San José, at fourteen hours thirty minutes on fifteen May two thousand thirteen. Constitutional challenge filed by ALLAN ASTORGA GÄTTGENS, of legal age, married, holder of a Bachelor’s Degree in Geology and a Doctorate in Natural Sciences, resident of San Rafael de Montes de Oca, bearer of identity card No. 3-0252-0451, and ALVARO SAGOT RODRIGUEZ, of legal age, attorney, resident of Palmares, Alajuela, bearer of identity card number 2-365-227, against Agreement No. 4230 adopted by the SENARA Board of Directors at Special Session No. 315-11 of 31 October 2011.

Background:

  1. 1By a filing received by the Secretariat of the Chamber at thirteen hours fifty-four minutes on fifteen December 2011, the petitioners request that Agreement No. 4230, adopted by the SENARA Board of Directors at Special Session No. 315-11 of 31 October 2011, be declared unconstitutional. They allege that the agreement is challenged because it violates the constitutional right to a healthy and ecologically balanced environment, the right to life, and the precautionary principle (principio precautorio), by authorizing the replacement or relocation of fuel tanks at service stations and facilities storing fuel for their own consumption, without requiring the submission of an environmental impact study (estudio de impacto ambiental).
  2. 2To substantiate their standing (legitimación) to bring this constitutional challenge (acción de inconstitucionalidad), they state that it derives from the second paragraph of Article 75 of the Ley de la Jurisdicción Constitucional, insofar as the action seeks to defend diffuse interests (intereses difusos), such as those relating to the environment.
  3. 3By a decision issued at fourteen hours thirty-seven minutes on eight February two thousand twelve, the action was admitted for consideration, and the Office of the Attorney General of the Republic, the Minister of Environment and Energy, the

Chair of the SENARA Board of Directors, and the Technical Secretary of the Secretaría Técnica Nacional Ambiental (SETENA) were granted a hearing.

  1. 4The Office of the Attorney General of the Republic submitted its report, stating that it is important to clarify the legal nature and scope of the challenged agreement. On the one hand, that agreement does not reflect an arrangement between public entities and agencies exempting the replacement of fuel tanks from the requirement to conduct an Environmental Impact Study; on the other hand, the challenged agreement does not entail the adoption of an administrative act of general application (acto administrativo de alcance general) that bindingly orders and establishes that an Environmental Impact Study, together with the corresponding hydrogeological study (estudio hidrogeológico), cannot be required for the replacement of fuel-storage tanks. It states that the replacement of fuel tanks requires a procedure conducted before the Dirección General de Transporte y Comercialización de Combustible (hereinafter DGTCC) of

MINAET and that, as provided in Article 72 of Decreto No. 30131-MINAE-S, both the remodeling and expansion of service stations and the mere replacement of fuel-storage tanks are authorized and supervised by the DGTCC. That entity is also responsible for forwarding applications to replace storage tanks to the Secretaría Técnica Nacional Ambiental (hereinafter SETENA) for the corresponding assessment, and SETENA, in turn, requests the corresponding hydrogeological studies as part of the Environmental Impact Study. The challenged agreement did not modify the aforementioned procedure. It further indicates that the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (hereinafter SENARA) is not the entity with jurisdiction to determine whether, pursuant to Decreto No. 30131-MINAE-S, the replacement of fuel tanks must undergo an Environmental Impact Study and a hydrogeological study; accordingly, Agreement No. 4230 did not decide anything in that regard.

SENARA is merely one of the entities consulted during the processing of applications to construct and operate service stations for distribution to final consumers or for fuel storage. (Article 7.4 of Decreto No. 30131-MINAE-S). In other words, the decision adopted by the SENARA Board of Directors could not have the effect of preventing the DGTCC from forwarding the application to SETENA or preventing SETENA from requesting the Environmental Impact Study and its corresponding hydrogeological study, because the agreement did not provide for any such thing. It concludes that Agreement No. 4230, adopted by the SENARA Board of Directors at its Special Session No. 315-11 of 31 October 2011, did not eliminate the Environmental Impact Study or the corresponding hydrogeological study from the procedure to be followed before the DGTCC for the replacement of fuel-storage tanks. Moreover, during the period in which the agreement remained in force—because it was revoked at Ordinary Session No. 608-11 of 19 December 2011, pursuant to Agreement No. 4306 of the SENARA Board of Directors—the challenged agreement did not have the effect of modifying the procedure followed for replacing fuel-storage tanks, which requires an Environmental Impact Study and the corresponding hydrogeological study. Consequently, it considers that this action should be summarily dismissed.

  1. 5Mr. René Castro Salazar, Minister of the Ministerio de Ambiente, Energía y Telecomunicaciones, responds to the hearing granted, stating that, according to the Dirección General de Transporte y Comercialización de Combustible and the technical regulations currently in force, specifically Decreto Ejecutivo No. 30131-MINAET-S, tank replacement does not contemplate consultations by the Dirección General de Transporte y Comercialización de Combustible with the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento or SETENA as part of a specific procedure. He states that, through official letter SG-DEA-0273-2011 of 25 January 2011, SETENA issued its technical and legal opinion regarding that institution’s procedures for tank-replacement works. Regarding the vulnerability of water resources, he indicates that, within the environmental assessment process (proceso de evaluación ambiental), where a significant degree of hydrogeological vulnerability requires the

introduction of technical-engineering solutions or compensation, mitigation, or prevention measures, as applicable in each specific case, SETENA is the technically competent and specialized body responsible for determining and ordering the actions to be taken. He states that SETENA, for its part, has indicated that the agreement creates considerable uncertainty because, on the one hand, it states that the Secretaría Técnica Nacional Ambiental will not request an environmental impact study in cases involving the replacement or relocation of fuel tanks at service stations and storage facilities for their own consumption, while, on the other hand, uncertainty arises as to the possibility of applying other types of instruments in such cases, a situation that creates considerable uncertainty for SETENA. He states that official letter No. 733-2011 from the Dirección General de Transporte y Comercialización de Combustible requested that the Secretaría Técnica Nacional Ambiental and the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento review the content and scope of Agreement No. 4230 of the SENARA Board of Directors.

In conclusion, it is indicated that official letter JD-SEA-OF-001-2012 dated 22 January 2012, signed by Licda. Iveth Castillo Ruiz, communicated that Agreement No. 4306 of that agency’s Board of Directors, adopted at Ordinary Session No. 608-11 of 19 December 2011, repealed Agreement No. 4230 adopted by that Board of Directors at its Special Session No. 315-11 dated 31 October 2011. He requests that the constitutional challenge filed by the petitioner be denied.

