Constitutional challenge (acción de inconstitucionalidad) filed by Luis Gerardo Fallas Acosta, of legal age, attorney, identity card number 1-753-259, resident of Tabarcia de Mora, in his capacity as Deputy Ombudsman of the Inhabitants of the Republic, against Article 71 bis, second paragraph, in relation to subsections c) and f) of Article 130; subsections g), i), and j) of Article 131; subsections f), g), h), and l) of Article 132; subsections c), d), e), g), and j) of Article 133; subsections a) and ch) of Article 136; subsections c), ch), and e) of Article 134; and Articles 130, 131, and 132, all of the Ley de Tránsito por Vías Públicas Terrestres, number 7331, dated April thirteenth, nineteen ninety-three, as amended. Also participating in the proceedings were Ana Lorena Brenes Esquivel, Attorney General of the Republic; Luis Llach Cordero, in his capacity as Minister of Public Works and Transportation; and Flor Madriz Molina, in her capacity as Acting Executive Director of the Consejo de Seguridad Vial.
Background:
The body of constitutional law (bloque de constitucionalidad) imposes on the legislature—when imposing fines and penalties—the duty to ensure a fair and equitable proportion between the amount of the penalty (quantum de la sanción) and the economic circumstances of the person penalized, as well as a fair proportion in relation to the manner, time, and place of the alleged acts. Valid and effective legislative techniques exist to achieve that aim, including those that establish minimum and maximum fine parameters, enabling the oversight body to ensure that the penalty imposed on the offender closely reflects the offender’s actual economic means. In support of the foregoing, it cites as an example Article 53 of the Criminal Code, which provides that the judge must determine the amount of money corresponding to each fine-day (día de multa) according to the convicted person’s economic circumstances, taking into account that person’s standard of living, all daily income, and reasonable expenses for meeting both personal and family needs.
Each fine-day may not exceed fifty percent of the convicted person’s daily income. Accordingly, the fine is understood to be linked to the offender’s ability to pay; for example, if a farmer is ordered to pay ten fine-days and earns five thousand colones, the fine will be fifty thousand colones; if the offender is a professional upon whom the same fine was imposed but whose salary is fifty thousand colones per day, the fine will be five hundred thousand colones. Against this backdrop, the provision in question fully complies with the principle of equality (principio de igualdad), because it treats equally those who are in equal circumstances and differently those who are in different circumstances, since there is no greater injustice than treating unequals equally. The petitioner (accionante) states that he does not intend to suggest that the State may not establish fixed fines applicable to all members of society; however, in such a case, the benchmark must be the economic means of the lowest-income population, since otherwise unequals would be treated equally, thereby violating the principles of equality, reasonableness, proportionality, and a basic principle of equity.
In the case of the challenged fines contained in the Traffic Law (Ley de Tránsito), those constitutional violations are apparent, given that fixed fines are established on the basis of the salary of an “Administrative Assistant 1” of the Judiciary, disregarding the economically weakest members of the population, who are ordinarily the most affected, as a consequence of an unjust distribution of national income in which recent trends even point toward the concentration of wealth in increasingly smaller groups. Indeed, to demonstrate the foregoing, one need only examine the results of the survey conducted by the Instituto Nacional de Estadística y Censo, the 2006 “National Household Income and Expenditure Survey,” which covered the preceding sixteen years in the country. The relevant portion states: “(…) Real income grew, on average, by 33.7%; the highest-income 20% enjoyed income growth of 67.9%.
The lowest-income 40% saw their average real income decline: -13.9% for the poorest 20% and -2,7% for the second 20% of households. All households were able to achieve growing per capita income because today nearly all households have, on average, one fewer member. The highest-income 20% experienced per capita income growth of 95,6%; the lowest-income 20%, growth of 6,7%. Currently, the highest-income 20% of households, comprising only 16% of the population, receives 52% of the country’s income, while the lowest-income 20% obtains 4.6% of income, and 80% of households, comprising 84% of the population, obtains 48,0%. This reflects redistribution toward higher-income sectors. Over these 16 years, the highest-income 20% of households increased their share of income by approximately 10 percentage points, equivalent to around one quarter of their initial income. For their part, lower-income households lost 2 percentage points of their share, that is, one third of their initial income.
The middle sectors (40% of middle-income households) also lost part of their share of total income, amounting to 7 percentage points (…).” The manner in which the penalties contemplated in the challenged provisions are established clearly reveals a violation, arising from deficient legislative drafting, of the principles of reasonableness and proportionality: first, because the benchmark used is a salary higher than the statutory minimum wage (the salary of an Administrative Assistant 1), creating gross discrimination based on the economic means of all inhabitants of the country who fall within the circumstances giving rise to liability for that fine. The amount set for the aforementioned judicial position does not correspond to the country’s socioeconomic reality, where the minimum wage for unskilled personnel is ¢ 220.345,47 for the second half of 2010, while that of a skilled worker is ¢249.725,33, with the fines increasing automatically on the basis of the selected base salary, which by its nature is much higher than the statutory minimum earned by most of the country’s workers.
The legislature’s lack of social awareness and disregard for the country’s economic reality creates a significant group of people who may be placed in a state of complete socioeconomic vulnerability when these penalties are imposed on them, which in many cases could well mean the loss of their livelihood through the loss of their principal work tool—their vehicle. Substantive equality (igualdad real), like liberty and economic efficiency, is a constitutional value embodied in the Law of the Constitution (Derecho de la Constitución) through its values, principles, and rules. Faithful to this maxim, constitutional courts have therefore advocated guaranteeing minimum subsistence (mínimo vital) to all inhabitants of the State. The concept of minimum subsistence may be regarded as one of the most important developments in the protection of human rights, since it is the right to have the minimum conditions necessary for personal subsistence and a dignified life.
Second, the percentages applied in each of the articles challenged as unconstitutional entail the imposition of fines that, in ordinary circumstances, place most people at a marked economic disadvantage relative to a small, economically powerful sector. The Constitutional Chamber addressed this issue in judgment number 2011-6805. Consequently, because the challenged provisions establish a salary that does not correspond to the statutory minimum and because its percentage-based application could threaten the inhabitants’ minimum subsistence, those provisions are deemed to suffer from absolute defects of unconstitutionality and—once they have been declared as such—the fines that were in force before the enacted reform must be applied.

Article 130, subsections c) and f), in turn, provides:
“ARTICLE 130.- A fine equal to one monthly base salary corresponding to the position of ‘Administrative Assistant 1’ (‘Auxiliar administrativo 1’) appearing in the Judicial Branch (Poder Judicial) position schedule shall be imposed, in accordance with the Republic’s Ordinary Budget Law (Ley del presupuesto ordinario de la República) approved in the month of November preceding the date on which the traffic violation is committed, without prejudice to related penalties (sanciones conexas):

“ARTICLE 102.- Motor vehicles, trailers, and semi-trailers transporting hazardous or explosive materials shall comply with the following requirements:
It is therefore entirely reasonable that, in addition to fines, a system for the loss of license points was established to penalize violations of the Traffic Law in proportion to the seriousness of the offense. With regard to the compensated transportation of persons (transporte remunerado de personas), in its various forms, it should be borne in mind that this is a public service vested in the State, although the State may delegate it to private parties. The public interest involved in this service is more than evident, and therefore only duly authorized persons or companies should be permitted to provide it. Accordingly, if a bus or taxi driver is aware that the vehicle being driven is not authorized to provide the public service of compensated transportation of persons, the driver must refrain from providing that service because, in the event of an accident, users or other affected persons would not have the protection required by the legal system (ordenamiento jurídico) in such cases.
For its part, the transportation of hazardous materials, by its very nature, requires strict compliance with the permits and mechanical conditions necessary for the safety of the motor vehicle and, of course, of the driver, other drivers, and pedestrians. It would be irresponsible for a driver to operate this type of vehicle without, for example, the semiannual technical inspection certifying due compliance with the necessary safety conditions. The same applies if the corresponding permit is not carried or if the vehicle travels at unauthorized times or on unauthorized routes. In such cases, the danger to which residents would be exposed is itself sufficient to justify the penalties imposed on drivers under the Traffic Law. Consequently, in the opinion of the Office of the Attorney General, the provision does not incur the constitutional violations alleged by the petitioner. 2. Alleged unconstitutionality of the second paragraph of Article 71 bis in relation to Article 131, subsections g), i), and j), of the Traffic Law. The provisions at issue state, insofar as relevant: “ARTICLE 71 bis.- … The number of points initially assigned shall be reduced or automatically deducted in any of the following circumstances:
a) …
Article 131, subsections g), i), and j), in turn, provides:
“ARTICLE 131.- A fine equal to seventy-five percent (75%) of one monthly base salary corresponding to the position of ‘Administrative Assistant 1’ appearing in the Judicial Branch position schedule shall be imposed, in accordance with the Republic’s Ordinary Budget Law approved in the month of November preceding the date on which the traffic violation is committed, without prejudice to related penalties:
a) …
Article 100 at issue provides:
“ARTICLE 100.- The following special provisions apply to vehicles that transport or haul vehicles by means of a tow-truck service:
ch ) They must carry the lights and accessories prescribed by this Law and its Regulations; in addition, they must have a three-hundred-and-sixty-degree (360) rotating beacon with an amber light visible from a distance of one hundred and fifty (150) meters, and two (2) searchlights, which shall be used when the vehicle is stopped and may be aimed so that the beam does not affect other drivers on the road. These accessories may be used only while tow-truck service is being provided.
Regarding the reasonableness of the loss of points, consideration should be given to what was stated for that purpose in the preceding section. As with the conduct already analyzed, the Office of the Attorney General (Procuraduría) considers that the provisions in question, insofar as they penalize drivers, are not unreasonable. As may be seen, the prohibited conduct is directed at drivers (choferes), not at vehicle owners. However, given the serious consequences that noncompliance could cause, the Office of the Attorney General considers it reasonable and consistent with Constitutional Law (Derecho de la Constitución) for the fine and the penalty involving the loss of 20 license points to be imposed on drivers. Driving a vehicle for which the vehicle registration fees (derechos de circulación) or mandatory motor vehicle insurance (seguro obligatorio de vehículos) have not been paid is extremely serious because, in the event of an accident, it would leave those affected without protection.
Consequently, there is no justification whatsoever for a driver to operate a vehicle under such circumstances. The same applies to operating a motor vehicle with license plates that do not belong to it. In the event of an accident, who would be liable for the losses and damages (daños y perjuicios) caused to third parties? Given the seriousness of the offense (falta), it is reasonable to penalize the offending driver. As for operating tow trucks, because this is a special service, they must have the corresponding authorization from the Consejo de Transporte Público, provide service within the authorized area, charge the stipulated rates, maintain the corresponding activity logbook, and display the license plates specifically designated for this type of activity. In addition, vehicles used for this activity must carry the lights and accessories prescribed for this type of vehicle. However, failure to comply with the requirements described above pertains, for the most part, to the driver as well as to the owner of the motor vehicle.
In that regard, it is reasonable for the penalty for violating them also to be imposed on drivers. 3. The alleged unconstitutionality of the second paragraph of Article 71 bis in relation to the provisions of Article 132, subsections f), g), h), and l), of the Traffic Law (Ley de Tránsito). The relevant portions of the provisions in question state:
“ARTICLE 71 bis .- …
The number of points initially assigned shall be automatically reduced or deducted in any of the following circumstances:
a) …
“ARTICLE 132 .-A fine equal to fifty percent (50%) of the monthly base salary corresponding to the position of ‘Administrative Assistant 1’ appearing in the Poder Judicial position schedule shall be imposed, in accordance with the Republic’s Ordinary Budget Law approved in November preceding the date on which the traffic violation is committed, without prejudice to related penalties:
a) …
And Article 32, in the sections cited, provides:
“ARTICLE 32 .- All motorized and non-motorized vehicles, whether privately or publicly owned, that are authorized to travel pursuant to Article 1 of this Law must comply with the following requirements concerning active and passive safety devices, as well as all safety measures:
a) …
In addition to the requirements contained in subsection 1) of this article that apply according to their construction, cargo vehicles, trailers, and semitrailers must comply with the following:

In the particular case of the conduct prohibited by the provisions indicated in this section, a fine and the loss of 15 license points are imposed on anyone who operates a cargo vehicle without reflective devices; on the driver of a bus that does not have an easily accessible emergency exit separate from the bus’s entrance and exit doors; on anyone who drives a vehicle whose engine, fuel-injection or carburetion systems, or emissions-control systems have been altered or modified; and on anyone who drives a vehicle that, without any justification, does not display the required license plates. In the opinion of the Procuraduría, the provisions at issue are not unconstitutional per se, since in many cases the driver is also the owner of the vehicle. However, it likewise does not consider it acceptable to exempt from liability the driver of a truck that lacks the required reflective devices, given the importance of such devices for road safety and because their cost is not significant.
