Amparo proceeding (recurso de amparo) processed under expediente número 11-007404-0007-CO, filed by J.F.A.C., identity card number 0-0000-0000, against GRUPO RONIDA SOCIEDAD ANÓNIMA AND THE MINISTERIO DEL AMBIENTE, ENERGÍA Y TELECOMUNICACIONES.
Background:
Justice Cruz Castro drafts the opinion; and,
Whereas:
The petitioner comes before this Chamber in defense of his right to a healthy and ecologically balanced environment because, he alleges, thousands of cypress trees are being felled on property owned by RONIDA S.A. in San Isidro de Heredia; he considers this situation harmful because it is a zone of high geological hazard, which could affect the Las Caricias and Lajas streams.
The following facts are considered duly established and material to the determination of this matter, either because they have been proven or because the respondent failed to address them as ordered in the initial ruling:
By virtue of every person’s right to a healthy and ecologically balanced environment, the Chamber has ruled on numerous occasions in defense of that right. In this regard, by resolution Nº 2011003114 at nine hours and three minutes on once de marzo del dos mil once, this Court stated:
³Article fifty of the Constitución Política establishes as fundamental the right of every person to a healthy and ecologically balanced environment. Even before Article 50 was amended to expressly address environmental matters, the Chamber, through its case law, had derived this right from the constitutional provisions of Articles 21—the right to life and health—69—the rational use of land—and 89—the protection of natural beauty. The Chamber has adopted an open or macro-level understanding of the concept of the environment and the protection afforded to it, extending beyond the basic or primary protection of soil, air, water, marine and coastal resources, minerals, forests, the diversity of flora and fauna, and the landscape, to also consider elements relating to the economy, the generation of foreign currency through tourism, agricultural development, and others. Thus, by judgment number 5893-095, at nine hours and forty-eight minutes on 27 de octubre de 1993, the Chamber held that: ³[E]nvironmental Law (Derecho Ambiental) should not be associated solely with nature, since nature is only part of the environment.
Policies for the protection of nature also extend to other matters, such as the protection of hunting, forests, natural parks, and natural resources. It is therefore a macro-environmental concept, so as not to exclude important concepts and thereby to unify the body of law that we call Environmental Law".´
Similarly, regarding the State’s duty to protect the environment, the same judgment emphasizes that:
³(…) Following the amendment of constitutional Article 50, which expressly enshrined environmental rights (derecho ambiental) as a fundamental right, the State’s obligation to guarantee, defend, and protect this right was also established—in categorical terms—thereby making the State the guarantor of the protection and safeguarding of the environment and natural resources. Pursuant to this provision, in conjunction with Articles 20, 69, and 89 of the Constitución Política, the State’s responsibility to exercise a protective and governing role in this field was derived, as provided by the constitutional provision under discussion, a role developed through environmental legislation. Thus, the constitutional mandate establishes the State’s duty to guarantee, defend, and preserve that right. In this regard, it must be considered that the applicable legislation designates the Ministerio del Ambiente y Energía as the governing body for the natural resources, energy, and mining sector, pursuant to Article 2 of the Ley Orgánica of that Ministry, number 7152, dated 4 de junio de 1990.
In the Chamber’s view, this governing role in environmental matters encompasses not only the establishment of appropriate regulations for the use of forest resources and natural resources, as also provided by Article 56 of the Ley Orgánica del Ambiente, but also confers upon it the important role of exercising leadership in environmental matters, which entails maintaining a predominant role in this field. In this regard, the oversight and supervision of environmental matters and activities constitute an essential function of the State pursuant to Article 50 of the Constitution, insofar as its third paragraph provides, as relevant here: “The State shall guarantee, defend, and preserve that right”; this is consistent with the constitutional principle established in the second paragraph of Article 9 of the Constitución Política, which expressly prohibits the Branches of Government from delegating the exercise of functions that properly belong to them, especially when those functions are essential.
