Non-compliance proceeding (gestión de inejecución) filed by the petitioner, against the Executive President of the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados).
Whereas (Resultando):
1.- By brief received at the Secretariat of the Chamber at fifteen hours three minutes on the thirteenth of January of two thousand fourteen, the petitioner alleges disobedience to ruling No. 2013-008669 of 9:05 hrs. on June 28, 2013, issued in this matter, insofar as the representative of the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados) was ordered to, in coordination with the protected ASADA, determine the exact dimensions of the effective protection zone of the spring (naciente) by means of a hydrogeological study and to perform a laboratory analysis for the purpose of evaluating the presence of agrochemicals in the water. He indicated that, as his represented parties informed him, "to date they have not been able to obtain collaboration from the respondent entities, and have only had compliance from Mr. P.C. regarding the suspension of human and agricultural activity within a 200-meter radius of said water spring (naciente)." 2.- By resolution of 11:58 hrs. on January 14, 2014, the present proceeding was transferred to the Executive President of the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados).
3.- Yesenia Calderón Solano, in her capacity as Executive President of the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados), reports under oath (brief filed at 10:24 hrs. on June 20, 2013) that, in compliance with this Chamber's resolution, she provides the report of the hydrogeological study and physical-chemical laboratory analysis on the presence of agrochemicals in the water, issued by AyA's UEN Environmental Management (Gestión Ambiental), Functional Area of Hydrogeology, regarding the water supplied by the ASADA of Santiago de Paraíso de Cartago to its population. Said report is dated January 4, 2014.
4- In the proceedings followed, legal requirements have been observed.
Magistrate Castillo Víquez writes the following; and, Considering (Considerando):
Sole.- In the present matter, the petitioner claims that the respondent authority has failed to comply with what was resolved by this Chamber in judgment No. 2013-008669 of 9:05 hrs. on June 28, 2013. Notwithstanding the above, this Court does not consider the interested party to be correct, given that, from the facts contained in the record, as well as from the report rendered by the Executive President of the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados) —which is given under oath with timely warning of the consequences, including criminal ones, provided for in Article 44 of the Law of Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional)—, it clearly follows that since January 4 of this year, before disobedience was alleged, the hydrogeological study establishing the dimensions of the protection zone of the "Agustín Solano" spring (naciente) had already been conducted, as well as the laboratory analysis for agrochemicals, which indicates that no type of pesticide was detected in the water collected from the referenced source above the detection limit. Thus, in the opinion of this Chamber, the non-compliance proceeding (gestión de desobediencia) under consideration is not appropriate, and it is therefore rejected.
Therefore (Por tanto):
The proceeding filed is dismissed.

Sala Constitucional Clase de asunto: Recurso de amparo Analizado por: SALA CONSTITUCIONAL *130038870007CO* Res. Nº 2014001432 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las catorce horas cincuenta minutos del cuatro de febrero de dos mil catorce.
Gestión de inejecución promovida por el recurrente, contra la Presidenta Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados.
Resultando:
1.- Por escrito recibido en la Secretaría de la Sala a las quince horas tres minutos del trece de enero del dos mil catorce, el recurrente alega desobediencia al voto No. 2013-008669 de las 9:05 hrs del 28 de junio del 2013 emitido en este asunto, en cuanto a que se ordenó a la representante del Instituto Costarricense de Acueductos y Alcantarillados que en coordinación con la ASADA amparada, determinara las dimensiones exactas de la zona de protección efectiva de la naciente, mediante un estudio hidrogeológico y que realizara un análisis de laboratorio con el fin de evaluar la presencia de agroquímicos en el agua. Señaló que según le indicaron sus representados, “a la fecha no han logrado obtener colaboración por parte de las entidades recurridas, siendo que solamente han tenido acatamiento por parte del señor P.C. en cuanto a la suspensión de la actividad humana y agrícola en el radio de 200 metros de la referida naciente de agua".
2.- Mediante resolución de las 11:58 hrs. del 14 de enero del 2014 se le dio traslado de la presente gestión a la Presidenta Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados.
3.- Informa bajo juramento Yesenia Calderón Solano, en su condición de Presidenta Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados (escrito presentado a las 10:24 hrs del 20 de junio del 2013), que en cumplimiento de la resolución de esta Sala, aporta informe del estudio hidrogeológico y análisis de laboratorio físico-químico sobre la presencia de agroquímicos en el agua, emitido por la UEN Gestión Ambiental de AyA, Área Funcional de Hidrogeología, con respecto del agua que suministra la ASADA de Santiago de Paraíso de Cartago a su población. Dicho informe es de fecha 4 de enero de 2014.
4- En los procedimientos seguidos se ha observado las prescripciones legales.
Redacta el Magistrado Castillo Víquez; y,
Considerando:
Único.- En el presente asunto, el recurrente aduce que la autoridad recurrida ha incumplido lo resuelto por esta Sala mediante la sentencia No. 2013-008669 de las 9:05 hrs del 28 de junio del 2013. No obstante lo anterior, este Tribunal no estima que lleve razón el interesado, toda vez que, de los hechos que constan en autos, así como del informe rendido por la Presidenta Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados, -el cual es dado bajo fe de juramento con oportuno apercibimiento de las consecuencias, incluso penales, previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional-, se desprende con claridad que desde el 4 de enero de este año, antes de que se acusara desobediencia, ya se había realizado el estudio hidrogeológico que establece las dimensiones de la zona de protección de la naciente “Agustín Solano”, así como el análisis de laboratorio sobre agroquímicos, el cual indica que no se detectó la presencia de ningún tipo de plaguicidas en el agua captada en la referida fuente, por encima del límite de detección.