Nor is it considered acceptable to exempt from liability the driver of a vehicle whose engine, fuel-injection or carburetion systems, or emissions-control systems have been altered or modified, since this could be dangerous to the vehicle’s normal operation. Under such circumstances, the driver should refrain from driving a vehicle in that condition. The same may be said of driving a vehicle that, without justification, does not display the required license plates. The driver, as the person responsible for operating a vehicle, must ensure that it meets the minimum necessary conditions and carries the documents and devices establishing its right to be driven on public roads. Accordingly, the driver likewise should not be exempted from the liability and penalties imposed for such conduct by the legislation under discussion. The only conduct for which the Procuraduría considers an exemption from liability appropriate is that of a bus driver whose bus does not have an emergency exit.
It is obvious that compliance with that requirement cannot be attributed to the driver. In that case, however, the corresponding fine must be imposed on the owner of the vehicle. It should be recalled that, pursuant to Articles 150 and 153 of the Ley de Tránsito, fines may be entered both on the offender’s driver’s-license record and against the license-plate number of the vehicle with which the traffic violation was committed, so that collection may be carried out through the entity responsible for collecting mandatory motor-vehicle insurance premiums. 4.- The Alleged Unconstitutionality of the Second Paragraph of Article 71 bis in Relation to Article 133, Subsections c), d), e), g), and j), and Article 136, Subsections a) and ch), of the Ley de Tránsito. The provisions at issue state, insofar as relevant:

Rearview mirrors and their supports and mounting devices must not have forward-facing points, sharp edges, or hazardous shapes. … h) At the rear, vehicles must have two red-light-emitting devices that remain illuminated when the high or low beams are switched on, with a section that emits a brighter red light when the brakes are applied. Passenger vehicles must also have a third red-light device that is likewise activated automatically by the brakes, located inside or outside the vehicle at the height of the rear seats and centered in relation to the rear windshield, unless the device was installed elsewhere by the manufacturer. Light-duty cargo vehicles are exempt from this requirement. i) Vehicles must have at least two (2) turn-signal lights at both ends of the front and rear. They must have one (1) lighting system that operates independently of the main lights in emergencies. … l) Vehicles must be equipped with at least one (1) fire extinguisher in perfect working order. … r) Vehicles must be equipped with brakes capable of slowing and stopping the vehicle safely, quickly, and effectively, as well as a parking or emergency brake to be used when parked or in any emergency.
The parking brake must keep the vehicle stationary, regardless of its load, on an uphill or downhill gradient of eighteen percent (18%). s) Every motor vehicle that uses a compressed-air system to operate its own brakes or the brakes of any trailer or semitrailer attached to it must be equipped with a visible and audible warning signal, located on the instrument panel in the driver’s compartment of the towing vehicle, which is activated if the air reservoir falls below fifty percent (50%) of the pressure set by the compressor regulator. Vehicles that use a vacuum-powered braking system must have a similar warning system. t) The bodywork in front of the windshield must not support forward-facing elements that are not technically indispensable, nor may it have pointed or sharp elements or elements constituting a sharp angle or hazardous protrusion. Likewise, bumpers must not have hazardous protrusions, and their side ends must be directed toward the bodywork. … 6) Public passenger transportation vehicles: In addition to the requirements set forth in subsection 1) of this Article that are applicable according to their construction, public passenger transportation vehicles must comply with the following: a) … b) Every bus used to provide public passenger transportation service must display a visible sign authorized by the Consejo de Transporte Público, clearly indicating the number of passengers who may travel in it, the name and number of the route, and the authorized fare. … f) Owners of public passenger transportation vehicles (buses, minibuses, and microbuses) must position the exhaust-pipe outlet of those vehicles as prescribed by the Regulations issued by the Executive Branch, provided that this does not conflict with the manufacturer’s technical specifications. (…).” The underlining is not in the original.
“ARTICLE 99.- Limited-capacity cargo vehicles are governed by the following special provisions: a) … c) They must have a valid special insurance policy from the Instituto Nacional de Seguros, the amount of which shall be determined by that Institution on the basis of technical, factual, and actuarial studies. “ARTICLE 101.- Drivers of light-duty and heavy-duty cargo vehicles must comply with the following regulations: a) … j) Light-duty and heavy-duty cargo vehicles must carry the Weight and Dimensions Card (Tarjeta de pesos y dimensiones) issued by the competent body of MOPT, as established by regulation. (…).” “ARTICLE 114.- It is prohibited to drive a motor vehicle that has any sign, poster, decal, or other opaque material affixed to the front or rear windshield that obstructs the driver’s view of the roadway and its surroundings. This prohibition does not apply to the display of the vehicle registration sticker (marchamo) and the technical-inspection decal. Opaque or tinted material may be used on the side windows provided that it allows inward or outward visibility of no less than seventy (70%) percent. All of the foregoing is without prejudice to the provisions established by the Consejo de Transporte Público concerning the signage and information for users that must be displayed on paid passenger transportation and student transportation vehicles.” As in the case of the conduct already examined, drivers could not be exempted from liability when they engage in conduct such as driving a vehicle that does not have seat belts, functioning rear red lights, brakes in good condition, or the required windshield, or whose visibility is obstructed.
Failure to satisfy such conditions could prevent safe driving or cause improper distractions; consequently, drivers must refrain from driving the motor vehicle concerned. Likewise, it would be inadmissible to exempt taxi drivers who refuse to use the corresponding taximeter from the liabilities and penalties established by the regulations under discussion, since doing so would entail deficient service to the detriment of the user. Other conduct, however, such as displaying route signage on public transportation vehicles and the duty to position vehicle exhaust pipes in the location prescribed by the respective Regulations, does fall within the owners’ sphere of responsibility. Even in these cases, however, the regulations at issue are not unconstitutional. Quite simply, the fine must be imposed on the owner of the motor vehicle.
“ARTICLE 71 bis.- … The number of points initially assigned shall be automatically reduced or deducted in any of the following circumstances: a) … f) Five (5) points for committing any of the acts specified in subsections … c), ch), and e) of Article 134 of this Law.” The underlining is not in the original— “ARTICLE 134.- A fine equal to thirty percent (30%) of the monthly base salary corresponding to ‘Administrative Assistant 1’ appearing in the Poder Judicial staffing schedule shall be imposed, in accordance with the Republic’s Ordinary Budget Law approved in the month of November preceding the date on which the traffic violation is committed, without prejudice to related penalties (such as, for example, the loss of 5 points from the driver’s license): a) … c) On the driver of a motor vehicle who fails to comply with any applicable general or special provision established in Article 32 of this Law, provided that such noncompliance is not penalized under another provision of this Law. ch) On the driver of a public transportation vehicle of any type who provides service without meeting any of the conditions established in Article 109 and in subsection 1), paragraphs a), b), g), j), k), n), p), and q), as well as in subsection 6), paragraphs d) and i), of Article 32 of this Law. …” As indicated above with respect to the previously challenged conduct, drivers could be exempted from liability and from the sanctions established by the regulations at issue only when the conduct falls exclusively within the sphere of responsibility of the owners.
But even in such cases, the regulations at issue are not unconstitutional; quite simply, the fine must be imposed on the owner of the motor vehicle. B) On the proportionality of the fines contained in Articles 130, 131, and 132 of the Ley de Tránsito. Despite the settled case law (jurisprudencia) issued by the Sala Constitucional on this matter, which has annulled several provisions of the Ley de Tránsito on the ground that the amounts of the fines established in various provisions violate the constitutional principles of reasonableness and proportionality (principios constitucionales de razonabilidad y proporcionalidad), including judgments n.° 6805-2011, at 10:30 hours on 27 de mayo del 2011, which annulled Article 131, subsection k), of the Ley de Tránsito—seat belt; n.º 2011-13393, at 14:30 hours on 5 de octubre del 2011, which declared Article 132, subsection ñ), unconstitutional—technical inspection; n.° 2012-129, at 14:30 hours on 11 de enero del 2012, which declared Article 131, subsection b), unconstitutional—speed limits; n.º 2012-3942, at 16:22 hours on 21 de marzo del 2912, which declared Article 131, subsection a), unconstitutional—speeding; n.º 2012-3947, at 16:27 hours on 21 de marzo del 2912, which declared Article 134, subsection c), unconstitutional—failure to carry a reflective vest; n.º 2012-3948, at 16:28 hours on 21 de marzo del 2012, which declared Article 132, subsection n), unconstitutional—obstructing the passage of other vehicles; n.º 2012-3950, at 16:30 hours on 21 de marzo del 2012, which declared Article 134, subsection c), unconstitutional—failure to have a fire extinguisher; and n.° 2012-5250, of 25 de abril del 2012, of 25 de abril de 2012, which declared Article 131, subsection ch), unconstitutional—failure to obey a red traffic light—the Procuraduría considers that the amount of the fines established in the challenged provisions is neither irrational nor disproportionate.
The Sala Constitucional itself, in judgment n.° 2011- 16614, of 2 de diciembre de 2011, issued in an amparo proceeding (recurso de amparo), held that a fine of more than three hundred thousand colones for driving without a license or permit was reasonable and proportionate because it considered the conduct a serious offense. This demonstrates that, for purposes of deciding the case, the seriousness of each of the offenses established in the challenged provisions must be analyzed. In any event, it must be borne in mind that these are not fixed-amount fines; rather, they are adjusted annually. In initially setting them, the Asamblea Legislativa took into account the supporting technical studies conducted by the Ministerio de Obras Públicas y Transportes. It should also be borne in mind that, for many years, the general criticism was that the fines were too low and that traffic regulations were therefore disregarded, which partly prompted the change in their amounts.
Finally, the Procuraduría considers that assessing the technical factors considered by the Administración and the legislator in setting the amount of fines for violations of traffic regulations is a matter relating more to judicial review of legality (control de legalidad) or to a debate over technical criteria, which falls within the authority of the corresponding administrative bodies and, ultimately, the ordinary courts. In conclusion, the Procuraduría recommends dismissing the constitutional challenge (acción de inconstitucionalidad), because the challenged regulations present no conflict with the Constitution whatsoever, or, alternatively, partially upholding it solely with respect to conduct prohibited by the regulations at issue that expressly falls within the sphere of responsibility of motor vehicle owners, in which case the monetary penalty should not be imposed on employed drivers but on the owners.
It is difficult to conceive, for example, in the case of unauthorized public transportation or the transportation of hazardous materials, that a driver could disregard the fact that a motor vehicle lacking the respective authorizations—which is not merely a matter of formalities or paperwork, but of verifying the vehicle’s fitness to obtain such approvals—is indispensable in light of the particular conditions under which that vehicle would be operating. Under the ownership-relationship criterion advanced by the Defensoría de los Habitantes, there is a risk of overgeneralization, because the lack of an owner-driver relationship may arise from a conscious arrangement which, precisely if the Defensoría’s theory were endorsed, could become a loophole for evading liability. The same may be said of the effects arising from family relationships, where, although formally or according to the registry the motor vehicle is not owned by the person operating it, that person is not unaware of the actual condition of the vehicle being driven.
These are the circumstances contemplated in Article 130 of the Ley de Tránsito por Vías Públicas Terrestres. Clarifications must also be made regarding the circumstances under Article 131, namely subsections g) and h). Drivers cannot disregard their duty to drive with the required authorizations. Operating a motor vehicle with license plates that do not belong to it is conduct that could be associated with the commission of criminal offenses. It defies even the most basic understanding to suggest that a driver operating a motor vehicle under those conditions should be shielded from the consequences of the law. Once again, the error of overgeneralization is committed, since it would never be excusable, for example, for a cargo vehicle to display private-vehicle plates when that circumstance is an immediately apparent matter that the driver has an absolute duty to recognize. The same applies when a motor vehicle displays public-transportation plates belonging to a province other than the one in which it is operating.
Such conditions must be immediately observed by the driver. The same conclusions apply to the objections raised concerning subsections f), g), h), and l) of Article 132. First, with respect to cargo vehicles, the risk is extremely high; drivers must therefore understand the importance of the equipment required therein and the risks resulting from its absence because of visibility concerns, not only for other drivers but also for themselves. The same considerations apply to the structural condition of the motor vehicle being driven and to pollutant emissions (emisiones contaminantes). Finally, because displaying the prescribed license plates is an essential requirement for a vehicle, as established in subsection c) of Article 4 of the Ley de Tránsito por Vías Públicas Terrestres, it cannot reasonably be argued that a driver should not bear the legal consequences of driving a motor vehicle under those conditions.
The same reasoning applies to the objections raised against the challenged subsections of Article 133, again emphasizing the tremendous risk of overgeneralization that would result from the claim made by the Defensoría de los Habitantes, as well as the restrictive balancing that must always be undertaken when the provision of the public service of passenger transportation is at issue. Attention must also be drawn to the fact that the use of the taximeter (“maría”) is essential to the operation of taxi-type public transportation services; accordingly, it is difficult to understand how it could be deemed unreasonable to penalize a driver who tampers with it, an act commonly committed knowingly by the driver, or who fails to use or carry it, with evident harm to the passenger. In a similar vein, and to avoid needless repetition, the same position is taken regarding subsections c), ch), and e) of Article 134 of the Ley de Tránsito por Vías Públicas Terrestres.