Accordingly, with respect to environmental protection, the functions of governance, oversight, and supervision in environmental matters belong to the State and are entrusted to its various administrative agencies.´
In light of the State’s aforementioned obligation, it is appropriate to emphasize the importance of the precautionary principle (principio precautorio) in environmental matters, since it seeks to prevent possible harm to or adverse effects on the environment that could prove irreversible by postponing any activity carried out in the area in question until the corresponding environmental impact studies (estudios de impacto ambiental) have been conducted. In this regard, international instruments advocate precautions in this field, such as the Declaración de Río, adopted at the Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo, which provides:
³Principle 15.- In order to protect the environment, States shall widely apply the precautionary approach in accordance with their capabilities. Where there is a threat of serious and irreversible damage, a lack of absolute scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation´.
Thus, prevention seeks to anticipate adverse effects and ensure the protection, conservation, and proper management of resources—when certainty is lacking as to the potential harm that may occur and the mitigation or remediation measures (medidas de mitigación o reparación) that must be implemented—because, in environmental matters, ex post enforcement is ineffective, since once the harm has occurred, its biologically and socially harmful consequences may be irreparable.
In the present case, the petitioner seeks protection of his fundamental rights, alleging that thousands of cypress trees are being felled on the property owned by RONIDA S.A. in San Isidro de Heredia; he considers this situation to violate his right to a healthy and ecologically balanced environment. From its review of the case file and the reports submitted under oath, the Chamber finds it established that the environmental authorities acted in strict compliance with environmental protection legislation, since the Administración Forestal del Estado, through the Oficina Sub-regional de Heredia of the Área de Conservación Volcánica Central, part of the Sistema Nacional de Áreas de Conservación and the entity with territorial jurisdiction, has safeguarded environmental preservation by requiring RONIDA S.A., the owner of the property in question, to comply with all environmental requirements.
In this regard, that regional office conducted multiple on-site inspections (inspecciones in situ), as evidenced by official letters ADIM-145-EXTERNOS-09 dated 03 de diciembre de 2009, SRC-H-168 dated 23 de febrero de 2010, SRC-H-225 dated 05 de marzo de 2010, OH-348 dated 14 de abril de 2011, and OH-748-2011 dated 29 de junio de 2011—appearing at folios 12, 14 and 15, 17 and 18, and 30 and 31, respectively, of the administrative record—; consequently, the Sistema Nacional de Áreas de Conservación of the Área de Conservación Cordillera Volcánica Central, by resolution Nº ACCVC-D-686-2011 dated 29 de junio de 2011, ordered a precautionary measure and the suspension of forest harvesting operations (medida Cautelar y Paralización de Labores de Aprovechamiento Forestal), an order that reflects adherence to the precautionary principle in environmental matters. As to the possible encroachment upon the protected area (área de protección) of the Las Caricias stream, the record shows that the Tribunal Ambiental Administrativo, by resolution number 635-11-TAA dated 01 de julio de 2011, ordered as a precautionary measure (medida cautelar) the suspension of the entire project, work, or activity being or potentially to be carried out on the property located in the district of Concepción de San Isidro de Heredia, and that order was duly served.
Therefore, since the President of the Tribunal is aware of the situation reported by the petitioner, it is through that proceeding that the petitioner must present his grievances, because this summary proceeding lacks evidence confirming an alleged injury to the environment, an issue that is being examined in depth in the administrative forum. Consequently, the petition must be dismissed, as it hereby is.

#/ SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas cinco minutos del ocho de junio de dos mil doce.
Recurso de amparo que se tramita en expediente número 11-007404-0007-CO, interpuesto por J.F.A.C., cédula de identidad 0-0000-0000 , contra la sociedad GRUPO RONIDA SOCIEDAD ANÓNIMA Y EL MINISTERIO DEL AMBIENTE, ENERGÍA Y TELECOMUNICACIONES.