  1. 6Mr. Carlos Dengo Garrón, in his capacity as Chair of the Board of Directors of the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), responds to the hearing granted, stating that SENARA’s powers must be made clear, since Article 3, subsection ch), of Ley 6877 states that SENARA may: “Investigate, protect, and promote the use of the country’s water resources, both surface water and groundwater.” He further states that, pursuant to subsection h) of the same statute, SENARA issues opinions before SETENA and the

Dirección de Hidrocarburos adopt decisions concerning the subject matter within its jurisdiction, namely water resources. Regarding the challenged agreement, he states that replacing or changing a fuel tank was deemed not to entail a land-use change (cambio en el uso del suelo), as would be the case with the comprehensive remodeling of a fuel station; consequently, it was not appropriate to require an Environmental Impact Study procedure, and the use of another type of environmental measure—the sworn declaration of environmental commitments (declaración jurada de compromisos ambientales), signed by a geologist—was sufficient to ensure that no fuel spilled from the tanks. He indicates that this is because the environmental authorities have several intervention and regulatory techniques, including what are known as authorizations, which are distinguishable from the other state regulatory technique, namely regulation-making.

He states that the Reglamento General sobre los procedimientos de evaluación de impacto ambiental, Decreto Ejecutivo No. 31849-MINAE-S-MOPT-MAG-MEIC of 24 May 2004, distinguishes between the Environmental Impact Study and environmental assessment. The aforementioned regulation provides that activities, projects, or works must undergo an environmental assessment process. The regulatory determination of which projects, activities, or works are exempt and which must undergo such assessment is a discretionary decision of the Executive Branch; because it constitutes the exercise of public authority affecting private activities, it may not be exercised arbitrarily. He indicates that SETENA was consulted and stated that requiring an Environmental Impact Study was unnecessary and that, on this basis, it is not admissible to assert that the challenged provision is unconstitutional. He does not consider it necessary to request an Environmental Impact Study for the change or replacement of a tank at an existing fuel-service or storage facility, because the precautionary principle, the provisions of Article 50 of the Constitution, and Article 17 of the Ley Orgánica del Ambiente have been satisfied by requiring compliance with a procedure less burdensome than that Study, namely a sworn declaration of environmental guarantees (declaración jurada de garantías ambientales), since it is more proportionate and reasonable under the circumstances.

Likewise, it uncertainty in the issued guidelines, just as “ states that, additionally, the principle of non-regression in environmental matters (principio de no regresión en materia ambiental) is not violated, as the petitioner alleges, because no new instrument is being invented or created. Rather, it is stated with complete transparency that what is required is one of the instruments previously established: the sworn declaration of environmental commitments (declaración jurada de compromisos ambientales), and that the protective instrument identified in the challenged provision has existed for more than 7 years. Furthermore, he states that the dispute over whether an environmental impact study (Estudio de Impacto Ambiental) or a sworn declaration of environmental commitments should be conducted is a dispute beyond the jurisdiction of this Chamber, since it would entail reviewing the technical criteria on which the Administration or the competent body relied when issuing the challenged provision, which exceeds the nature of an action of unconstitutionality (recurso de inconstitucionalidad).

He cites voto 2004-01976 of this Chamber, from which it follows that the Chamber has repeatedly held that it is impossible to analyze disagreements concerning technical criteria or parameters. In conclusion, he states that the challenged resolution was repealed by resolution No. 4306, adopted at Ordinary Session No. 608-11 of 19 de diciembre del 2011 by the Board of Directors of SENARA, and therefore there is currently no provision in force to challenge. He requests that the action of unconstitutionality be dismissed.

  1. 7Mr. Uriel Juárez Baltodano, in his capacity as Secretary of the Secretaría Técnica Nacional Ambiental, responds to the hearing granted, stating that, through official letter JD-0258-2011, the Board of Directors of the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) issued the transcript of resolution No. 4230 from Extraordinary Session No. 315-11,

held on 31 de octubre de 2011, concerning the procedure for replacing fuel tanks before the Dirección General de Transporte y Comercialización de Combustible, the Secretaría Técnica Nacional Ambiental, and SENARA. (Anexo 1 to official letter No. JD-258-2011, the transcript of resolution No. 4230, and the arguments against it are attached.) He states that the resolution provides: “SETENA does not require an environmental impact study.” He adds that it is important to understand why the DGTCC decided to require environmental viability (Viabilidad Ambiental) as a prerequisite for the replacement of fuel tanks, the essential basis for which was Resolution No. 2009-012667 of the Sala Constitucional de la Corte Suprema de Justicia, in which a violation of Articles 41 and 50 of the Constitución Política was alleged. He indicates that the referenced case was processed by SETENA under administrative expediente No. 1419-2008-SETENA.

The project consisted of replacing three old fuel tanks with new ones meeting the characteristics currently required by the legislation in force. He states that, through Official Letter No. 177-10-SETENA dated 26 de abril del año 2010, Eng. Sonia Espinosa requested that SETENA’s Departamentos de Evaluación Ambiental y Seguimiento y Auditoría Ambiental prepare a report for the Comisión Plenaria specifying the procedure being followed to process the follow-up assessment of fuel-tank replacement projects. That procedure was carried out jointly with the DGTCC and with review by AyA’s UEN de Gestión Ambiental. The report was submitted to the Comisión Plenaria through Official Letter No. ASA-659-2012. In view of the foregoing, it is stated that the position of the senior officials of MINAET and SETENA, as well as the Comisión Plenaria, is clearly to conduct environmental impact assessments (Evaluaciones de Impacto Ambiental) in order to strengthen environmental analysis.

However, resolution No. 4230 states that SETENA will not require environmental impact studies for the replacement of fuel tanks, which contradicts the previously issued guidelines. In addition, another directive in resolution No. 4230 states that fuel-tank replacement projects will not be required to undergo proceedings before SETENA; however, it states that the DGTCC must submit a sworn declaration (Declaración Jurada) by the public-service provider, endorsed by an expert professional, guaranteeing that there is no possible fuel spill or presence of vapors at the site. This means that SETENA would have no involvement in the environmental monitoring (seguimiento ambiental) of these projects. He states that it is important to clarify that, through official letter JD-SEA-OF-001-2012 dated 22 de enero del 2012, signed by Licda. Iveth Castillo Ruiz, Secretary of the Board of Directors of SENARA, it was reported that resolution No. 4306 of SENARA’s Board of Directors, approved at Ordinary Session No. 608-11 of 19 de diciembre del 2011, repealed resolution No. 4230 adopted by that Board of Directors at Extraordinary Session No. 315-11 dated 31 de octubre del 2011.

He concludes by citing Article 84, subsections b and c, of the Ley Orgánica del Ambiente, which states: “The functions of the Secretaría Técnica Nacional Ambiental are as follows: b) Recommend the actions necessary to minimize the impact on the environment, as well as those technically appropriate for restoring it. c) Address and investigate complaints submitted to it concerning the degeneration caused by environmental damage.” He requests that the action of unconstitutionality be granted.

