#/ Decision No. 2012014991 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at ten hours and five minutes on October twenty-six, two thousand twelve.
Amparo proceeding (recurso de amparo) filed by RICARDO ARAYA MONTERO, holder of identity card number 2-0259-088; against the MINISTRY OF ENVIRONMENT, ENERGY AND TELECOMMUNICATIONS, NATIONAL TECHNICAL ENVIRONMENTAL SECRETARIAT, NATIONAL SERVICE OF GROUNDWATER, IRRIGATION AND DRAINAGE, MINISTRY OF HEALTH, MUNICIPALITY OF ALAJUELA, AND COSTA RICAN INSTITUTE OF WATER SUPPLY AND SEWERAGE.
Findings of Fact:
to supply water to 80% of the inhabitants of this area. He indicates that such contamination could occur through percolation through the unsaturated zone (zona no saturada), as well as through runoff (escorrentía) of leached contaminants (contaminantes lixiviados) toward the Pasito, Gutiérrez, Lankaster, Quesada and Bogantes springs (nacientes), and the resulting contamination of the Acuífero Barva. He adds that Desamparados de Alajuela, because of the number of associated groundwater sources, is an area of great hydrogeological importance to the Cuenca del Valle Central. He states that it is part of the formación Barva, which outcrops along the channels of the Bermúdez, Segundo, Ciruelas, Cachaza and Alajuela rivers and at the confluence of Quebrada Cañas and Quebrada Seca, and is associated with lava flows generated in the macizo de Barva. He explains that two aquifers are exploited in that region, with hydrogeological conditions ranging from fair to good.
They have medium to high permeability due to the textural and granulometric characteristics of the materials and the area’s vertical recharge conditions (BGS-SENARA, 1988). He adds that the developer itself, in the Annex to Administrative File No.1008-2005-SETENA, page 17, states that the aquifer associated with the formación Barva is detected beneath the gas-station project at a depth greater than 54 meters and has high potential. The wells drawing from this aquifer extract a flow of up to 55 liters per second, which indicates that it is an aquifer with quite favorable conditions. He adds that page 20 of the cited Annex also states that the service station is located over the protection zone (zona de protección) of the Pasito, Lankaster, Gutiérrez and Quesada springs and concludes that some degree of contamination could result from the gas station. He explains that the report likewise does not rule out the possibility that the fuel-retailing activity could contaminate the aquifer, since the cited Annex states that the possible sources of contamination of the waters near the project would be spills of liquid waste, septic tanks, broken sewage drains, or wastewater or fuel channels or storage tanks (ANNEX to Administrative File No. 1008-2005-SETENA, page 20).
He states that Desamparados de Alajuela has no stormwater, sewage, or wastewater sewer system; there is only a system of gutters, ditches, or channels used to collect stormwater, a system that currently, because of the increase in housing and soil sealing, becomes overloaded with even a small amount of rain, so public roads and homes are constantly flooded, thereby endangering the health and property of the people who live there. He believes this situation would be aggravated by the “DON ABEL SERVICE STATION,” since the stormwater collection system will remain the same. He adds that the respondent authorities did not require—as they should have in order to preserve a healthy and ecologically balanced environment and the life, health, and property of the residents of the community near the gas-station project—any hydraulic study to determine whether the existing system (gutters, ditches, channels, and streams) has sufficient hydraulic capacity to collect water from the gas station together with that from existing homes and other buildings and those to be built in the future in accordance with the area’s urban characteristics.
In the same regard, he notes that, according to the Mapa Hidrogeológico de Alajuela, it will be installed near several springs or natural springs (manantiales), as stated, which will be affected by sewage and stormwater carrying hydrocarbon residue from the service station, which will discharge into Quebrada Targuá or Quebrada Seca, compounded by the fact that Quebrada Targuá lies between the El Pasito Uno and El Pasito Dos springs, located at Lambert Norte coordinates 222000, Este 515335, and therefore that aquifer will unquestionably be contaminated. He indicates that the Defensoría de los Habitantes, according to OFICIO N° 00697-2009-DHR -[CV] in EXPEDIENTE N° 17496-2008-SI of the Defensoría (attached as evidence 1), conducted an ex officio investigation (investigación de oficio) concerning the area of the EL PASITO spring in Desamparados de Alajuela, a nearby site where the “DON ABEL SERVICE STATION” gas station will be built, and concluded that the Plan Regulador de Alajuela did not incorporate for this area the hydrogeological studies recommended to the Municipalidad de Alajuela in several initial reports corresponding to various investigations conducted by that institution from the year 1996 through the year 2004 (those final reports correspond to files 1297-03-93, 07749-24-99, 09165-24-2000y 14865-23-2003), which must be incorporated into the canton’s Plan Regulador in order to ensure that construction developments permitted under these regulations in the Desamparados de Alajuela area do not endanger water resources, particularly groundwater.
The Defensoría ultimately determined or concluded that the Municipalidad de Alajuela has not conducted risk assessments of the aquifers located in the Desamparados de Alajuela sector, which had still not been done as of the date this amparo proceeding was filed. He indicates that an inquiry was also made to the Fiscalía Agrario Ambiental de Alajuela as to whether there were technical limitations on the construction of a housing development project in light of an existing complaint; it replied that a detailed hydrogeological study must be performed to assess the local vulnerability of the water resource to contamination in the area designated for construction of the project, considering that the project is located within zone 2, or the zone of influence of the protection zone for the EI Pasito, Gutiérrez, Lankaster, Quesada and Bogantes springs (Oficio N° 00697-2009-DI-[R -[CV] of the Defensoría de los Habitantes, EXPEDIENTE No.17496-2008-SI).
He notes that, as SENARA indicated on that occasion regarding that project, this should have been considered with even greater reason when evaluating the service station. He states that SENARA has denied several projects in Alajuela, including the “DON ABEL SERVICE STATION” gas station, because detailed hydrogeological studies had not been conducted to assess the local vulnerability of the water resource to contamination, as stated in Oficio N° 006912009-DHR -[CV] of the Defensoría de los Habitantes in Expediente l7496-008-SI. He highlights oficio DIGH-OF-O024-20l2 dated February 23, 2012, from the Dirección de Investigación y Gestión Hídrica of SENARA (attached as evidence 2), issued in response to an inquiry as to whether the DON ABEL SERVICE STATION gas station had been approved by that institution and whether the hydrogeological studies had been submitted; the response to both questions was no. He adds that even if a project has environmental feasibility (viabilidad ambiental) granted by SETENA, that does not exempt the Municipalidad or the institutions involved from obtaining SENARA’s opinion when granting permits, licenses, or authorizations, for purposes of granting or denying them.
He concludes that groundwater contamination from solid and liquid discharges, including hydrocarbons, is the main potential threat that the gas station will create, because it will be installed in an area of high hydrogeological vulnerability and highly permeable soils; furthermore, stormwater runoff ultimately carries untreated discharges, including hydrocarbon residue, into nearby rivers, streams, or springs. He states that the foregoing is contrary to constitutional case law, specifically judgment 2004-01923 of February 25, 2004, which refers to the duty of the municipality and other institutions to verify the environmental impact of projects. He also indicates that it will be located in a medium-density residential area, which, in his opinion, endangers the life, health, and environment of the residents. He adds that the aforementioned service station will be built a few kilometers from the Alajuela geological fault, a detail that he believes likewise should not have been overlooked.
Justice Rueda Leal drafted the opinion; and,
Considering:
I.Concerning active interventions as supporting parties (coadyuvancias activas). Through briefs added to the record, Gilberto Francisco Salas Hidalgo, Diana Hernández Víquez, Angela Evelia Víquez Chacón, Jorge Enrique Hernández Villalobos, María de los Ángeles Fernández, Ana Isabel Ruiz Rojas, German Montes Guevara, Daniel Barquero Solís, Oscar Alberto Segura Castro, Olga Marta Hernández Sandoval, JOsé Cruz Campos and Rodolfo Pérez Ocampo requested recognition as active supporting parties (coadyuvantes activos) in this amparo proceeding. In this regard, section 34, paragraph 3 of the Ley de la Jurisdicción Constitucional provides that anyone possessing a legitimate interest (interés legítimo) in the proceeding may intervene as a supporting party, whether on the claimant’s or respondent’s side. In this specific case, according to the applicants, the Gasolinera Servicentro Don Abel will be built in an area of high hydrogeological vulnerability and aquifer recharge (recarga acuífera), near several springs and wells, and the water resource could therefore be affected, which they believe violates fundamental rights.
