SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine hours and five minutes on the thirteenth of June, two thousand fourteen.

Writ of amparo (recurso de amparo) proceeding under expediente número 13-002986-0007-CO, filed by YASMIN HERRERA MAHOMAR, identity card 0401280766, against the ALCALDE DE ALAJUELA and the DIRECTOR DEL PROCESO CONTROL URBANO, both of the MUNICIPALIDAD DE ALAJUELA.

RESULTS:

  1. 1By a written submission received by the Secretariat of the Chamber on 13 de marzo de 2013, the petitioner filed a writ of amparo against the ALCALDE DE ALAJUELA and the DIRECTOR DEL PROCESO CONTROL URBANO, both of the MUNICIPALIDAD DE ALAJUELA, and states that the respondent municipality has allowed the construction of twenty-five cellular telephone towers at various locations in the canton of Alajuela. She indicates that those structures were permitted without any type of municipal permit or environmental assessment procedure (procedimiento de evaluación ambiental) or environmental license (licencia ambiental) issued by the Secretaría Técnica Nacional Ambiental (SETENA). She indicates that, because there is no type of municipal permit or environmental assessment for the towers constructed within the jurisdiction of the Municipalidad de Alajuela, citizens are left unprotected from the unlawful proliferation of these structures, since their construction absolutely and irreparably violates the right to citizen participation in access to information and the guarantee of effective participation in decision-making concerning environmental projects, which reflects the constitutional right to a healthy and ecologically balanced environment, enshrined in artículo 50 of the Constitution.She complains that, although the respondent Municipality is aware of these facts, it has shown no interest in stopping the conduct described, since it has not intervened by effectively exercising its oversight or authorization powers. She alleges that conduct potentially harmful to the right to a healthy and ecologically balanced environment and the right to citizen participation is taking place. She requests that the writ of amparo be granted in all respects; that the Alcalde and the Director del Proceso de Control Fiscal y Urbano of the Municipalidad de Alajuela be ordered to take the actions within the scope of their authority to immediately remove the telecommunications antennas; that their reinstallation not be permitted until they comply with the requirements established by SETENA; and that the respondents be held jointly and severally liable for payment of the corresponding costs.
  2. 2ROBERTO HERNÁN THOMPSON CHACÓN, in his capacity as Alcalde Municipal de Alajuela, and ROY DELGADO ALPÍZAR, in his capacity as Director del Proceso de Planeamiento y Construcción de Infraestructura of that Municipality, report under oath that permits have been approved throughout the Canton of Alajuela, for which the requirements are the same as those required for a conventional construction permit, in addition to verification that there are no other towers within a minimum distance of 250 meters. They state that, as part of the process, the owner of the land on which the tower is to be located must have provided written approval. They explain that the construction plans must bear the approval of the Dirección General de Aviación Civil and SETENA’s environmental feasibility approval (viabilidad ambiental). With respect to the towers reported, they state that the Departamento de Proceso de Planeamiento y Construcción de Infraestructura and the Departamento de Proceso de Control Fiscal y Urbano have coordinated the necessary measures for municipal inspectors to take all appropriate actions because the towers did not have the respective permits at that time; the complaints were duly reported to the Proceso de Control Fiscal y Urbano.
  3. 3WILLIAM QUIRÓS SELVA, in his capacity as Presidente del Concejo Municipal de Alajuela, reports under oath to the same effect as Roberto Hernán Thompson Chacón and Roy Delgado Alpízar.
  4. 4URIEL JUÁREZ BALTODANO, in his capacity as Secretario General de la SETENA, reports under oath that, pursuant to that institution’s powers, it acts once the regulated party submits the environmental impact form (formulario de impacto ambiental) (art. 84 inciso a) of the Ley Orgánica del Ambiente (LOA), or once a complaint has been filed against an activity, work, or project having an administrative case file (expediente administrativo) before SETENA (art. 51 of Decreto Ejecutivo N°31849 Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA). Regarding the cited facts, he indicates that, according to the technical opinion of the Departamento de Evaluación Ambiental, set forth in official letter DEA-1530-2013 of 24 de mayo del 2013, 199 applications have been submitted for the installation of telecommunications towers in Alajuela, and they are at various stages of processing.SETENA has authority only to grant or deny environmental feasibility approval when a new project is submitted to an environmental impact assessment (evaluación de impacto ambiental, EIA) before that agency. In this case, he is unable to provide further information to determine whether the 25 towers reported by the petitioner are among those 199 that were submitted to the environmental impact assessment process or whether they have not been processed before SETENA, because the petitioner does not specify the administrative case file number (if one exists), the developer’s name, or the geographical location of each of those towers. He requests that the writ of amparo be denied insofar as it concerns SETENA.
  5. 5SISY CASTILLO RAMÍREZ, in her capacity as Viceministra de Salud, acting in this case as Ministra de Salud, reports under oath and states that she requested a report on the matter from the offices having territorial jurisdiction, namely, the Áreas Rectoras de Salud de Alajuela 1 y Alajuela 2; accordingly, Dr. Jaime Gutiérrez and Dr. Ronald Mora Solano, respectively, submitted a report through official letter Nº CN-ARS-A1-1673-2013. In that official letter, they explain that, after reviewing and analyzing the legal documentation in the case, they did NOT find that an Área Rectora de Salud is responsible for issuing siting and/or construction permits for cellular telephone towers, because that authority belongs to local governments, as established in artículo XIX 2 bis of the Reforma al Reglamento de Construcciones, which states: “The installation, expansion, or modification of the telecommunications network or infrastructure may be located anywhere within the national territory, must comply with the technical quality and coverage parameters defined by SUTEL, and shall be undertaken by telecommunications operators and providers duly accredited and authorized for that purpose, who must apply to the respective Municipality to obtain a conforming land-use designation (uso del suelo), pursuant to the technical provisions of this regulation, and a construction license.In the case of sensitive areas, as identified by the Ministerio de Salud, that entity shall be responsible for defining the applicable setbacks and conditions.” She states that she is unaware of any areas in the canton of Alajuela that have been declared “sensitive.” She emphasizes from the foregoing that it is not the responsibility of the Ministerio de Salud; rather, it is the duty of the Municipalities to grant construction licenses for this type of tower, ensure that the towers are located in suitable areas, and monitor compliance with artículo 50 of the Constitution. Lastly, she indicates that, as of the date the report was drafted, the petitioner had not filed any complaint with the aforementioned Áreas Rectoras. She requests that the writ filed be dismissed.
  6. 6OFELIA TAITELBAUM YOSELEWICH, in her capacity as Defensora de los Habitantes de la República, reports under oath that the institution she represents has no record of any complaint filed by the petitioner from 2002 to the present. She states that this was verified through a meticulous review of the electronic complaint-registration system; additionally, a circular was sent by email to all officials to request any information indicating that a complaint had been processed under the circumstances described by the petitioner; because this inquiry likewise produced no positive results, it was determined with complete certainty that no complaint from the resident had been received. She states that she finds it surprising that the petitioner never used any of the institution’s available means of communication to verify receipt of the complaint. She indicates that the petitioner does not refer to any acts or omissions attributable to the Defensoría de los Habitantes; therefore, although she lacks a factual basis on which to address the particular facts arising from the specific case, she nevertheless notes that the institution does possess valuable information regarding the environmental impact of telecommunications towers.She therefore assumes that a report was requested from the Defensoría not because it is a party to the matter, but to assist the Administration. In accordance with the foregoing, reference is made to the cellular telephone tower issue addressed in expediente Nº 64560-2010-SI, from which recommendations were issued to the Ministerio de Salud, Ministerio de Ambiente, Energía y Telecomunicaciones, SETENA, Comisión de Coordinación para la Instalación o Ampliación de Redes de Telecomunicaciones, Superintendencia de Telecomunicaciones, the Municipalidades, Instituto de Normas Técnicas de Costa Rica, and Dirección de Normalización, as well as a suggestion to the Presidencia de la Asamblea Legislativa. She clarifies that compliance with these recommendations underwent a process that concluded with an Informe de Cierre de Seguimiento, which forms part of the body of evidence submitted in this case by the Defensoría de los Habitantes.She considers that the petitioner’s case must be addressed with the greatest possible urgency so that her situation, and that of the various communities located near the towers, does not give rise to further environmental or health complications; that protection of natural beauty must be guaranteed; and that the procedures must be corrected to ensure respect for the principles of public information and citizen participation.
  7. 7By resolution issued at 11:20 on 17 de marzo de 2014, the Alcalde Municipal de Alajuela was asked to supplement the report concerning the processing of the complaint regarding the lack of permits for the installation of cellular telephone towers.
  8. 8ROBERTO HERNÁN THOMPSON CHACÓN, in his capacity as Alcalde Municipal de Alajuela, and ROY DELGADO ALPÍZAR, in his capacity as Director del Proceso de Planeamiento y Construcción de Infraestructura, both of the Municipalidad de Alajuela, report under oath that personnel from the Departamento de Proceso de Control Fiscal of that Municipalidad de Alajuela are issuing notices concerning the lack of construction permits.
  9. 9As evidence to assist in reaching a decision, by resolution issued at 08:36 on 05 de mayo de 2014, a report was requested from the Superintendencia de Telecomunicaciones so that it would indicate whether the twenty-five cellular telephone towers located in various parts of the Canton of Alajuela, to which the petitioner refers and which, according to the Alcalde Municipal and the Director del Proceso de Planeamiento y Construcción de Infraestructura, both of the Municipalidad de Alajuela, do not have the respective installation permits, are in operation and provide details regarding their status.
  10. 10Maryleana Méndez Jiménez, in her capacity as President of the Council of the Superintendencia de Telecomunicaciones (SUTEL), states under oath—in response to the ruling issued at 08:36 hours on 05 de mayo de 2014—that a review of the engineering tables submitted by telecommunications network operators and service providers in December 2013, conducted to determine whether the cellular telephone towers identified in the action appear in SUTEL’s records, showed that only 19 of the 25 towers identified have been registered with the Superintendencia. It may therefore be assumed that those towers are operational, since they were reported as part of the operators’ networks.
  11. 11The statutory requirements have been observed in the proceedings conducted.

Justice Cruz Castro drafted the opinion; and,

Whereas:

I.Subject matter of the action: The petitioner alleges that the Municipalidad de Alajuela has allowed the construction of 25 cellular telephone towers without an environmental impact assessment (evaluación de impacto ambiental, EIA) permit or procedure issued by SETENA. Nor has there been effective citizen participation in environmental matters. She claims that the Municipality’s omission has resulted in a violation of her right to a healthy environment.

II. Proven facts: The following facts relevant to the resolution of this matter are deemed proven

  • a)SETENA is processing 199 applications for the installation of telecommunications towers in Alajuela (Official Letter DEA-1530-2013 dated 24 de mayo del 2013, from the Departamento de Evaluación, cited in the report of the Secretaría Técnica Ambiental).
  • b)By Official Letter Nº MA-PPCI-0903-2012 dated 24 de agosto del 2012, the Director del Proceso de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela notified Movistar that the 25 reported towers were operating without the required municipal permits and therefore requested that the corresponding corrective measures be taken (copy of Official Letter Nº MA-PPCI-0903-2012 dated 24 de agosto del 2012, attached to the filing).
  • c)By Official Letter Nº MA-PPCI-0904-2012, dated 24 de agosto del 2012, the Director del Proceso de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela informed Movistar that the closure of the reported telecommunications towers had been ordered because they had been constructed and were operating without the required permits (copy of Official Letter Nº MA-PPCI-0904-2012, attached to the filing).
  • d)By Official Letter MA-PPCI-0905-2012, dated 24 de agosto del 2012, signed by the Director del Proceso de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela, the SUPERINTENDENCIA DE TELECOMUNICACIONES (SUTEL) was informed that the closure of the reported telecommunications towers had been ordered because they had been constructed and were operating without the required permits (copy of Official Letter MA-PPCI-0905-2012, attached to the filing).
  • e)By Official Letters MA-PPCI-914-2012, MA-PPCI-915-2012, MA-PPCI-916-2012, MA-PPCI-918-2012, MA-PPCI-919-2012, MA-PPCI-920-2012, MA-PPCI-921-2012, MA-PPCI-922-2012, MA-PPCI-923-2012, MA-PPCI-924-2012, MA-PPCI-925-2012, MA-PPCI-926-2012, MA-PPCI-927-2012, MA-PPCI-928-2012, MA-PPCI-929-2012, MA-PPCI-930-2012, MA-PPCI-931-2012, MA-PPCI-932-2012, MA-PPCI-933-2012, MA-PPCI-934-2012, MA-PPCI-935-2012, MA-PPCI-936-2012- MA-PPCI-937-2012, MA-PPCI-938-2012, MA-PPCI-939-2012, all dated 27 de agosto del 2012, signed by the Director del Proceso de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela and addressed to the Ingeniero del Control Fiscal Urbano, notice was provided of the locations of the towers lacking permits (official letters attached to the filing).
  • f)By Official Letter MA-PPCI-0983-2012 dated 03 de setiembre del 2012, signed by the Director del Proceso de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela and addressed to the Ingeniero del Control Fiscal Urbano, the latter was informed that the owner had been granted a period of 30 days to submit the project and apply for a building permit (licencia de construcción) for the reported towers (copy of Official Letter MA-PPCI-0983-2012 dated 03 de setiembre del 2012, attached to the filing).
  • g)By Official Letter MA-PPCI-1065-2012 dated 19 de setiembre del 2012, signed by the Director del Proceso de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela, the Alcalde de la Municipalidad de Alajuela was requested to ensure that the Proceso de Control Fiscal y Urbano fulfilled its duties so that the measures taken would be implemented (copy of Official Letter MA-PPCI-1065-2012 dated 19 de setiembre del 2012, attached to the filing).
  • h)Of the 25 towers reported by the petitioner, 19 have been registered with SUTEL; they were reported as part of the operators’ networks, and SUTEL assumes that they are operational (Report of the President of the Council of the Superintendencia de Telecomunicaciones).