Resultando:
Redacta el Magistrado Cruz Castro; y,
Considerando:
El recurrente acude a esta Sala, en defensa de su derecho a un ambiente sano y ecológicamente equilibrado, en virtud de que, acusa, se está realizando la tala de miles de árboles de ciprés en la finca que es propiedad de la sociedad RONIDA S.A. en San Isidro de Heredia; situación que considera lesiva por tratarse de una zona de alta peligrosidad geológica, lo cual podría afectar las quebradas Las Caricias y Lajas.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
En virtud del derecho a un ambiente sano y ecológicamente equilibrado que posee toda persona, en múltiples ocasiones la Sala se ha pronunciado en defensa del mismo. En este sentido, mediante resolución Nº 2011003114 de las nueve horas y tres minutos del once de marzo del dos mil once, este Tribunal señaló:
³El artículo cincuenta de la Constitución Política establece como fundamental el derecho de toda persona a un ambiente sano y ecológicamente equilibrado. De previo a la modificación de este artículo 50 para considerar de manera expresa lo relativo al ambiente, ya la Sala, a través de su labor jurisprudencial, había derivado este derecho a partir de las disposiciones constitucionales de los artículos 21 ±derecho a la vida y a la salud-, 69 ±explotación racional de la tierra- y 89 ±protección de las bellezas naturales-. La Sala ha optado por una consideración abierta o macro del concepto ambiente y de la protección que se brinda al mismo, trascendiendo de la protección básica o primaria del suelo, el aire, el agua, los recursos marinos y costeros, minerales, bosques, diversidad de flora y fauna, y paisaje, para considerar también elementos referentes a la economía, a la generación de divisas a través del turismo, la explotación agrícola y otros.
Así, mediante sentencia número 5893-095, de las nueve horas cuarenta y ocho minutos del 27 de octubre de 1993, la Sala estableció que: ³[E]l Derecho Ambiental no debe asociarse sólo con la naturaleza, pues ésta es únicamente parte del ambiente. La política de protección a la naturaleza se vierte también sobre otros aspectos como la protección de la caza, de los bosques, de los parques naturales y de los recursos naturales. Se trata, entonces, de un concepto macro-ambiental, para no dejar conceptos importantes por fuera y así lograr unificar el conjunto jurídico que denominamos Derecho Ambiental".´
Similarmente, en cuanto al deber del Estado de tutelar el ambiente, la misma sentencia hace hincapié que:
³ («) A partir de la reforma del artículo 50 constitucional, en la cual se consagró como un derecho fundamental, se estableció también -en forma terminante- la obligación del Estado de garantizar, defender y tutelar este derecho, con lo cual, el Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. Es a tenor de esta disposición, en relación con los artículos 20, 69 y 89 de la Constitución Política, que se derivó la responsabilidad del Estado de ejercer una función tutelar y rectora en esta materia, según lo dispone la propia norma constitucional en comentario, función que desarrolla la legislación ambiental. Es así como el mandato constitucional establece el deber para el Estado de garantizar, defender y preservar ese derecho. En este orden de ideas, debe considerarse que la normativa establece al Ministerio del Ambiente y Energía como el órgano rector del sector de los recursos naturales, energía y minas, según lo dispuesto en el artículo 2 de la Ley Orgánica de este ministerio, número 7152, de 4 de junio de 1990.
Esta función de rectoría en la materia ambiental, a criterio de la Sala, comprende no solo el establecimiento de regulaciones adecuadas para el aprovechamiento del recurso forestal y los recursos naturales, según lo dispone también el artículo 56 de la Ley Orgánica del Ambiente, sino que le confiere la importante función de ejercer la rectoría en la materia ambiental, consistente en mantener un papel preponderante en esta materia. En este sentido, el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado según lo dispuesto en el artículo 50 de la Constitución, en tanto dispone en lo que interesa en el párrafo tercero: "El Estado garantizará, defenderá y preservará ese derecho"; lo cual resulta concordante con el principio constitucional establecido en el párrafo segundo del artículo 9 de la Constitución Política, que expresamente prohíbe a los Poderes del Estado la delegación del ejercicio de funciones que le son propias, máxime cuando se constituyen en esenciales.