Consequently, the aforementioned requests to intervene as supporting parties are admissible, with the clarification that, because the supporting parties are not the principal claimant, they are not directly affected by the judgment or by the res judicata effect (cosa juzgada) of the ruling, although they may benefit indirectly from the effectiveness of the decision because of the erga omnes nature of the case law and precedents of this Constitutional Court.
II.Subject matter of the proceeding. The petitioner alleges that the “Estación de Servicio Don Abel” construction project threatens the environment because it is located in an aquifer recharge area near several springs and wells, compounded by the fact that no hydrogeological study was required, which could affect the water resource.
III.The State’s duty to protect the environment. Following the amendment of constitutional Article 50, which expressly enshrined the right to a healthy environment (derecho ambiental) as a fundamental right, the State’s obligation to guarantee, defend and protect that right was also established unequivocally, thereby making the State the guarantor of the protection and stewardship of the environment and natural resources. Under this provision, read in conjunction with Articles 20, 69 and 89 of the Constitución Política, the State’s responsibility to exercise a protective and governing role in this field was derived, as provided by the constitutional provision under discussion, a role implemented through environmental legislation. Thus, the constitutional mandate establishes the State’s duty to guarantee, defend and preserve that right. In this connection, it must be considered that the applicable law designates the Ministerio del Ambiente y Energía as the governing body for the natural-resources, energy and mining sector, pursuant to Article 2 of the Ley Orgánica of that ministry, number 7152, of 4 de junio de 1990.
In the Sala’s view, this governing role in environmental matters includes not only establishing appropriate regulations for the use of forest resources and natural resources, as also provided by Article 56 of the Ley Orgánica del Ambiente, but also confers upon it the important function of exercising leadership in environmental matters, which entails maintaining a predominant role in this field. In this regard, oversight and enforcement in environmental matters and activities constitute an essential function of the State pursuant to Article 50 of the Constitución, whose third paragraph provides, insofar as relevant: “The State shall guarantee, defend and preserve that right”; this is consistent with the constitutional principle established in the second paragraph of Article 9 of the Constitución Política, which expressly prohibits the Branches of Government from delegating the exercise of their own functions, particularly when those functions are essential.
Accordingly, where environmental protection is concerned, the functions of governance, oversight and enforcement in environmental matters belong to the State and are entrusted to its various administrative agencies.
IV.Prevention of environmental risk. This obligation of the State having been established at the constitutional level, it is important to consider how international human rights protection instruments also establish specific obligations that must be respected. In environmental matters, the precautionary duty (deber de precaución) that must apply in this field has been defined; the Rio Declaration, adopted at the United Nations Conference on Environment and Development, provides that:
“Principle 15.- In order to protect the environment, States shall widely apply the precautionary approach (criterio de precaución) according to their capabilities. Where there is a threat of serious and irreversible harm, lack of full scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.” Precaution (precaución) seeks to anticipate adverse effects and ensure the protection, conservation, and proper management of resources. Consequently, the guiding precautionary principle (principio rector de precaución) is based on the need to take and implement all precautionary measures (medidas precautorias) to prevent or contain possible harm to the environment or human health. Thus, when there is certainty of a risk of serious or irreversible harm, a preventive measure (medida preventiva) must be adopted; when doubt exists in that regard, a precautionary measure (medida de precaución) must be adopted, including, where appropriate, postponement of the activity concerned.
This is because, in environmental matters, ex post enforcement (coacción a posteriori) is ineffective, since once the harm has occurred, the biologically and socially harmful consequences may be irreparable; punishment may have moral significance, but it will hardly compensate for the damage caused to the environment. As stated both in the cited international instrument and in Article fifty of the Constitution itself, the State is responsible for carrying out this preventive work, as this Chamber recognized in judgment number 2001-6503, of 6 July 2001, when it held: “The third paragraph of Article 50 of the Constitution states with complete clarity that the State must guarantee, defend, and preserve every person’s right to a healthy and ecologically balanced environment; this means that public entities are not only required to ensure that private parties and other public entities comply with environmental legislation, but also, first and foremost, must conform their own actions to the mandates of those protective bodies of law.
State institutions are the first entities required to comply with protective environmental legislation, and there is no justification whatsoever for exempting them from compliance with environmental requirements such as, for example, the environmental impact study (estudio de impacto ambiental) required by the Ley Orgánica del Ambiente for activities undertaken by public entities that, by their nature, may alter or destroy the environment.” (emphasis added)
V.Coordination among public institutions in the comprehensive protection of the environment. The State—as a whole—is obligated to take the measures necessary to protect the environment in order to prevent levels of pollution, deforestation, extinction of flora and fauna, and excessive or improper use of natural resources that endanger the health of the governed population. For purposes of this undertaking, “public institution” encompasses both the Central Administration—Ministries such as the Ministerio del Ambiente y Energía and the Ministerio de Salud, which, by reason of their subject matter, have extensive involvement and responsibility regarding environmental conservation and preservation and which most often act through their specialized departments, such as the Dirección General de Vida Silvestre, the Dirección Forestal, and the Secretaría Técnica Nacional Ambiental (SETENA)—and decentralized institutions such as the Instituto Nacional de Vivienda y Urbanismo, SENARA, the Instituto Costarricense de Turismo, and the Instituto Costarricense de Acueductos y Alcantarillados.
Municipalities likewise bear substantial responsibility for this undertaking within their territorial jurisdiction. Given the diversity of actors that may be involved, it might be thought that this shared responsibility would create chaos in administrative management. Therefore, to prevent the simultaneous coexistence of spheres of authority of differing origins and natures, duplication of national and local efforts, and confusion regarding the rights and obligations of the various parties involved, it is necessary to establish a series of coordination arrangements among the various departments of the Executive Branch and decentralized institutions, and between those entities and the municipalities, so that they may perform the functions entrusted to them. This Chamber has previously addressed the principle of coordination (principio de coordinación) between public agencies and municipalities in the pursuit of common purposes, stating in judgment number 5445-99, at fourteen hours thirty minutes on 14 July 1999, that: “[C]oordination is the organization of the relationships among these various independent activities, addressing their concurrence with respect to the same object or entity so as to make it useful to an overall public plan, without eliminating the mutual independence of the participating actors.
Because there is no hierarchical relationship among decentralized institutions, or between the State itself and the municipalities, specific conduct cannot be imposed upon them; consequently, interinstitutional ‘concerted action’ (concierto interinstitucional), in the strict sense, is indispensable, whereby autonomous and independent centers of action agree upon that preventive and comprehensive framework, within which each performs a role with a view to a mission entrusted to the others. Thus, relations between municipalities and other public entities may be conducted only on an equal footing, resulting in mutually agreed forms of coordination and excluding any mandatory arrangement that would impair municipal autonomy by subjecting corporate entities to a coordination framework without or against their consent; this does, however, allow for the necessary subordination of these entities to the State and in the State’s interest (through the State’s ‘administrative oversight’ (tutela administrativa), specifically its function of reviewing legality, which falls within its authority, together with powers of general supervision over the entire sector).”
Moreover, failures to fulfill the duty to protect the environment and to comply with environmental regulations are constitutionally significant because administrative inaction in this area may cause damage to the environment and natural resources, sometimes with consequences similar to or more serious than those arising from administrative actions. Examples include authorization of regulatory plans (planes reguladores) or construction projects without approval of the environmental impact study by the Secretaría Técnica Nacional Ambiental; failure by the Dirección General de Vida Silvestre of the Ministerio del Ambiente y Energía to monitor and oversee implementation of management plans (planes de manejo) for protected areas; allowing businesses to operate without health permits concerning wastewater treatment—Acueductos y Alcantarillados and Ministerio de Salud—or failure to verify noise controls in bars, restaurants, or party venues—municipalities and Ministerio de Salud—.