  1. 8The notices referred to in the second paragraph of Article 81 of the Ley de la Jurisdicción Constitucional were published in issues 50, 51 and 52 of the Boletín Judicial on 09, 12 y 13 de marzo de 2012.
  2. 9The hearing provided for in Articles 10 and 85 of the Ley de la Jurisdicción Constitucional is dispensed with, pursuant to the authority granted to the Chamber by Article 9 thereof, because this decision is deemed sufficiently grounded in evident principles and provisions, as well as in the case law of this Court.
  3. 10The statutory requirements have been met in these proceedings.

Justice Castillo Víquez drafts the opinion; and,

Considering:

I.Admissibility. The action of unconstitutionality challenges resolution No. 4230 of the Board of Directors of the Servicio

Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), adopted at Extraordinary Session 315-11 of 31 de octubre de 2011, which forms part of the procedure for obtaining authorizations from the Dirección General de Transporte y Comercialización de Combustibles of MINAET to replace fuel tanks at service stations and storage facilities for hydrogeological, in its place “ self-consumption. The action seeks to protect the aquifers (mantos acuíferos) underlying service stations from fuel leaks, in violation of Articles 21 and 50 of the Constitution. In accordance with the second paragraph of Article 75 of the Ley de la Jurisdicción Constitucional and the extensive case law on the subject, environmental protection constitutes a typical case of diffuse interest (interés difuso), which establishes standing (legitimación) to bring actions of unconstitutionality directly. Accordingly, the merits of the action of unconstitutionality must be decided.

II.Subject matter of the challenge. The challenged resolution states that it is the result of coordination among several public agencies involved in the issuance, by the Dirección General de Transporte y Comercialización de Combustibles of the Ministerio de Ambiente, Energía y Telecomunicaciones, of authorizations to replace hydrocarbon-fuel storage tanks. It constitutes an instrument promoting the development of a strategy for the expedited processing of applications, to safeguard the rights of regulated parties (administrados), address vulnerability, and protect water resources. In this regard, it regulates the replacement of underground fuel tanks at service stations and aboveground storage tanks for self-consumption, where those facilities are accredited to provide the service (it is not intended to regulate

new service stations, their renovation, or the installation of new self-consumption tanks). The resolution states that SETENA will not require an “environmental impact study,” and that SENARA will not require a “sworn declaration endorsed by a professional expert in the field, guaranteeing that there is no fuel spill or presence of vapors at the site where the tanks are located and are to be replaced.” In summary, when MINAET’s Dirección General de Transporte y Comercialización de Combustible consults SENARA, SENARA will issue an opinion on the degree of intrinsic vulnerability (vulnerabilidad intrínseca) of the aquifer where such studies are available. If no hydrogeological studies (estudios hidrogeológicos) exist for the respective sites of interest, a warning will be issued to the Dirección General de Transporte y Comercialización de Combustible. In that event, the measures established in Decreto Ejecutivo No. 30131 MINAE-S, published in the Diario Oficial La Gaceta No. 43 of 1 de marzo de 2002, will be required. Once the application has been approved, copies of the sworn declaration and the replacement permit will be sent to SENARA and SETENA.

III.Unconstitutionality for violation of the precautionary principle (principio precautorio). It is evident that the challenged resolution seeks to streamline the procedures applicable to regulated parties, an apparently legitimate purpose contained in Article 41

of the Constitution, but one that must be implemented in such a way that every action by the State maintains a fair balance among the interests involved, particularly those concerning the fundamental right to a healthy and ecologically balanced environment. Where there is certainty that certain activities have a low environmental impact, it may be appropriate to waive certain scientific and technical environmental-impact studies and assessments; but where such certainty is absent, the State must safeguard other principles. Thus, judgment 2011-2699 stated:

“Furthermore, the State is under an obligation to act preventively, avoiding—through oversight and direct intervention—the commission of acts that harm the environment, and is subject to the corresponding and equally unavoidable prohibition against encouraging its degradation. The foregoing requires not only recognition of the right to the environment, but also the use of all materially and legally valid means to protect it against any harm to which it may be subjected. Because environmental damage is often irreparable, preventive oversight by the Administration and the promptness of the measures it adopts directly affect the magnitude of the harm to the environment. For this reason, the precautionary principle has been recognized in the case law of this Chamber and granted constitutional status, including in judgment N. 2219-99 at 15:18 hours on 24 de marzo de 1999. It is important to emphasize the principle of rational use of resources (principio del uso racional de los recursos), derived from Article 69 of the Constitution, which refers to the ‘rational use of natural resources.’” This Chamber—in various rulings—has established that environmental protection must be directed toward the proper and intelligent use of environmental elements and their natural, sociocultural, technological, and political relationships (sustainable development (desarrollo sostenible)), thereby safeguarding the heritage to which present and future generations are entitled.

Therefore, the primary objective of the sustainable use and protection of the environment is that, through the production and use of technology, not only economic gains are obtained, but above all favorable development and evolution of the environment and natural resources alongside human beings, that is, without causing damage or harm.

Likewise:

“3.- Regarding the precautionary principle (principio precautorio), or ‘principle of prudent avoidance’ (principio de la evitación prudente), a concept developed in judgments numbers 2806-98, 2003-06322, 2004-1923 and 2005-12039 of this Court, which is grounded in Article 15 of the 1992 United Nations Conference on Environment and Development, Rio Declaration, and refers to the necessary action and effect of preventing in advance possible harm to the constituent elements of the environment; accordingly, it advocates implementing actions aimed at the proper protection, conservation, and appropriate management of resources, that is, adopting all precautionary measures to prevent or contain possible harm to the environment or human health. Thus, where there is a risk of serious or irreversible harm—or an objective doubt in that regard—a precautionary measure must be adopted, including postponement of the activity in question, because subsequent enforcement is ineffective in this area, given that biological effects are irreversible in most cases; although punishment may have moral significance, it will scarcely compensate for the harm caused to the environment.

The Chamber takes into account that the interest in expediting administrative procedures can never take precedence over the precautionary principle, especially when the activities involved are hazardous to the environment and human beings. It should be noted that Decreto Ejecutivo No. 30131-MINAE-S (prior to the amendment of its Article 72) would apply only to a very limited extent to tank replacement, because although Article 1 states that it covers the minimum technical specifications for the construction and remodeling of service stations and storage tanks, the provisions it develops contain no express reference to or specific regulation of tank replacement, but only remodeling and expansion. Therefore, when the challenged decision was in effect, the Decreto Ejecutivo had to be applied through an analogical interpretation of its provisions. Worse still, given the gap left by the Decreto Ejecutivo, this silence could invite an application contrary to the precautionary principle within SENARA, because hydrogeological studies (estudios hidrogeológicos) were effectively dispensed with. It must be taken into account that the Poder Ejecutivo amended those regulations through Decreto Ejecutivo No. 36967 del 9 de enero de 2012, establishing new regulations that provide greater environmental safeguards and are tailored to tank-replacement activities.