III.Merits. In this matter, the petitioner raises two issues of constitutional significance. First, that the respondent Municipalidad de Alajuela has not subjected the construction of 25 cellular telephone towers to the applicable procedure, which is unlawful and may violate the rights to health and to a healthy and ecologically balanced environment. Second, she alleges that the hearing required to guarantee citizen participation in the procedure for installing those towers was omitted. In this judgment, the Court will first address its precedents concerning the installation of cellular telephone towers, in which it has emphasized the importance of and need for telecommunications infrastructure, as well as the desirability of standardizing the procedures used by the various public bodies to obtain authorizations to construct and install telecommunications infrastructure. It will then address two interconnected matters: the installation of cellular telephone towers and the rights to health and to enjoy a healthy and ecologically balanced environment. Finally, a separate section will analyze the consequences of the lack of citizen participation in the installation of telecommunications infrastructure and its possible implications under this Court’s precedents.

IV. The importance of telecommunications infrastructure. Regarding this issue, the Chamber has held

“IV.- RELEVANCE OF TELECOMMUNICATIONS INFRASTRUCTURE TO THE DEVELOPMENT OF PEOPLES UNDER PUBLIC INTERNATIONAL LAW (Derecho Internacional Público). PRIOR COMMITMENTS UNDERTAKEN BY THE COSTA RICAN STATE. The Costa Rican State has been a member of the International Telecommunication Union (ITU), a specialized agency of the United Nations, since September 13, 1936. Through Law No. 8100 of April 4, 2002, the Constitution and Convention of the International Telecommunication Union (Geneva, December 22, 1992) and the instrument amending the Constitution and Convention of the International Telecommunication Union (Kyoto 1994) were approved. The objectives set forth in the ITU Constitution include the improvement and rational use of telecommunications of all kinds; increasing the efficiency of telecommunication services, extending their use, and making them as generally available to the public as possible; promoting the extension of the benefits of new telecommunication technologies to all the world’s inhabitants; and creating, developing, and improving telecommunication facilities and networks in developing countries by every available means, among others (Article 1).

Article 6 of the ITU Constitution, concerning the implementation of the Union’s instruments, requires Member States to observe and comply with the provisions of the Constitution, the Convention, and the Administrative Regulations. Among the resolutions adopted by the Plenipotentiary Conference—the body established under the ITU Constitution, composed of delegates from each of the States Parties and convened every four years—several emphasize the importance of telecommunications infrastructure. Thus, No. 22 recognizes “that the development of telecommunication/ICT infrastructure and services is a sine qua non for social and economic development”; No. 25 considers that “further development of national telecommunication/information and communication technology (ICT) infrastructure will help bridge digital divides at the national and global levels”; No. 71 (Union Strategic Plan for 201-2015) states that one component of the “Strategic Goal of the ITU Telecommunication Development Sector” is to “promote the availability of infrastructure and foster an enabling environment for the development of ICT infrastructure (…)” and further states that “to take full advantage of the potential offered by telecommunications/ICTs, governments and other stakeholders (…) must create an underlying infrastructure sufficiently robust to overcome challenges while also seizing opportunities”; and No. 139 emphasizes “the indispensable role of telecommunication/ICT infrastructure (…) in achieving the goal of digital inclusion and enabling sustainable, widespread, and affordable access to global information.” Furthermore, several international declarations emphasize the importance of creating, improving, and developing telecommunications infrastructure as a key factor in social and economic development, including the “Florianópolis Declaration” of June 21, 2000; the “Geneva Declaration of Principles” (First Phase of the World Summit on the Information Society) of December 12, 2003, and its “Plan of Action”; and the “Tunis Commitment” (Second Phase of the World Summit on the Information Society) of November 18, 2005, and its “Agenda.” Specifically, the “Plan of Action” of the “Geneva Declaration of Principles,” in section C.2, entitled “Information and communication infrastructure: an essential foundation for the Information Society,” states as follows: “9.

Infrastructure is central to achieving the goal of digital inclusion, enabling universal, sustainable, ubiquitous, and affordable access to ICTs for all, taking into account relevant solutions already implemented in developing countries and countries with economies in transition to provide connectivity and access to remote and marginalized areas at the regional and national levels.” It should be noted that Costa Rica participated in the Geneva Declaration of Principles and its Plan of Action through a substantial delegation of seven representatives. Ultimately, the construction, development, improvement, and expansion of sound and robust telecommunications infrastructure has been established in various instruments of Public International Law as an inescapable commitment and obligation of national States, one that cannot be left to the discretion of internal territorial local governments because doing so could generate disparities, with the resulting lack of standardization and nationally coordinated telecommunications development, thereby seriously impairing the ability of inhabitants to enjoy the benefits of the information society and of new information and knowledge technologies.

V.IMPORTANCE, PUBLIC INTEREST, AND NATIONAL SCOPE OF TELECOMMUNICATIONS INFRASTRUCTURE WITHIN THE CONSTITUTIONAL AND SUBCONSTITUTIONAL LEGAL ORDER. Based on a systematic analysis of the constitutional and subconstitutional legal order currently in force, it may be concluded that telecommunications infrastructure has significance extending beyond the local or cantonal sphere, is clearly a matter of public interest, and undoubtedly constitutes an issue falling within the national sphere, with implications even in the field of Public International Law, since its development entails compliance with a series of international obligations previously assumed by the Costa Rican State. First, as this Constitutional Court has indicated, telecommunications are of great constitutional significance—so much so that Article 121, subsection 14), subparagraph c), of the Constitution provides that “wireless services” or the electromagnetic spectrum form part of the constitutionally protected public domain and, specifically, constitute property belonging to the Nation, meaning that they may neither be removed from public use nor cease to form part of the State’s domain.

The General Telecommunications Law (Ley General de Telecomunicaciones) No. 8642 of June 4, 2008—hereinafter LGT—when setting forth the guiding principles governing this sector, provides in Article 3, subsection i), that there must be an “optimization of scarce resources,” emphasizing that telecommunications infrastructure must be used in an “(…) objective, timely, transparent, nondiscriminatory, and efficient manner, with the dual objective of ensuring effective competition and the expansion and improvement of networks and services.” Specifically, the optimization, judicious use, expansion, and improvement of telecommunications infrastructure and networks are consistent with the express purposes of that body of law, including ensuring the application of the principles of universal access, efficiency, equality, continuity, quality, broader and better coverage, and solidarity in telecommunications (Article 2 LGT).

Furthermore, Article 32, subsection d), LGT states with absolute clarity that the objective of universal access, universal service, and solidarity is achieved, among other means, through the “development of infrastructure,” because only robust and fully developed infrastructure can reduce the digital divide and enable enjoyment of the benefits of the Information and Knowledge Society (sic), connectivity, and the availability of access devices and broadband services. For its part, the Law of the Regulatory Authority for Public Services (Ley de la Autoridad Reguladora de los Servicios Públicos), No. 7593 of August 9, 1993, in Article 74, as amended by the Law for the Strengthening and Modernization of Public Entities in the Telecommunications Sector (Ley de Fortalecimiento y Modernización de las Entidades Públicas del Sector Telecomunicaciones) No. 8660 of August 8, 2008, declared telecommunications infrastructure and networks to be matters of public interest by providing as follows: “The establishment, installation, expansion, renewal, and operation of public telecommunications networks or any of their components shall be deemed an activity of public interest.” This declaration has far-reaching consequences because it recognizes by law that infrastructure in this field is a matter of clear and unequivocal public or general interest that extends beyond the country’s local or regional sphere and reaches the national and international spheres, enabling the Costa Rican State to comply in good faith with a series of obligations and commitments assumed within the context of Public International Law.

It should be noted that public interest is defined by Article 113, paragraph 1, of the General Law of Public Administration (Ley General de la Administración Pública) of 1978 “as the expression of the coinciding individual interests of those subject to the Administration”; for its part, paragraph 2 of the cited provision of the LGAP of 1978 clearly provides that “The public interest shall prevail over the interest of the Public Administration when the two may conflict.”

One consequence of the foregoing is that the interests of any decentralized Costa Rican public entity, such as the municipalities, may not take precedence over the clear public interest in telecommunications infrastructure expressly declared by the national legislature through a law expressing the general will (Articles 105 and 121, subsection 1, of the Constitution). That public interest must prevail over local interests because municipal autonomy does not permit municipal governments to exempt themselves from what has been declared a matter of national interest; otherwise, territorial autonomy would be distorted, transforming municipalities into microstates removed from the inter-administrative direction or administrative oversight (tutela) that the State may exercise through its constitutional bodies by enacting valid and effective laws and through the conclusion by the Executive Branch of international conventions and treaties approved by the Legislative Assembly (Articles 7, 121, subsection 4, and 140, subsection 10, of the Political Constitution).

The declaration of public interest made by Article 74 of the Law of ARESEP likewise has sufficient and legitimate constitutional grounding in Article 45, paragraph 1, of the Political Constitution, which establishes the principle of the relative inviolability of property by recognizing expropriation “for a legally established public interest.” A second consequence arising from the declaration of public interest is that the construction, expansion or development, and improvement of telecommunications infrastructure have a clear and unequivocal national scope. Accordingly, the State and its bodies assume governance and direction in this field, to which all subordinate public entities must adhere in order to achieve objectives such as universal access and services, the reduction of the digital divide on grounds of solidarity, and the interconnection and connectivity necessary to enable all Costa Ricans, regardless of the locality, district, canton, or region in which they live, to enjoy the benefits and advantages of the Information and Knowledge Society (sic).

Far from “localizing” telecommunications infrastructure, the national legislature expressly and unequivocally made it a national matter. This is reflected in the establishment (sic) of the “Telecommunications Sector” provided for in Article 38 of the aforementioned Ley de Fortalecimiento y Modernización de las Entidades Públicas del Sector de Telecomunicaciones, which states as follows: “The Telecommunications Sector is hereby established within the framework of the State’s sectoral organization. It shall consist of the Public Administration, both centralized and decentralized, as well as public enterprises performing functions or activities related to telecommunications.” Under this provision, the telecommunications sector is cross-cutting and therefore national in nature because it encompasses the entire universe of public entities, including territorially decentralized entities such as municipalities.

Municipal governments therefore may not exempt themselves from that sector. The national character of telecommunications in general, and particularly of their infrastructure, becomes even clearer when Article 39 of the cited Law is considered, since it establishes that the sector’s “governing authority” shall be the Minister of Environment, Energy and Telecommunications, who, in exercising a general function of inter-administrative direction or administrative oversight, is responsible, among other duties, for the following: “a) Formulating policies for the use and development of telecommunications”; “b) Coordinating (…) the preparation of the National Telecommunications Development Plan (…)”; “c) Ensuring that the Sector’s policies are implemented by the public and private entities participating in the Telecommunications Sector”; “e) Issuing the National Telecommunications Plan, as well as the corresponding executive regulations”; “h) Coordinating telecommunications development policies with other public policies intended to promote the information society”; and “i) Ensuring compliance with applicable national environmental regulations and the sustainable development of telecommunications in harmony with nature.” Lastly, the clearly national character of telecommunications and their various components is evident in Article 40 of the aforementioned Law, which regulates the “National Telecommunications Development Plan,” defined in paragraph 1 of that provision as “(…) the instrument for the Sector’s general planning and direction, which defines its goals, objectives, and priorities.” The legislature therefore chose to plan telecommunications at the national level rather than merely at the local or regional level.