VI.Merits of the case. The petitioner (recurrente) alleges that on 2 May 2012, preparatory work began for the construction of the “Estación gasoline station
Don Abel Service Station,” in Desamparados de Alajuela. The complaint alleges that, hydrogeologically, the area where the gas station will be built is an aquifer recharge zone (zona de recarga acuífera) of high vulnerability and that construction of the gas station will therefore create a high risk of contamination of the principal aquifers of the Valle Central. Specifically, it states that the project is located over the protection zone (zona de protección) of the Pasito, Lankaster, Gutiérrez and Quesada springs (nacientes). In this regard, María Ofelia Ramírez Barrantes submitted applications to develop the “Estación de Servicio Don Abel” project, consisting of the construction and operation of a service station that will have three storage tanks, supply pipelines, five fuel-dispensing islands with ten access lanes, three parking areas, a convenience store, restrooms, two storage rooms, a cashier area, an automated teller machine, a machinery room, an employee room, an electrical room, a water tank, three garden areas, sidewalks, ramps, curbs and gutters.
The central issue in this matter is whether hydrogeological studies (estudios hidrogeológicos) were available when the Secretaría Técnica Nacional Ambiental granted environmental viability (viabilidad ambiental). It should be noted that the issue here is not whether such hydrogeological studies are required, since the Dirección de Aguas del Ministerio de Ambiente, Energía y Telecomunicaciones stated that the location where the gas station is intended to be built is indeed a highly vulnerable aquifer recharge zone. For her part, the Executive President of the Instituto Costarricense de Acueductos y Alcantarillados reported that, although the project is not located within the protection zone delineated by the study conducted jointly by AyA-SENARA, it must nevertheless be technically demonstrated whether the surface and subsurface areas will be affected. It should also be noted that the Head of the Dirección de Investigación y Gestión Hídrica of SENARA reported that, according to the contamination vulnerability map prepared by SENARA under the PRUGAM project for the Cantón de Alajuela, the project at issue is located in an area of medium vulnerability, and that the Vulnerability Matrix for contamination of water resources indicates that detailed hydrogeological studies are required for this type of project, given the high contamination risk posed by this type of activity.
Furthermore, both the General Manager and the Head of the Dirección de Investigación y Gestión Hídrica, both of SENARA, clarified that the Estación de Servicio Don Abel project has not submitted to the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento the detailed hydrogeological study required under SENARA’s terms of reference, which SETENA had requested since 2005; consequently, SENARA has issued no technical opinion regarding the project. For his part, the Secretary General of the Secretaría Técnica Nacional Ambiental stated that the reason the study was not submitted to SENARA was that the requirement to obtain SENARA’s prior approval of hydrogeological studies was established through the Chamber’s case law beginning in 2010, and because environmental viability for this project was requested in 2005 and granted in 2008, that requirement was not imposed.
This Court finds that this is not a valid argument, given that SENARA expressly requested submission of this requirement through official letter number ASUB 341-2005. It should be emphasized that SENARA requested the hydrogeological study in response to an earlier request by SETENA that it issue an opinion on the project, which defeats SETENA’s argument that SENARA’s approval was not a requirement, since SETENA itself requested it in 2005. Moreover, Article 3(h) of the Ley de Creación del Servicio de Aguas Subterráneas, Riego y Avenamiento clearly establishes an obligation to comply with the criteria issued by SENARA concerning water protection. Accordingly, this Court concludes that the “Estación de Servicio Don Abel” project must have the hydrogeological study that SENARA noted as missing in its report. This is necessary to prevent any violation not only of Article 50 of the Constitución Política, but also, potentially, of Article 21, because the protection of drinking water is at stake.
In view of the foregoing, the proper disposition is to grant the appeal against the Secretaría Técnica Nacional Ambiental. It should be clarified that the appeal is granted only with respect to SETENA because, although the other respondent authorities issued other permits, such as land-use approval (uso de suelo) and approval of the site for construction, among others, the fact remains that the hydrogeological study alleged not to have been conducted relates directly to environmental viability and not to the other permits. Nevertheless, this Chamber clarifies that determining whether the other permits bear any relationship to the missing study is a matter of ordinary legality. The complainant is also advised that, although he submitted to this Chamber as evidence a hydrogeological study that he claims was filed with SETENA and SENARA, the aforementioned Servicio Nacional de Aguas expressly states that it has not issued the corresponding permits; therefore, that evidence does not alter the conclusion reached by this Court.
VII.On citizen participation (participación ciudadana) in projects related to environmental matters. In decision 2009-07540, issued at once horas y veinte minutos del ocho de mayo de dos mil nueve, this Chamber stated:
“IV.- ON THE MERITS. Article 6 of the Ley Orgánica del Ambiente provides:
‘The State and the municipalities shall encourage the active and organized participation of the inhabitants of the Republic in decision-making and actions aimed at protecting and improving the environment.’ For its part, the Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (Decreto 31849-MINAE-MOPT-MAG-MEIC) provides the following regarding mechanisms for being heard by the Secretaría Técnica Nacional Ambiental:
‘Article 55.—On mechanisms for being heard. Pursuant to Article 22 of the Ley Orgánica del Ambiente, every natural or legal person, whether public or private, has the right to be heard by SETENA at any stage of the assessment process and during the operational phase of activities, works or projects. Their observations shall be included in the case file (expediente) and evaluated in the final report.
1. The mechanisms established in these regulations for receiving or considering such observations are as follows:
1.1. Written submissions filed at SETENA’s offices.
1.2. Private hearings with the SETENA Plenary Commission and with any of its technical departments.
1.3. Public hearings.
2. Hearings must be requested from SETENA in writing, stating a postal address or telephone or fax number to which the response will be communicated, including the time and date when the applicants will be heard. Hearings shall be scheduled as follows:
2.1. Within quince días naturales after the request is submitted, in the case of a private hearing.
2.2. Within the following tres meses, in the case of a public hearing.’ (Emphasis not in the original) ‘Article 56.—Requirement for a hearing. Pursuant to Article 95 of the Ley de Biodiversidad, when a natural or legal person requests that SETENA hold a public information and analysis hearing concerning a particular activity, work or project, the SETENA Plenary Commission shall determine, in view of the magnitude of the potential environmental impact and following a technical assessment of the circumstances involved in its development, whether such a hearing is necessary. If it decides not to hold the requested public hearing, the Commission shall determine the mechanism through which it will receive observations.’ ‘Article 58.—Participants in a public hearing. At least four members of the Plenary Commission, a representative of the legal advisory office and the technical team responsible for analyzing the Environmental Impact Study (Estudio de Impacto Ambiental, EsIA), all from SETENA, must be present at the public hearing.
The developer of the activity, work or project must also be summoned and must present a summary of its most relevant aspects together with the technical team responsible for preparing the EsIA. Persons from the communities involved, persons who have notified SETENA in writing of their interest in participating in the hearing, representatives of the local municipalities and representatives of other government institutions must also be summoned, the latter only when deemed necessary.
If any person summoned is not present at the public hearing, the hearing may validly proceed on a second call, thirty minutes after the time scheduled for the first call, with those persons who are present.’ Likewise, on the same subject, in decision 2008-12583, issued at las quince horas y dos minutos del diecinueve de agosto del dos mil ocho, the Chamber stated:
‘Indeed, one form of citizen participation in environmental decision-making is embodied in the opportunity for individuals to review and express their opinions regarding the various environmental impact studies (estudios de impacto ambiental) submitted to the Secretaría Técnica Nacional Ambiental, pursuant to Article 6 of the Ley Orgánica del Ambiente and Article 95 of the Ley de Biodiversidad. On this specific subject, the Chamber stated the following in the aforementioned decision:’ ³The environmental impact assessment (evaluación de impacto ambiental) procedure is characterized as an administrative procedure with a distinguishing feature, since it seeks to avoid or minimize the possible occurrence of environmental damage in the course of activities that are known with certainty to have a harmful effect on the environment if carried out without any containment measures. In other words, this instrument embodies the prevention principle (principio de prevención), because, when faced with an activity known beforehand to be harmful to the environment, the interested party proposes to the public body or entity—in this case, SETENA—a series of measures intended to prevent or mitigate ecological harm, and that body or entity is responsible for determining whether those measures are the most appropriate for that purpose.
