or how many medicines must undergo testing. The Chamber has indeed already held (see voto 2001-12226) that registering multisource medicinal products posing a health risk without therapeutic-equivalence studies is unconstitutional; however, it cannot now be asserted that designating only seven medicines as posing a health risk—and therefore requiring only those seven to undergo such therapeutic-equivalence testing—is likewise unconstitutional, because the number of substances requiring testing to protect health cannot be disputed in these proceedings.
In the prior ruling, the action was granted because no testing whatsoever was being conducted; but now that it has been determined that seven active ingredients must undergo testing, the constitutional analysis can go no further. Indeed, on what grounds, other than a mere a contrario sensu presumption based on the statements of the competent authorities, could the Chamber say that designating only seven active ingredients—the only ones subjected to therapeutic-equivalence testing—is insufficient? Thus, because there are no determinative criteria for stating that the number should be seven, fourteen, twenty-one, or more—other than the opinion of the politically responsible body, which has already determined that it should be seven—it is not possible to issue any ruling in this regard. (…) In conclusion, this Constitutional Chamber is not the court responsible for deciding such a technical issue as the one under discussion, nor does it have sufficient grounds to conclude that reducing the number to seven products violates the right to health (…).” (Emphasis not in the original).
(See, to similar effect, Votos Nos. 11114-2001 at 12:53 hrs. on 26 de octubre de 2001, 14349-2005 at 09:14 hrs. on 21 de octubre de 2005, 11343-2007 at 09:36 hrs. on 10 de agosto de 2007, 3216-2009 at 10:08 hrs. on 27 de febrero de 2009, and 12282-2011 at 11:23 hrs. on 9 de septiembre de 2011).
Moreover, the petitioners contend that there is an inconsistency between the provisions of article 1° of Decreto Ejecutivo No. 34202 of 21 de mayo de 2007 at issue and the express provisions of sections 1°, 2°, 7°, 38, 262, 264, and 275 of the Ley General de Salud -Ley No. 5395-, and sections 1°, 50, and 51 of the Ley Orgánica del Ambiente -Ley No. 7554-. In this regard, this Constitutional Court has repeatedly held that ex novo regulation or an ultra vires defect in a regulatory provision constitutes a matter of ordinary legality that must be heard and decided by the Contentious-Administrative Jurisdiction (Jurisdicción Contenciosa Administrativa), established in article 49 of the Constitución Política for the express purpose of ensuring the legality of administrative action, including the exercise of regulatory authority (potestad reglamentaria) in a manner consistent with the law. Thus, on this specific issue, this Chamber has issued extensive case law stating the following:
“(...) Sole Ground: Inadmissibility of the action because it concerns matters of mere legality. In essence, this action is limited to challenging the conflict that the petitioner claims exists between section 2.16.2 of the “Operational Manual for the Regulations on Travel and Transportation Expenses for Public Officials” of the Ministerio de Trabajo y Seguridad Social and article 38 of the Código de Trabajo. Although the petitioner believes that this conflict of norms constitutes an infringement of the constitutional powers assigned to the Poder Ejecutivo by article 140, subsections 3) and 18), of the Constitution and of the restrictions on the exercise of public powers that comprise the principle of legality (principio de legalidad) set forth in article 11 ibidem, the fact remains that the issue does not present a genuine constitutional conflict, except indirectly or by implication. On repeated occasions (for example, in Judgment number 2000-01149 at 15:39 horas on 2 de febrero del 2000), this Chamber has held that determining whether a regulatory provision violates or exceeds the provisions of a statute is a matter of legality that does not fall within this jurisdiction. Article 49 of the Carta Fundamental assigns review of the legality of the State’s administrative action to the contentious-administrative jurisdiction, not to the constitutional jurisdiction. If this Chamber were to use actions of unconstitutionality to review the various potential instances in which the principle of legality may be infringed in administrative offices, it would, in practice, supplant the courts having jurisdiction over those matters—contrary to the constitutional text. Consequently, if the petitioner considers the challenged regulatory provisions unlawful, the petitioner may, if so desired, assert those rights before the aforementioned contentious-administrative jurisdiction. (...).” (Voto No. 14901-2006 at 14:47 hrs. on 10 de octubre de 2006). (See, to the same effect, Judgment No. 13458-2006 at 10:17 hrs. on 8 de septiembre de 2006).
In view of the foregoing background and because this is a matter of legality, the action filed must be dismissed with respect to this issue.
Finally, it is necessary to clarify for the petitioners that this Chamber, through an action of unconstitutionality (acción de inconstitucionalidad), lacks jurisdiction to analyze the remaining arguments raised, namely, those concerning: 1) the absence, on most banana farms, of buffer zones (zonas de amortiguamiento), as well as the required distances between water springs (nacientes de agua), streams, and brooks and the area used for agricultural plantations; 2) the banana companies’ failure to comply with the legal system (ordenamiento jurídico), particularly regarding aerial spraying; 3) the conditions under which agricultural products, especially bananas, are cultivated; and 4) the negative impact of aerial spraying on water resources. This is because, as can be seen, the petitioners refer to factual situations that fall outside the strictly legal analysis conducted through an action of unconstitutionality, pursuant to Articles 73 et seq. of the Law on Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional). Accordingly, the petitioners may, if they deem it appropriate, pursue the ordinary legal remedies available for that purpose.
