SummaryResumen

The Constitutional Chamber rejected on the merits a renewed challenge to Articles 27 and 28 of the Forestry Law and Articles 90 and 91 of its Regulation because those provisions had already undergone constitutional review in judgment 2007-3923, and the Chamber found no reason to alter that precedent. The claim argued that the tree-cutting regime left non-native trees, plantations, and wooded areas unprotected even when, despite not meeting the statutory definition of forest, they performed important environmental, watershed, and landscape functions. The Chamber nevertheless reiterated its 2007 holding: Article 28 contains a relative legislative omission because it fails to establish precautionary measures for prior verification of its proper application and for the protection of areas or species excluded from the legal definition of forest. Thus, although the new action was rejected, the Legislative Assembly was reminded that it must remedy that omission. Justices Jinesta Lobo and Castillo Víquez disagreed that Article 28 required amendment, viewing administrative enforcement as sufficient.

Key excerptExtracto clave

This Court considers that there are no grounds for changing the considerations set forth therein; accordingly, the proper course is to reject the action on the merits and reiterate what this Chamber ordered in the cited judgment, namely, that it is for the Legislative Assembly to remedy the absence of precautionary measures that ensure, in advance, the correct application of Article 28 in protection of the environment, as stated in the reasoning of that decision. Therefore: The action is rejected on the merits. The Legislative Assembly shall take note of the provisions of the final paragraph of the first consideration of this judgment. This judgment shall be communicated to the Legislative and Executive Branches. Justices Jinesta Lobo and Castillo Víquez append a separate note.

CASE FILE N° 13-002058-0007-CO CASE FILE N° 13-002058-0007-CO Case: 13-002058-0007-CO Decision Nº 2013004619 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at fourteen hours thirty minutes on April tenth, two thousand thirteen. Constitutional challenge (Acción de Inconstitucionalidad) filed by Verny Valerio Hernández, of legal age, married, attorney, resident of Santiago de San Rafael de Heredia, identity card number 1-902-177; Sandra Batalla González, of legal age, divorced, merchant, resident of Los Angeles de San Rafael de Heredia, identity card 1-581-540; Alice Espinoza Hernández, of legal age, married once, homemaker, domiciled in La Suiza de San Rafael de Heredia, identity card 4-103-1456; and Carlos Alonso Rojas Esquivel, of legal age, married once, precision mechanic, domiciled in Santiago de San Rafael de Heredia, identity card 1-771-433, against Articles 27 and 28 of Ley Forestal N.7575 and Articles 90 and 91 of its regulations, Decreto Ejecutivo 25721-MINAE of October 17, 1996.

Background (Resultando):

  1. 1In a brief filed with the Chamber on February 20, 2013, the petitioners request that

Articles 27 and 28 of Ley Forestal N.7575 and Articles 90 and 91 of its regulations, Decreto Ejecutivo 25721-MINAE of October 17, 1996, be declared unconstitutional because they consider them contrary to Articles 50 and 89 of the Political Constitution. They act in defense of a diffuse interest (interés difuso), as holders of the collective right to seek protection of the environment, ecological balance, natural beauty, and respect for the landscape features of the area in which they live, and of which they are, in the first instance, municipal residents and inhabitants of the sector directly affected by the challenged provisions, as well as political representatives in their capacity as council members of the Municipalidad de San Rafael de Heredia.

They bring this action against the challenged provisions, which permit or authorize the cutting or felling of trees provided that the trees are not indigenous to a particular area, which may seriously affect the environmental balance because it permits the removal of vegetation cover (cobertura vegetal). In the case of the Cantón de San Rafael de Heredia and the surrounding cantons of the Zona Norte de Heredia, the unrestricted felling of species such as cypress and pine is permitted. Although these species are not native to the area, they were introduced into the northern part of the Provincia de Heredia many decades ago and, in many cases, constitute the only forest cover (cobertura boscosa) existing in the area. They form part of the area’s natural beauty and landscape setting, which the Sala Constitucional has recognized as an integral element of the right to a healthy and ecologically balanced environment.

The challenged provisions permit the felling of non-indigenous species on land used for agriculture and livestock and without forest, with simple authorization from the Consejo Regional Ambiental or the respective municipality, up to a limit of twenty trees. If more than twenty trees are to be cut, a forestry-science professional must certify that they do not form part of a forest. Furthermore, Article 28 of Ley Forestal establishes forest plantations (plantaciones forestales), agroforestry systems (sistemas agroforestales), and individually planted trees as exceptions to the requirement of cutting permits. Thus, when that provision is read together with Article 3(d) of the same statute, which defines the legal concept of forest, the immediate effect is that no type of permit is required to cut cypress and other non-indigenous species, because the legal concept of forest entails a native or indigenous ecosystem covering more than two hectares, occupying more than 70 % of the surface area, and having more than 60 trees per hectare.

Under that statutory authorization, therefore, cypress may be cut in the area, which has led to excessive felling in the sector because the commercial value of cypress wood is well known, without accounting for the environmental effects that such unrestricted felling may cause to the environment and the area’s landscape features. The challenged provisions have also opened the possibility of felling on land used for agriculture and livestock and without indigenous forest, without establishing a requirement to conduct environmental assessments (valoraciones ambientales) of the effects inherent in the statutory authorization granted and without considering that the Zona Norte de Heredia is a Special Protection Zone (Zona Especial de Protección) pursuant to Decreto 25902-MIVAH-MP-MINAE. Thus, on the one hand, that decree imposes a series of restrictions and limitations on land use for environmental protection purposes, while, on the other, the provisions challenged here open the possibility of felling or cutting species that are not indigenous to the region.

They contend that the statutory and regulatory authorizations contained in the challenged provisions violate not only the environmental balance but also the duty to preserve the area’s natural beauty, scenic beauty, and landscape features, which have suffered serious impacts and drastic and excessive changes due to the removal of a species that had characterized and identified the area in question.

  1. 2Article 9 of Ley de la Jurisdicción Constitucional empowers the Chamber to summarily dismiss, either on procedural grounds or on the merits, at any time, including upon filing, any petition submitted for its consideration that is manifestly inadmissible, when it finds that sufficient grounds exist to dismiss it, or when it is merely a repetition or reproduction of a previously dismissed identical or similar petition.

Drafted by Justice Calzada Miranda; and, Considerations (Considerando):

I.In judgment number 2007-3923, issued at 15:02 hours on March 21, 2007, this Chamber ruled on the constitutionality of the provisions challenged here, namely Articles 27 and 28 of Ley Forestal N.7575 and Articles 90 and 91 of its Regulations, Decreto Ejecutivo N.25721-MINAE, in the following terms:

“III.- Subject matter of the challenge. The petitioner challenges Articles 27 and 28 of Ley Forestal and Articles 90 and 91 of its Regulations (Decreto No. 25721-MINAE), considering them contrary to Articles 46 and 50 of the Political Constitution insofar as they permit unrestricted tree felling merely because the trees do not qualify as native or indigenous to an area, even though they may perform an important function in protecting water resources and maintaining environmental and ecological balance. For greater clarity, the provisions under review are quoted below:

“Article 27.- Authorization to cut A maximum of only three trees per hectare may be cut annually on land used for agriculture and livestock and without forest, after obtaining authorization from the Consejo Regional Ambiental. If the cutting exceeds ten trees per property, authorization from the Administración Forestal del Estado shall be required. Promotion of forest plantations Article 28.- Exception from the cutting-permit requirement Forest plantations, including agroforestry systems and individually planted trees and their products, shall not require permits for cutting, transportation, industrial processing, or export. However, where, before this law entered into force, a forestry contract was signed with the State to receive Certificados de Abono Forestal or an income-tax deduction, cutting shall be carried out in accordance with the management plan (plan de manejo) approved by the Administración Forestal del Estado.

CHAPTER SEVENTEEN

On Forestry Oversight 1- On harvesting in non-forested areas.

Article 90: Persons wishing to carry out forest harvesting (aprovechamiento forestal) or tree felling on land without forest that, by its characteristics, does not constitute an agroforestry system may choose whether to apply for authorization from the Consejo Regional Ambiental or from the municipality in which the property is located, provided that the total does not exceed twenty trees per year.

The application shall be submitted by the owner or possessor of the property in accordance with the requirements established for each case by both the Consejos Regionales and the respective municipalities.