Consequently, given that this procedure seeks at all times to anticipate any adverse consequence through a broad flow of information, it is natural to understand that one of its characteristics is that persons who may be affected by the development of the project may provide essential data or viewpoints that the competent authorities, through omission or arbitrary conduct, might ignore or disregard, thereby leaving the environment unprotected. Thus, the principle or right of participation (principio o derecho de participación) entails, within the environmental impact assessment procedure, a high degree of public disclosure (publicidad), to the extent that any act or application having a significant effect on its final outcome must be made generally available to all interested parties, so that they may express their views at any time and not be confined to a particular procedural stage. The public’s role as a defender of a healthy environment extends ³from cradle to grave´, that is, from the inception of a productive activity as a project until the end of its useful life; it would therefore be inadmissible, in an undertaking intended to last for an indefinite period, even decades—as in the case of hydroelectric projects—and having irreversible consequences, to limit the participation of potentially affected social sectors to a procedural stage that, like a hearing, may last only a few hours.
Accordingly, because of its preventive nature, a project subject to environmental impact assessment must, from the very moment of its inception, be brought to the public’s attention in order to initiate an open process of participation´ (judgment number 2002-10693 of eighteen hours and twenty minutes on the seventh of November of two thousand two).
Regarding the alleged failure to hold a public hearing (audiencia pública), the Secretary of the Secretaría Técnica Nacional Ambiental stated: ³As part of the Environmental Impact Study (Estudio de Impacto Ambiental) (page 195), a Local Perception study was included, indicating that 27 families living near the proposed site were randomly interviewed, and concluding that within the study area there is a 67% approval rating for the project; however, according to the commitments undertaken by the developer, the explanatory presentation to introduce the project to the community and clarify any questions has not been held, nor has the Solid and Liquid Waste Management Plan been presented, among other matters´. Accordingly, this Chamber concludes that the right to public disclosure established in Article 6 of the Ley Orgánica del Ambiente was not respected. This right is one of the forms of citizen participation (participación ciudadana) in environmental decision-making and gives concrete effect to the possibility of learning about and expressing an opinion regarding the various environmental impact studies submitted to the Secretaría Técnica Nacional Ambiental.
This is so because, clearly, selecting 27 families to express their opinion on the project excludes the vast majority of the population; there was no high degree of public disclosure and, therefore, the final outcome was not generally available to all interested parties. In view of the foregoing, the appropriate course is to grant the application for relief (recurso) with respect to this issue as well.
VIII.Corollary. In view of the foregoing, the appropriate course is to annul the resolution of the Secretaría Técnica Nacional Ambiental that granted and extended the environmental viability (viabilidad ambiental) of the “Servicentro Don Abel” Project, since the relevant hydrogeological studies were not available and, furthermore, no public hearing was convened. Accordingly, the respondent may grant environmental viability again only after the hydrogeological-study and public-disclosure requirements have been met.
Justice Jinesta Lobo dissents and would deny the application for relief for the following reasons:
Also prominent within this dense and extensive legislative framework are Ley Forestal, No. 7575 de 5 de febrero de 1996 and its amendments; Ley de Protección Fitosanitaria, No. 7664 de 8 de abril de 1997; Ley de concesión y operación de marinas turísticas, No. 7744 de 19 de diciembre de 1997; Ley de Biodiversidad, No. 7788 de 30 de abril de 1998; Ley de Uso, manejo y conservación de suelos, No. 7779 de 30 de abril de 1998; and, more recently, Ley para la Gestión Integral de Residuos, No. 8839 de 24 de junio de 2010. Moreover, even before Article 50 of the Constitution was partially amended, sector-specific statutes already existed for the protection and defense of certain aspects of the environment, such as Ley de Aguas, No. 276 de 27 de agosto de 1942 and its amendments; Ley General de Salud, No. 5395 de 30 de octubre de 1973 and its amendments; Ley de Salud Animal, No. 6243 de 2 de mayo de 1978; Ley de Conservación de la Vida Silvestre, No. 7317 de 21 de octubre de 1992 and its amendments; Ley de Hidrocarburos, No. 7399 de 3 de mayo de 1994; and Ley del uso racional de la energía, No. 7447 de 3 de noviembre de 1994.
At the substatutory level, the regulatory framework is even more extensive, comprising various executive regulations implementing those statutes and decrees governing the protection, conservation, and defense of the environment. At this hierarchical level of protection, for example, Decreto Ejecutivo No. 31849 de 24 de mayo de 2004 is particularly noteworthy. It is the Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), which comprehensively regulates every aspect of the environmental impact assessment procedures for activities, works, and projects, according to predefined categories, in order to prevent any environmental damage or harm, as well as their review and environmental viability, subsequent monitoring and oversight, complaints, participation mechanisms, the environmental officer (responsable ambiental), compliance and operational guarantees, and an enforcement regime (régimen sancionador).
Also noteworthy is Decreto Ejecutivo No. 34136 de 20 de junio de 2007, which is the Reglamento de procedimiento del Tribunal Ambiental Administrativo, governing the tribunal responsible for hearing and deciding complaints concerning threatened breaches or actual violations of legislation protecting the environment and natural resources and for determining compensation for damage or harm to them.
Article 50 of the Constitution and seeks to guarantee, protect, and preserve it requires this Constitutional Court to distinguish, in this area, the sphere of constitutionality review (control de constitucionalidad) from that of legality review (control de legalidad). With respect to constitutional review mechanisms or constitutional questions, as Title IV of the Constitutional Jurisdiction Act (Ley de la Jurisdicción Constitucional) refers to them, a concept that includes actions of unconstitutionality and constitutional consultations—legislative and judicial—the boundary between constitutionality review and legality review is clear and unequivocal because, without question, this Constitutional Court has exclusive and sole jurisdiction to hear and decide such matters (Articles 10 of the Constitution, 1°, 2°, subsection b), and 73 to 108 of the Ley de la Jurisdicción Constitucional), as, for example, when it is alleged that a statutory or regulatory provision is unconstitutional because it violates Article 50, namely, the right to a healthy and ecologically balanced environment, or the values and principles underlying it.
The real problem in delineating the respective spheres of review arises with respect to the amparo remedy or proceeding (recurso o proceso de amparo), for several evident reasons, which are as follows: a) The cross-cutting nature of the right to a healthy and ecologically balanced environment, which permeates every layer or stratum of the legal system; b) the open texture of constitutional provisions, by virtue of which any grievance may appear to be constitutional in nature; and c) the tendency to use amparo proceedings as a substitute for ordinary jurisdiction (jurisdicción ordinaria). Nevertheless, certain criteria may be established, on the basis of Article 7° of the Ley de la Jurisdicción Constitucional, that make it possible to distinguish amparo proceedings from other ordinary judicial proceedings. Thus, when, with respect to an activity, work, or project, a public authority—an administrative entity or body—has intervened by carrying out studies, assessments, reports, or evaluations of any kind pursuant to the dense and extensive subconstitutional legal framework, it is clear that the matter must be brought before the ordinary courts and not the constitutional jurisdiction.
The same applies when a public authority has failed to fulfill the obligations imposed on it by the subconstitutional legal framework, whether statutory or regulatory in nature, regarding the protection of the environment and natural resources. Under this interpretation, this Constitutional Court must hear and decide a matter in amparo proceedings only when no public authority has intervened by exercising its oversight or authorization powers and conduct is occurring that is potentially or currently harmful to the right to a healthy and ecologically balanced environment; additionally, the violation of that right must be evident and manifest or readily ascertainable—without extensive production or taking of evidence—and must also be highly relevant or consequential and serious. If a public authority has failed to fulfill the obligations and duties established by the subconstitutional legal framework, the matter likewise should not be heard by the constitutional jurisdiction because, in addition to the complaint mechanisms available in administrative proceedings, the ordinary jurisdiction, particularly the administrative litigation jurisdiction (jurisdicción contencioso-administrativa), has sufficient jurisdiction to review material or formal omissions by public entities.