Furthermore, the national nature of telecommunications is reinforced by the creation of the Superintendencia de Telecomunicaciones (SUTEL), which is assigned a series of powers that are unequivocally national in scope. Thus, under Articles 59 and 60 of the Law Creating ARESEP (Ley de Creación de la ARESEP), it is responsible for “(…) regulating, applying, supervising, and enforcing the telecommunications legal framework (…)”; for all such purposes, it “shall act in accordance with the Sector’s policies, the provisions of the National Telecommunications Development Plan, the Ley General de Telecomunicaciones, the provisions established in this Law, and all other applicable statutory and regulatory provisions.” The “Plan Nacional de Desarrollo de las Telecomunicaciones” 2009-2014, for its part, provides that: “To make progress in harnessing the benefits of the Information and Knowledge Society, the country must undertake a significant investment effort in developing telecommunications infrastructure so as to provide more and better telecommunications services to all sectors of the population.

In this regard, infrastructure development in that sector constitutes a necessary and indispensable condition that must receive special priority in any national ICT project (…)”; it then specifies that, to develop the national telecommunications infrastructure, the following guidelines must be followed: “a.1 Take the measures necessary to ensure that the country has modern telecommunications infrastructure while also ensuring the provision of quality services and the creation of value-added applications, enabling convergence, interoperability among systems, the adoption of advanced technologies, and secure communications”; and “a.6 Ensure the development of infrastructure that makes it possible to provide telecommunications services to all inhabitants of the country, fulfilling the objectives and goals of universal access, universal service, and solidarity (…).” This is, therefore, a plan that, by express provision of law, is binding upon or imposes obligations on, among others, municipal entities, and requires them to have a robust, modern, optimal, adequate, and developed telecommunications infrastructure in order to enjoy the benefits of the Information and Knowledge Society (sic).

The achievement of this goal or objective will necessarily be thwarted if each territorial corporation, in a matter clearly national in scope, seeks to establish its own direction and requirements above national legislation and the instruments of Public International Law that are binding upon all entities comprising the State in the broad sense.

VI. TELECOMMUNICATIONS INFRASTRUCTURE, MUNICIPALITIES, REGULATORY PLANS, ZONING, LAND-USE CERTIFICATES, AND BUILDING PERMITS

In a clear attempt to provide consistency and standardization in matters of telecommunications infrastructure, given that this is an issue of an unmistakably national nature, a significant number of generally applicable regulatory instruments have been enacted at both the national and cantonal levels. Thus, the Executive Branch issued Decree No. 36159 of 10 May 2010, entitled “Standard Rules and Powers of Public Entities for the Coordinated and Expeditious Approval Required for the Installation and Expansion of Telecommunications Networks,” whose purpose was to standardize the procedures for obtaining authorizations to construct and install telecommunications infrastructure in view of the prevailing regulatory fragmentation and to fill existing gaps in this area. Article 10°, paragraph 1°, of this Executive Decree provided that municipalities have the authority to “Issue land-use certificates (certificados de uso de suelo), in accordance with the Regulatory Plan (Plan Regulador) or its regulations in force, provided that such plan or regulations contemplate the installation of telecommunications infrastructure.

In cases where the Regulatory Plan and local regulations do not address this matter, land-use certificates shall conform to the provisions of articles 4, 5, 6 and 11 of this decree.” Consequently, the decree recognizes two scenarios: a) The respective municipality has a Regulatory Plan and, specifically, Zoning Regulations (Reglamento de Zonificación), which regulate the installation of telecommunications infrastructure; and b) In the absence of such regulations, the municipal government must consider and decide the application for a land-use certificate pursuant to articles 4° (integration of rules), 5° (public interest in the establishment, installation, expansion, renewal, and operation of public telecommunications networks), 6° (definition of a public telecommunications network), and 11° (principles governing the granting of land-use approvals and building permits) of that Executive Decree. Article 11° of the Executive Decree under discussion provides as follows:

“1. In cases where zoning for the installation of telecommunications infrastructure is not explicit or is not established in each Municipality’s Regulatory Plan, or where land-use planning regulations (ordenamiento territorial) conflict with it or do not regulate this matter, pursuant to the principle of legality established in both article 11 of the Political Constitution and article 11 of the General Law on Public Administration, the Municipality shall facilitate its establishment, expansion, renewal, and operation by applying the provisions of article 74 of the Law on the Regulatory Authority for Public Services, Law No. 7593, which declares the activities of establishing, installing, expanding, renewing, and operating public telecommunications networks or any of their components to be in the public interest. In all cases, that decision shall likewise require compliance with the guiding principles of the Telecommunications Sector set forth in article 3 of the General Telecommunications Law and with the principle of legality to which the entire Public Administration is subject pursuant to article 11 of the General Law on Public Administration and article 11 of the Political Constitution.

2. By virtue of the provisions of subsections a) and h) of article 3 of the General Telecommunications Law, Law No. 8642, as well as the provisions of article 74 of the Law on the Regulatory Authority for Public Services, Law No. 7593, and in compliance with the principle of legality established in article 11 of the General Law on Public Administration and article 11 of the Political Constitution, municipalities shall base their actions for granting ‘conforming land-use approvals’ and ‘building permits’ on the following principles:

  • a)Principle of universality, so as to promote the granting of the aforementioned authorizations, without discrimination of any kind, to all parties interested in offering telecommunications services in the canton, in order to guarantee at least a minimum level of telecommunications services on equal terms for the inhabitants of all areas and regions of the country.
  • b)Principle of technological neutrality, so that the granting of the aforementioned authorizations guarantees the right of network operators and telecommunications service providers to select the technologies they will use.
  • c)The declaration of public interest established in article 74 of the Law on the Regulatory Authority for Public Services, so that the aforementioned authorizations are granted in recognition that the establishment, installation, expansion, renewal, and operation of public telecommunications networks or any of their components is in the public interest. (…)” Beginning in December 2010, several municipal corporations jointly approved and published their respective “General Regulations for Municipal Telecommunications Licenses,” based on model draft regulations that were adopted by most territorial entities and that contain, with respect to land-use certificates, a provision repeated in nearly all of them in the following terms: “The Land-Use Certificate shall be issued as a conforming use in any zoning area of the canton, provided that the requirements and conditions established in this Chapter are met.” The requirements include completing a form indicating the height of the tower, georeferencing the location of the tower’s center using longitude and latitude coordinates, a registered cadastral survey plan (plano catastrado), and the applicant’s identity card or certification of legal representation.

The properties on which the infrastructure is installed or located must also have certain minimum frontage and depth dimensions, a minimum buffer strip around the structure, minimum and maximum heights, setbacks, etc. Those municipal regulations even provide for the possibility of making exceptions to such requirements when the applicant demonstrates the need for different parameters based on technical studies supporting them. Under this interpretation, municipalities must issue land-use certificates for the construction and installation of telecommunications infrastructure in any zoning area of the canton; therefore, the preexisting Regulatory Plan or Zoning Regulations—if any—need not be revised, amended, or supplemented to establish a specific zone in which telecommunications infrastructure may be located. To locate the infrastructure, it is sufficient to comply with the technical and siting requirements established by national legislation and by the specific regulations of the Executive Branch or the municipalities. In this particular case, the “General Regulations for Municipal Telecommunications Licenses of the Municipalidad de Goicoechea” of 1° June 2011 provide in article 11°, final paragraph, as follows:

“The structures referred to in these Regulations should preferably be located in the Industrial Zones currently defined by the Regulatory Plan, without prejudice to their location in other places within the Canton under the terms of these Regulations.” Section 11°, final paragraph, of the aforementioned regulations of the Municipalidad de Goicoechea is sufficiently clear in providing that a land-use certificate for the construction and installation of a telecommunications tower or antenna may be granted in any of the areas or zones previously established in the Regulatory Plan and, particularly, in the Zoning Regulations, without any need to revise, supplement, or amend such instruments, provided that the remaining requirements and conditions established by the legal system are met. With respect to the building permit for the installation, expansion, or modification of a telecommunications tower or antenna, the Urban Planning Law (article 29) and the aforementioned municipal regulations make its issuance conditional upon obtaining a land-use certificate and satisfying other formal and technical requirements.” (Judgment Nº 015763-2011, issued at nine forty-six a.m. on 16 November 2011).

V.The relationship between health and the environment and the installation of cellular telephone towers. In the case at hand (sub lite), 25 cellular telephone towers were constructed without following the procedures for their installation and without obtaining either a building permit or an operating license. Of the 25 towers, according to a report by the President of the SUTEL Council (official letter 3240-SUTEL-CS-2014, of 23 May 2014), at least 19 are reportedly in operation, as they were reported as part of the operators’ networks. The evidence submitted in the case file does not show, with respect to any of the 25 reported towers, that the respondent Municipalidad de Alajuela took effective measures to regularize the proceeding initiated outside the applicable regulations. The potential impact on health of installing telecommunications and cellular telephone towers is an issue that this Chamber has addressed extensively.

In each case, it has held, on the one hand, that there is currently simply insufficient evidence to conclude that such towers pose a danger to public health (decision Nº 2010-014449 issued at 08:54 on 31 August 2010). Accordingly, as there are no grounds for changing that position, the application must be dismissed with respect to this claim. Regarding the appellant’s allegation of a possible infringement of the right to enjoy a healthy and ecologically balanced environment, due to the failure to comply fully with the requirements and procedures governing the construction of cellular-signal transmission towers, in decision 2012-016866 issued at 14:30 on 04 December 2012, the Chamber held:

“V.- ON THE VIOLATION OF THE RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT. In the present matter, the appellants claim that the location where the cell-phone tower in question is being constructed endangers the aquifers (mantos acuíferos). In this regard, it has been established that the Secretaría Técnica Nacional Ambiental granted environmental viability (viabilidad ambiental) to the cell-phone tower, finding that, although it is true that no SENARA study exists, it was verified that the water table (nivel freático) lies at a depth of six meters, such that drilling a 2.5-meter hole does not affect the aquifers in the area. However, notwithstanding the statements made by the representative of the Secretaría Técnica Nacional Ambiental, it is also true that the General Manager of the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) expressly states that the water-table levels in the area range from 0.39 meters to 30 meters in depth and that SENARA has no hydrogeological studies (estudios hidrogeológicos) for the area to determine whether the construction and operation of the Telecommunications Tower has any impact on the water table or on the vulnerability of the water resource (recurso hídrico).

This is because it has received no consultation requesting an opinion regarding the proposed project ‘mobile-phone antenna in La Unión,’ and no hydrogeological study has been submitted assessing the conditions of the aquifer in the affected area. Nevertheless, he explains that the Telecommunications Tower does not in itself have an impact on the aquifer, although the hydrocarbons to be used for the emergency generator could pose a threat to groundwater, because the water-table levels are very shallow. Accordingly, he argues that the water-table levels are very shallow and that there is a risk of contamination from the use of hydrocarbons in the tower’s operation, in addition to the fact that SETENA has not forwarded to SENARA any reports concerning this project that the interested party may have submitted to SETENA for the purpose of assessing the risk of hydrocarbon contamination. He therefore concludes that the structural construction (obra gris) is not considered capable of affecting the aquifer, except in the case of hydrocarbons.

In view of this situation, the SENARA representative, through official letter DIGH-875-10 sent to SETENA’s Departamento de Evaluación Ambiental, recommended the requirements to be considered with respect to Telecommunications Towers, since their operation requires emergency generators that use fossil fuels, as well as other recommendations. Thus, this Court finds it established that there is a risk of contamination arising from the construction of the Cell-Phone Tower in question, based on the statements of the General Manager of the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) that the use of hydrocarbons in the operation of the tower presents a risk of contamination, given that the water-table levels are very shallow. In this regard, there is no evidence that the SETENA representative took SENARA’s recommendations into account or forwarded to SENARA the reports concerning this project for assessment of the risk of hydrocarbon contamination, confirming that the risk of contamination has not been dispelled.