Within 10 days, the Consejos Regionales Ambientales shall decide on and issue the cutting and transportation permits. The Consejos Regionales Ambientales and the municipalities shall forward a copy of the documentation to the A.F.E. Article 91: In cases where more than twenty trees are to be harvested in wooded areas excluded from the definition of forests, the application shall be processed by the corresponding Oficina Sub-Regional del A.C. In addition to the general requirements established in these regulations, an inventory shall be submitted containing the number of species to be cut, the number of individual trees to be cut, and the volume to be extracted. The inventory shall be prepared and signed by a forestry-science professional, and a sketch of the property shall also be prepared indicating the approximate location of the trees to be cut. The application shall contain a certification from the professional stating that the area does not constitute a forest or part of a forest as defined by the Law and shall comply with the requirements established in Article 85 of these regulations. Upon receipt of the application, the corresponding Oficina Sub-Regional del A.C. shall verify the requirements and issue the corresponding permit without requiring a prior inspection.”

IV.Merits. Having defined the subject matter of the action, and because the petitioner’s challenge concerns permission to cut trees based on the type of land on which they are located and their nature, the corresponding constitutional analysis shall be conducted after first identifying the fundamental right that has been infringed:

A.- The Fundamental Right to a Healthy and Ecologically Balanced Environment. In judgment No. 2003-6322, this Court discussed the jurisprudential treatment that the Chamber has given this constitutional right, which is summarized for purposes of reviewing this action and supplemented by other considerations. Even before Article 50 of the Political Constitution was amended, the Chamber’s case law had already recognized environmental protection and preservation as a human right (judgment number 1993-2233), deriving it from Articles 21 (right to health), 69 (the constitutional requirement of the “rational use of land”), and 89 (protection of natural beauty), all of the Constitution, based on the following considerations:

“V.)- Human life is possible only in solidarity with the nature that sustains and supports us, not only by providing physical nourishment but also psychological well-being: it constitutes the right of all citizens to live in an environment free from pollution, which is the foundation of a just and productive society. Thus, Article 21 of the Political Constitution states: ‘Human life is inviolable.’ It is undeniably from this constitutional principle that the right to health and to physical and mental well-being derives, and social, a human right that is inextricably linked to the right to health and to the State’s obligation to protect human life. Likewise, from the psychological and intellectual standpoint, a person’s state of mind also depends on nature; therefore, because the landscape also becomes a useful space for rest and leisure, its preservation and conservation are obligatory. This latter aspect is protected by Article 89 of the Constitution, which literally states: “Among the cultural purposes of the Republic are: to protect natural beauty, preserve and develop the Nation’s historical and artistic heritage, and support private initiative for scientific and artistic progress.” Protecting nature from an aesthetic standpoint does not mean commercializing it or turning it into a commodity; it means educating citizens so that they learn to appreciate the aesthetic landscape for its intrinsic value” (judgment number 1993-3705, de las quince horas del treinta de julio de mil novecientos noventa y tres).

“XIII.- The term ‘natural beauty’ was the term used when the Constitution was promulgated (7 de noviembre de 1949), and has now developed into a legal specialty: environmental law (derecho ambiental), which recognizes the need to preserve the environment not merely as a cultural objective, but as a vital necessity for every human being. In this regard, the concept of the right to a healthy environment (derecho al ambiente sano) goes beyond recreational or cultural interests, which are also important aspects of life in society, and additionally constitutes an essential requirement for life itself. [...]

[...]

Thus, it is clear that there is no longer any doubt concerning the constitutional protection of the right to health, linked to the right to life and, through it, to a right to a healthy environment. By way of example, we may cite judgments 1580-90; 1833-91, 2362-91; 2728-91; 2233-93; 4894-93, which have recognized the right to health and to a healthy environment as an individual constitutionally protected right” (judgment number 1993-6240, de las catorce horas del veintiséis de noviembre de mil novecientos noventa y tres).

“Provision 69 of the Political Charter refers to the ‘rational use of land’ (explotación racional de la tierra), which constitutes a fundamental principle. Consequently, such protection and preservation, as well as the rational use of the aforementioned resources, are tenets of the constitutional order” (judgment number 1993-2233). The principle of rational use of land derives from Article 69 of the Fundamental Charter, and both private parties and the State, in its broadest sense, are subject to the obligation to protect and preserve renewable natural resources:

“II. Protecting the environment is a task that falls equally to everyone: to public institutions, by enforcing the legislation in force and promoting efforts that prevent or eliminate dangers to the environment; and to private parties, by complying with those provisions and collaborating in the protection of soil, air, and water, since any harmful change resulting from a human act in their composition, content, or quality will also be detrimental to the quality of human life” (judgment number 4480-94, de las diez horas cuarenta y un minutos del diecinueve de agosto de mil novecientos noventa y cuatro).

In constitutional case law, the concept of the “environment” has not been limited to the primary elements of nature—that is, soil, air, water, marine and coastal resources, minerals, forests, biological diversity in flora and fauna, and the landscape—which form the environmental framework without which basic needs, such as food, energy, housing, sanitation, and recreation, would be impossible to meet. It is important to emphasize that this term has been understood more comprehensively, establishing a “macro-environmental” concept that also encompasses aspects relating to the economy, the generation of foreign currency through tourism, agricultural exploitation, and others:

“For the foregoing reasons, Environmental Law should not be associated solely with nature, because nature is only part of the environment. Nature-protection policy also extends to other matters, such as the protection of hunting, forests, natural parks, and natural resources. It is therefore a macro-environmental concept, intended to avoid excluding important concepts and thus to unify the body of law that we call Environmental Law” (judgment number 5893-95, de las nueve horas cuarenta y ocho minutos del veintisiete de octubre de mil novecientos noventa y cinco; and, to the same effect, numbers 3705- 93, cited above, and number 2988-99, de las once horas cincuenta y siete minutos del veintitrés de abril de mil novecientos noventa y nueve).

1-Protection of environmental rights, a State duty. Following the amendment of Article 50 of the Constitution by Law number 7412, de tres de junio de mil novecientos noventa y cuatro, which expressly enshrined the right to a healthy environment as a fundamental right, the State’s obligation to guarantee, defend, and safeguard this right was also conclusively established, thereby making the State the guarantor of the protection and safeguarding of the environment and natural resources. It was through this amendment that citizens were granted full standing to defend it, thus giving express content to this right:

“[...], this Chamber has established that the right to a healthy and ecologically balanced environment (ambiente sano y ecológicamente equilibrado) is a fundamental right, and as such is already enshrined and guaranteed by Constitutional Law, [for which reason] it does not consider it pointless, much less objectionable, for that right to be expressly recognized and clearly identified, [...]” “II.- It follows, then, that the position adopted by this Court in this regard is now confirmed by the aforementioned constitutional amendment, which merely reflects the understanding that, although human beings have the right to use the environment, they also have the obligation to protect and preserve it for the enjoyment of future generations” (judgment number 5668-94, de las dieciocho horas del veintiocho de septiembre de mil novecientos noventa y cuatro).

It was pursuant to this provision, in conjunction with Articles 20, 69, and 89 of the Political Constitution, that the State’s responsibility was derived and the Social State under the Rule of Law (Estado Social de Derecho) took shape. We may therefore conclude that the Political Constitution emphasizes that protecting the environment is an appropriate mechanism for safeguarding and improving everyone’s quality of life, making intervention by the Public Authorities necessary with respect to factors that may disrupt its balance and impede individuals from developing and thriving in a healthy environment. Thus, the constitutional mandate establishes the State’s duty to guarantee, defend, and preserve that right:

“Prima facie, to guarantee means to secure and protect the right against some risk or need; to defend means to bar, prohibit, and prevent any activity that threatens the right; and to preserve is an action aimed at shielding the right in advance from possible dangers so that it may endure for future generations. The State must adopt a dual course of action and restraint: on the one hand, it must refrain from itself violating the right to a healthy and ecologically balanced environment; and, on the other hand, it must undertake the task of issuing measures that make it possible to comply with constitutional requirements” (judgment number 9193-2000, de las dieciséis horas veintiocho minutos del diecisiete de octubre del dos mil).