IV.Regarding SENARA’s lack of jurisdiction. In the Chamber’s view, SETENA, in its Oficio SG-DEA-0273-2011 del 25 de enero de 2011, clearly

determined the requirements for processing this type of authorization: namely, the D1 environmental impact assessment (evaluación de impacto ambiental), hydrogeological studies, including a hydrocarbon migration study (estudio de tránsito de hidrocarburos). In principle, decision No. 4230 issued by the Junta Directiva del Servicio Nacional de Aguas Subterráneas, Riego y Aventamiento would be repealed after having remained in effect for approximately one and a half months. Indeed, in the Chamber’s view, that decision suffers from other substantive defects because, although it arose from an effort to standardize the processing procedures for fuel-storage-tank replacement permits by the public authorities participating in the proceeding before the Dirección General de Transporte y Comercialización de Combustible del MINAET and other institutions, the challenged portion of the decision exceeds its jurisdiction and encroaches upon other administrative bodies. This is demonstrated by SETENA’s reports, which reject SENARA’s actions and consider them to create uncertainty. Furthermore, it is clear that, because it was a decision issued after SETENA’s determination, it could not alter what that body had previously established, namely:

“For this purpose, because the storage tanks are replaced with new tanks, whether underground or aboveground, an environmental impact assessment is required, without exception, through the submission of environmental assessment document D1 (documento de evaluación ambiental D1), together with the required documentation (…) The following studies must also be submitted: (…) b) A hydrogeological study, including a hydrocarbon migration study. Although the service station is in operation and does not have environmental feasibility approval (viabilidad ambiental), the specified studies must be submitted” (oficio SG-DEA-0273-2011 del 25 de enero de 2011). The Procuraduría General de la República, more clearly than the Ministerio de Ambiente, Energía y Telecomunicaciones, maintains its general claim that SENARA’s decision is not binding on the other public agencies because the entity issuing it lacked jurisdiction to do so.

As the Ministro states, decisions cannot modify the powers granted by regulations and laws, and consequently application of that decision would be wholly irregular because it would impair the powers of the other institutions. In the Chamber’s view, because the act was issued by an entity lacking jurisdiction and would modify SETENA’s criterion by dispensing with the environmental impact assessment in these circumstances, the proper course is to deem it null and void under Article 129 of the Ley General de la Administración Pública. This is also required for the reasons set forth below.

V.The decision issued granted an exemption from the environmental impact study (estudio de impacto ambiental), which would have consequences that cannot be quantified because none of this has been reported to the Chamber. Consequently, it could be misleading simply to dismiss the action based on the arguments of the Procuraduría General de la República, the Ministro de Ambiente, Energía y Telecomunicaciones, and the reasons provided by SENARA. Although the Environmental Impact Study (Estudio de Impacto Ambiental, EsIA) is contained within the Environmental Impact Assessment (Evaluación de Impacto Ambiental, EIA) and forms part of the latter, the EIA is specifically established as the procedure for obtaining this type of authorization because it guarantees that human activity—particularly category D1 activities, which are classified as having high or moderate potential environmental impact—will mitigate its impacts. Accordingly, to permit any administrative or judicial correction of an unconstitutional application of the challenged decision due to the violation of the precautionary principle, the action must be granted in order to remove from the legal system any threat to the right to a healthy and ecologically balanced environment. Any act or decision must be annulled to protect the environmental right established in Article 50 of the Constitution and against its possible

application, in addition to the aforementioned violation of Article 129 of the Ley General de la Administración Pública.

Por tanto:

The action is GRANTED. Consequently, decision No. 4230 of the Junta Directiva del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), adopted at Sesión Extraordinaria No. 315-11 del 31 de octubre de 2011, is annulled as unconstitutional. This judgment has declaratory and retroactive effect as of the date on which the annulled decision entered into force, without prejudice to rights acquired in good faith. This ruling shall be communicated to the Poder Ejecutivo. A summary of this ruling shall be published in the Diario Oficial La Gaceta, and the ruling shall be published in full in the Boletín Judicial. Notice shall be given.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las catorce horas treinta minutos del quince de mayo de dos mil trece. Acción de inconstitucionalidad promovida por ALLAN ASTORGA GÄTTGENS, mayor, casado, Licenciado en Geología, Doctor en Ciencias Naturales, vecino de San Rafael de Montes de Oca, portador de la cédula de identidad No. 3-0252-0451, y ALVARO SAGOT RODRIGUEZ, mayor, abogado, vecino de Palmares, Alajuela, portador de la cédula de identidad número 2-365-227 contra el Acuerdo No. 4230 por la Junta Directiva del SENARA, en Sesión Extraordinaria No. 315-11 del 31 de octubre de 2011.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las trece horas cincuenta y cuatro minutos del quince de diciembre de 2011, los accionantes solicitan que se declare la inconstitucionalidad del acuerdo No. 4230 por la Junta Directiva del SENARA en Sesión Extraordinaria No. 315-11 del 31 de octubre de 2011. Alegan que el acuerdo se impugna porque lesiona el derecho constitucional a un ambiente sano y ecológicamente equilibrado, el derecho a la vida y el principio precautorio, al autorizar la sustitución o traslado de tanques de combustible en estaciones de servicio y de almacenamiento para auto consumo, sin necesidad de presentar un estudio de impacto ambiental.
  2. 2A efecto de fundamentar la legitimación que ostenta para promover esta acción de inconstitucionalidad, señala que proviene del párrafo segundo del artículo 75 de la Ley de la Jurisdicción Constitucional, en el tanto se hace defensa de intereses difusos, como lo son los referentes al medio ambiente.
  3. 3Por resolución de las catorce horas treinta y siete minutos del ocho de febrero de dos mil doce, se le dio curso a la acción, confiriéndole audiencia a la Procuraduría General de la República, al Ministro de Ambiente y Energía, al

de la Junta Directiva de SENARA y al Secretario Técnico de la Secretaría Técnica Nacional Ambiental (SETENA).