In view of the foregoing, this action of unconstitutionality must be dismissed.

es/801 Dissenting opinion of Justices Armijo Sancho and Cruz Castro, drafted by the former: With the utmost respect for the majority of the Constitutional Court, the undersigned Justices disagree with the reasoning set forth by the Chamber in judgment No. 2012-11064 of 16:31 hrs. on 14 de agosto de 2012, which holds that the provisions of Article 1 of Decreto Ejecutivo No. 34202 of 21 de mayo de 2007 do not violate Constitutional Law, particularly the rights protected by Articles 21 and 50 of the Political Constitution. In this regard, the undersigned Justices reiterate the position adopted in judgment No. 2006-16276 of 14:46 hrs. on 8 de noviembre de 2006, which declared unconstitutional Article 70 of the Regulations for Agricultural Aviation Activities (Reglamento para las Actividades de Aviación Agrícola), Decreto Ejecutivo No. 31520-MS-MAG-MOPT-MGSP of 16 de octubre de 2003, insofar as it provides:
“That strip may be reduced to a minimum of 30 metros if, between the field to be treated and the specified sites, there are buffer zones reforested preferably with native species, provided that pesticides of no more than moderate toxicity are also applied and that the application is conducted under appropriate conditions regarding flight altitude, particle size, and wind speed that, taken together, reduce spray drift, and provided that the aircraft has equipment suitable for that purpose and flies parallel to the buffer zone. If the application is conducted perpendicular to that zone, an additional strip of no less than 40 metros must be left within the crop, in which pesticides may not be applied by airplane in order to reduce the effect of drift; the corresponding area may be treated by helicopter or another method that ensures drift control. The pesticide-free application strip may be omitted in the case of internal roads or pathways used exclusively for the crop to be treated, provided that there are no dwellings and none of the circumstances referred to in the first paragraph of this article arise.” This provision has content similar to the provision challenged on this occasion, namely, Article 1 of Decreto Ejecutivo No. 34202 of 21 de mayo de 2007, which reduced from 100 to 30 metros the distance that must exist between the field to be treated and any road, population center, dwelling, building occupied by workers, water source, or adjacent crop or neighboring property for the purpose of conducting aerial pesticide applications.
In this regard, it must be recognized, as it was in judgment No. 2006-16276, that this Chamber has extensively developed the scope of the fundamental right to a healthy and ecologically balanced environment, as reflected in judgment number 2003-06322 of fourteen minutes past fourteen hours on tres de julio del dos mil tres, without prejudice to other subsequent expansions and qualifications from which a series of parameters and principles are derived, summarized as follows:
1. the State’s obligation to guarantee, defend, and safeguard this right, whereby the State becomes the guarantor of environmental and natural-resource protection and safeguarding. It must secure and protect that right against any risk or necessity; to defend means to bar, prohibit, and prevent any activity that infringes the right; and to preserve means to take action intended to shield the right in advance from possible dangers so that it may endure for future generations. The State must adopt the dual conduct of acting and refraining from acting: on the one hand, it must refrain from itself infringing the right to a healthy and ecologically balanced environment, and on the other, it must undertake the task of issuing measures that ensure compliance with constitutional requirements” (judgment number 9193-2000, of sixteen hours and twenty-eight minutes on diecisiete de octubre del dos mil).
2. the oversight and supervision of environmental matters and activities constitute an essential function of the State under the provisions of Article 50 of the Constitution; 3. the principle of rational resource use, to ensure the necessary balance between the country’s development and the right to the environment; 4. the principle of environmental quality, under which environmental quality is a fundamental parameter of quality of life, as are health, food, work, housing, and education, among others; 5. the precautionary principle (principio precautorio): One of the essential principles comprising environmental law is the “precautionary principle,” or the “principle of prudent avoidance” (principio de la evitación prudente), as contained in the United Nations Conference on Environment and Development, Rio Declaration, under which prevention seeks to anticipate adverse effects and ensure the protection, conservation, and proper management of resources.
Consequently, the guiding principle of prevention is based on the need to take and adopt all precautionary measures to prevent or contain potential harm to the environment or human health; 6. the requirement to conduct an environmental impact study (estudio de impacto ambiental) before commencing works and activities that may cause measurable environmental damage and pollution, such as the presence of toxic substances or external elements that create adverse environmental conditions both for biological diversity—including flora and fauna—and, above all, for human life, as reflected in human health or well-being—soil, habitat, air, water, etc.; the impact of these elements requires scientific evaluation and treatment; 7. the obligation of State institutions to comply with environmental legislation in their ordinary activities; 8. the rule that only a declared state of necessity exempts compliance with environmental standards; 9. the principle that a lack of financial resources on the part of public institutions is not an excuse justifying the failure to protect environmental rights; 10. the principle of coordination among the various public agencies to guarantee environmental protection.- To all the foregoing must be added the constitutional recognition of the fundamental right to health and the requirements arising from that recognition for both public authorities and private parties in the conduct of any activities that may endanger it.