Once a public authority has intervened by exercising its statutory and regulatory powers, conducting a procedure—a linked series of administrative actions—and issuing administrative acts (actos administrativos), the matter falls outside the sphere of constitutionality review; the same is true if it fails to fulfill or omits its statutory and regulatory obligations. The amparo remedy is essentially a summary proceeding governed by simplicity or, in the terms of Article 25 of the American Convention on Human Rights, a remedy that must be simple and prompt. Consequently, when it is necessary to review various administrative actions—procedures and formal acts reflected and embodied in an administrative record (expediente administrativo)—the matter ceases to fall within the scope of amparo because recourse must be had to plenary adjudicatory proceedings (proceso de cognición plenaria), that is, full adjudicatory proceedings that can be conducted only before the ordinary jurisdiction.
Amparo is not designed to compare or review technical or legal criteria expressed in light of the subconstitutional legal framework, or to receive new evidence to compare against the evidence contained in an administrative record that has been processed carefully over lengthy periods. Ultimately, amparo proceedings cannot be converted into ordinary proceedings for full adjudication (“ordinariarlo”), because doing so distorts their nature and undermines their aims and purposes. Accordingly, when a public authority has intervened by carrying out studies, endorsing or approving expert assessments submitted by the interested parties, issuing reports, administrative decisions, permits, licenses, or any other formal administrative act, or generally conducting one or more administrative procedures, amparo proceedings are not the proper means for reviewing such actions; the proper means is administrative litigation.
Administrative intervention that can be verified or established is decisive in determining whether the matter lies at the inherently abstract and open plane or level of constitutionality or at the denser level of legality. Nor should this Constitutional Court hear and decide matters involving failure to fulfill obligations imposed by the statutory or regulatory framework, since powerful and effective remedies are available for that purpose in administrative proceedings (the sanctioning regime (régimen sancionador), complaints, and the Tribunal Ambiental Administrativo) and, ultimately, an administrative litigation jurisdiction whose function is to review the legality of administrative action (Article 49 of the Constitution), including statutory or regulatory, material or formal omissions—an ordinary jurisdiction that, under the new procedural legislation, is now more flexible, expeditious, prompt, plenary, and universal.
Por tanto:
The remedy is granted. The following decisions are annulled: a) 1528-2008-SETENA of 23 de mayo de 2008 and b) 1712-2010-SETENA at 8:25 hours on 27 de julio de 2010, both issued by the Secretaría Técnica Nacional Ambiental. Consequently, the “Estación de Servicio Don Abel” may not continue construction work or begin operating until it has obtained the environmental approval (viabilidad ambiental) granted by the Secretaría Técnica Nacional Ambiental and the approval of the Servicio Nacional de Aguas Subterráneas, Riesgo y Avenamiento. The State is ordered to pay the costs and damages caused by the facts underlying this decision, which shall be assessed during enforcement of the administrative litigation judgment. Justice Jineta Lobo dissents and would deny the remedy. Let notice be given.- Ana Virginia Calzada M.

#/ SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las diez horas cinco minutos del veintiseis de octubre de dos mil doce. Recurso de amparo interpuesto por RICARDO ARAYA MONTERO, portador de la cédula de identidad número 2-0259-088; contra el MINISTERIO DE AMBIENTE, ENERGÍA Y TELECOMUNICACIONES, SECRETARÍA TÉCNICA NACIONAL AMBIENTAL, SERVICIO NACIONAL DE AGUAS SUBTERRÁNEAS, RIEGO Y AVENAMIENTO, MINISTERIO DE SALUD, MUNICIPALIDAD DE ALAJUELA E INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Resultando:
Nacional Ambiental (SETENA), que el 8 de julio de 2005 se recibió el Formulario de Evaluación Ambiental Preliminar del Proyecto Estación de Servicio Don Abel, al cual se el asignó el número de expediente 1008-2005-SETENA. Mediante resolución No. 2513-2005-SETENA del 27 de setiembre de 2005 se solicitó la presentación del Estudio de Impacto Ambiental, el cual fue recibido el 29 de setiembre de 2006. Comenta que por resolución No. 1528-2008-SETENA del 23 de mayo de 2008, se otorgó viabilidad ambiental al proyecto. Indica que de la lectura de los estudios hidrogeológicos presentados como anexo al Estudio de Impacto Ambiental, se determinó que la zona de afectación de la zona de protección de las nacientes Pasito Lanakaster Gutiérrez y Quesada va a ser mínima o nula, con dicho proyecto. Conforme a lo anterior, de acuerdo con las conclusiones realizadas por el profesional que lo realizó, no da cuenta de riesgo de contaminación de los acuíferos por interferencia directa del proyecto de la estación de servicio.
Refiere que el 8 de julio de 2008, un grupo de vecinos de Desamparados de Alajuela presentó una denuncia contra el proyecto. El 29 de setiembre de 2011 ingenieros de SETENA realizaron una inspección en el área del proyecto como seguimiento a dicha denuncia, donde posteriormente se contestó todas y cada una de las inquietudes manifestadas por los denunciantes. Agrega que mediante resolución No. 3031-2011-SETENA del 7 de diciembre de 2011 se acordó acoger la denuncia en lo que respecta al tema de la consulta popular y la falta del rótulo informativo, y se rechazó en los demás puntos.
Redacta el Magistrado Rueda Leal; y,
Considerando:
I.Sobre las coadyuvancias activas. Mediante escritos agregados a los autos, Gilberto Francisco Salas Hidalgo, Diana Hernández Víquez, Angela Evelia Víquez Chacón, Jorge Enrique Hernández Villalobos, María de los Ángeles Fernández, Ana Isabel Ruiz Rojas, German Montes Guevara, Daniel Barquero Solís, Oscar Alberto Segura Castro, Olga Marta Hernández Sandoval, JOsé Cruz Campos y Rodolfo Pérez Ocampo solicitaron que se les tuviera como coadyuvantes activos del presente recurso de amparo. Sobre este particular, el numeral 34, párrafo 3 de la Ley de la Jurisdicción Constitucional, estipula que quien posea un interés legítimo en el proceso puede intervenir, sea en su perfil activo o pasivo, como coadyuvante. En el caso concreto, según lo indicado por los gestionantes, la Gasolinera Servicentro Don Abel, se construirá en una zona de alta vulnerabilidad hidrogeológica y de recargo acuífera cerca de varias nacientes y pozos, por lo que se podría ver afectado el recurso hídrico, lo cual, estiman violenta los derechos fundamentales.
En consecuencia, resultan admisibles las referidas solicitudes de coadyuvancia, dejando claro que los coadyuvantes, por no ser el actor principal, no resultan directamente afectados por la sentencia, ni por la condición de cosa juzgada del pronunciamiento, aunque puede de manera indirecta favorecerle la eficacia de lo resuelto por el carácter de erga omnes de la jurisprudencia y los precedentes de este Tribunal Constitucional.
II.Objeto del recurso. El recurrente aduce que el proyecto de construcción de la ³Estación de Servicio Don Abel´, atenta contra el ambiente, toda vez que se encuentra en una zona de recarga acuífera, cercana a varias nacientes y pozos, aunado a que no se exigió ningún estudio hidrogeológico, lo que podría afectar el recurso hídrico.
III.Hechos Probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
III.El deber del Estado en la tutela del ambiente. A partir de la reforma del artículo 50 constitucional, en la cual se consagró expresamente el derecho ambiental como un derecho fundamental, se estableció también -en forma terminante- la obligación del Estado de garantizar, defender y tutelar este derecho, con lo cual, el Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. Es a tenor de esta disposición, en relación con los artículos 20, 69 y 89 de la Constitución Política, que se derivó la responsabilidad del Estado de ejercer una función tutelar y rectora en esta materia, según lo dispone la propia norma constitucional en comentario, función que desarrolla la legislación ambiental. Es así como el mandato constitucional establece el deber para el Estado de garantizar, defender y preservar ese derecho. En este orden de ideas, debe considerarse que la normativa establece al Ministerio del Ambiente y Energía como el órgano rector del sector de los recursos naturales, energía y minas, según lo dispuesto en el artículo 2 de la Ley Orgánica de este ministerio, número 7152, de 4 de junio de 1990.