Likewise, neither the representative of Claro CR Telecomunicaciones S.A. nor the representatives of the Municipalidad de La Unión address these facts, leaving SENARA’s statements unrefuted. That said, it is not for this Court to determine whether this facility will use energy to power the equipment to be installed on the telecommunications tower—with the only telecommunications equipment requiring hydrocarbon fuel being the diesel-powered motor-generator, as stated by the representative of Claro CR—or whether fossil fuels and hydrocarbons will be used to generate that energy, since SETENA and SENARA are the entities responsible for addressing their use. In summary: because the risk to the aquifers of contamination from the use of hydrocarbons identified by SENARA has been established, this Court finds a violation of the right to a healthy and ecologically balanced environment, pursuant to the precautionary principle (principio precautorio) set forth in the preceding recital (considerando).

Consequently, the appropriate course is to grant the present constitutional appeal (recurso) with respect to this issue.” Beyond the challenge to the operating requirements for the towers, this matter reveals a complete absence of studies and construction permits establishing the conditions governing the location, construction, and installation of the structures. The administration has been unable to assess whether the towers comply with, among other requirements, acceptable dimensions or whether the soil on which they are installed is suitable. Consequently, the presumption that exposure to those electromagnetic fields poses no risks to public health or the environment does not apply, because that presumption applies when the installation of cellular-telephone infrastructure allows for an assessment of the minimum technical requirements and studies established by the applicable regulations.

It follows that the complete absence of permits for the installation of the towers gives rise to the presumption that they were constructed through unauthorized direct action (vía de hecho), which, based on the cited case law, endangers the right to enjoy a healthy and ecologically balanced environment. Indeed, in this case, the representatives of the respondent Municipalidad report that the land-use authorization (uso de suelo) required before the installation of telecommunications infrastructure has not been submitted. Nor has a construction license (licencia de construcción) been obtained for that type of infrastructure; and no evidence has been provided that those conditions were subsequently satisfied in order to rule out potential environmental problems at the locations where the telephone infrastructure was installed. Consequently, it is unknown—and there are no data indicating—whether the towers were erected in sensitive areas requiring technical analyses to measure and rule out potential harm, such as harm that could occur if the towers were installed in areas where aquifers would be affected.

This omission is noted by Ms. Sisy Castillo Ramírez, in her capacity as Ministra de Salud, who informs this Chamber that the authority to issue permits for the location and/or construction of cell-phone towers lies with the local governments, as established in Article XIX 2 bis of the Reforma al Reglamento de Construcciones, which states: “(…) The installation, expansion, or modification of the telecommunications network or infrastructure may be located anywhere within the national territory, must comply with the technical quality and coverage parameters defined by SUTEL, and shall be the responsibility of telecommunications operators and providers duly accredited and authorized for that purpose. They must apply to the respective Municipalidad to obtain conforming land-use authorization, in accordance with the technical provisions of these regulations, and a construction license. In the case of sensitive areas, as identified by the Ministerio de Salud, that entity shall be responsible for defining the applicable setbacks and conditions.” (Emphasis in the original.) From the report submitted by the Alcalde Municipal and the Director del Proceso de Planeamiento y Construcción de Infraestructura, both of the Municipalidad de Alajuela, it may be inferred that those authorities tolerated the construction of the towers without having granted the corresponding authorization and that, to date, despite more than one year having passed since they became aware of the irregular situation, they have taken no measures to regularize the procedure and have instead adopted a passive stance.

Based on the foregoing considerations, pursuant to the Precautionary Principle (Principio de Precaución) of the Declaración de Río de Janeiro de junio de 1992, sobre Medio Ambiente y Desarrollo, as well as the provisions of judgment Nº 2012016866 of 14:34 hours on 04 de diciembre de 2012, the appeal must be granted for violation of the right to enjoy an ecologically balanced environment.

VI.Citizen participation (participación ciudadana) in the approval of permits or licenses for the construction of telecommunications infrastructure. Regarding the alleged failure to hold a public hearing (audiencia pública) in which residents could participate during the processing of the installation of cellular towers, this Chamber reiterates what it held in judgment number 015763-2011 of 09:46 hours on 16 de noviembre de 2011, cited supra. Consistent with that precedent, it finds that the granting of a municipal construction license for a telecommunications tower or antenna, or the granting of a land-use certificate (certificado de uso de suelo) in accordance with existing zoning, does not entail an amendment or reform of the Plan Regulador or of the zoning established in the urban-development regulations forming part thereof. In view of the strategic and essential nature of telecommunications for social and economic development, there is a declared national public interest, which authorizes municipal corporations to issue land-use certificates and, on the basis of those certificates and other requirements, construction licenses for telecommunications infrastructure, without needing to amend or reform the preexisting Planes Reguladores and municipal regulations forming part thereof.

In the case under review, the precedent applies, as noted, because permits to install telecommunications towers do not entail an amendment or reform of the Plan Regulador or of the zoning established in the urban-development regulations. Under these circumstances, there is no reason to depart from that position, and the appeal must be denied, because the installation of telecommunications antenna towers does not require a prior public hearing in which residents of the community may participate.

VIII Dissenting opinion (voto salvado) of Justices Armijo Sancho and Cruz Castro regarding citizen participation (participación ciudadana). We respectfully dissent from the majority opinion insofar as it concerns the lack of notice and opportunity for citizen participation in the procedure for constructing cellular telephone towers. As stated in the dissenting opinion concerning judgment number 015763-2011 of 09:46 on November 16, 2011, we recognize and underscore the legal significance of both the fundamental right to telecommunications and the constitutional right to participatory government. On the one hand, the importance of telecommunications to the development of society and the personal development of citizens is recognized; on the other, the construction of cellular telephone towers also affects legally significant community interests. It is apparent in this matter that the cellular telephone towers were installed through unauthorized de facto actions (vías de hecho), without complying with installation or operating requirements and without adhering to the regulations governing the subject.

Likewise, the installation process reveals the absence of a prior public-consultation mechanism (mecanismo de consulta pública previa), which is contrary to the right to citizen participation in the procedure for constructing cellular telephone towers; accordingly, we would grant the action with respect to this issue.

Por tanto:

The action is partially granted, solely on the grounds of violation of the Precautionary Principle (Principio Precautorio). ROBERTO HERNÁN THOMPSON CHACÓN, in his capacity as Municipal Mayor of Alajuela, and ROY DELGADO ALPÍZAR, in his capacity as Director del Proceso de Planeamiento y Construcción de Infraestructura, both of the Municipalidad de Alajuela, or whoever holds those offices, are ordered to take the necessary measures so that, within a maximum period of three months from notification of this judgment, the applicable legal requirements concerning the processing of the prerequisites and authorizations required for the installation and construction of the 25 reported telecommunications towers in the Cantón Central de Alajuela are satisfied. They are hereby warned that they could incur the offense defined in article 71 of the Ley de la Jurisdicción Constitucional, which provides that any person who receives an order issued in an amparo action (recurso de amparo) that the person must comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years or fined twenty to sixty days, provided that the offense is not subject to a more severe penalty.

The action is denied in all other respects. The Municipalidad de Alajuela is ordered to pay the legal costs, damages, and losses caused by the events underlying this ruling, which shall be assessed during enforcement of the judgment (ejecución de sentencia) in contentious-administrative proceedings (proceso contencioso administrativo). Justices Armijo Sancho and Cruz Castro dissent regarding citizen participation. SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas cinco minutos del trece de junio de dos mil catorce.

Recurso de amparo que se tramita en expediente número 13-002986-0007-CO, interpuesto por YASMIN HERRERA MAHOMAR, cédula de identidad 0401280766, contra el ALCALDE DE ALAJUELA y el DIRECTOR DEL PROCESO CONTROL URBANO, ambos de la MUNICIPALIDAD DE ALAJUELA.

RESULTANDO:

  1. 1Por escrito recibido en la Secretaría de la Sala el 13 de marzo de 2013 la recurrente interpone recurso de amparo contra el ALCALDE DE ALAJUELA y el DIRECTOR DEL PROCESO CONTROL URBANO, ambos de la MUNICIPALIDAD DE ALAJUELA y manifiesta que el municipio accionado ha permitido la construcción de veinticinco torres de telefonía celular en diferentes lugares del cantón de Alajuela. Indica que dichas construcciones han sido permitidas sin contar con ningún tipo de permiso municipal ni procedimiento de evaluación ambiental o licencia ambiental emitida por parte de la Secretaría Técnica Nacional Ambiental (SETENA). Indica que al no existir ningún tipo de permiso municipal ni evaluación ambiental de las torres construidas en la jurisdicción de la Municipalidad de Alajuela, los ciudadanos se encuentran desprotegidos ante la ilegítima proliferación de estas estructuras, pues su construcción viola de forma absoluta e irreparable el derecho de participación ciudadana al acceso a la información y la garantía de participación efectiva en la toma de decisión del los proyectos ambientales, lo cual es un eco del derecho constitucional a un ambiente sano y ecológicamente equilibrado, contenido en el artículo 50 constitucional.Reclama que, aunque estos hechos le constan a la Municipalidad recurrida, no ha manifestado interés en detener los hechos descritos, pues no ha intervenido ejerciendo sus competencias de fiscalización o de autorización de forma efectiva. Aduce que se está desarrollando una conducta potencialmente lesiva del derecho a un ambiente sano y ecológicamente equilibrado y el derecho de participación ciudadana. Solicita que se declare con lugar el recurso de amparo en todos sus extremos; que se ordene al Alcalde y al Director del Proceso de Control Fiscal y Urbano de la Municipalidad de Alajuela realizar las acciones que estén dentro del ámbito de sus competencias para retirar de inmediato las antenas de telecomunicaciones; que no se permita su reinstalación hasta tanto no cumplan con los requerimientos establecidos por SETENA; y se condene a los recurridos en forma solidaria al pago de las costas correspondientes.
  2. 2Informan bajo juramento ROBERTO HERNÁN THOMPSON CHACÓN, en su calidad de Alcalde Municipal de Alajuela; y ROY DELGADO ALPÍZAR, en su calidad de Director del Proceso de Planeamiento y Construcción de Infraestructura de esa Municipalidad que se han aprobado permisos a lo largo del Cantón de Alajuela, cuyos requisitos son los mismos que los exigidos para un permiso de construcción convencional, además de la revisión de que no existan otras torres a una distancia mínima de 250 metros. Señalan que, como parte del trámite, el propietario del terreno donde se va a ubicar la torre haya emitido su visto bueno por escrito. Explican que los planos constructivos deben contar con el visado de la Dirección General de Aviación Civil y la viabilidad ambiental de SETENA. Refiriéndose a las torres denunciadas, informa que el Departamento de Proceso de Planeamiento y Construcción de Infraestructura y el de Proceso de Control Fiscal y Urbano han coordinado lo necesario para tomar todas las acciones que corresponden por parte de inspectores municipales, por no contar con los respectivos permisos en ese momento; denuncias debidamente informadas al Proceso de Control Fiscal y Urbano.
  3. 3Informa bajo juramento WILLIAM QUIRÓS SELVA, en su calidad de Presidente del Concejo Municipal de Alajuela, en el mismo sentido que Roberto Hernán Thompson Chacón y Roy Delgado Alpízar.
  4. 4Informa bajo juramento URIEL JUÁREZ BALTODANO, en su calidad de Secretario General de la SETENA que, acorde con las potestades de esa institución, ésta actúa a partir de que el administrado presenta el formulario de impacto ambiental (art. 84 inciso a) de la Ley Orgánica del Ambiente (LOA) o bien, una vez presentada la denuncia contra actividad, obra o proyecto con expediente administrativo en SETENA (art. 51 del Decreto Ejecutivo N°31849 Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA). Sobre los hechos citados indica que, conforme a criterio técnico del Departamento de Evaluación Ambiental, por medio del oficio DEA-1530-2013 del 24 de mayo del 2013, se han presentado 199 solicitudes para la instalación de torres de telecomunicación en Alajuela, las que se encuentran en diferentes estados de tramitología. La SETENA solo cuenta con la competencia para otorgar o denegar una viabilidad ambiental cuando el proyecto nuevo se somete a EIA ante esta dependencia.En este caso, se ve imposibilitado de brindar una mayor información para determinar si las 25 torres denunciadas por el recurrente se encuentran dentro de esas 199 que se sometieron al proceso de evaluación de impacto ambiental o no se han tramitado ante el SETENA, porque no detalla el recurrente el número de expediente administrativo (si existe), el nombre del desarrollador, o bien la ubicación geográfica de cada unA de esas torres. Solicita que se declare sin lugar el recurso de amparo en lo que corresponde a la SETENA.
  5. 5Informa bajo juramento SISY CASTILLO RAMÍREZ en su condición de Viceministra de Salud, actuando en este caso como Ministra de Salud, y manifiesta que solicitó informe del asunto a quien por competencia territorial le corresponde, es decir, a las Áreas Rectoras de Salud de Alajuela 1 y Alajuela 2; por lo que el Dr. Jaime Gutiérrez y el Dr. Ronald Mora Solano, respectivamente rindieron informe mediante oficio Nº CN-ARS-A1-1673-2013. En dicho oficio, exponen que, revisada y analizada la documentación legal del caso, NO encontraron que sea responsabilidad de un Área Rectora de Salud otorgar permisos de ubicación y/o construcción de las torres de telefonía celular; pues es competencia de los Gobiernos locales como se establece en el artículo XIX 2 bis de la Reforma al Reglamento de Construcciones que dice: “La instalación, ampliación o modificación de la red o infraestructura de telecomunicación se podrá ubicar en cualquier parte del territorio nacional, deberá cumplir con los parámetros técnicos de calidad y cobertura definidas por la SUTEL y estará a cargo de los operadores y proveedores de las telecomunicaciones debidamente acreditados y habilitados para tal efecto, debiendo acudir a la Municipalidad respectiva para la obtención del uso del suelo conforme, a las disposiciones técnicas del presente reglamento, y la licencia de construcción.En caso de zonas sensibles; así identificadas por el Ministerio de Salud, será esta entidad quien se encargará de definir los retiros y condiciones aplicables.” Manifiesta que no tiene conocimiento de que exista en el cantón de Alajuela zonas declaradas “sensibles”. Destaca de lo anterior que no es competencia del Ministerio de Salud, sino es deber de las Municipalidades otorgar las licencias de construcción para este tipo de torres, garantizar que estén en zonas adecuadas y vigilar que se cumpla con el artículo 50 constitucional. Por último, indica que a la fecha de redacción del informe no se tiene ninguna denuncia en las Áreas Rectoras mencionadas interpuesta por la recurrente. Solicita se desestime el recurso planteado.
  6. 6Informa bajo juramento OFELIA TAITELBAUM YOSELEWICH, en su condición de Defensora de los Habitantes de la República, que en la institución que representa no se registró desde el año 2002 hasta la fecha, ninguna denuncia interpuesta por la recurrente. Afirma que esto fue constatado por medio de minuciosa revisión del sistema electrónico de registro de denuncias; además se remitió circular vía correo electrónico a todos los funcionarios con el propósito de requerir información que pudiera indicar que se había tramitado una denuncia en los términos expuestos por la recurrente; y dado a que tampoco se obtuvieron resultados positivos se arribó a la total certeza de que no se recibió denuncia alguna de la habitante. Manifiesta que le extraña que la recurrente nunca haya dispuesto alguna de las formas de comunicación que dispone la institución con el fin de corroborar la recepción de denuncia. Indica que la recurrente no hace alusión a actuaciones u omisiones imputables a la Defensoría de los Habitantes, por lo que a pesar de que no tiene una base fáctica para pronunciarse sobre los hechos particulares derivados del caso concreto, no omite decir que sí cuenta con información valiosa en el tema del impacto ambiental de las torres de telecomunicaciones.Por eso supone que se ha solicitado informe a la Defensoría, no por ser parte en el asunto sino para colaborar con la Administración. Conforme a lo anterior, se hace referencia al tema de las torres de telefonía desarrollado en el expediente Nº 64560-2010-SI, del cual se emitieron recomendaciones al Ministerio de Salud, Ministerio de Ambiente, Energía y Telecomunicaciones, la SETENA, Comisión de Coordinación para la Instalación o Ampliación de Redes de Telecomunicaciones, la Superintendencia de Telecomunicaciones, las Municipalidades, el Instituto de Normas Técnicas de Costa Rica,la Dirección de Normalización, así como una sugerencia a la Presidencia de la Asamblea Legislativa. Aclara que el cumplimiento de estas recomendaciones contó con un proceso que concluyó con un Informe de Cierre de Seguimiento, que constituye parte del elenco probatorio que adjunta en este caso la Defensoría de los Habitantes.Considera que el caso de la recurrente debe ser atendido con la urgencia posible, de modo que su situación, y la de diversas comunidades que guardan cercanía con las torres, no presenten mayores complicaciones ambientales o de salud; que se garantice la protección a las bellezas naturales y se enderecen los trámites para respetar los principios de información y participación ciudadanas.
  7. 7Por resolución de las 11:20 horas del 17 de marzo de 2014 se pide al Alcalde Municipal de Alajuela que amplíe el informe sobre el trámite de denuncia de falta de permisos en instalación de torres de telefonía celular.
  8. 8Informan bajo juramento ROBERTO HERNÁN THOMPSON CHACÓN, en su calidad de Alcalde Municipal de Alajuela; y ROY DELGADO ALPÍZAR, en su calidad de Director del Proceso de Planeamiento y Construcción de Infraestructura, ambos de la Municipalidad de Alajuela, que se están llevando a cabo notificaciones por falta de permiso de construcción por parte de personeros del Departamento de Proceso de Control Fiscal de esa Municipalidad de Alajuela.
  9. 9Como prueba para mejor resolver, por resolución de las 08:36 horas del 05 de mayo de 2014 se pidió informe a la Superintendencia de Telecomunicaciones, par que indique se encuentran en funcionamiento y detalle en qué situación están las veinticinco torres de telefonía celular, ubicadas en diferentes partes del Cantón de Alajuela, a las que se refiere el recurrente y que, según el Alcalde Municipal y el Director del Proceso de Planeamiento y Construcción de Infraestructura, ambos de la Municipalidad de Alajuela, no cuentan con los respectivos permisos de instalación.
  10. 10Informa bajo juramento, Maryleana Méndez Jiménez, en su calidad de Presidente del Consejo de la Superintendencia de Telecomunicaciones (SUTEL) -en atención a la resolución de las 08:36 horas del 05 de mayo de 2014- que, de la revisión de las tablas de ingeniería aportadas pro los operadores de redes y proveedores de servicios de telecomunicaciones, en diciembre de 2013, con el fin de verificar si las torres de telefonía celular indicadas en el recurso se encuentran dentro de los registros de la SUTEL, de las 25 torres señaladas la Superintendencia únicamente se han registrado 19. A partir de lo cual es posible asumir que dichas torres se encuentran en funcionamiento, pues fueron reportadas como parte de las redes de los operadores.
  11. 11En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Cruz Castro; y,

Considerando:

I.Objeto del recurso: La recurrente aduce que la Municipalidad de Alajuela ha permitido la construcción de 25 torres de telefonía celular, sin que éstas cuenten con un permiso o procedimiento de EIA, emitido por parte de la SETENA. Tampoco se ha contado con la participación efectiva de los ciudadanos en temas ambientales. Acusa que la omisión de la Municipalidad ha ocasionado que se violente su derecho a un ambiente sano.

II. Hechos probados: De importancia para la resolución de este asunto se tienen por demostrados los siguientes hechos

  • a)En la SETENA se tramitan 199 solicitudes para la instalación de torres de telecomunicación en Alajuela, (Oficio DEA-1530-2013 del 24 de mayo del 2013, del Departamento de Evaluación citado en informe de la Secretaría Técnica Ambiental) b) Mediante oficio Nº MA-PPCI-0903-2012 del 24 de agosto del 2012, el Director del Proceso de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela, pone en conocimiento de la empresa Movistar que las 25 torres denunciadas están en funcionamiento sin contar con los permisos municipales requeridos, por lo que solicita se tomen las medidas correctivas correspondientes (copia del oficio Nº MA-PPCI-0903-2012 del 24 de agosto del 2012, adjunto escrito interposición).
  • c)Mediante oficio Nº MA-PPCI-0904-2012, de fecha 24 de agosto del 2012, el Director del Proceso de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela, comunica a Movistar que se ordenó la clausura de las torres de telecomunicación denunciadas, pues fueron construidas y están en funcionamiento sin contar con los permisos requeridos (copia oficio Nº MA-PPCI-0904-2012, adjunto escrito de interposición).
  • d)Mediante oficio MA-PPCI-0905-2012, de fecha 24 de agosto del 2012 suscrito por el Director del Proceso de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela, comunica a la SUPERINTENDENCIA DE TELECOMUNICACIONES (SUTEL) que se ordenó la clausura de las torres de telecomunicación denunciadas, toda vez que fueron construidas y están en funcionamiento sin contar con los permisos requeridos (copia oficio MA-PPCI-0905-2012, adjunto escrito interposición).
  • e)Mediante oficios MA-PPCI-914-2012, MA-PPCI-915-2012, MA-PPCI-916-2012, MA-PPCI-918-2012, MA-PPCI-919-2012, MA-PPCI-920-2012, MA-PPCI-921-2012, MA-PPCI-922-2012, MA-PPCI-923-2012, MA-PPCI-924-2012, MA-PPCI-925-2012, MA-PPCI-926-2012, MA-PPCI-927-2012, MA-PPCI-928-2012, MA-PPCI-929-2012, MA-PPCI-930-2012, MA-PPCI-931-2012, MA-PPCI-932-2012, MA-PPCI-933-2012, MA-PPCI-934-2012, MA-PPCI-935-2012, MA-PPCI-936-2012- MA-PPCI-937-2012, MA-PPCI-938-2012, MA-PPCI-939-2012, todos del 27 de agosto del 2012, suscritos por el Director del Proceso de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela dirigidos al Ingeniero del Control Fiscal Urbano, se informa la localización de las torres que carecen de permisos (oficios adjuntos al escrito de interposición).
  • f)Mediante oficio MA-PPCI-0983-2012 del 03 de setiembre del 2012 suscrito por el Director del Proceso de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela, dirigidos al Ingeniero del Control Fiscal Urbano, se le informa que se otorgó un plazo de 30 días para que el propietario presente el proyecto y solicite la licencia de construcción de las torres denunciadas (copia oficio MA-PPCI-0983-2012 del 03 de setiembre del 2012, adjunta a escrito de interposición).
  • g)Mediante oficio MA-PPCI-1065-2012 del 19 de setiembre del 2012, suscrito por el Director del Proceso de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela, se solicita al Alcalde de la Municipalidad de Alajuela que el Proceso de Control Fiscal y Urbano cumpla con sus competencias para que las gestiones realizadas sean ejecutadas (copia oficio MA-PPCI-1065-2012 del 19 de setiembre del 2012, adjunta a escrito de interposición).
  • h)De las 25 torres denunciadas por el recurrente, ante la SUTEL se han registrado 19 de éstas, que fueron reportadas como parte de las redes de los operadores y asume la SUTEL se encuentran funcionando (Informe Presidente del Consejo e la Superintendencia de Telecomunicaciones).

III.Sobre el fondo. En este asunto, la recurrente plantea dos consideraciones de relevancia constitucional. Que la Municipalidad de Alajuela recurrida no ha sometido al trámite correspondiente la construcción de 25 torres de telefonía celular, lo que resulta ilegítimo y puede vulnerar derecho a la salud y a un ambiente sano y ecológicamente equilibrado. En segundo lugar acusa que se ha omitido la audiencia que garantice la participación ciudadana en el procedimiento de instalación de dichas torres. En esta sentencia, se referirá el Tribunal en primer lugar, a sus precedentes relacionados con la instalación de torres de telefonía celular en los que ha destacado la importancia y necesidad de la infraestructura de telecomunicaciones, así como la conveniencia de uniformar los trámites para obtener autorizaciones para construir e instalar infraestructura de telecomunicaciones, por parte de los distintos órganos públicos. Luego abordará el tema que constituye un binomio: instalación de torres de telefonía celular y derechos a la salud y a gozar de un medio ambiente sano y ecológicamente equilibrado. Finalmente, en otro apartado, se analizará las consecuencias de la falta de participación ciudadana en la instalación de la infraestructura de telefonía y sus posibles implicaciones de acuerdo con los precedentes de este Tribunal.

