Amparo proceeding (recurso de amparo) processed under expediente número 13-013323-0007-CO, filed by LORENA GUTIÉRREZ CORRALES, identity card 0106800212, of legal age, a resident of Goicoechea, against the MUNICIPALIDAD DE GOICOECHEA.-
Findings:
Justice Salazar Murillo authored the opinion; and,
Whereas:
I.Subject matter of the proceeding.- The petitioner alleges that for years she has filed several complaints concerning the existence of a vacant lot owned by the Municipalidad de Goicoechea, which was originally designated by the Instituto Nacional de Vivienda y Urbanismo as a playground or green area. She asserts, however, that the lot is in a complete state of abandonment and has become a garbage dump that not only causes the proliferation of cockroaches, flies, rats, and other pests, but also becomes a “den” where homeless people spend the night, a situation that poses a serious problem for the safety and health of the community’s residents, to the detriment of Articles 21 and 50 of the Constitución Política.
a. The petitioner has filed several complaints with the Municipalidad de Goicoechea seeking an effective solution to the pollution and safety problem caused by a vacant lot belonging to that municipal entity (undisputed fact).
b. The Municipalidad de Goicoechea has not provided a solution to the pollution problem reported by the petitioner (report of the respondent authority).
III.On the Right to a Healthy and Ecologically Balanced Environment. On repeated occasions, this Court has emphasized the State’s duty to protect the right enjoyed by the country’s inhabitants to a healthy and ecologically balanced environment, in order to guarantee their right to health. In this regard, the provisions of judgment number 2002-11429, issued at nueve horas con catorce minutos on veintinueve de noviembre de dos mil dos, are relevant; that judgment stated, insofar as pertinent:
“(… ) IV.- On the right to health and to a healthy and balanced environment. This Constitutional Court has widely recognized the attention warranted by the right to health, which, although not expressly recognized in the Carta Magna, necessarily derives from the right to life protected by Article 21, which provides, ‘Human life is inviolable’; moreover, it has been established as a precursor to the right to a healthy and balanced environment enshrined in constitutional Article 50:
‘ARTICLE 50. The State shall seek the greatest welfare of all the country’s inhabitants by organizing and encouraging production and the most appropriate distribution of wealth.
Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that infringe that right and to seek compensation for the damage caused.
The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding liabilities and penalties. (As amended by Article 1 of Law No.7412 of 3 de junio de 1994).’ Thus, it is relevant to revisit certain considerations concerning this matter that this Constitutional Court has expressed on previous occasions:
‘III.- On the law. Article 50 of the Constitución Política establishes that every person has the right to a healthy and ecologically balanced environment. The right to a healthy environment has broad content equivalent to the aspiration to improve the surroundings in which human beings live; it therefore extends beyond criteria of nature conservation and encompasses every sphere in which a person develops, whether the family sphere, the workplace, or the environment in which that person resides. Hence, it is said to be a cross-cutting right, meaning that it extends throughout the legal system, shaping and reinterpreting its institutions. The Real Academia Española de la Lengua defines the environment as the “set of physical circumstances surrounding living beings,” which further underscores the general nature of the right. By contrast, the right to an ecologically balanced environment is a narrower concept referring to an important part of the surroundings in which human beings develop: the balance that must exist between society’s advancement and the conservation of natural resources.
Both rights are expressly recognized in Article 50 of the Constitución Política, which defines the Social State under the Rule of Law (Estado Social de Derecho). The placement of the right to a healthy and ecologically balanced environment within the constitutional provisions governing the Social State under the Rule of Law is the starting point from which it must be analyzed. The Social State under the Rule of Law results in the incorporation into the fundamental text of a series of policy objectives of great social significance and the introduction of a substantial number of social rights that ensure the common good and the satisfaction of people’s basic needs. From this perspective, the Constitución Política emphasizes that protecting natural resources is an appropriate means of safeguarding and improving everyone’s quality of life, making it necessary for public authorities to intervene with respect to factors that may disrupt the balance of natural resources and, more broadly, prevent people from developing and functioning in a healthy environment.