Accordingly, the Administration has been vested with specific powers and obligations concerning the performance of those activities. Thus, regarding the scope of Article 70 of the Regulations for Agricultural Aviation Activities, Decreto Ejecutivo No. 31520-MS-MAG-MOPT-MGSP of 16 de octubre de 2003, the Constitutional Chamber held in judgment No. 2006-16276 that:
“Although Article 70 establishes a 100 metros aerial no-application strip, it nevertheless permits the strip to be reduced to 30 metros if, between the field to be sprayed and the houses, communities, and other locations, there are buffer zones reforested with native species, provided that pesticides of moderate toxicity are applied and that the application is conducted under flight-altitude, particle-size, and wind-speed conditions that reduce drift, and provided that the aircraft has equipment for that purpose and flies parallel to the buffer zone. The Chamber has held that the precautionary principle must be applied in these cases (see, among others, judgment number 7294-98), particularly considering that there is no scientific or technical basis justifying the reduction of the strip. The challenged Regulations do not specify the permitted percentages of pesticide drift and establish the possibility of reducing the application strip to 30 metros, subject to toxicity, weather, and flight conditions that cannot even be monitored in advance by the public authority.
This endangers the fundamental rights to health and to a healthy and ecologically balanced environment because it involves a polluting activity using toxic substances in which it is impermissible to reduce the levels of protection established in the previous regulations.” Accordingly, the reasons offered on this occasion by the majority of the Constitutional Court to justify the conformity with Constitutional Law of Article 1 of Decreto Ejecutivo No. 34202 of 21 de mayo de 2007 in no way justify the change in position that has occurred in this particular case, which has affected the full enjoyment of the rights protected by Articles 21 and 50 of the Political Constitution and, in particular, the precautionary principle governing environmental law. Based on the foregoing, the undersigned Justices dissent and declare the challenged provision unconstitutional insofar as it contains a provision similar to the one already annulled by this Constitutional Court in decision No. 2006-16276.

SEPARATE NOTE OF JUSTICES CASTILLO VÍQUEZ AND RUEDA LEAL, DRAFTED BY THE FORMER We agree with our colleagues’ arguments for dismissing the action, except on one point: that an ex novo regulation or any ultra vires defect that a regulatory provision may contain constitutes a matter of ordinary legality that must be resolved by the Contentious-Administrative Jurisdiction (Jurisdicción Contenciosa Administrativa). The Court’s position—that when a regulatory provision violates or exceeds the provisions of a statute, this is a matter of legality whose discussion does not fall within this jurisdiction—is generally legally correct. There is no doubt that it is for the ordinary judge to determine the scope of the interpretation and application of the statute and, consequently, to establish whether or not a regulatory provision violates the statutory provision. There is, however, an important nuance in this matter: in my view, when it is plainly and readily evident that the regulatory provision exceeds, eliminates, or contradicts the text of the statute, there can be no doubt that the principle of the force, authority, or effectiveness of statute (principio de fuerza, autoridad o eficacia de la Ley) is flagrantly violated; that principle enjoys constitutional protection and must be safeguarded by this Court.
As is well known, the principle of the force, authority, or effectiveness of statute refers us to its power (active force), its resistance (passive force), and the system for challenging statutes (régimen de impugnación de la Ley). Under the first aspect of the concept, once a statute enters into force, it repeals or amends every provision of equal or lower rank. Under the second, a statute cannot be repealed or amended by a provision of lower rank. Lastly, under the third, a statute may be challenged only on grounds of unconstitutionality and, therefore, may be annulled only through a decision of the Sala Constitucional.
The constitutional basis for this principle is found in Article 129 of the Carta Fundamental, which provides that a statute may be repealed, abrogated, or amended only by a subsequent provision of equal rank.
Furthermore, the principle of the force, authority, or effectiveness of statute is an essential prerequisite of the social and democratic state governed by the rule of law (Estado social y democrático de Derecho), since it proceeds from a fundamental idea: a parliamentary normative act (acto normativo parlamentario) ranks above normative acts issued by the other Powers of the State, particularly the Poder Ejecutivo. This means that all Powers of the State, when exercising rulemaking authority (potestad normativa) (Article 6, subsection d), of the Ley General de la Administración Pública), must comply with what the legislature has prescribed. When this does not occur, the normative rank of the statute is disregarded; within the hierarchy of legal norms (escala jerárquica normativa), the statute occupies third place in importance after the Constitución Política and International Treaties (Articles 10 and 7). Consequently, a key principle of the social and democratic state governed by the rule of law is violated.
Ergo, when a regulatory provision plainly and manifestly exceeds, eliminates, or contradicts a statute of the Republic, Article 129 of the Carta Fundamental and the principle of the force, authority, or effectiveness of statute are violated, and the Constitutional Court does have jurisdiction over the matter, without prejudice to the jurisdiction also vested in members of the ordinary courts when the circumstances described above are not present.
In the case before us, the petitioner does not demonstrate the existence of a plain and manifest contradiction between the statute and the regulation; accordingly, we dismiss the action as to this issue, albeit for other reasons.