IV. De la importancia de una infraestructura de telecomunicaciones. En cuanto a este tema, la Sala ha dicho

“IV.- RELEVANCIA DE LA INFRAESTRUCTURA DE TELECOMUNICACIONES PARA EL DESARROLLO DE LOS PUEBLOS EN EL DERECHO INTERNACIONAL PÚBLICO. COMPROMISOS PREVIOS ASUMIDOS POR EL ESTADO COSTARRICENSE. El Estado costarricense forma parte de la Unión Internacional de Telecomunicaciones (UIT), organismo especializado de la Organización Mundial de las Naciones Unidas, desde el 13 de septiembre de 1936. Mediante la Ley No. 8100 de 4 de abril de 2002, se aprobaron la Constitución y Convenio de la Unión Internacional de Telecomunicaciones (Ginebra 22 de diciembre de 1992) y el instrumento de enmienda a la Constitución y Convenio de la Unión Internacional de Telecomunicaciones (Kyoto 1994). En la Constitución de la UIT figuran objetivos tales como los de mejoramiento y empleo racional de toda clase de telecomunicaciones, aumentar el rendimiento de los servicios de telecomunicación, acrecentar su empleo y generalizar al máximo su utilización por el público, promover la extensión de los beneficios de las nuevas tecnologías de telecomunicaciones a todos los habitantes del planeta, la creación, el desarrollo y el perfeccionamiento de las instalaciones y redes de telecomunicación en los países en desarrollo por todos los medios que se disponga, etc. (artículo 1).

El artículo 6 de la Constitución de la UIT, en lo relativo a la ejecución de los instrumentos de la unión, obliga a los Estados miembros a observar y atenerse a las disposiciones de la Constitución, el Convenio y los Reglamentos administrativos. Entre las resoluciones adoptadas por la Conferencia de Plenipotenciarios –órgano previsto en la Constitución de la UIT, conformado por delegados de cada uno de los Estado partes y que se reúne cada cuatro años-, hay varias que destacan la relevancia de la infraestructura en telecomunicaciones, así en la No. 22 se reconoce “que el desarrollo de la infraestructura y los servicios de telecomunicaciones/TIC es una condición sine qua non del desarrollo social y económico”, en la No. 25 se considera que “un mayor desarrollo de las infraestructuras nacionales de las telecomunicaciones/tecnologías de la información y la comunicación (TIC) permitirá reducir las brechas digitales a escala nacional y mundial”, en la No. 71 (Plan Estratégico de la Unión para 201-2015), se indica que la “Meta Estratégica del Sector de Desarrollo de las Telecomunicaciones de la UIT” tiene como una de sus vertientes “promover la disponibilidad de infraestructura y fomentar un entorno propicio para el desarrollo de infraestructuras TIC (…)” y luego se indica que “para aprovechar plenamente el potencial que ofrecen las telecomunicaciones/TIC es necesario que los gobiernos y otras partes (…) creen una infraestructura subyacente que sea lo suficientemente robusta como para superar las dificultades y a la vez aprovechar las oportunidades”, en la No. 139 se enfatiza “la función indispensable de la infraestructura de las telecomunicaciones/TIC (…) para alcanzar la meta de la integración digital y permitir un acceso sostenible, generalizado y asequible a la información mundial”.

De otra parte, en el concierto internacional, existen varias declaraciones que destacan la importancia de la creación, mejora y desarrollo de la infraestructura en telecomunicaciones como factor clave para el desarrollo social y económico, tales como la “Declaración de Florianópolis” de 21 de junio de 2000, la “Declaración de Principios de Ginebra” (Primera Fase de la Cumbre Mundial sobre la Sociedad de la Información) de 12 de diciembre de 2003 y su “Plan de Acción”, el “Compromiso de Túnez” (Segunda Fase de la Cumbre Mundial sobre la Sociedad de la Información) de 18 de noviembre de 2005 y su “Agenda”. Específicamente el “Plan de Acción” de la “Declaración de Principios de Ginebra” en el punto C.2 denominado “Infraestructura de la información y la comunicación: fundamento básico para la Sociedad de la Información”, se indica lo siguiente: “9. La infraestructura es fundamental para alcanzar el objetivo de la integración en el ámbito digital, propicia el acceso universal, sostenible, ubicuo y asequible a las TIC para todos, teniendo en cuenta las soluciones pertinentes ya aplicadas en los países en desarrollo y en los países con economías en transición para ofrecer conectividad y acceso a zonas distantes y marginadas en los ámbitos regional y nacional”.

Cabe aclarar que Costa Rica participó en la Declaración de Principios de Ginebra y su Plan de Acción con una nutrida participación de siete delegados. En definitiva, la construcción, desarrollo, mejoramiento y ampliación de una infraestructura sólida y robusta de telecomunicaciones ha sido enunciada en diversos instrumentos del Derecho Internacional Público como un compromiso y una obligación indeclinable de los Estados nacionales, que no puede estar al arbitrio de los gobiernos locales territoriales internos, por cuanto, podría generar asimetrías, con la consiguiente falta de normalización y de un desarrollo nacional de las telecomunicaciones que provoca serios perjuicios para que los habitantes pueden gozar de los beneficios de la sociedad de la información y de las nuevas tecnologías de la información y del conocimiento.

V.IMPORTANCIA, INTERÉS PÚBLICO Y VOCACIÓN NACIONAL DE LA INFRAESTRUCTURA DE LAS TELECOMUNICACIONES EN EL ORDENAMIENTO CONSTITUCIONAL E INFRACONSTITUCIONAL. A partir de un análisis sistemático del ordenamiento jurídico constitucional e infraconstitucional vigente, es factible concluir que la infraestructura, en materia de telecomunicaciones, tiene una relevancia que excede la esfera de lo local o cantonal, asumiendo un claro interés público y, desde luego, erigiéndose como una cuestión que atañe a la órbita de lo nacional con, incluso, proyecciones en el terreno del Derecho Internacional Público al suponer su desarrollo el cumplimiento de una serie de obligaciones internacionales asumidas previamente por el Estado costarricense. En primer término, como lo ha indicado este Tribunal Constitucional, el tema de las telecomunicaciones tiene gran relevancia constitucional, tanto que en el artículo 121, inciso 14), subinciso c), de la Constitución se indica que los “servicios inalámbricos” o el espectro electromagnético forma parte del dominio público constitucional y concretamente es un bien propio de la Nación, siendo que no puede ser desafectado o salir del dominio del Estado.

La Ley General de Telecomunicaciones No. 8642 de 4 de junio de 2008 –en adelante LGT-, al enunciar los principios rectores en este sector, indica en su artículo 3°, inciso i), que debe haber una “optimización de los recursos escasos”, destacando que la utilización de las infraestructuras de telecomunicaciones debe ser “(…) objetiva, oportuna, transparente, no discriminatoria y eficiente, con el doble objetivo de asegurar una competencia efectiva, así como la expansión y mejora de las redes y servicios”. Precisamente, la optimización, utilización ponderada, expansión y mejora de la infraestructura y redes en materia de telecomunicaciones, obedece a los fines manifiestos de ese cuerpo normativo, tales como los de asegurar la aplicación de los principios de acceso universal, eficiencia, igualdad, continuidad, calidad, mayor y mejor cobertura y solidaridad en las telecomunicaciones (artículo 2° LGT).

De otra parte, el artículo 32, inciso d), LGT establece con claridad meridiana que el objetivo del acceso y servicio universales y de la solidaridad, se logra, entre otros medios, a través del “desarrollo de la infraestructura”, dado que, sólo con una infraestructura robusta y plenamente desarrollada logra reducir la brecha digital, disfrutar de los beneficios de la Sociedad de la Información y del Conocimiento (sic), la conectividad y la disponibilidad de dispositivos de acceso y servicios de banda ancha. Por su parte la Ley de la Autoridad Reguladora de los Servicios Públicos, No. 7593 de 9 de agosto de 1993, en su artículo 74, modificado por la Ley de Fortalecimiento y Modernización de las Entidades Públicas del Sector Telecomunicaciones No. 8660 de 8 de agosto de 2008, hizo una declaratoria de interés público de la infraestructura y las redes en telecomunicaciones al preceptuar lo siguiente: “Considérase una actividad de interés público el establecimiento, la instalación, la ampliación, la renovación y la operación de las redes públicas de telecomunicaciones o de cualquiera de sus elementos”.

Tal declaratoria tiene grandes repercusiones, por cuanto, se reconoce, por ley, que el tema de la infraestructura en la materia reviste un claro e inequívoco interés público o general que trasciende la esfera de lo local o regional a lo interno del país, para proyectarse en el ámbito nacional e internacional, al permitirle al Estado costarricense cumplir, de buena fe, una serie de obligaciones y compromisos asumidos en el contexto del Derecho Internacional Público. Cabe advertir que el interés público es definido por el artículo 113, párrafo 1°, de la Ley General de la Administración Pública de 1978 “como la expresión de los intereses individuales coincidentes de los administrados”, por su parte, el párrafo 2 del numeral citado de la LGAP de 1978 dispone, claramente, que “El interés público prevalecerá sobre el interés de la Administración Pública cuando pueda estar en conflicto”. Una consecuencia de lo anterior es que los intereses de cualquier ente público descentralizado costarricense, como podrían ser las municipalidades, no puede anteponerse al claro interés público de la infraestructura en telecomunicaciones así declarado, expresamente, por el legislador nacional a través de una ley que manifiesta la voluntad general (artículos 105 y 121, inciso 1°, de la Constitución), el que debe prevalecer sobre los intereses de carácter local, dado que, la autonomía municipal no le permite a los ayuntamientos sustraerse de lo que ha sido declarado como un interés de carácter nacional, de lo contrario se pervierte la autonomía territorial transformando a los municipios en micro estados, abstraídos de la dirección intersubjetiva o tutela que pueda ejercer el Estado, a través de los órganos constitucionales, mediante la emisión de leyes válidas y eficaces, la celebración de convenios y tratados internacionales por el Poder Ejecutivo y aprobados por la Asamblea Legislativa (artículos 7°, 121, inciso 4°, y 140, inciso 10°, de la Constitución Política).

La declaratoria de interés público efectuada por el artículo 74 de la Ley de la ARESEP, tiene, a su vez, asidero constitucional suficiente y legítimo en el numeral 45, párrafo 1°, de la Constitución Política, al establecer el principio de la intangibilidad relativa del patrimonio, al admitir la figura de la expropiación “por interés público legalmente comprobado”. Una segunda consecuencia que se extrae de la declaratoria de interés público, es que el tema de construcción, ampliación o desarrollo y mejora de la infraestructura en materia de telecomunicaciones tiene una clara e inequívoca vocación nacional. De modo que es el Estado y sus órganos los que asumen la rectoría y dirección en la materia a la que deben someterse todos los entes públicos menores para lograr objetivos como el acceso y servicios universales, la reducción de la brecha digital por razones de solidaridad, la interconexión y conectividad necesarias que le permitan a todos los costarricenses, independientemente de la localidad, distrito, cantón o región donde habiten, gozar de los beneficios y ventajas de la Sociedad de la Información y del Conocimiento (sic).

El legislador nacional, lejos de “localizar” el tema de la infraestructura en telecomunicaciones lo nacionalizó expresa e inequívocamente. Reflejo de lo anterior, son la creación (sic) del “Sector Telecomunicaciones” previsto por el artículo 38 de la citada Ley de Fortalecimiento y Modernización de las Entidades Públicas del Sector de Telecomunicaciones, al disponer lo siguiente: “Créase el Sector de Telecomunicaciones, dentro del marco de sectorización del Estado. Estará constituido por la Administración Pública, tanto la centralizada como la descentralizada, así como por las empresas públicas que desarrollen funciones o actividades relacionadas con las telecomunicaciones” a tenor de esta norma el sector de las telecomunicaciones tiene un carácter transversal y, por ende, nacional, por cuanto, incluye a todo el universo de los entes públicos, incluidos, los descentralizados territorialmente como las municipalidades.

Es así, como los ayuntamientos no pueden sustraerse de tal sector. El carácter nacional de las telecomunicaciones, en general, y, particularmente, de su infraestructura queda más patente al considerar el artículo 39 de la Ley citada, en cuanto establece que el “rector” del sector lo será el Ministro de Ambiente, Energía y Telecomunicaciones, al que le corresponde, en ejercicio de una función general de dirección intersubjetiva o tutela administrativa, entre otras, las siguientes: “a) Formular las políticas para el uso y desarrollo de las telecomunicaciones”; “b) Coordinar (…) la elaboración del Plan nacional de desarrollo de las telecomunicaciones (…)”; “c) Velar por que las políticas del Sector sean ejecutadas por las entidades públicas y privadas que participan en el Sector Telecomunicaciones”; “e) Dictar el Plan nacional de telecomunicaciones, así como los reglamentos ejecutivos que correspondan”; “h) Coordinar las políticas de desarrollo de las telecomunicaciones con otras políticas públicas destinadas a promover la sociedad de la información” e “i) Velar por el cumplimiento de la normativa ambiental nacional aplicable y el desarrollo sostenible de las telecomunicaciones en armonía con la naturaleza”.