Just as the principle of the Social State under the Rule of Law is immediately applicable, so too is the right to a healthy and ecologically balanced environment; it therefore has the dual character of an individual right held by persons and an objective or purpose of the actions of public authorities in general. The effect of the right to a healthy and ecologically balanced environment on State activity is based, first, on the fact that rights, by definition, are not limited to the private sphere of individuals but also have significance for the very structure of the State in its role as their guarantor and, second, on the fact that State activity is directed toward satisfying the interests of the community. The Constitución Política establishes that the State must guarantee, defend, and preserve that right. Prima facie, to guarantee means to secure and protect the right against any risk or need; to defend means to bar, prohibit, and prevent any activity that infringes the right; and to preserve is an action aimed at shielding the right in advance from possible dangers so as to ensure its continuation for future generations.
The State must assume the dual obligation to act and to refrain from acting: on the one hand, it must refrain from itself infringing the right to a healthy and ecologically balanced environment; on the other, it must undertake the task of adopting the measures necessary to satisfy constitutional requirements.” (Judgment N° 00644-99, issued at once horas veinticuatro minutos on veintinueve de enero de mil novecientos noventa y nueve; to the same effect, see voto 4947-2002, issued at nueve horas con veinticuatro minutos on veinticuatro de mayo de dos mil dos).’ In accordance with the foregoing considerations and the provisions set forth in the General Health Law (Ley General de Salud), it follows that the State and the Municipalities are obligated to protect the right enshrined in Articles 21 and 50 of the Political Constitution (Constitución Política), which must be defended and preserved to secure the well-being of all the nation’s inhabitants.
IV.On the actions of the Municipalidad de Goicoechea in this specific case. The report submitted by the respondent authorities—given under oath, after due warning of the consequences provided for in Article 44 of the Law on Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional)—establishes a violation of the right to a healthy and ecologically balanced environment, as well as the right to health, for the reasons set forth below. It has been established that the petitioner filed several complaints with the Municipalidad de Goicoechea seeking an effective solution to the pollution and safety problems caused by a vacant lot belonging to that municipal entity. That property—which is designated as a park area and belongs to the respondent municipal corporation—is abandoned and has become a garbage dump that causes the proliferation of cockroaches, flies, rats, and other pests, thereby posing a threat to public health.
Likewise, there is no oversight of the homeless persons who spend the night on that lot, a situation that creates a safety and health problem for the residents of the community. In her statutory report (informe de ley), the Mayor acknowledges the situation reported by the petitioner and informs this Chamber that administrative arrangements have already been made for cleanup and other work intended to eliminate the problems described by the petitioner. Accordingly, based on the evidence contained in the case file (expediente), it may be determined that the respondent municipal corporation had known for years about the environmental pollution problem affecting the property identified by the petitioner, but merely confirmed its existence and evaded its responsibility, without taking timely action to mitigate or control it. Consequently, the Municipalidad de Goicoechea has not taken concrete action to provide a permanent solution to the reported problem; the alleged violation of Articles 21 and 50 of the Political Constitution is therefore established. In view of the foregoing, the appropriate course is to grant the petition, as is hereby ordered.
Por tanto:
The petition is GRANTED. Ana Lucía Madrigal Faerrón, in her capacity as Mayor of the Municipalidad de Goicoechea, or whoever may hold that office in her stead, is ordered to immediately issue the appropriate instructions to permanently resolve the problem reported by the petitioner, Lorena Gutiérrez Corrales. This shall be done within the non-extendable period of ONE MONTH from service of this judgment, with the warning that failure to do so could constitute the offense defined in Article 71 of the Law on Constitutional Jurisdiction, which provides that anyone who receives an order issued in an amparo proceeding (recurso de amparo) that must be complied with or enforced and fails to comply with or enforce it shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipalidad de Goicoechea is ordered to pay the legal costs, damages, and losses (costas, daños y perjuicios) caused by the acts underlying this ruling, to be determined in the judgment-enforcement proceedings (ejecución de sentencia) before the administrative litigation court. This decision shall be served upon Ana Lucía Madrigal Faerrón, in her capacity as Mayor of the Municipalidad de Goicoechea, or whoever may hold that office in her stead.-

Recurso de amparo que se tramita en expediente número 13-013323-0007-CO, interpuesto por LORENA GUTIÉRREZ CORRALES, cédula de identidad 0106800212, mayor, vecina de Goicoechea, contra la MUNICIPALIDAD DE GOICOECHEA.-
Resultando:
Redacta el Magistrado Salazar Murillo; y,
Considerando:
I.Objeto del recurso.- La recurrente acusa que desde hace años ha presentado varias denuncias sobre la existencia de un lote baldío, que es propiedad de la Municipalidad de Goicoechea, el cual, inicialmente, fue destinado por el Instituto Nacional de Vivienda y Urbanismo, como parque infantil o zona verde. Sin embargo, asegura que dicho lote está en completo estado de abandono, y se ha convertido en un botadero de basura que produce no sólo la proliferación de cucarachas, moscas y ratas, entre otros, sino también que se convierte en una "guarida" para que los indigentes pasen las noches, situación que constituye un serio problema para la seguridad y la salud de los habitantes de las comunidad, lo que va en detrimento de los artículos 21 y 50 de la Constitución Política.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
a. La recurrente ha planteado varias denuncias ante la Municipalidad de Goicoechea, para que se brinde una solución efectiva al problema de contaminación y seguridad provocado por un lote baldío que pertenece a dicho ente municipal (hecho no controvertido).