The requirements established in Article 32 are extremely important, as is the issue of unauthorized modifications. Particularly from the standpoint of professional drivers, whose experience makes their understanding of the consequences of noncompliance especially relevant, it is doubtful that they bear no responsibility whatsoever for the absence of those requirements. The same observations apply to the challenge concerning the effects established for subsections a) and ch) of Article 36 of the applicable law, where it is likewise inexplicable that a driver could claim ignorance of those requirements and of the consequences of their absence. The established penalty system placed the regime of fault-based liability (responsabilidad subjetiva) on the driver, excluding the owner. Therefore, at most, one might question the decision not to include the owner as an additional person subject to penalties for the conduct observed by the traffic officer.
This does not, however, relieve the driver of liability, because the driver is ultimately the person operating the motor vehicle, including under hazardous conditions. Regarding the alleged impairment of the right to work raised by the Defensoría de los Habitantes, the Sala Constitucional stated in voto 2012-3945 de las dieciséis horas veinticinco minutos del veintiuno de marzo del dos mil doce: “(…) it is clear that the provision of a public service through the grant of a taxi license plate is governed by certain statutory and regulatory provisions establishing the general guidelines, conditions, terms, parking locations, methods for providing the service, and so forth, which must be complied with. This Sala has held that the right to work entails an individual’s ability to choose, from among a wide range of lawful occupations, the one most conducive to attaining that individual’s well-being, while the State undertakes not to impose a particular activity and to respect the individual’s sphere of choice.
In every case, however, the requirements imposed by law for performing the position must be met. If they are not met, or if the work is performed without due diligence, the State is entitled to impose restrictions on this right, which, like all rights, is not absolute.” Therefore, if the situation described by the Defensoría de los Habitantes occurs, it cannot be generalized that drivers are unaware in every case of the omissions and violations of traffic legislation under which they operate the vehicles. The requested relief would violate the principle of equality by seeking different treatment from that afforded to other drivers. Contrary to the assertion of the Defensoría de los Habitantes, there is no transfer of liability through a legal fiction (ficción jurídica); rather, liability arises from driving the motor vehicle in a manner contrary to the law. Through the challenge mechanism (mecanismo de impugnación) provided for in Articles 152 et seq. of the Ley de Tránsito, drivers who believe that they do not deserve the liability attributed to them may submit the appropriate arguments and defenses for individual consideration, instead of accepting the fiction, arising from the error of overgeneralization advanced by the Defensoría de los Habitantes, that the penalties and deduction of points should be declared unconstitutional on the basis of the provisions it challenges.
Therefore, the legislature was not required to draw the requested distinction, which would be dangerous. Instead, the result sought through this constitutional challenge (acción de inconstitucionalidad) may be achieved through the challenge mechanism if the absence of liability is actually established. There is no violation whatsoever of due process, because drivers who believe that their rights have been infringed may freely exercise it. Many of the situations cited by the Defensoría de los Habitantes, involving the loss of points by professional drivers, arise precisely because they failed to exercise the available avenues of appeal, despite having been able to do so. The system can do no more than provide citizens with the means to challenge a decision, leaving their exercise to the citizens’ own discretion. Regarding the alleged violation of the proportionality standard arising from the monetary fines provided for in the first paragraph of Articles 130, 131, and 132 of the Ley de Tránsito por Vías Públicas Terrestres, the claim made by the Defensoría does not comply with Article 78, second paragraph, of the Ley de Jurisdicción Constitucional.
First, it challenges three provisions of the Ley de Tránsito in generic terms, separating the penalty from the penalized conduct, even though the two cannot be considered separately. Second, it also disregards the conduct constituting the offense (acción típica) defined in each article, because each contains several circumstances, all with different characteristics and different degrees of impact on the value of road safety. Third, there is no justification whatsoever because the constitutional challenge fails to explain why, out of the seven tiers of violations established in Articles 131, 132, 133, 134, 135, and 136 of the applicable law—all of which use the same penalty parameter—only the first three would present the alleged constitutional conflict. What is offered is a subjective assessment rather than technical constitutional reasoning. Moreover, constitutional challenges have already been filed analyzing several of the forms of conduct penalized under the challenged articles and reaching conclusions as to their constitutionality or unconstitutionality.
In other words, challenges are being raised regarding matters already decided by the Sala Constitucional. Driving motor vehicles and, more generally, participating in the traffic system on public land routes is, by definition, a hazardous activity. This authorizes the State, as the entity responsible for those routes, to establish the corresponding rules for the purpose of creating a rational order. Those rules take the form of standards of conduct intended to prevent events resulting in collisions involving property damage and, in the worst cases, deaths or injuries on the road. The percentage of violations committed among all licensed active drivers ranges between 2.16% and 3.71%, according to the pattern of violations since primero de marzo del dos mil diez, the date on which the entire system of violations entered into force. This supports a basic conclusion: within the population of licensed active drivers, the proportion of persons who have not been deterred by the traffic rules since the entry into force of a system regarded as strict is extremely low.
Moreover, after excluding between 5% and 10% of traffic citations (boletas de citación) in which some type of preparation error may be identified, the situation becomes even more evident. Thus, based on a small group of offenders, an attempt is being made to undermine a system that has been functioning, relying solely on external or theoretical assessments of the rules. The mistaken premise that a penalty must be set at an amount the offender can afford to pay is repeated, when the objective is for the offender not to commit the violation. If the overwhelmingly larger percentage of licensed drivers have been deterred by the traffic rules, since offenders represent only minute percentages, the theoretical argument that the system is disproportionate or irrational must be rejected; the contrary position is based on assumptions.
The gradual whittling away of the list of violations (infracciones) and their corresponding penalties (sanciones), in an effort to remove certain penalties on the grounds of their alleged disproportionality or unreasonableness, sends a negative message regarding the expectation that participants in the traffic system will comply with it. The conduct established in Articles 130, 131, and 132 involves risk factors that require special attention, with penalties imposed on those who choose to disregard those standards of conduct. The protection of the legally protected interest (bien jurídico) of road safety, or traffic safety, which has been gaining recognition in the various legal systems, is evident and indirectly affords advance protection to life and physical integrity. Under these parameters, it is clear that the expected benefit of protecting those higher values cannot be diminished on the basis of an economic calculation, since neither life nor physical integrity has a price.
In Spanish legal scholarship and case law, traffic safety has increasingly been recognized as a legally protected interest worthy of protection, and it has therefore been deemed necessary to put forward a definition: “(…) The maintenance of the conditions necessary to ensure that the operation of motor vehicles does not pose a risk to the safety of all those involved therein.” Thus, one sector of legal scholarship presents it as the prerequisite for protecting life and physical integrity. Traffic safety is also identified as an intangible legally protected interest that is deemed impaired when the personal or property-related legally protected interests of specific individuals are placed at abstract risk. Gradually, however, the prevailing view in legal scholarship has been to assign traffic safety an instrumental character as a collective and autonomous legally protected interest with its own substantive identity, aimed at protecting material and individual legally protected interests.
There are likewise other, somewhat restrictive positions that define traffic safety as the safety of each of the legally protected interests that may be harmed or threatened in the course of road traffic; consequently, it would not ultimately constitute a legally protected interest distinct from the protection of persons and their property. He states that he does not share the position of the Sala Constitucional, which places the offender’s ability to pay and the financial burden that the penalty may represent for some persons on the same level, when it was precisely through their own decision to violate traffic rules that they voluntarily placed themselves in that situation. Nor should the concept of a Social and Democratic State governed by the Rule of Law (Estado Social y Democrático de Derecho) serve as an instrument for undermining a measure—namely, punishment—intended to help reduce road accidents alongside other approaches such as education or active prevention on the roads.
Similarly, given the demonstrably small population of offenders, one cannot proceed on the basis of a speculative exercise by assuming that most of them are low-income citizens who must therefore receive protection, and on that basis modify the entire current penalty system (esquema sancionatorio) or any similar system. In light of the foregoing, the test of rationality and proportionality (test de racionalidad y proporcionalidad), whether technical, legal, or factual, must favor the current penalty system and, accordingly, the challenged fines. Compared with other special laws, the traffic legislature actually fell short in its penalty regime (régimen de sanciones), but it clearly calibrated the specific penalty regime, contrary to the alleged lack of social awareness that the Defensoría de los Habitantes seeks to uncover. The amounts established are reasonable and proportionate. The legislature assesses the presumed danger (peligro presunto) arising from failure to observe the obligations or duties established for vehicular traffic, in view of the imminence of the consequences that may result, and the severity imposed on those who fail to comply with the mandate is determined accordingly.
There are also other aspects inherent to the regulation of vehicular traffic that must be governed by rules and severely punished when those rules are not observed. Although the amount may outwardly appear high, the objectives underlying its establishment are primarily preventive; moreover, the defined universe of persons who may potentially be liable for it is not sufficiently broad to justify modifying the system devised on their account. In any event, it is appropriate to ask: how could a standard proportionate to the entire population of drivers in the country feasibly be established? The legislature made a policy decision regarding the benchmark that would henceforth be used for a penalty regime, in this case fines for violating Ley de Tránsito number 7331. He considers that the penalties established are neither abusive nor confiscatory, but commensurate with the expected conduct, which is instead not observed.
The measures are legitimate and appropriate in view of the purposes they seek to safeguard and the imperative need to encourage compliance. He cites as examples the following judgments in which the Sala has held that a fine is not unconstitutional: 2011-16042, 2011-16614, 2011-15543, 2012-3944, 2012-3951, 2012-3939, 2012-3941, 2012-3953. All the conduct analyzed is contained in the challenged Articles 130, 131, and 132.

Opinion drafted by Justice Calzada Miranda; and,
Considering:
I.Subject matter of the action. The Defensoría de los Habitantes challenges two matters in this constitutional challenge (acción de inconstitucionalidad). First, the provisions of Article 71 bis, second paragraph, in relation to subsections c) y f) of Article 130; g), i), j) of Article 131; f), g) h) y l) of Article 132; c), d), e), g) y j) of Article 133; a) y ch) of Article 136; and c), ch) y e) of Article 134, all of the Ley de Tránsito por Vías Públicas Terrestres, number 7331 del trece de abril de mil novecientos noventa y tres and its amendments, on the grounds that they violate the principle of technical reasonableness (principio de razonabilidad técnica) by providing for the deduction of points from a driver’s license for conduct that, according to the petitioner, is attributable to the vehicle owner rather than the driver. Those provisions state:
ARTICLE 71 bis.- Upon issuance of a license, each driver shall be assigned a total of fifty (50) points in order to establish, thereafter, a mechanism for monitoring the driver’s performance; the foregoing is intended to determine the corresponding penalties when deficiencies arising from violations of this Law are established, as well as to implement corrective measures aimed at remedying the driver’s behavior and encouraging conduct that strengthens road safety.
The number of points initially assigned shall be automatically reduced or deducted in any of the following circumstances:

d)Quince (15) points for engaging in any of the conduct specified in subsections a), b), c), ch), d), e), f), g), h,), i), j), k), l), m), n) y ñ) of Article 132 of this Law.
e)Diez (10) points for engaging in any of the conduct specified in subsections b) y c) of Article 131, subsections a), b), c), ch), d), e), f), g), h), i) y j) of Article 133, and subsections a), b) y ch) of Article 136 of this Law.
The points shall be automatically deducted from the driver’s record (expediente del conductor) once the imposition of the penalty becomes final in administrative or judicial proceedings (vía administrativa o jurisdiccional), and the final point balance shall be recorded.
In the case of learner drivers or persons who drive without being duly licensed or while their license is suspended, if they engage in any conduct identified as a violation of this Law that entails a point deduction, the corresponding deduction shall be applied when the driver’s license is issued.
If the traffic citation (boleta de citación) that resulted in the revocation of authorization (cancelación de la acreditación) because of the loss of all assigned and/or available points was not challenged, Cosevi shall notify the interested party of that consequence at the location the party was required to provide for receiving notices when the citation was issued, which shall be entered in the driver’s record. If no such location was provided, the party shall be deemed notified within veinticuatro (24) horas after the corresponding decision was issued. That communication shall be for informational purposes only and shall not be subject to any administrative appeal.