De esta manera, tratándose de la protección ambiental, las funciones de rectoría, control y fiscalización de la materia ambiental, corresponden al Estado, a cargo de las diversas dependencias administrativas.´
A partir de la obligación del Estado supra mencionado, cabe destacar el valor que el principio precautorio en materia ambiental posee, por cuanto este pretende prevenir posibles daños o afectaciones del ambiente que podrían resultar irreversibles, al posponer toda actividad que se realice en el área cuestionada, para la realización de los estudios de impacto ambiental correspondientes. Al respecto, existen instrumentos a nivel internacional que abogan por las precauciones en este ámbito, como la Declaración de Río, adoptada en la Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo, que dispone:
³Principio 15.- Con el fin de proteger el medio ambiente, los Estados deberán aplicar ampliamente el criterio de precaución conforme a sus capacidades. Cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente´.
Es así como, la prevención pretende anticiparse a los efectos negativos y asegurar la protección, conservación y adecuada gestión de los recursos -en la medida que se carezca de certeza en cuanto a un posible daño a producir y las medidas de mitigación o reparación que deben implementarse-, debido a que en materia ambiental, la coacción a posteriori resulta ineficaz, por cuanto de haberse producido el daño, las consecuencias biológicas y socialmente nocivas pueden ser irreparables.
En el presente caso, el recurrente acude en defensa de sus derechos fundamentales alegando que se está realizando la tala de miles de árboles de ciprés en la finca propiedad de la sociedad RONIDA S.A. en San Isidro de Heredia; situación que considera lesiva de su derecho a un ambiente sano y ecológicamente equilibrado. Del estudio de los autos y de los informes rendidos bajo fe de juramento, la Sala tiene por acreditado que las autoridades ambientales actuaron en estricto apego del cumplimiento de la legislación tutelar ambiental, en virtud de que la Administración Forestal del Estado, a través de la Oficina Sub-regional de Heredia del Área de Conservación Volcánica Central, del Sistema Nacional de Áreas de Conservación, ente competente por territorio, ha velado por la preservación ambiental, exigiendo a la empresa RONIDA S.A., propietaria de la propiedad en cuestión, el respeto de todos los requisitos ambientales.
En ese sentido, dicha oficina regional realizó múltiples inspecciones in situ, lo cual se constata mediante los oficios ADIM-145-EXTERNOS-09 del 03 de diciembre de 2009, SRC-H-168 del 23 de febrero de 2010, SRC-H-225 del 05 de marzo de 2010, OH-348 del 14 de abril de 2011 y OH-748-2011 del 29 de junio de 2011±visible en folios 12, 14 y 15, 17 y 18, 30 y 31, respectivamente, del expediente administrativo-, consecuentemente, el Sistema Nacional de Áreas de Conservación del Área de Conservación Cordillera Volcánica Central, mediante resolución Nº ACCVC-D-686-2011 del 29 de junio de 2011, ordenó medida Cautelar y Paralización de Labores de Aprovechamiento Forestal, orden que esboza apego al principio precautorio en materia ambiental. En cuanto a la posible invasión del área de protección de la quebraba Las Caricias, se desprende que el Tribunal Ambiental Administrativo mediante resolución número 635-11-TAA de fecha 01 de julio de 2011, ordenó como medida cautelar la paralización de todo el proyecto, obra o actividad que se realice o se pueda efectuar en la propiedad ubicada en el distrito Concepción de San Isidro de Heredia, la cual fue debidamente notificada, por lo tanto al tener conocimiento el Presidente del Tribunal de la situación denunciada por el recurrente, es ante esa vía en la que debe presentar sus agravios, pues, en este proceso sumario se carece de elementos probatorios que confirmen una supuesta lesión al medio ambiente, discusión que se está ventilando, con profundidad, en sede administrativa. En consecuencia, se impone declarar sin lugar el recurso como en efecto se hace.