The impact of this right on State activity finds its primary rationale in the fact that, by definition, rights are not confined to individuals’ private sphere, but also have significance for the very structure of the State in its role as guarantor of those rights; and, secondly, because State activity is directed toward satisfying the interests of the community. In this regard, it must be considered that the regulations designate the Ministerio del Ambiente y Energía as the governing body for the natural resources, energy, and mining sector, pursuant to Article 2 of the Organic Law of that ministry, number 7152, de cuatro de junio de mil novecientos noventa:

“The functions of the Ministerio del Ministerio del Ambiente y Energía shall be the following:

  • a)To formulate, plan, and implement the Government of the Republic’s policies on natural resources, energy, mining, and environmental protection, as well as to direct, control, oversee, promote, and foster development in the aforementioned fields. Likewise, to conduct and supervise research, technical explorations, and economic studies concerning the sector’s resources.
  • b)To promote the development of natural, energy, and mineral resources.
  • c)To promote and administer legislation on the conservation and rational use of natural resources, in order to achieve their sustainable development, and to ensure compliance therewith.

ch) To issue, by executive decree, mandatory rules and regulations concerning the rational use and protection of natural resources, energy, and mines.

  • d)To promote scientific and technological research related to matters within its jurisdiction, in coordination with the Ministerio de Ciencia y Tecnología.
  • e)To promote and administer legislation on the exploration, exploitation, distribution, protection, management, and processing of natural resources related to its area of jurisdiction, and to ensure compliance therewith.
  • f)To process and grant permits and concessions relating to matters within its jurisdiction.
  • g)To facilitate, in accordance with the legislation in force, the execution of international treaties, conventions, and agreements, and to represent the Government of the Republic in national and international proceedings within its jurisdiction. All of the foregoing in coordination with the Ministerio de Relaciones Exteriores y Culto.
  • h)To promote and develop environmental education programs at all educational levels and for the general public.
  • i)To prepare inventories of the country’s natural resources.
  • j)To advise public and private institutions regarding environmental planning and the development of natural areas.
  • k)Any other functions assigned to it by the legal system.” In this Court’s view, this governing role in environmental matters encompasses not only the establishment of appropriate regulations for the use of forest resources and natural resources, as also provided in Article 56 of the Organic Environmental Law, but also confers upon it the important function of exercising leadership in environmental matters, consisting of maintaining a leading role in this field, for which purpose, “[...] it shall issue general and specific measures relating to the research, exploration, exploitation, and development of those resources, based on the provisions of the Plan Nacional de Desarrollo”; In this regard, the oversight and enforcement (control y fiscalización) of environmental matters and activities constitute an essential function of the State, pursuant to Article 50 of the Constitution, insofar as the third paragraph provides, in relevant part: “The State shall guarantee, defend, and preserve that right”; this is consistent with the constitutional principle established in the second paragraph of Article 9 of the Political Constitution, which expressly prohibits the Branches of Government from delegating the exercise of functions inherent to them, particularly when those functions are essential.

Accordingly, with respect to environmental protection, the functions of governance, oversight, and enforcement (rectoría, control y fiscalización) in environmental matters belong to the State and are entrusted to its various administrative agencies.

2- Rational use of resources. A balance between the country’s development and the right to the environment. Based on Article 69 of the Constitution, insofar as it provides for the “rational use of natural resources,” the Chamber has established in its case law the constitutional parameters for their proper use; by virtue of those parameters, it is clear that environmental protection must be directed toward the appropriate and intelligent use of its components and their natural, sociocultural, technological, and political relationships—sustainable development (desarrollo sostenible)—thereby safeguarding the heritage to which present and future generations are entitled. Therefore, the primary objective of using and protecting the environment is to ensure that the production and use of technology yield not only economic gains—freedom of enterprise (libertad de empresa)—but also development and evolution favorable to the environment, natural resources, and human beings, that is, without causing harm or injury:

“This Chamber has also recognized that both the right to health and the right to an environment free from pollution, without which the former could not be made effective, are fundamental rights; therefore, the State is obligated to protect them, whether through general policies intended to achieve that purpose or through specific actions by the Administration. Sustainable development is one of those general policies established by the State to broaden the possibilities for everyone to fulfill their aspirations for a better life by increasing productive capacity or expanding the possibilities of achieving equitable progress amid population growth or between such growth and natural systems. Sustainable development is the process of transformation in the use of resources, the direction of investments, the channeling of technological development, institutional changes, and everything else that helps meet present and future human needs” (judgment number 1994-1763, at sixteen hours forty-five minutes on thirteen April nineteen ninety-four).

The Chamber has stated that the environment must be understood as a development resource to be used appropriately and that action must be taken in an integrated manner with respect to its natural, sociocultural, technological, and political relationships; otherwise, its productivity for the present and future is degraded, potentially jeopardizing the heritage of future generations. The origins of environmental problems are complex and arise from an interplay of natural and social processes within the framework of the socioeconomic development model adopted by the country. For example, environmental problems arise when methods of exploiting natural resources cause ecosystem degradation beyond the ecosystems’ regenerative capacity, thereby harming broad sectors of the population and generating high environmental and social costs that diminish the quality of life, since the primary objective of using and protecting the environment is precisely to achieve development and evolution favorable to human beings.

Environmental quality is a fundamental parameter of that quality of life; other no less important parameters include health, food, work, housing, education, and so forth. More importantly, however, it must be understood that although human beings have the right to use the environment for their own development, they also have a duty to protect and preserve it for present and future generations. This is not particularly novel, because it is merely the application to this field of the principle of “injury” (lesión), already firmly established in ordinary law, under which the legitimate exercise of a right has two essential limits: on the one hand, the equal rights of others and, on the other, the rational exercise and beneficial enjoyment of the right itself. Like any other nation, our country has depended and will continue to depend on its natural resources and environment to meet the basic needs of its inhabitants and keep operating the productive apparatus that sustains the national economy, whose principal foundation is agriculture and, in recent years, tourism, particularly ecotourism.

Soil, water, air, marine and coastal resources, forests, biological diversity, mineral resources, and the landscape form the environmental framework without which basic needs—such as living space, food, energy, housing, sanitation, and recreation—could not be met. Likewise, our economy is also closely tied to the condition of the environment and natural resources. Furthermore, the goals of sustainable development concern human survival and well-being and the maintenance of essential ecological processes, that is, environmental quality and the survival of other species. To speak of sustainable development in terms of meeting present and future human needs and improving the quality of life is to speak of the demand for natural resources at the individual level and of the direct or supporting means necessary for the economy to function by generating employment and creating capital goods, which in turn make it possible to transform resources into consumer, production, and export goods.

The declaration issued at the 1992 Earth Summit proclaimed and recognized the integral and interdependent nature of the planet; this signifies acceptance of certain principles that guide the transition from current development models to sustainability. The signatory States, including Costa Rica, committed themselves, as part of preserving sustainable development, above all to protecting human beings. They began with the principle that every person has the right to a healthy and productive life in harmony with nature; they included the right of present and future generations to development conducted in a manner that satisfies their environmental and developmental needs; and they upheld the sovereign authority of States to exploit their resources, while emphasizing their responsibility to ensure that activities conducted within their jurisdiction and control do not cause environmental harm to other States or to areas beyond the limits of their national jurisdiction.

They established the duty of States to cooperate in the conservation, protection, and restoration of the environment, as well as their common responsibilities in that regard; thus, international cooperation in promoting and supporting economic growth and sustainable development would make it possible to address environmental degradation more effectively. Likewise, a special duty was imposed on developed countries, based on their responsibility in pursuing sustainable development, given the evident pressure exerted on the global environment by the technologies they develop and the financial resources they possess.

3- The precautionary principle (principio precautorio) in environmental law. This principle is contained in the United Nations Conference on Environment and Development, Rio Declaration, which provides:

“Principle 15.- In order to protect the environment, States shall broadly apply the precautionary approach according to their capabilities. Where there is a threat of serious and irreversible damage, the lack of absolute scientific certainty shall not be used as a reason for postponing the adoption of cost-effective measures to prevent environmental degradation.” (See, to the same effect, Article 11 of the Biodiversity Law (Ley de Biodiversidad)).

As the Chamber has already stated, the term prevention (prevención) derives from the Latin “praeventio,” which refers to the act and effect of preventing and to preparations and measures taken in advance to avoid a risk or carry something out. Prevention seeks to anticipate adverse effects and ensure the protection, conservation, and proper management of resources. Consequently, the guiding principle of prevention is based on the need to take and adopt all precautionary measures necessary to prevent or contain potential harm to the environment or human health. Thus, where technical studies establish a risk of serious or irreversible harm—or uncertainty in that regard—a precautionary measure must be adopted, including, if necessary, postponement of the activity concerned. This is because, in environmental matters, after-the-fact enforcement is ineffective: once harm has occurred, the biologically and socially harmful consequences may be irreparable; punishment may have moral significance, but it will scarcely compensate for the damage caused to the environment.