  1. 4La Procuraduría General de la República rindió su informe, en él señala que es importante precisar la naturaleza jurídica y los alcances del acuerdo impugnado. Por un lado, dicho acuerdo no refleja un convenio entre entes y órganos públicos mediante el cual se dispuso dispensar de la realización de un Estudio de Impacto Ambiental a la actividad de sustitución de tanques de combustibles y, por otro lado, el acuerdo impugnado no supone la adopción de un acto administrativo de alcance general que disponga y establezca en forma vinculante la imposibilidad de exigir un Estudio de Impacto Ambiental, con su correspondiente estudio hidrogeológico, en cuanto a la sustitución de los tanques de almacenamiento de combustible. Señala que la sustitución de tanques de combustible requiere de un trámite que se lleva acabo ante la Dirección General de Transporte y Comercialización de Combustible (en adelante DGTCC) del

MINAET y que según dicta el Decreto No. 30131-MINAE-S, en su artículo 72, tanto la remodelación y ampliación de estaciones de servicios como la simple sustitución de tanques de almacenamiento de combustibles las autoriza y fiscaliza la DGTCC y que, a la vez, esta entidad es la encargada de remitir la solicitud de sustitución de tanques de almacenamiento a la Secretaría Técnica Nacional Ambiental (en adelante SETENA) para la evaluación correspondiente y que ésta, a la vez, solicita los estudios hidrogeológicos correspondientes como parte de Estudio de Impacto Ambiental y que dicho acuerdo impugnado no modificó dicho procedimiento manifestado supra. Adicionalmente indica que el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (en adelante SENARA) no es el ente competente para determinar, si en aplicación del Decreto No. 30131-MINAE-S, la sustitución de tanques de combustibles debe ser o no ser sometida a un Estudio de Impacto Ambiental, así como de un estudio hidrogeológico, por lo cual lo dispuesto en el acuerdo No. 4230, no acordó nada en ese sentido.

El SENARA es nada más uno de los entes a consultar en el trámite de las solicitudes para construir y operar estaciones de servicio para la distribución al consumidor final o para el almacenamiento de combustible. (Artículo 7.4 del Decreto No. 30131-MINAE-S), es decir, lo acordado por la Junta Directiva de SENARA no podía tener como efecto que la DGTCC no remitiera la solicitud a la SETENA o que la misma no solicitara el Estudio de Impacto Ambiental, con su estudio hidrogeológico correspondiente, ya que no acordó tal cosa. Indica de manera conclusiva que con base al acuerdo No. 4230, adoptado en su Sesión Extraordinaria No. 315-11 del 31 de octubre del 2011 de la Junta Directiva de SENARA, no se dispuso la eliminación del Estudio de Impacto Ambiental y el correspondiente estudio hidrogeológico en relación al trámite a seguir ante la DGTCC para la sustitución de tanques de almacenamiento de combustible y que, dado a lo previo, durante su periodo de vigencia ya que el acuerdo fue revocado en su Sesión Ordinaria No. 608-11 del 19 de diciembre del 2011, según acuerdo No. 4306 de la Junta Directiva del SENARA; el acuerdo impugnado no tuvo el efecto de modificar el trámite seguido para la sustitución de tanques de almacenamiento de combustible, el cual requiere de un Estudio de Impacto Ambiental y el correspondiente estudio hidrogeológico, y que, por ende, considera que la presente acción debe ser rechazada de plano.

  1. 5El señor René Castro Salazar, Ministro del Ministerio de Ambiente, Energía y Telecomunicaciones, contesta la audiencia concedida, manifestando que de conformidad con la Dirección General de Transporte y Comercialización de Combustible y con la reglamentación técnica vigente, específicamente el Decreto Ejecutivo No. 30131-MINAET-S, no se encuentra previsto para la sustitución de tanques, la realización de consultas de parte de la Dirección General de Transporte y Comercialización de Combustible al Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento a la SETENA, como parte de un procedimiento específico. Señala que mediante oficio SG-DEA-0273-2011 del 25 de enero del 2011, la SETENA emitió el criterio técnico y legal del proceder de dicha institución respecto a las obras de sustitución de tanques. Indica que sobre la situación de vulnerabilidad del recurso hídrico, se indica que dentro del proceso de evaluación ambiental, un grado importante de vulnerabilidad hidrogeológica que requiera la

introducción de soluciones técnico-ingieneriles o medidas de compensación, mitigacion o de prevención mencionado, según corresponda en cada caso específico, la SETENA es el órgano técnicamente competente y especializado para determinar y ordenar las actuaciones a seguir. Manifiesta que, por su parte, la SETENA ha indicado que dicho acuerdo presenta una gran incertidumbre, ya que, por una parte, se indica que la Secretaria Técnica Nacional Ambiental no va a solicitar un estudio de impacto ambiental en los casos de sustitución o traslado de tanques de combustible en estaciones de servicio y de almacenamiento para autoconsumo y, por otro lado, surge la duda en cuanto a la posibilidad de aplicar otro tipo de instrumentos para estos casos, situación que le genera una gran incertidumbre a la SETENA. Señala que mediante oficio No. 733-2011 de la Dirección General de Transporte y Comercialización de Combustible se solicita a la Secretaria Técnica Nacional Ambiental y al Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento revisar el contenido y alcance del acuerdo No. 4230 de la Junta Directiva del SENARA.

De forma conclusiva se indica que mediante el oficio JD-SEA-OF-001-2012 de fecha de 22 de enero del 2012, suscrito por la Licda. Iveth Castillo Ruiz, se comunica que mediante acuerdo No. 4306 de la Junta Directiva de esa dependencia, adoptado en la Sesión Ordinaria No. 608-11 del 19 de diciembre del 2011, se derogó el acuerdo No. 4230 tomado por dicha Junta Directiva en su Sesión Extraordinaria No. 315-11 de fecha 31 de octubre del 2011. Solicita que se declare sin lugar el recurso de inconstitucionalidad interpuesto por el recurrente.

  1. 6El señor Carlos Dengo Garrón, en su condición de Presidente de la Junta Directiva del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) contesta la audiencia concedida, manifestando que las competencias del SENARA, deben quedar claras, por cuanto el artículo 3, inciso ch) de la Ley 6877, indica que el SENARA podrá: ³Investigar, proteger y fomentar el uso de los recursos hídricos del país, tanto superficiales como subterráneos.´Y que de acuerdo con el inciso h) de mismo cuerpo legal, el SENARA emite pronunciamientos previos a la adopción de decisiones de la SETENA y la

Dirección de Hidrocarburos, en torno a la materia de su competencia que es el recurso hídrico. Expresa que sobre el acuerdo cuestionado, se estimó que el realizar una sustitución o cambio de un tanque de combustible no conlleva un cambio en el uso del suelo como bien lo sería una remodelación integral de una estación expendedora de combustibles, por lo que no resultaba procedente exigir un procedimiento de Estudio de Impacto Ambiental, bastando la utilización de otro tipo de medida de carácter ambiental que es la declaración jurada de compromisos ambientales, firmadas por un geólogo, con el fin de asegurar que no hubiesen derramamientos de combustible proveniente de los tanques. Indica que esto se debe a que existen varias técnicas de intervención y ordenación por parte de las autoridades ambientales, como son las llamadas autorizaciones, distinguibles de la otra técnica de ordenación estatal que es la reglamentaria.