Cosevi shall adopt appropriate measures to facilitate license holders’ access to their point balances through the maintenance of a record for each driver authorized to operate the motor vehicles defined in this Law, in which the points shall be calculated accurately and kept current; all of the foregoing is without prejudice to any criminal or civil penalties that may apply to the penalties described in this Article.” (As added by subsection e) of Article 2° of law N° 8696 de 17 de diciembre de 2008. Said Article 2° was subsequently repealed by Article 251 of the Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial N° 9078 de 4 de octubre de 2012) “ARTICLE 130.- A fine of one monthly base salary corresponding to the “Auxiliar administrativo 1” position appearing in the Poder Judicial staffing schedule shall be imposed, in accordance with the Ley del presupuesto ordinario de la República approved in the month of noviembre preceding the date on which the traffic violation is committed, without prejudice to related penalties: […]

ch) On the driver of a public transportation vehicle of any type who provides service without meeting any of the conditions established in Article 109 and in subsection 1), paragraphs a), b), g), j), k), n), p), and q), as well as in subsection 6), paragraphs d) and i), of Article 32 of this Law. […]
ARTICLE 136.- A fine equal to ten percent (10%) of the monthly base salary corresponding to the “Auxiliar administrativo 1” position appearing in the Poder Judicial staffing schedule shall be imposed, in accordance with the Ley de presupuesto ordinario de la República approved in the month of November preceding the date on which the traffic violation is committed, without prejudice to related penalties:
ch) On any person who uses sirens or rotating warning lights without complying with Article 33 of this Law.” As a second issue, the Defensoría considers that the proportionality standard (parámetro de proporcionalidad) has been violated by the fines prescribed in the first paragraph of Articles 130, 131, and 132 of the aforementioned Ley de Tránsito. It states that the State must necessarily consider not only the circumstances relating to the minor or serious nature of the offense, in observance of the principles of reasonableness and proportionality (principios de razonabilidad y proporcionalidad), but also the offender’s financial capacity. It asserts that the body of constitutional law (bloque de constitucionalidad) imposes on the legislature—when imposing fines and penalties—the duty to ensure a fair and equitable proportion between the amount of the penalty and the financial circumstances of the person penalized, as well as a fair proportion in relation to the manner, time, and place of the alleged acts.
It argues that the benchmark for imposing a fine should be the financial capacity of the lowest-income population; consequently, because the challenged provisions establish a salary that does not correspond to the legally prescribed minimum and because its percentage-based application could jeopardize the minimum subsistence needs of the inhabitants, it considers those provisions to be affected by absolute defects of unconstitutionality (vicios absolutos de inconstitucionalidad). The provisions it challenges in this regard are as follows:
“ARTICLE 130.- A fine equal to the monthly base salary corresponding to the “Auxiliar administrativo 1” position appearing in the Poder Judicial staffing schedule shall be imposed, in accordance with the Ley del presupuesto ordinario de la República approved in the month of November preceding the date on which the traffic violation is committed, without prejudice to related penalties:
ch) On any person who drives while their license is suspended on any of the grounds specified in this Law.
(*) (By judgment N° 3942 del 21 de marzo de 2012, the Sala Constitucional annulled the preceding subsection “in relation to the provisions of Article 108 of the same Law.” In the same vein, the Sala states that: “the amount of the fine applicable before the establishment of the fine amount annulled herein is deemed to remain in force…”, b) (*) On any person who disregards fixed traffic signs, including speed limits, or the directions of the traffic authority, in violation of Articles 79, 83, and 116 of this Law, which establish the duties to obey the oral or written directions of the traffic authorities and vertical and horizontal traffic signs, including those establishing speed limits; the prohibition against driving over channelizing islands or passing in the left lane of a roadway marked with a solid centerline. The cases contemplated in Article 107 and in subsections ch) and d) of Article 83 of this Law are excepted and shall be resolved in accordance with those provisions.

ARTICLE 132.- A fine of fifty percent (50%) of the monthly base salary corresponding to “Administrative Assistant 1,” as listed in the Judicial Branch’s position schedule pursuant to Ley del presupuesto ordinario de la República approved in the month of November preceding the date on which the traffic violation is committed, shall be imposed, without prejudice to related penalties:
ch) The driver who fails to comply with the provisions established in Articles 87, 88, and 89 of this Law concerning the use of vehicle lights.
(*) (By resolution N° 3945 of 21 de marzo de 2012, corrected by resolution N° 7425 of 06 de junio de 2012, the Constitutional Chamber annulled the preceding subsection in relation to Article 98, subsection b), item 1), of this Law, specifically with respect to “the fine imposed on a taxi driver for disregarding the stopping zones established by the Public Transportation Council.” In the same vein, the Chamber states that: “the amount of the fine applicable before the establishment of the fine amount annulled herein shall be deemed in force…,” which provides:
“A fine of twenty thousand colones shall be imposed…
ch) On the driver who provides public transportation services in any form without the respective authorizations, in violation of subsection a), item 1, or subsection b), item 1…” *See, in this regard, subsection ch) of Article 129 of version N° 9 of this Law, before the renumbering carried out by Ley N° 8696 of 17 de diciembre de 2008.)

II.On admissibility (admisibilidad). The third paragraph of Article 75 of Ley de Jurisdicción Constitucional authorizes the Defensoría de los Habitantes de la República to bring actions of unconstitutionality (acciones de inconstitucionalidad) directly, that is, without the need for a prior proceeding in which the respective claim of unconstitutionality was raised. Nevertheless, this broad standing (legitimación) does not exempt it from complying with the other requirements established by Ley de Jurisdicción Constitucional. In this particular case, the Chamber observes that the Defensoría broadly challenges the fines provided for in Articles 131, 132, and 133 of Ley de Tránsito 7331, on the ground that the State must take into account not only the circumstances relating to the minor or serious nature of the offense, in observance of the principles of reasonableness and proportionality, but also the offender’s financial means, indicating that one way of doing so would be to establish minimum and maximum fine parameters.
As may be seen from the preceding recital (considerando), Articles 131, 132, and 133 define various offenses in their respective subsections, some of which have already been examined by the Chamber. In some cases, the provisions have been declared unconstitutional; for example, the fines provided for under Articles 131, subsection k) (judgment 2011-6805), 132, subsection ñ) (judgment 2011-13393), 131, subsection b) (judgment 2012-129), 131, subsection a) (judgment 2012-3942), and 132, subsection n) (judgment 2012-3948), among others, were annulled. In other cases, the actions have been denied because, although the fine was substantial, the conduct being punished justified the penalty given its seriousness in relation to the protected legal interests (bienes jurídicos tutelados) (e.g., judgment 2011-16614). Given the lack of specificity in the pleading, the Chamber does not have all the information necessary to undertake the constitutional review, particularly because the Defensoría even challenges provisions that have already been declared unconstitutional.
Consequently, the action is summarily dismissed with respect to those provisions because its grounds are inadequate and insufficiently precise, in violation of Article 78 of Ley de Jurisdicción Constitucional. In all other respects, it is admissible.
III.- Merits. The Defensoría de los Habitantes considers that Article 71 bis, second paragraph, in relation to subsections c) and f) of Article 130; subsections g), i), and j) of Article 131; subsections f), g), h), and l) of Article 132; subsections c), d), e), g), and j) of Article 133; subsections a) and ch) of Article 136; and subsections c), ch), and e) of Article 134, all of the Public Roads Traffic Law, number 7331 of trece de abril de mil novecientos noventa y tres, as amended, are contrary to the principle of technical reasonableness (razonabilidad técnica), because they provide for points to be deducted from the driver’s license even though the conduct involved is attributable to the vehicle owner. In this regard, it should be noted that land transportation is a social and economic activity that facilitates the exercise of the right to freedom of movement and travel, as well as rights connected with economic freedom and private initiative relating to the provision of the public transportation service.
Its exercise places individuals’ fundamental rights at risk, including the rights to life, integrity, and safety, because of the danger inherent in travel by vehicle. It also affects collective rights such as the environment and the use of public space. For that reason, the legislature must regulate the exercise of the activity and establish rules and penalties for noncompliance as a means of guaranteeing order and protecting the rights and interests involved. The conduct penalized by the challenged provisions endangers traffic safety because it concerns reckless conduct committed by a vehicle’s driver or the operation of vehicles that do not meet the conditions required for safe travel without impairing legal interests of great importance, such as life and physical integrity. Both the vehicle owner, whether a natural or legal person, and the vehicle’s driver are required to know, comply with, and ensure compliance with the rules governing vehicle operation.
The responsibility borne by the vehicle owner or by the company in whose business the vehicle is used does not exempt the driver from the required due diligence (debida diligencia), particularly when operating vehicles used for public transportation service or vehicles that may pose a greater risk on the road, such as those transporting hazardous materials or cargo, trailers, tow trucks, etc. The driver may not excuse such conduct on the basis that the employment relationship could be affected when the conduct is manifestly dangerous or risky to physical integrity, life, and traffic safety. Thus, if such traffic violations were to result in harm to the life or physical integrity of third parties, the driver could even be held criminally liable for the result caused by the breach of the duty of care (deber de cuidado). For example, this would apply to a driver who, knowing that the bus being driven has brake problems, nevertheless begins providing service and an accident occurs that affects people’s physical integrity or lives; or to a driver who travels with an excessive number of passengers when this is determined to have caused an accident.
The legislature designed the loss of points from a driver’s license as a penalty for every driver who fails to comply with the prescribed rules, without distinction. That loss of points constitutes an ancillary penalty (sanción accesoria) to the fine, and its purpose is to encourage drivers to comply with traffic provisions. Nevertheless, this Chamber considers that a distinction must be drawn between conduct attributable to the driver and conduct outside the driver’s sphere of volition or action, such as obligations that must be fulfilled by the vehicle owner or the company that uses it in the course of its business. Accordingly, with regard to the conduct described in Article 71 bis, second paragraph, in relation to subsections g) and j) of Article 131; subsections f), g)—except for the conduct described in Article 125 of the Law, which is attributable to every driver—h), and l) of Article 132; subsections c), d), and g) of Article 133; and subsections ch) and e) of Article 134 of the same Law, points should be deducted from the driver’s license only when the vehicle’s driver is also its owner.
As the Defensoría de los Habitantes correctly notes, these are obligations imposed upon the owner, and a professional driver’s license should not be affected by them because the driver is subordinate to the employer. These include, for example, operating a vehicle without being current on the payment of circulation fees or mandatory vehicle insurance; driving a vehicle with license plates that do not correspond to it; driving a vehicle without rear reflectors; driving a vehicle without emergency exits; driving an altered or modified vehicle; driving a vehicle that lacks seat belts, white- or yellow-light projectors at the front, red-light projectors and brake lights at the rear, turn signals, hazard lights, a fire extinguisher, reflective triangles or an analogous safety device, a retroreflective vest, or a visible sign stating the number of passengers, the route name and number, and the authorized fare; improperly positioning the exhaust pipe; failing to display the required signs; driving without a windshield or with obstructed visibility; driving a limited-load vehicle (taxi carga) that exceeds the maximum permitted weight; etc. In the other challenged circumstances, the Court finds that the vehicle’s driver is responsible for compliance with the rules.
Examples include transporting hazardous materials in violation of the law; operating a tow truck without meeting statutory and regulatory requirements; driving a cargo vehicle that obstructs visibility; tampering with or failing to use the taximeter; failing to comply with authorized bus stops; charging higher fares; traveling with an excessive number of passengers; using unauthorized warning lights or rotating sirens; opening the doors while the vehicle is in motion; etc. An exception must be made for Article 134, subsection c), of the Traffic Law, which concerns the condition of private automobiles. In that case, the decisive issue would be to determine in each specific case whether the person is a professional driver subject to an employment relationship that exempts the driver from liability because of that subordinate status. It should also be added that, in every case, the citation (boleta de citación) must expressly inform the driver of the number of points being deducted from the driver’s license so that the driver may fully exercise the right of defense (derecho de defensa) before the competent authorities.
This is because, although the penalty is ancillary to the fine, it has its own social effects and, specifically, employment-related effects for persons who work as drivers. The principle of technical reasonableness requires an appropriate relationship between the objectives advanced by a law and the means it provides for achieving them. It seeks to ensure that rules adequately correspond to the obligations they impose and the purposes they pursue. It is therefore not unreasonable to impose the loss of points as a penalty upon a driver for driving in violation of the rules, on the terms set forth in this judgment and with the understanding that the driver must be properly informed and given an opportunity to present a defense. This is because, where a penalized driver believes that the conduct is not unlawful because it was justified or because a defense exempting the driver from liability (eximente de responsabilidad) applies, the driver must have an opportunity to raise that argument either through administrative proceedings before the Unidad de Impugnaciones del Consejo de Seguridad Vial or through judicial proceedings before the administrative litigation jurisdiction (jurisdicción contencioso administrativa).
IV.Conclusion. For the reasons stated above, the action is summarily dismissed with respect to the challenged Articles 130, 131, and 132. Regarding Article 71 bis, second paragraph, in relation to subsections g) and j) of Article 131; subsections f), g)—except for the conduct described in Article 125 of the Law, which is attributable to every driver—h), and l) of Article 132; subsections c), d), and g) of Article 133; and subsections ch) and e) of Article 134, the Chamber finds that they are not unconstitutional, provided that the penalized driver is also the vehicle’s registered owner. Regarding the remaining challenged provisions, the action is denied. In every case in which points are deducted from a driver’s license, the citation must inform the driver of the number of points deducted so that the driver may fully exercise the right of defense before the competent authorities.