Esta función de rectoría en la materia ambiental, a criterio de la Sala, comprende no solo el establecimiento de regulaciones adecuadas para el aprovechamiento del recurso forestal y los recursos naturales, según lo dispone también el artículo 56 de la Ley Orgánica del Ambiente, sino que le confiere la importante función de ejercer la rectoría en la materia ambiental, consistente en mantener un papel preponderante en esta materia. En este sentido, el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado según lo dispuesto en el artículo 50 de la Constitución, en tanto dispone en lo que interesa en el párrafo tercero: "El Estado garantizará, defenderá y preservará ese derecho"; lo cual resulta concordante con el principio constitucional establecido en el párrafo segundo del artículo 9 de la Constitución Política, que expresamente prohíbe a los Poderes del Estado la delegación del ejercicio de funciones que le son propias, máxime cuando se constituyen en esenciales.
De esta manera, tratándose de la protección ambiental, las funciones de rectoría, control y fiscalización de la materia ambiental, corresponden al Estado, a cargo de las diversas dependencias administrativas.
IV.La prevención del riesgo ambiental. Estableciéndose a nivel constitucional esta obligación del Estado, resulta importante apreciar cómo a nivel de los instrumentos internacionales de protección de los derechos humanos también se establecen obligaciones concretas que deben ser respetadas. En materia ambiental se ha definido el deber de precaución que debe existir en este ámbito; la Declaración de Río, adoptada en la Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo, dispone que:
"Principio 15.- Con el fin de proteger el medio ambiente, los Estados deber án aplicar ampliamente el criterio de precaución conforme a sus capacidades. Cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente".
La precaución pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos. Consecuentemente, el principio rector de precaución se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar o contener la posible afectación del ambiente o la salud de las personas. De esta forma, en caso de que exista la certeza de un riesgo de daño grave o irreversible, se debe adoptar una medida preventiva, o cuando exista una duda al respecto, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Lo anterior debido a que en materia ambiental la coacción a posteriori resulta ineficaz, por cuanto de haberse producido el daño, las consecuencias biológicas y socialmente nocivas pueden ser irreparables; la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados al ambiente.
Tal como lo señala el instrumento internacional de cita como el mismo artículo cincuenta constitucional, es el Estado el llamado a efectuar esta labor de prevención, y así lo ha reconocido esta Sala al afirmar, mediante sentencia número 2001-6503, de 6 de julio de 2001, que: ³El párrafo tercero del numeral 50 Constitucional señala con toda claridad que el Estado debe garantizar, defender y preservar el derecho de todas persona a un ambiente sano y ecológicamente equilibrado; lo que implica afirmar que los entes públicos no sólo están en la obligación de hacer cumplir ±a los particulares y otros entes públicos- la legislación ambiental, sino también, ante todo, que deben ajustar su accionar a los dictados de esos cuerpos normativos tutelares. Las instituciones del Estado son las primeras llamadas a cumplir con la legislación tutelar ambiental, sin que exista justificación alguna para eximirlas del cumplimiento de requisitos ambientales como, a manera de ejemplo, el estudio de impacto ambiental que exige la Ley Orgánica del Ambiente para las actividades que emprendan los entes públicos que, por su naturaleza, puedan alterar o destruir el ambiente." (énfasis añadido)
V.La coordinación de las instituciones públicas en la protección integral al ambiente. Existe una obligación para el Estado ±como un todo- de tomar las medidas necesarias para proteger el ambiente, a fin de evitar grados de contaminación, deforestación, extinción de flora y fauna, uso desmedido o inadecuado de los recursos naturales, que pongan en peligro la salud de los administrados. En esta tarea, por institución pública se entiende tanto a la Administración Central ±Ministerios, como el Ministerio del Ambiente y Energía y el Ministerio de Salud, que en razón de la materia, tienen una amplia participación y responsabilidad en lo que respecta a la conservación y preservación del ambiente; los cuales actúan, la mayoría de las veces, a través de sus dependencias especializadas en la materia, como por ejemplo, la Dirección General de Vida Silvestre, la Dirección Forestal, y la Secretaría Técnica Nacional Ambiental (SETENA)-, así como también las instituciones descentralizadas como el Instituto Nacional de Vivienda y Urbanismo, el SENARA, el Instituto Costarricense de Turismo o el Instituto Costarricense de Acueductos y Alcantarillados.
Del mismo modo, en esta tarea tienen gran responsabilidad las municipalidades en lo que respecta a su jurisdicción territorial. Debido a la diversidad de actores que pueden intervenir, podría pensarse que esta múltiple responsabilidad provocaría un caos en la gestión administrativa. Por ello, a fin de evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos nacionales y locales, así como la confusión de derechos y obligaciones entre las diversas partes involucradas, se hace necesario establecer una serie de relaciones de coordinación entre las diversas dependencias del Poder Ejecutivo y las instituciones descentralizadas, y entre éstas con las municipalidades, a fin de poder llevar a cabo las funciones que les han sido encomendadas. Esta Sala se ha referido ya al principio de coordinación de las dependencias públicas con las municipalidades en la realización de fines comunes, al señalar mediante sentencia número 5445-99, de las catorce horas treinta minutos del 14 de julio de 1999, que: "[L]a coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes.
Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible «concierto» interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros. Así, las relaciones de las municipalidades con los otros entes públicos, sólo pueden llevarse a cabo en un plano de igualdad, que den como resultado formas pactadas de coordinación, con exclusión de cualquier forma imperativa en detrimento de su autonomía, que permita sujetar a los entes corporativos a un esquema de coordinación sin su voluntad o contra ella; pero que sí admite la necesaria subordinación de estos entes al Estado y en interés de éste (a través de la «tutela administrativa» del Estado, y específicamente, en la función de control la legalidad que a éste
compete, con potestades de vigilancia general sobre todo el sector).´ Por otro lado, las omisiones al deber de protección del ambiente y de cumplimiento de la normativa ambiental son de relevancia constitucional, por cuanto como consecuencia de la inercia de la Administración en esta materia, se puede producir un daño al ambiente y a los recursos naturales, a veces, de similares o mayores consecuencias que de las derivadas de las actuaciones de la Administración; como lo es la autorización de planes reguladores, o construcciones sin la aprobación del estudio de impacto ambiental por parte de la Secretaría Técnica Nacional Ambiental, o la falta de control y fiscalización en la ejecución de los planes de manejo de las áreas protegidas por parte de la Dirección General de Vida Silvestre del Ministerio del Ambiente y Energía, el permitir el funcionamiento de empresas sin los permisos de salud en lo que respecta al tratamiento de aguas residuales -Acueductos y Alcantarillados y Ministerio de Salud-, o no verificar los controles sónicos en bares, restaurantes o centros de fiestas -municipalidades y Ministerio de Salud-.
VI.Sobre el fondo. El recurrente alega que el 2 de mayo de 2012, comenzaron las obras preparatorias de la construcción de la gasolinera ³Estación
de Servicio Don Abel´, en Desamparados de Alajuela. Denuncia que hidrogeológicamente la zona en la que se construirá la gasolinera es de recarga acuífera y de alta vulnerabilidad, por lo que la construcción de la gasolinera se generará un alto riesgo de contaminación de los principales acuíferos del Valle Central. Concretamente, indica que el proyecto se encuentra sobre la zona de protección de las nacientes Pasito, Lankaster, Gutiérrez y Quesada. En ese sentido, se tiene que la señora María Ofelia Ramírez Barrantes, presentó solicitudes para poder desarrollar el proyecto ³Estación de Servicio Don Abel´, que consiste en la construcción y operación de una estación de servicio, que contará con tres tanques de almacenamiento, tuberías de suministro, cinco islas de suministro de combustible con diez pistas de acceso, tres zonas de parqueo, tienda de conveniencia, servicios sanitarios, dos bodegas, un área de cajas, un cajero automático, un cuarto de máquinas, un cuarto para empleados, un cuarto eléctrico, un tanque de agua y tres zonas de jardín, aceras, rampas, cordón y caño.