Señala que el Reglamento General sobre los procedimientos de evaluación de impacto ambiental, decreto ejecutivo No. 31849-MINAE-S-MOPT-MAG-MEIC del 24 de mayo del 2004, distingue entre el Estudio de Impacto Ambiental y la evaluación ambiental. El reglamento citado supra establece que las actividades, proyectos u obras deben ser sometidas a un proceso de evaluación ambiental. La determinación normativa en cuanto a que proyectos, actividades u obras se eximen, y cuales deben serlo, es una decisión discrecional del Poder Ejecutivo, y que como potestad pública que afecta actividades privadas, su ejercicio no puede ser arbitrario. Se indica que se consultó a la SETENA y la misma señaló que no resulta necesario exigir el Estudio de Impacto Ambiental y que, con base a esto, no es admisible señalar que la norma cuestionada es inconstitucional. No considera necesario el solicitar un Estudio de Impacto Ambiental para el cambio o sustitución de un tanque de una instalación de servicio o almacenamiento de combustible existente, pues el principio precautorio, lo dispuesto por el numeral 50 Constitucional y el artículo 17 de la Ley Orgánica del Ambiente, ha sido atendido al exigir el cumplimiento de un procedimiento menos gravoso que ese Estudio, como lo es la declaración jurada de garantías ambientales, ya que es de una naturaleza más proporcional y razonable a la situación en mano.

Asimismo, se incertidumbre en las directricesemitidas, tal y como ³ señala que adicionalmente no se ve violentado el principio de no regresión en materia ambiental, como alega el recurrente, dado que no se esta inventado o creando un instrumento nuevo, se indica, con total transparencia, que lo que exige es uno de los instrumentos establecidos con anterioridad: la declaración jurada de compromisos ambientales y que el instrumento de protección señalado en la norma impugnada, el que ha existido por más de 7 años. Además, manifiesta que el conflicto sobre si se realiza un Estudio de Impacto Ambiental o una declaración jurada de compromisos ambientales, es un conflicto que escapa de la competencia de esta Sala, por cuanto implicaría revisar los criterios técnicos en que se fundamentó la Administración o el órgano competente al emitir la norma impugnada, lo que excede la naturaleza del recurso de inconstitucionalidad, señalando el voto 2004-01976 de esta Sala, del cual se desprende que, de manera reiterada, ésta ha sostenido la imposibilidad de analizar la discrepancia en cuanto a criterios o parámetros de índole técnico.

De manera conclusiva, refiere que el acuerdo impugnado, ha sido derogado por medio del acuerdo No. 4306, adoptado en la Sesión Ordinaria No. 608-11 del 19 de diciembre del 2011, por parte de la Junta Directiva del SENARA, con lo que no existe norma alguna vigente que impugnar en la actualidad. Solicita que se declare sin lugar el acción de inconstitucionalidad.

  1. 7El señor Uriel Juárez Baltodano, en su condición de Secretario de la Secretaria Técnica Nacional Ambiental, contesta la audiencia concedida, manifestando que mediante el oficio JD-0258-2011 la Junta Directiva del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) emite la transcripción del acuerdo No. 4230 de la Sesión Extraordinaria No. 315-11,

celebrada el día 31 de octubre de 2011, referente al tramite de sustitución de tanques de combustible en la Dirección General de Transporte y Comercialización de Combustible, la Secretaría Técnica Nacional Ambiental y el SENARA. (Se adjunta anexo 1 del oficio No. JD-258-2011, la trascripción del acuerdo No. 4230, así como los argumentos en contra.) Refiere que dicho acuerdo presenta « SETENA no solicita un Estudio de Impacto Ambiental´. Añade que es importante conocer el motivo por el cual la DGTCC dispuso a solicitar como requisito de Viabilidad Ambiental para la sustitución de tanques de combustible, donde el punto fundamental lo constituyó la Resolución No. 2009-012667 de la Sala Constitucional de la Corte Suprema de Justicia, donde se alegaba la infracción a los artículos 41 y 50 de la Constitución Política. Indica que el caso en referencia fue tramitado por SETENA bajo el expediente administrativo No. 1419-2008-SETENA.

El proyecto consistió en la sustitución de tres tanques de combustible viejos por otros nuevos con las características exigidas actualmente mediante la legislación vigente. Manifiesta que mediante el Oficio No. 177-10-SETENA del día 26 de abril del año 2010, la Ing. Sonia Espinosa solicita a los Departamentos de Evaluación Ambiental y Seguimiento y Auditoría Ambiental de la SETENA que se prepare un informe para la Comisión Plenaria donde especifique el procedimiento que se está siguiendo para el trámite de evaluación de seguimiento de proyectos de sustitución de tanques de combustible. Dicho procedimiento se llevó en conjunto con la DGTCC y con la revisión de la UEN de Gestión Ambiental del AyA, El informe se remitió a la Comisión Plenaria mediante Oficio No. ASA-659-2012. En razón de lo expresado supra, se indica que es clara la posición de los Jerarcas del MINAET y de la SETENA y la Comisión Plenaria de querer ejecutar Evaluaciones de Impacto Ambiental con el fin de fortalecer el análisis ambiental, sin embargo, en el acuerdo No. 4230 se indica que la SETENA, para la sustitución de tanques de combustible, no solicitará Estudios de Impacto Ambiental, lo cual es contradictorio a los lineamientos emitidos de manera previa.

Adicionalmente otra directriz del acuerdo No. 4230 indica que los proyectos de sustitución de tanques de combustible no deberán realizar trámite ante el SETENA, sin embargo, indica que la DGTCC debe remitir la Declaración Jurada del prestador del servicio público avalada por un profesional que no existe un posible derrame de combustible o presencia de vapores en el sitio, situación que implica que la SETENA no podría tener injerencia en el seguimiento ambiental de estos proyectos. Señala que es importante aclarar que, mediante oficio JD-SEA-OF-001-2012 de fecha 22 de enero del 2012, suscrito por la Licda. Iveth Castillo Ruiz, Secretaria de la Junta Directiva del SENARA, que mediante acuerdo No. 4306 de la Junta Directiva del SENARA, aprobado en la Sesión Ordinaria No. 608-11 del 19 de diciembre del 2011, se derogó el acuerdo No. 4230 tomado por esa Junta Directiva en la Sesión Extraordinaria No. 315-11 de fecha 31 de octubre del 2011.