4- Coordination among public agencies must ensure environmental protection. On various occasions, constitutional case law has stated that protecting the environment is a task that falls equally to everyone; that is, the State—as a whole—is obligated to take the measures necessary to protect the environment in order to prevent levels of pollution, deforestation, extinction of flora and fauna, and excessive or improper use of natural resources that endanger the health of the governed. For purposes of this task, the term public institution must be understood to encompass both the Central Administration—Ministries such as the Ministerio del Ambiente y Energía and the Ministerio de Salud, which, by reason of their subject matter, have extensive involvement and responsibility regarding environmental conservation and preservation and which most often act through their specialized agencies, such as the Dirección General de Vida Silvestre, the Dirección Forestal, and the Secretaría Técnica Nacional Ambiental (SETENA)—as well as the institutions decentralized institutions, such as the Instituto Nacional de Vivienda y Urbanismo, SENARA, the Instituto Costarricense de Turismo, or the Instituto Costarricense de Acueductos y Alcantarillados; a task for which, of course, the municipalities bear considerable responsibility within their territorial jurisdiction.

It might therefore be thought that this shared responsibility would create chaos in administrative management, but that is not the case, because, in order to prevent the simultaneous coexistence of spheres of authority having different origins and purposes, the duplication of national and local efforts, and confusion regarding the rights and obligations of the various parties involved, it is necessary to establish a series of coordinating relationships among the various offices of the Executive Branch and decentralized institutions, and between those institutions and the municipalities, so that they may carry out the functions entrusted to them. This Chamber previously—and quite clearly—addressed the principle of coordination among public agencies and municipalities in pursuing common purposes —which must obviously also extend to the relationship maintained in this important function by institutions of the Central Administration and decentralized institutions—and therefore refers to what it stated on that occasion (judgment number 1999-5445, at catorce horas treinta minutos del catorce de julio de mil novecientos noventa y nueve):

“Thus, coordination is the organization of the relationships among these various independent activities, taking into account their concurrence with respect to the same object or entity in order to make them useful to an overall public plan, without eliminating the reciprocal independence of the acting entities. Because there is no hierarchical relationship among decentralized institutions, or between the State itself and the municipalities, specific conduct cannot be imposed upon the latter, and this gives rise to the indispensable interinstitutional ‘agreement,’ in the strict sense, whereby autonomous and independent centers of action agree upon that preventive and comprehensive framework, within which each performs a role with a view to a mission entrusted to the others. Thus, relations between municipalities and other public entities may be conducted only on an equal footing, resulting in mutually agreed forms of coordination, to the exclusion of any compulsory arrangement detrimental to municipal autonomy that would subject corporate entities to a coordination framework without or against their consent; nevertheless, this does permit the necessary subordination of these entities to the State and in the State’s interest (through the State’s ‘administrative oversight’ (tutela administrativa), and specifically through the function of legality review entrusted to it, with powers of general supervision over the entire sector).” Moreover, failures to fulfill the duty to protect the environment and comply with environmental regulations are constitutionally significant because, as a consequence of government inaction in this area, harm may be caused to the environment and natural resources, sometimes with consequences similar to or greater than those arising from government actions; examples include the approval of regulatory plans (planes reguladores), or construction projects without approval of the environmental impact study (estudio de impacto ambiental) by the Secretaría Técnica Nacional Ambiental; the failure of the Dirección General de Vida Silvestre del Ministerio del Ambiente y Energía to monitor and supervise the implementation of management plans (planes de manejo) for protected areas; allowing companies to operate without health permits concerning the treatment of sewage or wastewater (Acueductos y Alcantarillados and Ministerio de Salud); or failing to verify noise controls in bars, karaoke establishments, and discotheques (municipalities and Ministerio de Salud), etc.

B.—Ley Forestal. In furtherance of the foregoing, the Ley Forestal provides that an essential and primary function of the State is to safeguard the protection, conservation, use, industrialization, administration, and promotion of the country’s forest resources, in accordance with the principle of rational use of renewable natural resources, and distinguishes between the State forest estate (patrimonio forestal del Estado) and the private forest estate (patrimonio forestal privado). The former is subject to a public-domain regime (régimen de dominio público) and consists of all forests and forestlands within national reserves, areas declared inalienable, properties registered in the State’s name, and properties belonging to municipalities, autonomous institutions, and other Public Administration bodies. In this case, the Administration may grant use permits (permisos de uso) only for projects that do not require forest harvesting (aprovechamiento forestal) and do not affect ecosystems, wildlife, soils, wetlands, or aquifers.

The private forest estate, in turn, consists of all forests and lands suitable for forestry that belong to private natural or legal persons (Articles 1°, 32, and 43 of the Ley Forestal). Various activities may be conducted on these properties, depending on whether the land contains forest or forest plantations or consists of agricultural land without forest. Nevertheless, the requirements and restrictions governing the conduct of an activity within these areas are essentially related to timber or forest harvesting. The latter refers to the cutting or removal of standing timber trees or the use of fallen trees on private land not included in Article 1 of the Ley Forestal, where such activity generates or may generate some benefit, advantage, utility, or profit for the person carrying it out or for the person represented. As already noted, this concept excludes all lands forming part of the State’s natural heritage (patrimonio natural del Estado), because such harvesting must take place on private properties.

The boundaries established by the Ley Forestal are clearly linked to the concept of forest. This legislation defines what must be considered a forest and what constitutes a forest ecosystem. According to Article 3 of this Law, a forest is a native or indigenous ecosystem regenerated through natural succession or other forestry techniques, occupying an area of two or more hectares and characterized by the presence of mature trees of different ages, species, and sizes, with one or more canopies covering more than 70% of that area and containing more than 60 trees per hectare having a diameter at breast height (DBH) of fifteen or more centimeters. Accordingly, the determining factor is essentially the area of land that it must occupy—more than 2 hectares—to qualify as such. A contrario sensu, and as described, no forest exists on land having an area of less than two hectares, nor is one constituted by trees that are not indigenous.

In light of the foregoing, the legal system, through Executive Decree No. 27998, published on 29 de julio de 1999 and entitled “Manejo Sostenible de Bosques Secundarios y Certificación Forestal,” adopted a definition of secondary forest (bosque secundario) in order to protect forests having a smaller area and lower density, defined as follows:

“Land with woody vegetation of a secondary successional nature that develops after the original vegetation has been removed by human activities and/or natural phenomena, with a minimum area of 0.5 hectares and a density of no fewer than 500 trees per hectare of all species, having a minimum diameter at breast height of 5 cm. This also includes secondary-forest land immediately after harvesting under the regeneration-cutting system.” Nevertheless, the foregoing could not be effectively applied because it conflicts with a definition of forest established by statute, making it ineffective as protection in relation to the permits and procedures established in the Ley Forestal. Under the legal system, on land considered forest pursuant to the cited Article 3, SINAC may authorize certain types of activities, such as infrastructure projects of a public or private nature and of national interest; the construction of houses, offices, stables, corrals, nurseries, roads, bridges, and other facilities dedicated to recreation, ecotourism, and related activities on privately owned land and properties; cutting trees for reasons of human safety or scientific interest, preventing forest fires, natural disasters, or other analogous causes, as well as for harvesting.

These forests may be harvested only if their lawful owners have a Management Plan (Plan de Manejo) duly approved by SINAC, provided that the impact it may cause is analyzed beforehand. For this purpose, the authorized person may submit the Management Plan to the Forest Certification System (Sistema de Certificación Forestal) through the participation of a Forest Certifier (Certificador Forestal) duly accredited by the Administración Forestal del Estado, or may file an application with the subregional office for the corresponding approval of the Management Plan. In the first case, a forest certifier duly accredited by the A.F.E. must first certify that the management plan complies with legal and technical requirements, after which the authorization procedure may continue; in the second case, the application initiating the proceeding must be signed by a forestry professional, who shall be responsible for the information certified therein. Under Article 3(e), this management plan must be understood as:

“A set of technical standards governing the actions to be carried out in a forest or forest plantation, on a property or part thereof, for the purpose of harvesting, conserving, and developing the existing tree vegetation or” seeks to establish, in accordance with the principle of rational use of renewable natural resources that guarantees the sustainability of the resource.” Likewise, pursuant to Article 21 of the Ley Forestal, there must be a forest manager (regente forestal), who shall be responsible for implementing the management plan (plan de manejo) and shall be responsible for ensuring that it is complied with, subject to the criminal and civil liabilities arising from that position. The issue is that all this protection revolves around what the law conceives, under the previously cited restricted definition of forest (bosque), which is intended to protect only areas larger than 2 hectares and composed exclusively of native or indigenous species.