El punto medular de este asunto es si se contó o no con estudios hidrogeológicos para otorgar por parte de la Secretaría Técnica Nacional Ambiental la viabilidad ambiental. Cabe destacar que en la especie, no se cuestiona si se requieren o no dichos estudios -los hidrogeológicos-, toda vez que la Dirección de Aguas del Ministerio de Ambiente, Energía y Telecomunicaciones, indicó que efectivamente el lugar donde se pretende construir la gasolinera es una zona de recarga acuífera de alta vulnerabilidad. Por su parte, la Presidenta Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados informó que aunque el proyecto no se encuentra dentro de la zona de protección delimitada por el estudio efectuado entre el AyA-SENARA, sí se deberá demostrar técnicamente si hay o no afectación a la parte superficial y subterránea. Y, cabe destacar que el Jefe de la Dirección de Investigación y Gestión Hídrica del SENARA, informó que según el mapa de Vulnerabilidad a la contaminación elaborado por el SENARA en el marco del proyecto PRUGAM para el Cantón de Alajuela, el proyecto de marras se localiza en una vulnerabilidad media y la Matriz de Vulnerabilidad a la contaminación de los recursos hídricos, indica que para este tipo de proyectos se requiere la presentación de estudios hidrogeológicos detallados, considerando el alto riesgo a la contaminación por este tipo de actividad.
Además, aclararon tanto el Gerente General como el Jefe de la Dirección de Investigación y Gestión Hídrica, amso del SENARA, que el proyecto Estación de Servicio Don Abel no ha presentado en el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, el estudio hidrogeológico detallado según los términos de referencia del SENARA, el cual fue solicitado a la SETENA desde el 2005, por lo que no ha emitido pronunciamiento técnico en relación con dicho proyecto. Por su parte, el Secretario General de la Secretaría Técnica Nacional Ambiental, señaló que la razón por la cual no aportó el estudio ante SENARA, fue porque es a través de la jurisprudencia de la Sala que se estableció que se debe solicitar el visto bueno previo de SENARA de los estudio hidrogeológicos, ello a partir de 2010 y como la viabilidad ambiental de este proyecto se solicitó en el 2005 y se otorgó en el 2008, no se pidió tal requerimiento.
Considera este Tribunal que este no es un argumento válido, habida cuenta que SENARA expresamente solicitó la presentación de este requisitos mediante oficio número ASUB 341-2005. Debe resaltarse que SENARA solicitó el estudio hidrogeológico con ocasión de una solicitud previa hecha por SETENA para que se pronunciara sobre el proyecto, lo que trae abajo el argumento de SETENA en cuanto a que no era un requisito el visto bueno de SENARA, habida cuenta que ella mismo lo solicitó en el año 2005. Aunado a ello, el artículo 3 inciso h) de la Ley de Creación del Servicio de Aguas Subterráneas, Riego y Avenamiento, claramente establece que existe una obligación de respetar los criterios emitidos por SENARA en lo que atañe a la protección de aguas, de ahí que este Tribunal concluya que es necesario que el proyecto de ³Estación de Servicio Don Abel´cuente con el estudio hidrogeológico que extraña en su informe el SENARA.
Ello resulta necesario en aras de evitar cualquier lesión no solo al artículo 50 de la Constitución Política, sino, además, eventualmente al numeral 21, pues se encuentra de por medio la tutela del agua potable. En mérito de lo expuesto, lo procedente es declarar con lugar el recurso en contra de la Secretaría Técnica Nacional Ambiental. Cabe aclarar que el recurso procede únicamente en cuanto a la SETENA toda vez que si bien las demás autoridades recurridas otorgaron otros permisos, tales como uso de suelo, aprobación de terreno para la construcción, entre otros, lo cierto del caso es que el estudio hidrogeológico que se alega no se realizó, se relaciona directamente con la Viabilidad Ambiental y no con los otros permisos. No obstante, aclara esta Sala que determinar si los demás permisos guardan alguna relación con el estudio faltante, es un asunto de mera legalidad. También se le aclara al amparado que a pesar de que como medio probatorio aportó a esta Sala un estudio hidrogeológico que alega presentó ante la SETENA y el SENARA, el Servicio Nacional de Aguas citado, expresamente indica que no cuentan con sus permisos, por lo que dicha prueba no cambia la conclusión a la que arribo este Tribunal.
VII.Sobre la participación ciudadana en proyectos vinculados a materia ambiental. Esta Sala en resolución 2009-07540 de las once horas y veinte minutos del ocho de mayo de dos mil nueve, señaló:
³IV.- SOBRE EL FONDO. La Ley Orgánica del Ambiente, en su artículo 6°, establece que: ³El Estado y las municipalidades, fomentarán la participación activa y organizada de los habitantes de la República, en la toma de decisiones y acciones tendientes a proteger y mejorar el ambiente.´ Por su parte, el Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (Decreto 31849-MINAE-MOPT-MAG-MEIC) dispone, en lo que se refiere a mecanismos para ser escuchados por la Secretaría Técnica Nacional Ambiental, lo siguiente: ³Artículo 55.²Sobre los mecanismos para ser escuchados. De conformidad con el artículo 22 de la Ley Orgánica del Ambiente toda persona física o jurídica, pública o privada, tiene derecho a ser escuchada por la SETENA, en cualquier etapa del proceso de evaluación y en la fase operativa de las actividades, obras o proyectos. Sus observaciones serán incluidas en el expediente y valoradas en el informe final.
1. Los mecanismos que se establecen en el presente reglamento para recibir o conocer dichas observaciones son los siguientes:
1.1. Los escritos que se presenten en las oficinas de la SETENA.
1.2. Las audiencias privadas con la Comisión Plenaria de la SETENA y con cualquiera de sus departamentos técnicos.
1.3. Las Audiencias Públicas.
2. Las audiencias deberán solicitarse por escrito a la SETENA, señalando dirección postal o número telefónico o de fax, donde se le comunicará la respuesta, incluyendo la hora y el día, en que serán atendidos. Las audiencias se fijarán, de la siguiente manera:
2.1. Dentro del plazo de quince días naturales después de haberse solicitado, en caso de audiencia privada.
2.2. Dentro de los tres meses siguientes, en caso de audiencia pública.´ (El resaltado no es del original) ³Artículo 56.²Requerimiento de una audiencia. Conforme el artículo 95 de la Ley de Biodiversidad, cuando alguna persona física o jurídica solicite a la SETENA se lleve a cabo audiencia pública de información y análisis para el caso de una determinada actividad, obra o proyecto, la Comisión Plenaria de la SETENA en virtud de la magnitud del potencial impacto ambiental, determinará, previa valoración técnica de las situaciones implicadas en el desarrollo de la misma, la necesidad o no de celebrarla. En caso de decidir no celebrar la audiencia pública solicitada, dicha comisión deberá determinar el mecanismo mediante el cuál recibirá las observaciones.´ ³Artículo 58.²Participantes de una audiencia pública. En la audiencia pública deberán estar presentes al menos cuatro miembros de la Comisión Plenaria, un representante de la asesoría legal y el equipo técnico responsable del análisis del EsIA; todos de la SETENA.
También, deberán ser convocados: el desarrollador de la actividad, obra o proyecto, quien deberá exponer un resumen de los aspectos más relevantes, junto con el equipo técnico responsable de la elaboración del EsIA. Asimismo, deberán ser convocados personas de las comunidades involucradas, personas que hayan manifestado por escrito ante la SETENA su interés de participar en la audiencia, representantes de las municipalidades locales y los de otras instituciones gubernamentales, estos últimos, sólo cuando se considere necesario.