Por tanto:
The action is summarily dismissed with respect to the fine prescribed in Articles 130, 131, and 132 of the Public Roads Traffic Law, number 7331 of trece de abril de mil novecientos noventa y tres, as amended. Regarding Article 71 bis, second paragraph, in relation to subsections g) and j) of Article 131; subsections f), g), h), and l) of Article 132; subsections c), d), and g) of Article 133; and subsections ch) and e) of Article 134 of the same Law, the action is denied, provided that the penalized driver is also the vehicle’s registered owner. In all other respects, the action is denied. In every case in which points are deducted from a driver’s license, the citation must inform the driver of the number of points deducted so that the driver may fully exercise the right of defense before the competent authorities. Notice shall be given.

Acción de inconstitucionalidad promovida por Luis Gerardo Fallas Acosta, mayor, abogado, cédula de identidad número 1-753-259, vecino de Tabarcia de Mora, en su condición de Defensor Adjunto de los Habitantes de la República contra los artículos 71 bis, párrafo segundo en relación con los incisos c) y f) del artículo 130; incisos g), i), j) del artículo 131; los incisos f), g) h) y l) del artículo 132, los incisos c), d), e), g) y j) del artículo 133, los incisos a) y ch) del artículo 136; los incisos c), ch) y e) del artículo 134 y artículos 130, 131 y 132; todos de la Ley de Tránsito por Vías Públicas Terrestres, número 7331 del trece de abril de mil novecientos noventa y tres y sus reformas. Intervinieron también en el proceso Ana Lorena Brenes Esquivel, Procuradora General de la República, Luis Llach Cordero, en su condición de Ministro de Obras Públicas y Transportes y Flor Madriz Molina, en su condición de Directora Ejecutiva a.i. del Consejo de Seguridad Vial.
Resultando:
El número de puntos asignado inicialmente, se verá reducido o descontado en forma automática, en cualquiera de los siguientes supuestos :
a) …
Los puntos serán descontados en el expediente del conductor en forma automática, una vez que sea firme la imposición de la sanción, en vía administrativa o jurisdiccional y quedará constancia del saldo final de puntos.” Lo subrayado no es del original.
Por su parte, el artículo 130, incisos c) y f), disponen:
“ARTÍCULO 130 .- Se impondrá una multa de un salario base mensual correspondiente al “Auxiliar administrativo 1 ” que aparece en la relación de puestos del Poder Judicial, de conformidad con la Ley del presupuesto ordinario de la República, aprobada en el mes de noviembre anterior a la fecha en que se cometa la infracción de tránsito, sin perjuicio de las sanciones conexas:
a) …
Y a su vez, el artículo 102, señala “ARTÍCULO 102 .- Los vehículos automotores, remolques y semirremolques que transporten materiales peligrosos o explosivos deberán cumplir las normas siguientes:
Por ello, es totalmente razonable que, además de las multas, se haya establecido un sistema de pérdida de puntos de la licencia para sancionar, de manera proporcional a la gravedad de la falta, las infracciones a la Ley de Tránsito. Ahora bien, en el caso del transporte remunerado de personas, en sus distintas modalidades, téngase en cuenta que se trata de un servicio público cuya titularidad corresponde al Estado quien, no obstante, la puede delegar en los particulares. El interés público involucrado en este servicio, es más que obvio por lo que solo se debe permitir que lo brinden las personas o empresas debidamente autorizadas. En ese sentido, si un chofer de bus o de taxi es consciente de que el vehículo que conduce no está autorizado para brindar el servicio público de transporte remunerado de personas, debe de abstenerse de brindarlo, pues ante un eventual accidente, los usuarios o demás personas que resulten afectados no tendrían la protección que el ordenamiento jurídico exige para estos casos.
Por su parte, el transporte de materiales peligros, por su misma naturaleza, exige el cumplimiento estricto de los permisos y de las condiciones mecánicas necesarias para la seguridad del automotor y, por supuesto, del mismo chofer, demás conductores y peatones. Sería irresponsable que un chofer conduzca un vehículo de este tipo, sin contar, por ejemplo, con la revisión técnica semestral que acredite el debido cumplimiento de las condiciones de seguridad necesarias. Y lo mismo ocurre en caso de que no se porte el permiso correspondiente o el circular en horarios y rutas no autorizadas. En tales casos, el peligro al que se expondría a los habitantes justifica de suyo las sanciones dispuestas en la Ley de Tránsito en contra de los conductores. Por consiguiente, en criterio de la Procuraduría no incurre en las violaciones constitucionales que alega el accionante. 2. De la alegada inconstitucionalidad del párrafo segundo del artículo 71 bis en relación con lo dispuesto en el artículo 131, incisos g), i), y j) de la Ley de Tránsito.
Las normas en cuestión, en lo que interesa, disponen: “ ARTÍCULO 71 bis .- … El número de puntos asignado inicialmente, se verá reducido o descontado en forma automática, en cualquiera de los siguientes supuestos :
a) …
Por su parte, el artículo 131, incisos g), i) y j) disponen:
“ARTÍCULO 131 .- Se impondrá una multa de un setenta y cinco por ciento (75%) de un salario base mensual correspondiente al “Auxiliar administrativo 1”, que aparece en la relación de puestos del Poder Judicial, de conformidad con la Ley del presupuesto ordinario de la República, aprobada en el mes de noviembre anterior a la fecha en que se cometa la infracción de tránsito, sin perjuicio de las sanciones conexas :
a) …
Y el artículo 100 en cuestión, dispone:
“ARTÍCULO 100 .- Para los vehículos que presten el transporte o acarreo de vehículos mediante la modalidad grúa, rigen las siguientes disposiciones especiales:
ch ) Deben portar las luces y los accesorios estipulados en esta Ley y en su Reglamento; además, una torre giratoria a trescientos sesenta (360) grados, con luz de color ámbar que cubra una distancia de ciento cincuenta (150) metros y dos (2) faros buscadores, los cuales se utilizarán cuando el vehículo esté parado y puedan orientarse de manera que el haz de luz no afecte a otros conductores en circulación. Estos accesorios solo se podrán utilizar cuando se realice el servicio de grúa.
En cuanto a la razonabilidad de la pérdida de puntos téngase en cuenta lo indicado al efecto en el apartado anterior. Y al igual que las conductas ya analizadas, en consideración de la Procuraduría las normas en cuestión, en cuanto sancionan a los conductores, no resultan irrazonables. Conforme se puede apreciar, las conductas prohibidas están dirigidas a los conductores (choferes) y no a los propietarios de los vehículos. Ahora bien, por la gravedad que su incumplimiento podría ocasionar, estima la Procuraduría que resulta razonable y conforme con el Derecho de la Constitución que la multa y la sanción con pérdida de 20 puntos de la licencia se haga recaer en los choferes. El conducir un vehículo que no ha pagado los derechos de circulación o el seguro obligatorio de vehículos es sumamente grave pues, ante un eventual accidente, dejaría sin protección a quienes se vean afectados. Por consiguiente, no existe justificación alguna para un chofer que conduzca un vehículo en tales circunstancias.
Y lo mismo cabe decir del hecho de conducir un automotor con placas que no le corresponden. Ante un eventual accidente, ¿quién se haría responsable de los daños y perjuicios que ocasione a terceros? Por la gravedad de la falta, es razonable que se sancione al chofer infractor. En cuanto a la conducción de vehículos tipo grúa, por tratarse de un servicio especial, deben contar con la autorización correspondiente por parte del Consejo de Transporte Público, brindar el servicio en la zona autorizada, cobrar las tarifas estipuladas, llevar el libro de registro de actividades correspondiente y portar las placas específicas para este tipo de actividad. Además, los vehículos que se dediquen a esta actividad deben portar las luces y los accesorios estipulados para este tipo de vehículos. Ahora bien, el hecho de no cumplir las exigencias apuntadas, en su mayoría atañe también al conductor y no solo al propietario del automotor.
En ese sentido, es razonable que la sanción por su infracción recaiga también en los choferes. 3. De la alegada inconstitucionalidad del párrafo segundo del artículo 71 bis en relación con lo dispuesto en el artículo 132, incisos f), g), h) y l) de la Ley de Tránsito. Las normas en cuestión, en lo que interesa, disponen:
“ ARTÍCULO 71 bis .- …
El número de puntos asignado inicialmente, se verá reducido o descontado en forma automática, en cualquiera de los siguientes supuestos :
a) …
“ARTÍCULO 132 .-Se impondrá una multa del cincuenta por ciento (50%) del salario base mensual , correspondiente al “Auxiliar administrativo 1” que aparece en la relación de puestos del Poder Judicial, de conformidad con la Ley del presupuesto ordinario de la República, aprobada en el mes de noviembre anterior a la fecha en que se comete la infracción de tránsito, sin perjuicio de las sanciones conexas:
a) …
Y el artículo 32, en los acápites mencionados, dispone:
“ARTÍCULO 32 .- Todos los vehículos con motor o sin él, de propiedad privada o pública, que se autoricen para circular conforme al artículo 1 de la presente Ley, deberán cumplir, obligatoriamente, los siguientes requisitos referentes a los dispositivos de seguridad activa y pasiva, así como todas las medidas de seguridad:
a) …
Además de los requisitos contenidos en el inciso 1) de este artículo, que le sean acordes según su naturaleza constructiva, los vehículos de carga, los remolques y semirremolques deberán cumplir lo siguiente:
Además de los requisitos contenidos en el inciso 1) de este artículo, que le sean acordes según su naturaleza constructiva, los vehículos de transporte público de personas deberán cumplir lo siguiente:
En el caso particular de las conductas prohibidas en las normas indicadas en este apartado, se sanciona con multa y la pérdida de 15 puntos de la licencia a quien circule un vehículo de carga sin los dispositivos reflectantes; al conductor de un autobús que no cuente con salida de emergencia de fácil acceso, independiente de las puertas de entrada y salida del autobús; a quien conduzca un vehículo que se encuentre alterado o modificado en el motor, o en los sistemas de inyección o carburación, o los sistemas de control de emisiones; y a quien conduzca un vehículo que sin justificación alguna no porte las placas reglamentarias. En consideración de la Procuraduría, las normas en cuestión no son inconstitucionales per se, pues en muchos de los casos el conductor es a la vez el propietario del vehículo. Sin embargo, tampoco considera admisible eximir de responsabilidad al conductor de un camión que no cuente con los dispositivos reflectantes requeridos, debido a la importancia que tales dispositivos tienen para la seguridad vial y por cuanto su costo no es significativo.
Tampoco se considera admisible el eximir de responsabilidad al conductor de un vehículo alterado o modificado en el motor, o en los sistemas de inyección o carburación, o en los sistemas de control de emisiones, pues podría resultar peligroso para el normal funcionamiento del automotor. En tales condiciones, lo procedente es que el chofer se abstenga de conducir un vehículo en tales condiciones. Y lo mismo cabría señalar de la conducción de un vehículo que, sin justificación, no porte las placas reglamentarias. El chofer, como responsable de la conducción de un vehículo, debe velar porque el automotor cumpla con las condiciones mínimas necesarias y que porte los documentos y dispositivos que acrediten su derecho a circular. Por ello, por esta conducta tampoco cabría eximir al chofer de la responsabilidad y sanciones que le imputa la normativa en comentario. La única conducta en la que Procuraduría sí considera procedente el eximir de responsabilidad, es al chofer de autobús que no cuente con la salida de emergencia.
Resulta obvio que el cumplimiento de dicha exigencia no podría ser imputable al chofer. Sin embargo, en este caso la multa correspondiente debe recaer en el propietario del automotor. Recuérdese que de conformidad con lo dispuesto en los artículos 150 y 153 de la Ley de Tránsito, las multas pueden anotarse tanto en el asiento de la licencia de conducir del infractor, así como en el número de placa del vehículo con el cual se incurrió en la infracción de tránsito, a efecto de que el cobro se realice a través del ente recaudador del seguro obligatorio automotor. 4.- De la alegada Inconstitucionalidad del párrafo segundo del artículo 71 bis en relación con lo dispuesto en los artículos 133, incisos c), d), e), g) y j) y 136 incisos a) y ch ) de la Ley de Tránsito. Las normas en cuestión, en lo que interesa, disponen:
“ ARTÍCULO 71 bis .- …
El número de puntos asignado inicialmente, se verá reducido o descontado en forma automática, en cualquiera de los siguientes supuestos :
a) …
a)…
“ARTÍCULO 136 .- Se impondrá una multa de un diez por ciento (10%) de un salario base mensual , correspondiente al “Auxiliar administrativo 1” que aparece en la relación de puestos del Poder Judicial, de conformidad con la Ley de presupuesto ordinario de la República, aprobada en el mes de noviembre anterior a la fecha en que se cometa la infracción de tránsito, sin perjuicio de las sanciones conexas (como por ejemplo la pérdida de 25 puntos de la Licencia de conducir):
ch ) A quien utilice sirenas o señales rotativas luminosas , sin cumplir con lo dispuesto en el artículo 33 de esta Ley. (…)”. Lo subrayado no es del original.