b. La Municipalidad de Goicoechea no ha brindado una solución al problema de contaminación denunciado por la recurrente (informe de la autoridad recurrida).
III.Sobre el Derecho a un Ambiente Sano y Ecológicamente Equilibrado. En reiteradas ocasiones este Tribunal ha insistido en el deber que tiene el Estado de tutelar el derecho a un medio ambiente sano y ecológicamente equilibrado del que gozan los habitantes del país, con el fin de garantizar su derecho a la salud. Sobre el particular, resulta de relevancia lo dispuesto en la sentencia número 2002-11429 de las nueve horas con catorce minutos del veintinueve de noviembre de dos mil dos, en la que se señaló en lo que interesa:
“(… ) IV.- Sobre el derecho a la salud y a un ambiente sano y equilibrado. Es ampliamente reconocido por este Tribunal Constitucional la atención que merece el derecho a la salud que si bien no está expresamente reconocido en la Carta Magna, se extrae inevitablemente del derecho a la vida protegido por el artículo 21, que señala ‘La vida humana es inviolable’; además, se ha establecido que como antecedente del derecho a un ambiente sano y equilibrado consagrado en el artículo 50 constitucional:
‘ARTICULO 50. El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza.
Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello, está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado.
El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes. (Así reformado por el artículo 1º de la ley No.7412 de 3 de junio de 1994).’ De esta manera, resulta de interés retomar algunas consideraciones respecto a este punto, emitidas en anteriores ocasiones por este Tribunal Constitucional:
‘III.- Sobre el derecho. El artículo 50 de la Constitución Política establece que toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. El derecho a un ambiente sano tiene un contenido amplio que equivale a la aspiración de mejorar el entorno de vida del ser humano, de manera que desborda los criterios de conservación natural para ubicarse dentro de toda esfera en la que se desarrolle la persona, sea la familiar, la laboral o la del medio en el cual habita. De ahí que se afirme que se trata de un derecho transversal, es decir, que se desplaza a todo lo largo del ordenamiento jurídico, modelando y reinterpretando sus institutos. El ambiente es definido por la Real Academia Española de la Lengua como el 'conjunto de circunstancias físicas que rodean a los seres vivos', lo que recalca aún más el carácter general del derecho. En cambio el derecho a un ambiente ecológicamente equilibrado es un concepto más restringido referido a una parte importante de ese entorno en el que se desarrolla el ser humano, al equilibrio que debe existir entre el avance de la sociedad y la conservación de los recursos naturales.
Ambos derechos se encuentran reconocidos expresamente en el artículo 50 de la Constitución Política, que perfila el Estado Social de Derecho. La ubicación del derecho a un ambiente sano y ecológicamente equilibrado dentro de las regulaciones constitucionales del Estado Social de Derecho es el punto a partir del cual debe éste ser analizado. El Estado Social de Derecho produce el fenómeno de incorporación al texto fundamental de una serie de objetivos políticos de gran relevancia social y de la introducción de un importante número de derechos sociales que aseguran el bien común y la satisfacción de las necesidades elementales de las personas. En esta perspectiva, la Constitución Política enfatiza que la protección de los recursos naturales es un medio adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los poderes públicos sobre los factores que pueden alterar el equilibrio de los recursos naturales y, más ampliamente, obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano.
De igual forma que el principio del Estado Social de Derecho es de aplicación inmediata, el derecho a un ambiente sano y ecológicamente equilibrado también lo es, de manera que se manifiesta en la doble vertiente de derecho subjetivo de las personas y configuración como meta o fin de la acción de los poderes públicos en general. La incidencia que tiene el derecho a un ambiente sano y ecológicamente equilibrado dentro de la actividad del Estado, encuentra su primera razón de ser en que por definición los derechos no se limitan a la esfera privada de los individuos sino que tienen asimismo trascendencia en la propia estructura del Estado en su papel de garante de los mismos y, en segundo término, porque la actividad del Estado se dirige hacia la satisfacción de los intereses de la colectividad. La Constitución Política establece que el Estado debe garantizar, defender y preservar ese derecho.