En el caso de que no esté presente en la audiencia pública alguno de los convocados, se podrá llevar a cabo válidamente dicha audiencia en una segunda convocatoria, treinta minutos después de la hora fijada para la primera convocatoria, con las personas presentes.´ Asimismo, sobre el mismo tema, en la resolución 2008-12583 las quince horas y dos minutos del diecinueve de agosto del dos mil ocho, la Sala mencionó:
³Precisamente, una de las formas de participación ciudadana en la toma de decisiones en materia ambiental, se concretiza en la posibilidad que tienen las personas de conocer y brindar su opinión con respecto a los distintos estudios de impacto ambiental que se presenten ante la Secretaría Técnica Nacional Ambiental, esto conforme lo dispuesto por el artículo 6 de la Ley Orgánica del Ambiente, y el artículo 95 de la Ley de Biodiversidad. Sobre este tema en concreto, la Sala señaló en el voto antes mencionado, lo siguiente:
³El procedimiento de evaluación de impacto ambiental, se caracteriza por ser un procedimiento administrativo con una nota diferenciadora, pues lo que busca es eludir o minimizar la eventual configuración de un daño ambiental, dentro de la ejecución de actividades sobre las que existe certeza acerca del efecto perjudicial que éstas producirían sobre el ambiente, de llevarse a cabo sin mediar contención alguna. En otras palabras, este instrumento corresponde a la materialización del principio de prevención, por cuanto ante una actividad que se sabe de antemano que es dañosa para el ambiente, el interesado propone una serie de medidas tendientes a evitar o mitigar el detrimento ecológico, al órgano o ente público ±en este caso la SETENA±que se encarga de determinar si las mismas son las más adecuadas para tal fin. Por consiguiente, dado que este procedimiento lo que persigue en todo momento es el prever cualquier consecuencia negativa, a través de un amplio flujo de información, resulta natural entender que una de sus características es que las personas que puedan verse afectadas por el desarrollo del proyecto puedan aportar datos o puntos de vista fundamentales, que las autoridades competentes a raíz de una conducta omisiva o arbitraria podrían ignorar o dejar de lado, desprotegiendo consecuentemente al ambiente.
Es así como el principio o derecho de participación implica dentro del procedimiento de evaluación de impacto ambiental, un alto grado de publicidad, al punto de que cualquier acto o solicitud que tenga un efecto significativo sobre el resultado final del mismo, debe ser de alcance general para todos los interesados, de modo que estos puedan ejercer sus opiniones en cualquier momento y no ser encasillados a un momento procesal determinado. El papel de la población como defensor de un ambiente sano, va desde ³la cuna hasta la tumba´, es decir, desde el inicio de la actividad productiva como proyecto, hasta el fin de su vida útil, por lo que no sería admisible que en una explotación encaminada a durar por un período de tiempo indefinido, inclusive décadas ±como es el caso de los proyectos hidroeléctricos±, y de consecuencias irreversibles, se limite la participación de aquellos sectores sociales que puedan verse afectados, a una etapa procesal, que como una audiencia, puede durar sólo unas cuantas horas.
Así, en razón de su naturaleza preventiva, es exigible que desde el mismo momento de su inicio, un proyecto sometido a evaluación de impacto ambiental deba ser puesto en conocimiento de la población a efectos de iniciar un fenómeno abierto de participación´ (sentencia número 2002-10693 de las dieciocho horas con veinte minutos del siete de noviembre de dos mil dos).
Con relación a la alegada falta de audiencia pública, el Secretario de la Secretaría Técnica Nacional Ambiental, indicó que: ³Como parte del Estadio de Impacto Ambiental (página 195) se incluyó un estudio de Percepción Local, donde se indica que se realizó una entrevista en forma aleatoria a 27 familias que habitan en las cercanías del sitio propuesto, concluyendo que en el área de estudio existe una percepción del 67% que aprueba el proyecto; sin embargo, según los compromisos asumidos por el desarrollador, no se ha realizado la charla explicativa para presentar el proyecto a la comunidad y aclarar cualquier tipo de duda, además de exponer el Plan de Manejo de Desechos Sólidos y Líquidos, entre otros´. De esta manera, esta Sala concluye que no se respetó el derecho de publicidad establecido en el artículo 6 de la Ley Orgánica del Ambiente, que es una de las formas participación ciudadana en la toma de decisiones en materia ambiental, se concretiza la posibilidad de conocer y brindar su opinión con respecto a los distintos estudios de impacto ambiental que se presentan ante la Secretaría Técnica Nacional Ambiental.
Lo anterior toda vez que evidentemente, el escoger a 27 familias para que indiquen su opinión sobre el proyecto excluye a la gran mayoría de la población, no existió un alto grado de publicidad y por ende, el resultado final no fue de alcance general para todos los interesados En mérito de lo anterior, lo procedente es declarar con lugar el recurso también en cuanto a este punto se refiere.
VIII.Corolario. En mérito de lo expuesto, lo procedente es anular la resolución de la Secretaría Técnica Nacional Ambiental que otorgó y prorrogó la viabilidad ambiental al Proyecto "Servicentro Don Abel", toda vez que no se contó con los estudios hidrogeológicos pertinentes y, además, no se convocó a la audiencia pública. En virtud de ello, la accionada podrá otorgar nuevamente la viabilidad, únicamente previo cumplimiento de los estudios hidrogeológicos y de publicidad.
El Magistrado Jinesta Lobo salva el voto y declara sin lugar el recurso por las siguientes razones:
También destacan, en ese denso y vasto entramado legislativo, la Ley Forestal, No. 7575 de 5 de febrero de 1996 y sus reformas, la Ley de Protección Fitosanitaria, No. 7664 de 8 de abril de 1997, la Ley de concesión y operación de marinas turísticas, No. 7744 de 19 de diciembre de 1997, la Ley de Biodiversidad, No. 7788 de 30 de abril de 1998, la Ley de Uso, manejo y conservación de suelos, No. 7779 de 30 de abril de 1998 y, más recientemente, la Ley para la Gestión Integral de Residuos, No. 8839 de 24 de junio de 2010. De otra parte, incluso, antes de reformarse parcialmente el artículo 50 de la Constitución, ya existían leyes sectoriales de protección y defensa de ciertos aspectos del medio ambiente, tales como la Ley de Aguas, No. 276 de 27 de agosto de 1942 y sus reformas, la Ley General de Salud, No. 5395 de 30 de octubre de 1973 y sus reformas, la Ley de Salud Animal, No. 6243 de 2 de mayo de 1978, la Ley de Conservación de la Vida Silvestre, No. 7317 de 21 de octubre de 1992 y sus reformas, la Ley de Hidrocarburos, No. 7399 de 3 de mayo de 1994 y la Ley del uso racional de la energía, No. 7447 de 3 de noviembre de 1994.
El marco normativo, en el plano infra legal, es aún más nutrido con diversos reglamentos ejecutivos de esas leyes y decretos que regulan la protección, conservación y defensa del medio ambiente. En este nivel jerárquico de protección, a modo de ejemplo, destaca el Decreto Ejecutivo No. 31849 de 24 de mayo de 2004 que es el Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA) que regula, prolijamente, todas las aristas de los procedimientos de Evaluación del Impacto ambiental de actividades, obras y proyectos, según categorías predefinidas, para prevenir cualquier daño o lesión al ambiente, su revisión y la viabilidad ambiental, su control y seguimiento posterior, denuncias, mecanismos de participación, el responsable ambiental, las garantías de cumplimiento y de funcionamiento y un régimen sancionador. También descuella el Decreto Ejecutivo No. 34136 de 20 de junio de 2007 que es el Reglamento de procedimiento del Tribunal Ambiental Administrativo encargado de conocer y resolver las denuncias por amenaza de infracción o violación efectiva a la legislación tutelar del ambiente y de los recursos naturales y para establecer las indemnizaciones por daños o lesiones a éstos.
Por tanto:
Se declara con lugar el recurso. Se anulan las siguientes resoluciones: a) 1528-2008-SETENA del 23 de mayo de 2008 y b) 1712-2010-SETENA de las 8:25 horas del 27 de julio de 2010, ambas de la Secretaría Técnica Nacional Ambiental. En consecuencia, la "Estación de Servicio Don Abel", no podrá continuar los trabajos de construcción ni entrar en funcionamiento hasta tanto no cuente con la viabilidad ambiental otorgada por la Secretaría Técnica Nacional Ambiental y el visto bueno del Servicio Nacional de Aguas Subterráneas, Riesgo y Avenamiento. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