Hence, the petitioner considers that the alleged violation has occurred, because he states that cypress is not protected under that scenario. Indeed, cypress, whose common name belongs to the genus Cupressus, is a fast-growing tree found in warm or temperate zones that can reach 20 m in height, with an approximate diameter of about 60 cm. It is an evergreen conifer of the Cupressaceae family. It grows naturally anywhere in the world where temperatures and soils are suitable, but it is grown commercially in East Africa, South Africa, and New Zealand. The planting of cypress trees in our country dates back many years, since it is a non-native species planted by some people for various purposes, including as part of reforestation projects (for harvesting and selling the timber), as well as for windbreaks in highland areas, while others have used them for their scenic beauty. The petitioner argues that the function performed by cypress trees should be protected in the same manner as a natural forest; however, it is a non-native species that, as already indicated, is not protected under our legal system, which first warrants a ruling by this Court.

C.—Forests. Regardless of the definition set forth in the current Ley Forestal, broader doctrinal definitions of forest may be conceived. For example, a forest is a site populated by trees and shrubs, generally growing densely. Expanding upon the definition, it may also be stated that “a forest is any area of land where plant communities are growing, predominantly consisting of trees of different sizes, whether or not they have been harvested, that are capable of producing timber or other products; they influence the climate and the hydrological regime and also provide protection for wildlife.” In its report, the Procuraduría General also provides us with several definitions: “forests are dynamic ecosystems, with continuous processes of change (growth and deterioration), containing representative and dominant trees.” They interact with other plants, animals, and microorganisms, as well as with their physical and geographical environment, producing a series of complex interactions among biotic and abiotic elements known as ecological functions (funciones ecológicas), such as:

hydrological regulation, nutrient cycling, energy flow, and climate regulation. Others distinguish between primary forest (bosque primario) and secondary forest (bosque secundario). Primary forests, regarded as virgin or climax forests, are characterized by an abundance of mature trees that have not been altered by human activities; according to data provided by the Procuraduría, 78% of these forests worldwide have already been destroyed. Secondary forests, for their part, contain ecosystems that regenerate naturally within an average period of approximately 15 years following a substantial disturbance: flooding, agricultural burning, forest fires, land clearing, or extensive harvesting. They are characterized by the small number of mature trees, an abundance of fast-growing species, and a dense understory of seedlings and herbaceous plants. They are also characterized by arising, on some occasions, from scrubland (charrales) or secondary brushland (tacotales).

Indeed, it is extremely important to emphasize that the Ley Forestal, prior to its amendment by Ley No. 7575 of 5 de febrero de 1996, contained a very broad definition of forest in Article 6: “Forests are all plant communities composed predominantly of trees and other woody vegetation.” Neither that definition nor those cited made any distinction requiring a forest, in order to be considered as such, to consist exclusively of native trees rather than exotic ones—which may even have regenerated naturally—or to exceed 2 hectares. Another important aspect to consider is the services provided by forests, which are of the utmost importance to people and to the development of society itself. These include timber services (use of timber, firewood, and posts); non-timber services (medicinal herbs, dyes, ornamental plants, seeds, vines, palms and construction materials, and materials for handicrafts); maintenance of the hydrological cycle (water for human consumption and for industrial, commercial, and domestic activities; protection of agriculture; hydroelectric power); microclimate regulation; control of floods, erosion, sediment, winds, and noise; landscapes (photography, painting, videos, fishing, and tourism); recreation and ecotourism; maintenance of resilience, preservation of ecosystems and biodiversity (research material and scientific tourism); and climate change mitigation (carbon dioxide sequestration).

Consequently, harm to forests causes serious problems for human beings themselves, since deforestation causes floods, landslides, water shortages, and sedimentation of rivers, streams, and reservoirs, as well as crop losses, etc. In view of the foregoing, it is clear to the Chamber that the Procuraduría is correct in stating that the definition of forest contained in the current Ley Forestal is insufficient and provides inadequate protection for our country’s forests, with the aggravating circumstance that this definition serves as the basis for the other definitions of the types of land on which trees may be felled, in some cases subject to regulation and, in others, even without restriction. Certainly, the amendment to this law enacted through Ley No. 7575 of 5 de febrero de 1996 was intended to promote and incentivize reforestation in our country, for which purpose it sought to eliminate unnecessary procedures for felling certain types of trees.

Notwithstanding the foregoing, this Court considers that, by moving from a broad definition of forest, which afforded greater protection, to one so restricted in terms of species and area, the law reduced the protection previously afforded to the environment without reasonable justification extending beyond the need to reforest and eliminate administrative obstacles as an incentive for this activity, without first ensuring that its implementation would not endanger the environment. We must recall that our country has undertaken international commitments to protect the environment and that one of the principles it must safeguard is the aforementioned precautionary principle (principio precautorio), under which prevention must precede negative effects and ensure the protection, conservation, and proper management of resources. Consequently, this guiding principle of prevention is based on the need to take and implement all precautionary measures necessary to prevent or contain possible harm to the environment or human health.

Thus, where there is a risk of serious or irreversible harm—or uncertainty in that regard—a precautionary measure must be adopted, including, where appropriate, postponement of the activity concerned. Undoubtedly, this requires a preventive, active, and vigilant stance on the part of the Administration, because a belated response limited solely to imposing sanctions would render ineffective any action intended to protect the environment; once damage has occurred, it can scarcely be remedied, and its harmful effects may have not only national but also global consequences. Prevention is, indeed, one of the guiding principles of environmental law. This does not mean preventing development or halting progress and the economy; rather, a balance must be sought that allows human beings to develop while also living in and enjoying that development, to which not only current generations but also future ones are entitled. The Chamber has stated:

“The origins of environmental problems are complex and arise from an interaction between natural and social processes within the framework of the model of socioeconomic development adopted by the country. For example, environmental problems arise when the methods used to exploit natural resources cause ecosystem degradation beyond their capacity for regeneration, resulting in harm to broad sectors of the population and generating high environmental and social costs that lead to a deterioration in quality of life; for the primary objective of using and protecting the environment is precisely to achieve development and progress favorable to human beings...but more important than this is to understand that, although human beings have the right to use the environment for their own development, they also have a duty to protect and preserve it for the use of present and future generations. This is not particularly novel, because it is merely the application to this field of the principle of ‘injury,’ already established in ordinary law, under which the legitimate exercise of a right has two essential limits: on the one hand, the equal rights of others and, on the other, the rational exercise and beneficial enjoyment of the right itself.” (See judgments 1993-3705 of fifteen hours on 30 de julio de 1993 and 1783-94 of nine hours and fifty-seven minutes on 15 de abril de 1994).

This reasoning is not intended to treat forests and forest plantations (plantaciones forestales) indiscriminately in the same manner, since ecological and socioeconomic studies may determine, for example, that an area must be designated as a protective forest area (área forestal protectora) because of the need to restore the soil or water or protect species of flora and fauna; likewise, in some cases, the advisable course may be to restore the resource while permitting its forest harvesting (aprovechamiento forestal) or the renewal of the forest. Thus, what matters is not to impose a total and unreasonable prohibition that prevents the use of resources, but rather to ensure that such use is properly regulated and preceded, at a minimum, by inspections guaranteeing that neither native nor exotic trees, regardless of the area involved, are felled when they perform an essential environmental function in the area where they were planted or naturally established.