Prima facie garantizar es asegurar y proteger el derecho contra algún riesgo o necesidad, defender es vedar, prohibir e impedir toda actividad que atente contra el derecho, y preservar es una acción dirigida a poner a cubierto anticipadamente el derecho de posibles peligros a efectos de hacerlo perdurar para futuras generaciones. El Estado debe asumir un doble comportamiento de hacer y de no hacer; por un lado debe abstenerse de atentar él mismo contra el derecho a contar con un ambiente sano y ecológicamente equilibrado, y por otro lado, debe asumir la tarea de dictar las medidas que permitan cumplir con los requerimientos constitucionales." (Sentencia N° 00644-99 de las once horas veinticuatro minutos del veintinueve de enero de mil novecientos noventa y nueve; en el mismo sentido se puede consultar el voto 4947-2002 de las nueve horas con veinticuatro minutos del veinticuatro de mayo de dos mil dos).’ De conformidad con lo señalado en las consideraciones anteriores, y de las normas contempladas en la Ley General de Salud, se infiere la obligación del Estado y de las Municipalidades de proteger el derecho protegido en los numerales 21 y 50 de la Constitución Política, derecho que debe ser defendido y preservado con la finalidad de obtener el bienestar de todos los habitantes de la nación.
IV.Sobre la actuación de la Municipalidad de Goicoechea en el caso en concreto. Del informe rendido por las autoridades recurridas -dado bajo la solemnidad del juramento, con oportuno apercibimiento de las consecuencias previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional-, se constata la vulneración del derecho a un ambiente sano y ecológicamente equilibrado, así como el derecho a la salud, con fundamento en las razones que a continuación se exponen. Se tiene por acreditado que la recurrente ha planteado varias denuncias ante la Municipalidad de Goicoechea, para que se brinde una solución efectiva al problema de contaminación y seguridad provocado por un lote baldío que pertenece a dicho ente municipal. Dicho inmueble -que constituye zona destinada a parque y pertenece a la corporación municipal accionada- está en estado de abandono y se ha convertido en un botadero de basura que produce la proliferación de cucarachas, moscas y ratas, entre otros, convirtiéndose en una amenaza a la salud pública.
De igual manera no existe control sobre los indigentes que pasan las noches en dicho lote, situación que constituye un problema para la seguridad y la salud de los habitantes de las comunidad. En su informe de ley, la Alcaldesa reconoce la situación denunciada por la amparada, e indica a esta Sala que ya se coordinó administrativamente la limpieza y realización de otros trabajos a fin de eliminar los problemas descritos por la recurrente. De este modo, de conformidad con los elementos probatorios que constan en el expediente, es posible dirimir que desde hace años la corporación municipal recurrida tenía conocimiento del problema de contaminación ambiental existente en el inmueble señalado por la recurrente, y se limitó a constatar su existencia y evadir su responsabilidad, y sin realizar las acciones oportunas para mitigar el mismo o controlarlo. En consecuencia, la Municipalidad de Goicoechea no ha tomado acciones concretas para dar una solución definitiva al problema denunciado, por lo que se constata la alegada violación los artículos 21 y 50 de la Constitución Política. En mérito de lo expuesto, lo procedente es declarar con lugar el recurso, como en efecto se dispone.
Por tanto:
Se declara CON LUGAR el recurso. Se ordena a Ana Lucía Madrigal Faerrón, en su condición de Alcaldesa Municipal de Goicoechea, o a quién en su lugar ocupe ese cargo, girar inmediato las instrucciones pertinentes a fin de solucionar definitivamente el problema denunciado por la recurrente, Lorena Gutiérrez Corrales. Lo anterior dentro del término improrrogable de UN MES contado a partir de la notificación de esta sentencia y bajo apercibimiento de que podría incurrir en el delito tipificado en el artículo 71 de la Ley de la Jurisdicción Constitucional, el cual dispone que se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Goicoechea al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese la presente resolución a Ana Lucía Madrigal Faerrón, en su condición de Alcaldesa Municipal de Goicoechea, o a quién en su lugar ocupe ese cargo.-
