Optional legislative constitutional consultation (consulta legislativa facultativa de constitucionalidad) filed by Deputies JUAN CARLOS MENDOZA GARCÍA, JOSÉ MARÍA VILLALTA FLORES-ESTRADA, CARMEN MUÑOZ QUESADA, CLAUDIO MONGE PEREIRA, PATRICIA PÉREZ HEGG, LUIS FISHMAN ZONZINSKI, ANA EUGENIA VENEGAS R., XINIA ESPINOZA E., AND OTHERS, regarding the bill entitled “LAW RECOGNIZING THE RIGHTS OF THE INHABITANTS OF THE SOUTHERN CARIBBEAN,” legislative expediente number 18.207.

  1. 1The consultation was received by the Secretariat of the Chamber at 15:36 hours on 18 de febrero del 2014. The consulting Deputies submit an optional legislative constitutional consultation concerning the bill entitled “LAW RECOGNIZING THE RIGHTS OF THE INHABITANTS OF THE SOUTHERN CARIBBEAN,” legislative expediente number 18.207. Proceedings on that bill began on 21 de julio del 2011, and it was published in La Gaceta 170, supplement number 60, on 5 de septiembre de ese mismo año. The background to this bill is already known to this Chamber, which ruled on a previous consultation in expediente number 12-011721-0007-CO. With respect to procedural matters, they inquire into the constitutionality of the legislative procedure followed in processing the aforementioned bill. Specifically, they state that, although the technical study required by this Sala Constitucional was carried out hastily, the violation of an essential requirement still remains, namely the absence of direct consultation with the native and Indigenous peoples and inhabitants of the area, who have lived in these areas for centuries, as is the case of the Afro-descendant population, and for millennia, as is the case of the Indigenous inhabitants, who have historically been displaced and rendered invisible, as required by International Labour Organization Convention 169 concerning Indigenous peoples in Article 6.They contend that this requirement was entirely disregarded and replaced with consultations involving organizations that are not necessarily representative of those groups. In other words, those consultations do not guarantee that these groups will be consulted and participate in the process. This omission alone, because of its seriousness, constitutes a serious procedural defect (vicio de trámite) in the bill, warranting its return in the legislative process to the stage at which such consultation can be conducted. On the merits, they inquire into the violation of the constitutional principle of the supremacy of international human-rights conventions (Articles 7 and 48 of the Constitución Política). They state that the proposed reduction of the boundaries of the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo could violate commitments undertaken by Costa Rica in international environmental conventions and, consequently, the principles derived from Articles 7 and 48 of the Carta Magna, which establish the supremacy of international human-rights instruments incorporated into the legal system.Specifically, they refer to the Convention on Wetlands of International Importance Especially as Waterfowl Habitat (RAMSAE Convention), approved by Law number 7224 of 2 de abril de 1991, Article 4, subsection 2). Costa Rica has included the Refugio de Vida Silvestre Gandoca-Manzanillo in the list of wetlands of international importance (humedales de importancia internacional) under the RAMSAR Convention (registration number 6CR005). This protection encompasses the entirety of that protected wildlife area (área silvestre protegida), including the coastal zone whose protected status the bill seeks to revoke. In other words, the area that is to be severed from the wildlife refuge is protected as part of the list of wetlands registered by the Costa Rican State pursuant to the RAMSAR Convention, and the State has undertaken to safeguard it in compliance with the rules and principles of that international instrument.Article 4, subsection 2, of the aforementioned convention plays a fundamental role among those rules. Despite the unequivocal nature of that international obligation undertaken by the Costa Rican State, legislative expediente 18.207 contains no action or provision whatsoever to fulfill it. Indeed, the existence of that obligation continues to be disregarded. The bill entirely omits compliance with the Costa Rican State’s obligation to compensate for the removal of protection from the refuge’s coastal zone and does not create new equivalent reserves, in clear violation of the RAMSAE Convention. They note that, in resolution number 1993-6240, the Sala Constitucional held that international environmental instruments are mandatory and fully enforceable insofar as their provisions require no further legislative development and must therefore be observed because they hold superior normative rank.Such is the case with the cited convention. Furthermore, they inquire into the violation of the constitutional environmental principles of non-regression (no regresión), pro natura, and precaution (precautorio). They state that Article 50 of the Constitución Política gives rise to a series of State duties that preclude any form of regression in environmental protection. That principle was developed extensively in the report issued by the Departamento de Servicios Técnicos concerning this bill, where a discussion of the principle may be found. The principle of non-regression establishes that environmental laws and case law should not be reviewed or amended when doing so would entail a retreat from the level of protection previously attained in this field. This is clearly what the bill under consultation would do if enacted. With respect to the precautionary principle, the Sala Constitucional has ruled unequivocally that all measures necessary to prevent adverse effects on the environment and to ensure its protection and conservation, as well as the proper management of its resources, must be taken.This is not contemplated in the bill under consultation, so it is clear that the bill represents a serious regression in a highly sensitive area. For all the foregoing reasons, they file this consultation.
  2. 2Initially, this optional legislative constitutional consultation was submitted by Deputies JUAN CARLOS MENDOZA GARCÍA, JOSÉ MARÍA VILLALTA FLORES-ESTRADA, CARMEN MUÑOZ QUESADA, CLAUDIO MONGE PEREIRA, PATRICIA PÉREZ HEGG, LUIS FISHMAN ZONZINSKI, ANA EUGENIA VENEGAS R., XINIA ESPINOZA E., MARTÍN MONESTEL CONTRERAS, AND JOAQUÍN PORRAS CONTRERAS, in a written filing submitted at 15:36 hours on 18 de febrero del 2014. However, later that same day, Deputies Martín Monestel Contreras and Joaquín Porras Contreras submitted written statements expressly withdrawing their signatures from the consultation.
  3. 3The statutory requirements have been observed in the proceedings, and this resolution is issued within the period established in Article 101 of the Ley de la Jurisdicción Constitucional.