V.Regarding the challenged provisions. Under the challenged Article 27, only a maximum of 3 trees per hectare may be cut annually on agricultural land without forest, after obtaining authorization from the Consejo Regional Ambiental. If the cutting exceeds 10 trees per property, authorization from the Administración Forestal del Estado shall be required. Thus, this provision authorizes tree cutting on agricultural land without forest, which, under Article 2 of the Reglamento a la Ley Forestal, consists of private farms containing trees not established under an agroforestry system (sistema agroforestal), farms having areas of forest cover (cobertura boscosa) smaller than two hectares, or trees located in urban areas. This Court does not find from the foregoing that Article 50 of the Constitución Política is being violated, because that article provides that prior authorization from the competent bodies is required for the respective cutting, and because the land in question is agricultural land without forest, subject also to the limitations established by Articles 33 and 34 of the Ley Forestal:

“Article 33.- Protection areas (áreas de protección) The following are declared protection areas:

  • a)Areas surrounding permanent springs (nacientes), defined by a radius of one hundred meters measured horizontally.
  • b)A strip of fifteen meters in rural areas and ten meters in urban areas, measured horizontally on both sides along the banks of rivers, gullies, or streams, if the terrain is flat, and fifty horizontal meters if the terrain is steep.
  • c)An area of fifty meters measured horizontally along the shores of natural lakes and reservoirs and of artificial lakes or reservoirs constructed by the State and its institutions. Privately owned artificial lakes and reservoirs are excluded.
  • d)Recharge areas and the aquifers of springs, the boundaries of which shall be determined by the competent bodies established in the regulations to this Law.” “Article 34.- Prohibition on cutting in protected areas The cutting or removal of trees in the protection areas described in the preceding article is prohibited, except for projects declared by the Poder Ejecutivo to be in the national interest.

The boundary alignments (alineamientos) that must be processed in connection with these areas shall be established by the Instituto Nacional de Vivienda y Urbanismo.” Likewise, Articles 90 and 91 provide:

“1- Regarding harvesting in non-forested areas.

Article 90: Persons wishing to conduct forest harvesting (aprovechamiento forestal) or tree cutting on non-forested land that, because of its characteristics, is not an agroforestry system may decide whether to apply for authorization from the Consejo Regional Ambiental or from the Municipalidad where the property is located, provided that the total does not exceed twenty trees per year.

The application shall be submitted by the owner or possessor of the property in accordance with the requirements established for each case by both the Consejos Regionales and the respective Municipalidades.

Within 10 days, the Consejos Regionales Ambientales shall issue a decision and grant the cutting and transportation permits. The Consejos Regionales Ambientales and the Municipalidades shall forward a copy of the documentation to the A.F.E.” “Article 91: In cases where the number of trees to be harvested exceeds twenty trees in wooded areas excluded from the definition of forest, the application shall be processed by the corresponding Oficina Sub-Regional del A.C.; in addition to the general requirements established in these regulations, an inventory shall be submitted stating the number of species to be cut, the number of individual trees to be cut, and the volume to be extracted. That inventory shall be prepared and signed by a forestry professional, and a sketch of the farm shall also be prepared showing the approximate location of the trees to be cut. The application shall include a certification from the professional establishing that the area does not constitute a forest or part of a forest under the definition in the Law, and shall comply with the requirements established in Article 85 of these regulations.

Upon receiving the application, the corresponding Oficina Sub-Regional del A.C. shall verify the requirements and issue the applicable permit without requiring a prior inspection.” It should be noted that, under both articles, cutting is not unrestricted but is subject to the conditions of the land and the applicable permits. Our current regulations provide for two types of permits, depending on the number of trees to be cut. Thus, only a maximum of three trees per hectare may be cut annually after obtaining authorization from the Consejo Regional Ambiental, and if the cutting exceeds ten trees per property, authorization from the Administración Forestal del Estado (A.F.E.) shall be required; accordingly, for land having these characteristics, the permits to be processed are: permits for fewer than 20 trees and inventories. The first situation is addressed in challenged Articles 27 and 90, for which approval of the permit requires completion of an entire procedure set forth in the regulations.

Under that procedure, once the interested party submits an application, it is reviewed by the competent authority, which may require compliance with any missing requirements or additional information concerning a particular requirement and shall grant thirty days for compliance. The competent authority shall issue a final decision within 10 days, thereby granting the cutting and transportation permits. The relevant authorities shall forward a copy of the documentation to the A.F.E. In the event of noncompliance, after the interested party has been notified of the missing requirements, the case file (expediente) shall be placed in temporary storage for the six months following the noncompliance, without any need to issue a decision, and the case file may be reactivated during that period. Once that period has expired, the proceeding may be declared lapsed by decision and the case file permanently closed.

Any subsequent application concerning the same matter must be processed as a new application. Decisions and orders issued by the Consejos Regionales, including a decision denying an application for a harvesting permit on agricultural land, may be challenged through motions for reconsideration (recursos de revocatoria) and appeals (apelación). A motion for reconsideration shall be heard by the same authority and decided within a maximum of twenty days, while appeals shall be decided by the Ministerio del Ambiente y Energía. For its part, the inventory required by Article 91 is the type of permit that must be requested by owners or possessors of farms whose land may be classified as agricultural land without forest and on which they may cut more than 20 trees per year, although they must use the forest-inventory permit. As a prerequisite, the area to be harvested must not fall within the definition of forest contained in the Law.

Nevertheless, despite the preliminary delineation made by Article 3 of that Law in defining forest, this situation also requires an application for prior authorization, which must follow this procedure: A person interested in conducting forest harvesting involving more than 20 trees on agricultural land without forest must submit to the Oficina Sub-Regional del Area de.Conservación correspondiente an application containing the applicant’s information, the required documentation, and a clear explanation of the request. Accordingly, the application must include an inventory stating: the number of species to be cut, the number of individual trees to be cut, and the volume to be extracted. That inventory must be prepared and signed by a forestry professional. In addition, the applicant must prepare a sketch of the farm showing the approximate location of the trees to be cut. The application must also include a certification from the professional establishing that the area does not constitute a forest or form part of a forest under the stated definition.

The application submitted by the interested party shall be reviewed by the competent authority, which may require compliance with any missing requirements or additional information concerning a particular requirement, for which thirty days shall be granted. The Administración Forestal del Estado (A.F.E.) shall issue its final decision within a maximum period of thirty calendar days. In the event of noncompliance, after the interested party has been notified of the missing requirements, the case file shall be placed in temporary storage for the six months following the noncompliance, without any need to issue a decision, and the case file may be reactivated during that period. Once that period has expired, the proceeding shall be declared lapsed by decision and permanently closed. Any subsequent application concerning the same matter must be processed as a new application. Decisions and orders of the AFE, including a decision denying an application for an inventory permit, may likewise be challenged through motions for reconsideration and appeals.

Accordingly, and as has been duly explained, in this Court’s view the cited regulations do not violate Article 50 of the Constitución Política because, as already stated, the tree cutting at issue is regulated and excludes our country’s forests. Notwithstanding the foregoing, what this Chamber continues to find is that there is indeed a problem with the definition of forest contained in Article 3 of the Ley Forestal.

-For its part, challenged Article 28 does establish an exception to the tree-cutting permit requirement, providing that forest plantations (plantaciones forestales), including agroforestry systems and individually planted trees and their products, do not require permits for cutting, transportation, industrial processing, or export. When the provision refers to a forest plantation, it means one or more hectares planted with one or more forest species whose purpose principal, but not the only, purpose shall be timber production. The foregoing clarifications are important because, for purposes of this study, it is relevant to distinguish a forest (bosque) from a forest plantation (plantación forestal) and an agroforestry system (sistema agroforestal), in order to determine the degree of protection and safeguards afforded to the species by the Ley Forestal. As already indicated, our law defines a forest as a native or indigenous ecosystem, regenerated through natural succession or other forestry techniques, covering an area of two or more hectares, characterized by the presence of mature trees of different ages, species, and sizes, with one or more canopies covering more than 70% of that area, and containing more than 60 trees per hectare with a diameter at breast height of fifteen or more centimeters (DAP).

A forest plantation, in turn, is land covering one or more hectares, cultivated with one or more forest species, whose principal, but not only, purpose is timber production. An agroforestry system, on the other hand, is a form of land use involving the combination, over time and space, of forest species with agronomic species, in pursuit of the system’s sustainability. The foregoing is relevant to clarify that the substantial difference among them is that forest plantations and individually planted trees result from a productive and economic decision by their owners; therefore, reasonable ease must be provided for their felling, transportation, industrial processing, and export. This is the situation contemplated in the challenged Article 28. A forest plantation is an artificial system, unlike a forest, which is an ecosystem in its natural state. Furthermore, forest plantations also generate environmental services (servicios ambientales), including: mitigation of greenhouse-gas emissions through fixation, reduction, sequestration, storage, and absorption; protection of urban, rural, or hydroelectric use; protection of biodiversity for conservation and sustainable, scientific, and pharmaceutical use; research and genetic improvement; protection of ecosystems and forms of life; and others.