Por último, el carácter evidentemente nacional de las telecomunicaciones y sus diversos componentes, queda de manifiesto, cuando el artículo 40 de la Ley precitada regula el “Plan nacional de desarrollo de las telecomunicaciones”, el cual es definido en el párrafo 1° de ese numeral como “(…) el instrumento de planificación y orientación general del Sector y define las metas, los objetivos y las prioridades de éste”. El legislador optó, entonces, por planificar a nivel nacional y no meramente local o regional el tema de las telecomunicaciones. De otra parte, la naturaleza nacional de las telecomunicaciones queda reforzada al crearse la Superintendencia de Telecomunicaciones (SUTEL), a la que le corresponde una serie de competencias de inequívoca índole nacional, así, conforme a los artículos 59 y 60 de la Ley de Creación de la ARESEP, le corresponde “(…) regular, aplicar, vigilar y controlar el ordenamiento jurídico de las telecomunicaciones (…)” para todo lo cual “actuará en concordancia con las políticas del Sector, lo establecido en el Plan nacional de desarrollo de las telecomunicaciones, la Ley general de telecomunicaciones, las disposiciones establecidas en esta Ley y las demás disposiciones legales y reglamentarias que resulten aplicables”.

El “Plan Nacional de Desarrollo de las Telecomunicaciones” 2009-2014, por su parte, establece que “Para avanzar en el aprovechamiento de los beneficios de la Sociedad de Información y Conocimiento, el país debe hacer un esfuerzo importante de inversión en el desarrollo de infraestructura de telecomunicaciones de manera que permita contar con más y mejores servicios de telecomunicaciones para todos los sectores de la población. En este sentido, el desarrollo de la infraestructura en ese sector constituye una condición necesaria e indispensable a la que deberá brindarse una prioridad especial en cualquier proyecto país en materia de TIC (…)” y luego especifica que para lograr el desarrollo de la infraestructura nacional de telecomunicación deberá atender los siguientes lineamientos: “a.1 Tomar las medidas necesarias para garantizar que el país cuente con una infraestructura moderna de telecomunicaciones, y al mismo tiempo asegurar la prestación de servicios de calidad y la generación de aplicaciones de valor agregado, permitiendo la convergencia, la interoperabilidad entre los sistemas, la incorporación de tecnologías de avanzada y la seguridad en las comunicaciones” y “a.6 Garantizar el desarrollo de una infraestructura que permita llevar los servicios de telecomunicaciones a todos los habitantes del país, cumpliendo con los objetivos y metas de acceso universal, servicio universal y solidaridad (…)”.

Se trata, entonces, de un plan que, por disposición expresa de ley, vincula u obliga, entre otros, a los entes municipales y que les conmina a contar con una infraestructura de telecomunicaciones, robusta, moderna, óptima, adecuada y desarrollada para disfrutar de los beneficios de la Sociedad de la Información y del Conocimiento (sic). El logro de esta meta u objetivo, se verá, necesariamente, frustrado si cada corporación territorial, en un tema de clara vocación nacional, pretende establecer su propia orientación y requerimientos, por sobre la legislación nacional y los instrumentos del Derecho Internacional Público que obligan a todos los entes que conforman el Estado en sentido amplio.

VI.INFRAESTRUCTURA DE TELECOMUNICACIONES, MUNICIPIOS, PLANES REGULADORES, ZONIFICACION, CERTIFICADOS DE USO DE SUELO Y LICENCIAS DE CONSTRUCCIÓN. En un claro intento de brindar simetría y normalización en materia de infraestructura de telecomunicaciones por tratarse de un tema de clara vocación nacional, se han dictado una serie importante de instrumentos normativos de carácter general, tanto a nivel nacional como cantonal. Así, el Poder Ejecutivo dictó el Decreto No. 36159 de 10 de mayo de 2010, denominado “Normas Estándares y Competencias de las Entidades Públicas para la aprobación coordinada y expedita requerida para la Instalación y Ampliación de Redes de Telecomunicaciones”, cuyo fin fue uniformar los trámites para obtener autorizaciones para construir e instalar infraestructura de telecomunicaciones ante la dispersión normativa imperante y colmar las lagunas existentes en la materia.

En el artículo 10°, párrafo 1°, de este Decreto Ejecutivo se dispuso que es competencia municipal “Otorgar los certificados de uso de suelo, de conformidad con el Plan Regulador o sus reglamentos vigentes, siempre y cuando en dicho plan o reglamentos se contemple la instalación de infraestructura de telecomunicaciones. En los casos donde el Plan Regulador y la reglamentación local no contempla esta materia, los certificados de uso de suelo se adecuarán a lo establecido en los artículos 4, 5, 6 y 11 del presente decreto”. Consecuentemente, el decreto admite dos hipótesis: a) Que la respectiva municipalidad cuente con Plan Regulador y, concretamente, Reglamento de Zonificación y dentro de los mismos se regule el tema de la instalación de infraestructura de telecomunicaciones y b) En ausencia de esa normativa, el ayuntamiento debe conocer y resolver la solicitud del certificado de uso del suelo, conforme los artículos 4° (integración de normas), 5° (interés público en el establecimiento, instalación, ampliación, renovación y operación de las redes públicas de telecomunicaciones), 6° (concepto de red pública de telecomunicaciones) y 11° (principios para el otorgamiento de usos de suelo y permisos de construcción) de ese Decreto Ejecutivo. El artículo 11° del Decreto Ejecutivo de comentario establece lo siguiente:

“1. En los casos donde la zonificación para la instalación de infraestructura de telecomunicaciones no sea de cada Municipalidad, o bien que la reglamentación del ordenamiento territorial se contraponga a la misma o no se regule esta materia, aplicando el principio de legalidad establecido tanto en el artículo 11 de la Constitución Política así como el artículo 11 de la Ley General de la Administración Pública, la Municipalidad favorecerá su establecimiento, ampliación, renovación y operación aplicando lo dispuesto en el artículo 74 de la Ley de la Autoridad Reguladora de los Servicios Públicos, Ley No. 7593, que declara el carácter de interés público de las actividades de establecimiento, instalación, ampliación, renovación y la operación de las redes públicas de telecomunicaciones o de cualquiera de sus elementos. En todo caso, dicha decisión determinará, igualmente, que se cumpla con la aplicación de los principios rectores del Sector Telecomunicaciones señalados en el artículo 3 de la Ley General de Telecomunicaciones y en cumplimiento del principio de legalidad al cual toda la Administración Pública se encuentra sujeta por así disponerlo el artículo 11 de la Ley General de la Administración Pública, así como el artículo 11 de la Constitución Política.

2. En razón de lo dispuesto en los incisos a) y h) del artículo 3 de la Ley General de Telecomunicaciones, Ley No. 8642, así como lo dispuesto por el artículo 74 de la Ley de la Autoridad Reguladora de Servicios Públicos, Ley No. 7593, y en cumplimiento del principio de legalidad establecido en el artículo 11 de la Ley General de la Administración Pública, y en el artículo 11 de la Constitución Política, las municipalidades fundamentarán sus acciones para el otorgamiento de “usos de suelo conforme” y “permisos de construcción” en los siguientes principios:

  • a)Principio de universalidad, de manera que se propicie la concesión de las autorizaciones citadas a todos los interesados en ofrecer servicios de telecomunicaciones en el cantón sin discriminación alguna, con el objeto de que se garanticen, al menos, un mínimo de servicios de telecomunicaciones para los habitantes de todas las zonas y regiones del país en igualdad de condiciones.
  • b)Principio de neutralidad tecnológica, de manera que el otorgamiento de las autorizaciones citadas garanticen el derecho de los operadores de redes y proveedores de servicios de telecomunicaciones de escoger las tecnologías por utilizar.
  • c)La declaratoria de interés público que establece el artículo 74 de la Ley de la Autoridad Reguladora de los Servicios Públicos, de manera que se otorguen las autorizaciones citadas, considerando que resulta de interés público el establecimiento, la instalación, la ampliación, la renovación y la operación de las redes públicas de telecomunicaciones o de cualquiera de sus elementos.(…)” A partir de diciembre de 2010, de manera conjunta, varias corporaciones municipales aprobaron y publicaron el respectivo “Reglamento General para Licencias Municipales en Telecomunicaciones”, según un proyecto de reglamento modelo que ha sido adoptado por la mayoría de las entidades territoriales y el que dispone en cuanto a los certificados de uso de suelo una norma que se repite, en casi todos, bajo los siguientes términos: “Se otorgará el certificado de Uso de Suelo como uso conforme en cualquier área de la zonificación del cantón, siempre y cuando cumpla con los requisitos y condiciones establecidos en este Capítulo”.

Dentro de los requisitos que se fijan están cumplimentar un formulario con la indicación de la altura de la torre, georeferenciación de la ubicación del centro de la torre con coordenadas de longitud y latitud, plano catastrado, cédula de identidad o certificación de personería jurídica del solicitante. También los predios donde se instala o ubica la infraestructura deben tener ciertas medidas mínimas de frente y fondo, una franja de amortiguamiento mínima alrededor de la obra, alturas mínimas y máximas, retiros, etc.. Incluso en tales reglamentos municipales, se prevé la posibilidad de excepcionar tales recaudos cuando el solicitante justifique la necesidad de parámetros distintos con fundamento en estudios técnicos que así lo justifiquen. Bajo esta inteligencia las municipalidades deben otorgar los certificados de uso de suelo para la construcción e instalación de infraestructura de telecomunicaciones en cualquier área de zonificación del cantón, por lo que no se requiere que el Plan Regulador o el Reglamento de Zonificación preexistentes –en caso de existir- sean reformados, modificados o adicionados para regular una zona específica para ubicar la infraestructura de telecomunicaciones.

Para la ubicación de la infraestructura basta cumplir con los requisitos técnicos y de emplazamiento fijados por la legislación nacional y los reglamentos del Poder Ejecutivo o municipales específicos. Para el caso específico, el “Reglamento General para Licencias Municipales en Telecomunicaciones de la Municipalidad de Goicoechea” de 1° de junio de 2011, dispone en su artículo 11°, párrafo in fine, lo siguiente:

“Las obras a las que se refiere este Reglamento se deberán ubicar de preferencia en las Zonas Industriales, definidas en la actualidad por el Plan Regulador, sin perjuicio de su ubicación en otros lugares del Cantón en los términos de este Reglamento”.

El numeral 11°, párrafo in fine, del citado reglamento de la Municipalidad de Goicoechea es suficientemente elocuente, al disponer que el certificado de uso del suelo para construir e instalar una torre o antena de telecomunicaciones puede ser concedido en cualquiera de las áreas o zonas establecidas previamente en el Plan Regulador y, en particular en el Reglamento de Zonificación, sin que sea necesario reformar, adicionar o modificar tales instrumentos, siempre y cuando se cumplan el resto de los requisitos y condiciones que establece el ordenamiento jurídico. En punto a la licencia de construcción para la instalación, ampliación o modificación de una torre o antena de telecomunicaciones, la Ley de Planificación Urbana (artículo 29) y los Reglamentos municipales ya citados condicionan su otorgamiento a contar con un certificado de uso de suelo y el cumplimiento de otros requisitos de carácter formal y técnico.” (Sentencia Nº 015763-2011, de las nueve horas cuarenta y seis minutos del dieciséis de noviembre de dos mil once).

V.Del binomio salud y medio ambiente e instalación de torres de telefonía celular. En el sub lite fueron construidas 25 torres de telefonía celular, sin observar los procedimientos para instalarlas, sin haber obtenido la licencia de construcción, ni de funcionamiento. Del total de las 25 torres, según informe de la Presidente del Consejo de la SUTEL (oficio 3240-SUTEL-CS-2014, de 23 de mayo de 2014) al menos 19 de éstas se encuentran se indica están en funcionamiento, pues fueron reportadas como parte de las redes de los operadores. No consta, de la prueba traída al Municipalidad de Alajuela recurrida haya tomado medidas efectivas para enderezar el procedimiento iniciado al margen de la normativa aplicable. El impacto que pueda tener sobre la salud la instalación de torres de telecomunicaciones y telefonía celular es un tema que ha sido ampliamente tratado por esta Sala, considerándose, en cada caso, por un lado, que en la actualidad simplemente no hay suficiente evidencia para estimar que éstas representen un peligro para la salud pública (voto Nº 2010-014449 de las 08:54 horas del 31 de agosto de 2010), razón por la que no habiendo motivos para cambiar de criterio, procede declarar sin lugar el recurso en cuanto a este extremo.