Por su parte, los referidos artículos 32, 99, 101 y 114 de la Ley de Tránsito, por su orden, disponen:
“ARTÍCULO 32 .- Todos los vehículos con motor o sin él, de propiedad privada o pública, que se autoricen para circular conforme al artículo 1 de la presente Ley, deberán cumplir, obligatoriamente, los siguientes requisitos referentes a los dispositivos de seguridad activa y pasiva, así como todas las medidas de seguridad: 1 ) Requisitos generales para la circulación de todos los automotores : a) … d) Todos los vehículos, en general, deberán contar con cinturones de seguridad de tres puntos , en todos los asientos laterales; en los restantes deberán tener cinturones subabdominales , con excepción de las motocicletas, motobicicletas, bicimotos, triciclos, cuadraciclos , y otros ciclomotores, salvo que, en este último caso, se les adapte un dispositivo tipo sidecar, donde el pasajero deberá contar con el cinturón correspondiente. Se exceptúan, además, los autobuses de transporte interurbano, los autobuses, las busetas y los microbuses autorizados para el servicio de transporte remunerado de personas, con la salvedad indicada en el inciso 6) apartado e) de este artículo. e)Tener colocados espejos retrovisores o cualquier otro dispositivo que cumpla la función de permitirle al conductor, desde su asiento, observar la vía que queda atrás y a los lados de su vehículo, así como al frente o detrás de su vehículo, cuando sea necesario.
Los espejos retrovisores, sus soportes y sus dispositivos de fijación, no deberán presentar, hacia delante, puntas, bordes agudos ni formas peligrosas . … h ) En la parte trasera, deberán portar dos dispositivos proyectores de luz roja, que permanezcan encendidos al poner en funcionamiento la luz alta o la baja, con una sección que dé una luz roja más intensa, al aplicar los frenos. Asimismo, los vehículos de pasajeros deberán portar un tercer dispositivo de luz roja, que se accione igualmente con los frenos en forma automática, ubicado dentro del vehículo o fuera de él y a la altura de los asientos traseros, centrado en relación con el parabrisas trasero, salvo que, de fábrica, dicho dispositivo haya sido posicionado en otro lugar. De esta obligación se exceptúan los vehículos de carga liviana. i)Portar al menos dos (2) luces direccionales , en ambos extremos de las partes trasera y delantera.
Contar con un (1 ) sistema de luz, que se encienda independientemente a las luces principales, en los casos de emergencia. … l)Estar provistos de por lo menos un (1) extintor de incendios , en perfecto estado de funcionamiento. … r)Estar equipado con frenos capaces de moderar y detener el movimiento del vehículo de un modo seguro, rápido y eficaz ; así como, con un freno de estacionamiento o de seguridad, que se utilizará cuando se estacione o en cualquier emergencia. El freno de estacionamiento deberá mantener el vehículo inmóvil, cualesquiera que sean las condiciones de carga en una pendiente, ascendente o descendente, del dieciocho por ciento (18%). s) Todo vehículo de motor que utilice un sistema de aire comprimido para el funcionamiento de sus propios frenos o de los frenos de cualquier vehículo remolque o semirremolque adherido a él, deberá estar provisto de una señal de advertencia visible y sonora, ubicada en el panel de instrumentos del habitáculo del conductor del vehículo tractor, que entre en funcionamiento, si el depósito de aire se encuentra por debajo del cincuenta por ciento (50%) de la presión dada por el regulador del compresor.
Un sistema de advertencia similar deberán tener los vehículos que utilicen vacío para el sistema de frenos. t) La carrocería ubicada delante del parabrisas no deberá soportar hacia adelante elementos que técnicamente no sean indispensables; tampoco elementos puntiagudos, cortantes ni que constituyan un ángulo vivo o una protuberancia peligrosa. Asimismo, los parachoques no deberán presentar protuberancias peligrosas y sus extremos laterales deberán ser dirigidos hacia la carrocería. … 6) Los vehículos de transporte público de personas: Además de los requisitos contenidos en el inciso 1) de este artículo, que le sean acordes según su naturaleza constructiva, los vehículos de transporte público de personas deberán cumplir lo siguiente: a)… b) Todo autobús dedicado al servicio del transporte público de personas debe llevar un cartel visible, autorizado por el Consejo de Transporte Público, en el que se indique, claramente, el número de pasajeros que puedan viajar en él, el nombre y el número de la ruta, así como la tarifa autorizada . … f) Los propietarios de los vehículos para transporte público de personas (autobuses, busetas y microbuses) deberán ubicar la salida del tubo de escape de esos vehículos según el Reglamento que establezca el Poder Ejecutivo, siempre que no contravenga las especificaciones técnicas del fabricante.
(…).” Lo subrayado no es del original. “ARTÍCULO 99 .- Los vehículos de transporte de carga limitada se rigen por las siguientes disposiciones especiales: a) … c) Deben tener vigente un seguro especial del Instituto Nacional de Seguros , cuyo monto será determinado por esta Institución, con base en estudios técnicos, reales y actuariales. (…)”. Lo subrayado no es del original. “ARTÍCULO 101 .- Los conductores de vehículos de carga liviana y de carga pesada deben acatar las siguientes regulaciones: a) … j) Los vehículos de carga liviana y pesada deberán portar la Tarjeta de pesos y dimensiones, extendida por el órgano competente del MOPT, conforme se establezca reglamentariamente. (…).” “ARTÍCULO 114 .- Prohíbese conducir un vehículo automotor que tenga puesto, en el parabrisas delantero o trasero, algún rótulo, cartel, calcomanía u otro material opaco, que obstruya al conductor la visibilidad de la vía y sus alrededores.
De esta situación se exceptúa el hecho de portar el marchamo y la calcomanía de revisión técnica. En el caso de las ventanillas laterales, podrá utilizarse un material opaco o polarizado que permita la visibilidad hacia adentro o hacia afuera de no menos de un setenta (70%) por ciento. Todo lo anterior sin perjuicio de lo dispuesto por el Consejo de Transporte Público, en relación con la rotulación e información al usuario que deberán portar las unidades de transporte remunerado de personas y de transporte de estudiantes.” Al igual que en el caso de las conductas ya estudiadas, no cabría eximir de responsabilidad a los choferes de vehículos que incurran en conductas tales como conducir un vehículo que no cuente con cinturones de seguridad, o que no tenga en funcionamiento las luces rojas traseras, o los frenos en buen estado, o que no cuente con el parabrisas correspondiente o tenga la visibilidad obstruida.
El incumplimiento de tales condiciones podrían impedir una conducción segura o propiciar distracciones indebidas y, en consecuencia, los choferes se deben abstener de conducir el automotor correspondiente. Igualmente, resultaría inadmisible el eximir de las responsabilidades y sanciones que establece la normativa en comentario a los choferes de taxi que se nieguen a utilizar el taxímetro correspondiente, pues ello implicaría una prestación deficiente del servicio en perjuicio del usuario. No obstante, otras conductas, tales como la rotulación de la ruta en las unidades de transporte público, así como el deber de ubicar el tubo de escape de los vehículos en lugar que establezca el Reglamento respectivo, si recaen bajo la órbita de responsabilidad de los propietarios. Pero incluso en estos casos, la normativa en cuestión no resulta inconstitucional. Simple y sencillamente la multa se debe hacer recaer en el propietario del automotor. 5.- De la alegada Inconstitucionalidad del párrafo segundo del artículo 71 bis en relación con lo dispuesto en el artículo 134, incisos ch ) y e) de la Ley de Tránsito.
Las normas en cuestión, en lo que interesa, disponen: “ ARTÍCULO 71 bis .- … El número de puntos asignado inicialmente, se verá reducido o descontado en forma automática, en cualquiera de los siguientes supuestos : a) … f) Cinco (5) puntos, por la comisión de alguna de las conductas detalladas en los incisos … c), ch ) y e) del artículo 134 de la presente Ley.” Lo subrayado no es del original- “ARTÍCULO 134 .- Se impondrá una multa de un treinta por ciento (30%) de un salario base mensual correspondiente al “Auxiliar administrativo 1” que aparece en la relación de puestos del Poder Judicial, de conformidad con la Ley del presupuesto ordinario de la República, aprobada en el mes de noviembre anterior a la fecha en que se cometa la infracción de tránsito, sin perjuicio de las sanciones conexas (como por ejemplo la pérdida de 5 puntos de la Licencia de conducir): a) … c) Al conductor de un automóvil que incumpla cualquiera de las disposiciones, generales y especiales, que le sean aplicables, establecidas en el artículo 32 de esta Ley, siempre que dicho incumplimiento no haya sido sancionado en otra norma de la presente Ley. ch ) Al conductor de un vehículo de transporte público, de cualquier modalidad, que preste servicio sin que reúna alguna de las condiciones establecidas en el artículo 109 y en el inciso 1), apartados a), b), g), j), k), n), p) y q), así como en el inciso 6), apartados d) e i) del artículo 32 de esta Ley. …” Al igual que se ha indicado en el caso de las conductas impugnadas anteriormente, solo cabría eximir de responsabilidad y de las sanciones que establece la normativa en cuestión a los choferes cuando las conductas recaigan exclusivamente bajo la órbita de responsabilidad de los propietarios.
Pero incluso en estos casos, la normativa en cuestión no resulta inconstitucional; simple y sencillamente la multa se debe hacer recaer en el propietario del automotor. B) Sobre la proporcionalidad de las multas contenidas en los artículos 130, 131 y 132 de la Ley de Tránsito. A pesar de la reiterada jurisprudencia emanada de la Sala Constitucional en esta materia, que ha anulado varias disposiciones de la Ley de Tránsito por considerar que el monto de las multas dispuesto en diferentes normas resulta violatorio de los principios constitucionales de razonabilidad y proporcionalidad, entre otras, las sentencias n.° 6805-2011, de las 10:30 horas del 27 de mayo del 2011, que anuló el artículo 131, inciso k), de la Ley de Tránsito -cinturón de seguridad; n.º 2011-13393, de las 14:30 horas del 5 de octubre del 2011, que declaró la inconstitucionalidad del artículo 132, inciso ñ) –revisión técnica-; n.° 2012-129, de las 14:30 horas del 11 de enero del 2012, que declaró inconstitucional el artículo 131,inciso b) –límites de velocidad-; n.º 2012-3942, de las 16:22 horas del 21 de marzo del 2912, que declaró la inconstitucionalidad del artículo 131, inciso a) –conducir en exceso de velocidad- ; n.º 2012-3947, de las 16:27, horas del 21 de marzo del 2912, que declaró la inconstitucionalidad del artículo 134, inciso c) –no portar chaleco reflectivo - ; n.º 2012-3948, de las 16:28 horas del 21 de marzo del 2012, que declaró inconstitucional el artículo 132, inciso n) –interceptar el paso de otros vehículos-; n.º 2012-3950 , de las 16:30 horas del 21 de marzo del 2012, que declaró la inconstitucionalidad del artículo 134, inciso c) –no contar con extintor de incendios-; y n.° 2012-5250, del 25 de abril del 2012, del 25 de abril de 2012, que declaró la inconstitucionalidad del artículo 131, inciso ch ) –no respetar la luz roja del semáforo-, en consideración de la Procuraduría el monto de las multas establecido en las normas impugnadas no resulta irracional o desproporcionado.
La misma Sala Constitucional, en la sentencia n.° 2011- 16614, del 2 de diciembre de 2011, dictada en un recurso de amparo, sostuvo que era razonable y proporcionada la multa de más de trescientos mil colones por conducir sin licencia o permiso, por considerarla una falta grave. Ello evidencia que para efectos de resolver el caso, debe analizarse la gravedad o no de cada una de las faltas que se establecen en las normas impugnadas. En todo caso, debe tenerse en cuenta que no se trata de multas por un monto fijo, sino que se actualizan anualmente. Y en su determinación inicial, la Asamblea Legislativa tuvo en consideración los estudios técnicos realizados por el Ministerio de Obras Públicas y Transportes que la justifican. Téngase en cuenta, además, que por muchos años, la crítica general era de que las multas eran muy bajas y que por ello no se respetaban las normas de tránsito, lo cual motivó en parte, su variación.