Considerations:

I. ADMISSIBILITY OF OPTIONAL LEGISLATIVE CONSULTATIONS

Pursuant to Article 96, subsection b), of the Ley de la Jurisdicción Constitucional, an optional legislative consultation may be brought regarding bills under consideration by the Asamblea Legislativa when submitted by no fewer than ten Deputies.

II. ADMISSIBILITY OF THE CONSULTATION IN THIS SPECIFIC CASE

In this case, although the optional consultation was initially submitted by ten Deputies of the Asamblea Legislativa—namely, Juan Carlos Mendoza García, José María Villalta Flores-Estrada, Carmen Muñoz Quesada, Claudio Monge Pereira, Patricia Pérez Hegg, Luis Fishman Zonzinski, Ana Eugenia Venegas R., Xinia Espinoza E., Martín Monestel Contreras, and Joaquín Porras Contreras—two of them (Martín Monestel and Joaquín Porras) subsequently expressly withdrew their signatures, leaving only eight signatures as of this date. Consulta legislativa facultativa de constitucionalidad interpuesta por los diputados JUAN CARLOS MENDOZA GARCÍA, JOSÉ MARÍA VILLALTA FLORES-ESTRADA, CARMEN MUÑOZ QUESADA, CLAUDIO MONGE PEREIRA, PATRICIA PÉREZ HEGG, LUIS FISHMAN ZONZINSKI, ANA EUGENIA VENEGAS R., XINIA ESPINOZA E., Y OTROS, respecto del proyecto de ley denominado “LEY DE RECONOCIMIENTO DE LOS DERECHOS DE LOS HABITANTES DEL CARIBE SUR”, expediente legislativo número 18.207.

Resultando:

  1. 1La consulta se recibió en la Secretaría de la Sala a las 15:36 horas del 18 de febrero del 2014. Los Diputados consultantes formulan consulta legislativa facultativa de constitucionalidad sobre el proyecto de ley denominado “LEY DE RECONOCIMIENTO DE LOS DERECHOS DE LOS HABITANTES DEL CARIBE SUR”, trámite el 21 de julio del 2011, se publicó en La Gaceta 170, alcance número 60, del 5 de septiembre de ese mismo año. Los antecedentes de este proyecto son ya conocidos por esta Sala que ya resolvió una consulta anterior en el constitucionalidad del procedimiento legislativo seguido en la tramitación del citado proyecto de ley, específicamente, manifiestan que si bien se cumplió de forma apresurada con el estudio técnico que esta Sala Constitucional demandó, aún prevalece la violación de un requisito esencial tal cual es la ausencia de consulta directa a los pueblos y pobladores nativos y autóctonos de la zona, con antecedentes centenarios de vida en estas zonas, como lo es la población afrodescendiente y con antecedentes milenarios como en el caso de los pobladores indígenas, históricamente desplazados e invisibilizados, tal y como lo demanda el Convenio Internacional 169 de la OIT sobre pueblos indígenas en el artículo 6.Sostienen que ese requisito se incumplió completamente, sustituyéndose por consultas a organizaciones no necesariamente representativas de estos grupos. Es decir que no garantizan su consulta y participación en la misma. Esta sola omisión por grave, ya pone un grave vicio de trámite a este proyecto que amerita su devolución en procedimiento hasta el estado en el que esta consulta sea realizable. Sobre el fondo, consultan sobre la violación al principio constitucional de supremacía de los convenios internacionales sobre derechos humanos (artículos 7 y 48 de la Constitución Política). Indican que la reducción de límites del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, que se pretende con este proyecto, podría ser violatoria de compromisos asumidos por Costa Rica en convenios internacionales de naturaleza ambiental y con ellos los principios derivados de los numerales 7 y 48 de la Carta Magna que establecen la supremacía de los instrumentos internacionales sobre derechos humanos incorporados al ordenamiento jurídico.Concretamente, la Convención relativa a los Humedales de Importancia Internacional especialmente como Hábit de Aves Acuáticas (convención RAMSAE) aprobada por Ley número 7224 del 2 de abril de 1991, artículo 4, inciso 2). El Refugio de Vida Silvestre Gandoca-Manzanillo ha sido incluido por Costa Rica dentro de la lista de humedales de importancia internacional con base en la Convención RAMSAR (registro número 6CR005). Esta protección abarca la totalidad de dicha área silvestre protegida, incluyendo la zona costera, que se pretende desafectar mediante este proyecto de ley. Es decir, la zona que se pretende desmembrar del refugio de vida silvestre se encuentra protegida como parte de la lista de humedales que el Estado costarricense ha registrado de conformidad con la Convención RAMSAR y se ha comprometido a resguardar acatando las normas y principios de dicho instrumento internacional. Dentro estas normas juega un papel fundamental el artículo 4, inciso 2 de la citada convención.A pesar de la contundencia de esa obligación internacional asumida por el Estado costarricense, en ninguna parte de dicho expediente legislativo 18.207 consta acción o disposición alguna para cumplirla. De hecho sigue sin considerarse su existencia. El proyecto de ley omite por completo el cumplimiento de la obligación del Estado costarricense de compensar la desprotección de la zona costera del refugio y no crea nuevas reservas equivalentes, en claro desacato de la convención RAMSAE. Refiere que la Sala Constitucional en la resolución número 1993-6240 dispuso que los instrumentos ambientales internacionales son de acatamiento obligatorio y gozan de plena ejecutoriedad, en tanto sus normas no precisen mayor desarrollo legislativo y por ende deben ser respetadas, ya que el rango normativo de aquellos es superior. Tal es el caso de la convención citada. Por otra parte, consultan sobre la violación de los principios constitucionales de no regresión, pro natura y precautorio en materia ambiental.Manifiestan que del artículo 50 de la Constitución Política derivan una serie de deberes estatales opuestos a cualquier tipo de regresión en materia de protección ambiental. Dicho principio ha sido desarrollado ampliamente en el informa rendido por el Departamento de Servicios Técnicos en relación con este proyecto de ley y ahí puede encontrarse su desarrollo. El principio de no regresión establece que las normas jurídicas y la jurisprudencia en materia ambiental no deberían ser revisadas o modificadas si con ello se busca retroceder en relación con la protección que en esta materia se ha alcanzado anteriormente. Lo que claramente, estaría haciendo el proyecto de ley consultado en caso de aprobarse. En relación al principio precautorio, la Sala Constitucional ha sido contundente al resolver que deben tomarse todas las medidas que sean necesarias para prevenir efectos negativos al ambiente y asegurar su protección, conservación y una adecuada gestión de sus recursos.Lo cual no se está contemplando en el proyecto de ley en consulta, por lo que es claro que se está ante un grave retroceso en una zona altamente delicada. Por todo lo anterior, interponen la presente consulta.
  2. 2Inicialmente, la presente consulta legislativa facultativa de constitucionalidad fue planteada por los Diputados JUAN CARLOS MENDOZA GARCÍA, JOSÉ MARÍA VILLALTA FLORES-ESTRADA, CARMEN MUÑOZ QUESADA, CLAUDIO MONGE PEREIRA, PATRICIA PÉREZ HEGG, LUIS FISHMAN ZONZINSKI, ANA EUGENIA VENEGAS R., XINIA ESPINOZA E., MARTÍN MONESTEL CONTRERAS Y JOAQUÍN PORRAS CONTRERAS, por escrito presentado a las 15:36 horas del 18 de febrero del 2014. Sin embargo, posteriormente, ese mismo día, los Diputados Martín Monestel Contreras y Joaquín Porras Contreras, presentaron escritos en los que, expresamente, retiraron su firma de la consulta.
  3. 3En el procedimiento se han observado las prescripciones de ley y esta resolución se dicta dentro del término establecido en el artículo 101 de la Ley de la Jurisdicción Constitucional.

Redacta el Magistrado Armijo Sancho; y,

Considerando:

I. SOBRE LA PROCEDENCIA DE LAS CONSULTAS LEGISLATIVAS FACULTATIVS

De conformidad con lo dispuesto en el artículo 96 inciso b) de la Ley de la Jurisdicción Constitucional, procede la consulta legislativa facultativa sobre proyectos de ley que se estén conociendo en la Asamblea Legislativa, cuando éstas son presentadas por un número no menor a diez Diputados.