Finaliza citando el artículo 84, incisos b y c de la Ley Orgánica del Ambiente que indica: ³Las funciones de la Secretaria Técnica Nacional Ambiental son las siguientes: b) Recomendar las acciones necesarias para minimizar el impacto sobre el medio, así como las técnicamente convenientes para recuperarlo. c) Atender e investigar las denuncias que se le presenten en lo relativo a al degeneración del daño ambiental.´Solicita que se declare con lugar la acción de Inconstitucionalidad..

  1. 8Los edictos a que se refiere el párrafo segundo del artículo 81 de la Ley de la Jurisdicción Constitucional fueron publicados en los números 50, 51 y 52 del Boletín Judicial, de los días 09, 12 y 13 de marzo de 2012.
  2. 9Se prescinde de la vista señalada en los artículos 10 y 85 de la Ley de la Jurisdicción Constitucional, con base en la potestad que otorga a la Sala el numeral 9 ibídem, al estimar suficientemente fundada esta resolución en principios y normas evidentes, así como en la jurisprudencia de este Tribunal.
  3. 10En los procedimientos se han cumplido las prescripciones de ley.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I.Sobre la admisibilidad. Se impugna en la acción de inconstitucionalidad el acuerdo No. 4230 de la Junta Directiva del Servicio

Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), adoptado en la Sesión Extraordinaria 315-11 del 31 de octubre de 2011, que forma parte del trámite para la aprobación de autorizaciones ante la Dirección General de Transporte y Comercialización de Combustibles del MINAET, para sustituir los tanques de combustible en estaciones de servicio y de almacenamiento para hidrogeológico, en su lugar ³ autoconsumo. La acción pretende proteger de las fugas de combustible a los mantos acuíferos subyacentes a las estaciones de servicio, en detrimento de los artículos 21 y 50 constitucionales. De conformidad con lo dispuesto por el párrafo segundo del artículo 75 de la Ley de la Jurisdicción Constitucional, según la abundante jurisprudencia en el tema, la defensa del medio ambiente constituye un caso típico de interés difuso, ello es un presupuesto de legitimación directa para la interposición de acciones de inconstitucionalidad. En este sentido, corresponde resolver por el fondo la acción de inconstitucionalidad interpuesta.

II.Objeto de la impugnación. El acuerdo impugnado, consigna que es el resultado de la coordinación de varias dependencias públicas que intervienen para que la Dirección General de Transporte y Comercialización de Combustibles del Ministerio de Ambiente, Energía y Telecomunicaciones gire la autorización de sustituir tanques de almacenamiento de combustibles hidrocarburados. Constituye un instrumento que promueve la definición de una estrategia para la tramitación ágil de solicitudes, para resguardar los derechos del administrado y la vulnerabilidad y resguardo del recurso hídrico. En este sentido, regula la sustitución de tanques de combustible en estaciones de servicio, sean éstos subterráneos, y de almacenamiento de autoconsumo, para tanques aéreos, que se encuentren acreditados para la prestación del servicio (no pretende regular

estaciones nuevas de servicios, su remodelación, así como la instalación de nuevos tanques de autoconsumo). El acuerdo consigna que la SETENA no solicitará un ³estudio de impacto ambiental ´, que el SENARA no solicitará un estudio «debe aportar una declaración jurada avalada por un profesional experto en la materia que garantice que no existe derrame de combustible o presencia de vapores en el sitio donde se ubican los tanques y se vayan a sustituir´. En resumen, cuando la Dirección General de Transporte y Comercialización de Combustible del MINAET consulte al SENARA, ésta rendirá un criterio sobre el grado de vulnerabilidad intrínseca del acuífero cuando se tengan tales estudios; de no haber estudios hidrogeológicos para los respectivos sitios de interés, se dará la advertencia a la Dirección General de Transporte y Comercialización de Combustible. En tal caso, se exigirá las medidas establecidas en el Decreto Ejecutivo No. 30131 MINAE-S, publicado en el Diario Oficial La Gaceta No. 43 del 1 de marzo de 2002. A su vez, aprobada la solicitud se enviarán copias de la declaración jurada y permiso de sustitución al SENARA y a SETENA.

III.Inconstitucionalidad por infringir el principio precautorio . Es evidente que el acuerdo impugnado busca la flexibilización de los trámites de los administrados, un fin aparentemente legítimo contenido en el artículo 41

constitucional, pero que debe acordarse de modo que toda actuación del Estado guarde un justo equilibrio entre los intereses involucrados, especialmente aquellos referentes al derecho fundamental al ambiente sano y ecológicamente equilibrado. Cuando hay un estado de certeza por un bajo impacto ambiental sobre ciertas actividades, podría ser procedente relevar ciertos estudios y evaluaciones técnicas científicas de impacto ambiental, pero cuando ello no está presente, el Estado debe resguardar otros principios. Así por sentencia 2011-2699 se indicó que:

³Además, el Estado se encuentra en la obligación actuar preventivamente evitando -a través de la fiscalización y la intervención directa- la realización de actos que lesionen el medio ambiente, y en la correlativa e igualmente ineludible prohibición de fomentar su degradación. Lo anterior obliga no sólo a reconocer el derecho al medio ambiente, sino además a utilizar todos los medios material y jurídicamente válidos para su protección contra los ataques de que pueda ser objeto. En virtud de que los daños al entorno suelen ser irreparables, la fiscalización preventiva de la administración y la celeridad de las medidas que adopte, incide directamente en la magnitud de la lesión al ambiente. En razón de lo anterior, el principio precautorio ha sido reconocido por la jurisprudencia de esta Sala, otorgándole rango constitucional, entre otras, en la sentencia N. 2219-99 de las 15:18 horas del 24 de marzo de 1999. Interesa destacar el principio del uso racional de los recursos, derivado del artículo 69 constitucional, que se refiere al "uso racional de los recursos naturales".

Esta Sala -en diversas resoluciones- ha establecido que la protección al ambiente debe encaminarse a la utilización adecuada e inteligente de sus elementos, y en sus relaciones naturales, socioculturales, tecnológicas y de orden político (desarrollo sostenible), para con ello salvaguardar el patrimonio al que tienen derecho las generaciones presentes y futuras. Por ello, el objetivo primordial del uso sostenible y protección del ambiente, es que a través de la producción y uso de la tecnología, se obtengan no sólo ganancias económicas, sino sobre todo un desarrollo y evolución favorable del medio ambiente y los recursos naturales con el ser humano, esto es, sin que se cause daño o perjuicio.