Finalmente, en consideración de la Procuraduría el valorar los aspectos técnicos considerados por la Administración y el legislador para establecer el monto de las multas por la infracción a las normas de tránsito, es un asunto que tiene que ver más con el control de legalidad o el debate de criterios técnicos, lo que se encuentra en manos de las instancias administrativas correspondientes y, en última instancia, de los tribunales ordinarios. En conclusión, la Procuraduría recomienda declarar sin lugar la acción de inconstitucionalidad, pues no se aprecia roce de constitucionalidad alguno en la normativa cuestionada o, en su defecto, declararla parcialmente con lugar únicamente en el caso de aquellas conductas prohibidas en la normativa en cuestión, que recaigan expresamente bajo la órbita de responsabilidad de los propietarios de los automotores, en cuyo caso la sanción económica no debe hacerse recaer sobre los choferes dependientes, sino en los propietarios.

Redacta la Magistrada Calzada Miranda; y,
Considerando:
I.Objeto de la acción. La Defensoría de los Habitantes cuestiona dos aspectos en esta acción de inconstitucionalidad. Primero, lo dispuesto en los artículos 71 bis, párrafo segundo en relación con los incisos c) y f) del artículo 130; g), i), j) del artículo 131; f), g) h) y l) del artículo 132; c), d), e), g) y j) del artículo 133; a) y ch) del artículo 136; c), ch) y e) del artículo 134, todos de la Ley de Tránsito por Vías Públicas Terrestres, número 7331 del trece de abril de mil novecientos noventa y tres y sus reformas, por considerar que vulnera el principio de razonabilidad técnica, al disponerse la reducción de los puntos de la licencia del conductor, por conductas que según el accionante, son atribuibles al propietario del vehículo y no al conductor. Dichas normas señalan:
ARTÍCULO 71 bis .- En el momento de expedirse una licencia, se le asignará, a cada conductor, un total de cincuenta (50) puntos, con el fin de establecer, en lo sucesivo, un mecanismo de control de su desempeño; lo anterior, para determinar las sanciones correspondientes, de constatarse deficiencias derivadas de las infracciones a esta Ley, así como para la ejecución de medidas correctivas dirigidas a la enmienda de su comportamiento y que tiendan a fomentar conductas que fortalezcan la seguridad vial.
El número de puntos asignado inicialmente, se verá reducido o descontado en forma automática, en cualquiera de los siguientes supuestos:

c)Veinte (20) puntos, por la comisión de alguna de las conductas detalladas en los incisos a), e), f), g), i), j), k) y l) del artículo 131 y en el inciso o) del artículo 132 de la presente Ley.
d)Quince (15) puntos, por la comisión de alguna de las conductas detalladas en los incisos a), b), c), ch), d), e), f), g), h,), i), j), k), l), m), n) y ñ) del artículo 132 de la presente Ley.
e)Diez (10) puntos, por la comisión de alguna de las conductas detalladas en los incisos b) y c) del artículo 131, en los incisos a), b), c), ch), d), e), f), g), h), i) y j) del artículo 133 y en los incisos a), b) y ch) del artículo 136 de la presente Ley.
Los puntos serán descontados en el expediente del conductor en forma automática, una vez que sea firme la imposición de la sanción, en vía administrativa o jurisdiccional y quedará constancia del saldo final de puntos.
En el caso de los aprendices de conductor o de aquellos que conduzcan sin estar debidamente acreditados o con la licencia suspendida, si incurren en alguna de las conductas señaladas como infracción a la presente Ley y es objeto de deducción de puntaje, se aplicará la deducción correspondiente en el momento de la expedición de la licencia de conducir.
Si la boleta de citación que motivó la cancelación de la acreditación por la pérdida de la totalidad de los puntos asignados y/o disponibles no fue impugnada, el Cosevi le comunicará esa consecuencia al interesado, en el lugar que debió indicar para recibir notificaciones en el momento de haber sido levantada la boleta y que se incorporará en el expediente del conductor. De no haberlo indicado, se tendrá por notificado en el transcurso de veinticuatro (24) horas después de dictada la resolución correspondiente. Esa comunicación será meramente informativa y no tendrá recurso alguno en vía administrativa.
El Cosevi adoptará las medidas oportunas para facilitarles, a los titulares de licencias, el acceso a su saldo de puntos, mediante la existencia de un expediente por cada conductor autorizado para la operación de los vehículos automotores definidos en esta Ley, en el que se contabilizarán los puntos de manera precisa y actualizada; todo lo anterior sin perjuicio de las sanciones penales o civiles que puedan ser aplicables a las sanciones descritas en este artículo.” (Así adicionado por el inciso e) del artículo 2° de la ley N° 8696 de 17 de diciembre de 2008. Dicho artículo 2° fue derogado posteriormente por el artículo 251 de la Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial N° 9078 de 4 de octubre de 2012) “ ARTÍCULO 130.- Se impondrá una multa de un salario base mensual correspondiente al “Auxiliar administrativo 1” que aparece en la relación de puestos del Poder Judicial, de conformidad con la Ley del presupuesto ordinario de la República, aprobada en el mes de noviembre anterior a la fecha en que se cometa la infracción de tránsito, sin perjuicio de las sanciones conexas: […]

ch) Al conductor de un vehículo de transporte público, de cualquier modalidad, que preste servicio sin que reúna alguna de las condiciones establecidas en el artículo 109 y en el inciso 1), apartados a), b), g), j), k), n), p) y q), así como en el inciso 6), apartados d) e i) del artículo 32 de esta Ley. […]
ARTÍCULO 136.- Se impondrá una multa de un diez por ciento (10%) de un salario base mensual, correspondiente al “Auxiliar administrativo 1” que aparece en la relación de puestos del Poder Judicial, de conformidad con la Ley de presupuesto ordinario de la República, aprobada en el mes de noviembre anterior a la fecha en que se cometa la infracción de tránsito, sin perjuicio de las sanciones conexas:
ch) A quien utilice sirenas o señales rotativas luminosas, sin cumplir con lo dispuesto en el artículo 33 de esta Ley.” Como segundo aspecto la Defensoría considera vulnerado el parámetro de proporcionalidad en las multas previstas en el párrafo primero de los numerales 130, 131 y 132 de la Ley de Tránsito referida. Señala que el Estado necesariamente debe tomar en cuenta no solo las condiciones relativas a la levedad o gravedad de la falta, respetando los principios de razonabilidad y proporcionalidad, sino también la capacidad económica del infractor. Refiere que el bloque de constitucionalidad le impone al legislador –a la hora de imponer multas y sanciones- el deber de garantizar una justa y equitativa proporción entre el quantum de la sanción y las condiciones económicas del sancionado, amén de una justa proporción con las circunstancias de modo, tiempo y lugar de los hechos atribuidos. Aduce que la referencia para imponer una multa debe ser la capacidad económica de la población de menores ingresos; en consecuencia, al establecerse en las normas impugnadas un salario que no responde al mínimo legal fijado y siendo que su aplicación porcentual podría atentar contra la subsistencia mínima vital de los habitantes, considera que revisten vicios absolutos de inconstitucionalidad. Las normas que cuestiona en cuanto a este aspecto son las siguientes:
“ARTÍCULO 130.- Se impondrá una multa de un salario base mensual correspondiente al “Auxiliar administrativo 1” que aparece en la relación de puestos del Poder Judicial, de conformidad con la Ley del presupuesto ordinario de la República, aprobada en el mes de noviembre anterior a la fecha en que se cometa la infracción de tránsito, sin perjuicio de las sanciones conexas:
ch) A quien conduzca con la licencia suspendida por las causales señaladas en esta Ley.
(*) (La Sala Constitucional mediante resolución N° 3942 del 21 de marzo de 2012, anuló el inciso anterior “en relación con lo dispuesto en el artículo 108 de la misma Ley”. En el mismo sentido indica la Sala que: “se tiene por vigente el monto de la multa que se aplicaba antes del establecimiento del monto de multa que aquí se anula…”, b) (*) A quien irrespete las señales de tránsito fijas, incluso los límites de velocidad o las indicaciones de la autoridad de tránsito, en contravención de los artículos 79, 83 y 116 de esta Ley, normas que establecen los deberes de acatar las indicaciones verbales o escritas de las autoridades de tránsito, el señalamiento vertical y horizontal, incluso el que comprende los límites de velocidad; la prohibición de pasar sobre las islas canalizadoras o de adelantar por el carril izquierdo de la carretera demarcada con línea continua en el centro. Se exceptúan los casos considerados en el artículo 107 y en los incisos ch) y d) del artículo 83 de esta Ley, que se resolverán de acuerdo con lo que determinan dichos numerales.
(*) (La Sala Constitucional mediante resoluciones N° 00129-12 del 11 de enero de 2012, N° 05249-12 del 25 de abril de 2012, N° 06876-12 del 23 de mayo de 2012, N° 09203-12, N° 09204-12 ambas del 04 de julio de 2012 y N° 00091-13 del 09 de enero de 2013 , anuló de este inciso el monto de la multa establecido en el encabezado de este artículo, “…en la parte que se dirige a sancionar la infracción a las señales de tránsito fijas que establecen límites de velocidad”; en la parte que se dirige a sancionar “…a quién irrespete la señal fija de solo viraje a la derecha.”; “ para quien irrespete las señales de tránsito que indiquen carril exclusivo para buses.”; “…a quien irrespete la señal fija de prohibición de viraje a la derecha.”; “al conductor que estacione su vehículo en zona prohibida.” y “ para quien irrespete la prohibición de pasar por una isla canalizadora.” En el mismo sentido, indica la Sala en dichas resoluciones que: “se tiene por vigente el monto de la multa que se aplicaba antes del establecimiento del monto de multa que aquí se anula”, misma que dispone que:
“Se impondrá una multa de cinco mil colones, sin perjuicio de la imposición de sanciones conexas:
“g) A quien irrespete las señales de tránsito fijas, incluyendo los límites de velocidad…” *Ver en este sentido el inciso g) del artículo 131 de la versión N° 9 de esta ley, antes de la reforma hecha por Ley N° 8696 del 17 de diciembre de 2008.)
ch ) (*) Al conductor que irrespete la señal de alto de la luz roja de un semáforo, excepto cuando vire a la derecha, según lo estipulado en el inciso a) del artículo 90 de esta Ley.
(*) ( La Sala Constitucional mediante resolución N° 5250 del 25 de abril de 2012, anuló este inciso. En el mismo sentido indica la Sala que: “se tiene por vigente el monto de la multa que se aplicaba antes del establecimiento del monto de multa que aquí se anula…”, misma que dispone que:
“Se impondrá una multa de diez mil colones…a) Al conductor que irrespete la señal de alto de la luz roja de un semáforo, excepto cuando vire a la derecha…” * Ver en este sentido el inciso a) del artículo 130 de la versión N° 9 de esta Ley, antes del corre de numeración hecho por la Ley N ° 8696 del 17 de diciembre de 2008.)
(*) ( La Sala Constitucional mediante resolución N° 6805 del 27 de mayo de 2011, declaro inconstitucional este inciso “…en cuanto a la multa que se impone por el no uso del cinturón de seguridad”. No indica la Sala si se restablece el monto de la multa anterior.)
(La reformada practicada por el inciso p) del artículo 1° de la ley N° 8696 de 17 de diciembre de 2008, fue derogada posteriormente por el artículo 251 de la Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial N° 9078 de 4 de octubre de 2012) (Así corrida su numeración por el inciso a) del artículo 2° de la ley N° 8696 de 17 de diciembre de 2008, que lo traspasó del artículo 130 al 131 . Dicho artículo 2° fue derogado posteriormente por el artículo 251 de la Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial N° 9078 de 4 de octubre de 2012) ARTÍCULO 132 .- Se impondrá una multa del cincuenta por ciento (50%) del salario base mensual, correspondiente al “Auxiliar administrativo 1” que aparece en la relación de puestos del Poder Judicial, de conformidad con la Ley del presupuesto ordinario de la República, aprobada en el mes de noviembre anterior a la fecha en que se comete la infracción de tránsito, sin perjuicio de las sanciones conexas:
ch) Al conductor que incumpla las disposiciones establecidas en los artículos 87, 88 y 89 de esta Ley, en relación con el uso de las luces del vehículo.
(*) (La Sala Constitucional mediante resolución N° 3945 del 21 de marzo de 2012, corregida mediante resolución N° 7425 del 06 de junio de 2012, anuló el inciso anterior, en relación con lo dispuesto en el artículo 98 inciso b), numeral 1) de esta ley, específicamente en cuanto a “la multa que se impone al conductor de taxi por irrespetar las zonas de parada establecidas por el Consejo de Transporte Público”. En el mismo sentido indica la Sala que: “se tiene por vigente el monto de la multa que se aplicaba antes del establecimiento del monto de multa que aquí se anula…”, misma que dispone que:
“Se impondrá una multa de veinte mil colones…
ch ) Al conductor que se dedique a prestar el servicio de transporte público, en cualquiera de sus modalidades, sin contar con las respectivas autorizaciones, en violación de lo dispuesto en el inciso a), numeral 1 o en el inciso b), numeral 1 …” *Ver en este sentido el inciso ch) del artículo 129 de la versión N° 9 de esta Ley, antes del corre de numeración hecho por la Ley N° 8696 del 17 de diciembre de 2008.)