Another benefit is the creation of employment promoted by reforestation through timber harvesting, which is also extremely important for our domestic market, since the amount of timber that must be imported to cover the shortfall will depend on the amount extracted. Studies by MINAE, FONAFIFO, and SINAC reveal that the number of planted hectares in the country has declined substantially, causing a timber shortage. This entails a further series of problems for the country and for nature itself, not only in terms of employment but also economically, because the ideal course is unquestionably to promote reforestation and thus avoid reducing payment for environmental services (pago por servicios ambientales), which is a fund intended to promote it. This is the principal reason why the Ley Forestal provides for various incentives to make reforestation projects more attractive, and one of them is precisely the exemption from the felling permit (permiso de corta) established in the challenged Article 28.

In establishing a reforestation project, technical, social, environmental, and financial considerations are evaluated, along with compliance with other legal guidelines. One of the cited incentives is that investors in this field analyze the profitability of the reforestation project, as well as projections of the volume required by industry and the market generally, thereby generating a previously scheduled flow of raw materials and income. Clearly, the purpose is not to encourage unrestricted tree felling solely to favor investment to the detriment of the environment, but to seek a balance that contributes to sustainable development, within the framework of the principles of reasonableness and proportionality. The Chamber has stated that environmental quality is a fundamental parameter of quality of life; however, there are other equally important parameters, including health, food, employment, housing, and education.

It has been emphasized that the most important consideration is to understand that, although human beings have the right to use the environment for their own development, they also have a duty to protect and preserve it for present and future generations. Like any other nation, our country has depended and will continue to depend on its natural resources and environment to meet the basic needs of its inhabitants and keep the productive apparatus underpinning the national economy operating. Soil, water, air, marine and coastal resources, forests, biological diversity, mineral resources, and the landscape constitute the environmental framework without which basic needs—such as living space, food, energy, housing, sanitation, and recreation—could not be met. Likewise, our economy is also closely linked to the condition of the environment and natural resources. The goals of sustainable development, moreover, concern human survival and well-being and the maintenance of essential ecological processes; that is, environmental quality and the survival of other species.

To speak of sustainable development in terms of satisfying present and future human needs and improving quality of life is to speak of individual demand for natural resources and of the direct or supporting means necessary for the economy to operate, create employment, and produce capital goods that, in turn, make it possible to transform resources into consumer, production, and export goods. Under these guidelines, establishing an incentive for forest plantations, such as authorization to fell certain tree species, is not unconstitutional. It should be noted that the very purpose of a forest plantation is to plant and subsequently harvest; in this case, the product is timber as a raw material. Furthermore, this exploitation is subject to a limit on the number of trees and to the obligation to reforest again. Reforestation, contrary to what the claimant has asserted, contributes to soil conservation and promotes the establishment of vegetation cover (cobertura vegetal).

There is also the separate situation in which owners, by their own decision, planted a small number of trees to beautify their land. Depending on the number of trees, it would likewise be unreasonable subsequently to require a permit to fell each one, merely as a restriction on the exercise of their property rights. The solution sought by the claimant, namely to prevent all felling, is unacceptable in this Court’s view, considering that some trees are planted specifically to be harvested; therefore, Article 28 is not unconstitutional per se. The Chamber does not doubt that a sound Reforestation Plan (Plan de Reforestación) guarantees reasonable and proportionate exploitation of forest plantations; in other words, it ensures the sustainable development of forest and water resources. It is also important to remove administrative obstacles concerning land used for agroforestry, where, as already indicated, agronomic species are combined with forest species.

Nevertheless, the Chamber does find that the law does not establish precautionary measures (medidas precautorias) ensuring the proper application of the challenged Article 28, since not every plantation requires a management plan (plan de manejo), and the only requirement is a certificate of origin (certificado de origen), but solely for removing and transporting the timber. That certificate must establish the existence of a forest plantation or agroforestry system on a particular property, and specify the planted area, number of trees, species, location, and the name of the owner. Nevertheless, as already indicated, the certificate is issued prior to the movement of the timber, that is, after it has been felled. The foregoing, together with the highly restrictive definition of forest introduced by the Ley Forestal, in this Chamber’s view constitutes an omission that violates the precautionary principle (principio precautorio), which must safeguard the right to a healthy and ecologically balanced environment.

The preceding analysis has duly established that the definition of forest set forth in Article 3 of the Ley Forestal is the basis from which the application and scope of all other permits and restrictions established in this field are derived. Accordingly, in ruling on Articles 27 and 28 of the law and Articles 90 and 91 of the challenged regulations, this Court must necessarily refer, by reason of their connection, to Article 3. One of the claimant’s arguments is that cypress is a non-native species and, therefore, its felling is not protected under any circumstances because it was excluded from the definition of forest. Articles 33 and 34 of the Ley Forestal do indeed protect areas regarded as protected areas (áreas protegidas) because they are located near water resources, regardless of the nature of the species. The Chamber nevertheless considers this insufficient, taking into consideration that a forest (bosque), in a broad sense, including as conceived in the Ley Forestal prior to its amendment, may also consist of non-native species, from which the same environmental services (servicios ambientales) previously noted may also be obtained.

Likewise, if the protection concerned the species or the method of production or regeneration of the trees, the Chamber likewise does not consider it reasonable to have established that the area had to exceed 2 hectares. The foregoing reveals insufficient legislative protection in this regard: rather than ensuring protection when the law was amended in the years 1995 and 1998, it narrowed the scope of protection and, consequently, the right to a healthy and ecologically balanced environment, without even adopting preventive measures in this regard. Subsequently, the Executive Branch even attempted, by decree, to protect areas smaller than those 2 hectares, with the added problem that a restriction not established by law cannot be imposed by decree, thus leaving forests smaller than two hectares or consisting of non-native species unprotected, irrespective of their area. It must be recalled that one of the prerequisites of a forest plantation (plantación forestal) or agroforestry system (sistema agroforestal) is that whatever is planted must have been planted from the outset for the sole purpose of being harvested (aprovechado).

It was on that premise that the law sought to encourage them by eliminating certain administrative procedures. Nevertheless, it must be established that this is indeed the case before the trees are cut, since the lack of oversight could enable the felling of areas that, in reality, constitute neither a forest plantation nor an agroforestry system. Moreover, there are lands where, through their owners’ inaction, a genuine forest has been allowed to proliferate on the property and is then felled without any regulation whatsoever; there are also trees that, even if planted, serve as windbreaks (rompevientos) because of their number, location, and the function they have performed for many years. The protection of fundamental values therefore warrants their conservation and regulation of their felling, irrespective of the nature of their species. There are even areas where plantations have been established, such as those planted by ICE, for the purpose of protecting adjacent protection zones (zonas de protección) or aquifer recharge areas (zonas de recarga de los acuíferos). The importance of this protection, including because of the location, is illustrated by the provisions of Decree-Law No. LXV of 30 de julio de 1888:

“Whereas it is in the public interest to conserve the forests where the streams and springs (manantiales) that supply, that supply water to the province of Heredia and part of the province of Alajuela originate, Art. 1- A strip of land two kilometers wide, on either side of the summit of the mountain known as Montaña del Volcán de Barba (sic), from the hill called el Zurquí to the hill known as Concordia, is hereby declared inalienable, whether that strip is nationally or municipally owned.

Art.2- The Executive Branch is authorized to increase or decrease the size of the strip referred to in the preceding article if, after the corresponding survey has been conducted by a scientific commission, it deems it appropriate to modify it as indicated by that commission.” According to legal opinion of the Procuraduría No. OJ-118-2004 of 27 de setiembre del 2004, approximately 82% of the area that is the subject of this action is currently located within the areas covered by the Reserva Forestal Cordillera Volcánica Central and the Parque Nacional Braulio Carrillo, and it encompasses approximately 40 springs (nacientes) described in the official cartography.