De igual modo ³3.- Del principio precautorio o "principio de la evitación prudente", concepto desarrollado en sentencias número 2806-98, 2003-06322, 2004-1923 y 2005-12039 de este Tribunal, que se sustenta en el artículo 15 de la Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo, Declaración de Río, de mil novecientos noventa y dos, que alude a la necesaria acción y efecto de prevenir anticipadamente a los posibles daños en los elementos integrantes del ambiente; con lo cual, se propugna por la implementación de acciones tendentes a la debida protección, conservación y adecuada gestión de los recursos, esto es, la adopción de todas las medidas precautorias para evitar o contener la posible afectación del ambiente o la salud de las personas. De esta forma, en caso de que exista un riesgo de daño grave o irreversible ±o una duda objetiva al respecto±, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate; por cuanto la coacción posterior resulta ineficaz en esta materia, dado que, en la mayoría de los casos, los efectos biológicos son irreversibles, donde la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados al ambiente.

Toma en cuenta la Sala que el interés por agilizar los trámites administrativos nunca puede ceder ante el principio precautorio, especialmente si se está frente a actividades peligrosas para el ambiente, y para el ser humano. Véase, que precisamente, el Decreto Ejecutivo No. 30131-MINAE-S (antes de la reforma a su artículo 72) se aplicaría muy limitadamente al caso de la sustitución de tanques, pues si bien en su artículo 1° dice contemplar las especificaciones técnicas mínimas para la construcción, y remodelación de estaciones de servicio, y tanques de almacenamiento, las disposiciones que desarrolla no contienen una referencia expresa o regulación concreta para la sustitución de tanques , sino solo la remodelación y ampliación. De ahí que la aplicación del Decreto Ejecutivo, al momento en que estuvo vigente el acuerdo impugnado, debía hacerse mediante una interpretación analógica de sus disposiciones, y peor aún, ante el vacío dejado por el Decreto Ejecutivo, este silencio podría invitar a una aplicación contraria al principio precautorio, a lo interno del SENARA, porque en efecto se prescinde de estudios hidrogeológicos. Debe tomarse en cuenta que el Poder Ejecutivo reformó esa normativa, por Decreto Ejecutivo No. 36967 del 9 de enero de 2012, estableciendo nuevas regulaciones más garantistas para el ambiente y ajustadas para la actividad de sustitución de tanques.

IV.Sobre la incompetencia del SENARA. Para la Sala, la SETENA, desde su Oficio SG-DEA-0273-2011 del 25 de enero de 2011, claramente

determinó cuáles eran los requisitos para tramitar este tipo de autorizaciones: es decir, la evaluación de impacto ambiental D1, los estudios de hidrogeología, incluyendo el estudio de tránsito de hidrocarburos. En principio, el acuerdo No. 4230 dictado por la Junta Directiva del Servicio Nacional de Aguas Subterráneas, Riego y Aventamiento sería derogado, teniendo una vigencia corta de un mes y medio, aproximadamente. En efecto, en criterio de la Sala dicho acuerdo adolece de otros vicios de fondo, porque si bien se origina en un esfuerzo para uniformar la tramitología de los permisos de sustitución de tanques de almacenamiento de combustibles de las autoridades públicas que intervienen en el trámite ante la Dirección General de Transporte y Comercialización de Combustible del MINAET con otras instituciones, en lo que se impugna el acuerdo, invade, por exceso de competencias, sobre otros órganos administrativos. Tan es así, que los informes de la SETENA descalifican lo actuado por el SENARA, los que consideran que causan incertidumbre. Adicionalmente, está claro que al ser un acuerdo posterior al de la SETENA, no podría modificar lo determinado por ese órgano cuando había establecido con anterioridad, que:

³Para este punto, como los tanques de almacenamiento son sustituidos por otros nuevos, ya sean subterráneos o aéreos, si requiere la evaluación de impacto ambiental, mediante la presentación del documento de evaluación ambiental D1, sin excepción, presentando la documentación que se les solicita («) además debe presentar los siguientes estudios («) b) Presentar el estudio hidrogeológico, incluyendo el estudio de tránsito de hidrocarburos. Aunque la estación de servicio esté en operación y la misma no cuenta con viabilidad ambiental, es necesario que se presenten los estudios indicados´(oficio SG-DEA-0273-2011 del 25 de enero de 2011). La Procuraduría General de la República con mayor claridad que el Ministerio de Ambiente, Energía y Telecomunicaciones, mantiene la pretensión general de que el acuerdo del SENARA no resulta vinculante para las otras dependencias públicas, dado que quien lo dicta no es competente para hacerlo, y según señala el Ministro las resoluciones no podrían modificar las competencias otorgadas por los reglamentos y las leyes, de manera que la aplicación de ese acuerdo sería totalmente irregular porque iría en detrimento de las competencias de las demás instituciones.

A juicio de la Sala, siendo que el acto fue dictado por un sujeto incompetente que modificaría el criterio de la SETENA, en cuanto habría prescindido de la evaluación de impacto ambiental para estos supuestos, lo procedente es tenerlo por nulo a la luz de lo dispuesto por el artículo 129 de la Ley General de la Administración Pública. Pero además, por las razones que se indican a continuación.

V.El acuerdo dictado eximió del estudio de impacto ambiental, lo que tendría consecuencias que no se han podido cuantificar porque nada de ello se le

ha informado a la Sala, de manera que podría ser engañoso sencillamente desestimar la acción sobre la pretensión de la Procuraduría General de la República, el Ministro de Ambiente, Energía y Telecomunicaciones y las razones dadas por SENARA. Si bien el Estudio de Impacto Ambiental (EsIA) está contenido en la EIA (Evaluación de Impacto Ambiental), y es una parte del segundo, precisamente el EIA se establece como el trámite para obtener este tipo de autorizaciones, porque es una garantía de que la actividad humana, especialmente cuando es de categoría D1, para actividades catalogadas de alto y moderado impacto ambiental potencial, logrará mitigar sus impactos. De este modo, para posibilitar cualquier corrección a nivel administrativo o judicial en la aplicación inconstitucional del acuerdo impugnado por la infracción al principio precautorio, debe declararse con lugar la acción para extirpar del ordenamiento jurídico cualquier amenaza al derecho a un ambiente sano y ecológicamente equilibrado. Debe anularse cualquier acto o acuerdo con el fin de proteger el derecho ambiental establecido en el artículo 50 constitucional, y su posible aplicación, además de la infracción señalada al artículo 129 de la Ley General de la Administración Pública.

Por tanto:

Se declara CON LUGAR la acción. En consecuencia, se anula por inconstitucional el acuerdo No. 4230 de la Junta Directiva del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), adoptado en la Sesión Extraordinaria No. 315-11 del 31 de octubre de 2011. Esta sentencia tiene efectos declarativos y retroactivos a la fecha de vigencia del acuerdo anulado, sin perjuicio de derechos adquiridos de buena fe. Comuníquese este pronunciamiento al Poder Ejecutivo. Reséñese este pronunciamiento en el Diario Oficial La Gaceta y publíquese íntegramente en el Boletín Judicial. Notifíquese.