En relación con la posible afectación al derecho de gozar de un ambiente sano y ecológicamente equilibrado que acusa el recurrente, por la falta de cumplimiento total de requisitos y trámites en la construcción de las torres transmisoras de señales de celular en el voto 2012-016866 de las 14:30 horas el 04 de diciembre de 2012 Sala dispuso:

“V.- SOBRE LA VIOLACIÓN AL DERECHO A UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO. En el presente asunto, los recurrentes reclaman que el lugar donde se está construyendo la torre de telefonía celular en cuestión se pone en peligro los mantos acuíferos. Al respecto, se constata que la Secretaría Técnica Nacional Ambiental otorgó la viabilidad ambiental a la torre celular, considerando que, aunque si bien es cierto no existe estudio del SENARA, se comprobó que el nivel freático se encuentra a seis metros de profundidad, de manera que la perforación de un hueco a 2.5 metros no afecta los mantos acuíferos de la zona. Sin embargo, a pesar de las afirmaciones del representante de la Secretaría Técnica Nacional Ambiental, también es cierto que el Gerente General del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) encuentran entre los 0.39 metros y 30 metros de profundidad y que SENARA no cuenta con estudios hidrogeológicos en la zona para determinar si la construcción y funcionamiento de la Torre de Telecomunicaciones genera algún impacto sobre el nivel freático o de vulnerabilidad del recurso hídrico.

Lo anterior, porque no ha recibido consulta para emitir pronunciamiento en relación con el proyecto consultado ³antena telefonía móvil en La Unión´y no se ha presentado un estudio hidrogeológico que valore las condiciones del acuífero en la zona afectada. No obstante, un impacto sobre el acuífero, sin embargo los hidrocarburos que serán utilizados para la planta de emergencia podrían representar una amenaza hacia las aguas subterráneas, ya que los niveles freáticos son muy superficiales. Por ende, argumenta que los niveles freáticos se encuentran muy superficiales y existe un riesgo de contaminación por el uso de hidrocarburos en la torre para su funcionamiento, además de que SETENA no ha remitido a SENARA informes sobre el presente proyecto de que el interesado haya presentado en SETENA para evaluar el riesgo de contaminación por hidrocarburos. Por eso, concluye que no se considera que la obra gris pueda afectar el acuífero, excepto en el caso de los hidrocarburos.

Ante esta situación, el representante de SENARA recomendó, mediante oficio DIGH-875-10, enviado al Departamento de Evaluación Ambiental de la SETENA, los requerimientos a tomar en cuenta con respecto a Torres de Telecomunicaciones, al requerir para su funcionamiento de plantas de emergencia que utilizan combustibles fósiles y otras recomendaciones. De esta forma, este Tribunal tiene por demostrado que existe un riesgo de contaminación en la construcción de la Torre de Telefonía Celular en cuestión debido a las afirmaciones del Gerente General del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) respecto a que existe un riesgo de contaminación por el uso de hidrocarburos en la torre para su funcionamiento, tomando en cuenta que los niveles freáticos se encuentran muy superficiales. Al respecto, no se constata que el representante de SETENA haya tomado en cuenta las recomendaciones de SENARA, ni que haya remitido a SENARA los informes sobre el presente proyecto para evaluar el riesgo de contaminación por hidrocarburos, lo cual confirma que el riesgo de contaminación no se ha disipado.

Asimismo, ni el representante de la empresa Claro CR Telecomunicaciones S.A. ni los representantes de la Municipalidad de La Unión se refieren sobre estos hechos, lo cual deja incólume las afirmaciones de SENARA. Ahora bien, no le corresponde a este Tribunal establecer si en esta obra se utilizara energía para alimentar los equipos que colocarán la torre de telecomunicaciones, siendo el único equipo de telecomunicaciones que necesita alimentación de hidrocarburos el Motogenerador, que trabaja por medio de diesel ±tal y como lo señala el representante de Claro CR- o si se utilizarán combustibles fósiles e hidrocarburos para generarla, pues este es un tema que le corresponde a SETENA y SENARA referirse sobre su uso. En síntesis: al comprobarse el riesgo de contaminación a los mantos acuíferos señalada por SENARA por la utilización de hidrocarburos, este Tribunal verifica la violación al derecho a un ambiente sano y ecológicamente equilibrado, según lo establecido por el principio precautorio indicado en el considerando anterior.

Por consiguiente, lo que corresponde es declarar con lugar el presente recurso respecto a este tema.” Más allá del cuestionamiento de los requisitos de funcionamiento de las torres, en este asunto se evidencia una falta total de estudios y permisos de construcción que determinen las condiciones de ubicación, construcción e instalación de las obras constructivas. No ha podido la adminitración valorar si las torres cumplen, entre otros requisitos, las dimensiones aceptables o si el suelo en que se instalan es apto, lo que hace que no aplique la presunción de falta de riesgos para la salud de la población o el medio ambiente, que deriven de la exposición a esos campos electro-magnéticos, por cuanto ésta aplica cuando en la instalación de la telefonía celular, se permite valorar los requisitos y estudios técnicos mínimos que establece la normativa aplicable. De ahí que la falta total de permisos en la instalación de torres hace presumir que las mismas fueron construidas por la vía de hecho, lo que, con base en la jurisprudencia citada, pone en riesgo el derecho a gozar de un ambiente sano y ecológicamente equilibrado.

En efecto, en este caso, informan los representantes de la Municipalidad recurrida, que no se ha presentado el requisito de uso de suelo previo a la instalación de infraestructura de telecomunicaciones. Tampoco se ha obtenido la licencia de construcción de ese tipo de infraestructura; ni se aporta evidencia de que tales condiciones hayan sido llenadas a posteriori, para descartar posibles inconvenientes al ambiente, en los lugares en que se instala la infraestructura de telefonía. Como consecuencia, no se sabe, no se cuenta con datos que indiquen si las torres fueron o no levantadas en zonas sensibles, que requieran de análisis técnicos que midan y descarten los posibles daños, como podrían darse si se instalan las torres en zonas en que se afectan mantos acuíferos. Tal omisión es apuntada por la señora Sisy Castillo Ramírez, en su condición de Ministra de Salud, que informa a esta Sala que el dar los permisos de ubicación y/o construcción de las torres de telefonía celular es competencia de los Gobiernos locales, como se establece en el artículo XIX 2 bis de la Reforma al Reglamento de Construcciones que dice: “(…)La instalación, ampliación o modificación de la red o infraestructura de telecomunicación se podrá ubicar en cualquier parte del territorio nacional, deberá cumplir con los parámetros técnicos de calidad y cobertura definidas por la SUTEL y estará a cargo de los operadores y proveedores de las telecomunicaciones debidamente acreditados y habilitados para tal efecto, debiendo acudir a la Municipalidad respectiva para la obtención del uso del suelo conforme, a las disposiciones técnicas del presente reglamento, y la licencia de construcción.

En caso de zonas sensibles; así identificadas por el Ministerio de Salud, será esta entidad quien se encargará de definir los retiros y condiciones aplicables.” (El destacado es del original) Del propio informe del Alcalde Municipal y del Director del Proceso de Planeamiento y Construcción de Infraestructura, ambos de la Municipalidad de Alajuela, se infiere que tales autoridades han tolerado la construcción de dichas torres sin haber dado la respectiva autorización y, a la fecha, pese haber transcurrido más de un año desde que advirtió la situación anómala, no han tomado medidas para enderezar el procedimiento y han asumido una actitud pasiva. Con base en las consideraciones Declaración de Río de Janeiro de junio de 1992, sobre Medio Ambiente y Desarrollo, así como de lo dispuesto en la sentencia Nº 2012016866 de las 14:34 horas del 04 de diciembre de 2012, procede acoger el recurso por violación del derecho a gozar de un ambiente ecológicamente equilibrado.

VI.De la participación ciudadana en la aprobación de permisos o licencias para la construcción de infraestructura para telecomunicaciones. En cuanto a la acusada falta de celebración de una audiencia pública en que pudieran participar los munícipes en la tramitación de la instalación de torres celulares, esta Sala reitera lo que dispuso en la sentencia número 015763-2011 de las 09:46 horas del 16 de noviembre de 2011 y que se citó supra, asumiendo conforme al precedente que en el otorgamiento de una licencia municipal de construcción de una torre o antena de telecomunicaciones o el otorgamiento de un certificado de uso de suelo de acuerdo con la zonificación existente, no implican una modificación o reforma del Plan Regulador o de la zonificación establecida en los reglamentos de desarrollo urbano que forman parte del primero, pues en virtud del carácter estratégico y primordial de las telecomunicaciones para el desarrollo social y económico, existe un declarado interés público nacional, situación que legitima a las corporaciones municipales para otorgar certificados de uso de suelo y, con fundamento en éstos y otros requisitos, licencias de construcción de infraestructura de telecomunicaciones, sin necesidad de modificar o reformar los Planes Reguladores y Reglamentos municipales previos que forman parte del primero.

En el caso que se examina el precedente es aplicable, según se mencionó, porque los permisos para instalar torres de telecomunicaciones no suponen una modificación o reforma del Plan Regulador o de la zonificación establecida en los reglamentos de desarrollo urbano; bajo estos supuestos, no hay razón para cambiar de criterio y el recurso debe ser desestimado, ya que en la instalación de torres de antenas de telecomunicación no requiere la realización de una audiencia pública previa en la que participen los ciudadanos de la comunidad.

VIII Voto salvado de los Magistrados Armijo Sancho y Cruz Castro respecto al tema de la participación ciudadana. Respetuosamente, nos separamos del voto de mayoría en lo atinente a la falta de comunicación y oportunidad de participación ciudadana en el procedimiento de construcción de torres para la telefonía celular. Conforme se indica en el voto salvado relativo a la sentencia número 015763-2011 de las 09:46 horas del 16 de noviembre de 2011, reconocemos y subrayamos la relevancia jurídica tanto del derecho fundamental a las telecomunicaciones, como del derecho constitucional al gobierno participativo. De un lado, se reconoce la importancia que tienen las telecomunicaciones para el desarrollo de la sociedad y el desenvolvimiento personal de los ciudadanos; del otro, la construcción de torres para la telefonía celular afecta también intereses comunales, jurídicamente relevantes. Se advierte en este asunto que la instalación de las torres de telefonía celular se dio por las vías de hecho, sin cumplir requisitos de instalación ni de funcionamiento; sin ajustarse a los reglamentos que regulan la materia.

Asimismo, se denota en el proceso de instalación, la ausencia de un mecanismo de consulta pública previa, lo que resulta contrario al derecho de participación ciudadana en el procedimiento de la edificación de las torres de telefonía celular, lo que hace que declaramos con lugar el recurso en cuanto a este extremo.

Por tanto:

Se declara parcialmente con lugar el recurso, sólo por violación del Principio Precautorio. Se ordena a ROBERTO HERNÁN THOMPSON CHACÓN, en su calidad de Alcalde Municipal de Alajuela; y a ROY DELGADO ALPÍZAR, en su calidad de Director del Proceso de Planeamiento y Construcción de Infraestructura ambos de la Municipalidad de Alajuela o a quienes ocupen tales cargos tomar las medidas necesarias par que en el plazo máximo de tres meses, contado a partir de la notificación de esta sentencia, se cumpla con las exigencias del ordenamiento respecto a la tramitación de los requisitos y autorizaciones que requiere la instalación y construcción de las 25 torres de telecomunicación denunciadas en el Cantón Central de Alajuela. Lo anterior, bajo apercibimiento de que podrían incurrir en el delito tipificado en el artículo 71 de la Ley de la Jurisdicción Constitucional, el cual dispone que se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

En lo demás se declara sin lugar el recurso. Se condena a la Municipalidad de Alajuela al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Los Magistrados Armijo Sancho y Cruz Castro salvan el voto respecto al tema de la participación ciudadana. Notifíquese de forma personal a ROBERTO HERNÁN THOMPSON CHACÓN, en su calidad de Alcalde Municipal de Alajuela; y ROY DELGADO ALPÍZAR, en su calidad de Director del Proceso de Planeamiento y Construcción de Infraestructura ambos de la Municipalidad de Alajuela o a quienes ocupen tales cargos.