The foregoing illustrates the importance of this sector as a water resource, which warrants preventive and protective measures to ensure its conservation. For this reason, this Court considers the challenged Article 28 unconstitutional, not because of its content, but because of a legislative omission, insofar as the Ley Forestal does not provide for measures to be taken before trees are cut, irrespective of their nature and the size of the area. The purpose is to provide those subject to the law with legal certainty (seguridad jurídica) that their conduct complies with the law and to ensure environmental protection by preventing cutting in areas where, according to experts in the field, it is inadvisable because of the serious environmental consequences that may ensue. Prevention seeks to anticipate adverse effects and ensure the protection, conservation, and proper management of resources.

Consequently, the guiding principle of prevention (principio rector de prevención) is founded on the need to take and implement every precautionary measure necessary to avoid or contain potential harm to the environment or human health. Thus, where there is a risk of serious or irreversible harm—or doubt in that regard—a precautionary measure must be adopted, and the activity in question may even need to be postponed. This is because, in environmental matters, action after the fact is ineffective: once harm has occurred, the ecologically and socially harmful consequences may be irreparable. Once it has been determined that the provision in question is unconstitutional because it fails to protect the right to a healthy environment, in which the precautionary principle (principio precautorio) must prevail, the effects of a declaration to that effect must necessarily be addressed. As already explained, the provision is deficient because the Ley Forestal does not provide for prior measures, which may range from authorization to an inspection before the trees are cut, irrespective of their nature and the size of the area.

The legislature’s failure to provide preventive measures in this regard constitutes what is known as relative unconstitutionality by omission (inconstitucionalidad por omisión relativa). This omission arises in cases in which a statutory provision regulates a particular legal situation, but does so defectively by omitting one of its dimensions from the regulation. In this type of silence, the explicit statutory provision is the subject of review, even though the reason it is challenged is not its text, but precisely what the text does not say, and that omission creates a situation contrary to the Constitution. A typical example of unconstitutionality by omission is found in statutory provisions that violate the principle of equality (principio de igualdad), either because they expressly and without apparent reason exclude a particular group of individuals from a benefit to which they would be entitled or have a legitimate expectation, or because, in regulating that benefit, the provision grants it to a particular group and remains silent as to everyone else (as in the case before us).

According to legal scholarship, a provision may be silent regarding a legal situation that warrants protection because the Constitution so requires. An implicit rule may therefore be derived from the provision, regulating the legal situation subject to constitutional protection differently from the explicit rule, as in this case with the right to a healthy and ecologically balanced environment, which implicitly includes the precautionary principle. According to the analysis of the challenged article, the legislature modified the concept of forest on which the protections, restrictions, and permits granted under the Ley Forestal are based —as is the case with Article 28 at issue, “Exception from cutting permit (Excepción de permiso de corta)”—in such a way that it restricted, without technical justification, the previous concept of forest contained in the law before its amendment. Consequently, non-native species and forested areas smaller than two hectares were left without statutory protection, with the result that, under the challenged Article 28, no permit to cut is required, nor even a prior inspection to ensure that the circumstances are those the provision sought to encourage: any forest plantation, agroforestry system, or individually planted tree.

This leaves exposed areas whose location, number of trees, and the function they have performed for many years warrant conservation and regulation of their felling, irrespective of the nature of the species and of the land on which they are located. Accordingly, for the reasons stated, this Chamber considers that relative unconstitutionality by omission exists in this case. Nevertheless, although the Constitutional Chamber has jurisdiction to declare a provision unconstitutional, a violation of this nature must be remedied by the Legislative Assembly, by extending the application of the law to cases not expressly covered by it, including, in this case, the species and areas left unprotected under the current concept of forest, and by adopting preventive and oversight measures for areas where felling is permitted. For all the foregoing reasons, we find that the challenged Article 28 violates Article 50 of the Political Constitution.

However, to avoid violating the principle of separation of powers (principio de separación de poderes), we consider it appropriate to grant the Legislative Assembly a reasonable period in which to remedy the violation identified.

VI.Conclusion. For all the foregoing reasons, the action is granted solely on account of the relative omission in Article 28 of the Ley Forestal

to establish precautionary measures (medidas precautorias) ensuring environmental protection in this regard. In all other respects, the action is denied. Justice Jinesta dissents and would deny the action.

Por tanto:

The action is granted solely on account of the omission in Article 28 of the Ley Forestal to establish precautionary measures ensuring environmental protection. The Legislative Assembly shall remedy the absence of precautionary measures that ensure, in advance, the proper application of Article 28 for the protection of the environment, as stated in the reasoning section of this judgment. This judgment shall be communicated to the Legislative and Executive Branches. A summary of this ruling shall be published in the Official Gazette “La Gaceta,” and its full text shall be published in the Boletín Judicial. In all other respects, the action is denied. Justice Jinesta dissents and would deny the action.´ This Court considers that there are no grounds for departing from the reasoning set forth therein. The proper course is therefore to dismiss the action on the merits and reiterate this Chamber’s holding in the cited judgment: the Legislative Assembly shall remedy the absence of precautionary measures that ensure, in advance, the proper application of Article 28 for the protection of the environment, as stated in the reasoning section of that decision.

II. SEPARATE OPINION OF JUSTICES JINESTA LOBO AND CASTILLO VÍQUEZ

Justice Jinesta Lobo reiterates the dissenting opinion recorded in judgment 2007-3923 at 15:02 hours on 21 de marzo del 2007, and Justice Castillo Víquez joins that opinion, which stated:

“I agree with the majority opinion’s analysis of the Fundamental Right to a healthy and ecologically balanced environment, as well as the State’s duty to protect it. I disagree, however, with respect to Article 28 of the Ley Forestal. Under that provision, no cutting permit (permiso de corta) is required for «Forest plantations, including agroforestry systems and individually planted trees». According to the majority opinion, precautionary measures must be added to Article 28 to ensure the protection of the environment and, consequently, orders the Legislative Assembly to do so. I consider the amendment of the provision along the lines indicated to be unnecessary and potentially detrimental to environmental protection. It must be borne in mind, on the one hand, that halting the exploitation of forests is in the public interest. On the other hand, the promotion of forest plantations (plantaciones forestales) is one of the policies adopted by the State to achieve that objective.

Thanks to these plantations, society’s needs for timber and derivative products are met without damaging the forest. This promotes a sustainable development model that reconciles human needs with forest protection. Consequently, it must not be overlooked that the provision at issue is the first article of Chapter III (Promotion of Forest Plantations), Title II (Private Forest Property), of Ley No. 7575 (Ley Forestal). Specifically, it grants the owner of a parcel of land permission to fell trees planted for commercial purposes, thereby providing the confidence needed to undertake such planting. It is a measure intended to encourage forest plantations and thus discourage forest exploitation; its ultimate purpose is to protect the environment, not to destroy it. Granting permission in advance is acceptable because it is clear that, to engage in such an activity—as in any other—the interested party must comply with land-use restrictions (limitaciones de uso de suelo).

Consequently, there is no purpose in having MINAE issue a permit to fell trees from a forest plantation when the law has already done so. Making the harvesting (aprovechamiento) of those trees subject to an administrative decision nullifies the incentive. The Administration not only has the authority but is also required to verify that timber produced in the country comes from a forest plantation and not from illegal logging (corta ilegal), without the need for each individual article of the Ley Forestal—including Article 28—to so provide. On the contrary, requiring a felling permit (permiso de corta), or even another less burdensome measure, could only discourage investment in forest plantations, increase the cost of timber and, consequently, make the irrational exploitation of forests, even in violation of the legal system, more profitable. I understand the concern expressed in the majority opinion (recital V (considerando V)) regarding the possible improper application of Article 28 to areas that are neither plantations nor agroforestry systems (sistemas agroforestales).

However, such overreach does not arise from the provision, nor would it be prevented by reiterating that the provision applies only to certain types of plantations—that is already known; it is a problem of inadequate oversight. MINAE’s oversight powers are neither diminished by the wording of the provision nor would they be increased merely because the provision repeated them. In short, although well-intentioned, I consider that a legislative amendment to the challenged article would bring more disadvantages than benefits for environmental protection, and therefore I consider that the action filed should be denied.”

Por tanto:

The action is dismissed on the merits. The Legislative Assembly shall take note of the provisions of the final paragraph of the first recital (considerando) of this judgment. This judgment shall be communicated to the Legislative and Executive Branches. Justices Jinesta Lobo and Castillo Víquez append separate notes.