(*) ( La Sala Constitucional mediante resolución N° 13393 del 05 de octubre de 2011, declaró inconstitucional el inciso anterior “…en cuanto a la multa que se impone por no cumplir con el requerimiento de la revisión técnica vehicular”. En este sentido indica la Sala que: “recobra vigencia la disposición anterior a la reforma operada por Ley N° 8696 del 17 de diciembre de 2008…”, misma que dispone que:
“…Se impondrá una multa de diez mil colones, sin perjuicio de la imposición de sanciones conexas: …
(La reformada practicada por el inciso p) del artículo 1° de la ley N° 8696 de 17 de diciembre de 2008, fue derogada posteriormente por el artículo 251 de la Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial N° 9078 de 4 de octubre de 2012) (Así corrida su numeración por el inciso a) del artículo 2° de la ley N° 8696 de 17 de diciembre de 2008, que lo traspasó del artículo 131 al 132. Dicho artículo 2° fue derogado posteriormente por el artículo 251 de la Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial N° 9078 de 4 de octubre de 2012).”
II.Sobre la admisibilidad. El artículo 75 párrafo tercero de la Ley de Jurisdicción Constitucional faculta a la Defensoría de los Habitantes de la República, para interponer acciones de inconstitucionalidad en forma directa, sea, sin necesidad de asunto previo donde se hubiere invocado la inconstitucionalidad respectiva. No obstante, esta amplia legitimación conferida no la exime de cumplir con los demás requisitos que establece la Ley de Jurisdicción Constitucional. Particularmente en este caso, la Sala observa que la Defensoría cuestiona en forma genérica las multas previstas en los artículos 131, 132 y 133 de Ley de Tránsito 7331, por considerar que el Estado debe tomar en cuenta no solo las condiciones relativas a la levedad o gravedad de la falta, respetando los principios de razonabilidad y proporcionalidad, sino también la capacidad económica del infractor, indicando que una forma de hacerlo sería estableciendo parámetros de multas mínimas y máximas.
Como puede apreciarse en el considerando anterior, los artículos 131, 132 y 133 tienen varias conductas tipificadas en los diversos incisos, y algunos de ellos ya han sido examinados por la Sala. En algunos casos se ha declarado la inconstitucionalidad de las normas, por ejemplo, se anuló la multa prevista para lo dispuesto en los artículos 131 inciso k) (sentencia 2011-6805), 132 inciso ñ) (sentencia 2011-13393), 131 inciso b) (sentencia 2012-129), 131 inciso a) (sentencia 2012-3942), 132 inciso n) (sentencia 2012-3948), etc. En otros supuestos se han declarado sin lugar las acciones por considerar que a pesar de tratarse de una multa elevada, la conducta que se sanciona justifica la sanción, por la gravedad que implica en relación con los bienes jurídicos tutelados (ej. sentencia 2011-16614). Dada la informalidad del planteamiento, la Sala no tiene todos los elementos para incursionar en el examen de constitucionalidad, pues véase que la Defensoría se dirige incluso contra normas que han sido declaradas inconstitucionales.
En consecuencia, se procede a rechazar de plano la acción en cuanto a esas normas por una inadecuada y poco precisa fundamentación de la acción, que incumple con lo previsto en el artículo 78 de la Ley de Jurisdicción Constitucional. En lo demás sí resulta admisible.
III.Sobre el fondo. La Defensoría de los Habitantes considera que los artículos 71 bis, párrafo segundo en relación con los incisos c) y f) del artículo 130; incisos g), i), j) del artículo 131; los incisos f), g) h) y l) del artículo 132, los incisos c), d), e), g) y j) del artículo 133, los incisos a) y ch) del artículo 136; los incisos c), ch) y e) del artículo 134, todos de la Ley de Tránsito por Vías Públicas Terrestres, número 7331 del trece de abril de mil novecientos noventa y tres y sus reformas, son contrarios al principio de razonabilidad técnica, en razón de que se dispone el rebajo de puntos de la licencia del conductor, a pesar de que se trata de conductas atribuibles al propietario del vehículo. Sobre el particular debe señalarse que el transporte terrestre es una actividad social y económica que facilita la realización del derecho de libre movimiento y circulación, así como los derechos vinculados con la libertad económica y la iniciativa privada relacionada con la prestación del servicio público de transporte.
Su ejercicio pone en riesgo derechos fundamentales de las personas, como el derecho a la vida, la integridad y la seguridad, por el peligro que implica la movilización a través de vehículos. También impacta en derechos colectivos como el medio ambiente y el uso del espacio público. Por esa razón resulta necesario que el legislador regule el ejercicio de la actividad, establezca normas y sanciones para los casos de incumplimiento como forma de garantizar el orden y proteger los derechos y bienes involucrados. Las conductas que se sancionan en las normas cuestionadas ponen en peligro la seguridad en el tránsito, porque tienen que ver con conductas imprudentes cometidas por el conductor de un vehículo o por la conducción de vehículos que no reúnen las condiciones que deben tener para poder circular de forma segura, sin menoscabo de bienes jurídicos de gran relevancia, como la vida y la integridad física.
Tanto el propietario del vehículo, sea persona física o jurídica, como el conductor del mismo están obligados a conocer, cumplir y hacer cumplir las normas relativas a la operación de vehículos. La responsabilidad que tiene el propietario del vehículo o la empresa en la que se utiliza el mismo, no exime al conductor de la debida diligencia que debe tener, sobre todo cuando se trata de la conducción de vehículos utilizados en el servicio de transporte público o de vehículos que puedan representar un mayor riesgo en carretera, como los que transportan materiales peligrosos, carga, los remolques, grúas, etc. El conductor no puede excusarse en la posible afectación de su relación laboral, cuando se trata de conductas que son evidentemente peligrosas o riesgosas para la integridad física, la vida y la seguridad en el tránsito. De ahí que en la eventualidad de que esas faltas de tránsito ocasionen un resultado para la vida o integridad física de terceros, tendría que responder incluso penalmente por el resultado causado por la falta al deber de cuidado.
Por ejemplo, el caso de un chofer que a sabiendas de que el autobús que conduce tiene problemas de frenos, sale a prestar el servicio y se produce un accidente que afecta la integridad física o vida de las personas; o el chofer que viaja con un exceso de pasajeros y se determine que esto constituye la causa de un accidente. El legislador diseñó la pérdida de puntos en la licencia de conducir, como una sanción a todo conductor que no se ajusta a las reglas previstas, sin distinción. Esa pérdida de puntos constituye una sanción accesoria a la multa y su finalidad es la de motivar a los conductores en el respeto a las disposiciones de tránsito. No obstante, considera esta Sala que debe diferenciarse entre las conductas que pueden ser atribuidas al conductor y aquellas que no dependen de su esfera de voluntad o acción, como son las relacionadas con obligaciones que debe cumplir el propietario del vehículo o la empresa que lo utiliza en el giro de su negocio.
Es así como se estima que tratándose de las conductas descritas en los artículos 71 bis párrafo segundo en relación con los incisos g) y j) del artículo 131; los incisos f), g) -con excepción de la conducta de descrita en el artículo 125 de la Ley, que sí es atribuible a todo conductor- h) y l) del artículo 132; los incisos c), d) y g) del artículo 133 y los incisos ch) y e) del artículo 134 de la misma Ley; el descuento de puntos de la licencia de conducir, solo debe realizarse en el caso de que el conductor del vehículo sea a su vez el propietario del mismo, dado que como bien señala la Defensoría de los Habitantes, se trata de obligaciones previstas para el propietario, por las que no podría afectarse la licencia de conducir del chofer profesional, pues el mismo está en una condición de subordinación frente a su patrono. Véase que se trata por ejemplo de las conductas de circular sin estar al día con el pago de los derechos de circulación o el seguro obligatorio de vehículos, conducir un vehículo con placas que no correspondan, conducir un vehículo sin dispositivos reflectantes traseros, conducir un vehículo sin salidas de emergencia, conducir un vehículo alterado o modificado, conducir un vehículo que no tenga cinturones de seguridad, dispositivos proyectores de luz blanca o amarilla en la parte delantera, dispositivos proyectores traseros de luz roja y luces de frenos, luces direccionales, luces de emergencia, extintor de incendios, triángulos reflectantes o dispositivo de seguridad análogo, chaleco retrorreflectivo, cartel visible con el número de pasajeros, nombre y número de la ruta, tarifa autorizada; inadecuada ubicación del tubo de escape, no llevar los rótulos exigidos, conducir sin parabrisas o visibilidad obstruida, conducir un vehículo de carga limitada (taxi carga) que viole el peso máximo permito, etc. En los demás supuestos impugnados, se estima que sí existe una responsabilidad del conductor del vehículo en el cumplimiento de las reglas.
Ejemplo de ellos, transportar materiales peligrosos en contra de lo que dispone la ley, conducir una grúa sin cumplir con las exigencias legales y reglamentarias, conducir un vehículo de carga que obstruya la visibilidad, alterar o no utilizar el taxímetro, incumplir con las paradas de autobuses autorizadas, cobrar tarifas más altas, viajar con exceso de pasajeros, utilizar señales luminosas o sirenas rotativas no autorizadas, abrir las puertas durante el recorrido, etc. Debe hacerse la salvedad de lo dispuesto en el artículo 134 inciso c) de la Ley de Tránsito, que se refiere a las condiciones de los automóviles particulares, en cuyo caso, lo determinante sería establecer en cada caso concreto, si se trata de un chofer profesional ligado a una relación laboral que lo exima de responsabilidad, por su estado de subordinación. A lo anterior debe agregarse que en todos los casos, es requisito indispensable que en la boleta de citación que se formule se le indique expresamente al conductor, la cantidad de puntos que se restan de su licencia, para que éste pueda ejercer plenamente su derecho de defensa ante las autoridades correspondientes.
Esto, por tratarse de una sanción que si bien es accesoria a la multa, tiene sus propios efectos en el ámbito social y específicamente laboral, en el caso de las personas que se dedican al oficio de chofer. El principio de razonabilidad técnica impone una apropiada adecuación entre los fines que postula una ley y los medios que planifica para lograrlos. Se procura que las normas tengan una adecuada correspondencia entre las obligaciones que impone y los propósitos que pretende. De ahí que no resulte irrazonable que se imponga la pérdida de puntos como una sanción al conductor por la conducción violatoria de las reglas, en los términos expuestos en este fallo y en el entendido de que debe informársele debidamente y dársele la oportunidad de ejercer su defensa. Ello por cuanto, en los casos en que el conductor sancionado considere que su actuación no es antijurídica por encontrarse justificada o por mediar una eximente de responsabilidad, debe tener la posibilidad de alegarlo ya sea en vía administrativa ante la Unidad de Impugnaciones del Consejo de Seguridad Vial o en sede jurisdiccional, ante la jurisdicción contencioso administrativa.
IV.Conclusión. Por lo anteriormente expuesto, se rechaza de plano la acción en cuanto a los artículos 130, 131 y 132 cuestionados. En relación con los artículos 71 bis párrafo segundo en relación con los incisos g) y j) del artículo 131; incisos f), g) -con excepción de la conducta de descrita en el artículo 125 de la Ley, que sí es atribuible a todo conductor-, h) y l) del artículo 132; incisos c), d) y g) del artículo 133 e incisos ch) y e) del artículo 134, estima la Sala que no resultan inconstitucionales, siempre y cuando el conductor sancionado sea a su vez el propietario registral del vehículo. En relación con las demás normas cuestionadas se declara sin lugar la acción. En todos los casos en que se aplique el descuento de puntos de la licencia de conducir, es requisito indispensable que se informe al conductor en la boleta de citación la cantidad de puntos rebajada, a fin de que éste pueda ejercer plenamente su derecho de defensa ante las autoridades correspondientes.
Por tanto:
Se rechaza de plano la acción en cuanto a la multa prevista en los artículos 130, 131 y 132 de la Ley de Tránsito por Vías Públicas Terrestres, número 7331 del trece de abril de mil novecientos noventa y tres y sus reformas. En cuanto a los artículos 71 bis, párrafo segundo en relación con los incisos g) y j) del artículo 131; los incisos f), g), h) y l) del artículo 132; los incisos c), d) y g) del artículo 133; los incisos ch) y e) del artículo 134 de la misma Ley, se declara sin lugar la acción siempre y cuando el conductor sancionado sea a su vez el propietario registral del vehículo. En lo demás se declara sin lugar la acción. En todos los casos en que se aplique el descuento de puntos de la licencia de conducir, es requisito indispensable que se informe al conductor en la boleta de citación la cantidad de puntos rebajada, a fin de que éste pueda ejercer plenamente su derecho de defensa ante las autoridades correspondientes. Notifíquese.
